We continue our laser focus on the track conditions for the 2024 horse race on today's BradCast, with somewhat better than usual news in a couple of different states. [Audio link to full show follows this summary.]

Among our many stories covered on today's program...

  • Hurricane John made landfall on the west coast of Mexico overnight, after spinning up from a tropical storm to a full-on Cat 3 in a single day, before blowing ashore. That, thanks to the storm's rapid intensification over record warm waters due to climate change. With that ominous note, Tropical Storm Helene, currently in the Caribbean, is also spinning up quickly over record warm waters and could soon become a very large and very dangerous hurricane as it guns for landfall along Florida's Gulf Coast by Thursday night.
  • It looks like the threat is over in Nebraska for now. As we reported last week, Republican lawmakers in the state --- one of just two which divvy up Electoral College votes by Congressional district, rather than winner-take-all --- were being hard-pressed by Team Trump to change the way the state apportions electoral votes before November's election, just six weeks away. Kamala Harris' "Blue Wall" strategy of reaching the 270 Electoral College votes needed to win the White House by carrying battlegrounds Wisconsin, Michigan and Pennsylvania along with the other traditionally "blue" states, requires that she also win the one single Congressional district around Omaha, as Joe Biden did in 2020. It is, as a grassroots campaign in the district characterizes it, a "blue dot" in an otherwise very "red" state. Nebraska's Republican Governor said last week that he would be willing to call a special session of the state legislature to change the 30-year old law for apportioning electoral votes to advantage Trump, if Republican lawmakers had the votes to do it. On Monday, however, a former Democratic state Senator turned Republican announced he would vote against the scheme, all but killing the possibility for now, according to the Governor today. As we discuss, however, that Omaha Senator may have had ulterior motives above and beyond his seemingly altruistic decision to simply do the right thing for democracy.
  • Good news late last week out of Arizona as well! Some 98,000 registered voters will not be blocked from voting in state and local elections and ballot measures this year. That, after a unanimous ruling from the state's Supreme Court on Friday. Republicans in the state have been working for years --- decades, in fact --- to purge voters from the rolls who failed to present proof of citizenship when registering to vote. There are a bunch of good reasons that registrants wouldn't have done so. (For example, if they registered prior to the state's 2004 requirement, or registered via the National Voter Registration Form which does not inform Arizona voters that proof of citizenship documents are required to vote.) But, last week, when the state announced that, thanks to a newly discovered glitch in the state registration database, nearly 100,000 voters were on the rolls without having submitted proof of citizenship --- due to some confusion with how the state motor vehicle office renews driver's licenses --- the matter ended up at the state Supreme Court. And, shockingly, the AZ Republican Party in this case, in a remarkable flip-flop from years of advocacy to the contrary, argued to keep those voters on the rolls! Why? Well, as it turns out, the voters in question, according to the state's Democratic Sec. of State (who also argued to allow the voters to remain fully registered), there were about 10,000 more Republicans on the list of voters than Democrats. Apparently, the GOP isn't that concerned about non-citizens voting after all --- as long as they're registered as Republicans. (Please note: Despite years of attempts by Republicans to mandate citizenship documentation or demand the purging of potential non-citizen voters, they have failed to offer evidence that more than a miniscule handful of non-citizens are actually registered to vote, much less actually voting in U.S. elections.)
  • The only way to vote that is more dangerous and less publicly overseeable than touchscreen voting is Internet Voting. And, yet, as much as cybersecurity and voting system experts advocate strongly against it, more and more states are allowing online voting for overseas citizens and military voters. One such state, apparently, is Montana, whose online voting system was opened for the 2024 election on Friday. It took only a few hours, it seems, before one voter noticed that Kamala Harris' name wasn't on the ballot in the Presidential race.
  • Joe Biden gave his final address as President of the United States to the U.N. General Assembly today. We're happy to share a few excerpts from his remarks on the need for the world to come together to end wars, take on the climate crisis, safeguard against the dangers of artificial intelligence and protect democracy...among other things.
  • Finally, Desi Doyen joins us for our latest Green News Report, as Climate Week kicks off in New York along with the U.N. Unlike Microsoft Windows, says our guest on today's BradCast in response to Bill Gates' new book on climate change, "if the global climate system crashes, you can't reboot it." Of course, what does a billionaire software engineer know about how to save our climate anyway? Well, our guest --- an actual Nobel Prize-winning climate scientist --- has a few thoughts on that as well. [Audio link to full show is posted below summary.]

First up, however, a few quick, breaking news items as usual...

  • The U.S. House has decided to adjourn for the week a day early after Capitol security officials warned of what they described as credible threats by rightwing extremists surrounding what QAnon dupes cite as the "true Inauguration Day" on March 4th (the day originally set by the Constitution). While the House may be scramming, the Senate will supposedly stay in session, as Capitol Police have "enhanced their security posture" and National Guard troops remain posted at the Capitol.
  • Before leaving, however, it appears that the House Oversight Committee has renewed its subpoena for tax and other financial records from Donald Trump's accounting firm, Mazars USA. The disgraced former President had successfully stalled the Committee's original effort, beginning in 2019, blocking the documents from being given to the panel for 22 months until the subpoena expired at the end of the legislative session last year. Committee Chair Rep. Carolyn Maloney (D-NY), however, is not giving up in her effort to obtain the documents. In a court filing, she described the subpoena and need for Trump's financial records as "just as compelling now as it was when the Committee first issued its subpoena" as "the committee's investigations into presidential conflicts of interest, presidential contracts with the federal government and self-dealing, and presidential emoluments” continue.
  • And President Biden offered some thoughts on what he described as a "big mistake" and "neanderthal thinking" by the Republicans Governors of Texas and Mississippi. On Tuesday, they both lifted statewide mask mandates and declared all businesses may now open to 100% capacity. That clever if wildly dangerous distraction comes while tens of thousands of residents in both states are still without running or clean water following a winter storm more than two weeks ago, and as both states rank in the top ten for COVID deaths per capita.

Then, with Trump out of the White House and Dems in control of both chambers of Congress, it seems a very good time to renew the previously forestalled federal efforts to take action on our critical climate crisis. Private industry has figured out the urgent need. This week, Volvo announced they would move to an all-electric car line by 2030 and, in just four years, by 2025, would produce only electric or hybrids. And the American people seems to have figured it out as well. By a whopping 79% to 20%, they now favor the development of renewable energy over the continued production of fossil fuels.

So, it's time to finally restart the debate about how best to move forward again to save our climate by decarbonizing our economy. We're joined today by award-winning climate scientist DR. MICHAEL E. MANN, Distinguished Professor and Director of the Earth System Science Center at Pennsylvania State University, author of nearly 200 peer-reviewed papers and loads of books, including his latest, The New Climate War: The Fight to Take Back Our Planet.

Last week, Mann penned an op-ed for Newsweek, detailing two very different potential paths forward. One, he describes as a "technocratic" path which "envisions climate action as a mere engineering problem" to be solved with massive --- if dangerous --- geoengineering schemes, as detailed in software mogul Bill Gates' new book, How to Avoid a Climate Disaster: The Solutions We Have and the Breakthroughs We Need. The other, which Mann favors, is the "sociopolitical" path relying on safe, clean, already-existing technologies.

"It can be a bit frustrating," he tells us. "To the extent that Bill Gates might use his platform to create more public awareness for the climate crisis, that's great. The thing that troubles me is that his prescription is wrong-headed, in my view. It's overly technocratic. It's like if your only tool is a hammer, everything looks like a nail.  If you built your reputation, if your role in society has been to promote computer technology, technological or technocratic solutions to problems, everything looks like a technocratic problem."

"The problem is climate change isn't a technocratic problem," Mann argues. "We have the solutions --- wind, solar, geothermal. [Gates] downplays those solutions, based on what I would say is an unbalanced assessment of the literature and what researchers have found. He downplays the potential for renewable energy to meet our needs and help us decarbonize our economy. By downplaying the obvious solution, it leads him to promote far riskier strategies --- like geoengineering, massively interfering with the Earth's system in some other way to try to offset global warming. What could possibly go wrong?"

"This problem at this point is a political problem, it's not a technological problem. We have the solution. The problem is that we don't yet have the representation in our government," asserts Mann, noting that Gates "actually said, 'Well, I don't know what the solution is to the politics here.' If you don't know the solution to the politics, then you don't know the solution to the problem, because that's what it is at this point. It's a political problem."

Our conversation is enlightening, encouraging, and, yes, maddening at times. We discuss, for example, one of Gates' "solutions" to the climate crisis: more nuclear energy. But even a number of esteemed climate scientists argue that we can't decarbonize without relying on nukes. Mann disagrees and explains why.

He cites peer-reviewed literature from energy experts who "all come to the conclusion that we can meet 80% of projected energy demand by 2035 from renewables, and 100% by 2050...based on existing technology," adding, "That's without nuclear."

As usual, there is much more in our in-depth conversation with Mann than I can cover here, but that is well worth tuning in for. Mann himself, in his Newsweek piece, notes that both he and Gates are optimistic about the future, and that he hopes to find places where their two different paths toward the same ultimate goal may converge. "Whether we have a crisis is no longer a matter of worthy debate. Precisely how we solve it is."

And, yes, we welcome a response from Gates. Happy to have him on the show, with or without Mann there to debate him as he sees fit. Though we do hope that our good-spirited snark today about Windows crashing won't keep Microsoft's former CEO from dropping by...

We warned you weeks ago to "buckle up" for what was to come between then and Election Day. On today's BradCast, a mountain of reminders as to why we issued the warning, as we hope that everyone remains buckled up until the madness comes to a full and complete stop. [Audio link to full show follows below.]

We begin today with the news that rocked the nation on Wednesday and continues reverberating today. Excerpts of audio recordings from Bob Woodward's eighteen separate interviews with Donald Trump for his new book revealed (among many other things) that the President was fully aware of the dangers of the coronavirus crisis as early as the beginning of the year, even while he was misleading the public about it. During one recording on February 7th this year, Trump told the Washington Post's Watergate journalist that the virus was transmitted through the air, was "more deadly than your strenuous flues" and was "deadly stuff". By March 19th, he is heard on tape telling the best-selling author that the COVID-19 disease was also affecting "plenty of young people" and that he "wanted to play it down" because, according to the recordings, he didn't "want to create a panic".

At the exact same time that he was telling Woodward one thing, Trump was lying about the virus publicly as more than 190,000 Americans have now died in the months since he first made clear to Woodward that the disease was wildly contagious and lethal. In mid-March, when he explained his strategy of down-playing the virus, only 150 Americans had died. Still, Woodward sat on the information until this week.

No doubt you've seen the reactions by now from many Democrats, including Joe Biden and even from anti-Trump Republicans. But what of the responsibility that Woodward himself had to warn the public about what Trump knew but was refusing to acknowledge publicly --- and, in fact, was lying publicly about?

We're joined today by investigative journalist DAVID SIROTA, former speech-writer for Bernie Sanders' 2020 campaign and now founder of the "Too Much Information" (TMI) newsletter. On Wednesday, in his TMI column, Sirota charged (as we long have) that Trump's actions constitute "a horrific crime against humanity," but, he adds, "it was aided and abetted by the popular face of investigative journalism: Mr. All The President's Men himself."

"The President of the United States said something to the nation's most famous reporter, and the most famous reporter sat on that information for seven months while tens of thousands of people died," Sirota says today. "Donald Trump committed a crime against humanity and Bob Woodward drove the getaway car."

Sirota is not the only journalist, progressive or otherwise, who has been highly critical of Woodward over the past 24 hours. So has Esquire's Charlie Pierce. So has The American Prospect's David Dayen. So has even the Washington Post's own Margaret Sullivan. And so are we.

"As a journalist, your job is to get the news from elected officials and to, at minimum, report what they say, and certainly report discrepancies in what they are saying," Sirota argues. "Your job is not to suppress that information, to hold that information while tens of thousands of people die, and to hold it to juice your book sales later on at a more opportune time. That is what happened."

Woodward has attempted to defend himself in several interviews since WaPo released the stunning recordings (which also reveal much more than Trump's secret views and/or knowledge about COVID-19). Sirota responds to Woodward's limp defense and to Trump's use of Woodward as "a human shield" today, when the President tweeted that Woodward's failure to release the information earlier was evidence that Trump's remarks were not "bad or dangerous," otherwise Woodward would have "immediately report[ed] them in an effort to save lives."

Sirota describes the entire fiasco as a "collision of both the corrupt political system and a deeply corrupt media culture" and tells me: "I genuinely believe that this is the biggest scandal in modern journalism."

As journalists, he asserts, we have "a duty to warn". Ironically, as the Poynter Institute, a journalism think-tank and fact-checking organization, reports in its own story asking "Was it unethical for Bob Woodward to withhold Trump’s coronavirus interviews for months?", Woodward himself is very aware of that duty --- if, perhaps, not for himself. "Woodward will be on CBS’s '60 Minutes' Sunday," Poynter's Al Tompkins reports. "In an excerpt of that interview, Woodward told CBS’s Scott Pelley, 'The president of the United States has a duty to warn.'"

Next up --- if you're still buckled in --- a new report from Microsoft today finds that Russia's military intelligence agency, the G.R.U., the same group alleged to have hacked and leaked email from the Hillary Clinton Campaign in 2016, is back at work in 2020 and has become more adept at covering their tracks. Moreover, the findings of the report contradict the Trump Administration's claims about both Russia and China. And for good reason. The Administration has corrupted U.S. intelligence to report what Trump wants the public to believe, rather than actual facts.

The new report alleges that Russia is attempting to access material from both the Trump and Joe Biden campaigns, and that China --- which Trump and the White House National Security Advisor and the U.S. Attorney General all claimed to be a greater threat to the 2020 election than Russia --- is actually focused on hacking Biden, not Trump. The Administration has claimed, falsely apparently, that China prefers Biden over Trump. Today's report, however, suggests just the opposite.

Given the extraordinary whistleblower report released on Wednesday by the House Intelligence Committee from one of Trump's senior officials at the Department of Homeland Security, none of this should be a surprise. The official, Brian Murphy, details in his complaint how he was instructed to change intelligence to remove references to Russian interference and add threats from China and Iran instead, because Russian interference in the U.S. election "made the president look bad," according to complaint.

Murphy's complaint also details how he and others were instructed to change intelligence assessments to match Trump's misleading claims and rhetoric regarding "antifa", to minimize the greater threat of White Supremacy groups, and to downplay anything about Russia all together. He says he was also instructed to change data to match the Administration's false narrative about terrorists coming across the U.S.-Mexico border, and about the dismal conditions in Central America that were undermining the Trump Administration's asylum policies. The result, Murphy charges, is intelligence assessments that "more closely resemble a policy document...than an intelligence document.”

As noted on today's show, this is decidedly not how intelligence gathering and analysis is supposed to work. In fact, it's the exact opposite. Murphy refused to make the changes mentioned, and he was eventually cut out from work on the national Homeland Threat Assessment and demoted from Deputy Under Secretary in the DHS Office of Intelligence and Analysis to a position in the agency's Management Division.

Guest: Cybersecurity journalist Kim Zetter on her jaw-dropping new exclusive finding battleground election systems vulnerable on the Internet despite claims to the contrary by elections officials, private vendors...

On today's BradCast: Elections officials seem to be panicking around the country, and for good reason. But their concerns may be coming a bit late...perhaps a decade or so too late, as virtually every aspect of our "public" elections in the U.S. --- from ballot programming to registration to voting to vote tabulation to election results reporting --- has now been allowed to have become largely taken over by private vendors and contractors, with little or no oversight from either state or federal officials. [Audio link to today's full show is posted at end of article.]

An exclusive analysis last month by AP found that virtually all voting systems currently in use in the nation's 10,000 separate voting jurisdictions in all 50 states run on software --- Windows 7 or earlier --- that will no longer be supported by Microsoft with regular security updates and patches as of January. That includes systems certified by the U.S. Elections Assistance Commission (EAC) from the nation's largest private elections vendors as recently as this year. Those newly certified systems still use Windows 7, which was released a decade ago in 2009.

Of course, the EAC's certification process --- for the few states which choose to follow federal voluntary (yes, voluntary) guidelines --- has been laughable for years. It focuses on usability and functionality, not security. Most systems in the U.S., if they are EAC certified at all, were tested to guidelines published by the EAC in 2005.

At a summit this week of elections officials and vendors, hastily convened by the EAC in Maryland in response to the disturbing AP analysis, officials complained about the lack of federal support and standards, and that financially strapped and technologically challenged elections divisions at both the state and local level are realizing only now that they are being asked "to take part in what is national security" with little or no help from the federal government. One official at the EAC confab reportedly complained: "We are talking about local communities having trouble funding roads and water bills, and now we want them to take part in defense against foreign and state actors."

Of course, it is not only nation-states like Russia that pose a threat to the security of America's vulnerable, computerized and privatized public elections, so do regular old Americans, as the recent hack by a woman in Seattle of more than 100 million customer records at Capitol One proved, along with the vulnerabilities in brand new voting and registration systems discovered by hackers in a few hours at the DefCon Voting Village convention last weekend in Las Vegas.

All of this comes on the heels of Thursday's federal court ruling finding Georgia's voting systems to be so "unsecure, unreliable, grossly outdated....seriously flawed and vulnerable to failure, breach, contamination and attack" that the judge declared the systems (which are similar to ones used in several other states) a violation of voters' Constitutional right to have their votes counted as cast.

But all of that might ultimately be small potatoes in light of longtime cybersecurity journalist and author KIM ZETTER's recent exclusive at VICE's Motherboard, finding that "Critical U.S. Election Systems Have Been Left Exposed Online Despite Official Denials". Zetter, one of the only journalists in the nation who has been covering these matters as long or longer than we have at this point, joins us on today's program to explain her jaw-dropping article which begins this way: "For years, U.S. election officials and voting machine vendors have insisted that critical election systems are never connected to the internet and therefore can't be hacked. But a group of election security experts have found what they believe to be nearly three dozen backend election systems in 10 states connected to the internet over the last year, including some in critical swing states. These include systems in nine Wisconsin counties, in four Michigan counties, and in seven Florida counties --- all states that are perennial battlegrounds in presidential elections. Some of the systems have been online for a year and possibly longer."

In many cases, she tells me, the elections officials seemed to have no idea that their systems were connected to the Internet by their vendors. As for the vendors' part --- in this case, the nation's largest, ES&S --- Zetter explains their bizarre claim that voting and backend tabulation and reporting systems connected around the clock for years at a time aren't really connected to the Internet at all --- and, even if they are, they are perfectly secure. Zetter and the data researchers found otherwise.

The systems found vulnerable on the net, she details, would allow a malicious actor to change unofficial election night results, official results, and the public reporting of the results themselves. Moreover, she explains, access to the exposed backend portions of these systems over the Internet could also result in malware being transferred to voting machines themselves. And all of this was discovered by a small team of researchers with little or no funding. No nation-state required, she confirms.

"If it was just a box on the Internet that was receiving the votes transmitted [on Election Night from the precinct] that would be a security problem in itself, not only because you could potentially alter those votes. They are unofficial results on Election Night --- and the officials results are taken from the actual memory cards in the voting machines. But if you can alter the unofficial results, that's going to create a lot of mistrust in the final outcome if they don't match," she says.

"But even if you don't alter those votes, that communication over the phone between the voting machine in the field and that backend server that's on the Internet creates a channel for infecting those voting machines. So, someone who could actually install that malware on that system on the Internet can design it in such a way that it downloads to the voting machines when they connect to that system. So the attackers can alter that voting machine in preparation for a future election."

"But that's not the only problem," she continues. "If that was the only thing that was on the Internet, that would be a concern in itself. What was remarkable is that ES&S acknowledged to me that they don't just put an empty box on there to receive the votes. Also connected to that Internet connection is the backend system for tabulating both the unofficial results on Election Night, and those official results that are later taken from the memory card."

"And the Election Management System is also connected. The Election Management System is used to do a lot of functions in elections. Among them is the actual programming of these voting machines before each election. So, if you don't get to the machines through that little receptacle that's connected to the Internet, you can get to that backend Election Management System and put in malicious code that then gets transferred directly to the voting machines before the next election."

But, of course, other than that, why worry, right? Well, Zetter has much more to say on that as well, including about Republican Senate Majority Leader Mitch McConnell's continuing efforts to block any and all election security measures in the Senate that might help shore up at least some of these concerns, including bills already passed by the House that would mandate hand-marked paper ballots for all voters. Even that, at this point, wouldn't fully protect against attacks on computer optical-scanners currently used in all 50 states to tabulate those ballots with little or no post-election audits to make sure they did so accurately...
