So much for the campaign to "Make America Healthy Again". Today on The BradCast, former public health officials are calling for the head of Donald Trump's chief health Secretary, a guy who has no scientific or medical expertise whatsoever. But he does have a famous name. [Audio link to full show follows this summary.]

Last Wednesday, Trump's Health and Human Services (HHS) Secretary, Robert F. Kennedy, Jr., announced he was cancelling some $500 million for research of the miracle mRNA vaccines that finally brought the world out of years of the COVID pandemic. Scientists at the National Institute of Health (NIH) were working on new versions that could also be used to protect against influenza and other diseases. The cuts came after Kennedy falsely claimed that the vaccine, which saved millions of lives, was not effective against respiratory diseases.

Two days later, on Friday last week, a man who blamed the COVID vaccine for making him depressed and suicidal, attempted a mass shooting at the headquarters of the Centers for Disease Control and Prevention (CDC) in Atlanta. He was blocked from entering the CDC, but opened fire at a pharmacy across the street, killing a police officer before, apparently, taking his own life.

RFK Jr., who was gone fishin' in Montana at the time, didn't bother to issue a public response to the incident for 18 hours. The CDC employees union has since called for a "clear and unequivocal stance in condemning vaccine disinformation" from the longtime vaccine denier. And a group of fired former federal health workers, Fired but Fighting, has called for the HHS Secretary to step down, along with White House Office of Budget and Management (OMB) Director Russ Vought, who previously declared: "When [federal workers] wake up in the morning, we want them to not want to go to work, because they are increasingly viewed as the villains. ... We want to put them in trauma."

Mission accomplished, Russ.

We're joined today by ARYN MELTON BACKUS, a now former health communications specialist at the CDC’s Office on Smoking and Health, and a founding member of Fired But Fighting. Though she won the legal challenge to her Valentine's Day firing in U.S. District Court, the matter remains on appeal and, as she explained today, she is not encouraged by what she has seen from our wildly corrupted U.S. Supreme Court. "We are also fighting for the future of public health," she tells me today. "So even if I am officially terminated, we will stay here and we will fight for the public health of our nation."

We discuss her firing and Kennedy's subsequent complete shutdown of her former office at CDC, and how (and if) the critical (and wildly successful) work of that office will be picked up anywhere else. The private sector, she laments, is simply not suited for such work. "Part of the problem with public health is that it is not profitable. If you can prevent people from getting sick or very sick to begin with, it doesn't make money for a lot of these private companies." She offers the example of a large, private pharmaceutical company who might make drugs to treat cancer, so may not be all that eager to prevent smoking, for some reason.

The closure of her office "was really surprising to a lot of people," given that smoking prevention isn't a particularly partisan issue. The campaign led by her office, Backus says, has "led to over a million people quitting smoking and saved the U.S. millions of dollars in healthcare costs. Smoking rates are the lowest they've ever been. But there's still a lot of work to be done." So, she explains, it came as a "a shock that Sec. Kennedy decided that we were no longer necessary, especially as he's declared a war on chronic disease, and smoking is one of the biggest contributors to chronic disease that there is."

As to his anti-vax advocacy, Backus charges: "Bobby Kennedy has been a major spreader of vaccine mis- and disinformation for decades. But going back to 2020 and the pandemic, he repeatedly spread lies about the COVID-19 vaccine. He called CDC a 'cesspool of corruption.' That has made a lot of people at CDC villainized." And that has got a lot of Backus' former colleagues very concerned at this time about their personal safety. Even more so after the shooting at the CDC on Friday.

• Back here at home, on Monday, Donald Trump announced his federalization of the Washington D.C.'s Metropolitan Police Department, including the deployment of the National Guard to D.C., despite crime being at a 30-year low in the nation's Capitol upon his taking office for a second term, and falling 26% as compared to this same time last year. (And despite his claims on January 6, 2021, that he didn't have the authority to deploy the national guard to protect the U.S. Capitol after inciting his supporters to attack it.

It's become very clear of late, as discussed on today's BradCast, that, whether the corporate media or rightwingers like to admit it or not, it is now progressive political policies that are popular among Americans. [Audio link to full show follows this summary.]

With progressive policies in place from the Biden-Harris Administration, for example, the U.S. economy continues to be the envy of the industrialized world. New, falling unemployment numbers and growing retail sales announced on Thursday, combined with recent data finding the annualized inflation rate has now fallen below 3%, sent the stock market soaring again on Thursday. Well, except for Donald Trump's failing media company (DJT), which fell to its lowest price since going public in January. Since then, the loser stock has shed more than 50% of its market value and a full two-thirds since its high-water mark in March. (We tried to warn MAGA investors. Oh, well.)

Just one of the progressive economic policies of this Administration is the landmark Inflation Reduction Act, signed by President Biden in 2022 after being adopted by Democrats in Congress without a single Republican vote. Among many other things, the IRA allows Medicare, for the first time in history, to negotiate drug prices with pharmaceutical companies. On Thursday, the Biden-Administration announced they have completed their first round of price negotiations on ten popular drugs which will save tax payers at least $6 billion a year and $1.5 billion in out-of-pocket costs to beneficiaries.

"Under the law I signed," Biden explained today in Maryland at a rally with Vice President Kamala Harris, "Medicare can negotiate lower prices for another 15 drugs next year, 15 the following, and 20 after that until every drug is covered. That's the law. Now!" As the non-partisan Congressional Budget Office determined before passage of the bill in 2022, the measure will save the federal government nearly $100 billion over a decade --- something that Republicans used to pretend to care about, at least until every single one of them voted against it.

That's just one example of popular progressive policies at work, of course. Harris' running-mate, Gov. Tim Walz, has signed a boatload of them into law in Minnesota, including the protecting abortion rights; legalizing recreational marijuana; implementing popular gun safety reforms; providing legal refuge for trans youths; enacting laws that expand paid family and medical leave; banning noncompete agreements; providing universal public school meals; free public college education for households with income less than $80,000/year; and capping the price of insulin in Minnesota (years before Biden was able to do so nationally.)

That alone is a virtual laundry list of both top progressive aims and popular policies that could be implemented at a national level. So, will a Harris-Walz administration be able to move such policies forward if elected in November? And what else do progressive activists hope to see from a new, Democratic administration?

We're joined today by ALAN MINSKY, Executive Director at Progressive Democrats of America, in advance of the group's 20th Anniversary Progressive Central gathering in Chicago this week ahead of the Democratic National Convention. Sen. Bernie Sanders will be keynoting the two-day gathering, co-hosted by a number of other progressive organizations and publications, with a speakers list featuring a huge list of progressive members of Congress, activists, and journalists.

So, how do progressives feel heading into next week's DNC after nearly four years of the most progressive Presidential administration in decades; an historic, month-long political whirlwind; and a brutal year of protests against Israel's horrific response in Gaza to last year's attack in Israel by Hamas? Minsky and I discuss the "turbulence" and "high stakes" of the moment, and the revelation, for much of the nation, that progressive policies are the popular ones.

"Progressive policies directly address the interests of the average household," Minksy explains, citing "four massive ticket items that just block people from achieving the American dream" so they "don't have to work three jobs to make ends meet."

Those four blocks, he explains, start with childcare. "It's almost prohibitively expensive to have a child in this society". And then the cost of higher education. "You get out with a degree, and you face housing costs, either rents or mortgages, both prohibitive for building anything like the kind of financial security that you want to have. And then, finally, of course, healthcare costs overwhelmingly shredding the finances of people and families late in life."

"Again, only progressives on all four fronts have clear policy solutions to each of those prohibitive costs that American families meet," he tells me, adding, "And these are practiced around the world in other countries, available for us to pursue. They're not radical ideas. They're commonsense ideas."

"The other thing progressive are willing to address that the other groups are not, because they just accept that it's there, part of the wallpaper of American society, and that's the clear spaces in our society where there is deep, endemic poverty. The urban core, small town and rural America, deep poverty in indigenous communities, and still in the Southeast --- the former Confederate states --- most of that region is still tremendously poor. Only progressives address this."

There is more, much more to chew on in our conversation, including the way disparate elements of the left can come together to achieve solutions to these issues, and how to "persuade a Harris-Walz Administration and their economic advisors that the way forward is to go further on those four big ticket items."

"Only the United States has a latent group of about 100 million people who can be lifted up, by very well understood mechanisms, into the middle class," observes Minsky. "When that happens, that is an economic boom."

As to the vibes on the ground in Chicago, where some progressive organizations are planning to protest the Biden-Harris position on Israel? "Free speech society, open society, that's where I want to live," says Minksy, before adding, in reference to the violence at protests at the DNC in the Windy City almost 60 years ago: "Chicago doesn't feel like it's 1968. It just doesn't. There will be notable actions. But, as much passion as there is out there, I don't think it's quite broadly at the level of what was going on in the country during the Vietnam War in 1968." We'll see if he turns out to be right about that.

Among the many stories covered today...

• It has been a very very bad 24 hours for our disgraced former President in three of his four criminal cases, as he's now received rejections from three different judges to three different motions to dismiss or delay in three different jurisdictions over that period. Last night, Juan Merchan, the judge in his New York hush-money fraud case rejected his last minute motion to delay his April 15th trial until after SCOTUS rules on his laughable "Presidential Immunity" claim. The judge in his Georgia election theft conspiracy case, Scott McAfee, rejected Trump's effort to dismiss on ridiculous First Amendment "protected political speech" grounds. And even Aileen Cannon, the corrupt Trump-appointed federal judge overseeing his case in Florida for stealing national security documents upon leaving the White House, finally issued an order rejecting his absurd Presidential Records Act defense as cause for pre-trial dismissal. Sad!

• The secretive, supposedly "centrist" No Labels group announced they will not be running a third-party candidate for President in 2024 after all.

• Kim Taylor, the wife of an elected Republican official in Iowa who was named as an unindicted co-conspirator, will get just four months in prison after being found guilty last year of 52(!) election fraud crimes, including registering and casting votes for her husband in the names of others. (Tip for vote fraudsters looking to get off easy: Be a Republican.)

• Wisconsin's newly progressive Supreme Court majority will now decide whether to reverse the previous right-wing majority's ban on the use of absentee ballot drop-boxes in the critical battleground state this year.

• An out-of-the-blue call on Tuesday by a rightwing extremist on Twitter to change the way Nebraska will allocate its Electoral College votes in 2024 --- in hopes of awarding an extra vote for Trump this year --- gained support just hours later from the state's Governor and the desperate former President before failing in a vote by the state legislature Wednesday night. Bigly. The measure still could come back up for another vote, however, before the legislative session's end on April 18, or in a Special Session thereafter if called by the Governor.

• Following a reportedly tense call on Thursday between the nation's two leaders, the White House announced that President Biden issued a warning to Israel's far-right Prime Minister Benjamin Netanyahu: Change course in Gaza or...else. The White House said the President demanded swift changes to Israel's war on Gaza to allow much more food and humanitarian aid to reach starving citizens and protection for both civilians and relief workers. Though it remains unclear how U.S. support may change, an Administration spokesperson said they expected to see action from Israel "in hours or days" before reassessing current policy.

• On Wednesday, Senator Bernie Sanders joined President Biden at the White House to tout their successful efforts at lowering the cost of healthcare and, specially, prescription drug prices following the adoption of the Inflation Reduction Act which every Republican in Congress voted again. After forcing Big Pharma to lower the cost of insulin and certain asthma medication for Medicare recipients to no more than $35/month, both men called for still more cuts in the price of overpriced prescription drugs sold in America to everyone, not just those on Medicare.

• Finally, Desi Doyen joins us for our latest Green News Report with news on a looming, climate-change fueled hunger crisis in Southern Africa; the Biden Administration's largest-ever investment to decarbonize American manufacturing; how melting polar ice is bending time itself; and the opening of America's first commercial-scale offshore wind farm...which is decidedly not killing whales (insists Desi.)

We've just about arrived at the point where the corrupt, stolen and packed rightwing U.S. Supreme Court almost isn't even trying to hide their corruption anymore. And, yes, as discussed today on The BradCast, that includes the Chief Justice. [Audio link to full show is posted below this summary.]

First up, Lori Lightfoot, the first black female and openly gay Mayor of Chicago was reportedly knocked out of contention in her reelection bid on Tuesday. It is the first time in 40 years that an incumbent Mayor was unseated. (The last one was the city's first female Mayor.) Paul Vallas and Brandon Johnson will go on to compete in the run-off set for April 4. Vallas is a "tough on crime" candidate vowing to add hundreds of police to the streets of the nation's third-largest city. He is supported by the police union, the Fraternal Order of Police, whose leader defended January 6 insurrectionists and equated Lightfoot's vaccine mandate for city workers to the Holocaust. Johnson, an African-American supported by the teachers union and progressive organizations, has called for more money to be spent not on police, but for mental health care, education, jobs and affordable housing.

Next, we're joined by DAVID DAYEN, progressive financial journalist, author and Executive Editor of The American Prospect to discuss Tuesday's oral arguments at SCOTUS on two different challenges --- both largely absurd --- to President Biden's student loan forgiveness program. But for being blocked by Republican-appointed lower court federal judges, the plan would forgive up to $20,000 for federal student loan borrowers making less than $125,000/year under the authority of the HEROES Act. The 2003 law, adopted by Congress and signed by the President in the wake of 9/11, grants authority to the Education Secretary to "waive or modify any statutory or regulatory provision" regarding student loan programs in the event of a national emergency.

Despite the legal authority granted by the clear language of the text, Republican lower court judges have blocked the program to date, and the corrupt rightwing Justices at SCOTUS seemed to be working hard to do the same during the 3-and-a-half hour hearing at the high court on Tuesday, according to Dayen. The Biden Administration, as he explains, has invoked the very same legal authority from the HEROES Act to "waive" student loan payments as the Trump Administration used to pause them during the pandemic. Of course, neither Trump's authority to do so, nor its authority to issue hundreds of billions of dollars in forgivable PPP loans to small businesses during the crisis, was challenged in court --- or saw its "fairness" questioned --- by Republican litigants. Low income student loan borrowers, however, are apparently a different matter.

There are two different sets of GOP plaintiffs challenging Biden's plan. One (Biden v. Nebraska) is a group of six Republican-controlled states (Missouri, Nebraska, Iowa, Arkansas, Kansas and South Carolina) and the other (Dept. of Education v. Brown) is two individuals who failed to qualify for student loan forgiveness. It seems that neither group of plaintiffs should have legal standing to sue at all in these cases, as neither seems to be able to demonstrate any real harm or injury. If these cases are to be tossed, it will likely be on those grounds. But, the Court's rightwingers sure did seem to want to block this program during Tuesday's hearing, citing the absurd and wholly-made-up, found-nowhere-in-the-Constitution "Major Questions Doctrine" as just one way to do so.

Dayen details the entire fiasco for us today. The Court will issue its opinion no later than June or July as hundreds of billions in financial relief for those need it most hangs in the balance.

Also discussed with Dayen today: The high court has decided to hear a case on whether the funding mechanism for the Consumer Finance Protection Bureau (CFPB) --- the brainchild of Elizabeth Warren during the Obama Administration following the 2008 financial crisis as the only federal watchdog agency focused mainly on consumers --- is unconstitutional. "If you believe it is," quips Dayen, "then you believe that not only numerous other agencies in the federal government have unconstitutional funding structures, but things like Social Security and Medicare are unconstitutional." A similar funding mechanism has been used for decades, without challenge, by the FDIC, the FDA, the Federal Reserve and many others.

Dayen describes the ruling that the CFPB's entire funding mechanism is unconstitutional as coming from the "deeply radical" 5th U.S. Circuit Court of Appeals. He seems to be hoping that SCOTUS has decided to hear this case next term (which begins in October) in order to reverse or, at least clarify, the lower court's ruling. We'll see if he's right about that.

Finally, we discuss drug-maker Eli Lilly's announcement today that the company plans to lower the cost for insulin, after President Biden and the Democrats' Inflation Reduction Act, adopted last year, capped expenses for the drug at $35/month for federally insured patients, such as those on Medicare. Also, we discuss today's announcement of the nomination of Julie Su as Biden's new Labor Secretary to replace the departing Marty Walsh. As Dayen reports, the clever appointment of Su, a California progressive, will place her in charge of the Department whether her nomination is blocked in the Senate or not...

On today's BradCast: The story of why Americans are still paying the health care price (in both blood and treasure) in 2022 for "free market champion" Ronald Reagan's 1987 Executive Order that gave away the tax-payer store to Big Pharma. First up today, an update in the still-broadening criminal conspiracy probe by Fulton County District Attorney Fani Willis into Donald Trump's many faceted and failed efforts to steal the 2020 Presidential election in Georgia. With 17 known "targets" in the probe so far, including Rudy Giuliani and 16 fake Trump electors, the prosecutor tells Washington Post in an exclusive interview that there will be more "targets" announced soon and that she believes some are likely "facing prison sentences." She has yet to decide if the former President will be among them, though, with dozens of witnesses who have already been subpoenaed and testified to her Special Grand Jury in Atlanta, Willis says the Grand Jury should wrap up by year's end. A decision whether to call Trump in to testify --- or declare him a target --- is likely "to be made late this fall," she says.

Next, now that far-right retired Brigadier General and dyed-in-the-wool conspiracy theorist Don Bolduc won the GOP nomination in New Hampshire this week to challenge incumbent Democratic U.S. Senator Maggie Hassan this November, he's...um...re-evaluating some of his previous positions. During a primary debate with fellow GOP candidates before the primary, he proudly denied Joe Biden's victory in the 2020 election. "I signed a letter with 120 other Generals and Admirals saying that Trump won the election and, dammit, I stand by my words!," Bolduc bravely declared to cheers from Party faithful. When asked about his position this week on Fox "News," however, after winning the GOP nomination, Bolduc hemmed and hawed his newly discovered belief after "a lot of research on this", finding the 2020 "election was not stolen" and that "President Biden is the legitimate President of this country." Granite Staters will undoubtedly fall for his pretend new "moderate" line, right?

Then, newly reformulated COVID vaccine booster shots from both Pfizer and Moderna, designed to combat both the classic coronavirus and several newer Omicron variants, are now available to the general public in the U.S. The White House and CDC are recommending Americans get the new shot by Halloween to lessen the chance of infection --- or killing your grandmother --- over Thanksgiving and Christmas holidays when a new surge is expected. (They also recommend getting a flu shot at the same time.)

But why are new COVID vaccines even necessary more than two years into the pandemic? One reason is thanks to the fact that, despite tens of billions of tax-payer dollars given by the federal government to private companies for the development of the life-saving vaccines, the private pharmaceutical giants who make them refuse to give up their patent and intellectual property rights to make the vaccines available to the world. That means new variants continue to emerge, leading to more infections and the need for updated vaccines and, yes, more profit for Big Pharma. It's a pretty nice deal...for them.

So, how did we get here? We're joined today by ERNEST A. CANNING, longtime legal analyst at The BRAD BLOG, who recently took a deep dive into a 1987 Executive Order by Ronald Reagan that gifted patents and profits that go with them to huge, for-profit pharmaceutical companies that used tax-payer dollars to develop their inventions. That, from the Republican idol who, ironically, once declared: "We who live in free market societies believe that growth, prosperity and ultimately human fulfillment, are created from the bottom up, not the government down."

The pharmaceutical industry may disagree, even if they won't say so out-loud. "No matter how big a company and how much money was poured in by federal government for research and development, the patent would belong to the giant company," Canning explains. "We've been paying, just in general research, about $28 billion in pharmaceutical R&D every year." Given the "value of those patents," he notes, "we're talking trillions of dollars in a gift, not just tens of billions."

He also explains how all of this came about (beginning with Jimmy Carter) and why its now so difficult for Joe Biden to merely repeal Reagan's Executive Order in regard to the COVID vaccines.

But Canning also offers some brighter news related to patent abuse by Big Pharma, which he also recently wrote about at The BRAD BLOG. In a landmark initiative, the state of California is now fighting back. Democratic Governor Gavin Newsom recently announced the state will begin manufacturing insulin and will make the hundred-year old drug available for just slightly more than it costs to produce. Canning explains why that has become necessary as Big Pharma takes advantage of loopholes in Intellectual Property laws to bilk diabetics with outrageous prices for the inexpensive, life-saving medicine.

Finally, a private company that is --- shockingly enough --- apparently doing the right thing for the country and the world. (What?!) The family that owns outdoor gear brand Patagonia, headed up by its 83-year old founder, announced this week that they will be "making Earth our only shareholder". While the company will remain a for-profit entity, currently valued at around $3 billion, it will now begin giving away all profits --- about $100 million a year --- to two newly created entities, a trust and a non-profit, both devoted to combating our climate crisis.

(Any chance we can coax Patagonia into the pharmaceutical business while we're at it?!)

We should be both relieved and outraged!

Relieved that, earlier this month, the Center for Disease Control (CDC) and Food & Drug Administration (FDA) approved a new round of booster shots specifically re-designed to address new variants of the deadly COVID virus.

Outraged because, despite the expenditure of tens of billions of U.S. taxpayer dollars on research and development (R&D), the pharmaceutical industry's refusal to waive its "gifted" patent rights prevented a global rollout of the COVID vaccines. In turn, that refusal resulted in the need for the new booster shots.

Outraged because the industry's refusal to waive their patent rights has produced "excess mortality" with COVID that, as of the beginning of this month, has killed at least 6.5 million people worldwide, with no end in sight.

Outraged because this will, in all likelihood, not be the last newly reconstituted booster shot needed. It is the considered opinion of two thirds of the world's epidemiologists that the failure to provide global vaccinations will give rise to mutations that "could render current COVID vaccines ineffective."

And, yes, the patent rights were, indeed, a gift --- from the United States to the Pharmaceutical Industry...
