Today on The BradCast: You're not the only one worried about the U.S. devolving quickly into an autocracy under Trump's attempted dictatorial rule. So are many of the world's top academic democracy experts and researchers! [Audio link to full show follows this summary.]

We've got quite a bit to get to on today's show. Here is a very quick round-up...

• Our quickly deteriorating man-baby President hates offshore wind power so much (because, years ago, he felt it would sully the view from one of his golf courses), that now we all have to pretend it causes cancer, or drives whales crazy, or is a national security risk. Whatever nonsense claim Donald Trump dreams up. His attempts to stop five nearly completed projects off the U.S. east coast were all blocked by the courts. Now, he has a new strategy: Paying a French company that won leases for two new projects (off of New York and North Carolina) during the Biden Administration, nearly a billion dollars to not move ahead with those projects. That's right, 928 million in your taxpayer dollars is being offered to the company in a settlement if they agree to not do any work to provide clean, safe, renewable energy to millions of Americans during an energy crisis sparked, in no small part, by Trump's ridiculously ill-considered war on Iran. One other thing the company must do as part of the deal, according to the settlement documents reviewed by New York Times: invest money in dirty, deadly, natural gas infrastructure in Texas.

• According to the tenth annual democracy report issued this week by the V-Dem Institute at the University of Gothenburg in Sweden, authoritarianism is on the rise across the globe with the U.S. and 43 other nations "autocratizing", while just 12 are becoming more democratic, out of more than 200 countries and territories examined by democracy researchers.

  "The speed with which American democracy is currently dismantled is unprecedented in modern history," the group's Democratic Report 2026 warns. It finds that "By magnitude of decline on the [report's Liberal Democracy Index], the 2025 plunge is the largest one year drop in American history going back to 1789 "“ that is, in the entire period covered by V-Dem data."

  Among the bullet points atop the 7-page special section on "Autrocratization in the USA," included in the 52-page report [PDF] (the special section starts on page 33 and is worth a read!)...

  • Under Trump's presidency, the level of democracy in the USA has fallen back to the same level as in 1965.
  • Yet the situation is fundamentally different than during the Civil Rights era. In 2025, the derailment of democracy is marked by executive overreach undermining the rule of law, along with far-reaching suppression and intimidation of media and dissenting voices.
  • The speed with which American democracy is currently dismantled is unprecedented in modern history.
  • Legislative Constraints --- the worst affected aspect of [U.S.] democracy [cited by the scholars] --- is losing one-third of its value in 2025 and reaching its lowest point in over 100 years.
  • Civil Rights and Equality before the Law are also rapidly declining, falling to late 1960s levels.
  • Freedom of Expression is now at its lowest level since the end of WWII.
  • Electoral components of [U.S.] democracy remain stable [in this year's "Liberal Democracy Index". But] election-specific indicators are re-assessed only in electoral years, and the 2025 scores are based on the quality of the 2024 elections.

  "What would it take to stop autocratization in the USA, and turn it around?," the report asks rhetorically. "Roughly 70% of all 'third wave' episodes of autocratization have been reversed, making U-turns. Elections were often pivotal windows of opportunity, and the first electoral cycle was often decisive."

• That stunning V-Dem report also cites the federal judiciary as one of the few remaining bulwarks against U.S. autocratization and the loss of freedom of expression, as the Executive branch has all but usurped the powers of the Legislative branch under a compliant GOP majority in Congress. To that end, judges in the lower courts, if not at the Supreme Court, continue, by and large, to adhere to the Constitution and Rule of Law, providing a check on the criminal excesses of the Trump Regime. Another ruling this week from a Reagan-appointed federal judge underscores that point. U.S. District Judge Royce Lamberth ordered that more than 1,000 federal workers at Voice of America --- the 84-year old beacon of democracy and for a free press around the globe --- be reinstated and VOA restored to the global airwaves by next week! That, following the unlawful dismantling last year of VOA, its parent agency (the U.S. Agency for Global Media) and its sister networks around the globe by twice-failed GOP candidate and Trump loyalist Kari Lake. Last week, the same judge determined Lake was never lawfully serving in her job and her mass firings --- leaving nothing more than a skeleton crew to unlawfully run rightwing propaganda --- were therefore null and void. This week, Lamberth gave the Administration one week to bring employees back to work and for the national treasure of a radio network, established during WWII, broadcasting in 49 different languages to some 352 million people, to finally be restored as per federal statutes.

• MAGA loyalist, white nationalist, and Trump National Counterterroism Center Director Joe Kent very publicly resigned this week, citing opposition to Trump's war on Iran. One of his objections from his announcement was that Iran "posed no imminent threat to our nation". As it turns out, there is much more to that story. And yes, it ties in to testimony given, or in this case not given, by Kent's friend and fellow veteran Tulsi Gabbard to the U.S. Senate Intelligence Committee this week. Gabbard, Trump's Director of National Intelligence and former opponent of dumb foreign wars (you can still buy one of Tulsi's "No War With Iran" t-shirts from her failed 2020 Democratic Presidential run, if you like) refused to say outloud during her testimony to the Committee whether the U.S. Intelligence Community assessed that Iran actually posed an imminent threat to the U.S., as Trump falsely insist. That, in contrast to her written testimony which concedes as much. All of this attracted the ire of Dems on the Committee, including Georgia's Sen. Jon Osoff, whose sharp questioning of Gabbard we share on today's program.

• Finally, Desi Doyen joins us for our latest Green News Report, as oil and gas prices continue to skyrocket and a hunger crisis looms thanks to Trump's war; and as the autocratic Administration bigfoots California state law to order the restart of a disastrously failed crude pipeline near Santa Barbara...

I wish we coulda talked about Bad Bunny for the entire BradCast. But, alas, fighting fascism calls. (Which actually brings us back to Bad Bunny! But I digress.) [Audio link to full show follows this summary.]

After a few minutes on the rollicking, patriotic Super Bowl Halftime show heard round the world on Sunday, and the doddering old man in the White House that it helped drive crazy --- (Yes. It's a short drive.) --- it's back to the business of trying to help save a nation from itself. And, truthfully, as horrible as it is, it's going pretty well, in that regard.

On Saturday, another Democratic candidate won a special election for a state legislative seat in a landslide after Donald Trump won the same district by a landslide in 2024. This time, it was Democratic Louisiana state House candidate Chasity Verret Martinez who defeated her Republican opponent by 24 points on Saturday, in a district that Trump won by 13, for an overall 37-point swing for the Ds. That special election followed on one in Texas just a week earlier for the state Senate, where the Democrat won by 14 points in a district Trump won in 2024 by 17 points. That was a 31-point swing for the Ds...in deep "red" Texas!

So, yeah, there is a way out of this madness, and it runs through the ballot box. Which is obviously why Trump is hoping to game that ballot box, take control of it, "nationalize" elections, etc. All stuff that he has zero legal or Constitutional authority or lawful ability to do. But that doesn't mean he won't try.

Toward that end --- (maybe?) --- at the end of last month, Trump's FBI obtained a warrant from a federal magistrate to raid the Fulton County, Georgia elections warehouse just outside of Atlanta. They absconded with the 2020 ballots and other materials from the state's largest County. The warrant explained that the search was meant to protect against violations of a federal law related to voting fraud and another to the federal law requiring retention of ballots and other election-related material for 22 months after each federal election.

But the 2020 election was more than five years ago now, which is theoretically outside of the statute of limitations to bring criminal charges against some sort of fraud in that election. Also, what was the Director of National Intelligence, Tulsi Gabbard doing at the raid in Fulton County?

Some of these questions may be answered in the next 24 hours or so, as a Trump-appointed federal judge has ordered the Government to release the affidavit that was used to gain the magistrate's approval for the Search Warrant in the first place. Presumably, that affidavit would detail allegations of some sort of ongoing crime or crimes.

But there are also a host of other questions, unlikely to be answered by that affidavit, including what harm Trump may actually do with the materials, including hundreds of thousands of ballots and 2020 voter rolls, obtained by the FBI? How could any of that be used to undermine Georgia's elections this year, or those elsewhere across the country?

We're joined today by longtime friend of the show and election integrity and voting system transparency hero, MARILYN MARKS of the nonprofit Coalition for Good Governance.

Marilyn knows the GA election system as well or better than anyone else, including, arguably, its Secretary of State, Brad Raffensperger, the Republican who many have regarded as a hero for holding off Trump's attempt to steal the state in 2020 during his infamous phone call seeking to strong-arm Raffensperger to "find" enough votes to flip the state from Joe Biden to Trump. But, as we note again today, Raffensperger is no hero.

It was Marks' long-running lawsuit against the state that resulted in the court-ordered decertification of GA's old, insecure, unverifiable touchscreen voting systems, only to see them replaced by Raffensperger with new, insecure, unverifiable touchscreen voting systems made by a different company. That, despite expert advice to move to a transparent, overseeable, resilient, verifiable hand-marked paper ballot system.

So, what is Trump's game with the FBI raid in Fulton? And should we be worried about it? Should Raffenpserger, who is running for Governor this year, be worried about it? Well, given the disastrous way he ran the 2020 election in the Peach State, argues Marks, yes, he should be quite concerned.

While she breaks down just some of the ways that Raffensperger screwed up the tallies of the 2020 election in Georgia --- and the purported three different counts that "confirmed" the results there (despite each count coming out differently!) --- it wasn't only the Republican Sec. of State whose decisions were odd. For his part, for example, though Trump asked for a received a "recount" in the election he lost by about 12,000 votes, that recount was done on the same computer tabulators that tallied the race the first time, even though he should have had a hand-count, according to state law.

"The law requires a manual count, not a machine recount," Marks tells me. "Trump and Biden and [Libertarian Party candidate] Joe Jorgenson would have all had the opportunity to put a counter at every table. Imagine if a proper hand recount were done and Trump had had a counter at every table. He would have a had a hard time saying later, 'the count was wrong', because it would have been his people counting. Raffensperger knew that was the law. He did not give Trump the recount that he should have had. And, mysteriously, Trump did not ask for the recount he should have had."

We discuss that mystery and many others, even as Marks reiterates that she has seen no evidence to suggest that the election was stolen from Trump in 2020.

"We have no evidence that Trump won the state," she reiterates again today. "Was the election conducted in a reckless, sloppy, unverifiable way? It indeed was."

"There's a lesson to be learned there," she explains. "We've got an even more contentious year here in 2026. And we damned well better get our act together to have a resilient system. So it is important for us to go back and know what was really done wrong in Georgia."

Today on The BradCast: The President of the United States likes to dismiss concerns about climate change by explaining that the real threat to humanity is actually nuclear weapons. And yet, as we were reminded again at midnight last night, he's not actually interested in doing anything about that threat to humanity either. [Audio link to full show follows this summary.]

FIRST... before we get to our excellent guest today on that, just a quick follow up to our recent coverage regarding last week's raid by the FBI at the Fulton County, Georgia elections warehouse, outside Atlanta, where federal officials absconded with ballots and other materials from the 2020 election that Donald Trump pretends was stolen from him, because he is unable to admit he lost it.

We've been trying to get to this story all week, but just a quick notice to mention that, following last week's raid --- and the Dept. of Justice's lawsuits against 23 states attempting to force them to turn over private voter data (suits that already being dismissed by federal courts) --- all three top Administration officials who had requested time to confront the bipartisan National Association of Secretaries of State (NASS) annual conference last week, cancelled their appearances at the last minute.

NASS had rearranged the conference schedule to allow for remarks by Attorney General Pam Bondi, Secretary of Homeland Security Kristi Noem and Director of National Intelligence Tulsi Gabbard. By Friday afternoon, however, all but Gabbard had cancelled. And just before her remarks were to begin, she pulled out as well. Maine's Democratic SoS, Shenna Bellows called them "cowards," noting, along with others, that the Administration's threats to interfere with upcoming elections is unlawful and likely to end poorly for them.

THEN... It's on to other, ahem, explosive news of the day. As of midnight last night, Trump allowed the last remaining nuclear arms treaty between the U.S. and Russia to expire. The New START agreement, struck with Russia by President Barack Obama in 2010, included strict caps on the numbers of ballistic missiles and nuclear warheads each country could deploy, and included an extensive verification regime. The 10-year pact was extended for another five years in 2021 by President Joe Biden, and Russia has said they were open to another extension. Trump simply let it expire.

We're joined today by long time nuclear weapons policy analyst STEPHEN SCHWARTZ, former Executive Director and Publisher of The Bulletin of the Atomic Scientists, keepers of the notorious "Doomsday Clock". On his excellent social media feed at @AtomicAnalyst last night, Schwartz lamented that, while "Trump has boasted for decades that he knows everything there is to know about nuclear weapons and could easily negotiate a great deal with Russia," he allowed New START, "the last treaty constraining US and Russian nuclear weapons" to expire, and "hasn't lifted a tiny finger to replace it."

"He did absolutely nothing during his first term," Schwartz tells me today. "Now, here we are again. He did absolutely nothing during his first year in office, and now we have no treaty whatsoever. I think because, first of all, he doesn't care about it, and because he views the treaty as tainted because it was negotiated by his arch-enemy Barack Obama."

"It's a great loss for humanity. It's not a win for anybody," he opines. "Anybody who thinks that getting rid of the treaty will make the United States or the world safer hasn't been living in reality for quite some time."

Welp. That sounds like Trump.

Schwartz breaks down the specifics of New START, and the dangers now posed with its loss. We also discuss, among other things, the fact that Trump's so-called "Golden Dome" anti-missile system, if Congress ever called for it to be built, is likely to make the U.S. less safe, not more so.

"The Golden Dome is the latest iteration of decades of efforts to try to use technology to eliminate the political problem that gives us the ever-present threat of nuclear war," Schwartz, author of Atomic Audit: The Costs and Consequences of U.S. Nuclear Weapons Since 1940 explains. "But it only works --- if it works at all --- against weapons that are flying through the air. It does not work on anything that would be coming at you from under water [such as Russia's Poseidon drones, developed in response to the threat of a U.S. defensive missile shield], nor for that matter would it shoot down planes that would be carrying nuclear missiles or nuclear gravity bombs."

It does, however, result in adversaries building even more advanced and more numerous offensive weapons systems to ensure they can overcome such a defensive system.

There's a whole lot more with Schwartz today, including: his assessments of the various nuclear threats now posed by China, North Korea, Iran and others, and whether the U.S. under Trump remains the greatest nuclear threat to the planet; why it would be such a terrible idea for Trump to restart U.S. nuclear missile testing, as he vowed last year; and much more.

On today's BradCast: Some of us saw it coming and warned about it long ago. Now that it's here, many STIL don't seem to see it. We get some help today, toward that end, from our guest, who published a startling report on all of it this week. [Audio link to full show follows this summary.]

FIRST UP, however, a few headlines...

The Trump Administration claimed today to be drawing down their deployment of under-trained, over-paid ICE and CBP goons from Minnesota. They say they are immediately withdrawing 700 of them. Donald Trump says a "softer touch" is needed. But that "softer touch" will still leave at least 2,000 thugs on the streets of Minneapolis --- the same number that had already been terrorizing residents in the Twin Cities region before they murdered Renee Good last month.

But staffing issues for the federal government is clearly a problem for them. More than a dozen of the top prosecutors have now resigned from the U.S. Attorney's office in Minnesota in recent weeks, since the start of Operation Metro Surge. And with hundreds of habeas petitions filed in court by detainees since then, federal judges are accusing ICE and government attorneys of ignoring scores of court orders to release them.

On Tuesday, one of those attorneys hit a breaking point. Julie Le, an ICE immigration court judge who volunteered at the beginning of January to help out the short-staffed U.S. Attorney's office, had been assigned more than 85 cases in that time. During a hearing yesterday, she made an emotional and dramatic plea to the judge. "I wish you would just hold me in contempt of court so I can get 24 hours of sleep," she said, adding "The system sucks, this job sucks, I am trying with every breath I have to get you what you need."

Today, it appears Le was pushed out of her job by DOJ, along with her supervisor.

THEN... We're joined today by Talking Points Memo's investigative reporter JOSH KOVENSKY, to discuss two different disturbing stories he's published in recent days. Both of them insane. One of them wacky. The other exceedingly troubling.

Following the FBI's raid of the Fulton County, Georgia elections warehouse last week outside of Atlanta --- part of Trump's latest scheme to obfuscate his humiliating election loss in 2020 --- the President of the United States took to social media to double down. He advanced a number of posts that revived the old "ItalyGate" conspiracy that posits (and forgive me if I get a detail wrong), that Barack Obama and China, with the help of money from Iran --- funneled somehow through Switzerland and/or Dubai --- took control of Italy's military spy satellites to hack computerized voting machines and/or ballot tabulators to steal the election for Joe Biden in 2020.

Sure, it may sound crazy, but that's only because it is. And while there may be no actual evidence to support any of it, that didn't prevent Trump's Director of National Intelligence, Tulsi Gabbard, from being on the ground to oversee last week's FBI raid of 2020 ballots in Fulton County. Why would the nation's top spy chief, whose job has nothing to do with domestic law enforcement, be there? We discuss that and other related idiocy today with Kovensky.

In far more troubling news, in a deep dive at TPM this week, Kovensky details how a series of White House memos issued after the assassination of Charlie Kirk, direct the Dept. of Justice to reinterpret a post 9/11 federal terrorism statute known as 2339A. The statute, as originally intended, allows prosecutors to hold associates of terrorists and terror groups to account for "material support to terrorists".

The Trump Administration's reinterpretation of the statute, however, demands, as Kovensky reports, that prosecutors use the provision to "target those who espouse 'anti-Americanism, anti-capitalism, and anti-Christianity,' [and] direct federal law enforcement to use speech --- including "extremism on migration, race, and gender" --- as key criteria for who to investigate and against whom to bring the most aggressive charges possible."

Once again --- (as longtime BRAD BLOG readers may recall when they were turned against me and my family in 2013 in a different way) --- the federal government's post 9/11 tools for fighting terror, are being turned against non-terrorist Americans.

In this case, the government is now employing these measures to prosecute, as terror organizations, people and left-leaning advocacy groups regarded as political opponents of Donald Trump, including Black Lives Matter and "Antifa" --- along with anybody else the government wants to associate with them.

"These are 'material support for terrorism' statutes. It sounds dry, but it's important," argues Kovensky today, explaining how the provision has already been used to go after people at protests where someone else may have committed a crime, "if the protest was associated with a leftwing cause or something opposed to the administration. Then we are now starting to see the DOJ go after it as 'terrorism'."

"With 'material support for terrorism', if you're convicted on that," he adds, "prosecutors can then apply for a 'terrorism enhancement.' Even if you have no prior criminal history, and regardless of whether or not the underlying charge was non-violent --- it could be something as simple as spray-painting a government building --- you're now looking at a recommended minimum for the judge of 17.5 years behind bars. So it dramatically increases the severity of the possible sentence."

This is why you may have heard people like A.G. Pam Bondi, FBI Director Kash Patel, and others in the Administration in recent months, refer to protesters --- even those like Renee Good and Alex Pretti who were murdered by immigration officials --- as "domestic terrorists", along with vows to hunt down and break up their "networks".

"It gives the government greater powers to investigate," Kovensky tells me, "but it also raises unbelievably grave concerns about freedom of speech and freedom of association."

And, yes, this is what many civil libertarians argued more than two decades ago. "If you look at the commentary in the early 2000s after 9/11 and what a slippery slope this was with the PATRIOT Act, it's all very eerie," he says.

• Donald Trump's hilariously ham-fisted attempts at covering up his long-running role in the life of his former bestie and late pedophile Jeffrey Epstein, are become more transparently ridiculous by the day. Driftglass describes it as "Stupid Watergate," where even the MAGA supporters are finally catching on. What took them so long? "This is a cult that we are dealing with" after all, Digby reminds.

  There is a lot of news wrapped into that one story alone to keep us busy today. But, no, neither Digby nor Driftglass believe Speaker Mike Johnson's gambit to recess the U.S. House early for the rest of Summer to avoid demands for votes to release the "Epstein Files" (which Johnson himself favored just last week) is going to make any of this go away or get better for Trump. Digby explains why. And it may, as the pair seem to concur, be the "load-bearing lie", finally knocked down, that does to the Trump Presidency what Hurricane Katrina did to George W. Bush's.

• One of Trump's latest attempts at distraction from his ever-growing Epstein woes was to declare this week that "Barack Hussein Obama" (and Hillary Clinton) have been caught dead to rights in a "coup" to steal the 2016 Presidential election! The one that Trump won. What is the "irrefutable proof" Trump claims has been newly uncovered by his Director of National Intelligence Tulsi Gabbard revealing that, as Trump charged yesterday, "Obama was sedatious"? (His actual word.) Well, it takes all of us on today's program to even muster a guess at what the hell any of them are talking about. (Even folks on the Right who previously decried "RussiaGate" aren't impressed.) But, sure. Here's the evidence. They finally caught Obama!

  Whatever the supposed crime is "doesn't matter because there's nothing there," explains Driftglass. "There is no conspiracy. It simply exists as a bright shiny object to distract from the fact that Donald Trump is covering up a pedophile business that his dead best friend ran, with Donald Trump's knowledge, consent, and approval. That's it. That's the only reason this is happening. It will be another distraction next week and another one after that if this one doesn't work."

• In somewhat darker news, we also try to make sense of the firing (next year, anyway) of Stephen Colbert by Paramount/CBS on the heels of a $16 million settlement paid by the company to Trump as an obvious attempt to win his FCC's approval for a merger with a company named Skydance.

  "The big overview here is that all these institutions have been caving," laments Digby. "Whether it's Big Law, universities, these big media companies settling with Trump, basically paying bribes to get what they want. "The fact that [Colbert's firing] happened within days of the settlement --- if it wasn't part of the settlement, or if they just decided to throw it in as a little treat for Trump to make him happy --- either way, it's a horrible thing. And it's happening throughout our culture."

  "All we've got are the comedians," she argues, echoing her column today at Salon. "The only people who have what it takes to speak truth to power in our whole damn culture. And that is a pathetic realization."

• All of which brings us to our final topic of discussion today, based on an email I received earlier this week, calling me out for describing Trump as a "wannabe-dictator" instead of a flat-out dictator. His argument, which I share today, was sound, and my guests tended to agree with him. (Trump's "a fascist," asserts Driftglass. "Coming up with an accurate definition of what is happening right now is important, because it gives us a place to stand and start.") But I think I'm gonna be sticking with "wannabe" by and large right now. I explain why on today's lively, funny and sometimes appropriately grim program...

It all sounds a bit too familiar to those of us on The BradCast who covered the last time a Republican President forced the U.S. into a "Forever War" in the Middle East based on known lies regarding "Weapons of Mass Destruction" which they never had. Here we go again? [Audio link to full show follows this summary.]

Of course, part of the irony this time around is that Donald Trump ran for President on the false claim that he opposed the war in Iraq. And, despite his expansion of every inherited U.S. war, his unlawful targeted assassination of Iran's top military commander, and extreme expansion of the use of killer drones in all sorts of country during his first term in office, his supporters (and the corporate media) were dumb or duplicitous enough to characterize him as an "anti-war" President.

Trump's unconstitutional and unlawful attacks on three nuclear facilities in Iran over the weekend --- after Israel had cleared the field for him --- should put an end to the "anti-war" fairy tale once and for all. But we'll see.

Following Saturday's U.S. bombing run --- which, according to the Administration, has "obliterated" the three targeted nuclear production cites (something about which you should remain skeptical) --- Iran has responded with a fairly limp attack on a U.S. air base in Qatar and perhaps another in Iraq; the U.S. Dept. of Homeland Security (DHS) has issued a terrorism advisory warning of potential Iran-sponsored cyberattacks and the possibility of new attacks in the U.S.; Trump's failing social media cite seems to have fallen victim to one of those cyberattacks over the weekend; and Russia suggests "a number of countries are ready to directly supply Iran with their own nuclear warheads."

Meanwhile, the Administration has been unable to proffer any actual evidence to suggest that Iran was anywhere near building a nuclear weapon --- the pretext for Saturday's attack --- much less posing a threat, imminent or otherwise, to the U.S.

According to sources in the U.S. intel community who spoke to our guest today, Rolling Stone's Senior Political Reporter, ANDREW PEREZ, "there is no intel" to suggest anything has changed regarding an Iranian nuclear program since Trump's own Director of National Intelligence, Tulsi Gabbard, testified to the U.S. Senate Intelligence Committee in March that "the IC [U.S. Intelligence Community] continues to assess that Iran is not building a nuclear weapon, and Supreme Leader Khamenei has not authorized the nuclear weapons program that he suspended in 2003."

While the White House attacked Perez and his co-author, Asawin Suebsaeng for "false and lazy 'reporting' designed to undermine President Trump's highly successful operation to dismantle Iran's nuclear capabilities," subsequent statements from Defense Secretary Pete Hegseth and Sec. of State Marco Rubio confirm that, in fact, "there is no intel" to suggest anything has changed in Iran's nuclear program between Gabbard's March 25th testimony in Congress and Trump's Saturday night B-2 stealth bomber assault on Iran.

Perez was not impressed by the White House attack on his reporting. "What we've been hearing from the Administration is that there has been no new intelligence to justify any sort of immediate actions against Iran," he says today. "What we're hearing is the White House is looking at the same intel it was looking at months ago."

To what does Perez attribute Trump's sudden decision to join Israel's war after spending months trying to negotiate a deal with Iran (like the one Obama struck in 2015)? "One of the major factors in the President's different posture, as it pertained to Iran, was watching Fox News coverage the last couple of weeks." On Fox, of course, they've been covering Israel's attack on Iran and calling for the U.S. to join in. Trump, according to Perez, thought "it looked very cool."

"What the President did this weekend definitely constitutes several acts of war," Perez argues. "It does look possible that this doesn't blow up into a broader conflict, but it still could."

None of this, it should be noted, should have even been necessary in the first place, but for Trump having unilaterally reneged on Obama's 2015 anti-nuclear deal with Iran. By all assessments (perhaps other than Israel's) the agreement worked, observably preventing Iran from enriching uranium above levels required for civilian use --- at least until Trump ripped it up upon taking office because HE wasn't the one to have made it.

Hilariously, that agreement was struck after Trump, in both 2011 and again in 2013 declared: "Remember that I predicted a long time ago that President Obama will attack Iran because of his inability to negotiate properly - not skilled!"

Then, with a few minutes left on today's program, we open up the phone to callers, including one who claims to have voted for Trump three times but now concedes he feels like he was completely duped. "I am so disappointed," he tells me. "I feel stabbed in the back." Tune in to find out why!...

Today on The BradCast: While Trump's mass deportation boondoggle gets worse, more cruel, more corrupt, more unlawful and more unconstitutional by the day, the increasing threat to U.S. national security, thanks to his Administration's unprecedented censorship of climate science, may soon collide with a "physical reality" that may make ALL of our problems far worse --- including immigration. [Audio link to full show follows this summary.]

FIRST UP... The Administration continues to characterize those being deported as criminal felons and sexual assaulters who entered the U.S. unlawfully, even if available evidence often suggests otherwise. Moreover, the convicted criminal felon and adjudicated sexual assaulter in the White House continues violate the law and Constitution himself with each passing day. He should be deported --- though allowed the due process of law he has always received, even as he denies it for everyone else.

Unlike the Administration, we offer evidence in support of our serious allegations: As the New York Times reported last night, emails from Director of National Intelligence Tulsi Gabbard's Chief of Staff reveal that her office attempted to manipulate a national intelligence analysis they didn't like --- which revealed Trump to be a liar --- regarding migrants from Venezuela and Trump's unlawful invocation of the Alien Enemies Act of 1798 to remove them without due process.

That news comes on the heels of a stunning new analysis from the right-leaning Cato Institute finding that at least 50 of the Venezuelans Trump deported to a maximum-security torture prison in El Salvador were in the U.S. lawfully. They included construction workers, cooks, delivery drivers, a soccer coach, a veterinarian and a makeup artist, most of whom used the U.S. Customs and Border Protection app, called CBP One, to schedule an asylum appointment from outside of the country to seek lawful entrance into the U.S. That's 50 out of just 85 migrants whose entrance circumstances Cato was able to figure out. More than 200 migrants have been sent to El Salvador without Constitutional due process and in violation of court orders.

And all of that preceded still-breaking news over the past 24 hours or so that the Administration has violated yet another judge's orders by sending migrants from Myanmar, Laos, Vietnam, Cuba and Mexico to South Sudan, a nation in the middle of a bloody civil war, where the U.S. State Department warns Americans "Do Not Travel", and where those migrants are not from. They were reportedly given less than 24 before being sent to a third country in violation of orders from the U.S. District judge overseeing their cases.

THEN... While the Administration is pretending to combat national security issues by deporting make-up artists and soccer coaches, actual national security issues are being exacerbated by their censorship and attempts at unpublishing climate science that you and I have paid for.

As my guest today recently explained, writing on the "silencing and censoring of environmental threats to U.S. national security" for the Bulletin of the Atomic Scientists (the keepers of the infamous Doomsday Clock), for well over half a century, U.S. intelligence and military agencies, under Presidencies of all political stripes, have been documenting and warning about changes to the climate that threaten national security. Now, Donald Trump is attempting to "cancel" climate science --- actually censoring the words "climate change" from all government documents --- and ignoring and/or shutting down internal warning mechanisms regarding increased environmental threats to national security.

Our guest today is renowned climate scientist DR. PETER GLEICK, who is attempting to sound the alarm about the Administration's "silencing and censoring of environmental threats to US national security." He is an author and co-founder of the non-profit Pacific Institute research center, a member of the U.S. National Academy of Sciences, a McArthur Fellow, and much more that I don't have space to list. (But see his website!) He has written dozens of scientific articles over the decades and has testified about the related matters before Congress.

"From a political point of view, between Democrats and Republicans, there's a very strong difference and emphasis on energy policy, on environmental policy," Gleick tells me when I ask about the timeline of the rise of climate denialism. But, he adds, it was "nothing like we're seeing today. What we're seeing today is fundamentally different than anything we've seen before."

"Even throughout both Democratic and Republican administrations in the past, the military and intelligence community have been very good about this. They see their job fundamentally as understanding and preparing for threats to the United States. All of those defense and intelligence assessments, throughout those administrations (since President Johnson), have repeatedly highlighted a clear understanding of two factors: One is how environmental issues may cause U.S. forces to get involved in conflict --- with failed states, with population displacements and migration, with impacts that lead to threats to our own security."

"The other category is how environmental threats may affect US military forces and bases and operations. Sea level rise we know is already flooding the naval bases in Norfolk. They are raising docks because they know sea level rise is a reality. They've seen extreme events damaging air force bases and destroying airplanes. They are aware of those threats, and they have been very good, throughout almost all administrations, about highlighting those threats in the national security assessments to the public," says Gleick.

But now, under Trump, things have very much gone sideways. We've got a Sec. of Defense who doesn't seem to understand that national defense is about more than simply cultivating manly warriors to fight on battlefields. And, for the first time, climate threats are no longer even being mentioned in National Security Strategy reports. The Congressionally-mandated National Climate Assessment may not even been published by the Administration at all when it is legally next due, in 2027. Gleick has worked on previous Assessments and is a member of the U.S. National Academy of Sciences which advises on the project. But says, this time, the scientists who volunteer to work on the report are being dismissed and that there may or may not even be a new report. "The Trump Administration doesn't seem to pay much attention to the law at the moment."

"If there isn't one, we know what the science of climate change says. What we'll be missing are just the latest updates, the most recent climate science that tells us even more about what the consequences of climate change will be," he explains.

We discuss a number of concrete ways in which the climate crisis is already a threat to national security, from conflicts over water and water systems; the disappearance of Artic ice leading to expanded military basis by Russia; decreased agriculture productivity resulting in famine and, yes, mass migration that the U.S. has already begun to deal with.

"Climate is no longer a hypothetical threat to the world, national security, and international security," he argues. "It's increasingly an important component of that threat, whether you believe in it or not."

But, Gleick offers some hope. Scientists, including himself, have been diligently working to prevent the "wholesale deletion" of government climate data; he believes that "the remarkable revolution we are seeing in the renewable energy industry is unstoppable" and while Trump may want to "revive the coal industry, that's just not going to happen"; and whether Trump hopes to "cancel" climate science or not on behalf of the fossil fuel industry, he will be unable prevent the world from seeing the unavoidable physical reality of what lies ahead.

"Physical reality will happen," he laments. "Bad things that otherwise would not have happened are going to happen. People are going to get sick and die. There will be conflicts we are not prepared for that we could have been prepared for. Whether those realities swing the pendulum far enough back so that some sort of rationality can be re-established --- I hope that's the case. But I think it's dangerous times."

Constitutional Due Process plays a starring role in today's BradCast --- as it damned well should --- in several different stories of note. [Audio link to full show follows this summary.]

• Today, we revisit the ridiculous story about the one election from 2024 that is still unsettled. At least it was before Monday, when a federal district judge may have finally put an end to it. We'll see. This is the contest for a North Carolina Supreme Court seat, where incumbent Democratic Justice Allison Riggs' re-election was challenged by her opponent, Republican Judge Jefferson Griffin. At least two recounts found that he lost by 734 votes out of more than 5.5 million cast. Nonetheless, Griffin has been deploying a playbook clearly created for Donald Trump prior to last year's election, in demanding some 65,000 lawfully cast ballots be tossed out entirely --- though only in a few Dem-leaning counties, and only for his race. We unpack all the details again on today's show. But, long story short: The state Supreme Court (dominated 6 to 2 by Republicans, or 6 to 1 in this case, since Riggs recused herself) recently okayed the potentially disenfranchisement of thousands of NC voters to help out Griffin. But Riggs then took the matter to federal court, where U.S. District Court Judge Richard Myers --- a Trump-appointee --- on Monday said absolutely not. You may not change the rules of an election after an election and violate the Constitutional Due Process of voters in the bargain, according to his order [PDF]. This is, of course, very good news for Riggs, but also for democracy itself. Hopefully, it's finally over. We'll see if Griffin chooses to keep his six-months of idiocy and attempted vote suppression going on appeal. Myers has given him one week to decide.

• Trump said over the weekend that he just doesn't really know if the Due Process mandates of the Constitution are actually, ya know, mandatory. He was answering questions about his use of the Alien Enemies Act of 1798 to detain and deport alleged gang members from Venezuela to a gulag in El Salvador for a life sentence, without ever allowing them a day in court to make their case, or even contact with lawyers or family. But the AEA law may only be invoked in the first place against migrants from nations that have declared war on the U.S., or in the event of "invasion" or "incursion" directed by a foreign government. That is certainly not the case with Venezuela, though Trump argued otherwise in his invocation of the wartime law. Earlier this year, reporting from the New York Times and Washington Post revealed that the U.S. Intelligence Community (IC) found back in February that there was no evidence of Venezuela's President directing an invasion of the U.S. Trump made his proclamation to begin deportations in March anyway. At the time, the Admin claimed the reporting was wrong and the DoJ vowed extraordinary measures to track down the leakers. But, according to a redacted memo released on Monday under the Freedom of Information Act by the Office of the Director of National Intelligence, summarizing the IC's findings, the newspapers had it right and --- I hope you're sitting down --- it appears the Trump Administration was lying about all of this from the jump.

• In related news, yet another federal judge --- this time in the Southern District of New York --- has enjoined the Trump Administration from moving migrants detained under the Alien Enemies Act until they are given full Due Process. The ruling was not unlike one from a Trump-appointed federal judge in South Texas last week. In this case, U.S. District Judge Alvin Hellerstein, a Clinton appointee, found [PDF] that since the Administration has "not demonstrated the existence of a 'war,' 'invasion' or 'predatory incursion,' the AEA was not validly invoked by the Presidential Proclamation."

• Meanwhile, the fortunes of Trump buddy and richest man on earth, Elon Musk --- also, potentially, the world's most hated --- are really beginning to nose dive. Aside from users fleeing Twitter/X in droves this year in the wake of both his partnering with Trump and the Nazification of the social media site, the future of his Electric Vehicle company appears even bleaker. The stock price of Tesla is down some 40% since he DOGEd himself to Trump last December and subsequently outed himself as a far-right extremist. But sales of the company's cars in Europe have fallen even farther. According to new numbers out this week from both Germany and the UK, where, even as overall sales of cars is dropping, EV sales are booming --- at least for companies not owned by Musk --- Tesla sales continue to drive over a cliff. They are down 46% in Germany compared to last April, and a whopping 62% in Britain. Sad!

• Finally, Desi Doyen joins us for our latest Green News Report, as drastic cuts to the National Weather Service are now beginning to endanger public safety, according to its former leaders; Trump's DoJ is suing states to block climate laws and lawsuits; and the Administration plans to shrink National Parks in the U.S. to make room for more mining and drilling, and violate international law by mining the sea floor...

Donald Trump's chaos coaster continues on today's BradCast. Our top on today's ride: Social Security. [Audio link to full show follows this summary.]

FIRST UP... As we warned yesterday amid "irrational exuberance" as the stock market briefly skyrocketed following Donald Trump's social media announcement that he was pausing his unilateral worldwide tariffs for 90 days, investors began to notice that it wasn't quite as good as it looked. Trump's remaining 10% tariffs on almost every nation (other than Russia) and boost of duties against imports from China to 145%, helped lead the U.S. markets to tank again today, if not quite as much as they rose yesterday.

But some brighter news for those who believe in both truth and election integrity today. Rightwing propaganda outlet Newsmax, which quietly settled a defamation suit last year brought against them by voting system company Smartmatic, was found this week by a judge in Delaware to have defamed Dominion Voting Systems following the 2020 Presidential election. A jury will now determine if the Trump-allied outlet intentionally smeared Dominion with "actual malice" when they claimed the company rigged voting machines in favor of Joe Biden, despite the lack of any such evidence. The trial is set to begin at the end of this month...unless Newsmax decides to settle that one too.

But, speaking of actual voter fraud, it looks like Trump's Director of National Intelligence, Tulsi Gabbard, committed it last year in Hawaii when she voted there in the 2024 election after previously declaring herself to be a resident of Texas. Oops.

THEN... Elon Musk's DOGE Bros are unleashing absolute havoc at the Social Security Agency. Their latest chaos involved a plan to end phone services for people filing for retirement or survivor benefits as of this coming Monday. But with cries of outrage, impossibly long lines at field offices, wait times on the phone, and website crashes for new applicants and longtime beneficiaries in recent days, the Agency has now backed off that terrible plan as well. For now.

We're joined today for insight and warnings about Trump, Musk, DOGE and much more by longtime Social Security expert DR. ERIC KINGSON, emeritus Professor of Social Work at Syracuse University, co-founder of the nonprofit Social Security Works, and policy advisor to two different Presidential commissions on Social Security Reform under both Ronald Reagan and Bill Clinton.

What DOGE is doing at SSA "has nothing to do with efficiency or correcting errors," he tells me. "There's an extremely small error rate in Social Security. As for efficiency, we spend less than one percent administering the program. It's a well-administered program --- until now."

He worries that for "the first time since the creation of the program, there is a major, major risk of dramatic changes that will hurt the American public, especially middle-aged workers and young workers today."

"It's purposeful," Kingson argues, regarding the chaos unleashed at the agency by Musk's DOGE Bros in recent weeks. "You don't do the things that DOGE is doing because you want to fix something. You want to destroy it. And you want to destroy it with cruelty and disrespect for human dignity."

Kingson, the co-author of a book on protecting and expanding "the Insurance Americans Love and Count On", believes "the next game plan" is to privatize the Agency on the basis that the havoc unfolding now will be used to argue later that the private sector "will do a lot better".

He concurs with President Biden's SSA Administrator Martin O'Malley that the damage being done right now could soon result in the collapse of the system; argues that DOGE and Trump "have been stripping Social Security of its expertise and historical memory"; and charges that Trump, Musk and House Speaker Mike Johnson, who claimed today that "Social Security, Medicare and Medicaid will not take a hit" in the President's legislative agenda moving forward in Congress, are lying about fraud at the agency and benefits for Americans, which they plan to undermine. Kingson cites "a huge crisis" on the road ahead, as "half of today's workers under 67 will not be able to maintain their standard of living in retirement. If you count the cost of healthcare and long term care, it's probably about two-thirds. That's a crisis. What they are doing is stripping away the one thing you can count on: Social Security."

Today on The BradCast: Things get worse for the Trump Administration and the buffoonish Republicans who love him on Capitol Hill, following another embarrassing round of disclosures from 'Signal Gate', while Dems take back control of a state House and flip a very "red" state Senate seat in Special Elections yesterday in a key battleground state. 'NOBODY WAS TEXTING WAR PLANS,' EH?: Capitol Hill continued to roil on Wednesday, after The Atlantic's Editor-in-Chief Jeffrey Goldberg published the full message thread from the Signal group chat that he was invited to join, for some still-unexplained reason, last week, by Donald Trump's National Security Advisor Mike Waltz in advance of a U.S. attack on Houthi rebels in Yemen. The small group consisted of high-level Trump National Security and Defense officials, from the Vice President to the Sec. of Defense, Sec. of State, CIA Director, Director of National Intelligence and more. The newly published text messages from the Signal conversation on the unsecured commercial mobile app, reveal very specific times, places and methods of attack, just as Goldberg originally asserted in his original blockbuster report on Monday.

In response to the original report, SecDef doofus Pete Hegseth falsely told reporters, "Nobody was texting war plans." Today's Atlantic report reveals that he very much did. The new details also appear to counter claims from Trump's CIA Director John Ratcliffe and his wildly unqualified Director of National Intelligence Tulsi Gabbard to the U.S. Senate Intelligence Committee on Tuesday, when they both asserted that no classified information was shared with the Signal group. They were both members of that group. Donald Trump also made that same false claim on Tuesday. If very specific attack plans posted to Signal by Hegseth weren't "classified" details, they certainly should have been. But, even if not, they were definitely National Defense Information, which means members of the group chat may have violated the Espionage Act. The messages set to disappear after a number of weeks by Walz, would also be in violation of the Presidential Records and Federal Records Acts, according to legal experts.

Even a number of rightwing columnists are calling for accountability and the removal of Hegseth and Waltz. A few Republican U.S. Senators are calling for full investigations. And, of course, Democrats have already been demanding accountability, both at yesterday's Senate Intel hearing and in another one today in the U.S. House Intelligence Committee, which also featured laughable testimony from Ratcliffe and Gabbard. Desi Doyen has details for us on today's program.

PA VOTERS PUSH BACK: While things are falling apart politically for Trump and his incompetent aides and Congressional sycophants in D.C., voters are already ringing in with their dissatisfaction at the polls. In Special Elections in Pennsylvania on Tuesday, a Democratic win in the state House has resulted in the party regaining their slim majority in the Legislature's lower chamber. But that was to be expected from a very Democratic district. Bigger news for Dems came in the Special Election for the state Senate, where the Democratic candidate managed to flip a seat in a very red district that Trump won by 15 points last November. James Malone narrowly defeated his Republican opponent by running against Trump's madness and Elon Musk's DOGE Bro efforts to dismantle Social Security, Medicaid and the rest of the federal government. It was a huge upset victory for the Democrats, as they won this particular area of Republican-leaning suburbs and farming communities for the first time in 136 years! (Tuesday's win echoes another last month when Dems flipped a state Senate seat in a special election held in a deep red, Trump +21 district in Iowa.)

MORE ELECTIONS NEXT TUESDAY: Another round of critical elections are underway right now, with Election Day next week (April 1) in Wisconsin and Florida. The battle for majority control of WI's Supreme Court is underway (as we discussed recently with the Badger State's John Nichols of The Nation), as the world's richest man, Elon Musk, has thrown some $18 million into the race to support far-right Trump Republican Brad Schimel, in hopes of defeating liberal candidate Susan Crawford.

In Florida, there are two special elections Tuesday for the U.S. House, though both are in very red districts. The CD-1 race will fill the seat vacated by alleged child sex trafficker Matt Gaetz, the other, in CD-6, is to fill the seat vacated by Trump's incompetent National Security Advisor and Signal chat enthusiast Mike Waltz. Democratic candidates Gay Valimont and Josh Weil, respectively, are waging uphill battles to flip those very "red" U.S. House districts to "blue". Each have, reportedly, outraised their Republican opponents. Though Musk has now also reportedly jumped into those races with his billions as well, at the very last minute. A victory for Democrats in either of those seats (or anything close to it), will be seen as a political earthquake next week.

TRUMP ATTEMPTS ELECTION POWER GRAB: Finally, you may have heard about the Executive Order that Donald Trump issued last night, purporting to mandate proof of citizenship when registering to vote. That said, Presidents DO NOT HAVE THE POWER to issue such mandates. Election law is largely the legislative domain of States, Counties and occasionally via laws adopted by Congress. Trump's largely performative EO (which also includes a number of other voting and election mandates that are similarly beyond his powers as President) will face huge legal challenges. As Election Law professor Rick Hasen noted in his initial response to Trump's "dangerous Executive Order" last night, the measure is an attempted "executive power grab" that, if successful, would "disenfranchise millions of voters."

Ya know...Just another dull day in these United States...

This one is really a debacle. It's likely criminal as well, on several levels, according to today's guest on The BradCast. [Audio link to full show follows this summary.]

You have likely heard by now about the group text chat that The Atlantic's Editor-in-Chief Jeffrey Goldberg was somehow invited to over the commercially-available mobile phone app called Signal, in which top-level Trump Administration cabinet officials, including Donald Trump's Defense Secretary and former Fox 'News' weekend host, Pete Hegseth, discussed specific U.S. attack plans for bombing Yemen,

Goldberg detailed on Monday (free link) how he was invited into the group chat by Trump's National Security Advisor, Mike Waltz. Classified information was discussed in the conversation. But, while Goldberg knew better than to publish specifics, he explained: "What I will say, in order to illustrate the shocking recklessness of this Signal conversation, is that the Hegseth post contained operational details of forthcoming strikes on Yemen, including information about targets, weapons the U.S. would be deploying, and attack sequencing."

Other Signal accounts participating in the group included those for JD Vance (Vice President), Marco Rubio (Secretary of State), Tulsi Gabbard (Director of National Intelligence), Scott Bessent (Treasury Secretary), John Ratcliffe (CIA Director), Stephen Miller (Deputy White House Chief of Staff), Susie Wiles (White House Chief of Staff) and Steve Witkoff (Special Envoy to the Middle East). That, as NPR reported today, the Signal app was cited in a Dept. of Defense email last week to all Pentagon employees, warning of a "vulnerability" exploited by "Russian professional hacking groups" that makes the app unsuitable for use by the military, even for non-public UNclassified information.

As luck would have it, the U.S. Senate Intelligence Committee had a hearing already scheduled for today, with witnesses including Gabbard and Ratcliffe --- both members of the Signal chat in question --- and Kash Patel, Trump loyalist and wildly-unqualified FBI Director. While most Republicans on the Committee were interested in discussing anything but this matter, Dems were rightly laser focused on it, including the fact that Witkoff was apparently at the Kremlin for a meeting with Russian President Vladimir Putin this month when the text list, detailing plans to bomb Houthis in Yemen and reportedly revealing the identify of a senior CIA officer, were discussed.

We're joined today by our friend and longtime independent national security journalist MARCY WHEELER. In her piece today at Emptywheel.net, she detailed "Seven Reasons Trump's Entire National Security Team Should Resign in Disgrace" following the signal debacle. We step through each of those reasons with her today.

Wheeler was amazed that, even though the identities of everyone in the group were available to all members, nobody seemed to notice, or be troubled by, the inclusion of a journalist. Especially a journalist who Hegseth would go on to try and smear as "a deceitful and highly discredited, so-called journalist whose made a profession of peddling hoaxes time and time again." That, after Hegseth revealed classified war plans to him in the Signal chat and the White House has already confirmed the matter.

Wheeler charges that Trump's entire national security team in the group appears to have potentially violated Section F of the Espionage Act, which, in her words from her today, "makes it a crime to so negligently mishandle National Defense Information that someone not authorized to receive it does receive it."

"If you are so stupid as to share attack plans on a Signal thread that a journalist happens to be accidentally added to, that may be criminal," she tells me today, detailing how Section F of the Act bars the sharing of National Defense Information "through gross negligence", etc. "In other words, Pete Hegseth shares information about this attack with somebody not entitled. Because Pete Hegseth is so stupid, that might get you to [Section F]. And you had the entire national security establishment just sitting there watching Pete Hegseth do that!"

There is also the matter of violating both the Presidential Records Act and Federal Records Act by setting comments in the chat group to automatically delete after a week. Moreover, she observes, the fact that Trump claimed on Monday afternoon to know nothing about the matter, even after the story was published in The Atlantic, means that either critical NatSec information was withheld from the President, or he was simply lying when he claimed to have known nothing about it when asked for comment by a journalist at the White House. Wheeler argues that's "not plausible, because if he hadn't been told in advance, he would be firing [group chat member and Chief of Staff] Susie Wiles right now. He'd be firing Mike Waltz right now. JD Vance. He would be firing everybody who knew this was going to come out and didn't warn him. He hasn't fired any of them, so we have to assume he was lying when he pretended he didn't know anything about this." She goes on to add: "But if he didn't know anything about it, it means that he can't trust anyone around him. That all the people who are running his national security are not keeping him in the loop."

Also, the fact that Witkoff was in Russia, at the Kremlin, as a member of the group chat means that all of the accounts of other members on the list may also be compromised. "You bring a phone into Russia, they are going to compromise the phone. Sitting in the Kremlin with Vladimir Putin is really close to the top of the list of stupid things you can do with a phone when you're planning war strikes," says Wheeler. "The timing on it is quite clear. He was in the Kremlin when that list was started. Was his phone compromised? And if so, what else was on his phone? That's, to my mind, one of the most pressing questions Democrats should be asking every minute."

Today on The BradCast: The last 4 or 5 days since Elon's DOGE Bros have, with the apparent permission of Trump, started taking command and control of computer systems and databases at federal agencies --- including the U.S. Treasury's system which pay out nearly $6 trillion per year --- have been, to say the least, chaotic, disturbing and insane. [Audio link to full show follows this summary.]

As we discussed yesterday, Trump, his co-Prez and their flunkies are unlawfully taking over and disassembling the U.S. Constitutional order and its Administrative State. In response, however, their lawless overreach also seems to be having the effect of coalesce the Opposition in a number of ways...

• Career federal agency insiders and whistleblowers are either pushing back against assaults on their agencies or otherwise informing the public of what is happening inside them;
• Civil lawsuits are being filed by both affected individuals at the agencies and by outside groups attempting to enforce the rule of law, informing the public of what is going on inside those agencies in the bargain.
• Public pressure is being brought to bear on elected officials through phone calls, attendance at protest rallies, etc.
• Democratic elected officials seem to be having a fire lit under them by all of this, and are finally beginning to lead rallies and take other actions in their overdue Opposition roles.

That is not an exhaustive list. For example, the free press, where we still have one, also play a key role in all of the above. In helping to let you know what is actually happening, public perception and opinion can change. From a wildly disinformed electorate last November to, perhaps, a more accurately informed populace as we all move forward and take action on those things, with at least some of the urgency that this historic moment demands

An Opposition is emerging. How effective and sustained it will be remains to be seen. But, I believe the outlines are finally beginning to coalesce. At least, I hope that is the case.

Today, we report some of the stories, connect some of the dots, and share some of the signs of that emerging Opposition, through a number of breaking news items over the past 24 hours or so...

• Trump's dumb new tariffs on China are bouncing back, raising energy prices for Americans.

• Disgraced Gen. Michael Flynn's stunning threat against insiders at CIA, FBI and the Office of the Director of National Intelligence who dare speak up against Trump's wildly unqualified nominees for HHS (RFK Jr.), Director of Nat'l Intelligence (Tulsi Gabbard) and FBI Director (Kash Patel).

• After the Acting FBI Director last week tried to courageously stand up to Trump's personal defense lawyer turned Acting Deputy AG at the DoJ, the Bureau turned over answers to questionnaires from some 5,000 employees who were assigned to work on January 6 cases. The head of the FBI's New York field office vows to defend his agents against the Administration's unlawful purges. The FBI Agents Association advises its members: "Do NOT resign or offer to resign." Lawyers for DoJ prosecutors and FBI agents threaten to sue against "violation of due process rights."

• Sen. Brian Schatz (D-HI) vows to place a "blanket hold" on all of Trump's nominees to the State Dept. until the Administration pulls back its attack on --- and DOGE Bro takeover of --- USAID.

• Trump prepares an Executive Order to shut down the Dept. of Education, even though he can't actually do so without approval by Congress, which he will not receive. Musk's DOGE Bros have reportedly now moved in there as well, and are said to be scheming to cut spending and staff while accessing sensitive computers systems with personal information on millions of students who have received financial aid.

• Federal employee unions and advocates for retired Americans sue to block Musk's DOGE Bro takeover of the U.S. Treasury Department's payment system. And who is it who has gained access to the incredibly sensitive computers that handle payments of some $6 trillion, annually, in Social Security checks, Medicare payments, veterans benefits, tax refunds, federal worker paychecks and almost everything else the U.S. pays for? Apparently, it's a 25-year old employee of Musk's named Marko Elez who has remarkably been allowed to obtain full access and Administrative privileges to the system, to cut off payments, and even rewrite the incredibly sensitive and (previously) highly-guarded code that handles some 95% of spending by the U.S. Department insiders are flabbergasted and speaking to the press about what is going on.

All of these stories, as terrible as they are, actually include positive indications of an overdue Opposition finally beginning to assemble.

U.S. House race updates from California where, this week so far, one seat has flipped from "red" to "blue", another that had been expected to turn "red" will likely stay in Dems hands (the seat formerly held by Democratic Rep. Katie Porter), and another longtime "red" seat (since 1980!) appears on the verge of flipping to Democrats. Even so, as of airtime, Republicans are now just one seat away from narrowly winning majority control of the lower chamber of Congress.

Donald Trump lost his first political battle with his upcoming Republican U.S. Senate Majority on Wednesday morning, as South Dakota Sen. John Thune, a Mitch McConnell deputy, was selected by the Caucus as its new Majority Leader. MAGA enemy McConnell is set to retire and Florida Sen. Rick Scott, loudly lobbied for by MAGA, was defeated in the contest to replace him.

Another wave of stooges, corporatists and/or unqualified buffoons were named for key Trump Admin roles since yesterday's program. And the latest wave includes some real humdingers!...

• 'The Ultimate Corruption': Richest-man-in-the-world and major government contractor Elon Musk and failed GOP Presidential nominee Vivek Ramaswamy were named to head up the "Dept. of Government Efficiency" (DOGE! Get it?), even though, as AP notes there is no such government agency.
• 'Who the f--k is this guy?': Trump's nomination of Fox "News" weekend host and former National Guard major Pete Hegseth's nomination for Defense Secretary --- to oversee an $800 billion annual budget and nearly three million troops and civilian employees --- stuns the military world.
• A Gift for Vlad: With no experience at all in the field, jilted Democratic Congresswoman/Presidential nominee turned Republican Putin propagandist and Trump fan Tulsi Gabbard is named to be the next Director of National Intelligence.
• 'Uniquely Awful': Florida Congressman and MAGA insurrection supporter Matt Gaetz, long investigated for the alleged sex trafficking of minors, is named to be Trump's U.S. Attorney General.

Then, we're joined by longtime national security and accountability journalist MARCY WHEELER of Emptywheel, to walk through the post-election status of the four different criminal felony indictments (and 34 convictions) of the incoming President of the United States.

Donald Trump's cases at the federal level --- for stealing national security documents and inciting the January 6, 2021 attack on the U.S. Government as one of several failed attempts to steal the 2020 election --- will now, most likely, just go away. Though Special Counsel Jack Smith is reportedly putting together final reports in those cases for potential release in advance of Trump taking office.

"The cases are going to end, but I suspect Jack Smith was already thinking about what he would do if Trump won, and the way in which to leave the best record available," Wheeler tells me, suggesting that he may do it soon enough that there could be public hearings on those indictments in the U.S. Senate, while Dems are still in majority control.

The two cases at the state level --- in New York, where he was convicted on 34 felony counts of fraud related to hush-money payments to help him win the 2016 election, and in Georgia, for trying to steal the 2020 election --- are a bit more complicated. It's less clear what will happen next in both cases, as sentencing is currently pending in NY and appeals are continue in GA where Trump's 18 co-conspirators, including his disgraced lawyer Rudy Giuliani and former Chief of Staff Mark Meadows, may be tried without him.

We also discuss what happens to Trump's civil verdicts where he was found liable for $355 million for fraud in New York, and for $90 million in the E. Jean Carroll sexual assault case.

Wheeler also discusses the pending fraud charges against Trump buddy Steve Bannon; the outrageous nomination of Matt Gaetz as Attorney General ("All of these Jan 6ers are going to be released, probably including the seditionists."); whether A.G. Merrick Garland could have done anything to bring any case against Trump to a trial, much less a conclusion, before this year's election; and how "the Republican Party, as a whole, has decided that they do not believe in rule of law anymore"...

• Tulsi Gabbard ends her Presidential run, endorses Joe Biden;

• Two members of Congress (one D, one R) test positive for coronavirus as leadership defies calls to allow for remote voting for members;

• Despite weeks of repeated BS claims to the contrary by Trump and his White House, coronavirus testing (or lack thereof) is causing chaos across the U.S., with those who need tests still, obscenely, unable to get one;

• Secretly recorded audio reveals that GOP Senator Richard Burr, speaking to wealthy political funders, knew well about the likely catastrophic dangers of the coming pandemic long before he (or Trump or anyone in the Administration) was willing to warn as much to the public, much less take what would have been live-saving action weeks ago. (But, as Trump said during a WH presser yesterday in response to why celebrities, and apparently members of Congress, seem to have no trouble getting tested quickly: "Perhaps that's the story of life. I've heard that happens on occasion.");

• There is a ray of hope from China, where the city of Wuhan, where the virus was first identified, reported zero new homegrown infections on Wednesday and only eight additional deaths there. Those are remarkably encouraging numbers, but come at a very steep price of mandatory isolation and a central government able to act quickly to shore up its medical system to rise appropriately to meet the moment;

• The good news from China is offset by the bad news from Italy, where 475 people died in a single day on Wednesday. The death toll there has now officially surpassed China's, even though the Asian nation has 1.4 billion citizens compared to Italy's 60 million. The numbers in the U.S. look more and more like Italy's every day, with the response from our own federal government being far worse;

• The pandemic has, virtually overnight, begun to show up in the U.S. economy with an enormous spike in unemployment claims in states across the nation and a federal government so gutted through huge, reckless, unending tax cuts for the wealthy and interest rate cuts during boom times that there are very few economic tools left in the federal arsenal to mitigate the cataclysmic shock to the economy that is almost certainly now in place;

• So, of course, yet again, every Republican in government who pretends to not be a socialist --- who couldn't wait for Sanders to win the Democratic nomination so they could pretend as much even louder --- is now, once again, relying on the federal government for enormous bailouts. (Funny how this happens every time Republicans are allowed to take control of the federal government, no?) Socialist GOP Senate Leader Mitch McConnell is now leading his party in calling for teeny-tiny checks to be sent to individual Americans and for more huge tax cuts --- as if there is anything left to cut --- for giant corporations. Yes, those would be same huge corporations which already received a trillion dollar tax cut from Trump and the same GOP just about a year ago, and the same ones who give huge money to Republicans year after year to call those seeking to end these economic nightmares "socialists" for wanting to do so. Nice work if you can get it. But "perhaps that's the story of life. I've heard that happens on occasion.";
