Among our stories today...

• House Speaker Kevin McCarthy has introduced a 320-page proposal [PDF] of cuts to the federal budget that he suggests Republicans must have in exchange for not blowing up the nation's economy for less than a year. The cuts being demanded in order for a vote to raise the nation's borrowing limit to pay for what we've already committed to spending and avoid a first-ever U.S. government default, include taking away food stamps from more than 4 million hungry Americans, and federal health insurance from more than 2 million poor and disabled people. He's also demanding another $130 billion dollars of cuts in social programs for Americans next year alone, though he doesn't say which programs. The White House believes it would most likely include deep cuts to "education, veterans medical care, cancer research, meals on wheels, food safety and law enforcement.” McCarthy's dead-on-arrival debt limit proposal --- if he's even able to get his own party to pass it in the House --- would also increase the deficit (which Republicans pretend to care about) by nearly $200 billion in cuts to IRS enforcement. But that will keep more money in the pockets of corporations and the wealthy, so there's that.

• Perhaps most disturbingly of all, McCarthy is calling for cuts to much of the $400 billion in climate initiatives to clean the air and fight global warming over the next decade, as adopted by Democrats in last year's Inflation Reduction Act. If I was one of McCarthy's constituents in Bakersfield, California, I'd be particularly pissed off about that, given this year's "State of the Air" report from the American Lung Association, released on the same day as McCarthy's debt ceiling bill. If I lived in Bakersfield, I might wonder why my own Congressman wants to kill me? The new report finds McCarthy's home town at the very top of two of the Lung Association's lists...but not the good ones. Bakersfield is the #1 most polluted city in the nation, as ranked by both short-term and year-round particle pollution. On the other hand, it's only the third worst in the nation when it comes to ozone pollution. Why does Kevin McCarthy want to slash climate programs and further harm his own constituents?!

• Some of these folks may be both dupes and dopes. Back in 2021, bedding impresario and 2020 election liar Mike Lindell promised to reveal iron-clad evidence that China helped steal the Presidential election from the former guy. Lindell declared he had data, from a whistleblower or something, proving that they had done so, somehow, via the Internet. He offered a $5 million challenge at a three-day "cyber symposium" in South Dakota that year to anyone who could "Prove Mike Wrong" by showing that the data packets he claimed revealed evidence of Chinese interference of the election didn't actually prove as much. Well, some guy, a Trump voter named Robert Zeidman, did exactly that, according to an arbitration panel who was called in after Lindell refused to pay up. The panel found that Zeidman proved the so-called "packet captures" included little more than jibberish and had nothing to do with the 2020 election. Now Lindell has 30 days to pay up, though he says he's going to court instead. It's all quite hilarious, in truth. But it may just be an appetizer for the $1.3 billion defamation suit [PDF] still pending against him by the Dominion Voting Systems company.

• Of course, Lindell wasn't the only one to screw himself over at that "cyber symposium" in SD. That's where Colorado's former Mesa County Clerk Tina Peters was speaking on stage when sensitive Dominion Voting System software from her own county was leaked to the public over the Internet. Peters was later charged by CO with 7 felonies and 3 misdemeanors related to her alleged scheme to sneak into the secure voting system room in her county with accomplices late at night, as they turned off the security cameras to make unlawful copies of the election tabulation software. Her trial on those state charges comes later this year, but last month Peters was found guilty of obstructing a law enforcement investigation related to one of her accomplices. Last week she was sentenced to 4 months of home detention and 120 hours of community service. The penalties she is likely to face for breaching the County's voting system software is likely to be much much worse if she's found guilty.

Today on The BradCast we talk with one of the few folks who got it right in 2022, when arguing that the data in the run-up to the midterms did not suggest a "red wave" would be coming for Republicans. Naturally, he was dismissed by the corporate media at the time. [Audio link to full show is posted below this summary.]

But first up, it's been a really really rough legal week for Fox "News", as jury selection in the $1.6 billion defamation suit they are facing from Dominion Voting Systems is supposed to begin tomorrow. We'll see if that happens. But we begin today with an explanation of why this case is so important and why Fox is now, arguably, the most dangerous institution in America (and, potentially, the world.) It's not due to their Republican politics, but due to the danger their propaganda poses to democracy itself.

Relatedly, over the weekend Fox reportedly settled with a Venezuelan businessman who sued the Republican propaganda outlet for having falsely named him on air as having participated in a scheme to steal the 2020 election from the former President. The terms of the settlement are undisclosed. But, given the evidence revealed so far in the Dominion lawsuit, it's safe to assume Fox likely paid a whole lotta money to make that other guy's suit go away.

On Tuesday in the Dominion case, Judge Eric Davis issued several pre-trial rulings, limiting what Fox could argue in court. Among them was that Fox would not be allowed to argue that the false claims they aired about the 2020 election being rigged against Trump were only made because Fox believed them to be "newsworthy" at the time. (They didn't, as evidence has already shown. They were lying about that on air.) Judge Davis was also furious to learn only this week that Fox lied to both Dominion and the court about Fox Corp. CEO Rupert Murdoch's position as an officer at Fox "News", where he apparently serves as "executive chair" but failed multiple times to report as much.

On Wednesday, Judge Davis sanctioned Fox after it became clear they had withheld evidence that should have been turned over during discovery long ago. He stated he was launching a third-party investigation of the circumstances and was concerned about "very serious" "misrepresentations to the court," later adding: "I need people to tell me the truth. And by the way, omission is a lie." All not a very good way for Fox to begin a defamation case regarding their alleged lies.

But also, there was this: A Fox Corp. shareholder has now filed a lawsuit against Rupert Murdoch, his son Lachlan, and several Fox Corp. board members, due to their "decision to chase viewers by promoting the false stolen election claims [which] has exposed the Company to public ridicule and negatively impacted the credibility of Fox News." The shareholder, Robert Schwarz, charges that "FOX knew --- from the Board on down --- that Fox News was reporting false and dangerous misinformation ... [and] ... was more concerned about short-term ratings and market share than the long-term damages of its failure to tell the truth."

For those who may remember my interview in February with Media Matters CEO Angelo Carusone, this is exactly the type of shareholder lawsuit for violation of fiduciary duty that he predicted would come in the wake of Dominion's suit. And here they come. Bloomberg Law reports more are likely on the way. "They won't be able to sustain that from a financial perspective" Carusone predicted on the show in late February, noting that the "cascading effects" from the voting machine company's lawsuit "puts control of the company in jeopardy." Good.

Then, we're joined by SIMON ROSENBERG, longtime political strategist, creator and President of NDN/New Policy Institute, and now creator and publisher of the "Hopium Chronicles" newsletter. We've got a lot too deep dive with Rosenberg about. Along with another favorite guest of ours, Tom Bonier of TargetSmart, Rosenberg led the way last year in arguing that, contrary to claims from Republicans and misleading reporting by corporate media, data clearly suggested there was unlikely to be a "red wave" in the 2022 midterms. He was right. There wasn't. But that didn't prevent folks like FiveThirtyEight's Nate Silver from accusing him at the time of relying on "hopium" in his analysis.

Now Rosenberg is gathering allies for a new project he describes as "Get to 55". As he details today, it's an effort to grow the Democratic and pro-democracy coalition to increase the Democratic President's victory margin from 51.4% in 2020 to 55% in 2024 and keep it there for a while. "It may be the only way we’re going to get the Republicans to abandon MAGA and become a more traditional center-right party," he recently wrote. Getting to 55%, he argued, "will be good for Democrats of course, but it will also be good for the country and the long-term future of the Republican Party itself."

Part of that strategy includes pulling in both disaffected Republican Never Trumpers and, especially, young voters into the Democratic coalition. What young voters pulled off last week, through a concerted effort to successfully help flip the Wisconsin Supreme Court to a liberal majority for the first time in 15 years, serves as a great object lesson in how it can be done. That remarkable effort resulted in a jaw-dropping 11-point win for the Supreme Court candidate endorsed by the Democrats and for what Republicans were describing the next day as "a five-alarm warning to Republicans about 2024."

But, while increasing turnout of young voters is one thing, will working with Never Trumpers like Bill Kristol and Liz Cheney force the Dems off of more popular, progressive policies in order to win over that 55% coalition? New revelations of lawlessness by Clarence Thomas (and his wife), literally, never seem to end, as discussed yet again on today's BradCast, on the heels of a stunning new report today detailing years of previously-unknown lawlessness by the U.S. Supreme Court Justice. [Audio link to full show is posted below this summary.]

• We have, been reporting on the scofflaw Thomases (both the corrupt far-right activist Justice and his corrupt, far-right activist wife "Ginni") for well over a decade now. Way back in January of 2011 The BRAD BLOG documented how he had "knowingly and willfully" violated the rule of law by failing to report his wife's annual salary of $120,000 per year from the far-right Heritage Foundation on his annual disclosure forms. The forms made clear that falsifying that section of the report, where he was supposed to list "Non-Investment Income" of his wife, was a violation of the law. He checked the box reading "NONE". Once he was eventually called out for it, after some 20 years of falsifying his annual disclosure forms, he quietly amended his filings. He was otherwise never held to account. (Documents supporting these allegations are available via the link above.)

• Later that same year, in June, we reported on what was described at the time as "Judicial Insider Trading", after it was discovered that Ginni had quietly opened up a non-profit 501(c)(4) organization back in 2009, in the months just after her husband had heard oral argument in the infamous Citizens United v. FEC case at the Supreme Court. After hearing the case, but prior to the release of the Court's opinion in favor of Citizens United, Ginni's activist group had received more than half a million dollars that the eventual ruling in the Citizens United case, in 2010, would allow to be used for political, election-related activities without disclosure. Ginni drew a salary from those funds as well. (As we also reported at the time, Clarence had failed to recuse himself from the case, despite having received the benefit of some $100,000 in TV ads from the Citizens United group in support of his own wildly controversial and incredibly contentious Senate confirmation back in 1991.)

• And today, some remarkable reporting at ProPublica by Joshua Kaplan, Justin Elliott and Alex Mierjeski reveals that Clarence Thomas has been the recipient of huge undisclosed gifts in the form of luxury vacations via private planes and superyachts around the world, courtesy of real estate magnate and major Republican megadonor Harlan Crow. Thomas' failure to report those trips, at least one of which would have cost at least $500,000 for just the cost of the plane and yacht alone, according to the report, is not only unethical for a member of the U.S. Supreme Court but, as experts cited in the article and elsewhere also point out, it is also unlawful.

  As Slate's legal reporter and Supreme Court expert Mark Joseph Stern tweets today about just one of the trips documented by ProPublica's stunning report, "Just to be clear here, it was a flagrant violation of federal law for Thomas to accept this wildly expensive luxury vacation without reporting it as a gift --- his conduct isn't just unseemly, it's illegal." Stern goes on to add in the same thread, "Thomas has long shown contempt for any law that applies to him."

  Yup. As we've been trying to point out, and report on, and document for years both here at The BRAD BLOG and on air. The extravagance of the gifts from Crow --- who was apparently the person who who gave $550,000 to Ginni's organization in late 2009 --- is somewhat gob-smacking, as we detail today.

  For the record, the graphic at the top of this article is a detail from a portrait by artist showing Thomas and Crow enjoying cigars at Crow's private, 105-acre lakeside resort in upstate New York where, ProPublica reports, Thomas has been a guest every summer for years, along with fellow guests from major companies and Republican think tanks who frequently file amicus briefings with the Court. The painting hangs inside of Crow's Adirondacks resort named Camp Topridge.

This one including 34 felony charges for having paid hush-money to a porn star to improve the odds of his 2016 Presidential election, along with his year's worth of cover-up checks written from the Oval Office thereafter in 2017.

Among the stories covered today making that point and related others...

• Donald Trump's "Indictment Week" in New York gets pushed back (at least) another week, though The Joker may or may not have something to say about it this weekend at the Manhattan Courthouse.

• Former news anchor, Trumpist election denier and GOP grifter Kari Lake in Arizona is still busy hoaxing what's left of her supporters into believing she won last year's Gubernatorial election against Democrat Katie Hobbs. (No, Hobbs is not a "twice-convicted racist", no matter how many times Lake repeats that sleazy, false claim.) On Wednesday, Lake saw her 2022 election fraud claims rejected [PDF] by yet another court. This time, it was Arizona's Supreme Court. While rejecting most of her claims yet again, they did kick one of her seven claims back to a lower court for re-examination. That claim has to do with the signature verification process for ballots cast during early voting. Both the lower trial court and Maricopa County Court of Appeals misinterpreted the claim, according to the Supremes. We explain the claim in question, why it needs to be reheard, and why it will almost certainly not result in the 2022 election results being overturned.

  None of that stopped Lake from misrepresenting yesterday's ruling at the high court to her supporters on social media, to whom she tweeted: "HUGE: AZ Supreme Court Rules in Favor of Kari Lake." She didn't bother to share a link to either a news story or the Court's actual order with that tweet.

  But that may be a step up from when she lost every single claim, for a second time, at the Appeals court in Maricopa last month and declared: "BREAKING: I told you we would take this case all the way to the Arizona Supreme Court...Buckle up, America!"

• Speaking of obnoxious Republican liars, Florida Governor Ron DeSantis who reportedly did win his election last year, was furious at critics of his "Don't Say Gay" law enacted earlier in the year. Opponents of the measure, such as legal journalist Mark Joseph Stern pointed out at the time that the language of the bill allowed for a ban on "Classroom instruction by school personnel or third parties on sexual orientation or gender identity" in all public school grades, not just kindergarten through third grade, as DeSantis falsely claimed at the time.

  When critics pointed out that DeSantis was wrong, he sanctimoniously charged they were being dishonest about what the bill actually said, claiming it only applied to grades K through 3. "It's why people don't trust people like you," he chastised journalists at the time, "because you peddle false narratives!"

  Well, funny thing about that. As AP reported Wednesday, the DeSantis Administration is now "moving to forbid classroom instruction on sexual orientation and gender identity in all grades." They hope to expand the ban to grades 4 to 12 based on the original legislation in the state where the Governor and GOP Presidential hopefully unironically claims "Freedom Lives Here". DeSantis appointees heading up the state Board of Education and state Education Department will be voting to make the change next month. No legislative changes will be needed to be made to the existing law. Imagine that.

• Coincidentally, the Republican state lawmaker who authored FL's "Don't Say Gay" law, pleaded guilty this week to numerous federal felonies, including wire fraud, money laundering and making false statements, after fraudulently obtaining more than $150,000 in federal COVID relief funding for two businesses of his that were defunct during the COVID pandemic. The (now former) lawmaker, Joseph Harding, now faces years in prison. He will be sentenced in July.

• The Sunshine State is hardly the only one where elected Republicans are punishing state residents with hateful and cruel legislation. Nebraska's state legislature advanced a bill today that would ban gender-affirming care for minors. The anti-LGBTQ measure has been strenuously opposed by progressive state Senators, including one, Senator Megan Hunt, who has a transgender teenage son. We share some of her remarks today. Opponents vow to filibuster every single other bill on the state Legislature's calendar, effectively shutting it down for the rest of the session, in order to block the bill. It must survive two more debates before passage and signature by Republican Gov. Jim Pillen who vowed to sign it if it reaches his desk.

Why isn't the FBI or DoJ investigating the broad, multi-state conspiracy, carried out by Trump supporters after the 2020 election, to breach sensitive voting and tabulation systems? Especially with the 2024 elections now coming into view? Disturbing new evidence of the DoJ and FBI's LACK of action on today's BradCast!

But, first up, a few quick words on the federal takeover of several failed banks late last week and into the weekend (after the Trump Administration rolled back regulations enacted after the 2008 banking crisis to help prevent such failures), and then on Biden's decision to allow a controversial new oil project on federal lands in Alaska, while otherwise ordering the federal protection millions of acres in Alaska and the Arctic from similar future drilling projects.

Next, a few quick words on former Vice President Mike Pence's weekend comments at the Gridiron Dinner in D.C., characterized by many in the corporate media as his "toughest words yet" against Trump's incitement of insurrection on January 6, 2021.

While Pence was, in fact, heroic that day in refusing to leave the Capitol while it was under siege by Trump supporters, until the Electoral College vote was officially certified, the former Veep's recent legal challenge to a Subpoena to testify before the Grand Jury in Special Counsel Jack Smith's probe of the deadly 1/6 probe is unconscionable.

Among Pence's reported comments at the no-cameras-allowed Gridiron Dinner on Saturday: "History will hold Donald Trump accountable." (No, sir. It's not history's job, it's law enforcement's! And, as a witness to a crime, it's your responsibility to help them!) Also, he repeatedly praised media and said, "I expect members of the fourth estate to continue to do their job" in covering the tragic, shameful events of that day. But, guess what? While it's the media's job to report on what happened, if witnesses don't tell law enforcement what they know, then those who should be held accountable will not be.

Then, speaking of people not being held accountable, why hasn't the FBI begun a probe of the multi-state effort, headed up by Trump's then-attorney Sidney Powell, to unlawfully and surreptitiously make copies of voting and tabulation system software in at least four states after the 2020 election? We now know that this happened in Coffee County, Georgia, Mesa County, Colorado, several townships in Michigan, and at least one county in Pennsylvania. We also have evidence that the conspirators planned to breach the election system in Nevada as well.

America's computerized election systems were officially designated as "critical federal infrastructure" during the Obama Administration. Shouldn't evidence of a multi-state conspiracy to unlawfully make copies and release that proprietary software publicly be a crime worth probing by the FBI? Especially before 2024?

SUSAN GREENHALGH, a longtime election integrity and transparency expert and Senior Advisor on Election Security at Free Speech For People thinks so. She and 14 other cybersecurity and voting system experts wrote a letter [PDF] last December to Attorney General Merrick Garland, Special Counsel Jack Smith, FBI Director Chris Wray and Cybersecurity & Infrastructure Security Agency (CISA) Director Jen Easterly, seeking a federal probe, given the overwhelming evidence of this MAGA conspiracy and the recent evidence that they are using the stolen software and knowledge gained from it for potentially nefarious means.

"The people that got the software seem to be interested in further disrupting elections," Greenhalgh tells me today. "They already tried once to disrupt an election and impact the results in 2020 and we see that this is continuing. The software that was taken unlawfully in Coffee County, Georgia, showed up at CPAC [the Conservative Political Action Conference] CPAC last week, in a presentation by a bunch of conspiracy theorists making a lot of unfounded and really disturbing false claims about elections in it."

"We can see the software already being used for disinformation campaigns," she continues, "but it could actually be used for much worse, like to reverse engineer it and create malware to impact and potentially corrupt an election."

As the Los Angeles Times reported last week, Greenhalgh has now heard back from the head of the FBI's Public Corruption and Civil Rights Section, in a polite, if terse, four-paragraph letter [PDF] that seems to not only suggest that the FBI is not investigating the matter, but to do so they would have to receive a request from local or state officials.

That doesn't make much sense. This is a federal issue, if only because it appears to be conspiracy stretching across multiple states. Moreover, as Greenhalgh explains, such requests have been made, for example, by the State Board of Elections in Georgia.

So, what is going on here? Is the matter being probed by the feds, but the FBI is suggesting otherwise (since they may not wish to comment on ongoing investigations)? Is it not being probed at all, for some reason? If so, why not? And, why does all of this matter? Greenhalgh answers those questions and many others on today's BradCast!

It's another one of those elections-have-consequences episodes of The BradCast. Happily, most of those consequences are good ones today! [Audio link to full story follows this summary.]

Among the stories covered on today's program...

• On Friday, Democratic Gov. Tim Walz signed a bill that will re-enfranchise more than 50,000 formerly incarcerated felons in Minnesota. That very good news for voting rights and democracy follows on the recent adoption of several other critical progressive measures in the state, including protecting abortion rights and mandating 100% carbon-free electricity. The new laws were all passed and since January, after Democrats won a trifecta in the state last November, winning the Governor's mansion and taking control of both chambers of the legislature for the first time in nearly a decade.

• After flipping a stunning 12 seats in the Pennsylvania statehouse in last year's midterms, Democrats in the chamber now have a majority for the first time in more than a decade and have finally seated Joanna McClinton as the state's first African-American female House Speaker. The months-long roller coaster ride toward between last year's elections and McClinton becoming Speaker includes the unexpected death of a lawmaker and three special elections since last November, the surprise election of a different Speaker earlier this year, and the thinnest possible one-seat margin for Democrats in the House. We 'splain the full crazy story.

• In Colorado, former Mesa County Clerk and aggressively gullible election fraud conspiracist, Tina Peters, has been found guilty of obstruction, after she refused a lawful warrant to turn over an iPad containing courtroom videos a judge instructed her not to take. While she could face several months in jail on that conviction, there is likely much more trouble ahead for the disgraced Republican and last year's failed GOP Sec. of State candidate. Peters faces a separate trial later this year on seven criminal felonies and three misdemeanors related to sneaking into her county's secured voting system room in the middle of the night while still serving as County Clerk, turning off the security cameras and making illicit copies of sensitive Election Management System software with two accomplices following the 2020 Presidential election. That proprietary software was subsequently leaked to the public while she was on stage at an election denier's conference in 2021. As all of this plays out, Peters --- who has become somewhat of a hero to some equally duped knuckleheads on the Right --- is hoping to become the next Chair of the Colorado Republican Party.

• As discussed on one of our programs last week, we are now waiting to hear whether the corrupted, stolen and packed U.S. Supreme Court will allow President Biden's lawful program to forgive up to $20,000 to federal student loan borrowers making less than $125,000 in annual income. In the meantime, receiving much less news coverage is the Administration's program to refund billions to students ripped off by for-profit schools which lied about their credentials, hoaxed students into enrolling and/or who have gone out of business in recent years. The program, begun during the Obama Administration, was largely put on ice by Donald Trump's Education Secretary Betsy DeVos. Following a court settlement last year against DeVos, the program has now begun refunding students, many of whom owe hundreds of thousands of dollars for their scam diplomas.

• Finally, Desi Doyen joins us for our 1,300th Green News Report! Including long overdue good news for the world's oceans; good news for solar energy in France; another train derailment in Ohio, and a legal threat to Minnesota's new law mandating 100% clean electricity by 2040...

As discussed on today's BradCast, support for labor unions in the U.S. is now near all-time highs. At the same time, the lawlessness by major companies willingly and repeatedly violating labor law is through the roof. [Audio link to full show is posted below.]

Last week, by way of just one example, a federal Administrative law judge found Starbucks had committed "egregious" violations of labor law in just one case that combined unfair labor practices charges at 21 union stores in the Buffalo, New York area alone. In fact, the National Labor Relations Board (NLRB) has brought some 75 complaints against the coffee company accusing them of more than 1,000 illegal actions over just the past year or two.

Despite a newly aggressive, pro-labor, pro-union NLRB under President Biden and an explosion of unionization efforts over the past two years at hundreds of shops and facilities owned by firms like Starbucks, Amazon, Apple, REI and Chipotle, those companies have spent tens of millions on attorneys specializing in breaking unions, according to our guest today.

DR. NELSON LICHTENSTEIN, author and longtime professor of labor history at Univ. of California, Santa Barbara, joins us today to discuss both the successes and obstacles faced by the new union movement rising in the U.S. since he was here in 2021. While the companies mentioned have long attempted to project a friendly, progressive image to the public, they have been very aggressive in attempting, frequently unlawfully, to block unionization of stores and facilities around the country. Firing workers who support unions; shutting down shops where union votes have been requested and/or have succeeded; and, where union votes have succeeded, companies have simply refused to negotiate union contracts. That "is par for the course," Lichtenstein argues.

He cites "almost fifty years of specialized anti-labor law firms" now being employed by those companies. "And it works! Why change it?," he quips. "Despite the public relations hit that it has had for Starbucks and the other companies, the managers had their meetings, they've run the numbers, they've decided they'll take a small reduction in their growth and it's worth it."

"The tremendous push-back is really a tribute to the importance of unionism," says Lichtenstein. "The official line of these companies is '[unionization is] not going to change anything!'...While they are moving heaven and earth to stop the union."

Lichtenstein describes "the most aggressively pro-labor" NLRB in decades, noting "they don't have much money and they're putting together real indictments of these companies. The problem is that the NLRB doesn't really have any disciplinary tools at its command. The penalties for breaking the law are really minuscule." And, with those small penalties, these anti-union companies have simply decided that repeatedly and "egregiously" violating the law is merely the cost of doing business.

Republicans in the last Congress blocked passage of the federal Protecting the Right to Organize (PRO) Act which would make many of these violations much more painful for company management. But, Lichtenstein explains, there are already laws on the books --- both anti-trust and RICO statutes --- that could be used by the federal government to bring anti-union companies to heal by making them feel real pain for violating the law.

We discuss all of that and much more today, including what Lichtenstein attributes to the recent rise in support for unions and unionization, and whether he is optimistic or pessimistic about the current state of labor and the new unionization movement.

Also today, Desi Doyen joins us to explain some very big news from over the weekend on protecting the planet's oceans, after the U.N. sealed a landmark deal in overtime on Saturday, following a nearly 20-year effort for the framework of the U.N. Convention on the Law of the Sea. The breakthrough agreement, as she details, will help protect about 50% of the world's "high seas" which are currently outside national boundary waters or otherwise protected only by a patchwork of regional agreements.

And finally, with the clocks mercifully changing once again to Daylight Saving Time this coming weekend, it's time for our annual call to make it permanent. Once again this year, we are backed by a bipartisan effort in both the House and Senate to do just that...

We've just about arrived at the point where the corrupt, stolen and packed rightwing U.S. Supreme Court almost isn't even trying to hide their corruption anymore. And, yes, as discussed today on The BradCast, that includes the Chief Justice. [Audio link to full show is posted below this summary.]

First up, Lori Lightfoot, the first black female and openly gay Mayor of Chicago was reportedly knocked out of contention in her reelection bid on Tuesday. It is the first time in 40 years that an incumbent Mayor was unseated. (The last one was the city's first female Mayor.) Paul Vallas and Brandon Johnson will go on to compete in the run-off set for April 4. Vallas is a "tough on crime" candidate vowing to add hundreds of police to the streets of the nation's third-largest city. He is supported by the police union, the Fraternal Order of Police, whose leader defended January 6 insurrectionists and equated Lightfoot's vaccine mandate for city workers to the Holocaust. Johnson, an African-American supported by the teachers union and progressive organizations, has called for more money to be spent not on police, but for mental health care, education, jobs and affordable housing.

Next, we're joined by DAVID DAYEN, progressive financial journalist, author and Executive Editor of The American Prospect to discuss Tuesday's oral arguments at SCOTUS on two different challenges --- both largely absurd --- to President Biden's student loan forgiveness program. But for being blocked by Republican-appointed lower court federal judges, the plan would forgive up to $20,000 for federal student loan borrowers making less than $125,000/year under the authority of the HEROES Act. The 2003 law, adopted by Congress and signed by the President in the wake of 9/11, grants authority to the Education Secretary to "waive or modify any statutory or regulatory provision" regarding student loan programs in the event of a national emergency.

Despite the legal authority granted by the clear language of the text, Republican lower court judges have blocked the program to date, and the corrupt rightwing Justices at SCOTUS seemed to be working hard to do the same during the 3-and-a-half hour hearing at the high court on Tuesday, according to Dayen. The Biden Administration, as he explains, has invoked the very same legal authority from the HEROES Act to "waive" student loan payments as the Trump Administration used to pause them during the pandemic. Of course, neither Trump's authority to do so, nor its authority to issue hundreds of billions of dollars in forgivable PPP loans to small businesses during the crisis, was challenged in court --- or saw its "fairness" questioned --- by Republican litigants. Low income student loan borrowers, however, are apparently a different matter.

There are two different sets of GOP plaintiffs challenging Biden's plan. One (Biden v. Nebraska) is a group of six Republican-controlled states (Missouri, Nebraska, Iowa, Arkansas, Kansas and South Carolina) and the other (Dept. of Education v. Brown) is two individuals who failed to qualify for student loan forgiveness. It seems that neither group of plaintiffs should have legal standing to sue at all in these cases, as neither seems to be able to demonstrate any real harm or injury. If these cases are to be tossed, it will likely be on those grounds. But, the Court's rightwingers sure did seem to want to block this program during Tuesday's hearing, citing the absurd and wholly-made-up, found-nowhere-in-the-Constitution "Major Questions Doctrine" as just one way to do so.

Dayen details the entire fiasco for us today. The Court will issue its opinion no later than June or July as hundreds of billions in financial relief for those need it most hangs in the balance.

Also discussed with Dayen today: The high court has decided to hear a case on whether the funding mechanism for the Consumer Finance Protection Bureau (CFPB) --- the brainchild of Elizabeth Warren during the Obama Administration following the 2008 financial crisis as the only federal watchdog agency focused mainly on consumers --- is unconstitutional. "If you believe it is," quips Dayen, "then you believe that not only numerous other agencies in the federal government have unconstitutional funding structures, but things like Social Security and Medicare are unconstitutional." A similar funding mechanism has been used for decades, without challenge, by the FDIC, the FDA, the Federal Reserve and many others.

Dayen describes the ruling that the CFPB's entire funding mechanism is unconstitutional as coming from the "deeply radical" 5th U.S. Circuit Court of Appeals. He seems to be hoping that SCOTUS has decided to hear this case next term (which begins in October) in order to reverse or, at least clarify, the lower court's ruling. We'll see if he's right about that.

Finally, we discuss drug-maker Eli Lilly's announcement today that the company plans to lower the cost for insulin, after President Biden and the Democrats' Inflation Reduction Act, adopted last year, capped expenses for the drug at $35/month for federally insured patients, such as those on Medicare. Also, we discuss today's announcement of the nomination of Julie Su as Biden's new Labor Secretary to replace the departing Marty Walsh. As Dayen reports, the clever appointment of Su, a California progressive, will place her in charge of the Department whether her nomination is blocked in the Senate or not...
