This week, Broward County, Florida, Elections Supervisor Brenda Snipes said, with a straight face, "No one could have anticipated that this election would be so historic and draw as much attention as it has," and defended her choice to oppose expanding early voting hours next week due to "logistical problems."

In addition to the problems in Florida, there are now reports that longtime GOP "voter fraud" hoaxster Pat Rogers (also known for his involvement in the U.S., Attorney Purge Scandal for the bogus "voter fraud" allegations he filed in 2004, and as a board member of the now-defunct and fully-debunked GOP astro-turf group, "American Center for Voting Rights," or ACVR), is apparently using private investigators to intimidate voters in New Mexico.

So NOW Can We Impound These Machines, Take Them Out of Service and Give Every Voter a PAPER BALLOT, Please?!

Yesterday we reported the problems experienced at the Davidson County (Nashville), TN polls by Election Integrity filmmakers David and Patricia Earnhardt. Patricia, like so many others before, in so many elections past, saw her vote flip before her eyes on the ES&S iVotronic touch-screen system from her intended candidate, Barrack Obama, to the Green Party candidate Cynthia McKinney.

Last week, we noted voter reports from two different WV counties, Putnam and Jackson, both counties where the same ES&S iVotronic touch-screen machines (which are notorious for flipping and losing thousands of votes and costing at least one Democratic U.S. House nominee her rightful seat) similarly flipped votes away from Democratic candidates.

Earlier today, John Gideon reported on ES&S iVotronics in SC which fail to include a number of races on the final review screen. In at least one county in that state, during the Republican Primary earlier this year, the machines had failed to even turn on at all, leading voters to scramble to find scraps of paper to vote on. ES&S is the nation's largest supplier of voting machines.

Now, finally --- and thankfully --- we have a report of voters experiencing votes flipping from the Republican candidate John McCain, to the Democratic candidate Barack Obama in a second TN county. Does this mean someone can actually take some action to get these machines the hell out of service now?!...

David and Patricia Earnhardt Report Their Problems During Early Voting in Nashville
Obama Vote Won't Register, Then Flips to Other Candidate, as Similarly Reported Recently in WV...

Now comes the vote-flipping on touch-screen machines in Davidson County (Nashville), TN, where early voting has also begun. This time, the problems occurred for David and Patricia Earnhardt, the director and executive producer of the award-winning election integrity documentary, Uncounted: The New Math of American Elections which details the history of problems with electronic voting across the nation and some of the whistleblowers and EI advocates who've helped to bring the matter to light. [Disclosure: The BRAD BLOG is prominently featured in the film.]

The Earnhardts' story of what happened to them last Friday when, among other things, Patricia's attempt to vote for Obama on the ES&S touch-screen wouldn't register at all, and at one point, with a poll-worker trying to help, had actually registered a vote for Green Party candidate Cynthia McKinney --- five rows away from Obama on the screen --- follows below.

The first reports of vote-flipping on touch-screen machines (we expect many more, as we saw in both '04 and especially in '06) came in from two counties last week in West Virginia, which also uses ES&S touch screens across the entire state.

The machines in both TN and WV need to be taken out of use and impounded immediately. So far, it's been Democrats, again, who are being affected by these problems, while votes are flipping from Democratic candidates to others. While the DNC and the Obama campaign ought to be raising holy hell, so far they are not...

E-Voting Machines Sit Empty as E-Registration Machines Cause Two-Hour Voting Delays

But this election is different. The six early voting sites across the county have experienced lines with 3,292 early ballots cast Wednesday and another 1,126 cast today by noon.

Some voters have complained of long lines in Smyrna and La Verge. Bill Butler a blogger out of Nashville (bill.butler.net) wrote he waited two hours to vote on the first day of voting.

"I would much rather our poll workers be accurate than speed up the line because some people are waiting," [Elections administrator Hooper] Penuel said.

Butler said the hold up was caused by slow computers to validate the voter's registration and that it only took a few minutes to actually vote.

"Most depressing was watching only two of the five voting machines in use because of the slow registration validation process," Bulter wrote.

This is 3,292 voters voting in one day in six early voting sites and lines up to two hours long. What are they going to do on Election Day?

There is something very wrong here.

In case you missed it, tremendous news for democracy lovers everywhere late yesterday, as the week ended up being a very good one for the voters, for a change...

  • On the federal level, GOP voter-fraud zealot Hans von Spakovsky (cue evil music), finally withdrew his nomination to the FEC, which had been blocked by Sens. Obama and Feingold. The standoff had kept the FEC from have the required quorum of commissioners needed to do business in a crucial election year. With vS out of the way, perhaps a responsible, pro-voter set of commissioners can now take their place. But we'll see. Rick Hasen has the outlook. Either way, it's another very big victory.
  • In Tennessee, both houses have approved a bill to require a paper ballot for every vote cast! The bill has to go back to conference to work out one last point, but given its extraordinary success in both houses (it passed unanimously this week in the state Senate!) it's likely to be enacted quickly. This is a huge win for the tireless Election Integrity citizen heroes on the ground in TN, and a loss for the pro-machine, pro-invisible/unverifiable ballot crowd there, including Davidson County's Republican Election Commissioner Lynn Greer, who once told me, after I attended a meeting there, that "paper is the biggest fraud ever perpetrated on this country." Apparently he was serious. The good news: the responsible folks in the state disagree with him. The bad news: the requirement for paper ballots won't take effect until 2010. But we'll take what we can get!
  • Finally, in Arizona, as Steve Rosenfeld, as one of my guests yesterday while I was guest hosting The Peter B. Collins Show told us, the DoJ has finally settled a lawsuit against the state where Sec. of State Jan Brewer, who once called Election Integrity advocates "anarchists" and "conspiracy theorists" has been doing everything she could, for years, to keep legitimate voters from being able to properly cast their ballots and have them counted accurately. The state has now finally agreed to follow the law (National Voter Registration Act of 1993, known as the NVRA or the "Motor Voter Bill") by performing voter registration services at public assistance facilities such as welfare clinics.

We spoke about most of the breaking good news above last night on the PBC Show (audio archive here), and will try, for the next few hours at least, to enjoy some of the great news, for a change, on several fronts in the continuing Republican War on Voting.

Slips Up And Accidentally Tells Hometown Republican Crowd the Truth
Doubtless Will Not Happen Again

Sen. Bob Corker (R-TN) is considered an intellectual lightweight back home in Chattanooga, where he once served as mayor. So you know it's getting bad when Corker slips up and tells a hometown audience the unfortunate truth that in meetings with George Bush, he has been "underwhelmed" by Bush's knowledge and understanding of the U.S. occupation of Iraq.

In remarks to a group of about 500 Republicans on Tuesday, Corker "raised some eyebrows," according to a local media outlet, when he recounted details of his recent visits to the White House:

"I was in the White House a number of times to talk about the issue [of Iraq], and I may rankle some in the room saying this, but I was very underwhelmed with what discussions took place at the White House," Corker said.

A few minutes later during a question and answer session a man in the audience asked him to clarify his statement.

"I was concerned about your statement that you were underwhelmed with what was going on in the White House. Did you mean with him or with his staff?"

In response, Corker said, "Let me say this. George Bush is a very compassionate person. He's a very good person. And a lot of people don't see that in him, and there's many people in this room who might disagree with that.... I just felt a little bit underwhelmed by our discussions, the complexity of them, the depth of them."

Corker quickly added that he supports Bush's occupation of Iraq --- even though he just admitted that Bush himself doesn't understand it --- and that all that is needed to turn things around is an increase in both the size of the U.S. government and the amount of happy-talk propaganda it spews at the public:

...I do believe that the most recent course of action we've pursued is a good one. I feel like what we've lack in our country is a coherent effort that really links together the Treasury Department, all the various departments of our government in a way that really focuses not just on the hard military side of things, but also the soft effort that it takes to build good will among people.

The senator then hastily added that he regretted having just expressed his true assessment about Bush's feeble intellect:

I really think much of that has righted itself, I'm just telling you that at that moment in time I felt very underwhelmed, and I'm just being honest. I've said that to them, and to him, and to others. I kind of in a way wish I hadn't said it today."

The last comment was greeted with laughter in the crowd.

Rest assured that Sen. Corker will never make the mistake of expressing an honest opinion in public again.

We were in Nashville a couple of months ago, at a meeting of the Davidson County Board of Elections. We tried to warn them that they would run into trouble with their ES&S touch-screen voting machines, probably sooner, rather than later. But the Kool-Aid drunk Republicans on the board would have none of it. "Paper ballots are the biggest scam ever perpetrated on America," one of them told us. To our astonishment, he actually seemed to believe himself.

That GOP blend must be some very tasty Kool-Aid.

Meanwhile, the nice Democrats who were in the majority on the board sat there and said and did nothing. They were very very nice. And completely clueless.

And now, next door in Memphis (Shelby County), where they use equally bad Diebold touch-screen machines, Mayor Willie Herenton is calling for an end to Early Voting, which began this week, as reports of votes flipping began coming into his office just after polls opened...

Since the EAC Refuses to Notify Them, We Hope You Will...

A commenter over at DU asked which states used the ES&S iVotronic touch-screen voting system found vulnerable to an undetectable countywide vote-flipping virus which can be implanted by a single person, as we reported this morning.

Based on our quick review of a county-by-county database of voting systems, sorted by state, as made available by Common Cause (EXCEL spreadsheet downloadable here) just prior to the November 2006 elections, it looks like the answer is 16 states in total.

Since the EAC refuses, as our report detailed, to do their job in notifying Elections Officials about this incredibly serious vulnerability, it looks like it's up to you to notify your state's Secretary of State and/or county Election Officials! Details on the vulnerability and mitigating steps that may be taken are detailed in this brief report at VotersUnite.org as written by a computer scientist and voting system expert well familiar with the newly discovered flaw. Please refer your voting officials to both our original article, and that scientific report for more details at the following URLs:

The states which use the ES&S iVotronic affected (with firmware versions either 8 or 9, with or without a so-called "Voter Verified Paper Audit Trail") are as follows:

Drudge Gets the Ball Rolling, Everyone Else in the Corporate Media Follows Dutifully
DNC: Still a No Show

Meanwhile...As reported long ago, the GOP is planning to declare fraud after next Tuesday's election. As initially linked by DRUDGE (which should tell you almost all you need to know) earlier today, the GOP is laying the groundwork:

Several electronic voting cards, used to cast ballots, are missing from a polling place in Memphis, according to the Tennessee Republican Party.

In a letter to the Shelby County Election Commission, state GOP chairman Bob Davis Jr. charges the "lack of oversight and control" over the so-called Smartcards "has created a situation which could allow for voter fraud."

The situation is not "lack of oversight and control" of these smart cards. It's lack of oversight and control of our electoral system such that we've come to a place where there are so many access points to the system, it's virtually impossible, with this equipment, to have any kind of security that could ensure a legitimate vote.

You'll also note this unsubstantiated allegation from the AP coverage of the claims in TN:

Davis sent his letter one day after Gibbons said he asked the Tennessee Bureau of Investigation to look into allegations two people each cast two ballots during early voting in Shelby County.

Looks like the GOP is in good shape in Tennesse at this point. If they lose, they can make whatever claims they like: Fraud by Electronic Voting, or Voter Fraud by those nasty double-voting Dems.

Take your pick. And where is the DNC? Asleep at the wheel, apparently, as we've been trying to point out for months.

Still over a week from election day and already the problems are piling up. Meanwhile the vendors and their shills are making excuses and attempting to sell the voting public a line of garbage. Among the shills is a federal agency, the Election Assistance Commission, that is supposed to assist the voter and, instead, has sent their chairman out on the road to defend the vendors.

In a blog posted yesterday, Brad said it well:

"The U.S. Elections Assistance Commission (EAC) is a complete and utter failure. The current commissioner, Paul DeGregorio, has done nothing to instill confidence in elections or provide a lick of oversight in the deployment and use of these voting systems across the nation in the Midterm Election. In his latest interviews and editorials, he is reprehensibly doing nothing but echoing Voting Machine Company propaganda and Election Officials who choose to be apologists for them."

In a rebuttal to DeGregorios' opinion piece in the Tallahassee Democrat Avi Rubin, Johns-Hopkins Professor, computer scientist and author of "Brave New Ballot" had this to say in his blog:

"I have not seen any reason to trust our nation's voting equipment. Trusting it just because an election official says we should is not good enough for me. I want to trust a system because I don't believe it can be compromised, not because someone implies that not trusting it is not patriotic."

AP Has New Details on the Apparently RNC-Funded Registration Fraud in Tennessee, Now Linked to Sproul & Associates
Fraudulent, Shredded Voter Registrations In 2004 Linked To Same Shadowy RNC Operative, Recipient of Largesse...

Last week we ran an item on fraudulent Voter Registration Forms submitted by a group reportedly tied to the RNC down in Tennessee where there's a tight U.S. Senate race in play to replace the outgoing Bill Frist.

More information on those dirty tricks, and the ties to long-time Arizona-based GOP operative, Nathan Sproul & Associates, are now being reported by AP.

Sproul & Associates, and their various shadowy front groups, were linked to the shredding of Democratic Voter Registration Forms in Nevada, West Virginia, Oregon and elsewhere in 2004 as reported by Max Blumenthal in October of 2004 and again recently in Bobby Kennedy's Rolling Stone exposé asking "Was The 2004 Election Stolen?" More details about Sproul and the millions of dollars he seems to have received from Team Bush '04, and their attempts to hide those costs, were reported by Mark Crispin Miller in June of 2005.

Regular readers of The BRAD BLOG will recall that Sproul & Associates were given buckets of unreported RNC cash before, during and after the 2004 election. For some reason or another. Sproul is also reported to be an organizer for the Christian Coalition. Natch.

And now, AP is reporting the RNC hired a group down in Tennessee calling themselves Liberty Consultants to register (Republican) voters. Even if they had to make them up to do so. And whaddaya know? Liberty Consultants are funded by our old friend Nathan Sproul...

Some good reporting from The Tennessean today on what appears to be some voter registration fraud, possibly tied to the Republican National Committee.

You'll note that Tennessee, a state which had previously been represented by outgoing Bill Frist and thought to have been a shoe-in for Republicans, is now an exceedingly tight race, with the Democratic candidate for that Senate seat, Rep. Harold Ford, beginning to pull ahead...but just barely...A few votes in a single state, at this point, could make the difference in control of the Senate this year.

With that in mind, and what we know about GOP willingness to game elections every which way possible --- extra-legal or otherwise --- please note the following tea leaf from today's Tennessean today...

Voter registrations faked in GOP drive

At least five apparently bogus voter registration forms were submitted to the Metro Nashville election commission by a worker with ties to the Republican National Committee, and up to 150 other registrations have been called into question, The Tennessean has learned.
...
The five Metro forms contain the names, addresses and phone numbers of bona fide citizens, but the birth dates, Social Security numbers, signatures and some other details are wrong. Four of the citizens told The Tennessean that they did not submit the forms.
...
Metro staff said the registration forms bearing that signature were submitted in the name of Tennessee Victory 2006, a booster group advocating for GOP candidates in the state.
...
Tennessee Victory 2006 is a joint effort between the state Republican Party and the Republican National Committee.

State Republican Party Executive Director Chris Devaney said that the RNC was running the show at Tennessee Victory in August, when the registrations were apparently collected.
...
Contacted by telephone Thursday evening, RNC spokesman Danny Diaz declined to answer questions about whether RNC officials worked in Tennessee at all.

Felix Harrod, 84, was a 25-year-old poll watcher at the courthouse during the shootout and said it was common for incumbents in the county about 45 miles northeast of Chattanooga to take ballot boxes to the jail and stuff them with pre-marked ballots.

That was a practice the former soldiers hoped to stop. They offered an all-ex-GI, nonpartisan ticket that promised a fraud-free election and reform. Their rallying cry: "Why fight overseas for freedom and come home and be denied the right to have your ballot counted?"

(Much to the Dismay of Diebold Spokesmen and the San Diego County Registrar...Who Believe Election Workers Would Never Commit a Felony to Game an Election!)

Apparently, it's neither a case of "sour grapes" nor "sore losers" when Republicans challenge elections that they reportedly lost. That's only the case when Democrats charge irregularities or illegalities in an election. And, of course, when it's a Republican whose ox has been gored, the GOP uses every available means to fight the results of the election, and the courts and the legislatures usually play along. And nobody bothers to call them "tin-foil hat conspiracy theorists." Go figure.

Yesterday, in Tennessee, three poll workers were indicted for adding ballots to an election for the state Senate in which a Democrat won by 13 votes.

Of course, the GOP has fought that election tooth and nail, as the GOP, unlike Democrats, always do. And they've even managed to convince the state Senate to overturn the election due to their "allegations" of "irregularities."

As you'll see in the report from AP, the idea of poll workers gaming an election has once again occured. That, despite many absurd claims of late from Diebold spokesperson David Bear to NEWSWEEK, NYTimes and others to this effect...

"For there to be a problem here, you're basically assuming a premise where you have some evil and nefarious election officials who would sneak in and introduce a piece of software," [Diebold spokesman, David Bear] said. "I don't believe these evil elections people exist."

Believe it, bitch.

Or this equally absurd comment from San Diego County Registrar Mikel Haas who discounted concerns of sending easily-hacked Diebold voting machines home for overnights with poll workers just before the Busby/Bilbray election. Even though the machines are incredibly vulnerable to tampering, and storage in poll workers' cars cannot be considered secure --- by Haas' own admission --- there is little to worry about when it comes to fears of poll workers doing anything untoward. As he made clear to me, "you'd have to want to commit a felony, which knocks out most of our poll workers."

Despite plenty of recent examples of "evil and nefarious elections officials" who were more than willing to "commit a felony," it looks like the story out of Tennessee yesterday makes the case against Haas and Bear's feigned Pollyanna-isms. Again.
