Congress and courts are still ignoring the full text of the Amendment, as penned by the Founders, to prevent any and all gun safety legislation...

Nearly nine years ago, we published an article called "High Cost of Willfully Misinterpreting the 2nd Amendment." It highlighted the compelling U.S. Supreme Court dissents written by the late Justice John Paul Stevens and Justice Stephen Breyer in District of Columbia v. Heller (2008) --- a 5 - 4 decision in which the Court's right-wing majority overruled a 1939 SCOTUS precedent by ruling, for the first time in our nation's history, that the Second Amendment created an individual's right to possess a firearm unconnected to service in a State militia.

Our coverage was written against the backdrop of that year's midnight massacre where one individual, sporting body armor and an AR-15 assault rifle with a high-capacity, 100-round drum magazine capable of firing between 50-60 rounds/minute, murdered 16 people and wounded 58 inside an Aurora, CO movie theater. The 2012 article was also written against the backdrop of the large number of mass shootings within the U.S. that could, at that time, be sharply contrasted with what had transpired in Australia.

Following what became known as the 1996 Port Arthur Massacre in Australia --- where a lone gunman, sporting an AR-15, murdered 35 people --- the country enacted strict gun laws that included a gun buy-back program. The result: Australia did not experience a single mass shooting over the next 20 years.

Over these past nine years in this country, Congressional Republicans, who, in 2004, refused to extend the successful 1994 Assault Weapons Ban, continued to oppose any and all forms of gun safety legislation. Not coincidentally, the carnage wrought by the radical assertion of an unfettered individual "right" to bear arms helped lead to more than 600 mass shootings in the U.S. over the course of the 366 leap year days in 2020, according to a The New York Times database. There were, according to Wikipedia's Mass Shooting Tracker project, 150 U.S. mass shootings, producing 148 deaths while wounding 485, over the first 106 days in 2021.

With that in mind, as the unrelenting death toll mounts in the U.S., revisiting our earlier analysis is once again apropos...

Heroes and heartbreak in Boulder; Filibuster reform inches forward; Response to Siegelman interview, Repub recall of CA's Dem Governor...

On today's BradCast: While U.S. flags were already at half-staff following last week's mass killings in Atlanta, another mass shooting erupted on Monday in Boulder, Colorado. On Tuesday, President Biden called for the flags to remain lowered, for the U.S. Senate to pass two bills already approved by the U.S. House to close loopholes in our federal background check system; and to restore the ban on assault weapons that helped keep down such mass casualty events before the George W. Bush Administration allowed it to expire. [Audio link to show follows summary below.]

"We can ban assault weapons and high-capacity magazines in this country once again. I got that done when I was a Senator. It passed. It was law for the longest time, and it brought down these mass killings. We should do it again," the President urged in his brief remarks at the White House. "This is not and should not be a partisan issue; this is an American issue. It will save lives --- American lives --- and we have to act."

Today, we cover some of the reaction following the latest mass shooting in the U.S., which took 10 lives at a supermarket in Boulder yesterday. We honor the heroes that include not only the police who responded --- one of whom, who had seven children, was killed during the shooting --- but also the grocery store workers who courageously helped to save customer lives in the store and, as their union has noted, have been risking their lives for all of us every day over the past year, as essential workers during the pandemic.

We also note the reactions from those who have spent years working to support the ability of terrorists to easily acquire weapons of mass destruction --- such as CO's Republican Rep. Lauren Boebert and the Colorado State Shooters Association --- who suddenly feel that this is no time to talk about guns. "Congressman" Boebert, who appears with guns in virtually appearance, says she "refuses" to use this shooting "to advance a political agenda." And the Shooters Association informs us that "Today is not a day to cloud our remembrance with ... emotional sensationalism."

All of that, after a state judge, just 10 days ago, struck down a law adopted unanimously by the Boulder City Council in 2018 to ban assault weapons in the city, after years of similar massacres in the Centennial State and elsewhere. The Colorado State Shooters Association was one of the plaintiffs in that case, which was "celebrated" just last week by the disgraced, terrorist-supporting NRA, because local laws supported by residents in the CO town were preempted by Big Government at the state and federal level.

But, despite urging from the President on Tuesday, if Republicans won't even agree to allow an up or down vote on background checks, the lowest hanging fruit when it comes to gun safety reforms, it seems impossible to imagine they would ever agree to restoring the federal assault weapons ban. That, no matter how many American lives it might save, no matter how many of their own constituents continue to be massacred in these tragic events.

In response to GOP intransigence, conservative, institutionalist Democrats in the U.S. Senate late last week and over the weekend, continued to inch toward support for filibuster reform --- the only way that gun safety reform and most of the rest of the Democrats' ambitious, progressive agenda will ever be adopted. So there's a small amount of encouraging news on another dark day.

Also today, some response from listeners to our interview with Alabama's former Democratic Governor, Don Siegelman on yesterday's BradCast and his response --- as someone who knows a thing or two about GOP hit jobs on popular Democratic Governors --- to the attempted recall of California's progressive Governor, Gavin Newsom.

Last week, Trump's new "sham" nominee to the U.S. Supreme Court appeared to not know if voter intimidation was even a violation of federal law. This week, as we report on today's BradCast, Trump and his henchmen find themselves facing a federal lawsuit over exactly that. [Audio link to show follows below.]

Among the many stories covered on today's show...

  • First up, Joe Biden has finally stated his position on expanding the U.S. Supreme Court. That position? A bi-partisan commission to study reforms for the federal court system, to offer recommendations after six months...if Biden wins the White House and Dems take the Senate. We discuss what is probably a pretty smart political position for the former VP to take right now, considering that corporate media can't stop using the words "court packing" to describe long-overdue reforms after years of actual court packing by the GOP.
  • Speaking of which, the Senate Judiciary Committee on Thursday, led by South Carolina's increasingly vulnerable Sen. Lindsey Graham, broke their own rules today to ram through the nomination of Amy Coney Barrett without a single Democrat present, after Dems refused to allow a quorum for today's vote. If she is confirmed by the full Senate on Monday, as Republicans currently plan, it will be one of the shortest confirmation processes and the closest to a Presidential Election Day for the seating of a Supreme Court Justice in the nation's history. That, after just 4 years ago Republicans blocked a Democratic SCOTUS nominee entirely for a full year, while vowing that a new Justice should never be seated during a Presidential election year. Republicans also changed the rules in the middle of that game as well, when they killed the filibuster for SCOTUS nominees after failing to get enough votes to pack Neil Gorsuch, Trump's first nominee, onto the Court. Over the past five years, Republicans have succeeded at completely delegitimizing the U.S. Supreme Court.
  • The GOP's already-stolen Supreme Court on Wednesday sided with Alabama's dishonest, lying, somewhat deranged, unlawfully Twitter-blocking, Republican Sec. of State John Merrill to nix curbside voting in counties that wished to use it to help keep disabled voters safe during the COVID crisis, as recommended by the CDC and approved the U.S. Dept. of Justice as a way to prevent violations of the Americans with Disabilities Act (ADA). All three remaining Democratic appointees on the Court dissented, siding with the U.S. District Court and federal appeals court which, after a three day trial, found the now-scrapped accommodation to be a "modest" and "reasonable" way to avoid a potentially fatal illness for some voters.
  • In recent days, Democratic voters in Florida and several other battleground states have been receiving threatening warnings via email, instructing them to "Vote for Trump or else!" The body of the emails, which appear to come from a Trump-supporting extremist group, cite the recipient's name and addresses and promise to "come after you" if they do not change their party affiliation to Republican and vote as instructed. Incredibly, and with zero supporting evidence, Trump's "partisan hack" Director of National Intelligence John Ratclifffe hastily convened an absurd press conference on Wednesday night to declare that Iran was actually behind the threatening emails to Democrats. He claimed they were designed to "damage President Trump". He also muttered something about Russia. But, again, no actual specifics and no actual supporting evidence for his claim that both countries accessed voter registrations systems to obtain the data (most of which is publicly available without actually hacking into election-related systems). Suffice to say, I believe absolutely nothing from this Administration at this point, about any of it, and, short of independently verifiable information, neither should you.
  • Then, we are joined by the Legal Director at Free Speech for People, RON FEIN, to explain the federal lawsuit his non-partisan good government organization filed on Wednesday on behalf of the Latino civic engagement group Mi Familia Vota Education Fund and several voters, charging that Donald Trump, Attorney General Bill Barr and Acting Sec. of Homeland Security Chad Wolf are violating federal laws against voter intimidation.

    The complaint [PDF] and accompanying request for a preliminary injunction, as Fein details, alleges defendants have exhibited a pattern of intimidation against voters that violates the Voting Rights Act of 1965, the Ku Klux Klan Act of 1871, and the First, Fifth, and Fourteenth Amendments to the U.S. Constitution.

    As FSFP explains in their announcement of the suit, the complaint is "based on the defendants’ violent suppression of public protests opposing police brutality, the encouragement of white supremacist 'vigilantes,' threats to send 'sheriffs' and other law enforcement to the polls, the undermining of mail-in voting, and the rejection of the peaceful transfer of power, which, the complaint alleges, constitute illegal voter intimidation."

    Fein offers more details on what he describes as a "threatening pattern of conduct stretching over the past few months," that has resulted in the suit. "People understand what it means when the President talks about sending law enforcement...When he tells the Proud Boys to 'stand by,' people understand what that means...This is not one piece of conduct, one isolated statement. This is a months-long pattern that the President and his top officials have been involved in, that has the purpose and effect --- hopefully not successfully --- but it certainly has that effect, of intimidating people from voting either in person or by mail."

    Explaining the relief sought by the complaint, he tells me: "First of all, we want relief prohibiting the defendants from deploying armed federal agents at or near polling places; from ordering federal agents to block the delivery of ballots or interfere in the counting of ballots; from taking any actions that could limit with the speed or reliability of mail delivery. And specifically to Trump, prohibiting him from encouraging his supporters to bring weapons to polling places, block access to polling places, to question voters, or from using official government public communications channels --- which now includes his Twitter account --- to suggest that lawful votes will be scrutinized or challenged."

    He also discusses a somewhat related federal case also filed this week by FSFP on behalf of the Minnesota chapters of the Council on American-Islamic Relations and League of Women Voters against a private mercenary contractor who has posted job listings, reported recently by the Washington Post, seeking to hire and deploy armed former special ops troops to patrol polling sites in the state.

Guest: American Prospect's David Dayen on the failure of coronavirus relief measures and 'Great Depression II'...

On today's BradCast: Don't believe a word you are being told by the Administration or Wall Street. Actual facts and data suggest its almost entirely all bullshit. [Audio link to show follows below.]

The economic outlook in the U.S. continues to quickly degrade in light of the coronavirus pandemic, with another record 6.6 million applying for unemployment benefits last week. That brings the total number of jobless claims to an unheard of 17 million or so in the past three weeks alone, with millions more unable to even apply for benefits due to still-overloaded websites and continuously busy phone lines at states across the country. The all-time weekly record for jobless claims, until three weeks ago, was 695,000. Over the past three weeks it has been 3.2 million, followed by 6.6 million, followed again by another 6.6 million.

The numbers are stultifying. For example, that 17 million figure is more than the total number of jobs added since 2013; far more than the total number of jobs in the 20 smallest U.S. states combined; and far more than every single job in the state of Texas, which has the 2nd largest state workforce in the country. The unemployment rate, believed to now be at least 12%, goes far beyond the worst days of the Great Recession and are now in Great Depression territory, with some independent economists refering to what we are now looking at as "Great Depression II". (Check out the two gobsmacking charts in WaPo's coverage today.)

And, yet, despite those data, and still climbing coronavirus cases and deaths, we are getting a whole lot of happy talk from the Administration. And not just from our desperate, pathetic Liar-in-Chief, from whom we'd expect it, but from folks like Treasury Secretary Steven Mnuchin, who absurdly suggested today on CNBC that America "could be open for business" by May! Donald Trump's Federal Reserve Chairman Jerome Powell assured the Brookings Institution that the "strong economic footing" before the COVID-19 crisis will support a "robust" recovery, as if we could expect one any day now! All of which was enough to continue the recent Wall Street rally that resulted in the biggest weekly jump in the S&P 500 since 1974!

Everything must be going great! But, of course, it isn't. At least not back here in Realityville, where the "irrational exuberance" (as long-ago Fed Chair Alan Greenspan once described it) of the Administration and Wall Street is nowhere near seeing its way to Main Street. That, even though the Fed announced $2.3 trillion in new funding schemes --- creating money out of nowhere (no Congress needed, thanks!) --- in hopes of offsetting the impact of the pandemic on the economy. The Fed initiative includes something they are calling the "Main Street Lending Program" to shovel money to "Main Street" companies with up to 10,000 workers and less than $2.5 billion in revenue. Ya know, like most of those business on your friendly local "Main Street".

At the same time, none of the promised, measly $1,200 checks for individuals from the $2.2 trillion CARES Act have made their way to Americans yet (Mnuchin says "next week!"), and the $350 billion Paycheck Protection Program (PPP) from the same emergency relief package adopted by Congress two weeks ago is still said to be mired in bureaucratic red tape at the commercial banks tapped to hand out the money (and take a cut in the bargain). There is little if any money actually getting to people and small businesses that need it most at the moment, even as Congress was bickering again on Thursday about adding another $250 billion to the program which will still be woefully underfunded even then.

But, somehow, Wall Street and the Administration are sending the message that all will be well, with America "back in business" as early as May! Don't count on it.

Investigative financial journalist DAVID DAYEN, Executive Editor of The American Prospect and author of its daily and indispensable "Unsanitized" report (which warned about all of these matters before they happened today and were only then picked up by the corporate mainstream media) joins us again to help unpack the details on all of the above, more related failures, and a few that we should be expecting in the days ahead, as the dire situation gets worse and the irrational exuberance and happy talk from D.C. and Wall Street continues impotently.

"John Edwards used to talk about the 'Two Americas'," Dayen notes. "Those two sets of statistics couldn't be starker about the Two Americas. Investors are letting the good times roll, while ordinary Americans are losing their jobs in numbers with a speed that we have never seen before."

"The difference between 2008 and today is that, in 2008, the institutions that were getting this largess were largely responsible for the downturn, whereas these businesses pretty much aren't responsible for the coronavirus. When you look at the proportionality of the response --- when you look at the neighborhood pizza shop or the neighborhood dry cleaner, and what they have to go through to survive in this Second Depression --- and you look at a 'main street' business with 10,000 workers, or the airlines, or some other large businesses, the velvet rope service they are getting, it is obviously very disproportional," he tells me.

"So let's not say nobody has been helped. We sped relief where we could, to the people who this bill was for, and that's investors on Wall Street."

Guest: FOIA plaintiff Jason Leopold of BuzzFeed News; Also: Good elections news regarding both the White House and Senate...

We enjoy a brief pause from our wall-to-wall election coverage of late on today's BradCast (if not entirely) to revisit the ongoing unraveling of the rule of law as we know it at the U.S. Dept. of Justice under Donald Trump's fixer Attorney General Bill Barr. [Audio link to show is posted at end of summary.]

Late on Thursday, a long-time U.S. District Court judge appointed by George W. Bush issued a blistering --- and perhaps unprecedented --- opinion, essentially describing the U.S. Attorney General as a liar. Judge Reggie Walton described Barr's characterization of the Robert Mueller Special Counsel's Report on the investigation into Russia's influence on the 2016 election, as "distorted" and "misleading".

He cited "inconsistencies" between Barr's description of the findings in Mueller's 381-page report before it was released in redacted form last year, versus the often-damning evidence actually revealed by the Special Counsel's probe. Walton declared that Barr's "lack of candor" called into question his "credibility and, in turn, the department's" reasons for redacting portions of the report in response to a Freedom of Information Act (FOIA) request for the full, unredacted text of the document.

"The inconsistencies between Attorney General Barr’s statements, made at a time when the public did not have access to the redacted version of the Mueller Report to assess the veracity of his statements, and portions of the redacted version of the Mueller Report that conflict with those statements cause the Court to seriously question whether Attorney General Barr made a calculated attempt to influence public discourse about the Mueller Report in favor of President Trump despite certain findings in the redacted version of the Mueller Report to the contrary," Walton said.

The unusually blistering opinion by a federal judge of a sitting U.S. Attorney General, challenging the credibility of DoJ prosecutors who, he felt, might be lying about the reasons for redactions in order to protect Barr's earlier false claims (that Mueller found no evidence of collusion and was unable "to establish that the President committed an obstruction of justice offense" --- all lies) is being cited by former prosecutors as "indicative of the fabric of the justice system deteriorating".

Judge Walton has now ordered the DoJ to privately reveal to him what is under the redactions that the government is claiming are related to national security and other lawful exemptions from FOIA requests.

We're joined today by BuzzFeed News investigative journalist JASON LEOPOLD, who filed the FOIA request in question and has now been forced to sue with the Electronic Privacy Information Center (EPIC) to challenge the validity of the DoJ's redactions. Leopold tells us he's filed "well over 3,500" such requests, having sued the government "70 times" to force them to follow the law, but says he has never seen anything like the response unleashed by Walton (who has presided over other suits brought by Leopold as well.)

In other similar litigation, Leopold explains, judges tend to simply defer to claims by prosecutors. If they say there is good reason to keep the material redacted, judges do not tend to question them. "It's rare, it's very rare that a judge will actually say 'let me take a look at this and make a decision'." But, Leopold tells me, he has noticed Walton increasingly losing patience with the Department in recent months. "He's become very, very frustrated and sees this as politicization...and therefore, he just can't take their word that these redactions are justified and followed the law."

When I ask if Walton's charge that Barr was "lacking in candor" is a polite way for the judge to say he may be lying, Leopold says "not 'may be' lying --- is lying!," according to his reading of the federal jurist's opinion.

"This is a very important opinion," he argues, "because you're going to see this opinion cited in other Freedom of Information Act cases, when they go to court to say that the withholding of records, that there's questions about whether there's politicization behind that, and that Barr is the person who presides over this department and simply doesn't have credibility." Leopold continues: "This doesn't just disappear. It doesn't just go away. This is in the record. This is a case that people can cite. Barr has really damaged the reputation of the Justice Department."

All of which serves as a helpful reminder of the importance of removing this dangerous Administration from office this November, no matter who ends up becoming the Democratic Presidential nominee. On that important point, and on the likelihood of Democrats winning back the Senate this year, we've got some encouraging news today --- presuming voters who oppose Trump can come together.

As usual, we cover far too much on today's BradCast, as New Hampshire voters head to the polls for their first-in-the-nation primary today. Full reported results from NH tomorrow, of course. [Audio link for today's show is posted below.]

Among those too many things covered today...

  • We start with some common sense news out of Nevada, where state Democrats, after the Iowa Caucus disaster, have decided to use hand-marked paper ballots for early voting in the state's upcoming February 22nd caucuses. However, they will still be relying on a vulnerable, online iPad tool to record sign-ins (albeit with paper backup, so there's that);
  • On Monday night, the eve of the New Hampshire primary, Donald Trump rallied in the Granite State by lying to supporters about voter fraud there, and by taking a small page from the disgraced Chris Christie's New Jersey "BridgeGate" scandal. Trump's Secret Service detail, according to campaign officials, made it difficult for Democratic candidates and their supporters to get around the state's largest city. Given that Republican Senators recently gave a thumbs up for Trump to cheat in the 2020 election with their "not guilty" votes at the end of last week's Impeachment Trial, nobody should be surprised he is now doing so;
  • But there was some very good news for Bernie Sanders from a national Quinnipiac poll on Monday night, revealing the Vermont Senator vaulting into first place ahead of Joe Biden for the first time. We also review a number of other interesting findings for the survey suggesting good news for Sanders, along with a warning that those are national numbers, in a nation that runs state-by-state elections instead. Just ask Hillary Clinton;
  • As he gains momentum, Sanders is also being forced to defend his identity as a "democratic socialist" and his support for programs such as Medicare for All and the Green New Deal. Republicans (and even some Democrats) are hoping to disparage Sanders with those charges, from which he does not shy away;
  • At the same time, Trump and friends and family are attempting to sow discord among Democrats by claiming that the DNC is rigging the election against Sanders, hoping they'll convince Sanders' supporters to sit out 2020 if he is not the nominee;
  • At the same time, Republicans in South Carolina are reportedly urging their own supporters to vote for Sanders in the state's upcoming February 29 primary, since the state GOP cancelled their own primary there as a gift to Donald Trump. The theory, also floated publicly by Trump himself, is that they'd love to run against Sanders this November because, they'd like you to believe he will be easy to beat;
  • And, just to the north, a mysterious group calling themselves the "Faith and Power PAC" is playing a similar game, by spending nearly $2.5 million to support a progressive state Senator for the Democratic U.S. Senate nomination in North Carolina's March 3rd Super Tuesday primary. The new group appears to be tied to Republicans and the candidate they are running ads for, state Senator Erica D. Smith [pictured above right], is currently running behind the centrist D.C. Dem-supported Cal Cunningham in the contest to win the Dem Senate nomination to run against vulnerable Republican incumbent Sen. Thom Tillis this fall. The TV spot purporting to be on behalf of Smith, highlights her support for Medicare for All, the Green New Deal, and other progressive policies making her "one of us", as the ad claims. (We interviewed Smith on The BradCast late last year, as she was demanding hand-marked paper ballots for North Carolina);
  • We're joined today by North Carolina's DR. WILLIAM BUSA of the progressive political data consulting firm EQV Analytics to discuss all of the dirty tricks in the Carolinas. Busa, who previously worked for state Senator Smith and writes as "DocDawg" at DailyKos, suggests this mysterious group of Republicans may have made a miscalculation in their attempt to monkey-wrench the Democratic Senate primary race in his state. He also explains how they may have committed fraud in their FEC filing. He shares his insight on the curious NC ad buy and the question of whether Republicans are really interested in running against progressives like Sanders and Smith because they believe they will be easy to beat this November, or because they want Democratic voters to BELIEVE progressives will be easy to beat. "Is this eleventy-dimensional chess or is this Tic-Tac-Toe that they're playing?," Busa asks. "I'm not entirely sure which it is, but I don't think it's eleventy-dimensional chess." We've got a lot to unpack in that conversation today!
  • Finally, Desi Doyen joins us for our latest Green News Report, with good news and bad Down Under, unquestionably bad news for bumblebees and Antarctica (and, by extension, for all of us) and the interesting way that Democrats raised the issue of climate change during last Friday's Presidential Debate in New Hampshire...
