North Carolina counties which use touch-screen voting systems will now have to post a "Voter Alert" at precincts warning voters about potential problems with the machines following a complaint [PDF] filed in federal court by the state's Republican Party on Friday. The lawsuit, heard today on an expedited basis, was filed after voters in several counties had reported to party officials that their attempts to vote for straight-ticket Republican ballots were flipping on the screen to straight-ticket Democratic ballots.

Those reports of vote-flipping led to the NC GOP issuing a threat late this week to sue the State Board of Elections (BoE) if their demands were not met to order certain precautions be taken at polling places which used the 100% unverifiable Direct Recording Electronic (DRE, usually touch-screen) voting systems. After the Executive Director for the BoE sent a letter in response to the GOP's demands, downplaying the reported incidents as "isolated" and "no different than ones that must be addressed in every election," the Republican complaint was filed in federal court on Friday afternoon. (The sharp letters back and forth between the state GOP and BoE can be read in our previous report on the NC situation.)

Judge Malcolm Howard tonight also ordered that pollworkers must tell voters to read the printed alert, and that memory cards and other programming materials, records and audit logs from the oft-failed ES&S iVotronic touch-screen DREs must be preserved for examination after the election. Late today, the BoE Executive Director Gary O. Bartlett sent a notice [PDF] to the County Boards of Elections detailing the changes ordered by the federal judge.

The "Voter Alert" to be posted in all precincts using the touch-screen voting systems must read as follows...

Unlike Jan Brewer, who was elevated from Arizona's Sec. of State to Governor by Obama's ill-considered selection of Janet Napolitano from AZ Governor to Director of the U.S. Dept. of Homeland Security, the state's newly appointed Republican SoS, Ken Bennett seems to have the ability to tell the truth every now and again --- even in the days just prior to a hotly-contested election...

"I take seriously any allegations of fraud in our election process," he said. "As soon as these accusations came to light, we got in contact with elections officials in Yuma County and across Arizona to determine if a fraudulent scheme was afoot. With our initial inquiry complete, I'm happy to report that these latest allegations of rampant registration fraud are without merit."

GOP attorney: ES&S iVotronic 'systems should have been banned'

[UPDATE 10/30/10: The North Carolina Republican Party has both filed and won their suit against the State Board of Elections. See details at end of article for more.]

It would have been nice if these guys had spoken up years ago, when the bulk of the Republican Party and their sympathizers were labeling Democrats as "conspiracy theorists" and "sore losers" for their documented complaints of touch-screen voting systems flipping votes on screen to Republican candidates. But better late than never, we suppose.

This afternoon, Legal Counsel for the North Carolina Republican State Executive Committee sent a letter [PDF] to the NC State Board of Elections threatening legal action if their "demands" were not "immediately" met for taking a number of specific actions to mitigate reported touch-screen voting problems describes as "significantly more widespread than the NC GOP initially understood."

The GOP attorney, John E. Branch III writes that the voting system problems should have been addressed prior to the early voting period "and, to the extend they were not, the touch screen systems should have been banned."

The problems in contention are related to reports of the state's ES&S iVotronic e-voting systems reportedly showing votes as flipping from Republicans to Democrats on the screen. The threat from the state GOP comes on the heels of complaints made last week in two different NC counties, Craven and New Hanover. Those reports were a switch from previous years when voters in dozens of states had reported votes flipping largely from Democratic to Republican.

Branch charges that the party has "received word" that similar problems have emerged in "Mecklenburg...Randolph...Cumberland, Wilson, Pender, Forsyth, Lenoir and other counties," which all similarly use the oft-failed, 100% unverifiable ES&S touch-screen voting machines. The same systems are also used in more than a dozen other states...

After reports of ES&S touch-screen votes flipping away from Republicans, for a change, over the last several days in North Carolina and in Texas, reports are now coming in from Nevada about similar occurrences on that state's Sequoia touch-screens, just in time to underscore the importance of my story published today at Truthout, "Hacking Harry Reid (or Sharron's Angle)" arguing that one or both of the candidates locked in the Silver State Senate Standoff need to get to a court immediately, even though neither of them are likely to do so.

First, the reports of touch-screen troubles today in NV (which closely mirror the scores of reports in the same state that I detailed exclusively in 2008 as affecting Obama and the Democrats during early voting). This time, however, it's Republican voters charging trouble with touch-screens...

County GOP Chair: The ES&S machines 'ain't worth a damn, we ought to go back to paper ballots'

Aaand the touch-screen voting machines continue to flip votes during the early voting period. Right on schedule. Just as always. But, for the second time this week we have the unusual occurrence of votes reportedly flipping away from the GOP.

Yesterday our report was of a touch-screen in Dallas, TX, caught on video flipping an attempted vote for Republican Gov. Rick Perry to straight-ticket Green Party selections in Dallas, TX.

Today's report, where the local election official is also misleading voters by downplaying the incident, comes from the same type of 100% unverifiable ES&S iVotronic touch-screen voting machine, but it took place in Craven County, NC, according to P. Christine Smith of the Sun Journal...

A Craven County voter says he had a near miss at the polls on Thursday when an electronic voting machine completed his straight-party ticket for the opposite of what he intended.

Sam Laughinghouse of New Bern said he pushed the button to vote Republican in all races, but the voting machine screen displayed a ballot with all Democrats checked. He cleared the screen and tried again with the same result, he said. Then he asked for and received help from election staff.

"They pushed it twice and the same thing happened," Laughinghouse said. "That was four times in a row. The fifth time they pushed it and the Republicans came up and I voted."

"Something is not right here," [Craven County GOP Chair Chuck] Tyson told the Sun Journal. He said he "got two or three calls" from people describing the same problem while they were voting.

Tyson also went on to report there were long lines reported as voters waited to use the two touch-screen voting machines available at one location (paper ballots don't cause that problem) and, even more disturbingly, "machines reporting 250 ballots cast where 400 voters had signed in to vote."

Well that's a problem, isn't it?...

Systems uncertified for state-mandated Instant Runoff Voting...

Well there's a twist! Hopefully you weren't drinking coffee when you read the headline.

How often do you hear of a voting vendor saying they really really (really!!) do not want to break the law, but state officials are forcing them to? But that's exactly what's about to happen in North Carolina where the first statewide use of Instant Runoff Voting (IRV) could produce, according to some, a "train wreck" this November.

Four years ago, the state legislature created new rules for special elections needed to fill vacancies in the state's appellate courts. They apply when an opening occurs on the bench after the primary but at least 60 days before the general election. If more than two candidates file to run, voters are asked to indicate their first, second and third choices on the ballot. If no candidate receives a majority of first-choice votes, the winner is determined by adding the second- and third-choice votes.

But while election officials are mandated to run IRV elections, there is actually no state or federally certified software to tally Instant Runoff Voting on North Carolina's e-vote systems and the representative for the vendors, ES&S and PrintElect, says the companies "cannot be held responsible for issues as a result of IRV"...

Today we have reports that ES&S software actually flipped votes in three races at one polling place in Crawford Co., Kansas. We also have reports that ES&S software incorrectly reported results in one race in Polk Co., North Carolina.

The long count of votes in Hillsborough Co., Florida, seems to be over with the blame for problems being put, where else, on “human error.” It seems that Premier/Diebold had warned Florida users of their high-speed OSX voting machines that those machines could not take a high-volume of ballots without bogging down and causing problems. Hillsborough ignored that warning. However, why would a vendor put out a system for use in elections that cannot be used in a high-volume of ballots. King Co., Washington, wanted badly to use that system. If they had it would have been a disaster....

With 17 Days To Go, Myriad Voting Obstacles Faced by Tens of Thousands in Dozens of States
As Fox 'News' Discusses Just One Issue (and It's Completely Phony)...

See below for a rather breathtaking "Round-up of Problems Facing Voters Nationwide", such as registration backlogs, illegal voting roll purges, deceptive practices and dirty tricks, etc., now plaguing American voters across the country with just 17 days left before our country's biggest election ever.

All of that, while Fox "News" (whose asked me to come on live tomorrow, Sunday, at 2:40pm PT, btw, along with my old friend John Fund "for balance") continues to misreport, alarm and deceive their viewers in regard to the GOP's phony ACORN "voter fraud" fraud. Unfortunately, it's not just Fox who is irresponsibly and dangerously misreporting that scam --- though they seem to have made a small cottage industry out of it of late --- CNN and MSNBC have been filed loads of equally inaccurate and misleading reports on it as well.

But take a look at the "Round-up" below, sent this afternoon via email by the 866ourvote.org Election Protection coalition of non-partisan election watchdogs. And keep in mind that their summary below doesn't even mention the myriad electronic voting issues we've been reporting here of late --- touch-screen votes flipping, paper ballot electronic tabulators that can't count correctly or that add thousands of "phantom votes" or that drop thousands of real ones etc. --- cropping up, yet again, across the country...

We've been reporting on the GOP's October "Surprise" over the last few days (challenges to Democratic voter registrations in a number of states, and, perhaps more notably, their bogus PR campaign to charge that ACORN, a community organization that heroically registers millions of low-income voters who nobody else bothers to, is committing "voter fraud." See here, here and here, for example.)

But the November Surprise, as we've been trying to warn for many months (if not years), will undoubtedly be the thousands who show up to the polls to vote on November 4th, only to find out that they have somehow "fallen off" the voter rolls.

We've urged folks to check their registrations, even if they recently voted in a primary election, to make sure they haven't been purged (info on how to do that quickly in all 50 states, right here).

Late last month, CBS News reported on voter purges occurring in at least 19 states across the country, many of them swing states, naturally.

Today, the New York Times has published a scathing report, based on a detailed investigation revealing that "Tens of thousands of eligible voters in at least six swing states have been removed from the rolls or have been blocked from registering in ways that appear to violate federal law."

Several days ago, in this space, we recommended that voters who have the ability to vote “straight party” do not exercise that right. Yes, it is easier because all you have to do is mark one box on the ballot for the top-of-the-ticket votes are all taken care of for you. However, consider this. In North Carolina (and South Carolina also) the “straight party” vote does NOT include President.

According to the first “Featured” article, ballots in North Carolina have the following words: “A Straight Party vote is a vote for all candidates of that party in partisan offices. Individual partisan office selections are not necessary if you select a Straight Party below.” What the ballot doesn’t tell you is that this does not include President. How many thousands of voters will vote straight-party but not for President in North and South Carolina?

In our second “Featured” article we learn another good reason not to vote straight party. New Mexico is one of the states that allows straight party voting, including the presidential race. However, if the ballots are not properly programmed and thorough pre-election testing is not accomplished, there is no telling what may be the result of voting straight party. Voters should not take a chance that the county has tested thoroughly. Voters should not take a chance that their machine may not even register straight party votes for their party while it does for the other party. Don’t trust them. Forego the “straight party” selection and pick each candidate individually.

The straight party states are: North Carolina, South Carolina, New Mexico, Utah, Oklahoma, Texas, Alabama, Kentucky, Pennsylvania, Iowa, Wisconsin, Michigan, Indiana, West Virginia, and Rhode Island. ...

Eason III, the director of the state of North Carolina's Standards Laboratory in Raleigh, was forced to resign this week because he refused to follow an order to lower the laboratory's flags in honor of former North Carolina Sen. Jesse Helms, who died late last week. Eason, 51, had worked for the state for 29 years, the entirety of his career.

CNN:

Former U.S. Sen. Jesse Helms, a North Carolina Republican who became an icon to conservatives, died Friday at the age of 86, a senior congressional source said.

The Heritage Foundation, a conservative think tank, announced on its website that he died at 1:18 a.m. Friday after having been ill in recent years.

Helms retired in 2002 at the end of his fifth term in the Senate.

When the Republicans were the majority party in the Senate, Helms was chairman of the powerful Foreign Relations Committee, where he consistently moved U.S. policy toward the right, especially regarding the United Nations and Cuba.

He also held seats on the Agriculture Committee, where he looked out for North Carolina's extensive tobacco industry, and on the Senate Rules and Administration Committee...

Helms had an operation in 2002, at age 80, to replace a faulty prosthetic heart valve put in place in 1992, when he also had quadruple-bypass surgery.

Charlie Black, John McCain's senior adviser, made news earlier this week when Fortune Magazine editor David Whitford reported that Black told him "with startling candor" when asked how a terrorist attack inside the United States would affect the campaign, "Certainly it would be a big advantage to [McCain]."

Keith Olbermann has been reporting on this story all week on his MSNBC news hour, in part to make that point that if a Democrat had made a similar gaffe, the Beltway punditocracy would have been in high dudgeon, demanding the adviser's head on a pike and lambasting the candidate for associating himself with such scum.

Longtime political junkies know that Charlie Black was among a handful of angry young rightwingers who remade the Republican Party after the debacle of Richard Nixon's resignation. Along with Roger Stone, Terry Dolan, Lee Atwater, Karl Rove and George Bush Jr., he is one of the inventors of today's GOP attack machine, a style of media-driven slash and burn politics that can be traced to the establishment by Black, Stone and Dolan in 1975 of a political action committee that raised millions from conservatives using deceptive direct-mail advertising and spent the money on TV ads that slimed Democrats.

Black, one of the most successful lobbyists and political strategists of the Reagan and Bush eras, has backed his share of losers over the years, too. But even when he has bet on the wrong horse, he has always landed on his feet --- which may explain why John McCain needs Charlie Black this year much more than Black needs McCain.

ALSO: Voting Machine, Registration Roll Problems Reported to National Election Protection Hotline...

The non-partisan Election Protection coalition offers a mid-day press release detailing some of the problems being reported to their 1-866-OUR-VOTE hotline today from both Indiana and North Carolina.

The Supreme Court's recent, outrageous approval of Indiana's restrictive and disenfranchising Photo ID law --- better described as their Voter Suppression Act, despite Scalia's claim that "the burden at issue is minimal," to him, anyway --- is already "working" to disenfranchise legal voters, denying them their right to cast ballots like everyone else.

According to EP, it's not just veterans, elderly, and minorities who are being affected by the ruling, so are young voters and, yes, nuns, who have reportedly already been disenfranchised today under the Republican law...

This morning, in South Bend, Indiana, a freshman student at St. Mary's College, excited to vote for the first time, left the polling place in tears because she only possessed a private college ID and was unable to vote. The poll workers, nuns at a local convent, were trying to help the young student through her problem. While they were helping her, they realized that some of their fellow nuns, who had just arrived at the polling place, also could not vote because of the photo ID law. Not only was this group of nuns disenfranchised, but so would be four floors of retired nuns in their convent.

Remember, the law was upheld by the Supremes just last week, despite Indiana's inability to point to a single instance of in-person, polling place, voter impersonation fraud (the type of "voter fraud" the law was purportedly meant to deter) in the entire history of the state.

UPDATE: Brad Jacobson has more on the dangerous "roaming pack of octogenarian and nonagenarian hooligans [nuns, who] attempted to exercise their right to vote," including one of them, a clearly-up-to-no-good, 98 year-old, trouble maker who Catholic Antonin Scalia and friends don't believe deserves the right to cast a ballot.

Milwaukee Magazine's Bruce Murphy notes today that if a study recently done in Wisconsin correlates to numbers in Indiana, as many as 620,000 citizens in the Hoosier State might lack the Photo ID needed to cast votes there. That, even as the state downplayed the numbers in the SCOTUS case, arguing that there were only 43,000 such voters there. The authors of the WI study were unable to check the same numbers in Indiana, because "the Indiana Bureau of Motor Vehicles would not provide the data needed to do the study," reports Murphy.

EP's news release goes on to list a number of other incidents being reported (if not yet by the corporate media) so far during voting today in IN and NC both, including multiple reports of voting machines problems; paper ballots not being offered to voters when machines go down; registered Independent voters being disallowed from voting in either party's primary; or voters being given Republican ballots when they believed they were registered as Democrats.
