If we are to put an end to what Dr. Martin Luther King, Jr. described as the "madness," the American public must...acquire the point of view of those upon whom the bombs are falling. The point came to mind with a question posed during a recent CA U.S. Senate debate suggesting that many in the mainstream media remain trapped within this nation's irrational, post-9/11, global "war on terror" mindset. Trapped, as it were, despite President Joe Biden's sage (if ignored) advice to Israel's far-right Prime Minister Benjamin Netanyahu to not "repeat mistakes" the U.S. made in the aftermath of 9/11.
Paraphrasing a remark said to be made by an unnamed Biden Administration official, KTLA 5 moderator Frank Buckley asked primary candidate Rep. Barbara Lee (D-CA) whether she agreed that "peace [in Gaza] can only begin with the elimination of Hamas"?
After condemning the October 7th Hamas terrorist attack, Lee proclaimed that "a diplomatic and political settlement" that eventually included a "two-state solution" offers the only means for achieving peace and security. "Killing twenty-five to thirty thousand civilians is counterproductive to Israel's security." That's why, Lee explained, she was calling for a "permanent ceasefire"...
We've got an amazing --- and chilling --- story for you on today's BradCast, about what has turned into a wave of proprietary voting system software theft in several key swing-states since Trump pretended the election was stolen in 2020. But the most disturbing part is that many of these thefts having been carried out by or with the help of actual elected GOP election officials in several states! And there is one in particular, in Georgia, which has just come to light which we focus on today, because our quick-thinking guest actually recorded a damning phone call she received from someone who claims to have been a part of that scheme. Before we get there today, however, we've got a very (too) quick round-up of results from Tuesday's primary elections in North Carolina, Kentucky, Oregon, Idaho and Pennsylvania, and some news on several of them that you may not have heard elsewhere. Among the most noteworthy of those races...
The loss of North Carolina's insurrectionist U.S. House Rep. Madison Cawthorn in his GOP primary, and what will now happen to the federal court case regarding Free Speech for People's challenge to his eligibility to run at all under the U.S. Constitution's "Insurrectionist Disqualification Clause." We've been covering that story closely in recent months and we've got comment today from the group's President on what may happen now in the federal case.
News on several apparent wins by progressive candidates for the U.S. House in PA and OR, including one that is set to result in the defeat of an incumbent establishment-backed Democratic Congressman and the other likely headed to a recount.
The good news for Democrats in the contest for PA Governor, as far-right Trump-endorsed insurrectionist wingnut state Sen. Doug Mastriano won the GOP nomination to run against state A.G. Josh Shapiro. Suffice to say for now, Republicans are not happy about their nominee.
And the critical race to fill the U.S. Senate seat being vacated by Republican Pat Toomey, where progressive Lt. Gov. John Fetterman easily won the Democratic contest and the battle for the Republican nomination is likely headed to a recount between Trump-endorsed celebrity TV doctor Mehmet Oz and pretty-much-just-as-Trumpy former hedge-fund CEO Dave McCormack. Both are now waiting on late arriving mail-in ballots to be tallied in the exceedingly close race, even though Republicans in 2020 argued that late arriving mail-in ballots in the Keystone State were all illegal and should have been tossed out. Not anymore, apparently. (And we wonder how long it'll be before they notice yesterday's BradCast rounding up several Republican-leaning counties where voters were turned away for hours after polls opened, thanks to voting system failures.)
THEN, it's on to the remarkable story of GOP election insiders in critical swing-states such as Michigan, Colorado, Ohio and Georgia, who, following the 2020 election, conspired with a cabal of election denying Team Trumpers to breach secure facilities in elections offices. They made illegal image copies of hard drives from key voting system computers containing sensitive, proprietary software and voter databases in at least 8 counties across the country...for some reason.
Part of this story is newly revealed evidence about one such a case in Coffee County, Georgia, which includes a damning recorded phone call received by our guest today, MARILYN MARKS of the Coalition for Good Governance. The caller admits to an elaborate scheme to copy and analyze hard drive data from the county that Trump is said to have won by about 40 points. He also told Marks that he hacked into her legislative filings in her long-running lawsuit against the state, which seeks to replace Georgia's unverifiable touchscreen voting systems with simple, verifiable hand-marked paper ballots.
You'll need to tune in for the full details on this story. It's broad and, at times, complicated. And, yes, we share some of the disturbing audio from that phone call to Marks from an Atlanta bail bondsman by the name of Scott Hall who brags about chartering a jet to Coffee County with a group that "scanned all the equipment, imaged all the hard drives and scanned every single ballot" with "the entire elections committee there" who, he claims on the call, said "we give you the permission. Go for it."
We pull together a bunch of threads from a bunch of investigative news sources (as well as some of our own reporting) on all of this, on the broad scheme carried out by some of Trump's top "Stop the Steal" compatriots and the almost inconceivable lack of apparent investigation --- or worse, cover-up --- by GA's Sec. of State Brad Raffensperger regarding the still mysterious incident in Coffee County.

Among the questions discussed with Marks: What the hell is going on here? Is it a violation of state and/or federal law to make discreet imaged copies of this software? Why was Team Trump doing it in the first place? Is Sec. Raffensperger's office investigating what happened in Coffee County, GA or not (they are offering conflicting statements, including in Marks' legal case challenging the use of the state's Dominion touchscreens)? What kind of threat does all of this pose to elections around the county in 2022 and 2024 in Georgia (their midterm primaries are next week) and in the many other states which use the very same software --- now stolen by these people --- to run their elections?
"Certainly they were violating state and federal laws," Marks tells me. "The difficult part of this is It puts virtually all states that are using the Dominion system --- without doing thorough audits and [using] hand-marked paper ballots --- it puts all of these at risk."
"If what Scott Hall and other have said happened truly happened, then there are people who have unauthorized copies of software off the server and off of all of the components," she explains. "These people can now craft and test malware and how to exploit the vulnerabilities in an election."
Marks believes the initial effort was meant "to try to find evidence or perhaps even fabricate evidence," regarding the 2020 election. But it has since gone far beyond that.
Raffensperger, she says, is offering "nothing but stonewalling" and "is telling different things to different people." She notes there is "no record of opening an investigation" in Coffee. That, as the Secretary's second-in-command, Gabe Sterling, seemed to suggest in a recent court deposition that there WAS an investigation of the server in Coffee, that it was actually quietly seized by the state, but that he "can't remember" the findings from the inquiry.
"There are many mysteries to unfold here. We don't know who has been in the system and how far any malware may have spread if it were implanted." She warns the Secretary's office and state Elections Board "want to hide their heads in the sand despite" the mounds of recent investigative reporting (as linked above) on what is going on here.
"The system has been breached," Marks cautions chillingly, before explaining what must be done now to safeguard our elections --- including from insider election officials who have now put our entire democracy at very serious risk. Even hand-marked paper ballots, she notes, are still tabulated by these same computer systems.
"Remember, the remedy we are seeking [in our suit] is not simply hand-marked paper ballots but hand-marked paper ballots with very thorough audits. IF we get the audits, yeah, there can be hacking but any outcome-changing hack will be detected and can be corrected," Marks argues. "While you can't get rid of the risk, you can remedy that risk."

As the horrors of war continue in Ukraine today, we focus on the latest efforts to counter it by ending --- or trying to --- Russian oil and gas imports to the EU and US, and as we enjoy more accountability for GOP election fraudsters and insurrectionists, including one who funneled Russian money to Donald Trump's 2016 campaign and another who used to appear on The BradCast from time to time. Fossil fuel profiteer Shell Oilapologizes after getting caught secretly buying cheap Russian oil, even after pretending last week that it was ending its business with the country after their invasion of Ukraine. Does it smell "like Ukrainian blood?," Ukraine's Foreign Minister wonders.
On Tuesday, after nearly two hellish weeks of unspeakable humanitarian suffering in Ukraine and pressure from the public to do the right thing, several more major American companies --- McDonald's, Starbucks, Coke and Pepsi --- finally decided to "pause" doing business in Russia.
The European Union, which has made the mistake of becoming reliant on Russia for about 45% of its gas imports, announced plans to try and wean themselves off two-thirds of it by year's end. Hopefully this will help hasten their move to clean, renewable energy.

Also, both White House Press Secretary Jen Psaki and President Biden pushed back hard against the obnoxiously phony claims by Republicans, Fox "News" and the oil industry that opening up more public land to oil and drilling leases and permits would lower surging U.S. gas prices. As both Psaki and Biden point out, Big Oil is already sitting on some 9,000 currently unused permits on millions of acres of land, as is. The GOP/Fox "News"/Big Oil axis of evil is really hoping that Americans don't know that, so they can blame Biden for the surge in global oil and gas prices...even as new polling finds American majorities are willing to pay more at the pump to help Ukraine and they want to expand renewable energy development, not fossil fuels.
The International Energy Agency (IAE) has a list of 10 things the EU can do to decrease gas use by at least 10% before year's end. Many of those things the U.S. can do as well. One thing many of us could and should do to lower the cost of gas in a big way during Russia's war on Ukraine --- since many of us already did it for much of the past two and a half years anyway, cleaning the skies and drastically lowering gas prices in the bargain --- WORK AT HOME AGAIN if possible!
The first January 6th insurrectionist to stand trial before a jury, was found guilty on all five felony counts today. (He's a helluva guy, apparently. Threatened to kill his own teenage children if they told on him. Ya know, as "patriots" do.) The DoJ hopes the result may lead other Trump insurrectionists to plead guilty. We hope it leads the DoJ to keep working their way up to the top of the insurrectionist cabal.
The leader of the violent rightwing street gang calling itself Proud Boys, Enrique Tarrio --- who wasn't even at the U.S. Capitol on January 6th, 2021 (because he was in police custody on a separate crime) --- was indicted, with several others in his gang of white hoodlums, on conspiracy charges related to their violent, coordinated attack on the Capitol. Tarrio had reportedly met with Oath Keepers leader Stewart Rhodes in a parking garage in the hours before the Republican assault on American democracy. Rhodes and several other Oath Keepers were also recently indicted on seditious conspiracy charges. And Rhodes, like another rightwing hoodlum facing new felony indictments in a separate matter (discussed below), had been a guest on The BradCast several years ago.
This story is amazing. Jesse Benton, a longtime Republican operative and former campaign manager for Senators Rand Paul (in 2010) and Mitch McConnell (in 2014), has already been pardoned for felony election fraud once, by Donald Trump in the closing days of his Administration. Now Benton has been indicted again, for more election fraud, and along with another former guest on The BradCast! Tune in for the full story, but Benton was originally charged and convicted some years ago for buying away an endorsement for about $75,000 from a Michele Bachmann supporter during the GOP Iowa Caucus in the 2012 Presidential campaign. At the time, he worked for Rand's father Ron Paul's Presidential campaign. Benton was sentenced to two years probation and a $10,000 fine just days before the scheme he has now been indicted for which includes receiving $100,000 from an unnamed Russian national, keeping $75,000 for himself, and giving $25,000 of it to the campaign of "Political Candidate 1" in his own name, an unlawful straw donation to avoid laws barring foreign money in American elections. Benton promised a meeting with "Political Candidate 1" in Philadelphia on September 22, 2016, the day that Donald Trump happened to be holding a fundraiser there. They all took pictures together, according to the September indictment unsealed on Monday, along with Doug Wead, a GOP Presidential historian and, in recent years, far-right operative who appeared a number of times on this program some years ago. Wead, a Senior Advisor to Ron Paul's 2012 campaign was indicted as a co-conspirator with Benton. They both face the potential of a lot of time in prison. Each of the six counts charged against both of them carries sentencing of 5 to 20 years. But, yup, more Russian money in Donald Trump's 2016 election. Who could have guessed it?
Finally, Desi Doyen joins us for our latest Green News Report, in which we can barely keep up with Russia/Ukraine related events in the energy industry (including nuclear) and as the U.N. offers some good news for a change, in this case regarding global plastic pollution.

"For the September 14, 2021 Gubernatorial Recall Election," according to the CA Secretary of State's Quick Facts Sheet [PDF], "all active registered California voters will receive their ballot in the mail." The ballot will contain two questions: (1) Whether California's Democratic Governor Gavin Newsom shall be Recalled, and (2) if Recalled, which of 46 official candidates should succeed him. Voters are expected to complete both parts of the ballot, even if they vote "NO" on the first question, though it is not a requirement.
California residents, who are 17-years old but will turn 18 on or before Sept. 14, can pre-register to vote. Otherwise eligible voters, who are not yet registered, can register to vote within 14 days of the Recall Election (by August 30) in order to receive a Vote-by-Mail ballot. Or, they can fill out a Conditional Voter Registration at the polls during either early, in-person voting or on Election Day.
This GOP-initiated Recall, which, per the California Voters' Guide, will cost state taxpayers an estimated $246 million, is the product of a purely partisan abuse of the Recall process. It was engineered by an increasingly authoritarian and immensely unpopular Republican Party --- a Party which hasn't won a statewide election in California since 2006; a Party that accounts for less than 1 in 4 registered CA voters; a Party which lost the last Presidential Election in the Golden State by more than 5 million votes; a Party that knows its only prospect for winning lies in what it hopes to be a low turnout, Special Recall Election. It's a cynical divide-the-vote-among-multiple-and-largely-unknown-candidates strategy that could potentially allow an otherwise unelectable Republican to prevail.
In recent television ads, sponsored by state Democrats and labor unions, Sen. Elizabeth Warren (D-MA) described what will take place on Sept. 14 as a "Republican Recall". Question (2) on the ballot reflects the accuracy of that assessment. Out of a total of 46 candidates on the second part of the ballot, 24 are Republicans. One other candidate, Riverside County Supervisor Jeff Hewitt, is a Libertarian --- the Party that embraces the deceptive ideology of the infamous Koch Brothers and hard-right ideologues like Sen. Rand Paul (R-KY).
The difficult decision for progressives is how to unite behind only one of the 21 remaining candidates so as to avert the disaster that could ensue if more than 50% of the electorate vote to recall the incumbent Governor, as recent polling suggests a very tight race on the ballot's first question.
Allow me to explain why the election of either of the two leading question (2) candidates --- Democrat Kevin Paffrath and Republican Larry Elder --- both represent a clear and present danger if Newsom is recalled on question (1). Then, I'll share my conclusion --- along with information on each of the non-Republican/Libertarian candidates on the ballot --- as to why Green Party Candidate Dan Kapelovitz, an ardent opponent of the "Republican Recall", who is running only to avert disaster should the Recall succeed, is the candidate Democrats and progressives would do well to support...

It was another busy news day, as confirmation hearings continue for Biden's cabinet picks.The Equality Act passed the House today, but not before Rand Paul went on a homophobic rant, aimed at the first transgender woman to be nominated for a Senate-confirmed federal position. In this case, it was a confirmation hearing for Dr. Rachel Levine, the nominee for Assistant Secretary for Health, and Dr. Vivek Murthy, the Surgeon General Nominee. And Rand Paul just couldn't help himself. He went off on her. And in the House, Marjorie Taylor Greene put up an ugly sign to counter her across-the-hall neighbor Marie Newman, who put out an equality flag to celebrate her transgender daughter and the Equality Act, which would be voted on later in the day. So much for unity.

And here I thought dealing with one President in a single hour on The BradCast was tough. Now we've got the previous one on trial after his second impeachment and a new one unveiling an ambitious new agenda to begin cleaning up the other guy's horrific mess, particularly on climate today...and not a moment too soon! First up today, the Department of Homeland Security issues a new warning about ongoing threats of violence by domestic, home-grown terrorists in the U.S., many of whom have been radicalized by Donald Trump's many lies about the 2020 election having been stolen.
Then, It's been only three weeks since Trump encouraged his MAGA Mob to march down Pennsylvania Avenue and "fight like hell" to prevent the formal counting of Electoral College votes by the U.S. Congress. The attempted insurrectionists violently broke into the U.S. Capitol, called for the hanging of the Vice President, succeeded in shutting down the tally for several hours and sent lawmakers fleeing for their lives into secured locations. Five people were killed, including a Capitol Police officer, in the ensuing violence. One week later, then President Trump was impeached by the U.S. House for a second time, this time for "Incitement of Insurrection", though the Senate's then Majority Leader Mitch McConnell refused to convene a trial. One week after that, Joe Biden was successfully sworn in as President. And today, just three weeks to the day since the Trump-incited mob's murderous attack on the Capitol, with Democrats now officially in the Senate majority, Trump's second Impeachment Trial has officially begun.
While the arguments in the trial will not be presented in full for another two weeks, Republican Senator and pretend Constitutionalist Rand Paul forced a vote on Tuesday, just after Senators were sworn in as "impartial jurors", to try and dismiss the entire matter by falsely claiming that an Impeachment trial after a President is out of office is "unconstitutional". (Though he repeatedly argued that "private citizens" cannot be impeached and that "If the accused is no longer President - where is the constitutional power to impeach him?")
Joining us today to answer to the clearly false and almost-certainly disingenuous argument proffered by Paul --- and, incredibly, supported by 45 of the Senate's 50 Republicans who voted in favor of his resolution on Tuesday -- is Constitutional law expert RON FEIN of the non-partisan government accountability group Free Speech for People. Fein, with John Bonifaz and Ben Clements, authored the 2018 book, The Constitution Demands It: The Case for the Impeachment of Donald Trump.
"The obvious flaw," in Paul's argument, Fein explains, is that Trump WAS impeached while he was President, and then McConnell stalled the process of the Senate trial by refusing to allow it to be held until Trump was already out of office." But on the broader issue, as he tells us, impeachment trials may absolutely be held after an official is out of office. "Congress has done it before and explicitly considered that exact question."
"If their argument was allowed to go forth, then what it would say is that any President can do whatever they want in the last couple of weeks of their term, because by the time they would get impeached, and by the time the Senate could convene for a trial, they'd be out of office already," he persuasively argues. "Disqualification from future office is an important remedy and penalty for impeachment. It is important to have that hanging over the head of a President even in their last couple of weeks in office."
We also discuss whether the votes of 45 GOP Senators --- including McConnell, who just last week conceded that Trump "provoked" the riot at the Capitol --- to dismiss the trial, signals that it will be impossible to win over the 17 Republicans needed to win the two-thirds vote necessary for a conviction; whether a vote can be held to prevent Trump from holding future office even without conviction; whether a second failure to win a conviction in a second impeachment would redound to Trump's benefit; and whether a resolution to censure the disgraced former President would serve as any kind of deterrent for similar behavior in the future (by Trump or other future Presidents), in the event that he is not convicted once again.
Fein also rings in with his thoughts in response to the GOP's stolen and packed U.S. Supreme Court which, on Monday, dismissed two cases regarding Trump's alleged violation of the Constitution's Emoluments Clause as "moot" since he is no longer in office and why it took so long for the cases to even reach the high court. We also discuss whether Fein believes that Trump actually did pardon himself, but is keeping that pardon a secret, somehow, until he's actually charged with a federal crime.
Finally, in far less maddening news, it was "Climate Day" in Joe Biden's new White House on Wednesday! And the new President unveiled an historically ambitious climate agenda that will, among many other things, if successful, result in carbon emissions-free power, nationally, by 2035. Today on The BradCast: His days left in office only seem like years, but for Donald Trump, they are quickly waning. Trumpism, however, among the completely captured and off-the-rails Republican Party, is doing anything but. Despite the very real danger that continues to pose to the nation --- measured by hundreds of thousands of lives lost when it comes to the worsening COVID crisis, and American democracy itself when it comes to the GOP's evidence-free claims of a "stolen" 2020 election --- the corporate media continue to downplay and "both sides" the root of the nation's massive problems, my guest argues today. [Audio link to full show is posted below.]
But first up today, a few quick late breaking news items. Desi Doyen joins us for coverage of the massive snowstorm smashing records and wreaking havoc across a huge swath of the Northeast today, as well as two reported and very important climate-related Joe Biden cabinet nominations. The first is North Carolina's chief climate regulator Michael Regan, now reportedly tapped as the first African-American EPA Administrator. And the second is Rep. Deb Haaland of New Mexico, who would be the first native American Secretary of the Interior Department. Desi explains why the two landmark appointments appear to be very good news --- even if the latter cuts very close to the Democrats' dangerously thin majority in the new Congress.
Then, we're joined by longtime political media analyst and author ERIC BOEHLERT, publisher of Press Run, where he has been covering, of late, what he describes as the "media's defining failure of 2020". That includes its "bogus Both Sides narrative" on the Republican Party's utter failure to respond to the COVID crisis with a long-overdue emergency relief bill for struggling Americans and an economy on the brink of disaster, as well as madness displayed by the more than 100 Congressional GOPers who recently signed on to indicted Texas Attorney General Ken Paxton's failed SCOTUS attempt to throw out the votes of 20 million Americans in four states in order to steal the election for Donald Trump.
On those two issues of serious, existential denialism, as Boehlert detailed in a recent column, "the press has no idea how to cover it."
"In terms of election denialism, COVID fantasies, the Republican Party is a pro-pandemic party, the Republican Party is an anti-democratic party," he argues. He cites mainstream corporate media coverage which fails to clearly explain these points to the American people, as they refer instead to "Washington" being broken and "Congress" failing to do more. The result, he notes, can be found in a recent poll with a plurality of Americans blaming Nancy Pelosi for the failure to pass a new COVID relief bill, despite the Democrats passage of a $3 trillion bill in the House last Spring, and a Republican Senate led by Mitch McConnell who refused to even negotiate at all until very recently, much less allow it to come up for a vote.
"The corrupt, insane behavior, even if we just look at this election nonsense...Right after the election, I wrote about how Politico was saying, 'This is all just performance art. Republicans don't believe that Trump wants to steal the election, they're just letting him blow off some steam...everyone just calm down.' We've been told by the beltway press to calm down for four years, and the beltway press has been wrong every single time."
"CNN did a report saying, 'Republicans had no choice but to go along with Trump' as he tried to overturn election results 'because Trump controls the base,' says Boehlert. "It's all viewed as this game. No one was laughing last week when more than 100 members of Congress signed on to a lawsuit that wanted to throw out 20 million votes."
"Those 100-plus Republican members of Congress signing off on that obliterated, forever, this narrative that the press has held onto for four years that the Republican Party is privately very concerned about Trump," he argues. "They can't sleep at night because of his tweets, and gosh, they can't say it publicly. And when Trump leaves everything will be fine. Baloney! That is garbage. This is going to define the next four years. And how the press treats this radical, dangerous political party over the next four years is going to be a really big story."
He (and I) have much more to say on all of that, but before we finish up today, there is one more idea I wanted to get his thoughts on. Longtime conservative Republican strategist and John McCain's 2008 campaign manager Steve Schmidt this week announced he was joining the Democratic Party. Schmidt left the GOP some time ago, fed up with their increasing radicalism and Trump lunacy. He became an independent and helped to found The Lincoln Project which created killer videos attacking Trump and the GOP alike during the run-up to the November election (and beyond). But a number of Democrats and progressives have expressed concerns about longtime Republican "Never Trumpers" and their political influence on the party as they join forces with Democrats and what that might mean for the party's progressive future.
We share Schmidt's announcement on the show today, explaining some of the reasons for his decision to become a Democrat, and get Boehlert's take on whether this is a positive sign or troubling omen for the Democratic Party as the Biden Administration prepares to take office...

After a glitchy start with a skeleton crew at KFPK in Los Angeles, today's BradCast was a reminder, for me at least, of why radio over our public airwaves is so essential, especially now. [Audio link to show is posted below.]
After a few news headlines on the latest from our horrifying global pandemic --- more state Governors, thankfully, issuing "stay-at-home" orders; more coronavirus cases and deaths in the U.S. and around the world; more screwups from our imbecilic President regarding his "great friends" in Congress who have now contracted COVID-19; more fights in Congress about a $1.8 trillion relief package meant to save the economy and the American people (or, if left to the Republicans, to save Donald Trump and their favored companies, unless Dems continue to hold strong and not fall for another bailout con); and my own suggested Bipartisan Stimulus Relief Plan (the one that should be adopted immediately) --- we open the phones to callers who have been enduring "stay-at-home" orders now for days in California, as well as elsewhere around the country.
I thought today would be a good moment to touch base with folks to see how everyone is doing, how they are holding up in these circumstances. Right now, radio and radio stations are considered an essential service as part of our federal Critical Communications Infrastructure (a designation we take seriously.) So we hope to stay on the air as long as possible, with as much live radio as we can.
Today's callers help underscore why I believe that's so important. Among the many great calls today:
The 80-year old from L.A. who lives alone with his dogs and is having trouble getting food for them;
The blind caller from Lake Elsinore who is "terrified";
The caller from Minneapolis who felt he has never had to lock his doors at night, until now;

In response to President Donald Trump having ordered a drone strike that killed a top Iranian general, the United States Senate on February 13 passed a resolution that would prevent him from engaging in further hostilities against Iran without first getting approval from Congress. The resolution had already passed the House by a vote of 224-194. It passed in the Senate by a vote of 55-45, with eight Republicans voting in favor.
Those Republicans include Mike Lee of Utah, Rand Paul of Kentucky, Susan Collins of Maine, Todd Young of Indiana, Jerry Moran of Kansas, Lamar Alexander of Tennessee, Bill Cassidy of Louisiana and Lisa Murkowski of Alaska.
President Trump is almost certain to veto the resolution. Both chambers lack the two-thirds majority necessary to override a Presidential veto. But the War Powers Act was written to be exempt from the possibility of a Presidential veto.
So, what's going on here? One of the most contentious fronts in the current power struggle between the Congress and the President involves the power to declare war. The Constitution makes clear that this power resides in Congress. Over time, this power has effectively shifted from the Congress to the President. Here's how that happened...

Among the stories covered today...
The deadly and dangerous fallout continues from Donald Trump's assassination of Iranian General Qassem Soleimani, with Democratic and Republican members of Congress from both the House and Senate, blasting the Administration for failing to provide evidence of an "imminent attack" which might have legally justified Trump's targeted killing of the second most powerful public official in Iran. Members who attended classified briefings by top Administration officials on Wednesday were outraged by the failure of those officials to provide the information they claimed they had regarding the killing. Without that information, Trump's targeted assassination of Iran's top military general was very possibly in violation of both domestic and international law. But are Democrats enraged enough to bring another article of impeachment over it?;
Not all Congressional members were upset by the classified briefing. Some, like Rep. John Rutherford (R-FL), charged that members such as Rep. Pramila Jayapal (D-WA), who claimed after the briefing that Trump "recklessly assassinated" Soleimani with "no evidence of an imminent threat or attack", was actually an "Ayatollah sympathizer" who was "divid[ing] our country" (Seriously. That's what he said. Rutherford's challengers this year are Donna Deegan and Christopher Eagle on the Democratic side, and 20-year Navy vet Dr. Erick Aguilar in the August Republican primary in the state.);
In related matters, as we surmised based on available evidence during yesterday's BradCast, U.S. officials today are now confirming their belief that the Ukrainian Airlines passenger jet that crashed minutes after takeoff from the airport in Tehran on Wednesday was, in fact, shot down by an Iranian missile. The crash killed all 176 on board just hours after Iran's non-lethal ballistic missile revenge attack on Wednesday in response to Trump's killing of Soleimani last week. Officials in the U.S., Ukraine and Canada (which lost 63 residents in the tragic disaster) believe Iran might have mistaken the passenger flight for a military response from the U.S. that night. Along with the 56 killed during a stampede amidst the massive funeral processions for Soleimani, the death toll of Trump's action has been extraordinary. How any of this has made Americans safer is anybody's guess;
In election news, a new, landmark study [PDF] was released this week by computer scientists, cybersecurity and voting systems experts at the University of Michigan. It finds that new, touchscreen computer Ballot Marking Devices (BMDs) --- which we have long been warning about, and which are now proliferating the country in advance of the critical 2020 Presidential election --- are "extremely unsafe" and vulnerable to undetectable hacking.
Most alarming (at least to those who haven't heard the same loud warnings from BradBlog.com and The BradCast for many years now) is that the researchers found that in a mock election, where they had rigged the new voting systems to misprint a voter selection on the computer-marked paper ballot printouts, more than 93% of voters failed to notice that their vote had been changed by the computer! 93%!
And yet, these all-new, vulnerable, 100% unverifiable touchscreen voting systems are now being deployed to battleground states like Pennsylvania and Georgia and North Carolina, and even to the nation's most populous voting jurisdiction, Los Angeles County, in advance of this year's elections! We explain the study's disturbing findings and what you can do to try and avoid having your vote lost to a touchscreen Ballot Marking Device in your home jurisdiction;

At the BRAD BLOG and on today's BradCast, we'll even fight for Donald Trump's right to vote --- even from prison, should he find himself there at any time in the near-ish future. [Audio link to show follows below.]
But, first up today, a bit of impeachment-related news, even as Congress is on recess for the Thanksgiving holiday. The House Judiciary Committee (as opposed to the House Intelligence Committee) has announced a new impeachment hearing for next Wednesday. Judiciary Chair Jerrold Nadler sent a letter to the President on Tuesday, inviting him and his counsel to attend and potentially question witnesses in the hearing titled Titled "The Impeachment Inquiry into President Donald J. Trump: Constitutional Grounds for Presidential Impeachment." Along with his invitation, Nadler also offered a warning about the White House's continued refusal to make witnesses and documents available to the Constitutional proceedings in the U.S. House.
In related news, Trump's Dept. of Justice on Tuesday filed for a stay to a blistering federal court ruling ordering that former White House Counsel Don McGahn appear for scheduled testimony in response to a lawful Congressional subpoena regarding the House's examination of the Robert Mueller investigation. McGahn played a key role in the probe, helping to detail Trump's multiple attempts to obstruct the Special Counsel's investigation of Russian interference in the 2016 election and Team Trump's cooperation with the effort.
The DoJ is now seeking a pause pending an appeal to U.S. District Judge Ketanji Jackson Brown's scathing 121-page ruling [PDF] issued on Monday, in which she eviscerated the DoJ argument that Presidents and their current and former White House officials enjoy "absolute immunity" from Constitutionally-mandated Congressional oversight. "Stated simply," the Judge wrote, "the primary takeaway from the past 250 years of recorded American history is that Presidents are not kings."
Trump, however, appears to feel otherwise. In addition to appealing the order, Trump tweeted today that "The D.C. Wolves and Fake News Media are reading far too much into people being forced by Courts to testify before Congress," adding that while he "would love" to have top Executive Branch officials like Sec. of State Mike Pompeo, acting Chief of Staff Mick Mulvaney and former National Security Advisor John Bolton testify in impeachment hearings in the Ukraine bribery affair, he is only "fighting for future Presidents and the Office of the President. Other than that, I would actually like people to testify."
But whether Trump wins his "absolute immunity" defense while President, it is unlikely to help him once he is out of office. To that end, yes, we'd hate to see him lose his right to vote if he ever should find himself imprisoned for any of his countless crimes. In the meantime, however, there are millions in prison who have already lost that right --- a right, not a privilege, even if many treat it that way --- while behind bars. There has been some noteworthy successful (and even bi-partisan in some cases) efforts of late in a number of states to help enfranchise former felons or those out of jail on probation or parole though state constitutional amendments, legislation or executive actions. But when it comes to the right to vote for those still in prison, the debate has been slower and more contentious. Currently, only Maine and Vermont allow prisoners to vote, a policy which Vermont's U.S. Senator Bernie Sanders strongly defended during a CNN Presidential Candidate Town Hall earlier this year.
After a Republican New York state Assemblyman recently described a state Senate bill there that would enfranchise convicts as "insulting [to] members of law enforcement and the criminal justice system who worked diligently to get these dangerous predators off the street," Nichanian reached out to prosecutors, correctional facility officers and elected officials in Maine and Vermont to see if they agreed. You'll be surprised to learn that not one of them did, with almost all either finding it to be no problem or, more frequently, lauding the connection to "the real world" that voting allows imprisoned citizens as they pay their debt to society.
Nichanian, a Senior Fellow at the Justice Collaborative and expert on criminal justice reform and mass incarceration, shares insight from the officials he spoke with, and explains why reform on this issue (which disproportionately affects minorities) --- and a number of related topics --- is long overdue.
"We are not treating the right to vote as an inalienable, fundamental right of U.S. democracy, as a right that every citizen should have, and have protected," he tells me, explaining why "ending felony disenfranchisement would also mean that law enforcement professionals are no longer the arbiters of who gets to exercise democratic rights."
Nichanian notes that "the way in which we talk about people who are incarcerated, it would seem like we forget that these people have families, they have kids who go to school, and the school board elections matter to them. They have families who also need to care about their elected officials."
"There's all sorts of arguments of whether people are worthy of voting or not, whether people have shown enough civic capacity to vote or not," he argues. "And I find all of that universe of questions to be questionable, because we are claiming for ourselves the power and authority to decide whether our fellow citizens should have the same rights as us. I find that to be a problematic question. And I think that's just the bottom line: whether we want the right to vote to be a protected right for all U.S. citizens."
He says that "we are definitely seeing the criminal justice reform conversation encompass these issues of rights restoration, as a tool of re-entry, as a tool of thinking about how people remain human, as a way of thinking about economic justice and racial justice throughout the process." But whether that, theoretically bipartisan effort will ultimately become a fight for re-enfranchising felons remains to be seen.
We also discuss how the imprisoned population is used in the fight over apportionment, with the incarcerated counted in the census and for redistricting purposes, even while that huge chunk of the population is disallowed from exercising any real political power through the vote. "The time to address it is literally now, because the next round of redistricting and map-drawing is coming up. If this is going to be reformed, it has to be in the next couple of years, or else we'll have ten more years of problems on this."

The fight to block brand new, unverifiable (and, of course, hackable) voting systems continues as election officials in a number of jurisdictions (including some key Democratic-leaning ones) are rushing to implement them despite unambiguous warnings from experts and as the national media (after years of our own warnings) have finally begun to take notice.
But first, very quickly, some of the many news headlines from the weekend and today covered on today's BradCast. [Audio link to full show is posted below.]
Former Attorney General Eric Holder announces he is not running for the 2020 Democratic Party Presidential nominee, but Colorado's two-term Governor and self-described "extreme moderate" John Hickenlooper declares that he will be joining the crowded field of mostly U.S. Senators;
Bizarre extreme weather across much of the U.S. as one or more mile-wide "monster" tornadoes flattened parts of Beauregard, Alabama on Sunday, killing at least 23, including a still-unknown number of children, with dozens still missing;
NBC reports the Pentagon is set to announce the U.S. is permanently ending annual large-scale joint-military exercises with South Korea and Japan following Donald Trump's failed summit with North Korean dictator Kim Jong-Un. The U.S. is, apparently, receiving no concessions from the North in return;
Rand Paul became the fourth U.S. Senate Republican to say he will vote to block Trump's "national emergency" declaration, which diverts money military construction money allocated by Congress in order to build a southern border wall instead. Paul's vote, along with Democrats and a handful of other Republicans who have said they will also vote against Trump, would be enough for a majority in the Senate to pass the bill already adopted by the House. Donald Trump, however, has vowed to veto the measure;
And, in far more embarrassing news for the President today, the U.S. House Judiciary Committee --- where any possible impeachment hearings would begin --- has requested a host of documents from more than 80 Trump officials, family members and organizations as it investigates impeachable issues of obstruction of justice, corruption and abuse of power by Donald J. Trump;
Meanwhile, our years-long attempt to wave a large, bright red warning flag regarding U.S. elections, especially in advance of 2020, continues today. But, over the weekend, I'm happy to say, we received a bit of help, finally, from the national media as Politico's Eric Geller ran a feature article summarizing some of the many warnings (see here [PDF] and here [PDF], for example) from cybersecurity and voting systems experts inveighing against new, touchscreen computer Ballot Marking Devices (BMDs) now being adopted or considered by jurisdictions around the country, including Georgia, Delaware, Philadelphia and elsewhere (including counties in Texas, Ohio and even here in L.A. County, the nation's largest voting jurisdiction.)
Officials are now rushing to adopt the new systems in advance of the 2020 Presidential elections. That, despite the mountain of evidence demonstrating that BMD systems cannot be reliably audited [PDF] after elections and will result in elections as faith-based and hackable-without-probability-of-detection as those on many of the older touchscreen systems they will be replacing. The boondoggle is set to be a bonanza for the private voting machine vendors, however, which stand to make hundreds of millions by forcing all voters at the polls to use unnecessary electronic systems, rather than much cheaper, verifiable, hand-marked paper ballot systems tallied by optical-scan computers or counted by hand.
Nowhere has the fight against these dangerous new systems been more contentious than in Georgia, where the state House has already voted, mostly along party lines, to move to the systems and as lawmakers in the state Senate are now on the brink of adopting the same bill, HR-316, as well. The measure would grant at least $150 million for the purchase of electronic touchscreen systems that produce an unverifiable, bar-coded (not human-readable), computer-marked "paper ballot" summary card which is no more verifiable than their 17-year old, oft-failed, easily-manipulated paperless touchscreen voting systems.
But, never mind that. The state's new Republican Governor and former Sec. of State (and infamous vote suppressor) Brian Kemp has long been pushing for such systems, as is his new successor, Republican Sec. of State Brad Raffensberger. A former official from ES&S, the nation's largest voting machine company, which will likely receive the contract to replace all current voting systems in Georgia, is also now said to be serving as Kemp's Deputy Chief of Staff.
We're joined again today by election integrity champion MARILYN MARKS of the non-profit Coalition for Good Governance with an update on the latest status of the battle in Georgia, where a Senate sub-committee held a brief hearing on HR316 on Monday. Marks, a registered Republican herself, reports in on the Peach State's partisan divide in this battle, with most Democrats and members of the public coming down against the new unverifiable systems and most Republicans and election officials pushing for them, contrary to the unwavering advice from cybersecurity and election experts offering a large and growing body of documented facts detailing the dangers of computer-marked BMD systems.
When I ask Marks how state lawmakers could possibly approve these systems, given all that is on the public record against them, she tells me: "They are working in a fact-free environment right now...The Republicans are rushing this through so fast. They know that this stinks to high heaven, that there is no logical reason anybody would choose this over hand-marked paper ballots, when the technology is so uncertain, the price tag is enormous, and no one will take time to let the experts speak" at public hearings.
"It's absurd, but right now they don't care about the facts," she insists. "They don't care about the money, either. The numbers that the are throwing out --- $150 million dollars --- the thing is going to cost far more than that, it's clear. Their numbers are wildly off. They are rushing headlong to do this deal --- the facts, the voters, be damned."
Why? Well, we discuss that --- and what you can do about it --- on today's program. But I will note, that Marks tells me that many other jurisdictions followed Georgia after they adopted touchscreens back in 2002. She feels that is likely to happen again now. "So, this is important to try to stop this here. Conversely, if we stop it here, then in a lot of other places, they will look really hard. If Georgia turned it down when they were this close, then I think it will help stop it in other places." For now, however, unless something changes, it's looking more and more like Georgia voters are about to be saddled for another whole bunch of years of election results that can never be verified as accurate. Unfortunately, they won't be the only ones...

On today's BradCast, our week of exploding ridiculous GOP myths continues. On Tuesday, we debunked the absurd notion that they oppose "big government" in favor of state and local control. Yesterday, the decades-long scam that they oppose debt and deficit spending. Today, their opposition to "socialism" is exposed for the lie that it remains. [Audio link to show follows below.]
But, first up today, Tuesday's primary runoff in Georgia offered yet another stark reminder of what could go terribly wrong in the Peach State --- and all of the others --- this November, as voters were, again, prevented from casting ballots due to a failure in the state's voter registration database and its computerized electronic pollbook system. That, of course, is on top of the 100% unverifiable touch-screen voting systems that voters are still forced to use in Georgia on Election Day --- at least when they are allowed to vote.
But, don't worry. Brian Kemp, the Republican Sec. of State who "oversees" both systems --- including during the several years when the entire registration database and administrative passwords for the tabulation systems were left unprotected online for downloading --- is now the GOP's nominee for Governor in the state. He'll make certain the public has confidence in the results of his race this November between him and Stacey Abrams, who could become the nation's first African-American female Governor.
Then, it's onto Donald Trump's socialist --- yes, socialist --- scheme to bailout farmers in the Midwest who are being devastated by Trump's trade war with China. But, again, don't worry. He's found an old FDR-era New Deal program that the White House plans to use to give farmers $12 billion in tax-payer money to make some of the losses he has caused them a bit less stinging. In response, Republicans in Congress this week pretended to be outraged about the bailout, while taking no actual action to reverse either it or Trump's trade wars with the world.
Of course, the GOP only pretends to oppose socialist programs, which are otherwise wildly popular with the American public. When needed, they are more than happy to privatize profits and socialize losses when they control the reins of government. By way of yet another example today, we share a remarkable story along those lines, about a very powerful Republican family from Indiana who has been enjoying local, state and federal government bailouts for years --- to the tune of some $20 million --- following the failure of their once-formidable gas station empire and the toxic trail it has left behind.
Finally today, Desi Doyen joins us for the latest Green News Report, as heat records continue to be shattered this month, global warming-fueled fires and flooding wreak deadly havoc across the globe and in the U.S., and as Trump and the Republicans expand their ongoing war on the environment, public lands and endangered species...

White Waffle House mass shooter peacefully apprehended, White GOP Judge in TX gets slap on the wrist for election fraud, and other recent tales of gentle accountability...
We've got a lot of news to cover from over the weekend, and breaking today on today's BradCast, even as we try to focus on the continued undermining of our electoral system, and the lack of accountability for certain lawbreakers versus others. [Audio link to full show is posted below.]
Among the stories we cover today, along with some great calls from listeners...
As we predicted last week, Republican Senator Rand Paul (KY), who had been pretending to oppose the nomination of CIA Director Mike Pompeo as the next Secretary of State, has flipped his position (as usual), and is now voting in favor of Pompeo, virtually guaranteeing the pro-war, anti-gay, climate science denier as the nation's next top diplomat.
The alleged shooter who killed 4 and injured several others at a Waffle House in Nashville on Sunday morning is finally apprehended and taken in peacefully by local officials. But why was the suspect, a 29-year old white guy with a long record of mental issues and run-ins with police, even in possession of four semi-automatic weapons that were taken from him, for a short time, following his arrest by Secret Service outside the White House, where he is said to have identified himself as a "sovereign citizen" (a rightwing domestic extremist movement, according to the Southern Poverty Law Center and law enforcement officials.) The mass shooting was ended on Sunday morning, not by "a good guy with a gun" but, in fact, by a potential African-American victim without a gun. James Shaw Jr. burned his hand as he grabbed the muzzle of the shooters AR-15 and wrestled it away from him.
Despite going to court to successfully stop Green Party Presidential candidate Jill Stein's attempted post-election "recount" in the state of Michigan after the 2016 election, state Republicans have now passed a number of bills in the state legislature to make it even more difficult for candidates and the public to oversee their own elections to ensure that computer-tallied results have been accurately reported. The measures heading to Republican Gov. Rick Snyder's desk follow Stein's attempted 2016 count, in a state which hadn't gone to a Republican Presidential candidate in nearly 30 years, where Trump is said to have won by just over 10,000 votes (out of more than 5,000,000 cast), and where terrible state "recount" laws prevented some 60,000 hand-marked paper ballots from even being considered for "recounting" in Detroit alone.
Meanwhile, down in Fort Worth, Texas, a Tarrant County Justice of the Peace, after submitting fraudulent signatures to appear on the Republican primary ballot last March, resigned from office after pleading guilty and receiving, essentially, five years probation. It appears disgraced Judge Russ Casey won't won't spend a day in a jail, despite his guilty plea and a previous record of an "improper sexual relationship" with a former clerk. We also contrast the gentle treatment of Casey, a white elected Republican judge, with that of Crystal Mason and Rosa Maria Ortega, both of them in Tarrant County. Mason is a 43-year old African-American mother sentenced to five years in prison just last month for voting in 2016 while on supervised release from her three-year sentence on a 2011 fraud conviction for helping tax clients receive larger refunds than they deserved. She was not told by her probation officer, or anyone else, that she was not allowed to vote while on probation in Texas. Ortega, a mother of four, voted unlawfully in both 2012 and 2014, thinking she was allowed to do so as a Green Card holder from Mexico. She received an eight-year prison sentence for her crime (and likely deportation after it), despite testifying that she believed she was allowed to vote as a permanent U.S. resident. Too bad for the black woman and the immigrant. But fantastic news for the white elected Republican Judge, who had received a $125,000/year salary since his initial election in 2007, before he knowingly committed his election fraud crimes!
Also today, speaking of accountability --- or, perhaps, lack thereof --- for powerful white Republicans, Missouri's embattled GOP Governor Eric Greitens was charged with a second felony late Friday, though he refuses to step down, despite the two charges. One is related to tying up a woman with whom he was having an affair, photographing her naked, and threatening to blackmail her, and the second for unlawfully using a veterans charity mailing list during his 2016 run for Governor. Top GOP lawmakers and the state's Attorney General have called for Greitens' resignation. But he, just like President Donald Trump, describes the investigation of his alleged felony crimes as nothing more than a "witch hunt...by the liberal media and their allies".

CA Dem joins 'BradCast' to tout new 'Woman and Climate' bill, much more!; Also: Rand Paul defines 'hypocrisy' in budget battle; Porter scandal reveals Trump, Kelly undermining national security at White House...
On today's BradCast: We're joined by progressive Democratic REP. BARBARA LEE of California, the only member of Congress, in either house, to vote against the Authorization for Use of Military Force (AUMF) after 9/11, calling it a blank check that would lead to endless war. As we now know, 17 years later, with the War in Afghanistan and many others still raging under the third President to cite the AUMF to justify military action anywhere in the world without Congressional oversight, she was, of course, correct. Along with continuing her fight to repeal that 2001 AUMF, this week Lee introduced a new bill regarding woman and climate change, which we discuss as well today. [Audio link to show follows below.]
But first up, on another insanely busy program, we detail what happened on Thursday night and Friday morning when Sen. Rand Paul (R-KY) single-handedly held up passage of the new, bi-partisan government spending bill, which includes up to $500 billion in new military and domestic spending, as well as disaster aid. In shutting down the government for the second time this year, for about seven hours, Paul described approval of the bill and increased deficit spending by his fellow Republicans to be the "the very definition of intellectual dishonesty [and] hypocrisy". That, after the intellectually dishonest and hypocritical Paul just voted in December, along with the entire Senate Republican caucus, for massive, unpaid-for tax cuts set to blow a $1.5 trillion hole in the national debt.
Then, late details on this week's newest scandal surrounding the resignation of White House Staff Secretary Rob Porter on Wednesday, following the public disclosure of his alleged violence against his two former wives. Among the new developments: Donald Trump's Chief of Staff John Kelly and other top White House officials reportedly knew about the charges long ago; Kelly has now said he'd be willing to resign over what happened, and several outlets are reporting that their remain "dozens" of White House staffers, some in very senior positions, still operating without full security clearance.
That suggests that many of them, like the President's son-in-law Jared Kushner, may never receive full security clearances, despite Trump and the GOP having run their entire Presidential campaign hypocritically (and falsely) charging that Hillary Clinton carelessly allowed classified information to be seen by those without proper security clearance. According to Rep. Sean Patrick Maloney (D-NY), a former White House Staff Secretary himself, describes this situation as "nuts", saying that Porter would have handled the nation's most highly classified secrets in his top Oval Office role. He believes an investigation is warranted to determine what both Kelly and Trump knew about the "eminently blackmailable" Porter and who gave him the okay to remain on, even after the FBI had determined he would not qualify for a full security clearance.
Next, we're joined by Congresswoman Lee, to detail her new "Woman and Climate Change Act of 2018" [PDF]. We discuss how women and girls around the world are "bearing the brunt in many ways", as the first and most affected victims of the dangerous effects of global warming and whether Republican members of the bi-partisan Women's Working Group may help in co-sponsoring this effort, despite "the climate deniers who are within the federal government running the show."
"Women are especially vulnerable to these changes in the environment," Lee explains. "We know women are the ones that are finding water, collecting food, caring for family members. And so now, more than ever, we need to focus on climate change as a whole, but also ways to empower women, as they are the most vulnerable people, and will be impacted most by these health epidemics, refuge crises, forced migration --- all the issues that we know women are disproportionately impacted by."
She also shares her opinion on the odds of Ivanka Trump, self-proclaimed women's champion, coming aboard this particular campaign. Lee, a former co-chair of the Progressive Caucus in the House, who now serves as Senior Democratic Whip, responds as to whether Democrats fought hard enough, during the recent government funding battle, to protect "Dreamers" facing imminent deportation as early as March 5, unless a legislative deal can be struck, and whether she believes House Speaker Paul Ryan will ever allow such a measure to be brought up for a vote. She urges Americans to keep contacting their members of Congress on both of these efforts.
"Listen, you have to stay optimistic. Otherwise we get stuck with their negativity and trying to take us back. The public has to be hopeful and has to work hard to get this done," she tells me.
Finally, Lee also shares her thoughts on the bi-partisan momentum in both the House and Senate for finally repealing (and replacing?) the 2001 AUMF. "Congress has been missing in action. We need to do our job, and we're not. But, believe you me, we are building support to do this," she insists. "Hold your elected officials accountable!"
We close today with a bit of listener mail in response to a recent story we covered on the record number of scientists now said to be running for office in 2018, and on the dangerous new effort by the Trump Administration place lifetime limits on Medicaid for the first time in the popular social safety net program's history...
