The outlook for Donald Trump appears grimmer by the day, but the systemic institutional problems that brought him to office and have now helped bring him to the brink of impeachment are of even larger concern on today's BradCast. [Audio link to today's program is posted below.]

First up, the latest in the House's ongoing impeachment inquiry, as the worm may --- emphasis on 'may' --- be turning, following Trump's Acting Chief of Staff Mick Mulvaney's nationally-televised admission that the Administration withheld hundreds of millions of dollars in Congressionally-allocated military aide to Ukraine in an effort to strong-arm the former Soviet nation into investigating Democrats and the 2016 election. Mulvaney's "confession", as House Speaker Nancy Pelosi described it, of a pretty clear quid pro quo has knocked several Republicans off their footing, as they struggle to find ways to defend the President's actions.

A number of Congressional Republicans in both the House and the Senate now appear troubled by the admission (which Mulvaney attempted to walk back just hours later) and it has led Ohio's former Republican Governor John Kasich to concede on Friday that he now supports the impeachment and removal of Trump based on the latest information.

Then, we're joined by BRENDAN FISCHER, Associate Counsel at the Campaign Legal Center (CLC) in Washington D.C., which filed a formal complaint with the Federal Elections Commission (FEC) in July of 2018, detailing serious campaign fiance law violations by Rudy Giuliani associates Lev Parnas and Igor Fruman. The Soviet-born Ukrainian-Americans were dramatically arrested and indicted at Dulles International Airport just over a week ago by federal prosecutors from the Southern District of New York, as they were attempting to flee the country with one way tickets to Vienna. Parnas and Fruman were charged [PDF] with using a fake shell corporation to illegally funnel hundreds of thousands of dollars from an unknown source to Republicans, including Trump's America First Action SuperPAC, in a successful effort to gain political power.

They also paid some $500 thousand to Giuliani --- who is working, for free, as Trump's personal lawyer --- and donated to Texas Congressman Pete Sessions, all in an effort to act on the conspiracy theories used by Trump and Giuliani to strong-arm Ukraine. As Fischer lays out in a piece at CLC detailing the backstory of the arrests of the two Trump donors, "Working closely with the president’s personal attorney, Giuliani, their efforts touched two branches of U.S. government, two presidential administrations in Ukraine, at least five countries, numerous individuals in and out of government, and, now, an impeachment inquiry into the U.S. President himself."

"The big giving opened a lot of doors," Fischer tells me. "It got them into political fundraisers where they rubbed shoulders with President Trump's inner circle. That money allowed them to build and deepen a relationship with Giuliani. And they were able to leverage that relationship in order to advance this narrative about Ukraine --- the same narrative about Ukraine that President Trump espoused in his call with Ukrainian President Zelensky, which has now led to this impeachment inquiry."

In other words, despite the ongoing mysteries behind the true source of their funding, they got a lot of bang for their campaign finance bucks used to buy influence with GOP officials and effect actual U.S. foreign policy in the bargain. But, as Fischer explains on today's program, had they not used a phony corporation to do it with someone else's money (and lied about that to the FEC), everything they did appears to be largely perfectly legal under U.S. campaign finance laws! Yes, apparently if you have enough money, you are allowed to use it to buy a major political influence operation that can directly effect U.S. foreign and domestic policy, even out of the White House.

Fischer explains how the dark money operation --- which didn't even include all that much money --- is still being unraveled by federal investigators as the probe (which could even nab Giuliani) continues and, perhaps even more importantly, how it may represent just be the tip of a campaign finance iceberg that illustrates the dangers of our disgraceful campaign finance laws in the wake of the Supreme Court's Citizens United ruling in 2010.

"The indictment makes clear that the purpose of the political contributions that Parnas and Fruman made was to buy access and to build influence with powerful political officials in order to advance their own personal financial interests," says Fischer. "But that is not what they are being indicted for. They were indicted because they laundered the funds through shell corporations and then lied about it." So, had they actually been rich dudes who used their own money for this scheme, it would have been just fine? "Yes, it would have been just a beautiful expression of their First Amendment right to free speech."

“This indictment of Parnas and Fruman is really an indictment of our big money political system. It lays out very clearly how powerful political figures operate on this cash-for-access practice. It's become entirely commonplace for wealthy political actors to buy their way into Congressional offices and into the President's inner circle. If you don't have money, your voice does not get heard in our democracy.”

Finally, longtime good government watchdog Fischer also rings in on Mulvaney's stunning announcement that the Administration has officially selected Trump National Doral resort in Miami, Florida as the location for next year's G-7 Summit of world leaders, despite the Emoluments Clause of the U.S. Constitution which strictly bans payments to the President from foreign officials --- a point that even Fox "News" (well, at least some there) appear to have a problem with as well...

I'm back after a few days off for today's BradCast! My huge thanks to Radio Or Not's Nicole Sandler for guest-hosting over the past several days and affording Desi and me a bit of much-needed down time.

Of course, as soon as we stood down, everything blew up in Congress and everywhere else. So, I touch on a few of those points --- particularly the Republican Party coming apart at the seams, as we now see in their inability to find a House Speaker or even a Presidential candidate for that matter --- on today's program.

Then, it's on to the continuing fight for the right to vote across the country. We've got some troubling news out of Kansas, where their Sec. of State Kris Kobach (R) is attempting to justify his voter suppression with new prosecutions. And then we've got some very good news out of California, where voter registration will now be automatic and could lead to as many as 6.6 million new voters in the Golden State.

At the same time, Fox "News" is now offering a huge lie about the state's new law, as advanced on air today by Judge Andrew Napolitano.

After offering his (rather remarkable) opinion that the U.S. Supreme Court "wrongly" found voting to be "a fundamental right," Napolitano asserted the lie that "once it said that, states like California decided to allow people to vote who aren't qualified by law to vote because of the fundamental aspect." The former Judge then added to his lie by claiming that "an illegal alien in California...can vote in local, state, and federal elections in California and those votes count," simply by obtaining a drivers license under the new Motor Voter Law signed over the weekend by Gov. Jerry Brown (D).

In response to Napolitano, we obtained a statement via email from Dean Logan, the Los Angeles County Register-Recorder/County Clerk, describing the outrageous assertion as categorically "false". "The new Motor Voter law only applies to those identified by DMV records as meeting the eligibility requirements to be registered to vote --- including citizenship," Logan says in his statement this afternoon, as read on air. "The law specifically mandates that distinction and the adoption of regulations to ensure against registration of non-eligible persons. The contention that the law automatically places non-citizens on the voter rolls is false."

Since airtime, the office of CA Sec. of State Alex Padilla (D) has also responded to our query and confirms that the new law "expressly prohibits" voter registration for non-citizens. Of course, Fox couldn't be bothered to find out and accurately inform their viewers.

Next, we are joined by Michael Collins of the Drug Policy Alliance to discuss the federal Bureau of Prisons' long overdue reform to sentencing guidelines that will result in some 6,000 inmates being freed within days, and perhaps a total of 46,000 thereafter. Collins explains how the changes came about and notes: "The Sentencing Commission definitely deserves to be applauded for what it's doing. But, at the same time, it's a drop in the bucket compared to the overall prison population."

"Drug offenses and the hysteria around drugs in the 80s and 90s, where laws were introduced, mandatory minimum sentencing was introduced, and we saw the prison population grow through the roof," requires reform that only Congress can provide. But, as dysfunctional as Collins acknowledges Congress to be, he says, on this issue, there is actually very real, bipartisan momentum in favor of reform in both chambers.

"There is a strong, bi-partisan movement for criminal justice reform and for sentencing reform," he tells me. "Republicans, Democrats, liberals, Tea Partiers, hard-core conservatives, old-school law and orders --- you name it --- there's this broad bi-partisan momentum to do something on criminal justice reform."

Finally, Desi Doyen joins us for our latest Green News Report, with an opportunity to call out Sen. Lindsey Graham (R-SC) for his remarkable display of hypocrisy in the wake of historic flooding in his home state.

Kochs respond, the story is advanced, my appearances on CNN and MSNBC, and even a response from the White House...of a sort...

A few quick follow-up items, for now, in advance of tomorrow morning's Part 2, from Part 1 of my exclusive secret Koch tapes scoop at Mother Jones this morning which went very viral, very quickly today, as I figured it probably would.

• As I noted in UPDATE to my short stub story this morning linking over to the MoJo article, the Kochs finally decided to respond today, first to Jake Tapper at ABC News, after days of their refusing to give me a response --- even though I pressed them, multiple times in advance, for an explanation of Charles Koch's seeming comparison of "Saddam Hussein" to Barack Obama and the 2012 election as the "Mother of All Wars." See their response, and my response to it, in that UPDATE.

Those of you who follow The BRAD BLOG closely may know that I've been working in the background, for a number of weeks, on an exclusive series concerning the billionaire Koch Brothers, the co-owners of the nation's second largest private corporation, the oil and chemical conglomerate Koch Industries. They are also massive funders behind much of the Rightwing political disinformation machine. The articles, as I can now reveal, cover audio I've obtained as recorded from inside their super-secret, super-confidential, invitation-only Summer Seminar held in late June at the tony Ritz-Carlton Beaver Creek Resort near Vail, CO (seen above).

Among this year's attendees, in addition to hundreds of corporate baron billionaires and millionaires, were GOP public officials such as current Republican Presidential front-runner Gov. Rick Perry (R-TX), Gov. Bob McDonnell (R-VA) and Gov. Rick Scott (R-FL).

It appears the brothers went to extraordinary measures, particularly on the first night of the event, to assure that none of the uninvited would ever know what went on inside or even who the first night's keynote speaker actually was.

Nonetheless, a few of their closely guarded secrets are about to spill out.

The first of my two articles in the series is finally published at Mother Jones today.

Part 1 focuses on the opening and closing remarks, as heard on tape, by billionaire brother Charles as he raises still more undisclosed political money and rallies his troops in advance of the 2012 Presidential election --- or "the mother of all wars" as he's heard describing it. On the first night, Charles welcomes his "great partners" to the event, alludes to President Obama as "Saddam Hussein" and proceeds to list --- by name --- those "partners" who have donated more than a million dollars to the Koch Foundation political causes over the past year. So much for the post-Citizens United "anonymity" that Koch exec Kevin Gentry, the emcee for both evening's dinners, informs patrons they can "help protect."

Today's article also details remarks, several rather noteworthy I think, made by the Kochs' closing night speaker, Judge Andrew Napolitano of Fox "News." The Fox host tells the crowd of corporate titans, among other things: how he got his job at Fox (it had to do with the FL 2000 Presidential election debacle, he claims); how he "sometimes" gets in "a little bit of trouble at Fox" when he's too tough on Republicans, and; what he believes the Second Amendment to the Constitution is really for. You'll have to read the article and/or the Napolitano transcript excerpts for the full details.

Finally, today's report at Mother Jones describes some of the extraordinary security measures taken by the Kochs to try and ensure that nobody outside the dinner pavilion at the Beaver Creek Resort in Bachelor Gulch would ever know the identity of the GOP public official who delivered the keynote address on opening night. To this day, neither the official's own constituents nor his own local media seem to have any idea that he'd ever even left the state to pal around with the Kochs, much less offer their opening night's headline address.

In tomorrow's report, we'll reveal the identity of that headliner and detail his stem-winder of a keynote! But for now...

After trying for days to get comment from the Koch's on Charles' "We have Saddam Hussein, this is the Mother of All Wars we've got in the next 18 months" remark, they've finally decided to respond now that the story is out and not, um, reflecting very well on them, it seems...

Good for Congressman Nadler! Calling on the people's airwaves to be used, as required by law, in the "public interest"...

Rep. Jerrold Nadler (D-N.Y.) said on Friday that the Federal Communications Commission should reinstate the fairness doctrine for broadcast television to ensure that multiple sides of controversial topics are offered to the public.

“For over the airwaves TVs, I think they should bring it back,” said Nadler on Fox Business News with Andrew Napolitano.

“I think it makes sense for people to be able to hear as many sides of political opinions as possible, and as long as it's the people's airwaves that should be used for that purpose.”

Nadler’s comments come in the wake of the recent shooting of Rep. Gabrielle Giffords (D-Ariz.), which has re-launched the debate over what role heated political rhetoric plays in the spurring people to take violent actions.

Nadler's comments follow on the heals of remarks by Rep. James Clyburn (D-SC) following the shootings in Tucscon. "Free speech is as free speech does," he is quoted by the The Post and Courier as saying. "You cannot yell ‘fire' in a crowded theater and call it free speech and some of what I hear, and is being called free speech, is worse than that."

Despite originally calling for a "clarif[ication of] the public interest obligations of broadcasters who occupy the nation's spectrum" on the White House website the day he was inaugurated, the Obama Administration has since retreated after false charges by the Right that Democrats intended to "censor" Rightwing talk radio. The passage was quickly removed from the White House website and, more recently, the Administrationhas said they have no interest in revisiting the Fairness Doctrine. (Though, we should note, that doctrine is not the only way to help restore fairness and balance to our public airwaves.)

The Fairness Doctrine, which had been enforced by the Federal Communications Commission (FCC) since 1949, required those who used the limited and publicly licensed broadcast airwaves to at least attempt to offer opposing views on controversial issues, was ordered abolished by President Reagan in 1987.

The doctrine's abandonment immediately paved the way for round-the-clock, one-sided propaganda from nationally syndicated talk radio hosts such as Rush Limbaugh and scores of others.

Diversity of viewpoints shared in the public interest over our public airwaves was further brought to an end by the federal Telecommunications Act of 1996, signed by President Clinton. The act, sold as a "boon to competition in the market" lifted the cap on the number of radio and TV station licenses that could be procured by a single corporation. For example, prior to the Telecom Act, the Clear Channel corporation owned just 59 radio and TV stations nationwide. After passage of the act, they were allowed to purchase and control more than 1,200.

In the bargain, real competition --- and virtually all pretense of fairness and balance --- on our public broadcast airwaves largely died, rather than flourish as supporters of the Telecom act had claimed (and as detractors, such as Ralph Nader, had predicted), as corporations were allowed to hold virtual monopoly control over political viewpoints on the nation's airwaves in nearly all major cities across the country.

The BRAD BLOG has covered this topic for years, long calling for fairness and balance to be restored to our public airwaves. Following the recent shootings in Tucson, we have revisited the topic again, most recently in an article highlighting Pima County Sheriff Clarence Dupnik's spotlight on "vitriolic rhetoric" on radio and TV as an element helping to incite violence and bigotry in his city which features six Rightwing radio stations, but none offering a progressive voice. And in another article, posted the day after the shooting, we offered statistics on how bad the problem is across the entire nation.

Says 'evidence overwhelming' they 'participated in criminal conspiracies to violate federal law and guaranteed civil liberties of hundreds, maybe thousands of human beings'...

Wow. Seriously. Just...really...Wow.

Fox "News" analyst and former NJ Superior Court Judge Andrew Napolitano was featured on a segment of C-Span's BookTV over the weekend, to discuss his book, Lies the Government Told You: Myth, Power, and Deception in American History.

While being interviewed by Ralph Nader, Napolitano says what Bush and Cheney did while in office was "blatantly unconstitutional, and in some cases criminal."

When asked by Nader what the consequences should be, the judge says, in no uncertain terms: "They should have been indicted! They absolutely should have been indicted! For torturing, for spying, for arresting without warrant."

Wow. Guess his contract on Fox must be up. If it wasn't, we suspect it is now. Good for him. Now, at some point, he needs to hold his own "news" channel accountable for all the damage they've done as well...

Fox News analyst Judge Andrew Napolitano says that the new Bin Laden tape is no excuse to subvert the constitution and conduct illegal wiretaps on Americans as the Bush Administration has been doing since before 9/11.

Of course, John "freedom hater" Gibson called the new Bin Laden tape the "trump card" in the argument for allowing unconstitutional spying and the Patriot Act.
