On today's BradCast, Al Gore returns to the scene of the 2000 crime in Florida, and so do we, as the fight to vote in the Sunshine State starts all over again. Because of course it does. [Audio link to show posted below.]

Hillary Clinton appears to have opened up a strong lead in national polls following the release of Donald Trump's 2005 'hot mic' tape lewdly boasting about sexually assaulting women. But the Presidential Debate on Sunday may have staunched some of the bleeding for now, as RNC Chair Reince Priebus announces they are standing by their man. Either way, if Trump is to win the White House, he must first take the state of Florida, where his ally, Republican Governor Rick Scott ordered the evacuation of millions last Thursday before Hurricane Matthew tore up the state's east coast.

In the bargain, voter registration drives were canceled on what had been set as the final weekend before the state's deadline to register. Scott --- with a very long and very unfriendly history towards voters --- refused to extend that deadline. Democrats sued [PDF], and a federal judge, who described the state's "irrational" reasons for not extending as "poppycock", has pushed today's deadline to Wednesday, pending a hearing scheduled for tomorrow when he may take further measures.

Election expert Dr. Daniel A. Smith, PhD, President and founder of ElectionSmith, Inc and University of Florida Research Foundation Professor of Political Science joins us to explain why extending the state's "arbitrary deadline" is so important, and to detail some of the empirical numbers and many concerns facing voters and would-be voters in the Sunshine State. For example, in 2012, as he notes, during roughly the same period in which this year's storm sent Floridians scrambling for safety, more than 116,000 new (and disproportionately Democratic-leaning) voters signed up to vote. That, even as many are just now returning home and dealing with flooding and other more pressing concerns in the aftermath of the Matthew.

"We looked at the last five or six days of voter registration prior to that cutoff [in 2012] and the numbers actually jumped out at me. On the last day of voter registration back in 2012 there were at least 64,000 people who registered to vote. On the last day!," he says. President Obama ending up winning Florida that year by just 73,000 votes.

And what of those who did manage to register and get their form into a mailbox mail before evacuating? "Who knows what happened to that mailbox?," Smith observes. Those forms "might not even be processed at all, because it's lost. We don't know. These individuals will have no recourse if they finally get back online and see that they're not registered, if that registration application doesn't get to the Supervisor's office."

We cover quite a bit in the conversation, including Gov. Scott's sorry history of taking extraordinary measures to make both voting and registration more difficult in Florida (remember those ridiculous 6-hour lines for Early Voting in 2012?), the fact that just 117 new voter registration forms have been turned in by the state GOP in the past month, as well as Smith's take on voter fraud and the likelihood of inappropriately purged voting rolls in Florida and other states around the nation. "When we talk about voter fraud in this country, it's really not at the retail level of individuals coming into the polls and falsifying their identity and voting twice or maybe three times. That rarely, if ever happens," he says. "Where we actually do have some concerns is that on the wholesale level, in which it's usually someone in a Supervisor's office, a clerk, or someone is --- it can be malicious, it can be just accidental - cleaning the records in a way that is not permissible under federal law . We certainly had that in 2012, when it was the directive of the [Florida] Sec. of State's office to the Supervisors of Elections. First, some 180,000 individuals who they suspected as being 'non-citizens', and then ultimately 2,625 individuals who they flagged as being potential non-citizens. Most of those were actually citizens."

Finally today, Desi Doyen joins us for our latest Green News Report, on the environmental issues raised (barely) during Sunday's Presidential Debate and a fact-check on the energy-related remarks by the two candidates at the bizarre, town-hall face-off in St. Louis.

On today's BradCast I'm joined by litigator Julie Ebenstein, staff attorney with the ACLU Voting Rights Project, to discuss the remarkable string of encouraging voting rights victories in courts in some six different states over just the past few days.

The long-fought and long-sought wins in both federal and state courtrooms in North Carolina and Wisconsin (as Ernie Canning reported earlier today), as well as in Texas, Kansas, Michigan and North Dakota (as summarized by The Nation's Ari Berman) in the past two weeks, have severely undercut Republican voter suppression laws imposing Photo ID voting restrictions, cuts to early voting, restrictions on voter registration and much more. As Berman writes: "The Republican war on voting rights is backfiring."

Ebenstein, who has helped lead the legal battle against these discriminatory laws for years, shares my delight over the recent rulings, but is surprised only that they have come so quickly in succession of late. "Given how extreme and egregious some of the laws are," she tells me, "I'm not surprised the courts have found they violate the Constitution. I think a lot of these laws really have gone very far to put barriers in the way of voters and, in many instances, particularly in the way of black voters."

On the courts finally striking down or weakening GOP Photo ID voting restrictions in NC, TX, WI and ND under the Voting Rights Act and/or the Constitution, she explains: "There's a broader recognition that this is really disenfranchising people in a very practical, day-to-day sense. I think the other thing the laws have highlighted, is that they're just not justified. As the North Carolina [ruling] put it, the laws constitute a solution in search of a problem. There's no evidence of any sort of voter impersonation, which is what these laws purport to protect against. So you have laws that will disenfranchise hundreds of thousands of potential voters. It's just shocking when you look at the harm these laws cause and the lack of justification that they were passed [with] in the first place."

But, she stresses, there remain a number of barriers and concerns about the November election and the various primaries leading up to it. "Even though we have a good decision, there's still going to be ongoing challenges. Things do stay in flux for quite some time," Ebenstein tells me, citing ongoing suppression tactics in a number of states, and adding, "I would encourage everybody to check right now whether you're registered, whether your registration is up to date, whether it has the accurate address on file, and [to] know what the rules are."

Also today: Hillary Clinton receives a bounce in both national and state polling (including in a number of very "red" states) following last week's Democratic National Convention in Philadelphia and Donald Trump's subsequent attacks on the parents of a Muslim-American U.S. Army Captain who is said to have given his life protecting fellow troops in Iraq in 2004. President Obama has declared Trump "unfit" for office in the bargain, and a number of high-ranking, elected GOPers have denounced Trump for it in recent days, but almost none have unendorsed the Republican nominee, much less announced an intention to keep him out of office by voting for Clinton. Following the massacre at the LGBT nightclub in Orlando in which more than 100 were shot and 49 killed, the media (including us!) have been reporting the incident as 'the worst mass shooting in U.S. history'. But was it really?

On today's BradCast [audio link to show posted below], I'm joined by Ariela J. Gross, professor of law and history at USC, co-author of several history text books, and the author of What Blood Won't Tell: A History of Race on Trial in America to discuss a number of U.S. mass killings from early in the 20th Century that were, arguably, far 'worse', in that the death toll was much higher.

Several of them, including those in East St. Louis, IL and Tulsa, OK, have been largely obscured by history as "race riots" instead of the mass killings they actually were. Some historians, she explains, now use the term "'massacre' because 'race riot' makes it sounds as though there were something two-sided" about these wholesale slaughters of African-Americans. "Some historians refer to them as 'racial cleansing', not unlike the ethnic cleansing that we saw in parts of Eastern Europe in the late 20th Century," Gross tells me.

The exact number of deaths in those horrific incidents (not to mention similar slaughters of Native Americans) are still unknown, but are believed to be in the hundreds in a number of cases. Gross notes, however, that had the killers at the time "had access to military-grade weapons the way [the Orlando shooter] did, we'd be talking about thousands of people dead." She also details how "racial terror has gone hand-in-hand with our gun culture" or the years.

Also today: Surprise! Attempts to pass gun safety legislation in the U.S. Senate fail again; The latest FEC filings are in, and the Trump Campaign appears to be in big big trouble, at least if fundraising, staffing and cash on hand mean anything to his particular candidacy and what it may mean for the RNC as a whole; And new polls find Hillary Clinton still ahead of Trump, though not by as much as might think, particularly given the presumptive GOP nominee's disastrous past couple of weeks.

Missouri Republicans hope to work around a series of adverse state court rulings by way of a ballot measure that would amend the Show-Me State Constitution and require that citizens present state-approved Photo ID at the polls before voting.

The legislation to place the issue on the ballot was approved by the state Senate 24-8 last Wednesday. The next day it was adopted in the House 110-39. The wide margin in both chambers, likely enough to override a veto by Democratic Governor Jay Nixon, was the product of a purported "compromise" that would permit voters who can't obtain the necessary documentation to sign an affidavit to that effect and cast an otherwise normal ballot. The "compromise" language was struck after days of filibusters in the state Senate by Democrats.

But Republican State Senator Bill Kraus told PBS that the stipulation would be temporary and that Missouri could have "strict Photo ID" in the near future, once the state constitution has been amended to allow for it. It wouldn't be the first "Missouri Compromise" to go awry...

The fires in the tar sands oil region of Canada and the lawsuits (yes, two of them filed today) result in a busy breaking news edition of The BradCast today. [Audio posted below.]

First up, Desi Doyen joins us for an update on the devastating climate-driven wildfires that have devastated the town of Fort McMurray, Alberta, in the heart of Canada's oil sands region where many workers from the oil sands mines live and work. Cooler weather, and even a bit of rain, helped keep the fires from growing to a full half-a-billion acres, as feared on Saturday. Still, the scenes of neighborhoods completely destroyed from the fire are heartbreaking. Some 88,000 residents remain evacuated, even as the irony of this particular region being devastated by climate-induced fires remains palpable.

Then, on to North Carolina Republicans' latest self-induced disaster. Late last week, the U.S. Dept. of Justice warned the state that their anti-LGBT law (HB2) was in violation of the federal Civil Rights Act. They were given until today (Monday) to let the DoJ know how they planned to respond in order to avoid the potential loss of more than $2 billion dollars in federal education funding. That response came today in the form of a suit filed against the DoJ by NC. The DoJ quickly responded in kind, with U.S. Attorney General Loretta Lynch announcing a lawsuit against NC for violation of the Civil Rights Act. She described HB2 as "state-sponsored discrimination," and told the transgendered community: "We see you. We stand with you…And please know that history is on your side."

Democratic NC state Rep. Chris Sgro, who also serves as president of Equality NC, joins us today to talk about the entire fine mess, even as news of the various suits were still breaking. He tells me that the state has already lost about half a billion to their economy, even before the potential loss of federal education funding, as businesses react to the "terrible anti-LGBT, anti-worker, anti-education bill that we know is in violation of the Civil Rights Act".

"This is not pro-business conservatism," Sgro tells me. "This bill wasn't about enabling local government. They went in and they were the big government who stripped local rights. And they are the anti-business party right now. If they really want to be pro-business, pro-growth, they have to act as quickly as possible to overturn House Bill 2. That's the only answer at this point."

On today's BradCast, as voters head to the polls for the big Presidential Primary in Indiana --- where many of them will again cast 100% unverifiable votes on touch-screen voting systems --- a Republican State Senator from Missouri joins us to explain his bill to do away with such systems in the Show-Me State. [Link to audio of the show at bottom of article.]

In April, St. Louis County held a disastrous local primary election in which, for the first time in years, they used only paper ballots at the polling places, since election officials said they did not have enough time, following the state's Presidential Primary in March, to reprogram the County's touch-screen systems. The County has long given voters the option to vote on hand-marked, optically-scanned paper ballots or on unverifiable touch-screen systems, with more and more voters choosing paper, even as local election officials encouraged them to vote on the oft-failed, easily-manipulated touch-screen machines.

The April disaster occurred when the County's co-Election Directors (one Democrat and one Republican, both of whom have gone on record to state they love the touch-screens and regard them as virtually infallible) failed to provide the correct paper ballots to some 60 precincts. There are now multiple ongoing investigations into the disaster from the state level on down. The Democratic Director has now been suspended and the Republican has tendered his resignation.

It's hardly the first time St. Louis County has screwed up their elections, but those human errors can be corrected with competent personnel. What can never be corrected is the fact that, for example, in the state's Presidential Primary in March, the reported margins of victory were so small (just over a thousand votes on each side), and the number of votes cast on unverifiable touch-screens in MO so large, that it is impossible to know if Trump actually beat Cruz on the Republican side and if Clinton actually beat Sanders on the Democratic side. Not a great way to run elections in the once-key swing state of Missouri.

Republican state Senator Bob Onder joins me on today's program to discuss his bill (SB 771) that calls for doing away with the state's touch-screen voting systems all together. Acknowledging the recent paper ballot foul-ups, Onder explains why the touch-screens are still worse: "you can't audit an electron."

"Only with a paper ballot can we have an auditable, verifiable record of a voter's intent as he or she casts a vote and exercises their most sacred privilege in our democratic republic, which is the right to vote," he says, going on to recall another local election in 2014 "in which the margin was very tight" and where "the loser in that election" is "not really sure he lost."

The GOP's Asst. Majority Floor Leader in the State Senate tells me about the various obstacles his legislation is facing, including from the state's Democratic Secretary of State Jason Kander who, he says, "is a big fan of electronic voting machines" and "an enemy of paper ballots."

It's a fascinating and encouraging conversation over all...at least until we discuss the MO Republicans' continuing push for disenfranchising Photo ID voting restrictions in the state, which Onder, unfortunately, supports (though apparently based on fraudulent information provided to him by some notorious GOP "voter fraud" hucksters, as I explain during the program.)

But, hey, we'll take what we can get! And if Republicans are willing to work with the long-time Election Integrity champions at Missourians for Honest Elections on the issue of banning touch-screens, I'll take it! We can try to get Dems on board and fight with Republicans about everything else on another day.

On today's BradCast: All too predictable voting problems in the state of Wisconsin and in St. Louis, MO today; MSNBC responds to our request for comment on why Bernie Sanders received short shrift on Rachel Maddow's show last night, on the eve of the crucial Badger State primary; And we debunk wingnut nonsense concerning the minimum wage as $15/hour victories come to California, New York and elsewhere. First, while voters wait on line to try and obtain new Photo IDs so they can vote at all today under the GOP's new voting restrictions in WI, many St. Louis County voters showed up for local elections in MO, only to find no ballots at all to vote on. Then, we explain what happened last night on Maddow's show to suggest that Hillary Clinton was polling ahead of Sanders in WI by 6 points, when the vast majority of pre-election polls in the state suggest the exact opposite. MSNBC responds to our query late today, to tell us that the issue was due to a technical error later corrected for the Midnight re-run and online versions of her show. Full details on that in today's program.

Then, in the wake of bills signed into law this week by the Governors of both NY and CA to raise the minimum wage to $15, we speak to financial journalist David Dayen about the Right's feigned concern about job loss (but only when it comes to raising the Minimum Wage), as well as the real concerns about the increase, and activists have had an extraordinary impact on the entire conversation about the decades long wealth gap between the rich and everyone else in the U.S.

Dayen explains why the new law, in CA alone, as he also reported at Salon last week, is a very big deal: "1 in every 8 workers in America is a Californian. Under this proposal, over 33% of them are going to get a raise at some point along the way between now and 2022. And thereafter, because after 2022, the minimum wage gets tied to inflation, so it keeps going up."

"It's really a testament to the power of activism. Before the 'Fight For 15' inaugurated in 2012, nobody would have believed that you could get a $15 an hour living wage, minimum, in a state as big as California. So, really, hats off to the #FightFor15 workers, who really pushed this," he says, offering kudos at the same time to both the Occupy movement and the Sanders campaign. "All of this is rumbling forward and moving Democrats who control states like California and New York into places that they were uncomfortable to go previously. And that is a testament to how this issue of inequality has become the functional, primary issue in American politics today."

Dayen, author of the upcoming book, Chain of Title: How Three Ordinary Americans Uncovered Wall Street's Great Foreclosure Fraud, also responds to the "hand-wringing on the part of economists and business leaders," when it comes to potential job loss in the wake of raised wages.

"We see all kinds of experiments" with the economy, he argues. "We see workers used as guinea pigs all the time by businesses" in all matter of schemes that may benefit those businesses, but not their workers. "These same economists are so worried about the fate of workers with this experiment with the minimum wage have never said a darn thing about all of these experiments that hurt workers --- that we knew were going to hurt workers at the time --- because it was literally about cutting their wages and getting rid of their benefits and putting them in hazardous workplaces. Spare me this rhetoric that you care about workers when you've sat by idly over 40 years as work has become more and more and more devalued."

But will raising the minimum wage, in fact, cost jobs? And, if so, does it even matter? Tune in for his answers to that and much more in a fascinating conversation on today's show --- one which you won't hear, for some reason, on Fox "News" or CNN...

On today's BradCast, several ominous signs for the days ahead --- for Wisconsin voters, for RNC convention goers, and for all the rest of us...

In WI, voter registration and DMV computers go down just days before the crucial primary elections when some 300,000 legally registered voters could find themselves unable to vote at all under state Republicans' disenfranchising Photo ID voting restriction, implemented for the first time in a major election this Tuesday.

Similarly ominous signs for the GOP, with growing evidence to suggest the party may be locked and loaded for a contentious and contested national nominating convention in Cleveland, as Trump may be fading and one (once?) powerful Republican calling for the nomination to go to a "fresh face". Good luck with that.

But there's some good news amongst the omens. An encouraging March jobs report; An infamous 'Wall Street Godfather' explains why he believes Bernie Sanders would be best for the economy; St. Louis, MO is set to use only paper ballots in their local elections on Tuesday (that's a mixed omen); A federal judge kills Mississippi's ban on adoption by same-sex couples; And there's even some encouraging news today amongst more ominous signs in our latest Green News Report today with Desi Doyen. On today's BradCast, the GOP continues to unravel, in both its Presidential nomination process and its increasingly untenable stand against even holding a hearing for Obama's U.S. Supreme Court nominee, and we speak to the filmmaker of a new documentary examining both the rise of the vast Rightwing media machine and how it has succeeded in tearing apart countless American families with its brilliant lies, conspiracies and rabid hostility.

First up, the quixotic search for a Donald Trump alternative continues for the GOP, as John Kasich's fanciful quest for the nomination after winning only the primary in his home state of Ohio continues. That, while Ted Cruz, the only mathematically viable (and, yet, hated) alternative for gaining enough delegates to actually win the nomination, welcomes a notoriously discredited, Islamaphobic conspiracy theorist into his campaign as a national security adviser. Some "alternative"!

And, as if that's all not embarrassing enough for Republicans, President Obama's nomination yesterday of the very moderate and well-respected D.C. Circuit Court of Appeals Chief Judge Merrick Garland to the U.S. Supreme Court is already proving problematic for Senate Republicans who have vowed to not even hold hearings for any nominee made by this President. The Senate Judiciary Committee's Orrin Hatch (R-UT), who has repeatedly supported and promoted Garland in the past, including for a seat on the U.S. Supreme Court, had trouble facing even the usually friendly questioning of Fox "News" in light of his party's bizarrely ill-conceived campaign.

Then, speaking of Fox "News" and dysfunction, I'm joined by documentary filmmaker Jen Senko to discuss her new film, The Brainwashing of My Dad. The documentary details both the rise of the Rightwing media in the U.S. over the past several decades and her own father's disturbing transition from a peaceful, loving Democrat into a hostile, angry 'conservative' after becoming addicted and, yes, brainwashed by Rush Limbaugh, Fox "News" and the rest of the "vast Rightwing conspiracy" machine that has torn apart so many families like her own.

While the film's tagline is "The truth behind the right-wing media machine that changed a father...and divided the nation," an alternative version for so many who will recognize, within their own families, the story of what happened to Senko's father, might have been: "You are not alone!"

"When I started the Kickstarter campaign" for the film, she tells me, "people just started writing me every day, with these heartbreaking stories about so-and-so in their family wouldn't speak to them anymore, or they couldn't talk about anything without them getting angry. It was really shocking. That's when I realized what a phenomenon it was."

Senko explains how her suspicions about what was happening to her father over the years, thanks to Rush, Fox, the endless forwarded emails containing long-disproven conspiracies about the Clintons, Obama and the so-called "liberal media" constituted actual brainwashing, as described by a number of experts in the film.

We discuss not only the long rise of what Hillary Clinton accurately described, in 1998, as the "vast Rightwing conspiracy" machine, but Democrats' own culpability in the scheme, and how it has all culminated in the ascendancy of someone like Donald Trump as the GOP frontrunner for President of the United States in 2016. The non-RW media, Senko notes, "keep saying people are angry because of the way the system is going. No. They're angry because of Fox News and rightwing media --- that includes emails from think tanks and so forth --- [which] have told them lies."

Without giving away the ending to her film, I'll just note that it is both encouraging and underscores that, just perhaps, there is a way out of the ugly, angry mess that so many families --- not to mention the country itself --- now find themselves in after decades of being repeatedly battered by the Republicans' well-crafted political lie machine.

And speaking of encouraging news, we finish up today with a bit of exactly that on St. Patrick's Day, underscoring that, yes, progressive change may take a long time (a very long time, in this case), but it eventually comes and the struggle is always worth it...

It very was a very big night for both Hillary Clinton and Donald Trump, as the two candidates with the lowest overall favorability ratings in their respective parties nonetheless reportedly swept up most of the votes in almost all of the 5 big states up for grabs during yesterday's 'Super Duper Tuesday' primary elections.

On today's BradCast, we review all of the results, still-remaining questions about several of them (some likely never answerable due to the close margins and 100% percent unverifiable e-voting systems that bit both Rs and Ds in Missouri), as well as inexcusable problems (such as outrageous paper ballot shortages in Illinois, photo ID voting restrictions in North Carolina, a gun in an Ohio polling place, and failed electronic pollbooks and purged voting rolls in Florida) that many voters faced while simply trying to cast a vote at all in a number of states.

While your candidate may or may not have been adversely affected yesterday, I'd urge you to pay close attention to today's program before the candidate (or party) you may favor ends up paying the price for the often-shameful system of voting we still have in this country. If not, by the time you decide to give a damn, it may very well be too late to do anything about it. (Did I mention the never-knowable intent of the voters on both the D and R side yesterday in Missouri?)

On today's BradCast, while Hillary Clinton and Donald Trump are busy smearing Bernie Sanders as "extreme" and even "communist", the broad and progressive social programs the Vermont Senator is calling for in his campaign are, as my guest explains today, as American as apple pie and Thomas Paine.

First, however, voters head to the polls for crucial Presidential primary elections in OH, IL, MO, NC and FL and run into a few problems; Massive flooding hits climate deniers in the south, shutting down major interstates and requiring the costly rescue of thousands in TX and LA; And, February global heat records "shock" even climate scientists.

Then, we're joined for today's interview by Univ. of Wisconsin-Green Bay Professor of Democracy and Justice Studies Harvey J. Kaye to discuss the rich history of social democracy (or, as Sanders calls it, "democratic socialism") in the U.S. and how, as noted in the headline of his article for Moyer's & Company, "Social Democracy is 100% American".

"Social democracy means that we harness the powers of democratic government to make American life freer, more equal and more democratic," he tells me. "That stands in contrast to a conservative approach, which is either to empower a hyper-individualism in the libertarian sense, or, as we've seen so often in the Republican Party, empowering big capital and corporations to pursue their interests with some idea that it will all trickle down."

Kaye, author of the books Thomas Paine and the Promise of America and The Fight for the Four Freedoms: What Made FDR and the Greatest Generation Truly Great, details how "the original visionary of Social Democracy was the American revolutionary Thomas Paine," oft-embraced by the modern Tea Party and other Republicans, even as they fail to notice his loud and frequent calls for "social security and other public initiatives" that would benefit all.

From Paine through Lincoln through FDR, Eisenhower and beyond --- at least until Ronald Reagan --- U.S. leaders helped "pioneer" a vast number of landmark social programs akin to the ones Sanders is now calling for in his Presidential campaign and on which our nation has been built from the beginning. Kaye, a supporter of the Democratic underdog, explains how and why he believes that "democratic socialism" has been turned into a pejorative over the years, thanks to both "red-baiting" Republicans hoping to tie it "communism", but also thanks to Democrats who have been playing into the same "class war from above."

"The Republican onslaught has been predictable," Kaye says, after detailing example after example of wildly popular socialist programs in the U.S. ever since our founding and through recent decades. "The corporate class war from above was predictable. But where are the Democrats to challenge it?"

Fear of such programs of social justice and economic prosperity, particularly by theoretically "progressive" Democrats, is a fairly new phenomenon in the U.S., which, he tells me, young people may not realize. "These last forty years we have seen this Republican-conservative ascendance that has so limited political possibilities. It has also limited our political imagination."

On today's BradCast, a whole bunch of stuff that's been happening that isn't related to the death of Supreme Court Justice Antonin Scalia --- and an item or two that are. [As usual, the audio link for the complete show is at the bottom of this article.]

First up, we catch up with the upcoming primaries and caucuses in Nevada and South Carolina with a look at the current polls on both the Republican and Democratic sides (some of which, if accurate, is quite surprising!) All of which offers another swell excuse to remind you about the oft-failed, easily-hackable, 100% unverifiable touch-screen voting systems that will, incredibly enough, once again be in use across South Carolina this year.

That, despite the infamous 2010 election in SC which resulted in a guy who nobody had ever heard of (Alvin Greene) --- a 32-year old man who did not campaign, had no campaign website, had no job, didn't even own a cell phone --- somehow being named the winner of the state's Democratic primary for the U.S. Senate! Somehow, as we covered in great detail at the time, he managed to "defeat" a popular former Circuit Court Judge named Vic Rawl (who did campaign across the entire state!) in the bargain.

Those same failed machines will once again be in use, not only in SC for this Presidential Election year, but also in many other states as well, including Ohio where some are reportedly failing already. In Lee County, FL, in the meantime, a candidate for Supervisor of Elections and a cybersecurity expert are now being investigated by state officials after the pair released a YouTube video showing how easy it was to hack into the main County Elections website server.

And, speaking of hacking, we are joined today by Corynne McSherry, Legal Director for the Electronic Frontier Foundation (EFF), to explain the debate over Apple's challenge to a federal court order requiring the company to break their own secure encryption technology in order, supposedly, to help the U.S. Government in their investigation of last December's horrific San Bernardino massacre.

McSherry explains why EFF supports Apple's position here and opposes the "quite extraordinary" pressure by the Federal magistrate to force private companies to give the U.S. Government special, backdoor access to otherwise secure software systems. In this case, it is one of the shooter's iPhone's that law enforcement officials are still unable to unlock.

"I don't know about you, but I don't have a tremendous amount of trust in the government's ability to make sure that that backdoor that Apple builds for them is kept secure. We know that government databases are hacked all the time," she tells me. "There's sort of this notion that you can just have a golden key and only good guys will use it. That's not how it works in practice. Ask any security expert and they will tell you. Once you build it, it will be used for nefarious purposes as well as laudable purposes."

McSherry believes it is no accident that federal officials are using the very high-profile San Bernardino case to try and set their precedent. "I don't think they chose this particular phone accidentally. I think that they chose this to be the case because they're hoping that people will be distracted from the very real thing that's happening here, which is that this is the first time that a company will be required --- required --- to build code in order to assist law enforcement to build a back door. That's really the precedent that the government is after here."

On today's BradCast (audio link below): The U.S. House rolls over for ISIS. And, could NAFTA and TPP lead to a return of the previously rejected Keystone XL pipeline?

First, the U.S. House voted today to do the bidding of ISIS by passing a bill that would essentially block refugees from war-torn Syria and Iraq from coming to the U.S.. Shamefully, while the bill was passed mostly by Republicans, some 47 cowardly Democrats voted in favor of what both Bin Laden and ISIS have made very clear they would love to see.

Meanwhile, wingnut conspiracy theories about Obama's super secret plan to force a "Muslim overthrow of the U.S." and the "Islamization" of our country continue to grow from the bowels of rightwing radio up through state legislatures and even into Congress and the U.S. Presidential race.

All of that, as, surprise surprise, a new report finds that illegal Mexican immigration is actually at a net negative during the Obama Administration, with some 130,000 fewer undocumented Mexicans now in the country, versus prior to 2009.

Then, financial journalist David Dayen of The Fiscal Times, Salon, WaPo, The Intercept and more joins us to explain his disturbing assertion about the troubling mechanism built in to both NAFTA and the newly released TransPacific Partnership (TPP) trade agreement that could lead to approval, after all, of the Keystone XL pipeline --- even though the dirty tar sands project has finally been rejected by the White House.

Dayen explains how KXL's owner, TransCanada, could invoke the "extra-judicial tribunal" known in both trade agreements as the Investor State Dispute Settlement (ISDS) system in order to force compensatory damages that might either lead to approval of the pipeline after all and/or serve to help scuttle the TPP itself.

The ISDS tribunals, as Dayen explains today, are "composed of corporate lawyers who can act on behalf of the corporation in one case and then sit on a panel judging that corporation on another case." He says that "one of the options" TransCanada now has is that "through the ISDS system in NAFTA, they can sue and say 'this is a violation, you are discriminating against a foreign pipeline operator relative to domestic pipeline operators, and we are going to sue for compensatory damages based on our expected future profits'." The resulting decision could become a "political footbal" at the "worst possible timing for the Administration," as they hope to put TPP up for a vote in a Congress where more Republicans and Democrats are coming out against the agreement.

There is much more that you need to know about in our conversation concerning the proposed TPP agreement, now that its 5,000 or so pages have finally been released to the public and now that the frontrunners for President in both the Republican and Democratic Parties have come out against it. "Political football," indeed.

On today's BradCast, the power of protest and organization.

We start at the University of Missouri after African-American players on the football team there used their power over the weekend to collectively and courageously support a student hunger strike in a protest to force university system President Tim Wolfe to resign amidst a series of racially charged incidents on the Columbia, MO campus. The leverage used by the players is another great reminder of how smart and courageous protest can succeed in making substantive change --- even against some of the world's most powerful entities. Go Tigers!

Speaking of which, my guest today is, once again, Douglas Hughes. You may recall him as the 61-year old Florida postal worker who landed his homemade gyrocopter on the West Lawn of the U.S. Capitol in a dramatic protest last spring. He was our guest back in April, just days after the incident where he had hoped to bring attention to the desperate need for campaign finance reform.

He was, at the time, arrested and charged with six felonies that might have netted him more than 9 years in jail for his attempt to deliver an important letter to all 535 members of Congress. Now, he has struck a plea deal with federal prosecutors and joins us to discuss the deal, why he took it, the latest developments in his case, and whether he feels his protest was ultimately worth the extraordinarily high cost.

Hughes tells us today that he has "no regrets" for having "stomped on the dragon's tail", despite losing his job at the Post Office, facing enormous fines, jail time, and even the loss of his ability to vote as a "felon".

"I stomped on the dragon's tail and I knew it was going to turn around and come after me," Hughes tells me. "And it has, and I have no regrets."

He credits the flight with helping to broaden the discussion about the need for reform, and says, despite the extraordinary cost, he'd do it again "in a heartbeat" as he continues his call for a "voters rebellion" to help "get the money out of politics so everybody that's in Congress knows they've got to answer to us."

Though Hughes was reluctant to mention it, he has a GoFundMe page where folks can donate to his legal defense fund and other needs as he is now struggling to survive day-to-date until his Social Security finally kicks in. Please consider helping him out if you can!
