On today's BradCast, it was (another) very bad day for Donald Trump, but a good day for Hillary Clinton, if anybody was able to notice, thanks to another shameful weekend by the mainstream corporate media. [Audio link to show follows below.]

Our stable genius President didn't make it any easier on himself by beginning his day with a grotesquely offensively comparison of his ongoing Constitutional impeachment inquiry to "a lynching". But it got far worse for Trump (if nowhere near as bad as an actual lynching), when his top diplomat in Ukraine, Bill Taylor, testified before impeachment investigators in the U.S. House. The veteran diplomat and foreign policy elder statesman spelled out, in no uncertain terms --- based on copious, contemporaneous notes --- that Trump had personally tied the release of nearly $400 million in military assistance for Ukraine to a quid pro quo requirement that Ukraine's President publicly commit to investigating Trump's 2020 political rival Joe Biden.

The testimony, according to House impeachment investigators, directly contradicts Trump, numerous top White House officials, and a number of Trump-appointees who offered earlier testimony. It also included a 15-page opening statement from Taylor, accurately described as "damning" by a number of Democrats.

Then, while you may or may not have heard about the news which was buried deep inside weekend papers on Saturday, the State Department --- Trump's OWN State Department --- concluded its years-long probe of emails sent to and from Hillary Clinton's private email server. The report, sent to Congress with little or no fanfare from either the media or the Trump Administration, found "no persuasive evidence of systemic, deliberate mishandling of classified information" by Clinton or anybody else in the Department.

The faux "scandal" that Trump, his campaign and his party disingenuously used to help propel him to office in 2016 has officially ended with a barely imperceptible whimper. That, even as top White House officials from daughter Ivanka Trump to son-in-law Jared Kushner to Steve Bannon to Stephen Miller to Executive Agency heads like Education Secretary Betsy DeVos have all since been found to have carried out government business on private email servers and have even reportedly shared classified information on private texting apps.

We're joined today by longtime media analyst ERIC BOEHLERT to discuss not only the phony "BUT HER EMAILS!" scandal that Trump falsely described during his campaign as "worse than Watergate" --- and which even today results in "Lock her up!" chants at his unhinged campaign rallies --- but the corporate mainstream media's dreadful failure and stunning "whitewash" of its own role in colluding with the Trump Campaign by constantly over-hyping the baseless charges in the run up to the fateful 2016 Presidential election.

"The email story does not exist without the Beltway press," Boehlert tells me, noting their coverage of the end of State Department's probe on page 16 (NYT) and 6 (WaPo) on Saturday. "Most of the network newscasts never even reported on the story over the weekend.

"This email story ran from March 2015 to November 2016," he rails. "This story rolled for months and months. If you take one peek, in September 2015, on average, if you look at the Washington Post --- print and online --- they were publishing two Clinton email stories every day for the month of September 2015. We forget how bad it was. Pick your adjective. Mind-boggling. Numbing. Irresponsible. Reckless. And what's important [is] to not let this happen again."

But, of course, it will, especially given the lack of contrition for this failure evidenced by the story's coverage this weekend. "These are smart people," he says. "They play dumb on an epic scale." Boehlert aptly compares the media's failure in becoming "hugely investigated in this story from the get to" to their similarly reckless coverage of the Bush Administration's claim that Iraq had WMD in the run-up to our disastrous war there beginning in 2003. He also goes on to offer warnings about the Administration's schemes to use the very same playbook in 2020.

"If you're concerned that we're going to have a repeat because the press not only refuses to learn any lessons from 2016, but doesn't even admit there are any lessons to be learned --- look at Joe Biden and the Ukraine. It's happening again. Not as bad as the other, because Trump has inadvertently impeached himself by publicly confessing to colluding with a foreign power. But we saw it in the beginning of this story, a lot of headlines, "Trump and Biden both tainted by Ukraine'. No, they're not. Let's not do that," he pleads.

We discuss why this seems to happen over and over (remember how the media fell for the John Kerry "Swiftboat scandal" in the 2004 campaign?) when it comes to the media's coverage of Democrats, what the media should have done both in 2016 and today, and what Americans can do to help avoid being taken for another predictable ride in 2020.

A spate of GOP pol scams, indictments and inappropriate pardons from D.C. to GA to MI and beyond; Also: Are Congress and corporate media finally waking up to our woefully insecure, non-overseeable elections?...

It's hardly breaking news at this point, but the GOP and its politicians now represent little more than a complete culture of corruption from top (Donald Trump) to bottom (find a state, pick an elected Republican). Among the tiny sampling of new stories covered on today's BradCast which bear that out. [Audio link to full show is posted below]...

  • The EPA's Office of Inspector General finds that disgraced former EPA chief Scott Pruitt owes tax-payers at least $124,000 for improper first-class flights and fancy hotels from during just 10 months of his reign before he was ultimately forced to resign. That, among nearly $1 million misappropriated for unnecessary, improperly approved security personnel and staff travel. The agency says it has no intention of asking Pruitt, who is now working for coal companies, to repay the money, of course;
  • But, since a fish rots from the head down, it's only appropriate to note that Donald Trump, on Wednesday evening, pardoned his billionaire pal and business partner, Conrad Black, who spent three years in jail on fraud and obstruction of justice charges after bilking millions from investors in his media company. But, he then said nice things about Trump in 2015 and has since written a book that fawns over the President titled Donald J. Trump: A President Like No Other. So, he's now officially pardoned by the President! Trump also pardoned Patrick Nolan, a former GOP leader of the California state assembly yesterday. Nolan was convicted on federal racketeering charges, but he recently criticized the Mueller investigation on behalf of the American Conservative Union, where he now works, so he gets a pardon too!;
  • The Republican Culture of Corruption hardly ends in D.C., however. On Tuesday, Georgia's newly elected Insurance Commissioner Jim Beck was indicted on 38 felony counts of mail fraud, wire fraud, and money laundering. Before reportedly being elected on Georgia's 100 percent unverifiable voting systems last November, Beck allegedly used a fraudulent scheme to embezzle money from a state-run insurance association he ran through several private companies he ran and then to the Georgia Christian Coalition. He has refused to resign but, on Thursday, the state's new (and similarly corrupt) Republican Governor Brian Kemp "suspended" him, whatever that means, while Beck fights the 38-count federal indictment;
  • In Michigan on Wednesday, state Rep. Larry Inman was indicted on charges of attempted extortion, soliciting a bribe and lying to the FBI. (Trump better have plenty of ink in his pardon pen!) According to text messages included in the indictment, the GOP super-genius texted a union rep for contributions in exchange for his and his colleagues votes against a measure that would repeal a law requiring union wages, along with the text message: "We never had this discussion";
  • But, of course, there are dirty Dems as well. But Republicans are so corrupt these days, they are even letting THEM off the hook...for some odd reason. A high-profile law firm in Boston was found by Federal Elections Commission staff investigators to have unlawfully reimbursed its attorneys for campaign contributions to Democrats to the tune of more than a million dollars in donations. The FEC lawyers recommended a further investigation to the FEC Commissioners, but they voted 2 to 2 on party lines to end the case without any further probe. You'll be shocked to learn the 2 Republicans on the Commission voted AGAINST the further probe, while the Democrat and Independent appointees both voted in favor of it. FEC Chair Commissioner Ellen Weintraub, the lone Democratic appointee, told the Boston Globe: "In every case, it doesn't matter whether Democrats or Republicans are subject of the complaint, the Democrats want to enforce the law and the Republicans don't. It's an ideological opposition to enforcing the law." That sounds about right. It's a Republican Culture of Corruption;
  • Next, a bit of a follow-up to our interview yesterday with 30-year Leon County, Florida Election Supervisor Ion Sancho, after news broke this week that the election systems of two Florida counties were said to have been penetrated by Russian Intelligence prior to the 2016 Presidential election, according to the FBI. The Bureau is currently forbidding state officials, and now members of Congress, from informing the public about which counties those are and if, in fact, there are more of them. Florida's U.S. House delegation is hopping mad about it all, as was Sancho yesterday. It should also be noted here that Florida's Republican Sen. Marco Rubio was told about much of this last year, as a member of the Senate Intelligence Committee, but said nothing even as his fellow Senator from Florida, Democrat Bill Nelson, also then an Intel Committee member, was excoriated before last year's election for noting publicly that Russia had penetrated the Sunshine State's electoral system. He was right. But Rubio said nothing as Nelson was portrayed as an insane old conspiracist. In the bargain, Nelson ended up narrowly losing (according to FL's unverified results) to Rick Scott, the state's then Republican Governor;
  • All of this mess, at least, has resulted in at least a few Republican and Democratic officials suddenly becoming alarmed about the dangers posed by vulnerable computerized voter registration and tabulation systems that cannot be overseen by the public to assure they have not been manipulated by hackers and have reported election results as per the voters' intent. George W. Bush's former cybersecurity czar Richard Clarke appeared on yesterday's Last Word with Lawrence O'Donnell to make that case, and to warn about the dangers of electoral manipulation from foreign sources that awaits in 2020. We share a clip and note that it's not only foreign sources such as Russia we must be concerned about. But, hey, after more than 15 years of our yelling and screaming about exactly these issues, at least a few elected officials and folks in the corporate media are finally beginning to notice. A little. Whether they have any clue regarding what to do about it is a separate matter all together. So, we'll keep shouting;

But before we can get to either of those races, the federal indictment of North Carolina Republican Party Chairman Robin Hayes, a longtime state power-broker and former GOP Congressman, was unsealed this week. The criminal charges against Hayes include counts of fraud, bribery, campaign finance violations and lying to the FBI. And another Republican Congressman from the state and member of House GOP leadership, Rep. Mark Walker (NC-06), is also finding himself entangles in the criminal scandal and named in the indictment as "Public Official A";

On today's BradCast, climate change slams Trump Country (again), several 2020 Democratic candidates call for structural change to our electoral system, some elected jerk in Missouri wants government to mandate everyone purchase an AR-15, and we continue to help you make sense of it all --- or, at least, try to make sense of it for ourselves. [Audio link to full show is posted at bottom of summary.]

Donald Trump responded to catastrophic record flooding in Nebraska, Missouri, Iowa and several other states by sending his Vice President Mike Pence to check it out today. In just Nebraska, damage to the agriculture industry alone is expected to near $1 billion. Had the President himself gone, he might have seen, first hand, yet again, how climate disruption has begun to wreak devastating and costly havoc on virtually every area of the U.S. at this point.

He might also have seen how two military bases --- one of them the headquarters for Strategic Command, which oversees our nation's nuclear arsenal --- have been devastated by floodwaters, despite recent upgrades after a "one thousand year flood" back in 2015 and devastating tornadoes in 2017. The flood walls built after 2015 have failed, as have dozens of levees in state after state as the waters of the Missouri and Mississippi Rivers continue to rise several feet above record flood levels.

Those fossil fueled disasters are of a piece with multiple recent reports by Trump's own scientific, military and intelligence agencies warning of the catastrophic effects of climate change, including last November's National Climate Assessment, a Pentagon report on the national security threat posed by climate change in January and, just weeks later, the U.S. Intelligence Community's annual consensus World Threat Assessment. Trump responded to the November report last year by saying: "I don't believe it". In response, the White House is reportedly preparing a commission to rebut to those reports, headed up by a climate science-denying retired physics professor named William Happer, who believes more CO2 in the atmosphere is beneficial, not a menace. He also compares the "demonization" of C02 by climate scientists to Hitler's demonization of the Jews. Seriously.

In other, slightly less insane news related to moving beyond our ongoing national Presidential nightmare, two 2020 Democratic Presidential candidates this week, Sen. Elizabeth Warren at a CNN townhall in Mississippi and Mayor Pete Buttigieg in an interview with Washington Post, have called for the Electoral College to be abolished. We discuss and explain why that may or may not be such a smart idea --- whether done via a Constitutional Amendment or statutorily via the National Popular Vote Interstate Compact --- or, at least something for which Dems may want to be careful what they wish for.

Next, a Missouri state lawmaker has introduced two bills that would force every Missourian over 21 in the state to own either an AR-15 or a handgun or both. Don't worry, there will be tax credits available to help you meet the mandate. The legislators name is Rep. Andrew McDaniel (R-Deering) in case anybody feels like taking this idiot on at the polls in 2020.

And then we share a few emails from listeners who strongly disagree with our conversation on yesterday's program with Slate's Mark Joseph Stern about the benefits of Daylight Saving Time, the cold, dark, endless nights of Standard Time and how wrong everybody is that feels otherwise. Those listeners who disagree with us --- despite their very interesting emails --- are, of course, entirely wrong.

Finally, Desi Doyen joins us for the latest Green News Report, filled with one deadly fossil fuel-related climate and environmental disaster after another from just the past several days, while finishing with some much more hopeful news for the future as millions of kids around the world skipped school last Friday to march in Climate Strikes around the globe, calling for action on global warming while vowing to keep the pressure on elected officials who, so far, have failed us all...

On today's BradCast: Desi and I are back after the holidays --- and to end the shutdown! You're welcome! There's a LOT of news to catch up on as Democrats officially settle in to their new U.S. House majority with the federal government remaining partially closed thanks to Donald Trump's new demand for $5 billion in tax-payer money (not Mexico's) to fund his southern border wall. [Audio link to show follows below.]

The federal shutdown is beginning to cause very real and negative effects across the country, particularly at our national parks and monuments and, if it goes on much longer, in food assistance to the poor. Oddly enough, National Park Service rangers are still deployed to one historic site in D.C. --- the one that happens to be inside the Old Post Office building....which is now the Trump International Hotel.

Meanwhile, Trump has announced plans for a prime-time speech to the nation on Tuesday night to address his pretend "National Security crisis on our Southern Border" and is requesting airtime for it from the national TV networks. However, while Trump is standing firm on his demand for some $5 billion to fund his border wall, (and Dems are standing equally firm in not giving it to him), his very own proposed budget plan for 2019 [PDF], as given to Congress last year, requested just $1.6 billion for the wall. (Seriously, open on the PDF and click on the section for the Dept. of Homeland Security, where it details the Admin's 2019 request: "Critical investments include $1.6 billion for construction of the border wall.") That's almost exactly what the Republican-controlled U.S. Senate voted to give him last year, which Trump agreed to...before criticism from Righwing media led him to increase his demand two weeks ago.

So, it's left to me, I guess, to explain how Democrats should give Trump exactly what he asked for in that proposal last year --- as written by Office of Management and Budget chief and now Trump's Acting Chief of Staff Mick Mulvaney --- in order to solve the very real shutdown crisis.

Also, among the many other stories covered on today's show:

  • For the first time in her career as a U.S. Supreme Court Justice, Ruth Bader Ginsberg, recuperating from cancer surgery, was not present for oral argument at SCOTUS on Monday.
  • In better SCOTUS news, the Court rejected ExxonMobil's plea to save them from an investigation by the Massachusetts Attorney General into the oil giant's decades of apparent fraud regarding climate change.
  • Over the weekend, newly-minted progressive Democratic Congresswoman Alexandria Ocasio-Cortez called for restoring the 70 percent income tax rate for the lucky few earning more than $10 million a year, in order to help fund a 'Green New Deal' to save the planet. Republicans, predictably, are both freaking out and lying about her proposal.

And, finally, we open up the phone lines to callers on all of the above and much more, including what listeners hope to see Democrats take on as their top priorities in the new Congress...

Donald Trump's tweet fingers were a'twitchin', as he tried to keep up with the flow of Mueller investigation news while churning out headlines of his own. For starters, he made three key appointments/nominations:

  • Army head General Mark Milley will move over to chair the Joint Chiefs of Staff;
  • Former H.W. Bush Attorney General William Barr is up for confirmation as Trump's next A.G.;
  • Former Fox 'News' talking head Heather Nauert is up to replace Nikki Haley as UN ambassador.

I've got the whys and wherefores on those for you. Also, Trump went into rage mode at word of his former Sec. of State Rex Tillerson's very frank discussion on Thursday at a public interview with CBS news veteran Bob Schieffer. Tillerson's explanation of Trump's incomprehension of basic issues, along with his trademark lack of discipline, provoked high-minded Trump tweets calling Tillerson "dumb as a rock" and "lazy as hell".

The BBC has a good basic rundown if you're trying to catch up with the case of Chinese telecom Huawei's alleged spying. I bring you the highlights plus updated news.

Meanwhile, a Swiss paper has published a conversation with Fox's Tucker Carlson who damned the White House occupant as "incapable" of fulfilling his promises. And he went further: "I don't think he's capable of sustained focus. I don't think he understands the system. I don't think the Congress is on his side. I don't think his own agencies support him."

Then, legal expert and journalist LARA BAZELON joins me to discuss her work on restorative justice for wrongly-convicted parolees. She's covered the topic for years for Slate.com, and has now released a book called Rectify. The full version of our conversation will be posted here over the weekend. On today's BradCast: Like clockwork the righwing conspiracy theories regarding pipe bombs begin, as do the voting system failures around the country, less than two weeks before this year's crucial midterm election. [Audio link to show follows below.]

First up today, a few quick updates on the mail bombs sent to several of the many vilified political critics of Donald Trump. In addition to explosive devices sent this week to former President Obama, Hillary Clinton, Eric Holder, John Brennan, Rep. Maxine Waters, George Soros and CNN, additional similar packages were reported today to have been delivered to former Vice President Joe Biden and actor Robert DeNiro. Where Trump and the White House called for unity and an end to divisive rhetoric on Wednesday, for about 5 minutes, both Trump and WH Press Secretary Sarah Huckabee Sanders quickly renewed their vitriolic attacks on the media shortly thereafter and again on Thursday.

Also on Thursday, as investigators reportedly focus on Florida as a possible source for the packages, the rightwing quickly cranked up conspiracy theories about the explosive devices being "fake bombs" meant to discredit the President in advance of the November 6 midterms.

Meanwhile, voting is already underway for those elections, as are the lawsuits aiming to prevent voter suppression and election fraud. A federal judge on Wednesday determined that Georgia may not discard absentee ballots on the basis of "signature mismatch" as determined by partisan officials with no training in hand-writing analysis. The state's legal defense for that statute was rather amazing, as we discuss. Happily, it was thoroughly dismissed by the U.S. District Court judge.

Also, the NAACP has filed official complaints with the state regarding reports of votes flipping in at least four counties on the state's 100% unverifiable touchscreen voting systems. Votes are reportedly hopping repeatedly from Democratic gubernatorial candidate Stacey Abrams to her opponent, Republican Secretary of State Brian Kemp, who oversees and has long defended the states easily-hacked and oft-failed Diebold touchscreen systems. We explain, however, why the reported flips are not likely to be hacks, but why that also doesn't really matter.

Similar, completely predictable voting system and ballot programming failures are beginning to rear their ugly head in other states as well with early, in-person voting now underway in some 30 states. The name of the Democratic candidate for Secretary of State in Arkansas was discovered left off of the touchscreen ballots in one Arkansas county, leading to lost votes and poll closures. And in DuPage County, Illinois, a fiasco erupted this week surrounding the appearance on the ballot (or lack thereof) for a Democratic candidate for the state House of Representatives, resulting in election officials scrambling to distribute paper ballots to early voting locations where, normally, only touchscreen systems are available to voters.

We're joined today by longtime DuPage County election integrity champion and government watchdog JEAN KACZMAREK, who is now the Democratic candidate for County Clerk in DuPage. She joins us to explain what is only the latest mess in a years-long stream of computer voting and tabulation system boondoggles by the Election Commission in the heavily Republican-leaning suburban county west of Chicago, where she has now been endorsed by the local Daily Herald.

Kaczmarek also details the County's astonishing refusal to provide her with serial numbers for the replacement paper-ballot scanners scavenged from unknown sources and recently supplied to the County by its private voting system contractor to replace more than 100 of the machines (originally purchased from Diebold in 2001) after they were damaged by an astounding failure during this year's March primary. The County has told the County Clerk candidate that their refusal to provide her with the serial numbers --- so she may try and determine where the machines were previously used --- is due to a bizarre "security risk" claim.

"I'm concerned mostly because of the lack of a chain of custody. At least the old machines that are in DuPage County have been stored here, and have been maintained here. Yes, I do have issues with those machines, but we do have that," Kaczmarek tells me. "But these other machines, we have no idea where they've been, who has maintained them, how much mileage they have. And I'm concerned there might be problems on these machines, perhaps a virus."

Her concerns are not without warrant, and are similar to such replacement schemes by mystery machines in other states, such as Wisconsin and elsewhere. Earlier this year, for example, at the DefCon hacking conference in Las Vegas, attendees discovered Chinese pop tunes and other software on voting systems recently discarded by elections officials around the country. "Here we are again," she says. "We have no transparency and accountability, and we're told to trust the results."

Finally today, we're joined by Desi Doyen for our latest Green News Report, with a bunch of pretty major environment news regarding a massive hurricane striking U.S. territories in the Pacific, a record year for tropical cyclones, New York state's new lawsuit against ExxonMobil charging the company defrauded investors regarding climate change, and a landmark new carbon tax announced this week by Canadian Prime Minister Justin Trudeau...

It was a dark day on Wednesday, but there were a few rays of light that managed to shine through anyway on today's BradCast. [Audio link to show follows below.]

We'll start here with the grim news. Pipe bombs were discovered to have been sent to perceived political enemies targeted by Donald Trump, including former President Obama, Hillary Clinton, former CIA Director John Brennan, former Attorney General Eric Holder, Congresswoman Maxine Waters and CNN. The explosive devices each appear to have been sent by the same person and follow on a similar one sent to Democratic Party funder George Soros earlier this week. All the intended targets have been widely derided for months, if not years, by Trump, Fox "News" and their many Republican followers.

Thankfully, nobody was hurt. But, as discussed today, the biggest surprise may be how long it has taken for something like this to happen, given the President of the United States --- and his fellow Republicans --- targeting their opponents and the corporate media as the "enemy of the people" with increasingly vitriolic attacks as the midterms approach.

Next up: Tens of thousands of voter registrations were recently rejected by Shelby County (Memphis), Tennessee election officials, with thousands more not yet even processed, even as Early Voting began in the state last week, and the November 6th midterms are now less than two weeks away. Moreover, many of those rejected voters haven't been notified and given a chance to cure the problem, in the very Democratic-leaning, majority-minority county.

The non-partisan Tennessee Black Voter Project, which submitted some 36,000 registration applications in recent months, has threatened the County with legal action. In turn, the County's Republican-led Board of Elections has blamed the Project for turning in a "staggering" number of registrations, many allegedly with what they claim to be errors or missing information. (The group is required to turn in ALL registration forms collected, whether or not they contain either major or minor errors when filled in by prospective voters.)

We're joined today by Shelby County Democratic Party Chair COREY STRONG to explain the hurdles that voting rights advocates there are now actively attempting to overcome, and the history of voter suppression that, he explains, African-American voters in Memphis continue to face this year.

He charges that local officials are disenfranchising minority voters. "We have a history of our Election Commission in Shelby County not necessarily taking it upon themselves to really uphold the values of fair and just elections," he tells me. "If all of the issues end up affecting one side --- the Democratic, urban, poor, minority voters --- then you have to start asking questions, and somebody's got to be held accountable."

The battle on behalf of Shelby County voters comes amidst a reportedly very tight U.S. Senate race between popular Democratic former Governor Phil Bredesen and Republican Rep. Marsha Blackburn, in the contest to fill the U.S. Senate of retiring GOP Sen. Bob Corker. The strongly "blue" county (which went to Clinton by 30 points in 2016 in a state that went to Trump by 25 points) is "very pivotal to statewide elections," Strong explains. In this case, it's central to the state's Senate race as well as Democratic hopes of gaining control of the upper chamber and Republican efforts to hold on to their thin majority.

Strong also discusses concerns about problems during Early Voting, the failure and dangers of electronic pollbooks used across state, and the 100% unverifiable touchscreen voting systems that voters in Memphis are still forced to use to cast their votes at the polling place

But, as noted, we do have a few rays of encouraging news on today's show as well!

On Wednesday, a federal judge ordered an injunction on Georgia's rejection of absentee ballots from disproportionately African-American voters. The rejections are said to be based on ballot signatures that allegedly do not match ones voters' signatures on file. The court found [PDF] voters were being disenfranchised by the scheme that allowed partisan, non-handwriting expert election officials to discard ballots without allowing voters an opportunity to cure any suspected problems on their mail-in ballot envelopes. According to several voting rights groups who sued Republican Sec. of State and gubernatorial candidate Brian Kemp, today's ruling is a big victory amid Kemp's tight race for Governor against African-American Democrat Stacey Abrams.

And, in a bit more good news today, the New York Attorney General, following a three-year investigation, has filed suit against ExxonMobil for an alleged "longstanding fraudulent scheme" to defraud shareholders by publicly downplaying --- and spending millions to deny and confuse the public about --- the serious risks that climate change poses to the company's bottom line. The suit could cost the company hundreds of millions, if not more, and expose Exxon to additional litigation elsewhere. According to the complaint, while publicly claiming concern about global warming as caused by their products in recent years, the company “employed internal practices that were inconsistent with its representations, were undisclosed to investors, and exposed the company to greater risk from climate change regulation than investors were led to believe"...

  • In not unrelated news, another major coal company, one of the nation's oldest, declares bankruptcy. It's the fourth to do so in the past three years;
  • ExxonMobil gets some great publicity from Bloomberg by spending just $1 million (which they generated every two minutes in 2017) in pretending to support a carbon tax scheme (that would benefit them anyway);
  • The U.S. Supreme Court allows a lower court's voter ID ruling to stand in North Dakota, despite the fact that the rule is a change from voting laws used during the April primary and is now likely to result in the disenfranchisement of thousands of Native Americans in a state where Democratic Sen. Heidi Heitkamp faces re-election after winning by just 3,000 votes in 2012. (Here's the ridiculous effort that thousands of Native Americans without a residential address, as now required by ND law to vote, must now go through to get one registered somehow before November 6th.);
  • A state court in Missouri blocks part of their new voter ID law for being "contradictory and misleading" and "impermissibly infring[ing] on a citizen's right to vote" in the state where Democratic Sen. Claire McCaskill is in a very close re-election battle. Her opponent, Republican Attorney General Josh Hawley is defending the law and is likely to seek an appeal from a higher state court;
  • After Georgia's Republican Sec. of State Brian Kemp was found to have purged hundreds of thousands of voters from the rolls over the past several years, AP finds that some 53,000 voter registrations are currently in a suspended state due to GA's "exact match" rule, which allows election officials to block registrants whose names aren't listed identically to the way they are on found on file at either the state's Department of Driver Services or the Social Security Administration. A missing hyphen or a typo by officials entering a name into one of the databases is enough to result in a suspension which, the AP finds, is disproportionately keeping black voters off the rolls. 70% of those blocked are African-Americans, even though GA’s population is just 32% black. Kemp is currently running for Governor against Stacey Abrams who, if successful on November 6th, would become the nation's first African-American female Governor;
  • Some listener mail on a recent show regarding West Virginia's Sen. Joe Manchin, who voted in favor of Brett Kavanaugh's confirmation to the U.S. Supreme Court last weekend, as the coal state Democrat faces re-election after WV voted for Trump by 42 points in 2016;
  • And, finally, a viral musical ditty to close us out today on the "very scary time for young men," as Donald Trump appallingly described it, following the multiple credible allegations of sexual assault by now-Supreme Court Justice Kavanaugh...
