Today on The BradCast: Trump's authoritarianism receives yet another greenlight from his corrupted SCOTUS just days after he signed a budget bill that makes ICE larger than the entire militaries of many countries. [Audio link to full show follows this summary.]

Sorry in advance for the less than cheery news on much of today's program. We don't invent it. We just report it...

  • Last week, the Trump Administration's Environmental Protection Agency took a huge swing at the First Amendment's Constitutional free speech "guarantees" when it placed about 140 staffers on leave. Their crime? Signing their names on a letter to EPA chief Lee Zeldin, detailing concerns about the current direction of the agency, including its use of misinformation and implementation of a dangerous partisan agenda that contradicts science and "undermines the EPA mission of protecting human health and the environment". A Trump EPA spokesperson described the dissenters, now facing investigations, as "unlawfully undermining, sabotaging, and undercutting the administration’s agenda."
  • Today, just before air, in an unsigned opinion [PDF] issued on the so-called "shadow docket", Donald Trump's corrupted SCOTUS overturned lower district and appeals court rulings that had previously blocked the Administration's mass layoffs of hundreds of thousands of government workers across dozens of agencies. The ruling came as part of a lawsuit filed by dozens of unions, non-profits and local governments which argue that only Congress, not the President, can order agency-crippling layoffs. The challengers had won injunctions in the lower courts to prevent the layoffs until after the suit had been fully heard. Today, SCOTUS said there is no need to wait because, contrary to the lower court rulings, the Justices believe the Government "is likely to succeed on its argument." Tens, if not hundreds of thousands of workers at the Departments of Agriculture, Commerce, Energy, Labor, Treasury, State, Health and Human Services, Veterans Affairs, the EPA and elsewhere are now expected to be permanently laid off, even as the trial continues to play out in the lower courts.
  • On Monday, scores of fully-armed and camouflaged federal immigration agents --- apparently led by Immigration and Customs Enforcement (ICE) and Customs and Border Protection (CPB) --- along with members of the U.S. military, descended upon MacArthur Park here in Los Angeles in armored vehicles and on horseback to take over the nearly empty park. It's unclear if any migrants were actually detained at all. But the ridiculous display was code-named "Operational Excalibur" and meant as a conspicuous "show of presence", according to internal Army documents obtained by national security journalist Ken Klippenstein.

    The ostentatious show of force comes just days after Donald Trump signed a massive spending and tax cut bill that will gut health care and food assistance to millions of Americans; slash renewable energy initiatives meant to combat climate change; give huge tax cuts mostly to wealthy people; while increasing the national debt by about $3 trillion.

    But the new law will also, as JOSH KOVENSKY, investigative journalist at Talking Points Memo joins us to explain today, massively expand the nation's immigration enforcement infrastructure by, among other things, supersizing ICE. The agency currently operates on an annual budget of around $9 billion. That will now tripled to about $27 billion annually, as the Trump/Republican bill pumps around $170 billion in new spending into detention and deportation efforts through 2029.

    As Kovensky reported on July 4th, when Trump signed the bill into law, the ICE budget will now be larger than the U.S. Bureau of Prison, the FBI, and even the U.S. Marine Corps. This new, virtual military branch, will unleash its newly gained power not in foreign lands, but right here in the good ole' U.S.A.

    Much of the funding will go towards a "drastic expansion" of detention, Kovensky reports, as the Trump Administration continues to "push people to voluntarily leave the country."

    "If you think about MacArthur Park, it was one park," he tells me, citing the obnoxious Monday incident in L.A. "But now, with all this money, they can try to replicate this across the country. With all of these new officers they're hiring to detain people, all these camps they are going to be building to hold them, you're going to be seeing scenes like this play out nationally. I think that's the real risk, and something people should be expecting."

    With the massive budget increase, Kovensky warns of the ongoing threat of increased militarization, not just against migrants (much less the few that can be found with criminal records), but political opponents of the Administration in the wake of recent questionable arrests against Democratic judges, mayors, and other elected officials.

    "More than half the people who are currently in immigration detention awaiting removal have no criminal record," Kovensky observes. "I think that's a tell. The resources they're putting into this dramatically exceed what would be needed to focus only on criminal aliens."

Massive 'No Kings' rallies across nation; Trump's military parade flops; Israel bombs Iran; Political assassination in MN; Callers ring in with reports from their own protest experiences...

Going into the weekend we knew we were in for a bizarre news split-screen on Saturday, with major protest rallies scheduled across the country and Trump's military birthday parade he threw for himself (with $40+ million of your tax dollars) in D.C. But, it wasn't just two huge stories happening at once by Saturday. It was four. We try to get you caught up on all of them on today's BradCast before opening the line to callers. [Audio link to full show follows this summary.]

All of the stories happening all at once over the weekend, were all thanks to Donald Trump in varying ways...

  • First, on Friday night, Israel unleashed a full-scale attack against Iran, killing its three top military commanders and several nuclear scientists --- among many others. The pretext for the attack was Iran's nuclear program which, had Trump not torn up the JCPOA (Joint Comprehensive Plan of Action), the hard-fought and carefully constructed nuclear deal Iran agreed to in 2015 with China, France, Germany, Russia, the UK and the U.S., there wouldn't even be a program for Israel to target. The strike came after Trump failed to strike a new nuclear deal with Iran, which had restarted its nuclear program after Trump reneged on the original deal. He had been begging them for the last month to agree to a new deal to limit its nuclear program that is almost identical to the one struck under Obama that Trump tore up during his first term. The ongoing volleys of missiles between Israel and Iran have also led the Trump Administration to call back the Voice of America Persian-bureau after foolishly (and unlawfully) shuttering VOA and its sister networks back in March.
  • In the early Saturday morning hours, a long-time Trump supporter disguised as a policeman assassinated the Democratic leader of Minnesota's House of Representative, Rep. Melissa Hortmann, and her husband inside their own home. Hortmann, as House Speaker in 2023-2024, was a key player in passage of a host of popular progressive initiatives under Gov. Tim Walz that came to be known as the Minnesota Miracle. The same shooter also attempted to assassinate Democratic state Senator John Hoffman at his house just prior. Hoffman and his wife remain alive but in critical condition after Hoffman was shot nine times and his wife eight times. The alleged rightwing assailant, 57-year old Vance Luther Boelter, was found to have had a list of some 70 names on a target list in his car. The names were reportedly Democratic officials, both state and federal, and champions of abortion rights. Officials also say he had a number of "No Kings" flyers in the car, suggesting he might have been planning to target one of Saturday's many protests in the state. After a two-day manhunt, Boelter was captured late on Sunday in a cornfield south of Minneapolis/St. Paul. He was charged on Monday with both state and federal crimes including assassination and attempted assassination. It is just the latest example of increasing political violence by the right in the Trump Era, as warned about for years, even by his own FBI Director who conceded that domestic homegrown terror from those on the right --- not by migrants --- was, by far, the greatest threat currently facing Americans.
  • The third major weekend story happening all at once that wouldn't have happened if not for Donald Trump, was the authoritarian-style military birthday parade he threw for himself (though we paid for it) that happened to fall on the U.S. Army's 250th birthday as well as Trump's 79th. It was, by almost all accounts, a sparsely attended snoozer of a parade which saw even Trump supporters streaming away long before it was over. Of course, the manhunt for the MN assassin and the war in Israel/Iran, thankfully, sucked up most of the cable TV news coverage.
  • In likely --- or hopefully --- the most important news of the weekend, some five million Americans took to the streets to stand up against the President in "No Kings" protests decrying the rising fascism of Donald Trump, including his deployment of military troops against Americans on U.S. soil and his burgeoning military-style migrant round-ups by ICE. According to organizers, enormous and joyful rallies were held in more than 2,000 cities and town in all 50 states. They were almost all entirely peaceful but for a man who brandished a rifle at protesters in Salt Lake City, UT (a protester was killed); a counter-protesters who pulled a handgun on rally-goers in Phoenix, AZ; and an SUV driver who struck and injured a demonstrator before speeding away in Riverside, CA.

    In Los Angeles, late in the day, there was a bit of violence as well. But, as all reporting seems to indicate (David Dayen's at TAP was the best) it was local law enforcement officials from both the L.A. County Sheriff's Dept. and the LAPD who sparked the violence with their unannounced use of horses, rubber bullets and teargas to suddenly clear demonstrators at 4pm, hours before the rally was to have ended in Downtown L.A.

Sadly, it's another in our Trump 2.0 Era "Then They Came For..." series on The BradCast, which previously included "the Judges", "the Mayors" and "Members of Congress". In today's case, at least, the victim, a U.S. Senator, was roughed-up and handcuffed but not arrested and was fairly quickly released. But those elected officials are hardly the only folks they are now coming for in Donald Trump's "New Police State". [Audio link to full show follows this summary.]

Among our stories today highlighting that New Police State, Trump's continuing failures as President on several fronts, and his ongoing war with the Golden State...

  • Breaking shortly before airtime... Just two days after the Trump Administration's corrupted and actually weaponized Dept. of Justice indicted a sitting Democratic U.S. Congresswoman from New Jersey on absurd assault charges related to allegedly impeding the arrest of Newark's Democratic Mayor (for whom all charges were soon dropped), California's Democratic U.S. Senator Alex Padilla, the state's first Hispanic Senator, was roughed up on Thursday, forcibly pushed out of a room where Homeland Security chief Kristi Noem was holding a press conference in L.A., was thrown onto the floor by FBI agents and handcuffed after he'd peacefully dared attempt to ask a question of Noem.
  • A new Quinnipiac poll finds that Donald Trump is being rejected by voters on virtually every front. His approval rating in the survey of more than a thousand registered voters has now fallen to 38%; his budget bill is opposed by almost twice as many as those who support it (while a huge majority of Americans want to see Medicaid expanded or left as is, as opposed to cut, as the Trump/GOP "Big Beautiful Bill Act" would do); and he is deeply underwater on every single issue they polled on, including immigration, deportation and the economy. New polling out today from AP/NORC finds similarly poor numbers for the President, which is largely unprecedented in modern times this early in a new term.
  • Those 4,000 California National Guard soldiers federalized by Trump and deployed against Americans on U.S. soil over the weekend against the wishes and needs of the state's Governor and the Los Angeles Mayor? They aren't getting paid yet, according to Military.com, which cites military sources describing a chaotic, still-incomplete activation, leaving soldiers without pay, a place to sleep, food, amid a local community uncharacteristically unsupportive of the deployed troops.
  • But Trump's New Police State is not only rolling out in large cities. WaPo's Catherine Rampell has a chilling story of heavily armed masked men, claiming to be federal agents (while refusing to show ID), showing up with out-of-state plates to sweep up migrant gardeners in a tiny New England town. Yes, Trump's New Police State is coming to a town near you as well, no matter where you live.
  • On Thursday at the White House, Donald Trump signed three bills that were recently --- and perhaps unlawfully --- rammed through the Senate by Republicans in violation of its rules, nuking the filibuster in the bargain to do so. They are meant to strip California of its legal right to establish its own clean air and car pollution standards. Specifically, the new laws, if they are allowed to stand --- CA has already said they are filing suit --- would, among other things, ban the state's 2036 deadline for phasing out the sale of new, gasoline-only cars and trucks. A dozen or so other states have previously adopted CA's now "banned" standards. Despite the fact that used all-gasoline cars and trucks could still be sold and that those who really wanted a new one could still buy them from another state in 2036, this is apparently what Trump has been falsely describing as "Joe Biden's EV mandate" for years now. Today, once again, he did another solid for his owners in the fossil fuel industry. Desi Doyen has the full scoop and context.

It's all so stupid and ridiculous. But, as discussed on today's BradCast, the stupidity and ridiculousness knows no bound now that he's won a criminal immunity ticket from the Supreme Court. So we will all pay the price until voters change the score. [Audio link to full show follows this summary.]

To that end, Gubernatorial primary elections were held in New Jersey on Tuesday for this November's general election. Democratic U.S. Rep. Mikey Sherrill, a Navy pilot and former prosecutor, will face off with Trump-endorsed Republican Jack Ciatterelli, who came within just about three points of unseating the state's now termed-out Democratic Gov. Phil Murphy four years ago.

Perhaps more interesting on Tuesday were six state legislative special elections held in three different states. Democrats outpaced expectations in five of them, including one in Tulsa, Oklahoma, where a native American candidate trounced her Republican challenger by a landslide 69 points! The results amounted to a 50-point over-performance by the Dem as compared to their results in the Presidential election in the same district last November. In all, Dems are now running an average of about 16.4 points ahead of their 2024 results in special elections in 2025.

Then, it's back once again to the mess here in Los Angeles, which isn't really a mess at all. Or, at least, it wasn't until tough guy Donald Trump decided to pretend that largely peaceful protests against his immigration policies required him to violate the law to federalize California National Guard troops and deploy them with the U.S. Marines to support the ICE round-ups of hard-working, non-criminal migrants in the city including, apparently, children.

In a televised address on Tuesday night, CA's Governor Gavin Newsom, who, along with L.A. Mayor Karen Bass, opposed Trump's federalization and deployment of troops in the city, described the President's "authoritarian", wannabe "dictatorial" tactics. He warned that Trump is now waging war on democracy and the Constitution itself, and that Americans outside of California can expect to see much the same thing soon in their own hometowns. Will Americans heed his warning?

We're joined today by fellow L.A. resident HEATHER DIGBY PARTON, award-winning Salon columnist and longtime Digby's Hullabaloo proprietor, and another OG blogger friend known simply as 'DRIFTGLASS', co-host of his weekly Professional Left Podcast. As usual, they are here for a roundtable discussion to help us make sense of it all...as senseless and stupid as it all is.

Both share thoughts on what they see as the real point of Trump's dumb but dangerous incitement of violence here in L.A., what it is meant to distract from, and where all of this is headed. Is there any chance this doesn't lead to an invocation of the Insurrection Act by Trump, so he can really violate the law, American values, rights, and the Constitution itself?

"Donald Trump simply has no reason to obey the law anymore, of any kind, for any reason," argues Driftglass. "They feel no compunction about breaking the law because there's no one to stop them" Because he was elected, after receiving criminal immunity from SCOTUS, he believes "he can do whatever he wants. It's an ugly, terrifying fact that we warned people about for years. We begged people not to do this. We still came up short, because 77 million or so people voted for exactly this."

But, will even MAGA support the deployment of U.S. troops on American streets? Something that Republicans, including MAGA, have pretended for years to oppose? "As long as Trump is doing it, they'll be for it," asserts Digby. "The minute it's not him, they'll be against it. They retired the concept of hypocrisy a long time ago."

It is going to worse before it gets better, she warns, citing Trump's top henchman Stephen Miller who, she says, "has given interviews saying that they have plotted this out. Plan B, Plan C. They've been thinking this stuff through. This is actually part of their plan. They're testing the electrified fence here to see what they can get away with."

There is, of course, much much more from both of them today, including on a couple of stories you may have forgotten about for some reason, from just days ago. For example, last Friday, less than a week ago, Elon Musk publicly accused Trump of being named in the unreleased Epstein Files. Also, if you remember, Congressional Republicans passed a bill to slash $1.4 trillion worth of health care and food assistance from low-income Americans to help defray the cost of some $4 trillion in tax cuts mostly for the wealthy, at the cost of a $3 trillion spike to the national debt.

Remember when Republicans used to care about such things? As Digby sez: "They retired the concept of hypocrisy a long time ago"...

We've got a bit more on today's BradCast regarding Team Trump's attempt to distract from the many failures of his Administration by hoping to frighten Americans with the deployment of military assets against those of us here in Los Angeles. Plus, we've got a number of other stories that I suspect they would be happy for us not to tell you about today. [Audio link to full show follows this summary.]

The City of Angels continues to hang tough against the Trump Administration, even as horrible human and DHS Secretary Kristi Noem, last night, described the city of nearly four million people as "a city of criminals". The pathetic insult against the nation's second largest city came after Trump federalized 4,000 California National Guard troops against the wishes of the state's Governor, Gavin Newsom, and deployed 700 U.S. Marines to L.A., purportedly to help ICE round up migrants as part of the Administration's by the San Francisco Chronicle from Noem to Fox "News" host turned SecDef Pete Hegseth, the DHS chief requests Hegseth order military troops to actively participate in arrests and detentions on U.S. soil, an apparent violation of the law, unless the President invokes the Insurrection Act first under certain circumstances. Her letter suggests the Administration is preparing to do exactly that. Or she doesn't understand how the law works. Or both.

In 2020, after George Floyd was murdered, spurring far larger protests than the relatively minor ones we've seen here in L.A. in recent days, Donald Trump insisted it would be against the law for him to federalize and deploy troops against the wishes of a Governor. "We have laws. We have to go by the laws," he insisted at the time. "We can't move in the National Guard. I can call 'insurrection' but there's no reason to ever do that. We can't call in the National Guard unless we're requested by a Governor."

Things change. Presidencies fail. The protests against the Administration in cities large and small are expanding by the day from coast to coast.

President federalizes CA National Guard, deploys U.S. Marines in defiance of Guv, Mayor, laws to distract from all of his other, ongoing failures...

Never mind all that stuff about Donald Trump's breakup with his best buddy on Friday, including Elon Musk's claim that Trump is blocking the release of the Jeffrey Epstein Files because he's featured in them. There's RIOTING AND LOOTING IN LOS ANGELES! ... according to Trump's social media feed.

As discussed on today's BradCast, however, from here in L.A., relatively minor weekend demonstrations against Trump's daily ICE quotas for arresting migrants --- now including day laborers outside of Home Depot, children and U.S. Marshals --- don't amount to much of a "riot" by L.A. standards, no matter what they may be showing you on cable TV or social media. [Audio link to full story follows below this summary.]

It was another lovely, mild, sunny day here in Southern California today, just as it was over the weekend. At least until Trump's federal Immigration and Customs Enforcement (ICE) brownshirts opened fire with tear gas and flash-bang grenades against largely peaceful demonstrators in a couple of small blocks downtown and a small city about 30 minutes south of downtown.

But I'm sure wall-to-wall media coverage and social media algorithms are telling folks out there a very different (and completely unhelpful) story about what is going on here.

In case they aren't, Trump is hoping to grab your attention by abusing his authority again, this time by federalizing the California National Guard against the wishes of both the state's Governor and the Mayor of Los Angeles. Moreover, late today, Trump is said to be deploying the U.S. Marines here, for some reason, in defiance of the U.S. Constitution. But the rule of law and Constitution are for suckers and Democrats, right?

We're happy to report on today's program what is actually going on today here in Los Angeles. Though it is fun to see that Trump --- after recently pardoning thousands of actually violent insurrectionists who actually launched a deadly riot against federal law enforcement officials at the U.S. Capitol a few years ago --- now thinks all of that, at least when it happens in California, is a bad thing.

Not that anything like what Trump incited among his followers on January 6, 2021 is happening here. Not even close. We have far larger demonstrations in this town about every other week just because it's a Thursday. Anyway, tough guy Trump would like you to discuss all of this, rather than his break-up with Elon and all of his other non-stop criming. So, I guess we make his dreams come true on today's program.

Among just some of our source material today...

  • ICE is so desperate to meet Stephen Miller's 3,000-arrests-per-day quota, that they mistakenly arrested and detained a member of the U.S. Marshal Service recently. Instead of being shipped off to a super max prison in El Salvador, the arrestee who matched the "general description of a subject being sought by ICE", was eventually released once other law enforcement officials vouched for him.
  • CA Governor Gavin Newsom charges that Trump's seemingly unlawful federalization of the California National Guard "is purposely inflammatory and will only escalate tensions". The state is now suing him to stop it. Newsom notes, correctly, that L.A. authorities have access to plenty of law enforcement officials to handle a handful of violent protesters amid the weekend's largely peaceful demonstrations. By Sunday night, in an excellent interview by NBC News' Jake Soboroff, an "unfazed" Newsom dared the Trump Administration to arrest him --- as Trump's "Border Czar" Tom Homan threatened against both him and Mayor Karen Bass --- and underscored again that Trump is little more than a bully whose tough guy act is being carried out because he is "trying to incite violence."
  • Trump's unnecessary deployment of federal troops was so poorly planned, by the way, that Guard Members are being forced to sleep on the floor in an L.A. federal building basement or on the street. Photos here.
  • His federalizing of the National Guard against the wishes of the Governor (and his mobilization of U.S. Marines) for this purpose is both unprecedented and likely unlawful under the Title 10 authority he has invoked. But if you think he will only do this in L.A. or California, think again. Trump's weekend declaration claims the authority to deploy federal troops --- in violation of the Posse Comitatus Act --- anywhere in the country that he feels like.

Today on The BradCast: The President of the Unites States' war on the U.S. Constitution and Rule of Law continues, even as he keeps losing battle after battle in courts of law, at ballot boxes and in the court of public opinion. [Audio link to full show follows this summary.]

Among our coverage today....

  • At the beginning of last week, we reported the news of the Canada's Liberal Party overcoming an enormous deficit against the Conservative Party last December to triumph in national elections on Monday, when the Conservative Party's Trumpy Leader even lost his own seat in Parliament. By week's end, we saw damned near the exact same story in Australia, where the Labor Party Prime Minister on Friday retained his post (the first time that a ruling PM was elected twice in a row over the past 20+ years) and the conservative opposition lost in a landslide that saw its Trumpy party leader also lose his seat in Parliament as well, for the first time in Australian history. If nothing else, Trump's obnoxious behavior toward our longtime allies seems to be working wonders for center-left political parties in those countries.
  • Trump announced over the weekend that he will place a 100% tariff on movies "produced in foreign lands". Apparently, that would include American-made films shot in other countries, though he didn't explain --- and nobody in the Administration seems to yet know --- how such a "tariff" would actually be levied. Many fear it could also devastate the U.S. film industry. The new tariffs are necessary, Trump lied, because foreign film production is somehow a "National Security threat", according to his social media announcement. (It isn't a national security threat, of course. But I explain on today's show why Trump needs to pretend as much.)
  • As Trump revealed on NBC's Meet the Press over the weekend, he's not entirely sure if Constitutional Due Process, as cited by the 5th and 14th Amendments, is actually mandatory. That despite the Supreme Court making clear that it very much is, and despite his sworn oath earlier this year upon taking office for a second time to "preserve, protect and defend the Constitution of the United States."
  • Clearly, the Rule of Law and Constitution don't mean all that much to Donald Trump, as again illustrated by his four Executive Orders, so far, targeting four different law firms that dare to represent people he regards as political enemies. His clearly unconstitutional orders bar attorneys at those firms from entering federal buildings, interacting with federal officials or taking federal jobs, etc. The largest and first of those targeted firms to challenge an Order is Perkins Coie. They won a resounding victory on Friday when a U.S. District Court Judge in D.C. found [PDF] the entire Order targeting them to be a clear cut case of "unconstitutional retaliation and viewpoint discrimination, plain and simple." She nullified the entire Order in the bargain.

Meanwhile, out here in Los Angeles, three prosecutors in the U.S. Attorneys office for the Central District of California tendered their resignations over the weekend, after Trump-appointed acting U.S. Attorney Bill Essayli appears to have struck a deal with former L.A. County sheriff's deputy Trevor Kirk, after his felony conviction by a jury in February.

Kirk was found by a jury to have injured a 58-year old black woman during what police body cam footage revealed as to be an "unjustifiably violent" arrest. The woman apparently had nothing to do with the robbery that the cops were called to respond to at a grocery store in Lancaster, an hour or so north of L.A., in 2023. But she claimed to be live-streaming the arrest of her male companion, who apparently wasn't involved in the reported robbery either. Kirk threw the woman to the ground, threatened to "punch" her "in the face", hand-cuffed and pepper-sprayed her twice.

The unusual deal between Essayli and Kirk was struck after the jury verdict, but prior to sentencing, which could have resulted in as many as nine years in prison for the now-former cop. The new agreement would change his felony conviction to a misdemeanor with prosecutors seeking probation for Kirk instead of jail time, and no bar on him serving as a cop in the future. None of the attorneys who obtained Kirk's conviction signed on to the new agreement struck on behalf of Trump's acting U.S. Attorney. It must still be approved by a judge.

We're joined today by independent L.A. based legal affairs reporter MEGHANN CUNIFF who was the first to break the story of the agreement before the ensuing resignations of the career prosecutors in the L.A. U.S. Attorney's office in what appears to be a response to the deal their new boss struck, undermining their case. Cuniff, who acknowledges how unusual it is for a deal to be struck after conviction and before sentencing, argues that it's possible the prosecutors might be resigning for other reasons in addition to the unusual post-verdict deal.

After making clear that she is not reporting a direct line between D.C. and the Trump-appointed loyalist Essayli and his deal to drastically reduce Kirk's sentencing, she concedes: "I've never seen it before. It's totally unheard of. You might see it if there's an issue of misconduct during the trial or somebody is cooperating afterward. But the prosecutors are definitely outraged after this."

Cuniff is also not at all certain that the U.S. District Court Judge who oversaw the case will agree to the terms of the deal struck by Trump's prosecutors. At the same time, L.A. County has struck a settlement in a $3 million civil lawsuit filed by the two victims in response to their wrongful arrests.

In addition to the Kirk case, the same U.S. Attorney's office is now reviewing the conviction of Alexander Smirnov, who pleaded guilty to lying to federal officials in 2020 about Hunter Biden having corrupt business dealings with a Ukrainian oil company, "in what prosecutors described as a Russian-influenced operation," says Cuniff.

"As soon as Trump took over, all of a sudden, they are trying to get this guy --- who took a plea deal and was sentenced in January --- out of prison, pending appeal, saying they are going to support his appeal," she explains. "The trial judge wouldn't do it, but they're going to the 9th Circuit [Court of Appeals]. The assistant U.S. Attorney who argued for this is the same one who went to court to argue for Trevor Kirk for a sentencing delay" to allow Trump's attorneys to strike a deal with the dirty cop...

It's one disaster after another on today's BradCast. [Audio link to full show follows this summary.]

Last night, 67 people were killed when an Army Helicopter crashed into an American Airlines jet from Wichita, Kansas as it was coming in for a routine landing at Reagan National Airport in D.C. Everyone in both aircrafts is presumed dead.

Today, even as dozens of bodies were still unrecovered from the icy Potomac River, and before virtually anything was known about the cause of last night's deadly disaster, the President of the United States presented a sick, disgraceful, lie-filled, misinformation-fest, disguised as a White House press briefing. He blamed "diversity" hiring by his two Democratic predecessors for the disaster, while admitting he had no evidence to support his claim, other than his "common sense" and "high level genius." I've got a thing or two to say about all of that on today's program.

While I wouldn't normally have drawn such an inference this soon after such a national tragedy or in just week two of any Presidency, given Donald Trump's appalling comments today, I felt it necessarily to detail that, in his very first week on the job, Trump fired the leadership of the FAA and TSA, as well as the entire membership of an air security and safety commission. He named no acting Director in the meantime at FAA, which had been in the middle of a hiring wave for air traffic controllers --- until Trump ordered a hiring freeze on his second day in office last week. Early reports from the FAA found that the air traffic control tower last night at Reagan National appeared to have been short staffed.

We'll wait for the NTSB's investigation (much less for the recovery of all the bodies) to be complete. But if there is any President to be blamed for what happened last night, the first major air crash in 16 years, it would seem be the "high level genius" currently in office, who thought it appropriate to use racist, sexist, ableist slurs to avoid accountability for his own pathetic, irresponsible actions in the first week of his second shamefully embarrassing Presidency.

THEN... We're joined by JACQUELINE SIMON, Policy Director of the American Federation of Government Employees (AFGE), the nation's largest federal workers union. She's here to discuss the Trump Administration's scammy email sent to some two million federal workers this week --- clearly written by co-President Elon Musk --- offering what many in the media incorrectly described as "buyout" offers this week.

In fact, it's a trap. The emails from the federal Office of Personnel Management --- portending to offer seven months of severance in exchange for workers at scores of federal agencies responding with "RESIGN" in the subject field of an email before February 6 --- were little more than "a barely veiled threat" to federal workers, charges Simon. Sign it now or be fired later. Moreover, she notes, "there's no guarantee whatsoever that anyone would ever see any of that money, because Congress would have to approve it. They don't have the money."

The scheme, Simon tells me, also ignores the legally required process for contract buyouts and severance pay for federal workers, as written into law. But, she observes, "they aren't really worrying the rules. They're not really worrying about the law. And if they are challenged, and if they do have to pay judgments, it's going to be the American people that pay. It's not coming out of Elon Musk's pocket. It's not coming out of Trump's pocket. It's coming out of your pocket and mine."

AFGE and several other public service unions also filed a legal complaint this week against a separate, if related scheme launched by Trump with an Executive Order signed last week. It would, if allowed by the courts, make it easier for him to fire career federal workers without cause which, Simon confirms, he has already begun doing unlawfully anyway.

On the day that vaccine science denier RFK, Jr. testified before Congress to become the nation's next Sec. of Health and Human Services, it seems only appropriate on today's BradCast to discuss the Trump Administration's War on Science. [Audio link to full shows follows this summary.]

But, before we get there, a few news items of note --- some of them, actually very good news, believe it or not!...

  • If you're wondering how things are going for Republicans around the country amid Trump's second, absurdly chaotic week in office, a special election on Tuesday in a very "red" state Senate district in Iowa may offer a hint. The Democratic candidate defeated the Republican by 4 points, flipping a seat in a district that Trump won last November by about 21 points. But that is hardly the only good news today...
  • Public (and media) pressure works! While Donald Trump may want to be the Fascist-in-Chief, he is not there yet. He is not invincible. In no small part because he still sucks at the job of Presidenting. On Monday night the White House Office of Management and Budget (OMB) issued a stunning memo, virtually out of nowhere, declaring that, on Tuesday at 5pm, there would be a full shutdown of some $3 trillion in Congressionally-appropriated grants and loans. The order would seriously cripple Americans in all walks of life in all 50 states. The freeze, as made very clear over the ensuing 24 hours, would effect about half of the entire annual federal budget. It was also unlawful. It would have stopped payments for Medicaid, disaster relief, farm aid, student loan programs, Head Start’s day care centers for kids, Meals on Wheels for the elderly, highway funds, nutrition assistance, rent assistance, cancer treatment programs, medicine for millions with HIV around the world, veterans suicide hotlines and scores of other very popular programs. But public push-back on the scheme was so loud --- from the media and from Americans in "red" and "blue" states alike --- that by Wednesday morning, the White House was forced to fold. Their ill-considered memo was rescinded. What does this mean moving forward and what lessons should be learned? We discuss. (But don't tell Trump's failed, personal defense lawyer turned ridiculously uninformed White House counselor Alina Habba!)
  • More good news: This week, a majority of workers at a Whole Foods Market voted to unionize in Philadelphia. It's the first store in the Amazon-owned chain to do so.
  • But bad news on a related front: Trump unlawfully fired one of three National Labor Relations Board Members, its former Chair, on Monday. The removal of Gwynne Wilcox, the NLRB's first black female Member, whose term was not set to expire until mid-2028, means the Board does not currently have a quorum to make any decisions in its critical federal oversight role over labor disputes and union elections. Wilcox called the dismissal "unprecedented and illegal" and vows to challenge it. In the meantime, the NLRB's critical work, with unionization elections pending around the nation, grinds to a full stop.

THEN... We are honored to be joined on the show again today, for a wide-ranging discussion, by one of the nation's most esteemed and indefatigable climate scientists and authors, DR. MICHAEL E. MANN, Presidential Distinguished Professor of Earth & Environmental Science; Director of the Penn Center for Science, Sustainability and the Media; and Vice Provost of Climate Science, Action, and Policy at the University of Pennsylvania.

In this month's issue of Skeptical Inquirer, Mann joins with renowned virologist Dr. Peter Hotez of Baylor College of Medicine, to break down what they describe as "A triple threat to humanity". Namely, climate change, newly emerging pandemics and "perhaps the most insidious component of all: a well-organized, financed, politically motivated, and steadily globalizing campaign of disinformation and attacks against mainstream science that makes it extremely difficult to mount an effective global response to the climate and pandemic threats." The pair have a forthcoming book on related issues, titled Science under Siege: How to Fight the Five Most Powerful Forces That Threaten Our World.

We discuss that War on Science today, who's funding it and how it endangers life on Earth. There is "an agenda here to create doubt, to discredit experts," Mann tells me. "Because in a world of relativism, where anybody's facts are as good as anyone else's, it's very favorable for bad actors like fossil fuel interests, the Koch brothers, petrostates like Russia and Saudi Arabia, with whom we are now aligned when it comes to our own policies under the new Trump Administration.

"Calling science into doubt, discrediting scientists and experts, is part of their agenda," Mann explains. "Creating confusion, doubt, conflict, chaos favors their agenda. Rational decision-making doesn't."

We also discuss a whole bunch of climate-related politics of the day and even some climate science, including...

  • The real concerns about Trump's withdraw from the Paris Climate Agreement and who it will benefit in addition to the fossil fuel industry;
  • Trump's ridiculous claims about California's water system and the real cause of the recent, horrific fires in Los Angeles;
  • Whether Trump and and his climate science-denying cronies know they are lying about climate change ("I know some of these people. I know some of these think tanks and front groups because they've come after me for decades. So I know who they are. These are smart people. They are well-educated people. They know they're lying.");

What happened? Have climate scientists been underestimating the speed in the rise of global temps?

After 'pausing' medical research grants and ending work between CDC and WHO, chaos reigns in D.C. as new White House memo unlawfully mandates immediate 'freeze' of more than $3 trillion in federal spending...

Today on The BradCast: Let the Constitutional Crises begin! As the Trump Administration attempts to Cancel Culture pretty much everything with a memo that orders nearly half of the total, already appropriated federal budget immediately (and unconstitutionally) put on ice! [Audio link to full show follows this summary.]

We might have seen it coming, as several of our other stories today might have augured. Among them...

  • Late last week, while touring fallout from last year's climate change-fueled Hurricane Helene disaster in a Republican-leaning area of North Carolina, and the then-ongoing climate change-fueled Los Angeles Fires, Trump suggested he might shut down (privatize) FEMA entirely and called for Photo ID voting restrictions in California in exchange for federal disaster aid to victims who had lost everything. When asked if NC would also see conditions placed on their federal disaster aid, Trump's meandering non-answer (full of one fantastical lie after another) made clear that, no, only Democratic-leaning states would have to agree to change policies in exchange for much-needed federal disaster aid.
  • Amusingly, Trump pretended on social media last night that he'd ordered the U.S. military into California "under Emergency Powers" to turn on the magical, non-existent water "spigot" somewhere in Northern California, which the state chooses to keep turned off in order to somehow cause devastating fires in Southern California. Now that might sound like a ridiculous lie and a completely delusional fantasy that makes no sense at all, but at her first White House press briefing, Trump's Press Secretary Karoline Leavitt confirmed today that "the water has been turned back on in California." (That's great news, because I live in Los Angeles, had to evacuate briefly a week or so ago due to the fires, and had no idea the water had been turned off all this time! (OMG... this is only Week 2?!?)
  • Last week, in Week 1, and receiving a bit less coverage than so many of the other nightmares Trump set off with his flurry of Executive Orders, is the fact that the Administration abruptly ordered the National Institutes of Health (NIH) to suspend all research grants, programs, travel and even ongoing cancer treatment trials. The result of putting tens of billions of dollars of research and grants on ice has sent confusion, anxiety and chaos throughout the American health community at what experts describe as one of the worst possible times, amid a slew of quickly spreading winter viruses and the increasing risks of avian flu in the U.S.
  • On Monday this week, U.S. public health officials at the Centers for Disease Control and Prevention (CDC) were ordered to cease all work with the World Health Organization (WHO) just one week after Trump signed an order declaring the U.S. was ending its cooperation with the worldwide organization. (Unclear he can legally do so, by the way. But he doesn't care.) His Executive Orders also froze spending on a decades old global AIDS program that has saved 25 million lives, but now will block HIV the distribution of medication to more than 20 million people, including drugs already obtained with U.S. funds and sitting on shelves at local clinics around the world.
  • All of that might have been a signal for where all of this was going. According to a two-page memo from the acting Director of Trump's Office of Management and Budget (OMB) on Monday, the White House has now ordered a "temporary pause" on "all federal financial assistance" with the exception of Medicare and Social Security payments. The memo directs federal agencies to pause "all activities related to obligation or disbursement of all federal financial assistance," and any other programs that included "D.E.I., woke gender ideology and the Green New Deal" as of Tuesday (today!) at 5pm. That, even though there is no "Green New Deal." It never passed. (Shhh...don't tell them!)

    As the non-profit news site NOTUS explained, "the list of programs that could be touched by the order is vast: Medicaid, disaster relief, farm aid, student loan programs, Head Start, highway funds, nutrition assistance, rent assistance and dozens of other programs." Some 70 million low-income Americans alone, who are enrolled in Medicaid, could lose their access to health care. These are all funds already allocated by Congress and approved by previous Presidents including, in some cases, Trump himself.

    The impoundment of the funds --- said to amount to "more than $3 trillion," according to the memo, which is nearly half of the entire federal budget for fiscal year 2024 --- appears to be in strict violation of the federal Impoundment Control Act of 1974, enacted by Congress after Richard Nixon held back Congressionally-appropriated funding that he didn't like. According to the Constitution anyway (quaint!) Congress, not the President, controls the purse strings of the U.S. budget.

    As you may recall, attempting to withhold Congressionally-approved funding to Ukraine during his first term, unless they agreed to announce a fake investigation of the Biden Family, is what led to Trump's first impeachment. Ever since, Republicans have devised an argument that the Impoundment Control Act is actually unconstitutional. This is clearly their first volley in getting a ruling on that from their corrupted U.S. Supreme Court.

    Late on Tuesday, as Trump's deliberate chaos reigned shortly before the 5pm deadline to freeze the spending, a federal judge placed an administrative stay on the order, pending further arguments on Monday morning. She also made clear that the National Council of Nonprofits, the plaintiffs which sued earlier in the day, alleging the freeze would cause their members irreparable harm, must show evidence to support that argument on Monday or the judge would have no choice but to end her administrative stay and deny the requested temporary restraining order. And then... ???

Guest: John Bergmayer of Public Knowledge; Also: Migrant worker round-up begins in CA; Judge blocks Trump order to end birthright citizenship...

When we allow a felon to become President of the United States (thanks, in no small part, to extreme rightwing activists on the Supreme Court ignoring and rewriting the 14th Amendment), it's not surprising that he'd quickly begin violating laws and undermining the U.S. Constitution. When that felon also hopes to be a dictator, we certainly shouldn't be surprised that one of his first targets is the Constitution's landmark guarantees of a free press, as discussed on today's BradCast. [Audio link to full show follows below this summary.]

FIRST... Unfortunately, the First Amendment isn't the only one Donald Trump is hoping to dismantle. According to nonprofit news outlet CalMatters, ICE has already begun rounding up migrant workers in Central California, resulting in about 75% of farm-workers staying home this week during peak harvest season for oranges and other produce in America's "Salad Bowl". If that continues longer term, economists are predicting "absolute economic devastation" locally, skyrocketing food prices and shortages across the country nationally, along with a "recession-level event if this is the new long-term norm."

In related news, Trump's Executive Order signed on Monday, seeking to redefine, by fiat, the text and clear meaning of the 14th Amendment's very first sentence establishing birthright citizenship to anyone born here, regardless of the citizenship status of the parents, ran into its first legal roadblock in Court on Wednesday. A Reagan-appointed federal judge declared today that the Order "boggles the mind," calling it "blatantly unconstitutional". He temporarily paused the Order nationwide in the first of five different challenges brought by 22 state Attorneys General. If allowed to be enacted, as one of the challengers argued in court today, it would "impact hundreds of thousands of citizens nationwide who will lose their citizenship under this new rule."

THEN... Trump doesn't seem to much care for the First Amendment either. And, shamefully, a number of mainstream broadcast news outlets owned by major corporations have been all too eager to help him dismantle it. See Disney-owned ABC News' pathetic agreement in December to settle Trump's absurdly frivolous lawsuit with blatantly unconstitutional claims. Instead of fighting the defamation suit, they agreed to contribute $15 million to Trump's Presidential Library fund. See also the reports last week that Paramount-owned CBS News is in talks to do the same thing over another ridiculous complaint that 60 Minutes edited an interview with Kamala Harris in a way that Trump didn't like.

While those outfits are settling private lawsuits, Trump's new Federal Communications Commission Chair, Brendan Carr is weaponizing the FCC to go after the same news outlets. Last week, President Biden's outgoing Chair dismissed several specious complaints against ABC, CBS and NBC that echoed Trump's private lawsuits, declaring "the FCC should not be the President's speech police" and that "the FCC should not be journalism's censor-in-chief." This week, however, the newly seated Carr un-dismissed those complaints (if not the ones against a Fox affiliate, for some reason).

We're joined today by JOHN BERGMAYER, the Legal Director at good government group Public Knowledge. He charges that "Chairman Carr has made it plain he intends to weaponize the FCC to threaten political speech and news coverage he disagrees with." You're not surprised right?

"We have things like defamation law against a public figure, but you can't just prove that they are wrong, or you disagree with them, or they're being unfair or 'mean to me'. You have to prove they are 'actively deciding to harm me' through conscious deception," Bergmayer explains today. "That's a very hard standard to meet. I don't think any of these cases meet the very tough requirements for the FCC to decide in the complainants favor."

He also adds: "It's really notable that Chairman Carr did not reinstate a complaint that was against a Fox affiliate in Philadelphia, that was based on the Fox affiliate airing information that it knew, that was judged to be, defamatory."

"It really is a troubling sign that the current Chairman views these regulatory tools as a means to advance his cultural and partisan agenda," Bergmayer tells me. "What's particularly disturbing is that the Chairman wants to pick fights with the First Amendment rights of broadcasters or use dubious theories of law to go after perceived slights by Big Tech."

We also discuss the 6th U.S. Circuit Court of Appeals' ruling earlier this month that appears to end the FCC's ability, as a federal agency, to ensure Net Neutrality and an Open Internet (not that Trump or his FCC would have any particular interest in doing so.)
