On today's BradCast: While many continue to insist the American economy is on a very strong footing, a few others are quietly warning that our climate emergency could break not only the U.S. bank, but the entire world economy --- again --- with a climate-fueled collapse that could make the 2008 Great Recession look like a picnic in comparison. At the same time, there's a whole bunch of Republican deniers in Congress who are getting out while they still can. [Audio link to show is posted below.]

First up, despite claims that impeachment will be a "disaster" for Democrats, it appears to be GOPers who are jumping ship in advance of 2020. This week, three more House Republicans have announced they will not be running next year, with one, just before air, announcing his resignation at year's end after pleading guilty to a federal fraud charge.

As of this week, a total of 19 Republicans elected in 2018 will not be running again in 2020, with potentially more such announcements coming before the year is over, and one sitting GOP Congressman now potentially facing felony charges for voter fraud --- in Kris Kobach's Kansas!

Then, we're joined today by financial journalist, author and now The American Prospect's Executive Editor DAVID DAYEN, to discuss the politics, policy and possibilities of Green New Deal legislation. The magazine has just published a landmark special edition in which they devote all of their coverage (along with their website) to the issue from virtually every angle, as covered by more than 22 reporters, experts and climate leaders. Dayen, who took over the reins at the feisty, progressive non-profit just six months ago, explains why he was moved to devote their latest entire issue to this one matter. He notes the unprecedented breadth of their coverage has actually made him more hopeful, not less, about our ability to achieve the radical change called for by the GND, and the greener --- and safer, and more livable --- future it could bring.

While "the Green New Deal, as a slogan, has gotten us further than practically any climate initiative has in the previous several years," he tells me, "we thought there was a gap in translating it into policy, and showing that it's not only urgent, but it's practical, and it's feasible, and it not only can be done, it must be done." He adds: "We're talking about our planet. We don't have a choice but to make this work....We have the technology on hand today to move to a carbon-free economy. That carbon-free economy will not sink global GDP growth but actually enhance it. And it can equalize our economy. It can create jobs, especially those in places that were hardest hit by the toxicity of the environment to this point."

All of that unlikely optimism aside, Dayen's own recent coverage at The Prospect on the failure of U.S. financial regulators to seriously examine the extraordinary disruption to virtually all sectors of the economy of either a looming climate catastrophe or the costs of mitigating it, should be a wake up call for many. His report cites a new issue brief published by the center-left Center for American Progress warning that the U.S., led by both the fossil fuel industry and a financial sector heavily invested in it, is currently either ignoring the possibility of a potential climate-fueled financial meltdown or actively working to cover up the realities of what could be a damned-if-we-do, damned-if-we-don't reality of either living with or transforming from our current fossil fuel-based economy. As Dayen --- the author of an award-winning 2016 book about the 2008 global financial meltdown --- warns, "our financial system seems to be whistling past a climate graveyard."

We may, in fact, be heading toward "widespread suffering and potential catastrophe. And these risks could manifest at any time." He explains what regulators in the U.S. must do --- and hopefully will do, if Democrats regain a governing majority next year --- to appropriately respond to the many fiscal red flags that so many now warn are merited, with the serious, sober consideration they deserve.

"I hope that it won't take a financial catastrophe to get us to the point where we need to do this," he says. But the cautionary note serves to underscore the importance of the topics tackled by The American Prospect's new and important special edition...

On today's BradCast, in an historic vote, the U.S. House officially adopted formal rules and procures to govern the ongoing impeachment inquiry of Donald J. Trump. We also do a bit of helpful Impeachment 101 to explain how it works, and what we know historically about the process from the three prior Presidential impeachment proceedings against Andrew Johnson, Richard Nixon and Bill Clinton. [Audio link to program is posted below.]

Then, it's on to today's vote in the U.S. House, undercutting a limp Republican argument --- already undercut by a federal court last week which determined no such vote was actually required by the Constitution to proceed with impeachment --- a sharply divided House adopted a resolution [PDF] by a 232 to 196 vote, setting out official rules for how the inquiry will proceed. All present members of the GOP voted against the measure and all but two Democrats (conservative ones, from districts won by Trump in 2016) voted in favor. So did former Tea Party Republican turned Independent Rep. Justin Amash of Texas.

The resolution sets the ground rules for upcoming public hearings in the House Judiciary Committee with witnesses who have testified to members behind-closed-doors in recent weeks. The adopted procedures allow the President and his attorneys to participate and cross-examine witnesses in those hearings, as well as request subpoenas for their own witnesses and other evidence, as long as they do not obstruct the proceedings or continue to withhold evidence. The Democrats are targeting a timeline that could see a vote on Articles of Impeachment in the Judiciary Committee and then the full House by Christmas, unless it is further derailed by continuing White House obstruction.

We cover the historic floor arguments today in favor of the resolution offered by Democrats from House Speaker Nancy Pelosi to Intelligence Committee Chair Rep. Adam Schiff to several rank-and-file members, along with arguments against the resolution from members like House Minority Leader Kevin McCarthy and Minority Whip Steve Scalise.

Even as today's vote was carried out, both Democratic and Republican impeachment investigators from the Intelligence, Foreign Services and Oversight Committees continued taking depositions behind closed doors on Thursday, from witnesses testifying about Trump's quid pro quo pressure campaign against Ukraine, which is at the center of the current effort to consider official Articles of Impeachment against the President. Testifying in the House today was the top Russia expert on the White House's National Security Council, Tim Morrison, who was hand-picked by his immediate superior, the extremely right-wing then National Security Advisor John Bolton (who Democrats have also summoned to offer testimony in coming days.) Morrison reportedly corroborated accounts by other senior Administration officials that Trump did, in fact, personally push to withhold $391 million in Congressionally-allocated security assistance to Ukraine in exchange for a commitment from its new President to open an investigation into Joe Biden and a conspiracy theory that Ukraine (not Russia) attempted to manipulate the 2016 U.S. Presidential election.

On today's BradCast: We're at the point in the ongoing impeachment inquiry of Donald J. Trump when the facts against him have become so damning that he and his supporters in Congress are pretty much just tossing everything they can against the wall to see what, if anything sticks. [Audio link to show is posted below.]

But first today, some long-overdue very good news out of North Carolina, where a three-judge state court panel has determined the state's Republican-drawn Congressional maps to be an "extreme partisan gerrymander" and has ordered new maps before the 2020 elections. The court went so far as to state that no more Congressional elections may be run on the current maps, and if new ones aren't drawn in time for next year's March 3 primary election, the judges --- two Democrats and a Republican --- will postpone the primaries until they do.

The news is long-overdue, though hardly a surprise. North Carolina is the most divided of swing states, but the GOP-skewed maps have resulted in 3 Democrats and 10 Republicans in the state's Congressional delegation for the past decade. A federal appeals court already ruled the same map to be an unconstitutional partisan gerrymander and ordered a new one drawn. But that ruling was ultimately over-ruled by the stolen Republican majority on the U.S. Supreme Court earlier this year, when they declared in a 5 to 4 opinion that federal courts may not hear partisan gerrymandering cases. Only state courts may now do so, and now North Carolina's state court has done so. The same court ruled last month that the state's legislative districts were also drawn in violation of the state constitution and ordered new maps there as well.

Meanwhile, speaking of Congress, a White House national security official and decorated Iraq War vet offered startling testimony to House impeachment investigators on Tuesday, regarding Trump's scheme to withhold nearly $400 million in military assistance to Ukraine unless the nation's President promised to investigate Joe Biden in advance of the 2020 election. Lt. Col. Alexander Vindman serves as the top Ukraine expert on the White House's National Security Council (NSC) and is the first official to testify in the impeachment matter who actually listened live to Trump's infamous July 25 "I need a favor though" phone call with Ukrainian President Volodmyr Zelensky.

According to Vindman's prepared opening statement obtained by the New York Times, the veteran Army officer and longtime civil servant was so alarmed by Trump's strong-arm tactics and withholding of military aid that, out of a "sense of duty", he alerted the top lawyer at the NSC --- twice --- in order to register internal objections about the policy, which he feared would "undermine national security."

"I am a patriot,” Vindman says in his testimony, "and it is my sacred duty and honor to advance and defend our country irrespective of party or politics." Since news of his testimony broke on Monday night, rightwing media have been attacking the Purple Heart winner who was wounded by an IED in Iraq, as a traitor who must be working for Joe Biden or George Soros or Ukraine, after he fled the then Soviet-controlled country as a 3-year old with his parents in 1979.

Next, were joined by former Asst. U.S. Attorney turned George Washington University Law School professor RANDALL ELIASON to discuss the Republicans' continuing, nonsensical whining that the impeachment inquiry lacks "due process" for the President. Though each of their arguments toward that end have been dismantled by both facts and federal courts in recent days, they are still making the case which Eliason describes as "nonsense" in his latest Washington Post op-ed.

He explains why on today's program, noting the old "saying in Washington, that if you're arguing about process then you're losing," adding: "I think that's certainly the case here." Eliason, a longtime expert in white collar crime, government fraud and federal criminal law, responds to a number of different allegations being offered by Trump and his defenders, including the specious claim that there is no crime at the heart of Trump's quid pro quo pressure campaign against Ukraine.

He also offers his thoughts on the recent news --- and "incredibly suspicious" timing behind it --- that Trump's Attorney General Bill Barr has elevated the Dept. of Justice's probe into the origins of the 2016 investigation into Russian election meddling into a criminal investigation of some sort.

Guest: Jeanne Devon of the AK Dem Party; Also: GA petition effort mandates new review of state's new unverifiable voting system...

On today's BradCast: A new petition effort to rename the block of Fifth Avenue in New York City where the Trump Tower is located after President Barack Obama has now gained nearly half a million signatures. It began as a joke, according to its author, but quickly caught on. While it's a brilliant, if unlikely idea, other, somewhat more important petition efforts --- with actual legal standing --- have recently caught fire over the past week or so as well. And the consequences of those efforts could be far reaching. [Audio link to today's show is posted below.]

First, in the battleground state of Georgia, where the Secretary of State has just selected an all new 100% unverifiable touchscreen ballot marking device (BMD) voting system for the state, which voters will be forced to use at polling places in 2020, was certified just a week or so ago in violation of the state's elections code, according to election integrity experts and opponents of Republican SoS Brad Raffensberger's $150 million new system made by Dominion Voting Systems of Canada.

Raffensberger's decision comes as a federal judge in Atlanta, just last week, found [PDF] the state's current 100% unverifiable touchscreen voting system to be "unsecure, unreliable, grossly outdated....seriously flawed and vulnerable to failure, breach, contamination and attack". So much so, that the judge also declared the old system be in violation of voters' right to have their votes counted as cast. As we discussed with one of the plaintiffs in detail last week, U.S. District Judge Amy Totenberg ordered the state to use a new, hopefully verifiable system in 2020. But the new system selected by Raffensberger may face a similar fate in federal court, as opponents vow to challenge it as well, while calling for hand-marked paper ballots instead.

In the meantime, however, more than 1,400 state voters, as of air time, have signed a petition demanding a reexamination of the newly selected system, charging that it was improperly certified in violation of the state elections code. Only 10 voters, according to GA state law, are needed to sign the petition to trigger such a second look, far fewer than the number of Georgia residents now demanding it.

And, at the same time, way up north in Alaska, another petition effort is rocking our nation's 49th state. In just two weeks, a multipartisan coalition has gathered more than 29,500 signatures calling for a recall of newly-elected Republican Gov. Mike Dunleavy. That is a thousand more signatures than required by law --- and a lot of signatures in such a short time, in a state with a population of only about three quarters of a million. The petitioners say they will continue to collect signatures through September 2nd. If this first step is successful, as appears likely, a second effort to get about 70,000 signatures will be needed to place the actual recall measure on the ballot.

The unprecedented effort comes as Gov. Dunleavy has attempted to implement radical cuts of some $443 million to the state budget, including $130 million --- or 40% of the state's budget contribution --- to the University of Alaska system. Also slashed was about $30 million for senior benefits, early learning funds and Alaska Legal Services. One of the most objectionable (and likely unlawful) attempted cuts was to the state's court system, a punitive measure in the exact amount of what the state currently spends on abortion services, meant as retaliation by the Republican Governor for the state Supreme Court having upheld a constitutional right in the state to abortion services.

And, all of this comes as Alaska is seeing record high temperatures and wildfires that have ravaged about two and a half million acres in the state this year amid our ongoing climate crisis, and as the President of the United States appears to have made a secret deal with the Governor to okay a controversial mining project on the pristine waters of the Bristol Bay watershed.

We're joined today by our old friend JEANNE DEVON, formerly known as "AKMuckraker" of the great Alaska blog The MudFlats. She now serves as Communications Director for the state Democratic Party and breaks down the details of the political tremors now reverberating in Alaska, including the fact that, while the state Democratic Party supports the petition effort to remove Dunleavy, they are not actually responsible for the effort. It is being brought forward by a coal baron, believe it or not, along with a longtime Republican legislator, the last living signer of Alaska's Constitution (a 95-year old Dem, pictured above), and the state's former independent Governor's Chief of Staff, among others.

The broad coalition, Devon explains, opposes Dunleavy for a host of reasons as the transplant from the "lower 48" does not appear to understand Alaska's values and how Republicans, Democrats and independents don't necessary operate on the same terms they do elsewhere in the country. For example, as we discuss, Alaska --- which has voted for the Republican nominee in every Presidential election since Lyndon Johnson --- is actually a socialist state, in that the fossil fuel companies who operate there are legally obligated by the state to send royalty checks to every man, woman and child each year.

"It's set up that way," Devon explains, because the resources are seen as being "owned communally by everyone in the state. We actually have written in our state constitution that our resources are to be developed 'for the maximum benefit of the people'." The result, she says, is that the people who live in Alaska own their own resources and receive a minimum basic income. Ideas that unleash shouts of "SOCIALISM! COMMUNISM!" by Republicans elsewhere, but not in Alaska for some odd reason, where the state relies, bigly, on those royalties from the fossil fuel industry. Devon notes the payments also serve to "keep 25,000 Alaska families out of poverty every year" and sever as "a huge influx of almost a billion dollars into the local economy."

As to the recall movement, she suggest that not only will petitioners successfully complete the first step, but that they are also likely to gather the 70,000 signatures needed in the second step to see the measure to remove Dunleavy placed on the ballot. "You do have folks that are Republicans, who are industry Republicans, business Republicans, who are conservatives but not ideologues in the way that Gov. Dunleavy is. He is coming from the point of view of really breaking government. And that is where the line is drawn. There is just a sense that he does not love the state, and he doesn't understand the state" as a native of Scranton, Pennsylvania.

In regard Dunleavy's attempt to punish the state Supreme Court, Devon argues "It's unconstitutional on so many levels. It's chilling that you can have a branch of government that not only will do their own calculations about the number of dollars that the state has spent on abortion, but will then line item veto just that amount from the entire court system as punishment. And then announce it, publicly, that this is what they're doing and why." With the help of a cold-hearted GOP operative by the name of Donna Arduin, hired by Dunleavy to slash the budget after similarly devastating cuts she made on behalf of GOP Governors in Kansas, Arizona and Florida, Devon explains that Dunleavy "even cut the money that would have earthquake-proofed children's libraries in schools, so that giant bookshelves won't fall on tiny children" in the earthquake prone state.

In our fascinating discussion today, Devon also explains what is known about the deal recently struck between Dunleavy and Donald Trump --- during a secret meeting at the state's airport in Anchorage --- that resulted in Trump's order to his EPA to reverse an environmental endangerment finding by the Obama Administration's EPA that had finally blocked the long controversial Pebble Mine project. The enormous and controversial planned gold, silver and copper mine, according to scientists, environmentalists and many other opponents in the state, will put the world's largest and most important sockeye salmon habitat in critical danger in and near Bristol Bay, causing what the EPA described previously as "irreversible loss of fish habitat". Devon describes it as"the largest wild sockeye salmon fishery on the planet. It employs almost 20,000 commercial fisherman. It feeds a region of indigenous Alaskans who have been surviving off of these fish for over 10,000 years. It's not only a food staple, but really an entire culture" that will be destroyed if the mine is allowed to be built.

Brutal ICE raids in MS; WH denial over domestic terror; MT assaulter acted on Trump 'rhetoric'; 'The OC' turns 'blue'; TX may soon do same...

Well, today's BradCast features an epic righteous rant or two for your listening pleasure, as we begin with some grim news of the day but finish with a much brighter outlook for the near future. [Audio link to show is posted below.]

  • First up today, the dark news out of Mississippi where Trump's federal deportation forces waited for the first day of the school year --- and the day after Tuesday's state and legislative primary elections --- to violently round up nearly 700 longtime immigrant workers at various food processing plants around the state. The record ICE arrests came just days after 22 were gunned down in the heavily Hispanic town of El Paso, Texas by a white supremacist who echoed Trump's words about an "immigrant invasion". Children in the MS towns reportedly came home from school to find parents gone, toddlers and infants were not picked up at day care, and local news highlighted a number of children roaming the street in tears, terrified about was happening to them and their families. It seems the federal government made no plans for what would happen when the U.S. citizen children of immigrants were violently hauled away. Even one U.S. citizen worker was tazed and knocked to the ground by the out-of-state invading ICE thugs;
  • At the same time, in an exclusive from CNN, details of the White House's purposeful failure to take action on the quickly growing threat of domestic terrorism by white supremacists like the shooter in El Paso, and so many other similar cases in recent years. According to the report, based on sources said to include current and former senior Administration officials, many in the Department of Homeland Security had been trying for some time to force the White House to take the rising menace more seriously, but those closest to Trump were reluctant to do so for fear it would "trigger the boss".

    Trump, like many Republicans and Fox "News" zombies have spent years in denial (or supportive) of the threat of domestic terror by rightwing extremists such as white supremacists. In 2009, after an outcry by Republicans, the Obama Administration shamefully withdrew a DHS draft report [PDF] on the growing threat of rightwing extremism that had been largely prepared during the George W. Bush Administration. There was no such outcry over a similar report, released without incident, on leftwing extremism. Nonetheless, Obama's DHS chief buckled, apologized(!), withdrew the draft report, and the DHS group which created it was largely dismantled. With increasing evidence of the white supremacist threat --- even cited by Trump's own FBI Director --- the Trump Administration has continued to insist on focusing on jihadist terror and illicit drug importation instead. That, as they exercise their own white supremacist terror on immigrant communities such as those across the state of Mississippi on Wednesday, a state with one of the lowest populations of undocumented immigrants in the nation;

  • All of this, of course, sends a very clear message. It was one that appears to have been heard loud and clear by a 39-year old man in Montana who placed a 13-year old in choke-hold and fractured his skull when body-slamming him to the ground after the boy refused to remove his baseball cap during the national anthem at a rodeo. The man's lawyer contends the U.S. Army veteran who had suffered his own brain injury in 2000, was acting on the President's "rhetoric". He told the local paper in Montana that the man's "Commander-in-Chief is telling people that if they kneel, they should be fired, or if they burn a flag, they should be punished." While he says the man takes "a big portion of accountability for what took place...there was other things at work here that definitely contributed". The attorney argues that “Trump never necessarily says go hurt somebody, but the message is absolutely clear....[his client] was doing what he believed he was told to do, essentially, by the President."

    The argument might sound absurd, until you connect a few dots to include, among many, Montana's Republican Congressman Greg Gianforte who, on the eve of his special election to the U.S. House in 2017, actually grabbed a reporter by the throat and slammed him to the ground. In 2018, during a campaign rally for Gianforte --- who won in deep red Montana in 2017, despite the incident --- Trump made light of the Congressman's violent 2017 assault of a journalist, noting to the delight of the assembled MAGA crowd that "any guy who can do a body slam is my kind of guy." Message delivered and, apparently, received;

  • But we've got some brighter news as well today, as formerly GOP strongholds appear to be turning "blue" in advance of the crucial 2020 elections. The Orange County Register reports something this week that would have been unthinkable just a few short years ago. California's former GOP stronghold of Orange County --- the birthplace of Richard Nixon --- now, officially, has more registered Democrats than Republicans. The CA state GOP Chairman's explanation for the news is --- as we discuss --- hilarious and completely counter to demonstrable facts and reality. (Which makes him perfect for the job!) That follows the 2018 midterm wave election when all four U.S. House seats in the OC, incredibly, flipped from "red" to "blue";
  • Evidence for a similar sea changes in the Trump Era is beginning to appear elsewhere as well, as this week saw the fourth Republican U.S. House member in a week from once-ruby-red Texas to announce that he would not be running again in 2020. He was the 9th GOPer to declare the same over the past three weeks, with 11 incumbent Republicans in total now planning to step down next year, as opposed to just 3 Democrats. The pace of announced House Republican retirements is now actually ahead of the number that called it quits at this time before the 2018 mid-term elections when Democrats ended up retaking the House majority by flipping some 40 seats in a Blue Tsunami route. Is Texas set to become the new Orange County next year?;
  • Finally, Desi Doyen joins us for the latest Green News Report with an important new U.N. report on farming and climate change, a growing worldwide water crisis, four U.S. fossil fuel explosions in 48 hours, and some miners in Kentucky finally waking up to how the dying coal industry is working to take advantage of them...

Both Democrats and Republicans alike --- on Capitol Hill and in the media --- are trying to make sense of Wednesday's landmark testimony by former Special Counsel Robert Mueller and where things go from here. We do a bit of the same ourselves on today's BradCast. Though I hope we are a great deal more honest about it than Donald Trump and Fox "News", and less confusing than Fox' Ainsley Earhardt who announced this morning that Mueller's testimony "didn't change anything", before going on to tell viewers that "it changed everything". [Audio link to show our full program is posted below.]

For full coverage and extended excerpts from Mueller's nearly seven hours of hearings before the U.S. House Judiciary and Intelligence Committees, see yesterday's special coverage show. For analysis and the fallout since the Republican former FBI Director confirmed the multiple and repeated felonious and impeachable crimes by the President of the United States detailed in his 448-page report [PDF], we're joined by the great HEATHER DIGBY PARTON of Salon and Hullabaloo today. As usual, we attempt to cut through the media drama and partisan positioning to get to the actual facts and important content that matters.

Among the issues discussed with Parton....

"It seems obvious to me that we have a criminal in the White House. And an abuser, a corrupt leader, and a barbarian and an ignoramus," Parton explains, cutting to the chase. "He's an unfit President and he should be impeached. To me, this is obvious."

But, she goes on, in struggling to make sense of why impeachment proceedings have not already been triggered, "One of the reasons that the dial is not being moved is the way that the press is covering this. There was a lot of criticism, during and after the testimony, about the fact that they covered it like a sporting event. 'He didn't put on the best show', etc. etc. The theater criticism. This is a big problem because this is a complicated story. People are seeing it as a game, as this is a strategy, instead of what it really is --- which is a fundamental threat to our democracy.

"If Donald Trump gets away with this, if he gets off scot-free --- re-elected or not --- if he gets away with doing these things while in office, it has changed everything. The President is no longer accountable. If Donald Trump cannot be impeached, then nobody can be impeached. Impeachment no longer exists as a stop on a President like this. And that's very scary," warns Parton.

On today's BradCast: Already increasing tensions in the Middle East got much higher today after Iran shot down an unmanned U.S. surveillance drone last night, which the Islamic Republic claims had crossed their border into their airspace. The U.S. contends the spy plane, a U.S. Navy RQ-4A Global Hawk that can fly as high as 10 miles in altitude with a wingspan as wide as a Boeing 737, was in international airspace at the time it was downed by an Iranian surface-to-air missile. Both nations suggest they have evidence to support their claims about the location of the craft when it was shot down. [Audio link to show is posted below.]

Tensions in the region have been rapidly rising in recent weeks as the U.S. has blamed Iran, without presenting evidence, for several attacks on shipping tankers near the narrow Straight of Hormuz, which borders Iran in the Persian Gulf and through which 20% of global oil supplies travel. Iran has denied any involvement in those incidents, other than helping to rescue the crew of one of the tankers and extinguishing its fire. But war-hawks in the U.S. have been banging the drums against Iran for some time. They applauded Donald Trump's unilateral withdrawal last year from the Joint Comprehensive Plan of Action, or JCPOA, the landmark deal struck between Iran and seven other nations during the Obama Administration. The hard-fought treaty ended any possibility of Iran enriching uranium for use in weaponry, at least until Trump broke the deal that had lifted crippling, years-long sanctions against Iran. Trump reinstated the sanctions after becoming President and pulling out of the pact that even his own Administration admits Iran has been in full compliance with.

On Thursday, Trump described Iran's action as "a very bad mistake" and "a foolish move", while repeatedly telling reporters "you're going to find out", when asked how and if the U.S. plans to respond. He did suggest, however, during Oval Office remarks, that he believed the incident must have been unintentional or taken by "someone who was loose and stupid" --- as if to suggest he was reluctant to retaliate and/or make the situation worse.

Nonetheless, at the very same time, GOP hawks in the Senate like Sen. Lindsey Graham (R-SC) seemed eager to inflame the situation by warning that Iran "needs to get ready for severe pain," vowing that "if [Iran] is itching for a fight, they're gonna get one."

We're joined today to discuss all of this by DR. ASSAL RAD, Research Fellow and policy analyst at the nonpartisan, nonprofit National Iranian American Council. In a statement today, the group's President, Jamal Abdi, counseled for both nations to "firmly step away from the path to war" by seeking out "third party mediators who can help de-escalate and bring the U.S. and Iran back to the negotiating table."

Rad explains what is known and unknown about the current situation, how dangerous the situation has now become, and how Trump's restoration of sanctions has crippled Iran's economy, at least for the working class, leading to severe shortages of food and medicine. In addition to increasing military tensions, she tells me, Trump's violation of the anti-nuclear pact has led to both increased uranium enrichment --- bringing Iran closer to the ability to build nuclear weapons if they desire --- as well as strengthening the political hand of anti-U.S. hardliners in the Islamic Republic.

"What Trump has done," she tells me, "is played into the hands of the hard-line elements in the country, tarnishing the image of the U.S., which was very positive. But, of course now, as they suffer, it's much easier for that government to point to the United States as the blame."

"On the U.S. side, of course, the argument can be made that there's a credibility issue, given that President Trump has gone back and forth in the tone he takes with Iran. He'll tweet something like 'we're going to end Iran' and 'that was a big mistake on Iran's part', and then walks it back. 'No, we don't want regime change' or 'we don't want a war'. But then he has advisers, like the National Security Advisor John Bolton, who argues exactly for those goals."

"And that's not, by the way, to give credibility to the Iranian side," Rad made clear. "The Iranian side also lacks credibility in their own right. And that's why without a full investigation and having evidence, I would avoid drawing conclusions. And certainly taking action based on conclusions that aren't based on full evidence."

She notes that "sometimes the way that our media frames it, it makes it seem like the Iranian side is an irrational party --- and yet that is the party that agreed to the deal and has abided by that deal, despite the fact that the U.S. abrogated that deal a year ago."

"One of the things that we know about war is that it's unpredictable. We don't know what will be the consequence. And to prevent this sort of unforeseen concern that something terrible could happen, we have the opportunity right now to prevent it," she concludes with optimism, advising fellow Americans to speak out to our representatives in Congress to urge them to find a peaceful solution to the quickly escalating crisis.

Then, just to lighten things up, we turn to our worsening climate crisis! With Republican state Senators in Oregon fleeing the state on Thursday to avoid a quorum needed for final approval of a sweeping bill meant to help curb climate change by reducing carbon and capping greenhouse gas emissions through a cap-and-trade system. Democratic Gov. Kate Brown has now authorized state police to try and find the rogue lawmakers and bring them back to the capital. Meanwhile, back in D.C., Florida Congressmen Ted Deutch (D) and Francis Rooney (R) announced the re-launch of a bipartisan 'Climate Solutions Caucus' with about 60 members, including more than 20 Republicans.

We get some thoughts on both of those stories from a skeptical (cynical?) Desi Doyen, who also joins us for the latest Green News Report, with troubling news on the Trump Administration's official roll back of Obama's landmark Clean Power Plan in favor of scheme to aid the coal industry which, according to Trump's own EPA, will result in the premature deaths of thousands of Americans. But, she's also got some good news for us today --- and not a moment too soon --- out of the state of New York, where lawmakers did not skip the state, but instead adopted one of the world's most ambition climate change action plans...

On today's BradCast, after what seems like a too-long absence, we're joined again today by Slate legal reporter MARK JOSEPH STERN for insight on the first batch of U.S. Supreme Court opinions issued at term's end this week. [Audio link to show follows below.]

But first today, mercifully brief coverage of Donald Trump's re-election campaign launch in Orlando, Florida on Tuesday night. While the rally followed the same tired pattern of pretty much all of the campaign rallies he's held non-stop since becoming President --- (Remember when the GOP and Fox 'News' used to complain that Obama was holding campaign rallies as President, rather than governing? That was darling.) --- the usual recitation of Trump lies and nonsense also included a fascinating reference to Republican opposition to "socialism" just one mere breath before Trump (falsely) touted GOP support for protecting much-beloved socialist programs such as Social Security and Medicare. The irony, no doubt, was lost on most of his brain-poisoned followers on hand or watching via the Fox "News" disinformation channel.

On Capitol Hill today, Democrats in the House Judiciary Committee finally heard testimony from a former Trump official in the aftermath of the damning Robert Mueller Special Counsel report. Longtime Trump aid Hope Hicks --- who worked with him before his campaign, during it, during the transition and in the White House --- cooperated with the Mueller probe and is cited within it as a witness about 180 times. She agreed to testify today, though only behind closed doors, with a transcript to be released later. However, White House and DoJ Attorneys were also on hand to continue what Committee member Rep. Ted Lieu (D-CA) described as "obstruction of justice in action". The lawyers issued objections to any and all questions related to Hicks' service with Trump as President, asserting "absolute immunity" from such questions. That is a newly invented "privilege" from the White House and DoJ which Lieu described as "not a thing. It doesn't exist." Lawmakers suggest the result will be court action to force Hicks' testimony on her time at the White House, now that she is a private citizen (who works for Fox "News"). Even House Speaker Nancy Pelosi, who is still opposed to opening an official impeachment inquiry, reportedly described the new White House offensive as "obstruction of justice", which --- in case she needs a reminder --- is one of the offenses included in the Articles of Impeachment for both Richard Nixon and Bill Clinton.

Also in D.C. today, the Trump Environmental Protection Agency, now headed by "former" coal industry lobbyist Andrew Wheeler, officially replaced President Obama's Clean Power Plan, meant to curb global warming greenhouse gas emissions from coal-fired power plants, with a new rule that makes the reduction of emissions optional for states. Even while coal plants have been shutting down across the country over the past two years in favor of cheaper, cleaner natural gas and renewable energy production, the Administration is implementing the new rule which, according to the EPA's own analysis, will result in thousands of unnecessary deaths per year. The new rule parallels a similar effort by the Trump Administration to roll back new mileage standards implemented by Obama with the cooperation of the auto industry, which the National Highway Traffic Safety Administration (NHTSA) says will save thousands of lives as well. So, yes, Trump is now purposely killing Americans and lying about it by claiming U.S. air and water has never been cleaner. That, according to actual findings from the Government, is also untrue, as pollution has increased over the past two years since Trump became President.

We're then joined by Slate's Stern for a review of this week's SCOTUS rulings and an explanation for some of the "strange bedfellow" partnerships found in several of them. Among the opinions discussed today...

  • A Supreme Court "punt if I've ever seen one," according to Stern, on a case involving yet another bigoted baker, this time in Portland, who refused to sell a wedding cake to a same-sex couple. The Justices sent that case back down to the lower court for review, though Stern suggests they are largely buying time before being forced to determine, once and for all, whether discrimination against LGBTQ people is Constitutional. "The Court can't duck this forever," says Stern;
  • The largely good news ruling of the week is for voters in Virginia, where a 5 to 4 majority opinion results in new, fairer, more competitive legislative districts in advance of the Commonwealth's statewide elections this November. The Justices held that the GOP-gerrymandered House of Delegates did not have standing to appeal new legislative maps implemented by lower courts to correct 11 districts found to have been unlawfully and unconstitutionally racially gerrymandered following the 2010 Census. Only the state's Attorney General, a Democrat, who initially challenged the ruling on behalf of the state but later declined to appeal the lower court's ultimate ruling, has such standing, the majority determined.

    But the majority opinion, written by Justice Ruth Bader Ginsburg was joined, unsurprisingly, by Justices Elana Kagan and Sonia Sotomayor, and much more surprisingly by Justices Clarence Thomas and Neil Gorsuch! Moreover, the minority dissent, penned by rightwing Justice Samuel Alito was also joined by the normally progressive Stephen Breyer. Stern offers an explanation for what appears to be very strange bedfellows on this opinion, and whether the ultimate outcome --- while very good news for Democrats who hope to take control of one or both chambers in the VA legislature this November --- will be good news or bad news for Democrats and Republicans in the future;

  • We then move to what Stern describes as "a tough but interesting case", for his explanation of the Court's affirmation of what has long been considered a loophole in the U.S. Constitution allowing an exception to its restriction on double-jeopardy cases. In fact, as the Court held in a 7-2 decision, virtually identical indictments may be brought against the same person, for the same crime, so long as they are brought in separate State and Federal jurisdictions, which are considered to be "separate sovereigns". On the minority in this case was another odd couple, Ginsberg and Gorsuch, while Thomas --- who previously decried the Double-Jeopardy Loophole by calling for a "fresh examination" of it --- chose not to vote for ending it when he had the opportunity. He did, however, take the opportunity to write a concurrence in the case, calling for reversing other long-held SCOTUS precedents, such as those which allow women the right to choose to have an abortion. "He used his opinion to launch into this crazy attack on precedent, that was clearly laying the groundwork for an attack on cases like Roe. vs. Wade" and marriage equality;
  • Finally, Stern offers some thoughts on the Court's expected opinion, due any day now, regarding the Administration's attempt to add a question on citizenship to the 2020 U.S. Census. That determination is still expected, despite evidence unearthed after oral argument that proves the Administration lied about their reasons for adding the question, which, according to the Census Bureau itself, will reduce participation. That, in turn, is expected to radically shift government funding and citizen voting power from Democrats and minorities toward white Republican jurisdictions. We discuss that bizarre matter --- and how SCOTUS can possibly rule on the case now, given the new evidence revealed from the hard drive of a now-deceased GOP gerrymandering expert following the Court's hearing months ago --- and a few of the other expected important decisions to come in the next two weeks before the Justices leave town for Summer vacation...
