On today's BradCast: Joe Biden is on a "go big" roll that has stunned even many long time progressives. Another one of them joins us on today's show to sing the praises (mostly) of his $2.25 trillion infrastructure, jobs and climate proposal known as the American Jobs Plan. It will be paid for --- at least in very small part --- by ending long time direct subsidies (yes, government socialism) to the Fossil Fuel Industry. But, even on that, the industry is getting a break that they shouldn't. [Audio link to full show is posted below this summary.]

First up today, however, some noteworthy news headlines...

• The white Brooklyn Center, Minnesota police officer who resigned yesterday after shooting black motorist Daunte Wright during a traffic stop on Sunday, has been charged with second-degree manslaughter after days of protest and unrest. The city's Police Chief, who also resigned on Tuesday, has said that the 26-year veteran officer, Kim Potter, meant to taze the 20-year old Wright, but shot him instead.

• A scathing new Inspector General's report finds that U.S. Capitol Police were instructed by leadership not to use their best crowd-control weapons on January 6th, despite clear intelligence from the FBI and Dept. of Homeland Security warning that "Congress itself is the target" for protests by Donald Trump supporters who were scammed by his false claims that the Presidential election was stolen. In the days before the assault, pro-Trump social media sites included explicit details regarding plans by MAGA Mob extremists to target both the Capitol and members of Congress, including maps of underground tunnels at the Capitol building and threats calling for "violence" and "war". While DHS and the FBI were aware of these threats --- and, therefore, so was Trump --- for reasons that still remain unclear, the Capitol Police were left wildly unprepared for the deadly siege.

• And, in perhaps the most critical news of the day, President Biden announced, in no uncertain terms, his plans to remove all U.S. troops (other than those needed to protect diplomats) from Afghanistan no later than September 11th of this year, the twentieth anniversary of the 9/11 attacks. He explained his reasoning and responded to critics of the move in remarks at the White House today, declaring that "It's time to end the forever war." We share extended excerpts from his address.

Then, we're joined by the great energy and climate journalist DAVID ROBERTS --- formerly of Vox, now publishing his own must-read newsletter called "Volts" --- for insight into Biden's plans to pay for what Roberts characterizes as a remarkably progressive infrastructure, jobs and climate proposal.

Introduced two weeks ago, the American Jobs Plan is to be paid for largely by an increase on the corporate tax rate. But, as Roberts detailed in a recent Volts article, it will also include a repeal of some of the permanent subsidies to the Fossil Fuel industry which they have enjoyed for decades, as written into the tax code. While many progressives are pleased about that, including Roberts, the fact is that those direct subsidies to the industry, as he points out, amount to a very small fraction of the cost of Biden's ambitious plan. Indeed, at some $35 billion for the entire industry, spread out over ten years, it also amounts to a very small amount of the true cost of the "indirectsubsidies" or "externalities" which the public pays for to boost profits for the polluting industry.

The direct subsidies, says Roberts, are "a drop in the bucket" compared to "the total amount of money that would be raised if you went after the indirect subsidies" with a carbon tax that accounts for the true cost of the industry's "products that produce a lot of social harm.  Harm in terms of air pollution that they generate, which then produces health costs, and people miss work. There's the climate damages that they do when they're burned. There's land pollution. There's abandoned oil and gas wells at the end of their life. Those cost a lot of money" to clean up, which the companies rarely, if ever, do.

"The oil and gas industry itself doesn't pay any of those costs. So when your product imposes all these costs and you don't pay them, the public steps in and pays them. Like the kids with asthma who are paying, rather than the fossil fuel companies." Roberts suggests "those externalities, as they're called, have always been the premise for a carbon tax, why we would want to put a tax on carbon so that you can recoup all these damages that the oil and gas industry are not paying for."

Still, setting aside how the package is to be paid for, Roberts concedes that he is "pleasantly surprised" about the "super-big and ambitious" package which includes, as he also details, a whole bunch of cool stuff that has received little coverage, since there is actually so much packed into the sweeping, long-overdue proposal.

How to get it passed, however --- and, specifically approved by "our emperor and benefactor Joe Manchin, long may He reign" --- is another matter, which we discuss in detail today as well.

"Where we are is so ludicrously far away from where we need to be, that it becomes difficult to judge anything in the middle," Roberts argues. "Is this a good big step or is it a grossly inadequate step? Yes. It's both. Everything we're going to do on climate change for the next decades will fit that description. It's going to be big and not big enough."

We then close today with a quick thought or two on a new statement from hundreds of companies and corporate executives in opposition to the GOP attempts to restrict voting rights around the country. We hope to have more time to discuss the matter on tomorrow's BradCast...

Hopefully today's BradCast, if nothing else, serves as a friendly reminder that Liz Cheney --- whether or not she met the incredibly low Republican bar by voting to impeach Donald Trump after the January 6th MAGA Mob insurrection at the U.S. Capitol --- is still not your friend, much less some sort of hero. Among the many news items and important insights and context covered on today's program...

• The Biden Administration will finally withdraw the last of our 2,500 U.S. troops still deployed to Afghanistan by September 11th of this year, 20 years after the 9/11 attacks which resulted in our seemingly endless war there and elsewhere. For some reason we remain dubious about that exit date...even if we are hopeful.

• The FDA and CDC are recommending a "pause" on the use of Johnson & Johnson's COVID vaccine after finding it led to rare blood clots in six women out of more than 3.8 doses administered in the U.S. For the record, the coronavirus, as of today, has killed more than 562,000 Americans to date, which is more deaths over the past year than 188 September 11th attacks.

• After two nights of protests and unrest in Brooklyn Center, Minnesota --- a suburb outside of Minneapolis, where white, former cop Dereck Chauvin is currently on trial for the murder of George Floyd --- the city's Police Chief and 26-year officer Kim Potter resigned Tuesday following her Sunday killing of Daunte Wright. Potter says she accidentally shot the 20-year old black man while attempting to taze him after he was pulled over for expired tags on his vehicle. The incident was capture by Potter's body cam video released on Monday, the day after the shooting.

• As disturbing as the video of Wright's killing was, another confrontation captured via body cam between cops and a black Hispanic man --- this one, a uniformed Army lieutenant named Caron Nazario --- is arguably even more disturbing for reasons we discuss on today's show. The incident, which included the berating and point-blank pepper-spraying at gun-point of an incredibly compliant and polite unarmed Nazario, occurred last December. The video tape, however, was only released publicly on Monday as part of Nazario's lawsuit against the abusive Windsor, Virginia police officers Joe Gutierrez and Daniel Crocker who pulled him over on a dark highway for a missing permanent license plate on his new car. (Temporary tags were in the window and clearly visible in the video tape.) Gutierrez has now resigned and Virginia's Attorney General has opened a civil rights investigation into the incident, one of undoubtedly thousands of similar ones not caught on viral video tape each year in America.

• Wyoming's Republican Rep. Liz Cheney has been attacked by many in her party and lauded by some on the non-right for living up to the absolutely lowest expectations for a Republican these days after having voted in favor of the second impeachment of Trump in January, for his incitement of the U.S. Capitol attack. But, as we've noted on several occasions since then, nobody should mistake her for anything other than her diabolically rightwing father's daughter. That was made clear on Monday during an appearance with Georgetown’s Institute of Politics and Public Service when she appeared to condemn the radical extremism rampant in her own party while simultaneously "both sidesing" the matter with references to extremist in "both parties". Sorry, Liz. This isn't even close to a "both sides" issue. But, if there are still any question about that...

• ...Disturbing new data released by the Center for Strategic and International Studies (CSIS), reaching back 25 years and analyzed by the Washington Post on Monday, finds "Domestic terrorism incidents have soared to new highs in the United States, driven chiefly by white-supremacist, anti-Muslim and anti-government extremists on the far right." And the numbers of both incidents and fatalities in recent years aren't even close to those attributed to "far left" attacks. We comb through the Post's analysis of the troubling data, while noting its alarming similarity to the warnings included in a 2009 DHS report on far-right domestic extremism that was ultimately retracted by the Obama Administration after Republicans pretended to be outraged about it (after saying nothing about a similar report regarding left-wing extremism released just prior.) Coincidentally we notice that WaPo's original headline for their analysis on Monday was "Domestic terrorism data shows right-wing violence on the rise." That was apparently quickly changed online yesterday to the more GOP-friendly "The rise of domestic extremism in America." We're sure Liz Cheney is delighted about that.

• Finally, Desi Doyen joins us for our latest Green News Report, chocked full of troubling climate change news, as usual, but featuring at least one story that leaves us moderately more hopeful today...at least when it comes to the ability for warring battery makers to come together for the good of our not-a-moment-too-soon electric car future...

The long, necessary and arduous 'Clean up on Aisle 45' isn't only a domestic challenge. The disgraced former President also left a disastrous mess behind in hard won foreign alliances and unilaterally broken international agreements. On today's BradCast, we dive back into the landmark, 7-party nuclear accord with Iran which Donald Trump not only violated and broke, but specifically sabotaged thereafter in order to make it more difficult, if not impossible, for future American Presidents to restore. [Audio link to full show is posted below.]

But before we dive into that foreign mess today, the domestic disaster Trump unleashed on January 6th at the U.S. Capitol continues to reverberate. On Wednesday, 10 more members of Congress joined the federal civil suit filed against the former President in February by Mississippi's Democratic Rep. Bennie Thompson. The suit charges Trump violated the Ku Klux Klan Act of 1871 by inciting his supporters to block Congress from carrying out its Constitutional duty of counting and ratifying the Electoral College vote from the 2020 Presidential election.

The newly amended complaint, filed by the NAACP, also names Trump attorney Rudy Giuliani, the white supremacist group The Proud Boys (and several newly formed entities created after the legal dissolution of that extremist organization), as well as the Oath Keepers as defendants. It details the trauma suffered by the Congressional members during the deadly attack and in the days that followed.

In February, a 57-43 majority of the U.S. Senate, including 7 Republicans, found Trump guilty of "Incitement of Insurrection" during his historic second impeachment trial. The plaintiffs in the amended Thompson complaint seek both compensatory and punitive damages, as well as injunctive relief, with the dollar amount to be determined by jurors at a D.C. federal court trial.

Coincidentally today, the New York Times obtained an excerpt from a new book by former Republican U.S. House Speaker John Boehner who correctly writes that his party has been taken over by "whack jobs" and cites Trump as having "incited that bloody insurrection," charging him with "stoking the flames of conspiracy that turned into violence in the seat of our democracy."

Next, we turn to one of Trump's (many) foreign disasters, as talks began this week in Vienna, through intermediaries for the U.S. and Iran, in hopes of finding a way toward restoration of the landmark 2015 nuclear deal between the two countries. The pact was struck after years of delicate negotiation by the Obama Administration along with China, France, Russia, the UK and Germany. As you'll recall, Trump unilaterally violated the otherwise successful deal that curbed Iran's nuclear program and removed stockpiles of uranium from the country in exchange for the lifting of certain sanctions against the Islamic Republic.

Even though the Trump Administration confirmed Iran's compliance with the terms of the deal, the 45th President nonetheless violated it by by pulling the U.S. out and re-imposing punishing sanctions. According to our guest today, however, that's not all he did. Trump also imposed additional punishing sanctions and did so in a way that would cripple the ability for any future President to lift them and return to the agreement.

We're joined today by DR. TRITA PARSI, Middle East foreign policy expert and Executive Vice President of the Quincy Institute for Responsible Statecraft. Parsi, who also co-founded the National Iranian American Council, the largest Iranian-American grassroots organization in the U.S., worked as an advisor to the Obama White House during the complicated negotiations for the 2015 deal, known as the Joint Comprehensive Plan of Action (or JCPOA). He documents those efforts in his book, Losing an Enemy: Obama, Iran, and the Triumph of Diplomacy.

Today, Parsi details Trump's sabotage of the JCPOA, and the clever trick employed by the Administration to make it far more difficult to lift the "sanctions wall" they imposed. While his Administration was a failure at just about everything else, Parsi quips, "I don't think anyone actually has accused them of being bad at destruction. At destruction they actually excelled quite well, and in almost an unprecedented and unparalleled way."

During the conversation, he goes on to explains the clear --- if difficult --- road back toward restoration of the accord; discusses the week's encouraging news out of Vienna; outlines the urgency of the talks just two months before new elections are held in Iran; and offers insight on the price the U.S. may now have to pay in order to win back the trust of the Iranians after the U.S. violated the hard-won terms of the agreement.

"To put it into context," Parsi tells me, "the Iranians just signed a 25-year agreement with the Chinese. The Iranians probably do not care at all who comes in and replaces [Chinese President] Xi, they don't care who is the head of the Communist Party, because they have confidence that the Chinese are going to keep their word. Whereas on our end, unfortunately, we couldn't keep an agreement for two years, even one that we were the lead negotiator of."

In some related-ish news which broke during our conversation with Parsi, the Biden Administration announced plans to restore some $325 million in U.S. humanitarian assistance to Palestinians which had been terminated by the Trump Administration.

Finally, we close today with an update on the landmark unionization vote at the Amazon warehouse in Bessemer, Alabama, at what would be the first such facility in the U.S. for the retail giant where workers win collective bargaining rights. Voting in the mail-in election ended about a week and a half ago. So what's the delay in learning the results? I explain the complicated process the federal National Labor Relations Board must carry out in tallying the secret ballots from the company's 5,800 warehouse workers in Bessemer. Long story short: We may be hearing news of the results fairly soon...

We've got another sorry tale on today's BradCast of yet another federal "watchdog" agency clearly captured by the industry corporations that it is supposed to be overseeing and/or regulating. This time, democracy itself is at stake. [Audio link to full show is posted below this summary.]

But first up today, we had quite a bit of breaking news just before airtime. For a start, the U.S. Capitol was locked down on Friday after two Capitol Police officers were rammed in a violent attack with a vehicle. One of the officers, an 18-year veteran, was killed. The other was said to be "fighting for his life" as of airtime. After ramming the officer, the assailant is said to have "lunged" at officers with a knife and was subsequently shot and killed. The assault was the most serious threat on the Capitol since the Donald Trump-incited insurrection on January 6th, which killed five, including one U.S. Capitol Police officer. Two more officers took their lives in the ensuing days after that attack by Trump supporters attempting to stop Congressional ratification of Joe Biden's 2020 Electoral College victory.

That attack --- and Trump's evidence-free Big Lie about his loss being the result of "fraud" --- continues to reverberate almost three months since the MAGA Mob's assault on U.S. democracy. Last week, Georgia's Republican-dominated state legislature adopted a massive voter suppression bill that will make it more difficult to vote by, among other things, requiring additional forms of ID for mail voting, limiting absentee ballot drop-boxes and early voting hours, and banning the distribution of food or beverages to voters forced to wait hours on line. It would also allow partisan GOP officials to undermine County Boards of Election and even overturn results. The state's Governor, Brian Kemp (R), signed the sweeping bill almost immediately after it passed both chambers of the state legislature in a matter of hours.

This week, after some 70 Black corporate executives spoke out against the transparent attempt to making voting more difficult for minorities in the state, a cascade of other corporate entities --- including Delta Airlines and Coca-Cola, both based in Atlanta --- finally decided to speak out in favor of democracy and against voter suppression. And then, on Friday, shortly before today's show, Major League Baseball announced they will be moving the All-Star Game and MLB Draft, previously set for July in Atlanta, to another state in response to the GOP attack on voting.

And, as Georgia Republicans pushed back on Delta Airlines this week for belatedly standing up for the right to vote, Gov. Kemp took his shot at the company by accusing its CEO of "false attacks" by claiming misleadingly in a statement: "The last time I flew Delta I had to show my ID."

But Kemp, the state's former Sec. of State, certainly knows that flying is a privilege, where voting is a right. He also likely knows that, no, an ID is not required to fly on Delta or any other airline. As clearly explained on the TSA.gov website...

In the meantime, as to real --- versus imagined or opportunistic and partisan --- threats of fraud in our elections, the U.S. Election Assistance Commission (EAC), the federal agency tasked with overseeing voting system security standards, is continuing the woeful job it has done since its creation by the Help America Vote Act of 2002. Since its inception, as we have documented at The BRAD BLOG for almost 20 years, the EAC has largely been captured by the private voting system vendors whose systems they are supposed to be testing, overseeing, regulating and certifying as meeting minimal standards.

For years, the EAC has consistently helped mislead the public regarding the dangers of modems inside of computer voting and tabulation systems. The EAC's original Voluntary Voting System Guidelines (VVSG), created about 15 years ago, allowed for use of the devices which cybersecurity experts have long warned can be used to introduce malware into systems that could disrupt elections or change results.

In August of 2019, as we detailed on the program at the time with cybsersecurity journalist Kim Zetter, a group of security and voting systems experts discovered "nearly three dozen backend election systems in 10 states connected to the internet over the last year, including some in critical swing states" such as Wisconsin, Michigan and Florida. In January of 2020, almost six months after Zetter's exclusive and disturbing report, Cynthia McFadden followed up with her own report at NBC News, in which, despite federal officials repeatedly and falsely declaring that "U.S. voting systems are never connected to the Internet," the President of the nation's largest vendor, Elections Systems and Software, Inc. (ES&S), conceded that at least 14,000 of the company's modems were being used in vulnerable voting and tabulation systems across the country, even as the 2020 election cycle was getting under way.

Nonetheless, over the last five years, the EAC has been working with stakeholders --- from elections officials to cybersecurity experts to vendors --- to develop new minimum security standards for the nation's voting systems, which they call VVSG 2.0. The good news is that the draft of those final standards for the VVSG 2.0, made available for public comment last Summer, included a ban on modems and other wireless communications devices in computerized voting and tabulation systems.

The bad news: After the public comment period and before the new standards were officially adopted by the EAC Commissioners, they apparently met in secret with several vendors and quietly changed the new standards to once again allow for modems and other wireless communications devices in new voting systems.

After the standards changed and weakened without public notice, the non-partisan government watchdog, Free Speech for People (FSFP), filed public records requests for documentation of the non-public meetings between EAC officials and the voting machine companies. Despite acknowledging hundreds of pages of existing documents responsive to the request, according to our guest today, the EAC failed to turn over any of it to the group. Now, FSFP is suing the EAC for those documents.

We're joined today by longtime election integrity advocate SUSAN GREENHALGH, Senior Advisor on Election Security at FSFP, to explain the organization's lawsuit [PDF], and the latest, extraordinary failure to protect our elections by the corporate-captured EAC.

"We have a real lack of leadership from the federal agency that's supposed to be helping assist election officials run election more efficiently, securely, accessibly and transparently at the EAC," Greenhalgh explains, charging "they're letting the vendors help weaken the standards directly."

"The EAC is way, way too deferential to the vendors," she says. "They need to either do the right thing and do their job, or they need get out of the lane and come up with some other way. Because there's an expectation by members of Congress that this is being taken care of, that the EAC is doing their job, they're developing the standards, they're testing voting systems. Unless you scratch the surface and find out what's really going on, you might think on the outside that they're doing their job, and they're not. They're taking up that space, and that makes us all less safe and secure in our elections."

There is, as you might guess, much more that Greenhalgh has to explain about this ongoing mess and FSFP's legal efforts to crack open the EAC blockade.

On today's BradCast: While U.S. flags were already at half-staff following last week's mass killings in Atlanta, another mass shooting erupted on Monday in Boulder, Colorado. On Tuesday, President Biden called for the flags to remain lowered, for the U.S. Senate to pass two bills already approved by the U.S. House to close loopholes in our federal background check system; and to restore the ban on assault weapons that helped keep down such mass casualty events before the George W. Bush Administration allowed it to expire. [Audio link to show follows summary below.]

"We can ban assault weapons and high-capacity magazines in this country once again. I got that done when I was a Senator. It passed. It was law for the longest time, and it brought down these mass killings. We should do it again," the President urged in his brief remarks at the White House. "This is not and should not be a partisan issue; this is an American issue. It will save lives --- American lives --- and we have to act."

Today, we cover some of the reaction following the latest mass shooting in the U.S., which took 10 lives at a supermarket in Boulder yesterday. We honor the heroes that include not only the police who responded --- one of whom, who had seven children, was killed during the shooting --- but also the grocery store workers who courageously helped to save customer lives in the store and, as their union has noted, have been risking their lives for all of us every day over the past year, as essential workers during the pandemic.

We also note the reactions from those who have spent years working to support the ability of terrorists to easily acquire weapons of mass destruction --- such as CO's Republican Rep. Lauren Boebert and the Colorado State Shooters Association --- who suddenly feel that this is no time to talk about guns. "Congressman" Boebert, who appears with guns in virtually appearance, says she "refuses" to use this shooting "to advance a political agenda." And the Shooters Association informs us that "Today is not a day to cloud our remembrance with ... emotional sensationalism."

All of that, after a state judge, just 10 days ago, struck down a law adopted unanimously by the Boulder City Council in 2018 to ban assault weapons in the city, after years of similar massacres in the Centennial State and elsewhere. The Colorado State Shooters Association was one of the plaintiffs in that case, which was "celebrated" just last week by the disgraced, terrorist-supporting NRA, because local laws supported by residents in the CO town were preempted by Big Government at the state and federal level.

But, despite urging from the President on Tuesday, if Republicans won't even agree to allow an up or down vote on background checks, the lowest hanging fruit when it comes to gun safety reforms, it seems impossible to imagine they would ever agree to restoring the federal assault weapons ban. That, no matter how many American lives it might save, no matter how many of their own constituents continue to be massacred in these tragic events.

In response to GOP intransigence, conservative, institutionalist Democrats in the U.S. Senate late last week and over the weekend, continued to inch toward support for filibuster reform --- the only way that gun safety reform and most of the rest of the Democrats' ambitious, progressive agenda will ever be adopted. So there's a small amount of encouraging news on another dark day.

Also today, some response from listeners to our interview with Alabama's former Democratic Governor, Don Siegelman on yesterday's BradCast and his response --- as someone who knows a thing or two about GOP hit jobs on popular Democratic Governors --- to the attempted recall of California's progressive Governor, Gavin Newsom.

Unlike Microsoft Windows, says our guest on today's BradCast in response to Bill Gates' new book on climate change, "if the global climate system crashes, you can't reboot it." Of course, what does a billionaire software engineer know about how to save our climate anyway? Well, our guest --- an actual Nobel Prize-winning climate scientist --- has a few thoughts on that as well. [Audio link to full show is posted below summary.]

First up, however, a few quick, breaking news items as usual...

• The U.S. House has decided to adjourn for the week a day early after Capitol security officials warned of what they described as credible threats by rightwing extremists surrounding what QAnon dupes cite as the "true Inauguration Day" on March 4th (the day originally set by the Constitution). While the House may be scramming, the Senate will supposedly stay in session, as Capitol Police have "enhanced their security posture" and National Guard troops remain posted at the Capitol.

• Before leaving, however, it appears that the House Oversight Committee has renewed its subpoena for tax and other financial records from Donald Trump's accounting firm, Mazars USA. The disgraced former President had successfully stalled the Committee's original effort, beginning in 2019, blocking the documents from being given to the panel for 22 months until the subpoena expired at the end of the legislative session last year. Committee Chair Rep. Carolyn Maloney (D-NY), however, is not giving up in her effort to obtain the documents. In a court filing, she described the subpoena and need for Trump's financial records as "just as compelling now as it was when the Committee first issued its subpoena" as "the committee's investigations into presidential conflicts of interest, presidential contracts with the federal government and self-dealing, and presidential emoluments” continue.

• And President Biden offered some thoughts on what he described as a "big mistake" and "neanderthal thinking" by the Republicans Governors of Texas and Mississippi. On Tuesday, they both lifted statewide mask mandates and declared all businesses may now open to 100% capacity. That clever if wildly dangerous distraction comes while tens of thousands of residents in both states are still without running or clean water following a winter storm more than two weeks ago, and as both states rank in the top ten for COVID deaths per capita.

Then, with Trump out of the White House and Dems in control of both chambers of Congress, it seems a very good time to renew the previously forestalled federal efforts to take action on our critical climate crisis. Private industry has figured out the urgent need. This week, Volvo announced they would move to an all-electric car line by 2030 and, in just four years, by 2025, would produce only electric or hybrids. And the American people seems to have figured it out as well. By a whopping 79% to 20%, they now favor the development of renewable energy over the continued production of fossil fuels.

So, it's time to finally restart the debate about how best to move forward again to save our climate by decarbonizing our economy. We're joined today by award-winning climate scientist DR. MICHAEL E. MANN, Distinguished Professor and Director of the Earth System Science Center at Pennsylvania State University, author of nearly 200 peer-reviewed papers and loads of books, including his latest, The New Climate War: The Fight to Take Back Our Planet.

Last week, Mann penned an op-ed for Newsweek, detailing two very different potential paths forward. One, he describes as a "technocratic" path which "envisions climate action as a mere engineering problem" to be solved with massive --- if dangerous --- geoengineering schemes, as detailed in software mogul Bill Gates' new book, How to Avoid a Climate Disaster: The Solutions We Have and the Breakthroughs We Need. The other, which Mann favors, is the "sociopolitical" path relying on safe, clean, already-existing technologies.

"It can be a bit frustrating," he tells us. "To the extent that Bill Gates might use his platform to create more public awareness for the climate crisis, that's great. The thing that troubles me is that his prescription is wrong-headed, in my view. It's overly technocratic. It's like if your only tool is a hammer, everything looks like a nail.  If you built your reputation, if your role in society has been to promote computer technology, technological or technocratic solutions to problems, everything looks like a technocratic problem."

"The problem is climate change isn't a technocratic problem," Mann argues. "We have the solutions --- wind, solar, geothermal. [Gates] downplays those solutions, based on what I would say is an unbalanced assessment of the literature and what researchers have found. He downplays the potential for renewable energy to meet our needs and help us decarbonize our economy. By downplaying the obvious solution, it leads him to promote far riskier strategies --- like geoengineering, massively interfering with the Earth's system in some other way to try to offset global warming. What could possibly go wrong?"

"This problem at this point is a political problem, it's not a technological problem. We have the solution. The problem is that we don't yet have the representation in our government," asserts Mann, noting that Gates "actually said, 'Well, I don't know what the solution is to the politics here.' If you don't know the solution to the politics, then you don't know the solution to the problem, because that's what it is at this point. It's a political problem."

Our conversation is enlightening, encouraging, and, yes, maddening at times. We discuss, for example, one of Gates' "solutions" to the climate crisis: more nuclear energy. But even a number of esteemed climate scientists argue that we can't decarbonize without relying on nukes. Mann disagrees and explains why.

He cites peer-reviewed literature from energy experts who "all come to the conclusion that we can meet 80% of projected energy demand by 2035 from renewables, and 100% by 2050...based on existing technology," adding, "That's without nuclear."

As usual, there is much more in our in-depth conversation with Mann than I can cover here, but that is well worth tuning in for. Mann himself, in his Newsweek piece, notes that both he and Gates are optimistic about the future, and that he hopes to find places where their two different paths toward the same ultimate goal may converge. "Whether we have a crisis is no longer a matter of worthy debate. Precisely how we solve it is."

And, yes, we welcome a response from Gates. Happy to have him on the show, with or without Mann there to debate him as he sees fit. Though we do hope that our good-spirited snark today about Windows crashing won't keep Microsoft's former CEO from dropping by...

Bonifaz is also the co-author of the 2018 book The Constitution Demands It: The Case for the Impeachment of Donald Trump. In a wide-ranging discussion, Bonifaz delves into various paths towards accountability for the 45th President and the Republicans who supported and promoted the deadly January 6th insurrection as well as critical actions and crucial reforms to our electoral system that must be implemented to protect and defend our democratic system going forward.

Our BradCast special coverage continues today, as House Impeachment Managers completed their opening argument in Donald Trump's second Senate Impeachment trial, closing out a damning case for the charge of "Incitement of Insurrection" and pre-butting the arguments expected from the former President's defense team. [Audio link for today's full show is posted below the summary.]

But first up today, in not-at-all-unrelated news, Reuters is reporting a nascent effort by unhappy Republicans --- many of whom served in the Administrations of Reagan, Bush Sr., Bush Jr. and even Trump --- to begin building a third national party to help break away from the Trump-captured GOP. They claim the new party would reflect "principled conservatism" and could be called the "Integrity Party" or "Center Right Party". Or the effort, discussed on a Zoom call late last week by some 120 Republicans disenchanted by their party's hard-right, nativist turn, could fizzle all together. We discuss.

Then, following Wednesday's emotionally gripping first day of opening arguments in the Impeachment Trial, in which Democratic House Managers presented a tightly-knit, point-by-point, media-rich case detailing Trump's incitement of the murderous January 6th attack on the U.S. Capitol, Republican Senators were reportedly moved by some of the harrowing, never-before-seen-or-heard audio and video shared during the presentation. Nonetheless, even after seeing hard, persuasive evidence of Trump's long-planned attempt to steal the election after all of his non-violent schemes had fizzled, Washington Post reports that most of the GOP Senate jurists were still likely to vote against conviction. That, even as some of the Senators were visibly shaken by the dramatic presentation of the MAGA mob's violent ransacking of the Capitol with Trump's encouragement and their hopes of assassinating Vice President Mike Pence, House Speaker Nancy Pelosi, or any of the other lawmakers who came frighteningly close to being overrun by the insurrectionists.

Foolishly, it seems, the cowardly Republican Senators who are still in thrall to Trump and in fear of his supporters don't seem to understand that this Impeachment Trial is affording them an opportunity to neutralize the only real superpower that Trump now has left: his control over them and the Party itself, thanks to his ability to run again in 2024 --- where he is currently the easy front-runner for the GOP nomination. End the possibility of him ever becoming President again and his one remaining superpower will almost certainly dissipate in surprisingly short order, as I explain today.

Nonetheless, the Impeachment case picked up on Thursday, with House Managers underscoring Trump's personal role in inciting the violence and his complete failure to take any action at all to stop it after it had begun, leaving lawmakers "for dead", as compellingly detailed yesterday. Even now, the Managers noted, Trump has failed to take any personal responsibility for the riot or even concede that he lost the 2020 election. That "Big Lie", as the Managers explained, continues to threaten national security; has cost the federal government nearly half a billion dollars for protection of the Capitol; has resulted in adversaries in China, Russia and Iran dismissing America's promise of Constitutional democracy; and has made a joke of Republican claims to support either the rule of law or law enforcement itself. (One Capitol Police officer was killed in the January 6 assault, two more killed themselves in the days that followed, and hundreds were seen being attacked by MAGA mobsters on video, describing them as "traitors" before more than 100 were seriously injured that day.)

Today we share excerpts from presentations made by Impeachment Managers Jamie Raskin (MD); Diana DeGette (CO); Ted Lieu (CA); Joaquin Castro (TX); and Joe Neguse (CO).

Each warned in different ways that if the Senate fails to convict and then bar Trump from holding future office, the chances are very good that he --- or a future President --- will repeat his deadly, authoritarian tactics. The most chilling moment of the day, however, may have belonged to Lieu, who noted that the disgraced former President "will undoubtedly cause future harm if allowed, because he still refuses to account for his high, grave crime against our government."

"I'm not afraid of Donald Trump running again in four years," Lieu warned. "I'm afraid he's gonna run again and lose...because he can do this again."

Their case concluded, essentially, with the reminder that if an insurrection directed by the President of the United States against the U.S. Government itself is not impeachable, then nothing is. The Managers also pre-butted the expected arguments from Trump's attorneys, noting that the First Amendment free speech clause does not protect incitement of violence. And, since Trump declined their invitation to answer himself under oath, the Managers asked his lawyers to explain why Trump took no action at all as Commander-in-Chief to stop the murderous attack once it began and if they even agree that a President inciting an insurrection against the U.S. Government amounts to an impeachable offense.

Trump's attorneys will present their own case beginning on Friday...

On today's BradCast: On the same day that news broke that Fulton County (Atlanta), Georgia's newly elected prosecutor has opened a criminal investigation into Donald Trump's apparent attempt to steal the 2020 Presidential election in her state, the U.S. House Impeachment Managers began their not-unrelated and rather damning opening argument against the disgraced former President in his historic second U.S. Senate Impeachment Trial. And though it was not necessarily surprising, it was still stunning to see that Fox "News" didn't even bother to carry some of the most disturbing and chilling testimony and video presented on Wednesday. [Audio link to show follows below summary.]

Our special, seat-of-our-pants coverage continues today, as Democrats from the House laid out what certainly came across as a compelling, seemingly air-tight, point-by-point case against Trump. They detailed, through his own repeated tweets and media statements, all the way back to last Summer, how he cultivated and prepared his supporters for his false claim that, if he lost the election, it could only be due to massive election fraud.

While the Article of Impeachment itself, for "Incitement of Insurrection" at the U.S. Capitol on January 6th, focuses largely on that day's deadly attack by his MAGA Mob, Trump had laid the groundwork for the assault for months. The House Managers offered a meticulous presentation of tweets and media statements from the then-President, detailing how he used his various platforms to gin up false outrage about a "stolen election", both before and after the election itself. That, despite a lack of evidence to support his claims and his carefully orchestrated attack on the last day possible to prevent the final certification of Joe Biden's decisive Electoral College victory.

Lead Impeachment Manager Jamie Raskin (MD), describing Trump as "the Inciter-in-Chief," charged that his scheme was "the greatest betrayal of the Presidential Oath in the history of the United States." The entire team of Managers spelled out exactly how Trump "praised, supported and cultivated" the eventual violence that resulted in five deaths that day, including a Capitol Police officer, two officer suicides in the days that followed, and well over 100 serious injuries to police attempting to protect the Capitol and the hundreds of lawmakers inside.

"For months," Rep. Eric Swalwell (CA) explained during his presentation, "Trump assembled the logs and the kindling" to convince his supporters that the election would be rigged, "so if he lost, his supporters would be ready to light the match."  And they were --- especially after Trump "doused the flames with kerosene" once he lost the election and eventually ran out of non-violent option to overturn it.

Unfolding, appropriately enough, like a violent crime prosecution, the Managers detailed how Trump ignored more than 60 court challenges he lost (several of which were at the hands of federal judges he himself had appointed); pressured and threatened election officials in several states to change results in his favor; attacked Senators and members of the House for failing to take action on his behalf; pressured the Dept. of Justice to bring fraudulent fraud cases; and even used his platforms to repeatedly attack his own Vice President Mike Pence for refusing to try and steal the election for him.

By the time his supporters were primed to storm the Capitol on January 6, as previously unseen video and federal charging documents reveal, many in Trump's mob were focused on the assassinations of Pence and House Speaker Nancy Pelosi, among others. Chilling surveillance footage of fleeing lawmakers and courageous, quick-thinking law enforcement officials also reveals how close the insurrectionist mob actually came to being able to do so. It's miraculous that there weren't even more deaths.

Underscoring the entire case, however, is the fact that none of it --- none of the violence, none of the death --- would have occurred, had not Trump incited it and then failed to stop it. All of it. On purpose. Unapologetically, even now.

We're joined today for insight on today's historic proceedings and how Trump's defense team can possibly respond to it, by LISA GRAVES of True North Research. With her experience as a former Deputy Asst. Attorney General at the U.S. Justice Dept., a former Chief Counsel in the U.S. Senate, and a former Deputy Chief for the U.S. Court system, she brings a broad and helpful perspective to all of this.

Among the points discussed today, in addition to her general opinion of the case to date by the House Managers: How this Impeachment Trial differs both from Trump's first one and Bill Clinton's; Whether she would like to see witnesses called during this trial and, if so, who?; How much of this matter should be seen as "Kabuki Theater" given the general belief (true or not) that there are unlikely to be 17 Republican Senators willing to vote for conviction, as needed; Whether this Impeachment Trial helps or hurts the odds of criminal charges being brought against Trump in the future for this matter; And what she might expect from Trump's defense attorneys in response.

"I think it's vital that, under our Constitution, these proceedings take place even if there are members of that body who do not have the courage -- the moral courage --- or the devotion to our Constitution to do the right thing, based on the evidence that's been presented so far, to convict Donald Trump," Graves tells me. "I think there should be accountability for members based on how they vote in this trial. And people should be held to account for whether they are willing to speak up against this unprecedented assault on our democracy, on our legislative branch of government, on the rule of law, and on the very notion of how you determine elections are valid, which is the certification process that every single state engaged in."

"So, I think it's an important thing historically," she argues. "It's important for our Constitution. It's important for the people, regardless of the outcome."

On today's BradCast Special Coverage: There have only been three Presidents during the 243-year history of the United States who have been Impeached, for a total of four Presidential impeachments. Donald Trump has been impeached twice. He alone makes up a full half of all of the Presidential Impeachments in the history of our nation. That will be a scar and mark of shame that will never be removed from his pathetic legacy, no matter what happens in his historic second Impeachment Trial in the US Senate, which began in earnest today....sort of. [Audio link to show follows below summary.]

Democratic House Impeachment Managers on Tuesday were forced to make the case for the Constitutionality of holding an Impeachment Trial for a President who is already out of office. Frankly, it's a ridiculous case to have to make, as we discussed on yesterday's show and again today. Of course an impeached, former official can be tried by the U.S. Senate after leaving office. It's been done several times in our nation's history, and legal scholars from both the Right and Left have argued as much in recent days in response to the disingenuous case made against it by Trump's defense attorneys and his sycophantic Republican supporters in the Senate.

Nonetheless, lead Impeachment Manager Rep. Jaime Raskin (MD) opened the argument on this point on Tuesday, with a compelling narrative that there is no "January Exception" to the Constitution's impeachment clause. If there was, he argued, Presidents leaving office would have impunity to cause any amount of mayhem during their final weeks in office. Raskin's presentation began with a stunning, riveting and chilling video juxtaposing Trump's January 6th rally comments to his supporters at the White House, instructing them to "fight like hell" before directing them to the U.S. Capitol, along with previously unseen video clips of his supporters subsequent attack on the U.S. Capitol on January 6th. The montage showed Congress being interrupted by the violent insurrectionists, with lawmakers sent scurrying for their lives during the Joint Session to certify the 2020 Electoral College results from last November's Presidential Election victory by Joe Biden...

Raskin's presentation was followed with ones from Managers Joe Neguse (CO) and David Cicilline (RI) who offered historical, Constitutional and legal background in support of their case, before Raskin returned to close the argument with a heartbreaking personal tale of his --- and his family's --- experience during the January 6th attack at the Capitol. We share extended excerpts from his presentation and video.

Next, Trump's team of defense attorneys offered their own case, beginning with a rambling, disjointed, confusing, often political case by lead defense attorney Bruce Castor (famous for having refused to charge Bill Cosby while a prosecutor in Pennsylvania), before an angry, confusing, and even-more-political and partisan case was made by attorney David Schoen (who had previously represented convicted felon and Trump pal Roger Stone, and was set to defend convicted sex trafficker Jeffrey Epstein before he committed suicide in prison.)

Castor made no case at all about the Constitutionality of the proceedings, and even appeared to threaten at least one Republican Senator before arguing that a trial to determine if Trump should be allowed to hold future office was not necessary, since "smart" voters had already done a very good job of voting Trump out of office by themselves. (Begging the question of whether Castor will be allowed by Trump to return tomorrow!) Schoen eventually seemed to make a case against the Constitutionality of the trial, but his argument was so quickly read, and included so many arcane Constitutional and historical references, it was virtually impossible to follow or make sense of.

No worries, however. His case --- any case at all, apparently --- was good enough to win the votes of 44 Republicans Senators when the resolution to dismiss the trial was ultimately defeated at the end of the day by a 56-44 vote. All Democrats and six Republicans (Collins, Cassidy, Murkowski, Romney, Sasse and Toomey) voted to allow the trial to proceed. Opening arguments for the actual substance of the article of impeachment for "Incitement of Insurrection" begin on Wednesday.

Finally, in our closing few minutes today, we switch gears (mostly) for a quick report on two disturbing, and somewhat related developments. The first story regards an apparent hacker or intruder who was able to use remote access software several days ago, to dangerously increase sodium hydroxide (sometimes known as lye) levels at a water treatment plant in Oldsmar, Florida, near Tampa. Luckily the incident was noticed --- live, as it was happening --- by an alert operator at the plant who saw the manipulation on his monitor before drinking water was actually poisoned.

And, in somewhat related news, we learned over the weekend that top officials at the U.S. Election Assistance Commission (EAC) --- the federal agency responsible for certifying computer voting and tabulation systems --- quietly changed a provision in new security standards for voting systems to allow wireless modems and chips in such systems. The change comes after years of work on the new draft standards by cybersecurity and voting systems experts who strongly urged against allowing remote access hardware, which can be used to hack election results, in such systems.

Whether they are used to manipulate results or not obviously makes no difference to those who are concerned that results might have been changed by hackers, as today's Impeachment Trial should, once again, underscore.

We hope to have more information in the future on this, but the newly modified standards --- known as the Voluntary Voting System Guidelines (VVSG) --- are now much more friendly to private voting system vendors (and hackers) and are set to be approved by the Commission tomorrow (Wednesday). The EAC has long been captured by private voting system vendors, and appears to be doing their bidding once again.

The Election Integrity advocates at Free Speech for People have set up a petition that they are asking voters to sign in hopes of encouraging EAC leadership to return to the safer, modem-free standards before they are officially adopted and used by many states across the country...

We keep trying to move on from Trump on The BradCast. But his crimes, his criminal supporters, the growing terrorist menace they pose, not to mention the billion dollar lawsuits that keep coming in against the suckers who fell for and/or promoted his phony, sore loser "stolen election" conspiracy theories, are not making any of it easy. This is gonna take a while.

First up today, in advance of Trump's second Impeachment Trial next week, the Democratic House Impeachment Managers today invited the disgraced former President to give testimony under oath. The man who has never turned down the chance to be the center of the attention, turned down the offer. His lawyers call the invite "a political stunt". But, of course, since Trump can't help but lie, it's probably very wise that he has decided to not get himself into even more legal trouble than he is already facing.

At the same time on Thursday, Smartmatic, a small voting machine company that Team Trump attorneys Sidney Powell and Rudy Giuliani falsely claimed to be interchangeable with their competitor Dominion Voting Systems, and somehow behind theft of the 2020 Presidential election, pushed back hard. The company which, in the U.S., does business in only one county (Los Angeles, where they received a contract to build it's new voting systems used for the first time last year), sued Fox "News", three of its hosts (Lou Dobbs, Maria Bartiromo and Jeanine Pirro) for $2.7 billion. The suit also names Giuliani and Powell as defendants. They were each, separately, similarly sued for $1.3 billion each by Dominion recently.

Smartmatic's voting systems played no role in any of the battleground states where Team Trump has baselessly claimed the election was stolen from him. Their 285-page lawsuit [PDF] filed today, however, like those filed to date by Dominion (more are likely to be coming soon) against Giuliani and Powell, charge defamation and ensuing loss of business, after Fox, its hosts and Trump's attorneys all repeatedly made false claims based on their re-imagined reporting by The BRAD BLOG. My 2010 investigative exclusive regarding Dominion and a company they purchased which was once owned by Smartmatic, was accurate. Team Trump and the MAGA Mob Media's bastardization of that reporting was used to spin their own phony, evidence-free story of a massive, worldwide election theft conspiracy --- as we explain yet again today.

Next, in the wake of the January 6 MAGA Mob assault at the U.S. Capitol --- the incitement for which is the basis of Trump's second impeachment --- almost two hundreds perps have been rounded up so far and charged in the deadly attack. Members of a number of far-right extremist and/or racist organizations like The Oath Keepers and Proud Boys have been arrested and indicted on conspiracy charges, and Dept. of Justice officials are said to be mulling the use of RICO statues to cast an even wider net with conspiracy laws initially enacted to help bring mafia kingpins to justice.

The violent insurrection in January, however, was completely predictable. In early December on this program, we were joined by a longtime researcher of terrorism, insurgency and political violence who warned that Trump was setting the stage for coming insurgencies not unlike like the one we all witnessed at the Capitol on January 6. He warned at the time that Trump was "encouraging his supporters to engage in insurgency-like tactics and behaviors," that there are "real-world consequences to this," and that those listening to Trump and his media organs like Fox "News" and even farther rightwing media outlets were "living in an alternate universe", and "going to act on it."

We're joined once again today by that expert, COLIN P. CLARKE, a Senior Research Fellow at The Soufan Center and author of a number of books on international terrorism, to discuss his recent New York Times op-ed warning that, while "the storming of the Capitol on Jan. 6 by a rabid mob of Donald Trump supporters resulted in a failed insurrection...for far-right extremists, including anti-government militias, white supremacists and violent conspiracy theorists, nothing about the insurrection was a failure."

"Not only was it not a failure, at least viewed on the part of the insurrectionists," he tells me today, "but it was entirely predictable. Everything Trump was doing, including his violent rhetoric, was laying the groundwork for this type of political violence."

"It was obvious to any extremism researcher that knows what they're talking about that this was the logical conclusion of where things were headed. The President was stoking the flames. His enablers in the GOP were providing that passive support necessary. And he unleashed a mob, essentially, against his own government," Clarke explains.

But the even more unsettling part is that Clarke, who has studied insurgencies across the globe going back decades, believes that attack has now set the stage for the recruitment of even farther Right extremists and for still more violent events in the near future.

We discuss how both law enforcement officials and lawmakers need to grapple with the emerging threats posed by "a new era" of domestic terrorism; if our current laws are adequate to safeguard against further attacks; and the justifiable concerns that Americans should have regarding the possibility that new measures enacted to combat domestic terrorism, along with those enacted after 9/11 to guard against foreign terrorism, might inappropriately be used against perceived political adversaries of those in power.

"We need to be on guard over the mistakes that we've made in the past. We need to be transparent about what the strategy is going forward....At the same time, some of the lessons we've learned from  the last twenty years fighting jihadists just don't pertain," Clarke says. "For the better part of the past two decades, we've been focused on fighting groups and organizations overseas. Now we're concerned with individuals and movements on US soil. Quite a bit of difference there. Americans have different rights under the law --- including First and Second Amendment --- than we would be talking about if we were analyzing an ISIS network operating in Syria. So there's a lot of care to take as we figure out what to do next."

On an encouraging note, however, he explains that he has "been heartened [by] seeing that the Biden Administration understands the sense of urgency. It's tapped some of the most capable people in this country to lead the charge." He says he expects their work to be "empirically driven" based "on the data", which is "something we didn't see under the last administration, when we had President Trump talking about 'I'm going to designate Antifa as a terrorist group.'"

Now that Trump is safely out of office, as my guest on today's BradCast argues, Congress needs to "get back in the game" to reform the National Emergencies Act now, so it cannot be so easily abused by yet another President. [Audio link to full show is posted below.]

But, first up today, we pick up on a study we cited on yesterday's show finding that, in 16 developed countries examined over the past 50 years --- from the U.S. to Australia --- tax cuts have had no effect whatsoever on either jobs or Gross Domestic Product. The only thing they have done, however, is make the rich richer and increase economic inequality in countries that institute them.

In that vein, a new piece from the New York Times David Leonhardt reports on economic data finding that the U.S. economy has done better by every measure --- from jobs to GDP to incomes and even stock prices --- under Democratic Presidents than Republicans for the past 90 years. Going all the way back to FDR, the economy has grown at an average annual rate of 4.6 percent under Democrats and just 2.4 percent under Republicans. That means, as Leonhardt notes, that "The average income of Americans would be more than double its current level if the economy had somehow grown at the Democratic rate for all of the past nine decades." But why is that? We discuss. (HINT: It has to do with Dems heeding economic and historic lessons, such as using government resources to invest in flagging economies during recessions, versus the GOP's only apparent economic strategy for both good times and bad --- tax cuts!)

But, with Joe Biden now safely in office and Democrats finally in control of both Houses of Congress, things are, surprisingly enough, working out very well for a change...for now...after just two weeks. Years of Post Traumatic Democrat Syndrome, however, has left us waiting for that to change for the worse at any moment. Nonetheless, before that happens, what other lessons can be learned from the previous, disastrous Administration?

We're joined today by ELIZABETH GOITEIN, co-director of the Liberty and National Security Program at NYU's Brennan Center for Justice. Back in 2018, with a report at the Brennan Center and a disturbing landmark article for The Atlantic on "The Alarming Scope of the President's Emergency Powers", Goitein scared the hell out of a lot of us, when she warned of the dangers of the National Emergencies Act and the extraordinary powers it affords to the White House. The Act --- ironically enough, enacted by Congress, in theory, to rein in Presidential emergency powers --- "unlocks powers contained in more than 100 different provisions of law," as she recently discusses again at Politico.  However, "Since the law’s enactment in 1976, presidents have declared 69 national emergencies; 39 remain in effect today," she explains.

One of those "emergencies," a phony one, was Trump's declaration at the border with Mexico, used to steal money appropriated to the U.S. Military in order to build his wall, after Congress expressly voted against it. Another one might have been a national emergency declaration that we now know --- thanks to some stunning reporting by Axios yesterday --- that Team Trump loons Sidney Powell, Rudy Giuliani and Mike Flynn were encouraging him to declare during an absolutely bonkers (and frightening!) White House meeting in December. They were hoping he'd invoke the act in order to impound Dominion Voting Systems machines and somehow use them to steal the election from Biden.

Goitein argues that after the last four years offered a very clear demonstration of how Presidents can abuse these emergencies powers, now is the time to reform the "under a president who seems more inclined to rescind bogus emergency declarations than issue them." On today's show, she explains how that can responsibly be done by Congress.

"I think there is an understanding that this administration is our chance --- and it's a chance that we must seize - to shore up the guardrails on our democracy. Emergency Powers has been part of that conversation, and I hope and trust that it will continue to be," she tells me. "Many of those laws absolutely need to be revisited and reformed to be made more narrow. There's absolutely no reason why, in a national emergency, the President should be able to take over radio stations. And the fact that by merely declaring a threat of war, the President could potentially even take over the Internet in this country is horrifying."

At the same time, however, new Senate Majority Leader Chuck Schumer is now calling on President Biden to invoke an emergency declaration to take action on our worsening climate crisis, which, as Schumer argues, would allow him to do "many, many things under the emergency powers of the President...that he could do without legislation," in order to get around Republican denialism and intransigence in Congress. Is that a good idea? Is it justifiable? Is it even possible under the National Emergencies Act, reformed or otherwise? Goitein recently responded to some of those questions at WaPo. We discuss them with her today, along with her revelations about some of her worst fears that Trump might have carried out under the existing powers.

Finally, it seems that the loony wingnut MyPillow CEO, Mike Lindell, is having trouble selling both pillows right now and his evidence-free claims that Dominion voting machines were used to steal the election from Trump. We share an hilarious clip of Lindell trying --- and failing miserably --- to make his case, even on the far-right NewsmaxTV, after the voting machine company has issued very serious legal warnings to both Newsmax and Lindell that they intend to sue for defamation if they continue to libel the company. After $1.3 billion lawsuits filed against both Powell [PDF] and Giuliani [PDF], Newsmax appears to be taking that threat very seriously. Lindell? Not so much!...

Some pretty huge news on today's BradCast, for the American economy and for the continuing prospects for human civilization. So, yeah, pretty huge news. [Audio link to show is posted below summary.]

Among the stories covered on today's program...

• General Motors announced on Thursday that it will end the production of all gasoline and diesel powered cars and SUVs by 2035. The announcement signals a potential sea change (both figuratively and literally) in American automobile production --- and not a moment too soon;

• That news comes on the heels of President Biden's ambitious climate action agenda announced on Wednesday, which includes plans to replace the entire federal fleet of about half a million cars with electric vehicles, fueling about a million new jobs in the industry, and a rapid move away from dangerous, dirty, expensive fossil fuels towards cheaper, cleaner renewable energy. He also called for a carbon emissions-free national power grid by 2035 and full carbon neutrality by 2050. Naturally, fossil fuel-captured Republican officials and Fox "News" dupes are freaking out about the bad news for their industry funders (even if it's great news for their constituents!);

• The potential boost to jobs and the economy comes not a moment too soon, as federal government numbers released on Thursday reveal that 2020 saw the biggest collapse of the American economy since World War II. The numbers also signal the end of the longest economic expansion in U.S. history (11 years! Thanks, Obama!) and that the average annual GDP growth under President Obama far outpaced that of supposed business genius Donald Trump. Just like the last Republican President before him, Trump inherited a booming economy from a Democratic President and subsequently tanked it for the next Democratic President to have to clean up after him;

• That next Democrat, President Biden, continued his Executive Order flurry on Thursday by rolling back Trump's efforts to prevent Americans from receiving healthcare coverage. Biden re-opened the Healthcare.gov exchange to allow millions of Americans who lost their jobs during the pandemic to obtain affordable health insurance, which Trump refused to do. (Did I mention we are still in the middle of the worst healthcare crisis in 100 years? Made even worse by the failures of the former President?);

• Despite all of that --- a new Democratic President working to create millions of new, good paying jobs and provide healthcare and vaccines to all --- there are still a whole bunch of brain-poisoned MAGA wingnuts so misinformed that they are plotting to kill Democratic officials and overthrow the American government. One such brain-poisoned MAGA wingnut, freshman Rep. Marjorie Taylor Greene (R-GA), was recently discovered to have supported calls for Nancy Pelosi and Hillary Clinton to be killed, and to have stalked and harassed a survivor of the Marjory Stoneman Douglas High School massacre just weeks after the 2018 shooting in Parkland, Florida. She described him as a coward. Now, a Democratic Congressmember is calling for Greene to be expelled from the U.S. House;

• Finally, Desi Doyen heroically --- in just six minutes! --- summarizes Biden's massive, landmark plan for climate action, as unveiled at the White House on Wednesday, in our latest Green News Report...

And here I thought dealing with one President in a single hour on The BradCast was tough. Now we've got the previous one on trial after his second impeachment and a new one unveiling an ambitious new agenda to begin cleaning up the other guy's horrific mess, particularly on climate today...and not a moment too soon! [Audio link to full show is posted below summary.]

First up today, the Department of Homeland Security issues a new warning about ongoing threats of violence by domestic, home-grown terrorists in the U.S., many of whom have been radicalized by Donald Trump's many lies about the 2020 election having been stolen.

Then, It's been only three weeks since Trump encouraged his MAGA Mob to march down Pennsylvania Avenue and "fight like hell" to prevent the formal counting of Electoral College votes by the U.S. Congress. The attempted insurrectionists violently broke into the U.S. Capitol, called for the hanging of the Vice President, succeeded in shutting down the tally for several hours and sent lawmakers fleeing for their lives into secured locations. Five people were killed, including a Capitol Police officer, in the ensuing violence. One week later, then President Trump was impeached by the U.S. House for a second time, this time for "Incitement of Insurrection", though the Senate's then Majority Leader Mitch McConnell refused to convene a trial. One week after that, Joe Biden was successfully sworn in as President. And today, just three weeks to the day since the Trump-incited mob's murderous attack on the Capitol, with Democrats now officially in the Senate majority, Trump's second Impeachment Trial has officially begun.

While the arguments in the trial will not be presented in full for another two weeks, Republican Senator and pretend Constitutionalist Rand Paul forced a vote on Tuesday, just after Senators were sworn in as "impartial jurors", to try and dismiss the entire matter by falsely claiming that an Impeachment trial after a President is out of office is "unconstitutional". (Though he repeatedly argued that "private citizens" cannot be impeached and that "If the accused is no longer President - where is the constitutional power to impeach him?")

Joining us today to answer to the clearly false and almost-certainly disingenuous argument proffered by Paul --- and, incredibly, supported by 45 of the Senate's 50 Republicans who voted in favor of his resolution on Tuesday --  is Constitutional law expert RON FEIN of the non-partisan government accountability group Free Speech for People. Fein, with John Bonifaz and Ben Clements, authored the 2018 book, The Constitution Demands It: The Case for the Impeachment of Donald Trump. 

"The obvious flaw," in Paul's argument, Fein explains, is that Trump WAS impeached while he was President, and then McConnell stalled the process of the Senate trial by refusing to allow it to be held until Trump was already out of office." But on the broader issue, as he tells us, impeachment trials may absolutely be held after an official is out of office. "Congress has done it before and explicitly considered that exact question."

"If their argument was allowed to go forth, then what it would say is that any President can do whatever they want in the last couple of weeks of their term, because by the time they would get impeached, and by the time the Senate could convene for a trial, they'd be out of office already," he persuasively argues. "Disqualification from future office is an important remedy and penalty for impeachment. It is important to have that hanging over the head of a President even in their last couple of weeks in office."

We also discuss whether the votes of 45 GOP Senators --- including McConnell, who just last week conceded that Trump "provoked" the riot at the Capitol --- to dismiss the trial, signals that it will be impossible to win over the 17 Republicans needed to win the two-thirds vote necessary for a conviction; whether a vote can be held to prevent Trump from holding future office even without conviction; whether a second failure to win a conviction in a second impeachment would redound to Trump's benefit; and whether a resolution to censure the disgraced former President would serve as any kind of deterrent for similar behavior in the future (by Trump or other future Presidents), in the event that he is not convicted once again.

Fein also rings in with his thoughts in response to the GOP's stolen and packed U.S. Supreme Court which, on Monday, dismissed two cases regarding Trump's alleged violation of the Constitution's Emoluments Clause as "moot" since he is no longer in office and why it took so long for the cases to even reach the high court. We also discuss whether Fein believes that Trump actually did pardon himself, but is keeping that pardon a secret, somehow, until he's actually charged with a federal crime.

Finally, in far less maddening news, it was "Climate Day" in Joe Biden's new White House on Wednesday! And the new President unveiled an historically ambitious climate agenda that will, among many other things, if successful, result in carbon emissions-free power, nationally, by 2035. Declaring that "we can't wait any longer" to address our worsening climate crisis, Biden detailed his new Executive Orders and Directives to "supercharge" the United States' efforts to combat global warming by pausing new oil and gas leases on federal lands, ending fossil fuel industry subsidies, and creating millions of new jobs in the electric car market and renewable energy industry, and by capping and closing old, unused mines and wells across the nation. His new Climate Envoy, former Sec. of State John Kerry and new White House National Climate Advisor, former EPA Administrator Gina McCarthy, also responded to media questions (naturally framed by rightwing talking points) during a White House briefing. We share some of their remarks, and the entirety of Biden's historic announcement during today's very busy BradCast...
