We've spent quite a bit of time of late on The BradCast discussing what could happen if Democrats are able to hold their majority in the U.S. House this year and pick up two more seats in the Senate. Codifying privacy rights and reproductive freedoms into federal law; passage of the much-needed Freedom to Vote Act; expansion of the corrupted U.S. Supreme Court to un-corrupt it. That all become possible in such an event, just to cite a few of the most pressing issues. But what happens if they don't? [Audio link to today's full show follows this summary.]

We've noted that it remains an uphill battle for Democrats to hold their majorities in either chamber of Congress this year, much less expand one of them. So, what happens if Republicans win a majority in one or both?

In short, it would be very very bad for a host of reasons, including for democracy itself. But TPM's Kate Riga detailed just some of the political nightmares that are likely to occur, as Republicans have revealed in their own words. From endless Congressional investigations of nonsense (think "Benghazi on steroids") to pointless culture war legislation that would be vetoed by President Biden even if it somehow overcame a Senate filibuster, to impotent efforts to impeach the President and various members of his Cabinet...for something or other.

But, even without majorities in both chambers, Republicans can wreak extraordinary damage to both the U.S. and global economies simply by re-upping their 2011 "Tea Party" scheme to hold the nation (and world) hostage to any number of demands in exchange for raising the dumb debt ceiling next year. ("Dumb", because it's absurd that the U.S. even has such a statute requiring Congressional permission to borrow money to pay for stuff that has already been purchased with Congressional and Presidential authority. Also "dumb" because Republicans only use it as a dangerous bargaining chip when a Democrat is in the White House. Despite blowing up the deficit by trillions during the Trump Administration, the debt limit was raised three times by Congress with nary a peep.)

As Riga and others have reported this week, Rep. Kevin McCarthy, the GOP's presumptive House Speaker if they take back a majority, has signaled that his party intends to hold cuts to Medicare and Social Security among hostages in exchange for agreeing to lift the debt ceiling. That, in the words of our guest today, would be "catastrophic" on several levels.

We're joined today by Congressional historian, political scientist and author NORM ORNSTEIN, who has been covering Congress for nearly 50 years via the conservative American Enterprise Institute, where he is a Senior Fellow Emeritus and now as contributing editor and columnist for The Atlantic.

Last week at The Atlantic, Ornstein warned that it's not just "democracy at stake this fall", as he asked "how far would a Republican majority go?" in undermining the U.S. economy in advance of the 2024 Presidential election. He recounts the first real use of the debt ceiling as a blunt political instrument to wreak havoc on U.S. policy and the economy along with it by the "Tea Party" back in 2011. While a last minute compromise at the time avoided a first-ever default of the U.S. government and the inability to pay its debts, the brinkmanship and hostage-taking cost the economy billions. Our credit rating was downgraded for the first time ever and the Dow plunged some 2,000 points.

But Ornstein is now more worried about what may happen next year if the GOP wins a House majority. As he explains today, "back in 2011, there were grownups in the room who kept it from getting out of control." Today, however "we're in a different world."

"In the past," he tells me, citing Donald Trump as an "accelerant" for GOP "dysfunction," "we still had what we could think of as a political party, even as it began to go downhill. But now it's a full-blown cult. The willingness of new members coming in, joining with a lot of radical members who will be returning to blow the whole thing up, the lack of interest in fundamental institutions or in the need to be responsible at governance is astonishing."

"I have never, in fifty-plus years of being immersed in the institution, seen a weaker or more pathetic leader than Kevin McCarthy," he says. "The idea that he would stop them from mayhem is, at this point, not believable."

"Other than that the fact that these are radicals dominating the party, they can't pass legislation on their own. They can't impeach and convict and remove from office the officials they would want to, including the President and the Attorney General and Sec. of Homeland Security, among many others."

But, as Ornstein adds, they will have "the power for the purse" with which they can cause extraordinary damage both here and around the world. He details both the chaos and what Democrats can do to try and preempt it during the Lame Duck period after the November midterms in the event that Republicans win back a majority in one or both chambers.

"The best thing to do is to do as every other country does and eliminate this ridiculous device [the debt ceiling]," but, since Dems can't do that on their own via reconciliation, they could invoke "the ironically named McConnell Rule" through reconciliation to stave off the threat of GOP debt ceiling brinkmanship that could result in a first-ever financial default by the nation. Or, of course, Americans could simply reelect Democrats to majorities in both chambers and avoid the guaranteed nightmares that lie ahead with GOP control of either, now that they have wasted away into little more than a radical, extremist, "full-blown cult."

Finally, we close today with a fascinating spy story, of sorts, regarding retiring, eight-term Sen. Patrick Leahy (D-VT) and the U.S. intel agencies during the lead-up to the Iraq War (which he voted against), based on false evidence of WMDs hyped by the Bush/Cheney Administration...

  • We hope to cover this more on an upcoming show, but on Monday, not long before air, the Dept. of Justice filed a federal lawsuit against Texas, hoping to block the Lone Star state's newly drawn and racially gerrymandered Congressional and state legislative districts under what is left of the Voting Rights Act. The state is adding two new Congressional districts following the 2020 Census, after gaining some 4 million new residents over the past decade. But, despite growth in the Latino and Black populations comprising 95% of the increase in voters, the state Republicans added two new majority White districts on their new maps, and removed yet another Latino-majority district.
  • Health officials over the past 24 to 48 hours, including Dr. Anthony Fauci, have been suggesting that early data on the coronavirus Omicron variant indicates that, while it appears to be much more transmissible than previous variants, it may be less lethal. Though that is the headline you may have seen from the media since the weekend, that doesn't actually tell the full story about what that could mean. We try to fill in at least some of the blanks for the moment before folks get too prematurely excited. In short, if you haven't received a booster yet, now is a great time to do so. And, if you haven't had your initial shots, 6 months ago would have been a great time to do so (but now will suffice.) AND, if you think that already having had COVID --- and, thus, now have antibodies that you believe will protect you --- now is a great time to think again about that. We explain in full on today's show.
  • Finally, we've been reporting --- somewhat anecdotally in recent weeks --- on the bizarre way that the corporate media have been misreporting on the largely robust, and at times record, growth in the economy under President Biden over the past year as the nation attempts to crawl out from under the pandemic. Millions of jobs have been created (more than during the entire Trump Presidency); unemployment has plummeted to 4.2% (falling a remarkable four tenths of a percent in November compared to October and a full two points since the beginning of the year, when experts said it would be 2025 before unemployment fell to 4.2% again); New weekly jobless claims the week before last were the lowest they have been since 1969; etc. Yet, oddly enough, Biden's approval ratings have been driven down in recent months, thanks, in no small part, to often wildly misleading media coverage that continues to lead with areas of perceived weakness in the economy. That, despite the fact that those perceived weaknesses are misleading and/or not weakness in the economy at all.

    Late last week, Washington Post's Dana Milbank wrote that he's noticed the same thing from his colleagues. He commissioned a study to find out if he was right and, as it turns out, he is. "After a honeymoon of slightly positive coverage in the first three months of the year, Biden’s press for the past four months has been as bad as --- and for a time worse than --- the coverage Trump received for the same four months of 2020."

    "Think about that," wrote Milbank. "In 2020, Trump presided over a worst-in-world pandemic response that caused hundreds of thousands of unnecessary deaths; held a superspreader event at the White House and got covid-19 himself; praised QAnon adherents; embraced violent white supremacists; waged a racist campaign against Black Lives Matter demonstrators; attempted to discredit mail-in voting; and refused to accept his defeat in a free and fair election, leading eventually to the violence of Jan. 6 and causing tens of millions to accept the 'big lie,' the worst of more than 30,000 he told in office....And yet Trump got press coverage as favorable as, or better than, Biden is getting today."

    Now, why would that be? We discuss and open up the phone lines today to listeners who call in with their own thoughts on why the so-called "liberal media" has been doing such a lousy, misleading job in covering Biden's Presidency to date...

Vote 'NO' on recalling Gov. Newsom on the first question and for the Green Party's Dan Kapelovitz on the second. Here's why...

"For the September 14, 2021 Gubernatorial Recall Election," according to the CA Secretary of State's Quick Facts Sheet [PDF], "all active registered California voters will receive their ballot in the mail." The ballot will contain two questions: (1) Whether California's Democratic Governor Gavin Newsom shall be Recalled, and (2) if Recalled, which of 46 official candidates should succeed him. Voters are expected to complete both parts of the ballot, even if they vote "NO" on the first question, though it is not a requirement.

California residents, who are 17-years old but will turn 18 on or before Sept. 14, can pre-register to vote. Otherwise eligible voters, who are not yet registered, can register to vote within 14 days of the Recall Election (by August 30) in order to receive a Vote-by-Mail ballot. Or, they can fill out a Conditional Voter Registration at the polls during either early, in-person voting or on Election Day.

For the reasons set forth in my July article, "Now May Be a Good Time to Reform or Eliminate California's Gubernatorial Recall System", this progressive believes the answer to question (1) of the ballot is simple and straightforward. I'll vote "NO" only because the ballot does not contain the option to vote "HELL NO!"

This GOP-initiated Recall, which, per the California Voters' Guide, will cost state taxpayers an estimated $246 million, is the product of a purely partisan abuse of the Recall process. It was engineered by an increasingly authoritarian and immensely unpopular Republican Party --- a Party which hasn't won a statewide election in California since 2006; a Party that accounts for less than 1 in 4 registered CA voters; a Party which lost the last Presidential Election in the Golden State by more than 5 million votes; a Party that knows its only prospect for winning lies in what it hopes to be a low turnout, Special Recall Election. It's a cynical divide-the-vote-among-multiple-and-largely-unknown-candidates strategy that could potentially allow an otherwise unelectable Republican to prevail.

In recent television ads, sponsored by state Democrats and labor unions, Sen. Elizabeth Warren (D-MA) described what will take place on Sept. 14 as a "Republican Recall". Question (2) on the ballot reflects the accuracy of that assessment. Out of a total of 46 candidates on the second part of the ballot, 24 are Republicans. One other candidate, Riverside County Supervisor Jeff Hewitt, is a Libertarian --- the Party that embraces the deceptive ideology of the infamous Koch Brothers and hard-right ideologues like Sen. Rand Paul (R-KY).

The difficult decision for progressives is how to unite behind only one of the 21 remaining candidates so as to avert the disaster that could ensue if more than 50% of the electorate vote to recall the incumbent Governor, as recent polling suggests a very tight race on the ballot's first question.

Allow me to explain why the election of either of the two leading question (2) candidates --- Democrat Kevin Paffrath and Republican Larry Elder --- both represent a clear and present danger if Newsom is recalled on question (1). Then, I'll share my conclusion --- along with information on each of the non-Republican/Libertarian candidates on the ballot --- as to why Green Party Candidate Dan Kapelovitz, an ardent opponent of the "Republican Recall", who is running only to avert disaster should the Recall succeed, is the candidate Democrats and progressives would do well to support...

On today's BradCast, we open the phones to talk vaccination again, though for a different reason than we've done so in the past. [Audio link to full show follows the summary below.]

Among the stories discuss today...

  • The third highest Republican in the U.S. House, Rep. Elise Stefanik (NY) lauds Medicare and Medicaid and the "the critical role these programs have played to protect the healthcare of millions of families," but warns --- in the very same gobsmacking tweet(!) --- "To safeguard our future, we must reject Socialist healthcare schemes." Seriously. That's who now serves in the GOP leadership seat previously occupied by Rep. Liz Cheney, until she was tossed out of it by the Republican House caucus for telling the truth about Trump and replaced by Stefanik.
  • Nonetheless, as clueless as Congressional Republicans are, somehow Democrats are managing to move enough of them forward, for now, on a landmark, bipartisan $1 trillion infrastructure bill with some really good and important stuff in it. We break down the key details, released over the weekend, for the package that is to be paired with a much larger, $3.5 trillion Democrats-only bill that can be passed in the Senate with a simple majority vote. But both bills must be passed in the Senate before House Speaker Nancy Pelosi will allow either to come to the floor for a vote in the lower chamber. For now, the smaller bipartisan package is on track for passage before the Senate takes its August recess at the end of this week. But, there's still a long way to go and a lot of potential landmines to be avoided from both the Right and the Left. If Biden and Dems can pull both packages off, it would be a remarkable achievement, and the largest investment in America since FDR's New Deal.
  • At the same time, the Delta variant of the coronavirus continues to wreak havoc across the nation, almost entirely on the unvaccinated, even though the vaccinated are paying a shamefully high price for the idiocy of the unvaxxed. Nowhere in the U.s. more so at the moment than in Gov. Ron DeSantis' Florida, where he's blocked the ability for local officials to issue mask mandates and signed a law preventing private companies from requiring vaccination for customers or employees. On Friday, however, the Sunshine State registered more new COVID cases than at anytime during the pandemic --- including back before there were safe, plentiful, effective, free vaccines to help people avoid it! Now, as infections rage out of control, the state's hospitals have filled up as they reach record capacity and non-COVID-related treatments and surgeries are being cancelled because of it.
  • Several weeks ago we opened the phone lines to hear from unvaccinated listeners as to why (the hell) they were refusing to protect themselves and/or their friends, families, neighbors and co-workers. Today, we opened the phones for a related reason. Since the rise of the highly transmissible and dangerous Delta variant, and its horrifying surge across the country --- most markedly in Trump-supporting states and counties --- almost 5 million longtime holdouts finally decided to get their shots, with those Trump states leading the way in increased uptake. (Sadly, the decision to get vaccinated continues to come too late for many, including this Las Vegas family discussed today.) So, we were curious what it was, specifically, that has led some longtime vaccine holdouts to finally decide to get inoculated. We were also curious what folks thought about the idea of compulsory vaccinations, for which legal analyst Ernie Canning made the legal case today at The BRAD BLOG. In the short term, the U.S. government can and should compel all citizens, other than those for whom the COVID vaccines may be medically contraindicated, to be vaccinated at the government's expense. It should also insist that the major U.S. pharmaceutical companies contractually waive their right to enforce their COVID vaccine intellectual property rights before a World Trade Organization (WTO) tribunal.

Long term, if we place a greater value on human life than we now do with respect to obscene levels of wealth accumulation by a privileged few, both the U.S. and other governments should renegotiate the TRIPS agreement so as to eliminate intellectual property rights of pharmaceutical companies over life-saving vaccines developed with the aid of public monies.

Alternatively, the U.S. and other governments should take a hard look at whether their respective pharmaceutical industries should be nationalized...

Democracy, politics and death. Ya know, just another day on The BradCast. [Audio link to full show is posted below summary.]

Among the many stories covered on today's program...

  • Maricopa County, Arizona will now be forced to spend millions on new voting systems after state and County officials determined that their previous machines, which they only began using in 2019 and still haven't paid off, cannot be used again, and will be destroyed. That, after potential corruption of the systems during the Arizona GOP Senate's secret "audit" process, carried out by a private, conspiracy theory contractor named Cyber Ninjas. So much for those "fiscally conservative" Republicans (just in case you're wondering why we almost never refer to Republicans as "conservative" in almost any context. It's because they ain't. And folks in the media and in Congress and everywhere else should stop doing them the favor of playing along with their friendly, if utterly false and misleading, branding.)

    As we also discuss today, Maricopa doesn't actually have to spend millions of dollars on new computers to scan their hand-marked paper ballots. They could simply count them publicly by hand in the first place!

    The real cost of the phony, completely non-transparent and still-ongoing "audit" clown show in Phoenix, however, is that it is likely to make Democrats even more reluctant to seek recounts and post-election audits in the many cases where they absolutely should. (Here's just one such example.)

  • The wingnuts at CPAC over the weekend were laughing at Democratic Senators Joe Manchin (WV) and Kyrsten Sinema (AZ) for their gullible willingness to do their obstruction bidding for them. A group of Republican officials were caught on video tape, laughing, applauding and urging others to call and thank the two Democrats for blocking reform of the Senate filibuster. "We don't want the people's will to be done," says former U.S. Senator Rick Santorum in the clip. "Call Joe Manchin an say thank you, seriously. Call Kyrsten Sinema and say thank you," the failed Presidential candidate and fired CNN pundit says. That, as Senate filibuster reform (or elimination entirely!) is desperately needed right now in order to adopt federal protections for voting rights in hopes of countering GOP voter suppression measures now being adopted in Republican-controlled state after Republican-controlled state.
  • But, in somewhat brighter Manchin-related news, he does seem at least mostly willing to go along with the Democrats' landmark, "transformative", $3.5 trillion infrastructure reconciliation package, which --- unlike a voting rights bill --- can be adopted by the U.S. Senate with a simple majority vote...so long as Manchin and Sinema, and all of the other Democrats, play along.
  • In the meantime, back in the states, the COVID infection rates are on the rise again nationally, along with surging hospitalization and death rates in areas of the country with the lowest vaccination rates. That, as the Delta variant is quickly gaining a foothold across the nation. Last week, we discussed Missouri's horrific situation in the rural, Southwestern part of the state, where hospitals are already overwhelmed. Today, we discuss the similarly horrific numbers out of Mississippi, where state officials issued new recommendations for masking indoors once again, and warned the unvaccinated last week that "people are going to die needlessly."

    But the Trump Death Cult appears to be in full flower now in Tennessee, where the State Health Department's new directive bars state health officials from vaccination outreach to teens, incredibly enough. But that's not only for the COVID vaccines, but any and all vaccines --- from Measles to HPV to flu shots! They are no longer allowed to even remind teens when it is time to get their second COVID shot, despite the lack of protection against the Delta variant after only one dose of the Pfizer and Moderna vaccines. That, just one day after the same brainwashed wingnut ghouls of Trump's Death Cultists at CPAC last weekend actually broke into cheers when a panelist discussed the unwillingness of millions of Americans to save their own lives by getting vaccinated.

    There is, however, a bit of apparent good news regarding some of these Trump Death Cult states. Vaccination rates have suddenly been increasing by double digits in some of them over the past week. So, maybe they're finally getting the fear of God in them. Not everywhere, unfortunately. In Tennessee, the number of doses administered over the past week, versus the prior one has fallen by 70 percent as of today. In Mississippi, it's fallen by 80 percent! It's only worse in Joe Manchin's home state of West Virginia, where the rate of vaccination has fallen 94 percent since the previous week, according to Washington Post's vaccine tracker.

  • Finally, I'm happy to say that Desi Doyen's latest Green News Report has much more encouraging news packed into it than usual, including a breakdown of the many long-overdue climate and clean energy provisions currently set for inclusion in the Dems' new infrastructure package (if Manchin doesn't kill them), and in a similar new "Green Deal" initiative being launched this week in the European Union...

Wherein Brad and Desi get their first dose; COVID cases surge again, particularly among the young; The U.S. tops its record for vaccine distribution in a race with deadly new variants; And listeners ring in with their own experiences and concerns on all of the above...

Both Desi and I, as seen in the photo, got our first COVID vaccine shots over the weekend! It was on the same day that a record 4 million Americans also received shots. And it was, in various ways, both revelatory and relieving as discussed on today's BradCast. [Audio link to full show follows summary below.]

There are additional signs today that there is, indeed, light at the end of the COVID tunnel (and that the light is not an oncoming train, as Desiree often warns!), but there are also serious concerns as confirmed infection rates are back on the rise in more than 30 states, including some where it's absolutely spiking in recent weeks.

Overall, cases rose more than 5% in the past week in the U.S., even as testing declined by 13%. We have significantly better news in that the new daily death rate has fallen by some 20% over the past week, but COVID-related hospitalizations are once again on the rise. That's usually followed by an increase in deaths.

Moreover, there have been some very disturbing spikes in cases of younger people becoming hospitalized in recent weeks in several states, as we are now in a race to distribute vaccine quickly enough to avoid allowing for deadlier and more transmissible variants to develop.

As it has been a while, and as I'm in a reasonable good mood after Moderna #1 over the weekend, today seemed a good day to open up the phones to listeners to hear about how their own experiences getting vaccinated --- or trying to --- has been going and how it has gone for them. (I experienced mild fatigue for a day or so. Desi felt pretty much nothing.) And, for those listeners who do not plan to get a vaccine for some reason, we're open to hearing why would be.

The dark money conspiracy behind the anti-mask, pro-hydroxychloriquine movement; The conspiracy of white supremacist provocateurs behind BLM 'riots'; Also: COVID conspiracist Rep. Gohmert has COVID...

On today's BradCast (after a quick correction, thanks to @RadioDoogie on The Twitters, about a point covered on yesterday's show): Conspiracy theorists are too often disregarded. Especially with so many actual conspiracies behind so many of the disasters we're now facing in the U.S. [Audio link to show is posted below summary.]

Sure, some should be disregarded. One example is rightwing wingnut Rep. Louie Gohmert of Texas, who seemed to think that the coronavirus was some sort of conspiracy spun up by Democrats or the Chinese (or someone) to take down Donald Trump and the Republicans. A missive from one of his aide's suggests he berated staff members who wore masks after he demanded they show up at his office each day in the middle of our worsening pandemic to "be an example to America on how to open up safely."

COVID isn't a conspiracy. And now Gohmert is infected with it. We wish him and, most importantly, his family and staff well. He's just one of far too many who could now be facing serious consequences because he either fell for the phony conspiracy claims or knew better but didn't care. Here's just another heartbreaking example of someone else who fell for the hoax that Gohmert was helping to spread that coronavirus was a hoax.

But, there is indeed a conspiracy behind the claims that COVID is a hoax. We saw that well-funded conspiracy playing out in real time this week, as the dark money-supported "Tea Party Patriots" spun off to another phony astroturf organization calling itself "America's Frontline Doctors". They're the ones who put on that Breitbart live-streamed show in D.C. this week --- with quack "doctors" declaring hydroxychloroquine is a "cure" for COVID and that you shouldn't wear a mask --- which both Donald Trump and Donald Trump Jr. (and millions of others) retweeted in tandem earlier this week. The pair of Stable Geniuses were temporarily suspended (Jr.) by the social media platform for sharing what Twitter and Facebook and YouTube describe as "false information about cures and treatments for COVID-19" or saw the retweets deleted entirely (Sr.) But, yes, there is a very real --- and well-funded --- conspiracy of desperate wingnuts hoping to save the 2020 election for Trump who are behind the deadly nonsense that has hoaxed so many and killed at least 150,000 Americans to date.

Meanwhile, in Minneapolis, police have now identified the infamous "Umbrella Man". Remember the white man clad from head to toe in black, with a gas-mask and umbrella, using a hammer to casually smash the windows at an AutoZone store to help kick off riots and looting after two days of otherwise peaceful protests following the police killing of George Floyd?

Turns out the man, now identified by the Minneapolis Police Department as Mitchell Wesley Carlson, is allegedly a member of the Hell's Angels-affiliated Aryan Cowboy Brotherhood, a white supremacist group who "wanted to sow discord and racial unrest by breaking out the windows and writing" "free shit for everyone zone" on the doors of the store, according to the MPD. (He has also been tied to the Aryan Cowboys harassment of a Muslim woman and her four-year old child in a neighboring city of Stillwater.)

The conspiracy to spark riots blamed on "leftist anarchists" worked, and was undoubtedly part of a larger effort identified by leaked memos from federal authorities tracking "white racially motivated violent extremists" who reportedly discussed inciting riots while posing as "members" of the loosely affiliated group of anti-fascists who call themselves Antifa. So, the "conspiracy theory" pushed by Trump and Attorney General Bill Barr and other Fox "News"-fueled Republicans that Black Lives Matter, Antifa and unidentified "leftist anarchists" are somehow behind riots and looting at mostly peaceful protests around the country has little evidence to support it. But the theory that a conspiracy of white supremacist provocateurs is hoping to spark a race war --- evidence of which is conveniently ignored by Trump, Barr and all the rest --- appears to be, so far, right on the money.

We're getting our sea legs back n today's BradCast, after a few days off (thanks, Nicole Sandler for filling in for us!) Luckily it's been a slow few new days since we last spoke. Sigh... [Audio link to full show is posted below summary.]

Anyway, among the stories covered on today's program...

  • How pathetic is malignant narcissist, Donald Trump? So pathetic that he completely made up an invitation to throw out the first pitch at a Yankees game after the nation's top infectious disease expert, Dr. Anthony Fauci, was invited to toss the first pitch at the Washington Nationals' home opener last week;
  • Well, that didn't take long. Now 17 members of the Florida Marlins are said to be infected with the coronavirus, leading Major League Baseball to suspend the Marlins' season through at least this Sunday along with the cancellation of three games this week between the Yankees and Phillies. All of this comes just days after MLB opened for a truncated 60 game season. They didn't make it past Day 3 without an outbreak;
  • If MLB and its billions of dollars can't keep its player safe, how do you suppose your local school district is gonna fare next month if they are ordered to re-open for in-person classes? That is still the plan for Florida Governor Ron DeSantis who is bravely risking the lives of his state's children and their teachers in hopes that somehow that will help Donald Trump get re-elected in 98 days. We wonder if he's noticed that the infection and hospitalization rate for KIDS in the hot-spot Sunshine State is now exploding, with more than 31,000 cases of COVID-19 for Floridians under the age of 18 as of late last week --- a 34% increase in cases and a 23% increase in hospitalizations since the week prior. More than 300 children in Florida are now hospitalized with the virus, with one-third of them between the ages of 14 and 17, and 67 cases of hospitalization for those younger than one year old. That, after Donald Trump told the nation last week at a White House coronavirus briefing that school age kids "don’t catch it easily; they don’t bring it home easily";
  • Meanwhile, on Capitol Hill, the nation's most corrupt Attorney General in history, Bill Barr, testified for the first time ever before the U.S. House Judiciary Committee on Tuesday, as federal troops wreak chaos on American streets and after interceding in criminal cases on behalf of Trump's convicted felon friends, former National Security Advisor Michael Flynn and GOP dirty trickster Roger Stone. Both were found guilty of lying to federal investigators during Robert Mueller's Special Counsel probe into Russian interference in the 2016 election. It was a contentious hearing that seems to have accomplished little. Though it did include a moment when Barr, who pretended to be concerned about the rule of law, seemed to suggest it might be just fine for the President to solicit and/or accept foreign assistance in an election. For the record, that remains illegal --- at least for those who actually do care about the rule of law --- whether Barr actually enforces such things or not;
  • Then, the disinformation wars continue, as led by the President of the United States and his more-than-willing accomplices. One of which, naturally, is his eldest son and namesake Don Jr., who ended up in "Twitter Jail" today for retweeting a video by Breitbart "News" that Twitter, Facebook and YouTube consider to be "false information about cures and treatments for COVID-19."
  • But, of course, Trump Sr. has many such accomplices in the rightwing media. Unfortunately, that isn't limited only to wingnut propaganda cable channels like Fox "News" or Internet propaganda outlets like Breitbart. It also includes the second largest owner of local television stations in the nation. Late last week Sinclair Broadcasting Group, which is allowed to own nearly 200 local stations in more than 100 markets, was shamed into temporarily pulling an episode of American This Week, as hosted by disgraced and fired Fox "News" personality Eric Bolling. (While texting unsolicited photos of one's genitalia is apparently enough to get ya fired by Fox, Sinclair doesn't seem to mind it all!)

    The episode in question featured an interview with a dubious, self-proclaimed "expert in virology" who, among other thing, claims that wearing a mask causes COVID-19, that Dr. Fauci "manufactured" the virus and sent it to Wuhan, China for some reason, and that an eventual coronavirus vaccine will "kill millions". After light was spread on the false claims featured in the episode, Sinclair pulled it for retooling. Today, CNN reports, they will not be airing it at all anymore. The Media Matters Senior Researcher who first exposed the Sinclair conspiracy propaganda, ZACHARY PLEAT, joins us on today's show to explain what happened and why Sinclair's pro-Trump propaganda --- hidden in plain sight, often coming out of the mouths of your favorite trusted local news anchors --- is arguably more insidious than even Fox "News".

    Moreover, that rightwing propaganda is being spread over OUR PUBLIC AIRWAVES in dozens of mostly southern and midwestern states across the country, on stations owned by Sinclair with frequencies licensed (for free) to them by the federal government in exchange for serving "in the public interest". Hopefully the FCC, during the next Administration, will take a long hard look at Sinclair's licensing agreements next time they come up for renewal;

  • Finally, Desi Doyen joins us for our latest Green News Report, with two surprise hurricanes in two different U.S. states over just one weekend; more environmental destruction by the Trump Administration on (hopefully) their way out the door; and the installation of the world's largest battery now set to power tens of thousands of homes with clean, renewable energy in Southern California...

Guest: Constitutional attorney Ben Clements of Free Speech for People; Also: New COVID records; Woolery deletes his Twitter account; RBG battling cancer again; Bowman declared 'winner' in NY...

It ain't over 'til it's over. And several well-respected Constitutional attorneys have just filed a motion arguing the Roger Stone case is not over at all. Not yet anyway. One of those attorneys joins us on today's BradCast to explain. [Audio link to show is posted below.]

But first, some other news of note today. It's becoming a broken record, but the U.S. broke yet another record for new, daily COVID-19 cases on Thursday. It's the 11th such record smashed in the first 16 days of July. With more than 75,600 confirmed new cases reported on Thursday alone, the U.S. is now quickly rushing toward the 100,000 cases per day that Dr. Anthony Fauci shocked the nation a week or so ago by predicting was likely coming soon.

Of course, why should anybody believe the nation's top infectious disease expert Fauci on these things? Former game show host turned rightwing genius Chuck Woolery certainly doesn't! Or didn't. Maybe he does now. Woolery unleashed an unhinged Twitter rant on Sunday calling news about COVID-19 "outrageous lies", and warning us that "The CDC, Media, Democrats, our Doctors" are "lying" about it all. The President of the United State retweet that screed to much notice on the same day. The very next day, however, on Monday, Woolery tweeted again. This time "To further clarify and add perspective." What was his added perspective? His son had been diagnosed with COVID-19. That led the former "Love Connection" host to concede that the virus "is real and it is here." He deleted his entire Twitter account soon thereafter.

Yes. It's real and here, no matter how much Trump and his duped followers hope to pretend it away. And Woolery is just the latest wingnut to be hoisted on his own idiotic social media rantings suggesting the coronavirus is little more than hoax by the media and by Democrats to help them win the upcoming election and/or to allow Fauci and Bill Gates to control the world. Or something. Unlike so many other wingnuts, sadly, who've offered similarly dangerous public rants over the past several months, Woolery wasn't actually killed by the virus before his embarrassing social media spew revealed him to be an idiot. We send our best wishes for a healthy future to both him and his son.

Similarly, we send such wishes to U.S. Supreme Court Justice Ruth Bader Ginsberg who, after apparently overcoming an infection that hospitalized her overnight this week, announced that she, separately, has been undergoing twice-weekly chemotherapy since being diagnosed with a recurrence of cancer on her liver in May. She has, so far over the past decade, survived pancreatic, colon and lung cancer. She says her current cancer is "at bay" and that she is "able to maintain an active daily routine." In her statement today, she vowed to continue her work at the Court until she can no longer "do the job full steam," adding "I remain fully able to do that." In fact, according to NBC News, other than Chief Justice John Roberts and Justice Brett Kavanaugh, Ginsburg authored more opinions over the past term than any of the other Justices, even as she was undergoing treatment for cancer. Meanwhile, the nation will remain on pins and needles until a new President is sworn in.

Ginsburg's still-sharp mind may soon be needed on a number of landmark matters that could come before the Republican's stolen SCOTUS, as the Trump Presidency (hopefully) nears its ugly end over the next several months, even as he becomes more desperate, manic, narcissistic and reckless with each passing day. One such matter that could come before the Court is a ruling on the Constitutionality of Trump's grant of Executive Clemency to his long time pal, former Trump campaign official, and decades-long GOP dirty trickster Roger Stone.

On Wednesday this week, to little public notice, the non-partisan good government group Free Speech for People (FSFP) filed a motion [PDF] with U.S. District Court Judge Amy Berman Jackson, who oversaw the Stone case and his eventual sentencing to 40 months in prison. Stone was found guilty by a jury of 7 counts of lying to Congress and federal investigators in their probe of Russian interference in the 2016 election, and of witness tampering (threatening to kill the witness and his dog) in his case. Jackson, in her closing remarks after sentencing Stone, said he "was prosecuted for covering up for the President."

That same President then granted Clemency to Stone by commuting his 3-year sentence to zero days late last Friday night, before Stone could even reported to prison as scheduled this past Tuesday. But a number of well-respected Constitutional legal scholars are now arguing that Trump's action on Stone's behalf was unconstitutional and should be overturned by Judge Jackson.

"This case isn't over," declared Ron Fein, Legal Director of FSFP in a statement announcing the motion filed with Jackson on Wednesday. "The Supreme Court has acknowledged that the pardon power is not unlimited, and the Constitution requires the President to exercise that power loyally and carefully in the public interest rather than in his own self-interest."

Joining us on the show today is BEN CLEMENTS, a former federal prosecutor, former Chief Counsel to MA Governor Deval Patrick and now Board Chair and Senior Legal Advisor for FSFP. Clements, with more than thirty years of expertise as a constitutional attorney in both the public and private sectors is co-counsel on the motion filed by this week with Judge Jackson.

"In the very clause establishing the Presidency itself, Article II of the Constitution, the framers included language making clear that the presidency is, in effect, a public trust. Its powers must be exercised for the benefit of the public, and not the personal benefit of the President," Clements tells me today. "They specifically provided that the President is required to take care that the laws be faithfully exercised and executed, and they required the President to take an oath to faithfully execute the office of President."

Clements goes on to explain that the Presidential pardon power, while "considerable" is "not absolute," and that the Supreme Court has recognized those powers "are subject to the textual constraints in the Constitution itself." In other words, as he details today, it can't be used in a criminal manner or with a corrupt purpose. He offers the example that it would be unlawful and unconstitutional for a convicted felon to pay bribe money to the President in exchange for a pardon.

"Granting a pardon or a commutation for a completely unlawful and illicit purpose is antithetical to [the President's] obligation to ensure that the laws are faithfully executed," Clements argues, adding, "There's ample public evidence that this was part of an illicit bribe. Stone agreed to protect the President by refusing to tell the truth, even lying to investigators investigating the role of Trump and his campaign in Russia's unlawful interference in the 2016 election. And Trump agreed, in exchange, to protect Stone from the legal consequences of his illegal conduct."

"At a minimum, the public evidence --- including statements from Trump himself throughout these last several years, and from the White House in describing the reasons for this commutation --- that evidence demonstrates that Trump's purpose in commuting [Stone's] sentence is to reward him for covering up for Trump, and to continue to protect Trump," according to Clement. "So, this is not 'faithful execution' of the laws as required by Article II. This is obstruction of the law, it's obstruction of justice, and it's obstruction of lawful investigations all for corrupt and self-interested purposes."

He says it is up to the court --- right now, Judge Jackson --- to consider the arguments presented and "if the judge agrees that the evidence is persuasive, to declare [the Commutation] constitutionally invalid and to order Roger Stone back to prison."

It's a fascinating twist --- or, at least, a potential one --- in the case. Clements goes on to offer his insight on how all of this may play out in the days ahead...including what may happen once, and if, the case reaches the High Court. You'll want to tune in for today's conversation for much more on this important filing, that has otherwise flown largely under the radar this week with everything else that is going on.

Finally, we end with some bonafide good news --- at least for progressives --- as 44-year old progressive African-American and first time political candidate, Jamaal Bowman, is declared the winner by AP over 16-term establishment U.S. Rep. Eliot Engel in New York's June 23rd Democratic primary. Bowman's reported victory in the 16th Congressional District mirrors Alexandria Ocasio-Cortez' win over 10-term Democratic Congressman Joe Crowley in 2018. And, as with AOC's District next door, Bowman's is heavily Democratic as well, meaning the winner of this year's primary is, as AP reports, "virtually assured of victory in the general election in November."

So there's a bit more good news to take home with you this weekend, as we all limp together towards the hoped-for coming end of the Trump nightmare and all that has come with it...

Government whistleblower slams Trump's disastrous response; Dems ditch proposed give-away to 'dark money' groups; WI Supremes endanger state again; Trump voters now more at risk of virus...

As ever (but especially on Fridays!), we try to find some good news where we can on The BradCast. It's been slim pickings of late, but we work with what we've got. We don't create the news. We just report it. [Audio link to full show is posted below.]

We start off with what progressive journalist and former Bernie Sanders staffer David Sirota describes as "Some actual good news". It picks up on an issue we discussed with The American Prospect's David Dayen, who has also been reporting on the same issue, on yesterday's show. House Democrats have been putting together their proposal for the next round of coronavirus emergency funding. Their so-called Heroes Act bill amounts to about $3 trillion of spending in response to the crisis, including a curious expansion of the Paycheck Protection Act for small businesses. The expansion would allow for certain non-profit organizations who were not previously eligible to take advantage of the program.

Among the expanded groups are industry trade groups (lobbyists!) and dark money campaign organizations, which both Davids --- Dayen and Sirota --- strongly objected to. (As noted with Dayen yesterday, and again today, I'm not quite as vehemently against it, for reasons which I explain in a bit more detail on today's program.) In any event, as Sirota reported late on Thursday, it appears that House Democrats heard the complaints, thanks to the handful of independent progressive media outlets reporting on it, and quietly amended the measure to ensure that PPP recipients do "not make a contribution, expenditure, independent expenditure, or electioneering communication."

After that "good news" section of the program, we move on to the lesser good news. Though anytime whistleblowers are able to shine sunlight on corruption and failure that's actually pretty good news as well. On Thursday, longtime federal government career official Dr. Rick Bright --- formerly Deputy Asst. Secretary of Health and Human Services for Preparedness and Response, and Director of the Biomedical Advanced Research and Development Authority (BARDA) --- testified to a U.S. House Committee on the unspeakable failures of the Trump Administration in their early response to the virus, when it could have saved tens of thousands of lives, and even now, after more than 86,000 Americans have been killed.

Bright, who, until last month, had been leading the Government's effort to produce a coronavirus vaccine, was demoted after the Trump Administration became unhappy about him questioning the use of an unproven anti-viral drug (hydroxychloroquine) that Trump was pushing to treat COVID-19. Bright has now filed a whistleblower complaint to get his old job back, alleging he was moved out of his post for opposing "efforts to fund potentially dangerous drugs promoted by those with political connections."

Today, we share some key parts of his more than three-hour long testimony on Thursday, in which he warned that the U.S. lacks any plan at all to battle the virus or even a strategy to produce or distribute a vaccine once one is eventually developed. He blames the Administration for months of failure to obtain and distributing adequate personal protective equipment for medical workers and testing kits for all. He told lawmakers that a shortage of simple but critical supplies like syringes could become catastrophic and cautions that we could be looking at "the darkest winter in modern history" in 2020 if action is not taken very quickly by a dreadfully inept federal Administration.

Meanwhile, Donald Trump told Fox "News" on Thursday that a vaccine will be available by "the end of the year"! And that "we will give it to a lot of people very, very rapidly." So, who ya gonna believe?

Well, apparently, there are a lot of folks in Wisconsin who believe the President, because they were out in droves at bars this week --- crowded together without masks in tiny spaces --- in some parts of the Badger State within minutes after the state's rightwing Supreme Court struck down Democratic Gov. Tony Evers' "Safer at Home" order.

The timing was perfect, as a new study from a researcher at Brookings Institution this week finds that COVID-19 is now spreading at an alarming rate in less populated rural areas (including across Wisconsin) as the rate of infections is declining in the nation's urban centers which were initially hit hard. The study finds that earlier in the crisis, at the end of March, counties won by Hillary Clinton in 2016 amounted to the majority of "high prevalence" COVID-19 counties. As of mid-May, however, that has flipped. It is now people in suburban and rural counties that supported Trump who are more likely to be become infected at an alarming rate. That said, as of May 10, according to the study, some 72% of the nation's population was living in a "high prevalence" county, though only 23% of them were in urban areas.

So, good luck, Trump voters! Donald Trump has a special song for you today!

Finally today, we close with Desi Doyen and the latest Green News Report which we ran out of time for yesterday, in which we find another "bright" side to the crisis, along with the usual amount of otherwise disastrously troubling environmental news...

It was another impossible news day to cover on today's BradCast, but we did our best with two historic hearings happening in D.C. at the very same time and a few special elections around the country just to keep us on busy. [Audio link to show is posted below summary.]

One hearing was on Capitol Hill and the other was at the U.S. Supreme Court --- or, at least, on the live-streamed telephone conference call that has now replaced traditional in-person oral argument at the actual Court, thanks to the still worsening coronavirus pandemic.

We begin today with the SCOTUS hearing. Two of them, in fact. Both on the attempts by federal and state officials to obtain Donald Trump's financial records stretching back 10 years from before he became President. One case concerns subpoenas from three different U.S. House Committees to Mazars USA, the President's longtime accounting firm, as well as to Deutsche Bank and Capitol One, with whom Trump has done business. The other case is over a subpoena by by the Manhattan District Attorney for many of the same documents and tax records from the same financial institutions. That document demand is part of a state grand jury investigation related to unlawful hush money payoffs Trump gave to two women in advance of the 2016 election, and his convicted lawyer Michael Cohen's allegation that Trump and his companies fraudulently inflated and deflated his net worth when applying for loans or filing taxes.

Trump is not actually a party to the subpoenas, but is suing the financial institutions to prevent them from responding to the lawful subpoenas. To date, he has lost every hearing in the cases in lower Courts, where his lawyers actually argued that a sitting U.S. President could shoot people on 5th Avenue and could not be stopped, arrested or investigated for doing so. While the Justices didn't seem to entertain that argument, several of them, particular the Republican-appointees, seemed to be trying to find a way to help Trump out of this jam. We discuss what seems likely to result in either a split on the two different cases --- with the Court blocking the Congressional subpoenas while allowing the ones in the state criminal investigation in NY --- and/or one or both cases being remanded back to lower courts for a more narrow reconsideration that would likely prevent Trump's tax returns and other financial records from being released in advance of the 2020 election.

As those arguments were playing out today, the heads of Trump's CDC, FDA and Dr. Anthony Fauci, Director of the National Institute of Allergy and Infectious Diseases, testified before the U.S. Senate's Health, Education, Labor and Pensions (HELP) Committee. They did so remotely from their homes, where they are each self-quarantining after recently coming into contact with infected individuals at the White House. One of those individuals was Vice President Mike Pence's Press Secretary who tested positive on Friday, just before Pence appeared at a meeting with food producers in Iowa. As the company CEOs waited for the round-table discussion with Pence to begin, they were asked by an aide to the Vice President to remove their masks! That, despite advice from health officials (including the White House's own), and even though two of the executives run meatpacking plants where thousands of workers have contracted COVID-19. One represents Tyson Foods where more than 1,000 workers --- a third of its workforce --- at a meatpacking plant in Waterloo, Iowa have now tested positive. At least three workers at the plant have died.

Rural counties, especially in the heartland --- many with meatpacking plants and prisons --- are seeing a spike in cases of late, along with metropolitan areas where mostly Republican Governors have begun to prematurely lift stay-at-home orders to try and help the economy recover. An unreleased White House document prepared by the CDC and Department of Homeland Security, obtained by NBC News on Sunday, details hotspots all over the country, with many "red" states and counties seeing huge increases in cases over the past week. For example, last Friday, Arizona saw its largest single-day increase in cases, just about a week after Republican Gov. Doug Ducey began reopening the state.

A separate analysis of infections by the Associated Press today finds increasing cases in many of the same hotspots cited by the unreleased White House document, while noting that thousands of people are now getting sick from COVID-19 at their workplaces, including in recently reopened sectors such as construction workers in Austin, TX. At the same time, health workers continue to be hit especially hard, with more than 28,000 now having tested positive with more than 230 deaths in the industry. That, as well over 81,000 Americans have now been killed by the virus over the past two months.

No doubt, all of this is why Fauci warned Senators today of "really serious" consequences, including "suffering and death that could be avoided", if businesses reopen too soon. "There is a real risk that you will trigger an outbreak that you may not be able to control," he cautioned. "Which, in fact, paradoxically would set you back. Not only leading to some suffering and death that could be avoided, but could even set you back on the road to trying to get economic recovery because it would almost turn the clock back, rather than going forward."

But Donald Trump has an election to win this November, and it appears no number of dead Americans will get in his way of winning a second term. On that note, it's Election Day in several states today. And Trump was offering a preview of this November by lying over the weekend about today's Special Election for the U.S. House in California's 25th Congressional District. On Saturday, Rep. Tom Emmer (R-MN), who heads the National Republican Congressional Committee (NRCC) issued a memo to House Republicans with an "urgent call to arms", telling them to "raise hell" because Democrats in California were "doing all they can do to steal the election". Naturally, Trump took the lie and ran with it, tweeting about the addition of an extra in-person polling place for early voting over the weekend in a diverse part of the District, opened at the request of the city's REPUBLICAN Mayor!

Trump falsely claimed the polling place was added by the state's Republican Governor Gavin Newsom. (It wasn't, it was added by L.A. County --- at the request OF THE REPUBLICAN MAYOR who, while supporting the Republican in the race, was furious there was no polling place within his city's boundaries.) Trump falsely declared a "Rigged Election!" and lied to his Twitter followers that the election "was supposed to be mail in ballots only". That is also untrue. For the record, last Friday, Newsom did announce that every registered voter in the state would be sent a postage-paid absentee ballot for the November Presidential election. The move is said to be for safety reasons due to the pandemic --- the pandemic which Trump originally ignored, made much worse, and is now pretending to be over.

Finally today, Desi Doyen brings us the latest Green News Report, as the Administration reopens national parks despite the growing risks of coronavirus; as tax-payers are forced to pay for cleaning up old wells of bankrupted oil companies; and as France offers an airline bailout in exchange for cuts in greenhouse gas emissions. Now there's an idea...

NY State Dems under fire for removing Sanders/Biden contest from ballot; Native American Tribes settle ND Photo ID voting lawsuit; Drano Don still swirling after dangerous disinfectant remark; Plus Callers and more!...

We've got good news and bad --- and a whole lot of facts to go with it --- on today's BradCast. And we even have some time to open the phones to listener calls today!. [Audio link to full show is at bottom of summary.]

Among the stories covered on today's program...

  • Backlash is growing against COVID-19 financial relief measures adopted by Congress, signed by the President, and failing to help the Americans that they were supposedly designed to be help;
  • But, in what appeared (at least as of early this morning) to be much better news, Donald Trump had been planning to stop endangering public health with his appearances at White House coronavirus task force briefings. He did not appear at any briefings over the weekend and, as of Monday morning, on the heels of continuing blowback in response to his musings at last Thursday's briefing in which he discussed injecting people with disinfectant to "cure" coronavirus, his Press Secretary confirmed he would be reducing his role in those nightly briefings which, long ago, turned into Trump Campaign TV shows. A few hours later, however, the White House backtracked. Sure enough, by Monday evening, Trump was back at the podium. But we're still ignoring him. You're welcome.;
  • We can't, however, ignore everything he says, particularly when he continues to put out dangerous misinformation from that podium. Thankfully, we have more trustworthy news sources like....Saturday Night Live to correct him! Brad Pitt played Dr. Anthony Fauci on the show over the weekend, and we share it today because a) it was very funny and b) it helps correct a whole bunch of deadly BS that Trump has been misinforming the American public with. (So much so that even Republicans have been forced to come out and correct the President's dangerous misinformation on poisoning people to try and kill the coronavirus, after calls to emergency poison control hotlines spiked around the country following Trump's remarks.);
  • Shifting to elections news --- the only way we'll ultimately be able to turn the page from many of our ongoing nightmares --- some very good news out of North Dakota today. A settlement has been reached, according to the Campaign Legal Center, with two Native American tribes who sued the state over the GOP effort to prevent them from voting with a law that mandates a Photo ID voting restriction requiring IDs with residential street addresses. That, even though thousands of tribal members living on reservations in the state do not have residential addresses. The settlement, agreed to by the state in hopes of avoiding a trial, will (theoretically) ensure that all Native Americans voters will be able to do so without a problem in ND's upcoming June 9th primary and beyond. That good news also allowed us to report another related good news story from the 2018 election that we've being trying to cover for the past year and a half! It has to do with the three Republican members of the ND state legislature, incuding the House Majority Leader, whose seats were flipped from "red" to "blue" in the 2018 mid-terms in response to the GOP-majority's purposely-disenfranchising Photo ID measure. The best part: The guy who sponsored the 2013 law which took effect in 2018 for the first time, was ousted in the same election by Democrat Ruth Buffalo --- a Native American!;
  • With that good election news out of the way, we move on to New York for some much-less-than-good election news. On Monday, the Democrats on the State Board of Elections voted to cancel the June 23 Democratic Presidential Primary, even though Bernie Sanders, who has suspended his campaign and endorsed Joe Biden, has said he wishes to remain on the ballots for the 20 or so remaining primaries. Over the weekend, his campaign asked the NY Dems to NOT cancel the primary. While most NY voters, due to the coronavirus, will be allowed to vote via absentee ballot in the June 23 election (where there will still be other primaries and issues on the ballot), Democratic state officials said that removing the Presidential race from the ballot would lower turnout in hopes of making in-person voting safer.

    The Sanders Campaign is furious and calls the move a "blow to American democracy". Democratic NY Rep. Alexandria Ocasio-Cortez is also angry and called for the DNC --- which claims they did not call for the cancellation --- to override or reverse the decision, in some fashion. She notes that "Sen. Sanders explicitly stated that he intended on continuing to collect delegates in order to advance wage, healthcare, climate & other priorities into the platform at the convention," adding "unity isn't a feeling, it's a process. Undemocratic, unilateral decisions that disenfranchise millions of progressive voters & volunteers is extremely destructive to the process of unifying the party for Nov."

    The Sanders Campaign has now petitioned the NY State Board of Elections to keep his name on the ballot, with his attorney noting that the Vermont Senator "is concerned that his removal from the ballot would undermine efforts to unify the Democratic Party in advance of the general election." The vote today --- which neither Biden, nor the state Party, nor Gov. Andrew Cuomo asked for --- comes despite the reasonable argument detailed last week at The BRAD BLOG by Ernie Canning, who explained why he believes the more votes Sanders receives in the remaining primaries, the more likely that presumptive nominee Biden will actually win this November!;

  • Also, speaking of elections, voting in Ohio's postponed-at-the-last-minute March 17th election will finally end as of tomorrow (April 28). Absentee ballots postmarked by Monday night will be counted if they arrive at County headquarters by May 8 or if voters deliver them to County Boards of Election by Tuesday night at 7:30pm. In-person voting will be available on Tuesday for disabled or homeless voters, though the state's Secretary of State has said that any voter who claims disability or that they are unable to receive mail will not be challenged and will be allowed to vote in person at County Boards of Elections on April 28;
  • Finally, we take some calls on any number of things discussed on today's show and even much that we didn't!...

Guest: Buzzfeed News Media Editor Craig Silverman; Also: Grim virus numbers, tragically failed Presidency, faint but clear signs of hope...

On today's BradCast, the news remains largely grim --- we'd expect no less during a global pandemic --- but there continue to be signs of light, way, way...way down at the end of the tunnel. For many in the journalism industry, however, the tunnel may be far too long and dark to make it out to the other side. [Audio link to show follows below.]

First up, thanks to an entirely dysfunctional, entirely failed Presidential Administration, things that should already be getting better --- the easy stuff, like testing, personal protective equipment and ventilator shortages --- shamefully, do not appear to be getting better in many parts of the country. The death toll in the U.S. has now officially surpassed both China's and our own on 9/11.

But we see more and more signs each day that at least physical distancing appears to be working as hoped --- slowly, but with unmistakable progress in locations where it is being dutifully practiced. But there remains a long way to go, and a dark tunnel to get through until we see that full light.

With nobody on the federal level leading the way, states and cities continue to do so as best as they can. But it is difficult if not impossible for them, or the news media, to know what to even expect on a macro level as the economy heads into completely unknown territory. According to at least one new economic analysis from the St. Louis Fed, unemployment rates could end up dwarfing even the highest levels of the Great Depression, much less the Great Recession.

And with that cheery news, we're joined today by longtime media industry expert CRAIG SILVERMAN, BuzzFeed News' Media Editor, to discuss the troubling outlook for independent local media as well corporate media amid the coronavirus pandemic. The industry is one of the first to feel the brunt of a nearly national shutdown. Ironically enough, the readership for many news outlets has "skyrocketed across the board" online, he says. "People are hungry for the latest quality information about what's going on with the coronavirus, and they're going to news organizations to get that information."

At the same time, however, ad revenue has collapsed and the same outlets across the country (and world) seeing a spike in readership are being forced to shut down the print sides of their publications, lay off journalists, and otherwise scale back reporting at a time that good local journalism is needed more than ever.

A number of alt-weeklies have already gone under, as their ad revenue is based almost entirely on industries like restaurants, bars, movie theaters, concerts and live events that have all been forced to shut down. "The alternative weeklies are kind of canaries in the coal mine. A lot of alt-weeklies have already gone out of business in Canada and the United States," Silverman warns. "A lot of the very small newspapers, especially that are part of chains, or had debt, they may not be able to come back."

"Now, we've got some of the biggest newspaper chains in the US, like Gannett [publisher of USA Today and more than a dozen other major papers], yesterday they announced they're doing unpaid newsroom furloughs for one week a month. Los Angeles Times is significantly cutting back on its print sections Monday to Friday. Other newspapers are getting rid of print editions," he tells me.

Silverman explains what one journalism industry analyst is describing as a "full extinction event" for many outlets, and the millions of dollars in lost revenue for some of the largest ones, thanks to a bizarre ad blocking scheme that some major brands are instituting on coronavirus related news stories.

We also discuss what you, dear readers and listeners, can do to help. "This is the moment for you to pay for the media that you care about," he says. "It's about people deciding for themselves what media they want to support. It may not be a big national outlet. If you have money right now --- and that is a big 'if', a lot of people are struggling --- but if you have money and you can afford maybe $5, $10, $15 a month, this is the time to stand up and show that support. A lot of people in newsrooms who are getting laid off, furloughed, who are getting pay cuts, this can make a difference if enough people step up and start to do it."

Finally, we're joined by Desi Doyen with our latest Green News Report as Trump's EPA, even in the middle of an unprecedented health crisis, has now officially reversed landmark Obama-era mileage standards for cars that, in addition to combating climate change and lowering gas prices, would have also helped prevent some 1,400 unnecessary American deaths per year. But that's not all the Administration is doing to undermine the planet's climate and the health of Americans while most folks are looking the other way, and as the plastic industry is hoping to find profit in a pandemic...
