Today on The BradCast: He hasn't even been sworn in and he's already violating federal law. Surprised? In this case, the law that he's violating is one that he himself signed into law in 2019. [Audio link to full show follows this summary.]

The flood of wholly-unqualified appointments to cabinet level posts and other top appointments, since Donald Trump barely won a plurality (not a majority) of the national popular vote two weeks ago, continues. You're probably well familiar by now with the nominations of alleged child sex trafficker Rep. Matt Gaetz for U.S. Attorney General, the nation's top law enforcement official, and of Fox "News" weekend host Pete Hegseth as Defense Secretary.

Neither have any experience leading huge organizations (or even medium-sized ones) with millions of employees --- or even any experience at all at the organizations they have been tapped by Trump to lead. And Hegseth, who was disqualified from serving in the National Guard during Joe Biden's 2021 inauguration as a potential "insider threat" due to his White Supremacist tattoos, was also revealed over the weekend by Washington Post to have paid off a woman to settle her accusations of sexual assault. He reportedly denies the rape allegation, if not the settlement.

The Trump Transition team claims they knew nothing about any of it when they selected Hegseth to head DoD. That should give you chills. Perhaps that's because the Transition team hired a private firm to vet Trump's nominees, rather than rely on the FBI, as they would be doing, had Trump complied with the bipartisan amendment to the Presidential Transition Act that he himself signed into law during his first term.

The measure also requires Presidential candidates to sign agreements with the White House and General Services Administration by October 1 before an election to begin the transition process with a publicly disclosed ethics policy and a public statement of how the future President plans to avoid conflicts of interest while serving, if elected. It allows for FBI vetting of incoming officials to grant access to classified documents and other material from the previous Administration at the nation's 438 Executive Branch agencies that they will control. Signing the agreement, as required by law, also includes a vow that Transition teams may take no more than $5,000 from any one person for certain transition costs, and that they will publicly disclose the names of those donors, among other things.

Donald Trump has, so far, refused to sign any of those agreements, alarming ethics, national security and legal experts as he begins defying federal law (again) even before taking office for a second term as President.

Joining us to explain the national security and other serious consequences and ramifications of all of this is LISA GRAVES. She is uniquely qualified to discuss these issues, given her service in all three branches of the federal government, as a Former Deputy Asst. Attorney General at the U.S. Justice Dept.; former Chief Counsel for nominations in the U.S. Senate; and former Deputy Chief for the Article III Judges Div. of the U.S. Court system. She now heads up the government watchdog and political research organization, True North Research.

We've got a lot to discuss with Graves today, beginning with what alarms her most about Trump's refusal to sign the Presidential Transition Act agreements. She identifies the avoidance of the FBI background investigation process as a "huge red warning flag."

"He does not want his cabinet appointees to go through the regular clearance process. The FBI background process is a long-standing part of the process," she tells me. It's "designed to help look at whether you have any issues that could made you blackmailable. That's part of it. For people who are seeking access to our most sensitive information, there are additional national security assessments. The investigators are looking at: do you have stability, trustworthiness, reliability, discretion. Do you have good character and judgment, honesty, and unquestionable loyalty to the United States to ensure that people who get positions of trust, with access to our most sensitive information, have unquestioned loyalty to the United States and not a foreign power."

Graves argues that "many" of Trump's nominees "have serious deficits in more than one of those categories." She also tells me that Trump's own "track record would raise serious concerns about his trustworthiness, his reliability, about his fitness for having access to information."

As to Trump's plans to force the U.S. Senate into recess, so that he may avoid the Constitution's mandate for "advice and consent" on top-level appoints, she describes the scheme as "un-American, unconstitutional, and unprecedented."

What should be done --- what can be done --- to shore up advances made in recent years in the fight against climate change before "a climate denier Fascist-in-Chief" takes office? And what can be done to slow down his promised destruction thereafter? Those are just some of the questions discussed on today's BradCast. [Audio link to full show follows this summary.]

FIRST... A few updates on some key races still being tabulated and/or called, unofficially, by media...

  • Democratic Rep. Ruben Gallego has been called as the winner over Republican election denier Kari Lake for the U.S. Senate seat in Arizona.
  • Republican hedge fund CEO Dave McCormick's lead over incumbent three-term Democratic U.S. Senator Bob Casey has narrowed to about 30,000 votes out of seven million cast in Pennsylvania. Crucially, that gap is currently less than one half of one percent, meaning it would trigger an automatic recount in the Keystone State if it holds.
  • As of now, if the current numbers become official in all "called" races, Republicans will hold at least 52 seats in the U.S. Senate majority next year, and Democrats will hold at least 47.
  • Majority control of the U.S. House is still up for grabs, with 16 uncalled races (depending on who you're asking) , though Republicans need just four more seats to win what, as of now, appears likely to be a very narrow majority in the lower chamber of Congress next year. A smaller one than even the thin majority they've been embarrassingly wrestling with over the past two years.

THEN... Donald Trump's nominations to key Executive Branch posts are coming very quickly now. Among them, as of airtime today...

  • Florida Rep. Mike Waltz, a former Green Beret and China hawk for National Security Adviser.
  • Florida Sen. Marco Rubio, "Li'l Marco" as Trump derisively used to call him, as Sec. of State. He has already reportedly said he would not call for a ceasefire in Gaza.
  • Puppy killer and South Dakota Governor Kristi Noem as Chief of the Dept. of Homeland Security.
  • John Ratcliffe, Trump's former Dir. of National Intelligence is tapped to head the CIA.
  • Trump's first-term acting Director of ICE and family separation supporter, Tom Homan tapped for "Border Czar", after telling 60 Minutes last month that he intends to lead the mass deportation of millions of immigrants and that it can be done without separate families: "Families can be deported together," he said.
  • Former New York Rep. Lee Zeldin, who voted against a raft of environmental protection laws in Congress, is named to head the Environmental Protection Agency (EPA).

NEXT... All of that as Trump's transition team at EPA, led by a former oil lobbyist and a former coal lobbyist, prep to reverse every single piece of Joe Biden's climate agenda as possible, including, as the New York Times reports (gift link), "withdrawing the United States from the Paris climate agreement, eliminating every office in every agency working to end the pollution that disproportionately affects poor communities and shrinking the size of national monuments in the West to allow more drilling and mining on public lands."

This comes on the same week that climate advocates from around the globe are gathering in Baku, Azerbaijan for the 29th annual U.N. Climate Summit (COP29) and vowing to continue the global trajectory toward clean, inexpensive, renewable energy to replace the fossil fuels that are heating the globe toward ever-quickening disaster. They claim "they're ready for Trump 2.0" after facing a similar challenge in 2016. But that may be easier said than done.

We're joined today by JEAN SU, Senior Attorney at the Center for Biological Diversity and Director of their Energy Justice Program to discuss the Biden Administration's legacy, including success and failures; what his Administration can now do before leaving office to shore up its successes; and what groups like hers can do to stop, or at least slow down, the destructive attacks on the environment promised by a second Trump Administration.

"What we'll be seeing happening with the Trump Administration is that it is a total, unfettered giveaway to oil and gas. He does not care about clean energy. He does not care about the communities, at all, in any of the places that fossil fuels are being produced or shipped," says Su, whose organization vows "unprecedented resistance".

"I'll be really honest. It is just, truthfully, a dark moment at this time, in terms of our federal work. We are basically facing a trifecta of monopolization of all three branches of government under a climate-denying fascist," she tells me. "We have our Executive Branch taken over by a climate denier Fascist-in-Chief, Donald Trump. He has vowed to 'drill baby drill' with no relief for any clean energy or any care for climate. And he will strip the Environmental Protection Agency [and] the Civil Rights Division of the Dept. of Justice, an entire administrative apparatus entirely smothered, stripped bare, and not functional in any way in terms of actually protecting our environment and our health and safety."

But, she also explains, there are a number of actions that the Biden Administration can still take before leaving office; actions that legal organizations like hers can take after Trump comes in; and actions that the states must take as soon as possible to, at least, mitigate the worst of the damage as long as possible.

"The bright spot in all of this, the place where we are going to see any movement on climate is at the state level," Su argues. "What we've been hearing from different people on the ground is that the initiatives that are happening at the state level are things that people can feel. They are able to see how some climate initiatives will generate the jobs that they need in their own backyards. That gives us a bright spot of actual work to be done." She also cites local efforts to reform electricity regulators, elected Public Utility Commissions and monopoly utility companies. "Those monopoly utilities are stifling rooftop and community solar, and digging in on more fossil fuels. That's an area that is ripe for intervention and organizing. Those are the bright spots that we're going to see the most movement in climate."

We've got a helluva BradCast for you today, on two different topics, both of hugely critical importance to American democracy and this year's elections. [Audio link to full show follows below this summary.]

FIRST UP... On Tuesday, two different major media outlets offered alarming new reports on, among other things, Donald Trump's long-time admiration for Adolf Hitler. Both detailed stories are based in part or full on new interviews with Trump's longest-serving White House Chief of Staff, General John Kelly, who also served as Trump's Dept. of Homeland Security chief before being brought over to head up his White House.

The very conservative Kelly explains in his on-the-record, recorded conversations with the New York Times' Michael Schmidt (free link!) that he had been reluctant, as a longtime, high-ranking member of the military, to speak out publicly about his old boss, given his belief that the military should largely stay out of public politics. But Trump's recent, repeated comments about "the enemy within", in reference to the former President's personal domestic political opponents, and his remarks about unleashing the U.S. military against them, changed his mind.

As of late this afternoon, Fox "News" reportedly still hasn't found time in its 24/7 schedule to play any of the disturbing, freely available audio from Schmidt's three conversations with Kelly, as published yesterday. So we figured we'd go ahead and do so ourselves on today's program. You're welcome!

In short, Kelly's remarks detail how Trump...

  • meets the very "definition of fascist", is "certainly an authoritarian", "admires people who are dictators" and "prefers the dictator approach to government;
  • repeatedly praised Hitler during Kelly's time in the White House and insisted the German dictator "did some good things";
  • doesn't understand either history or the U.S. Constitution, though frequently insisted he knew more about the President's Constitutional authority than the lawyers in the White House Counsel's office did;
  • looked down on those who were disabled or killed on the battlefield, confirming that Trump would often described them as "losers and suckers";
  • and that, never mind his policies, many of which Kelly might agree with, the man simply doesn’t have the character to serve as President of the United States, which is far more important than any particular partisan policy positions.

That, of course, is the quickest of summaries. Tune in for more. And for a really harrowing report on Trump's disturbing views of the military ("only suckers went to Vietnam"), the Constitution, rule of law, and extraordinary lack of character, see Jeffrey Goldberg's article yesterday at The Atlantic, headlined "Trump: I Need the Kind of Generals Hitler Had". It includes more from Kelly and opens with the story of a murdered woman in the military whose family was told by Trump at the White House that he would personally pay for her funeral. Then, when the bill arrived, he was reportedly furious, refused to pay it, and declared "It doesn't cost 60,000 bucks to bury a fucking Mexican!"

NEXT UP... In a sharp, if perhaps welcome, turn, we're joined today by CHRIS MELODY FIELDS FIGUEREDO, the Executive Director of the nonprofit Ballot Initiative Strategy Center.

The record 11 different abortion rights related referendums on the ballot in 10 different states this year, in the wake of SCOTUS overturning Roe v. Wade in 2022, have received a fair bit of attention from the media. But, in fact, there are more than 150 ballot measures on the ballot this year across 41 states right now, on everything from how elections are run, to how redistricting should happen, to who gets paid sick leave, to raising the minimum wage, to stuff like banning trophy hunting and cracking down on retail theft. All of which has the potential to reshape state policy on key issues nationwide for years to come.

In a very lively conversation today with Fields Figueredo, we discuss much of the above and more, including the explosion of the use of citizen ballot initiatives (and reasons for it); ongoing efforts in Republican-controlled states to make such citizen referenda harder to get onto the ballot and more difficult for voters to adopt; why very progressive initiatives are frequently adopted in otherwise very "red" states; how a number of critical initiatives this year could radically change politics as we know it in states like Ohio; whether there is a real correlation between initiatives on the ballot and partisan turnout; some of the sneaky initiatives on ballots in some states this year; and where progressives can go to get advice on how best to vote on often deceptive or confusing referendums. (I've got twenty of them on my ballot here in Los Angeles this year!)

"Ballot guides are my favorite thing," she tells me, admitting that she's a huge "nerd". "There are a number of organizations in your state that may be producing ballot guides that give you information in plain language," Fields Figueredo advises. "Go to organizations that you trust. Also a great resources is the League of Women Voters. Their ballot guides put it in simple language. We also have a Ballot Measure Hub. It's not going to have every single ballot measure in the country, but I would go to trusted news sources or local organizations that are going to try to put these issues into plain language."

Was the Trump Campaign really hacked as they've recently claimed? If so, was it actually by Iran, as they also claim? And, If so, isn't that a far greater threat to national security than the corporate media reporting on it seem to understand, so far? Those are just some of the questions asked and answered on today's BradCast. [Audio link to full show follows this summary.]

BUT FIRST... before we get to our guest today with answers to those questions, another tropical storm has spun up very quickly this week in the record hot Atlantic Ocean. Desi Doyen has the latest today on the climate change-fueled Hurricane Ernesto as it blows by Puerto Rico, which is still rebuilding its crippled power grid from previous storms, and heads toward Bermuda.

NEXT... it was primary Election Day on Tuesday in Connecticut, Vermont, Minnesota and Wisconsin with Congressional and state primaries and even some ballot initiatives for good measure. We've got several noteworthy reported results from all four states after what appears to have been a smooth Election Day in all of them, along with a look ahead and what a number of the contests may portend for November.

THEN... You probably saw the headlines over the weekend about someone calling themselves "Robert" approaching Politico, New York Times and Washington Post with what they claimed to be internal Trump Campaign documents, such as vetting documents for GOP Vice Presidential candidate J.D. Vance. You probably also heard that the Trump Campaign is claiming they were hacked by Iran, and that Microsoft, just one day earlier, had issued a security bulletin [PDF] stating that a hacking outfit tied to Iran had "sent a spear-phishing email to a high-ranking official of a presidential campaign from a compromised email account of a former senior advisor." (That "former senior advisor" appears to be federal convict, Republican dirty trickster and longtime Trump buddy, Roger Stone.)

So, are all of those things actually connected, as the Trump Camp is claiming? And, after Donald Trump repeatedly lauded the publication of internal campaign email documents hacked from the Clinton Campaign by Russia in 2016, how hard should we now be laughing at his own 2024 Campaign spokesperson warning: "Any media or news outlet reprinting documents or internal communications are doing the bidding of America's enemies"?

It's difficult not to chuckle at how the worm has turned, but for our guest today, national security journalist MARCY WHEELER of Emptywheel, joining us to explain what is seemingly being missed by the mainstream coverage of the events --- accurate or not --- as noted above.

First, we try and sort out with Wheeler what is actually known versus still speculative, and how much of it could amount to Team Trump conflating events in hopes of playing the victim and/or protecting themselves from the publication of documents said by "Robert" to be marked as "privileged & confidential". It's certainly interesting to compare how the media have treated these internal campaign documents versus Hillary's in 2016.

But the larger concern, as Wheeler reports this week, is that since Trump doesn't seem to firewall his Campaign documents from the legal documents related to the many criminal cases against him, there are very serious concerns that whoever hacked his campaign emails --- if, in fact, they did --- may also have gained access to highly classified information related to those cases, such as the felony charges he is facing in Florida for having stolen highly classified national security information when leaving office in 2021.

"Donald Trump has not firewalled his campaign from his crimes," Wheeler tells me today. "If you were to hack their computer, it would be a gold mine. It would be a gold mine that would make all of us less secure."

"Remember, we know one of the documents charged against Donald Trump [in the stolen documents case] summarizes the 2019 plans against Iran if they attacked us," she warns. Also, there were documents pertaining to what we know about Iran's nuclear program. She says that, if in fact you have hacked email accounts from the law firm that was vetting J.D. Vance, "then you're getting a lot closer to things that go to Trump's stolen documents case. That's one of several reasons where, if the Iranians were successful, as Russia was [in 2016], you could have a snowballing effect on the national security implications here."

"Most normal humans beings firewall these things," Wheeler asserts, while detailing the way Trump's campaign business is known to have been co-mingled with his legal defense funding and more. "Donald Trump has never kept those separate. We know he hasn't kept them separate. Those are the reasons why the fact that Donald Trump may have been hacked raise additional concerns."

And, oh yeah, there is the newly revealed evidence, via the Dept. of Justice, that someone linked to Iran was recently working on an assassination plot against the former President. That, too, as she details today, plays into this initially hilarious and, on second thought, potentially horrifying turn of events...

Guest: Attorney Keith Barber; Also: Menendez 'guilty' on all counts...

On today's BradCast: Boy, if Joe Biden's "weaponization" of the Justice Department against Trump and Republicans keeps going like this, there won't be any Democrats left who haven't been convicted of a crime! Too bad old Joe didn't realize he should have just packed the courts with corrupt judges, like Donald Trump did. [Audio link to full show follows this summary.]

First up today --- after a kick-off by TikTok's @DanasInspired; a few thoughts on Trump's appearance at the RNC on Monday night after the weekend's failed assassination attempt and his naming of Ohio's Sen. J.D. Vance as his running mate --- we start with news about today's conviction, on all counts, of New Jersey's Democratic Sen. Bob Menendez. The three-term U.S. Senator and former chair of the Senate Foreign Relations Committee was found guilty by a jury on Tuesday after a nine-week criminal trial on charges related to abusing his office to protect foreign associates from criminal investigations and to help funnel money to Egyptian officials. In exchange, prosecutors alleged, Menendez and his wife Nadine Menendez collected millions in gifts, cash and gold bars. She was charged as well, though her trial has been postponed for the time being as she undergoes cancer treatment.

Democratic Majority Leader Chuck Schumer and NJ's Democratic Governor Phil Murphy each called for Menendez to resign following the verdict. He had previously vowed to run for re-election as an independent this year, while Democratic Rep. Andy Kim has been nominated by state voters to run for his seat in November against Republican Curtis Bashaw in the Dem-leaning state.

But Menendez' corruption doesn't hold a candle to Donald Trump's, thanks in no small part to the corrupt jurists Trump appointed to lifetime positions on the federal bench while in office, many of whom are now returning the favor at an alarming rate in recent weeks. On Monday, it was U.S. District Judge Aileen Cannon's turn, apparently, to use her position to let Trump off the hook. In this case, dismissing his 40-count federal criminal indictment brought by Special Counsel Jack Smith in South Florida for Trump's theft of thousands of pages of highly classified national security documents upon leaving office; his repeated refusal to return them to the government; and his attempts to hide them from prosecutors and enlist Mar-a-Lago employees to help cover up and/or destroy evidence of the crimes.

In a remarkable 93-page ruling [PDF] issued on Monday, Cannon dismissed the entire federal case against Trump and his co-defendants on the basis that Smith's appointment as Special Counsel was somehow in violation of the Constitution and federal statutes. The argument made by Trump's attorneys and accepted by Cannon --- who had already been slow-walking the case for months --- was similar to those repeatedly rejected for decades by judge after judge, including appellate courts and, as our guest details today, unanimously by the U.S. Supreme Court in Nixon v. U.S. But Cannon, appointed by Trump at the end of his term and seated after he lost the 2020 election, appears to know more about the law than all of those other lesser judges.

We're joined today by former lifelong Republican and attorney KEITH BARBER, who writes on the law and Constitution for Daily Kos as "KeithDB", where he detailed Cannon's ruling yesterday. He explains why both the text of the Constitution and several federal laws written to allow Attorneys General to appoint Special Counsels in cases where it is important to avoid the appearance of a conflict of interest, prove Cannon's ruling wrong. But, as he argues today, being right on the law doesn't actually matter. "She just wanted to dismiss the case because her buddy Trump appointed her [and] gave her that job. It's time to return the favor, and so she has," he says.

Barber published a second article yesterday listing more than half a dozen Special Counsels and Special Prosecutors appointed similarly to Smith, from Archibald Cox and Leon Jaworski in the Watergate matter to Ken Starr during the Clinton Administration to Robert Mueller's probe of Russian interference on Trump's behalf in the 2016 election to the recent probe of President Biden himself by Special Counsel Robert Hur.

"A lot of people have gone to jail as a result of special counsels appointed by the Attorney General" over the years, Barber tells me. "None of them got the benefit of a rogue judge saying, 'Nope, all of that is not valid.' The Republicans and the MAGAs like to talk about this notion of two-tiered justice and how unfair it's been to Trump. No court accepted the notion that Special Counsels weren't authorized by statute and weren't something Attorneys Generals could do until it came to Trump. That is what two-tiered justice looks like."

If Cannon's ruling on Monday is correct, Barber asserts, then as part of the Mueller probe, former Trump attorney Michael Cohen's three-year prison sentence would have been unconstitutional and Trump associate and convicted pedophile George Nader would need to be freed immediately from his ten-year prison sentence, among other cases convictions that would need to immediately be revisited.

Will this ruling hold up to appellate scrutiny by the conservative 11th Circuit Court of Appeal, much less Trump's corrupted, packed, stolen and activist U.S. Supreme Court majority? We discuss that and much more.

Well, it's been several slow news days since we last spoke on The BradCast. Sigh... [Audio link to full show follows this summary.]

On Saturday, a 20-year old registered Republican tried to kill Donald Trump during a campaign rally in Butler, Pennsylvania with the type of long-range, high-capacity, semi-automatic rifle that Republicans have spent years fighting to ensure are easily available to almost anyone in the country who wants one. Their only use is for mass shootings. Now we've had one at a Republican political rally. Thankfully, the shooter, Thomas Matthew Crooks, barely missed the former President. Though he did kill one rally goer and critically injured two others.

Democrats, from President Biden on down, have since been calling for a cooling of political rhetoric, the type of which led to the assassination attempt on Nancy Pelosi's husband, the attempted kidnapping and murder of Michigan's Democratic Governor Gretchen Whitmer, and the attempted insurrection at the U.S. Capitol, among too many other such recent incidents.

Republicans, on the other hand, from the new Republican Vice Presidential nominee and Trump critic turned toady, U.S. Sen. J.D. Vance on down, have opportunistically used the tragic shooting to blame Democrats somehow for the attempt on Trump's life. Some have gone so far as to blame Biden himself in one for somehow personally attempting to murder Trump. Republicans have also attempted to use the incident as a way to chill factual, peaceful political speech that is appropriately and accurately critical of their standard bearer and the party's efforts to undermine America's Constitutional democracy in favor of autocracy and fascism.

No actual motive has emerged for the shooter who was killed by the Secret Service and has so far been identified as a gun enthusiast and "definitely" a "conservative" by one of his former classmates.

We discuss much more on that story today which should have been our lead and only story today. Sadly, it wasn't.

Down in federal court in Florida, the corrupt Trump-appointed U.S. District Judge Aileen Cannon imagined up a reason to dismiss the entirety of Special Counsel Jack Smith's federal indictment of Trump and two co-conspirators on 40 criminal counts related to his theft of thousands of pages of classified documents when leaving the White House and his refusal to return them, in violation of the Espionage Act and other federal statutes. Cannon's reasons [PDF] for dismissing the case --- questioning the constitutionality of the Special Counsel's appointment --- has been rejected by court after court for years in many other cases where a Special Counsel was appointed (including the Robert Mueller probe of Russian interference in the 2016 election and more recently in the case against Hunter Biden) But, following recent instructions in a solo opinion issued by corrupt Supreme Court Justice Clarence Thomas (signed by no other Justices) in an unrelated case, Cannon dismissed the entire stolen documents case. The Dept. of Justice has said they will appeal. Hopefully, when they do, they will also finally move to have Cannon removed once and for all from this case.

There are just 140 days until the November 5 General Elections. Threats against them by adversaries both foreign and domestic are simmering and/or growing. We discuss some of them --- and much more --- on today's BradCast. [Audio link to full show follows this summary.]

Among our stories today...

  • Kari Lake loses yet again. This time, it's the Arizona state Court of Appeals which has, again, rejected her claims that the 2022 gubernatorial election was stolen from her when she lost it by some 17,000 votes to Democrat Katie Hobbs.
  • Unexplained mass texts, warning of voter intimidation, falsely suggesting they were sent by the Spartanburg County Elections Office during South Carolina's down-ballot primaries last week, should serve as a warning for this November's elections.
  • U.S. officials from the Office of the Director of National Intelligence are reportedly sending their own warnings, privately, to candidates in the U.S. who, they say, are being targeted with disinformation campaigns by foreign adversaries, including Russia, China and Iran.
  • And, in what should serve as yet another warning before November, a pro-Kremlin hacker group, said to be closely allied with Russia's intelligence services, reportedly took down the websites of a number of political parties and other institutions on the first day of voting in Europe's recent parliamentary elections.
  • New York's highest court on Tuesday rejected an appeal by Donald Trump to lift the gag order barring him from attacking witnesses, jurors and the family members of prosecutors or the judge in the hush money/election interference case in which the disgraced former President was recently found guilty of 34 criminal felonies.
  • And, speaking of, the Biden-Harris Campaign is finally using Trump's shameful court losses --- for both felony crimes and civil liabilities --- against him, in an aggressive television ad and mass emails to supporters taking him to task as a "convicted felon" as well as "a liar and a fraud". Of course, even now, Team Biden will have to overcome ridiculous reporting on the effort by the New York Times, whose headline yesterday (until it was changed) read "Biden Campaign Ad Paints Trump as a Felon". Um...."paints" him as a felon?! He is a felon!
  • After telling us for months that President Biden is so mentally debilitated that "he can't string two sentences together," Donald Trump supporters like Sean Hannity at Fox "News" are now working overtime to try and lower expectations for him in advance of next week's first Presidential debate.
  • Maryland's Democratic Governor Wes Moore on Monday pardoned about 175,000 convictions related to marijuana and paraphernalia possession over the years. The long-overdue pardons, following the state's full legalization of marijuana last year, will help tens of thousands of Black and Brown people who were disproportionately charged and convicted over the many decades of our failed, frequently racist "war on drugs". Moore's action follows President Biden's 2022 mass pardon of thousands charged under federal marijuana law and his request to state Governors to take similar action given that most cannabis related crimes were brought under state law.

How the U.S. has fallen prey to a decade-long Russian intel op; Also: Lindell owes $5 million for 2020 'election data' challenge; Media ignore good Biden polling amid ill-considered bids to replace him...

On today's BradCast: As of this week, if it wasn't clear before (and, obviously, for many, it was not) it is now clearer than ever that the U.S., its corporate media, the Republican Party, its front-runner for the 2024 Presidential nomination (and, sadly, even too many on the "left"), have all fallen prey --- knowingly or unknowingly (it doesn't really matter) --- to a wildly successful, decade-long Russian intel op. [Audio link to full show is posted below this summary.]

From the Hillary emails in 2016 to the Hunter Biden laptop in 2020 to the Biden Burisma "bribery" allegations that fell apart so spectacularly this week with the arrest of the man who House GOPers cited as the lynch-pin for their entire Revenge Impeachment case against President Biden, it turns out it was all part of a wildly successful foreign campaign to divide and threaten American political system.

Turns out Alexander Smirnov, that guy with the false Burisma claims about the Bidens, apparently got it all from Russian intel operatives who have, for the past ten years, been pushing all of these phony narratives straight out from the Kremlin through various useful idiots, onto the set of Fox "News" and the rest of the rightwing media, into the mouth of the disgraced former President, and straight through to the hearing rooms of the U.S. Congress where it was shared --- either knowing or unknowingly (it doesn't really matter) --- by GOP dupes.

It's quite an extraordinary success story, in truth. For Vladimir Putin. And a shameful failure of our corporate mainstream media to even notice much of it happening in real time. They also played the role of useful idiots when it counted the most over much of the past decade and right on up until today.

Josh Marshall described it as "A Bigger Story Than You Can Possibly Imagine" this week, and I believe he is correct. Much more on all of that --- and Putin's deadly rise --- on today's program.

ALSO TODAY...

  • MyPillow CEO Mike Lindell is not only an election denier and grifter. He also won't pay off a bet. In 2021, Lindell claimed to have obtained "irrefutable" evidence that the 2020 election was stolen from Donald Trump by China over the Internet. His evidence was Internet data packets that he claims to have obtained from a "whistleblower". He offered $5 million to anyone who could prove the data wasn't from the election. A two-time Trump voter did so in 2022. The data, he proved, was nothing but junk. But Mike wouldn't pay up the $5 million he offered via his "Prove Mike Wrong" challenge. A private arbitration panel agreed the man was owed the money. Cheap chiseler Mike still wouldn't pay. This week, a federal judge ordered him to do so.
  • Corporate media spend a lot of time focusing on Joe Biden's bad polling numbers against Donald Trump. This week, a new survey by Quinnipiac University, a major pollster, found Biden beating Trump among registered voters nationally by 4 points. So Politico covered the new survey with this headline: "Poll: Nearly 70 percent of voters say Biden is too old to serve again".
  • Is it any wonder so many on the left are still under the misguided impression that someone, anyone, who knows who?, but certainly someone, should replace Joe Biden on the 2024 ballot! Because that unidentified someone would certainly have a better chance of defeating Donald Trump this year! Well, even if there was evidence of Biden not running this year (there isn't), recent polling doesn't even back up the assertion that other Dems would do better against Trump than Biden would. But, hey, if you've got a realistic scenario to replace Joe Biden that won't result in a second Trump Presidency, please feel free to email me! Among our many stories for your listening pleasure, amusement and outrage today...

  • Jon Stewart is back on The Daily Show! At least on Monday nights. At least for this year. And, boy howdy, was he missed. Other than looking about 20 years older, he literally hasn't missed a step over the 9 years since he's been away from the show, both comically and, more importantly, politically. His first night back included an epic opening monologue that framed the various concerns among Democrats about Joe Biden's age in a way that nobody else has or could. Hopefully, it helps to kick off the serious conversation that Democrats need to start having amongst themselves to begin coming to terms with the fact that one of the most effective and, yes, oldest Presidents of our lifetimes (or ever) will be running for re-election this November. We've got lots to say here. But, much more importantly, so did Stewart last night.
  • Battling a massive Nor'easter and racing the clock against whatever may happen in the Special Election for U.S. House in New York's 3rd Congressional District tonight, in the contest to fill the expelled Rep. George Santos' seat, House Republicans take a do-over on Tuesday after their embarrassing failed effort last week to Revenge Impeach the Secretary of Homeland Security Alejandro Mayorkas. The first impeachment ever of a sitting cabinet members is not for any actual "High Crimes and Misdemeanors" as required by the Constitution, but for...something something ...border policy...something something. (And because they haven't been able to figure out yet how to Revenge Impeach Joe Biden.)
  • After insisting that any new aid package for Ukraine must include a massive new package for the U.S. Border Security. And then after striking a bipartisan deal with Democrats for that Border Security bill they insisted on. And then after insisting that any new aid for Ukraine not include a massive new package for the U.S. Border because Donald Trump told them to kill the Border provisions, because he needed an issue to run on in November....Senate Republicans (some of them anyway) joined Democrats after an all-night filibuster to pass a foreign aid bill for Ukraine, Israel and Taiwan. House Speaker Mike Johnson, however, has already said he'll do everything he can to keep this National Security measure from ever being allowed up for a vote on the House floor. Because Donald Trump told him to.
  • In the greatest tradition of Banana Republic strongmen, Donald Trump is reportedly planning to install his own daughter-in-law Lara Trump as co-Chair of the Republican National Committee and the Chair of his own Campaign as the RNC's Chief Operations Officer. The GOP takeover by a twice-impeached, four-time criminally indicted, one-term failed President is now all but officially complete.
  • And then we finally get to the Hur Report today and the corporate mainstream media's epically failed coverage of it's release by Special Prosecutor Robert Hur, who was appointed by Trump to the DoJ. Last week, the Dept. unsealed the full, unredacted, nearly 400-page report [PDF]. Hur was tapped by Attorney General Merrick Garland to probe the small number of classified documents that Joe Biden's attorneys discovered at one of his old office spaces and in his home.

    The headline for the report's release should have been "Special Prosecutor Fails to Find Evidence of Crimes in Biden Classified Docs Probe", at least if one bothers to read what Hur actually detailed in the bulk of his report.

    That, as Hur himself points out, by way of contrast to the many reasons that 40 criminal felony counts were brought against Trump under the Espionage Act after he stole tens of thousands of pages of highly classified documents upon leaving office and then refused to return them to the Government.

    "Most notably, after being given multiple chances to return classified documents and avoid prosecution, Mr. Trump allegedly did the opposite," writes Hur on page 11. "According to the indictment, he not only refused to return the documents for many months, but he also obstructed justice by enlisting others to destroy evidence and then to lie about it. In contrast, Mr. Biden turned in classified documents to the National Archives and the Department of Justice, consented to the search of multiple locations including his homes, sat for a voluntary interview. and in other ways cooperated with the investigation."

    The report went on for hundreds of pages, laying out exculpatory evidence after exculpatory evidence, as former DoJ prosecutors Andrew Weissman and Ryan Goodman detail. That, even as Hur rifled through Biden's personal diaries searching for evidence of a crime, as brilliantly highlighted by national security journalist Marcy Wheeler.

    But the screaming HEADLINE NEWS!!! that our corporate media took away from all of it in dozens and dozens of stories was that the Trump-appointed Hur included remarks in the report having nothing to do with whether Biden should be charged with a crime or not, but that Hur, not a medical professional, describes as the President having a "poor memory" and "diminished faculties".

    And you wonder why our country is going to hell in a handbasket?

With Democrats still wetting themselves over last week's NYT/Siena polling showing Donald Trump beating President Biden a year from now in five of six swing-states, we finally carved out some time on today's BradCast to dig into the matter.

After a few news headlines, it's on to "that polling" that has freaked out so many regarding Biden's odds next year. It has spawned a thousand explanations. But mine, in short, is not unlike Margaret Sullivan's at The Guardian, where she argues that the bottom line is --- whether the polling is accurate or not --- the media are failing to accurately inform the American people. Not about the "horse race", but about Biden's accomplishments in office and the unprecedented dangers of Trump's vow to move the U.S. to become an authoritarian regime if he is allowed back in office.

President Obama's 2012 campaign manager Jim Messina argues today in Politico there is "no need to panic" over the polling numbers, based on his experience presiding over similarly grim numbers for the incumbent Prez back in 2011, when data guru Nate Silver suggested Obama was "toast" a year out from the election (which he ended up winning); New York Times Magazine gave him just a 17% chance of prevailing (apparently he beat those odds); polling by Politico showed Obama tied with Mitt Romney in 10 battleground states (Obama would go on to win 9 of them); and a December 2011 Gallup poll showed Obama losing to Romney across 12 battlegrounds states (he ended up winning 11 of them.)

In short, polling this far out doesn't mean much. But there are still plenty of reasons to be concerned. And plenty of reasons to spend time not on the horse race, but on the FACTS that Americans apparently aren't receiving from their mainstream media outlets. The FACTS of Joe Biden's extraordinary accomplishments in his first term, rivaling LBJ or FDR, and the chilling FACTS of what Donald Trump himself has vowed to do if he is re-elected, rivaling Hitler and Mussolini. (And, no, that is not hyperbole.)

As we discuss today, here is a new poll from Navigator Research revealing how wildly popular Biden's accomplishments are, whether the American people realize he has implemented them or not. And here is a list of 27 "insane things" Trump has promised, in his own words, to do if he wins a second term. And that list was created in September. He has doubled and tripled down on many of them since then.

After discussing much of the above, we open up our phone lines to listeners today, to get their explanations for all of this. Many of whom seem to get it, but a few, sadly, clearly do not. They are still buying the lies being spun by Trump, Republicans and Fox "News", because real news outlets are doing such a lousy job of telling the real story. The actual FACTS.

We're old enough here on BradCast to remember when the Republican Party and their scofflaw cult leader used to pretend, at least, to believe in the rule of law and the U.S. Constitution and even the Judiciary system. You may need to buckle up for today's show --- or stay away from sharp objects --- for your own safety. Among the insane amount of stuff --- breaking and otherwise --- that we do our best to cover today...

  • First, some listener mail following yesterday's program on Section 3 of the 14th Amendment to the U.S. Constitution, which makes it pretty clear that Donald Trump is Constitutionally barred from running or holding any federal office after having "engaged in insurrection or rebellion" against the U.S. Government on January 6, 2021. That same "Insurrection Disqualification Clause" will come up again later on today's show, so pay attention!
  • Oh, look! It's not only tens of thousands of documents that Trump stole upon leaving the White House, Haaretz is reporting that he appears to have stolen priceless Israeli artifacts as well! "Antiquities belonging to Israel have been kept for the past several months at former U.S. President Donald Trump’s Mar-a-Lago estate, and senior Israeli figures have unsuccessfully tried to have them returned to Israel. ... Among the antiquities are ancient ceramic candles which are part of Israel’s national treasures collection. They were sent to the U.S. in 2019 with the approval of then-Director of the Israeli Antiquities Authority, Israel Hasson, on the condition that they be returned within weeks, yet almost four years later, they have yet to be returned." Yup, we're also old enough here to remember when Trump pretended to love Israel too.
  • Wrapping up just prior to airtime, the first federal court hearing before the unrecused, Trump-appointed U.S. District Judge Aileen Cannon in Special Counsel Jack Smith's 38-count criminal indictment against Trump and his valet, Walt Nauta, in the stolen documents case. The DoJ seeks a speedy trial to begin in December. Team Trump wants an indefinite delay until some point after the 2024 election. Reports from those in the courtroom suggest the Judge was "disinclined" to grant the DoJ's requested December trial, "but also seemed skeptical" of a delay until after 2024. Her decision is supposedly coming "soon".
  • In Georgia, where Trump and a broad array of co-conspirators are likely to be charged next month (if not sooner) as part of Fulton County District Attorney Fani Willis' criminal investigation of his attempt to steal the 2020 election in the Peach State, the state's Supreme Court, on Monday, unanimously rejected Team Trump's ill-considered preemptive motion to block any indictment and to remove Willis from the case.
  • The biggest news of the day, arguably, is Trump's long, rambling social media revelation on Tuesday morning that he received a letter from the Justice Dept. on Sunday, notifying him that he is the target of Jack Smith's broad investigation surrounding the January 6 insurrection and other efforts to steal the 2020 election (and otherwise profit off of false claims that it was stolen from him). Even though the source of the targeting claim is Trump, there are still a number of tea leaves to be read here, including who may now be cooperating with Smith's probe on yet another imminent indictment against the disgraced former President.
  • BREAKING just moments before airtime today, Michigan Attorney General Dana Nessel announced that she had filed criminal charges against 16 fake Republican electors in the state, including the co-chair of the MI GOP and the state's Republican National Committeewoman. Each of the "false electors" signed paperwork claiming to be MI's "duly elected and qualified electors" after the 2020 election, Nessel notes, even though Joe Biden won the state. Each have now been charged with eight felony counts, including forgery.
  • A number Republican candidates for the 2024 Presidential nomination --- a contest in which Trump is currently the far and away front-runner, despite being indicted on (so far) 71 criminal felony charges at both the state and federal level, with more coming soon --- were asked to respond to his claim about being targeted and likely soon indicted by Jack Smith in his January 6 probe. Only one of them (so far), was smart enough to point out that any charges related to the insurrection will further disqualify him from both office and the ballot under the U.S. Constitution's "Insurrection Disqualification Clause" (Section 3 of the 14th Amendment). Will any of his other supposed opponents have the moral courage to point that out?
  • Voting rights advocates were stunned last month when Chief Justice John Roberts and Justice Brett Kavanaugh joined the Court's three liberal justices in a majority to uphold the Voting Rights Act and its ban on racial gerrymanders. The case came out of Alabama and the opinion, written for the majority by Roberts, held that the state's U.S. House District maps violated the VRA by including just one Black majority District out of seven. (Black voters comprise nearly 30% of the state's population.) Roberts' SCOTUS opinion [PDF] ordered a new map in the state that "will need to include two districts in which Black voters either comprise a voting-age majority or something quite close to it." On Monday, following a special session of the GOP-controlled state legislature, the newly drawn map was revealed to include...just one majority Black district. Again. Apparently, while Republicans no longer give a damn about the rule of law, they also have no problem defying the U.S. Supreme Court either.

Trump and his henchmen facing more consequences by the day; Trump apologists in Congress hilariously face-planting...

Today on The BradCast: It's taken longer than it should have to get here, but Accountability Season for Trump World is finally beginning to fire on all pistons, even as his stooges in Congress, pretending to bring "accountability" for..."Biden crime family" something or other...continue to step on rakes. That part is hilarious. [Audio link to show follows this summary.]

First up today, the GOP House "whistleblower" face-plants...

  • Yesterday, we quickly detailed a supposed "IRS whistleblower" claim that Trump-appointed and Biden-retained U.S. Attorney David Weiss was somehow blocked by Biden's DoJ from bringing anything more than a couple of minor misdemeanor charges against Hunter Biden for under-paying two years of taxes. In a letter sent to Sen. Lindsey Graham, however, Weiss made clear that the GOP argument was completely false and that he was given full agency to investigate and prosecute anything he wanted.
  • Then, just after airtime last night, there was news about yet another supposed GOP "whistleblower" blowing up. This one has long been touted by House Oversight Committee Chair James Comer...at least until the guy, Gal Luft, suddenly went missing a few months ago. Still, Comer, claimed the dude was ready to spill the goods on a massive bribery scandal regarding the Bidens and illicit payoffs from China. Comer appeared on Newsmax just three days ago with a host describing Luft as "well connected in intelligence circles in Washington" and "not just some weird guy who popped up out of nowhere." Comer agreed that Luft was "very credible" and that people on MSNBC who said he looked like a fool would be sorry. Well, the guy is still on the lam, but on Monday, we learned why. The DoJ unsealed an 8-count indictment against Luft, a dual U.S.-Israeli citizen, related to working as an unregistered foreign agent for China; brokering illicit Chinese weapons and Iranian oil deals; and unlawfully trafficking arms to places like Libya, UAE and Kenya. Other than that, he's "very credible" and will soon be cracking open the Biden Crime Family case with House Republicans who don't look like "fools" at all.

In news today of actual accountability for real crimes...

  • Grand jurors are being convened in Atlanta today, where they will soon be voting on indictments in Fulton County, Georgia District Attorney Fani Willis' broad criminal probe of the attempt to steal the 2020 Peach State election by Donald Trump and his henchmen, including Rudy Giuliani, fake electors, and likely many others. Let the accountability begin!
  • Accountability is already under way for a number of Trump's top 2020 legal henchmen. In recent days, a panel of the D.C. Bar found Rudy Giuliani should be disbarred in the District for bringing "frivolous" and "destructive" lawsuits after the 2020 election that falsely alleged fraud. The formerly respectable NYC Mayor turned disgraced Trump attorney has already had his license to practice law suspended in New York, but still has a few more chances to appeal his case in D.C., even after the panel determined that his misconduct was so disgraceful that it "sadly transcends all his past accomplishments."
  • L. Lin Wood, a formerly respected Georgia attorney turned Trump wingnut was allowed by the State Bar of Georgia last week to transfer to "Retired Status effective immediately," rather than face disciplinary charges from the state Bar for his part in attempting to steal the 2020 election for Trump with bogus lawsuits. The retirement is "unqualified, irrevocable, and permanent," and bans him from practicing law in Georgia or any other jurisdiction. But it allows the seemingly mentally unstable, formerly high-profile 70-year old attorney to retire to his $16 million South Carolina plantation without consequence.
  • John Eastman, the disgraced, far-right Trump attorney responsible for dreaming up the unlawful and unconstitutional scheme to have then Vice President Mike Pence block Joe Biden's Electoral College certification in Congress on January 6, 2021, is in an ongoing trial with the California Bar Association facing 11 disciplinary charges likely to result in the loss of his license to practice law in the Golden State.
  • Late last week, disgraced, deadbeat Trump advisor and former Campaign Chair Steve Bannon was ordered by a New York Judge to pay his own former attorneys nearly $500,000 after stiffing them for legal fees related to representation in his unsuccessful trial for Contempt of Congress after refusing to answer subpoenas from the House Jan. 6 Committee (he was sentenced to 4-months in prison, but is currently free pending appeal) and many other crimes and grifts.
  • MyPillow, the Minnesota-based company founded and run by 2020 election fraud conspiracist Mike Lindell, is reportedly auctioning off factory equipment and sub-leasing manufacturing space after, according to Lindell, losing $100 million in business following his continuing, evidence-free claims that the election was stolen from Trump. Now he's mad at "the box stores, the shopping networks, the shopping channels" because "all of them did cancel culture on us." We're all crying in our Bud Light beer for ya, Mike.

And finally...

  • While Accountability Season is finally beginning, Climate Season is, sadly, fully underway all across the globe and, as Desi Doyen details in our latest Green News Report, here at home with record temps broiling the U.S. Southwest and hurricane-like downpours drenching the U.S. Northeast. (Rainfall in Vermont over the past 24 hours has now reportedly outpaced 2011's Hurricane Irene.)

Critics charge state laws block him from doing so, even if he wanted to...

Despite newly revealed cybersecurity flaws in Georgia's statewide touchscreen voting systems; a weeks-long breach by right-wing operatives of the sensitive voting and tabulation software used across the state; and a growing clamor by both the public and state officials for decisive action to try to plug some of these vulnerabilities before next year's Presidential election, all evidence obtained by The BRAD BLOG to date suggests Georgia's Secretary of State has little interest in taking any action at all. At least not before next year's critical contests in the battleground state.

Even if Republican Secretary of State Brad Raffensperger did want to take action, we have learned, he has yet to even begin necessary steps toward state certification of Dominion Voting Systems' newly created software said to remedy some of the recently disclosed cybersecurity flaws. Moreover, well-informed critics argue any software upgrades to the state's touchscreen Ballot Marking Devices (BMDs) would still result in violations of fundamental legal requirements for the state's voting systems.

The path toward nailing down what Raffensperger's office is or isn't doing; what they may or may not do under state law; and what they are or aren't telling the public about all of it has been an odyssey over the past days, amid misleading discussion with a representative of the Secretary's office, contrary information from an official at one of the country's few certified independent voting system test labs, and a curious admission by a representative for Dominion, the state's election system vendor.

The only thing fully clear as of now: Despite calls from cybersecurity and elections experts to mend Georgia's insecure, unverifiable voting systems before next year's Presidential contest, the state insists they will not be upgrading the Dominion voting software until 2025. What has become clearer to us in recent days is that the Secretary of State cannot upgrade the systems legally, at this point, even if he wanted to --- which, evidently, he does not...

It's a good day on The BradCast. Let's enjoy it while it lasts. [Audio link to full program follows below this summary.]

After a full year of five-alarm warnings on this program about the the Moore v. Harper case at the U.S. Supreme Court, and the havoc its so-called Independent State Legislature theory would wreak on American elections and hundreds of years of American election law if approved by a Court majority, I'm very happy to say, the grave threat is over. For now.

By a 6 to 3 majority, with Chief Justice John Roberts and Justices Kavanaugh and Barrett joining all three liberals on the Court, the fringe ISL theory was soundly rejected (PDF). That theory, pushed by Rightwingers --- especially by Trumpers after the 2020 election --- holds that the U.S. Constitution's Elections Clause, allowing State Legislatures to determine "times, places and manner" of federal elections in their state, also give those Legislatures plenary power to make all laws pertaining to federal elections without the possibility of any sort of judicial review.

Had the Supreme Court majority gone the other way in this case, as many feared, State Legislatures would have had the only power to make such laws and rules. No Gubernatorial veto or state Supreme Court or state constitution --- or even state ballot initiative adopted by voters --- could have blocked them. They could have instituted partisan gerrymanders, even if their state's constitution barred them. They could have chosen which Presidential electors to send to the Electoral College, even if state voters had selected a different candidate. (It is under the ISL theory that Trump and his legal stooges like Rudy Giuliani and John Eastman tried to convince State Legislatures in Georgia, Arizona, Wisconsin, etc., that they had the power to choose Trump electors, even though voters in all of those states had voted for Biden.)

Voting rights advocates are breathing a huge sigh of relief today. Had the Court gone the other way, as many feared, more than 170 state constitutional provisions, over 650 state laws delegating authority to make election policies to state and local officials, and thousands of regulations down to the location of polling places could have been affected or simply overturned, according to Brennan Center for Justice.

Tuesday's news follows several other, surprisingly not insane rulings by the Court in recent weeks, where enough rightwingers peeled off to join the Court's Liberals to avoid worst case scenarios. As Slate's Mark Joseph Stern concludes in his article today on the Moore v. Harper decision, headlined "John Roberts Has Wrested Back Control of the Supreme Court": "So far this term, [Roberts] is once again in the driver’s seat—and the court is acting a lot more like a court than this time last year. It’s too early for grand conclusions. But it sure looks like a majority of the justices want us to know that they are backing away from the brink."

There are a few more major rulings to come --- on Affirmative Action in college admissions; on Biden's student loan forgiveness program; and on another dumb anti-LGBTQ "religious rights" case --- before this year's term wraps up at week's end. Decisions are likely to come on Thursday. But, even adverse rulings on those issues, as expected, are unlikely to have the democracy-rattling effect of what the case over the ISL theory would have wreaked, or had the Supremes gutted what is left of the Voting Rights Act (which was also feared but, also surprisingly, the Court did the right thing instead by following both precedent at the Constitution.) Perhaps a few members of SCOTUS' far-rightwing have learned a thing or two since their disastrous Dobbs decision overturning Roe v. Wade this time last year.

On the other hand, having not learned a think since this time last year is our twice-criminally indicted former President. On Monday night, CNN released the actual audio recording of a meeting cited in Special Counsel Jack Smith's 37-count felony indictment [PDF] against Trump on charges related to violations of the Espionage Act and obstruction of justice. It's a tape of the July 2021 meeting at his Bedminster, New Jersey resort, as described on pages 15 & 16 of the indictment, wherein Trump claims to be showing classified documents on military plans for an attack on Iran to a group of people writing a book.

Trump is heard in the audio telling his cackling audience that the documents he is showing them are "highly confidential," "done by the military [and] given to me," and that he no longer had the power to declassify them, now that he was out of office.

His recent explanation about the incident to Bret Baier of Fox "News", when asked about the description in the indictment prior to the release of the actual tape on Monday night, appears to be in pretty stark contradiction with what is heard on the audio tape. We play both recordings in full today so you can decide.

We're joined again today by former Republican attorney and U.S. Army Captain turned Daily Kos blogger KEITH BARBER to discuss the Trump tape; how it compares to its description in the Mar-a-Lago indictment; who might have leaked it and why; what the same behavior would have earned him as a member of the military; and what it is likely to mean for Trump's stolen documents case as it plays out in Florida under a wildly inexperienced and arguably corrupt Trump-appointed federal judge.

Cracks emerge in wall of secrecy surrounding mysterious County meeting in small town conspiracy with national implications...

At first glance, a closed-door executive session of the Board of Elections at the Coffee County Courthouse in the battleground state of Georgia appeared to involve nothing more than discussion of that day's resignation letters from then-Election Supervisor Misty Hampton and her assistant over their purported cheating on timesheets.

But the previously undisclosed, simultaneous presence of an unacknowledged quorum of County Commissioners at that executive session --- a secret meeting during a secret meeting, a game-changer confirmed by The BRAD BLOG --- combined with curious doth protest too much efforts the County is still using to defend its secrets about the supposedly humdrum assembly, indicate the February 25, 2021 meetings (now known as meetings plural) and surrounding events were the nexus of a much broader statewide, perhaps even nationwide, cover-up.

That night, the very same reputedly run-of-the-mill Thursday in February when the elections board gathered at the Courthouse, MyPillow founder and close Trump associate Mike Lindell --- a chief Stop the Steal bankroller --- landed his private jet in the county's tiny seat of Douglas, population 11,685. A few hours earlier, flight records show, he landed in D.C. A few hours before that, his plane took off from a runway not 15 miles from the private Mar-a-Lago club belonging to a certain twice-impeached Florida Man named Donald J. Trump. Why did Lindell fly so circuitously from the Palm Beach area to the nation's capital and then back down south to rural Coffee County, of all places?

And why did he want to speak with Misty Hampton, Coffee's resigning Election Supervisor? Evidence yielded from a years-long lawsuit by actual election experts challenging Georgia's Dominion voting system has revealed that the far-right bedding baron's lawyer, Kurt Olsen, tried to get ahold of Hampton the previous evening to talk, as word spread that she'd be dismissed the next day. Why would he want to do that?

Over the January prior to the unexplained meeting(s) --- in fact, beginning just the day after armed and violent Trump supporters assailed the U.S. Capitol in hopes of preventing Joe Biden's 2020 election victory --- a motley mix of mostly MAGA operatives illicitly entered the Coffee County elections building on multiple occasions. The breach was funded and organized by Trump attorney Sidney Powell, that prolific and since-sanctioned filer of failed lawsuits seeking to steal Biden's 2020 win.

One client of the breach-funding Powell, it turns out, was "fake elector" Cathy Latham, the former Coffee County GOP chair. Latham was found to have helped facilitate --- and to have lied about her presence during --- the breach at the elections office, where the invited intruders copied Dominion's proprietary software that is still to be used in the 2024 Presidential election in Georgia and numerous jurisdictions beyond.

Hampton, as director of elections for the Republican-leaning county, welcomed the Powell-paid team into the local elections office to have at the voting equipment, tabulators and sensitive election management systems.

With statewide voting systems gravely compromised by the ensuing breach --- Georgia Secretary of State Brad Raffensperger forces every county to use the same touchscreens, also employed in more than a dozen states nationwide --- and with traces of top Trumpers everywhere, the scandal is, as the county seat's Mayor Pro Tem recently put it, "only getting bigger."

Indeed, Atlanta-based District Attorney Fani Willis is reportedly investigating the Coffee County breach, along with Team Trump's multistate plot to gain access to and copy data from voting systems in other states as well. The scheme, as we have since learned, was hatched during a notorious December 2020 meeting in the Oval Office with Trump present. That fact came to light in testimony to the U.S. House subcommittee that investigated January 6th.

Frustrated, fighting back tears, Douglas Mayor Pro Tem Olivia Pearson, a lifelong Coffee resident and voting rights activist in the majority black seat of the majority white county, said at a recent gathering as the reality of the breach finally began galvanizing local residents, "We have got to make it right. We can't keep covering it up!"

Starting in earnest last month, local residents have increasingly attended the Board of Elections' open meetings, only to be told, more than once, by its unapologetic Chairman Wendell Stone --- who some locals are said to describe as "Chairman Stone(wall)" --- to stop asking questions.

Of course, that makes us want to ask many more questions about what really happened among the cows and cornstalks in the rural Peach State county. Such as: Why did Hampton and her assistant who helped facilitate the unlawful Trump/Powell/MAGA breach to illicitly copy and distribute Coffee County's sensitive voting system software actually tender their resignations on February 25, 2021?; Did local and state officials know about the breach and attempt to cover it up with secret meetings? What on Earth was Mike Lindell doing there for several hours that night?; And why has the office of Republican Secretary of State Brad Raffensperger, heralded by some as a 'moderate Republican' hero for not helping Trump steal the state's election in 2020, denied the severity of the breach and lied by both omission and commission to aid in covering it all up?

And, yes, all of this matters at the national level --- not only to the Coffee residents, who have lately found themselves in a fight they never asked for over their beloved county's soul...
