ALSO: Unverifiable, Decertified, Virus-Prone, Failed E-Voting Systems Set for Use in Hoosier State Primary Tomorrow...
By Brad Friedman on 5/5/2008 1:23pm PT

[Ed Note: Please see the update at the bottom of this article, for the state's explanation concerning the 1.1 million voter records discussed in the following.]

The Republican War on Voting continues apace.

In addition to the recent, outrageously bad decision by the Supreme Court to approve Indiana's draconian polling place Photo ID restrictions, sure to keep thousands of legal voters from even being able to cast votes in tomorrow's important Primary Election --- despite the state's inability to offer up a single instance of in-person polling place voter impersonation that's ever occurred during the state's entire history (as we've covered here, here and here, for example) --- another 1.1 million voters have now been purged from the voting rolls altogether, reports Bev Harris of Black Box Voting, as based on the Hoosier State's own data.

Moreover, the state will use unverifiable touch-screen style voting systems across the state. One widely used system, made by MicroVote, will be used despite having been decertified, and two other systems, made by ES&S and Diebold, have been found vulnerable to undetectable vote-flipping viruses by several reputable universities.

According to Harris' report...

Primary in Nation's 10th Largest State Could Matter for First Time in Decades
By Jon Ponder on 3/12/2008 5:53pm PT

Guest blogged by Jon Ponder, Pensito Review.

You wouldn't know it by tuning into the Beltway pundits but there are actually two "big states" with primaries remaining in this cycle, not one --- if "big state" is defined as one of the top 10. Pennsylvania (sixth in population, with 12.2 million) votes on April 22, and North Carolina (ranked tenth, with 8 million) votes on May 6.

It surprises people to learn that North Carolina is the tenth largest state despite the fact that this has been true for years, except for a brief drop to 11 recently when Georgia moved up while New Jersey was moving down. Georgia is now the ninth and New Jersey is eleventh.

While Hillary Clinton leads in Pennsylvania, early numbers from Rasmussen show Barack Obama with double digit lead in the Tar Heel state...

Republicans Delay Vote on New Registration Initiative with Dubious Charges of 'Invalid Voters'...
By Brad Friedman on 6/20/2007 10:56am PT

Blogged by Brad Friedman on the road...

It looks like the numerous scandals embroiling the Bush Administration Justice Department haven't slowed down the GOP's stealth campaign to suppress voters and pervert democracy any way they can get away with it...

On June 5, less than thirty minutes before the North Carolina State Senate was scheduled to vote on a bill that would allow voters to register up until three days before an election (down from 25), the Republican state auditor sent out an email to legislators saying that he had "sensitive information" about voting irregularities. Lawmakers agreed to delay the vote.

So what was all the fuss about? His office's preliminary report had discovered tens of thousands of potentially invalid voters and nearly 400 votes by dead people, he announced. Clearly the scourge of voter fraud had hit North Carolina --- more registered voters could only logically mean more chances for fraud.

'04 Campaign Coordinator Voted Twice, and in Wrong District, in '04 Primary Decided by 86 Votes
But as BlogActive Reports, That's Not All the Congressman May Have to Worry About...
By Brad Friedman on 5/12/2007 6:02pm PT

It looks like Rep. Patrick McHenry (R-NC) is housing his own little Republican voter fraud factory at his NC crib.

Mike Rogers has several scoops, following up on this item from CBS News today:

The CBS News Investigative Unit has learned a man who was a field coordinator in Congressman Patrick McHenry's (R-NC) 2004 campaign has been indicted for voter fraud in North Carolina.

The indictment charges that Michael Aaron Lay, 26, illegally cast his ballot in two 2004 Congressional primary run-offs in which McHenry was a candidate. The charges indicate that Lay voted in a district where it was not legal for him to vote.
...
McHenry won the primary by only 86 votes.

Whoops. But Rogers's version of the story reports a number of additional questionably-registered folks who appear to be living in McHenry's house as well, along with a few additional juicy details (okay, rumors, but interesting ones) about the "unmarried" McHenry...

Since the EAC Refuses to Notify Them, We Hope You Will...
By Brad Friedman on 4/16/2007 4:32pm PT

A commenter over at DU asked which states used the ES&S iVotronic touch-screen voting system found vulnerable to an undetectable countywide vote-flipping virus which can be implanted by a single person, as we reported this morning.

Based on our quick review of a county-by-county database of voting systems, sorted by state, as made available by Common Cause (EXCEL spreadsheet downloadable here) just prior to the November 2006 elections, it looks like the answer is 16 states in total.

Since the EAC refuses, as our report detailed, to do their job in notifying Elections Officials about this incredibly serious vulnerability, it looks like it's up to you to notify your state's Secretary of State and/or county Election Officials! Details on the vulnerability and mitigating steps that may be taken are detailed in this brief report at VotersUnite.org as written by a computer scientist and voting system expert well familiar with the newly discovered flaw. Please refer your voting officials to both our original article, and that scientific report for more details at the following URLs:

The states which use the ES&S iVotronic affected (with firmware versions either 8 or 9, with or without a so-called "Voter Verified Paper Audit Trail") are as follows:

  • Arkansas
  • Florida
  • Indiana
  • Iowa
  • Kansas
  • Kentucky
  • Missouri
  • New jersey
  • North Carolina
  • Ohio
  • Pennsylvania
  • South Carolina
  • Tennessee
  • Texas
  • West Virginia
  • Wisconsin

If we've missed any, or any of the states above do not use the system in at least one county, please let us know and we'll amend the list.

And a Concession in New Mexico...Despite Our Own Personal Best Efforts...
By Brad Friedman on 11/22/2006 1:54pm PT

Of course, we've been covering Christine Jennings's (D) refusal to concede and her stand in favor of the voters in the FL-13 fiasco. And though we haven't mentioned it lately, vote-rigging whistleblower Clint Curtis (D), rather than conceding, is convening a group of volunteers to verify the reported "results" of his race against the corrupt Tom Feeney (R) in FL-24.

But several other House candidates, from North Carolina to Ohio (but not New Mexico), are still fighting to assure the voice of the voters is accurately heard...

BRAD BLOG: New Mexico's 1st Congressional District Should Be Re-Counted by Hand in Full!
By Brad Friedman on 11/17/2006 3:50pm PT

We hate to rely on such questionable fringe sources as Associated Press, but for lack of time today, we'll point to their coverage of the remaining "handful of close contests for the House" which are still undecided.

The races that AP describes as "still in dispute" are in NM, NC, FL, and two in OH (naturally).

In addition to the completely obvious and resignation-worthy mess in the FL-13 race, The BRAD BLOG would draw particular attention to the less-discussed contest in New Mexico's 1st Congressional district. We've been plowing through first-hand accounts sent our way detailing the disasterous state of conditions in the counting rooms out there where there's a very close race between incumbent Rep. Heather Wilson (R) and her opponent Patricia Madrid (D).

Based on the exceedingly detailed reports we've read so far of the (ahem) less-than-optimal-or-accurate initial tally of votes (yes, Bernalillo County, we're talking to you), we'd suggest any recount of that race must be done as a complete hand count of all ballots in order to assure the final result actually resembles the intention of New Mexico's voters.

But we just may be radical that way.

Legal Resources Being Gathered by National Party to Challenge Close Elections Where Dems Currently Trail
Other Candidates, Citing Concerns About Voting Machine Failures, Also Refusing to Concede Until All Votes Can Be Verified...
By Brad Friedman on 11/14/2006 3:22pm PT

Just off the phone from a DNC insider --- very much in a position to know --- who says the following races are being considered, as of this afternoon, to still be very much in play by the DNC (* = Incumbent, Results shown latest reported by state websites as available):

NC-8: Larry Kissel (D) 60,016 / Robin Hayes (R)* 60,481
CT-2: Joe Courtney (D) 121,321 / Rob Simmons (R)* 121,151
FL-13: Christine Jennings (D) 118,739 / Vern Buchanan (R) 119,116
NM-1: Patricia A. Madrid (D) 103,376 / Heather Wilson (R)* 104,863
OH-15: Mary Jo Kilroy (D) 98,100 / Deborah Pryce (R)* 101,636
OH-2: Victoria Wulson (D) 112,952 / Jean Schmidt (R)* 115,817

The source believes that all of the above races, each of them currently very, very close, are winnable and the feeling is that they "could easily win three of those six."

In each --- except for CT-2, where Courtney is leading --- the Democratic candidate is currently trailing in the reported results as absentee, provisional, and paper ballots are still be canvassed. As well, challenges and recounts are underway in some of those races (we hope to have more detail shortly here on a couple of those races).

(UPDATE: Several readers have written to ask if other races beyond those mentioned above --- such as the U.S. House race in Washington state's 8th Congressional district between Democrat Darcy Burner and Republican Dave Reichert --- are now off the table as far as the DNC is concerned. The races reported above are the only ones named explicitly to us by the DNC sources. However, two different sources there have confirmed that they are largely driven by the folks on the ground in the states, and would urge that noise be made locally --- and loudly enough that higher-ups might hear it at the DNC --- in order to gain more attention from the national party to other such races still of concern.)

The source also adds that the DNC is considering whether or not to ask for contributions from the public to a legal fund to assure they will have the funds needed to provide full legal resources to thoroughly challenge each of those races.

As well, The BRAD BLOG has also learned the DNC is still keeping their eyes on the Colorado Secretary of State race between Ken Gordon (D) and Mike Coffman (R), given the problems revealed in Colorado's disasterous certification procedures for voting machines prior to the election, and their massive meltdowns on Election Day in Denver and elsewhere which caused thousands of voters to be turned away from the polls due to machine malfunction.

AP is reporting today that Coffman's lead is beginning to look insurmountable, though given the fact that Gordon's numbers in Denver alone outpace Coffman's by some 70 to 30 percent, the fact that Denver voters, specifically, were disenfranchised at such an alarming rate due to equipment failure on Election Day, certainly "exemplifies," as the source put it, the need for Election Reform across the country and the importance of Secretary of State races.

The six U.S. House races named above, of course, are just the federal races that the DNC considers "still in play," but there are innumerable local races and initiatives being challenged around the country, as another DNC source told The BRAD BLOG this morning. As well, there are a number of Congressional races where the candidates have, honorably, refused to concede until every vote is counted and accounted for.

Clint Curtis, the vote-rigging whistleblower who ran against Tom Feeney, the man he claims asked him to create vote-rigging software in 2000 (as The BRAD BLOG originally broke back in 2004 and whose story we've been following closely ever since) has issued a press release this morning saying that he will not concede in the race until every vote is accounted for.

"The right to vote and to have that vote counted accurately is the very foundation of our democracy, and I owe it to the voters in my district and the state of Florida to continue to push for accurate, honest elections," Curtis said in the news release. He points out that as a candidate, he "now has the legal standing to pursue an investigation into the anomalies," which he claims were reported during his race.

"I can accept that the citizens across the state of Florida were out of step with the rest of the country," added Curtis, "as long as we know that this election truly reflects their intent." The Florida Secretary of State's website currently shows Feeney leading Curtis 58 to 42 percent.

In California's 50th Congressional district, Francine Busby (D) has still refused to concede in her race against Brian Bilbray (R) in which she reportedly trails 54 to 43 percent. We applaud Busby's refusal to concede given the outrageously bad administration of the election across the entire San Diego County as overseen by Registrar Mikel Haas, one of the country's worst.

A Zogby poll taken on Election Day (and shortly thereafter) shows an unexplained 6 point disparity with the final results as we reported last week.

As reported earlier today, Haas's resignation was called for on Election Night by San Diego County Democratic Party Chair Jess Durfee after voters were disenfranchised across the county when Diebold touch-screen systems failed to work and not enough paper ballots were made available for voters. Many of those voters ended up voting on Spanish language paper ballots after English ballots had run out by 9am on Election Day; others simply gave up and went home or to work without being able to cast a vote at all.

We echo Durfee's call for Haas to step down immediately. San Diegans deserve honest and accurate elections in which the voters may have confidence in the reported results. Haas has, disgracefully, provided none of the above during his irresponsible tenure.

We originally reported that the Democratic candidate was trailing in the reported results in each of the six DNC-named races. In fact, Democratic candidate Joe Courtney in the CT-2 race is currently ahead in the results as reported so far. We've corrected the original misstatement in the article above. Further, AP is now reporting Courtney as the winner after a final canvassing of the ballots.

Is Anybody There? Does Anybody Care?
By John Gideon on 5/7/2006 4:39pm PT

By John Gideon, Executive Director, VotersUnite.Org and Information Manager, VoteTrustUSA.Org --- May 8, 2006

This has been another week of "Train Wrecks" across the country. Three states had major primaries with mixed success and failure, a few states had local elections with failures, and some states are preparing for May primaries and they are meeting the "oncoming locomotive" as they can't get machines or software for the machines and are having to revert to paper ballots or lever machines.

Elections Systems and Software (ES&S) is now facing investigations, lawsuits, or just plain pissed-off elections officials in West Virginia, Arkansas, Missouri, Indiana, Texas, Pennsylvania, California, and other jurisdictions. And now we learn that Diebold has a huge security vulnerability that all voting systems experts who know the details are very concerned about.

Next Tuesday, May 9, finds the train barreling down on primary elections in West Virginia and Nebraska. May 16 brings potentially hazardous primary election whistle-stops in Kentucky, Oregon and, the grand central station that is Pennsylvania.

Let's take a look at some of the continuing derailments from the past week, about which prompted Brad Friedman of The BRAD BLOG to ask of D.C. politicians and, more notably, the National Mainstream Media: "Is anybody there? Does anybody care?"

Our Elections are Now Officially 'A National Disaster in the Making'
A MUST READ GUEST EDITORIAL BY JOHN GIDEON OF VOTERSUNITE.ORG
By John Gideon on 4/9/2006 5:24pm PT

By John Gideon, VotersUnite.Org and VoteTrustUSA.Org

Normally this space is taken with my ideas of what are the "Top 5" voting news stories for the week. Today I am going to use this space to talk about what I see as the beginning of a disaster in the making with our elections. This isn't the election fraud that some point to when they talk about the vendors and some elections officials. It's not about recounts or audits. This is a real, get your hands around it, happening problem that will disrupt our election process if we do not do something about it now. While we have been involved in all of our issues about Direct Recording Electronic (DRE or "touch-screen") voting machines or paper ballots the electronic voting machine vendors have been wreaking complete havoc across the country.

So far this year two states have conducted primary elections. In Texas there is at least one candidate who has stepped forward and has challenged the election because of anomalies in vote counts and known voting machine failures. One county's machines counted some votes up to 6 times which resulted in approximately 100,000 more votes being counted than were cast. Though the vendor, Hart Intercivic, initially blamed the problem on human error, they finally had to admit that it was a programming error and not poll workers or voters who had erred. In Illinois some county officials are threatening to withhold final payment of funds on contracts with Sequoia Voting Systems because of failures with their machines that ended with results in the primary not being known for over a week after the voters went to the polls. In both states the involved vendors were very successful in the media with deflecting the blame from their machines to "human errors" or "glitches". However, when you listen to people who were there and who saw and worked through the problems you get a very different picture...

Same Models as Those Which Lost 4,400 Votes in NC!
Unusually High Rate of 'Undervotes' in both States on Same Machines.
By Brad Friedman on 1/23/2005 7:11am PT

After November 2nd, 2004, there were increasing reports from elections officials, small local papers, and, yes, bloggers who had bothered to studiously examine official election results, The New York Times published several articles labelling such concerns by Americans as "conspiracy theories".

So we sent them a list of "15 Unanswered Questions" --- all of them based on hard evidence --- that we'd hope they'd investigate and report on to the American people. That was on November 21st, 2004.

One of those questions concerned a single county in North Carolina which had used the UniLect voting machine and, as we reported on November 4th, 2004, had completely lost a full 4,438 votes. Those lost votes later spawned a Special Election in Cartaret County, NC to re-vote some of the local issues because of it.

We had asked suggested to The Times that such hard facts were hardly "conspiracy theories" and we had hoped they'd be able to investigate and report on which other states and counties had been using the identical UniLect machines which --- company officials admitted --- had contained memory chips that stored fewer votes than they had told state officials.

Since UniLect machines were also in use in Ohio, we thought it was a particularly germane point. But apparently The Times didn't agree. They neither investigated, nor reported on the matter to our knowledge.

And now, months after the election, and days after the inaugural, The Charlotte Observer reports this morning that the same model of UniLect machines used in North Carolina were also in use in Pennsylvania and seem to have lost votes there as well [emphasis added]:

Local and state officials in Pennsylvania are examining malfunctions and questions with voting machines in three counties --- the same model machine that lost more than 4,400 votes in North Carolina.

"We continue to be uncertain about these machines," said Michael Coulter, who heads an independent committee examining voting machine mishaps in Mercer County, Pa., where he said machines in 13 precincts erased some voters' choices.

Mercer County, as well as Beaver and Greene counties, along the Ohio border, use the Unilect Patriot voting machine, an electronic mechanism that does not produce a paper ballot and is the same model that lost 4,438 votes in Carteret County, along the N.C. coast.

As well as lost and erased votes, there was also an unusually high rate of "undervotes" on the Presidential ballot where those machines were in use [emphasis again added] ...

All three of the western Pennsylvania counties recorded a high percentage of "undervotes" for president, which is when a voter doesn't vote in that race. Mercer County's undervote was 7.8 percent, four times higher than in 2000, when they used old, lever machines.

In North Carolina, state lawmakers are scrutinizing why more than 10 percent of Burke County voters were recorded as not making a choice in the presidential race, an "undervote" rate that is four to five times as high as nearly all the other counties in the state. Burke and Carteret are the only N.C. counties that use Unilect machines.
...
[M]achines in 13 of Mercer's 100 precincts would let a voter select candidates in the races on several pages of the ballot and highlight the choice, but when the voter reached the sixth page the highlighting disappeared and all the candidates were unselected. The voter's choices had vanished.

"The voter's choices had vanished."

And we remind you again, The New York Times didn't find it necessary to look into which counties in Ohio used these same machines, if there were any lost votes or an unusually high rate of "undervotes" on them, presumably because such notions were simply the "conspiracy theories" of "leftist bloggers" as they had described them at the time.

That despite just 60,000 or so of 5.5 million in a single state (Ohio) which would have completely flipped a United States Presidential Election.

Repeating: Election officials and the voting machine manufacturer admit that 4,438 votes were entirely lost in just one North Carolina county where UniLect machines were used.

Repeating: UniLect machines were also in use in Ohio.

We will continue to press both the Mainstream Media, the States and the Voting Machine Companies to better serve the American Public whom they are failing to adequately serve at this time. But just in case you wonder why --- on January 23rd, 2005 --- this information is finally being reported by The Observer at all, it is because of inquiries in Pennsylvania that were demanded by the voters who spoke up, made noise, and created a petition to force their elected officials into taking action:

Their inquiry was prompted not by Election Day glitches, but by a petition sent by voters in Beaver County who suggested the machines were susceptible to fraud and tampering.

Your voice does matter. When you speak up.

We've set up VelvetRevolution.us to help you do that. Please visit and sign-up (it's free!), so you can speak up, make noise and take part in some upcoming actions that will be announced there in the coming weeks.

Apparently this story appeared last Friday, but I missed it. I'm trying to keep all of these stories straight, report them only once, and attempt to confirm them before passing them on.

In this case, as many as 22,000 miscounted votes were caught in time to reverse the results of two different races in state races in North Carolina according to the Charlotte Observer.

Agriculture, education races change as counties fix vote-tally errors

The Guilford totals didn't change President Bush's win in the state, but did shift the vote total by 22,000.

Please remember the announced margin of "victory" for Bush in Ohio was about 135,000 in a state of 5.5 million. How many of these types of errors went undetected and/or unreported in Ohio?

How many more of these types of articles do you we need, folks? The system is a disaster, and Congress is sitting on their hands waiting for the Electoral College deadline to pass.

...While Democrats solidly take the state.

MyDD has a telling analysis of the situation in North Carolina where problems with vote counting (some votes apparently counted twice in some places, 4,500 votes completely lost elsewhere, etc.) may require a re-vote in all, or part, of North Carolina.

Nonetheless, it's telling that, though the Republican candidates for President and U.S. Senate were able to claim victories down there, Democrats somehow had virtually all the rest of the success in NC.

The NC Democratic candidate for Governor won in a landslide (55%-44%), Dems won control of the NC House by at least 3 seats, and in the NC Senate the Dems added to their "already healthy" margin. Additionally, the first openly gay lesbian to be elected to the NC statehouse was also victorious in her Senate race!

That victory on the state level mirrors other results around the country, where Dems solidly increased their foothold, or took control of many State Legislatures and Governships.

Even Dallas, TX(!!!) elected a lesbian/hispanic Sheriff!

All of which just serves to make me even more suspicious of the election results.

Republicans control the "Solid South" says conventional wisdom --- but then how does one account for North Carolina? "Value voters" showed up and gave Bush his victory, says CV, and yet gay and lesbian candidates had unprecedented victories in "solid" GOP strongholds.

It's certainly reasonable to assume that voters preferred the GOP at the national level while opting for Dems back at home...for whatever reason. Had there not be so many other oddities in the days following this election, I'd likely not have given it all too much thought. But taking everything we now know about highly improbable disparities in the Exit Polling --- where alleged "inaccuracies" just happened to only benefit Bush and never Kerry in the final results --- along with everything else we now know about the manufacturers of the E-Voting and Counting machines, their secrecy and their exceedingly close ties to the Republican party, it all just adds to my existing suspicions here that something stinks. Bad.

While 150,000 Votes Already Miscounted or Lost!
By Brad Friedman on 11/10/2004 11:50am PT

Yesterday Bev Harris' BlackBoxVoting.org site began issuing "Bandwidth Exceeded" messages to users attempting to access the site. Such a message generally occurs when more users are attempting to access the site than the server can comfortably handle or when the bandwidth allocated by the domain's Internet Provider is exceeded.

Today, attempts to access the site now simply return a "Cannot Find Server" page, leading me to believe that hack attempts and/or Distributed Denial of Service (DDoS) attacks have been successful for the time being. [UPDATE: BlackBoxVoting.org is now finally back online. At least for now.]

We have had such attacks here at the BRAD BLOG for the last three days which have taken us similarly down and/or greatly slowed page retrieval at various times. Given the much higher profile BBV has had, it's little surprise that folks who'd rather see patriotic efforts like theirs discontinued would work feverishly to disrupt it.

Ms. Harris and BBV has been spearheading a huge "Freedom of Information Act" filing to collect and review audit logs and other materials from the election in some 3,000 US counties, and thus, her group has attracted quite a bit of attention in the past week. BBV has been attempting to warn Americans for at least the past year about the ticking time-bombs of unregulated, unauditable, and privately owned Electronic Voting machines and their corporate owners (the vast majority of them very closely tied to the Republican party).

Attempts to silence and/or disrupt sites like hers and ours, I believe, speak volumes in support of the underlying charges that we've been making. If there was nothing to fear in examining the inner-workings of these companies, and the way that our votes our counted --- specifically in last week's election --- there would be no reason to attempt to silence and disrupt those who are attempting to do so.

In other words, if the election was clean and fair, what's the fear of giving it a close inspection?

Now perhaps the problem at BBV really is simply related to an overage of bandwidth demand, however, given past attacks the site has received, similar attacks here, and the message changing from "Bandwidth Exceeded" to "Cannot Find Server", I'm inclined to believe that the problem is hostile attacks.

To those who claim that the roughly 150,000 (so far) documented votes that have been reported and confirmed by Election Officials as being mis-allocated would not have changed any election results, I'd point out:

1) Those are just the numbers reported by a mainstream media which by and large went "on vacation" after Kerry's "concession" last Wednesday.

2) Many of those mistabulated and/or lost votes discovered were due to software errors that likely exist on many other identical computers in many other counties in America where they may not yet have been noticed and/or reported.

3) The results of at least one ballot initiative last Tuesday has already been reversed when 70,000 previously mis-counted votes due to "software error" were "discovered" in Broward County, FL!

4) There has been a long record of elections in this country being mis-tabulated and/or reversed due to Electronic Voting Machine error in recent history.

Chapter 2 of Bev Harris' book, Black Box Voting outlines tons of those recently overturned elections. Here's the PDF version of Chapter 2, but since it's currently offline as of this posting, here's a summary of just a few such recent incidents summarized courtesy of Hunter over at DailyKos:

In the 2002 general election, a computer miscount overturned the House District 11 result in Wayne County, North Carolina. Incorrect programming caused machines to skip several thousand partyline votes, both Republican and Democratic. Fixing the error turned up 5,500 more votes and reversed the election for state representative.
...
Voting machines failed to tally "yes" votes on the 2002 school bond issue in Gretna, Nebraska. This error gave the false impression that the measure had failed miserably, but it actually passed by a 2 to 1 margin. Responsibility for the errors was attributed to ES&S, the Omaha company that had provided the ballots and the machines.
...
An Orange County, California, election computer made a 100 percent error during the April 1998 school bond referendum. The Registrar of Voters Office initially announced that the bond issue had lost by a wide margin; in fact, it was supported by a majority of the ballots cast. The error was attributed to a programmer's reversing the "yes" and "no" answers in the software used to count the votes.
...
Software programming errors, sorry. Oh, and reverse that election, we announced the wrong winner. In the 2002 Clay County, Kansas, commissioner primary, voting machines said Jerry Mayo ran a close race but lost, garnering 48 percent of the vote, but a hand recount revealed Mayo had won by a landslide, receiving 76 percent of the vote.
...
In the November 2002 general election in Scurry County, Texas, poll workers got suspicious about a landslide victory for two Republican commissioner candidates. Told that a "bad chip" was to blame, they had a new computer chip flown in and also counted the votes by hand --- and found out that Democrats actually had won by wide margins, overturning the election.
...
In 1986 the wrong candidate was declared the winner in Georgia. Incumbent Democrat Donn Peevy was running for state senator in District 48. The machines said he lost the election. After an investigation revealed that a Republican elections official had kept uncounted ballots in the trunk of his car, officials also admitted that a computerized voting program had miscounted. Peevy insisted on a recount. According to the Atlanta Journal-Constitution: "When the count finished around 1 a.m., they [the elections board] walked into a room and shut the door," recalls Peevy. "When they came out, they said, `Mr. Peevy, you won.' That was it. They never apologized. They never explained."
...
A software programming error gave the election to the wrong candidate in November 1999 in Onondaga County, New York. Bob Faulkner, a political newcomer, went to bed on election night confident he had helped complete a Republican sweep of three open council seats. But after Onondaga County Board of Elections staffers rechecked the totals, Faulkner had lost to Democratic incumbent Elaine Lytel. Just a few hours later, election officials discovered that a software programming error had given too many absentee ballot votes to Lytel. Faulkner took the lead.
...
In a 1998 Salt Lake City election, 1,413 votes never showed up in the total. A programming error caused a batch of ballots not to count, though they had been run through the machine like all the others. When the 1,413 missing votes were counted, they reversed the election.

If an official investigation doesn't take place immediately, there is little hope of determing the correct winner of any number of races from last week's election. Not the least of which is the race for President of the United States. And I would think, especially after four years of questions about George W. Bush's legitimacy as "President" that even the Right Wingnuts would like to be able to demonstrate once and for all to the American People that he was, in fact, legitimately elected this time.

Apparently, it's up to us to find the answers.
(Sshhh...Don't wake media.)
By Brad Friedman on 11/9/2004 9:25pm PT

Excellent and cogent analysis and action items concerning Florida and the Exit Polls from Ian Welsch over at BOP. Please give it a look and see if you can help.

I would add one further question/action item to Ian's list. It would be useful to learn what type of counting machine was in use in Broward County when it began subtracting votes from the tally, due to a bug in the software, and what other counties in Florida and/or the rest of the country used the same machine and software. 70,000 votes were "found" in that incident, and a local initiative overturned with the discovery of them.

The code used in these machines is not written separately for each individual machine that I know of. If the error occurred once in Broward (and was reportedly noticed), where else did it also occur and not get noticed?

Ditto for the UniElect machine in North Carolina that entirely lost at least 7,000 votes in a single county because it's memory chip only held 3005 votes instead of the 10,000 that manufacturer UniLect had promised. Where else was the same type of computer in use? I know Ohio used UniLect machines, and they reported unfixable problems with them on Election Day, but I haven't been able to tell if they were the same type as those in North Carolina.

(It must be up to us to figure this crap out, because the MSM is enjoying their well-deserved nap.)
