If, like me, you're old enough to get the joke in today's headline, congratulations on still being alive! (If you don't remember it, here's a reminder.) But, no, we didn't forget Poland on today's chocked-with-a-surprising-amount-of-not-awful-news BradCast!

Among our stories covered today....

• Who knew that holding a U.N. conference (COP28) on our climate catastrophe in a petrostate like the United Arab Emirates might end without an agreement --- or with a bad one --- from all 200 participating nations for the first time in the annual summit's 28 year history? Well, it ain't over until it's over, with nations now officially in "overtime" at the Conference, which was otherwise set to end last night. Will they dare mention the phrase "fossil fuels" in whatever final statement they finally unanimously agree to make? Stay tuned!

• In what is being described as a "political earthquake", after eight years under the heavy hand of a far-right anti-immigrant, anti-media, anti-woman authoritarian party's Prime Minister and President, Poland --- with a front-row seat over the past two years to Russia's autocratic invasion of Ukraine --- elected a centrist, pro-EU Prime Minister on Monday! That is good news on a whole bunch of fronts. It became official today when Donald Tusk received a vote of confidence from parliament after a brief delay when a right-wing lawmaker used a fire-extinguisher to douse candles in a Hanukkah menorah in parliament. "This is a wonderful day," said Tusk to the Polish people on Monday night. "Not for me, but for all those who have deeply believed over these years that things will get even better, that we will chase away the darkness, that we will chase away evil. From tomorrow, we will be able to right the wrongs so that everyone, without exception, can feel at home." The news is a welcome counter-point to the recent rise of right-wing authoritarianism in nations from Argentina to The Netherlands. And, hopefully, its a good omen for 2024 in the U.S.

• On the other hand, Ukrainian President Volodymyr Zelenskyy had to fly all the way to the U.S. on Tuesday to, essentially, beg far-right Congressional Republicans --- who have apparently lost the plot of democracy --- to continue supporting Ukraine's efforts to hold off the imperialist invasion of his country by fascist Russian dictator Vladimir Putin.

• Speaking of Congress and democracy, very good news out of New York's high court today, which ordered a new U.S. House map for next year's 2024 Congressional elections, after the map used in 2022 resulted in a bunch of seats flipping from D to R in newly drawn districts after state Dems kinda screwed up the whole process. We explain.

• And in more potentially good news for 2024, inflation continues to fall faster than expected, as the U.S. economy continues to show surprising resilience and little sign of the recession that many had feared when Donald Trump's Federal Reserve Chairman, Jerome Powell, began raising interest rates last year to combat inflation. Inflation is almost back to normal at 3.1% over last year; gasoline is down 11% over the past two months; employers are still hiring and unemployment remains at a near record-low rate of 3.7%. But, some prices are still high at grocery stores, as is rent and the cost of a home mortgage. Economists are watching Powell closely for a read as to when the Fed may deign to finally lower interest rates next year.

• No sooner had we gotten off air yesterday, than the U.S. Supreme Court announced it would consider an expedited petition filed on Monday by Special Counsel Jack Smith to hear Donald Trump's appeal on Presidential Immunity in his January 6 federal indictment. It doesn't necessarily mean SCOTUS will hear the full case. But it means they will consider doing so. Smith had filed the petition for cert just hours earlier, leapfrogging the D.C. Circuit Court of Appeals in hopes of keeping next year's scheduled March 4th trial date for Trump on track. All of which, at least for now, is encouraging news to suggest that SCOTUS may both do the right thing and do so with the alacrity that would allow the American people a verdict in the case against Trump in advance of next year's Presidential election.

• The defamation damages trial against dirtbag former NYC Mayor and Trump attorney Rudy Giuliani --- in which he's already been found guilty of defamation --- continued into its second day on Tuesday. But not before his attorney admitted in Court on Monday (as the federal judge has already found), that Rudy's horrendous claims about two Georgia election workers in 2020 committing fraud for Joe Biden were false. And not before Giuliani then stepped out of the courtroom on Monday and repeated the same baseless claims yet again on the courthouse stairs. Today, U.S. District Court Judge Beryl Howell scolded both Rudy and his attorney, noting that Giuliani's remarks on Monday night "could support another defamation claim" by mother and daughter plaintiffs Ruby Freeman and Shaye Moss. The pair are currently seeking damages in the amount of $15.5 to $43 million in their civil lawsuit. And they will deserve every penny they receive.

• Speaking of dirtbags, following the news last week that Wisconsin's 10 fake Trump electors had settled a civil lawsuit against them, the state's U.S. Senator Ron Johnson --- already on record as having encouraged state lawmakers to steal the Badger State's 2020 election for Trump --- described the settlement as a "travesty of justice." He insisted that Democrats had done the very same thing "repeatedly" and "in multiple states" in the past. Nonetheless, he couldn't name any state where Democrats had secretly created false slates of electors in hopes of stealing an election when pressed by CNN's Kaitlan Collins. (If Johnson was referring to what happened in Hawaii in 1960, he is wrong about that as well.)

• Finally, Desi Doyen joins us for our latest Green News Report, with both the good and bad, so far, out of the COP28 Climate Conference in Dubai, and some very good news indeed from President Biden regarding the nation's largest ever investment in high speed rail and U.S. passenger rail service.

Given all the legal delay tactics available to him, Is it even possible at this point for there to be a verdict in any of Donald Trump's criminal trials before November 5th, Election Day, in 2024? A former federal prosecutor joins us to discuss that very thing on today's BradCast. [Audio link to full show follows below this summary.]

BUT FIRST, there was quite a bit of other news today, some of which is somewhat related...

• Short-lived former Republican U.S. House Speaker Kevin McCarthy announced he is quitting Congress at the end of this month. The GOP's thinnest of House majorities will become even thinner until California holds a Special Election next year to fill the seat, likely not before next June. That means Republicans will have just two votes to spare on any legislation, including on whether to prevent the Government from shutting down in mid-January. (Happy New Year!)

• The U.S. Dept. of Justice unsealed war crimes charges against four Russian soldiers accused of torturing an American in 2022 following their ongoing invasion of Ukraine. It is the first time such charges have been filed under a 30-year-old statute. Nonetheless, Congressional Republicans --- even after the news of atrocities committed against Americans and Ukrainians alike --- continue to oppose additional military aid to help our sovereign ally defend democracy itself in Europe against the imperialistic assault of its fascist Russian neighbor.

• The ten fake 2020 Trump electors in Wisconsin have settled a lawsuit filed against them by two official Biden electors. All ten Republicans, some of them top state GOP officials, have agreed to withdraw their false election filings, acknowledge Joe Biden won the 2020 election, share all related communications, and never serve as a Presidential Elector again in any election where Trump is on the ballot. Exchanges disclosed between several of them reveal that they knew what they were doing was wrong and an attempt to "possibly steal" the election. The exchanges also reveal that WI's U.S. Senator Ron Johnson advocated for the state Legislator to to steal the election for Trump.

• The six fake 2020 Trump electors in Nevada were criminally indicted today by the state's new Democratic Attorney General Aaron Ford. They all face penalties ranging from one to five years in prison for each of the various charges. This crew of miscreants also includes top Republican state officials, such as state GOP Chair Michael McDonald, Clark County GOP Jesse Law, and Jim Hindle, the man who runs elections in Storey County! Those degenerates join others in both Michigan and Georgia who have already been charged for their parts in attempting to steal the 2020 election for Trump. That, in a state where a new law adopted by the Democratic-run legislature to specifically criminalize future fake electors was vetoed by the state's new Republican Governor Joe Lombardo earlier this year.

THEN, we're joined by RANDALL D. ELIASON, the former chief of the fraud and public corruption section at the U.S. Attorney’s Office for the District of Columbia. He now teaches criminal law at George Washington University Law School, contributes to the New York Times and elsewhere, and blogs at his own site, Sidebarsblog.com.

Last week, Eliason penned an op-ed for the Times, calling for a "Rocket Docket" for Donald Trump's criminal charges, particularly related to his federal indictment in D.C. related to his attempt to steal the 2020 election. Eliason argues that the American people, to paraphrase Nixon, "have got to know whether or not their (former) President is a crook" before they may have to decide whether to vote for him next year. In fact, he argues, they have a right to know that.

But with all of the pre-trial motions available to the former President, in all four of the criminal trials he is currently scheduled to face next year, is it even be possible for there to be a verdict at the trial level in any of those cases before Election Day, after which, if Trump wins, he'll be able to make most, if not all of the charges disappear?

Eliason argues yes, particularly in the federal trial in D.C., currently overseen by U.S. District Court Judge Tanya Chutkan, as scheduled to begin on March 4 (the day before Super Tuesday). But, he notes at the Times, "whether it happens will be decided by a relative handful of federal jurists --- including a number appointed by Mr. Trump himself."

Nonetheless, Eliason maintains today that a court schedule to keep that trial on track for a verdict before Election Day next year --- and even before Republicans must finalize their 2024 Presidential nomination at their convention next Summer --- is still totally possible. What the courts need to do, he tells me, "is pretty simple. They need to put these [pre-trial] motions on a fast track...They can do that when they want to. They have done it in the past. They just have to have the will to do it. Same with the Supreme Court."

We discuss a number of historic cases --- Watergate, the 2000 election, even cases from 2020 and several of Trump's current cases --- where even the Supremes were able to act with alacrity. "Bush v. Gore they decided in one day," notes Eliason, "so they can move quickly when they want to. But that's really what it all comes down to now."

So, will they? And, if they do, will Trump be able to argue that he did not receive a fair trial in the bargain because they were rushed? And, is there any indication to date that the appellate courts, including SCOTUS, also appreciate the importance of ensuring a conviction or an acquittal before Election Day next year?

It's impeachment madness on today's BradCast! Also, a whole bunch of Republicans are otherwise quitting, backing down or facing jail time. In other words, Tuesday. [Audio link to full show is posted below this summary.]

Among the many stories covered on today's program...

• Tommy Tuberville (R-AL), a U.S. Senator and grown man who goes by the name Tommy, finally backed down from his pointless, one-man, months-long blockade of promotions for more than 400 U.S. military officials. He had been protesting a Pentagon abortion policy that none of the officers in question had anything to do with. The Senate quickly promoted all of them by simple voice vote shortly thereafter.

• House Speaker Mike Johnson (R-LA) announces he has "no choice" but to hold a floor vote for a (revenge) Impeachment inquiry of President Biden next week. The announcement follows the latest bombshell disclosure by Oversight Committee Chair and supergenius Rep. James Comer (R-KY) that Republican investigators have discovered secret monthly payments made by China to Joe Biden and laundered through his son, Hunter! Err...Three monthly payments of about a $1,400 each from Hunter Biden to his dad in 2018 to repay him for the purchase of a used truck the then former Vice President helped him buy. (Yes, the same bombshell loan repayment reported almost two years ago by the New York Post.)

• The bow-tied, far-right, but not-insane-enough-for-today's-House-Republicans Rep. Patrick McHenry (R-NC) has had enough. He joined a growing number of colleagues announcing they will be quitting at the end of this term.

• An important CORRECTION following my mention yesterday of North Dakota Gov. Doug Burgum dropping out of the GOP 2024 Presidential race, and the RNC announces the four candidates who have qualified to appear at Wednesday's night's "Presidential Primary Debate" in Alabama. (Neither Burgum nor Trump will be there. DeSantis, Haley, Ramaswamy and Christie will, for some reason.)

• The three top officials for Ron DeSantis' "Never Back Down" super PAC have backed down. They quite over the weekend, joining a growing number of other Never Back Downers who have exited the Florida Governor's losing 2024 campaign in recent days.

• Two Republican Cochise County officials, Peggy Judd and Tom Crosby, have been indicted on state charges in Arizona for conspiracy and interference of an election officer after refusing to certify the county's 2022 election results because...well, tune in.

• Kim Taylor, the wife of Republican Woodbury County, Iowa Supervisor and failed GOP Congressional candidate has been convicted on 52 counts of election fraud-related charges for falsifying voter registrations and casting dozens of fraudulent votes in the names of others in the 2020 election. Her husband, Jeremy Taylor, named as a co-conspirator, has yet to be indicted for some reason.

• Finally, Desi Doyen joins us for our latest Green News Report (and our only one this week, due to our coverage of this week's dumb GOP "Presidential Primary Debate") with a bit of surprisingly good news out of the U.N.'s COP28 climate conference this week in Dubai, and more good news on the Biden EPA's new rule that will eliminate all 9 million toxic lead water pipes across the entire nation...

Not only was it another historic Arraignment Day on today's BradCast, but it was also an opportunity to wish a very happy 77th birthday to our disgraced former President, who was celebrated with the circus-like atmosphere of a smattering of supporters, protesters and observers outside of the federal courthouse in Miami today. [Audio link to full show follows this summary.]

Donald J. Trump's attorney pleaded "Not Guilty" on his client's behalf Tuesday, during his historic arraignment in the Southern District of Florida on 37 federal felonies related to his theft of hundreds of highly classified documents and repeated attempts at obstructing the government from taking them back. Those attempts included, according to the indictment [PDF] filed last week by Special Counsel Jack Smith, efforts to have his attorney Evan Corcoran commit a list of crimes on his behalf.

Former federal prosecutor Dennis Aftergut, detailing the seriousness of these charges yesterday, explained how highly the documents in question were classified and the "bone-chilling" concerns about specific foreign nationals who visited Mar-a-Lago under false identities as Trump stored dozens of boxes of stolen documents haphazardly in a ballroom, a bathroom, a storage room and other unsecured locations at his resort property. "There's never been anything remotely like it," Aftergut contended, adding that Trump's legal peril is "extreme" and "that prosecutors' obligation, should there be convictions, would be to ask for the maximum term of imprisonment available." That would amount to decades in prison for the Birthday Boy.

We're joined today for special coverage analysis by HEATHER DIGBY PARTON, award-winning columnist at Salon and Hullabaloo, and KEITH BARBER, a former Republican attorney who now writes for Daily Kos and Medium.

• Whether Democrats previously critical of Attorney General Merrick Garland may now have changed their tune.
• The breathtaking nature of this "slam dunk" indictment and these charges.
• Whether Trump's problems finding lawyers to represent him will help or hurt in this case.

We also spend some time debunking (yet again) the absurd claims still being made by duped Republicans that Trump is somehow the persecuted victim of unequal justice and that "Joe Biden and Hillary Clinton did the exact same thing, but were never charged for it!" Over the weekend, dopey, dishonest Sen. Ron Johnson (R-WI) even ridiculously claimed on Fox "News" that Trump "decided not to pursue any kind of prosecution of Hillary Clinton" and that "Joe Biden could have made the exact same decision, but he didn't. He allowed a SWAT raid on the very secure residence of President Trump."

Every point made by the lying Senator is simply false. Biden had nothing to do with the FBI search warrant approved by a federal judge after finding probable cause that Trump was committing several serous crimes, including those he's now been charged with under the Espionage Act, at his South Florida resort.

As to the handful of classified documents found at an old office of Biden's and at his Delaware home, Barber explains: "Of course they say, 'They should be treated the same!' So I say, fine, let's treat them the same. Donald Trump was not charged for anything related to any of the documents that he voluntarily returned. So, if you're going to treat them similarly, then Biden [who immediately returned all documents inappropriately found in his possession] should not be charged for any documents that he voluntarily returned. It's simple. And that is what's going to happen."

For her part, Parton dismantles Johnson's stupidly false claims about Trump having "declined" to prosecute Clinton. "There were five investigations into the Clinton email server," she explains, after writing about this very point on Monday. "There was the original FBI investigation. There was a DOJ Inspector General's investigation. There were two State Department investigations. And Bill Barr himself...named a US Attorney in Utah to also look into all that stuff. They all concluded the same thing: Hillary Clinton didn't break any laws with this."

"The facts of the case don't match at all on the Clinton thing," says Parton. "All of this is nonsense, it's what-aboutism. It is, of course, what they would do. And there are a million cases of poor schmucks that worked in the government that did much less than anything that Trump did, much lesser kinds of offenses, that actually went to jail."

Apparently, our week of GOP debunkery continues on today's BradCast. I have a feeling we may be at it for quite some time, as Republicans are just getting started with their crash and burn majority control of the U.S. House. [Audio link to full show follows this summary.]

On yesterday's program, we shared a few clips from interviews this week with the new Republican Chair of the House Oversight Committee, Rep. James Comer of Kentucky. He explained why he was dead set on his committee investigating the connection between classified documents found by Joe Biden's aides at his Delaware residence (and immediately returned to the federal government) and concerns about "influence peddling" by the President and his family. That, despite any actual evidence to support the allegations.

Comer also made clear he had no interest in his Committee investigating the former President, despite the hundreds of classified documents he'd stolen from the White House (and refused to return, with many still missing) and mountains of evidence of influence peddling by Donald Trump and many of his children, including son-in-law Jared Kushner who received $2 billion from the Saudis just after Trump left office.

There was one point Comer focused on, however, in an effort to buttress his case. "There's one email that's been identified that is suspicious, that we want to look into," he explained. "We want to make sure that this one email that was on Hunter Biden's laptop wasn't one of the classified documents" found at Biden's residence in DE.

This claim seems to stem from an allegation first published by a New York Post columnist, apparently. GOP Senators have also been citing the same claim of late. Sen. Ron Johnson (WI) recently argued on Fox Business that an email from 2014, said to have been found on what Republicans have long claimed to be an "abandoned" laptop from the President's son contained "a very detailed analysis of what's happening in Ukraine." Sen. Ted Cruz (TX) alleged on a podcast that information in the email "could easily have come from a classified briefing."

Washington Post's Glenn Kessler examined the allegation and the evidence today. He found that the facts stated in the 22-point email said to be from Hunter actually lined up with information that was not only on the public record at the time, but published by major news outlets just weeks before the date of the email. "Laptop email suggests Hunter Biden read newspapers, not classified documents," Kessler's headline reads today. He awarded "Three Pinocchios" to the claims from Johnson and Cruz, as echoed by Oversight Committee Chair Comer on Sunday.

At the same time, Hunter Biden, after years of staying quiet about all of this, appears to now be pushing back. His attorneys recently sent legal letters to Fox "News" and Tucker Carlson, for example, demanding they retract and apologize for what the letters characterize as defamatory statements. They've also sent letters seeking criminal investigations by both state and federal authorities into the dissemination of his personal data by folks like Rudy Giuliani in the run-up to the 2020 election, making clear that while some of the data discovered was his, he neither authorized its public release, nor dropped off an allegedly abandoned laptop at a repair shop, as the GOP story, initially spread by Giuliani, goes.

Much more on all of the above today. But if Republican members of Congress believe that House investigations into this sort of stuff is what voters want them to do, after months of campaigning on claims of out-of-control crime, record inflation, high gas prices, etc., they are likely very wrong. At least according to a new report on focus groups of independent voters in Wisconsin, Virginia and Texas.

Next up today, we share some of the remarks by Rep. Ilhan Omar (D-MN) from the House floor today before a vote by House Republicans to remove her from the Foreign Affairs Committee based on comments they regard as anti-Israel four years ago. In truth, the move by House Speaker Kevin McCarthy --- who was finally able to scrounge up the minimum number of votes needed to remove her (all Dems voted in her favor) --- was clearly revenge for Democrats removing Reps. Marjorie Taylor Green (GA) and Paul Gosar (AZ) from their committee assignments during the last Congress. That, after they each posted violent threats against Democrats. (For example, Green promoted a comment from a supporter calling for the assassination of then House Speaker Nancy Pelosi. Gosar posted a video in which he is depicted as decapitating Rep. Alexandria Ocasio-Cortez and attacking President Biden with a ninja sword.)

Then, Desi Doyen joins us for our latest Green News Report, as Big Oil profiteers announce all-time record profits after a year or two of inflating gas prices; and the Biden EPA announces some very good news for longtime opponents of what would have been a toxic mining project in a pristine part of Alaska.

Finally today, a programming announcement for The BradCast! We will be moving to a four-day-a-week, Monday through Thursday schedule (with rebroadcasts scheduled for Friday) for the foreseeable future. While there are no emergencies, as noted on the program, there are several reasons for this change. Catching up on some long overdue health issues (physical, emotional, mental) is just one of them. We're fine. But, after moving from a weekly to a daily schedule back in early 2015, in order to cover the 2016 elections, and then staying with that schedule thanks to the "surprise" ending of that election, and then continuing on through four years of Trump and a years-long pandemic...well, we've got a lot to catch up with here and hope you will both understand and forgive us for our need to take Fridays off for a while. "Election Day" coverage continues today into its second week on BradCast, as more of the closest races are being called and as a clearer picture emerges as to what actually happened and why. [Audio link to full show follows this summary.]

Shortly after airtime on Monday night, media outlets finally called the very close Arizona Governor's race for Democratic Sec. of State Katie Hobbs over former TV news anchor and failed Trump-wannabe Kari Lake. As we detail, Lake's apparent narrow loss was likely particularly satisfying for outgoing GOP Rep. Liz Cheney.

Hobbs' lead over Lake, with almost all votes tallied, is 0.7% as we go to air. That is above the 0.5% or less required for an automatic recount in AZ, where state law (shamefully) does not allow for candidates to request and pay for a recount on their own. That, of course, will allow Lake to continue to present evidence-free claims of "fraud" in her election, particularly given unexplained Election Day failures of some optical scanner at some polling places in Maricopa County. That shouldn't have prevented anybody from voting --- thankfully, Arizona votes on hand-marked paper ballots --- but it did mean that some ballots cast at the polls on Election Day had to be tabulated back at County headquarters later.

Presuming Hobbs' victory is certified as expected, that means the AZ's Governor's office turns from "red" to "blue" for the first time in 13 years. (It'll be the third state where that happened this year.) Add to that the state's two Democratic U.S. Senators and Democrat Adrian Fontes' victory over Trump-backed election liar Mark Finchem for Sec. of State, and Democrat Kris Mayes currently leading Republican Abe Hamadeh (if barely --- and easily within recount territory for now) in the race to replace the state's outgoing Republican Attorney General. All of that looks a lot like a new "blue" state, with every major statewide seat in AZ perhaps soon to be occupied by a Democrat in advance of 2024.

Yes, it was a stunning midterm election across the nation, as that "red wave" that Republicans and corporate media imagined and promised, never arrived.

"This is the best midterm election result for a newly-elected Democratic President in their first term since Franklin Delano Roosevelt in 1934," notes our guest today, progressive journalist and author JOHN NICHOLS of The Nation, describing the results as "remarkable" and "against all sorts of historical patterns," while observing that this is the "third election cycle in a row where Donald Trump has been the dominant figure in the Republican Party and the Republican Party has lost. It's kind of a pattern."

So why did the results defy history? "I think the answer is that our politics have changed. We're not in the same world that we were in before," explains Nichols, who we have turned to many times over the years following Election Days to try and make sense of them. "Local media doesn't exist the way it used to, so elections are nationalized. We have seen the two parties go more to their corners --- the Democrats at least somewhat to the left, Republicans way to the right --- so we have to adjust our filter. And if we do, we understand that this election actually tells us a lot about where potential Democratic majorities and coalitions are in the future."

We dig deep into the remarkable results and how they may have been even better for the Democrats had the party not been so taken by their own fears that the media might have been right about the "red wave" which never came. Those poor predictions (which often contradicted the media's own available evidence to the contrary) also resulted in an overconfident GOP which, like the Democrats, ended up spending money in many of the wrong races. Nichols explains how Dem victories might have been even broader had they fought more aggressively and less defensively by funding, for example, more rural races where Democrats could have also won with more support from the Party.

He breaks down the likely reasons that the excellent Democratic candidate Mandela Barnes, in Nichols home state of Wisconsin, ended up losing to the insufferable Republican insurrection enthusiast Sen. Ron Johnson, and why other excellent candidates, if arguably less progressive ones, like Tim Ryan in Ohio and Cheri Beasley in North Carolina, ended up falling short.

In addition we also dig into how critical young voters --- lots of them! --- were to what ultimately happened this year. "Young people ought to be where you're putting a lot of your resources. As a party, Democrats need to be talking to young voters, bringing young people into leadership positions in the party. If you do, the rewards are immense," he avers. "Under 30 and especially under 25, the bias is 28% in favor of the Democrats. At the very end of the 2022 cycle, in states across the country, you had a lot of young voters lining up and casting votes. They don't turn out at the same percentage, at the same level, as older voters do. But if they turn out strong, it has a huge impact."

We also discuss how an institutionalist like Joe Biden has been clever enough as President to shift his policies toward the progressive left, in tune with those voters and the American electorate overall.

"Let's be very clear," Nichols argues today, "despite what games pundits try to play, Americans had a very clear choice. In 2022, they had a choice between an extreme rightwing Republican Party straying toward authoritarianism on many issues and a Democratic Party that was edging toward progressivism, and was attacked for that. And what did the American people decide to do? In a surprise to everyone, to the politicians and the pundits, they decided to go for the party that is edging towards progressivism."

On today's BradCast: It's no surprise that Fox 'News' deluded itself for months and even years about a "red wave" or "tsunami" coming for the 2022 midterm elections. It shouldn't be a surprise that the theoretically legitimate media got it wrong as well, given that they seem to make the same errors election after election. And yet, it's both surprising and disappointing, given that the data to counter their erroneous narrative was right there in front of their face the whole time...if they simply bothered to, or had the courage to, listen to it. "There was nothing magical about what I did," our guest today, TOM BONIER of the Democratic data research firm, TargetSmart, explains. "It was, as you say, seeing the numbers and reporting the numbers and, in the end, trying to stay away from predictions or projections, but to say, 'Look, this is what we're seeing'."

Bonier's well-documented Twitter threads on the data over the past many months spelled out what shouldn't have been a surprise to anyone. In the face of extremism from the right and, in particular, the Supreme Court, there was a backlash against Republicans which served to boost Democrats across the board.

Prior to today, Bonier joined us twice in recent months to discuss his analysis of data and what he was seeing and tweeting about to anyone who might have wanted to listen. In late August, after voters in deep red Kansas decisively rejected a ballot initiative that would have rewritten the state constitution to allow abortion to be banned, he joined us to explain what he saw as a "jaw-dropping" spike in new voter registrations for young, Democratic women following the Supreme Court's Dobbs decision in late June, overturning Roe v. Wade. Bonier saw similar spikes in new registrations all over the map, in "red" and "blue" states alike, but particularly where reproductive rights were most threatened.

In late September he joined us again after analyzing specific voter data from that failed Kansas referendum. Hard evidence of an incredible spike in women voters that, he told us at the time, "just doesn't happen in elections." He posited that any suggestion that Democrats would be swamped in November, as the so-called Conventional Wisdom offered by pundits would have it, was simply ignoring the available data. He argued the election would be very close and almost certainly not a "wave" for the GOP.

He was right. Even though, over the past month in the run-up to Election Day, the corporate media were, largely in lock step, warning that Dems were done for, soon to be swamped by a red wave or even tsunami! How much of that erroneous punditry "blunted" the final results, Bonier laments, citing races like Mandela Barnes' in Wisconsin, where the Democratic candidate for U.S. Senate fell just shy of unseating incumbent Republican Ron Johnson by a single point.

"I like to think of myself as an optimist, but it was difficult over the last few weeks and months," he tells me. "In reality, what we do at TargetSmart is we listen to the data. That's all we were doing. Along the way I was looking at the voter registration data, looking at the early vote data, looking at it in the context of the polls and trying to draw some conclusions. But mostly providing context and questioning the hard-set assumptions that were really leading everyone."

We discuss, among other things, the "flood of Republican polling" in the last few weeks of the campaign and how it warped forecasts from poll aggregation sites like FiveThirtyEight, and how his fellow traveler, Simon Rosenberg, who also had it right, was "mocked" when he highlighted how forecasts were being swamped by those bad GOP polls.

By itself, the media failure "doesn't happen. It took some level of complicit behavior from those who should be guards against it," Bonier insists. "People are mocking Fox News at this point. We know it is a very biased Republican media platform. But the bottom line is most of cable and these other outlets had a level of certainty about this outcome in a very similar way. I have to say, as I spoke with reporters in the closing weeks, I would be telling them 'Look, this is going to be a close election. I don't see a Republican wave. I don't see that in the numbers.' And I was just short of mocked by reporters."

But, why? Is it a lack of courage to stray from the pack journalism and group think? Or, as media critic Dan Froomkin argued today, a symptom of systemic "rot" in the political media? Bonier offers his frank thoughts on that and much more as we dig deep in today's discussion. I strongly urge you to tune in for it in full.

Republicans and corporate media appeared to be shocked on Tuesday night. But it looks like we had it right all along on BradCast regarding this year's midterm elections. And, once again, the corporate media didn't. But, good news for them! As usual, they'll pay no price for being wrong, no matter how many times they ill-serve the nation with their failures. [Audio link to full show follows this summary.]

There was no "red" wave. Conventional wisdom, as we've been advising since early Spring, was to be ignored before this year's midterms in these decidedly UNconventional times. If we could see that data --- sometimes via polling from some of the very same media outlets --- why couldn't the corporate media? Maybe its group think. Maybe its because whatever Republicans tell them they believe to be the truth, or simply report it as such.

In any event, while there was no "red" wave, it is still quite possible that Republicans win majorities in both the U.S. House and the Senate --- if just barely in each case. And while Dems, as we go to air today, have an apparent edge to hold on to their Senate majority, it'll almost certainly require another win in another U.S. Senate runoff in Georgia next month to nail it down. There even remains a long-shot chance that Dems can keep a majority in the House as well, and that, as we explained yesterday, it all may come down to the effect of unusually large downpours on Tuesday's Election Day in both Northern and Southern California.

Either way, for the moment, American democracy, while still on life support, has lived to see another day. For now. In similarly encouraging news, our previous President may even finally face some accountability from his own infuriated party. They were deprived of what should have been a huge and easy win on Tuesday, but for the rightwing loons that Donald Trump helped push into the Party and onto ballots across the nation. Many of them, if not all, lost bigly.

On today's program, we discuss all of the above and, based on what we know as of airtime, run through a ton of critical victories and losses --- including both inspiring surprise wins and several disappointments --- in dozens of states, at both the state and federal level.

As of yesterday's election, anyway, American voters (including many young ones, thankfully!) appear to have held the line for democracy. It is not dead yet. For that, I hope you'll take a minute or two to breathe a small sigh of relief. But not too many minutes. The good fight ain't over yet. Not by a long shot...

It's a grab bag on today's BradCast, as we cover a ton of stuff from around the world and here at home, just over two weeks before another critical Election Day. [Audio link to today's show follows below.]

Among our many stories covered today...

• With one disgraced, failed Conservative Party Prime Minister after another in Britain since they fell for that whole rightwing BREXIT scam, perhaps the good citizens of the UK might want to consider leadership from amongst the liberal Labour Party instead? Just a thought, but surely they couldn't perform any worse than the Torries, could they Lizz Truss, the third Tory PM to resign amid financial chaos and disgrace in as many years (she lasted just 44 days!) exited stage right today as the financial markets look to downgrade the the UK's credit rating amid continuing fiscal havoc and political uncertainty.

  It's all "self-immolation" and it echoes financial and political chaos repeatedly sown by our own "conservative" party here in the U.S. And yet, for some reason, a majority of the American public reportedly remain disinformed enough to believe, somehow, that Republicans are better on economic issues than Democrats. It's yet another sign of a failed corporate U.S. media, frankly. More thoughts and details in today's actual show, of course.

• There was better than expected news on global CO2 emissions this week! Despite a temporary return to coal, oil and gas by some in the EU in response to Russia's horrific war on Ukraine, the growth in fossil fuel emissions this year is far lower than previously predicted. This year, according to a new report from the International Energy Agency (IEA), growth in emissions from fossil fuels was just 300 million metric tons, compared to nearly 2 billion tons last year. New renewable energy coming on line from wind and solar and other sources of clean energy, along with the world's move to Electric Vehicles, is helping to counter a temporary return to fossil fuels in some parts of the world. Much of this is attributed to the acceleration of major clean energy policy plans around the world, some in response to Russia's war, but also to nations' effort to meet goals of the Paris Climate Agreement. That would include efforts here at home by Democrats and President Biden who enacted the world's largest single investment in climate --- nearly $400 billion --- in the Inflation Reduction Act, adopted without one Republican vote.

• With just over two weeks until the critical midterm elections with so much on the ballot, from democracy itself to all manner of Constitutional rights and freedoms, Democrats, progressives and other anti-authoritarians are pushing hard to win over voters. VoteVets, the nation's largest progressive veterans support group, released a blistering ad this week targeting Wisconsin's Republican Senator and insurrection enthusiast Ron Johnson, as a "traitor". And California's Rep. Eric Swalwell released a bone-chilling ad illustrating a dystopian future where police are knocking on doors to round women who've had an illegal abortion.

• Swalwell's fictional ad is hauntingly echoed by actual video footage obtained and published this week by the Tampa Bay Times in Florida, revealing law enforcement officials rounding up and arresting residents for what even the confused officers describe as "some sort of voter fraud thing". In August, GOP Governor and Presidential hopeful Ron DeSantis --- who is on this year's ballot against Democrat and former Gov. Charlie Crist --- held a dramatic news conference announcing 20 arrests by his new "Office of Election Crimes and Security". As we have since learned, those arrested were former felons who believed their voting rights had been restored after the landslide 65 to 35% passage of a statewide ballot initiative in 2018. But, the initiative had a few exceptions that the former felons weren't told about when they registered and when those registrations were approved by DeSantis' own State Department.

  “Voter fraud?," said one perplexed man as he was told he was being hauled off to jail for voting illegally years earlier. "Y’all said anybody with a felony could vote, man." Other arrestees, nabbed out of the blue at their homes just hours before DeSantis' news conference, were similarly stunned. Local law enforcement officials participating in the arrests also seemed unable to explain exactly why any of this was happening. The majority of the arrestees, according to the paper, were black and/or Democrats, "a throwback to the worst images of the Jim Crow South and a preview of a dystopian future under GOP authoritarianism," writes the Philly Inquirer's Will Bunch today.

  Yes, the authoritarian dystopian future envisioned by Swalwell's fictional video of cops rounding up a woman who had an abortion is shockingly similar to the videos published this week by Tampa Bay Times.

• Speaking of Florida and dystopia, GOP Sen. Marco Rubio and his Democratic challenger for reelection, Rep. Val Demings, squared off in a debate this week. Among the embarrassing moments for the two-term Republican Senator: his claim that absentee ballot drop-boxes shouldn't be used because someone could "put some explosives in it and blow it up and burn all of those ballots' and his explanation for why he previously claimed, after the 2018 Parkland high school massacre that killed 17, to support a ban on the sale of semi-automatic assault weapons to those under the age of 21 --- but he no longer does. "You've done nothing, nothing to help address gun violence," charged Demings, the former Police Chief of Orland in response. "How long will you watch people being gunned down in first grade, fourth grade, high school, college, church, synagogue, a grocery store, a movie theater, a mall and a night club and do nothing?!”

• Finally, Desi Doyen joins us for our latest Green News Report, as the President releases more oil from the nation's Strategic Petroleum Reserve; New Jersey sues Big Oil for decades of climate lies; and as the November 8 midterm elections are set to determine the course of climate action for decades to come...

As noted on today's BradCast, we generally cover the track conditions of our elections more than the actual horse races. We do so again today. But, as it turns out, Dems have put up some pretty good horses this year. We cover a couple of them today as well. [Audio link to full show is posted below this summary.]

First, track conditions...

The corrupt, stolen and packed rightwing U.S. Supreme Court majority on Tuesday overturned an appeals court ruling which had found that both the landmark Civil Rights Act of 1964 and Pennsylvania law mandates that legitimately voted ballots may not be invalidated due to minor errors that are "immaterial" to determining voter qualification. In this case, the question was about absentee ballots where voters had forgotten to fill in the date on the ballot's outer envelope. The activists on SCOTUS, however, held today that such ballots may not be counted this November, despite the Civil Rights Act provision that previously ended the Jim Crow era's use of immaterial errors to invalidate perfectly legitimate votes.

Also, FBI officials say they have identified no credible threats to U.S. election systems this year, despite efforts by some foreign adversaries, including Russia, to sow doubt about fraud. But do these officials understand the actual threats now posed to our non-transparent, easily manipulated and error-prone computerized voting and tabulation systems? Do they appreciate the increased threat level thanks to recent breaches of election management systems by MAGA conspiracy theorists in several states following the former President's false claims of fraud?

While the Trump-appointed FBI Director Christopher Wray seems to falsely suggest there are similar domestic threats of violence from "both sides" following the 2020 election and the SCOTUS ruling on Roe v. Wade, the federal Elections Threat Task Force, launched last year by the Dept. of Justice, seems to finally be taking at least some action in response to the thousands of violent threats made by rightwingers against election officials and poll workers following the last Presidential election.

Next, horse races...

During a U.S. Senate debate in Ohio on Monday night, Democratic candidate Rep. Tim Ryan called out his Republican opponent, author J.D. Vance, for running a fake non-profit charity to support opioid addicts; defending January 6 insurrectionists; and for giving up his "dignity" to Trump who said about Vance at a recent rally in Youngstown: "All you do is kiss my ass to get my support," before Vance went on to pose for pictures with the disgraced former President. "Ohio needs an ass-kicker, not an ass-kisser," said Ryan in response.

In Wisconsin's U.S.. Senate race, Democratic Lt. Gov. Mandela Barnes was similarly ass-kicking in his debate against incumbent Republican Sen. Ron Johnson. Barnes called out the Badger State GOPer for supporting the January 6 insurrection while claiming to support police, despite the serious injuries to more than 140 law enforcement officials that day. Barnes also made clear he would vote to codify the rights of Roe v. Wade into federal law, and made a very impressive showing against Johnson.

Both races are currently neck and neck, and are among at least five Senate races this year (along with Pennsylvania, North Carolina and even Florida) where Dems have real shots at flipping currently GOP-held seats from "red" to "blue". That, by way of contrast with Republicans who are looking at just two states (Nevada and Georgia), where they stand any real chance, generally speaking, of flipping a Senate seat from "blue" to "red" this year --- at least if you have any confidence in this year's pre-election polling.

Remember during the 2016 Presidential election when Donald Trump repeated over and over how only mobsters plead the Fifth Amendment? Yeah, so does he, as discussed on today's BradCast . And yet, he repeatedly took the Fifth for some four hours in a row during his deposition in New York today. [Audio link to full show follows below this summary.]

Before we get to those details and the related story of the FBI search at Trump's home in Florida on Monday...Good news for Americans is, of course, bad news for Republicans. According to new numbers released by the Department of Labor on Wednesday, inflation may now be slowing, along with gas prices which fell in July by roughly 20%. Obviously, that is completely thanks to the brilliant policies of President Joe Biden. (It's not, but since the GOP blamed him for inflation and the rise in prices at the pump, it seems only fair to give him all the credit when the numbers go the other way.)

Next, our highly selective and curated coverage of noteworthy results from Tuesday's primary elections in four states --- Connecticut, Minnesota, Vermont and Wisconsin. (And one last noteworthy race called from last week's primary in the state of Washington.) Here too, good news for far-right MAGA Republican voters may turn out to be very bad news for them in November. If not, it's likely to be very bad news for American democracy in advance of the 2024 elections. Many of Trump's endorsed candidates, all of whom are 2020 election deniers, are winning GOP nominations for offices likely to be critical during the 2024 Presidential election, if those candidates are successful in the 2022 election. We cover a bunch of them today, with appropriate warnings, along with a number of the encouraging Democratic victories on Tuesday.

Then, Trump's horrible, no good, very VERY bad week continues to get worse. Of course, that is good news for the bulk of Americans who actually do believe in law and order and accountability and stuff. On Wednesday, Trump finally sat down for the under oath deposition he has fought so hard against in New York Attorney General Letitia James' civil probe into his and the Trump Organization's years of apparent bank, tax and insurance fraud. For four hours, he repeatedly exercised his Constitutional Fifth Amendment right not to incriminate himself, despite claiming for years --- or, at least while he was running for President in 2016 --- that doing so is "horrible, horrible, horrible" and "disgraceful" because "if you're innocent, why are you taking the Fifth Amendment?"

(As it turns out, Trump invoked the Fifth nearly 100 times during his 1990 divorce deposition as well. His own kid, Eric, one of the titular heads of the Trump Organization while Trump was in office, invoked the privilege more than 500 times when he was deposed in the James' probe back in 2020. And, over the past several days, two of his other kids, Don Jr. and Ivanka, were also reportedly deposed. Any guess what they might have done?)

All of this, of course, comes on the heels of the FBI executing a search warrant at Trump's Mar-a-Lago home on Monday, though we still don't actually know what they were looking for nor which of the several federal criminal investigations Trump is the focus of it pertained to. Trump does. It says as much on the warrant he has in his possession. He's just not telling anyone, while describing the matter (as usual) as a "political witch hunt" and declaring that it means the U.S. is now a "broken, Third-World Country."

We're joined today for some really helpful insight into both of these ongoing cases by former Asst. U.S. Attorney in D.C. and chief of the DoJ Public Corruption/Government Fraud section, RANDALL D. ELIASON.

As usual, Eliason, who now teaches law with a focus on white collar crime at George Washington University Law School, is able to offer clear, straight-forward facts on what much of cable news has been speculating about over the past 72 hours or so.

For example, what's the difference between a "raid", as Trump and many on the Right are describing what happened in South Florida on Monday, and the lawful exercise of a search warrant, approved by a federal judge? "I'm not sure if there is a universally agreed-upon definition of a raid," he explains, "but I think the most likely definition is it's a raid if it happens to you."

In response to the reports of Trump pleading the Fifth in his NY fraud case, Eliason doesn't think it's "terribly surprising, given what we know" about both the case and the former President, but he goes on to lay out both the difference between a civil case (such as the James') and a criminal probe, and how the Fifth Amendment can be used against Trump in the former, but not the latter, even if it may help criminal prosecutors, like the Manhattan District Attorney, identify where the disgraced former President himself believes he has potentially committed a crime.

Eliason explains what material would be revealed by the portion of the FBI search warrant from Mar-a-Lago that is now in Trump's possession, even as he is refusing to disclose it. "It has to cite the statutes that the investigators believe might have been violated," he says, while noting that there is nothing that legally prevents Trump from releasing it tothe public. Also, he asserts, Trump would, by now, "have an inventory of what was seized" by the FBI, even if he has also failed to release that information as well, despite his many claims of innocence and being a victim.

We also discuss the hurdles that would have to have been cleared by Trump-appointed FBI Director Christopher Wray, Biden-appointed U.S. Attorney General Merrick Garland, as well as the federal magistrate judge who finally approved the Mar-a-Lago search warrant. (Eliason also breaks down the difference between a federal judge and a federal magistrate judge, who Florida's Republican Sen. Marco Rubio suggested on Fox "News" last night, isn't actually a real judge.)

"Given the outcry that you know was going to result from this, and that we've actually seen, you'd want something far beyond just 'probable cause'," argues Eliason, a contributing columnist at the Washington Post and at his own Sidebars Blog. "The DoJ is not going to do this in a marginal case. Before taking this kind of extraordinary, unprecedented step, they're going to really be sure they've got substantial proof, and that it's something really important that they're going after."

As far as what they're "going after"? Well, nobody --- other than Trump, his attorneys and the FBI, DoJ and a federal judge --- actually knows at this point. There has been much TrumpWorld-sourced reportage that this all has something to do with the more than 15 boxes of Presidential Records, many of them highly classified, according to the National Archives, that Trump absconded with to Florida after leaving the White House. But none of that is actually confirmed.

I convince the usually quite careful Eliason to offer his own speculation about what the FBI could be looking for that would involve such a monumental and politically fraught step as obtaining a search warrant for the home of a former President. "Most people are speculating about these crimes that involve Presidential Records," he says. "If that's all it was, and it was relatively routine stuff, I would be surprised that they'd take this kind of step. That makes me think either the documents themselves are something extraordinarily sensitive, and potentially dangerous to national security, or that there's something else going on."

What might that "something else" be, according to Eliason? For that, you'll need to tune in...

What's the difference between a white supremacist mass murderer in Buffalo, NY and a GOP candidate for the U.S. Senate? Well, in terms of their racist rhetoric not a heck of a lot, it seems. That and many more reasons to both pay close attention and be skeptical of "conventional wisdom" regarding this November's critical midterm elections on today's BradCast, as American Democracy v. Violent Strongman Authoritarianism is most definitely on the ballot in every state this year. [Audio link to full show follows this summary.]

Among the stories underscoring all of that on today's program...

• A number of the attorneys who helped Donald Trump try to steal the 2020 election have had their law licenses suspended or are facing permanent disbarment. One attorney who has yet to be held accountable in any way, however, is Sen. Ted Cruz, who volunteered to represent Trump in two different bogus election challenges before the U.S. Supreme Court; knowingly spread false claims of fraud; and then voted against certification of Joe Biden's Electoral College victory even after Trump's deadly insurrection at the U.S. Capitol. A bipartisan group is now hoping to change that. This week, they filed a complaint with the State Bar of Texas, seeking an investigation into possible disbarment for the sleazy Texas Senator/still-licensed attorney.

• Speaking of sleazy still-licensed Texas attorneys, the state's chief law enforcement officer, Attorney General Ken Paxton now says he has been sued by the Texas State Bar for misconduct. Paxton has already been charged with several securities fraud felonies; is being investigated by the FBI for abuse of power and bribery after a federal criminal complaint by eight of his top former deputies; and brought a laughable case to the U.S. Supreme Court seeking to toss the 2020 election results in four states that were not Texas. It is for his help in trying to steal the election for Trump at SCOTUS that has resulted in the state Bar's lawsuit against him. Paxton is running for re-election anyway. On Tuesday he's in a runoff election with the state's Land Commissioner George P. Bush (the very Trumpy son of Jeb and nephew of the guy who made "one of the biggest Freudian slips of all time" at Southern Methodist University yesterday.) No sooner did Paxton get sued by the state bar then he turned around and opened an investigation into the Texas Bar Foundation for "facilitating mass influx of illegal aliens" --- ya know, the stuff that racist "great replacement" conspiracy theories are made of.

• And speaking of the racist "great replacement" conspiracy theory, as repeatedly cited by the white supremacist domestic terrorist who murdered 10 and wounded 3 others in a Buffalo supermarket in a predominantly black neighborhood last weekend, a whole bunch of Republicans running for the U.S. Senate this year have been using nearly identical rhetoric to that racist murderer for a very long time. The once-fringe, now mainstream rightwing theory claims that Democrats are hoping to replace white American voters with immigrants, Jews and people of color to control the electorate with one-party rule. Or something. And, in the wake of Trump's embrace of white nationalism as President, AP highlighted a bevvy of mainstream GOP Senate candidates this year --- either running for reelection or for the party's nomination --- whose rhetoric on immigration directly echoes the same baseless, racist fear-mongering. Their list includes Blake Masters in Arizona; A.G. Eric Schmitt and disgraced former Gov. Eric Greitens in Missouri; GOP Senate nominee J.D. Vance in Ohio; and two-term U.S. Senator Ron Johnson of Wisconsin. The full list of elected and hopeful GOP officials who also espouse rhetoric shared by rightwing domestic terrorists is obviously much, much longer.

• And speaking of domestic terrorists, the U.S. House passed the Domestic Terrorism Prevention Act (again) on Wednesday. All Democrats voted for it. Every Republican, except for retiring Illinois Rep. Adam Kinzinger, voted against it. Democrats vow to bring it up in the Senate next week. It may be a heavy lift over the undemocratic 60-vote filibuster threshold in the upper chamber. Too bad it wasn't called the Domestic Terrorism by Non-White People Prevention Act. It might have easily passed in both chambers, as most legislation related to terrorism that doesn't target white supremacists tends to.

• And, speaking of extremism, on Thursday, the Oklahoma legislature passed a new law that, if signed by the Governor, would ban nearly all abortions starting at fertilization, which would make it the nation's strictest abortion law. It would also, in turn, make certain forms of birth control --- like IUDs, The Bill, Plan B, which don't necessarily prevent fertilization, but prevent implantation of a fertilized egg --- a form of "abortion" or, in Oklahoma, a homicide. More Republican-controlled states are likely to follow suit, despite the vast majority of Americans who support abortion rights. Please keep all of this in mind in November.

• And, speaking of this November, polling last month from the Harvard Youth Poll suggests --- contrary to "conventional wisdom" --- that young voters are very eager to vote this year. The number who say they are "definitely" voting in the 2022 election is almost identical to the number who said same before the 2018 "blue wave" election. That could be good news for Democrats. Again, please ignore "conventional wisdom" in these decidedly unconventional times.

• And, speaking of young people, even in deep "red" Wyoming, they don't dig attacks on LGBTQ+ people --- yes, even trans people --- as the state's U.S. Senator Cynthia Lummis found out the embarrassing way during a commencement address she gave over the weekend at the University of Wyoming. It took a while, but now she "apologizes" if she offended anyone with her remarks that were broadly booed during the speech at the school once attended by Matthew Shepard, the young gay man who was brutally beaten and left to die on a fence nearly 25 years ago. He became one of the namesakes of the landmark Matthew Shepard and James Byrd Jr. Hate Crimes Prevention Act.

• And, speaking of civil rights for all --- and of keeping Big Government and the GOP's stolen and packed Supreme Court out of our bedrooms and doctor's offices --- support for abortion rights has reached a record high in a new NBC News poll following the leak of SCOTUS' draft opinion overturning Roe v. Wade and its 50 years of protection for reproductive rights. The poll also finds support for same-sex marriage (perhaps next on the chopping block after Roe's Constitutionally established right to privacy is killed) at an all time high, while approval for the High Court is at an all time, 30-year low in this particular poll.

I have a fascinating, timely show for you today. But I had to start with the news that broke overnight as the Supreme Court did nothing. They just stood back as the most restrictive anti-abortion law in the nation took effect in Texas when the clock struck midnight this morning, the first day of September. They could have stayed it until they hear an actual challenge to Roe v Wade from Mississippi that's already on the calendar this term, which begins in just a month. And it's doesn't only criminalize abortion at six weeks or at the moment a fetal heartbeat is detected. It also deputizes people to turn in anyone they suspect of trying to get an abortion or "aiding and abetting" an abortion-seeker. Welcome to Gilead. One more thing. When I awoke this morning, I noticed a video of Senator Ron Johnson of Wisconsin, one of the more despicable Republicans in the US Senate had gone viral. Well, progressive journalist and activist LAUREN WINDSOR of The Undercurrent shot undercover video of the liar Senator explaining that Joe Biden did, indeed beat Donald Trump in Wisconsin, fair and square. Oops. Go figure...

Prepare to be outraged by some gobsmacking and maddening numbers from today's guest on The BradCast. [Audio link to show is posted below summary.]

But first, speaking of startling numbers, statistics from this year's flu season prove that masks and social distancing do indeed help to prevent viral transmission and death. That, of course, is bad news for residents of Texas and Mississippi, where their idiot Governors this week lifted statewide mask mandates and all restrictions on businesses, even as COVID infection rates are on the rise in both states. Both are among the top 10 worst states in the nation in that regard in recent weeks. Mississippi leads the nation, with Texas not far behind. And that was before they ended statewide mandates this week in contradiction of strong advice from health experts.

In Washington, Congressman Eric Swalwell (D-CA), one of the House Impeachment Managers during Donald Trump's second Impeachment Trial, filed suit against the disgraced former President, his son Don Jr., Rudy Giuliani and Rep. Mo Brooks (R-AL) for their roles in inciting the January 6th U.S. Capitol insurrection. Swalwell's civil complaint follows on a similar one filed last month by Mississippi Rep. Bennie Thompson and the NAACP.

At the same time today, the U.S. Senate continued debate over the American Rescue Plan, President Biden's $1. 9 trillion emergency COVID relief and stimulus package after Republican Sen. Ron Johnson of Wisconsin forced an all-night reading of the 628-page measure that was passed by the House late last week. In addition to funds to speed distribution of vaccines, the bill includes $1,400 payments to Americans making less than $75,000, an extension of federal unemployment benefits, hundreds of millions to reopen schools safely, and to supplement lost revenue to hard-hit, cash-strapped states and cities.

As tens of millions of Americans have lost their jobs through no fault of their own, and are both struggling to keep a roof over their heads and put food on the table, the relief can't come soon enough, despite zero votes of support from Republicans in either the House or Senate, so far, for the otherwise wildly popular bill. Johnson described it as a "boondoggle" full of unnecessary spending that would blow out the national deficit, even as it will cost the same amount of money that he and all the other Republicans voted in favor of when they passed Donald Trump's 2017 tax cuts for mostly wealthy Americans and corporations.

But while Senators --- even on the Democratic side --- squabble over whether unemployment payments should be $400 a week and last through August, or $300 a week and last until September, America's 664 billionaires could cover almost the entire cost of the measure from only the money they've made during the last 11 months of the pandemic.

We spoke last Summer with CHUCK COLLINS, Director of the Program on Inequality and the Common Good at the Institute for Policy Studies, where he co-edits Inequality.org, about his "Billionaire Bonanza 2020" report. Today, he joins us again with a maddening update to that report, finding that, as more than half a million Americans died, 73 million lost work, nearly 100,000 business permanently closed, 29 million adults reported their household did not have enough food over the past week and 11 million children didn't eat enough because their household couldn't afford to fully feed them, the 664 billionaires in the U.S. actually gained $1.3 trillion in added wealth since the beginning of the pandemic!

The profits of that handful of mostly white, male billionaires could cover more than two-thirds of the entire $1.9 trillion American Rescue Plan and, "At $4.2 trillion," Collins' updated report reveals, "the total wealth of America's 664 billionaires is also more than two-thirds higher than the $2.4 trillion in total wealth held by the bottom half of the population, 165 million Americans."

Those are just some of the startling numbers from his latest report, highlighting the obscene inequality in the U.S., made even worse by the nearly year-long coronavirus pandemic. Shamefully, all of the numbers are still worse for women and people of color. "The inequalities of income and wealth and the racial wealth divide were the pre-existing conditions as we went into the pandemic," he explains. Collins tell me that "the number of people who have no financial reserves --- zero, or negative financial wealth" is "14% of white households...but double that, 28% of Black households, 26% of Latino households...[and] that was before the pandemic."

"That's why 660 billionaires can have almost twice as much as the bottom half of US households --- because the bottom half doesn't have much!," he reports. So, what to do about it? Will the American Rescue Plan help? How about Sen. Elizabeth Warren's recently refiled "Ultra-Millionaire Tax Act" that would tax two cents of every dollar of wealth above $50 million, generating at least $3 trillion in revenue over ten years in the bargain.

Warren cites Collins' new study in making the case for her new wealth tax proposal. Her proposal is wildly popular among voters of all political stripes, as she pitched a similar version during her Presidential run last year. The fact that it isn't already the law, Collins argues, "is simply a reflection of the power of wealthy interests to block change in our political system. It's not that they're changing the political system --- they're able to stop and thwart and block change. And that's unfortunately what we're up against."

"That's the debate we're watching right now in the Senate," he adds, "where half the members in the Senate, they don't have a program to help America get through these hard times. They just want to block the one that would actually make a difference. Unfortunately, the Republicans have been the 'Party of No' because they don't want government to succeed in making a difference in people's lives, because that would undermine their whole program."

Yes, we've got a lot to discuss today with Collins, whose newest book out this month, The Wealth Hoarders: How Billionaires Spend Millions to Hide Trillions, details "the shadowy Wealth Defense Industry," which he explains today as well. Sen. Bernie Sanders writes that "Chuck's book reveals a blueprint for reversing this obscene inequality so we can take back our democracy and ensure that our government works for everybody --- not just the billionaire class and wealthy campaign contributors"...
