We didn't learn much. But we learned a little. And the evidence, as discussed on today's BradCast, suggests there is much more to come. [Audio link to full report follows this summary.]

On Monday, Fulton County Superior Court Judge Robert McBurney ordered the partial release of the final report by the Special Purpose Grand Jury convened by Fulton County District Attorney Fani Willis last year. She is probing whether or not Donald Trump and his allies unlawfully pressured Georgia officials to change the 2020 Presidential election results to declare him the winner, despite his having lost to Joe Biden by about 12,000 votes.

Today, about five pages from that report were released, including its introduction, conclusion, and one section finding that "A majority of the grand jury believes that perjury may have been committed by one or more witnesses testifying before it."

After hearing "evidence from or involving 75 witnesses during the course" of their investigation, the 26-member panel (including three alternates) went on to recommend "the District Attorney seek appropriate indictments for such crimes where the evidence is compelling." They also determined "by a unanimous vote that no widespread fraud took place in the Georgia 2020 presidential election that could result in overturning that election."

The portions of their report released on Thursday did not include any specific names, however, out of concern by both Willis and McBurney, of "fairness" to any potential future defendants. During the hearing on whether to release the report partially, in full, or at all, back on January 24, Willis asked McBurney to temporarily withhold the report "in the interest of justice and the rights of, not the state, but others," as she explained that charging "decisions are imminent."

Based on court documents, witness statements and other information, the Special Grand Jury, which completed its work in December, was believed to be examining phone calls made by Trump and others to Georgia officials, such as the notorious one from January 2, 2021, in which Trump was famously heard threatened the state's Secretary of State and instructed him to "find" enough votes to flip the election from Biden to himself; the state's 16 fake Republican electors who falsely declared themselves "duly elected and qualified"; false allegations of fraud presented to state lawmakers by Rudy Giuliani and others; Attempts to pressure election workers into falsely confessing to fraud; and the unlawful, secret duplication of voting system software by GOP operatives in rural Coffee County, among other things.

We're joined today for insight and analysis by KEITH BARBER, attorney and legal commentator formerly known as "KeithDB" at Daily Kos, who now writes at Medium. He explains that it was actually remarks from Judge McBurney on Monday, when ordering the partial release of the Special Grand Jury report, that leads him to believe the panel's full report recommends indictment of our disgraced former President.

"The biggest hint that it likely includes Trump is in the judge's decision ordering the release. In that decision," Barber explains, "the judge expressed special concern for the due process rights of potential defendants who did nothave an opportunity to testify before the grand jury. And, as we know, a whole lot of people testified, including Rudy Giuliani, Lindsey Graham, and many more. The one who did not have an opportunity to testify, who was never asked to, is Donald Trump."

In fact, as Washington Post observes, "At least 18 people have been notified that they are targets of the election interference investigation, according to court documents and statements from their attorneys." Giuliani has said he is one of them. The 16 fake electors were reportedly told the same. Who might the 18th be? Well, while Trump's legal team in Georgia stated that their client was never invited to testify, they refused to comment when asked if he'd been given notice by Willis that he's a target.

Another curious point we also discuss is that, despite Judge McBurney describing the full report as including "a roster of who should (or should not) be indicted, and for what, in relation to the conduct (and aftermath) of the 2020 general election in Georgia," the report's conclusion is on a page that is numbered as "9". Barber observes that a separate Special Grand Jury Report from 2012 [PDF], out of the state's DeKalb County, recommended charges for just one person. But that report was 83 pages in length. What does that mean? We discuss.

One potential explanation for the apparently short report from Fulton County, as I note, is that those that the Grand Jury recommendations for indictment may be listed in an Appendix to their report, which may come on pages numbered after the report's "conclusion" section.

We read those tea leaves and many others today, including why Willis' "imminent" charging decisions may be taking a while to become indictments. We also discuss the delightfully fascinating data point that Georgia's state Constitution bars the Governor (currently, Republican Brian Kemp) from issuing pardons. Only a state commission appointed by the Governor may do so, but only after the perpetrator in question has completed their sentence. Given that Willis may be working toward invoking the state's expansive racketeering statutes in this case --- which can add many years to state sentences when defendants are found to have participated in a conspiracy --- that could result in very long, unpardonable prison sentences for Trump, Giuliani, the fake electors (which included both GA's current Lt. Governor and the state's Republican Party chair) among others.

As usual, on today's BradCast, there is more continuing Trump corruption news than we can possibly keep up with. But don't blame us for trying. [Audio link to full show is posted below this summary.]

First up, however, a bit of news on the Omicron sub-variant BA.2, which has now become the dominant variant in the U.S. The FDA announced today that it has approved second Pfizer and Moderna boosters for everyone 50 years of age and over who received their last shot at least four months ago. Also, Will Smith apologized on Instagram to Chris Rock for assaulting him at the Oscars. A day late, but there ya go.

Then, we try to catch up with some of the latest Trump corruption/accountability news and some that we've fallen behind on, with an assist from longtime Philadelphia Inquirer columnist WILL BUNCH, who has been in a bit of a funk over the mountain of evidence of corruption on the Right and the lack of accountability for it.

Among the stories he and I discuss today...

  • The news of the longtime prosecutors who recently resigned from the probe of Trump's years-long bank, tax and insurance fraud felonies after the new Manhattan D.A., Alvin Bragg, took over the investigation and tanked it. As revealed last week, one of the disappointed lead prosecutors told Bragg in his resignation letter last month that Trump was "guilty of numerous felony violations, that dropping the probe was "a grave failure of justice" and that "the team that has been investigating Mr. Trump harbors no doubt about whether he committed crimes - he did."
  • The insane, conspiracy-theory laden text messages sent in November 2020 by longtime rightwing activist Ginni Thomas --- wife of longtime rightwing Supreme Court Justice Clarence Thomas --- to Trump's then Chief of Staff Mark Meadows, encouraging him to fight to steal the 2020 election. And the difficulty (at least by Democrats) of bringing accountability for our corrupted Court and its "giant legitimacy crisis".
  • The seven and half hour gap in the Trump White House call logs from January 6th, 2021, as reported today by the Washington Post's Bob Woodward and Robert Costa, showing no record of Trump calls during the insurrection he incited at the U.S. Capitol from 11:17am that day until 6:54pm that night, even though the U.S. House Committee investigating the insurrection has confirmed a number of phone conversations that occurred with Trump that day.

"There seems to be no way or no will to hold our staggeringly corrupt leaders accountable --- whether it's Trump defrauding the banks or plotting an attempted coup from the Oval Office, or a Supreme Court justice ruling on his wife's bat-guano crazy political crusade," Bunch lamented in his column over the weekend. "I'm in a total funk over the state of the union."

Today he tells me, "We have this situation where there are a lot of people in the body politic saying look, the evidence is overwhelming that the 45th President of the United States was a criminal, and yet, the handful of people who are actually in the most key positions for possibly doing something about it won't go there, apparently." While he recognizes that some, such as our friend Marcy Wheeler of Emptywheel, believe Attorney Gernal Merrick Garland actually is working his way up the food chain toward Trump, he remains dubious.

"Common sense is telling me that, given what's at stake, this is taking too long," he argues. "While this hangs out there, you've got all of these state legislatures enacting laws to make it possible to pull off a coup in 2024. Maybe putting a few of these guys on trial and sending a few of them up the river, maybe that would change the dynamic a bit in the country."

Bunch does put stock in the House J6 Committee's work and looks forward to Watergate-like hearings in the coming months which might change the current trajectory. But, in the meantime, he remains concerned about the ability of key institutions, like our corrupted SCOTUS, to maintain any legitimacy.

"A healthy democracy would have a healthy Supreme Court. But it's a very reform-proof operation. Only one Supreme Court Justice has been impeached in U.S. history," he notes. "They don't have any particular code of ethics, even when it comes to recusing themselves on cases like this Clarence Thomas situation. They're supposed to use their best judgment, and we kind of have to hope for the best."

"For a long time there has been this simmering general sense that there are two systems. There's not one system of justice in this country. That certain privileged people at the top, it's not just politicians, it's wealthy people, it's high-profile people...Here's New York City with six cops ganging up on somebody who jumps a subway turnstile because they didn't pay the $2.50 fare because they probably couldn't afford it. There's a sense of anger about that, and I think it ties in to how people feel about Trump or Ginni Thomas, that it's all of one piece. And I think that is just causing a broader lack of trust in this country."

But, Bunch also insists that he remains "an optimist," is hopeful things can still change and that we may soon begin to see accountability. "That's the January 6 Committee. Once they get their case out there, the public demand for [accountability] might peak. And for that, we can only hope."

There were a surprising number of callers into yesterday's program who seemed to believe that if the U.S. simply left Ukraine to its own devices, somehow there wouldn't be a massive genocide and destruction of the Ukrainian state by Russia, and that it wouldn't somehow lead to WWIII. Those callers are wrong, I'm sorry to say. And I'm even sorrier that many of them are on the left. On today's BradCast we spend some time explaining how many have come to misunderstand a lot of bad and (often purposely) misleading information out there, and how deeply-ingrained (and well-justified!) anti-war sentiments against the U.S. war machine are now ill-serving some on the supposed left now that Russia is the actual aggressor. We also cover several ongoing fights for our own struggling democracy here at home --- in the U.S. Senate, at SCOTUS, and in both Kentucky and Texas. [Audio link to today's show is posted below this summary.]

Among the many stories covered or referenced today...

  • A quick review of Day 2 of Judge Ketanji Brown Jackson's confirmation hearings in the U.S. Senate, where Republicans are spending their time questioning the first black female nominee to the U.S. Supreme Court as a way to improve their own electoral ambitions and/or nab an appearance on Fox "News". ("Do you believe babies are racist, Ms. Jackson?") Since we don't care to privilege the lies, we don't spend much time on that idiocy, though there were some important exchanges with some of the Democratic Senators, including Jackson's thoughts on the importance of respecting long-settled issues of law and civil rights. That, as the GOP's current stolen, packed and bought majority on the High Court begins dismantling decades of well-established and critical legal precedents.
  • Then, some thoughts on some of our callers and emailers on yesterday's program, when we opened the phone lines up to listeners on why they believe President Biden's approval ratings remain low, even as his actions in response to Russia's barbaric attack on Ukraine are so wildly popular among Americans of all parties. We discuss why we believe those callers who want the U.S. to stop supporting Ukraine are deadly wrong about that, and why an emailer who cites Putin's pretext about "de-Nazification" in Ukraine has been wildly misled.
  • That conversation also includes some audio from an interview with a Rabbi in Odesa by NPR's investigative correspondent in Ukraine, Tim Mak. He is told by Rabbi Avraham Wolf, during the interview in a synagogue built by his wife's great great grandfather in 1898, that he believes talk about Nazis in Ukraine is "stupid" and that he has "never in 30 years" experienced any anti-semitism in Odesa.
  • The conversation on all of this also includes this weekend's remarks on ABC News from the courageous Marina Ovsyannikova, a producer at Russia's state-run Channel One, describing her "spontaneous decision" to appear on air with a "NO WAR" protest sign during a news report recently. "I could see what in reality was happening in Ukraine, and what we showed on our programs was very different from what was going on in reality," she explained on Sunday following her arrest, as she still faces a potential 15 years in prison under Putin's new censorship law. While she claims that most Russians oppose Putin's "gruesome war," Ovsyannikova determined that her televised protest might "show to the Russian people that [the state-run media outlet's reports were] just propaganda, expose this propaganda for what it is and maybe stimulate some people to speak up against the war."
  • Then, it's back to our own faltering democracy in the U.S., but with a bit of long-awaited good news for a change. After seven years of delays in court --- thanks to a well-moneyed far-right legal outfit --- Kim Davis, the infamous and Fox-famous Rowan County, Kentucky Clerk who cited "religious beliefs" for her refusal to issue marriage licenses after SCOTUS established the right to marriage equality in 2015, was finally found to have violated the law. In a lawsuit filed by several couples who were refused licenses to marry, a George W. Bush-appointed federal judge held that Davis "cannot use her own constitutional rights as a shield to violate the constitutional rights of others while performing her duties as an elected official.” A jury will determine the financial penalty for Davis, who lost her re-election bid in 2018. Of course her wingnut attorneys will attempt to appeal all the way to the U.S. Supreme Court (even though they already rejected one of Davis' previous arguments...at least before Republicans stole their 6 to 3 majority on the High Court.)
  • In far less encouraging news, an AP analysis has determined that some 23,000 absentee voters in Texas' first-in-the-nation 2022 mid-term primaries on March 1, had their ballots rejected and never counted. AP finds roughly 13% of mail ballots were discarded under the TX GOP's new voter restriction law, SB 1, that they claimed would make it "easier to vote and harder to cheat". That, compared to the 2% of mail ballots that were rejected during the state's previous mid-term primaries in 2018. Thousands of voters in both Republican- and Democratic-leaning counties alike were disenfranchised under the first election held under the new law, though rejection rates were slightly higher in larger, more Dem-leaning counties. Mail voters in Harris County (Houston), for example, saw a gobsmacking rejection rate of 19%! In the weeks and months ahead, primaries will be held in some 17 other states where Republicans have passed new laws making it harder to vote in response to Donald Trump's evidence-free claims of massive fraud in the 2020 election.

A Green New Deal didn't cause the Lone Star State's deadly power crisis, but it could help prevent the next one...

Contrary to GOP gaslighting, the source of the Lone Star State's disastrous power outage cannot be found in the yet-to-be adopted Green New Deal or in a failure of wind turbines, which account for only a small percentage of the energy supply in Texas. As Naomi Klein observed, when she recently appeared on Democracy Now, "Texas is about as far from a Green New Deal as you can possibly get."

The true source of the Texas energy failure, per Klein, lies in the Enron-like deregulation of the Texas energy grid.

As has occurred in other privatized and profit-driven sectors of the economy, like healthcare, where profit-driven "efficiencies" resulted in an insufficient hospital bed capacity in the midst of the deadly COVID-19 pandemic, Texas failed to deploy "built-in redundancies," she explained. While uniquely refusing to be a part of either of the two national energy grids, the state's 1999 deregulation scheme also failed to account for the impact of extreme weather on its own, isolated statewide power grid.

The failure of some wind turbines in TX, for example, was entirely avoidable. Wind turbines, according to a Canadian government study, can include "cold weather packages" that allow them to function in temperatures as low as -30C (-22F). In fact, the U.S. Research Station at McMurdo Sound in Antarctica operates on wind turbines that produce enough electricity to power 100 American homes.

Thermal energy production by natural gas, coal and nuclear, accounts for about 80% of energy production in the state. Those systems, which were also not winterized, brought the most disruption to the state's energy supply.

But the problem isn't limited to the profit-driven evasion of "built-in redundancies". Those Texans who didn't lose power became victims of what Tyson Slocum of Public Citizen's Energy Program described as "predatory utility pricing" in which the cost per megawatt hour (MWh) suddenly spiked from $20/MWh to $9,000/MWh. Roland Burns, CFO of Comstock Resources, Inc., a natural gas supply company owned by Dallas Cowboys' billionaire owner Jerry Jones, boasted that the Texas power disaster was "like hitting the jackpot."
