Filling in for Bill O'Reilly on tonight's Factor, Michelle Malkin ripped Homeland Security Chief Michael Chertoff for destroying the faith of the American people in our government's ability to enforce immigration laws. Later, she went after an immigrant advocate attorney who called for an end to the deportation of illegals, stating, "it is not a bumper sticker to say that we should enforce the laws that are on the books." Between the two, Malkin finds time to joke with "Democratic" Strategists, Kirsten Powers and Laura Schwartz, about Bush letting Scooter Libby "Off The Hook." Surprisingly, she appeared much less concerned with the law and order aspects of the Libby case.

UPDATE FROM BRAD 7/3/07: I believe it's worth underscoring Alan's point above. The two Fox 'News' analysts interviewed by Malkin, claiming that commuting Libby's sentence was "the right thing to do" are both identified as "Democratic" strategists. Incredible. Only on Fox...

The total commutation of Libby’s sentence should put an end to any questions, if any remain, about whether the Bush-Cheney cabal is completely crooked.

Briefly: the published statement for public consumption that the president found Libby’s sentence “excessive” is transparently false. If he had merely found the sentence excessive, he could have commuted it PARTLY. Two and a half years could have been reduced to two, or to one and a half, or to one year. It could have been drastically commuted to six months, or to three months.

That did not happen. Instead, George Walker Bush elevated smarmy propagandists like Byron York over federal judges. He elevated Charles Krauthammer over three U.S. Circuit Court Judges appointed by three former presidents. (Not that Krauthammer’s first reaction after Libby was indicted was to defend Libby. Au contraire: Krauthammer took the line, on ABC’s Inside Washington, that Libby’s actions were the work of one man, namely Libby. Neocon loyalty at work – until the echo chamber pulled Krauthammer back in line.) Bush elevated rightwing talk show hosts, the creepy National Review, Fox television and Rupert Murdoch's media empire and the now-moribund PNAC over the U.S. justice system.

Typical for him, that.

Bloomberg reports that, "George W. Bush commuted Lewis 'Scooter' Libby's 2 1/2-year prison sentence in the CIA leak case, sparing him from punishment the president called 'excessive.'" It seems W. changed his mind in the last four months about respecting jury verdicts involving serious matters as seen in the video above. Or, maybe the White House had given up all hope of restoring "honor and dignity," and thus felt it had nothing to lose.

UPDATE: RAW STORY has more details, reaction. This is amazing. But what else is new? Revealing the identities of covert CIA assets is now just fine, apparently.

UPDATE FROM BRAD 10:54pm PT: A short message from Bush's dad. Sent to him from 1999 when he was speaking to his former colleagues at the CIA. Li'l Bush, apparently, disagrees...

While it's tough keeping up from the road --- where we will be for a long while still --- we rest much easier knowing that Greg Gordon of McClatchy Newspapers continues to lift the rocks and scrape off the slime that's found under them in the name of the disgraced "non-partisan" GOP front group calling themselves the "American Center for Voting Rights" (ACVR) and their vote-suppressor in chief, the Bush/Cheney '04 General Counsel, Mark F. "Thor" Hearne.

Today, Gordon advances the ACVR story --- which we broke more than two years ago and have been drilling down into ever since --- with the latest in his string of doozies that he's been rolling out since jumping on the beat.

His latest must-read begins by detailing the ACVR Menace as it reached its tentacles into New Mexico and the case behind the political firing of U.S. Attorney David Iglesias.

He also details some fresh gut-busters from our friend Thor, whose turds just don't seem to have the same luster they once did, when previously offered to a far less dubious media...

Leahy on Meet the Press today (via TPM, who has more, video available at C&L)...

RUSSERT: Are you prepared to hold the Bush White House, the vice president, the attorney general and his office under contempt of Congress?

LEAHY: That is something that the whole Congress has to vote on. In our case, in the Senate, we'd have to vote on it; in the House, they would have to vote on it. I can't...

RUSSERT: Would you go that far?

LEAHY: If they don't cooperate, yes, I'd go that far. I mean, this is very important to the American people.

Leahy's comments synch up with what Conyer's telegraphed a week during a House Judiciary hearing when he asked outgoing Dep. AG Paul McNulty if the DoJ would work with Congress should the White House ignore their subpoenas and it became necessary to issue criminal contempt charges. (For the record, McNulty punted in response, stating he's recused himself from the issue, will likely be gone by then, since he's already resigned, and otherwise, couldn't speak for the DoJ on the matter.)

Washington Post noticed Leahy's comments as well, and offers this road map to what comes next in their Monday edition...

The next step is for the congressional committee chairman to rule on the validity of the privilege claims. If the claims are deemed invalid, the committee can repeat the directive to comply. If the president continues to refuse, the committee can find the president in criminal contempt, and the issue would go to the full Senate or House. If a majority in either chamber approves the criminal citation, the matter is referred to a U.S. attorney with a recommendation to issue an indictment.

"Referred to a U.S. attorney." See what a frickin' mess we're looking at here? The USA in question would be Jeffrey A. Taylor of the District of Columbia. Unless he gets fired any time soon. Don't know much about Taylor, with no time to dig for now. So feel free to fill us in with any thoughts on him in comments.

Next time you hear Nova M Radio's Mike Malloy unleashing one of his trademark tirades, just remember, he may well be wearing the "geezer slippers," as he described them, received for his 65th birthday, and as seen in the photo below.

Now, how scary could that be?

As luck would have it, I was able to hang with Mike --- perhaps the most fearless man on American radio --- and his lovely wife Kathy in Atlanta this weekend, as he celebrated. Today (July 1) is his official, birthday. So happy Birthday, geezer! Here's to many more!

And thanks to you both for the great old fashioned southern hospitality while in town!

Another 'Loyal Bushie' Announces Departure From Bush's Justice Department

Catching no one by surprise, yet another official in Bush's Department of Justice has resigned with an announcement late on a Friday afternoon, apparently in hopes of minimizing coverage of the beleaguered department in the media.

According to the Boston Globe (via Think Progress), Rachel Brand, Assistant Attorney General in the Office of Legal Policy, announced she will step down from her post on July 9.

While no reason was given for Brand's departure, apparently the department is floating the explanation that she is "expecting a baby soon." It is unclear what, if anything, that floater is intended to imply. Is it that the Bush Administration's version "maternity leave" is unofficially equivalent to permanent leave, or Brand never intended to return to her job after having her baby anyway, and simply decided to leave the job early and forgo using maternity leave benefits altogether? In the past, the Bush Justice Department has used maternity leave as a reason to pass over other pregnant career professionals for promotion. That is considered an illegal form of job discrimination, and in any other Justice Department, would be grounds for an investigation.

Aside from the pregnancy discrimination question, Brand's resignation couldn't possibly be related to the U.S. Attorney firing scandal, could it? According to the Globe, why, yes, it could...

News Site 'Traffics in Hating both Bush and Cheney,' Read by 'Not All That Many People,' According to Imaginary News Man...

Congrats to our friends, at RAW STORY. They've made it onto the radar screen of Rightwing Extremist, borderline psychotic John Gibson of Fox "News." They must be doing something right. Fantasy World Dwellers like the Bush dead-ender Gibson must be seeing the writing on the wall. If Gibson's silly, desperate, and unsupportable shots at RAW are any indication, it seems that the previous strategy of the 28-percenters may be quickly disintegrating. Pretending the real world doesn't exist --- by ignoring actual journalism and critics of administration policies (such as breaking the law, ignoring the constitution, etc.) --- may be a dog whose time on the hunt is soon coming to an end.

"The far Lefties are mad at [Cheney] for a host of imagined and concocted offenses. Having mostly to do with the fact that Cheney doggedly pursues our nation's enemies and he doesn't much care what other people think of what he's doing," opines Gibson from the undisclosed location of his own mind. That, after using the words "far far," "extreme," and "lefties" more times in his opening several sentences than we were able to count this morning.

Gibson, not watched by all that many people on Fox "News," describes RAW as being read by "not all that many people." In the past week, RAW STORY has had over 3.5 million page views. Anyone have time to check any numbers for Gibson's "Big Show"? We wonder how it compares number-wise.

By the way, the "Leftist blog" RAW STORY, as Gibson attempts to marginalize it, is not a blog. It's a news site. But, given his employer, we'll forgive Gibson for being unfamiliar with what news actually looks like.

To date, BRAD BLOG's extensive coverage of the alleged Fox comedy show has included a video post from the debut episode in February, a Brad Friedman exclusive interview with one of the stars from the premiere and a follow-up video post when the fake fake news show unexpectedly returned after a long hiatus. Let this put to rest once and for all any talk that BRAD BLOG only provides worthwhile coverage of election integrity issues!

A long predicted constitutional battle has finally begun. The judiciary committees of both the House and the Senate have subpoenaed administration documents pertinent to the U.S. attorney scandal. In a letter of response, White House counsel Fred Fielding has declined to cooperate, invoking executive privilege.

Thursday was the deadline for surrendering the documents. The White House also made clear that (former counsel Harriet) Miers and (ex-political director Sara) Taylor would not testify next month, as directed by the subpoenas, which were issued June 13. The stalemate could end up with House and Senate contempt citations and a battle in federal court over separation of powers.

The judiciary committees have, in a separate action, also subpoenaed documents relating to the warrantless wiretapping controversy. The White House is again expected to invoke executive privilege.

Congressman John Conyers has fired back at the White House attorney...

Arrogant Letter Agrees to Comply With Law by Submitting Source Code for Review, But Mysteriously Insists That SoS Bowen Revoke Demand to Release Version of Source Code Held by Escrow Firm...

As The BRAD BLOG reported yesterday, voting machine company ES&S has finally relented and agreed to join all of the other companies operating in the state by cooperating with the Secretary of State Debra Bowen's "Top-to-Bottom Review" of all electronic voting systems previously certified by her predecessor Bruce McPherson. After previously refusing to supply the state with source code for the company's InkaVote Plus system used exclusively in Los Angeles County, Bowen had demanded the release of the source code from escrow where it was stored by state law, as we also reported previously.

But has ES&S really relented? Or is something else up?

We asked yesterday why ES&S decided to send their source code, instead of allowing Bowen to pull it from the escrow facility at Iron Mountain, as she had previously demanded. And now, based on a letter from the company which The BRAD BLOG was able to obtain from one of our sources, as sent to Bowen's office when they agreed to supply the source code Monday, the smell of something fishy continues to permeate. The complete ES&S letter is posted in full at the bottom of this article.

On Monday, June 25, ES&S sent the letter to Lowell Finley, California's Deputy Sec. of State in charge of Voting Systems Technology and Policy, agreeing to supply the source code for InkaVote Plus is an amazing example of the company's arrogance even as it continues to beg a myriad of unanswered questions.

ES&S opens the letter repeating their desire for changes to the previously agreed upon Non-Disclosure Agreement (NDA) they have with the state. AS well, they believe the cost of Bowen's "top-to-bottom review" is too high, and they have concerns with some of the researchers who are doing the review. Nonetheless, they agree to cooperate.

Yet, after informing Finley that they intend to finally send the required source code, they instruct him that they expect him to send a letter to Iron Mountain Intellectual Property Management Inc. to release the firm from the state's request for the escrowed source code. Now why would they need to do that?

"As ES&S is providing the InkaVote Plus voting system source code directly to your office, ES&S requests that you send a letter to Iron Mountain retracting your request for the InkaVote Plus voting system source code," writes ES&S' Steven M. Pearson in the letter.

"This will provide the required notification to Iron Mountain that you are no longer in need of the requested source code and allow Iron Mountain to close your request. In addition, this will avoid ES&S from having to issue contrary instructions to Iron Mountain to prohibit the release of the InkaVote Plus voting system source code."

So what the heck is that all about?...
