Well, we're back on today's BradCast --- like it or not --- after our holiday break, with a head cold (but not COVID) and a doozy of a day in Washington D.C.! [Audio link to full show follows this summary.]

For the first time in 100 years, the party in charge of the U.S. House --- which would theoretically now be the Republicans --- adjourned on the first day of the new, 118th Congress without electing a House Speaker.

After three ballots in which he failed to win the 218 votes needed, Republican Majority Leader Kevin McCarthy of California actually lost one of his votes on the third ballot to Republican Jim Jordan. The Ohio right-winger received 20 votes in the third round of voting, even after he had actually been the one to nominate McCarthy on the second round. And even after McCarthy had desperately attempted to broker deals for votes up until this afternoon.

On all three ballots, Democrats remained unified behind their new leader, Hakeem Jeffries of New York. He received 212 votes to McCarthy's 203 in the first and second round. McCarthy won only 202 on the last ballot before Republicans decided to adjourn for the day and regroup before trying again tomorrow. While Jeffries won more votes than anyone else on all three ballots, a majority of members present and voting is required to win the Speakership. That number today --- and presumably tomorrow --- is 218.

Without a Speaker, no business in the House can proceed. Given the silly business planned by the GOP majority in the House, that's no great loss. Back in December of 1855 it took until February of 1856 for a speaker to be chosen. But since the Civil War, there has only been one time until today --- way back in 1923 --- that the majority party was unable to elect a Speaker without multiple ballots. It remains to be seen how long it will now take Republicans to select a Speaker this time, as at least 20 GOP "rebels", led by Florida's Rep. Matt Gaetz, appear to be "Never Kevins" for the time being, with no particular Plan B in sight.

House Dems, of course, are eating it all up, as they should. We'll see how it goes tomorrow.

Also today, we catch up with a few items we missed while away over the holidays. Specifically, some of the remaining statewide contests in Arizona, one of which was still somewhat up-in-the-air before we left in the formerly "red" state.

Over the holidays, the GOP's gubernatorial candidate and Donald Trump "Mini-me", Kari Lake, saw her election challenge dismissed by a Maricopa County Superior Court Judge after she was certified to have lost by some 12,000 votes out of more than 2.5 million cast. Her victorious opponent, Democrat Katie Hobbs, was sworn in as the state's new Governor on New Years Day after receiving a generous hand-written note of welcome from her not-insane Republican predecessor, Gov. Doug Ducey.

But the incredibly tight Attorney General's race in the Grand Canyon State was still facing an automatic recount through the holidays after Democrat Kristin Mayes was certified as having defeated 2020 election denier Abe Hamadeh by just 511 votes.

At year's end, the state's mostly machine-recount wrapped up, with Mayes remaining victorious over the Republican by 280 votes. That's actually a fairly sizeable vote shift for a machine-recount, with most of the changes being attributed to "human error" in the original count in Republican-heavy Pinal County.

Hamadeh, like Lake, vows to continue to challenge the results. Nonetheless, Democrats in the state were sworn in to office for Governor, Sec. of State and Attorney General on January 1. Arizona's Democratic U.S. Senator Mark Kelly was sworn in for his first full six-year term today in D.C. after also winning election in the state in November, as the fall-out and disarray from the Trump Era for Republicans continues from D.C. to Phoenix and beyond.

Yes, on today's BradCast, we discuss a new, maddening --- and likely unconstitutional --- voter suppression law signed this week by Arizona's Republican Governor. But, as our guest notes, "Don't worry, we've got this!" We'll see. He's got a plan in response that voters in other swing-states may wish to look at as well. Other than that though, today's show ends your week with nothin' but good news! (Mostly.) [Audio link to full toe-tappin' show is posted below this summary.]

First up, good news on COVID! According to the Dept. of Health and Human Services, hospitalizations are now at their lowest rate since the U.S. began keeping records at the beginning of the pandemic two years ago. Of course, last time hospitalizations where near this low we got slammed by Delta and then Omicron shortly thereafter. So, hey, now's a great time to get a vaccine shot or a booster if you haven't in the past 4 months or so!

Then, more good news on the economy! 431,000 new jobs were added in March, as Americans continue to shake off the pandemic, even amid war in Europe and inflation. Since Joe Biden took office, the economy has added a record 7.9 million jobs. Unemployment is the lowest it's been since before the pandemic and barely higher than the nation has seen in a half-century, as the President did some justifiable crowing about those numbers today. Things would be even better had Republicans and Sen. Joe Manchin allowed his Build Back Better bill to pass, given that many more women are needed to fill millions of open jobs, but can't afford the child care (that BBB would have paid for) in order to take them.

But there's still more good news today, for workers and labor unions! Amazon employees in deep red Republican Staten Island, New York voted "yes" to unionize in an historic labor win at the only fulfillment center in New York City! It's the first Amazon facility in the U.S. to do so, but it likely means many others will join them. Another unionization vote at Amazon's fulfillment center in Bessemer, Alabama remains too close to call for the moment. It's the second such vote held at that plant after the National Labor Relations Board found that Amazon had cheated in the first vote and ordered a re-do.

Speaking of cheating in elections: Republicans. Though it may make your head (and mine) explode, mid-term primaries are beginning to kick off all over the country. The first one, last month in Texas, resulted in tens of thousands of disenfranchised absentee voters whose ballots were rejected thanks to the state GOP's new voter suppression law there.

We had slightly better news this week in Florida. There, a federal judge struck down several provisions of the new voter suppression law adopted last year by the GOP-dominated state legislature and Republican Gov. Ron DeSantis (who barely won his initial election back in 2018). U.S. District Judge Mark Walker found that the law unlawfully targeted black voters in violation of both the Constitution and the Voting Rights Act. Most notably, he ordered the state back under the VRA's preclearance regime for the next decade, mandating approval in advance from the federal government for any new election-related laws that may effect minority voters.

Republicans in Arizona, however, have been running a bit behind in their voter suppression. But, on Wednesday this week, the state's Governor Doug Ducey, also facing re-election this year, signed HB 2492 [PDF], even though legislative attorneys in both the state House and Senate found the measure to be likely unconstitutional. In short, it requires state voters to prove they are citizens before they may vote for candidates in state and local elections. But it goes farther than previous such laws in the state. This one could disenfranchise anywhere from 31,000 to nearly 200,000 voters in a state where Democrats won the Presidential election in 2020 by just over 10,000 votes. It would prevent voters who fail to prove their citizenship (or can afford to do so) from voting for either state officials or President. They may still be able to vote for members of Congress, but not during either early voting or via absentee ballot.

We're joined today by ERIC KRAMER, former Chair of the Navajo County Democrats, now Director of the Arizona Deserves Better non-profit coalition to discuss HB 2492 and, more importantly, what he and other voting rights advocates in the state are currently doing to both overturn such measures and prevent even worse ones from being adopted at any time in the future with their new Arizonans for Fair Elections ballot initiative.

We first learned of the effort via DailyKos, where Kramer writes as "EricAZ". Two articles of his there caught our eye in particular. The first, in early March, was headlined "Arizona Right-Wing Goes Batshit Crazy in Attack on Voters (Don’t Worry, We’ve Got This)". The second, a few weeks later, is titled, "The Joy of Soon Beating the U.S. Supreme Court on Several Voting Rights Issues".

Kramer explains how the AZ Fair Elections initiative, targeted for inclusion on the ballot this November, would work to prevent the kind of voter suppression we have been seeing from the increasingly extremist Republican radicals who now control the AZ state legislature. It would roll back laws like HB 2492 and prevent similarly disenfranchising laws from being adopted in an election year. It would also repeal a number of other laws recently adopted by state Republicans which target minority voters (Native Americans in particular), while instituting proactive measures to increase voter turnout, rather than block it, as the GOP is now working so hard to do there and elsewhere.

"In addition to these places where we're kind of playing defense against what they've done to voters in the past, there are some where we are playing offense," Kramer explains in detailing the voter referendum. "We have automatic voter registration. We have Election Day registration. We expand the periods for early voting. And we do quite a lot to help Native American voters and especially disabled voters --- we give more opportunities to vote. So it is a very good initiative."

Can his group, which is currently in the signature gathering process, get the measure onto the ballot in November? And, if so, can they get it passed? "We are going to get it done," he tells me confidently. "We need 243,000 signatures [by July 7] to get on the ballot. We're currently collecting at more than twice the rate we need. Fundraising has gone well. People from all over the country are supporting this. We will get it done."

Our final good news for the day is about cannabis. U.S. House Democrats, with almost zero help from Republicans, adopted a measure today to decriminalize marijuana at the federal level, though it will still have to overcome a likely GOP filibuster in the Senate. That, despite the American public's overwhelming support not just for decriminalizing cannabis, but for fully legalizing it once and for all. Not sure why the GOP would be dumb enough to take a pass on shooting the measure down again, as they did back in 2020 when they held the majority in the upper chamber, but explaining Republican stupidity is not my strong suit.

But to keep you happy and singing well into the weekend, we close with a new ditty from Canadian comedian and "The Internet's Favourite Dad* (*unproven)", according to his Twitter profile, Stewart Reynolds, who sings that "it's nice to be disliked!"...So "annoy a Nazi" today!...

We've got quite a few updates on a number of stories we've been covering of late on The BradCast. Some of them not necessarily happy and others quite astounding. As well as some mainstream media failure, and other news from this seemingly endless Summer. [Audio link to full show is posted below this summary.]

Among the stories covered on today program...

• Even as infections, hospitalizations and deaths continue to soar in their states, more politically ambitious Trumpy Rightwing Governors are leading their constituents on a death march by banning mask mandates by small local governments and school districts. Happily, a number of the school districts are putting the health and safety of their children above the authoritarian edicts of their Governors, as well as over the deadly demands of too many brainwashed, disinformed parents fighting to endanger their own children and themselves.

• We've got updates today on several stories we've covered in recent weeks, including the anti-vax parents of four children in Texas, who both changed their minds about vaccinations just before they were intubated several weeks ago. Also, updates on some of the Rightwing anti-vax radio hosts who have either recently died or are now hospitalized in grave condition from COVID. Also, yet another far-right radio host --- this one a Christian broadcaster who derided COVID vaccines as "government control" on his daily "Prophecy Today" program --- has now died from...you guessed it.

• A disturbed far-right Trumper from North Carolina brought Capitol Hill to a standstill today --- requiring evacuations from the U.S. Capitol to the U.S. Supreme Court --- after pulling his license plate-free pickup truck onto the sidewalk in front of the Library of Congress and threatening to detonate a bomb. During the 5-hour standoff with police, which thankfully ended peacefully, media outlets reviewed the man's Facebook Live-streamed rants and other videos. He reportedly railed against Joe Biden, "Nancy", "antifa" and the Democrats, demanding they all resign en masse; declared "the revolution is here" and that he is the "last generation" of those willing to stand up for America. He said that Trump will be reinstated and posted video from his participation at "Stop the Steal" and "Million MAGA March" rallies. So, how did Associated Press, at least for a time today (via the Internet Archives), lead their description of the man's politics? By claiming that in one of his videos he "said he loved the president, Democrat Joe Biden." --- Really, AP?

• We've also got a few quick updates today on the Trump-loving Mesa County, Colorado County Clerk, Tina Peters, who, as we have been reporting in some detail over the past week, allegedly entered a secure area of the County's Election Division in the middle of the night with two accomplices last May, turned off the security cameras, and allowed two hard drives containing Dominion Voting's Election Management System (EMS) software to be copied in full. During one of her several appearances on stage last week at MyPillow CEO Mike Lindell's failed three-day "Cyber Symposium" where he didn't reveal the promised "proof" that China stole the election for Joe Biden, the extremely sensitive contents of those hard drives were released into the Internet wilds for download by thousands. That, in the middle of California's critical Gubernatorial Recall election, where some 60% of the state will rely on that same, proprietary Dominion EMS software. Peters claimed during Lindell's forum that she was being "persecuted" by CO's Democratic Sec. of State Jenna Griswold because she's a "conservative Republican". Griswold has now removed Peters from her role, as Mesa's now-former chief election official is facing a criminal probe by the County's conservative Republican District Attorney. This week, the FBI joined that investigation, as federal crimes may have been violated in the theft and release of that software. And today, VICE reports, Peters is on the lam, being sheltered in a "safe house" somewhere by the MyPillow guy (who already faces a $1.3 billion lawsuit [PDF] from Dominion himself.) Will the "persecution" never end?

• Finally, Desi Doyen joins us for our latest Green News Report, with grim news of deadly climate change-fueled extreme weather from Haiti to both coasts of the U.S. to much of Europe; and some happier news this week from the Biden Administration...

On today's BradCast, we see some light at the end of America's dark tunnel. [Audio link to full show follows below.]

On Tuesday, the swing-states of both Pennsylvania and Nevada certified Joe Biden's victory over Donald Trump, joining Michigan from Monday. In Arizona, which certifies next week, its very Trumpy Republican Governor Doug Ducey conceded that "Joe Biden did win". And, despite Trump's repeated lie that the stock market would crash if Biden was elected, it continued to soar today, with the Dow closing above 30,000 for the first time. Trump stayed largely inside his White House bunker while continuing to falsely tweet that he won the election, though he did come out long enough to "pardon" a couple of turkeys. He's probably warming up for what is to come during the last desperate days of his failed Presidency.

We're joined today to discuss all of that and much more by Constitutional attorney and election law expert JOHN BONIFAZ, co-founder and President of the nonpartisan, non-profit good government group Free Speech for People (FSFP). His organization won several important victories in key voting rights cases prior to the election. One of them helped extend Arizona's registration deadline during the pandemic, allowing for 35,000 new registrations in the state that Democrats now appear to have won, for the first time in decades, by about 10,000 votes.

Our conversation today focuses largely on accountability, and the need for the President-elect to assure the criminal Administration of the previous four years does not escape it, as the Obama Administration allowed the George W. Bush Administration to do in their ill-considered effort to "look forward not back". Biden has reportedly been uttering similar thoughts of late. Bonifaz argues that would be a fatal mistake. "You can draw a straight line from the decision that President Obama made to only look forward, not to look back at the war crimes, the torture that had taken place during the Bush Administration --- you can draw a straight line from that decision, that strategic error, to the rise of Donald Trump. And I do think that we cannot make that mistake again," he tells me.

Among the areas of accountability that await the outgoing President, as Bonifaz sees it and hopes to ensure with FSFP: Crimes that were not included in Trump's impeachment for attempted extortion of the Ukrainian President (Bonifaz co-wrote a book on those crimes); obstruction of justice and other crimes touched on by Special Counsel Robert Mueller that remain unpunished; horrors carried out by the current administration at our nation's borders, including the "kidnapping" of children; the ongoing attempted coup to overthrow the results of the 2020 election; and even crimes against humanity for Trump's unforgivable failure to help avoid the unnecessary deaths of more than a quarter of a million Americans (to date) thanks to his criminal lies about the COVID pandemic --- just to name a few.

"What we've been left with now, since the election is perhaps the worst abuse of power of them all," explains Bonifaz, who is also founder of the National Voting Rights Institute. "His effort to subvert the Constitution, to disenfranchise millions of voters based on this falsehood that mail-in voting has been fraudulent, and to effectively overturn the Presidential election results, and engage in an attempted coup. All of that is not only an abuse of power, but it's a broad criminal conspiracy for which this President should be held accountable once he is out of office."

We also discuss whether Trump has the Constitutional power to pardon himself for any of those crimes before leaving office, and whether the Republican claims at having newfound concerns about election integrity (based in no small part on years of my own investigative reports, though bastardized by the cretinous lawyers currently representing Trump in his attempt to reverse his reelection loss by both hook and crook), might result in a new reason for hope for the real, decades-old Election Integrity movement. Longtime advocates like Bonifaz and myself have fought for years in that movement against the privatization of our elections by corporate voting system vendors and their proprietary computer voting and tabulation systems. Perhaps after the partisan opportunists have peeled off from the GOP's current false claims about "Dominion!" and "Smartmatic!" and "Hugo Chavez!", we'll find new legitimate allies from the Right.

"We have to reach for the gold standard of election integrity, which are hand-marked paper ballots for all of our jurisdictions across the country, with assistive devices for those who need it," Bonifaz tells me. "But we cannot have the private voting systems industry be in charge of counting our votes, because it leads to this distrust. It leads to this lack of verifiability. The reality here is that because so many people voted by mail this year, we actually had an ability to verify the election even more so than previous cycle. Hand-marked paper ballots are the gold standard."

Also today: A few overdue corrections before the holiday and several things that I am exceedingly grateful for, even in these dark days. And Desi Doyen joins us for our last Green News Report before Thanksgiving, which includes several items to be thankful for as well...for a happy change...

Some pretty scary topics on today's BradCast. But don't worry! There's a Rainbow at the end of this pot of gold to help make it all just a tiny bit better! [Audio link to show is posted at end of summary.]

First up: As we've been reporting for weeks, coronavirus infection rates and hospitalizations have been surging across much of the country, particularly in states with Republican Governors who reopened far too early, despite warnings to the contrary from health experts. Throughout this epic failure, however, there has been one statistic these sociopaths have been repeatedly clinging to in recent weeks to justify their ill-considered orders to try and goose the economy in the short-term before the election by reopening, despite the obvious dangers: mortality rates from COVID-19 had not been increasing along with the spike in infection rates

Of course, as we've also been reporting for weeks, the death rate is a lagging indicator that, sure enough, follows the increase in hospitalizations. And now, especially in states like Florida, Texas, Arizona and others where Republican Governors put their perceived (and twisted) political interests ahead of the health and lives of their actual constituents, death rates are now beginning to swell as expected. That, even as Donald Trump and Mike Pence, the head of his so-called White House Coronavirus Task Force, continue to mislead the public about such facts. "We are encouraged that the average fatality rate continues to be low and steady," Pence lied to reporters at the White House this week, while vowing to strong-arm schools into reopening for in-person classes next month --- including in Florida, where, as in Texas and Arizona, ICUs are now at capacity in much of the state, hospitals are running out of test kits and the Republican National Committee plans to hold its nominating coronation for Trump next month as well.

Governors Ron DeSantis (FL), Greg Abbott (TX), Doug Ducey (AZ) and others like them share the same buckets of blood on their hands with Trump, Pence, and the other rightwing death cultists, like Sean Hannity at Fox "News".

Then --- in even cheerier news --- it is now "not just possible but increasingly probable" that Donald Trump will steal the election, according to our guest, Colorado's former U.S. SENATOR TIM WIRTH! Writing recently at Newsweek with Editor-at-Large Tom Rogers, Wirth --- who has served in various branches of government since the Johnson and Nixon Administrations --- details a scenario in which Trump could lose not only the popular vote, but also the Electoral College votes of enough swing states to lose in a rout, but still manage to remain in office!

And, as they detail in 12 simple steps, it can all be done "legally" thanks to some obscure emergency powers granted by Congress decades ago to the President, some help from a compliant and stolen U.S. Supreme Court, and the shameless Republican caucus in the U.S. House of Representatives.

In short, the example scenario proffered by Wirth and Rogers involves the invocation of Presidential powers to launch an investigation into dubious claims of election fraud in several battleground states. That prevents the certification of results in those states which, as SCOTUS has previously ruled, would mean their electoral votes would not ultimately be included in the final tally. If the result was a tie or challenge to the final electoral count, the winner of the Presidential contest would, as specified by the Constitution, be determined by state delegations in the U.S. House, where Republicans currently hold the controlling majority in a majority of states (26).

While the specific scenario they spell out might seem unimaginable, their very specific step-by-step plan is both entirely plausible and, theoretically, perfectly legal. It is no more unimaginable than the idea that Donald Trump could become President of the United States in the first place.

So, Wirth warns we would be wise to begin imagining it --- and making plans for how to counter it --- immediately. "We can't wait until the middle of October or early November to ring the alarm bells," he tells me. "The alarm bells, in our opinion, have to go off now."

The scenario, as he details it, is as chilling as it sounds --- and completely imaginable under this President, who, Wirth explains, is already busily laying the ground work for such a coup. "If you look at Trump and what we've learned in the last 3 and a half years, this is a man who is absolutely deathly afraid of the word 'loser'," he argues. "He does not want to go down in history as the biggest loser in American political history. He will do everything he possibly can to avoid that and to stay in office."

"Effectively, under Article II of the Constitution, he can do practically anything that he wants to do. There are no constraints on his use of these emergency powers," says Wirth. "There is no review of these powers. The Congress actually knows very little about them. They are in statute, but held by the Justice Department and by the White House. The Congress has had little or no attention to these. They have not heard hearings about them, they don't know what's in these emergency powers, they have not reviewed them."

"Trump has no constraints on these. The Congress doesn't have any authority to check these powers. People can say, 'Well, it would go to court!' Who's going to take it to court? Barr, the Attorney General? Are they going to challenge what Trump says he's going to do?"

"The more you know, the worse it is. The more you know about these emergency powers, the more you sketch out what he may do, the more you see what he's doing in all of these swing states, how they're trying to discourage vote by mail, how he's making all kinds of wild statements about how corrupt electoral voting would be if its conducted by mail," the former Democratic Senator explains. "It would really take a failure of imagination not to begin to think... that this is not just possible, but probable. Let's connect the dots."

Wirth connects a bunch of those dots on today's show, adding to his opinion piece at Newsweek and another related warning he penned at Politico with former CO Senator Gary Hart and Carter and Clinton Administration officials Joel McCleary and Mark Medish, telling me today: "There is a danger in our system, and we have to build public attention to this, so that it doesn't happen...We should be alert to it, and aware of it, thinking about it, talking about it, and building the firewall against it."

Finally, because we suspect you need as much help as we do at shaking off today's nightmares --- and all of the ones we've endured over the past week (or even 3 an a half years) --- we close with some important advice from the great musical satirist, Randy Rainbow...

Even as COVID-19 cases are spiking around the country --- including in OK, where new cases surged 68% in the second week of June and where Tulsa's top health official and major newspaper are both begging Trump to call off this Saturday's planned campaign rally --- both men are now lying about both the growth in infections and in hospitalizations since states have begun reopening for business over the past several weeks.

They are both falsely explaining away the rise in confirmed infections in more than a dozen states as due to increased testing. It isn't. What epidemiologists are worried about is the rise in the percentage rate of positives tests, no matter the increase or decrease in the number of tests performed and about rising hospitalization rates, which are the best indicator of the increasing virulence of the pandemic in various parts of the country.

Pence reportedly instructed Governors, during a phone call on Monday, to lie about both matters, stating "the magnitude of increase in testing" explains the rise in positive cases and that increased hospitalizations are only because "people are going back to hospitals and elective surgery." But hospitalizations for elective procedures are decidedly not what infectious disease specialists are worried about, nor are they included in the spiking and often record rates of hospitalizations being seen right now for COVID-19 infections.

As we have been explaining on the show in recent days, as rates rise in Texas and Florida and Arizona (all three hit records for single day increases today) and elsewhere since Governors in those states prematurely reopened and are now seeing skyrocketing rates of illness since doing so, there is still no treatment, no cure, and no vaccine for the coronavirus. Lifting lock-down orders, failing to wear masks, and ignoring social distancing as many have now done, is little different than had we all done so in March and April as the virus first emerged.

In fact, as one of the very conservative COVID models --- one cited by the White House --- was adjusted today to predict more than 200,000 deaths in the U.S. by the first of October, our guest today explains why she believes "we are in a worse situation now" than we were back in March and April.

"We have a lot of infectious people in the community that we didn't have earlier on," notes DR. PURNIMA MADHIVANAN, infectious disease epidemiologist and Associate Professor at the University of Arizona's Zuckerman College of Public Health. "I would say it's Phase 2 in that regard. We have a lot more people who are infectious, who are shedding the virus, than when we had started earlier on."

Describing ICU beds, particularly in Phoenix, at near-capacity rates just one month after reopening, Madhivanan, Director of her school's Global Health Training Program, says the state of Arizona is in "crisis mode. We need to be doing something, like, yesterday." That, as Republican Governor Doug Ducey --- who abruptly announced reopening plans early last month on the same day as a visit to the state by Donald Trump --- continues to downplay the state's worsening predicament, despite a 76% increase in cases since the end of May and records of new cases and hospitalizations being consistently topped in recent days.

Madhivanan tells me she sees the state running out of ICU space within a week. "We have a crisis situation right here in Phoenix. And if [Ducey] were smart, he would close off the borders to Phoenix yesterday." This is not a so-called "second wave," she cautions. "We haven't even peaked with the first wave yet. We are number 42 among all states in terms of testing rates. So we haven't even gotten to the level where we can say our testing rates are good. And we've not even mentioned contact tracing yet. That's practically non-existent, and a huge concern."

It didn't have to be this way, Madhivanan explains, but for Ducey's abrupt reversal in early May. "What we had actually projected and predicted was we would get to the peak around the end of June, if everything had gone the way we had predicted with all the physical distancing in place, stay-at-home orders. But when the stay-at-home orders were not followed through, that peak came much, much earlier, and we are still continuing up on that wave. We have not come down yet."

This is an important, must-listen, detailed conversation which extends well beyond Arizona. I couldn't even begin to adequately summarize it here. We discuss the denialists and claims from mostly non-epidemiologists and ideologists who charge that lock-downs have made the situation worse, asserting that allowing for "herd immunity" to develop would have been a smarter strategy. She details why she strongly disagrees, explaining that it would have taken years and resulted in exponentially more deaths, in the millions, here in the U.S. Madhivanan further says containment, unlike during the SARS crisis of 2003-2004, became impossible "because we have an uncoordinated and poorly managed COVID response" at the federal level.

That means the only option left is shutdowns, mask wearing (which, she argues, makes a huge difference in mitigating spread of the virus), hand-washing and physical distancing. But, she laments, there is now very little, if any, of that being done in her state. Ducey has never mandated masking, for example, even as "masks are our lowest-hanging fruit and one of the most economical interventions. If all of us did it, we can dramatically bring down the number of infections."

She warns things are going to get much worse before they get better anytime soon. "If we had used the period of the shutdown to put comprehensive testing and tracing protocols in place, this investment would have paid off in the long run. But we failed to do that. So we only delayed the day of reckoning for us."

"At some point people need to start believing in science, is all I can say. We have the data, we have the evidence, and the science is pretty clear about this. We were not ready and we should not have opened," Madhivanan insists.

Finally, after a bit more news on the 28 states in the U.S. where infection rates are decidedly NOT falling, no matter how hard the Administration and his supporters are still trying to pretend it all away, we've got a bit of breaking news that came just before air time on Donald Trump hoping to sue John Bolton's upcoming new book away.

Today on The BradCast: This week the Republican's stolen U.S Supreme Court took a huge step forward toward public transparency by live-streaming their oral arguments for the first time in history. No, it wasn't on video. It was via telephonic conference call. But one step at a time, I guess. There's something, anyway, to thank the coronavirus for. [Audio link to full show is posted below.]

We're joined today by Slate's Supreme Court legal expert and justice reporter DAHLIA LITHWICK to discuss the first-ever oral arguments by phone for the Court and the first to be broadcast live to the nation. It was also the week when the nation's heart skipped a beat or two for a short time upon learning that Justice Ruth Bader Ginsburg had been "hospitalized with an infection". Turns out the infection was thankfully not COVID-19, but a gallbladder matter which left the 87-year old Justice able to participate in the week's historic telephonic arguments from her hospital bed in Maryland.

"It reminds us," Lithwick says, "pinning all of our hopes on an octogenarian...is a pretty scary way to be doing justice. But in a really profound way, it kind of reminds us that the people who are getting shredded by this virus are that generation" and "It does make you realize how unbelievably susceptible the bulk of the Supreme Court is right now."

Beyond that, Lithwick, who hosts her own Slate podcast, AMICUS, sees this week's live broadcasted SCOTUS hearings as an encouraging step toward transparency for a Court that has been frustratingly camera shy. She also cautions, however, that the live broadcasts allowing Americans to hear how our laws are adjudicated at the nation's highest court in real time may not last after the pandemic subsides.

However, the week's historic hearings went well enough, she reports, even if the structure required to carry out oral argument by conference call necessarily changed the way in which cases have traditionally been argued in person, as Justices were not able to interrupt each other to press various arguments as they have always done --- and even as someone on the call forgot to mute their phone during a toilet flush heard during one of the first day's hearings.

Yes, we get to the straight poop on who may have been behind "the flush heard round the world" today, before turning to the substance of the actual cases heard before the Court. One was a fairly straightforward case on trademarks. Another was a much less simple one on whether religious groups and even private businesses have their religious rights infringed by being allowed to opt out of the contraception mandate of the Affordable Care Act (ObamaCare). Yes, plaintiffs in this case --- including the Little Sisters of the Poor, a small group of nuns in Pennsylvania --- argue that being allowed to opt out of having their insurance provider offer contraceptive care to their employees somehow violates their religious and "moral" freedoms (whatever "moral" freedoms may be.)

We also discuss how the Court has selectively decided which of the many previously postponed cases from March and April (cancelled until the Justices figured out how to dial a telephone) would be rescheduled for this session versus the next one, where opinions will not come out until well after the critical 2020 Presidential election.

We then move on to an important (if too brief) conversation about how rightwingers seem to misunderstand the actual meaning of their favorite words "freedom" and "liberty", as invoked by the slave-holding founders of our Constitution. That, as anti-lockdown protesters haul semi-automatic rifles into state legislatures to demand the lifting of stay-at-home restrictions, shoot people who ask them to follow the law by wearing face masks inside stores, cite "tyranny" and invoke Japanese internment camps (as a Wisconsin Supreme Court Justice recently did) and call for the "LIBERATION" of states with Democratic Governors (as the President of the United States recently did.)

In her most recent column on this point, Lithwick flagged an essay by Ibram X. Kendi at the Atlantic which speaks to the "long-standing difference between core notions of what he calls freedom to and freedom from". The latter is seemingly being pushed out of the public square in favor of the former.

We discuss what Lithwick describes as "the movement out there that says, 'I don't have to wear a mask,' 'I have a Constitutional right to carry a gun into the capitol,' those are 'freedom to' values, but they subordinate huge masses of people who actually want to be free from those very things. These are a lot of the same arguments that people make about the Second Amendment. That they want to be free to parade around a restaurant, open carrying, and they don't realize that freedom for a lot of Americans is freedom from the terror of that act."

"I think that is a really emblematic new trend, where we're seeing these religious claims that say my freedom to X somehow subordinates and dominates your freedom to, in the Little Sisters context, have access to a statutory entitlement to contraception. My freedom to X, discriminate against people that I don't want to bake a wedding cake for, somehow is more important than your freedom from discrimination based on any identifiable class," Lithwick tells me. "I think this is a tension that is permeating how the courts are looking at a lot of values."

"It probably goes without saying, but let's go ahead and say it --- that it does seem as though if you are a straight, white Christian male, you have a lot of 'freedom to'. Even now, if you are protesting in the capitol in Michigan, if you're a white guy with a gun, your freedom to XYZ is predominant. And if you are an African-American out for a jog, your freedom from being executed summarily doesn't seem to matter. So I think part of the problem with this thumb on the scale for "freedom to" claimants is that it's not distributed equally across race, class, gender, or economic well-being."

The news is about the coronavirus working its way into the White House via Donald Trump's personal valet who tested positive this week and via Mike Pence's press secretary, Katie Miller, who tested positive today. After being in close contact with Pence and members of the press, it should also be noticed that Miller is married to Trump's Senior Advisor Stephen Miller, who is in close regular contact with the President of the United States. Will we see a change in the Administration's rush to reopen the country long before health experts say it is safe to do so if COVID begins to find its way into the White House --- and, perhaps, even the Oval Office?

The update is on the decision by Arizona's Health Department to reverse its cancellation earlier this week of the work by state university scientists on COVID-19 modelling.

And the listener mail regards a local postmaster who says he's decided to retire earlier than planned after "hatred" directed at his staff "by the segment of our town who watch Fox News" who are now "yelling" at Postal Workers for wearing masks on the job. Yes, it's an insane way to end another insane week in these "United" States of America...

Donald Trump is putting George Orwell to shame. A Republican U.S. Congressman is caught on tape committing election fraud. And our Green News Report may have finally jumped the shark --- or at least the news we report in it today has. All on today's BradCast. [Audio link to show is posted below.]

I've said many times on the show that Donald Trump and the Republicans can't simply lie this one away. Or vote it away. Or simply ignore it. The hard numbers of Americans dying --- at least 75,000 already --- can't merely be wished away, as Trump has successfully been able to do with so many of his crimes, misdemeanors, appalling failures as President and other scandals. But maybe I was wrong. Maybe they can actually pretend it all away. In fact, that is now what they are trying to do.

In Arizona, some two dozen experts at two top universities who had been compiling the state's most robust public modeling for COVID-19 were told by the head of the state's Department of Health Services to stop their work immediately, according to an email obtained by Phoenix' ABC affiliates and reported by the Arizona Republic on Wednesday. They will also no longer have access to special data sets the team had employed in their work. The order came as AZ's Republican Governor Doug Ducey was lifting coronavirus restrictions across the state, and after the experts from Arizona State University and the University of Arizona produced five different potential models for reopening the state, with only one scenario that did not show a dramatic increase in cases. That one allowed for businesses to reopen at the end of May. But Ducey wants them open now, so his Health Department has shut down the state's best information in favor of models they claim are coming from FEMA and the CDC --- moels that have no been released publicly.

Back in D.C., the President of the United States is now reportedly questioning the coronavirus death toll numbers, believing them to be lower than reported, according to AXIOS, when, in fact, it is almost universally agreed among experts that the most widely reported numbers from Johns Hopkins University are likely vastly lower than the actual death toll, since most states have only reported those who have died after testing positive for COVID. Tens of thousands of more Americans have died over the past several months almost certainly from the virus, but they are not currently included in those figures. Nonetheless, Trump and other senior aides are now planning to publicly question the death toll as being falsely inflated, while the tragic numbers continue to blow away Trump's repeated lies since January about expected U.S. deaths from the pandemic. Yes, he's preparing to simply pretend it all away, as he did with the death toll for Hurricane Maria in Puerto Rico and as Republicans have done for years regarding the science of climate change.

At the same time, as AP revealed today, the Administration is also preventing the release of a 17-page CDC guidance report meant to help local churches, restaurants, schools, summer camps, transit systems and other business reopen safely, with one CDC source telling AP they were told the guidance "would never see the light of day." After the publication of the report by the AP documenting the Administration's attempt to bury it, the New York Times reports the White House "rejected the recommendations over concerns that they were overly prescriptive, infringed on religious rights and risked further damaging an economy that Mr. Trump was banking on to recover quickly." In other words, Trump believes he can revive the economy quickly to improve his re-election chances, no matter how many Americans are unnecessarily killed in service to that cause.

And, speaking of elections, the Denver Post published a remarkable story on Wednesday night, along with an audio recording revealing Colorado U.S. Congressman and state Republican Party Chair Ken Buck ordering another GOP party official to falsify election results on an affidavit in order to place a Republican candidate for state Senate on Colorado's upcoming primary ballot.

The Republican official, Eli Bremer, GOP chair of state Senate District 10, is heard on the call refusing to do so without consulting with an attorney first. He asserts that he was being asked by Buck to commit a crime in signing a false affidavit to certify that at a local candidate received the 30% support necessary to be placed on the ballot when, in fact, he received only 24% in a recent vote.

A state District Court judge ruled on Monday that Bremer would have, in fact, been in violation of state law had he signed the affidavit as ordered by Buck. The state Republican Party appealed the ruling to the Colorado Supreme Court which declined to hear the case, leaving the lower court's ruling in place. Buck, a Tea Party right-winger and former District Attorney, claims the initial vote was flawed. He has yet to resign his post as Colorado GOP Chair or U.S. Congressman. He should step down from both. Had any Democrat been caught on tape doing anything even close to what Buck is heard doing in the recording, they would already be gone. We'll hope the Colorado state Bar Association, at the very least, sees fit to take away Buck's license to practice law after being caught on tape repeatedly ordering someone else to violate it.

Finally, even with what may be our most ridiculously apocalyptic Green News Report ever today, we have to tack on one more sign of the end of the world, as a potentially historic snowstorm is now forecast to dump as much as one foot this weekend in parts of the Northeast and New England --- in MAY! That story seems an apt intro today for Desi Doyen and our latest Green News Report today, in which it all falls apart --- including terrible climate crisis news and, yes, Murder Hornets! --- suggesting that, in fact, we may finally have reached 'Peak GNR'.

On today's BradCast, results, as reported by computer tabulators, from Tuesday's primary elections in Florida and Arizona and primary runoff elections in Oklahoma. Also, more details on what went so terribly wrong in Maricopa County, AZ which kept many voters from being able to cast a vote at all. Nevada's June primary disasters were far worse than reported. And an answer to at least one mystery regarding 2016 Presidential ballots in Michigan. [Audio link to complete show is posted at end of article.]

First up, among the noteworthy results we cover from yesterday's midterm primary elections...

• In Florida, progressive Tallahassee Mayor Andrew Gillum came from seemingly out of nowhere for an upset win of the Democratic nomination for Governor. If the Bernie Sanders-endorsed Democrat defeats the Donald Trump-endorsed Rep. Ron DeSantis in November, he'd become the state's first African-American Governor. That, as the current two-term Governor Rick Scott won his primary to vie for incumbent U.S. Senator Bill Nelson's seat, in what will likely become the most expensive U.S. Senate race this year (and, possibly, in U.S. history).

• In Arizona, establishment favorite Rep. Martha McSally held off two challengers from the hard right to win the GOP nomination to fill the seat being vacated by the state's retiring U.S. Sen. Jeff Flake (R). She'll face off against Democratic nominee Rep. Kyrsten Sinema in November for a seat that Dems believe they may be able to flip from "red" to "blue", even in a state like Arizona, in a very anti-Trump year. And Republican Gov. Greg Ducey --- who will soon name a replacement for the state's other U.S. Senate seat, vacated by the death of Sen. John McCain --- will now face off against David Garcia, a Latino and former educator who won the Democratic nomination for Governor, in a year in which teachers have walked out in protest of education funding cuts in so-called "red" states Arizona and Oklahoma. (Also of note, Republican Sec. of State Michelle Reagan lost her primary for re-election to the hard-right Steve Gaynor who is calling for English-only elections in AZ. Democratic nominee Katie Hobbs should see an opening there in the race to become the state's top election official)

• And, speaking of teachers and Oklahoma, it was a "bloodbath" in the primary runoff elections for incumbent GOP state legislators who voted against recent tax hikes to pay for new education funding. Just 4 of the 19 Republican state legislators who voted against the tax hike to give teachers a long-overdue raise have survived to run for re-election on this November's ballot.

Then, we turn to the massive problems at polling places in Maricopa County (Phoenix), AZ on Tuesday, as at least 62 polling places were unable to open for hours in the morning. It now appears that the reason was electronic pollbooks which were not properly set up, or set up at all, or which couldn't get Internet access. That effectively prevented voters from being checked in to vote on the County's hand-marked paper ballot voting systems (which use computer optical-scanners to tally votes.)

Remarkably, the County's Republican-majority Board of Supervisors rejected the recommendations of both Sec. of State Michelle Reagan (R) and Maricopa County Recorder Adrian Fontes (D) to seek a court order to keep polling places open for an extra two hours at precincts which failed to open on time on Tuesday.

As to the electronic pollbook disasters that kept them from opening in the first place, Fontes blames an IT contractor for not supplying as many personnel as promised for polling place installation and tech support. The contractor, Insight Enterprises, blames Fontes for being under prepared. What's clear for the moment is that voters --- potentially thousands of them --- were prevented from voting entirely because, once again, a voting jurisdiction has relied on oft-failed, mission-critical computer systems, supported by private vendors, to run our public elections without backup plans, such as paper pollbooks in this case.

We also learn this week that the failures reported during and shortly after Nevada's primary elections in June were much worse than officials and the private voting system vendor admitted to the public when the state's new, 100% unverifiable touchscreen voting systems failed across the state. A new report from the Reno Gazette-Journal, based on public records requests, finds that complaints about candidates missing from ballots and selections already filled in on the screen for some voters, were far more numerous than previously known. Nonetheless, election officials in the state are standing by their vendor (Dominion Voting, which took over for Sequoia Voting Systems) and, as the paper notes, parroting back talking points almost word-for-word from the voting machine manufacturer in hopes of minimizing the massive problems as little more than "human error" that did not effect reported results. (Sound familiar?) Evidence reported by the RGJ strongly suggests otherwise.

Finally, with the 22-month federal requirement for retaining all ballots and other elections materials from the 2016 Presidential election ending next week (September 8th), a voting rights group now known to be allied with the Democratic Party has requested copies of all 2016 general election ballots from the state of Michigan. The massive, and expensive, public records request should prevent the ballots, in that state at least, from being destroyed for now, after an attempt to hand-count them by Green Party Presidential Candidate Jill Stein was ended by a Republican court challenge in 2016. That, despite Trump's stunning, if unverified, upset win in the state by just over 10,000 votes and some 75,000 ballots said to have contained no vote for President at all, according to the computer-tabulated results. No such records request has yet been filed in either Wisconsin or Pennsylvania, however, despite the fact that had just three votes at each precinct in those three states been recorded for Hillary Clinton instead of Trump, she, not he, would now be President of the United States...

• First, the latest in the quickening collapse of the Trump Presidency, as his darkest week gets darker by the day, now including the Chief Financial Officer of the Trump Organization reportedly being granted immunity to cooperate with federal prosecutors in their ongoing probe(s) of all manner of criminality by Donald J. Trump and his 2016 campaign;

• Hurricane Lane is already wreaking havoc in Hawaii as it very slowly sweeps near the islands, dumping catastrophic amounts of rain (35 inches in 48 hours on the Big Island!) in its wake; And, speaking of Hawaii, listeners answer our call in response to a question we had yesterday regarding a slang Hawaiian term used by Sen. Mazie Hirono's (D-HI) in cancelling her planned meeting with Trump's U.S. Supreme Court nominee Brett Kavanaugh, charging that "an unindicted co-conspirator in a criminal matter, does not deserve the courtesy of a meeting with his nominee --- purposely selected to protect, as we say in Hawaii, his own okole";

• Senator John McCain's family announced on Friday that he will no longer accept medical treatment in his year long battle against terminal brain cancer. We discuss, a bit, what that could mean for Trump's Supreme Court nominee in advance of Arizona's midterm primaries, with Gov. Doug Ducey (R), who would appoint McCain's successor, on the ballot next Tuesday. Also, we note, the President's appalling recent behavior towards the ailing Senator;

• In Ohio's 12th Congressional District, Troy Balderson (R) is finally officially declared the winner over Danny O'Connor (D) in the U.S. House Special election held nearly three weeks ago. Balderson is said to have won by a razor-thin 1,680 votes out of more than 200,000 votes cast on the 100% unverifiable touchscreen systems used on Election Day in the previously very Republican district. The margin is just over the amount that would have triggered an automatic, state-sponsored "recount". The two candidates will face off yet again in November's general election, when a number of factors, as we discuss, could tip the advantage to O'Connor;

• And, in Georgia, as we predicted on yesterday's BradCast, the Randolph County Board of Elections quickly rejected a proposal to shutter 7 of 9 precincts in the majority African-American county in advance of the November midterms. The scheme, which used the pretext of violations of the Americans with Disabilities Act (ADA), was proffered by a consultant hired by the County at the recommendation of GOP Sec. of State Brian Kemp. The plan had drawn national outrage in a year when Kemp is running for Governor against Stacey Abrams, who could become the nation's first female African-American chief of state;

Then, as the nation is justifiably distracted by a Presidency quickly spiraling out of control, his policies continue to move forward nonetheless, including this week's major new (if little covered) Trump EPA proposal to "repeal and replace" Obama's landmark 2015 "Clean Power Plan", which would otherwise reduce deadly and climate change causing emissions from coal-fired power plants with something the Administration is calling the "Affordable Clean Energy Rule". By the Administration's own admissions, the Trump scheme would lead annually to at least 1,400 premature American deaths over Obama's plan, and result in tens of thousands of news cases of respiratory illness each year.

CONRAD SCHNEIDER, former U.S. Dept. of Justice trial attorney and current Advocacy Director at the non-profit Clean Air Task Force and lecturer on Environmental Law and Policy at Maine's Bowdoin College, joins us to explain the dangers --- and coal-industry corruption --- of what he calls the EPA's new "Dirty Power Plan".

"Thousands and thousands of Americans would die prematurely under the Trump plan whose lives would have been saved under the Obama plan," Schneider warns. "And that's just the tip of a pyramid of health effects that include hospital visits, emergency room visits, asthma attacks, children missing school days and adults missing work as a result of the pollution that would occur here" in what he describes as "just the latest of [Trump's] efforts to try to resuscitate the coal industry."

But, he also cautions, "this political promise" to the industry "runs headlong into the requirements of the Clean Air Act" and so, Schneider predicts, the plan may well face problems in court, where he promises, "we'll be arguing that as much as they might want to throw a lifeline to coal, the Clean Air Act is not the appropriate venue to do that."

"What we are doing here is we are fiddling while the planet burns. We're fighting things in court, when we really don't have the time to waste," he tells me, as we discuss why it is that the Trump Administration's many attempts at reversing Obama Administration environmental protections --- from water rules, to chemical plant safety regulations, to the Keystone XL pipeline (to name only a few from the past few weeks) --- continue to be blocked, overturned or delayed, by one federal court after another...
