Guest: Eddie Perez, former Twitter official and longtime election expert...

It's amusing how, in April of 2023, not long after he purchased Twitter, Elon Musk was asked by Tucker Carlson about "New Twitter's" role in the 2024 election. His response: "The goal of new Twitter is to be as fair and even handed as possible. So, not following any political ideology."

That. Was. Darling! Just over a year later, Musk has leveraged his site almost entirely on behalf of Donald Trump, flooding his nearly 3 million followers with out and out false claims, often echoing the disgraced former President, including blatant, evidence-free lies about election fraud by Democrats.

That's in addition to the, at least, $100 million that the world's richest billionaire has plowed into political action committees to support a second term for Trump. One such Musk-funded group is called Future Coalition PAC. It is currently running a wildly cynical set of ads targeting Arab and Muslim voters in the battleground state of Michigan, claiming that "Kamala Harris Stands With Israel". The very same Musk-bankrolled group is simultaneously running ads targeting Jewish voters in battleground Pennsylvania with the message "Two-Faced Kamala Harris Stands With Palestine".

Another of Musk's PAC's recently created a website called Progress 2028, tailored to look like an official Harris Campaign page, while pushing decidedly false messages. ("Let's remove barriers for undocumented immigrants who are undocumented!") Apparently, all of that is legal. Though the group is also sending out false text messages, seemingly impersonating the Harris Campaign, pushing voters to the Progress 2028 website. That may not be legal.

But it was on behalf of yet another Musk dark money super PAC, the one he calls America PAC, in which he's invested at least $75 million, that, he announced over the weekend, that he will be giving away $1 million dollars to one lucky person each day --- so long as the person is registered to vote in a battleground state and signed his petition in support of the 1st and 2nd Amendments. Noted election law professor Rick Hasen, following the first big, lottery style check Musk handed out on stage Saturday during a rally in Pennsylvania, details how what Musk is doing is "clearly illegal vote buying". That's right. While using wild lies to make the evidence-free case that Democrats are committing election fraud, Musk is committing actual election fraud on behalf of Trump, each and every day between now and Election Day. (Anyone home, DoJ?)

His million dollar giveaways to encourage voter registration (a violation of 52 U.S.C. 10307(c), barring "offers to pay...either for registration to vote or for voting") began on the same day that Musk lied to attendees at a weekend rally in PA about Dominion Voting Systems somehow stealing the 2020 election for Joe Biden. (Similar lies cost Fox 'News' more than three-quarters of a billion dollars last year in a record settlement with Dominion to end the voting technology company's defamation suit against the rightwing propaganda outlet hours before the trial was to begin.)

We're joined today by the perfect guest to discuss all of the above and more. EDDIE PEREZ was formerly a longtime official at Hart-Intercivic, one of the nation's few major voting machine companies. He then went on to work as the chief of Twitter's Civic Integrity unit, back before Musk bought the social media site...when they still had a Civic Integrity unit! Perez is now on the Board of Directors at the nonpartisan, nonprofit, Open Source Election Technology (OSET) Institute and penned an oped for MSNBC last week headlined: "I ran Twitter's civic integrity team. Elon Musk has no idea how elections work."

In addition to debunking a number of Musk's false claims (no, Dominion doesn't even have voting systems in Philadelphia, for example!), Perez speaks to how Twitter (now ridiculously renamed X) has changed since Musk's takeover, turning it into a den of far-right conspiracy theories, hate speech and other dangerous nonsense.

"The degree to which the entire platform has obviously fallen off the deep end is incredible," he tells me. "I think it's fair to say Musk has thrown out the window any kind of commitment to having actual facts about the reality of how elections are run. What we have right now is basically a referendum on whether billionaires and oligarchs are going to shape the public's understanding of how elections are run. Are they going to do that by spreading false rumors and flooding the airwaves? Or are we going to listen to election professionals? And are we going to have standards and journalistic facts to educate the American people about how their elections are actually run with integrity?"

What would Twitter have done in the old days, before Musk purchased it, if someone like Musk had spread the disinformation he is now using the platform to spread? "Twitter took it seriously," says Perez. "What would have happened is there are different ways we would redirect users to actual, credible information. You do that not through censorship, not through taking things down. If you had a post that made an obviously false claim about some election process or voting, you might see a label on that Tweet saying, 'Here's some more information' [with links to credible sites, like the National Association of Secretaries of State]. They took it seriously. We're not going to slash and burn and taken people's posts down. But if we see an opportunity to send them to good information from trusted sources, why not do that? That helps voters. That helps democracy."

Perez also offers a number of pieces of advice on how listeners and voters can push back against the even larger avalanche of lies that is absolutely going to begin spewing forth shortly, in the event that Kamala Harris defeats Trump this year.

"They need to get their answers from their local elections office. You need to check your ballot before casting it. If you have a by-mail ballot and you haven't returned it yet, I recommend turning it in to a drop-box. And when you see inflammatory images [on social media and elsewhere], ask yourself, 'What's the story behind this? What's the context?' And find out where it came from" before blithely passing it along to others.

Harris and Biden on Labor Day; Netanyahu's endless war; Russia's latest assault on Ukraine; Also: The neck-and-neck horse race to Election Day...

Yup. We're back! And we've got lots to begin getting caught up with on today's BradCast. [Audio link to full show follows below this summary.]

Among the many stories reported and discussed on today's program...

  • Donald Trump's recent flip-flops on abortion, pandering on IVF and his desecration of Arlington Cemetery for political purposes. (By the way, Dems should embrace Trump's pandering promise to have the Government pay for anyone's fertility treatments. It's the GOP's first baby step toward universal healthcare/Medicare-for-All after all! Sounds great! Hold them to it!)
  • More than 10,000 hotel workers celebrated Labor Day by going on strike for better wages and working conditions across the U.S. Kamala Harris and Joe Biden campaigned together, speaking to a packed house of union workers in Pittsburgh on Labor Day, touting the most pro-union, jobs-creating Admin in history and promised to continue it under a Harris-Walz Administration. Trump, apparently unable to find any union workers who wanted to hear from him, stayed home yesterday.
  • More than a hundred thousand demonstrators took to the streets in Israel to protest against their far-right Benjamin Netanyahu-led government, demanding a deal for a cease-fire and the release of hostages in Gaza, after six of them were found dead in a tunnel beneath Rafah on Sunday. Twenty-three year old Israeli-American hostage Hersh Goldberg-Polin was among those found dead, just days after his parents spoke at the Democratic National Convention in Chicago, calling for a cease-fire and the release of more than 100 hostages who remain in Hamas custody following their horrific attack on Israel last October. As we have been arguing for months, however --- and as Israeli protesters are noted as mentioning in this Guardian piece --- Prime Minister Netanyahu is unlikely to ever agree to a deal that would effectively end Israel's war on Gaza, because it would also result in the end of his governing coalition. After that, he will have to face corruption charges filed against him from which he is currently immune...as long as he remains Prime Minister. If all of that sounds like a deal that Donald Trump hopes to win for himself in November, you are right. Tune in for much more on all of this today.
  • Meanwhile, on Tuesday, Russia launched another deadly, long-range missile assault on Ukraine, this time on a military academy and nearby hospital. More than 50 were killed, more than 200 wounded. That as Ukraine has finally taken possession of land inside Russia's Kursk region, including some 500 square miles along the Ukrainian border, and continues to plead with the U.S. and Europe to send weapons to help them defend themselves against the two-and-half-year onslaught by its imperialistic Russian neighbor.
  • Massachusetts is holding its Congressional and state legislative primaries today, just days after its Secretary of the Commonwealth William Galvin warned residents in the state about scam text messages being sent to some voters, falsely telling them that they are ineligible to vote. It is just one of the many dirty tricks we will be seeing between now and Election Day, the period of time that I am calling PHASE 1 of this year's general elections.
  • And, speaking of, Labor Day is a good moment to mark where things are in the horse race toward Election Day, following the unprecedented plot-twist of the last 6 weeks following Kamala Harris taking over at the top of the ticket. She has surged in the polling averages against Donald Trump --- particularly in the seven critical battleground states --- since then. But, she remains just barely ahead of Trump in the states she most needs to win. Her slim lead nationally and in the most critical battleground states she would need to get to 270 electoral votes, in a system that advantages Republicans, has resulted in, as Politico colorfully describes it today, "the equivalent of a knife fight in a phone booth."
  • Finally, Desi Doyen joins us today to begin catching up on much that we missed in climate and environmental news after being off just one week, including the role of climate action in the 2024 contest; new data on deadly extreme heat in the U.S.; China meeting its renewable electricity targets six years early; and the Klamath River, now finally running free again along the California/Oregon border after being dammed up for more than 100 years!...

There are just 140 days until the November 5 General Elections. Threats against them by adversaries both foreign and domestic are simmering and/or growing. We discuss some of them --- and much more --- on today's BradCast. [Audio link to full show follows this summary.]

Among our stories today...

  • Kari Lake loses yet again. This time, it's the Arizona state Court of Appeals which has, again, rejected her claims that the 2022 gubernatorial election was stolen from her when she lost it by some 17,000 votes to Democrat Katie Hobbs.
  • Unexplained mass texts, warning of voter intimidation, falsely suggesting they were sent by the Spartanburg County Elections Office during South Carolina's down-ballot primaries last week, should serve as a warning for this November's elections.
  • U.S. officials from the Office of the Director of National Intelligence are reportedly sending their own warnings, privately, to candidates in the U.S. who, they say, are being targeted with disinformation campaigns by foreign adversaries, including Russia, China and Iran.
  • And, in what should serve as yet another warning before November, a pro-Kremlin hacker group, said to be closely allied with Russia's intelligence services, reportedly took down the websites of a number of political parties and other institutions on the first day of voting in Europe's recent parliamentary elections.
  • New York's highest court on Tuesday rejected an appeal by Donald Trump to lift the gag order barring him from attacking witnesses, jurors and the family members of prosecutors or the judge in the hush money/election interference case in which the disgraced former President was recently found guilty of 34 criminal felonies.
  • And, speaking of, the Biden-Harris Campaign is finally using Trump's shameful court losses --- for both felony crimes and civil liabilities --- against him, in an aggressive television ad and mass emails to supporters taking him to task as a "convicted felon" as well as "a liar and a fraud". Of course, even now, Team Biden will have to overcome ridiculous reporting on the effort by the New York Times, whose headline yesterday (until it was changed) read "Biden Campaign Ad Paints Trump as a Felon". Um...."paints" him as a felon?! He is a felon!
  • After telling us for months that President Biden is so mentally debilitated that "he can't string two sentences together," Donald Trump supporters like Sean Hannity at Fox "News" are now working overtime to try and lower expectations for him in advance of next week's first Presidential debate.
  • Maryland's Democratic Governor Wes Moore on Monday pardoned about 175,000 convictions related to marijuana and paraphernalia possession over the years. The long-overdue pardons, following the state's full legalization of marijuana last year, will help tens of thousands of Black and Brown people who were disproportionately charged and convicted over the many decades of our failed, frequently racist "war on drugs". Moore's action follows President Biden's 2022 mass pardon of thousands charged under federal marijuana law and his request to state Governors to take similar action given that most cannabis related crimes were brought under state law.
  • Finally, Desi Doyen joins us for our latest Green News Report with news on hundreds of millions in the U.S. now (or soon) facing record heat from the Midwest to the East Coast and an early wildfire season out West; Similarly oppressive heat has been bearing down from Greece to the Middle East; Calgary is facing a serious water crisis in Canada; France's nukes are being shut down by cheaper renewable energy sources like wind and solar; And a major rail company must cough up some $400 million for unlawful trespass against a native American tribe...

We're covering 2024 election news in at least four different states on today's BradCast --- track conditions, not horse race --- and only one of those stories is particularly good news as GOP dirty tricks and voter suppression seem to be getting an early start this year. [Audio link to full show follows this summary.]

Among our main stories today...

  • Voters in Maryland, Nebraska and West Virginia headed to primary polls on Tuesday, with critical U.S. Senate and other races on the ballot. Noteworthy results and/or problem reports on tomorrow's program.
  • We first began reporting on this story early last month, when it seemed utterly ridiculous to even contemplate. It still does, frankly. Nonetheless, Ohio's wildly dysfunctional, partisan-gerrymandered Republican state legislature missed last week's deadline for a legislative fix to allow Joe Biden on the Buckeye State ballot this year. Ohio has a state law that requires Presidential candidates be officially certified by their party 90 days before the general election to be included on the state ballot. But the Dems' convention this year is just 74 days before the election. In past years --- for example, for Donald Trump in 2020 --- lawmakers simply changed the deadline to cure the problem as needed when conventions are held later in the Summer. This year, however, petulant state Republicans are demanding a pound of flesh from Democrats to make any such changes. And now, with last week's deadline past, its going to be even more difficult to do so. Tune in for the full --- and still ridiculous --- skinny.
  • Speaking of ridiculous, a rightwing activist in the state of Washington placed two Democratic candidates for Governor named Bob Ferguson on the ballot last Friday, just hours before the state's August 6th primary deadline. The state's longtime Democratic Attorney General, and front-runner to win the Governorship this year, is also named Bob Ferguson. And so the GOP's dirty tricks chaos for 2024 officially begins.
  • If they can't keep Democratic candidates off the ballot for no good reason, or add several candidates with the same name to the ballot to wreak confusion, Republicans still remember how to do it with good old fashioned voter suppression laws, like the newest one signed last week by Georgia's Republican Governor Brian Kemp.
  • Meanwhile, Democrats are still in court fighting back Republican voter suppression from years ago. On Monday, the newly liberal majority on the Wisconsin Supreme Court heard oral argument to reverse a ridiculous ruling by the high court's previous rightwing majority that bans the use of secure absentee ballot drop-boxes. That, even as they've been used for years without incident or fraud in the Badger State (or anywhere else, for that matter.) The hearing was encouraging, as even the defendants --- the bipartisan Wisconsin Elections Commission --- agree there is nothing in state law that actually bans their use. "The Commission fully agrees that drop boxes are permitted under Wisconsin statutes," said the Asst. AG representing them at the hearing. But it sure was amusing to hear Republicans argue in favor of stare decisis (respect for legal precedent and settled law) to keep the 2022 ruling in place from the rightwing partisan court just two years ago. Especially when one of the court's liberal justices at the hearing cited none other than U.S. Supreme Court Justice Sam Alito's majority opinion in Dobbs that overturned 50 years of Roe v. Wade legal precedent. Using Alito's precise language from the SCOTUS ruling, the WI Justice asked what Republican plaintiffs thought the court should do if they found the previous ruling to be "egregiously wrong".

A California three-way; Polls shift toward Biden; Republican scam artists pay the price; Trump rejected again in NY criminal fraud case, facing trouble for phony $175M bond in NY civil fraud case...

Keep hope alive. We've got a bunch of mostly good news stories for you on today's BradCast! [Audio link to full program is posted at the end of this summary.]

Among those stories today...

  • EVERY VOTE MATTERS: The great state of California has finally wrapped up its month-long tabulation and canvassing following its March 5th Super Tuesday primaries. And, in one race, there's a bit of a first-of-its kind surprise. Ever since 2012, the state has run a top-two primary system, where candidates from all parties run in the same primary race and the top two vote-getters, regardless of party, go on to compete in the general election. This year, however, in a U.S. House race for an open seat in the state's 16th Congressional District, there was an exact tie among the 2nd and 3rd place candidates, who each received exactly 30,249 votes. So, three candidates --- in this case, all Democrats --- will go on to the November general election and its anybody's guess who may win.
  • BIDEN RISING: After months of polls showing Joe Biden trailing Donald Trump in national polling, now that the general election is in sight with Americans finally beginning to understand that --- like it or not --- it will almost certainly be a Biden v. Trump match-up, the polls are finally turning in favor of the President. It's a fairly small shift, but a meaningful one, with a bevy of high quality polls almost all finding Biden either ahead of or tied with Trump. There are lots of caveats for these numbers, as discussed today (for example, it's only April and these numbers could change, and they don't include third-party candidates, etc.), but the general news should come as an encouraging turn of events for those who have been freaked out for months about Biden's performance against Trump in early polling.
  • RIGHTWING DIRTY TRICKSTERS PAY THE PRICE: Bufoonish rightwing clowns Jacob Wohl and Jack Burkman, who sent misleading robocalls to thousands of Black voters, lying to them about being arrested and more if they voted in the 2020 election, continue to pay a price for their dumb, offensive, dirty tricks. The pair will now have to pay as much as $1.2 million for their violations of civil rights laws in New York, according to a consent decree struck with the state's Attorney General Letitia James. That follows previous penalties for the pair of a more than $5 million fine by the Federal Communications Commission last year, and two years of probation plus 500 hours of voter registration to which they were sentenced in Ohio, another of several states where their scam played out.
  • MORE RIGHTWING DIRTY TRICKSTERS PAYING A PRICE: A woman named Aimee Harris who pleaded guilty to stealing a diary belonging to President Biden's daughter Ashley Biden before the 2020 election, when she sold it for $40,000 to rightwing dirty trickster James O'Keefe and his nearly-defunct fake "news" outfit called Project Veritas, was sentenced to a month in prison, three in home confinement, two years of probation and to return the money she raised from her crimes. Her partner in the scam, who was smart enough to cooperate with federal authorities, will be sentenced later this year, suggesting that criminal charges may still be in the offing for the disgraced Republican operative O'Keefe. His home was searched by the FBI after the crime initially came to light. Keep hope alive.
  • NOPE: Yet another New York appeals court judge has rejected yet another last-ditch legal attempt by Donald Trump to delay his trial on 34 felony fraud counts related to his hush-money payments to porn star Stormy Daniels to help him cheat to win the 2016 election. That criminal trial is now still set to begin with jury selection this coming Monday. In this latest court denial, the NY appellate judge dismissed Trump's motion regarding the partial gag-order against him --- expanded after he identified and attacked the daughter of trial Judge Juan Merchan on social media --- charging the order was somehow "unconstitutional". The bad news for the disgraced former President comes just one day after his bid for a change of venue for the trial was similarly denied by a different appellate judge.
  • YOUR MONEY IS NO GOOD HERE: Last week it appeared that Trump successfully avoided, for now, the seizure of his property as he appeals his liability in New York's $454 million civil fraud judgment against him. He was allowed to file a reduced bond for just $175 million with the state. As it turns out, however, there are a lot of problems with that bond, as secured from a sleazy California outfit known as Knight Specialty Insurance Company. A LOT of problems. More and more of which have been coming to light ever since NY A.G. Tish James, last week, informed the judge in the case that Trump's bond appears to be deficient. Among those problems: the surety company is not licensed to issue bonds in New York; the company does not have enough "capital and surplus" to meet state standards (or even cover the amount of the bond!); and the bond itself appears to suggest Trump is responsible for the $175 million dollars, rather than Knight, which is not an actual bond at all. A hearing on the matter is scheduled in NY civil court for April 22.
  • HAPPY ENDING: Finally, Desi Doyen joins us for our latest Green News Report, with news on what scientists suggest could be a terrifying hurricane season; good news for California's mountain snowpack; disturbing news about the Colorado River water supply; and some long-overdue good news from the Happiest Place on Earth...

On today's BradCast we mark the Presidents' Day holiday honoring the birthdays of both George Washington and Abraham Lincoln, with a quip from our friend Marcy Wheeler, independent national security journalist at Emptywheel, who tweeted: "Happy President's Day, America, a holiday celebrating the guy who said Presidents should not be kings and the guy who said insurrectionists should not be President." [Audio link to full show follows this summary.]

Among our stories covered in that spirit today...

FIRST: During a stunning, hastily called news conference over the weekend in Pakistan, a top official alleged that the nation's recent parliamentary election was littered with fraud. He claims to know because, he says, he was in charge of it in one of the country's largest provinces. The official now claims to be ashamed of what he did, "stabbing the country in its back", and announced that he was both resigning and turning himself in to law enforcement. "We converted losers into winners, reversing margins of 70,000 votes of independent candidates for 13 national Parliament seats," he said on Saturday, as fraud allegations stemmed from, among other things, Internet and cell service that was shut down on Election Day, as polling locations were moved at the last minute.

THEN: Contrast that potentially very real election fraud, announced by a real whistleblower who expects to be thrown in prison for his crime, with the endless phony allegations of "election fraud" by Donald Trump and his duped supporters following the 2020 election. Those claims, shamefully, continue all the way up through today. Just last year, when Trump was again asked for evidence of fraud in the 2020 election, he cited an oft-debunked documentary film released in 2022 called 2000 Mules. It was a film made by convicted (and Trump-pardoned) election fraudster Dinesh D'Souza in partnership with the long-ago discredited Rightwing Texas-based "election fraud" group called True the Vote, as headed up by a woman named Catherine Engelbrecht.

Trump told CNN that the group had "found millions of votes on camera, on government cameras, where they were stuffing ballot boxes.” We already knew all of that was a lie. The much-debunked 2000 Mules film actually showed no such thing to anyone actually paying attention to it. But last week, it was reported that True the Vote was forced to admit in a court filing to the state of Georgia --- which is suing the group for information on their so-called "whistleblowers", who they had claimed were insiders to massive Democratic fraud in 2020 --- that they actually have no such information. They have no documentation, records of any conversations, or even contact details for the so-called "whistleblowers" and "informants" they said they had built their case on in their phony "documentary".

FINALLY: On Friday, Russia's democratic hero and Kremlin opponent Alexei Navalny died in an Arctic penal colony. He had been a prisoner of Vladimir Putin's on trumped-up charges since returning to Russia in 2021 after an assassination attempt (stunning details of which are revealed "live" in the extraordinary 2022 documentary Navalny). His death at 47-years of age stunned supporters, many of whom had assumed he would one day unseat Putin to become "Russia's first George Washington", it's first truly democratic leader. Instead, as one lamented, he will be their "Martin Luther King", as a moral example that will inspire generations of freedom seeking Russians.

On Monday, Navalny's widow Yulia Navalnaya again demanded the return of his body, which she charges Russia will keep long enough to hide allow any traces of the nerve agent she believes was used to kill him to dissipate. She also vowed to continue his fight against the Kremlin.

World leaders, including President Biden, upon word of Navalny's death, condemned Putin. Our own disgraced former President, however --- a huge Putin fan --- waited for three days before issuing an unhinged rant on his social media in which, after mentioning Navalny's name, quickly became a lengthy screed about his own legal problems.

In a chilling --- if inspiring --- portion of the documentary film Navalny, when asked by the filmmaker for a message to supporters if he is killed upon his then-planned return to Russia. He says, in English, "My message is very simple: don't give up." The filmmaker then asks him to respond directly to the camera in Russian.

"Listen, I've got something very obvious to tell you," Navalny quips. "You're not allowed to give up. If they decide to kill me, it means that we are incredibly strong. We need to utilize this power --- to not give up, to remember we are a huge power that is being oppressed by these bad dudes. We don't realize how strong we actually are."

Navalny then adds a familiar quote: "The only thing necessary for the triumph of evil is for good people to do nothing. So don't be inactive."

Putin is expected to win his fourth term as Russia's leader in Presidential "elections" next month. He faces no real opposition given that any such candidates have now been either jailed, killed or forced to live in exile.

Catching up after conquering COVID (again!); Also: DeSantis drops out, 'kisses the ring'; SCOTUS sides with Biden on border (for now); Callers ring in for first time this year...

Okay. I'm back. COVID free! (Again!) Hopefully for good this time, as discussed --- along with many other things --- on today's BradCast. [Audio link to full show follows this summary.]

Among the news we begin to get caught up with today after my rebound sidelining last week...

  • My surprise COVID rebound last week and lessons learned in the bargain. If the news out of the federal courtroom in New York today in the second E. Jean Carroll defamation trial is to be believed, our disgraced former President may have his own new infection again soon.
  • After, just last week, condemning those Republicans who "kiss the ring" of Donald Trump in order to save themselves, Florida Governor and failed 2024 Presidential candidate Ron DeSantis dropped out of the race on Sunday. And, yes, he kissed the ring in hopes of saving himself for 2028 by endorsing Donald Trump. DeSantis also used a fake quote from Winston Churchill when doing so, just so he could fail as spectacularly as possible on his way out the door.
  • New Hampshire's first-in-the-nation primary is Tuesday and former South Carolina Gov. Nikki Haley is the last GOPer left in the race other than the twice-impeached, four-time criminally indicted former President. If one believes the pre-primary polling, the race will be over by Wednesday. And the guy who was, literally, praising the idea of a "strongman running the country" during rallies in New Hampshire over the weekend, and telling supporters that U.S. Presidents must have complete immunity to commit any and all crimes, will be on a glide path toward becoming the 2024 Republican nominee for President of the United States.
  • While the DNC has not authorized a Democratic Primary in New Hampshire this year --- choosing instead to make South Carolina's February 3 contest the first official one for the Dems --- that hasn't stopped a write-in effort for Joe Biden in New Hampshire UNsanctioned Democratic Primary, in which Biden does not appear on the ballot. It has also resulted in what appears to be the first (known) dirty trick of 2024. NH voters began receiving robocalls over the weekend from "Joe Biden" instructing them not to vote at all on Tuesday. The incident is being investigated by law enforcement, but may give us an idea of what the abuse of Artificial Intelligence may have in store for us in this unprecedented 2024 election season.
  • On Monday, the U.S. Supreme Court --- in a 5 to 4 ruling --- sided with the Biden Administration's Border Patrol and said that they may, in fact, remove razor-wire placed on the Rio Grande by Texas Governor Greg Abbott, after Abbott's actions have already resulted in the death of a mother and her two young children drowning in the river. But four Justices (Thomas, Alito, Gorsuch and Kavanaugh) apparently have no use anymore for the U.S. Constitution's Supremacy Clause which gives deference to federal law over state law.
  • Finally, after weeks away from our flagship station (KPFK in L.A.) over the holidays and then during our multiple brushes with COVID, we were finally live in studio again and able to open the phone lines today to listeners on anything they wanted to discuss. Even if one of them felt like they had to lie to get on the air to say it.

Several victories for pro-democracy forces in MN, TX; FL Guv's registration hacked in voter database; VT Sec. of State demands correction from SCOTUS following Kavanaugh's error-filled WI opinion...

As I discuss near the top of today's BradCast, we are now in what amounts to a Cold Civil War on Democracy in this nation. The greatest direct threat we have ever faced to our Constitutional Republic since the Civil War is now playing out in our ongoing election. [Audio link to show is posted below this summary.]

As it turns out, that threat to what Joe Biden describes as "the soul of our nation", does not come from a foreign power, but from the President of the United States himself and his party of henchmen and supporters who are now attacking the very core of our Republic: the right to vote and to have that vote counted as cast. That right is now under direct assault in a way not seen since the Jim Crow era. And while the GOP has been using the guise of preventing "voter fraud" to wage similar battles in recent years, they aren't even trying to hide their direct assault on democracy anymore. They are simply using every (so far, peaceful) means possible --- legal and extra-legal --- to try and prevent legal voters from voting and lawfully cast ballots from being counted.

Unfortunately, they have packed enough stooges onto their stolen U.S. Supreme Court at this point, that they may pull it off...unless the pro-democracy forces simply overwhelm them between now and the close of polls next Tuesday night. Get busy, people. Only the fate of the Republic and...yes, human civilization, as Desi Doyen highlights yet again in our Green News Report today, are at stake.

Among the stories reported on today's show, as our trench warfare coverage continues...

  • Good news for democracy in Minnesota! A federal judge has ordered a mercenary contractor hiring armed para-militia to stalk polling places to stand down after violating federal voter intimidation laws. The company, Atlas Aegis, must also reveal who has been funding their program. The case is a victory for plaintiffs including the Minnesota chapters of the Council on American-Islamic Relations and League of Women Voters, as well as the group Free Speech for People (FSFP) whose lawyers brought the case. We spoke with FSFP attorney Ron Fein last week on the show, the day after the voter intimidation suit was filed in federal court;
  • Good news for voters in Texas! A Trump-appointed federal judge has found Gov. Greg Abbott's exemption for voters and pollworkers to his statewide mask mandate to be in violation of the Voting Rights Act. Masks must be worn inside of all polling places across the Lone Star state of today's ruling. The victory comes not a moment too soon, after several polling officials have already become sickened, poll sites were closed due to sick workers, and maskless poll watchers were said to have been using their presence to intimidate minority voters. That, in a state where the Republicans who have long controlled it went all the way to the Supreme Court to deny almost all voters under the age of 65 the right to request an absentee ballot due to fear of the spiking coronavirus pandemic. It's also another victory --- and a reversal of fortunes --- for the good folks at FSFP, including Senior Counsel Courtney Hostetler, who spoke with us on the show about their case in September, when its outlook then appeared grim;
  • More good news for democracy in Texas! A $31 million effort to improve access to the polls in the nation's third-largest voting jurisdiction, Harris County, which includes Houston, appears to have paid off big time. NBC News reports that more voters have now cast ballots there during early voting than were cast in the entire 2016 election. The increased turnout is thanks to expanded and innovative voting options, such as Early Voting sites that stay open later, some that stay open for 24 hours, and drive-thru polling places. The County's stunning turnaround in a state with notoriously low voter turnout comes after Dems won every countywide office in 2018, increased the elections budget from $4 million under GOP control to $31 million now, and with the hiring of innovative, 33-year old County Clerk Chris Hollins in late summer. Naturally, state Republicans have been challenging virtually every innovation to make it easier for voters to vote in the state's largest county. And while Gov. Greg Abbott has succeeded in limiting ballot drop-off locations to just one per county (from a dozen previously planned for sprawling Harris County, which is larger than Rhode Island), GOP attempts to block drive-thru voting have been denied by the state's all-Republican Supreme Court. Another new case was filed by Republicans this week, however, seeking to actually invalidate the votes of more than 100,000 voters who lawfully cast drive-thru votes during Early Voting.
  • On Monday, the U.S. Supreme Court's issued an appalling ruling that blocks tens of thousands of lawfully cast mail-in ballots postmarked by Election Day from being counted in Wisconsin if they arrive after Election Day due to, for example, slowdowns in U.S. Postal Service delivery by Trump's new Postmaster General. Criticism from legal experts and voting rights advocates of the embarrassingly error-riddled concurring opinion filed by GOP operative turned GOP activist Justice Brett Kavanaugh was swift. We discussed that factually deficient and laughable concurrence with Slate legal journalist Mark Joseph Stern in detail on yesterday's show. Among the egregious errors in the opinion was Kavanaugh's citing of Vermont's election laws. The Sec. of State of Vermont has now written a letter to the Court in response, demanding that the opinion be corrected to include actual facts about the state's voting laws, instead of the phony claims Kavanaugh made as he works toward using his lifetime appointment on the Court to steal this year's election on behalf of the man who appointed him to it;
  • Finally, as mentioned, Desi Doyen joins us for our latest Green News Report, as a record fifth hurricane in a single season slams storm-weary Louisiana today; Trump opens the nation's last protected tropical rain forest to commercial logging; China and Japan vault ahead of the U.S. in their pledges to reach net-zero carbon emissions; and the case is made for Joe Biden to expand the Supreme Court if we are to have any chance of combating our swiftly worsening climate crisis.

Last week, Trump's new "sham" nominee to the U.S. Supreme Court appeared to not know if voter intimidation was even a violation of federal law. This week, as we report on today's BradCast, Trump and his henchmen find themselves facing a federal lawsuit over exactly that. [Audio link to show follows below.]

Among the many stories covered on today's show...

  • First up, Joe Biden has finally stated his position on expanding the U.S. Supreme Court. That position? A bi-partisan commission to study reforms for the federal court system, to offer recommendations after six months...if Biden wins the White House and Dems take the Senate. We discuss what is probably a pretty smart political position for the former VP to take right now, considering that corporate media can't stop using the words "court packing" to describe long-overdue reforms after years of actual court packing by the GOP.
  • Speaking of which, the Senate Judiciary Committee on Thursday, led by South Carolina's increasingly vulnerable Sen. Lindsey Graham, broke their own rules today to ram through the nomination of Amy Coney Barrett without a single Democrat present, after Dems refused to allow a quorum for today's vote. If she is confirmed by the full Senate on Monday, as Republicans currently plan, it will be one of the shortest confirmation processes and the closest to a Presidential Election Day for the seating of a Supreme Court Justice in the nation's history. That, after just 4 years ago Republicans blocked a Democratic SCOTUS nominee entirely for a full year, while vowing that a new Justice should never be seated during a Presidential election year. Republicans also changed the rules in the middle of that game as well, when they killed the filibuster for SCOTUS nominees after failing to get enough votes to pack Neil Gorsuch, Trump's first nominee, onto the Court. Over the past five years, Republicans have succeeded at completely delegitimizing the U.S. Supreme Court.
  • The GOP's already-stolen Supreme Court on Wednesday sided with Alabama's dishonest, lying, somewhat deranged, unlawfully Twitter-blocking, Republican Sec. of State John Merrill to nix curbside voting in counties that wished to use it to help keep disabled voters safe during the COVID crisis, as recommended by the CDC and approved the U.S. Dept. of Justice as a way to prevent violations of the Americans with Disabilities Act (ADA). All three remaining Democratic appointees on the Court dissented, siding with the U.S. District Court and federal appeals court which, after a three day trial, found the now-scrapped accommodation to be a "modest" and "reasonable" way to avoid a potentially fatal illness for some voters.
  • In recent days, Democratic voters in Florida and several other battleground states have been receiving threatening warnings via email, instructing them to "Vote for Trump or else!" The body of the emails, which appear to come from a Trump-supporting extremist group, cite the recipient's name and addresses and promise to "come after you" if they do not change their party affiliation to Republican and vote as instructed. Incredibly, and with zero supporting evidence, Trump's "partisan hack" Director of National Intelligence John Ratclifffe hastily convened an absurd press conference on Wednesday night to declare that Iran was actually behind the threatening emails to Democrats. He claimed they were designed to "damage President Trump". He also muttered something about Russia. But, again, no actual specifics and no actual supporting evidence for his claim that both countries accessed voter registrations systems to obtain the data (most of which is publicly available without actually hacking into election-related systems). Suffice to say, I believe absolutely nothing from this Administration at this point, about any of it, and, short of independently verifiable information, neither should you.
  • Then, we are joined by the Legal Director at Free Speech for People, RON FEIN, to explain the federal lawsuit his non-partisan good government organization filed on Wednesday on behalf of the Latino civic engagement group Mi Familia Vota Education Fund and several voters, charging that Donald Trump, Attorney General Bill Barr and Acting Sec. of Homeland Security Chad Wolf are violating federal laws against voter intimidation.

    The complaint [PDF] and accompanying request for a preliminary injunction, as Fein details, alleges defendants have exhibited a pattern of intimidation against voters that violates the Voting Rights Act of 1965, the Ku Klux Klan Act of 1871, and the First, Fifth, and Fourteenth Amendments to the U.S. Constitution.

    As FSFP explains in their announcement of the suit, the complaint is "based on the defendants’ violent suppression of public protests opposing police brutality, the encouragement of white supremacist 'vigilantes,' threats to send 'sheriffs' and other law enforcement to the polls, the undermining of mail-in voting, and the rejection of the peaceful transfer of power, which, the complaint alleges, constitute illegal voter intimidation."

    Fein offers more details on what he describes as a "threatening pattern of conduct stretching over the past few months," that has resulted in the suit. "People understand what it means when the President talks about sending law enforcement...When he tells the Proud Boys to 'stand by,' people understand what that means...This is not one piece of conduct, one isolated statement. This is a months-long pattern that the President and his top officials have been involved in, that has the purpose and effect --- hopefully not successfully --- but it certainly has that effect, of intimidating people from voting either in person or by mail."

    Explaining the relief sought by the complaint, he tells me: "First of all, we want relief prohibiting the defendants from deploying armed federal agents at or near polling places; from ordering federal agents to block the delivery of ballots or interfere in the counting of ballots; from taking any actions that could limit with the speed or reliability of mail delivery. And specifically to Trump, prohibiting him from encouraging his supporters to bring weapons to polling places, block access to polling places, to question voters, or from using official government public communications channels --- which now includes his Twitter account --- to suggest that lawful votes will be scrutinized or challenged."

    He also discusses a somewhat related federal case also filed this week by FSFP on behalf of the Minnesota chapters of the Council on American-Islamic Relations and League of Women Voters against a private mercenary contractor who has posted job listings, reported recently by the Washington Post, seeking to hire and deploy armed former special ops troops to patrol polling sites in the state.

On today's BradCast: The endless court battles continue as Donald Trump and the Republican Party continue their fight to make voting harder and more dangerous during the worst pandemic in a century. But we've got mostly good news today on those fronts. The news on the climate front today, however, is not nearly as encouraging. [Audio link to full show is posted below summary.]

Among the many election and/or climate-related stories covered on today's show...

  • For the first time in its 175-year history, Scientific American magazine has made a Presidential endorsement. In this case, for Joe Biden. We explain why;
  • That endorsement comes on the heels of another recent endorsement for Biden by the BlueGreen Alliance, a coalition of major labor and environmental groups. It was the first endorsement of any public candidate in the coalition's 14-year history. The group includes the United Steelworkers, the Utility Workers Union of America, the United Association of Plumbers and Pipefitters, and four other unions with the Sierra Club, the League of Conservation Voters and the National Wildlife Federation;
  • Despite record wildfires up and down the West Coast, two hurricanes that slammed the Gulf Coast just over two weeks ago and another one set to do the same over the next 24 hours in a record storm season, network and cable TV outlets have been woeful in their coverage of climate change, which has made all of these emergencies far worse and much more damaging. Several recent Media Matters analyses finds plenty of coverage of the fires across the networks and cable stations, but barely any mention, in the hours of coverage, of why all of this is now happening. That, just weeks out from the most critical election in our nation's history, pitting a climate change denying Republican against a Democrat who is proposing $2 trillion dollars to combat the existential crisis while putting millions back to work creating clean, renewable energy;
  • Good news for election officials and voters alike in the battleground state of Wisconsin on Monday night, as one Justice on the state's rightwing-majority Supreme Court decided to join the court's liberals to put an end to absentee ballot chaos the court created last Friday. Then, a 4 to 3 decision by the court's rightwingers ordered elections officials in the state's nearly 2,000 voting jurisdictions to immediately stop sending out absentee ballots to allow the court more time to decide if the GOP-backed Green Party Presidential ticket should be added to the ballot after the Wisconsin State Election Commission declined to do so weeks earlier. On Monday, one "conservative" joined the liberals in another 4 to 3 ruling that finds the Greens ineligible this year in the Badger State after all. State election officials are greatly relieved, as some 380,000 ballots had already gone out, and there would have been no time to re-design, re-print, re-test and re-mail as many as one million absentee ballots before both state and federal statutory deadlines this week for doing so. Both the Green Party and a separate attempt to qualify for the ballot in WI by rapper Kanye West were aided by Republican lawyers and activists in a state which Trump is said to have won in 2016 by less than one percentage point;
  • Meanwhile, both bad and good news for voters in battleground Ohio. Republicans in the state legislature on Monday voted down a proposal from a bipartisan group of election officials to cover the postage for absentee ballots. One state lawmaker who voted against the proposal (and, thus, in favor of a poll tax) from the comfort of his home during the Controlling Board's virtual online meeting, did so just one hour after reportedly learning he'd tested positive for the coronavirus;
  • In (mostly) better news for voters from the Buckeye State, a Franklin County Court of Common Pleas judge has determined that the use of absentee ballot drop-boxes does not violate state election laws. Last month, OH's Republican Sec. of State Frank LaRose issued a directive that only one secure drop-box could be used, per county, outside of County Boards of Elections. LaRose claimed state law was unclear on the matter and that the state's GOP Attorney General hadn't responded to his request for a legal opinion. So LaRose, citing the Trump Campaign's ongoing suit to block drop-boxes in battleground Pennsylvania, decided the matter on his own. State Dems sued, the state GOP intervened to oppose, and now a judge has decreed that as many drop-boxes as counties which to use is just fine according to state law.

    However, LaRose, who in a parallel case in federal court claims he is not against the use of drop-boxes, so long as the law allows it, has said he will not allow it unless he is actually ordered by the court to do so, and his office suggests they plan to appeal the state judge's ruling. LaRose, sadly, is just another hypocritical, dishonest Republican Sec. of State in Ohio, and another reminder that nobody should simply be "trusted" in an election system from any party. American elections are supposed to be built on public oversight for checks and balances, not on "trust". That public oversight is made more difficult every day by election officials who continue to use computer voting and tabulation systems that are difficult, if not impossible, for the public to oversee;

  • And in the battleground state of Nevada, where Donald Trump held another COVID super-spreader campaign event to help make more of his supporters sick --- and possibly kill them --- on Sunday, the President took to Fox and Friends today to offer a completely farcical claim about how the state's Democratic Gov. Steve Sisolak is "in charge of the ballots" and using that power to rig this year's election. Among the several problems with Trump's pathetic, whiny, evidence-free charge: the state's chief election official is Republican Sec. of State Barbara Cegavske, who oversees and certifies all election results in the state.
  • Finally, Desi Doyen joins us for our latest Green News Report as climate change-fueled Hurricane Sally approaches the Gulf Coast (with several more behind her); record climate change-intensified wildfires rage out of control in the West; Biden blasts Trump as a "climate arsonist"; and Trump tells California officials that, like COVID, climate change will just go away...

Foreign and domestic election interference continues. So does our effort to help you make sense of what's actually going on...

We've got a lot to get to on today's BradCast, as voters in Massachusetts go to the polls today with a couple of very interesting primary races (results tomorrow!), and as the rest of us are now counting the days (63 of them), until general Election Day, with both hope and trepidation. [Audio link to show is posted below summary.]

Among the mountains o' stuff covered on today's program...

  • After years of our reporting on the very successful, perhaps irreversible, decades-long effort by the Right to brainwash its followers, we open today with a few thoughts about a similar, if not quite as successful (though it's getting closer), effort to brainwash those on the Left. That effort to brainwash the Left, like the scheme on the Right, is also carried out by folks on the Right or those who support them. (And yes, that means we have a few words today about the still-misreported facts regarding the Hillary/Bernie race from 2016);
  • We have more evidence of attempts to manipulate the Left in today's announcement from Facebook that, based on a tip from the FBI, the social media outlet has shut down several fake accounts created to support a Russia-related propaganda scheme targeting the Left in hopes of undermining Joe Biden and Kamala Harris. The operation reportedly included a phony media outlet calling itself "Peace Data", in hopes of appealing to progressives in advance of this year's election;
  • Information of that sort, as we discuss, is --- or should be --- useful to voters. Nonetheless, with just over two months until Election Day, with Donald Trump's top intelligence officers having recently warned that Russia is taking active measures, once again, to undermine the Presidential election in support of Trump, his recently-appointed Director of National Intelligence John Ratcliffe notified Congress over the weekend that he will no longer offer in-person briefings to lawmakers regarding foreign attempts to interfere in the election. The claim, offered by Trump himself without facts to back it up, is that members of Congress were illegally leaking certain information from the intelligence community, and that the information leaked was also "wrong". No evidence was given to support that charge, and while Trump claimed the decision to end intelligence briefings to Congress was made by him and Ratcliffe, evidence suggests that it was, instead, a directive from Trump himself. For some reason;
  • Speaking of the November 3rd election, the dirty tricks are now underway, as revealed by a new robocall to some Democratic-leaning Michigan voters falsely warning that signing up to vote by mail will result in voters contact information being added to a database for tracking down arrest warrants, credit card debt collection and "mandatory vaccines". None of that is true. Though you should expect much more of it in the weeks ahead;
  • Also in Michigan, the state's Democratic Secretary of State Jocelyn Benson, recently won a court case filed by rightwingers attempting to prevent her from sending absentee ballot applications to all of the state's 7.7 million voters. The ruling --- in a state which Trump is said to have won by just over 11,000 votes in 2016 --- comes in the wake of his misfired threat to withhold federal funding from Michigan in a tweet in which he falsely claimed the "rogue Secretary of State" was planning to send out actual ballots (as opposed to applications) to all voters;
  • And while Trump and his minions have been suing in state after state in (usually failed) efforts to make voting more difficult during the global pandemic that he failed to control --- even attempting to block the use of secure absentee ballot drop-boxes in key battleground states like Pennsylvania --- another newly elected Democratic Sec. of State, Jena Griswold in Colorado, announced today that her state will offer "at least 368 mail ballot drop boxes for the General Election, an increase of 49% since I was elected in 2018!";
  • Also today, a somewhat bizarre comment from a reader/listener in response to our coverage yesterday of L.A. County's disastrous, unverifiable new touchscreen voting system, in which the commenters offers several odd allegations amid of my nearly 20 years of critical coverage of e-voting and asks "whose side are you on?";
  • Finally, Desi Doyen joins us for our latest Green News Report in the wake of catastrophic week for the climate and the Republican National Convention...

Guest: APWU's Mark Dimondstein; Also: Progressive activist reportedly wins Dem U.S. Senate nomination in TN after being outspent 250 to 1...

On today's BradCast: Never mind the pre-election polling numbers you are hearing. Given the way Donald Trump and his Administration and acolytes around the country are actively working to undermine this year's November 3rd general elections, you'd make a mistake to place Joe Biden's odds of being declared the winner at any better than 50/50 at best at this point. Disturbing comments from our guest today only underscore that concern yet again. [Audio link for today's must-listen show is posted at bottom of article.]

But first up today --- after quick news that, contrary to yesterday's reporting, a second COVID test for the Governor of Ohio Mike DeWine appears to show he is actually, and happily, negative for the coronavirus --- we cover the stunning election news out of Tennessee on Thursday night. If the computer-tallied results of the Democratic Primary yesterday for U.S. Senate there can be believed, Marquita Bradshaw, a progressive African-American environmental activist supporting Medicare for All and the Green New Deal, has won the party's nomination to run for the seat being vacated by TN's longtime GOP Senator Lamar Alexander this November.

Bradshaw's campaign raised less than $10,000, according to FEC records, yet she reportedly defeated the Dem establishment-backed James Mackler who, with the support of Chuck Schumer's Democratic Senatorial Campaign Committee, had raised more than $2 million for his campaign while only managing to come in THIRD in yesterday's contest! That's right, Bradshaw was outspent 250 to 1, but appears at least, to have easily defeated both Mackler and everyone else in the race according to the still-unofficial results.

Unless an error in tabulation is discovered, Bradshaw will go on to challenge Trump's former Ambassador to Japan, Bill Hagerty, in November. He overcame a serious challenge in a contest that placed the Trump and Mitch McConnell-endorsed Hagerty against the Ted Cruz and Rand Paul-endorsed Manny Sethi. The far-rightwing Hagerty recently resigned from the board of a brokerage firm after they expressed support for the Black Lives Matter movement. He will now run against a black activist in TN, which has not elected a Democrat to the Senate since 1990. But, if Bradshaw could win after being outspent 250 to 1, who knows what may happen in November?

That said, the GOP dirty tricks this year are already underway. According to an email from our friend Tom Sullivan, a longtime blogger at Digby's Hullabaloo from the closely divided battleground state of North Carolina, some Democratic voters are now reportedly receiving phone calls purporting to be from the Board of Elections, falsely telling them they "no longer need to request an absentee ballot." That is completely false. If NC voters wish to vote by mail this year in the Tarheel State, they WILL need to request an absentee ballot --- though they can deliver their ballot by hand at county Boards of Elections, or even vote in-person later if they change their mind.

Dirty tricks from Republican activists, sadly, is nothing new, but bad enough. Especially in NC! But when the dirty tricks are coming from inside the White House itself, that is a matter of entirely different proportions. Shamefully, even as the President of the United States continues to make false claims about absentee voting (after fraudulently doing so himself!), Donald Trump's recently appointed Postmaster General, Louis DeJoy, is now undermining the U.S. Postal Service itself in advance of what will be, by far, the largest Vote-by-Mail elections in all 50 states in the nation's history. The Republican Trump mega-donor DeJoy, with no previous USPS experience, issued several directives upon taking office in June that have resulted in the slow down of mail delivery. And while both DeJoy and other leadership at the 250-year old Postal Service (whose first Postmaster General was Benjamin Franklin) have claimed the new directives are not aimed at slowing down mail or doing Trump's bidding to undermine absentee voting, our guest today, MARK DIMONDSTEIN, President of the American Postal Workers Union and Postal Service worker since 1983, charges that is exactly what is happening.

The new directives, purportedly meant as efficiency measures to curb overtime costs, "can't do anything but slow down mail," says Dimondstein. "Our understanding is that it's really happening all over the country, and it needs to be reversed. It needs to be stopped." The APWU chief, representing more than 200,000 postal workers, charges the new measures, which direct carriers to leave mail behind at sorting stations if waiting for it will delay their route, "runs counter to our DNA. Our DNA as a postal worker is to serve the customer, leave no mail behind, treat it as if it is our own."

The USPS is in crisis mode now, as coronavirus lockdowns have severely curbed regular mail delivery --- though package delivery has increased, he tells me, helping to mitigate that loss somewhat. The Post Office is funded entirely by postage, not tax payer dollars, but its Republican-dominated Board of Governor's, he says, unanimously voted to request a $25 billion emergency bailout from Congress earlier this year. While almost every other company in the nation has received crisis funding during the pandemic, Republicans in Congress and the White House have continued to block the request. "The Post Office does not run on tax dollars in normal times, it runs off the revenue. So if the revenue is not there, then the Post Office will run out of money," Dimondstein warns. "It's not a question of if, it's a question of when."

He goes on to respond to a host of questions, including on the safety (and necessity) of Vote-by-Mail and the President's attempts to undermine it. "Vote-by-Mail is nothing new for postal workers. We've been doing this for generations. Military personnel have been voting by mail since the days of the Civil War...And of course now, with the pandemic, it's a question of access to the ballot box at all for tens of millions of people who want to vote safely," he tells me, noting ironically that "Trump trusts us to deliver his mail-in ballot!"

We discuss what he describes as the "tremendous impact of COVID on the workforce," which has seen 40,000 workers quarantined and more than 2,500 who have tested positive, and why Donald Trump has had it out for so long --- even before the coronavirus --- for the Postal Service, which Trump has called "a joke". Contrary to popular speculation, Dimondstein doesn't believe Trump's antagonism is due to his dispute with Washington Post owner Jeff Bezos, CEO of Amazon which works closely with USPS. He believes it's based on little more than interest by Trump and other corporatists to privatize and profit from the massive customer base served by the USPS every day at all 160 million addresses across the country, six days a week.

"The idea that the Postal Service is a joke is an insult to every dedicated postal worker. 600,000 plus strong," says Dimondstein. "Out here in this pandemic, on the front lines, can you imagine how we all feel hearing that? And it's an insult to the customers. 91% of the people in this country, in the latest Pew Research Poll [support USPS]. The Postal Service always rates the highest. This year, it was the highest ever, I think out of a deeper appreciation for the role of postal workers in this pandemic."

"The country just laid to rest John Lewis," Dimondstein notes. "His historic role in this country, courageously done, was the question of voting rights for African-Americans in the South of the United States. And it was courageous. He was almost beaten to death. Voting rights now is right here at the epicenter of what's going on right now, and the Post Office is right in the middle of this thing. Because without Vote-by-Mail, people aren't going to be able to vote. It's as simple as that. Tens of millions of people, from seniors to young people, just will not be able to vote during this pandemic if they don't have good access to Vote-by-Mail and don't have the states step up. We have to worry about some of these states that don't want people to vote. That's the reality."

When asked how long before Election Day Dimondstein would advise voters get their absentee ballot into the mail to ensure it arrives n time to be counted, he recommends that if you haven't mailed it by the Tuesday or Wednesday before Election Day, you'd be wise to try and drop it off in person at your precinct or local County headquarters. (Check your own jurisdiction to find out what is allowed, as the laws are different in each state and sometimes each county or municipality.)

Guest: Dr. William 'DocDawg' Busa on a mysterious rightwing PAC spending millions to support a progressive in NC and GOP's pretend love for Sanders; Also: Bernie surges nationally, Trump lies in NH...

As usual, we cover far too much on today's BradCast, as New Hampshire voters head to the polls for their first-in-the-nation primary today. Full reported results from NH tomorrow, of course. [Audio link for today's show is posted below.]

Among those too many things covered today...

  • We start with some common sense news out of Nevada, where state Democrats, after the Iowa Caucus disaster, have decided to use hand-marked paper ballots for early voting in the state's upcoming February 22nd caucuses. However, they will still be relying on a vulnerable, online iPad tool to record sign-ins (albeit with paper backup, so there's that);
  • On Monday night, the eve of the New Hampshire primary, Donald Trump rallied in the Granite State by lying to supporters about voter fraud there, and by taking a small page from the disgraced Chris Christie's New Jersey "BridgeGate" scandal. Trump's Secret Service detail, according to campaign officials, made it difficult for Democratic candidates and their supporters to get around the state's largest city. Given that Republican Senators recently gave a thumbs up for Trump to cheat in the 2020 election with their "not guilty" votes at the end of last week's Impeachment Trial, nobody should be surprised he is now doing so;
  • But there was some very good news for Bernie Sanders from a national Quinnipiac poll on Monday night, revealing the Vermont Senator vaulting into first place ahead of Joe Biden for the first time. We also review a number of other interesting findings for the survey suggesting good news for Sanders, along with a warning that those are national numbers, in a nation that runs state-by-state elections instead. Just ask Hillary Clinton;
  • As he gains momentum, Sanders is also being forced to defend his identity as a "democratic socialist" and his support for programs such as Medicare for All and the Green New Deal. Republicans (and even some Democrats) are hoping to disparage Sanders with those charges, from which he does not shy away;
  • At the same time, Trump and friends and family are attempting to sow discord among Democrats by claiming that the DNC is rigging the election against Sanders, hoping they'll convince Sanders' supporters to sit out 2020 if he is not the nominee;
  • At the same time, Republicans in South Carolina are reportedly urging their own supporters to vote for Sanders in the state's upcoming February 29 primary, since the state GOP cancelled their own primary there as a gift to Donald Trump. The theory, also floated publicly by Trump himself, is that they'd love to run against Sanders this November because, they'd like you to believe he will be easy to beat;
  • And, just to the north, a mysterious group calling themselves the "Faith and Power PAC" is playing a similar game, by spending nearly $2.5 million to support a progressive state Senator for the Democratic U.S. Senate nomination in North Carolina's March 3rd Super Tuesday primary. The new group appears to be tied to Republicans and the candidate they are running ads for, state Senator Erica D. Smith [pictured above right], is currently running behind the centrist D.C. Dem-supported Cal Cunningham in the contest to win the Dem Senate nomination to run against vulnerable Republican incumbent Sen. Thom Tillis this fall. The TV spot purporting to be on behalf of Smith, highlights her support for Medicare for All, the Green New Deal, and other progressive policies making her "one of us", as the ad claims. (We interviewed Smith on The BradCast late last year, as she was demanding hand-marked paper ballots for North Carolina);
  • We're joined today by North Carolina's DR. WILLIAM BUSA of the progressive political data consulting firm EQV Analytics to discuss all of the dirty tricks in the Carolinas. Busa, who previously worked for state Senator Smith and writes as "DocDawg" at DailyKos, suggests this mysterious group of Republicans may have made a miscalculation in their attempt to monkey-wrench the Democratic Senate primary race in his state. He also explains how they may have committed fraud in their FEC filing. He shares his insight on the curious NC ad buy and the question of whether Republicans are really interested in running against progressives like Sanders and Smith because they believe they will be easy to beat this November, or because they want Democratic voters to BELIEVE progressives will be easy to beat. "Is this eleventy-dimensional chess or is this Tic-Tac-Toe that they're playing?," Busa asks. "I'm not entirely sure which it is, but I don't think it's eleventy-dimensional chess." We've got a lot to unpack in that conversation today!
  • Finally, Desi Doyen joins us for our latest Green News Report, with good news and bad Down Under, unquestionably bad news for bumblebees and Antarctica (and, by extension, for all of us) and the interesting way that Democrats raised the issue of climate change during last Friday's Presidential Debate in New Hampshire...

On today's BradCast: With media reports on Thursday that online "Trump trolls" were making hundreds of calls to tie up the Iowa Democratic Party's results hotline after Monday's Caucuses in order to hold up results and embarrass Democrats, we're joined for an exclusive interview today with stakiomeone who knows a thing or two about such plots. In 2002, ALLEN RAYMOND, a then decade-long Republican operative and owner of a GOP phone-bank company, was hired to lead a scheme to tie up the Democratic Get Out the Vote phone lines during that year's very tight New Hampshire U.S. Senate race between Republican John Sununu and the state's then-Governor, Democrat Jeanne Shaheen. The now-infamous scandal, which included thousands of automated phone calls to prevent Dems from carrying out their GOTV phone-banking effort, ended with a narrow win by Sununu that year. But the scheme was uncovered and four GOP operatives, were eventually convicted of, or pleaded guilty to, taking part in the RNC-funded effort. Raymond was one of them. He pleaded guilty and ended up serving 3 months in federal prison. In 2008, the contrite former operative published a book about that exploit and others during his time as a senior consultant to the Party called How to Rig an Election: Confessions of a Republican Operative.

Raymond joins us today to discuss the 2002 plot in NH, how it came about, and what was behind it, as well as to offer his thoughts about what we should know regarding whatever may have happened to the Democratic Party's hotline on Monday night in Iowa. He is skeptical about whether a few "trolls" on a popular rightwing Internet message board could effectively tie up enough lines to create the kind of chaos that ensued in Iowa, suggesting that its possible the scheme may be larger than currently reported.

"That takes a fairly sustained, collaborated, concerted effort," he explains. "So the question it raises in my mind is, can that happen organically?" Without making any allegations, he is calling for an immediate law enforcement investigation which he says should be able to quickly uncover the source of the phone harassment, the same felony for which he pleaded guilty to years ago in the RNC's NH scheme. "It raises enough suspicion of a coordinated effort that it's worth looking at."

It wouldn't be the first time in even recent months that an emboldened RNC has carried out a similar phone scheme against Democrats. As the New York Times reported last November, Republicans attempted to swamp Congressional Democratic phone lines with thousands of automated calls during the early stages of Donald Trump's impeachment inquiry.

Raymond also shares his thoughts on what has become of the Republican Party in recent years since he was thrown under the bus when the NH plot was uncovered (he is now a registered Democrat); how he and other political operatives justify such dirty tricks and/or illegalities when taking these kind of unsavory and/or unlawful actions in order to win elections; and what American voters should be concerned about as the 2020 election progresses under a Republican Party headed by a vengeful, recently-impeached President.

"This phone disruption effort occurring in the very first contest of the presidential nominating process leading up to November's general election, should be reason enough" to be concerned, he tells me. "If it's happening on the first one, and nothing's done, we're sending a signal that this is the new norm, it's okay, that you will not be punished or prosecuted for this kind of conduct. That's why, at minimum, an aggressive investigation should occur to determine what exactly happened, for the purposes of protecting against the same conduct in the future. Because by not prosecuting, by not investigating, the signal is being sent: 'Hey, we all agree that that stinks but that's okay, go ahead and do it because law enforcement is not going to come knocking on your door.'"

"A republic's center of gravity is its electoral process," Raymond warns. "And if our electoral process is compromised --- whether it be from domestic actors or foreign actors --- that's reason enough to do whatever you can to protect it."

On today's BradCast: We dispatch with the dark, ugly post-impeachment bitterness of our completely unfit and totally guilty President as quickly as possible at the top of today's show, along with a word or two about Mitt Romney's commendable, historic courage. Then it's on to looking forward to how Americans must remove this dangerous man from office, even as we all must surmount seemingly impossible odds with our nation's terrible, dangerous, nontransparent voting systems in 2020. On that score, first up, CBS-2 in Los Angeles ran an investigative report this week, featuring yours truly, on the County's new, unverifiable, $300,000,000 touchscreen voting system. We share the report from CBS-LA's David Goldstein in full, along with some additional thoughts, including the eerie similarities between comments in the CBS report from L.A. County's Registrar Dean Logan, who developed the new VSAP ("Voting Solutions for All People") system, on his strong confidence in the first-time use of this new system before the March 3rd Super Tuesday primary, and those from an interview with the Iowa Democratic Party Chair Tom Price on the night before the Iowa Caucuses about his own confidence in the party's new, secretly-developed smartphone app that failed so disastrously the next day.

Then, speaking of Iowa, several reports on Thursday confirm that there was an apparent effort by Trump supporting trolls to jam the phone lines used as the backup for precinct officials to phone in caucus results when the IDP's smartphone app had failed. That element of the story is eerily similar to the 2002 GOP phone-jamming scandal during a U.S. Senate election in New Hampshire that year. Four Republican operatives hired by the party were convicted in a criminal scheme and the party had to pay NH Dems $125,000 in damages afterward. How does that tie to what happened in Iowa? We hope to report more on that on tomorrow's BradCast. But for now, we hope it serves as a reminder that Russia is not the only threat to the integrity of U.S. elections. Not by a long shot.

Today we've got more new, and still-partial (97%), results out of Iowa, showing Pete Buttigieg and Bernie Sanders in a virtual tie, with Buttigieg barely leading in state delegates at the moment (3 out of several thousand divvied up between candidates) and Sanders winning in the raw vote counts in both the first and final rounds of voting on Caucus night. Controversy around the reported numbers, as chaotic and error-ridden as it has been, is actually a good thing, as we explain, given that publicly-witnessed, precinct-based counts (with hand-marked paper ballots to boot) are available from all 1,765 caucus sites. That means, when incorrect numbers have been posted to date, the public has been able to scrutinize and force corrections to those numbers, as has been the case in several instances across the state.

It should also be noted that, despite claims from supporters of some candidates, there is no evidence so far to suggest that any of the errors in reporting were meant to help or harm any particular candidate. As the NYTimes reports tonight, "Some of these inconsistencies may prove to be innocuous, and they do not indicate an intentional effort to compromise or rig the result. There is no apparent bias in favor of the leaders Pete Buttigieg or Bernie Sanders, meaning the overall effect on the winner’s margin may be small."

We go over some of those claims as well today. While some are viewing all of this as chaos and failure, we see it as a victory for PUBLIC OVERSIGHT OF ELECTION RESULTS. Public oversight is generally missing in jurisdictions where computers tally votes (which is to say, in all 50 states) leaving the public often entirely unable to verify results of their own elections. Similar errors occur in virtually every election, but due to the nature of secret counting in most locations, the public rarely learns about or notices them and erroneous results are rarely corrected. That, of course, was what we shamefully saw (or, rather, didn't) in Michigan, Wisconsin and Pennsylvania after the stunning reported end to the 2016 Presidential election.

Now, ironically enough, a furious National Democratic Pary chair is demanding a recanvass of results in Iowa. But where were those same Dems after 2016 when they decided to not challenge or scrutinize any of the dubious numbers from the most surprising Presidential election results in U.S. history?
