The Secret Koch Brothers Tapes...

By Brad Friedman on 4/10/2013 12:20pm PT

This seems to me to be a potentially larger issue --- with broader national implications --- than it's currently being regarded as in the bulk of the corporate media.

I'm prepping to interview Brendan Cummings, the lead litigator in this case, later today on my KPFK/Pacifica Radio show. [That interview is now here...] Cummings argued the case on behalf of the Center for Biological Diversity which sued the Obama Administration along with the Sierra Club.

So, for now, here's how the matter is being reported this week by Virginia Hennessey of the Monterey County Herald [emphasis added]...

MONTEREY --- Nearly 20,000 acres of prime Central Coast farm and ranch land may be protected at least temporarily from oil and gas "fracking" due to a federal judge's "watershed" ruling.

Environmentalists and local representatives cheered the decision by U.S. Magistrate Judge Paul Grewal, who said federal land managers violated a key environmental law when they auctioned off the rights to drill for oil and gas on public lands in Monterey County, home to one of the largest deposits of shale oil in the nation.

Grewal faulted the Bureau of Land Management for not reviewing the potential impacts caused by fracking before accepting bids for the drilling rights, in accordance with the National Environmental Policy Act.

The judge did not say whether the leases themselves would be invalidated, but said he would decide their fate after the parties meet and send him a proposal next week.

"This important decision recognizes that fracking poses new, unique risks to California's air, water, and wildlife that government agencies can't ignore," said Brendan Cummings, senior counsel at the Center for Biological Diversity, who argued the case for the plaintiffs. "This is a watershed moment --- the first court opinion to find a federal lease sale invalid for failing to address the monumental dangers of fracking."
...
Environmentalists worry the technique can contaminate groundwater and pollute the air, as well as trigger seismic activity in the state's most earthquake prone area.

The affected leases sold in September 2011 include scenic stretches of southern Monterey County, where cattle ranchers and wine grape growers rely on tight water supplies to irrigate their pasturelands and vineyards. The area is also part of the historic range of the endangered California condor, whose global population was recently estimated at less than 400 birds.

The lawsuit alleged the bureau relied on inadequate 2006 studies to assess the environmental risks associated with increased oil and gas development. BLM maintained the leases would not necessarily involve fracking and new reviews were not necessary until requests were filed to drill on the leased property.

And here is the actual 30-page ruling [PDF] of U.S. Magistrate Judge Paul Grewal issued earlier this week.

UPDATE 4/11/13: My interview with Brendan Cummings, senior attorney from Center for Biological Diversity who won this landmark case, is now posted here...

Rachel Maddow details how world's most profitable company pays almost nothing for continuing violations of federal law...
By Brad Friedman on 4/8/2013 2:48pm PT

It's just the cost of doing business for the world's most profitable corporation. And that "cost" is barely a blip (that may be an overstatement) on their daily profit sheet.

As Rachel Maddow noted on Friday in the short report below, ExxonMobil is the nation's largest and most profitable corporation. It is larger than Walmart, Google, McDonald's, American Express and Goldman Sachs...combined.

And yet, the penalties they pay for violating federal safety laws leading to oil spills is almost nothing at all. For example, when Exxon was caught failing to inspect a portion of the Pegasus Pipeline --- the one fill with sticky, gooey, tar sands crude that we don't know how to clean up...the pipeline that ruptured last week in a suburban neighborhood in Mayflower, AR --- they were fined a grand total of $26,000.

That's a $26,000 fine out of the $122 million dollars in profit that Exxon makes in per day.

"There is nothing that Exxon fears from the federal government," Maddow notes. "They have so captured the parts of the government that are supposed to punish them when this sort of thing happens, that the pain that that sort of punishment could cause them, redounds to them, essentially, not at all."

Yes, it pays for companies like Exxon to violate the law with impunity, so it will be left to the people of Arkansas, as Maddow explains, to make the company pay any kind of real price for their crime...if they can...

More photos of the Pegasus tar sands pipeline rupture in Mayflower, AR, taken by the EPA, are now posted here. Give 'em a look. If President Obama approves the Keystone XL pipeline, this is the type of spill that could be coming to a neighborhood near you very soon.

By Shawn Smith Peirce on 4/2/2013 6:35am PT

What do Minnesota, Wisconsin, Utah, and Arkansas all have in common? If you said "None of those teams are in the 2013 NCAA Men's Final Four," you wouldn't be wrong this year, though you also wouldn't be correct - at least within the boundaries of our topic for today.

If your answer was, "All four states have experienced massive oil spills within the last year - and three within the last two weeks," you'd be correct, unfortunately.

The latest disaster this weekend saw thousands of barrels of thick tar sands oil spewing from a ruptured Exxon Mobil pipeline into a residential neighborhood in central Arkansas. Twenty-two homes had to be evacuated, in a spill that literally saw oil running down residential streets and between houses. Take a look...

Of course, since it was a holiday weekend, smack-dab in the middle of Congress' latest two-week vacation, it was nearly impossible to find a politician of any kind with something serious to say about the latest disaster. That doesn't surprise us, since politicians of all kinds have been slipping and dancing around the issues of oil and environmental safety for far too many years now.

For all the work the Obama Administration has done on environmental issues --- like requiring much better fuel standards for cars and trucks, or clamping down on emissions --- the fact of the matter is, none of that will matter if President Obama and other politicians don't stop the Keystone XL pipeline route through Nebraska and all the way down to the Gulf of Mexico.

No matter what the decision is on the Keystone pipeline, the most important liquid flowing through Nebraska over the next hundred years won't be oil --- something a task force in the Nebraska Legislature made very clear last week...

By Brad Friedman on 3/23/2013 12:34pm PT

We desperately could use a toon or two around here of late. Sorry this is not a happier or funnier one though...

As to the extra punchline at bottom right, it's a reference to the quote misattributed to Churchill: "Americans can always be counted on to do the right thing…after they have exhausted all other possibilities."

And, by the way, a better name for "Carbon Tax" is "Pollution Tax".

Yes, companies who dump huge amounts of pollution --- tons and tons of it --- into our atmosphere every single day ought not be able to do it for free, as they do now, since we all have to pay the price of cleaning it up, as we are now doing in spades.

The BRAD BLOG's Desi Doyen discusses that and much more while guest hosting last night's 'The Young Turks'...
By Brad Friedman on 3/22/2013 2:07pm PT

If you haven't noticed, of late, Desi Doyen --- the Managing Editor of The BRAD BLOG's Green News Report and my co-host on that nationally syndicated radio feature --- has been guest hosting The Young Turks' nightly online video show quite a bit of late. (She did so several times already this week, and will be back again tonight. You can watch tonight's airing right here from 9p-11p ET / 6p - 8p PT.)

One of the segments from last night's episode, while disturbing, is worth flagging at least briefly here, as its an issue we've touched on throughout the years, going back to the earliest years of the Iraq War. It's also one that has been under-covered and under-investigated by the mainstream corporate media.

The use of depleted uranium, a byproduct of the nuclear power industry, in U.S. weaponry is believed by many to be tied to an alarming increase in birth-defects in Iraqi children, as well as cancer rates in members of the U.S. military. While some studies report no significant health risks due to the use of such weaponry, a lack of long-term studies leaves the issue, for now, an open question --- at the very least. Truthout's Mike Ludwig reported this week that "The United Nations Environment Program (UNEP) has estimated that 1,000 to 2,000 metric tons of depleted uranium was fired during the 2003 war in Iraq," and that clean-up costs for some 300 to 365 sites where "depleted uranium contamination was identified by Iraqi authorities" is estimated to cost tens of millions of dollars.

While the U.S. and British governments "disputed allegations that their weapons have poisoned soldiers and civilians and caused increased rates of cancer and birth defects," as discussed in the segment below from last night's TYT show, the reported rate of birth defects in Fallujah, for example, is now said to be 14 times higher than it was in Hiroshima and Nagasaki after the U.S. dropped atomic bombs there.

The use of depleted uranium in U.S. weapons is believed by some to be one of the reasons for that alarming statistic, as Desi discussed along with TYT regulars Ana Kasparian and Steve Oh last night. [WARNING: Some of the photos shown in the segment are graphic and disturbing]...

A couple of the other (less graphic) segments from TYT in which the lovely Desi helps with righteous rants and the raking of various muck include...

• Amazing backlog of Veteran Benefits begs question as to who actually "supports the troops"? (A particularly sharp, and personal, Desi rant in this one!) Watch it here...

• "Catfight" breaks out between current and former GOP chairs Reince Priebus and Michael Steele. Watch it here...

By Brad Friedman on 3/18/2013 1:04pm PT

These remarks at the Conservative Political Action Conference (CPAC) on Friday, in which Rep. Steve Scalise (R-LA) ridiculed the President because he "wants to keep pushing this green energy", helps place the 3-term Representative into the running, perhaps even the lead, for the absolute dumbest sitting GOP Congressman --- though we realize that's a very crowded field...

At CPAC today, Rep. Steve Scalise (R-LA) argued that climate change is a myth and doesn’t need to be addressed, noting that President Obama was cold during the inauguration.

"He talked about global warming at his inauguration, I found it ironic that the President was wearing a trench coat it was so cold but he’s talking about global warming," Scalise said.

He also noted that a snow storm later cancelled a congressional hearing on climate change, "you can’t make this stuff up."

Of course, climate change is actually leading to more incidences of blizzards and winter still tends to be cold.

See RightWingWatch for the actual video of Scalise's unbelievably stupid and misinformed remarks. To echo him, "you can't make this stuff up."
