We're getting caught up on today's BradCast with a whole bunch of stuff, from the dark Trump secrets still buried in unreleased Epstein Files, to his lies, illegal actions and terrible advice about the economy, to another loss for Republicans in the Gerrymandering Wars and some actual election fraud finally discovered in Georgia! (And you'll never guess whodunnit!) [Audio link to full show follows below this summary.]

Happily, the corporate mainstream media finally seems to be fully on board the disturbing, still-unexplained, and unlawful absence of critical documents from the Epstein Files released to date by the Dept. of Justice as per the Epstein Files Transparency Act. In addition to the absence of multiple 2019 FBI interviews with a woman who accused Donald Trump of sexually assaulting her when she was just 13-years old, additional revelations are coming to light. CNN, for instance, confirmed those three missing interviews and contemporaneous FBI interview notes this week, and found that at least another 90 interviews with other survivors are also apparently missing, for unexplained reasons, from the DOJ's website.

But, with the major outlets seemingly digging in, we've got a bit more time today to get caught up on some other stuff, regarding some economic matters, some SCOTUS issues, and some election news. Among those stories...

  • Fallout from last week's 6 to 3 U.S. Supreme Court ruling determining that Trump's chaotic, worldwide taxes on imports to the U.S., as issued under the supposed authority of the U.S. International Emergency Economic Powers Act (or, IEEPA), are both unlawful and unconstitutional. As it turns out, those illegal tariffs have also been very expensive for American consumers who paid for about 90% of them according to studies issued this month from both the Federal Reserve and the nonpartisan Congressional Budget Office. That, despite Trump's repeatedly lie (as echoed again during his State of the Union Address this week), that "the tariffs [are] paid for by foreign countries." Both the Fed and Congress disagree.
  • But, don't be fooled by SCOTUS' ruling last Friday, even if it came in opposition to the President for a happy change. In fact, the challenge to Trump's tariffs was a case brought by the far-right architect of today's corrupted Supreme Court, and it took almost half a year longer to be handed down by the corrupted Court than necessary. No, SCOTUS has not "joined the No Kings Movement", as MS NOW's Stephanie Ruhle ridiculously declared after the ruling was handed down.
  • For the record, the "economic emergency" that Trump disingenuously declared as his pretext to enact the levies was supposedly based on a global trade deficit that the U.S. has with many countries of the world. As it turns out, that deficit grew larger under Trump's tariffs last year, according to Trump's own Commerce Dept. data.
  • Not to worry, however, everyone is going to be rich once the Republicans' One Big Beautiful Bill Act kicks in for this year's tax season, right? Um, so far...based on IRS data to date, not so much, as average refunds in the first part of the filing season have been some 42% lower than the Administration has long been promising they would be.
  • But, hey, there are a lot of MAGA suckers out there, I guess. And we should have expected no less from the guy whose failing media company, Trump Media & Technology Group (which trades as DJT on the stock exchange) has seen its value plummet faster than his approval ratings. This week, shares in his loser company, which once sold for $100 --- and cost a bunch of MAGA folks their life savings --- closed for the first time on Monday in the single digits! The company, which has lost hundreds of millions of dollars every year since it went public in 2022, clawed its way back above $10/share in recent days. It seems unlikely to stay there.
  • In election and voting news, Team Red continue to struggle in their Gerrymandering Wars in advance of the critical midterm elections, as both the Utah state Supreme Court (on Friday) and a three-judge federal panel (on Monday), rejected state Republicans' attempts to override a 2018 ballot initiative in which voters chose to require U.S. House district maps in the otherwise very Republican state to be drawn fairly, with neutral rules, by an independent redistricting commission. The GOP state Legislature has been trying to lock in their unlawful map, drawn to create four safe Republican Congressional Districts. But, after the recent rulings, we appear now to be at the end of their four-year battle to block a new map that will offer three Republican leaning Districts and one safely Democratic seat in Salt Lake County.
  • Down in Georgia, where Trump has been falsely claiming massive voter fraud since he lost the 2020 election there, the MAGA majority on the State Election Board has, in fact, finally discovered some election fraud! And it was apparently committed by one of Elon Musk's super PACs in both 2020 and 2024.
  • Finally, Desi Doyen joins us for our latest Green News Report today, with a bunch of energy related lies from Trump's SOTU this week; Big Oil's appeal to SCOTUS to help them quash climate liability lawsuits; Trump's Interior Dept. quashing bedrock conservation rules for public lands; and a new suit filed by young Americans to challenge the Trump EPA's recent gutting of 20 years of climate change-related regulations...

We've got a lot to get to on today's BradCast. While much of our coverage may seem like a grab bag from the headlines above, you'll find there is a central theme at its heart. I think. [Audio link to full show follows this summary.]

Among our coverage today...

  • We begin with the darkest news, so things can only get brighter from there, right? The Bulletin of Atomic Scientists, keepers of the notorious "Doomsday Clock" reveal their latest adjustment, ticking the metaphorical timepiece from last year's 89 seconds to midnight, to just 85 seconds to humanity's end this year. The group of science advocates cited increasing risk of nuclear warfare, worsening human-caused climate change (Donald Trump was singled out there) and other threats to civilization itself, such as the misuse of biotechnology and artificial intelligence.
  • Buffoonish, Nazi-ish U.S. Customs and Border Patrol chief enforcement clown, Gregory Bovino, is pushed out following the latest killing of another U.S. citizen over the weekend in his violent, chaotic Minneapolis operation. New villains are rotated in by the White House, even as Trump appears to try and play nice with his mortal enemies, Minnesota's Democratic Gov. Tim Walz and Minneapolis Mayor Jacob Frey.
  • But there are even more signs that the courageous people of Minneapolis are winning this one, even if the battle is far from over. The chief federal judge in Minnesota (a George W. Bush appointee) has ordered in-person testimony from the Acting Director of ICE, after the Administration has repeatedly failed to comply with court orders regarding immigrant rights. The judge has ordered him to explain why he should not be held in contempt by the court.
  • Trump's corrupt U.S. Attorney General Pam Bondi's thuggish letter to Minnesota's Gov. Walz --- sent to the state just after the border patrol agent execution of 37-year old VA ICU nurse and U.S. citizen Alex Pretti over the weekend --- landed with a thud, after she essentially suggested the federal immigration crackdown would end only if the state turned over its voter roll data to the federal government. Voting rights and election law experts described the move as "reprehensible". Bondi has sued some 23 states who refused to comply with the demand. Two weeks ago, a federal judge in California dismissed the DOJ's lawsuit against the state, finding it "unprecedented and illegal". Last week, a judge in Georgia dismissed the lawsuit in the Peach State. And yesterday, a federal judge in Oregon dismissed the DOJ's suit there. In the meantime, MN Sec. of State Steve Simon has explained that he has no intention of violating state or federal law to answer Bondi's "ransom note".
  • As we covered last week, a recent federal review of nearly 50 million voter registrations found zero evidence of widespread fraud by noncitizens on the voter rolls in state after state, county after county. In a new report late last week, out of more than two million active voter registrations in Utah, the state was able to find just one single noncitizen on its rolls. The state found that the person never voted and has since been removed from the rolls. Utah is another state that has correctly refused to turn over its unredacted voter data to Bondi and the DOJ.
  • In news from the front lines of the Trump/GOP Gerrymandering Wars, Democrats in Maryland are now moving ahead with a plan to draw a new map designed to flip the state's last remaining Republican U.S. House district from "red" to "blue". And a state judge in Virginia, just before airtime today, declared the effort by state Democrats to adopt a constitutional amendment to redraw its U.S. House map to flip as many as 4 or 5 seats from "red" to "blue" this year to be unlawful. Proponents of the measure accuse Republican opponents as forum shopping for a friendly judge and vow to appeal his ruling.
  • Finally, Desi Doyen joins us for our latest Green News Report following the weekend's deadly winter storm across much of the U.S.; as House Republicans vote to overturn a decades-long ban on toxic mining in MN; as Michigan's Attorney General sues the Big Oil "cartel"; and as a judge blocks Trump's attempt to withhold funding for a national EV charging network adopted by Democrats under President Biden...

Our problems AND solutions begin AND end at the ballot box. In theory...

Both the solutions to the problems we face and the problems themselves, are created and/or ultimately settled at the ballot box. In theory. So, once again, much of our coverage on today's BradCast --- both good news and bad --- revolves around that fact in one way or another. [Audio link to full show follows this summary.]

A good chunk of today's show focuses in on the fallout following Sunday's late-night capitulation by seven Senate Democrats and one independent who caucuses with them over the federal government shutdown. A central point is that the huge majority of Dems in both chambers of Congress did not capitulate. They stood united during the longest government shutdown in U.S. history in favor of holding out for the restoration of enormous cuts by Donald Trump and Congressional Republicans to health care, including the Affordable Care Act, Medicaid and Medicare.

And, while the shutdown's imminent end is a disappointment to many who wanted the fight to continue --- especially those who understand that the 7+1 caving Democrats received little to nothing in return for their decision to vote with the Republicans --- it's important to understand that the failure was not by "the Democrats", but by those 7+1 (and, arguably, Senate Minority Leader Chuck Schumer who shamefully failed to prevent it) and the hundreds of Republicans in both chambers who unanimously stand by their cuts to health care subsidies that will result in skyrocketing prices --- by as much as 400% or even higher as of January 1 --- for millions of Americans, along with the loss of coverage for millions and the unnecessary deaths of tens of thousands.

It's also important to notice how well the Democratic caucus hung together this time --- how they are learning to fight in the Trump era, as opposed to similar situations in the recent past --- until a handful of rogue lawmakers undermined them on Sunday night. The Senators who caved should be held to account. Not the ones who didn't. That's particularly important to remember as the Continuing Resolution now working its way through Congress to reopen the government will time out again at the end of January, when all of this may start up all over again.

Among the stories cited in support of that particular argument, and other news covered on today's program...

  • Good news in the Gerrymandering Wars! A judge in Utah has ordered implementation of a new U.S. House map for 2026 that includes a new, heavily "blue" district in Salt Lake City. It will likely flip one of the state's four currently "red" seats in the U.S. House to "blue" next year.
  • Donald Trump's approval ratings continue to plummet through the shutdown and last week's blowout election results for Democrats. Relatedly, eight counties in California that voted for Trump last year voted in favor of Prop 50 last week, to redistrict the state to flip as many as five "red" U.S. House seats to "blue" in response to Trump and Texas Republicans' mid-decade gerrymander. (All further begging the question about the wisdom of the handful of Senate Dems to end the shutdown before affordable health care coverage could be restored to millions of Americans.)
  • While there are many reasonable arguments for reopening the government after 40 days of the longest shutdown in U.S. history, with many Americans suffering, even the right-leaning "center left" Third Way group slammed the supposed "moderate centrists" who caved on Sunday night. In a statement the group's President said they "oppose the agreement in the Senate to end the government shutdown," arguing: "This was a battle worth fighting, and it was worth fighting longer."
  • Trump issued full pardons over the weekend to 77 of his personal attorneys and political allies, including the fake electors in swingstates he lost, who worked so hard to try and help him steal the 2020 election. Those receiving clemency including folks like Rudy Giuliani, Sidney Powell, John Eastman, Ken Chesebro, Jenna Ellis, Christina Bobb, and many others involved in spreading lies about fraud in 2020, the fake electors scheme and the unlawful efforts to breach voting systems in places like Coffee County, Georgia. While many of those pardoned are facing state criminal charges, which a Presidential pardon can't change, none are currently facing federal charges. That begs the question of why he pardoned them and who else may be covered by the vaguely worded clemency statement. The Dept. of Justice's former Pardon Attorney, who was replaced by Trump, believes that the criminal President is sending a message that he has their back if they are needed to violate the law again to help him try and steal future elections.
  • On Monday, the corrupt, activist, rightwing U.S. Supreme Court majority announced they would hear a case regarding the Republican National Committee's challenge to Mississippi's law that allows mail-in ballots cast and postmarked by Election Day to be counted if they arrive up until five days afterward. The RNC and Mississippi State Republican Party argue that when Congress defined "Election Day", they meant that lawful ballots could only be cast on that day. A SCOTUS ruling in their favor, against the State, could undermine elections in some 30 states with similar laws allowing for late arriving ballots, just in time to create chaos in the critical 2026 midterms.

Trump weaponizes horrific tragedy for political gain. Callers ring in...

Today on The BradCast: Charlie Kirk was a racist, sexist, homophobic, anti-Semitic, Islamophobe. He also did not deserve to be killed for any of it. Prove me wrong, as Kirk liked to say, on either of those points. [Audio link to full show follows this summary.]

I'd have otherwise been happy to move on from the topic at this point, but for the inappropriate lionization of Kirk by, not just the Right, but the mainstream media in the days since his horrific murder in Utah last week, allegedly by a 22-year old man from a religious, Republican family from the state. Kirk no more deserves to be lionized than he deserved to be shot and killed by a longtime firearm aficionado.

It's also difficult to move on given the way the President of the United States and his Administration and his supporters are using Kirk's death --- lying about it --- as a weapon to declare war on their perceived political enemies, on civic democracy and on the Constitution itself.

Donald Trump has now repeatedly blamed "radical left" "scum" for Kirk's murder, despite any evidence yet to support such a claim. Despite being the worst demonizer to ever lead the American government, Trump claims the attack on Kirk is the "tragic consequence of demonizing those with whom you disagree, day after day, year after year, in the most hateful and despicable way possible."

He has now promised to use the federal government to go after those people and organizations that he believes to be organizers and "funders" of the "radical left", which he has repeatedly referred to (again, without evidence) as "fascists", "Marxists", "communists" and "worse". Despite the countless, recent, deadly attacks by Trump supporters against elected Democratic officials --- and despite his own Vice President (Vance) and HHS Secretary (Kennedy), comparing him to Hitler --- Trump insisted on Sunday that "the problem is on the left. It’s not on the right."

Kirk's killing took place, however, on the very same day that a 16-year old boy in Colorado --- who authorities claim to have been "radicalized" by an "extremist network" and obsessed with antisemitism, Nazis and Holocaust denial --- went on a gun rampage through his Evergreen, CO high school (near Columbine) before taking his own life.

Oddly enough, Trump has yet to mention one word about that incident, to my knowledge, even though it sent teenage students to the hospital in critical condition. Nor has he called for those who encouraged and funded and radicalized that shooter to be brought to justice, for some reason.

And, while Kirk is being lauded for championing free speech (he did, hateful as it may have been, at least at his personal appearances), he also organized a nationwide effort to tape and target school teachers and college professors for firing for not using the right kind of speech. With Kirk's death, that effort has now kicked into overdrive, as teachers, random Americans and even members of the media are being fired for merely quoting Kirk's actual, often wildly offensive words on social media.

All of this, I would argue --- the attack on the First Amendment by the Right --- a convenient way for them to avoid their very serious problem with political violence against their perceived enemies on the non-Right and a way to not have to deal with the nation's worsening gun violence epidemic which they, like Kirk before he died, continue to countenance through their words of support and lack of actions.

As Kirk would say, prove me wrong. We opened the phones up in the second part of today's show to allow listeners to do exactly that. How do you think it went?...

As Trump's economy falters, he and supporters declare 'WAR' on 'the radical Left' in response to the unsolved killing of rightwing activist Kirk...

It's clear that Donald Trump would much rather we talk about political violence today than his quickly failing economic policies or his 15-year close personal friendship with notorious pedophile, Jeffrey Epstein. So we do him the favor of discussing both at the top of today's BradCast. [Audio link to full show follows this summary.]

From there, it's on to our central story. On yesterday's show, we covered the news of the killing of rightwing activist and longtime Trump ally Charlie Kirk, as reports of his death were just breaking. Today, as the manhunt continues for his seemingly well-prepared killer, we've got more details on both the shooting and the investigation and, with 24 hours of perspective, well-considered analysis of what all of this may mean for the nation as we move ahead.

There is still no known motive for the uncaptured and still-unknown shooter. Yet, a huge portion of the MAGA Right --- from wingnut social media trolls to wingnut billionaires to wingnut elected officials, including the President of the United States --- are, in some cases literally, declaring "WAR" on "the radical left Democrats".

Trump took to the airwaves last night after the murder, conspicuously covering up his right hand in a pre-recorded Oval Office tantrum, in which he condemned political "violence and murder" by "the radical left" as the "tragic consequence of demonizing those with whom you disagree, day after day, year after year, in the most hateful and despicable way possible." (Hmmm...Can we think of anybody else who might have demonized those with whom they disagree, day after day, year after year, in the most hateful and despicable way possible?)

"My administration will find each and every one of those who contributed to this atrocity and to other political violence, including the organizations that fund it and support it, as well as those who go after our judges and law enforcement officials," vowed the President who has said the most despicable things about federal judges and pardoned --- on his first day in office --- more than a thousand of his own supporters for their political violence at the U.S. Capitol on January 6, 2021, where hundreds of them literally and physically attacked law enforcement officials.

Trump also failed to mention the violent attacks on elected officials in his four-minute revenge screed, like the ones against the Speaker of House in Minnesota, Melissa Hortman, who was assassinated along with her husband in the middle of the night in their own home less than three months ago by a far-right MAGA dude. The same man also gunned down MN State Senator John Hoffman and his wife in their home that same night, as part of a planned string of attacks against dozens of Democratic elected officials.

Let's also not forget Trump's repeated hilarious jokes over the years about the brutal attack on Paul Pelosi, whose skull was bashed in with a hammer by a guy hunting down Nancy Pelosi. Trump, his sons, and his supporters, have issued jokes about that violent attack for years. Just as Utah's Republican U.S. Senator Mike Lee did on social media earlier this Summer to make light of the shootings at the homes of Hortman and Hoffman in Minnesota.

But now, things are different, apparently. While political violence against Democrats doesn't seem to count, with Kirk dead there will be consequences and retribution. "THIS IS WAR," declared the Trumpers on Twitter. "The Democrat Party must be classified as a domestic terror organization and their members and leaders treated accordingly," warned a bunch of them.

"The Left is the party of murder," pronounced Elon Musk, the man with the most Twitter followers in the world. "If they won't leave us in peace, then our choice is fight or die," he tweeted, joining Trump and the others in trying to increase the blood lust, rather than working to cool it down.

At the same time, Democrats --- as they did when their own were attacked --- have been calling for an end to the growing epidemic of political violence and gun violence in this nation. We call for the same.

Among those whose comments or writings over past 24 hours are cited, either positively or negatively, on today's program...

Finally, as Trump and his duplicitous Administration are now, officially, taking credit for U.S. infrastructure improvements made under Joe Biden's Infrastructure Investment and Jobs Act, Desi Doyen joins us for our latest Green News Report where, whaddaya know? While Trump is working hard to kill the U.S. wind and solar energy industries on behalf of the fossil fuel industry, the rest of the world is quickly moving to clean, cheap, renewable energy. And China, not the U.S., is making a mint off of it...

Guest: David Dayen of 'The Prospect'; Also: High School shooting in CO; Russian drones in Poland; Dem wins U.S. House Special Election in VA...

As you might have guessed, it's a grim day on today's BradCast [Audio link to full show follows this summary.]

Among our coverage...

  • 31-year old, far-right youth activist, influencer and longtime Donald Trump ally Charlie Kirk, founder of Turning Point USA, said back in 2023: "I think it’s worth it to have a cost of, unfortunately, some gun deaths every single year so that we can have the Second Amendment to protect our other God-given rights." Today, Kirk was gunned down while answering a question, ironically enough, about U.S. gun violence during a heavily-attended outdoor speaking event at Utah Valley University. The shooting drew bipartisan condemnation before his death was announced just prior to airtime today. No suspect had yet been taken into custody.
  • Receiving much less attention, three teens were in critical condition in surgery or the emergency room after a shooting at their high school in suburban Denver at around the same time Kirk was shot in UT. The same sheriff's office that initially responded to Colorado's 1999 mass shooting at Columbine High School, which killed 14 students, was reportedly first on the scene today at Evergreen High School west of Denver.
  • Poland reported that as many as 19 Russian drones entered their airspace on Wednesday and were shot down with the help of NATO air command and the Dutch air force which scrambled F-35 fighter jets. A number of the drones were said to have been launched out of Belarus, an authoritarian Russian ally which has has been used to stage attacks on Ukraine since Russia invaded its sovereign neighbor in 2022. Poland, a NATO member, activated Article 4 of the defense pact, to demand consultation with allies. Europe and NATO remain on high alert today, though Russia claims it had attacked the "military-industrial complex of Ukraine" in a "large-scale strike" but that "there were no targets envisioned for destruction on the Polish territory."
  • In somewhat brighter news today, Democratic candidate James Walkinshaw trounced his Republican rival in a U.S. House Special Election in the 11th Congressional District of Virginia on Tuesday by 50 points, 75% to 25%. That's a 16-point swing toward the Dems as compared to last November's Presidential election in the northern Virginia suburbs of D.C. Walkinshaw's seating in Congress and promised signing of the Discharge Petition to force a U.S. House vote on the release of the Epstein Files puts proponents of that measure just one vote away from the necessary 218 signatures needed to trigger a mandatory vote on the House floor. Another U.S. House Special Election to fill another vacant seat in another very Democratic Congressional District in Arizona takes place later this month. The Democratic candidate there, Adelita Grijalva, has also vowed to sign the petition, which has currently has the signatures of all 212 currently seated Democrats and four Republican members.

Finally, we're joined today by author and financial journalist DAVID DAYEN, Executive Editor of The America Prospect, to discuss the coming showdown in Congress to avoid a government shutdown as of October 1. That's when the Continuing Resolution passed in March to keep the government open at the time expires. If Republicans can't come to terms with Democrats on another CR by the end of this month, the government will likely shutdown.

That is a price that more Democrats now seem willing to pay to try and stop --- or, at least slowdown --- Donald Trump's authoritarianism. And it's a moment when Democrats, currently in the minority in both chambers of Congress, actually have some leverage to use.

While all Democrats in the House voted against the Republican CR back in March, Senate Minority Leader Chuck Schumer and a handful of Dems agreed to help Republicans overcome the 60 vote filibuster threshold in in the Senate in exchange for...well, pretty much nothing.

This time, Schumer claims he will not do the same thing. But, is he asking for enough from Republicans in exchange for Democrats' support in keeping the government open this time? Is he willing to let it shut down in order to stop Trump?

There are a lot of things that Democrats could demand, above and beyond a short term fix to prevent health care costs from skyrocketing for the millions of Americans signed up to the Affordable Care Act. That's something, as we discuss, that Republicans should be desperate to do on their own. Democrats could demand that subsidy support for the ACA be made permanent. Schumer could demand that Congress assert its right to block Trump from refusing to spend funds already appropriated by Congress. He could demand the end to Trump's economy crushing tariffs, mass ICE raids, National Guard in U.S. streets and much more. In other words, this is a moment when Dems could demand an end to the Trump Authoritarianism.

But will they? And, if so, and Republicans don't agree to the terms, what then?

"The whole idea that we're going to get a goodie in exchange for participation in the budget is a very old way of doing business in Washington," argues Dayen today. "Business as usual is out the window in Washington. You have someone who is trying to consolidate power entirely into himself. And you have these rare moments where he can be thwarted at some level. And you can't approach that the way you would approach a normal negotiation. I just don't understand how that can be acceptable. You have to deal with the problem at hand, where Donald Trump is acting like a despot, a dictator, and the things that you could negotiate on would have to be things that would prevent dictatorial processes from going forward."

"Shutdown fights like this are teachable moments," he says. "They are ways to get the attention of the public. They are ways to get the public understanding that there is a debate happening in Washington, and this is what that debate is about. If you're the Democratic Party staring down 33% approval ratings, watching what Trump is doing, and seeing your party get less popular in the exchange because you're not doing enough about it, you should want this moment. You should want a way to reset public attention on what is happening. Maybe we'll see some things start to change here in coming days as Democrats start to internalize this, but it's been a bit enervating so far."

We're back! With (almost) everything we missed (and/or wish we had) over the past week during our end-of-Summer break!...

We're back on today's BradCast after a much-needed, "end of Summer" break. That's either good or bad news depending on how you (or I) might see it. [Audio link to full show follows this summary.]

The good news for me, I suppose, is that we missed one of the most insanely busy news weeks of Trump's second term. The bad news is that I need to get both you and me caught up on "our story so far", so everything makes sense (or, as much as is possible amidst this insanity) going forward into the Fall (and pending government shutdown at the end of this month.)

To that end, we've got a day-by-day, blow-by-blow, collected summary of much --- if not all --- of the key news from over the last week today. From many of the ongoing losses for Trump in the (lower) courts, to some very encouraging electoral news on several fronts for Democrats, to Americans pushing back (effectively) against the regime on several levels, to some of the not so good news, including natural and man-made disasters and tragedies, and the ever-ongoing, non-stop, self-destructive idiocy of the Trump Administration.

Also, Desi Doyen is here with our latest Green News Report, catching you up with some maddening and important stuff there as well!

We've been telling you for months on The BradCast that it was likely to be a very bumpy road to Election Day ... and likely beyond it, depending on how things go. We are now on that road. Lots of bumps, as predicted, but still plenty of hope to help us all stay positive in the closing days. [Audio link to full show follows this summary.]

Among our occasionally bumpy, occasionally hopeful coverage on today's program...

  • We open with some encouraging listener mail from a family of democracy champions, and their recommendation to help you stay engaged and hopeful and helpful above and beyond voting, by checking out the very cool Markers for Democracy, "Saving our democracy, one postcard at a time."
  • A U.S. Postal Service mailbox with a number of mailed absentee ballots in it, was set ablaze overnight at a post office in Phoenix, Arizona. Authorities are investigating the likely case of arson in the battleground state, and a USPS spokesperson suggests that, if you use a mailbox for your absentee ballot, try to drop it in "before the last collection time each day." Good advice. Better advice: Deliver that ballot in person to a precinct, voting center or town/county election headquarters, as allowed in your jurisdiction.
  • Also in Phoenix, Arizona today, details on charges filed against a 60-year old man suspected of shooting at the windows of a Democratic National Committee field office for Kamala Harris in Tempe, three times times over the past several weeks. Law enforcement officials say the man, now in custody, was found to have more than 120 guns and 250,000 rounds of ammo at his home, and a machine gun in the car he was driving. They say he appeared to be planning "a mass casualty event". No one was injured in the shootings, but the Harris field office was eventually closed. He has been charged with seven counts related to terrorism. He is also accused of hanging hand-made political signs critical of Harris and Democrats, lined with razor blades and a substance labeled as "biohazard" in a Democratic-leaning Phoenix suburb.
  • Given the disturbing allegations this week by Donald Trump's longest-serving White House Chief of Staff, retired 4-star U.S. Marine General John Kelly, describing his former boss as a "fascist", a fan of Hitler, and an opponent of the Constitution, rule of law and military vets injured or killed in the line of duty, Kamala Harris is leaning on a strong anti-fascism message in her closing argument, just over a week out from Election Day. We share both her initial response to Kelly's remarks yesterday in D.C., as well as those from a CNN town hall last night where she made no bones about her answer when asked if she believed the disgraced former President was, indeed, a fascist.
  • In case you are still unclear about what Donald Trump will do if he is elected again and how he will continue to undermine the rule of law, he said on a radio show this morning that he plans to "fire" Special Counsel Jack Smith "within two seconds" after taking office. "He'll be one of the first things addressed." Never mind that Trump wouldn't actually have the legal authority to do so. Smith, of course, has filed felony charges against Trump in D.C. for his many failed attempts to steal the 2020 election, and in Florida for having stolen thousands of pages of highly classified national security documents upon leaving the White House and refusing to return them to the federal government.
  • And, in case you're confused about who Donald Trump is referring to when he vows "retribution" against "the enemies within", it is you. E&E News has a new report out today detailing how Trump, when he was last allowed to be President, withheld FEMA aid following natural disasters in several states --- Washington, California, Georgia, Utah and Maryland --- due to political disagreements he had with their Governors following his election loss in November of 2020.
  • Desi Doyen joins us today for our latest Green News Report, tracking record heat, drought and wildfires in the U.S. Northeast; the U.S. Senate races which could determine who wins the majority in the upper chamber this year, and how that is likely to affect action on our climate crisis; and the Biden Administration's race to get climate and infrastructure funding out the door before next year's changing of the guard.

Noteworthy election results from NY, CO, UT, SC; SCOTUS opinions on public corruption, social media; More long-overdue pardons by Biden...

Stand by for news --- some good-ish, some not-ish --- on today's BradCast! [Audio link to full show follows below this summary.]

First up today, some noteworthy results from yesterday's primary elections. Among a bunch of races covered today from four different states...

  • Progressive New York "Squad" member Rep. Jamaal Bowman was soundly defeated in his 16th District U.S. House primary race by longtime local Democratic official George Latimer in what was, notoriously, the most expensive House primary ever run. The cost of the contest was largely due to the American Israeli Political Affairs Conference (AIPAC)'s investment of millions of dollars to defeat Bowman, who, among other sins, described Israel's war in Gaza as a genocide. That said, as many pointed out before Tuesday and as we detail today, Bowman, as a movement progressive, was likely to have lost this race anyway in a very diverse "normie Dem" district, even without the flood of AIPAC money.
  • Far-right Colorado Rep. Lauren Boebert's carpetbagging jump from her right-leaning, but swingy-ish 3rd District to the farther right 4th district --- after barely winning in the 3rd in 2022 by just a few hundred votes --- paid off as she managed to beat off three other Republicans to win the GOP nomination in the new district on Tuesday and, with it, most likely, another term in Congress this November.
  • U.S. Rep. John Curtis, a not-insane, Mitt Romney-like, pro-climate action Republican from Utah, defeated a Trump-endorsed opponent to win the GOP nomination to fill the seat being vacated by the retiring Romney in the very red, but not completely Trumpy state this November.
  • Another Trump-endorsed Republican lost, if narrowly, on Tuesday to Republican Sheri Biggs in South Carolina's primary runoff election for the U.S. House in the state's solidly red 3rd Congressional District.

And, some noteworthy news today from the corrupted U.S. Supreme Court, where a number of still-outstanding decisions remain, suggesting they may still be releasing opinions after the usual end of term in June, after we'll be on break over the Independence Day holiday week. Among the still-unreleased opinions are two that relate to criminal accountability for Donald Trump. It's up to you if you want to check out the (seemingly encouraging) abortion-related opinion that the Court appears to have accidentally released prematurely on their website for a few minutes on Wednesday morning. Beyond that, the two they meant to release today include...

  • A seemingly absurd finding that federal law does not prevent payoffs by private parties to public officials after an official has done something --- such as award a multimillionaire contract --- to the private party. The case overturns a conviction against an Indiana Mayor who received $13,000 after fixing the bidding process to award a million-dollar contract to a local trucking company. A payoff, or an agreement for one before such the contract was awarded, in a direct quid pro quo, would be considered unlawful bribery. But a payoff after the action in question, no matter how much, is considered a "gratuity" that, the Court ruled [PDF] in a 6 to 3 partisan decision today, is not barred by federal law. State and local jurisdictions may still prosecute such payoffs under their own laws, however, if they wish.
  • In a slightly more encouraging 6 to 3 ruling [PDF] today --- with three Republican-appointed Justices joining all three Liberals in the majority opinion --- the Court sided with the Biden Administration to reject claims by several Republican states and private plaintiffs that federal officials were unconstitutionally forcing social media sites to remove posts by so-called conservatives. The Court ruled that Plaintiffs had no standing here, since they all failed to demonstrate they faced any Constitutional harms by actions taken by federal officials --- in both the Trump and Biden Administrations --- to advise social media companies like Twitter and Facebook about potentially dangerous or misleading posts regarding COVID-19, election integrity and more.

And finally, on his HBO show last week, Bill Maher lauded Maryland's Democratic Governor Wes Moore for recently announced pardons to tens of thousands convicted over the years under state marijuana laws that have since been lifted. Maher then lamented how sad it was that Joe Biden wasn't smart enough to do the same thing at the federal level...even though Biden did exactly that two years ago when he also encouraged state Governors like Moore to do the same, as most marijuana convictions are at the state level. Of course, we covered both Biden and Moore's pardons as they happened. But, since Maher apparently never heard about it, I also want to make sure that at least you know about the new set of pardons issued today by the Biden White House...

  • As the military news outlet Task & Purpose reports: "U.S. troops who were convicted under a now-defunct military law that targeted gay service members will receive formal pardons, the White House announced Wednesday." The pardons will apply to thousands of LGBTQI+ troops who were discharged, going back to 1951, for military rules that have since been removed and/or found unconstitutional. Said President Biden in a statement: "Today, I am righting an historic wrong by using my clemency authority to pardon many former service members who were convicted simply for being themselves." I hope someone tells Bill Maher before he misinforms millions yet again...

Biden, Trump (mostly) sweep; Haley drops out; McConnell endorses; Protests haunt Dem victories in MN, CA; Few (though some noteworthy) Election Day voting system failures...

On today's BradCast: We distill a whole bunch of stuff --- results, problems, politics, concerns --- from Super Tuesday's primaries and caucuses in some 15 states and one U.S. territory. [Audio link to full show follows this summary.]

Included in our coverage today...

  • Donald Trump won most, if not all, of the GOP nominating contests on Tuesday by largely anywhere from 60% to 80% over Nikki Haley who defeated Trump in Vermont. Nonetheless, she subsequently announced on Wednesday that she is suspending her campaign, without (yet) endorsing Trump, saying he must now earn her support and those of her backers.
  • Republican Senate Minority Leader Mitch McConnell --- after pretending to be outraged by the deadly January 6, 2021 insurrection which he described Trump as "morally responsible" for --- endorsed him for President on Wednesday. I've got a word or two about that today.
  • Joe Biden won the Democratic contests in all of the states which voted on Super Tuesday, most by well over 80%. (He only received 70% and 73% respectively in Minnesota and Oklahoma. More on that below.) Nonetheless, if you were watching CNN last night, you'd have heard how Trump "DOMINATED!" his primaries, while Biden just did "very well" on the Democratic side.
  • After the U.S. Supreme Court, last year, required Alabama to finally add a second U.S. House District where Black voters might elect a candidate of their choosing --- in a state where 27% of the population is Black but only 1 of 7 U.S. House seats are even held by a Democrat --- more than 6,500 voters in that newly redrawn district were misinformed by County officials about which Congressional District they were supposed to vote in on Tuesday. The Chair of Montgomery County's Board of Registrars blamed a computer "software glitch" for what several candidates worried may have led to mass disenfranchisement.
  • Meanwhile, in Utah, where Republicans decided to run their own statewide Caucuses this year, an untold number of voters end up going home without voting when the Party's computer systems crashed or were otherwise unusable at many Caucus sites. The Salt Lake Tribune describes the "chaos" that ensued.
  • In North Carolina, GOP voters elected their Holocaust-denying Lt. Gov. Mark Robinson as their nominee for Governor this year. Democrats, who selected state A.G. Josh Stein for the job on Tuesday are likely delighted about that. Also in NC, preacher and former Rep. Mark Harris appears to be heading back to the U.S. House after his 2018 campaign for the state's 8th Congressional District resulted in a do-over election after Harris hired a known election thief who illegally collected ballots and filled them in for Harris. That election was tossed by the state Election Board and a chastened Harris chose not to run again. But now he's back! And on Tuesday, he apparently won enough votes to avoid a run-off. So, he appears headed back to D.C. next year thanks to further GOP gerrymandering of his NC district since he last tried to steal the election there.
  • In Texas, Democrats elected Rep. Colin Allred to take on Senator Ted Cruz this fall. Though state Republicans drew the line, apparently, at nominating a convicted January 6th insurrectionist for the U.S. House in the state's 19th Congressional District, sticking with the current Republican incumbent instead.
  • Jason Palmer defeated Joe Biden on Tuesday to win the Democratic Caucus in American Samoa! Who is Jason Palmer? We discuss, while noting that the victory came in a 51 to 40 vote (Not percentage points! That's the actual vote tally!) on the U.S. territorial island some 2,500 miles southwest of Hawaii. Apparently it pays to actually show up and campaign! Palmer was the only Democratic candidate who actually did so. Other than that, yeah, Biden actually "DOMINATED!" on the Dem side last night.
  • There was, however, a noteable vote for "Uncommitted" in Minnesota's Democratic Primary on Tuesday, with some 19% of voters casting a protest vote against the President, presumably as a statement in opposition to the Biden Administration policy regarding Israel's war in Gaza. The state has a sizeable Arab-American population. MN Democrats' bump for "Uncommitted" this year, as compared to the last time a Dem President ran for reelection in 2012, was substantial --- much more than a similar protest vote in Michigan last week --- even as all of the other states with similar "None of the Above" options on the ballot to date (Alabama, Massachusetts, North Carolina and Tennessee) all saw a decrease in such votes this year as compared to 2012.
  • Still, the protests from a small faction of the Left are unmistakable. Democrats dismiss those voters at their peril. Especially in critical battleground states like MI and MN. The protest was impossible to not notice at Rep. Adam Schiff's victory celebration last night in California. He will face Republican former MLB star Steve Garvey for the state's open U.S. Senate seat this November, after outpacing fellow progressive Congressmembers Katie Porter and Barbara Lee last night. But protesters chanted "Cease-fire Now!" and "Free Palestine!" throughout Schiff's entire victory speech on Tuesday, which the L.A.-based Dem handled gracefully. The Biden Administration does seem to be taking notice. Over the weekend, Vice President Kamala Harris gave remarks on Sunday calling for an "immediate cease-fire", "given the immense scale of suffering in Gaza."

UT's Sen. Lee in dead heat; Biden Admin begins student loan forgiveness; Biden vows to codify 'Roe' if Dems hold House, increase Senate majority; Also: Trump/Barr's dumb Special Counsel Durham loses another case...

Democratic voters, it seems, are an easily spooked bunch. A few bad polls and some seem ready to all but throw in the towel on the November midterms. But now is not the time for that sort of thinking. As discussed on today's BradCast, there is simply too much at stake this year --- Constitutional freedoms, democracy itself, survival on Planet Earth, just to name a few --- to get sidetracked by despair. To paraphrase Obama, don't boo-hoo! Vote! (And make sure everyone else you know does the same!) [Audio link to full show follows this summary.]

It was always gonna be an uphill fight this year. It still is. But it makes no sense to wallow. It does make sense to get to work. As President Biden correctly noted this afternoon, "Today we face an inflection point, one of those moments that only come around every several generations where there's so much change happening --- technologically, politically, and socially --- that the decisions we make now are going to determine the future of our nation and the future of your generation for the next 30 or more years."

With all of that in mind, these are among the stories covered on today's program...

  • Breaking just before airtime: Special Counsel John Durham --- tapped by Donald Trump and Bill Barr to investigate the investigators who investigated Russia's interference in the 2016 election --- is now 0 for 2 in Court. Igor Danchenko, said to have been a primary source for the so-called "Steel dossier", was charged in Durham's probe with five counts of lying to the FBI. He was acquitted today by a jury on all charges. He was the second to be indicted by Durham and then fully exonerated at trial. Even more humiliating for Durham: he personally handled most of the argument and questioning in court and reportedly ended up being rebuffed by his own witnesses who provided support for the defense. Worse, Danchenko, a Russian citizen living in the U.S., was reportedly "a treasured FBI informant" whose indictment "hurt U.S. national security."
  • Last week we detailed the five U.S. Senate seats that could plausibly be flipped this year from Republican to Democratic (in PA, OH, WI, NC and FL) and the two Democratic seats that could plausibly be won by Republicans (in NV and GA). At the end of yesterday's show, however, we added another to the Plausible Red to Blue list when the "gold standard" Des Moines Register poll over the weekend found Iowa's 89-year old, 7-term Republican Senator Chuck Grassley to be just three points ahead of his Democratic challenger Mike Franken. Today, there's yet another Republican Senate seat said to be in jeopardy --- in deep red Utah of all places! According to two different polls, independent candidate Evan McMullin is said to be in a dead heat with GOP Senator Presidential election theft enthusiast and not Trump "bootlicker" Mike Lee. On Monday, the two sparred in their only debate. It didn't go all that well for Lee.
  • On Monday, the Biden Administration opened its student loan forgiveness program at StudentAid.gov. The process has reportedly already served some 12 million applicants who may be forgiven for as much as $20,000 in debt. The process to apply reportedly takes no more than five minutes. All that is needed is a name, birthdate and social security number. The government will supposedly take care of the rest. At the same time, Republicans are suing to block Biden's program, created via Executive Order. But if they believe it's truly illegal, as Slate's Mark Joseph Stern observes today, they should introduce a bill to force those who received debt forgiveness to pay the money back. Do you think Republicans will do so?
  • On Tuesday, President Biden spoke at a DNC event and vowed to codify the Constitutional rights and freedoms previously guaranteed by Roe v. Wade into federal law as his first order of business in January, after our corrupt, stolen and packed Republican Supreme Court majority took privacy rights and reproductive freedoms away from Americans last June. We share Biden's remarks today. But, in order to enact those protections, as he points out, Dems will need to hold their House majority and pick up at least two more Democratic Senators willing to reform the undemocratic Senate filibuster rule in November. If that happens, not only can abortion and privacy rights be protected by federal law, but voting rights can be expanded and protected, and the corrupt Supreme Court itself can be expanded and un-corrupted. But, again, if that's what you'd like to see, you better to get to work between now and November 8!
