Today on The BradCast: The President of the United States likes to dismiss concerns about climate change by explaining that the real threat to humanity is actually nuclear weapons. And yet, as we were reminded again at midnight last night, he's not actually interested in doing anything about that threat to humanity either. [Audio link to full show follows this summary.]

FIRST... before we get to our excellent guest today on that, just a quick follow up to our recent coverage regarding last week's raid by the FBI at the Fulton County, Georgia elections warehouse, outside Atlanta, where federal officials absconded with ballots and other materials from the 2020 election that Donald Trump pretends was stolen from him, because he is unable to admit he lost it.

We've been trying to get to this story all week, but just a quick notice to mention that, following last week's raid --- and the Dept. of Justice's lawsuits against 23 states attempting to force them to turn over private voter data (suits that already being dismissed by federal courts) --- all three top Administration officials who had requested time to confront the bipartisan National Association of Secretaries of State (NASS) annual conference last week, cancelled their appearances at the last minute.

NASS had rearranged the conference schedule to allow for remarks by Attorney General Pam Bondi, Secretary of Homeland Security Kristi Noem and Director of National Intelligence Tulsi Gabbard. By Friday afternoon, however, all but Gabbard had cancelled. And just before her remarks were to begin, she pulled out as well. Maine's Democratic SoS, Shenna Bellows called them "cowards," noting, along with others, that the Administration's threats to interfere with upcoming elections is unlawful and likely to end poorly for them.

THEN... It's on to other, ahem, explosive news of the day. As of midnight last night, Trump allowed the last remaining nuclear arms treaty between the U.S. and Russia to expire. The New START agreement, struck with Russia by President Barack Obama in 2010, included strict caps on the numbers of ballistic missiles and nuclear warheads each country could deploy, and included an extensive verification regime. The 10-year pact was extended for another five years in 2021 by President Joe Biden, and Russia has said they were open to another extension. Trump simply let it expire.

We're joined today by long time nuclear weapons policy analyst STEPHEN SCHWARTZ, former Executive Director and Publisher of The Bulletin of the Atomic Scientists, keepers of the notorious "Doomsday Clock". On his excellent social media feed at @AtomicAnalyst last night, Schwartz lamented that, while "Trump has boasted for decades that he knows everything there is to know about nuclear weapons and could easily negotiate a great deal with Russia," he allowed New START, "the last treaty constraining US and Russian nuclear weapons" to expire, and "hasn't lifted a tiny finger to replace it."

"He did absolutely nothing during his first term," Schwartz tells me today. "Now, here we are again. He did absolutely nothing during his first year in office, and now we have no treaty whatsoever. I think because, first of all, he doesn't care about it, and because he views the treaty as tainted because it was negotiated by his arch-enemy Barack Obama."

"It's a great loss for humanity. It's not a win for anybody," he opines. "Anybody who thinks that getting rid of the treaty will make the United States or the world safer hasn't been living in reality for quite some time."

Welp. That sounds like Trump.

Schwartz breaks down the specifics of New START, and the dangers now posed with its loss. We also discuss, among other things, the fact that Trump's so-called "Golden Dome" anti-missile system, if Congress ever called for it to be built, is likely to make the U.S. less safe, not more so.

"The Golden Dome is the latest iteration of decades of efforts to try to use technology to eliminate the political problem that gives us the ever-present threat of nuclear war," Schwartz, author of Atomic Audit: The Costs and Consequences of U.S. Nuclear Weapons Since 1940 explains. "But it only works --- if it works at all --- against weapons that are flying through the air. It does not work on anything that would be coming at you from under water [such as Russia's Poseidon drones, developed in response to the threat of a U.S. defensive missile shield], nor for that matter would it shoot down planes that would be carrying nuclear missiles or nuclear gravity bombs."

It does, however, result in adversaries building even more advanced and more numerous offensive weapons systems to ensure they can overcome such a defensive system.

There's a whole lot more with Schwartz today, including: his assessments of the various nuclear threats now posed by China, North Korea, Iran and others, and whether the U.S. under Trump remains the greatest nuclear threat to the planet; why it would be such a terrible idea for Trump to restart U.S. nuclear missile testing, as he vowed last year; and much more.

Fear not!; Also: His support is eroding, and there are ways we can help...

You're going to get the most, by far, from today's BradCast, by listening to it. This briefest of summaries will not do it justice. Hopefully it suffices if only for a few links to a few of the stories and rulings cited throughout today's program. [Audio link to full show follows below this summary.]

In short (very short), the Trump Administration is losing and losing and losing in court, in case after case after case. And they are not only losing, but being upbraided by judge after judge --- those appointed by both Democrats and Republicans alike --- in one ruling after another now. At least at the lower federal court level. It's just one reason why the Administration is so desperate to get up to the final appeal phase at Donald Trump's corrupted, hand-picked Supreme Court.

The rulings from many of the U.S. District Court judges have been brutal for the Administration, as now coming in day after day. Just one example from yesterday is U.S. District Court Judge Ana C. Reyes' blistering ruling [PDF] in which she took DHS Secretary Kristi Noem to the metaphorical gravel pit over Noem's barely disguised racist rhetoric as part of the Administration's attempt to order the end of legal protected status for more than 350,000 Haitian refugees in this country. (Ya know, like the ones in Springfield, OH who don't eat dogs or cats.)

The good guys aren't winning every motion in every case. And, as noted, the corrupted SCOTUS may have the last word in some of them. But the increasingly dreadful record for the Government in these cases, for the moment, has essentially become the equivalent of legal trench warfare, forcing the Administration to step back or stand down, with the people largely holding off the attempted fascist federal takeover of the United States of America. Or, at least, preventing it from getting appreciably worse.

Russia was supposed to have taken over Ukraine in a week's time after they initially invaded their smaller, weaker sovereign neighbor four years ago this month. Similarly, Trump was supposed to have brought the U.S. to fascist MAGA heel by now. He decidedly has not.

With each loss, of course, in both courts of law and public opinion, he and his Administration grow angrier, more out of control and more dangerous --- but easier still to defeat in the bargain.

As his and his party's approval ratings --- and ability to win elections in even some of the "reddest" parts of the country --- continue to erode, he is now desperately turning to an attempted takeover of American elections themselves.

"The Republicans should say, ‘We want to take over,'" Trump blathered to Dan Bongino, former conspiracy podcaster turned Deputy FBI Director turned conspiracy podcaster again, on Monday. "We should take over the voting, the voting in at least many --- 15 places. The Republicans ought to nationalize the voting."

Trump then went on to completely mischaracterize why former MAGA Mesa County, Colorado Clerk Tina Peters is currently serving nine years in state prison for her criminal efforts related to attempting to defraud the 2020 election while illicitly conspiring to make unlawful copies of sensitive, proprietary voting system software. Despite having issued a pointless pardon for Peters (federal crimes have no effect on convictions under state laws), it's clear Trump knows absolutely nothing about her actual crimes.

But, as to the "nationalize the voting" thing, please know (as I explain in more detail on the show): Presidents have absolutely ZERO power to do any such thing. Elections are run by states and, to some extent, Congress may make laws that states must follow. He has no Constitutional or legislative or super-secret power to nationalize them, much less ordering "Republicans" to do so. It is, at best, a very empty threat. Whether he knows that or not is unclear. And, yes, as discussed, there are things that he can try to do, with the unlawful deployment of ICE forces, for example, to make things more difficult for voters to vote this year. But I suspect any such efforts will end up hurting his party's chances more than they will help.

At the same time --- as Saturday Night Live hilariously satirized over the weekend --- more and more Trump supporters are (slowly, but surely!) finding their way back toward sanity, or at least away from Trump. I suggest we find ways to help them safely get there.

We've been warning about it on The BradCast ever since the government re-opened after the last shutdown, its longest ever, in October and November. There now seems to be no way to avoid another shutdown as of midnight Friday, a former White House and Senate budget expert explains on today's 'BradCast'. But, he also notes, "this is the right thing to shut down the government for." [Audio link to full show follows this summary.]

BUT FIRST... A couple of other news items of note today...

  • The first special elections since the murder of Veterans Affairs Intensive Care Unit nurse Alex Pretti in Minneapolis were held on Tuesday, to determine partisan control of the Minnesota state House of Representatives. Two vacant seats in very Democratic-leaning parts of the Twin Cities region were up for grabs. One featured a Democrat who ran unopposed. (Spoiler: she won.) The other featured a Democratic candidate running against a Republican who had run for the same seat, and lost, in both 2022 and 2024. It's a district where Kamala Harris won by 71 points. On Tuesday, the Democratic candidate, Meg Luger-Nikolai, won the election by more than 91 points! That's a 20-point swing for the Ds, as Luger-Nikolai garnered more than 95% of the vote. Her Republican challenger won just over 4%. If Republicans weren't worried about this year's midterms before, Tuesday night's results oughta put the fear of God into 'em.
  • Speaking of elections, Donald Trump is still pretending he won the one that he lost in 2020 to Joe Biden. To that end, Trump has weaponized his FBI and today, they were ordered to raid the Fulton County (Atlanta) elections warehouse. Reportedly, the federal agents were there to collect ballots and other materials from the 2020 election, which have been retained by court order since then. Supposedly, this will finally provide Trump the evidence of massive "voter fraud" that he has alleged for so many years. If the Georgia Republican Sec. of State was unwilling back in January of 2021 to "find 11,780 votes" to help Trump steal the state's election that year, by golly, Trump is gonna "find" them himself now, five years later.

THEN... U.S. border patrol agents have fired shots 16 times over the course of the past year. In every instance, as WaPo reported yesterday, the Trump Administration declared the shootings to have been justified before any probe had been completed. Four U.S. citizens have been shot in those incidents. Two of them were killed over the past three weeks in Minneapolis.

While Trump is putting up a show of "softening" his stance on the federal government's invasion of the Twin Cities region by ICE and CBP, Greg Sargent argues that it's little more than posturing because Trump is now "frightened" that Democrats in Congress will shut the government down again unless serious restrictions are placed on funding for the Dept. of Homeland Security's immigration goon squads.

Senate Democrats, for their part, seem quite serious about doing just that, as the deadline for a new, 2026 government spending bill is midnight on Friday. With the House in recess, any changes made to the six funding bills they adopted before leaving, couldn't be voted on back in the House until they reconvene next week. That virtually guarantees at least a brief shutdown. To make things worse, Senate Republicans have been unwilling to decouple the DHS/ICE funding from the other funding bills, to keep the rest of the government open, until they can come to an agreement over new guardrails that Democrats are insisting on for ICE and CPB's clownish but deadly operations across the country.

"This is the right thing to shut down the government for," argues our guest, BOBBY KOGAN, today. He served as an advisor to the White House Office of Management and Budget under President Biden and, before that, as Senior Advisor on the Senate Budget Committee. He is now Senior Director of Federal Budget Policy at the Center for American Progress.

Kogan argues that "there is nothing more more quintessential than fighting government oppression." He tells me that he has long argued that nothing is more important to society than "shelter, food and healthcare. I'm the person who says that's the quintessential thing. But, actually, not being executed by the government is the most quintessential thing --- not being executed by the government for existing, and just filming them --- this is a thing you have to shut down the government for."

But at what cost? How many other unrelated agencies will also have to be closed for a time in the bargain? How many Americans will be harmed by those closures? And what exactly are Democrats insisting on in exchange for approving another $10 billion for ICE, after the Republicans' "Big Beautiful Bill" already established a $75 billion slush fund for the out-of-control agency just last Summer?

In addition to guarantees that they will follow the law and the Fourth Amendment's right to privacy with judicial warrants during raids of private homes, Kogan says that Democrats are coalescing on a number of demands, including mandated body cams during enforcement actions and DOJ civil rights reviews of federal government shootings. He also believes that someone, such as DHS Secretary Kristi Noem, will need to be fired, and that clawing back some of that $75 billion granted to ICE last year would also be "a good idea."

"We gave money to the IRS [during the Biden Administration], and as soon as they came to power," he explains, Republicans rescinded much of that money. He suggests Dems should do the same thing as well with the $75 billion that ICE received last year with no-strings-attached.

"There's not much leverage that the Democratic Party has because it is in the minority," Kogan concedes. "But you have to try. Because what else can you possibly do? This is one of the few must-pass bills that still exist. Government shutdowns cannot go on forever because eventually everything starts to break. So it's only a little bit of leverage, but you've got to use it."

Based on his conversations with Democrats in Congress, he tells me, they are not in the mood for "pinky promises from the administration that is busy executing U.S. citizens" when it comes to vows of course corrections. So, he assesses, "the most likely outcome is a six bill shutdown."

"Will it work? I don't know," Kogan asserts. "But Democrats owe it to the American people to do the best they can. Because it is not just political whims or whatever that matters. It matters to real people. And it matters to history. How we respond to this is going to shape what we are as a nation. So Democrats owe it to the American people to give it their all."

FINALLY... The legendary Bruce Springsteen released a new song today via social media called The Streets of Minneapolis. In his announcement, he explained that he "wrote this song on Saturday [the day Alex Pretti was killed], recorded it yesterday and released it to you today in response to the state terror being visited on the city of Minneapolis. It’s dedicated to the people of Minneapolis, our innocent immigrant neighbors and in memory of Alex Pretti and Renee Good." He added: "Stay free."

We've got a lot to get to on today's BradCast. While much of our coverage may seem like a grab bag from the headlines above, you'll find there is a central theme at its heart. I think. [Audio link to full show follows this summary.]

Among our coverage today...

  • We begin with the darkest news, so things can only get brighter from there, right? The Bulletin of Atomic Scientists, keepers of the notorious "Doomsday Clock" reveal their latest adjustment, ticking the metaphorical timepiece from last year's 89 seconds to midnight, to just 85 seconds to humanity's end this year. The group of science advocates cited increasing risk of nuclear warfare, worsening human-caused climate change (Donald Trump was singled out there) and other threats to civilization itself, such as the misuse of biotechnology and artificial intelligence.
  • Buffoonish, Nazi-ish U.S. Customs and Border Patrol chief enforcement clown, Gregory Bovino, is pushed out following the latest killing of another U.S. citizen over the weekend in his violent, chaotic Minneapolis operation. New villains are rotated in by the White House, even as Trump appears to try and play nice with his mortal enemies, Minnesota's Democratic Gov. Tim Walz and Minneapolis Mayor Jacob Frey.
  • But there are even more signs that the courageous people of Minneapolis are winning this one, even if the battle is far from over. The chief federal judge in Minnesota (a George W. Bush appointee) has ordered in-person testimony from the Acting Director of ICE, after the Administration has repeatedly failed to comply with court orders regarding immigrant rights. The judge has ordered him to explain why he should not be held in contempt by the court.
  • Trump's corrupt U.S. Attorney General Pam Bondi's thuggish letter to Minnesota's Gov. Walz --- sent to the state just after the border patrol agent execution of 37-year old VA ICU nurse and U.S. citizen Alex Pretti over the weekend --- landed with a thud, after she essentially suggested the federal immigration crackdown would end only if the state turned over its voter roll data to the federal government. Voting rights and election law experts described the move as "reprehensible". Bondi has sued some 23 states who refused to comply with the demand. Two weeks ago, a federal judge in California dismissed the DOJ's lawsuit against the state, finding it "unprecedented and illegal". Last week, a judge in Georgia dismissed the lawsuit in the Peach State. And yesterday, a federal judge in Oregon dismissed the DOJ's suit there. In the meantime, MN Sec. of State Steve Simon has explained that he has no intention of violating state or federal law to answer Bondi's "ransom note".
  • As we covered last week, a recent federal review of nearly 50 million voter registrations found zero evidence of widespread fraud by noncitizens on the voter rolls in state after state, county after county. In a new report late last week, out of more than two million active voter registrations in Utah, the state was able to find just one single noncitizen on its rolls. The state found that the person never voted and has since been removed from the rolls. Utah is another state that has correctly refused to turn over its unredacted voter data to Bondi and the DOJ.
  • In news from the front lines of the Trump/GOP Gerrymandering Wars, Democrats in Maryland are now moving ahead with a plan to draw a new map designed to flip the state's last remaining Republican U.S. House district from "red" to "blue". And a state judge in Virginia, just before airtime today, declared the effort by state Democrats to adopt a constitutional amendment to redraw its U.S. House map to flip as many as 4 or 5 seats from "red" to "blue" this year to be unlawful. Proponents of the measure accuse Republican opponents as forum shopping for a friendly judge and vow to appeal his ruling.
  • Finally, Desi Doyen joins us for our latest Green News Report following the weekend's deadly winter storm across much of the U.S.; as House Republicans vote to overturn a decades-long ban on toxic mining in MN; as Michigan's Attorney General sues the Big Oil "cartel"; and as a judge blocks Trump's attempt to withhold funding for a national EV charging network adopted by Democrats under President Biden...

It's difficult to fathom. But, we've got hard evidence on today's BradCast that Congress was actually in session today. Both chambers! Doing oversight. Holding votes and stuff! And, when it comes to the Republicans who control those chambers, natch, voting against the best interests of their own constituents. All of that, as Trump continued to lose one battle after another today --- in the courts and even in the state Senate of a very Republican state. [Audio link to full show follows this summary.]

There was also quite a bit of breaking news both right before and during today's hour. Among the stuff we covered...

  • Just before airtime, news broke that yet another federal grand jury has, for a second time, rejected an attempt by the Trump Administration's corrupt Dept. of Justice to revenge indict New York Attorney General Letitia James. If you're keeping score at home, that's one indictment tossed out by a federal judge, followed by two attempted indictments rejected by two different grand juries, against the woman who successfully held Donald Trump to account actual fraud to the tune of hundreds of millions of dollars in both criminal and civil court last year.
  • Also just before airtime, Republican lawmakers in the Indiana state Senate voted to reject a new U.S. House map that would have gerrymandered the Hoosier State's two remaining Democratic seats out of existence, defying Trump's orders, death threats from his supporters, threats to primary those Senators next year, and even his last minute message that he would cut off all federal funding to the state if they didn't obey! To their credit, the state Republicans did not!
  • A federal judge on Thursday found that Kilmar Abrego Garcia was being held unlawfully held by ICE in immigration detention and ordered that he be freed immediately. Despite foot-stomping and promises by Trump's DoJ to appeal, Abrego Garcia was released before today's show ended. He is, of course, the Maryland resident, father and Salvadoran national who was wrongfully deported back to El Salvador earlier this year, before being ordered to be brought back to the U.S. by a federal judge. DoJ then indicted him on seemingly trumped-up charges, which he still faces, and ICE unlawfully tossed him into detention. Until today.
  • Speaking of immigration, Dept. of Homeland Security chief Kristi Noem embarrassed herself and the Administration under questioning from Democrats in the U.S. House Homeland Security Committee on Thursday. We share some of the sharp questioning for DHS Barbie from Democratic Reps. Dan Goldman (NY) and Seth Magaziner (RI). Also testifying today was FBI Director of Operations Michael Glasheen who similarly embarrassed himself and the Administration when trying (and failing) to explain to the Committee's Democratic Ranking Member, Bennie Thompson (MS), why the non-existent "Antifa" organization is now absurdly regarded by the Bureau to be the nation's top domestic terror threat.
  • Over in the U.S. Senate, Republicans blocked a Democratic bill to restore premium subsidies for more than 20 million Americans who receive access to health care via the Affordable Care Act (ACA, or Obamacare). Monthly premiums are now almost certain to skyrocket for millions at years end, leaving many Americans without health care at all. Four Republicans joined the Democrats' attempt to restore the massive GOP cuts, but it wasn't enough to overcome a Republican filibuster. For their part, a ridiculous Republican bill to give Americans about $1,000 per year in a so-called Health Savings Account to somehow cover health care needs, went down in flames. Several pending discharge petitions in the House may force votes next week on the matter in the lower GOP-controlled chamber.
  • "Catastrophic" flooding is forcing evacuations for as many as 100,000 residents in the Pacific Northwest over the next several days, following as much as 18 inches of rain over the past 72 hours in some areas. The Skagit River in Washington, which reaches major flood stage at 32 feet, is now expected to crest at a record 47 feet! All consequences of the climate change disaster which most Republicans pretend is not happening, and pretend to not be caused by the man-made burning of fossil fuels.
  • With increasingly dangerous floods, droughts, storms, fires, etc., it is disappointing to learn that Zillow, the nation's largest real estate listing site, is removing a feature, added just last year, that allowed home buyers to learn about a property's exposure to the climate crisis. Making climate risk data more difficult to find and use, does not make its reality disappear, however. "The risk doesn’t go away,” says Matthew Eby, founder of the non-profit financial climate risk modeling site, First Street, which supplied the scientific data previously used for the Zillow feature. "It just moves from a pre-purchase decision into a post-purchase liability." Good luck, home buyers!

Is a similar ruling on Trump's military invasion of U.S. cities far behind?...

Even if nothing else was taking place at this perilous moment, the September 8 SCOTUS decision to temporarily suspend both a presumption of innocence as well as the right, previously guaranteed by the 4th Amendment, not to be seized absent a reasonable suspicion of unlawful status, is deeply disturbing. Taken in context of recent events, the Court's decision on the "shadow docket" poses an ominous threat.

The decision was handed down after the "dangerous sociopath", President Donald J. Trump, threatened to arrest California Gov. Gavin Newsom, one of his chief political rivals. More importantly, perhaps, it was handed down shortly after Trump threatened to use the U.S. military to invade Chicago.

If the same SCOTUS majority goes on to temporarily suspend the Order issued on September 2nd by U.S. District Court Judge Charles E. Breyer, that enjoined Trump's use of the military to engage in local law enforcement without the consent of State and local authorities --- an action that Breyer ruled to be in violation of the Posse Comitatus Act --- it could hasten a bitter end to federalism and to our constitutional republic…

On today's BradCast: Like everywhere else in the federal government, the Trump Administration's IRS seems determined to undermine decades of the rule of law. Specifically, 75-years of tax law as it regards elections and the separation between church and state. But why would he stop there? [Audio link to full show follows this summary.]

A few headlines before we get to today's main story...

  • A lively Democratic primary election was underway on Tuesday in Arizona's 7th Congressional District for a Special Election to fill the vacant seat of Democratic Rep. Raúl Grijalva, who passed away in March. Among the five candidates running are Grijalva's 54-year old daughter and a 25-year old political influencer. Both are progressives, as the race appears more about generational change than ideology. Republicans are holding a three-way primary as well today, in the geographically large and otherwise very "blue" district stretching into Tucson and across the southern border of the state.
  • New figures from the Dept. of Labor out today find consumer prices rising again, as Donald Trump's inflationary tariffs begin to take hold, just as pretty much all legit economists had long warned. The overall rate ticked up to 2.7% in June after clocking in at 2.4% the month prior. Trump has promised still larger tariffs in the weeks ahead, even as he pressures the Fed to lower interest rates --- which could further spike inflation.
  • Both the New York Times and Washington Post recently filed stories focused on implementation of new tax policy by the Administration following the Trump/GOP budget law that is now set to slash more than $4 trillion in taxes, mostly for the wealthy. The Times highlights Ken Kies, the longtime corporate lobbyist who Trump has tapped to head-up tax policy at the Treasury Department. After decades helping the ultra-rich and major corporations dodge taxes, Kies --- who was approved last month on a party-line vote in the Senate --- will now be able to adapt those tax-cheating skills to writing policy for the federal government itself.
  • THEN... Speaking of both taxes and election, we're joined by Professor ELLEN APRILL, longtime, recently retired tax law expert at Loyola Law School, now Senior Scholar in Residence for Philanthropy and Nonprofits at the UCLA School of Law.

    Last week, lawyers for Trump's Internal Revenue Service filed a stunning settlement agreement [PDF] in court, in a case filed against the government by several Texas churches and a group of religious broadcasters. The agreement, if accepted by the court, would allow houses of worship to endorse political candidates, despite their tax-exempt nonprofit status.

    The settlement would, at least for the specific challengers in this case, block the 75-year old Johnson Amendment which mandates that churches and other nonprofits may not participate in "any political campaign on behalf of (or in opposition to) any candidate for public office."

    That news was reported last week with much fanfare, suggesting the Trump Administration's IRS had declared it lawful for churches to endorse political candidates from the pulpit. The truth is not quite as awful...thought it's close. And it could quickly get worse if this agreement is approved by the judge in this case.

    "Technically, it is not a new statement of general application from the IRS," Aprill tells me today. "It is simply a settlement of a particular case involving two plaintiffs --- two churches and the National Religious Broadcasters --- and if the judge were to rule the way that the government and the plaintiffs have asked, it would enjoin enforcement of the Johnson Amendment for statements during worship [but] only for these two churches."

    But, as Aprill told the New York Times last week, "Even Las Vegas doesn’t stay in Las Vegas these days." The agreement on its own, if finalized, does not set legal precedent, she explains. But it may help to clear that path moving forward. And, in the meantime, she notes, it wouldn't just apply to places of worship communicating with their members --- like “a family discussion concerning candidates --- as the IRS motion characterized it. It could be used to endorse candidates on web sites run by churches with tens of thousands of members and, of course, millions of viewers across the country.

    Moreover, non-religious 501(c)(3) nonprofits are likely to soon say, "I don't know why you can do it for them, and not for me," warns Aprill. "They are really arguing for expanding the rule, not taking it away from houses of worship."

    It could also lead, she worries, to "faux churches, faux houses of worship, being formed just to get the tax deductible contributions" since "unlike other 501(c)(3)s, houses of worship do not have to file to become tax exempt, they do not have to file the annual information return that other 501(c)(3)s do."

    As if we don't have enough Dark Money in our electoral system already, this Administration --- led by a President who, in 2017, vowed to "get rid of and totally destroy the Johnson Amendment" --- seems hell bent (pun intended) on corrupting what's left of our democracy even further.

  • FINALLY... Yes, we are under a fascistic, authoritarian takeover of the United States. Yes, it can be frightening. But our wannabe authoritarians also happen to be clowns and fools and incompetent buffoons, and should be called out at such. And so we do on today's BradCast, even while our best chance to kick these degenerates to history's curb remains at the ballot box. Which is why they are fighting so hard to game it. Again. Among our coverage today...

  • Trump's EPA reverses its position to do the right thing after all regarding the Biden Administration's ban of cancer-causing asbestos? Can it really be true?
  • Donald Trump meets with African leaders at the White House, admires the Liberian President's excellent English and wonders how he learned to speak it so "beautifully". (Spoiler: English is the official language of Liberia.)
  • As recovery efforts continue following deadly flash flooding last Friday in Texas (and on Sunday in North Carolina, and on Tuesday in New Mexico), dullard DHS Sec. Kristi Noem convenes a meeting to discuss the Admin's stated plans for dismantling FEMA entirely. Her argument for doing so this week? A report that she claims reveals that FEMA's response to the 2023 wildfires in Maui, Hawaii was so bad that "one in six survivors were forced to trade sexual favors...for just basic supplies." But that's not what the report claims at all, and one of its authors calls Noem's interpretation a "gross manipulation" of their work.
  • Native American voters won a 2023 trial challenging North Dakota's racially gerrymandered legislative maps. But then the 8th Circuit Court of Appeals tossed out their 2023 victory, claiming the challengers lacked standing to sue because Article 2 of the Voting Rights Act doesn't explicitly allow individual groups or voters to challenge violations of the Act. Only the Dept. of Justice may do so, according to the 8th Circuit, despite decades of rulings to the contrary in the 60 years since passage of the VRA. The court's ruling last year now prevents private suits against discriminatory election laws in the seven states (Arkansas, Iowa, Minnesota, Missouri, Nebraska, North Dakota and South Dakota) comprising the 8th Circuit. On Wednesday, the tribes announced they were filing for a stay at the Appeals Court, as they intend to appeal to the U.S. Supreme Court.
  • Speaking of racial gerrymandering, on Wednesday, Texas Gov. Greg Abbott --- even as recovery efforts continue on the Guadalupe River where more than 100 are now dead and 160 still missing following Friday's flash-flooding --- wants the state legislature to convene a special session to...redistrict U.S. House seats in the state. TX Republicans already hold twice as many Congressional seats as Dems in the already-gerrymandered state. But the Trump White House and its corrupted DOJ have been pressuring TX to carry out a rare, mid-decade redrawing of its Congressional map in order to make four Democratic, minority-held seats around Houston and Dallas less...um...colorful. Abbott appears happy to oblige...

Massive 'No Kings' rallies across nation; Trump's military parade flops; Israel bombs Iran; Political assassination in MN; Callers ring in with reports from their own protest experiences...

Going into the weekend we knew we were in for a bizarre news split-screen on Saturday, with major protest rallies scheduled across the country and Trump's military birthday parade he threw for himself (with $40+ million of your tax dollars) in D.C. But, it wasn't just two huge stories happening at once by Saturday. It was four. We try to get you caught up on all of them on today's BradCast before opening the line to callers. [Audio link to full show follows this summary.]

All of the stories happening all at once over the weekend, were all thanks to Donald Trump in varying ways...

  • First, on Friday night, Israel unleashed a full-scale attack against Iran, killing its three top military commanders and several nuclear scientists --- among many others. The pretext for the attack was Iran's nuclear program which, had Trump not torn up the JCPOA (Joint Comprehensive Plan of Action), the hard-fought and carefully constructed nuclear deal Iran agreed to in 2015 with China, France, Germany, Russia, the UK and the U.S., there wouldn't even be a program for Israel to target. The strike came after Trump failed to strike a new nuclear deal with Iran, which had restarted its nuclear program after Trump reneged on the original deal. He had been begging them for the last month to agree to a new deal to limit its nuclear program that is almost identical to the one struck under Obama that Trump tore up during his first term. The ongoing volleys of missiles between Israel and Iran have also led the Trump Administration to call back the Voice of America Persian-bureau after foolishly (and unlawfully) shuttering VOA and its sister networks back in March.
  • In the early Saturday morning hours, a long-time Trump supporter disguised as a policeman assassinated the Democratic leader of Minnesota's House of Representative, Rep. Melissa Hortmann, and her husband inside their own home. Hortmann, as House Speaker in 2023-2024, was a key player in passage of a host of popular progressive initiatives under Gov. Tim Walz that came to be known as the Minnesota Miracle. The same shooter also attempted to assassinate Democratic state Senator John Hoffman at his house just prior. Hoffman and his wife remain alive but in critical condition after Hoffman was shot nine times and his wife eight times. The alleged rightwing assailant, 57-year old Vance Luther Boelter, was found to have had a list of some 70 names on a target list in his car. The names were reportedly Democratic officials, both state and federal, and champions of abortion rights. Officials also say he had a number of "No Kings" flyers in the car, suggesting he might have been planning to target one of Saturday's many protests in the state. After a two-day manhunt, Boelter was captured late on Sunday in a cornfield south of Minneapolis/St. Paul. He was charged on Monday with both state and federal crimes including assassination and attempted assassination. It is just the latest example of increasing political violence by the right in the Trump Era, as warned about for years, even by his own FBI Director who conceded that domestic homegrown terror from those on the right --- not by migrants --- was, by far, the greatest threat currently facing Americans.
  • The third major weekend story happening all at once that wouldn't have happened if not for Donald Trump, was the authoritarian-style military birthday parade he threw for himself (though we paid for it) that happened to fall on the U.S. Army's 250th birthday as well as Trump's 79th. It was, by almost all accounts, a sparsely attended snoozer of a parade which saw even Trump supporters streaming away long before it was over. Of course, the manhunt for the MN assassin and the war in Israel/Iran, thankfully, sucked up most of the cable TV news coverage.
  • In likely --- or hopefully --- the most important news of the weekend, some five million Americans took to the streets to stand up against the President in "No Kings" protests decrying the rising fascism of Donald Trump, including his deployment of military troops against Americans on U.S. soil and his burgeoning military-style migrant round-ups by ICE. According to organizers, enormous and joyful rallies were held in more than 2,000 cities and town in all 50 states. They were almost all entirely peaceful but for a man who brandished a rifle at protesters in Salt Lake City, UT (a protester was killed); a counter-protesters who pulled a handgun on rally-goers in Phoenix, AZ; and an SUV driver who struck and injured a demonstrator before speeding away in Riverside, CA.

    In Los Angeles, late in the day, there was a bit of violence as well. But, as all reporting seems to indicate (David Dayen's at TAP was the best) it was local law enforcement officials from both the L.A. County Sheriff's Dept. and the LAPD who sparked the violence with their unannounced use of horses, rubber bullets and teargas to suddenly clear demonstrators at 4pm, hours before the rally was to have ended in Downtown L.A.

Trump's 'new police state' expands with masked men in small towns; Also: Voters rejecting Trump and his policies; Nat'l Guard unpaid in L.A.; Trump signs bills after GOP Senate nukes filibuster to end CA clean car laws...

Sadly, it's another in our Trump 2.0 Era "Then They Came For..." series on The BradCast, which previously included "the Judges", "the Mayors" and "Members of Congress". In today's case, at least, the victim, a U.S. Senator, was roughed-up and handcuffed but not arrested and was fairly quickly released. But those elected officials are hardly the only folks they are now coming for in Donald Trump's "New Police State". [Audio link to full show follows this summary.]

Among our stories today highlighting that New Police State, Trump's continuing failures as President on several fronts, and his ongoing war with the Golden State...

  • Breaking shortly before airtime... Just two days after the Trump Administration's corrupted and actually weaponized Dept. of Justice indicted a sitting Democratic U.S. Congresswoman from New Jersey on absurd assault charges related to allegedly impeding the arrest of Newark's Democratic Mayor (for whom all charges were soon dropped), California's Democratic U.S. Senator Alex Padilla, the state's first Hispanic Senator, was roughed up on Thursday, forcibly pushed out of a room where Homeland Security chief Kristi Noem was holding a press conference in L.A., was thrown onto the floor by FBI agents and handcuffed after he'd peacefully dared attempt to ask a question of Noem.
  • A new Quinnipiac poll finds that Donald Trump is being rejected by voters on virtually every front. His approval rating in the survey of more than a thousand registered voters has now fallen to 38%; his budget bill is opposed by almost twice as many as those who support it (while a huge majority of Americans want to see Medicaid expanded or left as is, as opposed to cut, as the Trump/GOP "Big Beautiful Bill Act" would do); and he is deeply underwater on every single issue they polled on, including immigration, deportation and the economy. New polling out today from AP/NORC finds similarly poor numbers for the President, which is largely unprecedented in modern times this early in a new term.
  • Those 4,000 California National Guard soldiers federalized by Trump and deployed against Americans on U.S. soil over the weekend against the wishes and needs of the state's Governor and the Los Angeles Mayor? They aren't getting paid yet, according to Military.com, which cites military sources describing a chaotic, still-incomplete activation, leaving soldiers without pay, a place to sleep, food, amid a local community uncharacteristically unsupportive of the deployed troops.
  • But Trump's New Police State is not only rolling out in large cities. WaPo's Catherine Rampell has a chilling story of heavily armed masked men, claiming to be federal agents (while refusing to show ID), showing up with out-of-state plates to sweep up migrant gardeners in a tiny New England town. Yes, Trump's New Police State is coming to a town near you as well, no matter where you live.
  • On Thursday at the White House, Donald Trump signed three bills that were recently --- and perhaps unlawfully --- rammed through the Senate by Republicans in violation of its rules, nuking the filibuster in the bargain to do so. They are meant to strip California of its legal right to establish its own clean air and car pollution standards. Specifically, the new laws, if they are allowed to stand --- CA has already said they are filing suit --- would, among other things, ban the state's 2036 deadline for phasing out the sale of new, gasoline-only cars and trucks. A dozen or so other states have previously adopted CA's now "banned" standards. Despite the fact that used all-gasoline cars and trucks could still be sold and that those who really wanted a new one could still buy them from another state in 2036, this is apparently what Trump has been falsely describing as "Joe Biden's EV mandate" for years now. Today, once again, he did another solid for his owners in the fossil fuel industry. Desi Doyen has the full scoop and context.

We've got a bit more on today's BradCast regarding Team Trump's attempt to distract from the many failures of his Administration by hoping to frighten Americans with the deployment of military assets against those of us here in Los Angeles. Plus, we've got a number of other stories that I suspect they would be happy for us not to tell you about today. [Audio link to full show follows this summary.]

The City of Angels continues to hang tough against the Trump Administration, even as horrible human and DHS Secretary Kristi Noem, last night, described the city of nearly four million people as "a city of criminals". The pathetic insult against the nation's second largest city came after Trump federalized 4,000 California National Guard troops against the wishes of the state's Governor, Gavin Newsom, and deployed 700 U.S. Marines to L.A., purportedly to help ICE round up migrants as part of the Administration's by the San Francisco Chronicle from Noem to Fox "News" host turned SecDef Pete Hegseth, the DHS chief requests Hegseth order military troops to actively participate in arrests and detentions on U.S. soil, an apparent violation of the law, unless the President invokes the Insurrection Act first under certain circumstances. Her letter suggests the Administration is preparing to do exactly that. Or she doesn't understand how the law works. Or both.

In 2020, after George Floyd was murdered, spurring far larger protests than the relatively minor ones we've seen here in L.A. in recent days, Donald Trump insisted it would be against the law for him to federalize and deploy troops against the wishes of a Governor. "We have laws. We have to go by the laws," he insisted at the time. "We can't move in the National Guard. I can call 'insurrection' but there's no reason to ever do that. We can't call in the National Guard unless we're requested by a Governor."

Things change. Presidencies fail. The protests against the Administration in cities large and small are expanding by the day from coast to coast.

We've got much more for you today on all of this to remind you of many of Lindell's ridiculous lies, schemes, antics and evidence-free allegations. Though they are completely nuts, his own attorneys now seem to be hoping to use them in order to buttress his defense. Tune in for details.

Well, it's our last BradCast for a week or so, as we prepare for a muuuch-needed stand-down next week after Memorial Day. But we make up for it by packing a lot into today's program, with two of our favorite (and your favorite) guests. [Audio link to full show follows this summary.]

We're joined today again for one of our semi-regular (irregular?) round tables with our old-school, right-about-everything-for-20-years blogger pals, HEATHER DIGBY PARTON, award-winning columnist at Salon and her own Digby's Hullabaloo blog; and the notorious 'DRIFTGLASS', blogger and co-host of the weekly Professional Left Podcast from Flyover Country, Illinois.

As noted, we cover a whole lot of ground today, including both important and incredibly dumb news alike! Among the important news...

  • DoJ Team Trump attorneys are upbraided in court by a U.S. District judge in New Jersey for indicting Newark's Democratic Mayor Ras Baraka on ridiculous trespassing charges, vowing last week to bring him to trial, only to drop all charges this week. At the same time, they then went on to indict Democratic Congresswoman LaMonica McIver on ridiculous charges stemming from the same incident two weeks ago at an ICE detention facility in Newark. Those charges will also likely be dropped eventually, and Trump's former loser defense attorney, now interim U.S. Attorney in NJ, Alina Habba, will likely find herself upbraided again.
  • After Trump spent years campaigning on promises to not touch Social Security, Medicare or Medicaid, House Republicans earlier today barely passed Trump's budget bill that --- you guessed --- will slash both Medicare and Medicaid by more than a trillion dollars, taking away health care from as many as 14 million Americans. That, in order to help pay for tax cuts to wealthy people while ballooning deficit spending by about 4 trillion dollars. (Digby: "It's a complete travesty, and I think everybody knows it.")
  • The Trump Regime's ongoing horrors and errors and blatant, thuggish, authoritarian violations of court orders regarding his clownish yet cruel and unlawful mass deportation efforts. (Driftglass: "This is a mass weapon attack, like raining missiles down on an enemy target. Some of it is going to get through. And they'll get most of what they want.")
  • Qatar's $400 million bribe to Trump in the shape of a Boeing 747 "flying palace" that may never be used as Air Force One, but that he hopes to keep for his own personal use after his Presidency. "Emoluments," like "groceries," is such an old-fashioned word. (Driftglass: "He's just a giant greed hole of need and narcissism." Digby: "It sure sounds like 'I'd like you to do us a favor though...'")
  • And, oh, yeah, Republicans on Thursday also nuked the filibuster in the U.S. Senate by ignoring the Senate Parliamentarian to pass a law with a bare majority that, according to Senate rules, requires 60 votes for passage. And they did so in order to ban California's clean air laws. So much for states' rights. That, despite the fear by many Democrats of nuking the filibuster to protect Voting and Reproductive Rights for all Americans when they last controlled the Senate. (Digby: "Senate rules are dead. So get ready. We are in such untrod territory.")

As you might imagine, both Digby and Driftglass have quite a few thoughts on all of the above, as well as on the Dumb News we cover today as well (apologies in advance)...

  • Trump's Director of Homeland Security, Kristi Noem, doesn't know what "habeas corpus" means.
  • Republicans are pretending to be horrified by former FBI Director James Comey posting a photo of someone spelling out "86 47" in seashells on a beach. (Ya know, just like those "86 46" t-shirts rightwingers used to pimp. Says Digby: "This is a Republican thing, and they've been doing it forever." See her "Art of the Hissy Fit" from 2007 for more.)
  • Trump is attacking and threatening Bruce Springsteen. Bruce Springsteen!
  • And the dumbest news of all this week: Jake Tapper has a book about Joe Biden and a super-duper, totally important right now, conspiracy cover-up of his physical --- and, allegedly, cognitive --- decline while in office.

Don't worry. I didn't give away the best lines or hottest takes on either the important or dumb news, so tune on in!
