State-by-state analysis serves as warning to rogue election officials...

Non-profit government watchdog, Citizens for Ethics in Washington (CREW) has detailed what they describe as an illegal plot among Trump-supporting county election officials to sabotage the certification of the 2024 election results.

The scheme has been reported elsewhere in recent days, including in an excellent deep dive by Justine Glawe at Rolling Stone, reporting on "nearly 70 pro-Trump election conspiracists currently working as county election officials [in battleground states] who have questioned the validity of elections or delayed or refused to certify results."

In a lengthy and detailed State-by-State Analysis [PDF] released this week, CREW is offering a roadmap of legal remedies in each of eight battleground states that, if followed, they believe can defeat the looming threat posed by such a scheme and ensure timely certification of results in this November's Presidential election...

"Thank you, Madame Vice President, for the trust you put in me," he said as he began his remarks during their first public appearance together as running mates on the 2024 Democratic ticket. "But, maybe more so, thank you for bringing back the joy." We send our thanks in return on today's BradCast. [Audio link to full show follows below this summary.]

But, very quickly before we get there today, we've got a few of the noteworthy reported results from Tuesday's largely problem-free (so far) Congressional and state primary elections in Michigan, Missouri, Kansas and Washington state. And a few thoughts on Donald Trump's latest pathetic attempt to remain relevant by endorsing more than one --- sometimes all of the top contenders --- in the same Republican primary race. What a loser.

THEN... it's on to our roundtable guests today, who seem to be in a very good mood for some reason, after the Democrats' now official 2024 Presidential nominee, Vice President Kamala Harris, tapped Minnesota's progressive Governor Tim Walz as her VP candidate on Tuesday.

Walz, as we discuss, has a life and political biography that, if he was a fictional character in a political miniseries, you'd think the writers had laid it on a little thick. But, sure enough, Walz' extraordinary career and accomplishments --- born in rural Nebraska; 24 years of decorated service in the Army National Guard; 20 years as a high school teacher and state champion football coach; 12 years in the U.S. House; and two wildly effective terms as MN Governor, including the passage of a slew of popular progressive priorities --- all seem quite real. AND, it has all been carried out, it seems, with much of the same "joy" he thanked Harris for "bringing back" during their first joint appearance on Tuesday in Philadelphia.

Now, as the Dem ticket's poll numbers continue to surge, the pair is off and running with joint appearances in at least five battleground states this week, while Trump is set to appear in, well, just Montana for some reason.

We're joined again today for another one of our weekly roundtables with two very smart and fellow old school bloggers, HEATHER DIGBY PARTON of Salon and Hullabaloo, and 'DRIFTGLASS' of The Pro Left Podcast. They were last on the show together just three weeks ago. But, boy howdy, was that a different world, as Dems were still trying to figure out how to survive with Joe Biden at the top of their ticket following his disastrous late-June debate performance. What a difference three weeks makes.

Today, we are focused on the selection of Walz as VP and what all of that means for both the electrified Dem and seemingly stultified GOP tickets. By way of just a quick sample from our conversation today, from both guests in response to Harris' selection of Walz...

DIGBY: "Tim Walz, I think, is the most lovable politician I've come across in a long time. And I think the country is ready for that. ... One of the reasons why everybody has been in such a bad mood and has been for so long is because of Donald Trump. Because he won't go away. He won't stop talking. And he won't stop making everybody unhappy --- and that includes the people on his side. ... And then you've got this lovable dude coming out, and it's like suddenly you feel kind of good about politics. That maybe this thing that we've been going through for eight long years, maybe we have some hope of coming out of it. ... He said 'We're bringing the joy,' and I think that is exactly what he does, and that was a very wise choice. I think people are hungry for it and ready for it."
DRIFTGLASS: "He's Uncle Ted Lasso. He's happy, and he's joyful, and he's funny, and he has that Midwest Dad Energy just radiating off him. ... This is everybody's favorite uncle. ... Why was this sitting on the shelf all this time? And you realize there are a lot of people in the Democratic Party like this, who bring this stuff to the table. It's just that getting them to the front of the line sometimes is tricky. And the Trump Campaign thought they had this thing locked up. They're running Smelly Old Caligula, and their strategy is 'Just shut up and sit down, go golfing...if you just keep quiet we'll ease you into the White House.' And now they are completely on their back foot. J.D. Vance was supposed to be Tim Walz. Tim Walz was built in a lab to look like the perfect Midwest candidate."

There is much more where all of that comes from today, on how the progressive AOC and rightwing Joe Manchin are actually in agreement that Walz is an "excellent decision" and "the real deal"; on Team Trump's hilariously flatfooted response; on the one option the GOP could (but won't) deploy to turn things around; on "mind[ing] your own damn business"; on Minnesota/San Francisco/American values; on whether Trump could ever dump Vance; on whether the Dem momentum can continue for another 90 days; on Trump's bizarre post-Walz meltdown; and much more...

On today's BradCast, we take up the President's charge to stand "in defense of democracy". [Audio link to full show follows below this summary.]

Among our coverage today...

  • During President Biden's solemn, somber and historic prime time Oval Office address to the nation on Wednesday evening (transcript here), to explain his Sunday decision to drop out of the 2024 Presidential race and endorse Vice President Kamala Harris for the top of the ticket, he focused in no small part on the need to defend democracy against wannabe "kings and dictators," while he charged that "the cause of American democracy itself" is now at stake. "We must unite to protect it," he implored. We discuss and continue to join that fight.
  • Meanwhile, as the U.S. House on Wednesday voted 417 to 0 to create a special task force to probe what happened during the July 13 assassination attempt on Donald Trump in Pennsylvania, FBI Director Christopher Wray testified on Wednesday that, in fact, nearly two weeks since the shooting, we have no idea "whether or not it's a bullet or shrapnel" that wounded Trump's ear. In fact, to date, no medical expert or law enforcement official has ever offered an official public accounting of what actually happened to the former President that day, even as mainstream corporate media have simply taken the social media claim by Trump, an inveterate liar, that a "bullet...pierced the upper part of my right ear" as fact. Ever since, Trump has exploited the event to claim at his convention, in rally speeches and on social media, that he "took a bullet for democracy."

    As we detail today, however, all available evidence suggests that is simply a lie. The man who, himself, has become the greatest threat to American democracy in modern history is now using the near miss for stolen valor to pretend to be a defender of democracy.

    As Ernie Canning explains at The BRAD BLOG this week, whether Trump "took a bullet" or not, it was not "for democracy," as investigators have reportedly found no evidence to suggest the shooting was politically motivated. And, as TPM's Josh Marshall has been reporting for some time, evidence suggests it was more likely some sort of flying shrapnel that grazed Trump's ear, along with causing similar minor injuries to several local cops who were near the stage that day. In any event, the media's failure to even ask the Trump Campaign about these details --- as one rally goer was actually killed and two others critically wounded that day --- for apparent fear of angering the former President, is "bizarre" and "a total journalistic failure" to the American people and to history. It also, as we note, underscores tyranny expert and author Timothy Snyder's repeated warnings about giving up power to would-be autocrats by "obeying in advance." Much more on all of this on today's show.

  • We've got more details today on the DNC's plan to begin a virtual roll-call vote on August 1st next week --- well in advance of their August 19 convention in Chicago --- in order to finalize the party's Presidential and Vice-Presidential nominees no later than August 7th. Why are they doing this? No, it's not to ensure there are no challengers to presumptive nominee Kamala Harris. Rather, it is thanks to a story we've been covering since the beginning of the year about the failure by Republican state lawmakers to change the statutory deadline for submitting certified party nominees for the Buckeye State ballot by August 7th, as they've done for many years, as needed, when Republicans hold their national conventions late in the summer. Yes, state lawmakers, in a late special session, finally changed the statutory deadline. But the new law doesn't take effect until September 1, opening opening up Democrats to a potential legal challenge by Republicans as to whether their nominee can lawfully be on the state's ballot at all this November. Tune in for more details.
  • More news "in defense of democracy" out of Ohio this week. A ballot measure for a state constitutional amendment that would create an independent redistricting committee has qualified for the November ballot! If adopted by voters, it could end the state GOP's wildly gerrymandered Congressional and state legislative maps for 2026. Otherwise, Republican Buckeye State politicians will continue to be allowed to choose their own voters, rather than vice versa, until at least 2030.
  • And still more good news "in defense of democracy" from the Buckeye State today! A federal judge has struck down part of a sweeping election reform package adopted by Ohio Republicans last year that makes it a felony for disabled voters to allow caregivers, roommates, in-laws or even grandchildren to help them cast their absentee ballot by mail or drop box. The voter suppression law threatened to charge anyone but immediate family members (which apparently doesn't include grandchildren!) with felonies for helping those voters in need to cast their ballot. That, as the CDC finds that people with disabilities make up more than a quarter of the U.S. adult population.
  • Finally, Desi Doyen joins us for our latest Green News Report, with news on explosive wildfires in the U.S. and Canadian west; the two hottest days ever recorded on Planet Earth (this past Sunday and Monday); and a focus on the Republicans' shocking Project 2025 plans to gut federal science agencies --- such as the EPA and National Weather Service --- along with climate science and many if not most environmental protections and climate change initiatives...

Well, it's been several slow news days since we last spoke on The BradCast. Sigh... [Audio link to full show follows this summary.]

On Saturday, a 20-year old registered Republican tried to kill Donald Trump during a campaign rally in Butler, Pennsylvania with the type of long-range, high-capacity, semi-automatic rifle that Republicans have spent years fighting to ensure are easily available to almost anyone in the country who wants one. Their only use is for mass shootings. Now we've had one at a Republican political rally. Thankfully, the shooter, Thomas Matthew Crooks, barely missed the former President. Though he did kill one rally goer and critically injured two others.

Democrats, from President Biden on down, have since been calling for a cooling of political rhetoric, the type of which led to the assassination attempt on Nancy Pelosi's husband, the attempted kidnapping and murder of Michigan's Democratic Governor Gretchen Whitmer, and the attempted insurrection at the U.S. Capitol, among too many other such recent incidents.

Republicans, on the other hand, from the new Republican Vice Presidential nominee and Trump critic turned toady, U.S. Sen. J.D. Vance on down, have opportunistically used the tragic shooting to blame Democrats somehow for the attempt on Trump's life. Some have gone so far as to blame Biden himself in one for somehow personally attempting to murder Trump. Republicans have also attempted to use the incident as a way to chill factual, peaceful political speech that is appropriately and accurately critical of their standard bearer and the party's efforts to undermine America's Constitutional democracy in favor of autocracy and fascism.

No actual motive has emerged for the shooter who was killed by the Secret Service and has so far been identified as a gun enthusiast and "definitely" a "conservative" by one of his former classmates.

We discuss much more on that story today which should have been our lead and only story today. Sadly, it wasn't.

Down in federal court in Florida, the corrupt Trump-appointed U.S. District Judge Aileen Cannon imagined up a reason to dismiss the entirety of Special Counsel Jack Smith's federal indictment of Trump and two co-conspirators on 40 criminal counts related to his theft of thousands of pages of classified documents when leaving the White House and his refusal to return them, in violation of the Espionage Act and other federal statutes. Cannon's reasons [PDF] for dismissing the case --- questioning the constitutionality of the Special Counsel's appointment --- has been rejected by court after court for years in many other cases where a Special Counsel was appointed (including the Robert Mueller probe of Russian interference in the 2016 election and more recently in the case against Hunter Biden) But, following recent instructions in a solo opinion issued by corrupt Supreme Court Justice Clarence Thomas (signed by no other Justices) in an unrelated case, Cannon dismissed the entire stolen documents case. The Dept. of Justice has said they will appeal. Hopefully, when they do, they will also finally move to have Cannon removed once and for all from this case.

Given Saturday's horrific assassination attempt on Donald Trump at a political rally in Butler, Pennsylvania, I am postponing today's Sunday Toons for now. The toons I had prepared on Saturday, prior to the shooting, can wait. It does not feel appropriate to publish at this hour.

We all still very much need the occasional relief of finding humor in the god awful churn of news events this nation is facing. Perhaps now more than ever. But, for now, for this moment, that can wait. Maybe for a few hours. Maybe a few days. Or maybe until next week. We'll see.

What happened on Saturday was nothing but disgusting and shameful. I am glad --- and we are all very lucky --- the outcome was not even worse.

Though we don't yet know the full circumstances of whatever occurred, it is appalling that a would-be assassin was able to obtain what appears to have been a long-range semi-automatic rifle with which so many rounds could be fired in a matter of seconds and with such deadly precision at such a distance. (Reportedly from outside of the venue's perimeter, from about 150 yards away from where the former President was speaking.) Such a weapon is a weapon of war. It should come as little surprise then that they are now regularly being used in such a fashion. For a political war.

The political violence that has been fostered, and that we have seen play out in too many incidents in recent years, must end. The assassination attempt on Trump reveals America at its shameful worst. Despite his disgusting repeated mocking of a similarly grotesque attempt to assassinate the husband of Nancy Pelosi in October of 2022 --- repeatedly treated as a literal joke by Trump and his supporters --- there is nothing amusing about what happened on Saturday. We should all condemn such behavior, no matter who carries it out and no matter who the victim or attempted victim may be.

The May 3 article that appeared in UCLA's campus newspaper, the Daily Bruin, was disturbing but not surprising. The LAPD stood idly by as a group of "tear gas" wielding, pro-Israel "counter-protesters" violently attacked a pro-Palestine protest encampment. The attack reportedly went on for nearly four hours before the LAPD moved in, not to stop counter-protester violence, but to breakup the encampment.

In a formal Statement, staff members of the UCLA History Department noted:

LAPD advanced on the student encampment, pushing and herding them, using the tactic of kettling. Forced closely together, the students made easy targets for police who shot them with stun grenades, chemical agents, and rubber bullets. Police beat them with batons and shot them with rubber bullets, striking one student in the face with a rubber bullet. At least twenty-five students had to be hospitalized. They then arrested approximately 200 students, staff, faculty, dragging visibly injured students away.

The history professors chastised both University of California administrators and the LAPD for their "disregard" for "students' safety and their right to express their views."

The professors weren't the only ones to express concern for law enforcement's failure to intercede as pro-Israel "counter protesters" violently attacked the encampment. California's Democratic Gov. Gavin Newsom, according to the Los Angeles Daily News, "called for investigations into [why the] pro-Israeli counter-protesters' attack...was allowed to rage for several hours with little to no police intervention."

Sadly, the story, as recounted by the Daily Bruin and the UCLA history professors, is on the continuum of well over a century of right-wing bias on the part of local, state and federal law enforcement against those who exercise First Amendment rights to engage in non-violent strikes or in peaceful, anti-war, environmental, and civil rights protests....

The historic trial for Donald Trump's 2016 election interference indictment continues, but was on a break today in New York. That gives us an opportunity to get caught up with all the action since our previous mid-week "ketchup" episode in the first-ever criminal trial of a former U.S. President. We have much to discuss to that end on today's BradCast, but we first kick it off with some election and voting rights news. [Audio link to full show follows this summary.]

  • Democrats "massively outperformed" pre-election polling yet again on Tuesday, in a Special Election for the U.S. House in New York's 26th Congressional District. Timothy Kennedy was predicted to win the seat by 9 points. He won by 36!!!
  • The Trump-appointee heavy 3rd Circuit Court of Appeals voted to uphold a three-judge panel finding that mail-in ballots with missing or incorrect dates on their outer envelope in Pennsylvania must be tossed out, even though, as both sides agree, that date is used for exactly nothing. If a voter, for example, writes 2023 instead of 2024 on the ballot's outer sleeve this November, it cannot be counted, according to the Court. Democrats disproportionately vote by mail, as compared to Republicans, in the Keystone State. Voting Rights advocates are now deciding whether to take the matter to SCOTUS (good luck with that) or rehear the matter on a different basis at the trial court. Both options offer a perilous path before this year's election in the critical battleground state.
  • In an absolutely twisted ruling, a three-judge federal panel ruled on Tuesday struck down Louisiana's newly-drawn second majority-Black U.S. House district, declaring it to be "an impermissible racial gerrymander". The new House map was approved by the state's GOP-controlled legislature earlier this year after they'd lost their long fight in federal court against adding a second Black voting district in a state which has long had just one (out of six), despite Black voters comprising one-third of the state. The new map with the newly redrawn district was already used to select candidates in the state's primaries last month. As explained today, this is likely to become a real test of the corrupted U.S. Supreme Court's often opportunistically used, so-called "Purcell Principle".

The court takes Wednesdays off in Donald Trump's New York criminal trial on 34 felony counts related to his use of hush-money paid to a porn star to help him cheat his way to winning the 2016 Presidential election. So, today is a good opportunity for us here on The BradCast to get caught up on our trial story so far with two guests who are following it closely. [Audio link to full show follows this summary.]

But, FIRST UP, it was Primary day in Pennsylvania on Tuesday, and though the nominations for both major party's Presidential candidates are long ago all but official, the turnout and results from the Keystone State's closed primaries on both sides are somewhat revealing. Tune in for details, but suffice to say, Joe Biden appears to have outperformed Trump in the narrowly divided battleground state yesterday, where Dem turnout outpaced Republicans and Nikki Haley, who quit the race weeks ago, racked up nearly 17% of the GOP Presidential vote. There were several U.S. House races of note and uncontested primaries for this year's critical U.S. Senate race in PA, where incumbent Democrat Bob Casey is taking on billionaire hedge-fund manager Dave McCormick (who has been less than forthright about his upbringing.)

President Biden signed a long-overdue $61 billion aid package for our democratic allies in Ukraine after overwhelming Senate passage on Tuesday night. That followed on the heels of Saturday's passage in the House by Democrats following an about-face by GOP House Speaker Mike Johnson. The package adopted by Congress and signed by the President today is for $95 billion in all, including funding to replenish Israel's missile defense systems following Iran's attack last week, billions of dollars in humanitarian aid in Gaza, and military aid to Taiwan. The bill also includes a ridiculous measure that may result in the popular social media app TikTok being banned in the U.S.

In reproductive rights (or lack thereof) news, the corrupted far-right majority on the U.S. Supreme Court appeared skeptical during heated Oral Argument on Wednesday over a Biden Administration mandate under the Emergency Medical Treatment and Labor Act (EMTALA). The 1986 statute requires hospitals that accept federal medicare funding to offer emergency, life-stabilizing care to all patients who arrive in the emergency room. After SCOTUS overturned Roe v. Wade, the Administration reminded facilities that such care includes abortions when a patient is "in serious jeopardy" or any condition that might impair bodily functions or organs, no matter the state's own restrictions on reproductive care. Idaho disagreed and sued. The packed rightwing supermajority on the High Court was working hard today to side with Idaho.

There was somewhat brighter related news in Arizona on Wednesday when, after three weeks of trying, Democrats in the state's House were finally able to vote to repeal the state's 1864 territorial ban on nearly all abortions. Three Republicans joined all 29 Democrats to repeal the law. The measure still needs passage in the GOP-controlled state Senate, after which AZ's 15-week abortion ban would take the place of the 160-year old near-total ban.

And THEN, we're joined again today our friends award-winning columnist and blogger HEATHER DIGBY PARTON of Salon and Hullaballoo and former attorney (and former Republican) KEITH BARBER of Daily Kos to get up to speed on this week's fits and starts in Donald J. Trump's New York criminal trial.

After last week's faster-than-expected jury selection, the trial began with Opening Statements on Monday in which prosecutors described Trump's criminal scheme to hide several sexual affairs just before the 2016 election as "election fraud, pure and simple". On Tuesday morning, during a contempt hearing on at least 10 instances in which Defendant Trump violated the court's gag order against attacking jurors and witness, the judge instructed Trump's attorney Todd Blanche that he was "losing all credibility with the court." Says Barber today: "In a list of phrases that could be the worst to come out of a judge's mouth in the first two days of a trial, that would be right at the top of the list."

On both days, shortened for the Passover holidays, David Pecker, former National Enquirer publisher and longtime friend of Trump, took the stand on behalf of the prosecution to discuss hush-money payoffs he'd arranged as part of an alleged conspiracy with Trump and his attorney Michael Cohen to publish damaging stories about Trump's political opponents and quash stories that might be damaging to him. As Pecker detailed, that included paying off a Trump Tower doorman to shut up about his claim that Trump fathered an out-of-wedlock child with a maid who also worked there, and to "catch and kill" the story of Playboy model Karen McDougal who says she carried on a nearly year-long affair with Trump while his wife Melania was pregnant.

Parton describes the first witness in this case as offering several ironies since Pecker "said that their little scheme back in 2015 and 2016 was all fake news. Literally fake news. They made up stories. They killed negative stories about Trump and pushed negative stories that were literally fake news about his rivals. It's like gaslighting to the thousandth power."

Pecker's is expected to continue his testimony on Thursday regarding the $130,000 hush-money payment made to adult film star Stormy Daniels, which was repaid to Cohen by Trump via monthly installments during his first year in the White House. Those payments became the falsified business records at the center of this trial, as the Trump Organization logged them as legal retainer fees, rather than unreported reimbursements that ran afoul of campaign finance laws, according to prosecutors.

Both Parton and Barber find it curious that, while Trump has been relentless in his attacks on witnesses like his longtime attorney and fixer Cohen, he has not said a negative word about his friend Pecker since the former Enquirer chief signed a cooperation agreement with prosecutors in 2018. She believes there is much more that Pecker knows about Trump above and beyond the scandals he's already detailed in this case. Barber concurs: "There's reason to believe that David Pecker has more of Trump's bodies buried in various places."

During opening statements in the disgraced former President's ongoing criminal trial, prosecutors argued the scheme surrounding his hush-money payments to a porn star just before the 2016 election amounted to "election fraud, pure and simple." Similar fraud since then, by Trump and now much of his Republican party, pervades many of our stories on today's BradCast. [Audio link to full show follows below this summary.]

Among our stories today...

  • It's Primary Day in Pennsylvania. We'll have noteworthy results and/or problem reports on tomorrow's program. (Recent elections in PA have revealed serious problems with the touchscreen voting systems still shamefully used in a number of jurisdictions.) But the election in the Keystone State today --- as some voters are reportedly struggling with newly implemented Photo ID requirements --- also provides a reminder as to why it's a good idea to vote in primaries, even when races at the top of the ticket may already be foregone conclusions.
  • Donald Trump's election-fraud-via-hush-money criminal trial in New York continued on Tuesday. We offer a a few quick updates. One point we missed Monday's opening statements, included the fact that prosecutors say they have hand-written documentation from longtime Trump Organization CFO Allen Weisselberg as to why Michael Cohen was paid $420k as reimbursement for his $130k payment to porn star Stormy Daniels. Today, the day began with a contempt hearing over at least ten instances in which prosecutors allege that Trump has violated the court's gag order on attacking jurors and witnesses. The judge has yet to issue his ruling, but the hearing culminated with Trump's attorney Todd Blanche being upbraided by a frustrated Justice Juan Merchan, who told him, "You are losing all credibility with the court." For that, it appears, Trump's campaign and associated groups have been paying about $145,000 in donor money for legal fees each day since early 2023, according to newly released numbers. After the jury arrived, the trial's first witness continued his testimony. That would be former National Enquirer publisher, longtime Trump pal, and alleged "catch and kill"/hush-money co-conspirator David Pecker.
  • Arizona's 2022 Republican election losers, Kari Lake and Mark Finchem, both falsely claim their elections, for Governor and Sec. of State respectively, were stolen from them somehow, by the Republican officials who run elections in the state's largest County. They sued in 2022 and have lost in court after court ever since. On Monday, the corrupted rightwing U.S. Supreme Court also rejected their case. They are both running again in 2024, for U.S. Senate and state Senate respectively. What could possibly go wrong?
  • Speaking of 2024 Republican U.S. Senate candidates in battleground states, Wisconsin's Eric Hovde really, really wants you to know that he totally thinks "elderly should absolutely vote". Even after his previous comments about elderly voters in nursing homes that really kinda makes it seem otherwise.
  • The Trump Campaign and the RNC (now effectively one and the same) have announced their plans for an "Historic, 100,000 person strong Election Integrity operation"! We've got a few thoughts about what that really means. Though it probably doesn't help that a statement from Trump himself included in the announcement echoes almost precisely a statement long attributed to Josef Stalin that "it's not who votes that matters, but who counts the votes".
  • As to actual election fraud, as usual, the call is coming from inside the Republican house. This time, it's a guy named Austin Smith, an Arizona's Republican state Rep. and top leader of Turning Point Action --- a group which has long echoed Trump's false 2020 election fraud claims. Smith has apparently been caught submitting dozens of signatures, in his own hand-writing, for his own reelection campaign. While denying the charges, now being investigated by the AZ Attorney General, Rep. Smith has since resigned from Turning Point and called off his reelection campaign. But really, he insists, he didn't do it!

Not much is known as of airtime, beyond one dead, more than 15 injured and two (now three) said to be in custody, according to Missouri state officials.

Then, the House GOP, on behalf of the disgraced, twice-impeached former President was finally successful on Tuesday in passing Articles of Revenge Impeachment against Homeland Security Secretary Alejandro Mayorkas. The do-over vote follows their embarrassingly botched effort at same last week. This week, they were able to pass the Articles by one single vote, 214-213, against three Republican defectors and a unified Democratic caucus for "charges" that are not even close to the "High Crimes and Misdemeanors" mandated by the Constitution. Both Articles are expected to die, one way or another, over in the Senate, where even Republicans have shown little interest in the charade.

GOP House Speaker Mike Johnson had to get those Articles passed yesterday, however, given what New York voters did on Tuesday, when the seat in the state's 3rd Congressional District, formerly held by disgraced, expelled and indicted con-artist, Rep. George Santos, was flipped from "red" to "blue" by former Democratic Rep. Tom Suozzi. He easily defeated Republican Mazi Pilip by almost 8 points in Tuesday's hotly-contested Special Election, according to the latest reported numbers. That was almost twice the margin predicted by even the most optimistic pre-election polls. The Dem victory in New York (and another in Pennsylvania on Tuesday night --- by 36 points!), again underscores the dearth of issues that Donald Trump's dysfunctional Republican Party has to run on or offer voters this year. Had House Repubs waited just one more day to vote on Articles of Impeachment, they would have lost again.

More apparent good news for voters and Democrats this week in Wisconsin, as the Republicans who control the wildly gerrymandered state Senate and Assembly have passed legislation to adopt new legislative district maps in advance of the 2024 elections, as ordered by the state's Supreme Court. The new maps are ones created by Democratic Governor Tony Evers. And though they don't promise a Dem majority for this year's elections, they do appear to be much fairer for voters. For more than a decade the GOP's gerrymandered maps resulted in nearly twice as many Rs as Ds in the state legislature in the otherwise very closely divided state. State Republicans approved Evers maps because they fear if the High Court selects a map it will be even worse for them. Evers has suggested he plans to sign the legislation.

Meanwhile, as Democrats continue to out-perform in 2024 elections, Republicans are busy in court defending their criminal efforts to steal 2020. A fake elector in Michigan on Wednesday testified that he was lied to by party officials that state legislators could select the phony Trump slate of electors over those for Biden, who state voters actually chose. This particular fake elector has decided to cooperate with prosecutors while 15 others are now facing serious jail time for their alleged conspiracy to forge phony Elector certificates.

And this week, we've got new news from the man who invented the fake electors scheme in the first place. A massive trove of emails, text messages and other documents have been turned over to Michigan prosecutors by former Team Trump attorney Kenneth Chesebro and obtained by our guest today, investigative journalist JOSH KOVENSKY of Talking Points Memo. He has been detailing the documents in a new multi-part series this week at TPM which explores the attempted coup, hoped-for chaos, and the plan to pressure friendly members of SCOTUS.

Chesebro first dreamt up the fake elector plot for his own home state of Wisconsin in 2020, before he was asked by Team Trump attorneys, such as the disgraced John Eastman and Boris Ephstyn, to apply the same scam for phony electors in about seven swing-states following Trump's loss in November. They would be instrumental to the Trump team's failed legal efforts to steal the election.

The Chesebro documents shed new light on the failed "legal coup" which, as Kovensky reports, was not meant to be a one-day insurrection on January 6th, 2021, but to result in enough legislative chaos and trumped-up "questions" about the veracity of certified election results to force the U.S. Supreme Court to eventually settle the election themselves, ala Bush v. Gore twenty years earlier.

"What they really wanted was a stalemate in Congress" on January 6th, Kovensky explains. "And in that time, they would have used that stalemate to draw the country's attention to Congress, and then use that attention to put forth the campaign's completely nonsensical theories of voter fraud. That was the idea."

"If you talk to people who were around this, they'll say, 'Yeah, the invasion of the Capitol on January 6th destroyed that plan. Because it did draw attention to Congress, but there were no members of Congress there to make the case that there was voter fraud in the election," he tells me.

"The way the legal coup was meant to proceed was by halting the count," as detailed in the new docs obtained and reported out by Kovensky. "That's the key similarity between what the rioters on Jan. 6 ended up achieving by violent means and what the lawyers were trying to achieve just by procedural means. Which was that the count would have been stopped, [but] it would have been stopped indefinitely until potentially the Supreme Court stepped in to act and appoint Trump the winner."

So how did Chesebro --- who, until now, has not appeared, at least, to be a hard-right partisan ideologue along the lines of Eastman and Ephsteyn --- find his way into the vortex of Team Trump and the "legal coup" they were hoping to pull off? What is he hoping to accomplish by turning over these documents to prosecutors in MI and elsewhere since pleading guilty to one felony charge with no jail time in Georgia last year in exchange for testifying against his fellow conspirators? Will Trump be able to use Chesebro's documents and testimony to help himself in his own trials regarding his attempt to steal the 2020 election?

You may have noticed the nation is a bit of a tinder box right now. If the currently presumptive 2024 GOP nominee loses in Georgia again next year and just one precinct, out of thousands in the state, experiences something akin to what happened last week during elections in Northampton County, Pennsylvania... well, I don't even wanna think about the likely ramifications. Though we do discuss that today as part of our BradCast, which focuses almost exclusively on election-related lawsuits and criminal cases in the Peach State. Our guest is one of the plaintiffs in one of the most important cases you probably haven't heard about on your favorite cable news station. [Audio link to full show follows this summary.]

The long-awaited Curling v. Raffensperger voting system trial is finally set to begin in Atlanta in January, just after the start of the new Presidential election year in the critical battleground state Originally filed in 2017, the long-running federal lawsuit has already been extraordinarily consequential.

Among other things, it resulted in the 2019 banning of Georgia's then nearly 20-year old, unverifiable, insecure touchscreen voting systems made by Diebold after the judge still overseeing the case, U.S. District Court Judge Amy Totenberg, found the systems so deficient that their use was determined to be in violation of the U.S. Constitution.

In response, and ignoring the advice of voting system and cybersecurity experts, GA's Sec. of State Brad Raffensperger replaced the Diebold systems with newer, similarly unverifiable and insecure touchscreen voting systems made by Dominion. The plaintiffs challenged the use of those systems on similar Constitutional grounds, hoping to see the state move to verifiable hand-marked paper ballots at all polling places, where voters are now forced to vote on the unverifiable touchscreen systems. Raffensperger has refused.

As AP noted last weekend, the case also "spawned a landmark expert report that identified vulnerabilities in the election system used in Georgia that led [the US Dept. of Homeland Security's Cybersecurity and Infrastructure Security Agency (or CISA)] to issue an advisory" to all jurisdictions around the nation that use the same equipment, recommending they immediately apply security patches produced by Dominion to mitigate at least some of the systems' known insecurities. Raffensperger stunned the federal court in Atlanta earlier this year when his office announced they do not plan to apply the recommended security patches until after the 2024 Presidential election in the highly contested swing-state.

Perhaps most famously (or infamously?) the Curling case also resulted in the revelation of the January 7, 2021 statewide voting system software breach in Coffee County, GA. That led to the criminal indictment of Sidney Powell and four others, with Donald Trump, in Fulton County D.A. Fani Willis' sprawling racketeering conspiracy case against the former President and 18 alleged co-conspirators. The revelation of the unprecedented Coffee County breach, copying and Internet distribution of Dominion's sensitive software occurred when Atlanta bail bondsman, Scott Hall (who, along with Powell, has since pleaded guilty in the indictment), called and essentially confessed the entire plot to one of the plaintiffs in the 'Curling' case, who was smart enough to record the phone call. That call was originally aired by The BradCast in May of 2022.

That plaintiff, MARILYN MARKS, longtime, indefatigable election integrity champion and Executive Director of the non-profit good government group, Coalition for Good Governance, is once again our guest on today's program, as she and her team prepare for trial against Raffensperger and GA, now set by Judge Totenberg to begin on January 9th.

Late last week, Totenberg released a 135-page Opinion and Order [PDF], denying the State's attempt to dismiss the case and setting a trial date. For clarity, she took pains to note: "the record evidence does not suggest that the Plaintiffs are conspiracy theorists of any variety. Indeed, some of the nation's leading cybersecurity experts and computer scientists have provided testimony and affidavits on behalf of Plaintiffs' case in the long course of this litigation."

In the Order's conclusion, the federal judge emphasized: "The importance of the security, reliability, and functionality of state election systems, classified by the U.S. Homeland Security Department as critical national infrastructure, cannot be overstated in a world where cybersecurity challenges have exponentially increased in the last decade. The dynamics of how a breach in one part of a cyber system may potentially carry cybersecurity reverberations for the entire system for years to come exemplifies the important concerns raised in this case."

But, Totenberg also writes in her ruling that she is unable to order the use of a new voting system for the State, asserting that only the Legislature may do that. Thus, she urges the parties to find a compromise resolution. Nonetheless, as Marks explains today, this same judge, who will oversee a bench trial without a jury, found the old Diebold systems so dangerously deficient nearly five years ago, that she not only found them unconstitutional, she barred their use in any further Georgia elections.

"We've never asked for her to order hand-marked paper ballots," Marks clarifies today. "That ultimately just becomes the default, because state law already says that if the electronic system is not working, hand-marked paper ballots is what you go to. That's what the law says." She notes that Judge Totenberg "has the power to enjoin unconstitutional behavior, and that's what we are asking her to do."

"No amount of software patching is going to fix this Constitutional problem. No amount of so-called auditing. You can't do a real audit with those machine-printed ballots," argues Marks. After an election, only hand-marked paper ballots can be known to have been verified by the voter. Studies have found that voters didn't notice more than 93% of the time when a touchscreen voting system flipped their vote on a computer-printed paper ballot summary.

Last week, in Northampton, PA's elections, similar touchscreen Ballot Marking Devices to those used all across GA were showing voter selections one way on the screen in two different contests, in some cases, but printing the opposite on the paper that gets tallied. Imagine if that occurred in even one precinct next year in GA with Trump on the ballot. That is among the nightmare scenarios Marks is hoping to side-step by forcing the state to finally dump their insane --- and insanely expensive --- statewide system.

She says the solution is simple and inexpensive and can be done immediately. Emergency hand-markable paper ballots are already required at every precinct in the state. Just print more of them, and use the existing scanners in each polling location to tally them. "70% of Americans vote this way. This is not hard," Marks asserts. "Of course, the State pretends that it would take rocket science to make this happen."

There is, to say the least, much at stake in this upcoming trial, even as it is not receiving nearly the amount of attention of the other election-related case underway in GA right now, the Fulton County criminal case against Trump and his co-defendants. On that, we have some news as well on today's program, including...

  • An attorney for defendant Misty Hampton, the former Coffee County Elections Director, claims he is the one who leaked video proffers of Powell, Hall, and Trump attorneys Ken Chesebro and Jenna Ellis to the media. But is he really?
  • Willis is seeking the jailing of co-defendant Harrison Floyd for attempted witness intimidation. He is among those indicted in the conspiracy for threatening Atlanta election workers Ruby Freeman and her daughter Shaye Moss over false claims that they carried out ballot fraud in 2020.
  • And Freeman and Moss are now seeking between $15 and $43 million from former NYC Mayor and Fulton County co-defendant Rudy Giuliani in their civil defamation trial against him in federal court. The Judge in that case has already found Giuliani liable. The D.C. trial set to begin in December against him will now determine how much he'll have to pay to the two women.
