Today on BradCast: No, Tuesday's off-year elections were not nearly as disastrous for Democrats as the national media seems to want to insist. But there were both red flag warnings and important lessons they should absolutely pay attention to, and quickly. There were also wholly avoidable voting system failures which, unfortunately, open the door for some results to be challenged. [Audio link to full show is posted below this summary.]

First up, the latest summary on the marquee Gubernatorial races that seemed to encompass the entirety of the national media's coverage on Tuesday and into Wednesday. In Virginia, decades of modern history repeated itself, as the party that didn't win the White House last year appears to have taken control of the Governor's mansion this year. Trump-endorsed businessman and first-time candidate Glenn Youngkin was declared the narrow winner over VA's Democratic former Gov. Terry McCauliffe, after Youngkin dog-whistled his kinder, gentler not-Donald-Trump-at-all act into office.

His campaign leaned heavily on pretend, Fox "News"-generated phony outrage issues like opposition to teaching Critical Race Theory in public schools, even though there are no public schools in VA who actually teach it. But fake issues are much easier for Republicans to run on than the unpopular ones they actually support. So, with that, it appears Republicans may also have narrowly taken back majority control of the Commonwealth's House of Delegates, though those final numbers were still too close to call as of airtime.

In New Jersey, it appears that history will not repeat itself. Democratic Gov. Phil Murphy was declared the unofficial winner by media outlets late during today's show. If officially certified, Murphy will have defeated Republican John Ciaterelli to become the first Democrat to win a second term in the Garden State since the 1970s. But Ciaterelli made clear on Election Night that he plans to challenge the results. Reported electronic pollbook failures across the state on Tuesday (little noticed by most of the media, though we covered the pretty serious issue in some detail on our previous BradCast) may well give him an opening to mount such a challenge --- not that Republican election challengers these days generally need real problems to buttress false claims of fraud when they lose. If Murphy ends up falling behind again, he too could use the failure in his own contest.

We detail what appears to have happened across the state, preventing many voters from being able to vote at the polls for several hours on Tuesday morning, and why we've been warning about issues exactly like this for years when it comes to electronic voting, tabulation and pollbook issues that continue to threaten democracy itself.

But while many Democrats have been beside themselves since the polls closed on Tuesday night, wondering where they went wrong --- at least in those statewide contests --- in truth, if you dig below the national headlines, progressives had a bunch of victories on Tuesday in local races and on ballot initiatives.

We're joined today by one of our favorite post-election guests (following both good and bad nights for Democrats over the years), progressive champion, JOHN NICHOLS, Washington Correspondent for for The Nation, longtime contributor to The Progressive and Associate Editor of Madison, Wisconsin's Capital Times. We try to make sense of where both Dems and national media went both right and wrong during both the election and its aftermath. Why, for example, in both VA and NJ, where Democrats held control and adopted a host of very popular progressive policies in the past several years, did they have such a difficult time turning that record into victories yesterday? We also discuss several progressive wins that flew beneath the radar, and what Dems in D.C. and across the nation should take from what happened on Tuesday.

Finally, we close with a boatload of under-reported progressive wins in Tuesday's elections across the country, including historic mayoral victories from Boston to Pittsburgh to Albuquerque to Cincinnati to Durham, NC and beyond, along with a number of local ballot initiatives that defy the media narrative of the past 24 hours which seems to be arguing that Dems must immediately start acting more like Republicans if they hope to have any chance of victory during next year's critical 2022 mid-terms...

By way of a 31-page Memorandum Opinion this past week, U.S. District Court Judge Michael A. Shipp rejected the Trump Campaign's effort to challenge the legality of a recently enacted New Jersey statute that permits Garden State election officials to begin "canvassing" mail-in ballots ten days prior to the November 3 Presidential Election Day.

As defined by the U.S. Election Assistance Commission (EAC), a "canvass" is a "compilation of election returns and validation of the outcome that forms the basis of the official results".

NJ's COVID-driven election law in question, AB 4475, was enacted last August by the New Jersey state legislature and promptly signed into law by the Garden State's Democratic Governor Phil Murphy. The statute contains a number of provisions designed to facilitate an efficiently-run, mostly mail-in ballot Presidential Election. These include a directive that election officials, 29 days prior to the election, send mail-in ballots to every registered voter. The statute also includes a requirement that election officials provide secure absentee ballot drop-boxes in every county.

Existing NJ law mandates that the State's election officials certify the Nov. 3 election results by Nov. 20. The results must then be submitted to the NJ Secretary of State by Nov. 24.

AB 4475 streamlined the procedures for tallying the expected heavy influx of mail-in ballots by permitting election officials to begin processing and canvassing mail-in ballots ten days prior to Election Day. The new law, however, prohibits Garden State election officials from running a tabulation report or revealing any results before the polls close on Nov. 3.

Contending that the NJ statute was preempted by federal Election Day law, the Trump Campaign sought a preliminary injunction that would prevent NJ officials from canvassing mail-in ballots before Nov. 3. The Campaign also contested a section of AB 4475 establishing that "every ballot without a postmark...received by the county boards of elections from the [U.S. Postal Service] within 48 hours of the closing of the polls, shall be considered valid and shall be canvassed, assuming the ballot meets all other statutory requirements."

The court rejected the Trump Campaign's legal arguments and denied Trump's motion for a preliminary injunction.

The Trump Campaign did not respond to a Fox "News" inquiry as to whether it intended to appeal the decision. The President's "favorite propaganda network" described the decision as "a significant ruling for the state that will keep the current rules in place, barring a swift and successful appeal from the Trump campaign"...

On today's BradCast: As the U.S. crossed the 100,000 coronavirus death Rubicon over Memorial Day weekend, the President of the United States played golf. Twice. And called a potential Democratic Vice Presidential nominee fat. And a former Secretary of State and Democratic Presidential nominee a "skank". He also suggested a popular TV host murdered someone. And he lied again (and again) about absentee voting fraud (even though he committed it himself.) The Presidential election is 161 days away. [Audio link to full show is posted below.]

Before we get there, however, former CDC Director Tom Frieden said this weekend, "It's 100,000, but it looks like we're still at the beginning of this pandemic." He is not alone. According to the Imperial College London, the U.S. could see another 200,000 dead on top of those who have died already from COVID-19, thanks to the President's desperately premature push to reopen the nation's economy. That, while Trump is ignoring the first 100,000 dead, even though, as the New York Times observes:

"More Americans have died of the coronavirus in the last 12 weeks than died in the Vietnam and Korean Wars combined and nearly twice as many as died of battle wounds during World War I. The death toll has nearly matched the number of people killed by the initial blasts of the world’s first atomic bombs dropped on Hiroshima and Nagasaki. In terms of American deaths, it is the equivalent of 22 Iraq wars, 33 Sept. 11 attacks, 41 Afghanistan wars, 42 Pearl Harbors or 25,000 Benghazis."

At the same time, despite the Republicans' attempt to pretend the viral pandemic away, without very quick action by the Republicans who control the U.S. Senate to prevent massive layoffs at the state and local level, we could be looking squarely at a second Great Depression before year's end, The American Prospect's David Dayen reports today with very good evidence in support.

Other than all of that, we hope you had a delightful holiday weekend!

Speaking of that Presidential election (did we mention it's just 161 days away? --- but who's counting?), we have some very good news from Florida today to counter the grim news with which we felt it necessary to open today's program. A federal judge has nixed the voter suppression law enacted by Republican Gov. Ron DeSantis and the state's GOP-controlled legislature. The law was adopted to gut the state Constitutional Amendment passed by 65% of FL voters in 2018 to allow most former felons to register to vote after having completed "all terms of their sentence including probation and parole."

Amendment 4 ended the state's shameful lifetime ban on voting rights for former felons. U.S. District Judge Robert Hinkle, following an eight-day trial earlier in Spring, declared the GOP's new Jim Crow law --- enacted to upend Amendment 4 --- to be an unconstitutional poll tax, as the law mandated the payment of all fines and fees before former felons would be allowed to register to vote, whether they could afford the payments or not. Moreover, the state keeps no database of such fines and fees, so many former felons had no idea if they owed money or not. Because of that, many declined to register to vote for fear of being charged with perjury when attesting that they had they had "completed all terms" of their sentence on the voter registration application.

Despite that very good news, we suspect the roller coaster battle by the Florida GOP to prevent as many as 1.5 million new voters in the crucial battleground state --- including about a quarter of the its African-American male voting age population --- from getting their voting rights back will continue.

Of course, the GOP War on Democracy is happening all over the country right now. We close today's show with a new front opened in that war over the weekend by the Republican National Committee and former GOP Congressman-turned-candidate-again Darrell Issa. They filed a federal lawsuit alleging that California Gov. Gavin Newsom's May 8 order to send absentee ballots to all registered voters in the state for the November election is in violation of the U.S. Constitution.

Yes, it even sounds absurd on its face, but longtime BRAD BLOG legal analyst ERNEST A. CANNING joins us today to explain exactly why the complaint is even more ridiculous than it sounds and the two big reasons why he believes it is likely to be "dismissed at the district court level". Whether that dismissal will be upheld by the GOP's stolen majority on the U.S. Supreme Court, should Republicans push it that far (and why wouldn't they?), is a separate question. On today's BradCast: As messy as the process of passing two Articles of Impeachment against rogue President Donald J. Trump was, the post-impeachment phase got messier still on Thursday, as Democrats stood strong --- at least so far --- in their fight for a fair impeachment trial in the Republican-controlled U.S. Senate. We've also got some important election integrity and voting rights news, along with our final Green News Report of the year. [Audio link to show follows below.]

Before we get to today's impeachment standoff, we finish out a few points from shortly after we left air on Wednesday night, including a review of the late vote on those historic Impeachment Articles in the House --- and some thoughts on Tulsi Gabbard's less than courageous vote of "present" --- as well as the surprising emergence of the backbone being displayed at the moment by House Democrats.

In a blistering response to Senate Majority Leader Mitch McConnell's repeated admissions in recent days that he is working hand-in-glove with the White House and has no intention of serving as an impartial juror in the Senate trial to decide whether the President should be removed from office, despite his Constitutional mandate to do so, House Speaker Nancy Pelosi told reporters on Thursday: "Our Founders, when they wrote the Constitution, suspected that there could be a rogue President. I don't think they suspected that we could have a rogue President and a rogue Leader in the Senate at the same time."

We do our best today to bring you up to date on the ugly and quickly moving story of what has come today from McConnell's --- and, shamefully, fellow juror, Sen. Lindsey Graham (R-SC)'s --- attempt to make a mockery of the Senate trial by rigging it in favor of the White House in refusing to allow first-hand testimony from witnesses of Trump's alleged high crimes and misdemeanors. That, despite Graham's own insistence from 1998, when he served as a House Manager for Bill Clinton's impeachment, that "in every trial that there has ever been in the Senate regarding impeachment, witnesses were called. When you have a witness telling you about what they were doing and why, it's the difference between getting the truth, the whole truth and nothing but the truth."

Those archival video-taped remarks came courtesy of an ad released on Wednesday from Republicans for the Rule of Law to call out Graham. It is in response to McConnell and Graham's refusal to allow testimony from a number of top Administration officials who were first-hand witnesses, but who failed to answer lawful subpoenas for testimony and documents in the U.S. House. The witnesses sought by Democrats and by a huge majority of Americans of all parties (including 64% of Republicans and 72% of independents) include Trump's acting Chief of Staff Mick Mulvaney, Sec. of State Mike Pompeo, and former National Security Advisor John Bolton.

Then, we move to some quick election integrity and voting rights news as the first votes in the 2020 elections are now just weeks away. In New Jersey this week, the Democratic Governor signed a bill to restore voting rights to 73,000 people across the state who are currently on parole or probation.

In Georgia, after Republican Sec. of State Brad Raffensberger was allowed to purge more than 300,000 voters earlier this week amid an ongoing lawsuit to prevent the removal of at least 120,000 of them, his office was forced to admit today that at least 22,000 had been wrongly removed due to what Raffensberger's office describes as an error in the state's screening process. The Admission came just hours before another hearing in federal court, leading plaintiff Fair Fight Action to demand that "every voter purged this week" should be "reinstated immediately."

We also have a quick update on the recent internecine battle at e-voting watchdog VerifiedVoting.org after the courageous resignations of now two well-respected members of their Boards of Directors and Advisors. (We interviewed the first of those to quit, Prof. Philip Stark of UC-Berkeley on a BradCast last week, after which the resignation of the second, Prof. Rich DeMillo of Georgia Tech --- who we have also interviewed a number of times --- was made public as well.)

The public resignations were in response to Verified Voting's disturbing years of support for 100% unverifiable touchscreen Ballot Marking Device (BMD) voting systems now proliferating the country in advance of the critical 2020 elections, and their frequently misleading information about how post-election audits could be used to verify results on such unverifiable systems. This week, the group finally responded to the embarrassing and costly pushback they have been receiving from Election Integrity advocates.

There were also two very important stories published this week on the very serious concerns about e-voting systems in advance of 2020. The first, "How New Voting Machines Could Hack Our Democracy," by attorney and Twitter activist Jenny Cohn at New York Review of Books, is a disturbing and encyclopedic exposé on the dangers and failings of BMDs, the Election Integrity groups such as Verified Voting who have failed to adequately warn against their use in American elections, and the private vendor/election official revolving doors and payoffs that have brought us to this perilous moment.

The second investigative article, out today from NBC News, reviews the shady ownership and shadowy manufacturing processes that runs through China and the Philippines at the nation's largest electronic voting company, Elections Systems & Software, Inc. (ES&S) of Omaha, Nebraska.

Finally, Desi Doyen joins us for the latest Green News Report (our last one of the year!), with more disturbing news out of Australia, more bad news for our oceans, troubling news about the disturbing high costs of fracking and, shockingly, some kind words about global financial services behemoth Goldman Sachs!...

Guest: Mike Liszewski of Drug Policy Alliance; Also: Goodbye, Chris Christie and other encouraging news from the states...

On today's BradCast, the consequences of elections, from D.C. on immigration, to VA and NJ on gun safety legislation, and across both D.C. and dozens of states when it comes to marijuana policy under Trump's Attorney General. [Audio link to show is posted below.]

The White House, lawmakers and corporate media continue to squabble today over Donald Trump's racist and reportedly vulgar slur of black majority nations as either "shitholes" or "shithouses" during a bipartisan meeting on immigration last week, even as his Departments of Justice and Homeland Security issued a new and misleading report on terrorism that downplays the far greater threat of domestic attacks by homegrown white Americans, in favor of a focus on foreign-born terrorists.

In the meantime, as the White House and Congress attempt to strike a government spending deal that includes protections for DACA recipients in time to avoid a government shutdown at the end of this week, a changing of the guards in both New Jersey and Virginia following last November's elections is taking place and already reshuffling public policy.

NJ's wildly unpopular Republican Gov. Chris Christie was finally replaced on Tuesday by the new Democratic Governor Phil Murphy, one day after Christie finally signed a law that will ban deadly bumpstock devices, like those used to kill 58 people and wound hundreds of others in minutes in Las Vegas last year, in the Garden State. (To his discredit, he had little choice, as the legislation passed both state chambers with zero votes opposing it.)

At the same time, in VA, where Republicans managed to barely hang on to majorities in the state legislature, thanks to some gaming of several House races and of legislative district maps across the state (allowing them to retain control despite losing statewide by a 55% to 45% margin), the GOP's majority control in the state Senate resulted in the gutting of most of the gun safety agenda on which that state's new Democratic Governor Ralph Northam ran and won by a landslide.

Then, we head back to D.C., where Attorney General Jeff Sessions announced after the turn of the new year that the DoJ was reversing Obama-era enforcement guidance on federal law, in order to crack down on states where marijuana has been made legal for medicinal and/or recreational use after decades of prohibition.

As Drug Policy Alliance advisor and marijuana legislation lobbyist MIKE LISZEWSKI joins us to explain, the new DoJ guidance, rolling back the so-called "Cole Memo" from the Obama years, has not gone over well, even with a number of Republican lawmakers, particularly those from cannabis-friendly states where they have seen a dramatic rise in tax revenue thanks to new policies adopted by voters and state lawmakers.

"The Cole Memo was just guidance, it was never binding. But by removing it, Sessions has really given the green light to US Attorneys throughout the country to say, if you want to prosecute against state marijuana conduct you have our backing," Liszewski tells me, before arguing that there is no need for such policy, given that state laws, where pot has been legalized, are already very tough. "If someone was using a state marijuana law to shield some sort of bad activity, they're clearly in violation of state law. There's so much oversight, you're likely going to get caught rather quickly. So there's really no need for additional federal prosecution. It's really addressing a concern that doesn't actually exist --- unless you have some hysterical views about marijuana."

Sessions, of course, famously has views. Last year, for example, he famously stated that marijuana was "only slightly less awful" than heroin. Liszewski breaks down the DoJ's announced change in prosecutorial guidance and the effect it is likely to have (if any) in pro-cannabis states where, he says, it has "turned out to be wonderful for generating state tax revenue...in terms of the money it's pulling in, but also the law enforcement resources, the jail resources, the court resources, that don't have to go into prosecuting low-level marijuana cases."

We also discuss how Congress may still be able to move forward on drug policy under an Attorney General who is an avowed enemy of pot users and a President who claims to favor states' rights on the matter. Congress, Liszewski argues, is close to having the votes to end prohibition at the federal level all together, if it doesn't have those votes already. But, he says, thanks to a few "old guard" Committee Chairs in Congress, it may take a full reshuffling of the deck in the 2018 mid-term elections to see it actually happen.

"The 2018 elections are going to be so crucial to the future of marijuana reform," he says. "Because whether it's a shift in which party controls each chamber, or if it's just voting out the old guard and getting some new Republicans in, either way would be helpful towards ending federal marijuana prohibition."

"It would be very, very difficult to get the genie back in the bottle at this point," Liszewski adds, "especially seeing a good number of Republicans as well as states continuing to move forward right after the Sessions announcement. It really shows that Sessions is alone on an island with this and has very few supporters. I think the writing is on the wall."
