On today's BradCast we're hoping to help you get acclimated to the tsunami of "fraud" claims --- both real and fake, and what they mean and don't --- that are most likely about to come our way over the next few days and weeks...at least if Donald Trump loses to Kamala Harris in 2024 as he did to Joe Biden in 2020. [Audio link to full show follows this summary.]

Pardon us, however, for beginning with a brief victory lap following our L.A. Dodgers' big World Series win last night, and a related sidebar as to what history tells us (or doesn't) about who is going to win the Presidential election based on who won the World Series.

Then, as to the coming "fraud" storm...among the many stories cited along the way today...

• A Minnesota woman this week was charged with three felony counts of voter fraud after forging her dead mother's signature on an absentee ballot to vote for Donald Trump.

• Six people were charged over the summer for submitting nearly two dozen fraudulent absentee ballots on behalf of a Republican City Council candidate in New York. How they got away with it and how they got caught. The candidate's 19-year old daughter was among those charged.

• In the battleground state of Michigan, election officials in August indicted four voters who allegedly voted twice --- first by absentee and then again at the polls --- in the state's Presidential primary earlier this year. Once again, as in all of these cases, they were caught and charged thanks to safe-guards built into the system. Of the more than 11.7 million votes cast in the state over the past several elections, according to Michigan's State Auditor General, 99.99% of ballots cast were NOT from double voters.

• In Mesa County, Colorado this week, officials announced they blocked an effort in the very Republican-leaning county to cast about a dozen absentee ballots, apparently stolen out of mailboxes in the Vote-by-Mail state. The state's signature-matching procedures uncovered the fraud scheme, though three fraudulent ballots slipped through the system before the crime was discovered. Mesa is the same county where former County Clerk, Tina Peters, was earlier this month sentenced to 9 years in prison on felony charges related to helping her MAGA friends break into the County's voting systems in the middle of the night after the 2020 election to copy proprietary software and distribute it across the Internet to other Trump supporters.

• Last month we reported on the story out of Arizona where both the RNC and the state Republican Party went to court to argue against the removal of some 98,000 voters from the state voting rolls who, due to a years-old glitch in Maricopa County's voter database, had no record of presenting Proof of Citizenship with their registrations, as required by state law. In that case, Republicans opposed the systematic voter purge that the state's Democratic Sec. of State didn't want to do, but felt he had to under state law. The Republicans correctly argued to the AZ Supreme Court that such purges, within 90-days of an election, were in violation of federal law. They made that argument after the SoS revealed that the majority of the potentially "non-citizen" voters to be removed were registered Republicans.

  Yet, this week, on Wednesday in Virginia, after a U.S. District Court Judge and federal Appeals Court last week blocked an attempt by the state's Republican Governor to purge some 1,600 registered voters under the premise that some might be non-citizens, the corrupted Republican U.S. Supreme Court majority allowed the unlawful systematic purge, ordered by Gov. Glenn Youngkin, to move forward. All three Democratic-appointed SCOTUS Justices dissented. One of the purged Virginians, a U.S. citizen who has lived there her entire life, called it "a very bad October surprise."

All of these stories today help us understand the difference between real and fake fraud claims; the difference between voter fraud and election fraud; how easily most such penny-ante fraud is caught and often prevented before it happens; and how Republicans this year, from Donald Trump on down through his minions and back up through his corrupted SCOTUS, are hoping to use phony or exaggerated fraud claims to help sow the seeds to steal the election, if necessary, as of Tuesday night.

Get ready! Because that is coming --- if Harris is declared the winner.

Finally, Desi Doyen joins us for our latest Green News Report, with horrific "welcome to the future" news out of Spain this week, where extreme drought was followed up with a year's worth of rain and deadly flash flooding this week that swept through one town in a matter of hours, killing more than 150 so far; and some words of warning about Tuesday's election from Sen. Today on The BradCast: Bad news from the DC Court of Appeals for the disgraced former President, though things could get much worse this week depending on how things go at SCOTUS on Thursday. [Audio link to full program follows this summary.]

Among our stories today...

• The unrelenting downpour in Southern California continues for a third straight day, as Los Angeles alone reports more than 300 mudslides since the atmospheric river began pouring in on Sunday, resulting in continuing flash flooding and evacuations throughout the region. Thankfully, there have been no deaths or major catastrophes yet reported, though three were killed in Northern California where strong winds toppled trees as the storm blew ashore on Sunday. It's not yet over, but we're told the sun may finally reappear again in SoCal, at least for a time, on Wednesday.

• Today was the last day to vote in Nevada's all vote-by-mail 2024 Presidential primaries, though few may have bothered. On the Democratic side, President Biden faces little or no competition. On the Republican side, Donald Trump helped rigged the state in his favor with the help of NV state party officials. He's not on the NV Primary ballot, since he objected to the all-mail process created by the state. He demanded caucuses instead. So Nikki Haley will be on the primary ballot, but Trump won't. While Haley won't be participating in the Thursday caucuses, but Trump will. Republican Delegates, however, will only be awarded to the winner of the rigged GOP Caucuses.

• Welp, it took nearly a month, but a three-judge panel on the D.C. Court of Appeals finally released their long-awaited ruling on whether Presidents have immunity against any and all criminal charges for crimes they carry out while serving as President. That is what the four-time indicted former President is arguing. And, to the shock of pretty much nobody, the court ruled in a unanimous, very thorough 57-page decision [PDF] today, that, nope, a President may not avoid criminal consequences for, by way of an example Donald Trump's attorney defended in court last month, ordering Seal Team 6 to murder a political rival. While the ruling was not surprising, it was successful for Trump, at least in part, by delaying his previously scheduled March 4th federal trial on four felony counts [PDF] related to his many attempts to steal the 2020 election. The D.C. panel struck down every single argument made by Trump and ordered the case to be returned to the trial court unless the defendant appeals the ruling to SCOTUS by Monday. Of course he will. The only question for the moment is: will there be enough votes at the corrupted rightwing SCOTUS to bother even hearing this dumb case.

• Then, we're joined by BRAD BLOG's longtime legal contributor ERNEST A. CANNING to discuss both today's Immunity ruling and the arguably far more consequential matter that will be heard by the U.S. Supreme Court on Thursday. The Supremes will hear oral argument for and against the case for disqualifying Donald J. Trump from the ballot under Section 3 of the 14th Amendment, the "Insurrectionist Disqualification Clause". The specific case, Trump v. Anderson, is named for the 91-year old Republican, Norma Anderson, who is one of six Republican and independent voters that sued under 14.3 in the state of Colorado to bar Trump from the state's Presidential ballot. They were successful. The CO Supreme Court barred Trump in a very well argued (and very conservative) ruling [PDF] late last year, pending a decision from SCOTUS. In the month since the Justices agreed to hear the case, as Canning writes this week, no fewer than 50 amici (friend of the court) briefs have been filed both for and against the Constitution's post-Civil War ban on insurrectionists serving in public office.

  Canning cites several key points offered in the various briefs from a host of scholars and experts, and we preview the questions likely to be up for debate during this Thursday's landmark hearing. The eventual opinion issued by SCOTUS could determine whether Trump is barred from the Presidential ballot in all 50 states. And what might happen then?

  Canning argues that if you follow conservative "textualist" and "originalist" doctrine, "what the intent was, what the actual language was" by the framers of the 14th Amendment, "there's no way you can come to a decision other than the fact that Donald Trump is disqualified within the meaning of the statute."

  That largely matches conventional wisdom suggesting the Constitutional case for banning Trump from office is pretty rock solid legally. Nonetheless, most of those media pundits and legal experts also tend to argue that the former President's friends and appointees on the High Court are likely to conjure up some sort of jiggery-pokery and pure applesauce to allow him to remain on the ballot this year anyway. "That could very well happen here," Canning tells me, before adding: "But I wouldn't bet the farm either direction."

We're back live on today's BradCast after a much-needed holiday stand down last week, even as the world registered its hottest day on record...four different times on four consecutive days. Other than that, did we miss anything? [Audio link to full show follows this summary.]

The globe is broiling, but it's also flooding for the same reason. Our climate is in crisis. From the U.S. to Canada to Spain to India and China, just to name a few of the "hot spots" over just the past 24 to 48 hours or so. And, in case your other news sources forgot to tell you, it's all our fault. Or, at least the fault of the fossil fuel industry and the politicians and dupes they've bought off over the decades to hoax you into believing that our climate crisis itself is a hoax. It isn't. And, based on the mind-warping records being shattered across Planet Earth right now --- with little hope of cooling any time soon --- a case can be made that if we haven't hit a few disastrous, point-of-no-return tipping points by now, we are certainly on the verge.

Climate warming greenhouse gas emissions, mostly from the burning of fossil fuels, continue to increase along with smashed heat records. Is it too late to do anything about it?

Longtime climate and energy reporter ANDREW FREEDMAN of Axios joins us today to discuss the mind-blowing records now being shattered by the day, who should be held accountable for it (including those in the media), and if it is or isn't too late for humanity to take action to reverse course

When I ask Freedman if it's hard to wrap his head around all that now seems to be going on in the climate, even after so many years of warning folks that this would be, he tells me, "It is. While my expectations might have been for some of these records, everything everywhere all at once is how it feels right now. It feels that way as a reporter, it feels that way as just a person on Earth."

"The global records weren't something I was expecting to jump out this early in July. The peak is usually later in July," he explains. "It's pretty much a done deal that July will be the hottest July on record, and most likely the hottest month that we've seen since records began." The news he has for the rest of the year, and for next year, isn't much better.

He's got a lot more to say. He's been writing a lot about this of late for some reason.

Then, with an invitation for a "Reverse BradCast" --- where listeners call in to tell me what they think I need to know, and I get to tell them they are wrong about it --- most of our callers today wanted to talk about the climate instead for some reason. And that's probably a very good thing.

As Freedman notes today, citing climate scientist Katharine Hayhoe, "Her appeal to people is to say, 'The most powerful thing that you can do about climate change is to have a conversation with somebody about it.' We need to be talking about it more. All these things actually have an impact. It's not just 'Oh well, we're screwed.' It's hard not to think that way. It's hard for me and other climate reporters. But there are a ton of solutions. The question is are we going fast enough?"

So far, the answer, according to most scientists?: No. We absolutely aren't. That can still change. But only if we keep talking about it to everyone who will listen...and even those who don't want to...

Among our many stories...

• It was difficult to notice this week, but there was yet another very good election day on Tuesday for non-Rightwingers, including more bad news for MAGA World in several local contests around the country. In Lincoln, Nebraska, incumbent Mayor Leirion Gaylor Baird, supported by Democrats, defeated a well-funded opponent supported by the state's billionaire Republican U.S. Senator (and former Governor) Pete Ricketts and fellow billionaire publisher Thomas Peed. Gaylor Baird won by nearly 10 points. Apparently, ads describing Lincoln, the state capital, as a dystopian hellhole did not go over well with voters...in Lincoln.

• A MAGA election conspiracist and local elections clerk named Stephanie Scott (pictured above), was tossed out of her job in a rare recall election on Tuesday in Adams Township, Michigan in Hillsdale County, one of the state's most Republican-leaning areas. Scott is under state criminal investigation after refusing to turn over her town's computer vote tabulator in 2021, which she believed held evidence of fraud revealing Democrats had stolen the state's Presidential election in 2020. That, in a town that Trump/Pence won with 75% of the vote that year. (If the story sounds familiar, see Tina Peters, former Mesa County, Colorado Clerk, who has since been tossed out of her job and indicted on 10 counts.) This appears to be part of the multi-state MAGA conspiracy to breach voting systems, hatched at the Trump White House in December 2020, as we detailed again last week. Scott was defeated by a 2 to 1 margin on Tuesday by an independent challenger running on the slogan "Make Adams Township Boring Again".

• But, if ya can't beat 'em, suppress their vote! That seems to be the Republican plan for "winning" elections from here on out, apparently. After losing statewide ballot initiatives that would have restricted abortion rights last year, including in so-called "red" states like Kansas and Kentucky, the GOP is now hoping to game the ballot initiative process itself in several states. The most immediate and noteworthy is Ohio, where supporters of reproductive freedom hope to place an initiative on the ballot in November to establish a state Constitutional right to abortion. But Republicans, who just four months ago adopted a statute ending costly August elections, are now moving to place an amendment on the ballot in a $20 million Special Election in August that would raise the requirement for adoption of Constitutional Amendments from a simple majority vote to a required 60% for passage. (Ironically, the GOP lawmakers own Amendment, if voted on in August, would only require 50% to be adopted.) Other gerrymandered GOP states are now attempted to do the same thing, including Missouri, where Republican lawmakers there are doing something arguably even more insidious in their own attempt to fool voters into supporting their anti-democracy measure.

• And then there's Florida, where democracy goes to die. The state legislature has just passed a one of their final gifts to beleaguered Presidential hopeful Ron DeSantis: a 96-page law that will, among other things, severely restrict voter registration by nonpartisan third-party organizations. As recent research finds, Black and Latino voters are more than five times more likely to be registered by third-party groups than White voters. DeSantis is expected to sign the legislation soon as one of his last official acts before declaring his 2024 candidacy. It will be the third year in a row that Sunshine State Republicans have adopted new voting restrictions.

• A D.C. jury on Thursday convicted four members of the far-right, racist militia group, Proud Boys, of seditious conspiracy, obstructing an official proceeding, conspiring to impede Congress from performing its duties, obstructing law enforcement and other federal crimes related to their participation in Donald Trump's Jan. 6, 2021 insurrection at the U.S. Capitol. The charges for conspiracy and obstruction of an official proceeding both carry sentences of up to 20 years in prison. Their former leader, like Donald Trump, was not even at the Capitol during the riot, but was among those found guilty. All of that good news is likely very bad news for the former President and the specific federal charges likely to soon be brought against him.

• In still more bad news for Trump today, his lawsuit against the New York Times and several of their reporters, charging an "insidious plot" to obtain his tax records resulting in Pulitzer Prize-winning reporting by the paper, was tossed out by a New York judge on Wednesday. Moreover, the judge --- finding Trump's claims "fail as a matter of constitutional law" and that the paper's newsgathering efforts were "the very core of protected First Amendment activity" --- ordered Trump to pay all of the attorneys fees, legal expenses and other associated costs for the Times and their reporters.

• ProPublica strikes again. First they revealed that GOP megadonor Harlan Crow showered U.S. Supreme Court Justice Clarence Thomas for decades with hundreds of thousands of dollars in luxury vacations which he unlawfully failed to disclose. Then they reported that Crow had actually purchased Thomas' mother's house from him, made nearly $40,000 worth of improvements to it, and has allowed the corrupt Justices mom in it, rent-free, ever since. None of that was ever disclosed by Thomas either, in violation of the law. And now, on Wednesday, they did it again. Their latest bombshell scoop documents how Crow's company paid for years of tuition to private schools for Thomas' grandnephew who the nation's longest serving Justice says he raised "as a son" since taking legal custody at the age of 6. The tuition for the boy, now in his 30s, amounted to approximately $100,000. Congressional Republicans continue to applaud the unspeakably corrupt Thomas.

It was a very hot BradCast today --- in most every way you might imagine. [Audio link to full show follows this summary.]

This week, a billion or so in China are suffering under record extreme heat and humidity. The death toll from relentless record heat, drought and wildfires in Portugal and Spain has now topped 1,000, as the heat spreads to France and the rest of Europe where Ireland and the U.K. are likely to see triple digit temperatures and a red flag extreme heat advisory for the first time.

Here in the states, as AccuWeather reports, sweltering highs approaching 110 degrees Fahrenheit will continue as temperatures "reach their highest levels of the year so far from Rapid City, South Dakota, to Wichita, Kansas, as well as Oklahoma City and Dallas" and everywhere in between. Electric grids, particular in Texas, are under extraordinary stress (the power went out during a Houston TV station's live weather forecast, as they warned of possible power outages) with little immediate relief in sight.

Apocalyptic conditions are now being experienced across the globe thanks to a climate crisis caused by the burning of fossil fuels. That, even as the corrupt, U.S. Supreme Court at the end of last month made up a pretend "doctrine" (the "major questions doctrine", found nowhere in the Constitution or American case law) to bar the EPA from regulating carbon emissions, as mandated by federal statute in the Clean Air Act.

At the same time, corrupt, fossil fuel industry-funded "Democratic" Senator Joe Manchin continues to undermine any and all environmental initiatives agreed to by every Democrat in the U.S. House and all but him (and, to a slightly lesser extent, corrupt AZ Democratic Sen. Kirsten Sinema) in the Senate, designed to curb deadly greenhouse gas emissions.

In short, as Sen. Bernie Sanders made clear over the weekend, Manchin --- whose family literally makes millions from the coal industry, and whose campaign takes in millions from the fossil fuel industry --- "has sabotaged the President's agenda" as our existential climate crisis quickly worsens.

Manchin and all 50 Republican Senators in the upper chamber and every single Republican in the U.S. House continue to prevent Democrats from all efforts designed to save humanity. But, somehow, to some on the Left, it is the fault of Democrats?! And it is Democrats who may be voted out of their majorities in both chambers this November? Really?! What gives?

We open the phones today to some of those very questions, as there are a whole bunch of folks calling themselves progressives out there who are, somehow, blaming Democrats for this mess and many others. I don't relish saying "I told ya so" on The BradCast. But, in today's lead story, unfortunately, I have to yet again. [Audio link to full show follows this summary.]

Among the news stories covered on today's program...

• We've been telling you for months that West Virginia's corrupt Democratic U.S. Senator Joe Manchin --- whose family makes millions from the coal industry and campaign rakes in millions from the fossil fuel industry --- never had any intention of allowing any environmental measures to pass that might actually help reduce the deadly emissions that are causing our climate crisis. Nonetheless, his fellow Democrats and corporate media, like Charlie Brown, seem to keep buying his BS claims that he really really wants to adopt environmental provisions and raise taxes on the wealthy to help pay for them. After months of more pretend negotiations, Lucy pulled the football away from Charlie Brown yet again on Thursday night.

• Gas prices are finally falling. Will Joe Biden get credit for that, since he was inappropriately blamed for Big Oil's record profits from war profiteering and price gouging? (Which all Republicans in Congress refused to outlaw recently?)

• Texas' privatized, unregulated electric grid is on the brink of collapse yet again, thanks to record heat (which is thanks to a fossil fuel industry-sponsored climate crisis that all Republicans and Democrat Joe Manchin refuse to do anything about.) Will Lone Star State voters this November finally figure out who is to blame for the outages --- and hundreds of deaths that continue to come with them --- during both extreme heat and cold in the state?

• Oh, look! The Secret Service seem to have accidentally erased all of their text messages from January 5 and 6, 2021, even after the Dept. of Homeland Security's Office of Inspector General asked to see them. Luckily, not much happened over those days that the American people would very much like to know about.

• Oh, look! A D.C. Metropolitan Police Officer has reportedly testified to the bipartisan U.S. House Select Committee investigating the January 6, 2021 insurrection and Donald Trump's other attempts to steal the election that there was a physical altercation with Secret Service officials inside Trump's limo when he wanted to go to the Capitol instead of back to the White House that day. The alleged under-oath corroboration has so far received much less corporate media notice than the anonymous, still-unnamed person at the Service who claimed that Cassidy Hutchinson was lying during her explosive public testimony late last month about what she'd been told about the incident just after it happened. And the Secret Service officials who were supposed to come forward to dispute her story to the Committee have still failed to do so. (Sure would have been helpful if the Service hadn't erased their text messages from that day.)

• Mesa County, Colorado's disgraced County Clerk (and recently failed GOP candidate for Secretary of State), Tina Peters, is in yet more legal trouble. The easily-duped MAGA election fraud conspiracy theorist --- now charged with 7 felonies and 3 misdemeanors related to her orchestrating an illicit scheme to unlawfully copy and publicly distribute very sensitive voting system software last year --- had a warrant issued for her arrest by a Judge on Thursday after she left the state without court permission to speak at another evidence-free MAGA election fraud conspiracy conference in Vegas.

• But the actual election fraud perpetrated by GOP officials running for office continues. Just a few short weeks after 5 of the 10 Republicans running for the Gubernatorial nomination in Michigan were struck from the ballot for turning in tens of thousands of fraudulent petition signatures, it's happened again. This time in New York. The GOP nominee for Governor, U.S. Rep. Lee Zeldin --- who voted against confirming Joe Biden's 2020 Electoral College victory and whose website features a "Team Zeldin Election Integrity Task Force" page, vowing to work "around the clock now and into November to ensure we have fair elections" --- apparently turned in nearly 13,000 fraudulent petition signatures, including 900 pages of photocopies of signatures, in hopes of appearing on the Independent Party ballot line this fall. The Libertarian Party challenged the fraudulent signatures and the state Board of Elections confirmed the fraud, denying Zeldin a third line on the November ballot.
