It has been the most important week in the New York criminal trial of Donald J. Trump, as the last witness for the prosecution, Trump's former attorney and fixer Michael Cohen took the stand. The court is off today, so we have time on today's BradCast to catch our breath for yet another Trump Trial "ketchup" show for you. [Audio link to full show follows this summary.]

BUT FIRST, we've got a few noteworthy results from Tuesday's primary elections in Nebraska, Maryland and West Virginia, where, once again --- other than in WV --- Joe Biden outperformed Donald Trump among their respective party voters. Yes, the zombie campaign of Nikki Haley keeps on going. The former South Carolina Governor, who dropped out of the race months ago at this point, won 20% of the GOP vote in MD, while she and one other GOP candidate (that few have heard of) won about the same percentage among Republicans in Nebraska. In both states, Biden outpaced Trump among his own party's primary voters. FWIW.

On Wednesday, Biden threw down the gauntlet to challenge Trump to two early debates hosted by media outlets --- in a studio, without an audience --- rather than by the non-partisan Committee on Presidential Debates. The Biden-Harris Campaign explained their several reasons for pre-empting the CPD in a letter. They are mostly good ones. Among them, the fact that the group has failed to update its schedule for debates to hold them before tens of millions of Americans have already cast their ballots this year via early and absentee voting.

Trump quickly accepted the challenge, and within hours the pair had agreed to allow CNN host the first debate in Atlanta on June 27, and ABC to host the second on September 10.

THEN, it's on to today's coverage of noteworthy news from the 5th week of the first-ever criminal trial of a former American President. We're joined again today for insight and commentary by HEATHER DIGBY PARTON, award-winning Salon columnist and Hullaballoo blogger, and former attorney and former Republican KEITH BARBER, who now blogs on legal matters as "KeithDB" at the progressive Daily Kos.

Among our many topics of discussion today...

  • Parton discusses the embarrassing parade of elected Republican deplorables now showing up at the courthouse in Manhattan --- mostly in red ties and navy suits --- to display their love for the boss, audition to become his Vice Presidential nominee, and/or say the things that the Court has barred Trump from saying via a gag order. Among the "toadies [who] came a-croaking," as Barber quips: Senators JD Vance (OH) and Tommy Tuberville (AL), Rep. Byron Donalds (FL), Gov. Doug Burgham (ND), Vivek Ramaswamy, and, perhaps most shamefully from the former "Rule of Law" party, House Speaker Mike Johnson (LA). "These people are playing to Donald Trump," explains Parton, along with the warning that many of them are "the Michael Cohens the future."
  • This week's critical testimony of Michael Cohen --- who Parton describes as a "diminished, humiliated man sitting on the witness stand having to admit, over and over again, that he was a liar, a fool, a dupe, he got sent to jail, all in service to Donald Trump" --- and the "smoking gun" bank statement featuring proof of Cohen's $130,000 hush-money payment to porn storm Stormy Daniels. That document, we have now learned, also features Cohen's own hand-writing and that of former (now jailed for perjury) Trump Organization CFO Allen Weisselberg. Their marginalia details how the falsified reimbursements to Cohen, fraudulently described in the Trump Org's books as "legal retainer" fees, would be made in $35,000 monthly payments by Trump during his first year in the White House. But, as importantly, Cohen testified that Trump personally approved the fraudulent reimbursement scheme during a meeting at Trump Tower with both Cohen and Weisselberg present after Trump's hush-money scheme helped him to win the 2016 election.
  • Barber describes what he saw as a surprisingly limp start to cross-examination of Cohen by Trump's lead attorney, Todd Blanche, on Tuesday and how, frankly, Team Trump doesn't seem to have much to work with after the Prosecution spent much of their direct examination "inoculating the jury" to Cohen's many years of lying on behalf of Trump before he came clean and pleaded guilty to many of the crimes Trump is now being held to account for. Trump's attorneys have presented no alternative theory in the case, says Barber. Which also means they are unlikely to offer much, if any, defense case at all after the Prosecution rests. On Tuesday, they informed the judge that Cohen will be their final witness. Team Trump, meanwhile, is still pretending that Trump might actually testify. (He won't.)

Cohen's cross-examination of continues and likely completes on Thursday, and then the court will be off on Friday to allow Trump to go to his son Baron's high-school graduation (if the disgraced former President actually bothers to show up for it.) But it's been a fascinating and critical week of testimony so far, including Cohen's explanation of how he spent years "knee-deep in the cult of Donald Trump".

Brad and Desi sure picked a fine day to take a day off! It's NICOLE SANDLER in today to guest host the BradCast, and it figures that this is when Donald Trump is diagnosed with Covid-19.

It was bound to happen sooner or later as the "commander-in-chief" has completely screwed up our nation's response to the deadly pandemic and has been downplaying every aspect of it to the public since it began. Although the White House and Trump himself both insist that he's doing fine, he was taken to Walter Reed Medical Center today, and reports say that he's completely freaked out by the diagnosis.

DAVID DAYEN is executive editor of the American Prospect magazine, and he joins to me to talk about what it all means. (Hint: we don't really know as nothing like this has ever happened before!)

We're now in a waiting mode... waiting to see if Trump's condition improves or worsens, whether or not there will be any more debates, and for whatever inconceivable event could possibly happen next. Perhaps an asteroid hurling toward us will crash into the Earth... or we'll see more and more irresponsible Republicans come down with the 'rona.

Here's a question for you in the same vein as "if a tree falls in a forest and there's no one around to hear it, does it make a sound?": If Donald Trump wasn't president and causing diversion after diversion to prevent us from focusing on how truly awful he really is, would the big news stories stop falling through the cracks? I ask because what should have been one of the biggest stories of the year is barely registering. BuzzFeed News released the first of many installments in a massive series of articles under the heading The FinCEN Files. It even has its own website.

Based on thousands of "suspicious activity reports" and other US government documents culled over by BuzzFeed reporters and the International Consortium of Investigative Journalists, it exposes the scope of global financial corruption, the banks who enable it, and the government agencies that have failed to stop it. BuzzFeed News senior investigative reporter JASON LEOPOLD joins me to talk about how this massive project came together and some of what they uncovered.

On today's BradCast: What else? Special coverage of what we'll call the Presidential "debate" in Cleveland, OH on Wednesday night between Donald Trump and Joe Biden as nominally "moderated" by Chris Wallace of Fox "News". [Audio link to show follows below.]

It was, perhaps, best described by CNN's Dana Bash as "a shitshow", though her colleague Jake Tapper didn't do bad either in his description of "a hot mess inside a dumpster fire inside a train wreck." MSNBC's Rachel Maddow saw it as a "monstrous cavalcade of increasingly wild and obscene lies" and an "unintelligible display of logorrhea," mostly from the unhinged, unbalanced, unfit, wholly unqualified President of the United States. Stephen Colbert also did a helluva job in his own description of the train wreck as well on CBS' Late Show, though you'll have to tune in for that one.

To be fair, Trump 2000 Campaign Manager Bill Stepien called Trump's effort "the greatest debate performance in presidential history," and Fox "News" observed on their chyron: "BIDEN STUMBLES HIS WAY THROUGH FIRST DEBATE". So there's that.

We're joined today to try and make sense of whatever you may want to call Wednesday's embarrassing spectacle, by two of our favorite post-debate sense-makers, HEATHER DIGBY PARTON of Salon and Digby's Hullabaloo and ERIC BOEHLERT of Press Run, who argues in his column today that, unless the Presidential Debate Commission changes the format to, at a minimum, allow Trump's mic to be cut off (which, it looks like, they may), the next two Presidential debates should be called off entirely. Parton, who also wrote about Trump's "massive failure" today, agrees. But I don't, and we debate (ya know, an actual debate) as to why.

We also discuss and/or debate whether Biden should or shouldn't disclose his position on doing away with the Senate filibuster in order to expand the GOP's stolen U.S. Supreme Court and much much more, including Trump's failure to condemn white supremacy, his deadly criminal failure to contain the coronavirus, his very serious threat to American democracy itself, and whether either of the two candidates accomplished what they needed to.

As Parton sums up whatever went down in Cleveland on Wednesday night: "We had one mainstream, normal politician and an alien from outer space, debating on the same stage. And that didn't work out really well." She observes that all of this is "bad for the country" and goes on to cite Trump's "extra-Constitutional, extra-judicial" threat to "steal" the November election as "one of the most dangerous things any President has tried to do."

Says Boehlert about Trump performance: "He was dramatically different last night than he was in 2016. And he was awful in 2016," before going on to describe the reason as "creeping authoritarianism" in which "Trump is building a bonfire every day, every hour."

If you loved the first 2020 Presidential Debate, you may or may not love our show today. If you were as troubled by what you saw as we were, then you may take some comfort --- and even get a few much-needed laughs --- out of our special coverage today...

On today's BradCast: They were the last major decisions of the term for the Republicans' stolen U.S. Supreme Court. And at least all of the Justices seemed to mostly agree that Presidents are not above the law, even if this one was allowed to buy some time before facing accountability. [Audio link to show is posted below.]

Lucky for Donald J. Trump, that extra time granted by two remands to lower courts by SCOTUS today will almost certainly prevent the public from seeing his tax returns and other likely fraudulent financial documents from the years before his Presidency, before he must stand for re-election on November 3rd. Despite those considerable gifts from SCOTUS today, Donald Trump went off on an incomprehensible Twitter tantrum in response. For some, I guess, too much is never enough.

"Not even the President, is categorically above the common duty to produce evidence when called upon in a criminal proceeding," Chief Justice John Roberts wrote for the majority in one of Thursday's long-awaited 7 to 2 opinions [PDF]. Citing 200-year old remarks by Chief Justice John Marshall, Roberts observed: "We reaffirm that principle and hold that the President is neither absolutely immune from state criminal subpoenas seeking his private papers nor entitled to a heightened standard of need." Even accused sexual assaulter Justice Brett Kavanaugh agreed in a concurring opinion that "no one is above the law."

While no one may be above the law, Trump received two extraordinary gifts from the court today. One opinion, Trump v. Vance [PDF] effectively postpones the disclosure of his dubious financial documents to the Manhattan District Attorney for a criminal grand jury investigation until, mostly likely, after the November election. The other, Trump v. Mazars [PDF] prevents several Congressional Committees from seeing similar documents that they subpoenaed from Trump's accounting firm, also until after the election --- and maybe never if the clock runs out on the end of the Congressional session in December. It will likely take at least that long to work through the courts with SCOTUS' newly-raised bar for such subpoenas of the Executive Branch by Congress.

We're joined once again today, at the last minute, by Slate's great court reporter MARK JOSEPH STERN to offer his ever-helpful clarity and context to today's complicated opinions, which one attorney today described thusly: "The ruling is 'No president is above the law', but they post-dated it to the Biden administration".

"I think he just doesn't really understand how the Court gave him a gift," Stern explains, in response to my questions about Trump's whining, incoherent Twitter response to today's ruling. "These decisions are wrapped up in a lot of language that pointedly reduces the President's immunity and executive privilege from oversight and investigations. And announces or reaffirms some crucial principles, like, of course a state can subpoena a President's records for a grand jury proceeding and, yes, Congress can also subpoena the President and his confederates and businesses if it seeks to get that information to pass legislation."

"But the Court said 'We are going to draw a line because we're not so sure that here, either the New York grand jury or the House of Representatives checked all the boxes that we think they needed to in order to get this information.' So, there's going to be a run-down-the-clock thing now, where Trump tries to keep fighting this in the lower courts --- at least through the November election --- and that means we may never actually get to see these records that the Supreme Court said, theoretically, we could have a right to see."

Stern observes: "It was almost like it was a carefully brokered compromise to reach this exact result and then work backwards for the reasoning." Nonetheless, Stern notes, even if his financial firms are allowed to escape subpoenas by Congress, "the writing is on the wall" for the subpoenas filed by Manhattan District Attorney Cyrus Vance. "I think the lower court is going to very quickly say, 'Yep, these records can go to the grand jury.' And that's going to be that. It could happen in a matter of weeks."

We will see. Or not.

Next, a few more accountability odds and ends today. Trump received another gift this week in the form of a second --- and still-unexplained --- extension of the deadline for the release of his annual financial disclosure statement. Speaking of, the New York Times' Thomas Friedman thinks that Joe Biden should refuse to debate Trump (who now needs the debates more than Biden does) unless Trump releases his tax returns from his years as President, since he promised to do so in 2016, and Biden has already done so. Friedman has one other condition as well that he suggest Biden place on the debates before agreeing to participate this year.

On the COVID-19 front today, the CDC is now claiming they are not planning to rewrite guidance for the reopening of schools after Vice President Mike Pence indicated yesterday they would be doing so following Trump's complaint that their original recommendation for opening schools safely was "very tough and expensive". And, whaddaya know? There's a surge of COVID cases in Tulsa following Trump's unmasked super-spreader campaign rally there in late June, according to the city's top health official.

Brad Friedman was no doubt correct when he described the insanity that passed for a Second "Presidential Debate" as "one of the darkest chapters in modern U.S. Presidential history." That unfortunate event, however, led to a moment of extraordinary candor. Former Republican strategist Steve Schmidt told NBC's Chuck Todd that Donald Trump's candidacy had "exposed the intellectual rot in the Republican Party."

Schmidt's point is well taken, but there are also systemic sources for our current political malaise. These center upon (1) a privately-owned media system that elevates its own commercial interests over the public interest,, and (2) the euphemistically self-described "non-partisan" Commission on Presidential Debates (CPD) --- the undemocratic guardians of the status quo who, in conjunction with the two major political parties (which its commissioners represent) and the mainstream media, tirelessly strive to prevent Presidential debates from achieving their true function --- the facilitation of an informed electoral decision...
