Guest: FSFP's Susan Greenhalgh on new letter to Special Counsel Jack Smith; Also: Trump's new, digital trading card scam!...

While Special Counsel Jack Smith is said to be investigating the Trump-incited January 6 insurrection at the U.S. Capitol and the his fake electors plot to try and steal the 2020 election, among other things, there is a still-ongoing, post-2020, multi-state plot, coordinated by Trump's top MAGA lieutenants that the Feds don't yet seem to be probing. Our guest on today's BradCast is trying to change that. [Audio link to full show follows this summary.]

For the better part of this past year, we've have been closely reporting on the bizarre plot uncovered by frequent guest and longtime election integrity expert Marilyn Marks during the lawsuit filed by her group, Coalition for Good Governance, seeking to replace Georgia's 100% unverifiable touchscreen voting systems with hand-marked paper ballots.

Marks recorded a phone call she received last year from an Atlanta businessman who, essentially, confessed to a scheme that has since been revealed to have been overseen and paid for by disgraced Trump attorney Sidney Powell. It involved the Board of Elections and local Republican Party officials in right-leaning Coffee County, Georgia allowing a team of computer wonks to make copies of the County's proprietary voting and tabulation software, including the sensitive Election Management System, manufactured by Dominion.

Thanks to GA's Republican Sec. of State Brad Raffensperger, every county in the state is forced to use the same vulnerable, unverifiable voting systems. Making copies of those systems in one County essentially offers a blueprint for how to disrupt elections in various ways in every County in the state. Moreover, those systems are also used in jurisdictions in at least a dozen other states. Cybersecurity experts have described the Coffee County breach as extremely worrisome.

Nonetheless, until the scheme was exposed by Marks, Raffensperger's office appears to have been covering the entire thing up. And, even after it was exposed, his office --- including one of Raff's top lieutenants, Gabe Sterling --- continued to deny any of it had happened.

"Even recently, there was people saying, 'We went to Coffee County and we imaged everything,'" Sterling declared at an election forum at the Carter Center in Atlanta last April, before falsely adding: "There's no evidence of that. It didn't happen." But it absolutely did happen, as security camera video from the Coffee County Board of Elections offices, also obtained via Marks' lawsuit, subsequently made abundantly clear. The plot even involved a number of well-known MAGA Mobsters, such as Doug Logan, CEO of the Cyber Ninjas outfit that later carried out the phony post-2020 "audit" in Arizona last year.

Voting system software breaches similar to the one in Coffee County were also carried out and reportedly overseen by Powell, in several others states, including Nevada, Michigan and Colorado. As the Washington Post confirmed again this week, the stolen software "was then uploaded to a website, from where it was downloaded by election deniers across the country."

Despite all of this disturbing evidence, federal authorities do not appear to have even begun to probe these coordinated plots which, as our guest today confirms, can really be considered a crime still in progress, since the copied software can be used to undermine upcoming elections, for example, in 2024.

We're joined today by SUSAN GREENHALGH, Senior Advisor on Election Security at the non-profit good government group, Free Speech for People, to discuss the 14-page letter [PDF] that she and more than a dozen of the nation's top cybersecurity and voting system experts sent this week to Special Counsel Smith, Attorney General Merrick Garland, as well as the Directors of both the FBI and Cybersecurity and Infrastructure Security Agency (CISA), seeking a federal probe of the coordinated, ongoing plot.

"Now that they have the software," Greenhalgh explains today, "they have all the elements of the voting system, from the poll pads to the election management system which aggregates and reports totals, and everything in between. They can create their own election system and probe it to find out how it's vulnerable, and also develop ways that they can exploit those vulnerabilities. They can decompile the software to study the source code and understand how they might create malware that could get in and wreak havoc with the way the votes are counted."

Remember, these software breaches happened in most cases with the cooperation of insiders, local election officials who have direct access to these systems. Greenhalgh notes that "malware can be designed to be undetectable in many ways. So if you wanted, you could use it to disrupt an election so that people can't vote, or you could do it in ways to disrupt and manipulate or tamper with an election that is not visible to outsiders. Or you could just use the software to create disinformation campaigns and say 'I can show you how this election system was compromised and why it counts incorrectly'," even when it hasn't.

"We don't even have to imagine that because that's already been done," she continues. "That was by Matt DiPerno, the guy who ran against [Democrat] Dana Nessel for the Attorney General position in Michigan. He's also quite a famous election denier. He had a copy of voting system software that was obtained extra-legally in Michigan and put it on machines and put up videos that said, 'This is how we can manipulate these systems.'"

Greenhalgh details other ways in which these breaches are so troubling to the experts signed on to FSFP's letter; explains whether there is any evidence that the breaches were used to exploit systems in 2022; responds to remarks from the GA Sec. of State's office attempted to conflate real, longtime election security and voting systems experts with the MAGA conspiracy theorists and election liars; discusses how the Coffee County breach appears to have been covered-up by Raffensperger and other Georgia officials; and details why the lack of a federal investigation continues to threaten future elections, including the Presidential contest in 2024.

"The chance of manipulating elections going forward is very real," she warns.

Of course, just as COVID and other respiratory viruses are surging in L.A. (and California, and much of the rest of the country), we have our first in-studio guest on The BradCast since the pandemic. Oh, well. Wish us luck! [Audio link to full show is posted below this summary.]

We're joined today by the great STEVE HERMAN of Voice of America who spent some 26 years covering various regions in Asia and serving as VOA correspondent and Bureau Chief in India, Korea, Thailand. In 2016, he returned stateside to serve as VOA's Senior Diplomatic Correspondent, for a brief stint, before becoming the eight decade-old, U.S. funded media outlet's White House Bureau Chief. After serving 4 totally easy-peasy years at the White House during the Trump Administration and several months during Biden's, Herman is now on the road as VOA's Chief National Correspondent covering the 2024 campaign. (I know, I know...we're not even done with 2022 around here!)

In a broad, in-studio conversation today --- including questions from listener callers --- we cover, among many other things...

  • Herman's initial visit to the Fukushima nuclear plant just after the 2011 meltdown disaster...without any sort of physical protection! (That was when he first appeared as a guest on our program.)
  • How VOA stands virtually alone as a state-funded news outlet given its special charter, a "firewall" enshrined by federal statute that prevents the government from meddling in its coverage. "The White House, or even the head of our parent agency, the U.S. Agency for Global Media, cannot tell me or my editors what we have to report or cannot report. They cannot be involved editorially," says Herman.
  • How and why that makes VOA different from state-funded propaganda outlets in Russia, China, Iran and elsewhere. "I like to say VOA is probably the only news organization in the world that is mandated by law to be fair and effective," Herman explains. "In that charter it says we must reflect the different views of what's going on in the United States."
  • "Facts are facts," he tells me, regarding so much mis- and disinformation by both the Right and Left. "What they are reporting at RT [Russia Today] and Sputnik is not factual, especially about the war in Ukraine. ... It's a situation that we see from Chinese state media and Iranian state media. And this goes back all the way to why VOA was created after the start of World War II, because you had Nazi Germany on the airwaves, uncontested to a great degree, spitting out anti-American and pro-Nazi propaganda. What VOA was set up to do was to tell the audiences, initially in German and also in Japanese, what's going on with the war, whether it's good or bad."
  • The efforts by the Trump Administration, while Herman served as VOA's WH Bureau Chief, to affect the agency's news coverage and attempts to pressure Herman himself. "When these things have happened over the decades in various administrations, it also demonstrates that VOA is not a propaganda service," he argues. "If it were a propaganda service, we would not be getting complaints from within the United States government on some of the stories we've been doing."
  • - Herman's thoughts on the insane response by Donald Trump over the weekend to Matt Taibbi's "Twitter Files" thread detailing internal discussion/debate among Twitter executives in the run-up to the 2020 election when deciding whether or not to suppress questionably sourced reporting on Hunter Biden's laptop.
  • All of that and much more, including praise for sushi in Los Angeles from a guy who worked for decades in Asia!

There are just too many crimes. Next time we'll need to plan a longer BradCast. [Audio link to full show follows this summary.]

We're not yet beyond the 2022 elections. Votes are still being tallied and races still being called. Only last night, media outlets finally were able to project the GOP would win back a majority in the U.S. House next year, if barely, and that progressive Rep. Karen Bass would be the winner of the Los Angeles Mayoral race over billion real estate developer Rick Caruso. Of course, the fallout from the election will continue for a while. Today, two-time Democratic House Speaker Nancy Pelosi --- love her or hate her, one of the most effective Speaker's in history --- announced that, while she plans to remain in Congress, she will not seek a leadership role next session. The first women to hold that job said during floor remarks today, that she is passing the torch to a new generation.

Most notably, however --- at least when it comes to accountability for the most corrupt man likely to ever hold public office in this nation, much less as President of the United States --- actual 2022 midterm voting continues as well, in the December 6th U.S. Senate runoff in Georgia.

That means the Dept. of Justice guidelines barring overt action in politically-related cases during the 60-day window prior to elections is likely still in effect. But even after the GA runoff on December 6th, as our friend Marcy Wheeler of Emptywheel recently explained, "Merrick Garland hasn't done the specific thing you want because DoJ has been busy doing things they have to do first." In other words, before federal indictments can be brought against Donald Trump, as many (yours truly included) are eager to see, there remains a lot of legal work that must be done in order to ensure that any such indictments result in actual convictions.

Our guest today is DR. ALLISON GILL of the notorious "Mueller, She Wrote" Twitter account and podcast, which tracks the many (seemingly endless) criminal and civil cases and investigations under way against the disgraced former President about as closely as anyone in the country. She agrees that patience remains a virtue in these cases. Depending on the case, as she explains today, we are looking at a matter of weeks to a matter of months before indictments can be brought against Trump. Though she does believe they are coming and that his announcement this week that he is running again in 2024 provides no protection against prosecution in any of these cases.

As we begin to move beyond the midterms, today seemed a good day to touch base with Gill to help us try and reset where things are regarding to the many ongoing criminal and civil probes, indictments and lawsuits still bearing down on Trump. To be honest, we've lost track of some of them in recent weeks as we'd moved largely full time to 2022 election coverage.

Those pending cases include (but are not limited to):

  • The New York state criminal tax fraud trial currently underway against the Trump Organization and its CFO Allen Weisselberg, as brought by Manhattan D.A. Alvin Bragg;
  • Bragg's New York state criminal investigation into bank, tax and insurance fraud by Trump himself, as seemingly abandoned earlier this year, but which could be revived following the trial against his company;
  • The $250 million New York state civil lawsuit for bank, tax and insurance fraud against Trump, his company, and his three oldest kids, Don Jr., Eric and Ivanka, filed by NY A.G. Letitia James, which Gill sees as extraordinarily damaging to Trump;
  • The Georgia Special Grand Jury probe, as brought by Fulton County D.A. Fani Willis, of the Trump-led criminal conspiracy to convince state officials to steal the 2020 Presidential election on his behalf;
  • The Dept. of Justice's federal probe of thousands of pages of classified documents stolen from the White House by Trump upon leaving office, in apparent violation of the Espionage Act, Presidential Records Act and obstruction of justice;
  • The DoJ's federal probe of the Trump-incited January 6, 2021 insurrection at the U.S. Capitol and his other many failed attempts to steal the 2020 Presidential election, including via a fake electors plot.

Add to those, Trump's failure to show up for his deposition this week in response to a lawful subpoena.from the the bipartisan U.S. House Select Committee investigating the January 6 insurrection. (Trump's former advisor Steve Bannon was recently sentenced to two months in prison for Contempt of Congress for failing to answer similar subpoenas from the Committee.)

"Don't forget," Gill adds today, "his Save America PAC is under federal criminal investigation. His Truth Social [companies] are under FINRA, FEC, and federal criminal investigation. He is facing a lot --- a lot --- of legal problems. We've got the E. Jean Carroll case, the Mary Trump case, the Hillary sanctions, the Michigan sanctions. He's in a lot of trouble from a lot of things. We're going to just have to see who drops the hammer first."

"If we just look at the Watergate timeline," she posits, regarding the sprawling January 6 investigation, "we won't see indictments until April 2023. And this is far more complex [than Watergate]. So it's going to be interesting to see how the timing plays out. Or whether maybe Garland says, 'Hey, Fani Willis, you take the fraudulent electors stuff, I'll take the documents stuff.'" That, she explains, would have the advantage of potentially convicting Trump under state law for which he can't be pardoned by a future President (or even by a Georgia Governor, since they are not granted state pardon power.)

Gill does believe --- in fact, she is "very, very certain" --- that Trump will be indicted in at least one of the federal cases we discuss today. Tune in to find out which one!

And why all of that and still uncalled contests, very much matter...

Welp, Election 2022 continues into its second week of counting on today's BradCast. But it's our first chance to open up the phones to listeners after last week's historic midterm face-plant by Republicans and its associated very very good news for Democrats and American democracy itself. [Audio link to full show follows this summary.]

Before we go to the phones today, a bit of a monster "rant" on the accomplishments of Joe Biden and the Democrats after two years in office; a few updates on races called since we signed off last Friday; what they all mean; and some of the races still being tallied (which will also determine, among other things, which party controls the House of Representatives next year.)

The big races called since our final show last week include the U.S. Senate contests in Arizona and Nevada, both of which went to the incumbent Democrats in each state (Sen. Mark Kelly in AZ and Sen. Catherine Cortez Masto in NV). Those victories ensure majority control for Democrats in the upper chamber of Congress once again in January. Dems will have at least a 50/50 majority with Vice President Kamala Harris as the tie vote, even before the December 6 Senate runoff in Georgia between incumbent Sen. Raphael Warnock (D) and Herschel Walker (R).

But there are a ton of reasons for Democrats in GA to not let down their guard. Dante Atkins, over the weekend, detailed just some of the reasons why a 51-49 Senate is much better for Dems (and democracy) than a 50-50 Senate.

While Dems were celebrating retaining their Senate majority over the weekend, we were celebrating the fact that the last of the 2020 Election liars running for Secretary of State in battleground states were declared to have lost. In AZ, Democrat Adrian Fontes will become the new Sec. of State after defeating Trump-endorsed insurrection enthusiast and voting opponent Mark Finchem. And in NV, Democrat Cisco Aguilar was declared the winner over Trump-backed election liar Jim Marchant, founder of the "America First Secretaries of State coalition," featuring all of those Republican SoS candidates who, thankfully, were rejected by voters in last week's elections across the country in every single swing-state in which they ran. That alone will make the 2024 Presidential election indescribably safer.

Throughout the program, we also take care to call out a few of the folks from the Republican Party, the corporate media, and the even some on the lazy, knee-jerk far-left who ignored the available data and facts in order to misinform American voters that the GOP see a red wave, or even red tsunami, in last week's midterms. They didn't. They lost a seat in the Senate; will be lucky to win the narrowest of majorities in the House; lost Governorships in Maryland and Massachusetts (and, perhaps, Arizona, which is still close); took full control of both the Michigan and Minnesota state governments and may do the same in New Hampshire and Pennsylvania, just to detail a few of the GOP's remarkable failures in a year that Conventional Wisdom suggests they should have owned the night.

Also, mid-hour today, we get an update in the tallies of the very right Los Angeles Mayoral race where progressive Rep. Karen Bass just got a big boost from the latest numbers in her contest against "former" Republican billionaire real estate developer Rick Caruso.

Then, we turn to the phones for the first time since last week's midterms to get some thoughts from listeners on what the lack of "red wave" means for both Democrats and Republicans and whether any of it will help break the GOP's Trump Fever that is destroying both them and our democracy along with it (though not this week, at least!)...

Media lends GOP a hand; Tabulator failures in NJ and AZ, very different responses; Touchscreen vote disenfranchisement in TX; Much more...

On today's Midterm Elections Day 2022 BradCast: Unspooling the media's midterm mess and the high price of failed computerized voting and tabulation systems in several states.

Among the many stories covered today as voters across the nation headed to the polls...

  • What is the possible connection between today's otherwise much-needed downpours in both Northern and Southern California and potential partisan control of the U.S. House? We 'splain!
  • Major corporate media outlets have done another irresponsible job in their coverage of this year's midterms, particularly in their bizarre Doomsday-for-Dems coverage in recent weeks. While Tuesday's elections certainly could prove to be a "red" wave for Republicans --- after all, conventional wisdom (which we've been advising you to ignore all year) would certainly predict as much --- a fair reading of both pre-election polling and other available early voting data, suggests Dem strength could be greater than most outlets have been reporting. Some are even ignoring their own polling numbers to report a coming apocalypse for Dems. (Also: Compare and contrast NYT's front pages from day before the midterms in 2018, when Dems picked up 41 seats in the House, with the day before this week's midterms.) Of course, the polls are tight enough that a minor polling error in either direction could lead to either a "red" or "blue" wave, or simply a maddeningly close contest all around. But the problem is, the doom and gloom reporting can either become a self-fulfilling prophecy by depressing Dem turnout or, more dangerously, yet another misleading basis for Republicans to falsely declare "FRAUD!" in the event that Dems do better than expected on Tuesday night. Either scenario suggests another mainstream corporate media failure in 2022. We 'splain that too.
  • Donald Trump big footed Ohio's Republican U.S. Senate candidate J.D. Vance at his rally on Monday night by announcing that he's got a big announcement coming next week. Reportedly, Republican officials had to beg Trump to not declare his candidacy to run again for President before today's midterms. He wanted to do it last night. Of course, facing as many legal perils all at once as he now is, I'd want to try and change the subject as quickly as possible too. It won't work.
  • A tale of two voting system failures. In Mercer County, New Jersey today, hand-marked paper ballot optical scanners used across the county and made by Dominion failed to work. Luckily, they are one of only two counties in the state that offer voters hand-marked paper ballots. So, voters were instructed instead to place their ballots into the scanning system's locked box to be tabulated later at County headquarters. Voters did so. Voting continued. Life went on. Everything was fine. Meanwhile, at a bunch of polling sites in Maricopa County (Phoenix), Arizona, the scanners, also made by Dominion, were failing as well. Instead of following the same procedure to vote and place their ballot in the box to be scanned later, the wingnuts went crazy. Howls of "FRAUD!" followed, with demands to recall the County's Republican election officials and for paper ballots to be used from now on! (Someone please let GA's lunkhead Rep. Marjorie Taylor Greene know that Maricopa already uses paper ballots.) Sigh. This in a county where Reuters reported over the weekend that elections officials faced more than 100 threats in the lead up to today's elections, including calls to "kill them all" and worse. (The reason eventually discovered for the scanner failures in Maricopa was pretty mundane).
  • Meanwhile, actual voter disenfranchisement took place for hours in Harris County (Houston), Texas, on Tuesday morning, thanks to the fact that, like much of the Lone Star state, they don't allow voters to use verifiable hand-mark paper ballots at the polls. Instead, after a poll worker quit before today's Election Day, touchscreen voting systems made by Hart Intercivic were not properly set up until four hours after polls opened in a heavily-Hispanic part of the heavily-Democratic County. An unknown number of voters were turned away, unable to vote. Marjorie Taylor Greene has yet to say a word about it.

Formalizing 2020's ad-hoc strategy, Republicans have organized nationally to create and unleash phony fraud claims, as needed, amid the havoc of next Tuesday's critical elections...

Today on The BradCast, we continue our focus on next Tuesday's critical midterm elections by picking things up, somewhat, from our conversation on yesterday's program. [Audio link to full show is posted below.]

We were joined yesterday by longtime election and voting system expert Eddie Perez to discuss, among other things, what he has been writing about as the "manufactured chaos" that Republicans are creating to wreak havoc in the 2022 elections.

Today, we dive into broader details of that organized, manufactured chaos program that is emerging as a national strategy by the GOP to create enough havoc around the country to allow them a patina of "evidence" with which to challenge results of election outcomes they don't like.

A number of seemingly disparate efforts are actually now emerging as of a piece with a national strategy that you (and the Democrats and the media) need to know about before it all comes crashing down at once amid chaotic smoke and mirrors on Election Day and thereafter.

This is clearly an effort that echoes the less coordinated post-election chaos of 2020. Many of the same players are involved, including corrupt Trump attorneys John Eastman and Cleta Mitchell, as well as his convicted former aide Steve Bannon, the laughable billionaire pillow guy Mike Lindell, not to mention those in the far-right political media set to help execute the strategy as if it is legitimate, from Tucker Carlson on down.

The hope, as Josh Kovensky outlines at TPM today, is to sow the seeds of enough chaos to be able to create court cases and "thousands of sworn affidavits" (sound familiar?) to "credibly" point to (false) claims of "fraud" in virtually any election around the country next week, if and when they don't win it. "The chaos is the point," he writes.

We pull many of these threads together on today's program. One example is the seemingly isolated case of the campaign manager for Maryland's white nationalist Republican candidate for Attorney General who directed supporters at a rally last weekend to vote next Tuesday "as late in the day as possible," explaining that, "If everyone could stand in long, long lines at 6 o’clock, that would actually help us."

Then there are the door-to-door canvassers --- organized in part by folks like Eastman, Bannon, Lindell, Mitchell and others --- who, according to a Reuters report today, have been active in at least 23 states. They are dressing as if they are government officials --- sometimes armed and with badges --- intimidating voters with questions about who lives in their house, what their voting record is, etc. They appear to be collecting information to use to challenge voters on Election Day at the polls and/or in the post-election period, as required to create enough chaos to offer the appearance of fraud and/or uncertainty in the legitimacy of election results. And, yes, Fox "News" and the rest will be standing by to report all of these false accusations as if they are real.

Forewarned is forearmed, as they say. It's important that you --- not to mention the Democratic Party and everyone at legitimate media outlets --- understand what is going on before the fog of chaotic election war overwhelms all of us beginning next Tuesday.

In a not unrelated story today, we noted yesterday that AP has found more than 100 election lawsuits have already been brought this year related to the 2022 elections. Most have been filed by Republicans in efforts to make voting more difficult. We detailed several of those cases yesterday (in Pennsylvania, Arizona and Nevada). Today we discuss one filed in Illinois that seeks to invalidate lawful absentee ballots that are cast on or before Election Day but do not arrive until afterward, in the two week period allowed by state law. A Republican Congressman is suing to block the counting of those votes, even though they are lawfully cast ballots that could include tens of thousands cast by members of the U.S. military stationed overseas. The complaint was originally filed in May of this year. But the Trump-appointed federal judge overseeing the case has yet to rule on it, for some reason, with Election Day less than a week away. Chaos in waiting.

Also, since we quickly waved at these Trump accountability stories at the top of today's show, some links for more deets for ya:

  • A judge has appointed an independent monitor to oversee Trump Organization finances in the civil fraud suit filed by NY A.G. Letitia James against Trump, his company and his three oldest kids.
  • The NY criminal tax fraud case against the Trump Organization is now under way.
  • Top Trump aide Kash Patel has been granted immunity to testify against him before a federal grand jury probing the documents Trump stole upon leaving the White House.
  • Trump settled the lawsuit against him for ordering his security goons to beat up protesters in front of Trump Tower in 2015, as jury selection was underway in the case.

Guest: Theeda Murphy of No Exceptions Prison Collective; Also: Corrupt SCOTUS helps Trump on tax returns, Graham on GA testimony...

We've been discussing for weeks (months, actually) on The BradCast how critical the November 8 midterm elections are to American democracy itself. I've even referred to it as the most critical midterms since the Civil War. Until recently, however, I had no idea how on the money that comparison actually is. [Audio link to full show follows this summary.]

In five states this year --- from so-called "red" states like Alabama, Louisiana and Tennessee to the theoretically liberal bastions of Oregon and Vermont --- slavery itself will be on the ballot. Seriously. Or, at least "involuntary servitude". What's the difference between that and slavery? Even our guest today, an expert on such issues, has trouble discerning that.

The U.S. Constitution's 13th Amendment, adopted in 1865 to end slavery, reads [emphasis added]: "Neither slavery nor involuntary servitude, except as punishment for a crime whereof the party shall have been duly convicted, shall exist within the United States, or any place subject to their jurisdiction."

In other words, slavery was abolished --- except for prisoners, who may be forced into involuntary servitude as part of their punishment. It's a not-accidental loophole, you'll be shocked to learn, that has been disproportionately exercised historically against Black Americans.

In 2020, however, several Democratic members of Congress introduced a resolution to begin amending that part of the 13th Amendment. But changing the U.S. Constitution is a heavy lift that requires passage by two-thirds of each chamber of Congress and approval by three-fourths of the states. In the meantime, there are the exact same or very similar references to involuntary servitude --- or even slavery itself --- still present in a number of state Constitutions and/or statutes. And, this year, there are ballot initiatives in the five states mentioned above to finally change or remove those references entirely.

So, yeah. Ending slavery, at least in some state constitutions, at least for prisoners, is actually on this year's ballot as well.

We're joined today for insight by THEEDA MURPHY, Co-Director of the No Exceptions Prison Collective, a non-profit, grassroots initiative based in Nashville, TN, dedicated to, among other things, aboloshing slavery!

"Any type of forced labor is slavery. Period. And should not exist in the United States in 2022," Murphy explains, stating what one would think should be obvious. Surprisingly, it isn't. There are elected officials --- both Democratic and Republican --- who have offered various reasons to oppose such initiatives to rewrite the 13th Amendment and the state-based provisions which echo it. Most of their reasons have to do with assuring that cheap prison labor can continue, a $500 billion industry where the average pay is $1/hour. (Though that is, somehow, not considered slavery!)

Over the past two elections, in 2018 and 2020, three states, Colorado, Nebraska and Utah, adopted measures to ban involuntary servitude. A recent effort here in California failed to make it onto the ballot this year. But the hope of advocates like Murphy is that, with reform at the state level, interest may grow in a federal Constitutional amendment that finally ends what is known as the "Punishment Clause" or the "Exception Clause'. But there are other reasons to adopt such measures as well.

States where similar changes have been made, explains Murphy, "are beginning to have these discussions about what does it mean to now have people that cannot be treated like property, that the state no longer owns, and what that means for every aspect of a person who is incarcerated. Can you deny them healthcare? What kind of food do you feed them? Do you charge them for their clothes? Those are the kinds of questions that begin to be answered, or to be asked, because people are no longer property."

Murphy says that in her home-state of Tennessee, internal polling shows both Democrats and Republicans are "united" on the ballot measure this year. "Nobody is FOR slavery," she quips. "Nobody at least will come out and SAY they're for it."

Hey! Maybe we found at least one issue that doesn't divide Americans? We'll find out after next Tuesday.

In other noteworthy news today...

  • After nearly four years of House Democrats attempting to exercise the federal law that mandates the IRS "shall furnish" the tax returns of any taxpayer to the heads of several Congressional committees upon request, Donald Trump is running out of legal (and illegal) options to block the Democratic-controlled House Ways and Means Committee from reviewing his tax documents. But, after the federal appeals court in D.C. unanimously said last week that the IRS must turn them over, Trump filed an emergency appeal to his stolen, packed and corrupted Supreme Court. Today, Chief Justice John Roberts placed a temporary administrative hold on the lower court's order, buying Trump at least 10 days while the House responds to the disgraced former President's motion. But now, every day counts, with the possibility of Democrats losing their majority at the beginning of next year, when Republicans will almost certainly drop the House request. The clock is ticking.
  • In somewhat brighter related news, after a similar administrative hold by the corrupt Justice Clarence Thomas last week, the Supremes have decided that Trump ally Sen. Lindsey Graham (R-SC) must sit for a deposition with the Special Grand Jury created by Fulton County, Georgia District Attorney Fani Willis, in her investigation of the Trump-led conspiracy to steal the 2020 election in the Peach State. SCOTUS, however, has left open some doors for Graham to return to district court if he believes any of the questions he's asked violate his right to not answer questions related to his legislative activity as a Senator under the Constitution's Speech and Debate Clause.

First, ride-share companies Lyft and Uber scammed California voters two years ago with the landslide passage of Prop 22, which the companies spent nearly $250 million to put on the ballot and misrepresent to voters. They claimed that their workers in the state should not be treated as employees under CA law --- with all the benefits that come with it --- but as a new type of independent contractor. The companies told voters that, under Prop 22, their drivers would make at least 20% above minimum wage (currently $15/hour in the state) and would receive other increased benefits for healthcare, etc.

Now, two years in, it turns out that Uber and Lyft drivers in CA are averaging just $6.20/hour. Dayen explains how that can possibly be, adding: "When you allow a corporation to set the terms of employment and to opt out of, in this case, the state system that governs employment arrangements, they're probably going to take advantage of it for their devices. And that's exactly what happened here."

This year, Lyft is supporting another CA ballot initiative, Prop 30, that would tax millionaires to help subsidize elective vehicles for their drivers and to fund CA firefighting efforts. The state's Democratic Party seems to believe them. The state's Democratic Governor Gavin Newsom, on the other hand, doesn't. What explains that? We try to figure it out.

But, more importantly, Dayen argues the entire matter is symptomatic of what he now sees as CA's "failed experiment with direct democracy" in its ballot initiative process. Can it be reformed to make it work for the people as intended? Or has it been irreversibly taken over by corporate interests who have learned how to purchase their interests into state law?

Also today, Dayen breaks down last week's stunning ruling by a three-judge panel on the hard-right 5th Circuit Court of Appeals (all three were Trump appointees), finding that the way Congress chose to fund the Consumer Financial Protection Bureau (CFPB) is, somehow, unconstitutional. The CFPB was created during the Obama Administration to protect consumers after the 2008 global banking crisis and subsequent Great Recession. It was the brainchild of Elizabeth Warren before she became a Senator. The Bureau is the only federal agency built and devoted specifically to protecting consumers, as opposed to corporations.

As Dayen explains, the court's ruling, if allowed to stand, would not only make the CFPB go away entirely (long a goal of Republicans), but also hundreds of regulations and consumer protections that the Bureau oversees. Moreover, if the judges are right about the funding mechanism for CFPB being unconstitutional, well then so is the funding for dozens of other critical federal agencies and programs!

"The logic of the 5th Circuit's ruling is that all of those other agencies [including the FDA] are also unconstitutional," says Dayen. "There are also a number of mandatory spending items in America that are not funded through the appropriations process. Social Security, Medicare, Medicaid, food stamps. The logic of the 5th Circuit's ruling is that all those things are all unconstitutional."

In addition to "this ruling defunding the police --- the consumer protection police" in a case brought by the rapacious payday lending industry, he details how this is the very definition of the GOP's years-long vow to "destroy the administrative state". In this case, as Dayen argues, there are also a bunch of protections for big banks that would be wiped out as well unless the ruling is overturned. So, maybe that little glitch will --- ironically enough --- help to save the CFPB.

One more matter we touch on with the author of Monopolized: Life in the Age of Corporate Power, the recently announced takeover of Albertsons by Kroger, which already owns Ralph's, Food For less, and many others as the nation's largest grocery store conglomerate. Albertsons is the second largest. They own Vons, Safeway and many others. In short, Kroger's takeover, if it goes through, would result in one company owning --- and having near monopolistic pricing power over --- more than 60% of the nation's grocery stores. As you might imagine, Dayen has a few warnings about this "very, very disturbing merger," but adds that he's pretty sure that Biden's Federal Trade Commission (FTC) "is going to take a healthy look at it."

Finally today, one more thought on one more initiative on this November's CA ballot, one which is likely to spread like a deadly virus to much of the rest of the country if successful here. Prop 31 would ban the sale of flavored e-juice for vaping and e-cigs in the state. The disingenuous claim by supporters is that flavors --- like the one that I used, espresso, to finally successfully quit smoking --- are attractive to kids. Prop 31 proponents argue this ban on flavored vape juice is needed to keep kids from vaping. But the fact is that kids are already banned from buying these products in CA! Instead, the ban would serve only to kill actual smokers by preventing them from switching to vaping, which scientists universally find to be far safer than smoking. Dem Senate candidates smack down GOP opponents in OH, WI debates; Also: SCOTUS undermines key election provision of Civil Rights Act; Is FBI underplaying threats to election security?...

As noted on today's BradCast, we generally cover the track conditions of our elections more than the actual horse races. We do so again today. But, as it turns out, Dems have put up some pretty good horses this year. We cover a couple of them today as well. [Audio link to full show is posted below this summary.]

First, track conditions...

The corrupt, stolen and packed rightwing U.S. Supreme Court majority on Tuesday overturned an appeals court ruling which had found that both the landmark Civil Rights Act of 1964 and Pennsylvania law mandates that legitimately voted ballots may not be invalidated due to minor errors that are "immaterial" to determining voter qualification. In this case, the question was about absentee ballots where voters had forgotten to fill in the date on the ballot's outer envelope. The activists on SCOTUS, however, held today that such ballots may not be counted this November, despite the Civil Rights Act provision that previously ended the Jim Crow era's use of immaterial errors to invalidate perfectly legitimate votes.

Also, FBI officials say they have identified no credible threats to U.S. election systems this year, despite efforts by some foreign adversaries, including Russia, to sow doubt about fraud. But do these officials understand the actual threats now posed to our non-transparent, easily manipulated and error-prone computerized voting and tabulation systems? Do they appreciate the increased threat level thanks to recent breaches of election management systems by MAGA conspiracy theorists in several states following the former President's false claims of fraud?

While the Trump-appointed FBI Director Christopher Wray seems to falsely suggest there are similar domestic threats of violence from "both sides" following the 2020 election and the SCOTUS ruling on Roe v. Wade, the federal Elections Threat Task Force, launched last year by the Dept. of Justice, seems to finally be taking at least some action in response to the thousands of violent threats made by rightwingers against election officials and poll workers following the last Presidential election.

Next, horse races...

During a U.S. Senate debate in Ohio on Monday night, Democratic candidate Rep. Tim Ryan called out his Republican opponent, author J.D. Vance, for running a fake non-profit charity to support opioid addicts; defending January 6 insurrectionists; and for giving up his "dignity" to Trump who said about Vance at a recent rally in Youngstown: "All you do is kiss my ass to get my support," before Vance went on to pose for pictures with the disgraced former President. "Ohio needs an ass-kicker, not an ass-kisser," said Ryan in response.

In Wisconsin's U.S.. Senate race, Democratic Lt. Gov. Mandela Barnes was similarly ass-kicking in his debate against incumbent Republican Sen. Ron Johnson. Barnes called out the Badger State GOPer for supporting the January 6 insurrection while claiming to support police, despite the serious injuries to more than 140 law enforcement officials that day. Barnes also made clear he would vote to codify the rights of Roe v. Wade into federal law, and made a very impressive showing against Johnson.

Both races are currently neck and neck, and are among at least five Senate races this year (along with Pennsylvania, North Carolina and even Florida) where Dems have real shots at flipping currently GOP-held seats from "red" to "blue". That, by way of contrast with Republicans who are looking at just two states (Nevada and Georgia), where they stand any real chance, generally speaking, of flipping a Senate seat from "blue" to "red" this year --- at least if you have any confidence in this year's pre-election polling.

On today's BradCast: The story of why Americans are still paying the health care price (in both blood and treasure) in 2022 for "free market champion" Ronald Reagan's 1987 Executive Order that gave away the tax-payer store to Big Pharma. Plus, a bunch of other somewhat happier stories. [Audio link to full story is posted below this summary.]

First up today, an update in the still-broadening criminal conspiracy probe by Fulton County District Attorney Fani Willis into Donald Trump's many faceted and failed efforts to steal the 2020 Presidential election in Georgia. With 17 known "targets" in the probe so far, including Rudy Giuliani and 16 fake Trump electors, the prosecutor tells Washington Post in an exclusive interview that there will be more "targets" announced soon and that she believes some are likely "facing prison sentences." She has yet to decide if the former President will be among them, though, with dozens of witnesses who have already been subpoenaed and testified to her Special Grand Jury in Atlanta, Willis says the Grand Jury should wrap up by year's end. A decision whether to call Trump in to testify --- or declare him a target --- is likely "to be made late this fall," she says.

Next, now that far-right retired Brigadier General and dyed-in-the-wool conspiracy theorist Don Bolduc won the GOP nomination in New Hampshire this week to challenge incumbent Democratic U.S. Senator Maggie Hassan this November, he's...um...re-evaluating some of his previous positions. During a primary debate with fellow GOP candidates before the primary, he proudly denied Joe Biden's victory in the 2020 election. "I signed a letter with 120 other Generals and Admirals saying that Trump won the election and, dammit, I stand by my words!," Bolduc bravely declared to cheers from Party faithful. When asked about his position this week on Fox "News," however, after winning the GOP nomination, Bolduc hemmed and hawed his newly discovered belief after "a lot of research on this", finding the 2020 "election was not stolen" and that "President Biden is the legitimate President of this country." Granite Staters will undoubtedly fall for his pretend new "moderate" line, right?

Then, newly reformulated COVID vaccine booster shots from both Pfizer and Moderna, designed to combat both the classic coronavirus and several newer Omicron variants, are now available to the general public in the U.S. The White House and CDC are recommending Americans get the new shot by Halloween to lessen the chance of infection --- or killing your grandmother --- over Thanksgiving and Christmas holidays when a new surge is expected. (They also recommend getting a flu shot at the same time.)

But why are new COVID vaccines even necessary more than two years into the pandemic? One reason is thanks to the fact that, despite tens of billions of tax-payer dollars given by the federal government to private companies for the development of the life-saving vaccines, the private pharmaceutical giants who make them refuse to give up their patent and intellectual property rights to make the vaccines available to the world. That means new variants continue to emerge, leading to more infections and the need for updated vaccines and, yes, more profit for Big Pharma. It's a pretty nice deal...for them.

So, how did we get here? We're joined today by ERNEST A. CANNING, longtime legal analyst at The BRAD BLOG, who recently took a deep dive into a 1987 Executive Order by Ronald Reagan that gifted patents and profits that go with them to huge, for-profit pharmaceutical companies that used tax-payer dollars to develop their inventions. That, from the Republican idol who, ironically, once declared: "We who live in free market societies believe that growth, prosperity and ultimately human fulfillment, are created from the bottom up, not the government down."

The pharmaceutical industry may disagree, even if they won't say so out-loud. "No matter how big a company and how much money was poured in by federal government for research and development, the patent would belong to the giant company," Canning explains. "We've been paying, just in general research, about $28 billion in pharmaceutical R&D every year." Given the "value of those patents," he notes, "we're talking trillions of dollars in a gift, not just tens of billions."

He also explains how all of this came about (beginning with Jimmy Carter) and why its now so difficult for Joe Biden to merely repeal Reagan's Executive Order in regard to the COVID vaccines.

But Canning also offers some brighter news related to patent abuse by Big Pharma, which he also recently wrote about at The BRAD BLOG. In a landmark initiative, the state of California is now fighting back. Democratic Governor Gavin Newsom recently announced the state will begin manufacturing insulin and will make the hundred-year old drug available for just slightly more than it costs to produce. Canning explains why that has become necessary as Big Pharma takes advantage of loopholes in Intellectual Property laws to bilk diabetics with outrageous prices for the inexpensive, life-saving medicine.

Finally, a private company that is --- shockingly enough --- apparently doing the right thing for the country and the world. (What?!) The family that owns outdoor gear brand Patagonia, headed up by its 83-year old founder, announced this week that they will be "making Earth our only shareholder". While the company will remain a for-profit entity, currently valued at around $3 billion, it will now begin giving away all profits --- about $100 million a year --- to two newly created entities, a trust and a non-profit, both devoted to combating our climate crisis.

(Any chance we can coax Patagonia into the pharmaceutical business while we're at it?!)
