It looks like the numerous scandals embroiling the Bush Administration Justice Department haven't slowed down the GOP's stealth campaign to suppress voters and pervert democracy any way they can get away with it...

On June 5, less than thirty minutes before the North Carolina State Senate was scheduled to vote on a bill that would allow voters to register up until three days before an election (down from 25), the Republican state auditor sent out an email to legislators saying that he had "sensitive information" about voting irregularities. Lawmakers agreed to delay the vote.

So what was all the fuss about? His office's preliminary report had discovered tens of thousands of potentially invalid voters and nearly 400 votes by dead people, he announced. Clearly the scourge of voter fraud had hit North Carolina --- more registered voters could only logically mean more chances for fraud.

It's the worst time in the world for this. Except for any other. I've got to hit the road again, and will be on that road for the balance of the summer. Will be working from the road as usual, but if I'm lucky, I'll find some folks to cover for me here for extended periods, as I much need it. Heading to Atlanta for a start, to speak at the BackboneCampaign.org's Progessive Shadow Cabinet summit convening at the Carter Center next week. I'm proud to accept their nomination as "Secretary of Democracy."

No time, for the moment, to give much more than quick pointers. Sens. Kennedy and Whitehouse Send Letter to DoJ Inspector General's Office Seeking Probe into RNC Voter Supression Tactics
Inquiry Into What Justice Officials Knew About Griffin's Vote Caging Activities When He Was Named as US Attorney for Arkansas

Senators Kennedy and Whitehouse have sent a letter to U.S. Attorney General Alberto Gonzales demanding a probe by the DoJ's Office of the Inspector General and Office of Professional Responsibility into "allegations that the Republican National Committee engaged in 'vote caging' during the 2004 elections."

The letter, sent today to Gonzales, also requests an investigation into "whether any Department officials were aware of allegations that Tim Griffin had engaged in caging when he was appointed United States Attorney for the Eastern District of Arkansas, and whether appropriate action was taken."

The complete letter and a press release sent along with it are posted in full at the end of this article.

"The Republican Party has a long and ignominious record of caging – much of it focused on the African American community," Kennedy and Whitehouse explain in their letter which gives details of the RNC using voting caging tactics to suppress minority voters in both 1981 and 1986. After both incidents, the GOP had signed consent decrees that they would not engage in the activity in the future.

Nonetheless, email evidence has shown that in 2004, Tim Griffin created and sent caging lists on behalf of the Bush 2004 campaign as originally reported by the BBC to little American media fanfare, prior to the election. Griffin, who became an aide to Karl Rove, was later appointed by the Bush Administration as the US Attorney from Arkansas after they had fired Bud Cummins. Griffin has since resigned from the post in the wake of the scandal.

In recent testimony before the House Judiciary Committee, the now-resigned DoJ liason to the White House, Monica Goodling, admitted that now-resigned Deputy Atty General Paul McNulty was less than forthcoming in his sworn Congressional testimony concerning his knowledge about Griffin's involvement in vote caging during the 2004 campaign.

In her testimony, given under a grant of immunity from prosecution, Goodling said that McNulty "failed to disclose that he had some knowledge of allegations that Tim Griffin had been involved in vote 'caging' during his work on the President's 2004 campaign."

The Pro-HR811 Crowd Unleash All Manner of Personal Attacks Against Those Who Dare Oppose Thier Beloved Legislation as Written...

We've alluded to it before, and even in this article we'll not adequately reveal the depths to which some in the Election Integrity community have plumbed, but the Pro-HR811 folks are in full-court PR press mode of late in order to see Rush Holt's Election Reform bill passed in the U.S. House. By hook or by crook.

Despite claims passed on by supporters that the bill would come up for a full House vote in the past week or two, no such vote came to pass, although one could be scheduled at any time now that the bill has left committee. Inquiries seeking information on an official date for such a floor vote, sent by The BRAD BLOG to Holt's once-responsive legislative aide working on the legislation, have not been answered.

We too would like to see some version of the bill passed. But as it currently stands there are too many enormous flaws in the bill to earn our support, as we've discussed on these pages in great detail. (Here's one recent example.) As we've described, one of our greatest concerns is the bill's institutionalization of Direct Recording Electronic (DRE) touch-screen voting machines for use in American democracy. Such systems, even with the so-called "Voter-Verified Paper Audit Trails" (VVPATs) mandated by the bill --- and perhaps especially with such a mandate --- are antithetical to democracy, as they allow no way for voters to ever verify their invisible electronic ballots as accurate before or after the votes are cast and counted. The VVPATs themselves, as mandated by Holt, are also another problem which may make elections easier to steal, rather than harder. But we'll go into more detail on that at a later date.

There are a host of other reasons why DREs should never be used. Most supporters of Holt's bill --- except for People for the American Way (PFAW), which actually prefers such machines to paper-based systems --- recognize that. Nonethless, they've allowed PFAW and Holt's office to snow them into believing that a DRE ban could not pass in a Democratic Congress, while apparently the Republican dominated House and Senate in Florida, of all places, were able to ban such machines once and for all. Go figure.

As we described recently, it seems that none of the folks who've bought into the "DRE ban can't pass Congress" line seem to have bothered to ask for any evidence of the premise before passing it on to others. Or if they have, they've yet to share the evidence with the public, so that we might lobby those Congress Members who currently support the Holt bill, but would vote against it if it included a ban on DREs, so that the public might either educate them or otherwise discover and expose their reasons for supporting such dangerous machines in our democracy.

Anyway, the propaganda campaign from the pro-Holters is in full swing right now both behind and in front of the scenes as they place editorials and work the back-channel email lists. In the process --- and with the at least passive approval of Holt's office --- they seem hell-bent on destroying the character of any and all who they perceive as being in their way. Yours truly is no exception, of course, as we've been ruthlessly savaged by many of the "loudest" folks who want to see Holt passed --- even if they need to make stuff up about it and/or otherwise mislead Americans and Congress Members about what the bill actually does and doesn't do.

By way of example, see the email posted in full below, as written by NCVoter.net's Joyce McCloy, an ardent pro-Holter and forwarded by another, Kathy Dopp of UtahCountVotes.org. It was posted and then circulated to several large Election Integrity email lists. We can't help but highlight one of the grafs which refers to us directly, if only for the irony --- sure to be lost on the authors --- of our highlighting the charge here in the first place...

If it's Friday, it's time for another Bush Administration resignation or document dump. Looks like resignation is this week's choice, at least for the DoJ, where Attorney Purge heavy Michael Elston takes a dive, according to AP...

WASHINGTON — A senior Justice Department official who helped carry out the dismissals of federal prosecutors said Friday he is resigning. Mike Elston, chief of staff to Deputy Attorney General Paul McNulty, is the fifth Justice official to leave after being linked to the dismissals of the prosecutors.

Elston was accused of threatening at least four of the eight fired U.S. attorneys to keep quiet about their ousters.

Accomplished liar Mark. F. "Thor" Hearne told Jo Mannies at the Post-Dispatch (the only reporter he'll speak to of late) that there is absolutely nothing nefarious behind the continuing attempts by "someone" at his Missouri law firm, Lathrop & Gage, to scrub references to his discredited GOP "voter fraud" group, American Center for Voting Rights (ACVR), from his page at Wikipedia, as we discussed Tuesday, and again Wednesday, as the Wiki War continued, and as it became apparent that the ACVR had lied about their involvement in political activities on their federal 990 tax forms.

Mannies asked Thor about the ACVR references, now several times expunged from the page, and about what happened to the amazing, disappearing "voter fraud" hucksters. Incredibly, this is what she reports old Thor as having to say about it...

What will it take for Congress to realize that George W. Bush believes them to be utterly irrelevant? In the latest laugh in the face of Congress, RAW STORY is reporting that un-resigned Attorney General Alberto Gonzales used his stealthily-gained power to appoint interim U.S. Attorneys for one last time before Bush would sign the bill recently passed by Congress revoking that authority.

Congress recently revoked the little-noticed provision of the so-called "PATRIOT Act" which allowed such appointments to be made without Congressional confirmation. The bill had been sitting on Bush's desk for signing until late yesterday, when he finally signed it. But only after Gonzales reportedly named a new interim attorney to replace the fired US Attorney from California's Central District (Los Angeles), Debra Wong Yang.

Note: RAW STORY followed up it's report from yesterday, with another today suggesting that an interim appointment may not have been made after all. The issue is still murky, it seems. Just more fallout from a runaway Bush Administration that believes they are accountable to no one.

The change to the PATRIOT Act, revoking the Bush Administration's ability to appoint interim attorneys at will, was sent to Bush for signing on June 4th. The bill passed the Senate by a 94 to 2 vote, and in the House by 306 to 114. Bush waited until last night, June 14th, to quietly sign the bill.

At the same time, Washington Post is reporting that the Dept. of Justice itself is investigating its own Attorney General's testimony to Congress, in which Gonzales claimed he had not spoken to any "fact witnesses" at the DoJ concerning his involvement in the US Attorney Purge scandal due to Congress's ongoing investigation into the matter. The DoJ's liaison with the White House, Monica Goodling, would later testify under immunity to the U.S. House Judiciary Committee that Gonzales did speak of the matter, to her, in a conversation that she characterized as making her feel "a little uncomfortable." It seems Gonzo may have been hoping to get his/her story straight before testifying about it to Congress.

"It's remarkable that he's under investigation and that he's still attorney general," NYU School of Law professor, Stephen Gillers, told WaPo, underscoring both the obvious, and the Congress's continuing penchant for letting the White House play them for chumps. Why impeachment proceedings for Gonzales (much less Bush) have not already begun is beyond us. But as abused spouses also tend to wait until they're nearly dead before taking action to truly change their predicament, so, it seems will the Congress.

Gillers continued to note the absurdity of DoJ's investigation of itself. "At some point, it can no longer be done internally. This cannot be done by Gonzales's subordinates," he stated, pointing out the need for a Special Prosecutor at the very least.

But Bush doesn't care, of course, and continues to laugh in the face of Congress, which continues to behave politely, hoping everything will run its course in due time, as if they are not dealing with a near-sociopathic entity in the Bush Administration.

Yesterday, ThinkProgress reported that the White House now admits they have "found" some of the four years of "lost" emails sent by White House staffers on RNC email servers which are thought to contain details about the US Attorney purge. The "found" email has previously been politely requested by Congress. The White House, of course, has yet to turn them over to Senate investigators.

UPDATE: Compared Vote Caging With 'Caging Animals'...

Tim Griffin, former Karl Rove protege, former interim US Attorney from Arkansas and felonious vote cager, finally answered some charges in a speech yesterday in Arkansas. Apparently, he welled up with tears at various points in his presentation --- "crying as he said he had no plans to return to politics," reported AP --- to the point that the person who forwarded us the articles on the matter, said we should "call him a wahhhhmbulance."

We'd never be so cruel as to say or report any such thing, of course. That, despite the thousands of voters that Griffin sought to keep from exercising their franchise in America in 2004. During a time of war, no less. All to benefit his Republican paymasters.

AP reports that Timmy says that he plans to stay in Little Rock to "open a 'bipartisan' public affairs firm." We're sure he does.

Concerning the vote caging charges --- the ones based on the pre-2004 emails he sent, with the subject line "Re: caging," which included spreadsheet attachments with the names of thousands of minority (read: Democratic-leaning) voters he'd hoped the GOP would challenge at the polls, including folks in the military serving overseas, by the way --- Arkansas Business reports the former US Attorney is in denial:

"Griffin’s remarks about reports that he participated in effort to suppress Democratic votes, using a technique called "caging," came in response to a question at the end of his speech."This is all made up of whole cloth," he said. "I didn’t cage votes."

Some evidence for the "made up of whole cloth" charges, including some of Griffin's email, is available in this earlier BRAD BLOG exclusive from Greg Palast, who tells us he may have some more comments for us tomorrow on all of this. (UPDATE: Palast's comments on "Tears of a Clone" now here...)

Obviously, I’ve seen the Internet stuff about caging. First of all, the allegations that are on the Internet and have spread through the tabloids are completely and absolutely false, number one. And ridiculous. Caging, as you may know, I had it looked up, is a direct-mail term for basically organizing returned mail. … And I’ll just say that it’s so untrue. … This is all made up and faux pas. I didn’t cage votes, I didn’t cage mail, I didn’t cage animals, I’m not a zookeeper.

The Republican Who Most Likely Lost the Race, Held on Touch-Screen DRE Voting Systems, Continues to Serve in Congress as the Democrat Who Won Doesn't...

Probe of District 13 race is slowing

Democrat Christine Jennings was pinning her hopes of winning the 13th District congressional seat on the Democratic majority in Congress.

But a month after essentially abandoning her legal challenge in a Florida court, Jennings is finding her gamble to rely on Congress could take far longer than her supporters had hoped.

The U.S. Government Accountability Office is set to tell Congress on Thursday that it needs until September just to determine what other audits, investigations, and court proceedings have already turned up. Then, the GAO would go before Congress again to determine how much additional time, if any, it needs to produce a formal report for Congress with its own research, said Nancy Kingsbury, a spokeswoman for the GAO.

That would hardly conclude the investigation. The report would need to be vetted by a task force and then voted on by a full committee in Congress before it could then go before the full U.S. House, which has final say over the dispute.

That would all have to happen in the eight weeks between Labor Day and the targeted adjournment on Oct. 27 for the rest of the year.

The Congressional challenge is due to problems with touch-screen DRE voting systems in the district which resulted in 18,000 lost votes, in a race certified as having been "won" by the Republican Vern Buchanan over the Democrat Christine Jennings by a 369 vote margin. Even the machine vendor (ES&S)'s own expert in court admitted that Jennings would have most likely won were it not for problems with their touch-screen DRE voting machines during the race.

A recent study of DRE voting systems found that two-thirds of voters didn't bother to check their review screens at the end of the voting process on such systems, and that even if they check them, they do not notice votes that have been flipped by the system. The study concludes that paper trail records, printed out after the review screen on DREs, would similarly not be noticed or checked for accuracy. Those findings confirm earlier results from an MIT/Caltech study which looked at similar issues.

The embarrassments caused by the District 13 race in Florida helped lead the Republican-controlled House and Senate in Florida to finally legislate a ban on DRE touch-screen voting machines altogether.

Supporters of Rush Holt's HR811 Election Reform bill in the U.S. House, however, have said that it's impossible to get a similar ban in the Democratically-controlled House and Senate, so they've refused to add such a ban to their sweeping bill. Those who have made the claim that a DRE ban could never win passage in the Democratically-controlled House and Senate have yet to offer any evidence for that claim, or even offer a single name of a supporter of the bill who would vote against it if it included such a ban.

The bill currently has 216 co-sponsors, although ComputerWorld today confirmed our report from earlier this week that Presidential Candidate Dennis Kucinich (D-OH) plans to withdraw his co-sponsorship of the bill.

The FL-13 election, meanwhile, was held back in November of 2006. The earliest timetable detailed in the Herald-Trib article, quoted above, would result in a decision on the matter by October of 2007. The Republican Vern Buchanan, who most likely lost the race by nearly everyone's (but his and Sean Hannity's) estimation, continues to vote with the GOP caucus in the House while the Democratic candidate, whom Sarasota voters had tried to send to the U.S. House, bides her time in Florida.

This is exactly why Mark F. "Thor" Hearne and his "voter fraud" scamming buddies need to be called in, under oath --- with subpoenas if necessary --- before a Congressional committee. And pronto. The garbage they've been circulating for years is still taken "as gospel" by the Bush Dead Enders.

Here's one of them. Peter Kirsanow, appointed by Bush in 2001 to the US Commission on Civil Rights. Laura McGann has more details on this clown. But at left is the video of this clown's Senate testimony from last Thursday --- even after all of this stuff has been completely discredited --- repeating the same garbage, known well enough for him to repeat it a mile-a-minute, in a hearing concerning intimidation at the polls.

And yes, you read that right. This guy is on the US Commission on Civil Rights. The entire system has been compromised. It's time to haul in the ACVR bunch and get them on the record, to find out exactly "whodunnit." For example, the ACVR had nearly a million dollars to operate their "non-partisan" tax-exempt outfit in order to generate propaganda for chumps like Kirsanow to puke up in official hearings. That was the plan --- even while they lied about it on their tax forms --- and it's still working like a charm.

Before he became a "non-partisan" "voting rights" advocate, Hearne was the national general counsel for Bush/Cheney '04, Inc. He was recognized --- by name --- by Karl Rove when he spoke at a Republic National Lawyers Association event in April of 2006, thanking them for their "work on clean elections" in 2000, 2002, and 2004.

So where did Thor get his million dollars for his now shut down and discredited organization? We still don't know, because nobody has ever asked them under oath.

Anybody in the House or Senate Judiciary Committees paying attention here and feel like finding out?

Following up on Thor Hearne's apparent attempt to delete the taint of his American Center for Voting Rights (ACVR) con-man past by scrubbing his Wikipedia entry as we discussed yesterday in some detail.

And since Thor wants to keep playing, we'll point out that, yes, it appears his GOP "voter fraud" front group lied on their tax forms. Thor's a lawyer. A rather "important" one in fact, so one would think he would know better than to risk further tarnishing his powerful MO lawfirm Lathrop & Gage's reputation. Details below.

But first...today, Loyola law professor Rick Hasen, who originally discovered the attempt to expunge reality from Thor's Wiki, finds that the battle continues...

Two days ago, in this post, I noted that someone had deleted information on Thor Hearne's Wikipedia page noting Hearne's affiliation with and controversy over the American Center for Voting Rights. I updated the post to note that someone from Hearne's law firm, Lathrop and Gage, made a change to that page. Since my post appeared, Wikipedia readers restored information about on ACVR on Hearne's Wikipedia page. But now, that information has been deleted again by someone from ip address 65.204.234.241, which also belongs to Lathrop and Gage. Indeed, this search shows that someone at that law firm also has been editing the page on the American Center for Voting rights too.My Slate article on Hearne and ACVR, which apparently has not been deleted by anyone at Hearne's law firm, is here.

To those BRAD BLOG readers who have restored info to Thor's page and to the ACVR page, we'd ask you to keep up the good work. I suspect they will tire before you do!

Voter Fraud zealot Bradley Schlozman takes his do-over concerning testimony he gave last week to the Senate Judiciary Committee concerning his assertion (made 10 times in all), that it was Craig Donsanto of the Election Crimes division at the DoJ's Public Integrity unit who gave him the go ahead to bring voter fraud charges in Missouri days before last November's election. The indictments were in strict violation of the DoJ's written policies --- written by Donsanto, in fact --- that bar such indictments at times that they may have an impact on an election.

Says Schlozzie, in his freshly-filed and obviously-forced about face: "I want to be clear that, while I relied on the consultation with, and suggestions of, the Election Crimes Branch in bringing the indictments when I did, I take full responsibility for the decision to move forward with the prosecutions related to ACORN while I was the interim U.S. Attorney."


To which Sen. Leahy --- who pressed Schlozman hard on this precise point in a memorably heated exchange during the hearing (see angry video at left)-- says: "It is deeply troubling that after weeks of preparation Mr. Schlozman appears to have misled the Committee and the public about his decision to file an election eve lawsuit in direct conflict with longstanding Justice Department policy."

Also related...Hans von Spakovsky, Schlozman's GOP "voter fraud" partner at DoJ, comes before the Senate tomorrow for a hearing concerning his appointment as chair of the FEC. He had been previously recess-appointed to the position by Bush, but his Get Out of Jail Free Card is now up, and tomorrow he'll finally face questions on his role in gutting the Voting Rights Act at the DoJ against the advice of the decades-long experience of civil rights attorneys in the Voting Unit there. Five of those former DoJ staffers have written a letter to Congress urging them to reject von Spakovsky's nomination.

Mark F. "Thor" Hearne must really want to hide something about his discredited past as the front man for the GOP front group calling themselves the American Center for Voting Rights (ACVR).

In the latest chapter of a string of attempts by Hearne to cleanse his public record as lead snake-oil salesman for the mysteriously-funded "non-partisan" group that he founded to push propaganda about a massive (if non-existent) Democratic 'voter fraud' epidemic, it seems his Wikipedia page has been expurgated of all references to the ACVR.

Someone Named Sam92077 Has Cleansed Thor Hearne's Wikipedia Entry to Remove References to the American Center for Voting RightsSee here. The current cleansed page is here. Sam92077 does not appear to exist either. UPDATE: While I still don't know who Sam92077 is, the latest edit to the page (from ip address 63.76.92.100) was done by someone at Hearne's law firm.

As BRAD BLOG readers know, Hearne was formerly the national general counsel for Bush/Cheney '04 Inc. and continues to be both a friend of Karl Rove and a big time GOP operative in Missouri via his big time GOP law firm of Lathrop & Gage.

Since the spotlight has shone on the "voter fraud" fraud at the heart of the DoJ Attorney Purge, Hearne has been running for cover. The ACVR site was shut down, references to them have been purged from Thor's resume as various exposés have been run on his scam, by Murray Waas at National Journal, Hasen at Slate, and even on the once-ACVR and Thor-friendly NPR.

Of course, several of the scrubbed references and links on Thor's page were to our site, as we originally outed Hearne and his ACVR scam just days after he and fellow "non-partisan" "voting rights" activist Jim Dyke, Communications Director for the RNC, first started peddling their deceptive information. We first noticed them back in March of 2005 when Hearne testified before a Congressional hearing on the 2004 Election, claiming to be little more than a "long time voting rights advocate." Despite promises to the contrary, neither he nor Dyke have ever explained who was really behind the group, and who funded them to the tune of $1 million back when they set up shop out of a PO Box in a strip mall in Dallas, TX, where neither of them lived. The bogus information they peddled from coast to coast was --- and still is --- used by the folks throughout the DoJ and the Bush administration in hopes of affecting elections and seeing disenfranchising Photo ID restrictions legislated for polling places.

Hearne's powerful MO lawfirm, Lathrop & Gage, has also come into the spotlight of late in relation to a state fee office scandal said to have been under investigation by Arkansas US Attorney Bud Cummins at the time he was fired by the DoJ.

Recently, in one of the rare interviews he is now willing to grant to the media, Hearne blamed The BRAD BLOG specifically for many of his current woes.

You're welcome, Thor. Ready to come clean? Or will it take a subpoena for that? (We're guessing it'll take that subpoena.) Either way, unlike you, we've got nothing to hide, and we're not going anywhere...

UPDATE 6/13/07: Wiki info on ACVR restored, but Lathrop & Gage un-restores it. Twice. Plus, ACVR lied on their 990 public disclosure forms. Details on both matters now here...

In today's "Daily Voting News" John Gideon mentions the "banter back and forth between members of the Election Integrity community" over Rush Holt's controversial HR 811 Election Reform bill. "Banter" is a very nice way, for the very polite Mr. Gideon, to describe it. I'd call it just short of a shooting war.

In any case, while debate over such sweeping attempts at reforming our entire electoral system are essential, the continuing efforts by the pro-Holt folks to lobby in favor of their bill by offering deceptive and misleading information about it are certainly not useful to anyone. The bill itself is misleading by describing paper trails created by touch-screen voting machines as "paper ballots." The fact is, such trails aren't ballots. They are simply records (perhaps accurate, perhaps not, there is no way for any voter to know for certain) of the voters' votes. They are not actually used in the tally of results on Election Night, and almost never thereafter either.

BRAD BLOG readers are likely well familiar by now with various, and, worse, misleading claims about the bill from Holt's office staffers themselves and People for the American Way (PFAW) in particular, the biggest lobbyist/proponent for the bill. The latest entrant into the mislead sweepstakes is Pam Smith, President of Verified Voting. John points to her editorial today in the DVN, which begins this way...
