Oddly enough, covering good old fashion primary special election results for the U.S. House feels like a palate cleanser today on The BradCast, with all of the other ongoing nightmares around us. Even a scrappy one between Democrats in Ohio. [Audio link to full show is posted at end of this summary.]

Two vacant U.S. House seats are up for grabs in the Buckeye State. One in a very "red" district (the 15th), vacated by GOP Rep. Steve Stiver for a gig at the Ohio Chamber of Commerce. It will almost certainly stay in Republican hands this November. The other, in the very "blue" 11th Congressional District, comprised of Cleveland and Akron, was vacated by Rep. Marcia Fudge, who became Joe Biden's Secretary of Housing and Urban Development. That one will almost certainly stay in Democratic control this Fall. So, all the action in both races was to win their respective party's nomination on Tuesday.

In the 15th, the Donald Trump-endorsed coal lobbyist Mike Carey, who vows to vote like Ohio's Rep. Jim Jordan, easily topped an 11-candidate field to keep "draining the swamp" in D.C., by filling it up with Republican lobbyists in elected positions. And in the 11th, Cuyahoga County Council member Shontel Brown appears victorious over former Ohio legislator turned Bernie Sanders' backer Nina Turner, in a race that seemed to be Turner's to lose until things got very ugly in the final weeks.

Brown, the centrist, was supported nationally by Hillary Clinton, SC's kingmaker Rep. James Clyburn, and, in the final weeks, both the Israel lobby and the Congressional Black Caucus, which usually doesn't become involved in primary races, particularly between two African-American candidates. Both groups dumped millions into the race on behalf of Brown in the weeks before Election Day. Turner, for her part, was supported nationally by Sanders, Rep. Alexandria Ocasio-Cortez and other well-known progressives, including many in the CBC. But, according to Turner in her concession speech Tuesday night, it was "evil money" from outside groups that turned the tide against her. To be fair, Turner's own words and actions were turned against her in TV ads, highlighting some pretty ugly attacks she had made against the Democratic Party and even its standard bearer Joe Biden during the 2020 primaries. Nonetheless, it does appear to have been establishment money that ultimately tipped the scales against Turner.

We're joined today once again by longtime progressive champion and journalist JOHN NICHOLS, Washington Correspondent at The Nation, to break down what the results on Tuesday night mean --- or don't --- for Democrats and the feisty progressive movement hoping to challenge the Party establishment.

Nichols sees the local party machine as having made the ultimate difference for Brown, who chaired the Cuyahoga County Dems. He says the local party has "real strength," adding: "I do think that there was a tremendous amount of pressure brought on that race that focused a lot of attention on things that Nina Turner had said in the past about Joe Biden, about some other Democrats, and she was portrayed as being somebody who wouldn't be loyal enough to the Democratic Party or to Democratic organization."

But "there are always battles for the soul of political parties," he observers. "This goes back 75-80 years, this battle between progressives and centrists, between those who want the party to be transformational, and those who want it to be managerial.  Similarly, there have been such battles in the Republican Party over the years, going back definitely to the days of Joe McCarthy, Barry Goldwater, Ronald Reagan, a fight between the further right and moderates."

"What I'm telling you is, this is politics," he says.

We also discuss the big money in the 11th District race and the pathetically low voter turnout --- less than 17%, which both media and the Cuyahoga County Board of Elections described as "higher than expected"(!) --- as factors in Tuesday's primary and what all of it means, if anything, for the Party moving forward.

Also today, in a second segment with Nichols, we discuss the "Death Cult" that is now the GOP, as Florida Gov. Ron DeSantis --- even as his state is https://www.reuters.com/...rnor-2021-08-02/smashing all-time pandemic records for both infections and hospitalizations --- actually issued an Executive Order just last week barring schools from requiring face coverings as the school year begins in a matter of weeks. That, even while GOP denialism and the Delta variant of the coronavirus have helped the Sunshine State to lead the nation right now in per capita COVID infections.

As Nichols reports at The Nation this week, DeSantis is hardly the only one in his party putting constituents at risk with mad, anti-science positioning in hopes of becoming the next Donald Trump, or even his 2024 running-mate. But, Nichols explains, while "DeSantis has fully taken in this authoritarian rightwing approach," there are signs that his "really destructive approach" to governing may be backfiring as he faces re-election in 2022. He cites new statewide polling showing that potential Democratic opponents to the Governor "are suddenly either ahead of him or essentially tied with him." Apparently independent voters in the state aren't all that keen on "death by DeSantis".

We also discuss the potentially "transformational" infrastructure, jobs and health care package that Biden and the Democrats are --- against all odds --- still on track to pass this year via a $1 trillion bipartisan bill and a $3.5 trillion Democratic-only bill paired with it, that both establishment and progressive Dems hope to hammer out and push through with a simple majority vote. Does Nichols believe this remarkable achievement will be possible in the end? Tune in to find out.

Finally, while many elected Republicans are falling over themselves to kill their own constituents as quickly as possible by pushing against mask and vaccine mandates and science itself, one Republican Governor --- who had played along for a while, earlier this year --- now has regrets...

Among the stories covered on today's program...

  • NY Attorney General Letitia James releases a report finding Gov. Andrew Cuomo sexually harassed as many as 11 staffers and retaliated against one of them, in violation of both federal and state law. The third-term Democratic Governor continues to deny the charges compiled over 5 months by the AG and refuses to step down. President Biden joins the chorus of calls for Cuomo's resignation. The NY State legislature announces they will soon conclude their impeachment inquiry.
  • New York City's outgoing Mayor, Bill de Blasio, announces that patrons of indoor leisure venues such as restaurants, gyms and shows will soon be required to show proof of vaccination. It's the first major U.S. city to require vaccination for use of businesses as the deadly and highly transmissible Delta variant of the coronavirus wreaks havoc, even in places like NYC where a higher-than-average percentage of the population has been smart enough to become vaccinated.
  • We continue to share heartbreaking stories of those who waited to too long --- for any number of usually terrible reasons --- to get vaccinated. Today's story features a husband and wife in Texas who didn't trust the vaccine, but now wish they had. They've both been "very, very, very, very sick" in the ICU and on ventilators for weeks. They are now begging relatives to make sure their four children get their shots, as it was too late for both parents to do so.
  • Florida is leading the nation of late in infections, hospitalizations and deaths, breaking their own pandemic records on the first two data points over the past several days. President Biden today noted that the states of FL and TX now account for one-third of all cases in the U.S. and called on their GOP Governors to stop making things worse by blocking local health mandates. But, Louisiana is also breaking its own pandemic hospitalization record, leading Gov. John Bel Edwards (D) to reinstate indoor masking mandates and Dr. Catherine O'Neal, Chief Medical Officer of the state's largest hospital, to issue a dire statement on Monday. She calls these the "darkest days" of the pandemic in her state, and is begging residents to mask up and get vaccinated. ERs in the state, she explains, are now unable to treat non-COVID patients, such as those having heart attacks or suffering from vehicle injuries.
  • Whether the CDC will say it out loud or not, Pulitzer Prize-winning science reporter Laurie Garrett argues that the "science says" a third mRNA shot is going to be needed for all Americans --- and that those over 60 should already be getting them.
  • And, yup, as TPM's Josh Marshall recently argued, citing the damage that mixed-messages from public health officials is causing, including to their own authority, while trying to coddle the voluntarily unvaccinated, "we need more blame": "We need to be placing the burdens on non-vaccination on the unvaccinated. And we need to be clear with the public that the problem is the non-vaccinated. They’re at fault. They’re to blame. And even more, the public influencers, celebrities and political actors who’ve driven resistance to vaccination are to blame."
  • In lighter news, the month-old pro-Trump "free speech" social media network (just the newest of many) called GETTR --- created by Trump spokesperson Jason Miller and funded by one of Steve Bannon's Chinese benefactors --- is reportedly being flooded with pro-ISIS propaganda, including "reams of jihadi-related material...graphic videos of beheadings, viral memes that promote violence against the West and even memes of a militant executing Trump in an orange jumpsuit similar to those used in Guantanamo Bay." MAGA!

Also: Biden's landmark infrastructure agenda takes another step forward in the Senate...

On today's BradCast, we open the phones to talk vaccination again, though for a different reason than we've done so in the past. [Audio link to full show follows the summary below.]

Among the stories discuss today...

  • The third highest Republican in the U.S. House, Rep. Elise Stefanik (NY) lauds Medicare and Medicaid and the "the critical role these programs have played to protect the healthcare of millions of families," but warns --- in the very same gobsmacking tweet(!) --- "To safeguard our future, we must reject Socialist healthcare schemes." Seriously. That's who now serves in the GOP leadership seat previously occupied by Rep. Liz Cheney, until she was tossed out of it by the Republican House caucus for telling the truth about Trump and replaced by Stefanik.
  • Nonetheless, as clueless as Congressional Republicans are, somehow Democrats are managing to move enough of them forward, for now, on a landmark, bipartisan $1 trillion infrastructure bill with some really good and important stuff in it. We break down the key details, released over the weekend, for the package that is to be paired with a much larger, $3.5 trillion Democrats-only bill that can be passed in the Senate with a simple majority vote. But both bills must be passed in the Senate before House Speaker Nancy Pelosi will allow either to come to the floor for a vote in the lower chamber. For now, the smaller bipartisan package is on track for passage before the Senate takes its August recess at the end of this week. But, there's still a long way to go and a lot of potential landmines to be avoided from both the Right and the Left. If Biden and Dems can pull both packages off, it would be a remarkable achievement, and the largest investment in America since FDR's New Deal.
  • At the same time, the Delta variant of the coronavirus continues to wreak havoc across the nation, almost entirely on the unvaccinated, even though the vaccinated are paying a shamefully high price for the idiocy of the unvaxxed. Nowhere in the U.s. more so at the moment than in Gov. Ron DeSantis' Florida, where he's blocked the ability for local officials to issue mask mandates and signed a law preventing private companies from requiring vaccination for customers or employees. On Friday, however, the Sunshine State registered more new COVID cases than at anytime during the pandemic --- including back before there were safe, plentiful, effective, free vaccines to help people avoid it! Now, as infections rage out of control, the state's hospitals have filled up as they reach record capacity and non-COVID-related treatments and surgeries are being cancelled because of it.
  • Several weeks ago we opened the phone lines to hear from unvaccinated listeners as to why (the hell) they were refusing to protect themselves and/or their friends, families, neighbors and co-workers. Today, we opened the phones for a related reason. Since the rise of the highly transmissible and dangerous Delta variant, and its horrifying surge across the country --- most markedly in Trump-supporting states and counties --- almost 5 million longtime holdouts finally decided to get their shots, with those Trump states leading the way in increased uptake. (Sadly, the decision to get vaccinated continues to come too late for many, including this Las Vegas family discussed today.) So, we were curious what it was, specifically, that has led some longtime vaccine holdouts to finally decide to get inoculated. We were also curious what folks thought about the idea of compulsory vaccinations, for which legal analyst Ernie Canning made the legal case today at The BRAD BLOG. We opened up the phone lines to listeners on all of the above --- including the still, stubbornly, foolishly, idiotically, dangerously, voluntarily unvaccinated...

Today's BradCast should serve as yet another wake up call for those of us who may need one. [Audio link to full show is posted at end of this summary.]

First up, Washington Post revealed on Friday that Donald Trump, late last year, attempted to order his acting Attorney General to declare that the 2020 election was "corrupt". To his credit, the acting AG refused to, since there was no evidence of systemic fraud that might have reversed Trump's painful loss to Joe Biden. And, to the credit of the acting AG's staff, all of this was documented in real time with contemporaneous hand-written notes --- from that call and similar ones that reportedly took place on a near daily basis --- with the desperate loser President calling with fraudulent information from the Internet about "fraud". Those notes from the DoJ have now helpfully been handed over to Congress, so there will likely be more to come.

Of note, however, was Trump's response when he was told there was no evidence that would "change the outcome of the election." According to the hand-written notes of senior DoJ staff, Trump replied: "Just say the election was corrupt [and] leave the rest to me and the [Republican] Congressmen."

It was enough, for Trump's dishonest purposes, for the DoJ to simply say the election was "corrupt", even though there was no such evidence to support such a claim. It was similar to how, as we learned during his first impeachment, he wanted the President of Ukraine to say they were investigating Joe Biden and his family for corruption, even though they actually weren't. This is how a liar and a con-man and, yes, how a wannabe autocrat works.

But where Trump's pathetic attempt to stay in power failed last time, that may not be the case in the near future, as many respected voices are now warning. Fox "News" may say the Left is a bunch of autocrats and fascists, but that's only because they hope you won't notice that the Republican Right actually is, and becoming more so by the day. Many respected scholars and pundits from both the Left and the not-insane Right, such as David Frum and Steve Schmidt, are trying to warn about exactly that in advance of the 2022 mid-terms. Schmidt, John McCain's former Campaign Manager, asserted in a Twitter thread this past week, for example, that Trump will be the GOP nominee in 2024, adding that "the Pro-Democracy coalition is sleep walking into the ‘22 election and the stakes couldn’t be higher."

U.S. Naval Academy and Air Force Institute of Technology graduate BRYNN TANNEHILL, who served as a longtime naval aviator, with deployments to the Adriatic, Middle East and North Atlantic, says today that she shares a number of Schmidt's concerns. Her recently published book, hoping to call attention to the unprecedented perils the nation is now facing, is called American Fascism: How the GOP is Subverting Democracy. She joins us on today's show for a chilling, if insightful conversation.

As an investigator of shoot-downs in the military, she explains that she decided to approach this topic not unlike the NTSB might investigate a crash scene, examining every single potential factor that could have played a role in the disaster. "My book traces back some of the roots of the modern Republican Party all the way back to slavery and the Civil War," she explains, "to kind of give an historical sense of where this came from. [It] looks holistically at a lot of the different factors, including the media, loss of faith in science, how white evangelicals are different, how the system has been manipulated, the role of wealth inequality," examining "like an NTSB investigation, as many of the driving factors behind where we are today as possible."

But her clarion warning of where we now are is as chilling as her comparison of the Trump-incited failed insurrection at the U.S. Capitol on January 6th with Hitler and the Nazi's failed Beer Hall Putsch of 1923. "What Republicans can take away from [Jan. 6] is that even when there is a naked attempt at a coup, it costs them nothing. If they attempt to steal democracy by simply overturning an election, there's going to be even less consequences. That's our lesson."

Her book documents (and explains) what she describes as the rise of "competitive autocracy" in the U.S. or "managed democracy" as Russian President Vladimir Putin refers to it. "It's a type of government that has emerged since the end of the Cold War. Essentially, you have a democracy, or something close to a democracy, and then one party wins an election and then changes the rules, such that the incumbent party can essentially never be removed from power.  There are still elections. They are still very often 'free' in the sense that anybody can vote, and there's not just one person on the ballot. But the election through various means has been rigged such that the playing field has been so tilted that you can't remove the incumbent party from power."

We are seeing exactly that, as GOP-controlled states are changing the rules of elections right now, not only to make it harder for Democratic-leaning voters to vote next year and in 2024, but to allow them to replace election officials with partisans who can reverse election results no matter how the electorate actually votes. (See, for example, my conversation last week with now-former Morgan County, Georgia Board of Elections member and longtime voting rights champion Helen Butler who was just removed from her seat on the Board by the partisan County Board of Supervisors after 10 years, following the approval of the state's Republican Governor Brian Kemp.)

Citing similar democracies-turned-autocracies, she points to Russia, Hungary, Poland and others countries, noting that once a nation has headed down the path we are now on, historically, none of have been able to reverse course. "Hungary is absolutely a fascist movement," Tannehill points out, following the 2010 election of Victor Orbán, "and they have absolutely ended democracy there. That's a real danger, in the sense that we have a party that regards democracy as a hindrance to their goals, and their goals of establishing a particular kind of country is more important than the democracy itself."

So does the U.S. stand a chance of turning the tide? "The problem is the system is broken," she argues. "it is so easy to thwart solutions, via Congress, the Presidency, the courts, that it's really unlikely that a lot of the necessary solutions could ever happen.  For example, Senators representing only 19% of the American population can block virtually any legislation that they want to in the Senate."

"To an extent," Tannehill tells me today, the Founders, who thought their system of democracy would prevent a wholly unqualified person from being able to become President, "never dreamed that their vision for a country would be so corrupted that you would have legislators who would overturn elections based off of lies. They also never dreamed that the parties would become so powerful that they would pick the electors for the Electoral College.  The Electoral College was meant to prevent people like Trump."

There is much more to today's conversation, including a bit of hope. No, all is not necessarily lost, as grim as all of this sounds. But unless folks begin to appreciate the dangers of this moment in history, things could get very much worse --- and soon --- before they get better...if they ever do.

Finally, following that dark (if enlightening) conversation, some slightly more encouraging news. After Trump's DoJ spent years ignoring the plain text of the rule of law --- as authoritarian administrations do --- in refusing to enforce the federal statute requiring the IRS to share Trump's tax returns with Congress, Biden's DoJ has reversed course. In a memo issued today by the DoJ's Office of Legal Counsel (OLC), the Department has declared that, in fact, the Treasury Dept. must turn over those long-sought documents to the House Ways and Means Committee after their lawful requests beginning in 2019. Better late than never anyway. And it's nice to see an Administration with some apparent actual respect for law and order once again.

Today's BradCast, by and large, serves as another fine example of why we fight, and what we fight for. [Audio link to today's full show is posted at the end of this summary.]

Among our stories today...

  • We've got an update following yesterday's lively interview with John Brakey, the longtime, progressive Election Integrity and audit expert who has been serving as an observer and advisor at the Maricopa County, Arizona 2020 election "audit", alongside the state's Republican former Sec. of State Ken Bennett. Bennett was tapped by the GOP state Senate in April to serve as its liaison to the ill-considered clown show "audit" they hired the inexperienced, partisan, conspiracy theorist company named Cyber Ninjas to carry out. Last week, Bennet was shamefully locked out of the building after he'd shared information from the third count of the County's ballots with experienced outside experts who seem to confirm that the Ninjas' original ballot tally was wrong. In fact, they suggest that the original County count was accurate (as expected, by all by the Trump MAGA mob). As of yesterday's show, Brakey had confirmed that Bennett was resigning his post after the dust up. But shortly after we got off air, Brakey reports, Bennett met with Senate President Karen Fann and, essentially, unresigned. We explain what happened and what may happen next, as even Republican members of the state Senate are now describing the effort as "botched" and turning hard against both the Ninjas for their incompetency and Fann for her folly in having hired them.
  • Despite the obvious failure of the Ninja's disastrous pretend "audit" in Arizona, Republicans across the country are noticing the millions of dollars raised by the grifters running that spectacle, and have decided they'd like some of that sweet sweet "audit" theater in their own home states. But on Wednesday, the U.S. Dept. of Justice issued new guidance documents, warning that they intend to enforce federal laws that may be violated by such exercises.
  • In separate, but related guidance on Wednesday, the DoJ also also made clear they intend to enforce federal voting rights laws against states enacting new voter suppression measures, as GOP-controlled legislatures are now doing all over the country. That, even as recent rulings by the GOP's stolen and packed SCOTUS has made such enforcement much more difficult, in lieu of new federal laws needed to protect the franchise.

    To that end, the House Oversight and Reform Committee on Thursday held a hearing on, among other things, the Texas state legislature's attempt to adopt such a bill. Texas Democrats left the state two weeks ago to prevent the quorum needed to pass such a bill during the ongoing special session called by Gov. Greg Abbott to do just that. And today, 82-year old state Rep. Senfronia Thompson --- the longest serving woman and African-American woman in Texas history, now in her 25th term --- offered moving testimony about her and her family's personal experiences with Jim Crow voter suppression laws in the Lone Star State. We share some of her must-listen remarks in response to GOP Congressmembers at the hearing who downplayed the difficulty of minority voters to exercise their right to vote.

  • With COVID surging again, thanks to the Delta variant and those who have refused to get life-saving vaccinations, President Biden announced new initiatives at the White House today, following impassioned remarks to encourage Americans to get their shots. "This is an American tragedy," he said. "People are dying --- and will die --- who don't have to die. If you're out there unvaccinated, you don't have to die," the President pleaded before detailing the new incentives. Among them: Paying the unvaxxed $100 to get their shots; Expanding federal reimbursement for employers and employees to take time off to get both themselves and their families inoculated; and a new requirement for federal workers and contractors to either get vaccinated or face regular testing and other restrictions.

Guest: John 'Bamboo Ballots' Brakey of AUDIT-USA; Also: Bipartisan Senators say agreement reached on $1T infrastructure deal; Biden to require vaccination or weekly tests for federal work force...

On today's BradCast: Just when you think the joke of a post-election "audit" in Maricopa County (Phoenix), Arizona couldn't get more absurd...it does, as the official GOP Senate Liaison for the Cyber Ninjas' super-secret, partially taxpayer-funded tally of last year's election results gets locked out of the building, threatens to quit, and now may be reinstated. Our very colorful guest today --- who much of America may now recognize --- has been inside the "audit" in Phoenix since it began in April, working side-by-side with that Liaison. He tries to help us make sense of what's really going on right now...if that's even possible. [Audio link to full show is posted below this summary.]

First up, however, some quick news out of D.C., where a bipartisan group of U.S. Senators on Wednesday reached an agreement with each other and the White House for a $1 trillion "hard" infrastructure deal, that includes some $550 billion in new spending for roads, bridges and broadband Internet. If adopted, according to AP today, it would be one of "the most significant long-term investments in nearly a century, on par with building the transcontinental railroad or the Interstate highway system."

If it's adopted along with a much larger, $3.5 trillion Democrats-only package --- including "human" infrastructure such as a broad expansion of Medicare, the Affordable Care Act, child care, parental leave, the electric grid, an electric vehicle charging network and other long overdue climate-related projects --- it would be a landmark victory for President Biden and on par, according to experts, with FDR's New Deal.

Also today, the Administration will reportedly formally announce on Thursday that all civilian federal workers must either be vaccinated against COVID or be forced to submit to regular testing. The announcement comes as the Delta variant continues to spike across the nation, requiring new masking recommendations from the CDC in indoor public spaces and all K-12 public schools this fall.

Then, it's on to our guest, friend and longtime election integrity and transparency advocate, JOHN BRAKEY, Director of the Arizona-based AUDIT-USA. Brakey joined us earlier this year, as the "audit" theater clown show in Maricopa County was just getting underway, after the GOP state Senate forced the County (against the wishes of its Republican-majority Board of Supervisors) to turn over all 2.1 million ballots cast in the Presidential election last year, along with the County's brand-new Dominion Voting Systems equipment that tallied the hand-marked paper ballots. That, so that private contractors hired by the Senate could look into an array of evidence-free conspiracy theories charging the election was stolen from Donald Trump in the state.

Brakey, a dyed-in-the-wool progressive, quickly found himself serving as the right-hand man to Arizona's former Republican Sec. of State Ken Bennett, who had been tapped by the state Senate to serve as its Liaison and spokesperson for the hand-count and forensic audit they hired Cyber Ninjas, a Florida company, to carry out, despite the contractor and their CEO, Doug Logan, having zero experience with elections, voting systems or any kind of auditing. Logan is a hard-right Republican and, before being hired by AZ, had advanced ridiculously false and evidence-free conspiracy theories on social media about the election being stolen from Trump.

For his part, Brakey joined us on the show back in April, as the "audit" (AZ's current Democratic Sec. of State describes it as a "fraudit") got underway, to offer insight into what was going on inside the Coliseum, as most of the media were locked out entirely from what would normally be a fully public process. And though, at the time, he discussed the Ninja's laughable theory that they could prove tens of thousands of fraudulent ballots were stuffed into boxes in favor of Joe Biden by examining them for signs of bamboo fibers from China, most of the nation probably first learned of Brakey when his comments about the Ninja's examining ballots for bamboo was taken out of context by a local CBS reporter and echoed all over the national media. (The reporter, CBS-Phoenix' Dennis Welch, shamefully failed to include Brakey's comments that he didn't believe any of the bamboo nonsense, when he originally released the video of Brakey discussing it.)

But, the "audit" originally set to take three or four weeks, has now taken three or months and is still underway. Late last week, however, the GOP Senate's Liaison Bennett, was summarily locked out of the building by either the Ninjas or Senate President Karen Fann, after, they claim, he shared partial results of what is now a third county-wide tally of ballots. This third count --- of ballots only, as opposed to the votes on them --- is supposed to be completely independent from the Ninjas' earlier tally, which appears to have been greatly flawed (no surprise) and reportedly fails to match the number of ballots originally reported by the County after last year's election.

Earlier today, the Arizona Republic reported that Bennett was resigning due to the conflict, and Brakey confirmed as much on today's show. However, shortly afterward, Brakey called to notify me that he had spoken to Bennett and that he and Fann met late today and struck a deal for Bennett to continue with his supposed oversight of the project. An announcement to that end should come within the next 36 hours, he tells me.

If all of that sounds like a mess, it's because it is. Brakey speaks to all of it on today's show, including being targeted as a right-winger (which he decidedly is not) and for inappropriate national ridicule after that out-of-context "bamboo" video.

He also speaks today to...

  • My concerns expressed to him the last time he was on, about the absurd lack of public oversight in the Ninja's "audit", which is supposedly predicated on the need for "transparency"(!) after Trump and his supporters circulated false, evidence-free claims about the state's certified results finding that Biden defeated Trump by 10,400 votes in the state;
  • Why Bennett was locked out from the "audit" last week, and whether he had actually tendered his resignation this week;
  • Why a third count of ballots (after the County's official count and the Ninja's subsequent hand-count) became necessary, and whether that new count is truly independent from the Ninjas'. (It isn't, as the Ninjas' own attorney, Brakey reports, is actually working on that third count!)
  • Whether recent reporting is true that the "audit" team is concerned because they now believe the data actually proves Biden won.
  • How rightwing huckster Jovan Pulitzer is "a complete con-man", spreading ridiculous claims about China having "hacked the election system through the thermostat" and that "65 countries [were] involved in hacking the United States, in 6 states [and] 600 counties."
  • Multiple recent false and misleading claims by Ninjas CEO Doug Logan (who Brakey refers to as Doug-anon Logan) suggesting fraud, as subsequently echoed, expanded upon and further falsified by Trump this past weekend at a rally in Phoenix, where Trump falsely claimed the Maricopa County election database was found to have been completely deleted (it wasn't); that 18,000 voters were purged from the rolls only after they voted in November (they didn't vote in November); that 74,000 mail-in ballots were falsely added to the total (they weren't); and that 168,000 ballots were printed on illegal paper, suggesting they were fraudulent (the paper was not illegal, and the ballots were not fraudulent. "None of it is illegal. It's crazy!," says Brakey. "This is what we put up with --- these authoritarian-type leaders who talk like they know something, and these people are gullible. That's why I'm there, to help them understand!)

We also discuss --- and at times disagree on --- whether this entire exercise is helpful or harmful to the overall cause of legitimate election integrity and post-election audits, as disinformed GOP dupes have coughed up millions for a giant grift in Arizona, even as they call for similar (almost certainly fruitless) "audits" of the 2020 results in states across the country.

Harrowing, emotional testimony at first hearing of U.S. House Select Committee on deadly January 6 insurrection; Also: More unvaccinated regrets, new CDC mask guidance as Delta variant rises...

We can only hope that today's BradCast meets our mission of informing the electorate with stuff you need to know...and does not waste your time with stuff that you do not. [Audio link to full show follows summary below.]

Among the stories covered on today's program...

  • Another tragic story about yet another unnecessary COVID death. This time, a healthy 28-year old from Alabama who got sick along with his mother and sister, after the family failed to get vaccine shots, suspecting that COVID might be a hoax. The young man's dying last words, according to his Mom: "This is not a hoax, this is real." His mother tells Washington Post: "It took watching my son die and me suffering the effects of covid for us to realize we need the vaccine. We did not get vaccinated when we had the opportunity and regret that so much now."
  • Next door, in Gov. Ron DeSantis' petri dish called Florida, the state now leads the nation, as new COVID cases have tripled over the last two weeks, along with hospitalizations and deaths. Florida alone, according to CDC data, currently accounts for one quarter of all cases in the U.S. In another grim distinction they share with Arkansas today, both states now have "high" levels of transmission in every single county. The CDC finds several other states, including Missouri, Louisiana, Mississippi and Alabama, sadly, are not far behind in the number of "high" level counties. Many of those states also have shamefully low vaccination rates making everything worse.
  • The nationwide surge in COVID cases, due to the wildly transmissible Delta variant of the coronavirus, has resulted in the CDC reversing course on Tuesday, issuing new guidance for mask wearing. They now call, once again, for both the vaccinated and unvaccinated to wear masks in indoor, public spaces. They also now recommend indoor masking for all teachers, staff, students and visitors at K-12 schools in the new school year. Again, almost all of that thanks to those who refused to get vaccinated.
  • Meanwhile, in Washington D.C., the new U.S. House Select Committee on the January 6th attack on the U.S. Capitol held its first public hearing on Tuesday. Four U.S. Capitol and D.C. Metro Police officers gave riveting and often emotional testimony. The Committee was created by Speaker Nancy Pelosi after Republicans agreed to, and then reneged on, the creation of what would have been an evenly divided, bipartisan, independent blue ribbon panel, modeled on the 9/11 Commission, with equal subpoena power --- and the power to veto them --- granted to each side.

    After Republicans in the Senate blocked that plan, Pelosi created the House Select Committee, with seven Democrats and Republican Rep. Liz Cheney, chaired by Homeland Security Committee Chair Bennie Thompson. House Minority Leader Kevin McCarthy was allowed to nominate 5 members. Three of his nominees were Members who had voted, after the deadly insurrection on January 6th, against the certification of Joe Biden's decisive victory last November. Pelosi rejected two of them, and McCarthy thereafter withdrew all of his nominees. The Speaker subsequently added another Republican to the panel, Illinois' Rep. Adam Kinzinger.

    Today, we share parts of Thompson's opening remarks on the necessity of the Committee's mission to investigate the January 6th attack, including why it happened and who instigated it, in order to restore "the peaceful transition of power" in the U.S. As well, Cheney offered her own opening statement, vowing to learn "what happened every minute of that day in the White House --- every phone call, every conversation, every meeting, leading up to, during and after the attack."

    "If those responsible are not held accountable," Cheney declared, "and if Congress does not act responsibly, this will remain a cancer on our constitutional republic."

    We then offer extended excerpts from the moving and, at times, disturbing testimony of the four officers who each risked their lives --- some, very nearly dying --- that day to protect the Capitol and its occupants, who were carrying out their Constitutional duty to certify the 2020 Presidential election.

    Those testifying on Tuesday --- each of them tearfully --- included Capitol Police Sergeant Aquilino Gonnell, a naturalized citizen from the Dominican Republican and Iraq War combat veteran who believed he was going to die defending his country that day; D.C. Metro Police Officer Michael Fanone, who was dragged down the stairs of the Capitol, beaten by the Trump-incited MGA mob, repeatedly electrocuted with his own taser and feared he'd be killed with his own gun, as he suffered both a heart attack and a concussion that day; Metro Police Officer Daniel Hodges, famously seen screaming in pain as he was pinned between a door and the surging mob who he describes as "terrorists" after fearing he would be "lynched" and having his eye nearly gouged out; And Capitol Police Officer Harry Dunn, an African American who describes repeatedly facing "a torrent of racial epithets", being called the N-word by the angry seditionists for what he says was the first time in his life while in uniform as an officer.

  • Finally, after Desi and I let off a bit of steam from a somewhat grim and/or harrowing program, it's our latest Green News Report which, unfortunately today, is no less grim. Still, we hope today's is a useful, educational and even occasionally entertaining BradCasr nonetheless...

Guest: Ian Patton of Long Beach Reform Coalition; Also: COVID vaccine deniers now learning they were wrong...the hard way...

We've spent many years on The BradCast and at The BRAD BLOG explaining why touchscreen Ballot Marking Device (BMD) voting systems, like those used across the entire state of Georgia and in Los Angeles County, can never be known to accurately reflect the intent of any voter. We've also spent some time discussing why Voting Centers --- where voters in a county may vote at any center, rather than at their precinct --- may be convenient for voters, but are otherwise a terrible idea. As today's guest illustrates, those two terrible ideas came crashing down together at the expensive of election integrity and citizen oversight in a ballot measure election in Long Beach, California last November. And he's got the lawsuit and incredibly close election results to prove it. [Audio link to full show is posted below this summary.]

But, first up, the tragic stories from the COVID vaccine denier set, who are realizing --- only once it was too late --- that their denialism was, to say the least, ill-considered, continue to roll in. A state lawmaker in Missouri. A Trump-supporting couple in Sacramento. A rightwing radio host from Tennessee. A 34-year old anti-vaxxer in Los Angeles. Those who survived have come to regret their denialism. The families of those who didn't survive are now wishing their loved ones had taken their shots, and hope that you will do so now, if you haven't already.

The stories are tragic. But if continuing to tell them may help save a life, I'm happy to keep doing so on the air, as COVID spikes across the nation, almost entirely among the unvaccinated. That is thanks to the delta variant of the coronavirus and the 97% of the hospitalized who dreamt up all sorts of reasons to not take readily accessible and highly safe and effective vaccines. Many of their reasons for having failed to do so are based on misinformation spread by power hungry and/or ignorant politicians and personalities. The results are deadly and affect all of us, even the vaccinated.

In the meantime, thanks to the vaccine refuseniks, the vaccine mandates are now coming. Not a moment too soon. In New York City. In California. At the federal Dept. of Veterans Affairs.

Then, we've spent years reporting on California's election recount laws. In one sense, they are very good in that they allow any voter in the state to request a hand-count of any race, in any precinct or precincts they like, as long as they pay for it. (They are refunded if the count reverses the certified results.) But the law also allows each county Registrar of Voters to determine the price for those counts. As we've reported over and again for the past 15 years or more, the state law results in County Clerks arbitrarily and capriciously setting prices to pretty much anything they like, with a huge disparity among counties. It may cost a few cents per ballot to hand-count in Orange County, while Los Angeles is now charging well over two dollars per ballot.

The price in L.A. County, set by Registrar-Recorder/County Clerk Dean Logan, has just sky-rocketed, thanks to Logan's new touchscreen voting systems and the ill-considered use of Vote Centers that allow voters to vote at any Center they like, rather than the old precinct model of voting. One of the many problems with Voting Centers is that they make it almost impossible for Election Integrity advocates and the public in general to oversee tallies to ensure they are accurate and ballots are not stuffed into the boxes.

Another problem became crystal clear when the City of Long Beach held a ballot referendum last November to extend a city sales tax. The initiative, Measure A, passed by just 16 votes out of some 100,000 cast. When a group of citizens who opposed the measure sought a recount (California has no automatic recount law, no matter how small the margin, and though Logan could have chosen to recount it himself, he did not), they were in for a shock.

The County Clerk's handbook published before the election suggested that the count would cost them around $50,000, which they raised to pay for the count. That was before Logan informed them, just before the hand recount was to begin, that the cost would actually be closer to the $200,000 range, putting any kind of oversight out of reach to the local activists.

Why the change in pricing? Thanks to Vote Centers, ballots cast across L.A.'s county of some 4 million voters, are not sorted by precinct, even though state law requires that recounts be done by precinct. That means the County must spend HOURS sorting through millions of ballots to find the ones that included Long Beach's Measure A. Logan, who developed both the new touchscreen systems and the Vote Center model here, is charging the recount requesters for those hours, due to his failure to create an overseeable, sorted system of ballot tracking.

We're joined today by IAN PATTON, co-founder and executive director of the Long Beach Reform Coalition, to explain what happened, why the group was forced to call off their request for a recount, and why they are now suing the County instead, to charge them the original price they had expected to pay.

"This has been really eye-opening to me. Like waking up out of a slumber to a nightmare," Patton, who used to work as a staffer in Congress tells me today. "A paper trail is useless if you can't actually count it."

As the Long Beach Press-Telegram suggests in its reporting on this, the "Future of LA County election recounts could hinge" on this suit. It will be heard next month. But the future of Vote Centers, not just in Los Angeles, but across the country, where a number of jurisdictions are moving to them or considering the model, could also be affected by what goes on in L.A., the nation's most populous county...

Guest: Voting rights champion Helen Butler of The People's Agenda, after her GOP removal from Morgan County, GA's Board of Elections; Also: More tragic ends for COVID vaccine refusers; More evidence that AZ's election 'auditers' are clueless...

We've been reporting for months on the voter suppression laws being adopted by Republican-controlled states around the nation. But, in addition to disproportionately blocking minority groups from access to the ballot, we've also warned that many of these GOP state laws allow for the removal of qualified election officials, for virtually any reason, and replacement with partisans who may now undermine election laws and overturn election results. One of those longtime election officials who has just been removed in Georgia following the passage of the state's SB202 suppression law --- a woman who also happens to be a fierce, longtime voting and civil rights champ --- joins us on today's BradCast. [Audio link to full show is posted at end of this summary.]

First up, however, it's like the early days of the pandemic all over again in a number of very sad ways. Today, we have more sad news of misinformed, Trump-loving Republican COVID deniers and vaccine refusers who believed the pandemic was a hoax, and who are now tragically --- an unnecessarily --- being felled by the virus, despite the widespread availability of life-saving vaccines in the U.S. One doctor in Alabama wrote this week about sick patients begging for the vaccine, just before being intubated and told "it's too late."

Next, we add one important point to our detailed fact-check on yesterday's program in response to Cyber Ninjas CEO Doug Logan's ridiculous (and uninformed) suggestions that tens, if not hundreds of thousands of fraudulent votes may have been cast last year in Maricopa County (Phoenix), Arizona. His remarks were offered to a state GOP Senate panel last week, after the three month-long (and counting) "audit" theater his company was contracted to carry out of last year's election results, despite their lack of experience in elections or knowledge of voting systems. Those comments were then misinterpreted and amplified by the former President of the United States to falsely suggest the election in Arizona was stolen from him last November.

But there was one point from last week's forum that we didn't have time for yesterday. It included testimony claiming that Maricopa's computer voting and tabulation systems were wildly unsecure because their operating systems and anti-virus software hadn't been updated since the day Dominion Voting System's software was installed on the machines. It's true that those computers had not had security updates and patches applied since their first use in 2019. It's true that that is a "tremendous vulnerability" for those systems, as claimed at the forum. And it's also true that there is a very good reason why the software has not been updated since then --- which, had the AZ GOP Senate hired people who actually knew anything about voting systems, they would already have understood. We explain.

The story underscores the value of election officials --- and election auditors --- who are actually experienced and qualified for the job. Unfortunately, since Donald Trump launched his evidence-free Big Lie that the election was stolen from him, Republicans have been adopting laws in several states making it easier to remove experienced election officials and replace them with partisan patsies.

Nowhere is that more clear than in the great state of Georgia, where the GOP-controlled state legislature recently adopted SB202 in order to prevent certain voters from easy access to the ballot. That law, and others being adopted locally around the state, have resulted, according to the New York Times last month, in "members of at least 10 county election boards [who] have been removed, had their position eliminated or are likely to be kicked off...they will most likely all be replaced by Republicans."

HELEN BUTLER was one of them. She is one of the state's most prominent advocates for voting rights and the award-winning Executive Director of The Georgia Coalition for the People's Agenda, founded by the late civil rights icon Rev. Dr. Joseph Lowery (who founded the Southern Christian Leadership Conference with Martin Luther King, Jr.) She is also a ten-year veteran of the bipartisan Morgan County, Georgia Board of Elections in the Republican-leaning rural enclave east of Atlanta. Or, at least, she used to be. After approval by the state's Republican Governor Brian Kemp, Butler and the rest of the Board Members were replaced at the end of last month. The Board Members will all now be selected by the partisan County Commission, instead of built from members selected by local political parties.

On today's show, Butler, who testified on voting rights at a U.S. Senate Rules Committee field hearing this week in the state, explains the reason the Commission voted to remove the Board, claiming that it was "dysfunctional", but never explaining what that meant. "We were never brought up for any Secretary of State's violations as long as I was a member of the Board," she explains. In short, Butler suggests, she was removed because the Board hired a diverse group of pollworkers and worked hard to make sure everyone, of all parties in the County, could vote and that their votes were counted as cast.

SB202, among other things, now makes it harder to vote by mail, bans absentee drop boxes, and blocks the distribution of food or water on long voting lines. Eight different lawsuits, including those filed by The People's Agenda and the U.S. Dept. of Justice (as well as the Coalition for Good Governance, for which, FULL DISCLOSURE, I am serving as a named plaintiff representing media) have now been filed in hopes of blocking the law for a host of reasons, including the disproportionate difficulties that will now be faced by minority voters. Butler describes SB202 as a "voter suppression takeover".

But the ability to remove and replace long-serving, qualified election officials with partisan appointees who can refuse to certify elections is certainly among the most chilling aspects of the law, Butler warns. She argues that, had these new laws been in place last year, Trump's attempt to "find" enough votes to overturn his loss to Biden in the Peach State --- as we all heard in his recorded (possibly illegal) telephone call with Republican Sec. of State Brad Raffensperger --- would have been easy.

Our broad conversation, on a lot of these issues, also includes her thoughts on the ongoing investigation by the Fulton County (Atlanta) District Attorney into Trump's attempt to overturn the election. Butler also offers her plea for federal legislation, such as the For the People Act and the John Lewis Voting Rights Advancement Act, to help overcome the state-based attacks on voting.

The delightfully optimistic Butler then ends our discussion with an ominous warning: "This is our darkest hour," she tells me. "This is our Selma moment, and we must act.  This is not just for black people or people of color. It's for all of us, for all Americans to have equal access to the ballot. Democracy is at stake here.  So people have to understand it's not about black people voting, this is about democracy. This is the moment. We really need to be paying attention and act to get the right people elected that will preserve democracy for America."

Among the many sad legacies of the awful Donald Trump years, is how angry everyone has become in its wake. For always-angry Trumpers, ticking off "the libs" is a feature, not a bug. For progressives, however, while there is much to be justifiably angry about, we are wise to hold our outrage for points that actually matter...and happen to be true. We've got plenty of both on today's BradCast. [Audio link to full show is posted at end of this summary.]

First up, shortly before airtime today, the Dept. of Justice arrested and charged Trump's longtime friend, advisor and top fund-riser, Tom Barrack, who chaired the disgraced former President's corrupt Inaugural Committee in 2017. Barrack was charged on seven federal counts, including using his access to Trump to lobby for the United Arab Emirates and lying about it to federal agents. As an unregistered agent for the UAE, Barack allegedly lobbied both the Trump Campaign and Administration on their behalf, joining a growing list of Trump friends, officials and associates found to have unlawfully lobbied the so-called "America First" Administration on behalf of foreign nations like Turkey, Ukraine and the UAE, before lying about it to the FBI.

In other news out of Joe Biden's Dept. of Justice, Attorney General Merrick Garland, on Monday, issued a new policy prohibiting federal prosecutors from seizing phone, text and email records from journalists, with a few reasonable exceptions. While the Obama Administration did some of that, the Trump Administration took it to new heights, secretly spying on reporters at Washington Post, New York Times and CNN --- as well as Democratic members of Congress, their aides and even their family members --- all considered (by Trump) to be his political enemies. Freedom of Press advocates applauded Garland's "historic" Monday memo [PDF], as the A.G. also called for federal legislation to buttress the new DoJ policy.

That rather important story was somewhat overshadowed on Monday, however, by outrage from the progressive Left over a misreported story about the DoJ's failure to file charges against Trump's Commerce Secretary Wilbur Ross who, the agency's Inspector General found, lied twice to Congress about his roll in unsuccessfully attempting to add a question on immigration status to the 2020 U.S. Census. After the IG's investigation, which began in 2019, the office referred the matter to the DoJ for criminal prosecution.

Progressives were up in arms yesterday after it was inaccurately reported by several legit outlets, including Government Executive and AP, that Biden's DoJ, under the direction of A.G. Garland, had declined to prosecute Ross. However, as both outlets later acknowledged with corrections to their stories, it was actually the Trump DoJ which refused to prosecute Ross. He was at least the fifth Trump Cabinet member to have been referred for criminal prosecution to Trump's corrupt DoJ. (The others include his Interior Dept. chief Ryan Zinke, his HHS Secretary Alex Azar, Trump's second Secretary of Veteran's Affairs Robert Wilkie and his Transportation Secretary Elaine Chao, who happens to be Mitch McConnell's wife. They all skated.) Whether Biden's A.G. can or will revive those recommendations to bring charges is a separate matter --- and there is plenty of other stuff to be disappointed and/or outraged about regarding some of Garland's seemingly inscrutable decisions since taking the helm at the Department --- but the outrage on Monday from progressives over the declination to charge Ross appears to have been both premature and misdirected.

Next, speaking of fact-checking and going off half-cocked (or, in Trump's case, fully-cocked), late last week, Doug Logan, CEO of Cyber Ninjas, the rightwing, conspiracy-promoting company contracted by the Arizona state Republican Senate to carry out a post-election "forensic audit" of Maricopa County (Phoenix)'s 2.1 million ballots cast last year, offered public testimony on the progress of his three-month (and continuing) efforts to date.

Logan's remarks vividly demonstrated the dangers of hiring someone who knows absolutely nothing about elections or voting systems (or audits, for that matter) to carry out, in secret, what should have been a fully public exercise. It has been referred to as a "fraudit" and clown show by critics, including both Republican and Democratic state and county officials.

The former President offered three statements on Logan's remarks over the ensuing two days, the most detailed of which charged, falsely, that Logan's testimony "showed 168,000 fraudulent ballots printed on illegal paper (unofficial ballots), 74,000 mail in ballots received that were never mailed (magically appearing ballots), 11,000 voters were added to the voter rolls AFTER the election and still voted, all the access logs to the machines were wiped, and the election server was hacked during the election."

You'll be shocked to learn that absolutely NONE of Trump's claims are actually true.

Over the weekend, AP, CNN and others published lengthy fact-checks responding to the false claims by Logan and the wildly inaccurate nonsense from Trump. Today, we walk through some of false claims, detailing how both Trump and Logan got pretty much everything completely wrong, in the state where Joe Biden was certified by the Republican Governor to have defeated Trump by more than 10,400 votes last November. To date, there has been zero legitimate evidence to suggest otherwise in AZ or any of the other several states that flipped in 2020 from Republican to Democratic after four hellish years of the failed Trump Presidency.

Finally, Desi Doyen joins us for our latest Green News Report, with news on last week's catastrophic flooding in Germany and Central Europe, wildfires continuing to explode in the parched U.S. West, and disturbing news regarding both the Amazon rainforest and the near future of high-tide flooding...

Also: New analysis finds fewer than 200 POTENTIAL cases of voter fraud in AZ last year...

On today's BradCast: It's not only Trumpers who are wildly misinformed when it comes to the COVID vaccines. Callers ring in today (many who claim they are not Trumpers) to explain their reasons...as deadly and misinformed as they may be. [Audio link to full show is posted below summary.]

First up, however, as the clown show "audit" theater by the Cyber Ninjas continues into its third month in Maricopa County (Phoenix), Arizona, Associated Press has published their own analysis of voter fraud in the state last November, as based on actual evidence. Through public records requests filed in each of AZ's 15 counties, the news organization has found there is evidence for fewer than 200 potential cases of voter fraud last year out of more than 3 million votes cast. That's a very far cry from the "massive voter fraud" our disgraced former President has claimed was carried out to give Joe Biden his 10,400 vote victory in the state. The evidence comes via both Democratic and Republican County and State officials, including investigations currently under way by Arizona's Republican state Attorney General. To date, indictments have been filed in just four (4) cases. Two of those cases involve Democrats, two involve Republican voters. Most of the known cases are unlikely to result in charges, as many of them could be book-keeping errors or innocent mistakes by voters who attempted to vote twice (once by mail and once in person, or even in two different states) for perfectly understandable reasons we discuss on today's show.

Then, as the Delta variant of the coronavirus tears through largely unvaccinated pockets of the country, COVID infection, hospitalization and death rates are on the rise again in the U.S. While the vast majority of those who become severely ill and/or die are unvaccinated (more than 95%), the threat of new variants which may not respond as well to existing vaccines looms --- as mask mandates are being restored in some places and as the nation's economy is once again under threat.

We recently covered heart-breaking stories of deadly --- because they were completely unnecessary and avoidable --- spikes in Trump-supporting states like Missouri, Mississippi and Tennessee. Today, Arkansas is taking the lead in new cases for no good reason other than usually misinformed, unvaccinated residents in the rural areas of the state. The New York Times, over the weekend, ran a devastating report out of the state, detailing the surge in severely ill patients and hospitalizations --- almost all of them unvaccinated and many of them now MUCH younger than during previous COVID surges.

But, it's not only in Trump Country. Even here in Los Angeles County, there are many among the vaccine hesitant. Over the weekend, L.A. chose to reinstate its indoor mask mandate as rates, even here, are beginning to increase again.

We wondered why this is, and what sort of information people are receiving that would lead them to avoid the live-saving vaccines, so we opened up the phones to exactly that today. The reasons, apparently, are many and varied. Some are certain that Big Pharma is pulling a hoax on all of us. (Though one caller cited information from "the inventor of the mRNA vaccines," Robert Malone, who, as it turns out, isn't the inventor at all, despite his claim. One wonders why anybody would therefore take his advice --- that the mRNA vaccines are dangerous --- seriously.) Others cite racial elements, buttressed by the tragic Tuskegee Experiment. But, as one caller notes, the tragedy of that study occurred because black men were not given life saving medicine as part of the study.

At least one caller believes evolution should be allowed to run its course, no matter how many tens or hundreds of millions are likely to die on the long and deadly road to "herd immunity".

In any event, it was an interesting hour (we hope) that may shed some light on the mess we are now in, as the nation --- with plenty of life-saving vaccine for all --- could, nonetheless, soon find itself locked down all over again due to massive misinformation that continues to pollute the body politic...

[UPDATED] Sometimes we get what we deserve...

UPDATE 7/24/2021: No sooner did I post this item at the beginning of what I'd hoped would be a somewhat celebratory bday week, then my hard drive crashed on my main computer. Incredibly, we were somehow able to get three BradCasts up and on air Monday through Wednesday anyway, even as my hard drive tried to fix itself.

Miraculously, as I thought it was a goner and was ready to toss in the towel by Thursday, it finally showed some signs of life that morning after a couple of desperate tricks or two. I was able to reboot enough to get some of the most important things off of it, and have otherwise been rebuilding from scratch on a new drive since then, in hopes of returning to the real world in time for Monday's show. (HUGE thanks to Nicole for, once again, saving my butt and sitting in for us on Thursday and Friday!)

All of this is a long way of apologizing for my absence over the past week, especially to those who'd sent emails expecting a reply and particularly to those who were kind enough to respond to my birthday plea for donations! You might have expected a "thank you!" email by now, and would have received one, but for the fact that I couldn't answer email all week pretty much until sometime around 2am on Friday night/Saturday morning!

With the various unexpected expenses of this week's nightmares, I am particularly grateful to those who stepped up with donations big or small! THANK YOU! (And expect a brief email saying as much again as I work my through a mountain of incoming mail, now that I can finally receive it!)

Guest: Media analyst Eric Boehlert of PRESS RUN; Also: Masks back on in L.A. County; Deadly climate change-fueled deluge in Germany...

If you are faint of heart or a Fox "News" viewer, please proceed with caution before listening to today's BradCast, as we mention the very very scary issue of "Critical Race Theory" on today's program. Please call 911 immediately if, at any time while listening, you find yourself hating white people or turning into a gay communist. [Audio link to full show is posted below summary.]

With that warning out of the way (you're welcome!), we start today with a few less amusing matters. First, Los Angeles County is restoring its indoors mask mandate as of this weekend, due to a surge in COVID infections thanks to the Delta variant, largely affecting the unvaccinated.

Then, horrific flooding in Germany and elsewhere in Europe has resulted in a death toll topping 125 as we went to air, with hundreds still missing. Desi Doyen walks us through what happened and why and how, yes, this deadly deluge is related to climate change. In somewhat related news, she also explains some of the science behind the recent headlines you may have seen of late regarding a "moon wobble" that could result in serious flooding problems in coastal areas across the world in the years ahead, as sea level rise due to our climate crisis intensifies along with it.

Next up today, we're happy to lighten the mood. After outrage over Mr. Potato Head and Dr. Seuss failed to have the legs that Fox "News" and the Republican Party had hoped for, they've moved on to CRITICAL RACE THEORY(!!!) as the latest and greatest threat to our children, and life on Planet Earth itself. Since Joe Biden's inauguration, a recent study found, mentions of the obscure issue on Fox have at least doubled each month since. But, like most Americans --- and pretty much every Fox "News" viewer today --- you probably had no idea what Critical Race Theory actually was (and maybe still don't) until Fox started screaming about it and Republicans pretended to be outraged enough about it to actually pass First Amendment-defying laws to cancel its teaching in our schools.

(Fox would also appreciate, very much, if you'd run for your local school boards and demand they stop teaching it as well, before every good white person is "replaced" by a gay black Jewish communist...or something.)

Don't tell Fox or its easily duped viewers, but Critical Race Theory --- a decades old, largely obscure (until now), academic theory that (correctly) argues our nation's long history of systemic racism is now baked into our legal system, economy and society itself --- isn't actually taught in K-12 schools. It's barely taught in colleges and universities for that matter. But, if you turn on Fox "News" these days, you'll learn that it's actually a clear and present threat to our nation and that Joe Biden is now demanding every Kindergartner be indoctrinated to believe that white people are evil and America is bad. Or something.

Of course, all of this is as ridiculous as it sounds and something we have spent many weeks working hard not to waste your time on by covering it, because it's all so stupid. But, as longtime media critic and analyst ERIC BOEHLERT points out again this week in his PRESS RUN newsletter, when the Right gets angry, no matter the cause, non-wingnut media like the New York Times and Washington Post feel obligated to cover the faux fury. But on that, he argues on today's show, they are failing miserably in their coverage.

"The entire Republican Party is in on this," Boehlert explains. "This is how these phony outrages are created, and why the press pretends there's nothing they can do, they have to cover it. If you have the entire weight of the Republican Party, and the weight of a billion-dollar rightwing propaganda media empire and infrastructure all talking about the same thing, the press is defenseless."

"Yes, it is news that the Governor of Florida wants to ban the teaching of a topic in public schools," he rails. "What is also news, and what is also getting ignored, is that this topic is not taught in Florida schools! That should be the second paragraph of every one of these stories! "

"There have been hundreds of these stories. Most of the coverage doesn't even mention that Critical Race Theory is not taught in public schools!" Citing a recent 1,500 word story in the Times headlined "Why is the Country Panicking About Critical Race Theory?", Boehlert notes: "The country is not panicked. Trump voters and QAnon nut-jobs are. Most people don't know what Critical Race Theory is, they can't describe it, and people --- outside of that 30% [Fox] bubble --- are not panicked about it!"

"The real story --- if the press was being transparent and honest --- the real story is that this entire machinery has created this issue around a topic that must be banned, this kind of sorcery that they're depicting Critical Race Theory as, and it's not taught in a single school in this country. If I'm a reporter, and I look at that, I'd say, oh, I see the real story here!"

This sort of rightwing hoax, grievance culture, ginned-up outrage is meant, in this case, to somehow help Republicans in the 2022 mid-terms. It's nothing new. It's now the stock in trade for the post-governance Republican Party. So, how is it that the (theoretically) legitimate media can't seem to figure that out when they cover it? As you might guess, we've got plenty to talk to political media maven Boehlert about on today's program.

Just proceed with caution. We'd hate for anybody to be harmed during the listening of today's BradCast...

Democracy, politics and death. Ya know, just another day on The BradCast. [Audio link to full show is posted below summary.]

Among the many stories covered on today's program...

  • Maricopa County, Arizona will now be forced to spend millions on new voting systems after state and County officials determined that their previous machines, which they only began using in 2019 and still haven't paid off, cannot be used again, and will be destroyed. That, after potential corruption of the systems during the Arizona GOP Senate's secret "audit" process, carried out by a private, conspiracy theory contractor named Cyber Ninjas. So much for those "fiscally conservative" Republicans (just in case you're wondering why we almost never refer to Republicans as "conservative" in almost any context. It's because they ain't. And folks in the media and in Congress and everywhere else should stop doing them the favor of playing along with their friendly, if utterly false and misleading, branding.)

    As we also discuss today, Maricopa doesn't actually have to spend millions of dollars on new computers to scan their hand-marked paper ballots. They could simply count them publicly by hand in the first place!

    The real cost of the phony, completely non-transparent and still-ongoing "audit" clown show in Phoenix, however, is that it is likely to make Democrats even more reluctant to seek recounts and post-election audits in the many cases where they absolutely should. (Here's just one such example.)

  • The wingnuts at CPAC over the weekend were laughing at Democratic Senators Joe Manchin (WV) and Kyrsten Sinema (AZ) for their gullible willingness to do their obstruction bidding for them. A group of Republican officials were caught on video tape, laughing, applauding and urging others to call and thank the two Democrats for blocking reform of the Senate filibuster. "We don't want the people's will to be done," says former U.S. Senator Rick Santorum in the clip. "Call Joe Manchin an say thank you, seriously. Call Kyrsten Sinema and say thank you," the failed Presidential candidate and fired CNN pundit says. That, as Senate filibuster reform (or elimination entirely!) is desperately needed right now in order to adopt federal protections for voting rights in hopes of countering GOP voter suppression measures now being adopted in Republican-controlled state after Republican-controlled state.
  • But, in somewhat brighter Manchin-related news, he does seem at least mostly willing to go along with the Democrats' landmark, "transformative", $3.5 trillion infrastructure reconciliation package, which --- unlike a voting rights bill --- can be adopted by the U.S. Senate with a simple majority vote...so long as Manchin and Sinema, and all of the other Democrats, play along.
  • In the meantime, back in the states, the COVID infection rates are on the rise again nationally, along with surging hospitalization and death rates in areas of the country with the lowest vaccination rates. That, as the Delta variant is quickly gaining a foothold across the nation. Last week, we discussed Missouri's horrific situation in the rural, Southwestern part of the state, where hospitals are already overwhelmed. Today, we discuss the similarly horrific numbers out of Mississippi, where state officials issued new recommendations for masking indoors once again, and warned the unvaccinated last week that "people are going to die needlessly."

    But the Trump Death Cult appears to be in full flower now in Tennessee, where the State Health Department's new directive bars state health officials from vaccination outreach to teens, incredibly enough. But that's not only for the COVID vaccines, but any and all vaccines --- from Measles to HPV to flu shots! They are no longer allowed to even remind teens when it is time to get their second COVID shot, despite the lack of protection against the Delta variant after only one dose of the Pfizer and Moderna vaccines. That, just one day after the same brainwashed wingnut ghouls of Trump's Death Cultists at CPAC last weekend actually broke into cheers when a panelist discussed the unwillingness of millions of Americans to save their own lives by getting vaccinated.

    There is, however, a bit of apparent good news regarding some of these Trump Death Cult states. Vaccination rates have suddenly been increasing by double digits in some of them over the past week. So, maybe they're finally getting the fear of God in them. Not everywhere, unfortunately. In Tennessee, the number of doses administered over the past week, versus the prior one has fallen by 70 percent as of today. In Mississippi, it's fallen by 80 percent! It's only worse in Joe Manchin's home state of West Virginia, where the rate of vaccination has fallen 94 percent since the previous week, according to Washington Post's vaccine tracker.

  • Finally, I'm happy to say that Desi Doyen's latest Green News Report has much more encouraging news packed into it than usual, including a breakdown of the many long-overdue climate and clean energy provisions currently set for inclusion in the Dems' new infrastructure package (if Manchin doesn't kill them), and in a similar new "Green Deal" initiative being launched this week in the European Union...

Guest: Election security expert Susan Greenhalgh of plaintiff Free Speech for People; Also: Senate Dems announce deal for 'transformative' $3.5 trillion health care, climate, infrastructure package...

On today's BradCast: Senate Dems strike a very big deal and the U.S. Election Assistance Commission gets sued again, this time for rolling back voting system standards after secret, unlawful meetings with the manufacturers they are supposed to be regulating. [Audio link to show is posted below.]

First up, in what is being reported as potentially "transformative" legislation for the country, Senate Democrats on Tuesday night announced they had come to an agreement on a deal that would invest $3.5 trillion into the expansion of Medicare, the Affordable Care Act, child care and a host of other "human infrastructure" priorities, while also addressing climate change with a broad array of clean energy incentives. The blueprint for the agreement still lacks specific legislative language, but was struck after weeks of work in the Senate Budget Committee chaired by Bernie Sanders (I-VT). Democratic Committee members, such as centrist Mark Warner of Virginia, are also said to be on board with the package, which would be paid for by increased taxes on those making more than $400,000 a year and on large corporations. If all Senate Dems agree to the final bill and no more than 4 Democrats defect in the House, the measure could be adopted under Senate Reconciliation rules with a simple majority vote without the need for any Republicans.

Passage of that package, along with adoption of the smaller bipartisan nearly $600 billion proposal recently hashed out among moderate Senators on more traditional infrastructure spending, such as for roads and bridges, would amount to a massive victory for Democrats (presuming Republicans do not renege on their part of the agreement) and, more importantly, for jobs, families the climate and the American people as a whole. It would be the largest such spending package since the New Deal. We walk through some of the reported details of the new reconciliation package and what it may mean for Americans before the 2022 mid-term elections.

And, speaking of elections, earlier this year we reported on the U.S. Election Assistance Commission (EAC)'s secret and unlawful meetings last year with voting system vendors, as discovered by SUSAN GREENHALGH, longtime election integrity advocate and Senior Advisor on Election Security at the non-partisan government watchdog group, Free Speech for People (FSFP). As she revealed at the time, the EAC's meetings, even with vendors, are all supposed to be public, according to the federal Help American Vote Act (HAVA). Her group was forced to sue to make the EAC cough up emails and other records detailing the secret vendor meetings. Most disturbingly, the EAC's Commissioners made alarming changes to newly drafted voting system certification guidelines just after those meetings.

The EAC is the federal agency responsible for creating certification guidelines for the nation's voting and tabulation systems. After a painstaking 5-year process in public consultation with technical advisors and other experts, the final draft of the much-needed and long-awaited Voluntary Voting System Guidelines (VVSG) 2.0 was released last year. It included, among other important elements, a ban on wireless modems in voting and tabulation systems. Cybersecurity experts applauded the provision, after long warning of the dangers of such devices in systems that register, record and tabulate the nation's votes.

After the EAC's secret meetings with voting system vendors last year, however, the agency weakened the new guidelines --- removing, for instance, the ban against wireless modems --- and revealed an amended, watered-down version just days before Commissioners voted for final approval of the new standards. Experts were stunned. Now Greenhalgh's FSFP is suing the EAC again, along with co-plaintiff Philip Stark, an elections expert from UC-Berkeley and a member of the EAC's own Board of Advisors (as well as a recent guest on this program). The complaint [PDF] calls for the EAC to roll back the last minute changes made to the guidelines after they secretly met with the voting system manufacturers.

Greenhalgh joins us to explain all of this latest madness, what it could mean for election security, why the EAC made these changes and continue to roll over for the vendors they are supposed to be regulating, and to discuss the perils of the woeful EAC's under-handed changes at a time when cyberattacks are on the rise and confidence in election results (justifiably or not) is plummeting.

"Rather than being an independent source of information regarding voting systems, the EAC is going to the vendors to ask them the questions and understand how the systems work. And, of course, the vendors aren't going to say, 'Yeah, this is highly insecure, we shouldn't be doing this,'" Greenhalgh explains.

"It's mind blowing to me," Greenhalgh tells me, when I ask if the EAC Commissioners fully understand the security risks involved in allowing the modems that vendors want in their systems (for reasons she also explains.) "You would think they'd want to err on the side of caution, they would want to err on the side of security. And if there was a good reason to allow this, then why not have this process out in the open where they can make the case to the public as to why 'we think this is a secure way to go.'? Instead they did the whole thing behind closed doors, in a super shady manner. Doesn't engender a lot of confidence." 

Finally today, in addition to the Dems' massive new infrastructure proposal announced on Tuesday night, Senate Democrats also unveiled a long-overdue, landmark proposal to finally legalize cannabis at the federal level. That bill, however, will require some Republicans to come aboard for passage, so we'll see how it goes...
