We've got a few explainers on today's BradCast. But I thought you might find it useful to be armed with some facts, truth and understanding right about now. [Audio link to full show follows this summary.]

Among our explainer coverage today...

  • Not long after we got off air today, Democratic Senate Minority Leader Chuck Schumer signaled he would allow Donald Trump and Congressional Republicans to adopt a bad six-month spending bill rather than fight them, because that fight would results in a government shutdown as of midnight on Friday. It's certainly a dilemma for the Dems, many of whom seemed to come around to the decision to fight rather than fold today. Even the nation's largest federal workers union --- whose members would arguably be first and most directly effected by a shutdown --- persuasively called on Dems to do just that, arguing: "With thousands of federal workers either fired, placed on administrative leave, or at immediate risk of losing their jobs, AFGE members have concluded that a widespread government shutdown has been underway since January 20 and will continue to spread whether senators vote yes or no on H.R. 1968." Schumer's announcement that he will vote with Republicans to end debate on the Continuing Resolution Friday, suggests the GOP is likely to get the support of at least eight Democrats Senators that will be needed to overcome a filibuster tomorrow. But, we'll see if a few more Dems find the spine to stand up against Trump and stand up for Americans before then.
  • Speaking of AFGE, they and a few other unions won a big victory today. They had sued the federal government to restore the jobs of thousands of "probationary" federal workers unlawfully fired by the Trump Administration. Today, a federal judge ordered those workers, at the Departments of Veterans Affairs, Agriculture, Defense, Energy, Interior and Treasury to be rehired "immediately". U.S. District Judge William Alsup excoriated the Trump Justice Department's legal justification for the layoffs and their refusal to present evidence to support their case. "It is a sad day when our government would fire some good employee and say it was based on performance when they know good and well that’s a lie," railed Judge Alsup from the bench. "That should not have been done in our country. It was a sham in order to try to avoid statutory requirements."
  • Yesterday, you may have seen headlines about Trump's EPA chief Lee Zeldin declaring a rollback of more than 30 important health, safety and environmental regulations. (Eg: "Trump takes an ax to more than a dozen pollution rules in rapid-fire deregulation".) In fact, none of those regulations have actually been rolled back. Yet. "Today I'm pleased to make the largest deregulatory announcement in U.S. history," the new EPA Administrator dramatically declared in a two-minute video filled with one lie after another, falsely describing "suffocating rules that restrict nearly every sector of our economy and cost Americans trillions of dollars." The video was released to accompany Zeldin's Wednesday essay in the Wall Street Journal offering more false and misleading details on those lies.

    Today, we step through the key lies, explain the truth about them, and what Zeldin's announcement really amounts to. No, there is no "EV mandate" and the U.S. is already "energy dominant" as it was when Trump took office after America long ago became the world's leading producer of oil, gas, coal and renewable energy under President Biden, who also adopted a number of landmark climate initiatives that increased manufacturing, boosted the economy, produced clean energy and made America safer for everyone.

    It will be a long and difficult path for Trump's EPA to overturn dozens of health and safety rules long in place, as well as the agency's landmark 2009 scientific "endangerment finding" on the adverse health effects of planet warming carbon pollution on which a number of those regulations, adopted under the Clean Air Act, are based.

    Bottom line: the Trump Administration plan, as detailed by Zeldin, will increase pollution, worsen the climate crisis, allow more deadly cancer-causing toxins into our air and water, and force Americans to pay the bill for all of it through what Desi Doyen describes as a "pollution tax". You may support Zeldin and Trump's scheme to do all of those things, but let's be clear about what their announcement yesterday is calling for.

    The fossil fuel industry --- already the most profitable industry in the history of civilization --- immediately declared their support for the effort. Few others have done so and many have vowed to challenge it in court. Now it's up to all of us to fight against these unpopular plans. On today's BradCast: What's in it for Donald Trump? Seriously. Why does he want to break the government? [Audio link to full show follows this summary.]

I know why Elon Musk wants to dismantle and destroy the federal government piece-by-piece (so his government contracts can't be policed or businesses regulated, etc.) And I understand Trump's need for retribution against his perceived enemies. But why does Trump want to seemingly dismantle damn near every federal agency, from the U.S. Forest Service to USAID and beyond, no matter how ham-handedly? No matter how much it grows (not shrinks) the national debt, no matter how many Americans (including his own voters) it puts out of work, and no matter how much the chaos he is wreaking continues to sink his approval ratings? No matter how much none of his flailing lowers the price of eggs.

It's certainly not in the name of "efficiency" or cutting "waste, fraud and abuse", as the evidence makes plain, no matter how many lies and quickly disproven claims about "million and millions" of dead people receiving Social Security checks or Musk's DOGE Bros claiming to have "saved" at least $55 billion in Government contracts to date. (It's more like $2 billion.) All false claims that both Trump and Musk repeat, only to have to walk them back when proven wrong, time and again.

We discuss a lot of that at the top of the show, along with a bunch of related news headlines from over the weekend, before opening up the phones today to listeners for answers to that simple question: What's in it for Donald Trump? Why does he really want to dismantle the government?

We talk to a lot of callers with a lot of differing explanations (though being controlled by Vladimir Putin seems to be a listener fave...even if it doesn't fully answer all of my questions about Trump's behavior here.)

Perhaps Trump's recently-confirmed Sec. of the Treasury, Scott Bessent, gave away the truth on Fox "News" over the weekend, when he falsely claimed that Trump ran on "reprivatizing the economy". He didn't run on that. Though Project 2025 --- which he pretended to disavow during the campaign --- certainly called for it. Is that his game? Cripple federal government so private corporations can then fill the gap and offer the same services to the American people for a higher price that includes profit to those private corporations?

Indiscriminate mass firings, critical services endangered, laws violated, as even senior Trump-appointed 'acting' officials resign in protest...

Incredibly, many Trump-supporting MAGA dupes still believe any of this is being done in the name cutting government "waste, fraud and abuse" --- much less "efficiency" in the federal government. As discussed on today's BradCast, I guess there are still millions who won't give a damn about any of it unless --- more likely, until --- it effects them directly. And it will. [Audio link to full show follows below this summary.]

As David Dayen helpfully reported last month at The American Prospect, if you fired every single federal worker in existence --- all 2.3 million of them --- you'd save about $271 billion per year. While that may sound like a lot, it's just 4% of the annual budget. Of course, we'd lose much more in uncollected tax revenue, unprosecuted fraud in the private sector, lives lost, just to name a few big points. And, of course, Americans, such as Social Security recipients would lose a lot on a personal level when there was nobody left in government to send out their monthly checks.

But, as Republicans have been telling us (lying to us about) for decades now, the federal government has just become too bloated. It must be cut down to size, even if it's randomly done through mass firings at every federal agency, of anybody viewed as legally fireable (whether they are or aren't doesn't matter.) But here's another fun fact from Dayen: in 1960, amid the Golden Age of America's middle class, the federal government comprised 4.3% of all workers. Today, that number is just 1.4%.

Other than that, our government is huge, bloated and out of control! Who needs all that air traffic safety, security of nuclear weapons, food inspections, safe drinking water, disease tracking, cancer cures, law and order, disaster response, medical care, education, Social Security checks or life-saving weather reports and climate data? The federal government is just too "big". Let's gut it all! Legally or otherwise!

Until they wised-up and changed the lyrics of the Gilligan's Island theme song at the beginning of Season 2, to also mention "the Professor and Mary Ann", the song originally referred to only those two (of just seven!) castaways as simply "and the rest". While the nation has understandably been focused on Trump and Musk's almost complete shutdown of the U.S. Agency for International Development (USAID) and Elon's DOGE Bros' takeover of the computer payment system at U.S. Treasury that cuts checks for about 95% of payments made by the nation each year (about $6 trillion worth), the shutdowns, pauses and freezes at other critical, if smaller or lesser well-known agencies, has felt a bit like "and the rest." On today's BradCast, we focus on...well, the Professor and Maryanne for a bit...along with the other Castaways as well. [Audio link to full show follows below.]

Tortured TV metaphor aside, we're joined today by award-winning, best-selling investigative journalist and author DAVID DAYEN, Executive Editor of The American Prospect, to discuss a few government agencies that Donald Trump has pretty much completely put out of business for the moment, maybe permanently, and completely unlawfully.

This week, Dayen reported at TAP about Trump's takeover of the Consumer Financial Protection Bureau (CFPB), created in 2011 in response to the Great Recession. It is the only federal agency specifically focused on protecting consumers. It was the brain-child of Elizabeth Warren during the Obama Administration, before she became a U.S. Senator, and it actually holds major banks and other huge corporations financially responsible to the tune of hundreds of millions of dollars for ripping off Americans. No wonder the Republicans have been trying to shut it down since its inception. Now, as we discuss today, it appears they have done so. Unlawfully.

In late November, Elon Musk posted on Twitter/X: "Delete CFPB. There are too many duplicative regulatory agencies." In fact, the CFPB doesn't duplicate the work of any other federal agency. But the small, independent Bureau very well might have made it more difficult for Musk to take advantage of suckers on X with a new payment app he is rolling out.

Trump's newly-minuted U.S. Treasury Secretary Scott Bessent --- who allowed the DOGE Bros into the agency's computer payment system --- is also serving as Acting head of the CFPB. "The first thing Bessent did is he said, 'Put a pause on all litigation, all enforcement, all rule-making, and all communications,'" at CFPB, Dayen explains today. "They've basically turned the agency into a ghost town." Employees there tell him they are still able to do things like examine data and work on reports. But they just can't publish them or act on anything "that can protect consumers in real time."

We also discuss how Trump has effectively shut down the National Labor Relations Board (NLRB) with his unlawful removal of one of its Commissioners (who is now suing). Without her there, the Board which adjudicates union elections, worker rights and investigates labor law violations, no longer has a quorum to do any of that. "So it's a free pass for companies who don't want any consequences for union busting behavior to just continue to do it, appeal everything into a netherworld that half-exists and half-doesn't now," Dayen says.

All of this is illegal, of course. But Trump's captured DoJ certainly isn't going to do anything about it. Will the courts? As you know, SCOTUS has been captured and corrupted as well.

Dayen tells me he is also very concerned about whatever the DOGE Bros are doing inside of the nation's payment system at Treasury. Shortly after my conversation today with him, however, the news broke that Musk's lead Bros inside of Treasury's computer system, 25-year old Marko Elez, had resigned after a series of racist posts were discovered from a Twitter/X account that he deleted in December. If you're wondering if those posts are somehow out-of-context or written years ago, just last July he Tweeted: "Just for the record, I was racist before it was cool." So, yeah.

Also today, we discuss some of the very serious and under-reported concerns regarding the H5N1 bird flu above and beyond what it is doing to spike the price of eggs on grocery store shelves. The virus appears to be both quickly spreading AND mutating. Unfortunately, the Centers for Disease Control and Prevention (CDC) and Dept. of Agriculture (USDA) are also effectively handcuffed by the Trump Administration in what they are allowed to study any communicate to the public about it. Not that Trump that we have reason to worry about Trump's leadership during a deadly pandemic or anything.

Finally, Desi Doyen joins us for our latest Green News Report, with more news on the DOGE Bros' ongoing infiltration and attack on the U.S. Government and our Constitutional order, such as over at the National Oceanic and Atmospheric Administration (NOAA), where they have reportedly now descended, after the disgraced "scientist" who helped facilitate Trump's fake hurricane in Alabama years ago (remember "SharpieGate"?) has now been tapped to run the entire agency. In addition to producing critical climate and data on our oceans, the agency also houses the National Weather Service, which Project 2025 calls for privatizing. Sadly, she has even more today. Though we do close on an amusing note!...

Today on The BradCast': We momentarily take Donald Trump's delusional bait on Gaza, before spitting it out to take on his and Elon Musk's very real, horrifying, unlawful breakdown of the American Constitutional order and all that it means (or used to) around the globe. [Audio link to full show follows below this summary.]

After air last night --- as usual these days --- a number of troubling Trump-related stories broke. Among them, news that the Administration has notified all U.S. Agency for International Development (USAID) workers across the globe that they are immediately off the job and must return to the U.S. within 30 days. Decades-old programs in about 120 countries are now stopped dead in their tracks, including life-saving food for starving children that will now be left at the ports; HIV medicine on shelves that won't be delivered to AIDS victims; hundreds of other programs supporting clean water, independent media, education, including for girls under Taliban rule in Afghanistan; tracking and preventing polio, smallpox, tuberculosis and Ebola outbreaks; and much more.

American foreign aid "soft power" initiatives that foster goodwill around the globe and make up less than one-percent of the annual U.S. budget are apparently all now out of business. Foreign strongmen from Russia to Hungary to Iran to China and beyond are rejoicing today and openly expressing their public thanks to Musk and Trump for doing their bidding.

Also last night, Trump announced during a presser in D.C. with Israeli Prime Minister Benjamin Netanyahu, that the U.S. will relocate (forcibly, I guess?) nearly 2 million Palestinians from Gaza to somewhere or another, "take over the Gaza Strip", raze the entire territory and claim "ownership" of it for the U.S., before filling it with beautiful new seaside resorts, turning it into the "Riviera of the Middle East". What could possibly go wrong?

Here to explain what is definitely wrong about that and so much more today, are two of our favorite BradCast panelists, HEATHER DIGBY PARTON, of Salon and Digby's Hullabaloo blog, and the notorious 'DRIFTGLASS', longtime blogger and co-host of his weekly Professional Left Podcast.

In addition to Trump's delusional "ethnic cleansing" dreams for Gaza, we also discuss how he is "a powerful useful idiot" for Netanyahu and his rightwing allies. But Parton isn't buying the idea that his new scheme is meant to distract from Trump's lawlessness elsewhere. "The idea that he's got some strategy to distract from all the terrible things that Elon Musk is doing, I don't think that's true. I think they've just divided up the work."

"I'd say this is tossing a match onto a pile of oily rags," Driftglass chimes in. "But the fire is already burning. This is adding napalm to napalm. And everybody knows it. I think Trump is narcissistic enough and stupid enough and willing to listen to his real estate friends enough to say, 'Sure, why not?'"

Meanwhile, back on the home front (Fatherland?), where "Elon Musk bought his way into the Treasury [and] bought this 60% share in this President," the richest man in the world is "getting what he paid for," says Driftglass, in personally shutting down one federal agency after another, all unlawfully. But who's gonna stop him? Drifty argues Trump will simply ignore any adverse court rulings that may come down the road, if they come at all. "You can't undo the damage I've done, therefore I win!," he quips, before noting: "Trump is perfectly willing to change his mind on a dime and lie about everything and say 'I never authorized anything.' But it's going to take public outrage in the streets, by the right people." Who are those "right people"? Tune in.

Digby joins me in dismissing Trump's largely toothless Executive Orders but agrees that what Musk is doing is of another order. "The DOGE thing is a genuine constitutional crisis," she warns. "The Republicans have absolutely laid down and said [to Trump], 'Please give me your boots so I can lick them.' So they are completely useless, and that's a big part of the problem. I'm terrified about how far this can go."

Agency insiders, elected Dems, civil suits, public actions coalesce to take on the radical rightwing extremism of Trump, Musk and the DOGE Bros...

Today on The BradCast: The last 4 or 5 days since Elon's DOGE Bros have, with the apparent permission of Trump, started taking command and control of computer systems and databases at federal agencies --- including the U.S. Treasury's system which pay out nearly $6 trillion per year --- have been, to say the least, chaotic, disturbing and insane. [Audio link to full show follows this summary.]

As we discussed yesterday, Trump, his co-Prez and their flunkies are unlawfully taking over and disassembling the U.S. Constitutional order and its Administrative State. In response, however, their lawless overreach also seems to be having the effect of coalesce the Opposition in a number of ways...

  • Career federal agency insiders and whistleblowers are either pushing back against assaults on their agencies or otherwise informing the public of what is happening inside them;
  • Civil lawsuits are being filed by both affected individuals at the agencies and by outside groups attempting to enforce the rule of law, informing the public of what is going on inside those agencies in the bargain.
  • Public pressure is being brought to bear on elected officials through phone calls, attendance at protest rallies, etc.
  • Democratic elected officials seem to be having a fire lit under them by all of this, and are finally beginning to lead rallies and take other actions in their overdue Opposition roles.

That is not an exhaustive list. For example, the free press, where we still have one, also play a key role in all of the above. In helping to let you know what is actually happening, public perception and opinion can change. From a wildly disinformed electorate last November to, perhaps, a more accurately informed populace as we all move forward and take action on those things, with at least some of the urgency that this historic moment demands

An Opposition is emerging. How effective and sustained it will be remains to be seen. But, I believe the outlines are finally beginning to coalesce. At least, I hope that is the case.

Today, we report some of the stories, connect some of the dots, and share some of the signs of that emerging Opposition, through a number of breaking news items over the past 24 hours or so...

  • Disgraced Gen. Michael Flynn's stunning threat against insiders at CIA, FBI and the Office of the Director of National Intelligence who dare speak up against Trump's wildly unqualified nominees for HHS (RFK Jr.), Director of Nat'l Intelligence (Tulsi Gabbard) and FBI Director (Kash Patel).
  • After the Acting FBI Director last week tried to courageously stand up to Trump's personal defense lawyer turned Acting Deputy AG at the DoJ, the Bureau turned over answers to questionnaires from some 5,000 employees who were assigned to work on January 6 cases. The head of the FBI's New York field office vows to defend his agents against the Administration's unlawful purges. The FBI Agents Association advises its members: "Do NOT resign or offer to resign." Lawyers for DoJ prosecutors and FBI agents threaten to sue against "violation of due process rights."
  • Sen. Brian Schatz (D-HI) vows to place a "blanket hold" on all of Trump's nominees to the State Dept. until the Administration pulls back its attack on --- and DOGE Bro takeover of --- USAID.
  • Trump prepares an Executive Order to shut down the Dept. of Education, even though he can't actually do so without approval by Congress, which he will not receive. Musk's DOGE Bros have reportedly now moved in there as well, and are said to be scheming to cut spending and staff while accessing sensitive computers systems with personal information on millions of students who have received financial aid.
  • Federal employee unions and advocates for retired Americans sue to block Musk's DOGE Bro takeover of the U.S. Treasury Department's payment system. And who is it who has gained access to the incredibly sensitive computers that handle payments of some $6 trillion, annually, in Social Security checks, Medicare payments, veterans benefits, tax refunds, federal worker paychecks and almost everything else the U.S. pays for? Apparently, it's a 25-year old employee of Musk's named Marko Elez who has remarkably been allowed to obtain full access and Administrative privileges to the system, to cut off payments, and even rewrite the incredibly sensitive and (previously) highly-guarded code that handles some 95% of spending by the U.S. Department insiders are flabbergasted and speaking to the press about what is going on.

All of these stories, as terrible as they are, actually include positive indications of an overdue Opposition finally beginning to assemble.

With apologies to Rick Wilson, whose weekend social media quip I've stolen for the headline of today's BradCast, I'd say both things are true. We are both overwhelmed and under attack. In a way that the United States has never been under attack before. [Audio link to full show follows below this summary.]

The "attack", of course, is coming from inside the house. In this case, from inside Donald Trump's White House. Or, at least from his extra-Constitutional White House henchmen: Elon Musk and his band of personal employees, none of who have been elected to anything or approved by the U.S. Senate or anything else. And yet, this band of miscreants that call themselves the "Dept. of Government Efficiency" or DOGE, some just literally out of high school, are unlawfully taking over the command and control functions of independent federal agencies in the Executive Branch, including the one that at Treasury that controls the nation's actual checkbook and its payments of more than $6 trillion each year. That system includes checks to federal workers, Social Security and Medicare payments, tax refunds, foreign aid and much much more.

They are doing all of this, apparently, with the lawless President's blessing. It is a Trump-approved attack on the rule of law, our Constitutional order, and, of course (the enemy of all MAGA!) the "Administrative State".

Doing my best today to overcome some local transmitter issues here in L.A. and technical issues inside our flagship local KPFK studios during our live show, I tried to put into stark perspective what appears to be unfolding --- what we know and what we don't, some of the heroes standing up in opposition --- over the past 72 or so unprecedented hours since we last spoke.

Here are just some of the media reports I was culling from. You'll have to tune in to hear how all the pieces fit together, what they portend moving forward, and for a quick listener call or two at the end...

Guest: Author, financial journalist David Dayen of The American Prospect; Also: Final U.S. House seat called in CA, flips from 'red' to 'blue'; '2000 Mules' filmmaker apologizes for film's fraudulent 'fraud' claims...

As detailed on today's BradCast, the avenues for massive corruption by the incoming Trump Administration are, shamefully, only beginning to come into view. The fact that our corporate media so utterly failed to make such possibilities clear --- or even to simply explain to the electorate what tariffs actually are and how they actually work --- is just one more indictment that we will spend decades paying the price for. [Audio link to full show follows this summary.]

FIRST UP... The final uncalled seat for the U.S. House in the next Congress, following the November 5th election, has finally been called. Republican Rep. John Duarte conceded on Tuesday night to Democrat Adam Gray in California's 13th Congressional district. It was the closest race in the House this year. As of air time, just 187 votes separate the two out of more than 210,000 cast, as Dems flipped a third seat in the Golden State this year. That leaves Republicans with one of the slimmest House majorities in history, holding just 220 seats to Dems' 215. That said, with the resignation of Matt Gaetz, and two other GOP members set to step down if confirmed to be in Trump's cabinet, the margin for passage of any of his legislative agenda may be in question in the lower chamber in the early part of next year. Just one or two defectors, or members who are out sick, could make it impossible for Republicans to get anything through the House.

THEN... We've debunked the long-ago, many times discredited 2000 Mules film --- supposedly documenting massive fraud by Democrats to steal the 2020 election from Donald Trump --- over and over again in the past several years. Both state and federal law enforcement authorities have done so as well. Even the publisher and distributor of the documentary film and its companion book have pulled both from distribution and offered an apology. This week, so did the fraudulent film's director and rightwing pundit Dinesh D'Souza. He issued an apology to one of the people seen on surveillance video in the film, which claimed the man was committing a "crime" by depositing "fraudulent votes" into a drop-box near Atlanta in 2020. In fact, the man was dropping off his own ballot, his wife's and those of his adult children who lived with him --- all perfectly legal in Georgia. In his apology, D'Souza (who was pardoned for his own ACTUAL election fraud crimes by Trump!) appears to blame his partners on the film, a long-ago discredited GOP "voter fraud" fraudster group called True the Vote, for misleading him about the footage they supplied for his use in the film.

FINALLY... Donald Trump has been vowing for the past year or more on the campaign trail to institute massive trade tariffs on foreign nations of anywhere from 10% to 1000% depending on his mood on any given day at any given event. He has also, for years, been lying to the American public about tariffs, claiming they are paid by the nation whose products are taxed upon import into the U.S. In fact, as our guest today explains, they are almost always paid by the consumer in some fashion and are likely to inflate prices to boot.

We're joined today by DAVID DAYEN, investigative financial journalist, award-winning author and Executive Editor of The American Prospect magazine. He offers both a primer on how tariffs actually work (and/or don't), and how Trump plans to use them to muscle concessions and favors from other nations, beginning with Mexico, Canada and China, our three largest trading partners from whom we import some $1 trillion worth of goods each year.

"The heyday of tariffs was the 1890s," Dayen explains. "But the way that Trump is going about it, you've got to think of these tariffs as more like economic sanctions." Sanctions that could come back to bite the U.S. via a trade war if those nations decide to slap their own tariffs on our goods in return.

Trump has claimed that his recently promised 25% tariffs on Mexico and Canada, and new tariffs of 10% on goods from China are meant to stop the "invasion" of migrants and drugs into the U.S. But that explanation, charges Dayen, is dubious at best. They are more likely intended as "simply leverage" in advance of renegotiations of the USMCA, the slightly modified replacement for the NAFTA trade treaty that was struck between U.S., Mexico and Canada during Trump's first term.

But, as Dayen reported at The Prospect last week, "there's a second piece to Trump's tariff strategy" that involves corporate importers and exporters, rather than nations. That, as he explains today, is where Trump's ability to give away tariff waivers is set to be a wildly lucrative scheme that will open the door to perhaps unprecedented corruption and payoffs from corporate interests hoping to avoid the economic pain of tariffed goods.

In his explanation, Dayen cites the famous "Cantillon Effect" which "comes down to whoever is closer to power is going to have better success in business." And now, between Trump's hotels and publicly-traded social media company and, perhaps most disturbingly, his new cryptocurrency venture --- (which a Chinese entrepreneur currently under SEC investigation for fraud, market manipulation and other violations of U.S. law just dropped $30 million into, three weeks after the election) --- it is going to be open season to buy favors and favoritism galore from the new President.

"This is what oligarchies look like," says Dayen. "This is what Russia looks like. If you're closer to the king, you're going to do better. The next four years are going to reflect this tendency."

And, yes, as he argues today, "the mind boggles at the potential for corruption"...

Former Prez pleads 'not guilty' in election theft conspiracy; Also: U.S. credit rating cut thanks to 'fiscal conservatives'; WI GOP threaten 2024 election administration; MI GOP A.G. nominee charged with vote machine tampering; Willis threatened, but 'ready to go' in GA...

Ten years ago, a BradCast like today's would have been unimaginable. Today, it's just our latest BradCast. [Audio link to full show follows below this summary.]

Among our many stories covered (some of which we've been trying to get to all week but for all the breaking news that kept bumping them!)...

  • The former President of the United States pleaded "not guilty" to felony crimes in his third arraignment in four months. This one at the federal courthouse in D.C., on four alleged charges [PDF] brought by Special Counsel Jack Smith related to Donald J. Trump's failed conspiracies to steal the 2020 Presidential election before, during and after his January 6, 2021 insurrection. Defendant Trump was reportedly warned by the magistrate judge overseeing his arraignment about committing more crimes, tampering with jurors or communicating with co-conspirators while he was freed pending trial.
  • Congressional Republicans still pretend they are "fiscal conservatives". Shamefully, the media still allows them to do so. But their brand of "fiscal conservatism" is, once again, costing the Government and American people untold billions. This week, the Fitch Rating service downgraded the U.S. credit rating from top tier AAA to AA+, citing principally the GOP's recent brinkmanship threatening to allow the U.S. government to default on its debts for the first time in history, and even due to the January 6, 2021 attack on the U.S. Capitol. The newly lowered credit rating led the stock market to dive in response, is already increasing the cost of government borrowing and mortgage rates for homeowners.
  • On Tuesday, the state Supreme Court in Wisconsin officially flipped to a liberal majority for the first time in about 15 years after the election of Milwaukee Judge Janet Protasiewicz to the high court back in early April. The new era in the critical Presidential battleground state comes not a moment too soon, as Republicans in the gerrymandered state Senate are attempting to oust Elections Administrator Meagan Wolfe from the state's Election Commission after unanimously appointing her four years ago. When Trump lost the state in 2020, state Republicans decided the experienced administrator who has successfully overseen thousands of state election jurisdictions and is well-respected by clerks and experts of all parties, had cheated --- or didn't cheat enough --- or something. And now, amusingly, Democrats on the Election Commission are citing a ridiculous, 4 to 3 opinion by the state Supremes from last year, when the court had a rightwing majority, which allowed agency heads to remain in place after their term had ended. (The ruling was meant to support a sleazy GOP scheme to prevent Democratic Gov. Tony Evers from being able to appoint his own nominees to state agencies.) The 2024 election in the critical battleground state now hangs in the balance and may --- or may not --- as Bolt's Cameron Joseph reports, lead the Court's liberals to change their position on the issue when this matter, almost certainly, makes it's way to the newly liberal high court.
  • Michigan's failed 2022 Republican candidate for Attorney General, Matt DePerno, was indicted this week along with a former GOP State Rep. on state charges related to accessing and tampering with voting systems. The Trump-endorsed Matt DePerno was a 2020 election denier already under investigation for the alleged crimes when he was nominated by his party to become the state's top law enforcement official last year. State Attorney General Dana Nessell then referred the probe to a Special Prosecutor who brought charges this week against DePerno, former State Rep. Daire Rendon and, as we've learned since getting off air, GOP attorney and Trump ally Stefanie Lambert. The Special Prosecutor, D.J. Hilson, suggests more charges are likely coming as part of a scheme by the MAGA Republicans to take voting system tabulators from several counties in order to "test" them for...something or other. Lambert and four others targeted by the probe, also participated in the breach of sensitive voting system hardware and software in Coffee County, Georgia, a story which we broke on this show last year and have been covering in detail ever since.
  • Speaking of Georgia, election deniers, voting system breaches and GOP attempts to steal the 2020 election, Fulton County District Attorney Fani Willis, over the weekend, said she is "ready to go". She made the remarks to a local news outlet, suggesting she will be bringing indictments in her broad conspiracy probe of Team Trump's failed attempt to steal the Peach State's 2020 election "before September the first of 2023". Willis recently warned County officials to "stay alert" and keep staffers "safe" as barricades have now been erected around the County Courthouse in anticipation of new indictments. In her warning to County Commissioners, she shared a sample of the appalling, racist threats her office has received recently. All signs suggest that Trump --- and perhaps many others --- are about to be indicted in her probe. It would be Trump's fourth such criminal indictment in the past four months. We told you long ago accountability would be coming. Now, it finally is. Bigly!
  • Finally, Desi Doyen joins us for our latest Green News Report, with a climate in crisis that couldn't care less about politics. A new study finds that man-made climate change is getting very costly for small businesses; record high temps are, ironically, forcing the shut down of oil refineries and raising gas prices in the bargain (neat trick, eh?); and, speaking of Georgia, the state has finally opened the nation's first new nuclear plant in decades. It is already costing state ratepayers a lot more money...

At some point, the President is just gonna have to do the right thing and stop playing footsie with disingenuous, bad faith Republicans who are holding the nation's economy hostage over the unconstitutional debt limit law. Also, the Democratic Governor in Arizona has some splainin' to do on today's BradCast. [Audio link to full show follows below this summary.]

After a bit of breaking news at the top of the show (regarding a breakthrough agreement on water sharing between Western states on the drought-stricken Colorado River, and E. Jean Carroll suing Trump yet again for defaming her yet again), it's onto the dangerous negotiations still taking place, for some reason, between the White House and House Speaker Kevin McCarthy over whether or not the U.S. will follow the law and pay its bills or go into default for the first time in the nation's history.

We're joined today by investigative financial journalist, author and Executive Editor of The American Prospect, DAVID DAYEN. He has been reporting on a lawsuit recently filed by the National Association of Government Employees (NAGE) against President Biden and Treasury Secretary Janet Yellen, charging that they are already violating the law by "suspending investments into...employee retirement plans" as part of Yellen's so-called "extraordinary measures" to avoid hitting the arbitrary borrowing limit implemented by Congress. She has said that those measure will run out as early as June 1, before the U.S. won't be able to pay all of its bills without borrowing more money. "There is active and ongoing harm which will get worse if the ceiling is hit," the NAGE suit alleges.

At the same time, as listeners may know, we've been covering the text of Section 4 of the 14th Amendment which states in clear language: "The validity of the public debt of the United States, authorized by law, including debts ... shall not be questioned." While Biden has made clear he is aware of the Constitutional option, he has said (not necessarily correctly) that invoking the 14th Amendment to follow the law by ordering the Treasury Department to continue borrowing to keep paying all of our bills would have to be litigated. That, he suggests, would take too much time to be adjudicated in court in order to avoid an upcoming debt default. Thus, he has been negotiating with McCarthy to find an agreement that McCarthy, as Dayen points out today, is unlikely to be able to even get his own caucus to agree to vote for.

With all of that in mind, and NAGE having filed for an emergency injunction in their lawsuit late last week, Biden and Yellen now have until June 6 to respond to the suit. Dayen points out, in both his X-DATE newsletter today and on our program, that Biden/Yellen merely need to respond to the suit by saying they agree with the plaintiffs suing them. The federal judge will then have no choice but to find in favor of NAGE, ruling that the President cannot pick and choose which bills will or won't be paid and that the 14th Amendment likely makes the Debt Ceiling law unconstitutional.

Problem solved! At least if Biden and the White House finally take this golden opportunity that has been handed to them. Sure, there are some nuances, as we discuss with Dayen, but, in general, Biden could use this to end the standoff in short order, before a global financial catastrophe --- which will only increase the U.S. deficit that Republicans in the House are only now pretending to give a damn about --- comes crashing down as early as next week.

"Here's your chance, Joe," says Dayen. "You have to write a response in this active litigation, and what you can say is 'I agree, and I am not going to contest this lawsuit.'" Once the judge receives that, Dayen explains, he'll have to say, "'Okay, I've got two sides in this lawsuit. One side says the debt ceiling is unconstitutional, and the other says it, too.' Presumably, the outcome, the ruling, would be that the debt ceiling is unconstitutional. Who would appeal it? There are two parties in this case, and neither are House Republicans."

ALSO TODAY: Last week on the show we spoke with Arizona's former Republican Secretary of State, now state Senator Ken Bennett, about a bipartisan bill passed out of the state's legislature last week to greatly improve election oversight, transparency and security by making digital ballot images of every ballot cast available for anyone to download and count for themselves in their own home if they wish. (A ballot image is a digital photo of each ballot that is taken as the ballot is scanned by the computer tabulators. It shows exactly how the voter voted at the time the ballot was cast and counted.)

The landmark measure, HB2560 --- which would make it much more difficult for the MAGA right to falsely claim elections are stolen --- was sponsored by Bennett in the AZ legislature and supported by the state's current Democratic Sec. of State Adrian Fontes as well. Thus, last week, when we spoke with Bennett, his hope was that the state's new Democratic Governor (and former Democratic Sec. of State) Katie Hobbs would sign the landmark transparency measure this week.

Instead, just before airtime, Hobbs vetoed the bill, falsely claiming it would "threaten anonymity" of voters and "open the door to the spread of additional election mis- and dis-information."

As Bennett explained last week on the show, he strongly disagrees. So does the nonpartisan election transparency group, AUDIT USA, headed up by longtime Democrat and ballot image proponent, John Brakey. They issued a statement responding to Hobbs' veto, calling it "a blow to efforts to reduce election conspiracies."

They charge the measure would "achieve just the opposite" of spreading "mis- and dis-information." In the statement, Brakey said that "By claiming the bill would compromise the privacy and anonymity of voters and lead to the increased spread of disinformation, the Governor has ignored the experience of multiple jurisdictions around the country that have been posting ballot images without the problems she claims would be caused."

The group is now hoping to win the one more vote in the state Senate and 9 more votes in the state House that will be needed to override Hobbs' veto. They will have about 21 days after they come back into session in mid-June. Stay tuned...

Is President Biden falling into a dangerous GOP trap by negotiating the debt ceiling? Our guest on today's BradCast argues that a potential disaster could and should easily be avoided entirely.

BUT FIRST, while we covered the grotesque lawsuit filed by Noelle Dunphy detailing sexual abuse by the repulsive, alleged sexual predator Rudy Giuliani on yesterday's show, I had the chance to read the full 70-page complaint [PDF] this morning. And I discovered one paragraph that I hadn't yet seen reported elsewhere and just want to make sure it gets out there.

Paragraph 124 on page 23 details how Trump and Giuliani, according to Dunphy, already had worked out plans by early 2019 to claim phony "voter fraud" and that the election was stolen, if the then-President turned out to be the loser in 2020.

"On February 7, 2019," the suit alleges, "Giuliani told Ms. Dunphy...about a plan that had been prepared for if Trump lost the 2020 election. Specifically, Giuliani told Ms. Dunphy that Trump's team would claim that there was 'voter fraud' and that Trump had actually won the election."

Just wanted to make sure that gets out there today.

NEXT UP, we cover the reported results of a number of key state and local elections held on Tuesday, with overall very good results for Democrats (again) and some embarrassment for Florida Governor and hapless GOP Presidential hopeful Ron DeSantis. In an upset victory, voters in Jacksonville --- long the most populous city in the nation with a Republican Mayor --- chose Democrat Donna Deegan to take over. A Republican has served as Mayor there for all but 4 of the past 30 years. Now, it will be run by both a Dem and the city's first-ever female chief executive. That, after DeSantis endorsed her Republican opponent.

That wasn't the only embarrassment for Meatball Ron on Tuesday. In Kentucky, for some reason, he endorsed Trump's former U.N. ambassador at the last minute in the GOP primary for Governor. She came in third by more than 30 points. Trump's choice, Mitch McConnell protege and the state's first Black Attorney General, Daniel Cameron, will run against the popular incumbent Democratic Governor Andy Beshear this November. So, ol' Ron was 0 for 2 on the night, even if the candidate he endorsed in KY was a GOP megadonor that he hopes, I suspect, will want to return the favor by supporting a loser herself next year.

In Philadelphia, moderate Democrat Cherelle Parker emerged victorious from a group of five front-runners, defeating a more progressive Dem to win the primary. The win almost ensures Parker will become the City of Brotherly Love's 100th Mayor this fall, and the very first female, after 99 dudes in a row, to hold the position in the nation's 5th most populous city.

Dems also held on to the majority in Pennsylvania's state House, after narrowly taking it over, by one seat, for the first time in a dozen years in February. On Tuesday, the Democratic candidate won a seat in the state House recently vacated by a Dem accused of sexual harassment. In PA, the House sets the agenda for the entire state legislature, where Republicans still control the Senate.

And, Republicans may have dodged a bullet on Tuesday in the Keystone State when the only judge in the nation to rule in favor of blocking certification of the 2020 Presidential race lost the GOP primary to a not-insane Republican who will run against a Dem this fall for a recently vacated seat on the state's Supreme Court. No matter what happens in the general election, Democrats will retain a majority on the court in the critical battleground state.

FINALLY, an ever-optimistic President Biden on Wednesday announced that he will cut his planned overseas trip short to return to Washington on Sunday to finish what he believes is a possible deal to prevent the GOP from forcing the federal government into defaulting on our debts for the first time in history. We'll see if he's right about that. The Treasury Department warns that, without Congress raising the debt ceiling, we'll hit the dumb statutory debt limit as early as June 1, barring Treasury from borrowing more money to pay the bills for stuff that Congress and Presidents of both parties have already committed to paying for. Economic calamity would likely ensue in the U.S. and even across the globe if that happens.

But is it even necessary to play along with far-right Republicans hell-bent on holding the nation and world economy hostage to their pretend concerns about spending and debt? A number of Constitutional law experts, including Harvard's well-respected Laurence Tribe, argue that it is not. That the 14th Amendment makes clear: "The validity of the public debt of the United States, authorized by law, including debts ... shall not be questioned."

We're joined today by BRAD BLOG's longtime legal analyst, ERNEST A. CANNING, who agrees with Tribe and his argument that, in fact, there is no one who actually has the legal standing to sue the Biden Administration if he simply instructs Treasury to keep paying the nation's bills, as required by law, whether Congress raises the debt ceiling or not. Canning recently wrote an article explaining how a simple Executive Order from the President would do the trick.

But wouldn't litigating over the matter --- even the act of determining if, say, the GOP House had standing to sue --- still end up crashing the markets? Canning explains why he believes that will not happen and why Biden's concerns about invoking the 14th Amendment are unwarranted.

President Biden has, at his disposal, a simple, yet elegant solution to the Republican-manufactured debt ceiling crisis/hostage-taking effort.

On a legal level, as Harvard's Constitutional law expert, Laurence Tribe, points out, Biden can avert an unprecedented and catastrophic U.S. Government default on its Congressionally-created debt by invoking a critical provision of the U.S. Constitution to order the Government to continue borrowing as needed in order to pay for spending that has already been incurred. On a practical level, he could do so by issuing a simple Executive Order directing Treasury Secretary Janet Yellen to honor the nation's debt, irrespective of whether or not Congress passes a bill to increase the debt ceiling.

The President and his administration, Tribe contends, are required to make Congressionally-mandated payments, even if doing so requires borrowing sums beyond the existing statutory limit.

In a recent New York Times Op-Ed, Tribe joined others who have long argued that Section 4 of the 14th Amendment provides that "the 'validity' of the public debt 'shall not be questioned' --- ever!" He spelled out, in no uncertain terms, that, "after passing the spending that created these debts in the first place", Congress does not have the power to "invoke an arbitrary dollar limit to force the president...to do its bidding."

In the editorial, Tribe advised the President to remind Congress that he's "bound" by his Oath of Office "to prevent the country from defaulting on its debts."

In response to Tribe's advice, Biden, mentioning him by name, said he'd "been considering the 14th Amendment...but the problem would have to be litigated." He added: "In the meantime, without an extension, it would still end up in the same place."

Biden may have misunderstood the ramifications of Professor Tribe's analysis...

On today's BradCast: It's official. Our former President has now been found liable by a federal jury for sexual assault. And, it's not a matter of partisanship, but a matter of facts and evidence. The Republican Party has now clearly become a Party of Terrorism in these United States. [Audio link to full show follows this summary.]

Among the stories backing up those assertions on today's program...

  • A federal jury in New York on Tuesday, after no more than three hours of deliberation, found Donald J. Trump to liable for sexual abuse and defamation against magazine writer E. Jean Carroll after what she described as a rape in a New York department store in the 1990s. The jury in the civil case ordered Trump to pay some $5 million in damages to Carroll, even as he continued to lie about her both before and after the jury's unanimous decision.
  • Nations around the world are now warning their citizens to take precautions when traveling to the U.S. due to all the terrorism, specifically the gun-violence by domestic-terrorists which the Republican Party refuses to do anything about. Instead, like Texas Governor Greg Abbott --- who has presided over an untold number of mass murders carried out with AR-15 and similar weapons in his state during his three terms as Governor --- they are pretending (again) that the real issue isn't the easy availability of weapons of war, but "mental health". And yet, at the same time, Republicans like Abbott have slashed hundreds of millions of dollars from, you guessed it, mental health care, even while working hard to both take health care away from folks who need it entirely and make it easier for those with and without mental health issues to buy still more high-powered, military-style weapons.
  • We now know the identities of the 8 killed in the weekend mass murder at the Allen, Texas outlet mall, allegedly carried out by a neo-Nazi who echoed many ideas expressed by Republicans in his social media postings. One Korean American six-year old became an orphan during the weekend rampage as his mother, father and younger brother were all killed in the shooting. Two sisters in grade school were also murdered at the same time, along with a mall security guard and several others.
  • Over the same weekend, a 14-year old girl, miraculously, wasn't killed in Louisiana, even though she was shot in the head by a man who saw shadows outside of his house and started shooting at them. The shadows were of neighborhood children playing hide and seek. But, at least the 58-year old man bravely "stood his ground" against the "threat". Yet another victory for the Republican Party of Terror.
  • All of that as the Dept. of Justice Sentencing Memo we discussed on yesterday's program, "throwing the book" at the rightwing, Trump-supporting militia group Oath Keepers for their seditious conspiracy on January 6th at the U.S. Capitol, included a request for increased penalties for "terrorism" in the addition to the charges for which the conspirators were previously found guilty.
  • If being the Party of Terror by Murder and Terror by Insurrection wasn't enough for today's Republicans, they are now working on adding the Party of Economic Terror to their list of accomplishments. With the "X-Date" now looming for when the U.S. Government runs out of borrowing authority to pay its bills --- including payments for decades of stuff mandated by Congress and Presidents of both parties --- the U.S. is facing the real possibility of default for the first time in its history. That's because House Republicans are, so far, refusing to simply vote to raise or ignore the dumb debt ceiling law unless the White House agrees to cut billions of dollars in spending on food assistance, health care (including for veterans) and much more. If the U.S. defaults on its debts and its ability to pay interest on loans, social security checks and salaries to the military (and much, much more), we could see a financial calamity in world markets and economies as early as June 1, according to the Treasury Department.

    If Republicans shoot the proverbial hostage this time around, the Biden Administration is reportedly considering invoking Section 4 of the 14th Amendment, the text of which states clearly, in pertinent part: "The validity of the public debt of the United States, authorized by law, including debts incurred ...shall not be questioned."

    Under this theory, the Treasury Department would simply continue to borrow, as needed, in order to pay bills already incurred, even if Republicans refuse to lift the Debt Limit. Remember, the Executive Branch is required, by law, to pay bills that Congress already mandated be paid. If the Government runs out of money and can't pay its bills, it would be in violation of myriad laws. On the other hand, if Treasury borrows money to pay our bills without the Debt Ceiling limit being raised by Congress, it would also be violating the law, albeit only that one, dumb one and, arguably, the U.S. Constitution. Harvard Law professor Laurence Tribe explains all of this in a weekend op-ed at the New York Times in which he details his reasons for having changed his mind about the debt limit.

  • But, as Simon Rosenberg observed over the weekend, "If there was a terror org operating inside the US, how would it look any different then what we're seeing," from today's Republican Party? Good question, Simon. If al-Qaeda or ISIS had helped people obtain weapons to kill thousands of Americans, attempted to overthrow the U.S. Government in an insurrection and threatened to crash the U.S. and world economies, I suspect we'd have been in an actual shooting war with them long ago...

Time is running out on today's BradCast. [Audio link to full show follows this summary.]

Among the many clock-ticking stories covered today...

  • The contract for film and television writers ran out as of midnight last night. Today, 11,500 union members in the Writers Guild of America went on strike. The late-night comedy shows have already been shut down and, sadly, Americans are likely to be less well-informed because of it. We explain.
  • The deadline for how long Republicans can hold the nation and world economy hostage to ill-considered, self-destructive extremist idiocy --- before blowing everything up and creating a first-ever default of the U.S. Government in the process --- got much closer as of Monday. The new earliest date for when the U.S. Government may run out of authority to borrow the funds needed to pay for stuff that Republicans and Democrats alike long ago committed to paying for is now June 1, according to Treasury Secretary Janet Yellen.

    Yet, House Speaker Kevin McCarthy and his band of reckless Republicans in Congress continue to exploit our dumb debt limit law to try and extort huge cuts to food and health care to millions of Americans (including veterans) along with a rollback of critical climate crisis initiatives in exchange for not destroying the nation's economy.

    President Biden is right not to negotiate with terrorists on this matter. The way the media covers this mess, however, will make a big difference in whether or not Biden's able to continue to do the right thing. In the meantime, we sure do hope he has a plan to handle the worst-case scenario that today's gerrymandered, death-wish GOPers may actually be dumb enough to cause for the first time in U.S. history.

  • Not all Republicans have a death wish, apparently. On the same day last week, in two different "red" states, South Carolina and Nebraska, a handful of Republican state lawmakers voted to protect abortion rights. For now. It took the only two female Republican state Senators in South Carolina and one 80-year old Republican in Nebraska to block complete bans on reproductive freedoms. We'll see how long that lasts and/or if any other GOPers can figure out why they keep losing elections that they should have won after the corrupt U.S. Supreme Court overturned Roe v. Wade last year.
  • Back in February we covered the news from Washington Post's Josh Dawsey that the Donald Trump's Campaign paid $600,000 to a research firm to investigate every single potential claim of fraud in the 2020 Presidential election. They found absolutely nothing and told Trump as much in December of that year. Nonetheless, on January 6, 2021, Trump went out and lied yet again to his supporters about fraud in the election, even though he was told all such claims were baseless. And now, Dawsey reports, a second firm was paid $750,000 by the Trump Campaign at the same time to also find no evidence of fraud. That firm told him as well, in advance of January 6. Special Counsel Jack Smith has now reportedly subpoenaed records and testimony from both firms, as he probes the Trump Campaign fraudulently raising more than $250 million from their own supporters based on fraudulent claims we now know Trump absolutely knew to be fraudulent at the time he made the fraudulent claims.
