The Secret Koch Brothers Tapes...

By Brad Friedman on 5/12/2008 8:19pm PT

We believe the following video of Bill O'Reilly going ape-shit while he worked for Inside Edition years ago has at least as much legitimate news value as old video tapes of Barack Obama's former pastor. Thus, we're running it, as did Crooks & Liars where we caught it originally, despite CBS' success in having it yanked at least once from YouTube (we're guessing, after threats of lawsuits from the litigious Culture Warrior himself.)

The audio from O'Reilly's temper tantrum is not safe for work, nor for anybody who actually believes O'Reilly is just a swell, moral and righteous fellow, whose only "looking out for the folks"...

UPDATE 5/14/08: Colbert responds. And it's high-larious.

You're a Great American, Thor Hearne...
By Brad Friedman on 5/12/2008 2:56pm PT

The parade of disenfranchised and/or soon-to-be-disenfranchised elderly, nuns, U.S. veterans (even those disabled in Iraq and Afghanistan), hurricane victims, and other Democratic-leaning voters continues this week, following the recent Supreme Court decision to allow the disenfranchisement of thousands of such (previously) legal voters in Indiana.

While much of the coverage --- such as today's report by Art Levine at HuffPo --- has been intelligent and serious, the New York Times took the lazy way out in a front page story today, lending credence to the discredited GOP "voter fraud" huckster, Mark F. "Thor" Hearne, with quotes and reference to his defunct, sham organization, The American Center for Voting Rights (ACVR).

Writing about him and it, as if he were legit, and as if the ACVR were still in operation, the article's author, Ian Urbina --- who has written very good reports in the past --- didn't bother to mention the controversy surrounding Hearne and his group, that they had disappeared themselves under the glare of the U.S. Attorney Purge scandal, that they had lied on federal tax forms claiming that the group had not "attempted to influence national, state, or local legislation, including any attempt to influence public opinion on a legislative matter or referendum" (fraudulent tax form here), that Hearne himself has been behind every step of the systematic and dishonest scheme to get laws of this sort on the books across the country, and finally, Urbina didn't even bother to note that Hearne had been the national general counsel to Bush/Cheney '04 Inc. and remains the top election lawyer for the Republican National Lawyer's Association.

It's all easy to find, of course. We've even set up a Special Coverage page at https://BradBlog.com/ACVR so folks like Urbina --- and NPR who similarly quoted Hearne as if he were legit recently --- wouldn't have to look too far.

But darn that "liberal media" again. For the record, we sought comment from Urbina, who we've been a source for in the past, and who has done good work over the years, but he declined to comment on our criticism here.

In the days immediately following the horrible SCOTUS decision, we quickly turned to our old home state of Missouri, where the huckster Hearne has been basing his well-funded voter suppression operation on behalf of the White House and the RNC for years, going back at least as far as the moment we originally outed him in 2005 just after he had created the not "non-partisan," tax-exempt front group, ACVR, and testified just days later at a Congressional hearing, led by Ohio's felonious Rep. Bob Ney. Hearne told of fraud having been committed in Ohio in 2004, but by John Kerry's campaign, after Hearne described himself to legislatures only as a "longtime advocate of voter rights and an attorney experienced in election law."

We called on MO's Sec. of State Robin Carnahan for an exclusive interview, while we were hosting KPFK's "Special Election Year Coverage" last week (audio here), and took the opportunity to inform her, if she didn't already know, that Hearne's group lied on his federal tax form, and has, to this day, illegally failed to discose the source of his group's $1 million in start-up funding.

Our interview with Carnahan took place even as Missouri's Republican legislature was in mid-debate on the House floor about a new state Constitutional Amendment to require proof of citizenship in order to register to vote and for a similarly draconian Photo ID requirement as those approved by the SCOTUS for the polling places in the Hoosier State.

Kansas City Star reporter Dave Helling noticed our interview with Carnahan, and wrote a quick item about it, noting her characterization of these anti-voter efforts as "absurd," and alleging that she has not been quite as available to "reporters in the state"...

Appearing yesterday on the radio with well-known voting machine critic and blogger Brad Friedman, Secretary of State Robin Carnahan called the push for photo ID "absurd."

(Carnahan's discussion --- by telephone --- was rare. Her office usually refuses to make her available for questions from reporters in the state.)

...But whether the MO SoS has been available to Helling or not, she has been making quite a bit of noise ever since, concerning what a study by her office has found to be some 240,000 largely Democrati-leaning voters in the Show-Me State who would be disenfranchised by the Republican law as she explained to us on air.

Meanwhile, over in Arizona, a law that has already made it on to the books will similarly be keeping legal Americans from casting their legal votes this year.

Thor Hearne deserves a raise...

Conservative Media Begin Plans to Ignore Incident as Soon as Possible...
By Brad Friedman on 5/10/2008 12:57pm PT

Following their recently announced policy to keep disabled vets from registering to vote, the Bush Administration's contempt for U.S. troops continues apace, as it's been revealed that Dover Air Force base had contracted out cremation of service members killed in Iraq and Afghanistan to a local pet crematorium. Classy stuff.

David Edwards at RAW STORY has a video report, including the Pentagon's apology (for having gotten caught, apparently):

Fox’s Jennifer Griffin reported...“There is no evidence any soldier remains were ever comingled with pets but this soldier reported back the treatment of our fallen soldiers was undignified at best. When his friend’s coffin was taken to the crematory it was not flag draped and when it arrived the only sign outside the crematory said 'Friends Forever, Kent County Pet Cremation Service.' Yesterday, a press secretary apologized on behalf of Secretary Gates to the families of fallen soldiers.”

Rush Limbaugh and Sean Hannity have already begun plans to not mention the story as soon as possible, since it occurred during a Republican Administration.

On the other hand, had this occurred during the previous administration, how often, and for how many years, do you suppose you'd have heard it repeated in the Wingnut Media Echo Chamber as: "Bill Clinton despised the U.S. military! He hated them so much, he sent our heroic fallen troops to the dog pound to be cremated, for crying out loud! Just to show his disdain! I kid you not!"

The 2008 RNC Playbook: Same As 2006 Playbook, 2004 Playbook, Add Nauseum...
By Brad Friedman on 5/9/2008 7:38pm PT

Though the candidates may change (sort of), the playbook remains the same.

That playbook --- the public face of the Republican National Party, in any case, as you can expect to see it from here through November --- is posted below, courtesy of BobR, who sends the following along with it.

My brother is a registered independent in a suburb of Atlanta, GA. Yesterday, he received a letter and questionnaire from the Republican party. The letter contained his (independent) registration number, and addressed him as Fellow Republican.

The questionnaire was a push poll of the nastiest variety. Sample questions:

Should Republicans do everything they can to prevent liberal Democrats from repealing the USA Patriot Act and other important laws that help our intelligence agencies protect America?

Should we do everything we can to stop Democrats from weakening border security?

Should Republicans fight for a balanced budget? (why start now?, LOL)

The push-poll and the letter that came with it, follow in full below. Of course, the letter pleads with the reader to send back "your GOP CENSUS...to ensure we get ample and accurate results."

Unless they get "accurate results," the letter warns, Republican Congressional leaders "will not know how you and other Republicans at the grassroots level of our Party feel about the critical issues facing our nation" and "our Republican nominee for President of the United States (ed note: Hmmm...he's not named for some reason, I wonder who it is?) will need your input before he does battle with the Democrat machine."

Unless this form is filled out and sent in, the "RNC will be unable to develop a conservative legislative agenda!"

By Brad Friedman on 5/9/2008 4:24pm PT

Now that they've made it as difficult as possible for those pesky 90-year-old nuns to cast votes, it's time to make sure that vets injured and disabled in Iraq and Afghanistan have as difficult a time voting as possible.

The Republican War on Voting, as directed by Commander-in-Chief George W. Bush out of the White House, continues to continue.

The new front: Disallowing registration drives, by non-partisan organizations at Veterans Administration facilities. That, despite an order issued in late April by the Department of Veterans Affairs that they would allow such activity, in compliance with the National Voter Registration Act of 1993.

Apparently someone high up (we don't yet know who) found out about that, and ordered an about-face on the previous directive, leading the Veterans Health Administration's Under Secretary for Health, Michael J. Kussman, to announce this week that "Voter registration drives are not permitted" at their facilities, "due to Hatch Act requirements and to avoid disruptions to facility operations."

"The Department of Veterans Affairs has retreated on a recently announced policy to allow voter registration drives at its facilities where veterans' groups and others would assist wounded former soldiers to participate in the 2008 presidential election," writes Steven Rosenfeld over at AlterNet, where he points out that "the Hatch Act restricts political activities by federal employees."

Non-partisan voter registration drives by groups such as the League of Woman Voters, however, can hardly be considered "political activities by federal employees."

Senators such as Feinstein and Kerry, and disabled veterans groups, as you may imagine, are none too happy...

FL Supreme Court Justice: 'What's Wrong With Getting Elections Right?'
FL SoS in Response: 'Why Throw Monkey Wrench Into Outcomes?'
By Brad Friedman on 5/8/2008 2:09pm PT

"Why in the world would either the Legislature or the secretary of state or anybody object to local elections officials trying to ensure that their system operates as intended and that they get it right?" asked FL Supreme Court Justice Harry Lee Anstead as he crawled out of his cave to officiate at a hearing yesterday in Tallahassee.

The nearly-unheard of voice of reason momentarily reared its lonely head on Wednesday, if perhaps just temporarily, from the Alice in Wonderland rabbit hole down which American elections have almost entirely disappeared.

Anstead was questioning attorneys representing Sarasota's still-unresigned, democracy-hating Election Supervisor Kathy Dent and FL's Sec. of State Kurt Browning. The pair are attempting to nullify the democratic (small "d") citizens' ballot initiative successfully voted in by a majority of Sarasota voters in 2006. The initiative called for improvements in the county's election system --- including paper ballots with post-election audits --- in hopes of offering more accuracy and integrity.

Needless to say, Dent and Browning are against that idea.

The following snippet of yesterday's extraordinary exchange --- including the attorney's remarkable response to Anstead's question --- comes from a Sarasota Herald Tribune report today.

Silly Harry. Clearly he needs to get out more...

UPDATE: KC Paper Editorial Says 'Immature' Gov 'May Need to Resign for Good of State'...
By Brad Friedman on 5/8/2008 12:04pm PT

Who says investigative journalism in the corporate media is dead? Oh, yeah, that was us. Many times.

Nonetheless, the St. Louis Post-Dispatch's Tony Messenger proves the ability still exists for actual muckraking, watchdog-style investigative reporting (when the CMSM actually feels like it) in his exposé today concerning the unfolding scandal surrounding the downfall of professional GOP vote suppressor Thor Hearne's longtime benefactor, Gov. Matt Blunt of Missouri.

In January, Blunt shocked Show-Me Staters, and left local Republican officials "dumbfounded" and "speechless" with his surprise declaration, via YouTube, that he had changed his mind about running for a second term.

"After a great deal of thought and prayer, and with the knowledge that we have achieved virtually everything I set out to accomplish, and more, I will not seek a second term in the upcoming election," Blunt said, with a straight face, in his video-taped announcement.

As his re-election campaign had previously begun to organize and raise money, the claim of the first term Governor having finished his work wasn't taken very seriously by most. Trouble down the short road, from several ongoing criminal investigations, on the other hand, was largely believed to be the reason for his stunning duck and cover.

Today, the Post's Messenger reveals more details on just one aspect of what Blunt was likely hiding from: An investigation into the improper destruction of official e-mails, and the inappropriate termination of one of his attorneys who had allegedly advised that destroying the public documents would be neither legal nor proper.

Sound familiar? We'll remind you, a fish rots from the head down.

Messenger's investigative report is here, along with links to a secretly recorded audio tape. Audio tape?! Where does he think he works, at a blog?! We welcome the return of real journalism to a corporate mainstream media outlet. Hope they keep it up. We'd love to be put out of our "job."

UPDATE: KC Blue Blog tips us off to a Kansas City Star editorial today, calling for Blunt to step down. "It's time to start using the 'R' word with Missouri's immature governor, Matt Blunt," the Star editorial board's Yael T. Abouhalkah writes. "Yes, he may need to resign for the good of the state."

On Air Today (Wed.) at 2pm PT in L.A. and Santa Barbara, and Around the World via the Internets!
Call-In at: 818-985-5735...
By Brad Friedman on 5/7/2008 10:20am PT

[Updated post-show, with archive of show at bottom of article.]

Once again today, I'll be hosting an hour of "Special Election Year Coverage" for the good folks at L.A.'s Pacifica Radio affiliate, KPFK 90.7 FM, from 2p-3p PT this afternoon.

And, once again, we'll be looking less at the election "horse race" and much more at the "track conditions," with a special eye on the Supreme Court's unconstitutional support of polling place Photo ID restrictions such as the one that disenfranchised a bunch of 80 & 90 year-old nuns (along with many others) yesterday in Indiana.

My special guest will be MO Sec. of State ROBIN CARNAHAN, joining us to discuss the effect of the SCOTUS ruling in her state, which has been called "Ground Zero" for the phony GOP voter fraud scam. It's no coincidence that MO is the home of GOP Scammer-in-Chief Mark F. "Thor" Hearne, btw, as he's the democracy-hating front-man most single-handedly responsible for the Republican Photo ID/Voter Suppression effort.

We'll also be giving away some stuff to callers, such as a signed Duhmocracy CD and a signed Uncounted DVD. So join us, and call in with your questions at: 818-985-5735.

Tune in live from 2p-3p PT (4p-5p CT, 5p-6p ET) on air in Los Angeles at 90.7 FM, in Santa Barbara at 98.7 FM, or listen live online right here.

P.S. After the show, I'll be a guest on Voice of the Voters w/ Mary Ann Gould at 4pm PT, and then on People Speak Radio w/ David Swanson at 5pm PT. So it'll be a full day of BradCasting today! Hope you'll tune in...

Post-Show Update: We had another very lively show on KPFK with Sec. Carnahan, and loads of callers. Here's the full archive (appx 55 mins) for MP3 download, or you can listen online right here...

Beats me.
By Brad Friedman on 5/6/2008 9:17pm PT

Polls have been closed in Lake County for some 6 hours, but no results in Indiana's corner county, closely bordering Obama's homestate stronghold of Chicago and home to Gary. Tiny Union County has also failed to come up with any numbers just yet.

As of now, Indiana remains "too close to call" according to all the cable nets, with 92% of precincts (not necessarily votes, since Lake County is the second-most populous in the state) reporting. There are currently just under 20k votes reportedly between Clinton, who is currently leading, and Obama, out of more than 1.1 million "counted" so far.

For the record, Lake County uses a combination of the failed, unverifiable MicroVote Infinity DREs and paper-based MV-464's voting machines, according to Verified Voting's database of voting systems.

Union County, on the other hand, you needn't worry about, since our old friend Diebold runs the place with a combination of their hackable paper-ballot systems, and their unverifiable and hackable DRE (touch-screen) systems. But Union also has a tiny population of just more than 7k, whereas Lake has a population of just less than half a million.

Unfortunately, I don't know that I'll be able to follow this one through the night, so if I can't (or even if I can), I welcome you folks to tell the story in comments below as you are best able to figure out what seems to be going on there. Tonight, I'm guessing you can tell the story as well as (or better than) I can...

UPDATE 12:47pm ET: Results now coming in. The state could be a squeaker by a few thousand votes or less.

Let's see, with Indiana's own estimates of 43,000 voters who could be disenfranchised by their new Photo ID/voter suppression law, and less-conservative estimates suggesting several hundred thousand voters who could be robbed of their right to vote...Gosh, hope the final results in the Hoosier State don't come down to the question of a dozen or so 80 & 90 year-old disenfranchised nuns from South Bend...

ALSO: Voting Machine, Registration Roll Problems Reported to National Election Protection Hotline...
By Brad Friedman on 5/6/2008 1:37pm PT

The non-partisan Election Protection coalition offers a mid-day press release detailing some of the problems being reported to their 1-866-OUR-VOTE hotline today from both Indiana and North Carolina.

The Supreme Court's recent, outrageous approval of Indiana's restrictive and disenfranchising Photo ID law --- better described as their Voter Suppression Act, despite Scalia's claim that "the burden at issue is minimal," to him, anyway --- is already "working" to disenfranchise legal voters, denying them their right to cast ballots like everyone else.

According to EP, it's not just veterans, elderly, and minorities who are being affected by the ruling, so are young voters and, yes, nuns, who have reportedly already been disenfranchised today under the Republican law...

This morning, in South Bend, Indiana, a freshman student at St. Mary's College, excited to vote for the first time, left the polling place in tears because she only possessed a private college ID and was unable to vote. The poll workers, nuns at a local convent, were trying to help the young student through her problem. While they were helping her, they realized that some of their fellow nuns, who had just arrived at the polling place, also could not vote because of the photo ID law. Not only was this group of nuns disenfranchised, but so would be four floors of retired nuns in their convent.

Remember, the law was upheld by the Supremes just last week, despite Indiana's inability to point to a single instance of in-person, polling place, voter impersonation fraud (the type of "voter fraud" the law was purportedly meant to deter) in the entire history of the state.

UPDATE: Brad Jacobson has more on the dangerous "roaming pack of octogenarian and nonagenarian hooligans [nuns, who] attempted to exercise their right to vote," including one of them, a clearly-up-to-no-good, 98 year-old, trouble maker who Catholic Antonin Scalia and friends don't believe deserves the right to cast a ballot.

Additional updates at the end of this article, including details on the evil nuns, a newly married woman, and more disenfranchised students.

Milwaukee Magazine's Bruce Murphy notes today that if a study recently done in Wisconsin correlates to numbers in Indiana, as many as 620,000 citizens in the Hoosier State might lack the Photo ID needed to cast votes there. That, even as the state downplayed the numbers in the SCOTUS case, arguing that there were only 43,000 such voters there. The authors of the WI study were unable to check the same numbers in Indiana, because "the Indiana Bureau of Motor Vehicles would not provide the data needed to do the study," reports Murphy.

EP's news release goes on to list a number of other incidents being reported (if not yet by the corporate media) so far during voting today in IN and NC both, including multiple reports of voting machines problems; paper ballots not being offered to voters when machines go down; registered Independent voters being disallowed from voting in either party's primary; or voters being given Republican ballots when they believed they were registered as Democrats.

A few of the specific incidents as reported by EP so far, (which we post along with the usual caveat that frequently the most serious concerns do not come to light, if ever, until the days and weeks following such e-elections) include, from Indiana...

More power to you if you can figure out who the actual bad guys are here, versus the actual good guys (if any) in the following news, breaking this afternoon. At this point, the corruption across so many federal agencies has become so pervasive we couldn't even begin to guess at what's actually going on here, and who, if anyone anymore, can be trusted.

Call it the unintended (or, the intended) consequences of the Bush Era of Shame and Criminality.

Wall Street Journal's coverage is posted in full below, since it's otherwise behind their pay wall. Good luck...

By Brad Friedman on 5/5/2008 9:15pm PT

From Friday's Austin Chronicle...

County ClerkDana DeBeauvoir said she is committed to a point-by-point review of the county's eSlate machines, in the wake of a federal whistle-blower's lawsuit alleging that Hart InterCivic overpromised and underdelivered on the machines. The organization Vote Rescue was on hand at Tuesday's Commissioners Court meeting to provide copies of Hart technician William Singer's lawsuit, which alleges that Hart stretched reports of the performance of the eSlate in Ohio in order to secure its share of the $4 billion set aside in the Help America Vote Act. DeBeauvoir said she's not yet willing to pull the plug on the machines but would if she found significant problems in light of the lawsuit's allegations. Vote Rescue would prefer the county return its machines and choose to count ballots by hand.

Singer's futile July 2004 efforts, attempting to notify the Secretaries of State in both Texas and Ohio, were originally reported in exclusive detail by The BRAD BLOG in March of 2006.

Following discussions we had with Robert F. Kennedy Jr. after our report, he and his radio co-host, Florida attorney Mike Papantonio, filed a federal qui tam whistleblower suit [PDF] on behalf of Singer.
