Today's Rose Garden press conference was drenched in irony: a faltering, incoherent, angry man declaring a "national emergency", even as he demonstrated that he's the crisis. Donald Trump yelled at reporters to sit down, fell into sing-song whimsy, showed off his version of a Chinese accent, repeated phrases when he lost his train of thought, wielding terrifyingly grown-up powers with the gravitas of a toddler in a man's suit.
Fortunately, enough roadblocks will be thrown down --- by Reps AOC and Castro, by Nancy Pelosi and Chuck Schumer, by the ACLU, and presumably by property owners along the proposed wall sites --- that he should be kept busy and irritated for some time. The taxpayer money wasted will be appalling.
Republican former Massachusetts Governor Bill Weld appears willing to throw himself atop the bomb: he says he may primary Donald Trump. He minced no words -– I mean, he was stunningly straightforward -– in criticizing his fellow GOPers, who he said exhibit all the signs of Stockholm Syndrome(!). Someone needs to step up, he says. He even hints that he's willing to act as a spoiler to damage Trump in the general.

Finally, my guest JOEL SIMON of the Committee to Protect Journalists. His new book, We Want To Negotiate, makes a compelling case that both the US and Britain need to re-examine their "we don't negotiate with terrorists" policies. His research puts the lie to a lot of assumptions, for example, that to pay ransoms will encourage more kidnappings. It makes sense on the face of it, but --- wrong.

On today's BradCast: A preview of the unimaginably worse dysfunction that awaits us all after Democrats take over the U.S. House majority in January and Donald Trump becomes even worse and more dishonest at his job? [Audio link to show follows below.]
First up today, some quick news headlines, including Time Magazine'sannouncement that several journalists, killed or imprisoned, are "Person of the Year" for 2018, and a life sentence plus 419 years recommended by the jury for the neo-Nazi who murdered activist Heather Heyer by plowing a car into counter-protesters during the August 2017 "United the Right" rally in Charlottesville, Virginia.
Also, the Washington Post Fact Checkers have been forced to create a new category to describe Donald Trump's dozens of endlessly repeated lies, such as his claims that Mexico would pay for his border wall (he's demanding U.S. tax-payers do so instead) and that his tax cuts were the largest in U.S. history (they weren't. They were the 8th largest.) The new category will be called "Bottomless Pinocchio" and will apply to lies that repeated more than 20 times after they've long been debunked by the fact-checkers as a falsehood. To date, Trump is the only politician to merit such a rating. At least 14 of his most frequently repeated lies have already earned the dubious new distinction.
Then, Trump's bizarre on-camera pageant in the Oval Office today with presumptive, soon-to-be Speaker of the House Nancy Pelosi and Senate minority leader Chuck Schumer. During a media avail before what was to be a meeting regarding the impending federal budget deadline, the three bickered about Trump's threat to shut down the U.S. Government if a budget deal fails to include billions for his southern border wall. "If we don't get what we want," Trump threatened the Democrats during the lengthy and bizarre televised negotiation, "I will shut down the government."
Pelosi and Schumer tried to convince the President to accept one of two bi-partisan deals they say could be immediately passed by both the House and Senate. But Trump, the great deal-maker, failed to budge --- so far. Trump's threat to shutdown the U.S. Government despite the costs to Americans and the economy, comes even while Republicans still control both chambers of Congress. Things are likely to get much uglier once Dems take over the House with their (at least) 40-seat majority on January 3.
Speaking of which, we've got a few more new details today on the GOP election fraud scandal in North Carolina's still-uncertified 9th Congressional District race. Republican Mark Harris is said to have won the election in November by just 905 votes over Democrat Dan McCready. But evidence of absentee ballot fraud by a GOP contractor hired by Harris (in both the general election and Republican primary) has delayed certification of the race by the State Board of Elections. They will decide whether to order a new election or declare one of the two candidates the winner. The Board had planned to review evidence from the ongoing investigation by December 21, but has now told a state court they they may need more time, given that the Harris Campaign has been slow in responding to documents subpoenaed by the Board.
Also, new evidence this week reveals that election workers in Bladen County (one of two NC counties at the center of the probe), illegally tabulated early vote results and leaked them to non-election officials (the Harris campaign?) several days prior to the close of polls on November 6th.
Meanwhile, election officials in Florida have now revealed that more than 6,600 vote-by-mail absentee ballots sent and post-marked by Election Day went uncounted in the Sunshine State's midterm election. Those numbers don't yet include ballots from Palm Beach County, a Democratic stronghold. The untabulated ballots might have effected a number of close races in FL, including those tallied in statewide "recounts" for U.S. Senate, Governor and Agricultural Commissioner. While state law allows ballots post-marked by Election Day from overseas military votes to be included in the tally if they are received up to ten days after the election, all other "late" ballots are ignored.
Finally today, Desi Doyen joins us for the latest Green News Report with news from COP24, the U.N. climate conference in Poland, where the U.S. has joined Russia and Saudi Arabia in an "Axis of Oil" and is, literally, being laughed at for pushing coal while youth protesters demand fossil fuels be kept in the ground. Back home, the Trump Administration is now planning to reclassify high-level nuclear waste at the Hanford Nuclear Reservation in Washington state (and other facilities) in order to avoid billions of dollars in clean-up at the nation's most polluted former nuclear weapons site...

On today's BradCast: A rather extraordinary power battle, turf war, legal dispute is now being played out for control of the independent federal agency formed to protect consumers from fraud and deceptive practices by Wall Street banks and other large corporations following the 2008 global banking crisis and financial meltdown. [Audio link to show follows below.]
On Friday, Richard Cordray, the Obama-appointed Director of the Consumer Financial Protection Bureau (CFPB) resigned to, likely, run for Governor of Ohio. As he did, he named his Chief of Staff Leandra English, as the new Deputy Directory, which means that, according to the 2010 Dodd-Frank law that created the CFPB, English becomes Acting Director of the Bureau.
Nonetheless, hours later on Friday, Donald Trump appointed Mick Mulvaney, his own chief of the White House Office of Management and Budget --- and a long time foe of the CFPB, which he has described as a "sick, sad joke" --- as the new Acting Director of the important consumer agency. The White House claims the authority of a 1998 law, the Federal Vacancies Reform Act, allows the President to make the appointment. A strict reading of the rule of law seems to suggest otherwise. But, today, we now have two different "Acting Directors" of the same federal agency.
We're joined on today's show by Georgetown University law professor and former CFPB advisor ADAM LEVITIN --- who warned about this potential showdown well before it came to pass --- to explain which law takes precedent, why Trump is so desperate to name Mulvaney as Acting Director rather than simply appoint a permanent chief at the CFPB, whether English's federal lawsuit filed on Sunday will prevail, and how the Trump/Mulvaney scheme represents several extraordinary conflicts of interest and a plan for a full regulatory capture of the (theoretically) independent executive agency.
Levitin describes this power battle as unprecedented in the U.S.. "The closest thing I can think of is Bush v. Gore," he tells me. "For two different people claiming a federal office, I can't think of any situation like this in modern times. This seems like it's something out of Game of Thrones, where there are multiple contenders for the same throne."
In other unprecedented Trump Era news today: A hugely profitable media outlet named Meredith Corporation purchased Time Inc. (including TIME magazine, and others) over the weekend, with the help of $650 million from the far-right Koch Brothers; The US Senate is making a desperate run this week for massive tax cuts for hugely profitable corporations (like Meredith and Koch Industries), at the expensive of low- and middle-class Americans who will end up with increased taxes and cuts to social services like health care; And, finally, Trump, during a solemn ceremony for native American Navajo code talkers, used an offensive racial slur in describing Sen. Elizabeth Warren (D-MA) as "Pocahontas". It didn't go over well...

It would be far better to spend $100 billion per year granting them political asylum and paying for their transport and relocation to the US than invading their countries and caressing them with our freedom bombs.
Or you could come up thousands of other ways to spend $100 billion all of which would be almost infinitely better than invading their countries and caressing them with our freedom bombs if we cared about the women and children of the world.
So when an asshole like [Time magazine's managing editor] Rick Stengel suggests we must stay in Afghanistan otherwise more girls will be mutilated even though we're currently in Afghanistan and poor girls are still being tragically mutilated, I don't think that's the real reason he thinks we should be there.

This second project report is based on the first-hand documented experience of Mr. Sandalio Gonzalez, retired Drug Enforcement Agency (DEA) Special Agent in Charge. Time Magazine reporters Tim Burger and Tim Padgett had an opportunity to speak at length with Mr. Gonzalez and several other veteran DEA agents with direct knowledge of a major corruption case involving several DEA agents on drug traffickers' payrolls in Colombia. The involved corrupt US officers were also directly involved in helping Colombia's paramilitary death squads launder drug proceeds. Further presented at the meeting with Time's reporter was the documented cover up of this major scandal by the DEA and Dept. of Justice Inspector General (OIG) offices. Despite direct corroboration by a number of other sources, including several veteran DEA agents and other government officials with first-hand knowledge of the case; documented evidence disclosed and provided; and despite being given an 'exclusive' to the story as insisted on by the magazine, Time never published the story, and no reasons were ever provided...
