Committee Issues Short Statement, Slap on Wrist for One of Congress's 'Most Corrupt' Members on Last Day Before Democrats Take Over
But Troubles May Just Be Beginning for Florida Congressman...
By Brad Friedman on 1/3/2007 2:03pm PT

Republican U.S. Congressman Tom Feeney of Florida's 24th District has been ordered today by the House Ethics Committee to pay $5,643 for the cost of a "recreational" golf trip to St. Andrews, Scotland, which he had taken with the now-disgraced lobbyist Jack Abramoff in 2003. The bill had been previously paid for by Abramoff, the committee has found.

The slap on the wrist issued today by the U.S. House Ethics Committee on the last day before the change-over to the new Congress was announced in a terse, one paragraph, bare-bones statement posted to the committee's website. AP reported the matter here. Outgoing defeated Congressman Curt Weldon (R-PA) was also found in violation of House rules and has agree to pay back more than $23,000 in inappropriate gifts.

The findings from the Ethics Committee, however, may be just the tip of the iceberg for Feeney as there continues to be a number of other allegations and claims of misconduct, both new and old, which still hang precariously over the Congressman's head.

The claimed cost of Feeney's Scotland trip, $5,643, was apparently supplied to the committee by the Congressman himself in March of 2005 after the many tentacles of the Abramoff corruption scandal were beginning to reveal themselves. Only after the trip had been reported by the media did Feeney take the matter to the Ethics Commission.

Feeney, who has been named for the second year running as one of the "Most Corrupt Members of Congress" by the non-partisan ethics watchdog group the Committee for Responsibility and Ethics in Washington (CREW), had previously claimed that the trip, and several others, were pre-approved by the House Ethics Committee. As well, he had also originally claimed on his disclosure forms for the Scotland trip that it had been paid for by the National Center for Public Policy. The center has denied paying for the trip and Feeney has supplied no evidence that we're aware of that the Ethics Committee had pre-approved his vacation with Abramoff or any of the others.

In a statement released this afternoon, the National Center for Public Policy Research reiterated their denial of having had anything to do with Feeney's travels, despite continue statements from Feeney's office suggesting that they did. "The National Center for Public Policy Research played no role in this trip," the statement reads, "and only learned of its existence from media inquiries two years after it was taken."

No action has yet been taken on the other questionable vacations, one to Korea which was sponsored by he Korea-U.S. Exchange Council (KORUSEC), a registered foreign agent, and another to West Palm Beach, Florida, which Feeney had listed as having been paid for by a lobbying firm, which would also be a violation of House rules.

According to the Orlando Sentinel today, Feeney’s Chief of Staff Jason Roe --- who has had his own conduct questioned --- said of Feeney: "He’s personally and professionally embarrassed and considering it an expensive lesson."

The "lesson" however, was not all that "expensive" by Congressional standards, and certainly not if the $1.3 million that Feeney raised, mostly from corporate PACs, to spend on his recent campaign might be any indication of the funds that the once-exceedingly powerful Florida Republican has quick and easy access to.

"It's like he robbed a bank and was just asked to give back the money," said Naomi Seligman Steiner of CREW in deriding the light treatment given to Feeney by the commission.

The other two congressmen who had gone on junkets to St. Andrews with Abramoff, Tom Delay (R-TX) and Bob Ney (R-OH), have since resigned in the wake of criminal charges and guilty pleas. The cost for former Republican Majority Leader Delay's trip to Scotland with Abramoff was estimated to have been between $70,000 and $100,000. Feeney is the only Congress member of the three still serving in the U.S. House.

He was recently declared the winner by the state of Florida in the U.S. House race for 24th congressional district where Feeney ran one of the dirtiest --- and most expensive --- U.S. House campaigns in the nation against Clint Curtis, a computer programmer turned whistleblower. In early December of 2004, The BRAD BLOG broke the news of Curtis's affidavit alleging that Feeney was involved in a conspiracy to create electronic vote-rigging software when both men worked for the same Oviedo, Florida, software firm, Yang Enterprises, Inc. (YEI), in 2000. At the time, Feeney was employed as YEI's general counsel and registered lobbyist, even while he served as the powerful speaker of Florida's House of Representatives.

Curtis also charged at the time that Feeney had helped cover up a number of other legal violations by the company, including the employment of illegal aliens at YEI who he claimed had had been spying for Communist China. Curtis also alleged YEI was over-billing on state contracts and had been inserting illegal wiretapping modules into software the firm had been contracted to write for NASA and the Florida Dept. of Transportation (FDOT). In the ensuing years, one of YEI's employees, Hai Lin "Henry" Nee, the man Curtis accused of writing the wiretapping modules, pled guilty after being arrested by Federal Authorities in a four year sting in which he admitted sending computer chips used in Hellfire anti-tank missile guidance systems to Communist China. As well, a report issued by the State of Florida's Inspector General's office found that YEI had, in fact, over-billed the state of Florida on contracts and that Nee had indeed been an illegal alien.

Feeney, a good friend of Dr. and Mrs. Yang, the owners of YEI --- who have given thousands of dollars in campaign support to the disgraced congressman over the years --- still keeps his main campaign headquarters in the YEI office building in Oviedo, Florida, to this day. Feeney had previously been caught lying about his association with the Yangs.

Feeney's troubles, however, are likely far from over. As a member of the Republican Leadership in the 109th Congress --- he was a deputy whip --- Feeney has yet to detail what he knew about his Florida colleague Rep. Mark Foley's sexual transgressions with minors. After reports had surfaced that the Leadership had been made aware of the concerns about Foley many years ago, Curtis issued a press release during the campaign calling on Feeney to come clean on what he knew about Foley, when he knew it, and what he did about it. Feeney has stayed mum to this day, refusing to give details about his knowledge in the matter.

Feeney, who has claimed Curtis is both "crazy" and "a liar" has refused to take a polygraph test despite having been challenged publicly by Curtis, and others, to do so. For his part, Curtis successfully passed a lie detector test concerning his charges against Feeney and YEI back in early 2005.

Additionally, Curtis has since filed a challenge in Congress to the election of Feeney, claiming a number of irregularities found in the Diebold electronic voting systems used across several counties in Florida's 24th district. Yesterday, the National Election Data Archive issued an analysis [PDF] of precinct data for the election detailing a number of inexplicable discrepancies in the results as reported by the state of Florida. The non-partisan Election Integrity organization has announced that the discrepancies in the numbers are "consistent with a pattern that would be caused by voter disenfranchisement, vote fraud, or innocent miscount."

When the Congressional challenge was filed in the race between Christine Jennings (D) and Vern Buchanan (R) in the FL-13 race --- where the votes of some 18,000 Florida voters failed to register on ES&S touch-screen voting machines in Sarasota, with a reported margin of just 369 votes between the two candidates --- Feeney declared the Constitutional challenge to be "total political dictatorship." His statement was made to the media, however, before it was publicly known that Feeney's election would as well be challenged in the same Congress under the same Federal Contested Elections Act.

Curtis's challenge, and several others originating in the state of Florida, will reportedly be championed in the House by Congressman Rush Holt (D-NJ), who has long been an advocate for election reform in the U.S. House. We hope to have more details here at The BRAD BLOG on the Curtis challenge, and other related matters, shortly. Stay tuned...

Face the Nation Host Schieffer Critical of Fox over OJ Story
By Alan Breslauer on 11/19/2006 12:02pm PT

Guest Blogged by Alan Breslauer

Bob Schieffer's commentary this morning on CBS' Face the Nation is highly critical of Fox, Judith Regan and Rupert Murdoch for publishing OJ's new "if I did it" book and for giving the former football star two hours of prime time television to promote the fictional confession. Throw in the millions of dollars being funneled to OJ and one hardly remembers the similarly disgusting congressional page scandal.

Schieffer: "Someone, I think it was William F. Buckley, once said, something doesn't have to be against the law to be wrong. This one is more than wrong. It is just awful."

'At What Point Do We Stop Saying This is Accidental,' Asks Radio Host Bob Kincaid
By Brad Friedman on 10/11/2006 8:29pm PT

A rightwing extremist "news" outlet, Newsmax.com, was apparently also unable to help labelling disgraced Republican sexual predator Rep. Mark Foley as a Democrat in a report released on their website this morning.

Our buddy Bob Kincaid of Head-On Radio alerted us to this report today from NewsMax's "chief Washington correspondent," Ronald Kessler...

Page Scandal Goes Deeper

Ronald Kessler
Wednesday, Oct. 11, 2006

The scandal involving inappropriate e-mail messages by former Rep. Mark Foley, D-Fla., to congressional pages understandably has led to calls for abolishing the page program.

Kincaid asks us via email: "At what point do we stop saying that this is accidental?"

The original appearance of such an "accident" occurred, as we reported it last week, when Fox "News" labelled the Republican Foley as a Democrat in a chyron over a video cutaway. Three of them, in fact. Across two different O'Reilly Factor segments. After our report brought attention to the issue, Fox blanked out that part of the screen during their two subsequent of the program later that night.

The next day, Associated Press did the same thing, but at least had the decency to both correct the problem by changing the "D" to "R" and noting the original "error" at the bottom of the report in a journalistically appropriate way when they did so.

Like phony news organization Fox, who told Editor & Publisher a few days later that they felt no "correction per se" was necessary, phony news organization Newsmax apparently doesn't believe they need to tell anybody of the "error." They changed the "D" in their story to "R" later in the day --- after who knows how many had read the article --- but didn't bother to note the change in the updated article.

So much for Republican journalistic ethics. So much for Republicans taking personal responsibility. For anything.

We'd add: 'And What --- if Anything --- Did he DO About It?!'
By Brad Friedman on 10/9/2006 5:17pm PT

The Clint Curtis campaign for the U.S. House (FL-24) issued a press release late last week asking "What Did Feeney Know About Colleague Mark Foley's Predatory Behavior And When Did He Know It?". (Press release posted in full at the end of this article.)

It was not without reason that we asked the same question of Rep. Tom Feeney (R-Abramoff) last week at the end of a blog item on the latest misstep in the corrupt Congressman's crazy smear campaign he's running against Curtis. A smear campaign that, we might add, seems to be helping Curtis enormously!

For evidence of that, see this local Florida news report (includes video) blasting Feeney for sending porn mailings to local moms, and this darn-near accurate feature article in Saturday's Orlando Sentinel calling on Feeney to take a lie-detector test!

The question of what Feeney knew about Foley, when he knew about it and what he did about it is an appropriate one. Feeney, as Deputy Whip, is a member of the House GOP leadership who had reportedly been informed long ago of the "Foley Problem." Feeney is also a Florida caucus colleague of the now-disgraced child predator and proudly worked with Foley on bills such as the PROTECT Act of 2003 to punish those who would exploit children.

For background, as briefly as we can give it (regular BRAD BLOG readers may skip this graf) Curtis is running to unseat Feeney this year. Curtis alleged in December of 2004 that Feeney had asked him to create a vote-rigging software prototype to be used for flipping the votes in South Florida when both men worked at Yang Enterprises, Inc. (YEI), an Oviedo, FL, software firm. Curtis was a programmer, and Feeney was their general counsel and registered lobbyist (in addition to his day job as Speaker of the Florida House). As early as 2001, Curtis also alleged that YEI --- where Feeney maintains his campaign headquarters even today --- was harboring communist Chinese spies and overbilling state agencies by hundreds of thousands of dollars. Both of those claims have since been borne out (see this summary of the extraordinary Clint Curtis story); Curtis has also told his story in sworn video-taped testimony before a congressional panel and passed a polygraph test, which Feeney, for his part, still refuses to take.

Despite Feeney's silly and shameless use of doctored photos and doctored facts on his campaign's smear website and smear blog --- which has only just now been updated to disclose that its "Paid for by Tom Feeney" after an FEC complaint was filed --- and despite Feeney's various misfired attempts to tar Curtis with ridiculous and self-disproving claims, we'll avoid such cheap and childish shots at the Congressman. At least for the time being.

We will, however, suggest that Mr. Feeney --- who has been mighty quiet about the Foley scandal since it broke --- may want to go on record, sooner rather than later, about exactly what he knew and what he did, or didn't do, about the Foley issue over the past several years.

While we're at it, was Feeney one of those dozens of folks in Congress who recently received subpeonas on this matter? I'm sure he'll have no trouble telling us whether that answer is either yes or no.

As we all know, it's not the crime, but the cover-up that gets 'em every time. We're waiting Mr. Feeney. You may wish to make your move before someone else does it for you. Just trying to be helpful here.

First Foley was a Dem, Now Chaffee Is!
By Brad Friedman on 10/9/2006 3:18pm PT

You know what Fox "News" did last week. And of course, that they didn't think such an egregious "error" merited either an apology or on-air correction.

Here's what they're doing this week, as according to Sinfonian at dKos...

This weekend I was idly flipping channels and happened to land on Faux News' "Beltway Boys." They were discussing incumbent senators who face uphill battles in their reelection bids.

And guess what? After all of last week's craziness regarding their incessant labeling of Mark Foley as a Democrat, here's what they put up while discussing the Rhode Island Senate race between Sen. Lincoln Chafee (R) and Sheldon Whitehouse (D):

Yep, through Fox's looking-glass, the Republican candidate now is the leader, Whitehouse!

I have no idea what, if anything, can be done about this now epidemic misuse of the Chyron graphics machine, but it's really getting ridiculous. I mean, Jesus H. Christ in a chicken basket, how many times are they going to pull this crap? And what can be done about it?

(Hat-tip to Des.)

By Brad Friedman on 10/7/2006 5:22pm PT

We know how atrociously and shamefully Fox "News" has covered the Foley scandal. This superb and detailed article from Jamison Foser at Media Matters demonstrates how CNN's coverage has been just as bad and, arguably, far worse.

The piece underscores the case we've been making here for years. Corporate media no longer report news, They do nothing more than repeat it. And only when they are given direct orders to do so by the politicians they pretend to be covering. (And, by and large, only when those politicians are Republicans.)

"The most trusted name in news?!" What an utter debacle.

Statement to E&P Claims 'Honest Mistake' But Not Worth Noting to Viewers Apparently, Since 'Everyone Knows' Foley is a Republican...
By Brad Friedman on 10/6/2006 3:05pm PT

Editor & Publisher published a comment today from the Executive Producer of Fox "News'" O'Reilly Factor on their having run a title under video of Rep. Mark Foley --- three different times, in two different segments --- which labeled the now-disgraced, now-former Republican Congressman as a Democrat:

"Once it came to our attention, we removed the incorrect chyron immediately," said David Tabacoff, executive producer of the Fox News Channel show hosted by Bill O'Reilly, who also does a newspaper column distributed by Creators Syndicate. "We didn't run a correction per se."
...
Tabacoff told E&P late Thursday that "everyone knows" Foley --- who resigned his House seat after revelations that he sent sexually charged messages to teen Congressional pages --- is a Republican. So "The O'Reilly Factor," he said, didn't feel it was necessary to run a specific on-air correction on its Wednesday show. But Tabacoff emphasized that when Foley was pictured on "The O'Reilly Factor" after Tuesday, he was correctly identified as a Republican.

"It was an honest mistake," Tabacoff said of the Tuesday mislabeling.

The BRAD BLOG orginally broke the story of Fox's egregious "error" last Tuesday.

We followed up with a report on AP having done a similar thing the next day, though they had the journalistic integrity (unlike Fox "News") to issue a correction statement when the problem was found.

Yesterday ran we ran another follow-up on O'Reilly and Fox's failure to publicly correct or even acknowledge the "error," indisputably closing any further debate on whether Fox is actually a news organization. It isn't. We included links to videos of both The Daily Show's and MSNBC Countdown's coverage of same in that last report.

Whatever Credibility Fox 'News' Had Left as an Actual News Organization (if any) Is Now Completely Gone...
By Brad Friedman on 10/5/2006 3:36pm PT

So Fox "News" labelled an apparent sexual predator as a "Democrat", despite the indisputable fact that the man, disgraced Congressman Mark Foley, is a Republican.

As THE BRAD BLOG originally reported the day before last, Fox did so three different times during Tuesday's O'Reilly Factor and have never admitted this outrageous misreporting. They simply disappeared the issue on the subsequent rebroadcasts of the program after they were caught having done it.

The next day the Associated Press --- who appear to be a real news organization --- did something similar. However, they did the right thing within hours, and admitted the error in subsequent corrected versions of their original article, which had labelled the REPUBLICAN Mark Foley as a Democrat.

Everyone in the world, it seems, has now picked up on the story of Fox's outrageous "error." (Including Comedy Central's The Daily Show and MSNBC's Countdown with Keith Olbermann --- both videos now linked below.) Everyone, it seems, except for Fox. To our knowledge, Fox has not taken responsibility or accountability in any way.

For now, we'll presume that's the end of this particular story, which sheds additional light (as if any further was needed) on the absurd claims that the Fox "News" Channel is actually a "news" organization. It is not. It is a Propoganda Ministry beyond the reach of the accountability and responsibility under which any self-respecting and true news organization would normally operate.

We can only imagine the uproar from the "conservative" community, and the heads which would have been forced to roll had the situation been reversed and CNN, or anybody else in the media, labelled a Democratic sexual predator as a Republican. Three times. Without apology or correction.

As mentioned, both Stewart and Olbermann ran with the story yesterday. Here are links to each clip, both courtesy of Crooks & Liars...

First on Fox, Then on AP! Although At Lleast AP Had the Decency to Issue a Correction!
ON UPDATE: Hastert Also Labelled a DEM by AP!
By Brad Friedman on 10/4/2006 12:52pm PT

It looks like AP picked up on Fox's "error" yesterday in labelling Mark Foley as a Democrat!

From Josh Marshall today...

Good Old Associated Press ...

[Dobson] touched on the uproar over former U.S. Rep. Mark Foley, D-Florida, who resigned Friday in a scandal over electronic messages he sent to former teenage male congressional pages.

The party affiliation that dare not speak its name.

Late Update: As of about 12:18 PM, the version of the AP story I linked to at the San Jose Mercury News has been corrected. But it must have been what the AP sent out over the wire. So I'm sure there are million more examples of it still out there.

Indeed Josh would appear to be correct. As of a quick Google search moments ago, there were still several articles indexed as showing Foley as a "(D-Florida)":

The stories listed by Google above now seem to have corrected the text in their online versions. No clue how many actually made it into newsprint that way.

Several of the outlets who ran AP's original "Foley is a Dem" version now have this correction notice at the bottom of their articles:

Correction: This story originally referenced Rep. Mark Foley as a Democrat. He is a Republican. The AP ran a similar correction 3 hours after it first moved on the wire.

To our knowledge, no such admission has been issued by either O'Reilly or Fox "News", despite having run the most egregious version of this "error" (three times in total) during the initial primetime broadcast of The O'Reilly Factor last night as we originally reported just after it aired. They simply scrubbed the "error" by removing that title card during the later re-broadcasts of the program (the ones with the smaller viewerships).

(Hat-tip Joseph Cannon)

UPDATE: Eagle-eyed BRAD BLOG commenter "Fred T" notes that Hastert is also labelled as a Democrat in the AP story listed in the Google search graphic above!

Three Different Video Cutaways, 15 Seconds or More Each, Credit Disgraced REPUBLICAN Congressman as Being a Florida DEMOCRAT!
UPDATED: NOW WITH VIDEO! LATER UPDATE: 'Erroneous' Caption Scrubbed from Late-night O'Reilly Rebroadcasts Without Explanation!
By Brad Friedman on 10/3/2006 6:07pm PT

Just amazing. Fox's O'Reilly Factor just covered the Mark Foley (R-FL) issue in two different segments, one of them with a page who says he received communications from Foley, and another with Ann Coulter.

Never mind the content of either segment for now. Incredibly, during a total of three different cutaways to video footage of Foley, he was labelled at the bottom of the screen eachtime as "(D-FL)" !

Three different times. In two different segements. Each cutaway about 15 seconds or more. Showing Foley as a DEMOCRAT. Amazing.

Just an accident? We report, you decide.

UPDATE: Here's quick video clips two of the three times that Foley became made an honorary Fox "Dem"...

-- CLIP 1: Windows Media Player version...
-- CLIP 2 (Coulter): Windows Media Player version...

UPDATE 11:30pm PT: Though we didn't see the first evening rerun, several folks have reported that Fox "News" scrubbed the "error" by running the video during the late-night rerun of O'Reilly with no text on the bottom of the screen during those sequences. Also, please note we originally had the date of 6/3/06 on the screenshot above, instead of the correct 10/3/06. Once we noticed, we had so many folks linking up to this item, we couldn't get back in to the site at all to make the correction until now!

UPDATE 10/4/06 2:04am PT: Confirmed! We just watched the second late-night rerun of O'Reilly, and indeed, the evidence goes down the memory hole as Fox removed the mis-labelled chiron entirely from their later broadcasts without explanation! BTW, we watched both full segments this time, including the one with Florida's own alleged Queen of Voter Fraud, Ann Coulter who swears up and down that Hastert just couldn't have known anything about Foley's problem, he just couldn't have!

Screenshot from the rebroadcast, where the "(D-FL)" has been excised from all three video cutaways, is below...

UPDATE 10/4/06 2:13am PT: Heheh...Bob Johnson over at dKos may have the explanation for what happened at Fox today... :-)

UPDATE 10/4/06 1:46pm PT: Now AP also labels Foley a Democrat!...

UPDATE 10/4/06 3:03pm PT: Fairness and Accuracy in Reporting (FAIR) asks a fair question about this today...

[A]ssuming it was an honest mistake...how come when the show was re-aired, the lower third was removed entirely--rather than replaced by one with the correct information? If it was important to identify Foley by party when he was thought to be a Democrat, why isn't it just as important to correctly identify him as a Republican? We suppose that's why Dick Cheney insists on always having his hotel room TV sets tuned to Fox News.

UPDATE 10/4/06 7:15pm PT: Looks like Olbermann covered the story tonight, natch. (No credit to yours truly, however...go figure...sigh) ... Also, John Stewart this this on The Daily Show as well. Both videos now linked here...

UPDATE 10/6/06 3:49pm PT: O'Reilly Executive Producer now says 'no on-air correction necessary.' Full details...

UPDATE 10/10/06 4:52pm PT: Now NewsMax.com says Foley a "Democrat"!...

UPDATE 2/8/08: Fox now shows presumptive Republican Presidential candidate John McCain also as a Democrat! Screenshot...

By Brad Friedman on 10/2/2006 8:01pm PT

This via AmericaBlog from Drudge...And note, if it's correct (Drudge isn't always, as you likely know) this if from the Washington Times, the White House organ! Not the Washington Post!

WASHINGTON TIMES ON TUESDAY WILL CALL FOR SPEAKER HASTERT'S RESIGNATION, NEWSROOM SOURCES TELL DRUDGE... DEVELOPING... Editorial titled: 'Resign, Mr. Speaker': 'House Speaker Dennis Hastert must do the only right thing, and resign his speakership at once... Mr. Hastert has forfeited the confidence of the public and his party, and he cannot preside over the necessary coming investigation, an investigation that must examine his own inept performance'... --- Washington Times, October 3, 2006...

Holy crap.

UPDATE: We hear that Olbermann is reporting that Michael Reagan is calling for same! That's Michael Reagan, the White House organ! Not Ronny Reagan!

Holy holy crap crap.

LATE UPDATE: The Washington Times editorial --- "Resign, Mr. Speaker" -- is now up in full. Could this be the all-out implosion that seems like it should have come years ago? Should be an interesting coupla days/weeks...

LATER UPDATE: The New York Times weighs in on Republicans eating their own... "Pressure grows for G.O.P. Over Foley Scandal"

Another One Bites the Dust as U.S. Congressman Quits in Light of Creepy Email, Sexually Explicit Internet Chats with Minors!
UPDATED: Foley Was Part of GOP Congressional Leadership, Chair of House Caucus on Missing & Exploited Children!
By Brad Friedman on 9/29/2006 1:15pm PT

Rep. Mark Foley (R-FL) became the latest in a growing line of Republican Congressmen to suddenly resign and/or drop their re-election bid in the face of scandal.

Creepy e-mails had recently been released from Foley to a 16-year old boy. RAW STORY has the series of emails. ABC News has the story of Foley's resignation just moments ago.

UPDATE: ABC News now has text of sexually explicit Instant Message conversations between Foley and a teen boy. We should have pointed out previously, in addition to being a part of the GOP leadership in Congress, Foley was also Chairman of the House caucus on missing and exploited children! From ABC...

In Congress, Rep. Foley (R-FL) was part of the Republican leadership and the chairman of the House caucus on missing and exploited children.

He crusaded for tough laws against those who used the Internet for sexual exploitation of children.

"They're sick people; they need mental health counseling," Foley said.

Guess he was just doing research...
