On today's BradCast: With midterm primaries in Ohio and Indiana yesterday kicking off a month of about a dozen such primaries across the country, and more to come in subsequent months, America is voting again. So, naturally, America's voting systems are failing voters again. [Audio link to full show is posted below this summary.]

In Ohio, in at least three different counties (Lucas, Cuyahoga and Williams) reports of misprogrammed systems prevented voters from casting their votes or forced them to return later in the day to do so. Electronic pollbooks used as part of computer touchscreen Ballot Marking Devices (BMDs) appear to be the culprit this time. Again. In this case, at least in Lucas (Toledo) and Cuyahoga (Cleveland) it appears the e-pollbook vendor misprogrammed them to print out barcodes on ballot cards that subsequently brought up the ballot for the wrong party when voters put those ballot cards into the BMDs to try and cast their votes. Republicans received Democratic ballots and vice versa.

The widespread failure was reportedly corrected eventually, by about 2pm. In some cases, poll workers were able to manually punch in codes to bring up the correct party ballots and precincts onto the BMD systems for voters. In other cases, voters were given printed ballots that they could fill in by hand (begging the question as to why all voters weren't simply given reliable, verifiable hand-marked paper ballots to use in the first place to avoid these ongoing electoral nightmares!) Either way, problems like these do little to foster confidence in our electoral system, particularly on BMD systems which are already 100% unverifiable after elections, making it impossible to know if votes cast via such systems actually reflect the intent of any voter.

Luckily, confidence in our voting systems hasn't been a big concern in the U.S. of late, right?

As to actual reported results of voting on Tuesday, we cover, among other things, the Democratic U.S. House race watched closed by some on the progressive left between Rep. Shontel Brown and Bernie Sanders-ally Nina Turner in the state's 11th Congressional District (which happens to touch both Lucas and Cuyahoga Counties, where voting systems failed). The contest was a re-run of last Summer's special election to fill the House seat vacated by Rep. Marcia Fudge after she was tapped to serve as Joe Biden's HUD Secretary. Turner lost once again on Tuesday, reportedly by a much wider margin this time, before suggesting in her fiery concession speech that she may be planning an independent run for President in 2024.

All of the U.S. House races in Ohio were run on a new map found by the state Supreme Court to violate the state's constitution, requiring districts that reflect the state's partisan balance after a 2018 ballot iniative for fairer maps won 70% of the vote. Ohio's Presidential contest in 2020 was about 53 to 45% in Trump's favor. Nonetheless, the new maps created by the GOP-majority Redistricting Commission in the Buckeye State will likely result in a 13 to 2 --- or maybe 12 to 3 --- advantage in favor of Republicans in Ohio's U.S. House delegation, as redistricting expert Dave Daley told me via email today. The unconstitutional map is being used in 2022 as the court challenge continues. Perhaps they'll get fair U.S. House maps by 2024. Or not.

On the Republican side of Tuesday's primaries, all of Trump's endorsed candidates --- no matter how crazy, no matter how many times they've been accused of domestic violence or sexual harassment --- won yesterday in both Ohio and Indiana. In Ohio, that even included author and former never-Trumper J.D. Vance in his bid for the GOP U.S. Senate nomination. Vance, back in 2016, said he couldn't "stomach Trump" and found him "noxious". But he changed his tune when he decided to run for the open Senate seat being vacated by retiring Republican Sen. Rob Portman. Now, Vance says, Trump's "a great President, certainly the best President of my lifetime." That was enough, apparently, to win Trump's endorsement, which appears to have catapulted Vance from third place, just a few weeks ago, to a reported win on Tuesday night. He'll be running in November against Democratic nominee Rep. Tim Ryan.

While all of this is great for Trump's considerable ego, it remains to be seen whether having a bunch of far-right, radical loons and alleged abusers who insist the election was stolen from Trump in 2020 (despite any evidence to support the claim) will be good or bad for the GOP this November. It should be a big year for them, but there are still a whole lot of X Factors that could affect so-called Conventional Wisdom on this.

Next, the voters challenging the eligibility of North Carolina insurrectionist Rep. Madison Cawthorn to run for reelection had their day in federal appeals court on Tuesday, after a Trump-appointed lower court judge tossed their Constitutional challenge to Cawthorn's eligibility under the "Insurrectionist Disqualification Clause" of the 14th Amendment. The Q&A between Cawthorn's defense attorney and one of the judge's on the appeals panel was...um...kinda mind-blowing.

As Constitutional law expert John Bonifaz of Free Speech for People, the group representing the voter challengers, summarized on Twitter yesterday: "'Let's say you want to run for office at 12 years old, or something like that,' Judge James Wynn said. 'The state can't do anything? You've got to wait until Congress says they can't run?' Cawthorn's counsel: Yes, the state has no role + must allow that 12 year old on the ballot." Even that snippet doesn't do this hearing justice. We break the whole thing down for ya today.

Then, as we try to get caught up on a bunch of stuff that's been buried by larger stories (in Ukraine, at the Supreme Court) this week, a new memoir by Trump's last Defense Secretary, Mark Esper, claims that Trump wondered why the military couldn't just shoot Black Lives Matter protesters in the street.

Finally, Desi Doyen joins us for our latest Green News Report, as unprecedented heat in South Asia is now "testing the limits of human survivability" and much more, including even some good news on Denmark going all-electric...

We had a very lively call-in show today on The BradCast, as we stacked the deck with folks who disagree with me, in response to my calling out those, particularly on the (supposed) Left, for forwarding Kremlin propaganda (including at on our own flagship station, KPFK, here in Los Angeles), over our public airwaves, amid Russia's deadly and grotesque war and war crimes against Ukraine. [Audio link to full show is posted below this summary.]

Before we get to that and to a bunch of callers on that topic...The midterm primary season gets under way in earnest this week --- with Ohio and Indiana voters holding Election Day tomorrow. So, we've got a few quick words on that, and on the gerrymandered U.S. House District map that Republicans have managed to keep in play this year, even though it was found --- four times to date! --- to be in violation of the Ohio state Constitution by its state Supreme Court. But, as we discussed in detail last week, the GOP's packed federal courts allowed the even more gerrymandered map drawn after 2010 to be used once again in this year's election, as Ohio's GOP-majority Redistricting Commission purposely ran out the clock on drawing new legal maps following the 2020 Census.

Then, it's on to our main topic: Namely, Russia's ongoing military invasion of its sovereign neighbor and the propaganda help Vladimir Putin is getting from some on the far-Left in this country who are lying and/or misinformed about it all. Hopefully, via at least some of the calls from listeners today, we straighten out at least some of what happens to be Kremlin propaganda and what is not.

It remains unclear some on the Left --- who claim to be anti-war (like us), who were critical of the U.S. when we were the empire invading a sovereign nation (as we were) --- are now having such a difficult time condemning Russia for doing the very same thing. Our anti-war position has been both accurate and consistent. As you'll hear on today's program, at least a few of our listeners seem to have a problem with that sort of consistency, choosing to blame the U.S. for Russia's war.

Today's lively conversation also comes as new polling from WaPo/ABC finds huge, bipartisan majorities of Americans support Joe Biden's actions in Ukraine, including his vow to keep American troops out of the conflict, sanctions against Russia; and sending defensive weaponry, humanitarian and economic aid to Ukraine. Despite that, in the very same poll, only a minority of Americans say they support Joe Biden's actions in Ukraine! Ya know, the same ones they previously said in the very same poll that they supported. Seriously. So, what's going on here? We open the phones to callers to try and help us understand that puzzle as well today.

Among the lively calls, several who try to forward more Russia propaganda on Ukraine (it didn't go well), and one who seemed disappointed, oddly enough, that the U.S. was trying to stay out of the direct conflict in hopes of avoiding a nuclear World War III.

As midterm primary elections begin in earnest next month, today on The BradCast, we catch up with the latest successful attempts by GOP states to undermine their constituents' wishes through new, partisan gerrymanders following the 2020 Census and the Courts which are helping them do so. In the meantime, a Democratic-leaning court in New York today did the opposite, blocking a Dems from gerrymandering in the Empire State. [Audio link to full show follows this summary.]

Before we're joined by our guest to discuss all of that and more today, just a quick kudos to Rebecca Beitsch at The Hill for coming up with a new euphemism --- or, at least, one we haven't seen used yet by the rest of the corporate media --- to report on new evidence documenting the failed Trump/GOP attempt to steal the 2020 Presidential election. It's getting more difficult by the day to do so without using the correct word, "steal", when doing so. Sure, anyone can describe the GOP's attempt to "undermine" or "overturn" or "question the results". But that gets stale after a while. So, congrats to Beitsch for reporting on their attempt to "UNWIND the 2020 election", just to freshen things up! <insert eyeroll emoji here>

Then, we're joined today by redistricting expert and author DAVID DALEY, Senior Fellow at FairVote, to get caught up on a whole bunch of recent court rulings (and outrages) from over the past week or three when it comes to the last minute efforts --- largely by Republican-controlled states --- to game the 2022 midterms (and elections for the next ten years), with outrageously partisan gerrymandering of U.S. House maps.

Daley walks us through a number of such cases, including in several states where, over the past decade, large majorities of voters have adopted ballot initiatives to prevent the very gerrymandering that Republicans appear to be getting away with, nonetheless, in their newly redistricted maps.

In Ohio, the GOP-majority Redistricting Commission has had its new maps rejected four different times in recent weeks by the state's Supreme Court, with the help of its Republican Chief Justice. Despite being ordered by the court to follow the state's Constitution --- which now requires districts that generally reflect the partisan balance of the closely divided, if GOP-leaning state --- Republican Commissioners (which include state Gov. Mike DeWine, whose son sits on the state Supreme Court but refuses to recuse) aren't even trying anymore. With primaries scheduled for next month in the Buckeye State, the Commission is "just not meeting" anymore at all, says Daley. "They're trying to run out the clock so the federal court imposes one of the unconstitutional maps that has already been rejected by Ohio's state Supreme Court."

The state's previous gerrymandered map gave the GOP a 12 to 4 advantage in U.S. House districts. The new ones, repeatedly rejected by the state court, would give them a 13 to 2 advantage, despite the roughly 53-45% partisan split in the 2020 Presidential election and a 2015 mandate from more than 70% of voters rewriting the state Constitution to ensure new maps reflect the statewide partisan makeup.

In Florida, where voters also voted for redistricting reform, things are even more obnoxious and anti-democratic. The GOP-controlled legislature produced a map giving Republicans a 16 to 12 advantage, but it was rejected by Governor and Presidential hopeful Ron DeSantis for his own hand-drawn map that is likely to result in 20 Republican House seats and just 8 Democratic ones. State Republicans "already produced a pretty good Republican gerrymander," Daley explains, "and DeSantis said, 'Wait a second, I can do even better than that.'" With the state's high court packed with his own appointees, Daley warns, "that is not a Supreme Court that we should look to for any sort of help when it comes to fair maps."

Back in 2019, the U.S. Supreme Court determined that federal courts may play no role in preventing partisan redistricting, leaving the matter the chaos of each individual state court to decide. But on the matter of racial gerrymandering, SCOTUS is still happy to tell states what they can and can't do, even when the High Court's own rulings disagree with each other.

Daley explains how SCOTUS jumped in, back in February, months before the primaries, to block a new black-majority district ordered in Alabama by a lower federal court under the Voting Rights Act because. The Supremes, on the stolen and packed Court, determined it was just too soon before the primary election to draw up a new map. But late last month, after the Wisconsin Supreme Court approved a new state legislative map drawn by the state's Democratic Governor, SCOTUS ordered the state to rewrite the map, just weeks before the primaries, to remove a new black legislative district created in Milwaukee.

"The US Supreme Court has been eager this cycle to help Republicans and to put their foot on the scale against Democrats," Daley charges, describing their rulings as "Heads I win, tails you lose. They're not even pretending anymore."

And then we get to New York, where it was Democrats' turn to face the music for gerrymandering the state's U.S. House map to add three new likely Democratic U.S. House seats. Today, mid-show, NY's high court blocked the map (appropriately, as Daley sees it), ordering a court-appointed Special Master to draw up new maps in time for this year's primary (which the court also postponed until August to allow time to create the new maps.)

Last week, Daley, a longtime proponent of fair maps in all fifty states, wrote at CNN about what he saw as the "indefensible" map drawn up by NY Dems, describing it as "among the most obscene partisan gerrymanders nationwide." NY courts clearly agreed, but even Daley's own opinion article seemed to make the case for what Democrats tried --- but failed --- to do.

"If blue state courts roll back Democratic gerrymanders, but red state judges rule as partisan ideologues, a pro-GOP bias will be baked into the national map for another decade," he wrote. "A maximally gerrymandered national congressional map is...bad in nearly every way except, perhaps, compared with the previous decade's map, rigged so Republicans held control in 2012 even when they won 1.4 million fewer votes."

As regular listeners and readers know, over the past year I've (regrettably) changed my position on partisan gerrymandering, given the gaming of the system by Republicans which has succeeded in endangering America's small-'d' democratic project entirely. Short of federal legislation to ban partisan redistricting everywhere (an effort by Dems that was blocked by all Senate Republicans last year), I've been calling on states controlled by Democrats to gerrymander wherever possible. I hate that position. It's bad for many voters in the states but, ultimately, important for something resembling democracy on the national level at a time when democracy is facing a serious challenge from the forces of authoritarianism.

But Daley disagrees with. At least in as much as he has argued that such an effort could never be successful. "A national map that has been rigged for one side to win is extraordinarily dangerous, especially when one party has completely broken faith with democracy," he tells me as we debate this point again today. "Gerrymandering the hell out of Illinois and New York doesn't save democracy. It doesn't give Democrats that much of a leg up on fixing this. It is a band-aid, when what you need is a tourniquet. It's not sufficient. By all means, go ahead and put a band-aid on, but don't think it's going to stop the bleeding."

"I'm calling for a national standard that fixes the problem in New York as well as in Texas," he argues (as do I). "Because there are not enough New Yorks to balance out the Texases and Floridas. Democrats can gerrymander the hell out of these states if they want, but it's not going to help them. What they need to do is fix the overall structural problem, or it's only going to get worse."

Prepare for it to get worse...

Well, we're back after a much-needed break last week on The BradCast. (Thanks to Nicole Sandler for covering for us for a few days!) As it turns out, disappointingly, news didn't stop just because we were gone!

First up today, some very good news from over the weekend and from this afternoon...

According to Exit Polling (which tends to accurately report on Europe's various hand-marked, hand-counted balloting) on Sunday, center-right French President Emmanuel Macron defeated far-right extremist Marine Le Pen to win a second five-year term. The European Union and democracy-lovers everywhere are breathing a sigh of relief following the apparently failed third try by Le Pen --- a supporter of Trump, Putin and other far-right autocrats and an opponent of NATO, the EU and immigrants --- to win the Presidency. It was the first time in 20 years that a French President has won a second term. Macron did so by a comfortable 17 points, based on Sunday surveys. Le Pen's far-right coalition will now shift their efforts to Parliamentary elections coming up in June.

More good news today, this time out of New York, where the Judge overseeing state Attorney General Letitia James' civil probe of alleged bank, tax and insurance fraud by Donald Trump, his kids and the Trump Organization has found him in contempt. Trump is now being fined $10,000/day until he adequately answers the AG's subpoenas for documents. "Today, justice prevailed," James said in a statement following following the Judge's order. "For years, Donald Trump has tried to evade the law and stop our lawful investigation into him and his company's financial dealings. Today's ruling makes clear: No one is above the law." But, in potentially even better news, Asst. Attorney General Kevin Wallace is quoted by AP as saying "We plan to bring enforcement action in the near future". Translation: Trump is about to face serious civil litigation in NY that could ultimately break up and/or bankrupt his company, if successful.

At the same time, the Manhattan District Attorney's criminal investigation into many of the same matters, regarding Trump committing fraud over many years by lying on his annual financial statements, continues as well.

The quest for accountability in the wake of our failed former President's attempt to steal the 2020 also continues elsewhere. On Friday, Georgia's far-right Republican U.S. Rep. Marjorie Taylor Greene became the first sitting member of Congress to answer questions under oath about involvement in the January 6th, 2021 insurrection at the U.S. Capitol. Her testimony in an Atlanta courtroom, following a ruling to allow it by a federal judge, came in response to a ballot eligibility challenge filed by several voters in her 14th Congressional District. They charge Greene is ineligible for office based on Section 3 of the U.S. Constitution's 14th Amendment. The so-called Insurrection Disqualification Clause bars from office those who, after previously taking an oath to defend the Constitution, subsequently "engaged in insurrection or rebellion against the same" or have "given aid or comfort to the enemies thereof."

Greene was just one of the members of Congress who was neck-deep in the attempts by Trump and his MAGA Mob to block the certification of Joe Biden's 2020 election victory. She even went so far, as video produced by the plaintiff revealed, as to threaten violence to prevent the peaceful transfer of power to the new President. On Friday, Greene sat for several hours of questioning from attorneys at Free Speech for People (FSFP) who are representing voter-clients in Georgia, as well as several other states where voters are challenging the eligibility of elected officials who "engaged in insurrection" or gave "aid or comfort" to those who did.

Today, we step through her prevaricating testimony from Friday, in which she attempted to lie about charging that Democratic U.S. House Speaker Nancy Pelosi had committed treason ("punishable by death," Greene noted in the video she initially tried to pretend did not exist) and about expressing approval for a comment on her own Facebook page calling for a "bullet to the head" of the Speaker.

Much of Greene's testimony consisted of dozens of "I don't recall" and "I don't remember" responses to the plaintiff attorneys, even as her memory was suddenly razor sharp when it came to remembering tweets, comments and other social media posts and videos cited by her own defense attorneys. While Greene claimed she never called for violence, the clear record proves otherwise.

We're joined today by JOHN BONIFAZ, Co-founder and President of FSFP, the group working with voters bringing the challenges to Greene in GA, as well as Rep. Madison Cawthorn in North Carolina, Reps. Paul Gosar and Andy Biggs in Arizona, and against far-right AZ State Rep. Mark Finchem, the Trump-endorsed Republican candidate for Secretary of State.

Bonifaz offers his reaction to Friday's hearing and Greene's attempt to evade accountability for her role in the 2021 insurrection. He also offers updates on the appeals filed in federal court in North Carolina (where a Trump-appointed judge rejected FSFP's challenge to Cawthorn's candidacy on a rather remarkable basis, as discussed) and in AZ, where a Maricopa County Superior Court Judge on Friday dismissed FSFP's challenge to Gosar, Biggs and Finchem. In that case, as Bonifaz details, the judge rejected the Constitutional challenge not on the merits, but on the claim that private citizens have no right to sue under the 14th Amendment. Bonifaz, a longtime, well-respected Constitutional law expert, explains why he believes the AZ judge is wrong (for example, he observes, it would allow a 14-year old or Vladimir Putin to run for Congress!) and the basis for which his organization is appealing that ruling.

Meanwhile, back in Georgia, the state administrative law judge who oversaw Friday's testimony, Charles Beaudrot (a corporate tax attorney who was initially appointed by a Republican Governor), will soon give his recommendation to Republican Sec. of State Brad Raffensperger as to whether Greene should be disqualified from the mid-term ballot. Raffensperger will then decide whether to accept Beaudrot's recommendation or not.

No matter how it all shakes out, Bonifaz tells me today, the federal court ruling which allowed the challenge to go forward in the state last week is a victory in and of itself.

"Independent of what happened in the hearing on Friday," Bonifaz says, "what's happened is the door has now been opened for somebody like Donald Trump --- or anyone else who took an oath of office and engaged in insurrection --- being held accountable in Georgia. That door is now open because the precedent is there for voters to be able to challenge them based on Section 3 of the 14th Amendment. Assuming its upheld by the 11th Circuit (Greene's attorney, who also works for Trump, is appealing the U.S. District Court Judge's ruling) that means there will be a challenge, I think, to Donald Trump appearing on the Georgia ballot in 2024."

We repeatedly advised, back in 2016, that voters should ignore the so-called Conventional Wisdom heard from so-called "experts" and TV pundits at the time who insisted, over and again, there was no way Donald Trump could ever become President. Today on The BradCast we've got many more such reasons why Americans should similarly ignore Conventional Wisdom in these times which have proven to be anything but conventional. [Audio link to full story is posted below this summary..]

First, a little over a month ago, the Conventional Wisdom was that Russia's powerful military would quickly take over Ukraine within days, that NATO would likely have trouble uniting in their response, and that the entire organization itself could be on precarious grounds. Not only did all of that Conventional Wisdom prove to be wrong, but on Wednesday, Finland and Sweden, which have remained neutral for decades (if not centuries, in Sweden's case) announced they are very seriously considering joining the Western military alliance, perhaps as soon as in the coming weeks, after witnessing what happened to Ukraine. Yes, contrary to Conventional Wisdom, NATO may end up stronger and even larger than it has been in years.

In other Conventional Wisdom worth ignoring today, we are being told that Democrats are going to take a shellacking in this November's elections and are likely to lose their majorities in both the U.S. House and Senate in the bargain. Conventional Wisdom has it that the party in power before the midterms, especially with an unpopular President in the White House, pays a big price in those election years. Of course, that may well prove to be the case. But, as noted, these are not conventional times. Moreover, this year's elections are far more than a contest between Democrats and Republicans. They are no less than a contest between Democracy and Authoritarianism.

We're joined today by Roosevelt University political scientist DAVID FARIS, author of It's Time to Fight Dirty: How Democrats Can Build a Lasting Majority in American Politics and The Kids Are All Left: How Young Voters Will Unite America.

He recently penned a column at The Week, where he is a regular contributor, headlined "Democrats could still win in November. No, really." Really? Yes, really. Faris joins us to discuss how he believes it's still possible that Democratic candidates and President Biden can still take action to, at the very least, hold on to the U.S. Senate this fall and why, as he notes in the conclusion of his article, "it is still possible to squint and see a winning environment for Democrats this November."

His recommendations include, among other things we discuss today, Biden's use of his executive power to exercise the Defense Production Act; to take on corporate price-gouging and monopolies; and to combat Big Oil profiteering. Next, he explains how Democrats must turn the Right's idiotic (if effective) culture war --- banning books, threatening teachers who discuss race and gender, making abortion illegal --- against them, by boldly and aggressively taking on "radical Republican authoritarianism". And, yes, Dems need to loudly describe it as such.

"The stakes of these midterm elections are extraordinarily high," Faris explains, "because the Republican Party is like a proto-authoritarian cult. And every time that they are up for power, it could be the last free election that we have, as we currently understand them. And as long as that iteration of the Republican Party is what it is, every single national election that we hold here in the United States will have extraordinarily high stakes, because the Republicans are telling us exactly what they plan to do with their power."

"What we have to do is go on the offensive on some of these things. We have to identify the pieces of these culture war items, the panic of the day, most of which is not popular at all. The public does not support silencing public school teachers. People like teachers. The public does not support NOT teaching about slavery. The public does not support book banning."

"What's happening in Republican states is a comprehensive assault on human liberty," he argues. "These laws where you have people informing on one another --- cut an ad with what they did in East Germany. They had the Stasi, had people turn on each other and turn each other in. That's what this stuff is. It's authoritarian attempts to insinuate the Republican Party's priorities into our private lives and into our relationships with our fellow citizens, all in the service of creating this authoritarian dystopia where women are deprived of their rights and LGBTQ people are put back into their place."

He goes on to note that Dems may get some help from the Supreme Court between now and November, as the GOP's stolen and packed SCOTUS majority appears ready to turn back the clock on reproductive rights. "It will be a dark day in the United States when I think the Supreme Court overturns 'Roe v. Wade' sometime this summer. And this is a terrible tragedy that will impact the lives of many millions of women. It's just the first step in a path to gender tyranny, gender apartheid. It's a dark vision that they have for this country. But it could scramble the whole political landscape in this country in ways that we simply cannot anticipate right now."

The alternative to Dems shaking of their malaise and going on the bold offensive is detailed in Faris' more recent piece at The Week, headlined "Countdown to the Democrats' doomsday." That one persuasively explains how, by 2024, Republicans could end up winning a majority trifecta in D.C., with control of the White House, House of Representatives and, yes, even a filibuster-proof majority in the U.S. Senate.

So, yeah. It's time to ignore the Conventional Wisdom and get busy to help save this country and democracy itself. The alternative should be too grim by now to even contemplate. (Or, it would be, if the progressive side of the aisle had a media machine even close to what now exists on the Right.)

Finally, some listener mail (we got a lot of it!) in response to Monday's show with The Nation's John Nichols, in which we discussed accountability for the Trump Crime Family and the need to impeach the corrupt far-right active Supreme Court Justice Clarence Thomas...

A bad day for Donald Trump is generally a good day for America. Today on The BradCast (after horrible and tragic news unexpectedly swept over our show yesterday), it's one of those days. And, if our guest, a former federal prosecutor is correct, there may well be many more such bad days ahead for our disgraced former President. [Audio link to full show is posted below this summary.]

FIRST, history was made toward "a more perfect union" on Thursday when the U.S. Senate voted 53 to 47 to confirm Joe Biden's nominee, Ketanji Brown Jackson, as the nation's first black female Justice on the U.S. Supreme Court. She will officially be sworn in and seated in July, at the end of the Court's current term, when Justice Stephen Breyer officially resigns.

SECOND, three more 2022 ballot eligibility challenges were filed today against three more Republican insurrectionists, courtesy of good government group Free Speech for People, this time on behalf of voters in Arizona against Congressmen Paul Gosar and Andy Biggs, as well as AZ State Rep. Mark Finchem, the Trump-endorsed candidate for Secretary of State. The new Constitutional challenges follow on similar ones currently being litigated against Rep. Madison Cawthorn in North Carolina and Marjorie Taylor Greene in Georgia. All are based on Section 3 of the 14th Amendment which bars those from holding office who have sworn an oath to support the Constitution, before subsequently, as per 14.3, having "engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof."

THIRD, yet more good news today, as New York Attorney General Letitia James asked a state Court to hold Donald Trump in civil contempt for refusing to comply with a court order to turn over documents, as part of her investigation into bank, tax, and insurance fraud by the former President and his family members, Ivanka and Don Jr. Shortly after that court filing on Thursday, Manhattan D.A. Alvin Bragg told CNN that his criminal probe into many of the same matters is "very much ongoing," despite the two lead prosecutors in the years-long probe recently resigning after charging that Bragg was not willing to move forward with indictments against Trump.

THEN, we get to our guest today, who may --- depending on how you look at it --- have the best news of all for those hoping to see actual federal prison time for the disgraced former President. It could take a while, but he's here to tell us today that U.S. Attorney General Merrick Garland's investigation of the January 6th insurrection is proceeding in precisely the way he would expect it to proceed if, in fact, the AG was investigating possible criminal indictments of Trump for his part in inciting the deadly attack on the U.S. Capitol.

Writing at Washington Post late last week, RANDALL D. ELIASON, a former Asst. U.S. Attorney in D.C., where he served as Chief of the Public Corruption/Government fraud section, argued that legal critics of Garland, mostly on the left, are wrong. He sees progress by the Department as moving "impressively fast" and "unfolding at an increasingly rapid clip" just over one year into the investigation. (Eliason penned a similar argument late last year at WaPo.)

To date, independent investigative journalist Marcy Wheeler of Emptywheel has made one of the loudest cases, in the face of skeptics, that Garland is, indeed, working his way up the legal food chain toward Trump in the DoJ's huge investigation of the J6 insurrection. (She's joined us on the show a number of times in recent months to argue as much.) Today, Eliason says he believes she's absolutely right.

"There's this huge debate on Twitter and elsewhere, whether Garland's doing nothing at all or whether this is just what we should expect [if working toward a potential Trump indictment]. I agree with Marcy Wheeler here that this is exactly what we should expect," he tells me. "The signs are this is in fact what's happening."

"The alternative is you rush, you put together a case without doing it properly just to bring some charges, and you lose. You don't want to bring a half-baked case in something that's this significant or this important. If you're going to bring a case at all, you've got to do it properly."

"Garland's role here is to not be swayed by political pressures, but to take the case wherever the facts and the law lead them, as he said. Which, to me, appears to be exactly what he's doing," argues Eliason, who now teaches white collar criminal law at George Washington University Law School in D.C. "And the suggestions, frankly, from some of the critics, that Biden should replace him, or fire him, or lean on him to do something --- that's exactly what everybody was outraged about when Trump and Barr were doing it. That kind of politicization of the Justice Department --- the idea that Biden should lean on Garland or fire him because he's not moving fast enough --- is the exact opposite of what we want. And the exact opposite of what Biden and Garland promised to do to get away from the Trump era, where Bill Barr was running around and doing favors for Trump cronies, interfering in the administration of justice, and politicizing the Justice Department. That is the last thing we want."

Eliason speaks to how and if DoJ and the House January 6 Committee may be coordinating their efforts, and why some members of that Committee have recently called on the Departments to do more, faster. He also offers insight on why it may be that Mark Meadows, Trump's last Chief of Staff, has yet to be indicted for Contempt after Congress, after being referred for the charge months ago by the House, even as Steve Bannon was indicted within weeks after a similar referral.

In our broad discussion on these matters, we also discuss the unique time elements involved here, in regard to the possibility that Trump could declare his candidacy to run in 2024; what DoJ guidelines mandate regarding investigations or indictments to close to an election; and whether a federal indictment by Biden's Justice Dept. in such a case would be seen by the former President and his cult-like followers as little more than a political vendetta

There's a lot to tune in for here, particularly if you are a Garland skeptic or frustrated with the pace of his investigation. As Eliason reminds us, the Enron indictments came a full four years after the collapse of the company and their scam was exposed. Even Watergate took at least two years before major charges were brought. We are now just over one year out from what has become the largest probe in DoJ history. By far.

In addition to discussion about Trump accountability for his attempts to try and steal the 2020 election, we also discuss Trump's NY legal threats, and what should be done about corrupt, far-right activist Supreme Court Justice Clarence Thomas following the recent news that his corrupt, far-right activist wife Ginni was relentlessly texting Meadows in the days following Trump's election loss to encourage the Administration to prevent the peaceful transfer of power to Joe Biden, the winner of the 2020 Presidential election.

FINALLY, Desi Doyen joins us for a bit more accountability talk, this time for Big Oil CEO war profiteers who testified this week in Congress, in our latest Green News Report. Also on the GNR rundown today, Europe's move to ban Russian coal, the EPA's plan to finally ban deadly asbestos and the increasing cost to tax-payers --- in dollars and lives --- of increasing power outages during increasingly powerful climate change-fueled storms...

Santa, according to my guest today on The BradCast, is a "democratic socialist". Sarah Palin, on the other hand is...well...Sarah Palin, and she has decided to "un-quit politics." [Audio link to full show is posted below this summary.]

Before we get there today, however, a bit more on the grim news coming out of Ukraine this week, as independently documented evidence of horrific war crimes by Russia continues to mount. On Tuesday, President Volodymyr Zelenskyy addressed the U.N. Security Council from Ukraine and charged that if the U.N. is unable to remove Russia's veto, as a permanent member of the Council, then they might as well dissolve it entirely. He has a point.

Then, before we get to Sarah and Santa...The news that shouldn't be news at all. Three Republican Senators have now announced they intend to vote in favor of Joe Biden's nominee, Judge Ketanji Brown Jackson, perhaps the most qualified jurist every nominated to the U.S. Supreme Court. On Monday night, Utah's Mitt Romney and Alaska's Lisa Murkowski declared they will support Brown's confirmation, joining Maine's Susan Collins who did so last week. None of that should be news at all, but in the Republicans' twisted, hyper-partisanized world, voting for a SCOTUS nominee tapped by a Democratic President apparently it is. During Monday's Senate Judiciary Committee hearing, South Carolina's Lindsey Graham (who voted for Jackson's appointment to a federal Appeals Court seat just last year, but refuses to vote for her this year) said the quiet part out loud when he declared that if Republicans win back the Senate in November, none of Biden's nominees are likely to be seated to the federal bench.

In other insane GOP Congressional news, Michigan Rep. Fred Upton announced today that he will not seek re-election. He is the fourth of 10 Republican House members who voted in favor of Donald Trump's second impeachment (for inciting the January 6th insurrection) to retire instead of run for re-election.

Meanwhile, way up north in Alaska, more than 40 candidates are now running in the upcoming June Special Election to fill the state's one U.S. House seat, which had been held for 49(!) years by Don Young, the 88-year old Republican Congressman who died suddenly last month.

Donald Trump has chosen his favorite candidate in the race, the one my guest today describes alternately as "The Quitter" and the "former half-term Governor", Sarah Palin. The failed 2008 Vice Presidential candidate is emerging from Alaskan and rightwing media obscurity in hopes of finding relevance again in the far-right wingnut world she helped create during her 2008 run, just before quitting politics halfway through her first term as Alaska's Governor. Palin signed up to run for the Special Election and regular general election primaries --- both to be held on June 11th --- on the final day to qualify, last Friday on April Fools Day. (Seriously.)

We're joined today by one of the nation's foremost Palinologists, JEANNE DEVON, who made a name for herself as "AK Muckraker", helping to introduce Palin to the world in 2008 at her award-winning The Mudflats blog. She has since gone on to co-write a NYTimes best seller, Blind Allegiance to Sarah Palin - A Memoir of Our Tumultuous Years, and served as Press Secretary for Alaska's state Senate Democrats and as Communications Director for the state's Democratic Party. (She is currently working with FX to develop a television series based on her book, The Blood of Patriots, which she co-wrote will Bill Fulton about the Alaska militia movement.)

Before we get to Palin and the potentially insane way that Alaska is about to run its Special Election, Devon offers some thoughts on the decades long legacy of the late Don Young who, though "he didn't have that much power anymore" after being stripped of Congressional committee assignments due to "blatant corruption," was still "an institution, and Alaskans like their institutions."

While some in the media have been regarding Palin as the front-runner to fill Young's seat, Devon seems less convinced. "Palin's approval rating and likeability has been underwater since she quit [in 2009.] She is not a popular figure in the state anymore." Devon cites a comment she saw at today one of the "hardcore fringey rightwing" Facebook groups she sometimes drops in on, suggesting those folks do not appear to be fans. "Very hard pass," she reports one commenter as writing, adding "she quit once when the going got tough. And in my mind that defines her entire political career."

A lack of popularity is not all Palin will have to contend with. There are more than 40 candidates running in both the Special and regular primaries, which will be held on the same day. Palin has signed up for both. But in addition to several progressive candidates Devon cites, with impressive resumes and following, she seems most excited about one candidate on the ballot with at least as much "name recognition" as Palin: Santa Claus!

Yes, Claus is "actually a member of the North Pole City Council" and "literally on the ballot". He represents what Devon describes as "one of the most conservative towns in Alaska" and "he is a democratic socialist --- of course --- because he's Santa!"

Devon notes, however, that "Santa Claus has also said he will not run for the next full term. He will just run to finish the end of Don Young's term. Because we are now faced with two elections."

As to those two elections, they will be run under a new scheme in the state. For the first time, anybody who wants to run for office can simply sign up to run, no petition gathering necessary. (Thus, the 40+ candidates!) The top four vote-getters in the primary will then go on to the general election, which will use Ranked Choice Voting (RCV) --- a confusing and difficult to both count and oversee method of voting, allowing voters to rank their choices for the office. (As I explain to Devon, when and if Alaska tires of RCV, as many jurisdictions do after using it, when they discover that neither voters nor candidates understand it, they may wish to look into the simpler Approval Voting method, allowing voters to choose Yes or No for all candidates on the ballot. Easier to understand, to count and to oversee, since computers and centralized counting aren't needed for the complicated math and many rounds of tallying necessary under RCV.)

Of course, Devon has much more insight on what is likely to be a fascinating and/or hilarious race, with both Palin and Clause on the ballot. Additionally, there are six Democrats on the Special Election ballot. Among them, she cites "Christopher Constant, who was the first openly gay person to be elected to the Anchorage Assembly --- and remember, Anchorage is half the population of the state. Then there is Mary Peltola, who long ago served 12 years in the legislature. She's an amazing Native leader who is also an expert in fisheries, which is important up here. And there's a sitting legislator from Fairbanks named Adam Wool. So all of these are Democrats who could certainly fill that slot."

She also has some thoughts to share on Sen. Murkowski, who is up for re-election this year as a Republican --- after voting to remove Trump from office in his second impeachment and declaring her support for Ketanji Brown Jackson this week. Will that doom her chances of re-election? Tune in to find out what Devon has to say about that race --- which will also be run as a top-four primary contest with an RCV general, in a state which has a history of plenty of election and tabulation controversy in recent years.

Finally, after that amusing segment, Desi Doyen joins us to ruin all the fun, as usual, with our latest Green News Report, including special coverage of the U.N. IPCC's latest report warning that Planet Earth is likely to blow past the climate targets set by the Paris Climate Accord, even though, as the scientists note in their report, it is still not too late for the nations of the world to institute mitigation efforts to avoid catastrophic global warming in our all-too-near future...

Yes, on today's BradCast, we discuss a new, maddening --- and likely unconstitutional --- voter suppression law signed this week by Arizona's Republican Governor. But, as our guest notes, "Don't worry, we've got this!" We'll see. He's got a plan in response that voters in other swing-states may wish to look at as well. Other than that though, today's show ends your week with nothin' but good news! (Mostly.) [Audio link to full toe-tappin' show is posted below this summary.]

First up, good news on COVID! According to the Dept. of Health and Human Services, hospitalizations are now at their lowest rate since the U.S. began keeping records at the beginning of the pandemic two years ago. Of course, last time hospitalizations where near this low we got slammed by Delta and then Omicron shortly thereafter. So, hey, now's a great time to get a vaccine shot or a booster if you haven't in the past 4 months or so!

Then, more good news on the economy! 431,000 new jobs were added in March, as Americans continue to shake off the pandemic, even amid war in Europe and inflation. Since Joe Biden took office, the economy has added a record 7.9 million jobs. Unemployment is the lowest it's been since before the pandemic and barely higher than the nation has seen in a half-century, as the President did some justifiable crowing about those numbers today. Things would be even better had Republicans and Sen. Joe Manchin allowed his Build Back Better bill to pass, given that many more women are needed to fill millions of open jobs, but can't afford the child care (that BBB would have paid for) in order to take them.

But there's still more good news today, for workers and labor unions! Amazon employees in deep red Republican Staten Island, New York voted "yes" to unionize in an historic labor win at the only fulfillment center in New York City! It's the first Amazon facility in the U.S. to do so, but it likely means many others will join them. Another unionization vote at Amazon's fulfillment center in Bessemer, Alabama remains too close to call for the moment. It's the second such vote held at that plant after the National Labor Relations Board found that Amazon had cheated in the first vote and ordered a re-do.

Speaking of cheating in elections: Republicans. Though it may make your head (and mine) explode, mid-term primaries are beginning to kick off all over the country. The first one, last month in Texas, resulted in tens of thousands of disenfranchised absentee voters whose ballots were rejected thanks to the state GOP's new voter suppression law there.

We had slightly better news this week in Florida. There, a federal judge struck down several provisions of the new voter suppression law adopted last year by the GOP-dominated state legislature and Republican Gov. Ron DeSantis (who barely won his initial election back in 2018). U.S. District Judge Mark Walker found that the law unlawfully targeted black voters in violation of both the Constitution and the Voting Rights Act. Most notably, he ordered the state back under the VRA's preclearance regime for the next decade, mandating approval in advance from the federal government for any new election-related laws that may effect minority voters.

Republicans in Arizona, however, have been running a bit behind in their voter suppression. But, on Wednesday this week, the state's Governor Doug Ducey, also facing re-election this year, signed HB 2492 [PDF], even though legislative attorneys in both the state House and Senate found the measure to be likely unconstitutional. In short, it requires state voters to prove they are citizens before they may vote for candidates in state and local elections. But it goes farther than previous such laws in the state. This one could disenfranchise anywhere from 31,000 to nearly 200,000 voters in a state where Democrats won the Presidential election in 2020 by just over 10,000 votes. It would prevent voters who fail to prove their citizenship (or can afford to do so) from voting for either state officials or President. They may still be able to vote for members of Congress, but not during either early voting or via absentee ballot.

We're joined today by ERIC KRAMER, former Chair of the Navajo County Democrats, now Director of the Arizona Deserves Better non-profit coalition to discuss HB 2492 and, more importantly, what he and other voting rights advocates in the state are currently doing to both overturn such measures and prevent even worse ones from being adopted at any time in the future with their new Arizonans for Fair Elections ballot initiative.

We first learned of the effort via DailyKos, where Kramer writes as "EricAZ". Two articles of his there caught our eye in particular. The first, in early March, was headlined "Arizona Right-Wing Goes Batshit Crazy in Attack on Voters (Don't Worry, We've Got This)". The second, a few weeks later, is titled, "The Joy of Soon Beating the U.S. Supreme Court on Several Voting Rights Issues".

Kramer explains how the AZ Fair Elections initiative, targeted for inclusion on the ballot this November, would work to prevent the kind of voter suppression we have been seeing from the increasingly extremist Republican radicals who now control the AZ state legislature. It would roll back laws like HB 2492 and prevent similarly disenfranchising laws from being adopted in an election year. It would also repeal a number of other laws recently adopted by state Republicans which target minority voters (Native Americans in particular), while instituting proactive measures to increase voter turnout, rather than block it, as the GOP is now working so hard to do there and elsewhere.

"In addition to these places where we're kind of playing defense against what they've done to voters in the past, there are some where we are playing offense," Kramer explains in detailing the voter referendum. "We have automatic voter registration. We have Election Day registration. We expand the periods for early voting. And we do quite a lot to help Native American voters and especially disabled voters --- we give more opportunities to vote. So it is a very good initiative."

Can his group, which is currently in the signature gathering process, get the measure onto the ballot in November? And, if so, can they get it passed? "We are going to get it done," he tells me confidently. "We need 243,000 signatures [by July 7] to get on the ballot. We're currently collecting at more than twice the rate we need. Fundraising has gone well. People from all over the country are supporting this. We will get it done."

Finally, we close with even more good news and a song!

Our final good news for the day is about cannabis. U.S. House Democrats, with almost zero help from Republicans, adopted a measure today to decriminalize marijuana at the federal level, though it will still have to overcome a likely GOP filibuster in the Senate. That, despite the American public's overwhelming support not just for decriminalizing cannabis, but for fully legalizing it once and for all. Not sure why the GOP would be dumb enough to take a pass on shooting the measure down again, as they did back in 2020 when they held the majority in the upper chamber, but explaining Republican stupidity is not my strong suit.

But to keep you happy and singing well into the weekend, we close with a new ditty from Canadian comedian and "The Internet's Favourite Dad* (*unproven)", according to his Twitter profile, Stewart Reynolds, who sings that "it's nice to be disliked!"...So "annoy a Nazi" today!...

As usual, on today's BradCast, there is more continuing Trump corruption news than we can possibly keep up with. But don't blame us for trying. [Audio link to full show is posted below this summary.]

First up, however, a bit of news on the Omicron sub-variant BA.2, which has now become the dominant variant in the U.S. The FDA announced today that it has approved second Pfizer and Moderna boosters for everyone 50 years of age and over who received their last shot at least four months ago. Also, Will Smith apologized on Instagram to Chris Rock for assaulting him at the Oscars. A day late, but there ya go.

Then, we try to catch up with some of the latest Trump corruption/accountability news and some that we've fallen behind on, with an assist from longtime Philadelphia Inquirer columnist WILL BUNCH, who has been in a bit of a funk over the mountain of evidence of corruption on the Right and the lack of accountability for it.

Among the stories he and I discuss today...

• The news of the longtime prosecutors who recently resigned from the probe of Trump's years-long bank, tax and insurance fraud felonies after the new Manhattan D.A., Alvin Bragg, took over the investigation and tanked it. As revealed last week, one of the disappointed lead prosecutors told Bragg in his resignation letter last month that Trump was "guilty of numerous felony violations, that dropping the probe was "a grave failure of justice" and that "the team that has been investigating Mr. Trump harbors no doubt about whether he committed crimes - he did."

• The insane, conspiracy-theory laden text messages sent in November 2020 by longtime rightwing activist Ginni Thomas --- wife of longtime rightwing Supreme Court Justice Clarence Thomas --- to Trump's then Chief of Staff Mark Meadows, encouraging him to fight to steal the 2020 election. And the difficulty (at least by Democrats) of bringing accountability for our corrupted Court and its "giant legitimacy crisis".

• The seven and half hour gap in the Trump White House call logs from January 6th, 2021, as reported today by the Washington Post's Bob Woodward and Robert Costa, showing no record of Trump calls during the insurrection he incited at the U.S. Capitol from 11:17am that day until 6:54pm that night, even though the U.S. House Committee investigating the insurrection has confirmed a number of phone conversations that occurred with Trump that day.

"There seems to be no way or no will to hold our staggeringly corrupt leaders accountable --- whether it's Trump defrauding the banks or plotting an attempted coup from the Oval Office, or a Supreme Court justice ruling on his wife's bat-guano crazy political crusade," Bunch lamented in his column over the weekend. "I'm in a total funk over the state of the union."

Today he tells me, "We have this situation where there are a lot of people in the body politic saying look, the evidence is overwhelming that the 45th President of the United States was a criminal, and yet, the handful of people who are actually in the most key positions for possibly doing something about it won't go there, apparently." While he recognizes that some, such as our friend Marcy Wheeler of Emptywheel, believe Attorney Gernal Merrick Garland actually is working his way up the food chain toward Trump, he remains dubious.

"Common sense is telling me that, given what's at stake, this is taking too long," he argues. "While this hangs out there, you've got all of these state legislatures enacting laws to make it possible to pull off a coup in 2024. Maybe putting a few of these guys on trial and sending a few of them up the river, maybe that would change the dynamic a bit in the country."

Bunch does put stock in the House J6 Committee's work and looks forward to Watergate-like hearings in the coming months which might change the current trajectory. But, in the meantime, he remains concerned about the ability of key institutions, like our corrupted SCOTUS, to maintain any legitimacy.

"A healthy democracy would have a healthy Supreme Court. But it's a very reform-proof operation. Only one Supreme Court Justice has been impeached in U.S. history," he notes. "They don't have any particular code of ethics, even when it comes to recusing themselves on cases like this Clarence Thomas situation. They're supposed to use their best judgment, and we kind of have to hope for the best."

"For a long time there has been this simmering general sense that there are two systems. There's not one system of justice in this country. That certain privileged people at the top, it's not just politicians, it's wealthy people, it's high-profile people...Here's New York City with six cops ganging up on somebody who jumps a subway turnstile because they didn't pay the $2.50 fare because they probably couldn't afford it. There's a sense of anger about that, and I think it ties in to how people feel about Trump or Ginni Thomas, that it's all of one piece. And I think that is just causing a broader lack of trust in this country."

But, Bunch also insists that he remains "an optimist," is hopeful things can still change and that we may soon begin to see accountability. "That's the January 6 Committee. Once they get their case out there, the public demand for [accountability] might peak. And for that, we can only hope."

Finally, Desi Doyen joins us for our latest Green News Report, with news on Europe weaning itself from Russian fossil fuels and, speaking of a lack of accountability, new reporting on how corrupt Sen. Joe Manchin (D-WV) has, for years now, used his public office for massive personal financial gain...

There's plenty of bad news out there. But on today's BradCast, we've got plenty of good news amid the bad...some of which is interrupted by breaking, bizarre, though hardly surprising news (at least when it comes to the corrupt Clarence and Ginni Thomas!) Almost all of these stories deserve more attention than they've been getting. But, because they tend to amount to good news and/or news that may help Dems and/or hurt Republicans, you haven't heard as much about them as you should from corporate media outlets where bad news leads or on social media, where rightwing outrage is monetized and weaponized. Among our many stories today...

• According to the Commerce Dept., via Reuters, weekly jobless claims last week hit their lowest level since 1969! Seriously. But who knew? Do you think you might have heard more about that if Trump was President instead of Biden? While stories about inflation tend to dominate headlines, stories about Joe Biden's economy --- firing on all pistons, even amid both inflation and war in Europe --- quickly disappear off the front pages (if they showed up there in the first place.) Little wonder the President's approval ratings remain low, despite a booming economy and huge majorities of Americans (of all parties) supporting his response to Russia's war on Ukraine.

• Far-right Congressional loon Marjorie Taylor Greene's eligibility to run for re-election is being officially contested today by Georgia voters and the Constitutional law experts at Free Speech for People (FSFP). The non-partisan group previously filed a separate challenge against the Constitutional eligibility of North Carolina Rep. Madison Cawthorn to run in 2022 on the same basis. Greene, like Cawthorn, is accused of violating Section 3 of the 14th Amendment which bars those who have taken a federal oath to defend the Constitution from running again if they have subsequently "shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof." FSFP cites Greene's participation in the January 6, 2021 insurrection, including her pre-Jan 6 video-taped message urging supporters to block the peaceful transfer of power after Biden's 2020 Electoral College victory ("You can't allow it to just transfer power 'peacefully,'") and her charge that Biden and House Speaker Nancy Pelosi were "guilty of treason", which she described as "a crime punishable by death". That, before her supporters went on to attack the U.S. Capitol to block the peaceful transfer of power while calling for death of Pelosi. Under Georgia law, MTG will now have the burden of proving she isn't an insurrectionist, and FSFP will be able to depose her under oath in the process. Moreover, FSFP Co-Founder and President John Bonifaz tells The BRAD BLOG today: "There will be more such challenges to be filed this year."

• Speaking of insurrectionists, one of Trump's favorite ones just got dumped by him. Alabama Rep. Mo Brooks, running to win the GOP nomination for U.S. Senate in the state, was unendorsed by Trump on Wednesday. Brooks, a top "Stop the Stealer", spoke at Trump's January 6th Insurrection Day rally near the White House. But, after urging the MAGA mob last year to turn their disappointment about 2020 into efforts to win in 2022 and 2024, Trump pretended he didn't like Brooks anymore and unendorsed him yesterday. The real reason he dumped him, of course, is because Brooks is currently running third in the GOP primary and Trump doesn't want to be seen as backing yet another loser. But in response to getting dumped, Brooks put out an extraordinary statement last night claiming Trump asked him to "rescind the 2020 elections, immediately remove Joe Biden from the White House, immediately put President Trump back in the White House, and hold a new special election for the presidency." Brooks stood by the claim during a local TV interview last night, saying that Trump asked him repeatedly to remove Biden and restore Trump, even recently. TPM's Josh Marshall describes it as "definitional sedition."

• Then, as we did yesterday, we have to ask again: Where is Clarence Thomas? After being admitted to the hospital last Friday with an "infection" and "flu-like symptoms", the Supreme Court finally disclosed the hospitalization of the 73-year old Justice on Sunday, announcing "his symptoms are abating" after intravenous antibiotic treatment and that he'll be released "in a day or two". The Court has had no update since Sunday. Today, four days later, The Hill reports a friend says Thomas is "resting" and "going to be just fine", but won't disclose whether he's "resting" in the hospital or at home, for some reason. Why not? We discuss.

• And, speaking of the apparently ailing and clearly corrupt Clarence Thomas, his far-right activist wife Ginni Thomas --- according to breaking news this afternoon from Bob Woodward and Robert Costa at Washington Post --- sent dozens of insane text messages to then White House Chief of Staff Mark Meadows, encouraging him to somehow steal the 2020 election in November of that year. The Thomases have long been corrupt, but this incident may take the cake. She was encouraging the Trump White House to find ways to overturn the results of a Presidential election while her husband was often the lone vote at SCOTUS in favor of absurd MAGA lawsuits challenging the election. He even voted in favor of challenges regarding the January 6 House Select Committee's subpoenas. Ya know, subpoenas that resulted in Meadows turning over text messages from his wife Ginni Thomas! This is a remarkable amount of corruption inside of corruption inside of corruption. Is it finally time to impeach Clarence Thomas? (If he is ever released from the hospital, in any event.)

• Finally, Desi Doyen joins us for our latest Green News Report, in which --- aside from more climate-fueled disasters in Texas and Louisiana, and nuclear concerns rising at Chernobyl --- she manages to find a whole bunch of surprising silver linings in the response to Putin's war on Ukraine, which is resulting in Europe speeding up their move away from fossil fuels...

It was a day of some light amid the darkness. As usual, these days, we'll take what we can get. Today's BradCast may lurch you back and forth through both, though we do end on several upbeat notes of lightness and light.

Among both the light and dark stories covered on today's program...

• Russia continued to add to its many war crimes in Ukraine, further assuring Vladimir Putin's ignominious place in the history as one of humanity's most villainous war criminals. On Wednesday, Ukraine charged that Russian airstrikes flattened the historic Donetsk Regional Theatre of Drama in Mariupol, where "hundreds" of civilians were reportedly sheltering. As Ukraine's Foreign Minister tweeted, "the building is now fully ruined," adding "Russia could not have not known this was a civilian shelter." The untold number of victims is added to the thousands already reported as killed and buried in mass graves in the Southern coastal city which has been cut off by Russian forces for weeks now from food, water, electricity and medicine.

• In brighter news, a glimmer of hope for peace over the past 24 hours or so, amid continuing negotiations between Ukraine and Russia. The framework reportedly echoes a similar roadmap put forth on this program by the Quincy Institute for Responsible Statecraft's Anatole Lieven a couple of weeks ago. Both sides are citing progress toward what is emerging as a 15-point plan for ending the war. It includes Ukraine's acknowledgement that they will not become a member of NATO, but will become a defensively armed neutral country along the lines of Austria or Sweden, with security guarantees from allies such as the US, UK and Turkey. In return, Russia would fully withdraw its troops. There are still many questions surrounding what "security guarantees" might amount to, and exactly which regions Russia would fully withdraw from. But the news of both "hope" and "compromise" is both significant and encouraging.

• Meanwhile, Ukraine's courageous President Volodymyr Zelenskyy addressed the U.S. Congress on Wednesday morning via video-conference, eliciting bipartisan standing ovations both before and after his remarks. We share his presentation in full today, as he invoked Pearl Harbor and 9/11 and referenced both Martin Luther King and Mount Rushmore as he asked for additional support from U.S. lawmakers, called for still more sanctions against Russian lawmakers, and asked for President Biden's help in leading the world toward peace. "We need you right now," he said, adding: "I see no sense in life if it cannot stop the deaths."

• Several hours later, President Biden offered his own remarks at the White House, announcing a new round of defensive munitions earmarked for Ukraine. Today's $800 million tranche brings the total, in both military and humanitarian support sent to Ukraine since Biden took office, to about $2 billion. Congress has appropriated another $14 billion or so. In his White House comments, Biden excoriated "Putin's depraved onslaught". Later in the day he described the disgraced Russian leader as a "war criminal".

• Next, with those heavy lifts behind us, we return to domestic politics, as the Federal Reserve raised interest rates by a quarter of a percent on Wednesday, in hopes of easing inflation by forcing the economy into recession. The move follows yesterday's official withdraw of Biden's nomination of Sarah Bloom Raskin to a seat on the Fed's Board of Governors. Republicans in the Senate Banking Committee had denied a quorum to prevent her confirmation by refusing to show up at all. But her fate was finally sealed this week when Democratic Sen. Joe Manchin said he would not support her. The phony complaints from the GOP had to do with Raskin's anodyne commentary in the past that the Fed should reconsider its support of the fossil fuel industry amid our worsening climate crisis. Manchin, of course, makes millions from the coal industry and his campaign has raked in huge bucks from Big Fossil Fuel. Republicans, on the other hand, who approved Raskin for other roles twice in the past, may have had an additional reason to block the confirmation of Rep. Jamie Raskin (D-MD)'s well-qualified wife to a seat on the Fed Board.

• In the brightest news we can find today, the U.S. Senate, which usually only finds bipartisan agreement on matters that have to do with war, found something else to agree on Tuesday. It is unqualified great news and anyone who says otherwise is embarrassingly wrong. The Sunshine Protection Act, co-sponsored by Senators Sheldon Whitehouse (D-RI) and Marco Rubio (R-FL) was passed by the Senate with unanimous consent yesterday! The measure would make Daylight Saving Time permanent as of 2023. Sen. Patty Murray (D-WA) correctly lauded the long-overdue initiative by declaring: "No more dark afternoons in the winter! No more losing an hour of sleep every spring! We want more sunshine during our most productive waking hours!" Of course, she's right. And --- even though my remarks on this topic bring more email (both for and against) than just about anything else I ever cover --- I will note that anyone who opposes this, no matter how good their reasons by may be, are still shamefully wrong. If I can find time in the days ahead --- especially if it looks like this will move forward in the House and on to the President --- I'll try to find some time to share some of those amusing emails from listeners, especially those from some our nation's most determined Eeyores of Darkness.

• Finally, after delivering the light that we earlier promised, we end with a rainbow of it! Specifically, it's the return of brilliant satirist and national treasure Randy Rainbow, after a too-long absence. On today's BradCast: It's been a very bad week for the pretend "law and order" rightwingers dumb enough to have been suckered by Donald Trump's 2020 "election fraud" hoax. But it's likely to get still worse for them in the days ahead. That's fine by us. [Audio link to full show follows this summary.]

After a quick update today on the latest grim, and getting grimmer, news out of Ukraine as Russia's Vladimir Putin begins his third week of unspeakable barbarism, here are some of the much less grim stories we actually enjoyed covering today...

• Yesterday, we reported on the ongoing challenge (and emergency appeal filed after a bizarre ruling by a Trump-appointed judge) to North Carolina Rep. Madison Cawthorn's eligibility to run for re-election this year. The challengers, including our guest, Constitutional law expert Ron Fein of Free Speech for People, contend that Cawthorn is ineligible to run for federal office, after having violated the 14th Amendment's ban on those who "have engaged in insurrection" after taking an oath to defend the Constitution. But, no sooner did we get off air when news broke that Cawthorn was charged in NC with driving with a revoked license. Apparently, this is the second time he has been charged with the same crime. Will he face any real accountability for it this time around? The max sentence for that is 20 days in jail in NC.

• On the federal level, Attorney General Merrick Garland insisted today that his Justice Department will "not shy away from cases that are controversial or sensitive or political," telling reporters that "to do that would undermine an element of the rule of law." Glad to hear it. His comments came in response to questions about the DoJ's January 6th investigation and whether Trump and those around him would ever face accountability, as hundreds of low-level insurrectionists have faced charges for storming the Capitol on January 6th, 2021, after being being incited by the disgraced former President and his false claims that the 2020 election was stolen from him.

• Tina Peters, a Colorado elections official arguably incited to criminal acts by Trump's lies, is now facing state charges for them. She is the very Trumpy Republican Mesa County Clerk who recently announced her intention to run for Secretary of State. Peters turned herself into custody on Wednesday night after being indicted this week on 10 counts related to elections tampering. (A perfect resume for a GOP Sec. of State contender!) We've been reporting in detail on Peters over the past year, after she allegedly snuck into a secure facility where voting systems are stored in Mesa County along with accomplices (one of them her Deputy, who was also charged this week), turned off the security cameras, and then made copies of hard-drives with critical and proprietary Dominion Voting System software on them. Dominion's Election Management System software from Mesa was subsequently released, along with passwords to the system, to the Internet a few months later during one of conspiracy theorist and pillow magnate Mike Lindell's "election fraud" symposiums, just as Peters was speaking at the forum. The serious security breach with the public release of that software led to a bit of havoc in California's Gubernatorial Recall election just weeks later, where the same Dominion systems were used in several counties. We revisit the sprawling story of how we got here, as the loony Peters finally appears set to pay a very high price for being dumb enough to buy into Trump's con.

• And then there was more bad news this week for Fox "News" and several of the top clods and dupes who host programs on their various channels. A New York judge denied the motions to dismiss filed by Fox and a number of their top anchors, such as Maria Bartiromo and Lou Dobbs, in the $2.7 billion defamation lawsuit filed against them and conspiracy theorist/grifter attorneys Rudy Giuliani and Sidney Powell by voting system company Smartmatic. "At a minimum," the judge found in his 61-page ruling, "Fox News turned a blind eye to a litany of outrageous claims about plaintiffs, unprecedented in the history of American elections, so inherently improbable that it evinced a reckless disregard for the truth." That means the case against most of them will now move forward toward discovery and trial. (Several of those "inherently improbable" claims were based on The BRAD BLOG's own accurate, exclusive reporting back in 2010, which Powell, et al, bastardized to fit their pretend theories about massive election fraud.) Interestingly, the judge also cites a bit of accidentally responsible reporting from Fox star Tucker Carlson to underscore just how irresponsible the others were, in the judge's "finding that there is a substantial basis that Fox News acted with actual malice." The New York ruling follows a similar one from a judge in Delaware last December, who also rejected motions to dismiss from many of the same clowns in Dominion Voting Systems' separate $1.6 billion defamation lawsuit.

• In Texas, which held this year's first-in-the-nation midterm primary elections last week, AP finds that an extraordinary 27,000 mail ballots --- from both Democrats and Republican voters --- were flagged for rejection under the Lone Star State's new voter suppression law passed last year in pretend response to Trump's claims about a stolen 2020 election. The initial rejection rate was approximately 17% statewide and substantially higher in a number of large, Democratic-leaning counties. That, compared with a statewide rejection rate of about 1% of absentee mail ballots back in 2020.

• Finally, Desi Doyen joins us for our latest Green News Report, with more disturbing fallout (and, maybe, some theoretical upsides) regarding energy and security in the wake of Russia's horrific invasion of Ukraine...

The news out of Ukraine continues to be grim, but there are a few bright spots here at home on today's BradCast, a way that you can help fight fascism without leaving home, and a renewed challenge to an alleged insurrectionist Congressman's eligibility to run for re-election. [Audio link to full show is posted at the end of this summary.]

FIRST UP, Vladimir Putin is now unleashing outright atrocities and unspeakable war crimes against the civilian population of Ukraine. On Wednesday, for example, Russian troops bombed a maternity hospital in Mariupol as nearly half a million residents in the southern Ukrainian city have been cut off from food, water, medicine and power for days. It could all still get much worse. In several ways. One of them is that the crippled Chernobyl nuclear plant in Ukraine, now in the control of the Russians, has now been cut off from the power grid. Diesel generators are hoped capable of keeping the cooling system for the plant's 20,000 spent fuel rods from melting down entirely...as long as generators can be refueled and kept running.

Yesterday, we discussed a bit how working at home --- as many of us did during the pandemic lockdowns --- can help the war effort against Russia in several ways, if only by tamping down surging oil prices. A new poll from Rupert Murdoch's Wall Street Journal finds a huge majority of Americans, 79%, favor cutting off Russian oil imports, even if it further increases the cost of gas at the pump.

Today, we double down on our call: HELP FIGHT FASCISM! WORK FROM HOME! (For now. If you can. It really could make a difference in several ways!) One of our listeners has some additional thoughts, via email, which we share today along similar lines.

NEXT UP, some good news for Democrats --- and those who support representative democracy --- from the U.S. Supreme Court this week. But that good news on U.S. House redistricting in two critical swing states also served to overshadow some potentially ominous news from the GOP's stolen and packed Court. The good news was that the Justices turned away two Republican challenges to new U.S. House maps selected by two state Supreme Courts in Pennsylvania and North Carolina. Each is likely to benefit Democrats this November. The disturbing, largely overshadowed news, is that the four rightwing Justices who would have preferred to have heard the challenges to the new House maps, made clear in their dissents that they are likely supportive of the bonkers "Independent State Legislature Theory".

In short, that's an old Constitutional argument that's been around for years, but has never received the support of a majority of Justices. It holds that two clauses in the U.S. Constitution delegating the "time, place and manner" of elections to state legislatures means that only state legislatures can set any election law, procedures or district map. That means that any other state officials --- Secretaries of State, state Boards of Elections, Governors through their veto pens, or even state courts --- have absolutely no authority to challenge or change any election-related provision adopted by a state legislature. Under this theory, even state Constitutional amendments adopted by a vote of the people would be deemed unconstitutional!

As noted, it's a bonkers theory. But it's one that now apparently has at least four votes in support on the Republican Party's far-right stolen majority. The dissenting Justices in the redistricting cases made quite clear: this issue will return to the Court soon, and it needs the support of just one more Justice. You have now been warned.

FINALLY, for the past two weeks or so, largely since Russia invaded Ukraine, we've been trying unsuccessfully to get back to a story we were covering closely prior to the war, as its both an important one, and there have been a number of twists and turns in it since over the past several weeks.

As we discussed early last month with John Bonifaz, Constitutional law expert and Free Speech for People (FSFP)'s co-founder and President, voters in North Carolina filed a challenge with the State Board of Elections to first-term MAGA Congressman Madison Cawthorn's eligibility to run for re-election. The challenge is based on their claim that Cawthorn violated Sec. 3 of the 14th Amendment which bars anyone from running for federal office who has taken an oath to defend the Constitution, but subsequently "engaged in insurrection or rebellion" against it. The Civil War-era amendment was initially meant to prevent Confederates from running for federal office. Now it is being used to challenge Cawthorn's eligibility to run and, if successful, others as well, including Donald Trump himself if he becomes a candidate in 2024.

Cawthorn spoke at Trump's rally on January 6th, 2021, just days after being sworn in. He is also said to have been among some of the elected officials who may have helped organize the deadly assault on the Capitol that day, meant to prevent the ratification of Joe Biden's Electoral College victory.

There have been a number of twists and turns in this story in recent weeks. Rather than defend himself before the State Board, Cawthorn filed a federal lawsuit to block the challenge entirely, absurdly claiming the Board had no right to determine anyone's eligibility to run for office. Both the State Board and the state's Attorney General filed motions rejecting that argument.

As the case worked it's way through federal district court, the State Board of Elections paused the challenge, as the state's U.S. House map was being contested in state court as well. Once the state Supreme Court selected the maps to be used in the 2022 mid-terms, Cawthorn's district had changed. The voters who initially filed the challenge to his eligibility, with the help of the non-partisan, government accountability group, FSFP, were no longer residents of Cawthorn's new district. But FSFP found new voters in Cawthorn's new district to refile the challenge.

And then, last Friday, in a gobsmacking ruling from the bench, the Trump-appointed federal judge overseeing Cawthorn's lawsuit to block the state challenge ruled in his favor. Judge Richard E. Meyers II declared that a law adopted by Congress in the years after the Civil War, the Amnesty Act of 1872, somehow forgave not only Confederate soldiers, but also any insurrectionists against the United States at any time in the future. The judge's ruling essentially holds that an act of Congress 150 years ago --- without ratification by any states --- nullifies an actual Constitutional Amendment for all time.

Yes, as FSFP's Legal Director RON FEIN, who joins us today explains, the ruling is largely as absurd as it sounds. Fein explains why, and what FSFP plans to do about it, including their emergency appeal to Judge Meyers ruling, filed in federal court today...

As the horrors of war continue in Ukraine today, we focus on the latest efforts to counter it by ending --- or trying to --- Russian oil and gas imports to the EU and US, and as we enjoy more accountability for GOP election fraudsters and insurrectionists, including one who funneled Russian money to Donald Trump's 2016 campaign and another who used to appear on The BradCast from time to time. • Fossil fuel profiteer Shell Oil apologizes after getting caught secretly buying cheap Russian oil, even after pretending last week that it was ending its business with the country after their invasion of Ukraine. Does it smell "like Ukrainian blood?," Ukraine's Foreign Minister wonders.

• On Tuesday, after nearly two hellish weeks of unspeakable humanitarian suffering in Ukraine and pressure from the public to do the right thing, several more major American companies --- McDonald's, Starbucks, Coke and Pepsi --- finally decided to "pause" doing business in Russia.

• The European Union, which has made the mistake of becoming reliant on Russia for about 45% of its gas imports, announced plans to try and wean themselves off two-thirds of it by year's end. Hopefully this will help hasten their move to clean, renewable energy.

• President Biden announced today that the U.S. will halt all imports of Russian oil and gas. Hopefully this will help hasten our move to clean, renewable energy.

• Also, both White House Press Secretary Jen Psaki and President Biden pushed back hard against the obnoxiously phony claims by Republicans, Fox "News" and the oil industry that opening up more public land to oil and drilling leases and permits would lower surging U.S. gas prices. As both Psaki and Biden point out, Big Oil is already sitting on some 9,000 currently unused permits on millions of acres of land, as is. The GOP/Fox "News"/Big Oil axis of evil is really hoping that Americans don't know that, so they can blame Biden for the surge in global oil and gas prices...even as new polling finds American majorities are willing to pay more at the pump to help Ukraine and they want to expand renewable energy development, not fossil fuels.

• The International Energy Agency (IAE) has a list of 10 things the EU can do to decrease gas use by at least 10% before year's end. Many of those things the U.S. can do as well. One thing many of us could and should do to lower the cost of gas in a big way during Russia's war on Ukraine --- since many of us already did it for much of the past two and a half years anyway, cleaning the skies and drastically lowering gas prices in the bargain --- WORK AT HOME AGAIN if possible!

• The first January 6th insurrectionist to stand trial before a jury, was found guilty on all five felony counts today. (He's a helluva guy, apparently. Threatened to kill his own teenage children if they told on him. Ya know, as "patriots" do.) The DoJ hopes the result may lead other Trump insurrectionists to plead guilty. We hope it leads the DoJ to keep working their way up to the top of the insurrectionist cabal.

• The leader of the violent rightwing street gang calling itself Proud Boys, Enrique Tarrio --- who wasn't even at the U.S. Capitol on January 6th, 2021 (because he was in police custody on a separate crime) --- was indicted, with several others in his gang of white hoodlums, on conspiracy charges related to their violent, coordinated attack on the Capitol. Tarrio had reportedly met with Oath Keepers leader Stewart Rhodes in a parking garage in the hours before the Republican assault on American democracy. Rhodes and several other Oath Keepers were also recently indicted on seditious conspiracy charges. And Rhodes, like another rightwing hoodlum facing new felony indictments in a separate matter (discussed below), had been a guest on The BradCast several years ago.

• This story is amazing. Jesse Benton, a longtime Republican operative and former campaign manager for Senators Rand Paul (in 2010) and Mitch McConnell (in 2014), has already been pardoned for felony election fraud once, by Donald Trump in the closing days of his Administration. Now Benton has been indicted again, for more election fraud, and along with another former guest on The BradCast! Tune in for the full story, but Benton was originally charged and convicted some years ago for buying away an endorsement for about $75,000 from a Michele Bachmann supporter during the GOP Iowa Caucus in the 2012 Presidential campaign. At the time, he worked for Rand's father Ron Paul's Presidential campaign. Benton was sentenced to two years probation and a $10,000 fine just days before the scheme he has now been indicted for which includes receiving $100,000 from an unnamed Russian national, keeping $75,000 for himself, and giving $25,000 of it to the campaign of "Political Candidate 1" in his own name, an unlawful straw donation to avoid laws barring foreign money in American elections. Benton promised a meeting with "Political Candidate 1" in Philadelphia on September 22, 2016, the day that Donald Trump happened to be holding a fundraiser there. They all took pictures together, according to the September indictment unsealed on Monday, along with Doug Wead, a GOP Presidential historian and, in recent years, far-right operative who appeared a number of times on this program some years ago. Wead, a Senior Advisor to Ron Paul's 2012 campaign was indicted as a co-conspirator with Benton. They both face the potential of a lot of time in prison. Each of the six counts charged against both of them carries sentencing of 5 to 20 years. But, yup, more Russian money in Donald Trump's 2016 election. Who could have guessed it?

• Finally, Desi Doyen joins us for our latest Green News Report, in which we can barely keep up with Russia/Ukraine related events in the energy industry (including nuclear) and as the U.N. offers some good news for a change, in this case regarding global plastic pollution.

• Ukraine declaring neutrality (not unlike Austria or Finland after WWII), and that they they will not join NATO or any other military bloc (including Russia's!), while "demilitarizing" offensively, but retaining defensive-only military capability.
• Recognizing Crimea as part of the Russian Federation and allow some form of independence for the Russia-backed separatist regions in the Donbas in the eastern part of the nation. All three territories would then hold internationally observed referenda on who they would like to align with. (This would also likely include revisiting the Minsk II agreement that was brokered in 2015, leading to a a cease-fire in the Donbas region, even as Ukraine has been disinclined to move ahead with the negotiated terms of that agreement, thanks, in part, to opposition from ultra-nationalist factions in its country.)

Lieven's roadmap shares the broad contours --- if not every detail and critical nuance --- with the conditions for cease-fire the Kremlin reportedly putting forward before today's peace talks with Ukraine. That's good news. Or, at least we are choosing to see as such today.

The two parties had their third round of such talks on Monday, with hopes of first reaching an agreement on a temporary cease-fire to allow for humanitarian corridors so citizens can leave besieged cities and allow food and medicine to be brought in. Similiar hopes for cease-fires over the weekend were dashed after just a few hours. Both sides blame the other.

But, even as they struggle to create humanitarian corridors, Ukraine has reportedly agreed to Russia's condition of dropping hopes of joining NATO. But Russia, reportedly, is insisting that all conditions for a treaty be met before they end their lawless aggression. This could take a while --- even as both parties have good reason at this time to find their way to peace as quickly as possible.

We open the phones today to listeners to discuss peace, and whether Ukraine should take such a deal; whether Putin can be trusted to keep it (or whether his interests in reconstituting the Soviet Union or an even more expansive Greater Russian empire would see him continue his march of military aggression); and whether accepting such terms would be the equivalent of rewarding Putin's bad behavior (and war crimes.)

When Lieven opened his article last week on a potential path to peace in Ukraine, he used a quote from Robert Lovett, U.S. Defense Secretary for several years in the early 50s, declaring: "Forget the cheese --- let's get out of the trap." That argument has been cycling through my brain ever since.
