Guest: Election security expert Susan Greenhalgh, who helped expose the plot; Also: Still no speaker in wholly dysfunctional GOP House...
By Brad Friedman on 10/19/2023 6:36pm PT

That's two. And this is a big one, as discussed on today's BradCast with someone who helped make it happen. [Audio link to full show follows this summary.]

Former Trump attorney Sidney Powell pleaded guilty in Fulton County, Georgia today. She was the second of 19 co-defendants to do so in District Attorney Fani Willis' sprawling racketeering indictment [PDF] against Donald Trump and his alleged co-conspirators who tried, but failed, to steal the 2020 Presidential election in the Peach State.

Powell is, perhaps, most notorious for her so-called "Kraken" lawsuits filed after 2020, which she promised would expose evidence of massive Democratic fraud in several states. Her suits includes no such evidence and were all quickly dismissed. Her claims, for example, that dead Venezuelan President Hugo Chavez was somehow involved in stealing the election with voting machines --- in which Powell bastardized and misused some of my own accurate exclusive reporting on Dominion Voting Systems circa 2010 --- all turned out to be false.

But, as our guest today helped reveal earlier this year, Powell also organized and paid for a scheme to breach proprietary statewide voting system software in Coffee County, unlawfully make copies of it and distribute it across the Internet to sources still unknown. She was indicted by Willis on 7 felony counts related to that plot and, today, pleaded guilty to 6 misdemeanor charges that would keep her out of jail and on probation for 6 years, with the requirement that she cooperate fully with prosecutors and testify truthfully against her 17 remaining co-defendants still facing felony charges. Scott Hall, an Atlanta bail bondsman who initially confessed to the plot in Coffee County during a recorded phone call to frequent BradCast guest Marilyn Marks, as first aired on this program, pleaded guilty earlier this month and is also cooperating with prosecutors as part of his plea deal.

We're joined today for both a bit of a victory lap and a very serious warning by SUSAN GREENHALGH, longtime election integrity expert and Senior Advisor on Election Security at the non-partisan Free Speech for People. With Marks, whose Coalition for Good Governance has a long-running lawsuit against GA Sec. of State Brad Raffensperger, seeking to replace the state's touchscreen voting machines with hand-marked paper ballots, Greenhalgh helped reveal that the plot to breach the voting systems in GA was actually part of a broader, multi-state conspiracy hatched during an infamous December 18, 2020 meeting with Trump in the Oval Office. In addition to Powell, co-defendant Rudy Giuliani, disgraced former National Security Advisor Michael Flynn and others on Team MAGA were there that night, hoping that Trump would issue an Executive Order for the military to seize the nation's voting machines. Instead, they settled on the Coffee County scheme and others like it in several other states.

"We know that [Powell's] been involved in voting system software breaches in other states, like in Michigan," Greenhalgh explains today. "But Sidney hasn't been charged there. It's important to keep in mind that this was a networked, coordinated, multi-pronged plan to get access to voting systems in multiple states that she was a part of, and she really shouldn't escape responsibility for her role in those alleged criminal activities in other states."

Greenhalgh recently co-wrote a piece at Slate, calling on the U.S. Justice Department to launch a probe into the multi-state scheme which, she explains today, still poses a very serious threat to the 2024 elections. "Suppose there was a plutonium laboratory that had a robbery, and your local police prosecuted the thieves and the people that let them in. You wouldn't expect them to stop there. You'd expect the feds to go out and find out who got the plutonium and what was the plan to do with it. That's the kind of investigation that we need right now."

For today, at least, the guilty plea by Powell was good news. Marks called it "eminently important...for raising public awareness of the seriousness of the offense that puts Georgia’s 2024 elections at risk because Powell’s team released Georgia’s software into the wild."

As we've discussed with Marks on the program many times, however, Raffensperger has taken no action and has arguably helped cover up the Coffee County breach from the jump. "While Georgia’s Secretary of State has turned a blind eye and declined to either investigate or mitigate this massive security failure," Marks said in a statement today, "at least DA Willis is holding some of the ring leaders accountable in ways that will certainly expose other actors’ wrongdoing in this unlawful attempt to subvert the 2020 election."

For her part, Greenhalgh says today that, though she "was surprised at how lenient the deal is", she is hoping that Powell's guilty plea is "really going to bring the goods" on the multi-state plot and, of course, the involvement of higher-ups in the food chain like Trump and Giuliani.

Greenhalgh encourages listeners to contact their members of Congress to insist they take action on the ongoing threats posed to our voting systems by the breaches in Coffee County and elsewhere before 2024.

Given the mind-blowing and ongoing dysfunction in the GOP-run U.S. House right now, however, amid the Republican Party's continuing inability to choose a Speaker --- as we also discuss on today's show --- it's unlikely that there will be any kind of hearings or anything else there for quite some time.

Finally today, Desi Doyen joins us for our latest Green News Report, with bad news for snow crab fans; a decades-long scheme by the natural gas industry to cover-up health concerns about gas stoves; and some potentially encouraging news regarding both solar energy and U.S. climate goals...

Guest: Rich Logis on his escape from years in the 'cult' of Trump; Also: Biden in Israel; House GOP fails again to elect Jordan as Speaker...
By Brad Friedman on 10/18/2023 7:05pm PT

I hope you'll tune in for my fascinating, informative conversation on today's BradCast with a man who spent years as a self-identified "Ultra-MAGA" --- he voted in both 2016 and 2020 for Trump and had more than a dozen Trump hats and shirts to prove it. He is now working to rebuild his life after finally escaping the "cult" to become what he describes as a "born-again human being". [Audio link to full show is posted below this summary.]

First up, however, the latest news from the Israel-Hamas war and the ongoing humanitarian disaster in Gaza, including Biden's trip to Israel and his warning about mistakes made by the U.S. when reacting out of rage following 9/11. There is also encouraging news today that Israel and Egypt will allow some 20 truckloads of desperately needed humanitarian aid into Gaza, following the bombing of a hospital on Tuesday which Israel claims to be the work of a terrorist group allied with Hamas. Both dispute the evidence presented by Israel, who they blame for the tragedy that took hundreds of civilian lives.

Also, in his remarks from Tel Aviv, the President announced the U.S. will be sending some $100 million in humanitarian aid to Gaza, which presumably he will discuss more in a prime-time Oval Office address now set for Thursday night. It's unclear whether that money is already available to the White House or whether Congress will be needed to allocate it. If so, it may take a while...

The House GOP failed yet again on Wednesday to elect a new Speaker after deposing their previous one two weeks ago. In this week's second try, Ohio Republican Jim Jordan received even more GOP votes against him than he did on the first ballot on Tuesday. The House remains all but shut down now until Republicans can agree on a new Speaker or until Democrats decide to save them again. That is apparently becoming more of a possibility with each passing hour as the mess continues and as a government shutdown looms on November 17.

None of this comes as a surprise to those of us who have covered --- and have been warning about --- the Republican Party's long descent into madness and chaos over the years. It didn't begin with Trump by a long shot, but the manipulation by the narcissistic egomaniac and the rightwing media outlets which fostered it have left millions of otherwise well-meaning Americans in the MAGA lurch, as our guest today details.

RICH LOGIS was formerly a rightwing pundit and dyed-in-the-wool Trumper. He even wrote for the The Federalist Society. As he recently explained in Newsweek, he was a "four-time Donald Trump voter (twice in the primaries, and twice in the general elections)" and voted for Florida Gov. Ron DeSantis in both the primary and general election in 2018. "And I am here to tell you that I was wrong about all of it," he now concedes.

Today he joins us on the program to explain both how he was sucked into MAGA World before the 2016 election and what it finally took to shake him out of it in 2021, after years of damage that his obsession with Trump caused to both his family and friendships.

As a reformed "Ultra-MAGA," Logis tells me today that, as I was introducing my conversation with him, he was "thinking to myself, I cannot believe that I actually thought so much of that."

In short --- and none of this will do it justice, so please tune in to listen to our conversation --- his "skepticism of the two-party system" was the initial reason he was attracted to Trump. He notes that he says "none of this as a self defense," but being drawn in he allowed himself "to be influenced by many others, which is why that rabbit hole kept getting deeper and deeper for me as I stayed in MAGA."

He describes the "really toxic, perfect storm and amalgam of factors" that initially sucked him in. "It was a confluence of factors that all aligned themselves --- between Trump being brash, not giving a you-know-what, my dislike of the two-party system, those I was around who were influencing me --- and I came to conclude, and I know that it's going to really sound illogical, the more and more that I was around others who were in the MAGA world, in the rightwing world, the more I came to conclude that the Democratic Party and Hillary Clinton needed to be stopped. Because, if they won the election, they would never lose another election ever again. And anyone who was not a Democrat was going to be rendered irrelevant in their own country. If someone really believes that, as I genuinely believed that, that person will support anyone or anything."

Logis, as you'll hear, is anything but an uneducated rube. So how could he fall victim to what he now describes as "a cult"? He tells me that "when I woke up in the morning, I thought about MAGA. I went through my day thinking about MAGA. I went to bed thinking about MAGA. God knows I probably dreamt about MAGA. And then I got up the next day and did it all over again. It was all-consuming for me. And the more I was involved in the MAGA world, the more I came to see, and believe and conclude, that I and we in MAGA were on the correct side of history, and everybody else was on the wrong side of history."

In 2021, however, as DeSantis took a right turn regarding COVID, something began to give way for Logis, as you will hear him detail, along with how he was finally able to crawl his way out of the rabbit hole.

"One of the strategies I enacted, which is so simple," he explains, "I began to diversify my information sources. I lowered the defense mechanism of the black-and-white world of MAGA, which was that everything in the national press is out to get us. I started to realize, and very painfully, that so many of the rightwing mythologies that I believed, were actually the exact opposite. The Democrats were not coming for our guns. They were not trying to replace white people. They were not trying to render anyone who was a Republican or a conservative irrelevant in their own nation."

There is much more, of course, as discussed. But Logis has, since becoming a "born-again human being," formed Perfect Our Union, "an organization dedicated to healing political traumatization" and "building diverse, pro-democracy alliances" and writes for many outlets, including progressive ones like Daily Kos, where he is known as "@Leaving MAGA".

He offers advice today on how to approach your own friends and family members who may be similarly brainwashed by the MAGA cult, and explains that while he is now a registered independent, he plans to vote for Democrats for the foreseeable future because "MAGA must be electorally defeated."

"The Republican Party is a party in name only. They are a MAGA Party. That is a party that must be electorally mercy-killed so we can then enable responsible Republicans to think about how they're going to come back and rebuild that Republican Party."

Also: One step forward, two steps back in Gaza; No steps forward in GOP House Speaker debacle...
By Brad Friedman on 10/17/2023 6:43pm PT

Global chaos continues today on The BradCast, in Gaza, in elections around the world, in the U.S. House and, of course, for our worsening climate crisis. [Audio link to full show follows this summary.]

Our coverage today includes...

  • ISRAEL V. HAMAS: Some encouraging news last night, after an apparent diplomatic breakthrough on opening up the Gaza Strip to humanitarian aid seemed possible following days of shuttle diplomacy by U.S. Sec. of State Antony Blinken and some nine hours of marathon negotiations with Israel's P.M. Benjamin Netanyahu. The effort, reportedly at the direction of President Biden, resulted in the announcement that he would be visiting Tel Aviv on Wednesday --- a first for a U.S. President during war time --- for a meeting with Netanyahu, followed by meetings with the leaders of Jordan, Egypt and the Palestinian Authority in Jordan. The last part of that encouraging news may have begun to disintegrate with the late Tuesday bombing of a hospital in Gaza, said to have killed hundreds of civilians, including women and children. Hamas blames Israel. Israel blames Hamas. The innocent people of Gaza pay the price.
  • DEMOCRACY V. AUTOCRACY: There were elections both in the U.S. and several nations around the world over the weekend. In three of the four cases --- Louisiana, Ecuador and New Zealand --- the news was not good for small "d" democrats (or capital "D" democrats in Louisiana), as voters chose rightwingers to displace progressives (or conservative Democrats in Louisiana). But don't forget about Poland! There the news was far better in a nation which has had a front-row seat to the existential battle against fascism, as it borders both democratic Ukraine and Vladimir Putin's authoritarian Russia. Polish voters, in record numbers, voted out the ruling far-right party in favor of opposition centrist and progressive parties led by former EU President Donald Tusk. Good news indeed in perhaps the weekend's most important election.
  • U.S. HOUSE CHAOS: After winning his party's nomination to become House Speaker last week, election denialist and far-right Ohio Republican Jim Jordan was unable to win the 217 vote majority from his own caucus in the first round of voting on the House floor on Tuesday after GOP hard-liners deposed former Speaker Kevin McCarthy two weeks ago, and then refused to support the winner of the private caucus election that nominated Steve Scalise last week. Republicans no longer recognize elections as valid, unless they win them. As TPM's Josh Marshall recently wrote, regarding the election denialism Republicans invented to try and steal elections from Democrats in 2020, "It’s like the virus had escaped the lab. It wasn’t just Freedom Caucus weirdos anymore. It's now treated as a given that caucus elections are purely advisory or essentially meaningless." Or, as TAP's David Dayen quipped last week, while asserting that the internecine House GOP chaos "could really go on indefinitely" and that the lack of a House Speaker actually matters to millions of Americans (including you this Thanksgiving), "In the Future, Everyone Will Be Speaker for 15 Minutes."
  • CLIMATE REALITY AND LIES: Desi Doyen joins us for our latest Green News Report, as the Mississippi River hits records lows amid drought, along with rivers in the Brazilian Amazon Basin; Exxon Mobil makes a huge investment to expand its deadly fossil fuel production, even as climate change ravages bees, beer, coffee and chocolate; and years-long GOP lies about China taking no action on climate change are exposed as lies yet again...

Admin urges Israel to allow aid in, foreign nationals out as death toll rises, situation grows dire; Also: 6-year old Palestinian boy killed by angry rightwinger in IL; Admin settles suit over Trump's child separation policy...
By Brad Friedman on 10/16/2023 5:57pm PT

It was another necessarily grim BradCast today, as conditions worsen and the death toll rises in Gaza while Israel continues relentless airstrikes in the wake of Hamas' horrific attack over one week ago. [Audio link to full show follows below this summary.]

Hundreds of innocent civilians, including women and children, have been killed over the past week in the Gaza Strip in advance of Israel's likely ground invasion. Food, water, medical supplies and fuel remains cut off to the territory of 2.3 million, with supplies now running dangerously low. The U.S., along with the U.N. and human rights organizations are calling for humanitarian aid to be allowed in, and for innocent victims and foreign nations to be allowed out of the region. The death toll is now in the thousands and 30 Americans have been confirmed as killed.

Hopefully, as grim as it may be, today's program is an insightful one, with both accurate news and a number of spirited conversations with callers. You'll be the judge of the that.

Among just some of the stories we covered before opening our phone lines to listeners today...

  • Washington Post: "U.S. signals push to ease Gaza humanitarian crisis"
  • U.S. State Dept: Secretary Antony Blinken's Remarks to the Press in Cairo on Sunday
  • CBS' 60 Minutes: Interview with Joe Biden on Israel-Hamas conflict
  • Reuters: "Slain Palestinian boy mourned in Illinois after suspect appears in court"
  • NBC News: "Suspect in death of 6-year-old Palestinian American boy was obsessed with Israel-Hamas war, prosecutors say"
  • NYTimes letter from Fadi Abu Shammala: "What More Must the Children of Gaza Suffer?"
  • AP News: "Settlement over Trump family separations at the border seeks to limit future separations for 8 years"

Also: Latest on Israel-Hamas; Biden's curiously repeated comments about 'rules of war'; WI Repubs' impeachment threat now all but dead...
By Brad Friedman on 10/12/2023 6:35pm PT

It was a lot of show on today's BradCast. But at least one of my seemingly ridiculous-at-the-time theories from way back at the beginning of this year has now been vindicated. Buckle up. [Audio link to full show is posted below this summary.]

Among our many stories covered today...

  • The latest on the Israel-Hamas war, including rising death tolls, the retaliatory destruction of entire neighborhoods in Gaza, the potential for spread to other countries and more. We also observe some curiously repeated comments by President Biden in recent days. Whenever he cites his conversations with Israel's controversial, criminally-indicted, far-right Prime Minister Benjamin Netanyahu, Biden takes pains to mention "rules of war" for some reason. (See his remarks on Tuesday and Wednesday.)
  • In related news, it looks like it may take a while --- if ever --- for Republicans in the U.S. House to elect a new Speaker. (Since we got off air, the winner of yesterday's caucus vote, Steve Scalise, says he is dropping out of contention.) In the meantime, that means almost all business in Congress is ground to a halt. But, given the rising tenor of Republicans seemingly hoping to rope us into a war with Iran in the wake of the horrific Hamas attack on Israel, and the way both Republicans and Democrats tragically over-reacted following 9/11, perhaps there is an upside to a cooling off period in Congress right about now?
  • In other news, the GOP push to impeach a newly-seated Wisconsin Supreme Court Justice may now be all but dead. The election of Justice Janet Protasiewicz gave liberals a 4 to 3 majority on the state's High Court for the first time in 15 years. And now a challenge to the Republicans' rigged Assembly and Senate districts is before the Justices. Republican Assembly Speaker Robin Vos has threatened to impeach Protasiewicz if she didn't recuse herself from the case (for no good reason). On Friday, she announced she wouldn't. But now not one but two former rightwing WI Supreme Court Justices have weighed in --- hilariously, at Vos' request --- to say impeachment is both uncalled for and a violation of the Badger State constitution.
  • Democratic U.S. Senator Bob Menendez (NJ) and his wife have been slapped with yet another criminal felony charge. This time for unlawfully conspiring to act as an agent of Egypt, even while serving as Chair of the Senate Foreign Relations Committee. The pair were previously charged for accepting bribes of cash, gold bars and a luxury car. More than 30 of Menendez' Democratic colleagues in the Senate have called for him to resign. He has, so far, refused.
  • Everyone's favorite, wildly corrupt Republican Congressman, grifter and pathological liar, Rep. George Santos (NY), was charged with an additional 10 federal felony charges this week for identify theft and credit card fraud after allegedly using donor's cards to steal tens of thousands of dollars from them. He previously faced 13 counts for, among other things, lying on financial disclosure forms about being a millionaire and receiving unemployment funds when he was actually employed.

But it was last week's guilty plea by his former campaign treasurer that has now seemingly vindicated what I had described last January as my "ridiculous, couldn't-possibly-be-true George Santos theory" that I seemed to be the only one raising at the time. This was when Santos' life of lies had recently come to light following his 2022 election to Congress, and after he had amended some FEC paperwork from his campaign to claim that he had made a personal loan to it of some $500,000.

There were plenty of reasons to doubt that claim --- when he lost his 2020 campaign his disclosures revealed that he made less than $50,000/year --- but most assumed the donation was real, at least, even if probably came from someone else. But who?

My question was different. On several occasions, including with a campaign finance expert we had on the show in January, I kept wondering if the donation itself to Santos' campaign actually existed, if the FEC or anyone else had ever bothered to check his bank account to see if that money actually came in when he claimed it did, or whether the whole thing was just on paper.

While it seemed crazy to some at the time (even to me!), guess what his Campaign Treasurer revealed when she pleaded guilty to a fraud conspiracy charge last week?...

  • Finally, Desi Doyen joins us for our latest Green News Report, with some grim news for humanity (as usual); suspected sabotage of a natural gas pipeline off the coast of Finland; and the quiet launch of the European Union's first-in-the-world carbon border tax...

Guest: Dr. Marick Masters of Wayne State University; Also: Twitter/X allowing flood of misinfo, disinfo, propaganda amid Israel-Hamas war...
By Brad Friedman on 10/11/2023 6:21pm PT

On the heels of last weekend's Hamas attack on Israel and Israel's subsequent retaliation against Gaza, there has been a flood of disinformation about the conflict allowed to circulate on social media. Also on today's BradCast, we take some time to focus on a major victory back home in the ongoing strike by auto workers against Detroit's Big Three. [Audio link to full show follows below.]

FIRST UP, a quick word or two on the landfall of Hurricane Lidia last night on the Pacific Coast of Mexico near the resort of Puerta Vallarta. When we got off air yesterday, the storm had quickly spun up to a Category 3 before ultimately making landfall as a Category 4, with windspeeds topping 140 mph. Happily, it hit in a sparsely populated area, so damage and loss of life, so far, has reportedly been minimal. But the rapid intensification of the storm, and its gaining of strength as it got closer to land is both remarkable and something we have seen much more of in recent years as our climate crisis worsens. Also, the fact that Lidia made landfall on the Pacific Coast of Mexico just one day after another storm, Max, did as well, should similarly be ringing alarm bells.

NEXT, the relentless military response by Israel against Gaza continues in the wake of the unspeakably horrific attack by Hamas on Israel over the weekend. So does a flood of misinformation, disinformation and propaganda on social media sites. Elon Musk's Twitter/X site is particularly horrible in this regard, following his firing of most of the company's content moderation team and its replacement by community volunteers who are, according to an NBC report today, largely being ignored by the company as false and inflammatory content runs wild. AP is helpful today in offering independently verifiable facts to correct the record on a number of viral social media videos and photos purposely doctored to mislead. One, for example, showed a manipulated "order" from President Biden, claiming to send $8 billion in aid to Israel. Another purports to show videos of Russian President Vladimir Putin warning the U.S. to "stay away" from the Israel-Hamas conflict. Both assertions were completely false, but were allowed to remain on Twitter for hours without correction to be seen by millions of users.

THEN, in some brighter news, the United Auto Workers union struck a stunning deal late last week with GM that will allow workers who build batteries for electric vehicles to join the union's master agreement with the company. That, after many thought that an agreement to unionize workers at EV plants would be impossible.

Our guest today is DR. MARICK MASTERS, Professor of Business and Political Science at Wayne State University in Detroit, where he also served as Director of the Labor@Wayne program. He joins us to discuss the big news for workers at battery plants and other successes, so far, by the UAW and its President Shawn Fain during the ongoing, unprecedented strike against all three major U.S. automakers.

Late last week, Masters published an article at The Conversation on "Why the UAW union's tough bargaining strategy is working". He joins us today to discuss the new tactics and strategies employed by union leaders in the growing work stoppage and how it might both lead to success and ultimately be adopted by other union organizers.

On the landmark agreement with GM to include workers making parts for battery electric vehicles in the master union contract, Masters describes the deal as "a monumental achievement on the part of the UAW," adding: "I don't think that anyone, including myself, thought that this was doable. I didn't think that was something that the companies would concede, but GM did."

He cautions, however, that "it remains to be seen whether the two other companies [Ford and Stellantis] will accede to this demand of the union. But I don't think the UAW would sign a tentative agreement with them if they didn't."

Masters breaks down the UAW's so-far successful three-part strategy in the ongoing strike; explains why labor leader Fain is receiving so much support from the public both for his "audacious" demands and style of negotiations; and discusses whether the strategies employed by the auto workers might be applied elsewhere, at both non-union companies like Elon Musk's Tesla and in other industries where workers are finally standing up to management and demanding better pay, benefits and working conditions...

Also: WI Supremes to hear gerrymander challenge; Another GOP sports celeb to run for U.S. Senate; RFK, Jr. to run for Prez as independent...
By Brad Friedman on 10/10/2023 6:33pm PT

We begin again on today's BradCast with the latest developments in what AP is now calling the latest Israel-Palestinian war, before catching up with a number of political and climate related issues here at home. [Audio link to full show follows below this summary.]

ISRAEL v. HAMAS:

  • On Monday, the leaders of France, Germany, Italy, the U.K., and the U.S. issued an unusual joint statement condemning the "terrorist actions of Hamas" over the weekend, declaring "steadfast and united support to the State of Israel" and recognizing "the legitimate aspirations of the Palestinian people".
  • Today, an at-times visibly angry President Biden expressed similar sentiments, decried the weekend’s "atrocity on a appalling scale"; warned against adversaries both at home and abroad who might be tempted to take advantage of the situation for political violence; vowed to help secure the release of American hostages around the world; declared this "a moment for the United States to come together, to grieve with those who are mourning"; promised to uphold the "laws of war", and reiterated that the U.S. "stands with Israel" while condemning the "indiscriminate evil" of the weekend’s attack. He also confirmed that 14 Americans are now confirmed to have been killed as a result of Saturday's surprise assault by Hamas.
  • Beyond that, we cover the latest, including escalating death tolls, with at least 1,000 dead in Israel, and at least 800 dead in Gaza, as Israel continues its fourth day of pounding neighborhood after neighborhood in the Gaza Strip with air strikes. More than 200,000 Palestinians have reportedly fled their homes for U.N. shelters, as deliveries of food, fuel, water, electricity, medicine and other supplies to Gaza have been cut off by Israel, as hospitals are said to be running out of supplies, surgical equipment and antibiotics.
  • Back home in Congress, the U.S. House remains crippled thanks to Republicans having removed their own House Speaker last week. Given our recent history and the current situation in the Middle East, that might not actually be a terrible thing.

2004 MISCELLANY:

  • On Friday, the Wisconsin Supreme Court, after a 4 to 3 vote, scheduled a hearing next week on a voter petition to draw fair legislative maps for the state Senate and Assembly, for the first time in more than a decade. Justice Janet Protasiewicz, whose recent election gave liberals a majority on the High Court for the first time in 15 years, has decided to not recuse herself from the case, even as GOP Assembly Speaker Robin Vos' threat to impeach her if she did so has shown no sign of materializing yet.
  • Out here in California, 74-year old former L.A. Dodgers All-Star Steve Garvey announced today that he will be running as a Republican next year to fill the seat held by Dianne Feinstein, who recently passed away. He will be vying for one of the two spots up for grabs in next year's March Primary, in hopes of going on to compete in the November general election. He will have to face off with at least three Democratic all-stars hoping to become the state's new Senator, including Congressmembers Barbara Lee, Katie Porter and Adam Schiff --- and potentially against Laphonza Butler should she decide to run, after having been tapped by Gov. Gavin Newsom to fill the rest of Feinstein's term.
  • Robert F. Kennedy, Jr., with much support from Republicans, announced on Monday that he plans to drop out of his Democratic primary bid and run for President as an independent next year. In theory, he will join Cornel West who plans to do the same after leaving the Green Party, and a potential candidate put up for 2024 by the right-leaning "centrist" group calling itself No Labels.

LATE-BREAKING AND FINALLY:

  • Republican Rep. George Santos (NY), already facing 13 federal campaign finance-related charges, now faces an additional 10 related to identify theft for stealing donor credit cards to make unauthorized charges.
  • Hurricane Lidia spun up quickly before airtime to become a major Category 3 storm as it headed toward landfall on Mexico's Pacific coast near Puerto Vallarta. (Since we've gotten off air, Lidia has spun up even more, making landfall as a Cat 4 with 140 mph winds!) It is the second tropical storm to slam the Pacific coast in two days, following landfall by Max on Monday.
  • Desi Doyen joins us for our latest Green News Report, with good news for both striking auto workers and Electric Vehicles, and bad news for India, the children of the world, and your olive oil...

Callers ring in on all sides of the equation; Also: At least 2,000 killed in Afghanistan earthquake...
By Brad Friedman on 10/9/2023 6:11pm PT

We were otherwise looking forward to a fun BradCast today. Then Hamas launched a surprise attack on a number of Israeli towns and a music festival on a kibbutz on Saturday, in a horrific assault by land, air and sea. Hundreds were killed, injured or taken hostage. Now, Israel is brutally retaliating in Gaza. [Audio link to full show is posted below this summary.]

More than a thousand are reportedly dead on both sides, with attacks and atrocities against civilian populations that amount to nothing less than war crimes. At least 11 Americans have also been confirmed by the White House as killed, with an unknown number still missing.

Of course, none of this began over this weekend. So, today, we tried to offer some quick history of how we got here and how war crimes are "never okay" before opening up our phone lines to listeners --- both pro/anti-Palestine and pro/anti-Israel and pretty much everything in between --- with thoughts from callers on the weekend's tragedy and where it all goes from here.

The callers did not disappoint. Please tune in.

Here's some quick links to just a few of the articles and Twitter threads of note that I cited on today's program...

  • Josh Marshall at TPM: "[T]his takes everything into dramatically new territory. I don't know where that is exactly. But you can be confident that it's not where we've been to date."
  • Editorial from Israel's Haaretz newspaper: "Netanyahu Bears Responsibility for This Israel-Gaza War"
  • Twitter thread from Khaled Elgindy of the non-partisan Middle East Institute: "[A]ll the sophisticated weaponry & technology in the world cannot bring real security in absence of addressing underlying causes of conflict."
  • Twitter thread from Haaretz' Anshel Pfeffer: Netanyahu "will be forever remembered by Israelis for this disaster"
  • Twitter thread (parts one and two) from military ethics professor Shannon French: War crimes and atrocities are "always unethical, across time, space, and culture. It doesn't matter if you're on the weaker or stronger side of an asymmetric conflict [and] being the victim of war crimes/atrocities doesn't make it okay for you to commit them. It's never okay, full stop."

My hope today was not to inflame tensions on this very difficult topic, but to help inform the public (and myself!) over our public airwaves. It wasn't easy, but I think we did fairly well along those lines, especially the callers. But you'll be the judge of that...

Media woefully misleads on Biden and the border wall; AL to finally add second Black-majority House district; September heat 'gobsmackingly bananas'; Prez warns democracy in peril in perfectly normal interview...
By Brad Friedman on 10/5/2023 6:40pm PT

Good news, bad news, news about shamefully misreported news, and something that's as close to "normal" news as we are able to find these days. All on today's BradCast! [Audio link to full show follows this summary.]

THE GOOD NEWS: After two years and countless shameful losses in federal courts --- including twice at the U.S. Supreme Court --- Republican Alabama lawmakers are finally forced to follow the Constitution and Rule of Law by adding a second U.S. House District where Black voters may be able to elect a representative of their own choosing for the first time in state history. (Similar fights continue, however, in other states, such as South Carolina, Texas, Florida...)

THE BAD NEWS: September heat records around the globe were literally off-the-charts. Or, as climate scientist Zeke Hausfather recently described it, "absolutely gobsmackingly bananas". Is last month's alarming spike, completely blowing away some 80 years of temperature anomalies, temporary or here to stay? We discuss.

THE SHAMEFULLY MISREPORTED NEWS: Yes, the Biden Administration will be building some 17 miles of new border wall in the Texas Rio Grande Valley. No, it's not because Biden has "hypocritically reversed" his position on physical barriers or now agrees with Donald Trump (as Fox "News", Trump and too many actual news outlets have also been misleading reporting today). Rather, it is because the Administration is required to do so under the 2019 appropriations bill passed by Congress during the Trump Administration. Yes, the Biden Administration believes they must follow the Rule of Law, whether they agree with it or not. Crazy. The number of media outlets rewriting their originally misleading stories today would be hilarious, had the initial versions of those stories not been so woefully irresponsible.

SOMETHING CLOSE TO 'NORMAL' NEWS: We'll call it "The Old Normal". A U.S. President who is running for re-election next year sits down for a one-on-one interview with an actual journalists and answers many questions. No threats are issued. Nobody is attacked. In fact, no huge news is broken. But the electorate becomes better informed so they can hopefully cast an educated vote next year. We share the bulk of that interview because few others will bother to do so. And, yes, the perfectly reasonable conversation touches on our ongoing threats to democracy in America and around the world, and what can be done about the menace of looming political violence by rightwing MAGA extremists and their authoritarian cult leader. Seems important.

OUR LATEST GREEN NEWS REPORT: Desi Doyen has more today on the September heat records freaking out climate scientists; Antarctica's missing sea ice; a very weird turn against climate policies by Britain's Prime Minister; and the refusal by Big Oil and Gas to spend even an infinitesimal amount of their massive profits to permanently stop deadly, climate warming methane leaks...

Guest: David Dayen of The American Prospect; Also: Biden forgives another $9B in student loans; Jordan, Scalise to run for Speaker; Republicans try to blame Dems for Repub removal of McCarthy...
By Brad Friedman on 10/4/2023 6:47pm PT

The corrupt House GOP is in shambles but, for some reason, the corrupt Republicans at SCOTUS appear to have momentarily lost the plot, as all discussed on today's BradCast. [Audio link to full show follows this summary.]

We begin where we left off yesterday, as the historic and stunning news had just broken that far-right Republican members succeeded in their scheme to unseat Kevin McCarthy as Speaker of the U.S. House. Moments later, he announced he would not run again for the position. Then, after Republicans adjourned the House until next Tuesday to try and regroup, they immediately began trying to blame Democrats for the Republican coup. They even kicked former Speaker Nancy Pelosi out of her Capitol office, despite her being in California yesterday for Sen. Dianne Feinstein's funeral.

Of course, despite GOP politicians and pundits hoping to blame Dems for their own failure, none of it was evidence of Democratic genius, but of a thoroughly broken Republican party. They may not yet have noticed --- or care to admit it to themselves --- but the party has been collapsing for years under the strain of its own corruption, lack of self awareness, dedication to an autocratic cult leader, and its own toxic mix of of victim-hood, grievance, entitlement, rage and revenge.

Today, far-right Republicans Jim Jordan of Ohio and Steve Scalise of Louisiana tossed their hat into the ring to become the next Speaker. Others may jump in before next week. It may take even more than the record 15 rounds of voting the Republicans needed just nine months ago in January to install McCarthy as their new, if short-lived Speaker.

While the GOP continues to fall apart, the White House continues to fight for Americans by battling back against the corrupted rightwing U.S. Supreme Court. On Wednesday, the Biden Administration announced another $9 billion of student loan debt relief, for a total of $127 billion in loan forgiveness to date for some 3.6 million borrowers. That, as the Administration reformulates a plan to forgive the debt of tens of millions of Americans after SCOTUS made up a reason out of whole cloth earlier this year to reject Biden's previous plan.

But SCOTUS, as their new term got under way on Monday, has already unleashed some surprises. On Monday, the most corrupt Justice on the Court, Clarence Thomas, actually did the right thing and recused himself from a case where he obviously should have. (Are you okay, Clarence?) And on Tuesday, the majority of the Court, including Thomas, Brett Kavanaugh and several other rightwingers, appeared to push back hard against the attempt by Payday Lenders to dismantle the federal Consumer Financial Protection Bureau (CFPB) entirely on wildly dubious grounds.

The effort to undo the CFPB was actually spearheaded by rightwing extremists on the 5th U.S. Circuit Court of Appeals, arguably the most "conservative" (and corrupt) appellate court in the nation. They used a narrow lawsuit by the lenders to declare the CFPB's entire funding mechanism to somehow be unconstitutional, even though, when the consumer bureau was stood up, as the brainchild of Elizabeth Warren during the Obama Administration (before she went on to become a U.S. Senator), its funding mechanism was similar to many other quasi-independent Executive Branch agencies since the founding of the republic.

Thomas noted during oral argument on Tuesday that he did not see "a Constitutional problem" with the funding mechanism. Kavanaugh observed that Congress could change it "tomorrow" if they had a problem with it. Justice Elana Kagan charged the claims of the case were "flying in the face of 250 years of history." Justice Ketanji Brown Jackson, at one point, characterized the challenger's argument to say that "a provision of the Constitution is unconstitutional."

In short, it didn't go well for the lenders or Donald Trump's former Solicitor General who represented them at SCOTUS.

We're joined today to discuss what happened and what it all means --- including for other Executive Branch agencies that the right is similarly hoping to see dismantled, piece by piece, by the Judicial Branch --- by progressive financial journalist, author and Executive Editor of The American Prospect, DAVID DAYEN. He wrote a award-winning 2016 book about the same 2008 financial crisis that spurred the creation of the CFPB.

As Dayen explains today, the agency was created by Congress specifically to protect American consumers against scams by payday lenders, banks, credit card companies and other corporations. It receives its annual funding via the Federal Reserve, with a cap set by Congress. He argues that this case "threatens practically every consumer financial transaction that is made in the country."

After citing dozens of other federal agencies that are not funded via annual appropriates by Congress itself, Dayen asks, "If CFPB is unconstitutional, why wouldn't all these other things also be unconstitutional? In fact, there are plenty of other programs that are not funded by direct annual appropriations by Congress. I'll give you two big ones: Medicare and Social Security. They are mandatory spending. 60% of the federal budget is funded this way. Are they also unconstitutional because they are not exclusively funded by Congress?"

The 5th Circuit, he notes, "made this one ruling trying to help out payday lenders, but it really affects the functioning of daily life." The right has been gunning for the CFPB ever since its creation, and this case was supposed to be the one that finally killed it once and for all. But, Dayen suggests, with the caveat that anything could happen with this Court, after yesterday's argument at SCOTUS, he doesn't see the five votes that would be needed there to kill the CFPB...

Hard right moves to vacate, Dems stay united, next steps unclear; Also: Trump gag order in NY; John Kelly confirms Trump attacks on military, vets; Milley slams former Prez as 'wannabe dictator'...
By Brad Friedman on 10/3/2023 6:16pm PT

Breaking just before air on today's BradCast: Yup. More GOP chaos in Congress. But I'm sure, by week's end, it'll all be the Democrats' fault somehow. [Audio link to full show follows this summary.]

In the wake of House Dems helping to keep the federal government from a shutdown over the weekend by voting in support of then House Speaker Kevin McCarthy's last-minute, 45-day Continuing Resolution to keep the government open until the GOP's warring factions can pass a budget, Florida Rep. Matt Gaetz filed a Motion to Vacate against the Speaker of the House on Monday. By Tuesday afternoon, just before airtime, McCarthy was ousted in a dramatic 216 - 210 floor vote.

Gaetz and 7 other far-right Republicans joined all Democrats in voting to vacate the Office of Speaker of the House. It was a first in U.S. history.

Of course, we all saw it coming when McCarthy agreed to a deal with the farthest rightwing members of his own caucus in January to allow a single member to file a Motion to Vacate. It was one of many concessions by McCarthy in exchange for allowing him to become Speaker last on the 15th ballot. Moreover, he did himself few favors with the opposition party by breaking many promises with Biden and the Democrats regarding the shutdown, an absurd, evidence-free Impeachment Inquiry and more.

What happens next? That is completely unclear as of this hour, and as we scrambled to cover the historic news while still salvaging at least part of our previously planned program.

As the Republican Party falls apart in Congress, so does the life of the Republican front-runner for the 2024 Presidential nomination. Among our other stories, breaking or otherwise, today...

  • The judge in New York overseeing the state's $250 million civil fraud trial against Donald Trump, his company and two of his sons issued a gag order against the former President on Tuesday, after he targeted the judge's law clerk this afternoon in a social media posting and in an email blast to supporters.
  • Picking up on our continuing coverage of the racketeering case against Trump and 18 co-defendants in Georgia, related to their broad, failed conspiracy to steal the 2020 election in the Peach State, there was bad news in court on Friday for at least four of the co-defendants. We explain.
  • Retired U.S. Marine Corps General, former Secretary of the Department of Homeland Security and Trump's second and longest-serving Chief of Staff, John Kelly, finally went on record today to confirm his direct knowledge of a number of Trump's long-reported attacks against military members and veterans, including by describing them as "suckers" and "losers".
  • Kelly's devastating, if long-overdue, on-the-record remarks came in the wake of Trump's recent attack against General Mark Milley, Trump's Chair of the Joint Chiefs of Staff who the former President recently charged with committing "treason", a crime punishable by execution. For his part, Milley, whose four-year term expired last week, offered thinly-veiled, if striking and piqued remarks during his Farewell Address late last week. Without mentioning Trump by name, while describing the uniqueness of the American military's mission to protect the nation and our democracy by taking an oath to protect the Constitution, Milley railed: "We don't take an oath to a country. We don't take an oath to a tribe. We don't take an oath to a religion. We don't take an oath to a king or a queen or to a tyrant or a dictator, and we don't take an oath to a wannabe dictator!" While those comments have received a fair amount of attention by the media, Milley had much more to say along those lines. We share a bit more of his remarks that are worth hearing today.
  • Finally, Desi Doyen joins us for our latest Green News Report, after New York saw its third 100-year flood in the past two years over the weekend; extreme heatwaves shattered September records; climate change is straining the home insurance bubble; and Norway's effort to move to 100% electric vehicles is all but complete...

Guest: Marilyn Marks of Coalition for Good Governance; Also: Shutdown averted; CA's new Senator; Nobel prize for COVID vaccine masterminds; Trump in deeper trouble by the day...
By Brad Friedman on 10/2/2023 7:08pm PT

Longtime listeners of The BradCast likely knew about the big news last Friday better than almost anyone in the nation. Certainly better than those in the corporate media. We'd been reporting on it for years now, so our listeners likely knew the name "Scott Hall" before pretty much everyone else in the country. [Audio link to full show follows this summary.

On Friday, Atlanta bail bondsman Scott Hall was the first among Donald Trump's 18 co-defendants to plead guilty in the Fulton County, Georgia racketeering indictment, detailing Trump's broad conspiracy to steal the state's 2020 Presidential election in the state. Hall was indicted in the RICO scheme [PDF] on five felony charges related to his participation in the January 7, 2021 breach of Georgia's voting system software in rural, Republican-leaning Coffee County. The plot included Trump supporters unlawfully gaining access to the state's proprietary voting system software at the County's elections office, making copies of it and illegally distributing it via the Internet.

The crime first came to light after Hall called longtime Election Integrity champion and frequent BradCast guest MARILYN MARKS, founder of the nonpartisan Coalition for Good Governance, and essentially confessed to the entire scheme. Marks recorded the phone call "confession" and we were the first in the nation to broadcast audio from that phone call last year in May. Marks' group has been leading a long-running lawsuit against GA Sec. of State Brad Raffensperger, seeking to replace the Peach State's wildly vulnerable and unverifiable touchscreen voting systems with verifiable hand-marked paper ballots before next year's Presidential election. Her quick thinking to record Hall's phone call resulted in at least five of the indictments in District Attorney Fani Willis' case against Trump and friends.

"It was one of the more intelligent things I've done, which are not many!," quips Marks today. "But I'm glad I recorded that." She joins us today for the first time since Hall was the first to cop a plea in the case last week to avoid jail time in exchange for testifying against his fellow defendants. He received 12 months of probation and a $5,000 fine.

Marks explains that Hall will have a lot to share with Willis' team. "On mainstream media over the weekend, I heard many commentators saying, 'Well, he's kind of a small player.' Oh no no no --- he is not a 'small player'," she insists. "He knows the ladder, up and down. He was smart to get that deal he did. He got in early. And now Fani Willis has his truthful testimony about a whole range of characters and facts."

Among the many points we discuss with Marks today...

  • What Hall knows about the Coffee County breach, its organization by co-defendant and Trump attorney Sidney Powell, and the genesis of the multi-state plot beginning in Trump's Oval Office in December of 2020.
  • Why MyPillow CEO Mike Lindell flew into tiny Coffee County in his private plane for a few hours in the middle of the night as the County was preparing to fire its Election Director, co-defendant Misty Hampton, in the wake of the breach.
  • Why did all of Hampton's emails from her years as the County's Elections Supervisor supposedly disappear after she was fired? (Though, on today's show, we found one of them! Read on!)
  • Who else was involved in the breach but wasn't indicted by Willis (for example, Lindell and head of the now-defunct "Cyber Ninjas" outfit, Doug Logan) and why?
  • Why has GA SoS Raffensperger been covering up the breach since it happened in early 2021, and why is he still refusing to take any action in response to it? For example, why is his office refusing to install new security patches created by Dominion Voting Systems for the touchscreen voting systems until after the 2024 Presidential election?
  • Why is the state's voting system software breach in Coffee County important to the Coalition's lawsuit against Raffensperger, which seeks to move to hand-counted paper ballots? (The trial in that years-long case, by the way, is finally set to begin in federal court in January.)

"There is nothing to suggest that [Raffensperger] is remotely interested in learning what happened," Marks argues today. "He has still not started an investigation of the implications of this breach --- who was involved, how the administrative rules fell apart --- and has not done any kind of work on the security implications of it. It is absolutely shameful."

That's just the tip of the iceberg today which also includes another 'BradCast' first: We share the long sought after invitation letter allegedly sent by Hampton to the MAGA breachers on December 31, 2020, giving them the greenlight to come to the Coffee County Board of Elections office. "Y'all are welcome in our office any time," writes Hampton in the brief letter that Powell had claimed would somehow exonerate her, and in which Hampton goes out of her way to mention being in accordance with "Georgia Law" at least three different times, for some reason, in a single paragraph letter.

Tune in for all of that and much more today, including several news headlines on the federal government shutdown averted over the weekend, thanks to Democrats, and the price GOP House Speaker Kevin McCarthy may now pay for that; California Gov. Gavin Newsom's selection of political consultant, labor leader and Emily's List President Laphonza Butler to complete the term of Sen. Dianne Feinstein, who died late last week; Today's Nobel Prize in Physiology or Medicine awarded to two researchers who invested decades into developing the technology that would eventually become used to develop the COVID vaccines in record time in 2020; And several pieces of news from several different ongoing cases against Trump and his fellow co-conspirators, including his surprise appearance at the first day of New York state's $250 million civil fraud suit against him in Manhattan.

With smart special guests Heather Digby Parton of Salon and 'Driftglass' of 'The Pro Left Podcast'...
By Brad Friedman on 9/28/2023 5:20pm PT

Woah, Nelly! Today's BradCast may arguably be both the dumbest and most fun ever! [Audio link to full show follows this summary.]

The subject material --- Wednesday night's ridiculous GOP 2024 "Presidential Primary Debate" (if it's even worth calling it that) at the Ronald Reagan Presidential Library out here in Simi Valley, California --- is what makes it dumb.

It featured seven "candidates" --- former Vice President Mike Pence, Florida Gov. Ron DeSantis, former South Carolina Gov. and UN Ambassador Nikki Haley, South Carolina Sen. Tim Scott, former New Jersey Gov. Chris Christie, supposed businessman Vivek Ramaswamy and North Dakota Gov. Doug Burgum --- but not the much-indicted guy who Republicans apparently intend, for now, to actually nominate for the job next year.

Our excellent special coverage panelists --- award-winning blogger and columnist HEATHER DIGBY PARTON of Salon and Hullabaloo, and "DRIFTGLASS" of the Professional Left Podcast from "Flyover Country, Illinois" --- are what make it fun.

Hear Digby discuss the GOP's "Bizarro World alternet universe" and the "big orange elephant in the room"! Hear Driftglass explain the "Doomsday machine with no off switch" and "the smelly wet sock of the mainstream media"! Also, Doug Burgum!

To paraphrase Haley last night, hearing us today may help you "feel a little bit dumber." I'd tell you more, but that would ruin all the fun...and most of the dumbness! Enjoy!...

Guest: Author, historian, political scientist Norm Ornstein; Also: Gobsmacking details from NY state fraud ruling against Trump family; Late-night shows returning!...
By Brad Friedman on 9/27/2023 5:52pm PT

On today's BradCast: A couple of follow-ups and a deep dive into what almost certainly lies ahead beginning this weekend, including who is likely to be blamed for it, who may or may not still have a job when all is said and done, and what the cost is likely to be to the American people. [Audio link to full show follows below this summary.]

FIRST UP: The news broke just before airtime on yesterday's program, but I've now had time to read Tuesday's full, breathtaking court ruling [PDF] which seemed impossible to believe as it broke yesterday. But, yes, Judge Arthur Engoron's summary judgement ruling in New York state's $250 million fraud case against Donald Trump and his company and his two eldest sons is as brutal, if not more so, than we initially reported it yesterday.

In addition to utterly obliterating the case presented by defendants --- as "pure sophistry", "not relevant", "patently false", "fatally flawed", "simply untrue", "completely irrelevant," and "frivolous", among other things, some of which we share today --- Engoron details several of the eye-popping fraudulent lies told in years of Statements of Financial Condition (SFCs) signed off on by Trump in applications for bank loans. Breathtakingly inflated overvaluations of his key properties, including by 2,300% at Mar-a-Lago alone, where Palm Beach County assessed the property to be valued anywhere from $18 to 27.6 million in the years from 2011 to 2021. During those same years, Trump's SFCs said the property was worth from $426 to $612 million!

In total, the fraudulent overvaluations documented by the suit, just in the years in question, total anywhere from $812 million to $2.2 billion. "Even in the world of high finance," writes the Judge in response to defendants attempts to marginalize the false statements, "this Court cannot endorse a proposition that finds a misstatement of at least $812 million dollars to be 'immaterial'."

Each of the Trump properties seem to be "owned" by Limited Liability Corporations (LLCs) created by the Trump Organization to manage each of them. And, yes, the result of yesterday's ruling --- which we couldn't believe as it was breaking, but have now been able to confirm in the actual court order --- is that the Judge has ordered NY business certificates "controlled or beneficially owned by Donald J. Trump, Donald Trump, Jr., Eric Trump, Allen Weisselberg, and Jeffrey McConney" to be "canceled". He has also ordered "independent receivers to manage the dissolution of the cancelled LLCs."

All of that on summary judgement before the non-jury trial, to be decided by the very same judge, begins on Monday. Youch. There is, of course, the possibility for appeals and such. But it is kinda remarkable how Tuesday's ruling has sort of been downplayed by many of the corporate media outlets. Perhaps they can't believe it either.

Before we get to our guest today on a completely different topic, more good news as the Writers Guild of America approved their new contract with major corporate producers on Tuesday after a nearly 150-day strike. That now clears the way for a bunch of late-night shows to finally return to the air beginning this weekend and by Monday. Some shows and most films will still be largely paused as the actors union remains on strike against the studios.

NEXT UP: A federal government shutdown is now all but certain to begin as of Saturday, thanks to far-right Republicans in the House who are unable to strike a deal amongst themselves for a short-term Continuing Resolution, much less a full budget package for the new fiscal year. Nonetheless, a new poll out this morning suggests that while 1 in 3 Americans blame Republicans, 2 out of 3 are blaming either Democrats or President Biden for the shutdown?!? Seriously?!? How can that be?!?

To help make some sense out of all of this and what is about to happen and what its historical antecedents may be, we're joined today for a great conversation by author, columnist, political scientist, and longtime Congressional historian NORM ORNSTEIN of the American Enterprise Institute. He blames the corporate media's terrible "both sides", "access journalism" coverage for the mistargeting of blame by Americans for a shutdown by Republicans.

"It's entirely on House Republicans, egged on by Donald Trump," he explains. "These people want a shutdown. Because this is not an ideology. It is a theology. The theology is that government is evil, government is bad, lose government, we get freedom, without regard to the realities in the real world and on the ground. They are very happy to have chaos out there."

Ornstein also charges that the GOP, claiming to seek government spending cuts, are "hypocrites" because shutdowns end up costing the government money while hurting actual Americans. "This is not a harm-free zone we're entering into," he warns. "Not only does it not save the government money. In some instances, because functions will be postponed, maintenance will not be done, ultimately it will cost more. They're hypocrites, at minimum. They're not really talking about savings for the government. They're talking about bringing the whole mechanism down because they hate government."

While Republican House Speaker Kevin McCarthy is unable to wrangle his own caucus to even adopt a short term spending package to keep the government open as talks continue, he is also threatened with removal from his post as Speaker by the farthest right elements in the House. Ornstein offers some historical comparisons to this extraordinary moment, and argues that McCarthy "is in deep trouble."

"This movement towards using the threat of chaos, of shutdown, of default, as hostages" by Republicans in recent years, has "resulted in absolutely nothing happening. No concessions. Just the disruption." In recent years, he says, "we have been on a trajectory that is leading us further and further away from adults --- at least those that understand that no one is going to gain politically from a shutdown --- to a position now where we are basically being driven by the lunatic fringe."

He has, as ever, much more to help clarify on all of this today. All of it, as usual, well worth tuning in for...

Also: Biden joins picket line in MI; SCOTUS rejects AL gerrymander (again); Cassidy Hutchinson warns against former Prez; MUCH more...
By Brad Friedman on 9/26/2023 6:42pm PT

Some breaking news just before airtime helped, once again, threw off our best laid plans for today's BradCast. But, given this particularly huge breaking news, we're just fine with that. [Audio link to full show follows below this summary.]

The New York Judge in state Attorney General Letitia James' $250 million civil fraud lawsuit against Donald Trump, the Trump Organization, his eldest sons, Don Jr. and Eric, and two top company executives, ruled [PDF] that they all committed years of "persistent and repeated fraud" to the tune of billions of dollars by inflating the value of company assets when applying for bank loans. They also decreased the value of the same properties to receive favorable terms on both insurance and taxes, according to the ruling.

Judge Arthur Engoron found in favor of the state's key contention during the summary judgment phase of the landmark case on Tuesday, before the non-jury trial is slated to begin next Monday. Trump's attorneys had also sought summary judgement, hoping to see the case thrown out entirely. Instead, the key issue has already been decided against them and Engoron, in a brutal ruling, has stripped the former President, his company, his sons and execs, of control over several of his main New York properties. The Trump Organization and its various LLCs were placed into receivership to be controlled by court-appointed officers!

In the massive fraud suit, James seeks to permanently revoke the Trump family's license to do business at all in New York state. The trial, set to begin next week, will now determine the other issues at stake and the full breadth of penalties. Of course, Trump will appeal everything. But, make no mistake, this is a huge verdict against the failed former President and current 2024 GOP frontrunner who, as validated by Judge Engoron today, has built his business empire on decades of fraud and lies.

Among the many other important stories also covered on today's program...

  • Cassidy Hutchinson, star witness at last year's House January 6 Committee hearings and the former top aide to Trump's final Chief of Staff, Mark Meadows, warns that Trump "almost destroyed democracy in one day and he wants to run for President do it again."
  • This week's second GOP Presidential Primary debate, at the Reagan Library here in Southern California, will feature the same candidates as last month's debate in Milwaukee, other than former Arkansas Gov. Asa Hutchinson, who apparently did not meet the RNC's criteria. Trump was also not invited for refusing to sign the party's loyalty pledge, but he had already announced he wouldn't participate in any of their debates.
  • Labor economist Kathryn Anne Edwards offered a must-listen response to Louisiana's loopy U.S. Senator John Kennedy during a Senate subcommittee hearing last week on post-pandemic child care concerns. While Kennedy suggested he really really wanted to help, he had no idea where, oh, where the federal government could possibly find the money to do so. Edwards' straightforward, well-supported answer: Raise taxes on the wealthy that you've been lowering for the past two decades if you really care about children in need.
  • In a related matter on Tuesday, Joe Biden became the first sitting U.S. President, incredibly enough, to join a picket line with striking workers. In this case, he called on striking United Auto Workers members in Detroit to "stick with it," as he rallied workers with UAW President Shawn Fain. On Wednesday, the former President is set to speak at a non-union facility in a "red" county outside of Detroit.
  • California Governor Gavin Newsom signed a bill into law today that doubles the tax on sales of guns and ammunition in the state to help pay for increased school safety measures. While the federal government already charges a 10% tax on guns and ammo, California doubled it with one of their own, becoming the first in the nation to do so.
  • Bona fide good news today from our corrupted, packed and stolen U.S. Supreme Court. They rejected Alabama's attempt --- once again --- to violate the Voting Rights Act with a racially gerrymandered U.S. House map. Last June, in a surprising 5 to 4 ruling, with Chief Justice John Roberts and Justice Brett Kavanaugh joining the Court's three liberals, SCOTUS ordered the state to create a second majority black U.S. House District. Just 1 of 7 districts is currently a majority minority district despite African Americans comprising more than a quarter of the state's population. But Alabama Republicans, blatantly defying the U.S. Supreme Court, redrew their districts without including a second black majority district as mandated. A federal court panel then ordered a Special Master to draw up a new map instead. Alabama tried to stay that decision at SCOTUS, which unanimously rejected the state today in a one sentence ruling. That is good news for voters and bad news for several other GOP-controlled states trying the same gambit to cheat their way to a Republican majority in the House again next year.
  • Speaking of the Republicans' narrow majority in the U.S. House, it appears next to impossible at this hour to believe they will be able to agree amongst themselves on a spending bill to keep the federal government open as of Saturday. At least not without either Democrats saving them and/or House Speaker Kevin McCarthy losing his job as Speaker.
  • New Jersey's Democratic Sen. Bob Menendez, federally indicted for a second time late last week on charges of bribery and corruption, maintains his innocence. But the flood of fellow Democratic U.S. Senators calling for his resignation seems all but unstoppable now, with at least six of them --- including fellow NJ Senator Corey Booker --- calling for Menendez to step down. The charges, by the way, would seem to dramatically undercut Trump/GOP claims that the DoJ has been "weaponized" by Democrats against them.
  • Finally, Desi Doyen joins us for our latest Green News Report, as New Orleans declares a drinking water emergency; Fracking is "devouring American's groundwater" amid persistent drought in a number of states; and FEMA girds to suspend critical recovery operations in several states if Republicans shut down the federal government as of this Saturday...
