And here I thought dealing with one President in a single hour on The BradCast was tough. Now we've got the previous one on trial after his second impeachment and a new one unveiling an ambitious new agenda to begin cleaning up the other guy's horrific mess, particularly on climate today...and not a moment too soon! [Audio link to full show is posted below summary.]

First up today, the Department of Homeland Security issues a new warning about ongoing threats of violence by domestic, home-grown terrorists in the U.S., many of whom have been radicalized by Donald Trump's many lies about the 2020 election having been stolen.

Then, It's been only three weeks since Trump encouraged his MAGA Mob to march down Pennsylvania Avenue and "fight like hell" to prevent the formal counting of Electoral College votes by the U.S. Congress. The attempted insurrectionists violently broke into the U.S. Capitol, called for the hanging of the Vice President, succeeded in shutting down the tally for several hours and sent lawmakers fleeing for their lives into secured locations. Five people were killed, including a Capitol Police officer, in the ensuing violence. One week later, then President Trump was impeached by the U.S. House for a second time, this time for "Incitement of Insurrection", though the Senate's then Majority Leader Mitch McConnell refused to convene a trial. One week after that, Joe Biden was successfully sworn in as President. And today, just three weeks to the day since the Trump-incited mob's murderous attack on the Capitol, with Democrats now officially in the Senate majority, Trump's second Impeachment Trial has officially begun.

While the arguments in the trial will not be presented in full for another two weeks, Republican Senator and pretend Constitutionalist Rand Paul forced a vote on Tuesday, just after Senators were sworn in as "impartial jurors", to try and dismiss the entire matter by falsely claiming that an Impeachment trial after a President is out of office is "unconstitutional". (Though he repeatedly argued that "private citizens" cannot be impeached and that "If the accused is no longer President - where is the constitutional power to impeach him?")

Joining us today to answer to the clearly false and almost-certainly disingenuous argument proffered by Paul --- and, incredibly, supported by 45 of the Senate's 50 Republicans who voted in favor of his resolution on Tuesday --  is Constitutional law expert RON FEIN of the non-partisan government accountability group Free Speech for People. Fein, with John Bonifaz and Ben Clements, authored the 2018 book, The Constitution Demands It: The Case for the Impeachment of Donald Trump

"The obvious flaw," in Paul's argument, Fein explains, is that Trump WAS impeached while he was President, and then McConnell stalled the process of the Senate trial by refusing to allow it to be held until Trump was already out of office." But on the broader issue, as he tells us, impeachment trials may absolutely be held after an official is out of office. "Congress has done it before and explicitly considered that exact question."

"If their argument was allowed to go forth, then what it would say is that any President can do whatever they want in the last couple of weeks of their term, because by the time they would get impeached, and by the time the Senate could convene for a trial, they'd be out of office already," he persuasively argues. "Disqualification from future office is an important remedy and penalty for impeachment. It is important to have that hanging over the head of a President even in their last couple of weeks in office."

We also discuss whether the votes of 45 GOP Senators --- including McConnell, who just last week conceded that Trump "provoked" the riot at the Capitol --- to dismiss the trial, signals that it will be impossible to win over the 17 Republicans needed to win the two-thirds vote necessary for a conviction; whether a vote can be held to prevent Trump from holding future office even without conviction; whether a second failure to win a conviction in a second impeachment would redound to Trump's benefit; and whether a resolution to censure the disgraced former President would serve as any kind of deterrent for similar behavior in the future (by Trump or other future Presidents), in the event that he is not convicted once again.

Fein also rings in with his thoughts in response to the GOP's stolen and packed U.S. Supreme Court which, on Monday, dismissed two cases regarding Trump's alleged violation of the Constitution's Emoluments Clause as "moot" since he is no longer in office and why it took so long for the cases to even reach the high court. We also discuss whether Fein believes that Trump actually did pardon himself, but is keeping that pardon a secret, somehow, until he's actually charged with a federal crime.

Finally, in far less maddening news, it was "Climate Day" in Joe Biden's new White House on Wednesday! And the new President unveiled an historically ambitious climate agenda that will, among many other things, if successful, result in carbon emissions-free power, nationally, by 2035. Declaring that "we can't wait any longer" to address our worsening climate crisis, Biden detailed his new Executive Orders and Directives to "supercharge" the United States' efforts to combat global warming by pausing new oil and gas leases on federal lands, ending fossil fuel industry subsidies, and creating millions of new jobs in the electric car market and renewable energy industry, and by capping and closing old, unused mines and wells across the nation. His new Climate Envoy, former Sec. of State John Kerry and new White House National Climate Advisor, former EPA Administrator Gina McCarthy, also responded to media questions (naturally framed by rightwing talking points) during a White House briefing. We share some of their remarks, and the entirety of Biden's historic announcement during today's very busy BradCast...

It's beginning to feel like the beginning of the end on today's BradCast. And while there remains plenty to be concerned about and lots of work ahead...it's beginning to feel just a little bit better all the same. [Audio link to show is posted below summary.]

Among the many stories covered on today's show...

  • The world crossed a new, tragic COVID milestone. 2 million dead. That's the equivalent of 10 jumbo passenger jets falling from the sky every day for the past year. In the U.S., with more deaths by far than any other country thanks to Donald Trump's delinquent efforts, and the rate quickly rising, well over 390,000 are now dead --- or 2 jumbo jet crashes every single day for the past year;
  • Joe Biden's Chief of Staff, Ron Klain, predicts we may see as many as 500,000 COVID deaths in the U.S. before the end of next month. Therefore, it is very good to see the President-elect unveil a comprehensive, $1.9 trillion plan to both fight the virus and revive the economy --- and even raise the minimum wage to $15/hour at the same time! Republicans will oppose it, naturally. But almost everything in Biden's plan, save for the minimum wage increase, says The Prospect's David Dayen, can be adopted in the U.S. Senate with a simple majority vote...presuming all Dems are on board;
  • The nation is certainly on board for the Biden Presidency at this point, with Joe's approval rating up since the election and Trump's plummeting to an all-time low on his way out the door, according to a new survey out today from Pew Research;
  • Biden's Inauguration rehearsal has reportedly postponed due to security concerns following last week's Trump-incited Capitol Insurrection, and a warning from U.S. intelligence agencies that his "Domestic Violence Extremist" supporters may be planning more attacks, thanks to Trump's continuing, false, evidence-free claims that the election was stolen;
  • In a court filing, federal prosecutors said that Capitol Insurrectionists hoped to "capture and assassinate elected officials". Late today, they began to walk back that claim;
  • After a Congresswoman and former U.S. Navy pilot Mikie Sherril (D-NJ) charged this week that some insurrectionists were given "reconnaissance" tours of the Capitol by Republican lawmakers the day before last week's deadly riot Rep. Ayanna Pressley (D-MA)'s Chief of Staff reports that all of the panic buttons in the Congresswoman's office were found to have been mysteriously removed prior to assault;

Then, as moving vans begin hauling the remnants of the Trump Administration away, the outgoing President is reportedly angry and increasingly isolated. (Sad!) But as our long national nightmare will soon come to a close, his legal and financial nightmares may be just beginning. Even that, however, comes with threats to the security of the nation.

We're joined today by the great HEATHER DIGBY PARTON of Salon and Hullabaloo.  She's been writing about Trump's crumbling corporate empire both before, but especially in the wake of his failed Capitol Insurrection and the security concerns his financial woes pose to the nation. She explains why on today's show.

We also discuss the fallout from Trump's second historic Impeachment and how the U.S. Senate will proceed with the trial even as Biden takes office and hopes to see his cabinet confirmed and agenda enacted. And then there's the question of what we should expect as the "Ghost of Trumpism" lingers --- and continues to rot --- the soul of the Republican Party after he mercifully leaves office on Wednesday.

Finally, we close with some good news that got somewhat lost in the stampede of this week's instant Impeachment proceedings. Following a report from the Commerce Department Inspector General, the Census Bureau has now been instructed to abandon Trump's almost-certainly unconstitutional Executive Order scheme to withhold undocumented immigrants from apportionment data to be sent to Congress. Thus ends the Republicans desperate --- and now failed --- attempt to use the Constitutionally-mandated decennial federal Census as a means to shift political power from urban, Democratic-leaning areas of the country, to white, rural Republican districts...at least for another 10 years.

On today's BradCast: Donald Trump's Big Lie(s) continue to pose a terror threat, even as his world is crumbling. [Audio link to show follows summary below.]

On Wednesday, during the debate in the U.S. House over Donald Trump's second impeachment, a number of GOPers argued that the bipartisan call for accountability in response to the President of the United States inciting a terrorist attack on the U.S. Capitol last week would only serve to make matters worse. A number of Trump's defenders charged that if the Congress that was attacked by his MAGA Mob attempted to hold him to account it would be too "divisive" and anger his supporters at a time that the nation needed "unity" and "healing".

At the very same time, according to Greg Sargent at Washington Post today, a number of U.S. intelligence agencies, including DHS and DoJ, issued a memo warning that Trump's Big Lie about a "stolen election" was serving as the driving force for "Domestic Violence Extremists" (DVEs) who pose a serious threat of further violence in coming days.

Nonetheless, few of those Republicans in the House pretending to be concerned about dividing the nation further were willing to say the one thing that might actually "lower the temperature": That Joe Biden won the election fair and square according to all available evidence and that Donald Trump lost it in the same fashion.

Phony GOP concerns about "divisiveness" not withstanding, their refusal to do the right thing by debunking Trump's ridiculous claims that the election was stolen, rather than play along with them, has resulted in news that the National Mall in D.C. will now reportedly be closed entirely for the first time during a Presidential Inauguration due to the threat of domestic terrorism.

Trump's Big Lie about the election is not the only one. Some of the House Republicans on Wednesday were attempting to rewrite reality by claiming that Trump, at his MAGA Mob rally before the insurrection at the Capitol, did little more than "urged attendees to, quote, unquote, peacefully and patriotically make your voices heard. There was no mention of violence, let alone calls to action." That was the claim made by Pennsylvania's lying Rep. Guy Reschenthaler. Reality --- and actual evidence --- prove otherwise, as we do as well on today's program. Given that Trump's impeachment trial in the Senate on this very matter awaits, it seems wise to get a jump on this newest Big Lie.

But, as dark as this moment may be for the safety of Americans and future of American democracy, there is still plenty of Trump Schadenfreude News to be enjoyed today. Including the fact that Trump is reportedly "isolated and angry at aides for failing to defend him" during his second impeachment; his approval ratings have plummeted 11 points since December; and New York City is joining a growing list of those cutting ties to the disgraced Trump. As his Trump Organization empire begins to crumble, he is already losing millions of dollars worth of business from those who regard his brand as too toxic to get anywhere near at this point. And things are likely to get much much worse for him in the days ahead.

On today's BradCast: Donald John Trump made history yet again on Wednesday by becoming the first President to be Impeached twice. Plus, a former Congressman and diplomat warns accountability is needed if the nation ever hopes to recover. [Audio link to full show is posted below summary.]

The U.S. House voted 232 to 197, with 10 Republicans joining all of the Democrats, to charge the soon-to-be-former President with "Incitement of Insurrection" [PDF] for inflaming his violent MAGA mob before they stormed the U.S. Capitol just one week earlier. Using false claims that he had actually won the election in a landslide, he told his infuriated supporters to "fight like hell" to prevent the 2020 election from being stolen for Joe Biden. At least five people, including a police officer, were killed during the insurrection, another officer later committed suicide. Scores of both law enforcement officials and rioters were hospitalized as the marauders attempted to find and kill Vice President Mike Pence, House Speaker Nancy Pelosi and other lawmakers.

Soon-to-be-former Senate Majority Leader Mitch McConnell responded to the historic day by ruling out a trial on the charge in the U.S. Senate before next week's inauguration of Joe Biden. He did not, however, rule out his own vote to convict the twice-impeached President. Some close to McConnell have reportedly suggested that he may see the impeachment and a subsequent conviction of Trump as a way to distance the GOP from the nation's worst and most divisive President.

We share a number of the statements made during the House floor debate, both for and against Trump's impeachment, on Wednesday, including from one of the Republicans who broke with his party to vote to impeach the President.

Then, we're joined by former Democratic Congressman and diplomat TOM PERRIELLO, who now heads the Open Society Foundation for the U.S. Perriello, after serving as Representative for Virginia's 5th Congressional District, went on to serve as the U.S. Special Envoy to the African Great Lakes Region during the Obama Administration. Earlier in the 2000s he worked as a U.S. diplomat with the UN-mandated Special Court for Sierra Leone and as a consultant to the International Center for Transitional Justice in Kosovo (2003), Darfur (2005), and Afghanistan (2007).

Comments from Perriello caught our eye last week when he was quoted by the New York Times following the attempted coup at the Capitol. It was an article on the growing demands by Democrats for accountability for Trump, his family and his associates after he leaves office. In the piece, Perriello is cited --- based on his experience helping to resolve political crises in various developing nations, including one in which a President attempted to stay in office beyond his constitutional term --- noting: "Countries that skip the accountability phase end up repeating 100 percent of the time --- but the next time the crisis is worse."

“People who think that the way forward is to brush this under the rug," he told the paper, "seem to have missed the fact that there is a ticking time bomb under the rug."

On a day in which a majority of House Republicans argued and voted against accountability for last week's Trump-incited violent assault on the U.S. Capitol --- with many arguing, hypocritically, that impeachment would merely serve to anger Trump supporters and lead to more divisiveness and hostility at a time the nation needs healing --- Perriello's insight based on his years of experience abroad is enlightening. Citing, for example, the efforts to rebuild Liberia following the tumultuous, criminal reign of its former President Charles Taylor, was to bring charges. "The only real path to peace involved accountability for him and the other warlords who had driven so much of that conflict across the region."

"Accountability can take a lot of different forms, but there's a reason you don't have a lot of candidates out there and politicians saying they want to be the next Richard Nixon or the next Joe McCarthy. These are people who faced public accountability in the form of censure and resignation, with real consequences to them. And that tends to define the path forward," ," Perriello tells me. "There's a reason that in Germany, there are not statues set up to Hitler and other Third Reich figures. The way in which we choose to understand our history and hold people to account has real consequences for other leaders in the future, and the actions they choose to take."

Citing his concern about what could happen in the coming days, in the wake of last week's attempted coup, he notes: "The insurrectionists are already planning escalations. The failure to take seriously such similar provocations or promises, really, is part of what got us into this mess. ... To me, as someone who has worked in conflict zones and on transitional justice, the most scary image was them walking out not in handcuffs, because those images were ones that simply invited the idea of impunity. And impunity leads people to repeat those events, and repeat them with escalation. Allowing even a 24-hour news cycle in which these people could exit as heroes, was something that was almost certainly going to lead to more violence down the road. And that's why this issue of introducing accountability is important." 

So, is the best way for Joe Biden to help "heal" the country to look forward, not back, as the Obama Administration did when taking office after George W. Callers ring in on demands for accountability following last week's deadly, Trump-incited riot at the U.S. Capitol. But timing looms large before Inauguration Day, and as the MAGA Mob gears up for more violence...

We open up the phone lines on today's BradCast for the first time since Donald Trump's deadly attempted coup at the U.S. Capitol last week, to get feedback from callers on whether it makes sense to impeach him again with just about a week and a half left in his term. (For the record, my own opinion is "YES!," and I explain why throughout the course of today's show.) [Audio link to full show is below the summary.]

We start with some of the latest breaking news...

  • Trump's illegally appointed Acting Homeland Security Chief Chad Wolf announced, just before air time, that he is stepping down after being critical of Trump following last week's insurrection that killed at least five people, including a Capitol Police officer. Wolf called the riot "tragic and sickening".
  • The FBI has reportedly notified all 50 states of the possibility of armed attacks on state houses, as Trump's MAGA Mob are continuing to tell each other that Trump will be inaugurated on January 20th (he won't be) and that we should all prepare for a national emergency in which Trump invokes the Insurrection Act and begins "high profile arrests" between now and Inauguration Day. All of that, his minions have convinced themselves, come amid what they describe to each other as "a battle for our republic against elites that are attempting the very coup that they are accusing Trump of doing."
  • Over the weekend, however, House Speaker Nancy Pelosi informed House Dems that if Trump refused to resign, she would hold a vote on a resolution calling for Vice President Mike Pence to invoke the 25th Amendment to remove Trump from power. If that doesn't work (it doesn't appear that it will), a vote on a second Impeachment could be held in the House as early as Wednesday. We share the Article [PDF], formally filed in the House today by Reps. Jamie Raskin (D-MD), Ted Lieu (D-CA), David Cicilline's (D-RI), and Jerry Nadler (D-NY) for "Incitement of Insurrection", on today's program.
  • Over the weekend, both Democrats (like AOC) and Republicans like Sen. Pat Toomey (PA), Lisa Murkowski (AK), Ben Sasse (NE) and Trump ally and former Governor of New Jersey Chris Christie all suggested they might support impeachment and removal of the President. As Christie noted, "If inciting to insurrection" isn't an impeachable offense then "I don't really know what is."
  • Nonetheless, a number of Republicans are suggesting that if either the 25th or impeachment are invoked, it would lead to further violence. As Rep. Kevin Brady (R-TX) pathetically tweeted on Saturday, "Those calling for impeachment or invoking the 25th Amendment in response to President Trump's rhetoric this week are themselves engaging in intemperate and inflammatory language and calling for action that is equally irresponsible and could well incite further violence." --- In other words, if you hold anybody accountable for inciting violence, you are inciting the same people to more violence. So, best to do absolutely nothing, apparently. Very patriotic and courageous, Congressman.
  • On Sunday night, the PGA pulled their planned 2022 Championship from Trump's Bedminster, NJ golf resort, adding to the schadenfreude already most likely being enjoyed by anti-Trumpers since Twitter permanently banned him from the social media platform late on Friday.

As to the timing of how to pull off an impeachment with just days left in Trump's Presidency, it's important to understand --- as we discussed with former federal prosecutor Ben Clements on last Friday's show --- that an official doesn't even have to still be in office to be impeached. There is historical precedent for that. Clements, and others, argue it's important to impeach Trump if only to convict him at trial so that he cannot run for public office ever again.

It should also be noted that the House may vote to impeach this week or next, but wait until after Biden is sworn into office before sending the Articles to the Senate for a trial. That's what some Dems are now calling for. Rep. James Clyburn wants to wait until Biden's first 100 days are over. Others suggest waiting just long enough to allow Biden's cabinet to be sworn in, since all Senate business must stop when a Senate impeachment trial begins. With Chuck Schumer as Majority Leader, after Biden and Vice President-elect Harris are sworn in, a real trial could be held in the Senate, with dozens and dozens of witnesses, unlike the show trial McConnell held to quash the charges Trump was previously impeached for last year.

So, lots to chew over on today's program, and lots of callers ringing in with thoughts on all of the above...

Guest: Philadelphia Inquirer's Will Bunch on the D.C. mayhem, the Dem Senate victories and the MAGA legislative mob's extraordinary insurrection on Tuesday in the PENNSYLVANIA state Senate...

As "today" is still ongoing, we'll need to keep the summary of today's BradCast --- and the extraordinary events we find ourselves covering on the fly --- a bit more terse than usual. [Audio link to today's full show follows below.]

Our first draft of history today includes the news that both Democrats Raphael Warnock and Jon Ossoff have reportedly won their U.S. Senate runoff contests in Georgia against incumbent Republican Senators Kelly Loeffler and David Perdue, respectively. With those two stunning, if narrow, victories, Democrats will soon enjoy partisan control of the U.S. Senate under the new Democratic Majority Leader Chuck Schumer, instead of soon-to-be-former Republican Majority Leader Mitch McConnell. Warnock will be the first African-American Senator and Ossoff the first Jewish Senator to represent the Peach State. Ossoff, at 33 years old, will also be the chamber's youngest member.

While that momentous news alone would normally be our top and perhaps only story for the day, it barely makes the top three. As you know by now, after weeks of false, evidence-free claims by the President of the United States that the election was stolen from him, and after an hour of his endlessly repeated, ginned-up rhetoric on same at a so-called "SAVE AMERICA" rally in D.C. this morning --- and after Donald Trump's buffoon, criminal attorney Rudy Giuliani called for "trial by combat" in his own remarks --- the MAGA Mob he summoned to D.C. stormed the U.S. Capitol building.

The rioting came during a joint session of Congress, amid GOP challenges to the formal, usually ceremonial Electoral College affirmation of Joe Biden's decisive November victory. Both chambers of Congress were evacuated as Trump-supporting rioters broke windows and doors to enter the building. Both the House and Senate chambers, as well as lawmaker offices, including House Speaker Nancy Pelosi were violently breached by the anti-American marauders. Vice President Pence, who had been presiding over the Joint Session, was ushered, with several other key lawmakers, to a secure location through underground tunnels beneath the Capitol building. One of the insurrectionists is said to have been shot and killed. Questions remain, lots of them, as to why there was not a larger police presence around the Capitol before this perfectly predictable attempted coup.

But, while we offer a first draft of history on all of the above today, the attempt to overthrow the American government, abetted by the President himself, was hardly the only sign of the long and steady degradation of our Constitutional representative republic by members of the Republican Party. On Tuesday, GOP members of the Pennsylvania Senate refused to seat a duly elected veteran Democratic state Senator on the first day of their new session and used their gerrymandered majority to muscle Democratic Lt. Gov. John Fetterman out of his state Constitutional role as President of the state Senate. We share some of the remarkable audio from that Tuesday coup in the Keystone State, in what I'm calling "The Wisconsinization of Pennsylvania."

Joining us to explain what happened during those extraordinary events in Pennsylvania on Tuesday, the even more extraordinary events that we saw in D.C. on Wednesday --- and both where it all comes from and what it all means going forward --- is the great WILL BUNCH, longtime national columnist for the Philadelphia Inquirer and Philadelphia Daily News.

Finally, as the President of the United States with no more than two weeks left in office only made matters worse with his Twitter statements throughout the riots that he fostered today, we turn for sanity to the President-elect instead. We close today's program with Biden's calming words to a nation in crisis, while the current disgraced President returns to his bunker amid the American Carnage he has wrought...

On today's BradCast: Donald Trump's days in the White House are ending, but his response to that reality (and the reality of the most devastating hack of the U.S. government ever) is becoming more manic and desperate by the day. But at least, after nine months, Republicans have seen fit to allow some much-needed, long-overdue financial relief for sick, dying and desperate Americans as both Trump and the GOP's failed response to the pandemic has killed more than 316,000 Americans and may finally be catching up to them politically.

There was reportedly shouting and chaos --- even more than usual --- at the White House over the weekend, as Trump and his clown car friends and attorneys met to propose last gasp efforts to somehow steal and/or undermine the 2020 election. Trump's disgraced former National Security Advisor Michael Flynn --- recently pardoned by Trump for lying to the FBI --- is said to have called on the President to declare martial law to allow the military to re-run the Presidential election in swing-states that Trump lost; Team Trump attorney and professional conspiracy theorist Sidney Powell sought to be appointed as a Special Counsel to investigate 2020 "fraud"; and Team Trump's other corrupt, nut-ball attorney, Rudy Giuliani, reportedly wanted DHS to impound voting machines from battleground states for some reason. Trump's very Trumpy White House staff reportedly pushed back on all of those ideas, incredibly enough, and his outgoing Attorney General, Bill Barr, whose last day at DoJ is Wednesday, said in his final presser as AG on Monday that he saw no reason to appoint a special counsel and no legal grounds for the federal government to seize voting machines.

As that played out, over in the Senate, Mitch McConnell, who had refused to even negotiate with Democrats on a new COVID relief bill for the past nine months following the passage of the initial $2.2 trillion CARES Act in March, finally relented to allow another round of relief --- albeit much smaller --- to be adopted by Congress. That, following more than 16 million infections, hundreds of thousands of deaths and an economy in tatters. The $900 billion package he finally agreed to includes one time $600 payments for many Americans and extends unemployment insurance which runs out entirely by the end of the year, as tens of millions of Americans are now out of work due to the Administration's wildly mishandled pandemic. The package also includes nutrition assistance for the hungry, another round of the Paycheck Protection Program (PPP) for small businesses, money for hospitals and vaccine distribution, and even rent assistance, for the first time, among other things.

It's not nearly enough, says our guest today. But it's something, and it includes "nothing objectionable," at least for the most part. We're joined today by The American Prospect's Executive Editor, investigative financial journalist and author DAVID DAYEN, for details on the measure which he has been covering in-depth for months in his daily, indispensable "UNSANITIZED" report. Dayen explains what's in the bill and what is not, and why that is, along with why it is that McConnell even allowed the measure to come up for a vote at all after months of refusing to do so.

He argues that It's all about the January 5th U.S. Senate runoffs in Georgia, which will determine control of Congress' upper chamber for the next two years. "Mitch McConnell's Senate majority was on the line if he didn't get something done," says Dayen. "If McConnell manages to win at least one of those races in Georgia, he's going to be in control again. Joe Biden will be President, and every dollar that Mitch McConnell agrees to put into the economy is a dollar that helps Joe Biden."

"The question of how 'Not Enough' this bill is entirely is predicated on how fast we can vaccinate people," Dayen explains. "If we can vaccinate everyone by April, then we're probably going to get a rickety but sufficient bridge." But, he adds, if Biden's incoming Surgeon General is right when he noted over the weekend that "we won't get widespread availability of the vaccine until early Fall, then we're in big, big trouble. Because there's no more must-pass bills. The government is now funded through September of next year." That, Dayen notes, means that there is little if any leverage for Democrats to force Republicans to act on behalf of the American people.

"Democrats had to take out grants for state and local government relief," to get this bill passed, he tells me. "So when we get into next year, cities and states that have had these tremendous budget shortfalls, they are the ones who have to figure out how to fill that shortfall when they have no help from the federal government coming. It's likely going to result in cuts to public safety, teachers, firefighters, and public employees and not filling your potholes --- all sort of things at the local level that are going to have to be foregone because there is no money available. Mitch McConnell knows this, [and] that it could have the effect of offsetting any kind of recovery efforts at the federal level. We saw that in 2009. That stunted the overall recovery of the economy, and we're walking into it again." And with McConnell's eyes on 2022, he's likely just fine with that.

All of this underscores the importance of those two U.S. Senate runoffs in Georgia in January, and that Democrats Raphael Warnock and Jon Ossoff ought to be reminding voters every day that if they want any real relief from the federal government for the economic disasters that are almost certain to worsen due to all of this, they must elect both of them to give Senate control to the Democrats under a Biden Administration.

Finally, we've been reporting over the past week on two voting machines companies who have been threatening defamation lawsuits against Rightwing media outlets and the Team Trump attorneys who have been offering false claims that the companies were somehow involved in stealing the election for Joe Biden by flipping votes cast for Donald Trump. Last week, Smartmatic, which has no voting systems in any of the swing-states where Trump is trying to reverse his losses to Biden, threatened rightwing propaganda channels Fox "News", Newsmax and One American News Network (OANN) with defamation suits. They were sent a letter to instruct them that they would be sued if they did not retract false claims about the company, including allegations (apparently bastardized from our original, accurate investigative reporting from 10 years ago) that Smartmatic was somehow working with Venezuela's dead President Hugo Chavez and George Soros, along with the company's competitor Dominion Voting Systems in an international conspiracy to steal the election for Biden.

A day or two after Smartmatic's letter, Dominion sent a similar defamation threat letter to Team Trump attorney Powell seeking a retraction for her outlandish, evidence-free claims about the company.

On Friday then, in a bizarre segment on Fox' Lou Dobbs Tonight' --- which looked and sounded a lot like a deposition led by a disembodied off-camera voice --- Eddie Perez of the Open Source Election Technology (OSET) institute (he most recently appeared on The BradCast just a few weeks ago) answered a whole bunch of questions basically disabusing the evidence-free claims about Smartmatic that have been forwarded for weeks on Dobbs' show and many others. Reportedly Jeanine Pirro's and Maria Bartiromo's Fox shows ran the exact same segment with Perez, using almost identical introductions. The segments then led straight to commercial without comment from the hosts.

Fox is clearly terrified, and should be. As the New York Times' Ben Smith reported over the weekend, Smartmatic has retained attorney "J. Erik Connolly, who not coincidentally won the largest settlement in the history of American media defamation in 2017, for at least $177 million."

On today's BradCast: The monster isn't quite dead yet, but it's getting close. His zombie minions, however, pose an entirely different concern. [Audio link to full show is posted beneath summary below.]

Late on Thursday night, U.S. Supreme Court Justice Samuel Alito announced a schedule for the Court to examine a late challenge to Pennsylvania's election results, as filed by a top Trump ally in Congress and a number of state lawmakers. If successful, the challenge would result in the disqualification of hundreds of thousands of lawfully cast ballots in the Keystone State, handing its electors to the loser, Donald Trump. But Alito's delayed schedule to review the case --- until after the statutory so-called "safe harbor date" to conclude state Electoral College result challenges --- appears to all but preclude the possibility of SCOTUS overturning results in the state showing that Joe Biden defeated Trump by more than 80,000 votes.

That case, just like all of those filed (and rejected) by the Trump Campaign to date, does notinclude any evidence or allegation of fraud, widespread or otherwise.

So, is Trump's narrow path to overturning the will of the people now completely shut? Almost...though it's not quite foreclosed just yet, as we explain.

Then, following a week of death threats against Republican officials across the country by Republican supporters of Trump, as encouraged by the President of the United States himself, an expert in terrorism and insurgencies joins us to explain why he believes Trump is now actively laying the groundwork for a violent insurgency during Joe Biden's presidency.

COLIN P. CLARKE, is a senior research fellow at The Soufan Center, where he studies terrorism, insurgency and political violence. This week, in an Los Angeles Times op-ed, he argued that "President Trump's post-election antics are dangerous." Clarke, who has studied every political insurgency between WWII and 2009 writes: "I firmly believe that the president of the United States is laying the groundwork for violence and disruption to unfold regularly over the next four years. As a national security researcher, I never imagined I'd write that sentence."

Clarke, who also teaches Carnegie Mellon University's Institute for Politics and Strategy (IPS) and is author of a number of books on international terrorism, joins us today to explain his concerns, the evidence for them and why he believes it's important for Americans to understand the very real threat posed to U.S. national security by Donald J. Trump.

"Beyond just embarrassing himself, his administration and his band of sycophants, he's endangering the country," Clarke tells me. "As a counter-terrorism analyst, I find it my duty to be a sober assessor, to err on the side of caution, not to think that the sky is falling at all times. But I genuinely believe that what the President is doing right now is actively and deliberately attempting to undermine the legitimacy of the elections, of our democracy, and of the incoming Biden Administration."

Amid what Clarke describes as a political "tinderbox" created in the U.S. over the past four years, he charges that "Trump has always thrived on instability. He doesn't care if it happens to be in his own country. I don't consider him a patriot. I don't think he has the best interests of the United States in mind, and I don't think he ever has."

Following last week's assassination of Iran's top nuclear scientist (as discussed on a BradCast earlier this week with former National Security Council member William Tobey), Clarke also offers his assessment of whether it is the Islamic Republic or Trump himself who poses a greater threat to national security as Biden begins his Presidency next month.

Finally, Desi Doyen joins us for our latest Green News Report as the U.N. issues another dire warning on humanity "waging war against nature,"; the world's formerly most profitable corporation, Exxon Mobil, sees its value quickly disappearing as the world continues to move away from disastrously climate changing fossil fuels; and New Zealand's government declares a climate emergency and vows to reach net-zero carbon neutrality by 2025.

Guest: 28-year former Leon County, FL Supervisor of Elections, Ion Sancho; Also: Coronavirus begins third U.S. peak; Ransomware attack hits GA county's election infrastructure...

On today's BradCast: We're now just one week from Election Day. But as today's guest underscores, we may be much farther away from knowing who actually won it, given disturbing vulnerabilities that remain in our nation's voting system, beginning --- if not ending --- in the battleground state of Florida. [Audio link to full show is posted below summary.]

But first, the Trump Administration announced over the weekend, via White House Chief of Staff Mark Meadows, that it is no longer even trying to prevent the spread of COVID-19, with Meadows telling CNN that "we aren't going to control the pandemic." Rather, he said, they'll work on mitigating its effects, eventually, through the development of therapies and vaccines.

That, as the U.S. hit its third peak of infections over the weekend, with new daily records that outpaced those from the June-July peak, which previously outpaced those from the original March-April peak. The pandemic is getting far worse, not better, and it's now being super-spread by the President of the United States himself at maskless rallies around the country. The virus which has now killed almost a quarter of a million Americans in the past six months is also being similarly spread by Vice President Mike Pence at rallies, even after five of his top staffers and advisers, including his Chief of Staff Marc Short, were revealed over the weekend to have tested positive.

On Monday morning, Trump actually tweeted that reporting on COVID numbers should now be outlawed. At the same time, talks on a new emergency relief package for the American people, between the White House and Democrats in the U.S. House, collapsed yet again. And, in response to all of the above, the Dow plummeted 650 points on Monday.

Things are not going well, just one week out from Election Day, even after some 60 million Americans have already cast their vote this year, outpacing all early voting from 2016.

But, if you think Election Day will be the answer to all of our woes --- while I pray you are right --- you may want to hedge that bet. One of my greatest fears about the election, a ransomware attack, appears to already be playing out in one county in the battleground state of Georgia. In Hall County, a ransomware attack has hit the county's elections infrastructure by taking out its voter signature database and a precinct map hosted on its website. If a similar attack were to occur on or before Election Day, in any one of the thousands of counties which now rely on the Internet or networked computers to allow voters to cast a vote at all, we could see absolute chaos. This President, of course, is all to ready to exploit such a case to his advantage with the help of gerrymandered Republican-controlled state legislatures around the country and a compliant (and stolen) U.S. Supreme Court (made even more stolen today by the confirmation of Amy Coney Barrett in the U.S. Senate.)

Down in the critical battleground of Florida, as my guest explains today, voters may never even know if the election is stolen from them. That guest today is the legendary, former 28-year Supervisor of Elections in Leon County (Tallahassee), Florida, ION SANCHO, who was so well-respected by his peers on both the right and left he was appointed to oversee the eventually-aborted year 2000 recount between Al Gore and George W. Bush in the Sunshine State.

On Friday, Sancho sent an urgent letter [PDF] to the Supervisors of Elections in 47 of Florida's 67 counties which use wireless cellular modems to transmit precinct election results to county headquarters after the close of polls on Election Night. The letter warns that those modems --- and the Internet connections to them at the counties' central tabulators --- can be easily hacked "from anywhere in the world." If they are, he explains on today's program, it's very likely that such a hack, changing election results, would never be noticed by election officials.

"The issue is that we’re using equipment that is not secure," Sancho tells me. "To quote Sen. Marco Rubio, 'Many Florida election officials are arrogant over their belief that they can’t be touched, that they are secure.' And this is a state that does not compare the numbers that we generate on those electrical optical scanners to the actual, physical votes on the piece of paper. We’re completely dependent upon those electronic totals on Election Night."

Manual examination of hand-marked paper ballots in Florida, to make sure the reported computer tabulation was correct, is prohibited by state law. Sancho details his concerns about those modems --- which are not federally certified for use in elections --- and how the state's election officials can avoid the threat posed by this very serious vulnerability to the state's election infrastructure. Making matters worse, he notes, "We do not audit the paper ballots to confirm that the election totals are correct. And that’s a huge, huge problem – not just in Florida, but everywhere in the country."

"Most of the election officials were not even aware that their systems were connected [to the Internet], because the vendor [in this case, ES&S, the nation's largest] never told them. You’re almost 100% dependent upon the vendor for the information about your system. So our most public process – our elections process, which is public – really are controlled by private entities."

"The worst-case scenario," with the modems now used in the systems in Florida, "is that a man-in-the-middle attack could actually intercept the totals that are being electronically-transmitted over the Internet, and manipulate them --- not only to the central tabulator, but re-routing back into the actual digital voting machine and altering the results in that device," he warns. "You could have a complete disaster here."

Sancho may be familiar to some listeners from his landmark appearance in HBO's Emmy-nominated 2006 documentary Hacking Democracy, in which he allows an experiment by "white hat" Finnish hacker Harri Hursti. In the film's climactic scene, we see an actual hack of one of Leon County's optical scan systems, as carried out by Hursti in a mock election. The hack flips the results of the election in a way that would never be noticed by elections officials, save for a manual examination of the hand-marked paper ballots cast.

Sancho also offers his concerns today about whether the 2020 Presidential election could become a redux of what played out in Florida in 2000, when a weeks-long battle to determine who would be President of the United States was kicked off on Election Night, after an optical-scan tabulator --- for reasons still unknown to this day --- recorded negative 16,022 votes for Al Gore in Volusia County. The election was ultimately decided in favor of Bush by an "official" margin of just 527 votes, thanks to a right-wing U.S. Supreme Court which stopped Sancho's statewide hand recount from ever being completed...

Guest: Col. Moe Davis, former Chief Military Prosecutor at Gitmo, now Dem candidate for NC-11; Also: Hurricane Laura lands hard and Faking America Great Again (again) at RNC Day 3...

On Wednesday night at the Republican National Convention, the GOP's candidate for the vacant seat in North Carolina's 11th Congressional District offered some strange remarks. Today, on The BradCast, his Democratic opponent joins us to offer his response. [Audio link to full show follows below.]

Retired U.S. Air Force Colonel MOE DAVIS has a distinguished, 25-year career in the military that includes a boatload of awards and honors. As Chief Military Prosecutor at Guantanamo Bay, he pushed back against the George W. Bush Administration, refusing to use evidence obtained through torture against accused terrorists. When forced to do so anyway, he resigned. Later, while serving as a national security expert for Congress, he penned an op-ed critical of Obama's use of prosecutions at Gitmo. He was fired.

Now he's running for Congress as a Democrat in a NC District where Donald Trump reportedly won by 57 points in 2016, for the vacant seat previously occupied by Trump's latest Chief of Staff, Mark Meadows. But there are new court-ordered Congressional maps this year in North Carolina, after the previous Districts were found to have been unlawfully gerrymandered by state Republicans. The old maps allowed Republicans to hold 10 of 13 U.S. House seats over the past decade in one of the most closely divided states in the nation. Davis (and other experts) contend that while his District may still lean Republican, it is now much less so.

Moreoever, Davis will be running in November against a dashing 25-year old Republican kid --- and apparent Nazi-enthusiast --- by the name of Madison Cawthorn. You may have seen him speak from his wheelchair during Wednesday night's RNC. Col Davis joins us today to respond to some of Cawthorn's somewhat bizarre remarks (in which he incorrectly claimed that James Madison signed the Declaration of Independence when he was 25 --- though Madison did not sign the Declaration at all) and other elements of Cawthorn's apparently made-up resume.

Davis notes that his opponent was recently thanked "for his service to the country" on television by a Fox "News" anchor who apparently associated his wheelchair with military service. In fact, he was paralyzed in a car accident during a Spring Break trip to Florida when he was 18. "He didn't correct her," says Davis. But facts and telling the truth are no longer required in the Republican Party. In fact, both are apparently frowned upon. So Cawthorn could be the party's next superstar! "He plays fast and loose with the truth," charges Davis. "And I guess if you're on the side that 'alternative facts' are acceptable, then he's got a whole bag full." But, Davis concedes, Cawthorn "always gives you a good show. He's a handsome young man, very charismatic and articulate," before adding: "There's a lot of sizzle there but not much beneath the surface."

He says Cawthorn had promised to finally offer proposals for things like climate change and health care during his RNC speech, but instead argued simply that "conservatives" must "win the argument on both health care and the environment." He didn't bother to offer any actual argument, however. That on a night that a monster hurricane was speeding toward the Texas/Louisiana border --- the second one in a week --- while huge wildfires burned out west, after 3 nights of the RNC in which not one speaker seems to have uttered the words "climate change" even once.

"Mr. Cawthorn's plan for addressing health care is that we need more insurance companies," says Davis, who describes that as "laughable...If you're out of work, having more insurance companies isn't going to help you. That's his fresh new plan for the Republican Party.

For his part, Davis explains his own positions on several of these issues and others affecting some of the more rural (Republican-leaning) parts of his District. After the recent court-ordered redistricting in the swingiest of swing-states, the 11th District is now believed to be more Democratic, as it includes much more of Asheville. Davis notes that many describe the progressive city as "the Berkeley of the Blue Ridge....A big blue dot in the middle of a sea of red." He offers confidence that he'll be able to flip this previously "deep red" district to "blue" this year. He also shares his thoughts, as a law enforcement official himself, on calls from the Left for police reform amid continuing protests against systemic racism and a rightwing vigilante who murdered two peaceful protesters in Kenosha, WI on Tuesday night. And we discuss what he thinks about Donald Trump's pretend opposition to the Iraq War and threats to fill up Guantanamo Bay again, after it was nearly emptied during the Obama Administration.

Also on today's show: Desi Doyen joins us for details on the devastating damage wrought overnight by the monster Hurricane Laura in Louisiana and the bizarre, dangerous Night 3 of the RNC where Vice President Mike Pence gave his Presidential-sounding keynote address. He warned that violence in the streets under the Trump Administration is actually what we can expect, ironically enough, from "Joe Biden's America" --- to a maskless crowd filled with vulnerable elderly war veterans. Hopefully the event does not turn out to have been a COVID-19 super-spreader event, or Pence's closing promise to "Make America Great Again...Again" may never come to pass...again.

Two storms in the Gulf as RNC begins; Trump's sister calls him a liar; Former GOP lawmakers endorse Biden; Former Republican NatSec officials endorse Biden; Repubs fail to create a platform at national convention, party now officially a cult of personality...

Everything is now happening all at once. So, we couldn't get through half of what we would have liked to have covered while still having enough time left to open phones on today's BradCast to thoughts from listeners on last week's Democratic National Convention and this week's GOP version. [Audio link to show follows below.]

So, before we opened the phones to a bunch of great calls, we covered, among other things...

  • Last week, Donald Trump claimed Joe Biden will "hurt God" if he's elected. But it seems that God may have already chosen sides in this year's Presidential election. As if the COVID crisis derailing Trump's plans for rallies and a national convention in two different cities wasn't enough, this year's record Atlantic Hurricane season continues with not one but two storms in the Gulf (Marco and Laura) at the same time, both gunning for Louisiana and/or Texas this week as the Republican National Convention finally gets under way. Desi Doyen joins us for the latest on that;
  • Even Donald Trump's own family doesn't trust Donald Trump. We already know his niece, Mary Trump --- who recently released a best-seller about him --- thinks he's a lying, fraudulent, menace. But so too, apparently, does Donald's own sister, former federal Judge Maryanne Trump Barry, who is heard during secretly recorded conversations with Mary describing her brother, the President, as stupid, cruel, phony and a liar, among other nice things from a family member who knows him best. We share some of those audio recordings released over the weekend today;
  • Also parting ways with Donald Trump today, more than two dozen former Republican Senators and Congressmen, including Arizona's former Sen. Jeff Flake, who announced their endorsement of Joe Biden just hours before the Republican National Convention was to get under way on Monday;
  • That follows a group of more than 70 longtime national security officials who served under Trump and other Republican Administrations who issued an open letter on Friday endorsing Joe Biden and describing Trump as "dangerously unfit to serve another term";
  • But, of course, all of this is just part of the GOP's long spiral into a party that believes in absolutely nothing at all other than clinging to power any way that they can and, of course, cult-worshiping Trump, as Politico Magazine's Tim Alberta details in a new piece today headlined "The Grand Old Meltdown: What happens when a party gives up on ideas?" As one longtime Congressional GOP stalwart laments in Alberta's piece, "Owning the libs and pissing off the media. That's what we believe in now. There's really not much more to it.";
  • One thing that happens when a party gives up on ideas is they are unable to even craft a policy platform for their party. That is --- other than officially selecting a nominee for President --- the whole point of holding a national convention in the first place. But with a complete dearth of legitimate policy proposals, the RNC on Sunday essentially admitted as much by announcing they would not be producing a platform at all this year for the first time in....ever?;
  • Then, after a few words about the ongoing fight against the attempt by Trump and his Postmaster General Louis DeJoy to steal the election by slowing down the mail during the largest Vote-by-Mail election of all time, we open the phones to listeners with their thoughts on all of the above and much more...

Winning the Right to Vote; DeJoy to DeCongress; Repub Led Senate Report on Team Trump Lies About 2016 Russia Interference; Former DHS Official Calls Trump 'Terrifying', Lawless; Highlights from DNC Day 1...

Among the MANY stories covered today...

  • It's been 100 years since women won the right to vote, as the 19th Amendment was ratified on August 18th, 1920. They were not granted the right. They fought like hell for generations and won it for themselves. Sadly, thanks to Donald Trump and his fellow Republicans, too many are still fighting like hell to keep it;
  • Over the weekend, House Speaker Nancy Pelosi summoned lawmakers back to D.C. to pass a law this Saturday to roll back efforts by Donald Trump's donor and newly appointed Postmaster General, Louis DeJoy, to slow down mail delivery in advance of the November election. On Monday, he and U.S. Postal Service Board of Governors Chair --- and former RNC Chair --- Robert Duncan, agreed to testify before the House Oversight Committee next week. Today, DeJoy also agreed to testify before the Senate Homeland Security and Governmental Affairs Committee on Friday and, clearly under pressure and facing lawsuits by 20 different state Attorneys General, DeJoy agreed to pause his new directives at the USPS...if you believe him;
  • The Republican-led U.S. Senate Intelligence Committee released a damning, nearly 1000-page report today on Russian interference in the 2016 election, and the Trump Campaign's cooperation with the effort. The bipartisan report, described as more expansive than the one by Special Counsel Robert Mueller, highlights, among many other things: Trump's criminal lies to Mueller about conversations he "did, in fact" have with convicted felon Roger Stone (and multiple other campaign staffers) concerning the publication of stolen emails by WikiLeaks before the 2016 election; convicted Trump Campaign Manager Paul Manafort's collusion with a Russian intelligence agent described as a "grave counterintelligence threat"; the Russian "influence operation" after the election to claim that it was Ukraine, not Russia, which interfered in 2016 on behalf of Hillary Clinton, not Trump --- a claim for which the Senate Committee found "no reliable evidence" despite more than 200 interviews over three years of fact-finding, including with Trump family members and top campaign officials;
  • Just hours before the Democratic National Committee's Convention was to convene on Monday night, the group Republican Voters Against Trump released a damning video featuring Miles Taylor, the former Chief of Staff at Trump's Dept. of Homeland Security, who describes Trump's incompetence as "terrifying", detailing frequently "illegal" orders from the President who, he says, often attempted to exploit the DHS for his own political purposes and personal benefit. Taylor said today we should expect more insiders coming forward with similarly disturbing revelations in coming days;
  • Then, we move to the first night of the virtual 2020 Democratic National Convention with a few thoughts about the format (a "convention" without the actual convening part) and the high-profile Republicans --- including Ohio's former Governor and Republican Presidential Candidate John Kasich --- who spoke in support of Joe Biden on the Dems' opening night. We also share the segment featuring Kristin Urquiza, whose Trump-supporting father believed the coronavirus to be a hoax, until we was killed by it. We then play extended excerpts from former Democratic Presidential candidate Sen. Bernie Sanders' full-throated endorsement of Biden, making the progressive case for his Presidency, and finally an extended portion of the killer keynote remarks by former First Lady Michelle Obama, detailing Trump's irreparable failures as President and why the nation needs to replace him with Biden. Both Sanders and Obama made excellent arguments for why neither progressives nor Democrats nor the country nor the planet could endure four more years under the most inept, corrupt, dishonest, failed President in the history of the nation;
  • Finally, Desi Doyen joins us for our latest, incredibly jam-packed Green News Report, as extreme weather broils the U.S., Greenland's ice sheet faces its final days, and the Trump Administration opens up the previously pristine Arctic National Wildlife Refuge to commercial oil drilling...even though Donald Trump apparently does not even know what it is.

My first guest is author, professor and journalist JEFF SHARLET (author of The Family: The Secret Fundamentalism at the Heart of American Power). He went to a bunch of Trump rallies so you don't have to. Sharlet explains what he learned in Vanity Fair's "He's the Chosen One to Run America: Inside the Cult of Trump, His Rallies Are Church and He Is the Gospel."

We also check in with my old friend and radio colleague, JACK RICE. He's a former CIA officer who I wanted to speak with about the Russia bounty for dead American soldiers in Afghanistan. He has a unique perspective on the story.

Jack is also a criminal defense attorney who lives in Minneapolis, about 10 blocks from where George Floyd was killed. And he's representing someone who was arrested for pulling down a statue of Columbus.

Which leads us to an op-ed that appeared in the Sunday NY Times, written by a poet named Caroline Randall Williams. I ended the show with a reading of her devastating words that everyone should read titled "You Want a Confederate Monument? My Body Is a Confederate Monument."

On today's BradCast: Why does Indiana's Secretary of State Connie Lawson believe her emails with other Secretaries of State, and potentially voting system vendors, should be exempt from disclosure via public records requests? She is claiming her discussions about those systems with members of the private National Association of Secretaries of State (and any private vendors they may discuss or hear from) should somehow be protected due to exemptions for trade secrets and national security that cannot be exposed to the public. A judge in Indiana, however, seems to believes she is wrong. [Audio link to full show is posted below summary.]

But, first up today, a few items of breaking news amid our ongoing dystopian American nightmare...

  • A federal appeals court panel agreed today with a lower court judge that Donald Trump violated the law when he commandeered $2.5 billion in tax-payer dollars appropriated by Congress for the military in order to build his wall under the phony guise of a "national emergency". That, after Congress had specifically refused to allocate such funds. Bill Barr's corrupt Dept. of Justice will likely be appealing that one all the way up to the GOP's stolen U.S. Supreme Court if necessary;
  • As we have been warning for weeks (months?), the coronavirus pandemic is getting worse, not better, in the U.S. In particular, as we've demonstrated, many of the hardest hit regions where infection rates, ICU usage and deaths are skyrocketing are places where Republican politicians have been successful in joining our maniacal conman President in pretending the virus would simply go away if we just reopened our doors for business. That strategy has failed miserably and tragically. So much so, that the very Trumpy Republican Governors in two of the hardest hit states, Florida and Texas --- which were among the first to prematurely reopen --- were forced to re-close bars, restaurants and other businesses today as infections rates surge to record numbers in their states, and as ICU beds in some locations are quickly filling to capacity;
  • That, at the same time Vice President Mike Pence, who heads up the White House Coronavirus Task Force (remember them?), held their first press briefing in weeks to continue the Administration's attempted gaslighting of America to declare "very encouraging news" in the case numbers which are going straight up now in a majority of U.S. states;
  • Today's grim record COVID-19 numbers come just days after our failed President lied to his supporters at his latest maskless Death Rally inside a Phoenix church on Tuesday that "it's going away". It's not. It's getting worse. That was the same day in which internal White House task force documents, according to an NBC News exclusive, told both Trump and Pence that new case numbers in Phoenix --- which "had the highest number of new cases among the 10 metropolitan regions where the week-over-week change in infection rates spiked the most" --- was up some 150 percent over the past week. And, yes, infection rates, hospitalizations and deaths rates are rising as well, according to the White House's own numbers. That is not, despite the lies from both Trump and Pence, caused simply by "more testing".

With unabashed criminals like this now running our country --- and hopefully facing charges of criminal negligence if not mass murder someday soon --- we turn back to our "last firewall": our electoral system. There, we've got a bit of good news today, as Indiana Judge Heather Welch has rejected most of the claims made by the state's Sec. of State Connie Lawson (formerly a member of Trump's failed and phony "voter fraud" commission) to try and obscure her emails with members of the National Association of Secretaries of State (NASS).

The judge's ruling stems from a lawful request filed under Indiana's public records act. The suit, filed on behalf of the National Election Defense Council (NEDC) by Free Speech for People (FSFP), seeks those records in which Lawson was discussing voting systems with fellow Secretaries around the nation, NASS staffers, and, very likely, according to our guest today, private voting system vendors who wine, dine and lobby our nation's elections officials. In turn, those officials buy the unsecure, overly-expensive, error-prone computer voting and tabulation systems from the companies, and then parrot their talking points when the systems fail or when the public seeks to learn how they actually work (or don't.)

We're joined today by FSFP Legal Director RON FEIN to explain the court's recent ruling [PDF] in which the Judge rejected most of Lawson's claims to things like copyright and trade secret exemptions for her official Sec. of State emails. The judge is also demanding to privately review in her chambers those emails about which Lawson is claiming statutory exemption on the basis that disclosing those emails to the public would pose "a reasonable likelihood of threatening public safety by exposing a vulnerability to terrorist attack."

Lawson [pictured above with her newly purchased unverifiable computer voting systems] served as President of NASS from 2017 to 2018. She falsely testified [PDF] in 2017 before the U.S. Senate Intelligence Committee, during its probe of Russian interference in the 2016 election, that America's "voting machines are not connected to the Internet or networked in any way." That claim has been proven to be an out and out lie, over and over and again.

Nonetheless, if true, what possible "vulnerability to terrorist attack" could Lawson be referring to? Fein offers his thoughts, and explains why the judge's ruling that "access to public records is an important statutory right," is already a victory in this little known, but potentially very important case.

"The fact that the Indiana Secretary of State has fought so hard to keep these materials private suggests that at least some of them have something that's embarrassing that they don't want the public to see," Fein tells me, suggesting that, "In some cases, the [voting system] companies are either outright bribing or engaging in extremely unethical practices with election officials."

"One of the most essential elements of democracy is a free and fair election. And the free and fair election requires that it be secure and trustworthy...And we have misinformation out there about the security of these systems. When that misinformation is being spread by election officials whose job is supposed to be to spread accurate information and, if anything, tamp down misinformation, then it means that we have a crisis of legitimacy in the election," Fein explains. "What we're hoping through this public records access lawsuit is that, if we can shine a light on the processes by which election officials end up as vehicles for misinformation about the security and reliability of our election systems, then that will provide an opening for reform."

Please tune in for the full conversation, as we cover quite a bit of ground. And, just for the record, Lawson also misled the Senate Intelligence Committee when she insisted under oath that "no votes were changed in 2016." In fact, nobody actually knows one way or another, because nobody ever bothered to check.

Finally today, after yet another hellish week in Trump's America, we close with a smile and a song "celebrating" his under-attended Death Rally last weekend in Tulsa...
