On today's BradCast: A new cybersecurity incident has emerged in Coffee County, Georgia. That's the now-notorious rural enclave in the southeastern part of the Presidential battleground state where Donald Trump allies and operatives, in January of 2021, unlawfully breached, copied and distributed the state's proprietary touchscreen voting system software after the 2020 Presidential election. Five participants in that breach were charged with felonies as part of the broad racketeering conspiracy case against Trump filed in Fulton County, GA. [Audio link to full show follows this summary.]

Before we get there today, however, some quick news on Trump's New York criminal trial, where he stands accused of 34 felonies related to hush-money payments made just before the 2016 election to porn star Stormy Daniels. She took the stand today. We cover a few quick details, but will cover that and other related news in more depth on tomorrow's mid-week Trump Trial "Ketchup" program.

Also today, we're happy to announce another very rarely-bestowed BRAD BLOG Intellectually Honest Conservative Award. This one for Georgia's Republican former Lt. Governor Geoff Duncan. The prestigious honor comes in response to his courageous op-ed in the Atlanta Journal Constitution this week, in which he endorsed Joe Biden and encouraged fellow Never Trump Republicans to do the same, noting, "Unlike Trump, I’ve belonged to the GOP my entire life. This November, I am voting for a decent person I disagree with on policy over a criminal defendant without a moral compass."

Then, it's back to Georgia, where the Coffee County Board of Commissioners released a notice [PDF] late last month that they'd been notified by the U.S. Dept. of Homeland Security (DHS) and its Cybersecurity and Infrastructure Security Agency (CISA), 11 days earlier, about "unusual cyberactivity" on the County's local IT system. The terse statement from the County confirmed indications of "cyber-activity by an unknown malicious actor(s)". It claimed that "Steps have been taken to further secure the network and protect Coffee County's IT infrastructure", while noting that it had "informed Federal Authorities of the incident". (Yes, that would seemingly be the same incident that the very same press release says Federal Authorities, DHS and CISA, notified THEM about.)

We're joined today by longtime Election Integrity and Transparency champion MARILYN MARKS of the Coalition for Good Governance (CGG). Marks was the one who first learned about Team Trump's unlawful breach of GA's statewide voting system hardware and software in Coffee County that first took place on January 7, 2021 (the day after Trump's insurrection at the U.S. Capitol.) Her revelations resulted in the charges filed by Fulton County District Attorney Fani Willis against Trump attorney Sidney Powell (who pleaded guilty) and others involved in the Coffee County break in.

As Director of CGG, Marks is also the plaintiff in civil lawsuit in federal court, filed in 2017, seeking to ban GA Sec. of State Brad Raffensperger's mandated use of the state's easily-hacked, unverifiable touchscreen voting systems in favor of verifiable hand-marked paper ballots. The trial in that long-running case, known as Curling v. Raffensperger, was finally held in January of this year. As Marks explains today, plaintiffs are still waiting on a verdict from U.S. District Court Judge Amy Totenberg who oversaw the trial, which included demonstrations from plaintiffs' experts revealing that Raffensperger's systems can be hacked by any voter at the polling place with nothing more than a ballpoint pen.

Today, Marks charges that Coffee County appears to have "hid and concealed" information about the new cybersecurity incident from the Sec. of State's office "for some number of days." Though little is still known publicly about the new hack, she is troubled by the news. "This cannot just be coincidence that there have been two such cyberattacks this year on counties, one in Fulton and one in Coffee. That's it. The two counties that have a lot of information challenging Trump and his allies related to [the earlier breach in Coffee] and the theft of the [voting] software to begin with."

We also get an update from Marks on the status of the Curling case, where it is getting very late in the election year for the judge to issue a ruling that would require Georgia to make hand-marked paper ballots available to voters at the polls this November. Marks, however, remains ever hopeful, noting that the move to hand-marked ballots would require no new equipment above and beyond what is already available at each GA precinct.

Marks also discusses a new Georgia law (signed by Gov. Brian Kemp this evening) that will eventually ban the use of tabulation via QRCodes on computer-marked ballots, requiring computer scanners to tabulate from the ballots' human-readable text that is supposedly verified by voters after it is printed and before its cast. Unfortunately, as she explains, that bill, even if implemented in 2026 as mandated by the legislation, will not make the state's touchscreen Ballot Marking Devices any less vulnerable to manipulation or any more verifiable by the public after an election.

Marks, whose organization found no evidence that Biden's 2020 victory in the Peach State was decided incorrectly, is also offering testimony this week to the GA State Board of Elections, advocating that recounts in the state must be carried out by hand, rather than by the same computerized scanners that tallied ballots in the first place.

"The state law is quite clear, a recount is to be done by hand, for obvious reasons such as the machine [used to tally ballots] is coded wrong," she explains. Otherwise, she adds, you're going to get the same incorrect results "if you just run the ballot back through the machine that is miscoded."

The reason that Trump supporters are still arguing over the 2020 tally in the state, she believes, is thanks to the lack of a public hand-count after that very close election. Raffensperger insisted on a machine tally instead. "All of that could have been solved if they had done a manual recount, as the law required. Which would have allowed Trump to appoint a counter at every table, handle every single ballot. And they would have had a hard time arguing then about counterfeit ballots, wrong counts, no transparency," Marks tells me. "A lot of the problems that we've lived with now over three years would have been solved if they had just followed the law and done a manual recount."

We've got a lot of news from around the globe and right here at home on today's BradCast. Some of it is even not terrible! But, yeah, much of it is. [Audio link to full show follows this summary.]

Among our stories today...

  • It will be eight years next month since the 2016 BREXIT referendum in Great Britain offered a foreboding omen in advance of that year's Presidential election here in the U.S. We'll hope this past weekend's election results for mayoral races in London and elsewhere in Britain --- where the Conservative Party suffered crushing defeats against the Labour Party --- offer a much brighter omen for the UK's national elections later this year and the 2024 Presidential election here in the U.S. in November.
  • On the other hand, hopefully it is not Panama's weekend elections offering us an omen instead. A last-minute replacement for the country's former, popular, charismatic but criminal President --- who is barred from the ballot as he seeks sanctuary in the Nicaraguan Embassy after being sentenced to 10 years in prison for money laundering --- defeated three other rivals to win the Presidency on Sunday.
  • In other foreign affairs, we've got a lot of news out of Israel today. Over the weekend, the government of rightwing Prime Minister Benjamin Netanyahu shut down the local operations of Qatar-based news agency Al-Jazeera in a crackdown being decried by world journalism organizations as an attack on press freedoms. Hamas announced on Monday that it had accepted a cease-fire proposal forwarded via the Egyptian-Qatari based negotiations with Israel, but Israel --- which says it is studying the proposal --- appeared to be rejecting it as they began striking targets in the southern Gaza city of Rafah. That, as the Biden Administration has been warning Israel of threatened changes in U.S. support if a ground invasion in southern Gaza does not include measures to insure the safety of hundreds of thousands of civilian refugees. And all of that follows on what Axios reported last week as a hold placed by the Administration on a shipment of U.S.-made ammo earmarked for Israel, which may now be caught up in President Biden's push for more guarantees about its use by Israel.
  • But I thought the disgraced former President told us that the U.S. Justice Department has been weaponized by Democrats to go after Republicans?! If so, they've got a funny way of showing it. Last year, the DoJ indicted New Jersey's sitting Democratic Senator Bob Menendez (and his wife) on bribery and corruption charges. On Friday, the DoJ indicted Texas' Democratic Congressman Henry Cuellar (and his wife) on bribery and corruption charges. Its almost as if Trump was lying about the justice system being "weaponized" by Democrats to go after him and Republicans.
  • Speaking of our corrupt, lying, former President. Donald Trump was slapped with another fine on Monday for violating the court's gag-order against attacking jurors and witnesses. That brings the total number of contempt violations during his 2016 election interference case to 10. New York Superior Court Justice Juan Merchan once again warned that a jail sentence may be imposed after any more violations. As to the actual trial on 34 felony counts of falsifying business records to hide a hush-money payment made to a porn star to help him win in 2016, the Trump Organization's former Controller and its Accounts Payable Supervisor testified for the Prosecution on Monday about how Trump, while serving in the White House, signed checks from his personal account, fraudulently logged as legal expenses, to reimburse his former attorney Michael Cohen for the hush-money payment to Stormy Daniels.
  • Record flooding from climate change-fueled downpours in a wealthy section of Brazil is being described as among the worst disasters in its history, leading to chaos, the shutdown of highways and airports, hospitals without power, widespread looting, helicopter rooftop rescues, 20,000 left homeless and, so far, at least 83 deaths. "This was the third record flood in the same region of the country in less than a year," lamented Brazil's President, decrying his nation's lack of preparedness for the worst effects of climate change and for the "historic debt" that wealthy nations who caused this problem through the unfettered emission of climate warming greenhouse gasses owe to poorer countries who emitted little of it, but are now suffering the worst of the global consequences nonetheless.
  • Brazil's weekend disaster reportedly evoked scenes from post-Katrina New Orleans and post-Harvey Houston here in the U.S. But, over the same weekend, new scenes from Houston itself evoked the same thing, following days of downpours that pummeled the region and left residents stranded on rooftops requiring hundreds of rescues. Again. Some 23 inches of rain fell in Harris County over the past week, as floodwaters are finally beginning to recede in the nation's third-largest county today. Flood insurance has become all but unaffordable for many residents after years of ever-worsening storms as our global climate crisis continues to tighten its deadly grip. A disaster declaration was issued by the state's Governor in 91 counties impacted by the latest round of extreme weather in Texas.
  • Finally, with increased heat and moisture in the air, traditionally mosquito-free Los Angeles County is mosquito-free no more. County officials are now unleashing tens of thousands of irradiated male mosquitos (which don't bite), as part of a pilot program to target the female population (which do) for a particularly aggressive strain of bugs that have grown more aggressive in recent years, and are now said to be a vector for a number of deadly diseases. All thanks to climate change. Happy Spring!

Among the many stories covered on today's program...

  • American Presidential Primaries and Caucuses were always confusing for voters. This year, they are even more so. That, however, suits Donald Trump just fine in advance of next week's Nevada Primary (on Feb. 6) and Caucuses (on Feb. 8 ), which have been rigged by Team Trump to assure he cannot lose a single delegate to Nikki Haley, his last remaining challenger for the 2024 GOP Presidential nomination.
  • The day after the New Hampshire Primary last week, Trump supported an RNC executive resolution to officially declare him to be party's "presumptive 2024 nominee for the office of President of the United States." That, after nominating contests in only two states (Iowa and NH) where he won just 32 of the 1,215 delegates needed to clinch the nomination. Two days later (perhaps after receiving some sage legal advice) the desperate former President came out against the resolution, so the RNC promptly killed it. We what actually appears to have happened.
  • Well-respected and very conservative former U.S. Court of Appeals Judge Michael Luttig filed an amicus (friend-of-the-court) brief [PDF] with the U.S. Supreme Court on Monday, arguing that the Justices must adhere to the "textualist" approach that rightwingers on the High Court have claimed to follow in recent years, as they weigh whether Donald Trump is eligible for the 2024 ballot under the U.S. Constitution's "Insurrectionist Disqualification Clause." Trump has "disqualified himself" for the office of President under Section 3 of the 14th Amendment, Judge Luttig and others argue in the brief, after having "engaged in insurrection" on January 6, 2021, when he "sought to prevent the vesting of the authority and functions of the Presidency in the newly-elected President." That, the brief contends, may be even worse than when South Carolina seceded from the Union on December 20, 1860 to "prevent the newly-elected President Lincoln from governing only in that State." The Justices must not construct an artificial "off-ramp" to avoid their Constitutional mandate, the brief asserts. The matter will be heard by SCOTUS on Thursday next week.
  • Disgraced former Trump White House advisor and campaign Chair turned podcaster and con-artist, Steve Bannon, may be in more trouble than you know. He has already been convicted and sentenced to four months in federal prison for Contempt of Congress for his refusal to answer subpoenas from the House Select Committee investigating January 6. While free on appeal, he has also been charged by New York state for massive fraud in the "We Build the Wall" campaign which siphoned millions from duped Trump supporters. And now his former attorney in that case is gunning for Bannon's bank accounts after he was found to owe the law firm nearly half a million dollars in unpaid legal fees. Bannon's latest attempt to block his banks from turning over documents to the firm claims that doing so "poses a significant risk of compromising Mr. Bannon’s Fifth Amendment right against self-incrimination." Sad!
  • BREAKING DURING SHOW: A Delaware court judge has voided Tesla CEO Elon Musk's nearly $56 billion compensation package, ruling it was unlawfully dictated by Musk himself to a non-independent Board of Directors in sham negotiations. Also sad!
  • Finally, Desi Doyen joins us for our latest Green News Report, as President Biden puts a pause on approvals for new Liquified Natural Gas (LNG) export terminals; new reports find Canada tar sands are up to 6000% more toxic than previously known and that climate change made Brazil's Amazon rainforest draught 30 times more likely; and China, as it turns out, built more new solar power in 2023 alone than the U.S. has in its entire history...

We've got an unusually large amount of somewhat encouraging environmental-related news on today's BradCast. We apologize in advance. Don't worry. It's not all good.

Among today's stories...

  • More than 40 inches of snow fell on parts of the Northeast over the past two days. Desi Doyen explains why that may --- or may not be (though probably is) --- related to climate change.
  • Donald Trump's very narrow gag order in his $250 million civil fraud trial in New York, meant to bar him from attacking the court clerk --- which had resulted in hundreds of vile death threats against her --- has been reinstated by the state appeals court. Trump and his lawyers are pretending this is the greatest "tragedy" and injustice in world history. Shortly after the ruling [PDF] was handed down, Trump began posting attacks on social media against the Judge's wife.
  • OPEC+ member states, including cartel leader Saudi Arabia, Russia and others, announced they will be cutting oil production in 2024 in hopes of raising your gas prices in an election year. They had already cut production in late 2022, but, thanks in part to record U.S. oil production under the Biden Administration, prices came down anyway. (Yes, we realize that's the oppose of what you've been told by Republicans.) Sick of manipulation of global gas prices by foreign adversaries hoping to interfere in U.S. elections? We've got a few answers to that in the rest of today's show.
  • The Biden Interior Dept. announced on Thursday that it had invested some $468 million to advance wildfire resilience and a temporary increase in pay for firefighters across the nation under the Administration's "Investing in America" agenda, as wildfire season gets longer and more deadly thanks to our climate crisis. (The Biden-Harris Administration says it is working hard to find a way to make those pay increases permanent. But GOP members of Congress may have to play along.)
  • The Biden EPA also announced some very big news on Thursday. The Administration has proposed new restrictions on lead levels in drinking water that will result in all 9 million of the nation's lead water pipes --- which can cause brain damage and behavior disorders, particularly in children --- being replaced over the next 10 years! "To finally have a rule that mandates the removal of lead pipes is exactly what the government should be doing,” declared the Michigan pediatrician whose research first discovered the 2014 Flint, Michigan lead poisoning water crisis. This is very very good news and, yes, exactly the sort of thing that the federal government should be doing --- and should have done long ago!
  • But for, perhaps, the best examples of the federal government doing what it should be doing to help Americans this week came from Joe Biden's own remarks at a wind turbine manufacturing plant in Pueblo, Colorado on Wednesday. It is the largest such plant in the world, and will be even larger soon thanks to a number of pieces of legislation adopted during his Presidency. In his remarks, Biden touted the Administration's multifaceted jobs and manufacturing agenda --- via bills such as the Inflation Reduction Act, the Bipartisan Infrastructure Act, the CHIPS Act and more --- which has resulted in a clean energy jobs and manufacturing boom across the country. In this case, he was speaking in the district of --- and pushing back at --- handsy far-right Republican Congresswoman Lauren Boebert and other Republicans who voted against all of the measures that have brought thousands of jobs and hundreds of millions of dollars to her own district.
  • Finally, Desi Doyen joins us for our latest Green News Report with a suspiciously high ratio of good to bad news for a change today. It must be something in the water today. Hopefully it's not lead.

Global chaos continues today on The BradCast, in Gaza, in elections around the world, in the U.S. House and, of course, for our worsening climate crisis. [Audio link to full show follows this summary.]

Our coverage today includes...

  • ISRAEL V. HAMAS: Some encouraging news last night, after an apparent diplomatic breakthrough on opening up the Gaza Strip to humanitarian aid seemed possible following days of shuttle diplomacy by U.S. Sec. of State Antony Blinken and some nine hours of marathon negotiations with Israel's P.M. Benjamin Netanyahu. The effort, reportedly at the direction of President Biden, resulted in the announcement that he would be visiting Tel Aviv on Wednesday --- a first for a U.S. President during war time --- for a meeting with Netanyahu, followed by meetings with the leaders of Jordan, Egypt and the Palestinian Authority in Jordan. The last part of that encouraging news may have begun to disintegrate with the late Tuesday bombing of a hospital in Gaza, said to have killed hundreds of civilians, including women and children. Hamas blames Israel. Israel blames Hamas. The innocent people of Gaza pay the price.
  • DEMOCRACY V. AUTOCRACY: There were elections both in the U.S. and several nations around the world over the weekend. In three of the four cases --- Louisiana, Ecuador and New Zealand --- the news was not good for small "d" democrats (or capital "D" democrats in Louisiana), as voters chose rightwingers to displace progressives (or conservative Democrats in Louisiana). But don't forget about Poland! There the news was far better in a nation which has had a front-row seat to the existential battle against fascism, as it borders both democratic Ukraine and Vladimir Putin's authoritarian Russia. Polish voters, in record numbers, voted out the ruling far-right party in favor of opposition centrist and progressive parties led by former EU President Donald Tusk. Good news indeed in perhaps the weekend's most important election.
  • U.S. HOUSE CHAOS: After winning his party's nomination to become House Speaker last week, election denialist and far-right Ohio Republican Jim Jordan was unable to win the 217 vote majority from his own caucus in the first round of voting on the House floor on Tuesday after GOP hard-liners deposed former Speaker Kevin McCarthy two weeks ago, and then refused to support the winner of the private caucus election that nominated Steve Scalise last week. Republicans no longer recognize elections as valid, unless they win them. As TPM's Josh Marshall recently wrote, regarding the election denialism Republicans invented to try and steal elections from Democrats in 2020, "It’s like the virus had escaped the lab. It wasn’t just Freedom Caucus weirdos anymore. It's now treated as a given that caucus elections are purely advisory or essentially meaningless." Or, as TAP's David Dayen quipped last week, while asserting that the internecine House GOP chaos "could really go on indefinitely" and that the lack of a House Speaker actually matters to millions of Americans (including you this Thanksgiving), "In the Future, Everyone Will Be Speaker for 15 Minutes."

As the headline suggests, we've got a bunch of different odds and ends and follow-ups and codas to share with you on today's BradCast, along with, several new stories and even a musical ending to it all. [Audio link to full show follows this summary.]

Among today's stories...

  • Trump advisor Peter Navarro was found guilty by a jury in D.C. on Wednesday on two counts of Contempt of Congress for refusing to answer his House January 6 Committee subpoenas for testimony and documents. It's the second such conviction for a scofflaw Trump apparatchik. Last year, Steve Bannon was found guilty of the same crimes and sentenced to 4 months in prison. He remains out on appeal. Navarro is expected to appeal as well. We wish them both nothing but luck in their continuing efforts to evade the Rule of Law on behalf of the disgraced former President and continuing con-man.
  • Just a friendly reminder, because I haven't seen it covered much in the wake of the recent small plane death of former Vladimir Putin-ally turned short-lived Russian mutineer Yevgeny Prigozhin. I just wanted to make sure this factoid doesn't fall down the Memory Hole of History: On the day before last year's mid-term elections in the U.S., Prigozhin admitted, for the first time publicly, that Russia had, in fact, "interfered, are interfering and will interfere" in U.S. elections. Yes, in addition to heading up the brutal Wagner mercenary group in Ukraine and elsewhere, being known as "Putin's Chef" and eventually failed mutineer, he was also the guy who finally admitted to having interfered in U.S. elections. He was charged by Special Counsel Robert Mueller in 2018, for having done so in 2016.
  • Following Hurricane Idalia's landfall in Northern Florida last week, it's become clear that a radical new anti-immigrant law signed by the state's Republican Governor Ron DeSantis earlier this year will hamper rebuilding and recovery efforts in the Sunshine State. While damage from Idalia was intense, it made landfall on a sparsely populate part of the state. Next time, Florida may not be so "lucky". In not-unrelated news for the U.S. East Coast, the huge Hurricane Lee has now intensified to a Category 4 today as it nears the Caribbean.
  • A couple of weeks ago, we covered yet another case of voter fraud by a White Republican Trump donor after James Saunders, a 56-year old Ohio attorney, was convicted of unlawfully voting in both Florida and the Buckeye State in the 2020 and 2022 general elections. Last week, he received Ohio's maximum sentence of three years in prison. The judge sent him immediately to jail following his conviction without allowing him to remain free pending appeal.
  • In yet another new case of GOP election fraud last week, Alabama state Rep. David Cole was arrested and charged with voting in "multiple or unauthorized locations" after law enforcement officials determined the District 10 lawmaker actually resided in District 4 in violation of state law. He faces up to 10 years in prison for his crimes, though --- in a turnabout for GOPers these days --- Cole who was elected to public office last year, had the decency to resign following his arrest and says he plans to plead guilty.
  • We've been spent quite a bit of time over the past year and a half on both The BradCast and at The BRAD BLOG covering the alarming, unlawful breach, copying and distribution of Georgia's statewide voting system software by a bunch of MAGA folks on January 7th, 2021 in rural Coffee County. The scheme was allegedly organized by Trump attorney Sidney Powell after being hatched in the Oval Office in December of 2020. Powell and three others were finally charged by Atlanta-area D.A. Fani Willis for their parts in the plot, in Donald Trump's sprawling, 41-count RICO indictment [PDF]. We helped break some of the story last year and have been covering in detail it ever since, including yesterday with guest Marilyn Marks, the woman who first revealed the breach after learning about it via a bizarre phone call she received from one of the participants (who has also since been charged.)

    But there is another, less reported aspect to all of this, with no small amount of irony. Two of those charged for key roles in the plot, the County's then GOP Chair Cathy Latham and then Election Supervisor Misty Hampton, were also part of a voter suppression cabal in the heavily Republican County where about a quarter of the population is Black. In fact, for years, the pair had helped to bring false voter fraud charges against County Commissioner Olivia Coley Pearson, a Black Democrat, for her terrible habit of helping folks get to the polls when they need assistance. As CNN's Elle Reeve details in an excellent report this week from on the ground in Coffee County, there is good reason that some refer to it as "Crooked Coffee"...even before the massive Republican election fraud breach carried out by Hampton, Latham and many others.
