Gotta keep it short today. (You're welcome.) But there's plenty to make up for it on today's very lively BradCast. [Audio link to full show follows this summary.]

Among our coverage...

  • Habemus Papam! And all signs are that Pope Leo XIV may be a good one...even if he's from Chicago.
  • Happily, the new Pope tossed Donald Trump's dumb, first and only, but not-actually-done trade deal with U.K. right off today's front pages. But, suffice to say, it ain't much of a deal anyway, done or otherwise. At least not for the U.S.
  • Speaking of deals from the world's greatest (read: worst) negotiator, the one that Trump struck last week with Ukraine, to share some profits from exploitation of rare earth minerals in the war-torn nation in exchange for our continuing support, actually is a good deal! Especially for Ukraine, which seems to have outfoxed Trump. (Which apparently isn't all that difficult.)
  • In other dumb Trump trade news, California Governor Gavin Newsom and U.S. Senator Adam Schiff --- not to mention film and TV producers and unions, etc. --- are calling Trump's weekend bluff, when he claimed to want to save the U.S. film industry. He declared an unworkable, potentially industry-crushing 100% tariff on all films "produced in Foreign Lands". The serious people, however, want to see federal tax credits to encourage more production in the U.S. So, does Donny really want to keep the industry from "DYING a very fast death", as he claimed? If so, his Democratic friends in California have an actual solution. (Don't hold your breath he'll take it.)
  • Arizona's two-time statewide loser and election fraud fraudster Kari Lake has a new job with the Trump Administration. She's helping him shut down the world-revered Voice of America news and culture outlet and its global sister networks, despite the Congressionally-mandated and funded outlets' charter to produce accurate and unbiased news and cultural programming --- particularly in regions where a free press is restricted. VOA has done exactly that for the past 83-years since WWII, until being silenced by the Trump Administration. As lawsuits filed by VOA journalists, unions and contractors move forward to reopen the networks, Lake announced this week that she plans to replace the programming with far-right wingnut propaganda produced by the loons at the One America News Network (OAN). Which would, of course, be against the law.

Today on The BradCast: The President of the Unites States' war on the U.S. Constitution and Rule of Law continues, even as he keeps losing battle after battle in courts of law, at ballot boxes and in the court of public opinion. [Audio link to full show follows this summary.]

Among our coverage today....

  • At the beginning of last week, we reported the news of the Canada's Liberal Party overcoming an enormous deficit against the Conservative Party last December to triumph in national elections on Monday, when the Conservative Party's Trumpy Leader even lost his own seat in Parliament. By week's end, we saw damned near the exact same story in Australia, where the Labor Party Prime Minister on Friday retained his post (the first time that a ruling PM was elected twice in a row over the past 20+ years) and the conservative opposition lost in a landslide that saw its Trumpy party leader also lose his seat in Parliament as well, for the first time in Australian history. If nothing else, Trump's obnoxious behavior toward our longtime allies seems to be working wonders for center-left political parties in those countries.
  • Trump announced over the weekend that he will place a 100% tariff on movies "produced in foreign lands". Apparently, that would include American-made films shot in other countries, though he didn't explain --- and nobody in the Administration seems to yet know --- how such a "tariff" would actually be levied. Many fear it could also devastate the U.S. film industry. The new tariffs are necessary, Trump lied, because foreign film production is somehow a "National Security threat", according to his social media announcement. (It isn't a national security threat, of course. But I explain on today's show why Trump needs to pretend as much.)
  • As Trump revealed on NBC's Meet the Press over the weekend, he's not entirely sure if Constitutional Due Process, as cited by the 5th and 14th Amendments, is actually mandatory. That despite the Supreme Court making clear that it very much is, and despite his sworn oath earlier this year upon taking office for a second time to "preserve, protect and defend the Constitution of the United States."
  • Clearly, the Rule of Law and Constitution don't mean all that much to Donald Trump, as again illustrated by his four Executive Orders, so far, targeting four different law firms that dare to represent people he regards as political enemies. His clearly unconstitutional orders bar attorneys at those firms from entering federal buildings, interacting with federal officials or taking federal jobs, etc. The largest and first of those targeted firms to challenge an Order is Perkins Coie. They won a resounding victory on Friday when a U.S. District Court Judge in D.C. found [PDF] the entire Order targeting them to be a clear cut case of "unconstitutional retaliation and viewpoint discrimination, plain and simple." She nullified the entire Order in the bargain.

Meanwhile, out here in Los Angeles, three prosecutors in the U.S. Attorneys office for the Central District of California tendered their resignations over the weekend, after Trump-appointed acting U.S. Attorney Bill Essayli appears to have struck a deal with former L.A. County sheriff's deputy Trevor Kirk, after his felony conviction by a jury in February.

Kirk was found by a jury to have injured a 58-year old black woman during what police body cam footage revealed as to be an "unjustifiably violent" arrest. The woman apparently had nothing to do with the robbery that the cops were called to respond to at a grocery store in Lancaster, an hour or so north of L.A., in 2023. But she claimed to be live-streaming the arrest of her male companion, who apparently wasn't involved in the reported robbery either. Kirk threw the woman to the ground, threatened to "punch" her "in the face", hand-cuffed and pepper-sprayed her twice.

The unusual deal between Essayli and Kirk was struck after the jury verdict, but prior to sentencing, which could have resulted in as many as nine years in prison for the now-former cop. The new agreement would change his felony conviction to a misdemeanor with prosecutors seeking probation for Kirk instead of jail time, and no bar on him serving as a cop in the future. None of the attorneys who obtained Kirk's conviction signed on to the new agreement struck on behalf of Trump's acting U.S. Attorney. It must still be approved by a judge.

We're joined today by independent L.A. based legal affairs reporter MEGHANN CUNIFF who was the first to break the story of the agreement before the ensuing resignations of the career prosecutors in the L.A. U.S. Attorney's office in what appears to be a response to the deal their new boss struck, undermining their case. Cuniff, who acknowledges how unusual it is for a deal to be struck after conviction and before sentencing, argues that it's possible the prosecutors might be resigning for other reasons in addition to the unusual post-verdict deal.

After making clear that she is not reporting a direct line between D.C. and the Trump-appointed loyalist Essayli and his deal to drastically reduce Kirk's sentencing, she concedes: "I've never seen it before. It's totally unheard of. You might see it if there's an issue of misconduct during the trial or somebody is cooperating afterward. But the prosecutors are definitely outraged after this."

Cuniff is also not at all certain that the U.S. District Court Judge who oversaw the case will agree to the terms of the deal struck by Trump's prosecutors. At the same time, L.A. County has struck a settlement in a $3 million civil lawsuit filed by the two victims in response to their wrongful arrests.

In addition to the Kirk case, the same U.S. Attorney's office is now reviewing the conviction of Alexander Smirnov, who pleaded guilty to lying to federal officials in 2020 about Hunter Biden having corrupt business dealings with a Ukrainian oil company, "in what prosecutors described as a Russian-influenced operation," says Cuniff.

"As soon as Trump took over, all of a sudden, they are trying to get this guy --- who took a plea deal and was sentenced in January --- out of prison, pending appeal, saying they are going to support his appeal," she explains. "The trial judge wouldn't do it, but they're going to the 9th Circuit [Court of Appeals]. The assistant U.S. Attorney who argued for this is the same one who went to court to argue for Trevor Kirk for a sentencing delay" to allow Trump's attorneys to strike a deal with the dirty cop...

I've got no clue why so many in the media decided yesterday (Tuesday) was the 100th Day of Donald Trump's second term in office, when it is actually today (Wednesday). Am I missing something? No matter how many times I checked, counted, re-checked, recounted, asked AI, the 100th day --- not that any of it actually matters, unless you find accuracy from your media to be helpful --- is today. So, today is when we officially "celebrate" it on The BradCast. [Audio link to full, rollicking show follows below this summary.]

As we are wont at landmark moments in the second Trump Presidency, we are joined again today by two of our old school blogger friends who have been right about almost everything over the past 20+ years, whether the rest of the world wanted to notice or not. HEATHER DIGBY PARTON is the award-winning columnist at Salon and proprietor of Digby's Hullabaloo blog, and 'DRIFTGLASS' is the notorious eponymous blogger and co-host of the weekly Professional Left Podcast. They've both got plenty of thoughts to share at this particular "landmark moment".

Trump's approval ratings are plummeting on virtually every single issue via every single legitmate poll released over the past few days. Perhaps most notably, for the moment --- and for his own softening supporters --- his self-induced tanking economy is top of mind today. But, he's a loser on his immigration and mass deportation policies as well. Now, why would that be, given that he was supposedly elected for his great economic prowess ("Tariff is the most beautiful word in the dictionary of words!," he declared repeatedly in last year's campaign and right on up through his fateful "Liberation Day" on-again, off-again worldwide tariff proclamation earlier this month) and to "solve" the immigration issues that he and Republicans and Fox 'News' have been stoking and worsening for political purposes over so many years?

But none of it is working, as it turns out China is refusing to cower in the face of Trump's 145% tariffs because, as their Foreign Minister explained this week, "it will only make the bully want to push his luck more." There are quite a few elite American law firms, universities and media outlets that may wish to take notice of that response from the largest exporter of goods purchased by Americans, as ships will soon no longer be arriving and shelves at stores may be bare by the time we get to Christmas. That, as new economic numbers out today find that American GDP in the first quarter has fallen by 0.3% after increasing by 2.4% in the final quarter of last year under the economic guidance of President Biden, and more than two-thirds of Americans now predict a Trump Recession on the near horizon.

As to the violence, recklessness and fecklessness of his mass deportation policy, both of our guests concur that is backfiring as well. His supporters also seem to have begun to take notice. As Driftglass argues, they are seeing that "if anyone without a visa can be locked up and deported overnight, you can be, because now we have no Due Process." As Digby observes, "this is happening to people just like you who voted for Trump. And it could be you. They are not discriminating."

But there is much more on our plate to discuss today --- from why all of this is happening and whether it meets or exceeds our guests expectations; to what each of them expect to be Trump's response to his plummeting polls; to who they expect to be the first Trump cabinet member to fall; to what sort of Democrat is needed out there to guide the party back to relevance and put Humpty-Dumpty back together again --- if it can be.

Digby says she's "aged 10 years in the last 100 days" --- me too! --- as Driftglass breaks down what he describes as Trump's "fascist death spiral". Let it be true.

On today's BradCast: We're barely 100 days into Trump's second term as President and the odds seem to be improving quickly, believe it or not, for an historic third Impeachment for the worst, most failed, most unpopular (at this point in his term) President in U.S. history. [Audio link to full show follows this summary.]

BUT FIRST... Before we get to news on the possibility of yet another impeachment for Donald J. Trump, some wildly amusing election news out of Canada, where Trump's idiotic hectoring of our long-time friends to the North succeeded in improbably reversing the fortunes of the Liberal Party in Monday's election. Prime Minister Mark Carney was victorious yesterday, as the Liberals soundly defeated Conservative Party Leader Pierre Poilievre in a simply remarkable turn of events. The Liberals were all but doomed as of last December, when then-Prime Minister Justin Trudeau was facing a 25% deficit against the Conservative's Trumpy-wannabe Poilievre. Then Trudeau resigned and Carney took his place as PM, as Trump began threatening Canada with an offensive campaign to make it our 51st state. He then further won the hearts and minds of our largest trading partner and longtime ally by slapping huge trade tariffs on them and placing himself at the center of their Prime Minister's election. Long story short, Trump's idiocy translated into a once seemingly impossible victory for Carney and the Libs --- and Poilievre even lost his own seat that he's held in Parliament for 20 years to a Liberal opponent. Congrats, Mr. President! Please keep up the bad work!

NEXT... Back here in the U.S., Trump appears to be no more popular than he is in Canada. In fact, as pretty much every recent poll has shown, his approval ratings are in the toilet both overall and for almost every single issue pollsters are asking about.

That now includes Impeachment, where a poll released late last week found that a majority of American voters (52%), now "strongly support" or "somewhat support" the idea, including a 55% majority of voters who identify as independent and even 20% of self-identified Republicans!

That polling coincides with the introduction of seven articles of Impeachment on Monday in the U.S. House by Democratic Rep. Shri Thanedar of Detroit, who argues that Trump has "repeatedly demonstrated that he is unfit to serve" and "represents a clear and present danger to our nation's Constitution and our democracy."

All of that comes on top of the ImpeachTrumpAgain.org campaign, launched on Inauguration Day earlier this year by the nonpartisan nonprofit, Free Speech for People (FSFP). While their campaign initially called for Trump's Impeachment on Day 1 for violations of the Constitution's Emoluments Clauses and Trump's "unlawful, corrupt campaign practices," it has since expanded to include some 17 High Crimes and Misdemeanors that, "since taking office, Trump has committed."

According to my guest today, FSFP's co-founder and President, JOHN BONIFAZ, the campaign's petition in support of Impeachment has now garnered more than 400,000 signatures from the public. Bonifaz is a Constitutional Law expert and author of several books on Impeachment, including 2018's The Constitution Demands It: The Case for the Impeachment of Donald Trump. He has also given testimony in Congress in years past for U.S. House Impeachment inquiries.

Among my questions for Bonifaz today...

  • Why was Trump Constitutionally eligible as of Day 1 in his second term for Impeachment, as argued by FSFP's campaign?
  • If Trump's historic TWO impeachments during his first term failed to remove him from office, is it really worth doing yet again, especially with Republican majorities currently in both the House and Senate?
  • Impeachment or not, can Trump still be held accountable via the legal system for violations of the Constitution, including the Emoluments Clauses (as per a case found Moot by SCOTUS after Trump left office the first time) and for his withholding of nearly half a trillion dollars in spending approved by Congress?
  • Of the ImpeachTrumpAgain.org's current seventeen suggested Articles of Impeachment detailed on their website, what are the top three or four most critical, as he sees it?
  • How does the U.S. Supreme Court's absurd finding last year of so-called "Presidential Immunity" for "Official Acts" affect any hope of a U.S. Senate finding a President guilty of High Crimes and Misdemeanors under the Constitution's Impeachment Clause?
  • What is his response to Democrats --- for example, Rep. Dan Goldman of NY, who worked on one of Trump's previous Impeachments during his first term --- arguing, as the Congressman did in mid-February, that "regardless of whether or not there are impeachment offenses, it's not happening and we need to focus on other ways of providing accountability on Donald Trump"?

As usual, Bonifaz' responses are clear, insightful, and very educational, as he argues that "we are dealing here with somebody who is lawless in the Oval Office. He is a reckless, lawless person who claims to be President of the United States when really he's trying to act like a monarch and a tyrant."

"The Framers [of the Constitution] were very clear," he tells me. "We were not to be a nation governed by a monarch or a tyrant. This was going to be a different nation, governed by a President checked by a Congress and by a Judiciary. But importantly, they put an extra guardrail into the Constitution, in addition to those co-equal branches of government, and that was the Impeachment Clause. They were also aware that there might come a day when a President would so engage in trampling on the Constitution, would so engage in violating the rule of law, that there would need to be a measure to allow for the Impeachment and removal of that President. And that is the place that we are now in. This is the very remedy the framers put in the Constitution to deal with this lawlessness coming from the Oval Office."

"We either have a Constitution or we don't," Bonifaz asserts, when I ask about why any of this is worth trying, given previous failures to use Impeachment to remove Trump from office during his first term. "We either have an Impeachment Clause or we don't. If we do not invoke it at this very moment in the face of this lawlessness coming from this President, then what's the point of having the Constitution at all? And what's the point of having the Impeachment Clause? We are not going to give up on this idea of a Constitution in which a President must be accountable to the people and to the other branches of government."

"Second, we normalize these High Crimes when we don't name them for what they are. These are not policy disputes. These are abuses of power. And this President must be held accountable under the Impeachment Clause for these High Crimes."

"And third," he continues, "members of Congress take the same oath that Donald Trump took to protect and defend the Constitution. They have a duty to stand up at this critical moment in our history and defend the Constitution in the face of this attack by this President on the rule of law and on our democracy."

Donald Trump's chaos coaster continues on today's BradCast. Our top on today's ride: Social Security. [Audio link to full show follows this summary.]

FIRST UP... As we warned yesterday amid "irrational exuberance" as the stock market briefly skyrocketed following Donald Trump's social media announcement that he was pausing his unilateral worldwide tariffs for 90 days, investors began to notice that it wasn't quite as good as it looked. Trump's remaining 10% tariffs on almost every nation (other than Russia) and boost of duties against imports from China to 145%, helped lead the U.S. markets to tank again today, if not quite as much as they rose yesterday.

But some brighter news for those who believe in both truth and election integrity today. Rightwing propaganda outlet Newsmax, which quietly settled a defamation suit last year brought against them by voting system company Smartmatic, was found this week by a judge in Delaware to have defamed Dominion Voting Systems following the 2020 Presidential election. A jury will now determine if the Trump-allied outlet intentionally smeared Dominion with "actual malice" when they claimed the company rigged voting machines in favor of Joe Biden, despite the lack of any such evidence. The trial is set to begin at the end of this month...unless Newsmax decides to settle that one too.

But, speaking of actual voter fraud, it looks like Trump's Director of National Intelligence, Tulsi Gabbard, committed it last year in Hawaii when she voted there in the 2024 election after previously declaring herself to be a resident of Texas. Oops.

THEN... Elon Musk's DOGE Bros are unleashing absolute havoc at the Social Security Agency. Their latest chaos involved a plan to end phone services for people filing for retirement or survivor benefits as of this coming Monday. But with cries of outrage, impossibly long lines at field offices, wait times on the phone, and website crashes for new applicants and longtime beneficiaries in recent days, the Agency has now backed off that terrible plan as well. For now.

We're joined today for insight and warnings about Trump, Musk, DOGE and much more by longtime Social Security expert DR. ERIC KINGSON, emeritus Professor of Social Work at Syracuse University, co-founder of the nonprofit Social Security Works, and policy advisor to two different Presidential commissions on Social Security Reform under both Ronald Reagan and Bill Clinton.

What DOGE is doing at SSA "has nothing to do with efficiency or correcting errors," he tells me. "There's an extremely small error rate in Social Security. As for efficiency, we spend less than one percent administering the program. It's a well-administered program --- until now."

He worries that for "the first time since the creation of the program, there is a major, major risk of dramatic changes that will hurt the American public, especially middle-aged workers and young workers today."

"It's purposeful," Kingson argues, regarding the chaos unleashed at the agency by Musk's DOGE Bros in recent weeks. "You don't do the things that DOGE is doing because you want to fix something. You want to destroy it. And you want to destroy it with cruelty and disrespect for human dignity."

Kingson, the co-author of a book on protecting and expanding "the Insurance Americans Love and Count On", believes "the next game plan" is to privatize the Agency on the basis that the havoc unfolding now will be used to argue later that the private sector "will do a lot better".

He concurs with President Biden's SSA Administrator Martin O'Malley that the damage being done right now could soon result in the collapse of the system; argues that DOGE and Trump "have been stripping Social Security of its expertise and historical memory"; and charges that Trump, Musk and House Speaker Mike Johnson, who claimed today that "Social Security, Medicare and Medicaid will not take a hit" in the President's legislative agenda moving forward in Congress, are lying about fraud at the agency and benefits for Americans, which they plan to undermine. Kingson cites "a huge crisis" on the road ahead, as "half of today's workers under 67 will not be able to maintain their standard of living in retirement. If you count the cost of healthcare and long term care, it's probably about two-thirds. That's a crisis. What they are doing is stripping away the one thing you can count on: Social Security."

On today's BradCast: "Irrational exuberance" reigned on Wall Street as of 1:18pm Eastern Time. Though, after the past week of our moronic President's idiotic "economic policy" crashing the markets day after day after day, it's hard to blame investors for over-celebrating even the smallest hint of a respite from his imbecility. FIRST UP... Before we get to Trump (sort of) backing down from his worldwide (except for Russia) trade war, a bit of an addendum today to my disturbing conversation on yesterday's program with Slate's legal ace Mark Joseph Stern. He and I were both in general agreement on Tuesday that the Supreme Court's horrible 5 to 4 ruling on Monday night --- in a case challenging the deportation and foreign imprisonment of Venezuelan migrants without due process under Trump's peacetime use of the wartime Alien Enemies Act of 1798 --- allowed for the detention and foreign imprisonment of not just migrants but of U.S. citizens without due process as well.

Today, preeminent Constitutional law scholars Erwin Chemerinsky, Dean of UC-Berkley's Law School, and Laurence Tribe, Emeritus Professor of Constitutional Law at Harvard, argued an almost identical case in a New York Times op-ed headlined "We Should All Be Very, Very Afraid".

So it's not just some progressive radio dude and a legal reporter at a lefty-ish Internet publication issuing such a warning this week. Thus, I felt a need today to underscore that important point once again before it too gets lost in Donald Trump's ongoing authoritarian chaos.

For what it's worth, even a Trump-appointed federal judge in Texas on Wednesday has now temporarily blocked the deportation of Venezuelan migrants under Trump's Stalin-like implementation of the Alien Enemies Act. Details on today's program.

THEN... The roller coaster on Wall Street continued on Wednesday, though at least much of today's ride was an upswing for a happy change. After four and a half days of market blood-letting following Trump's ridiculous "Liberation Day" pronouncement of major sanctions against virtually every nation on Earth (except for Russia) last week --- and with the bond market tanking as well and economists warning about a likely recession --- President Super Genius finally backed down, at least partially, as he always does.

Despite a remarkable, immediate spike in the major market indexes in response, within minutes after Trump's lie-filled social media post about his "90 day PAUSE", investors may soon begin to realize that the news isn't quite as good as they might have hoped. Trump (for today anyway), is leaving in place 10% tariffs against pretty much everybody (except Russia) and now claims to be raising tariffs against China to 125%, because they dared match the previous sanctions he'd declared against them.

In all, though it was unclear as of this afternoon whether Trump was dropping his 25% or 35% or 10% tariffs against our largest trading partners, Canada and Mexico, if Trump keeps in place the current 10% tariffs against most of the world, and his 125% tax on goods imported from China, it seems that the inflationary cost to American consumers will be just about what it was before Trump choked this afternoon. Even after today's spike, the Dow remained about 10% lower than its all-time record set during the Biden Administration.

How that --- or any new brain farts from President Stable Genius --- affects the market in coming days remains to be seen.

In addition to the financial cost of Trump crashing the economy, there has seemingly been a political cost as well to President Make-It-Up-As-You-Go-Along as well, resulting in what Politico last night characterized as a "House Republican mutiny" that threatens to hold up (post air: sure enough!) or even block all together, his massive, deficit-exploding tax cuts for his wealthy friends and their corporations.

How will Trump's partial flip-flop on tariffs affect his political fortunes on the massive GOP budget plan? Stay tuned. Though keep your hands and arms inside the roller coaster at all times until this madness comes to a complete stop...whenever that may be...

On today's BradCast: The decision handed down by the corrupted U.S. Supreme Court last night just after we got off air was confusing, divided, muddled and, at closer inspection, as discussed with today's guest, even grimmer than it first appeared. [Audio link to full show follows below this summary.]

FIRST UP, however, what qualifies as the brighter news of the day, believe it or not...

  • Markets continued to plummet for a fourth straight day following Donald Trump's punishing, unilateral, worldwide (except for Russia) tariffs announced last week at the White House. But the push-back against his authority to issue them, granted by Congress, has begun to grow more quickly than one might have expected among Congressional Republicans.
  • And, just before airtime today, a Trump-appointed federal judge ruled in favor of the Associated Press in its lawsuit against the Administration after it banned the news outlet from coverage of certain events in the White House and on Air Force One. The AP has accused the Administration of unconstitutional viewpoint discrimination in violation of the First Amendment, in response to the outlet's decision to refer to the Gulf of Mexico by its internationally recognized name, rather than as the Gulf of America as Trump has attempted to mandate via Executive Order.

THEN, we're joined by Slate legal journalist MARK JOSEPH STERN to unpack the confusing --- and troubling --- 5 to 4 opinion issued by SCOTUS last night, largely allowing Trump's use of the Alien Enemies Act of 1798, for now, to detain and deport migrants to foreign gulags. Stern, who describing the ruling last night as one that "couldn't be more ominous", explains that the Court's brief, split decision is "going to cause a lot of confusion, chaos and uncertainty in the lower courts, and for these migrants, who the administration is trying to disappear to El Salvador."

While the five men on the Court disagreed with the four women (including the Court's lone female GOP-appointee, Justice Amy Coney Barrett) on most aspects of the ruling, they all agreed, at least, that deportees must be afforded the opportunity to challenge their detention in court before removal.

The terse, but alarming opinion was issued via the Court's "shadow docket" without full briefing or oral argument, in response to an emergency appeal in a challenge by Venezuela migrants deported under the AEA with no due process whatsoever. The Trump Administration invoked the wartime law --- which, according to its text, may only be used to detain and deport migrants from countries that have "declared war" on the U.S. --- to send Venezuelans they claim to be violent gang members to a gulag in El Salvador. And while the full Court decreed that such detainees must be allowed to challenge their detention in the jurisdiction in which they are detained, it will seemingly be impossible for the hundreds now already in a prison outside of the country to do so.

The Trump Administration's view, observes Stern, is that, once a migrant is locked up in a foreign gulag, they "have had their Constitutional rights permanently extinguished. They have no right to due process or any other rights, procedural or substantive. And further, that federal courts have no jurisdiction to order any kind of relief to help them." That is the case, according to the Government in the related Kilmar Abrego Garcia matter, even when someone has been "mistakenly" deported.

There are all sorts of troubling issues wrapped up in the majority's unsigned opinion, including the fact that they simply took the Administration at its word on several key points, despite Trump's Dept. of Justice repeatedly lying to and/or thumbing their nose at direct orders issued by U.S. District Court Judge James Boasberg, whose impeachment Trump subsequently called for. That call led to a gentle reprimand from the Chief Justice a few weeks ago, even if John Roberts sided with the majority in favor of Trump anyway in Monday's decision.

"We, as a Nation and a court of law, should be better than this," wrote Justice Sonia Sotomayor in her blistering dissent, excoriating the majority. "The government’s conduct in this litigation poses an extraordinary threat to the rule of law," she warned, ominously noting that it is now the official position of the Court that even "United States citizens could be taken off the streets, forced onto planes, and confined to foreign prisons with no opportunity for redress if judicial review is denied unlawfully before removal. History is no stranger to such lawless regimes, but this nation's system of laws is designed to prevent, not enable, their rise."

Stern shares her concern, particularly about the likelihood of U.S. citizens being swept off the streets and shipped off to foreign prisons. He adds: "By the way, something like 1-1.5% of individuals detained by ICE every year are actually U.S. citizens. The burden falls disproportionately on tribal citizens and Puerto Rican people on the mainland, due to racial profiling and other kinds of stereotyping. So this is not a far-off hypothetical."

He is also concerned about what the string of recent decisions by the corrupted high court in favor of the Administration and in contradiction to lower court judges, is likely to signal.

"I am worried that the Court is just going to start rubber-stamping these Trump requests for emergency relief, and refuse to consider the extraordinary and immense harms that will be inflicted on the American people by doing so," he explains. "That five men and sometimes Justice Barrett have decided that the real problem isn't Trump and his lawless crusade. The real problem is district court judges standing in his way. If that is the approach that the Supreme Court is taking --- if they really do think that the real problem is judges and not the Trump Administration's unprecedented assault on the rule of law, then again, we are all in grave danger. It's not just Venezuelan migrants."

We turn to callers for explanation of Trump's absurd trade war; Also: Court orders return of MD man disappeared to El Salvador; NC court orders possible disenfranchisement of 60k voters from LAST YEAR'S election...

On today's BradCast: The pointless bleeding on Wall Street caused by Donald Trump's trade wars slowed a bit by end of day Monday after a roller coaster ride throughout the day. U.S. markets ended largely down, through not as sharply as the two days last week just after Trump announced enormous sanctions against pretty much every nation in the world (other than Russia), for no explainable reason. [Audio link to full show follows below this summary.]

Given the pointlessness of it --- with even Republican billionaires and long-time supporters turning on him --- and the lies told by Trump when announcing his tariffs, we turn to Trump-supporting callers for an explanation. Would they be willing to call in and defend this madness? Spoiler: We don't get any persuasive explanations. Though we do get some interesting lies from one Trumper and some reasonable explanation from folks who don't support him or what he's doing to the world.

Also today, the tragic story of Maryland resident Kilmar Armando Abrego Garcia continued to churn late last week, into the weekend, and right up until airtime. The 29-year old father from El Salvador with a wife and five-year old autistic son (both U.S. citizens), had been protected from deportation by an immigration judge back in 2019 after escaping gang persecution in his home country. Last month, however, after detaining him in an Ikea parking lot in front of his son, the Trump Administration "mistakenly" sent Abrego Garcia to a gulag in El Salvador. Now they claim it's too late to get him back from the violent prison where, the judge noted, he faces threats from the same persecutors he'd escaped years ago. On Friday, a federal judge ordered the federal Government to bring him back. Today, just before air, Chief Justice John Roberts placed a (supposedly temporary) administrative stay on the U.S. District Court Judge's order on behalf of SCOTUS, following an emergency appeal by the Trump DoJ. Where it all ends, nobody currently knows.

And finally, before we turn to the phones, the remarkable story out of North Carolina, where a majority Republican state appeals court panel on Friday ordered that more than 60,000 voters should be stripped of their vote in last November's state Supreme Court election if they can't cure supposed problems with their ballots or voter registrations within 15 days. They would be robbed of their vote, but only, apparently, in the Supreme Court election. Losing Republican candidate Jefferson Griffin claims that the 60,000+ voters voted unlawfully in his contest against incumbent Democratic Justice Allison Riggs, even though they didn't. They followed all rules and laws in place at the time. Nonetheless, the 2 to 1 GOP appellate panel ordered those voters, including overseas military voters, to be given 15 days to be contacted and somehow cure supposed defects with their mail-in votes or voter registrations. This is part of Griffin's challenge to the election held almost six months ago, in which he lost to Riggs by 734 after two recounts and certification by the State Board of Elections. The matter now goes to the state Supreme Court, where Republicans have a 5 to 2 advantage over Democrats. One of those Dems is Riggs, however. She has recused herself. If the Court ties 3 to 3, the lower court ruling would stand...unless the federal court jumps in to put an end to this disturbing unconstitutional nonsense and blatant attempt by Republicans to steal another election before our very eyes...

So, what's their real purpose? Why wasn't Russia included? How does this idiocy end?; Also: Good news for voters from GOP-appointed federal judges in PA, TX...

Who coulda foreseen it? Oh, yeah. Everybody in the world other than the idiot who did it and his weird cult followers working desperately to justify it today. As you might expect, we've got a lot to try and make sense of on today's BradCast. [Audio link to full show follows this very brief summary.]

So, Donald Trump pulled the trigger during his rambling "Liberation Day" remarks in the White House Rose Garden, just after the close of markets on Wednesday. The trade tariffs would be slapped on virtually every country in the world and would be, as one tech investment manager described it just after the announcement, "worse than the worst case scenario."

Today, Wall Street reacted. Poorly. The Dow fell over a cliff by more than 1,600 points. The S&P 500 plunged nearly five percent. The tech-heavy NASDAQ plummeted almost six percent. That's what happens when 54% tariff on China suggest that your next iPhone may soon cost $2,300. (The price of Apple stock crashed by nearly ten percent). In all, today amounted to the biggest nosedive for the markets since the mishandling of the COVID pandemic in 2020...the last time this idiot was in the White House.

Nobel Prize-winning economist Paul Krugman asserted that Trump's numbers announced on Wednesday included "false claims about our trading partners" and simply make no sense, suggesting he's "gone full-on crazy." Though, no matter how many times reality and facts are likely to be pointed out to him --- that we are not, for example, "subsidizing Canada by $200 billion a year" --- he "will never drop that claim."

Trump's made-man and Senior Trade Advisor Pete Navarro, fresh out of prison, defended the tariffs, claiming they will raise $6 trillion in revenue for the U.S. over the next ten years. They won't. But if they did, that would amount to a new 25% tax on American consumers, the largest tax hike in U.S. history, since U.S. consumers, not foreign governments, will be paying higher prices to cover the huge new import taxes on just about everything.

Trump's new taxes are likely to result, as well, in reciprocal tariffs from virtually every nation in the world against the U.S. Every nation in the world, that is, except Russia, which was curiously left off the list of newly sanctioned nations for some odd reason.

But, as our friend David Dayen, investigative financial journalist, author and Executive Editor of The American Prospect explained on this program last year, these tariffs are better seen as a means by which Trump hopes to bend companies, industries and, yes, entire foreign governments, to his will. "Look at these tariff threats more as like sanctions," Dayen told us in early December. "'If you do things we don't like, you're going to get higher tariffs.' That's not really about trade policy. That's really about doing what the United States says. It's really about policing the world through economic terms."

"Businesses are going to come to this President and say, 'Give me a waiver from your tariff.' The mind boggles at the potential for corruption here," Dayen said at the time. "This is what oligarchies look like. This is what Russia looks like. If you're closer to the king, you're going to do better."

"He wants to use tariffs and, more generally, the role of the United States as an economic hegemony, to bully other countries to do our bidding," Dayen foretold, in what now appears to be exactly what Trump is doing. He reiterated and added to some of those thoughts at TAP today. "Stop trying to place coherence on a policy that’s really just a mob boss breaking legs and asking for protection money."

Sen. Chris Murphy (D-CT) smartly explained it in very similar terms last night in a social media thread. "Those trying to understand the tariffs as economic policy are dangerously naive," Murphy argued, citing how "British kings used taxation to reward loyalty and punish dissent. ... The tariffs are a tool to collapse our democracy. A means to compel loyalty from every business that will need to petition Trump for relief."

But there is a way out. There is a way to end this madness. Trump only enjoys the unilateral power to issue economy-killing, job-crushing, 401k-flattening sanctions because Congress gave him that power. They can also take it away. There was an attempt by every Democrat and a handful of Republicans in the U.S. Senate yesterday to do exactly that, when it came to sanctions against Canada. The measure was successfully adopted by the Senate, but is unlikely to receive a vote in the U.S. House, where it would likely also be adopted if members were allowed to vote on it. So, Speaker Mike Johnson will make sure they can't.

With all of that in mind, "these tariffs won't stand," writes Josh Marshall at TPM today. Anyone running for Congress or thinking of doing so has all they now need to take down any Republican who would support this insanity --- and the harm it is now causing to their own constituents. "It’s malpractice for anyone challenging a Republican member of Congress not to be on this today," he detailed this morning.

So, yeah. Once again, it all comes down to democracy and elections. To that end, a Trump-appointed federal judge in Pennsylvania this week ruled in favor of voters, believe it or not. And a George W. Bush-appointed federal judge in Texas did the same thing late last month. We break down both rulings today before Desi Doyen joins us to close with our latest Green News Report, including a bit of bad news for the coal industry, thanks to good news from voters in Illinois this week as, once again, still more evidence that, yes, elections matter!...

Guest: Climate Analyst Matt Sedlar; Also: Splashdown in the 'Gulf of America'; More Trump court losses; And why giving up isn't an option...

Earlier this month, Donald Trump issued an Executive Order calling for the "Immediate Expansion of American Timber Production". As discussed with our guest on today's BradCast, it's difficult to see that separately from his buddy Elon Musk's recent declaration that "logically we should privatize anything that can reasonably be privatized." [Audio link to full show follows this summary.]

BUT FIRST... A few items of note...

  • It was amusing watching corporate media outlets tip-toe in their reporting around the facts of Tuesday's successful return to Earth by astronauts Suni Williams and Butch Wilmore after being stranded on the International Space Station for 9 months following what was supposed to have been an 8 day mission. The pair were safely brought home in a SpaceX capsule that splashed down in the Gulf of Mexico. Can you see the dilemma for the nation's major news outlets yet? We discuss. And laugh. (And also point out that the mission was tasked to Elon Musk's SpaceX by NASA last August, under President Joe Biden. No, Donald Trump did not "rescue the astronauts", as his Administration seems to want you to believe.)
  • In more important news, after covering a string of losses in federal court for Trump on yesterday's program, a few more came in after we got off air. One was a major ruling that blocked his Order banning transgender people from serving in our nation's military. (Try not to laugh at Trump's straight-faced assertion in his EO that service by transgender people, many of whom have received top military honors, "conflicts with a soldier’s commitment to an honorable, truthful, and disciplined lifestyle, even in one’s personal life." Cuz if anyone knows about living an honorable, truthful, and disciplined lifestyle, even in one’s personal life, it would be the Commander-in-Chief who was found liable for nearly $100 million for sexually abusing and defaming writer E. Jean Caroll and found guilty of 34 criminal felony counts related to hush-money payments to porn star Stormy Daniels to help him cheat to win an election and other honorable, truthful and disciplined living by Corporal Bonespurs.)
  • In response to yesterday's program focused, in part, on the lower courts holding firm, for now, against Trump and Musk's rampant lawlessness, we received some interesting feedback from a number of listeners who seemed to view those victories for the Constitution and Rule of Law --- short-term or otherwise --- as hardly worth celebrating, given that all hope is now lost and, in short, America is all but over. While understanding the sentiment, I disagree with that thinking for several reasons, a number of which we discuss today.

THEN... Following news of yet another court loss for Trump late on Tuesday, in which a D.C. U.S. District Court Judge Tanya Chutkan blocked the Administration's attempt to claw back some $20 billion authorized by Congress and allocated by President Biden as part of his landmark climate initiatives before leaving office, we discuss a recent Executive Order signed by Trump that would massively expand logging and clear-cutting of our national forests and other public lands.

MATT SEDLAR, climate analyst at the Center for Economic and Policy Research, is here to discuss what this scheme is really about; how it relates to Trump's trade war with Canada; the various dangers it poses to both the economy and climate; and how it has little to do with improving forest management or wildfire protection, as Trump's EO falsely claims.

Sedlar explains how the Order appears to directly contradict pretty much everything else that Trump has been doing at the very same time.

"Laying off Forest Service workers, National Park Service workers, and putting out this Executive Order expanding logging, canceling leases for various offices and visitor centers for national parks across the United States," Sedlar tells me, "all point to the privatization of the public lands. Eliminating what we know of as national forests and national parks, and opening it up to making it into a revenue stream."

"It leans more towards that and less towards what he is saying, that this is forest management. Because the science simply does not support what he's saying. It didn't support it in the '80s when you had researchers and scientists warning against it, and it's definitely not going to support it now."

"These are all moves to generate revenue without a look at how this affecting long-term sustainable development. It's all short-term gain for long-term losses," he argues, citing both the costs to the fight against climate change and the bipartisan popularity of our National Parks and Forests.

I've gotta be quick with today's BradCast summary, as Trump's first address during his second term to a joint session of Congress is coming up shortly. And I don't want to miss a single lie! (Full coverage tomorrow, natch). [Audio link to full show follows this summary.]

But the central theme of today's show: Donald Trump is bad for business. He has no clue how to run a business, much less a country, which should decidedly not be run as a business. They are two very different things. But even on his own terms, Trump is lousy at running the country as a business.

Among our many stories today underscoring those points in various ways....

  • Today, Trump's 25% tariffs against our two largest trading partners and friends, Canada and Mexico, kicked in, earning blowback from the otherwise even-tempered and very polite Canadian Prime Minister Justin Trudeau. And, again, the U.S. stock market took another dive in response to Trump's "dumb" trade war, wiping out all gains since the election on the major indexes, thanks to Trump being lousy at his job.
  • Among Trump's biggest supporters last November were farmers. Now, they too, are beginning to notice what a clown he is, after the Trump Administration began wiping all climate related data from the U.S. Dept. of Agriculture website (cuz climate change doesn't exist if you delete website references to it), along with information on programs regarding grants and subsidies for farmers. All of which they rely on, especially as the Summer growing season is set to begin. A group of farmer's and environmental groups have now filed suit against Trump's USDA, demanding the returns of the databases and tools (that we paid for, before Trump thought it made good "business sense" to waste all of those tax-payer dollars.)
  • Cuts and mass layoffs at our beloved National Parks, in advance of the busy Summer tourist season, aren't going over much better with the public --- or the crucial staffers who keep the parks open and clean and some 375 million visitors a year safe. About 4,000 workers at both National Parks and U.S. Forests have now been laid off for specious, and potentially unlawful, reason. People will die because of these pointless cuts. Park experts believe it may take centuries to rebound from the damage to the parks these cuts will cost.
  • But what about all of that "waste, fraud and abuse" that Elon Musk and his DOGE Bros are telling us they are axing within federal government agencies? More than$100 billion, Musk is now claiming! Last week, we detailed how the DOGErs quietly deleted billions of dollars in claimed "savings" from their so-called "Wall of Receipts" website, documenting government contracts they'd cancelled at agency after agency. It turned out their "receipts", numbers and claims to go with them were riddled with errors. Last week, they had claimed to have "saved" American tax-payers some $65 billion. But thanks to excellent reporting by a number of outlets, it appeared the number was closer to just over $2 billion at best. The buffoonery continued over the weekend, however, as the Bros once again quietly removed still more false items --- about 1,000 of them! --- and replaced them with others again. You'll be stunned to learn the largest of those new "receipts", as well, are also riddled with errors and false claims.
  • This week we are "celebrating" --- if that's the right word for it --- our 16th Anniversary of connecting the climate change dots over your public airwaves in our world famous Green News Report. We have been producing it, week in and week out, over all these years, of course, thanks only to support from readers and listeners like you! Today, in our latest GNR, Desi Doyen has news on Trump's funding freezes crippling the nation's farmers; climate-fueled wildfires exploding in the Carolinas; and mass layoffs now underway at NOAA and the National Weather Service...
  • Finally, since Trump is so bad at both business and diplomacy, even a major oil company, Norway's Haltbakk Bunkers, is now refusing to fuel up U.S. Naval vessels in protest of Trump's disgraceful treatment of Ukrainian President Volodymyr Zelenskyy at the White House last Friday. "We have today been witnesses to the biggest shitshow ever presented 'live on tv' by the current American president and his vice president," the company posted to social media shortly after. "Huge credit to the president of Ukraine restraining himself and for keeping calm even though USA put on a backstabbing tv show. It made us sick. Short and sweet. As a result, we have decided to immediate STOP as fuel provider to American forces in Norway and their ships calling Norwegian ports. ... 'No Fuel to Americans!' ... We encourage all Norwegians and Europeans to follow our example. SLAVA UKRAINA".

Running the government "like a business" is working out great! Welcome to "America's Golden Age"!...

Unlawful Trump political firings at DOJ, FBI; Critical CDC databases gone; USAID offices taken over, shut down, employees locked out; Musk takes over Treasury Dept. payment system for entire U.S...

With apologies to Rick Wilson, whose weekend social media quip I've stolen for the headline of today's BradCast, I'd say both things are true. We are both overwhelmed and under attack. In a way that the United States has never been under attack before. [Audio link to full show follows below this summary.]

The "attack", of course, is coming from inside the house. In this case, from inside Donald Trump's White House. Or, at least from his extra-Constitutional White House henchmen: Elon Musk and his band of personal employees, none of who have been elected to anything or approved by the U.S. Senate or anything else. And yet, this band of miscreants that call themselves the "Dept. of Government Efficiency" or DOGE, some just literally out of high school, are unlawfully taking over the command and control functions of independent federal agencies in the Executive Branch, including the one that at Treasury that controls the nation's actual checkbook and its payments of more than $6 trillion each year. That system includes checks to federal workers, Social Security and Medicare payments, tax refunds, foreign aid and much much more.

They are doing all of this, apparently, with the lawless President's blessing. It is a Trump-approved attack on the rule of law, our Constitutional order, and, of course (the enemy of all MAGA!) the "Administrative State".

Doing my best today to overcome some local transmitter issues here in L.A. and technical issues inside our flagship local KPFK studios during our live show, I tried to put into stark perspective what appears to be unfolding --- what we know and what we don't, some of the heroes standing up in opposition --- over the past 72 or so unprecedented hours since we last spoke.

Here are just some of the media reports I was culling from. You'll have to tune in to hear how all the pieces fit together, what they portend moving forward, and for a quick listener call or two at the end...

Guest: Author, financial journalist David Dayen of The American Prospect; Also: Final U.S. House seat called in CA, flips from 'red' to 'blue'; '2000 Mules' filmmaker apologizes for film's fraudulent 'fraud' claims...

As detailed on today's BradCast, the avenues for massive corruption by the incoming Trump Administration are, shamefully, only beginning to come into view. The fact that our corporate media so utterly failed to make such possibilities clear --- or even to simply explain to the electorate what tariffs actually are and how they actually work --- is just one more indictment that we will spend decades paying the price for. [Audio link to full show follows this summary.]

FIRST UP... The final uncalled seat for the U.S. House in the next Congress, following the November 5th election, has finally been called. Republican Rep. John Duarte conceded on Tuesday night to Democrat Adam Gray in California's 13th Congressional district. It was the closest race in the House this year. As of air time, just 187 votes separate the two out of more than 210,000 cast, as Dems flipped a third seat in the Golden State this year. That leaves Republicans with one of the slimmest House majorities in history, holding just 220 seats to Dems' 215. That said, with the resignation of Matt Gaetz, and two other GOP members set to step down if confirmed to be in Trump's cabinet, the margin for passage of any of his legislative agenda may be in question in the lower chamber in the early part of next year. Just one or two defectors, or members who are out sick, could make it impossible for Republicans to get anything through the House.

THEN... We've debunked the long-ago, many times discredited 2000 Mules film --- supposedly documenting massive fraud by Democrats to steal the 2020 election from Donald Trump --- over and over again in the past several years. Both state and federal law enforcement authorities have done so as well. Even the publisher and distributor of the documentary film and its companion book have pulled both from distribution and offered an apology. This week, so did the fraudulent film's director and rightwing pundit Dinesh D'Souza. He issued an apology to one of the people seen on surveillance video in the film, which claimed the man was committing a "crime" by depositing "fraudulent votes" into a drop-box near Atlanta in 2020. In fact, the man was dropping off his own ballot, his wife's and those of his adult children who lived with him --- all perfectly legal in Georgia. In his apology, D'Souza (who was pardoned for his own ACTUAL election fraud crimes by Trump!) appears to blame his partners on the film, a long-ago discredited GOP "voter fraud" fraudster group called True the Vote, for misleading him about the footage they supplied for his use in the film.

FINALLY... Donald Trump has been vowing for the past year or more on the campaign trail to institute massive trade tariffs on foreign nations of anywhere from 10% to 1000% depending on his mood on any given day at any given event. He has also, for years, been lying to the American public about tariffs, claiming they are paid by the nation whose products are taxed upon import into the U.S. In fact, as our guest today explains, they are almost always paid by the consumer in some fashion and are likely to inflate prices to boot.

We're joined today by DAVID DAYEN, investigative financial journalist, award-winning author and Executive Editor of The American Prospect magazine. He offers both a primer on how tariffs actually work (and/or don't), and how Trump plans to use them to muscle concessions and favors from other nations, beginning with Mexico, Canada and China, our three largest trading partners from whom we import some $1 trillion worth of goods each year.

"The heyday of tariffs was the 1890s," Dayen explains. "But the way that Trump is going about it, you've got to think of these tariffs as more like economic sanctions." Sanctions that could come back to bite the U.S. via a trade war if those nations decide to slap their own tariffs on our goods in return.

Trump has claimed that his recently promised 25% tariffs on Mexico and Canada, and new tariffs of 10% on goods from China are meant to stop the "invasion" of migrants and drugs into the U.S. But that explanation, charges Dayen, is dubious at best. They are more likely intended as "simply leverage" in advance of renegotiations of the USMCA, the slightly modified replacement for the NAFTA trade treaty that was struck between U.S., Mexico and Canada during Trump's first term.

But, as Dayen reported at The Prospect last week, "there's a second piece to Trump's tariff strategy" that involves corporate importers and exporters, rather than nations. That, as he explains today, is where Trump's ability to give away tariff waivers is set to be a wildly lucrative scheme that will open the door to perhaps unprecedented corruption and payoffs from corporate interests hoping to avoid the economic pain of tariffed goods.

In his explanation, Dayen cites the famous "Cantillon Effect" which "comes down to whoever is closer to power is going to have better success in business." And now, between Trump's hotels and publicly-traded social media company and, perhaps most disturbingly, his new cryptocurrency venture --- (which a Chinese entrepreneur currently under SEC investigation for fraud, market manipulation and other violations of U.S. law just dropped $30 million into, three weeks after the election) --- it is going to be open season to buy favors and favoritism galore from the new President.

"This is what oligarchies look like," says Dayen. "This is what Russia looks like. If you're closer to the king, you're going to do better. The next four years are going to reflect this tendency."

And, yes, as he argues today, "the mind boggles at the potential for corruption"...

Dismantling pharmaceutical monopolies begins with repealing his 1987 Executive Order giveaway...

We should be both relieved and outraged!

Relieved that, earlier this month, the Center for Disease Control (CDC) and Food & Drug Administration (FDA) approved a new round of booster shots specifically re-designed to address new variants of the deadly COVID virus.

Outraged because, despite the expenditure of tens of billions of U.S. taxpayer dollars on research and development (R&D), the pharmaceutical industry's refusal to waive its "gifted" patent rights prevented a global rollout of the COVID vaccines. In turn, that refusal resulted in the need for the new booster shots.

Outraged because the industry's refusal to waive their patent rights has produced "excess mortality" with COVID that, as of the beginning of this month, has killed at least 6.5 million people worldwide, with no end in sight.

Outraged because this will, in all likelihood, not be the last newly reconstituted booster shot needed. It is the considered opinion of two thirds of the world's epidemiologists that the failure to provide global vaccinations will give rise to mutations that "could render current COVID vaccines ineffective."

And, yes, the patent rights were, indeed, a gift --- from the United States to the Pharmaceutical Industry...

Newsom makes good on vow to manufacture generic drugs, highlighting Big Pharma's long manipulation of Intellectual Property laws for profit...

The state of California is embarking on a ground-breaking effort to manufacture and distribute a life-saving drug. The plan also deals a first major blow to private pharmaceutical companies that have long abused the nation's legal system for profit at the expense of the health of the citizenry.

"On my first day in office I signed an Executive Order to put California on a path towards creating our own prescription drugs," Democratic Governor Gavin Newsom declared in a July 7 video posted to Twitter, referencing his inauguration promise in January of 2019. "And now it's happening".

Newsom's statement came in the wake of his approval of a Golden State Budget Proposal that will invest $50 million into development and $50 million more into a State-owned facility that will manufacture and distribute generic (aka biosimilar) insulin to Californians at slightly above cost.

If it succeeds, California, which has the world's 5th largest economy, will not only become the first State, but also the only government, other than Cuba, to embrace the socialized production of generic medications. (Although Cuba develops and manufactures its own generic medications and provides free "preventative medical care, diagnostic tests and medications for hospitalized patients", Pharmacy Times reported, "Cubans pay out-of-pocket for outpatient medications.")

California's progressive Democratic Governor pointed to the extraordinarily high cost of insulin as a form of "market failure" that justifies his embrace of socialized medications. His decision to allow the Golden State to produce its own generic insulin also highlights the immoral manipulation of the nation's patent laws by for-profit drug companies...
