On today's BradCast (with helicopters circling overhead here in Hollywood): Massive protests around the country continue today for an eighth day following last week's police killing of George Floyd in Minneapolis. The street protests continue to swell, no doubt, in response to the frequently brutal response by law enforcement officials in many major cities around the country toward the mostly peaceful demonstrations. But protests in the streets aren't the only much-needed response to years of violence instigated by law enforcement. [Audio link to full show is posted below.]

First up today, one response will be --- or, certainly should be --- at the voting booth this year. To that end, eight states and Washington D.C. are holding their Presidential primaries today. Congressional primaries and municipal elections are being held in a number of other states as well, many of them previously postponed due to the coronavirus. But the deadly pandemic continues, leading Republican Gov. Mike Parsons of Missouri --- where absentee voting is severely restricted --- to tell voters recently that if they don't feel safe to vote due to the pandemic, they just shouldn't bother. That, instead of working to expand absentee voting in the Show-Me State to make it safer for voters to exercise their right to participate in their own democracy. As a GOP-dominated state, however, making it easier to vote in MO may be the last thing Parsons wants.

Nonetheless, expanded absentee voting is now occurring in a number of states --- red, blue and battleground --- where problems have already emerged, including in Pennsylvania and in Idaho, as discussed on today's show.

We're hopeful that election officials see today's "practice run" primaries as a flashing red warning light to get their acts together before November 3rd. That will not be made any easier by intransigent Republican lawmakers in D.C. who are still refusing to appropriate the billions of dollars that elections officials say they need to upgrade systems for this year's elections amid a pandemic, or to bail out the U.S. Postal Service --- hard hit by the COVID crisis --- so they are able to handle the unprecedented mail-in voting we will see in this fall's critical general election.

In related news, the President of the United States, after reportedly spending time over the weekend locked away in a White House bunker due to fears of protests in front of the Presidential mansion, decided to play tough guy on Monday by unleashing federal troops with tear gas, rubber bullets, batons and shields on peaceful protesters in Lafayette Park, on the priest and several seminarians at St. John's Episcopal Church across the street, and on foreign journalists covering the American Dystopian nightmare live on television. D.C.'s Episcopal Bishop, as well as the Australian Ambassador, both had a word or two to say about it after a crew from the country's Seven Network was ">punched by federal storm-troopers as the journalists were covering the violent effort to clear out the park so that Trump could pose for a campaign photo-op holding a bible in front of the historic church.

And, in more related news, while Trump's questionably Constitutional threat on Monday to dispatch the U.S. military to quell protests in states around the country --- beyond his own front door, in any event --- is likely as hollow as most of his other strongman threats, the very real and systemic problem of brutal, racist policing policies continues in this country. To that end, calls to "Defund the Police" have grown in recent days, as seen in protest signs, from various non-governmental organizations around the country and in various media outlets.

We're joined today by longtime policing expert ALEX S. VITALE, Professor of Sociology at Brooklyn College and Coordinator of their Policing and Social Justice Project. Vitale, who penned an opinion piece for The Nation over the weekend headlined "The Only Solution Is to Defund the Police" explains how reforms instituted by the Obama Administration after outrage unleashed by the police murders of Michael Brown in Ferguson, MO and Eric Garner on Staten Island, NY six years ago have failed to bring much-needed institutional changes to police departments around the country. The Minneapolis Police Department, in fact, was once held up by some as a model of progressive change that, clearly, has not resulted in the hoped-for reform.

"Minneapolis was kind of a 'shining star' of this new approach to police reform," he tells me. "That comes out of the Obama Administration, the Department of Justice and a lot of academic think tanks. Their idea was if we can make the police more professional, less biased, more transparent, that this will help restore people's trust in policing. So they implement things like implicit bias training, mindfulness training, de-escalation training. They give police body cameras. They set up a lot of police-community encounter sessions. They try to identify a few problem officers, to give them supplemental training. These are the kinds of things that they hope will create a more modern, professional police force that hopefully will kill fewer unarmed black people."

None of that worked, however, he says. "The number of police killings has not been reduced over the last five or six years. The number of low-level misdemeanor arrests has not been reduced. The number of police in our schools has not been reduced. The war on drugs has not been reduced. So we haven't seen real changes in the impact of policing on those who are most heavily policed. And that's really the problem here."

Now, explains Vitale, author of the book The End of Policing, it is time to demilitarize and defund departments around the country after 40 years of expanded and intensified policing and the more recent failed reforms. "We have dozens of places across the country where people have organized campaigns to dial back police funding," he explains. "No one is out there saying tomorrow we can just flip a switch and there are no police. Most of these proposals are about rolling back increases in police spending over the last ten years."

He argues that many of the functions that cops are currently tasked with would be much better handled by social workers and community organizations, where funding should be shifted away from the police. He also details how this has been a long time bipartisan problem and that many of the "solutions" offered by politicians --- from tough guy "law and order" measures on the Right or more recent progressive initiatives to better train cops to handle sensitive racial situations and improve community policing efforts on the Left --- are more often "used by police leaders and political leaders to deflect and demobilize the protests against them."

Vitale explains how you can help join the movement, why its so important, and how it is literally the only chance we have left for change. Hopefully, this is just the beginning of a long-overdue conversation in our country. "My hope is that, as the immediacy of the protests subside, that people connect with these real movements to do the kind of sustained political organizing on the ground that can help change the view about policing, and develop a kind of new majoritarian politics that is more humane, and less centered on punishment and vengeance," he says.

On today's BradCast: It was another big night for Joe Biden, as he appears to have been the clear winner in 4 of the 6 states (Michigan, Washington, Missouri, Mississippi, Idaho and North Dakota) which held Democratic Presidential primaries on Tuesday. But Bernie Sanders said on Wednesday that he is not out of the running just yet. [Audio link to show is posted below.]

In the meantime, the fallout from the coronavirus --- now officially a global pandemic according to the World Health Organization with more than 1,000 cases in the U.S. --- continues to have a growing affect on nearly every aspect of life in the U.S. and around the globe. Aside from school closures, town lock-downs, industries directing employees to work at home, cancellations of large festivals, conventions and now sporting events, including the NCAA's March Madness tournaments set to be played without spectators in the arena, the Dow took another tumble today, falling more than 1,400 points and ending the 11-year bull market begun under Obama in 2009.

We discuss all of that today, and the bumbling Trump Administration's egregious failures in managing the worsening epidemic, before breaking down the reported results from Tuesday's 6 primary states, where voters appear to have chosen Biden in MI, MO, MS and ID, while preferring Sanders in ND and maybe WA, where the Vermont Senator currently leads by a hair as Vote-by-Mail ballots continue to be tallied.

Once again, voters on Tuesday were forced to shamefully wait in hours-long lines to cast their ballots in locations in both Michigan and North Dakota, even as many voters on social media persist in forwarding unsupported charges that the DNC is somehow behind the numerous failures of local and state officials to run efficient, reliable, and publicly overseeable elections.

We share extended excerpts from Biden's remarks following his victories on Tuesday night, offered to a nearly empty hall in Philadelphia were coronavirus concerns resulted in only media and campaign staffers in attendance. And we also share Sanders' remarks from Vermont today, vowing to stay in the race at least through Sunday night's scheduled debate, the first head-to-head forum between the last two Democratic candidates still standing.

We are then joined by the great progressive journalist JOHN NICHOLS of The Nation to try and make some sense of this remarkable moment in history and the surprising state of play in the increasingly bizarre 2020 election. He argues that Sunday's one-on-one between the two candidates is likely to be "the most consequential debate of 2020," adding that he "suspect[s] it will matter more than the fall debates between Trump and whoever is nominated at this point, presumably Biden."

Citing Sanders' remarks on Wednesday, Nichols believes Sanders "left himself an exit ramp, and left Biden an entry ramp. Because he essentially told Biden what Biden's got to do" in order to win support from Sanders' movement. "I genuinely think that Sanders is proposing a debate where, if Joe Biden really steps up, he's going to narrow the lane for Bernie Sanders --- which is already narrow. If Joe Biden steps up, he's got a lot of opportunities here as an entry lane into the fall campaign [to]bring the movement on board and this will sort out."

Whether Biden seizes that moment, however, remains to be seen. His subdued and even Presidential remarks from Philadelphia on Tuesday certainly suggest he is capable of it. But we'll see. "Is he the right candidate?," Nichols asks rhetorically. "If you can't build your movement, your coalition, and you can only do it by kind of forcing people to make choices rather than inspiring or exciting people, then that's a problematic situation."

Among the other oddities and ironies of this moment, Nichols observes in his column today that while voters in MI, MO and MS voted for Biden on Tuesday, exit polls reveal that they actually support Sanders' central campaign proposal for single-payer Medicare for All by huge numbers in all three states. What explains that irony? Nichols offers his thoughts on that and much more on the state of the race in very dark times during our conversation today...

Six more states are voting today (Michigan, Washington, Missouri, Mississippi, Idaho, North Dakota). We'll have results tomorrow, as we're still trying to figure out who actually won and lost, in some cases, last week on Super Tuesday, particularly in Texas and California. Nonetheless, today, like last week, has already revealed more problems with electronic pollbooks that resulted in voters leaving without voting, and there is more likely trouble on the horizon in several states set to vote in the next several weeks. Among the stories covered on today's BradCast...

• A fire at Venezuela's National Electoral Council warehouse over the weekend has resulted in the destruction of 50,000 touchscreen voting machines and 582 computers. We swear we didn't do it! The unverifiable voting machines in question have been used during questionable past elections and are made by Venezuelan-based Smartmatic...the same company with a dodgy background of failed elections who also made the new touchscreen voting systems which failed so disastrously in Los Angeles County on Super Tuesday last week. But, again, we didn't do it!;

• Closer to home, voters today in St. Louis County --- Missouri's most populous --- were turned away from the polls for an hour or so this morning from at least 50 of the county's 400 polling places. Though St. Louis has finally moved to hand-marked paper ballots, they are using a print-on-demand system that uses electronic pollbooks (yes, more computers) to instruct the printers which ballot should be printed. Those e-pollbooks, apparently, were failing this morning until the company that makes them issued an update. In the meantime, there is also a manual print mode that pollworkers could have used to print ballots for voters when the e-pollbooks weren't working, but many appear to have not known that or just panicked and forgot. Also, in MO, Kansas City's African-American Mayor was turned away from the polls after his name was not found on the voting rolls. Later in the day, they figured out why;

• Both Bernie Sanders and Joe Biden cancelled campaign rallies set for Ohio today (where early voting has already begun for next week's primaries in the Buckeye State), due to coronavirus concerns, in what may foreshadow still more trouble for this year's elections, including how to include enough hand-sanitizer for polling places, especially those which use touchscreens. (People can usually bring their own pens to polling places that use hand-marked paper ballots.) We may end up seeing Vote-by-Mail elections for the entire country this November if the virus continues to spread, despite the steady leadership of stable genius Donald Trump;

• Some good news for voters (finally!) out of Georgia today, as the state has reached a settlement with the Democratic party in federal court that requires voters be immediately notified about absentee ballots that are rejected by county officials due to perceived signature mismatch or some other infirmity, allowing them time to come in and cure the problem so their votes may still be counted;

• But there is also less good news out of Georgia, where last week's "good news story out of Georgia" was the fact that Athens-Clarke County's Board of Elections had voted to ditch the new, state-mandated unverifiable touchscreen voting systems for hand-marked paper ballots instead. The Board found that the touchscreens on the new Dominion ImageCast ballot marking devices (BMDs) were so large and bright that they violate voters constitutionally-mandated right to a secret ballot, as others could see how they were voting from 30 feet across the room, according to a related lawsuit filed in a separate GA county. But now, GA's Republican Secretary of State Brad Raffensperger has called an emergency hearing in Athens, charging that the County's Board is violating state law by not using the new, unverifiable voting systems. Now why would he want do that?;

• Meanwhile, in Texas, ballot scans stored on 44 thumb-drives from the new Ballot Marking Device systems used for the first time during last week's Super Tuesday primaries in Dallas County apparently were not included in previously reported results. As many as 7,000 ballots could be missing from the current results. The County's Election Director was required to get permission from a court to "recount" the computer-marked ballots scanned in the county to include those previously left out of the count. A Dallas court, on Tuesday, gave permission to do so, but the order is limited to a computer-scan of the computer-marked paper ballots that were previously not included in last week's results;

• Finally, Desi Doyen joins us for our latest Green News Report, with news on the coronavirus and an oil price war, both affecting the stock market (and banks and fossil fuel-reliant communities) this week, a new troubling report on air pollution caused by fossil fuels, and some good news as New York state's disposable plastic bag ban finally kicks in...

On today's BradCast, we've got a bunch of mostly encouraging news today for a happy change --- particularly for progressives, women, and women progressives! [Audio link to show follows below.]

First up, the least encouraging part of today's program, as some voters in Pennsylvania were once again prevented from voting when 100% unverifiable touch-screen voting systems at a York County precinct failed for the first hour of polling during Tuesday's statewide mid-term primaries. With just 10 --- that's right, just 10 --- emergency paper ballots on hand for each party, voters were turned away because the electronic voting systems failed. That completely predictable problem (which we've been warning about for well over a decade now), may well get even worse around the country, as states adopt new voting systems with the same problems, under the deceptive premise that they produce "paper ballots".

Other than that, the news was largely good for progressives (and bad for Congressional Republicans) following Tuesday's primaries in Oregon, Idaho, Nebraska and, of course, Pennsylvania, where Democrats hope to pick up as many as 6 seats from Republicans in their bid to retake the U.S. House this November. The news was particularly good for female candidates in PA and elsewhere, and for progressives who won in a number of places against candidates preferred by the national Democratic party.

We detail the key races and upsets in question, some of which will be pose an interesting test for progressives this fall, who have long argued that bolder progressive candidates --- calling for universal health care for all, higher wages and other progressive priorities --- will perform better in general elections than so-called "Republican lite" candidates. We'll see if they're right in just under six months.

Then, we're joined by Constitutional law expert and author IAN MILLHISER, to discuss the stolen U.S. Supreme Court's ruling this week striking down the Professional and Amateur Sports Protection Act (PASPA), a 1992 federal ban on sports betting in, largely, all states other than Nevada. But, the reason why the finding in the case (Murphy v. NCAA) is of note to progressives is not due to the specific issue of sports gambling, as he argues, but what it likely means for other federalism issues, such as the Trump Administration's attempted immigration crackdown on so-called "sanctuary cities".

Millhiser explains why progressives should be very happy about the Court's ruling this week --- even with the majority opinion written by far-right Justice Samuel Alito --- and why the Court unanimously found the law to be an unconstitutional "commandeering" of state's rights.

While the holding in that case may be bad news for Trump, so is another decision from a lower federal court this week. Millhiser also details a federal judge's ruling on Tuesday knocking down an attempt by Paul Manafort, Trump's indicted former campaign chair, to toss one of the two criminal cases filed against him by Special Counsel Robert Mueller.

Finally today, a bit more on Tuesday's primaries in Idaho, where a progressive female Democrat became the first native America woman to win the party's nomination for Governor, defeating the national Democrats' preferred candidate in a race seen as a long-shot for this fall. But, in a nation where thousands of teachers in yet another so-called "red" state (North Carolina) on Wednesday shut down schools to march in support of higher pay and more money for schools, anything may now be possible...if voters get out to the polls, are allowed to vote, and are able to make sure their votes are counted as cast this November...

Once again, voters headed to the polls and caucuses on Tuesday. This time in AZ, UT and ID. So, as you may have guessed, on today's BradCast we cover all of the reported results, historic turnouts and, yes, all of the problems faced once again by voters --- particularly in Maricopa County (Phoenix), AZ.

While Bernie Sanders won the night on the D side (not that the corporate media much mentioned that) and Trump, once again, won the R side, the biggest story was how election officials, yet again, failed the voters.

In Phoenix, longtime Maricopa County Recorder Helen Purcell (R), massively reduced the number of polling places from 211 in 2012 to just 60. She was able to do so after the U.S. Supreme Court gutted the Voting Rights Act in 2013. Prior to that, she would have had to get approval from the federal government for such a change before thousands were inconvenienced and/or disenfranchised by it. The result was thousands of voters waiting in line --- for up to five hours in some places --- with the last votes finally cast after midnight on Wednesday.

On today's show, we call out the folks responsible (the ones we know of, at this time), call for an official investigation, and even call out those folks (talking to you, many Bernie supporters!) shouting "VOTER FRAUD!", when your concerns are actually election fraud or voter suppression. (Please leave the voters alone! They are doing fine and performed heroically on Tuesday! But I have much more to say about that, and about falsely charging people with fraud without evidence in support of those charges, on today's show.)

On today's BradCast, we are live from Pacifica Radio's KPFK studios in Los Angeles, for coverage of last night's amazing nominating contests in MS, ID, HI and, mostly, MI, where Bernie Sanders reportedly overcame a 20pt deficit, according to the pre-election polls, to defeat Hillary Clinton.

Of course, Donald Trump wiped out his GOP competition again almost everywhere (including in Michigan, where there was no polling disparity on the GOP side), leaving Ted Cruz as his only real challenger as John Kasich and, especially, Marco Rubio, fade into near-certain oblivion.

So, how did Sanders' remarkable "win" in MI come about? What does it bode for next Tuesday's big primaries in neighboring (similarly industrial and neighboring) states? Should his supporters worry about reports of "irregularities" already in Chicago? How is it that Sanders ended up losing the delegate count (the real one, not the fake "SuperDelegate" count) anyway yesterday to Clinton? And will the mainstream corporate media continue to ill-inform voters by blatantly misreporting the race?

On today's BradCast we cover a number of important new rulings on a number of important cases around the country --- and most of those rulings are actually very good news!

I'm joined by Desi Doyen and The BRAD BLOG's legal analyst Ernest A. Canning to discuss several of them (after a blessedly short few minutes on Trump and Fox 'News' at the top --- you're welcome!), including:

• The matter of the nation's dumbest Governor, Maine's Paul LePage (R), who tried, but failed, to properly veto some 65 pieces of legislation passed by his state legislature. The verdict is now back from the state Supreme Court, to whom LePage had appealed to help fix his epic failure. Suffice to say, LePage remains the nation's dumbest Governor.

• A Colorado state appellate court has now ruled on the case of a local baker who says he really doesn't mind serving gay people in his shop at all...unless they want to buy a cake to celebrate their wedding. Should he be allowed to refuse service based on a so-called religious belief?

• The Connecticut Supreme Court rules on the constitutionality of the state's death penalty after the legislature passed a law banning its use...on everybody except the 11 prisoners who were already sentenced to die before the state's moratorium was passed.

• A U.S. Appeals Court rules on whether Idaho's "Ag-Gag" law, barring journalists and whistleblowers from video taping abuses at factory farms, feed lots and slaughter houses, etc.,. violates the Constitution's First Amendment and whether those who violate that law can be thrown in jail, as the law mandates!

• A U.S. Appeals Court in Texas has ruled against the state Republicans' disenfranchising Photo ID voting restriction, finding it a violation of the Voting Rights Act. But will the state GOP be successful in appealing and/or forestalling that ruling until after next year's elections?

In a carefully reasoned, 29-page decision, Chief U.S. District Court Judge B. Lynn Winmill struck down, as unconstitutional, an "Ag-Gag" statute that, according to the court, had been drafted for the express purpose of shielding Idaho's agricultural and dairy industries "from undercover investigators and whistleblowers who expose the agricultural industry to 'the court of public opinion.'"

"Under the law," the decision explains, "a journalist or animal rights investigator can be convicted for not disclosing his media or political affiliations when requesting a tour of an industrial feedlot, or applying for employment at a dairy farm. An employee can be convicted for videotaping animal abuse or life-threatening safety violations at an agricultural facility without first obtaining the owner’s permission." The offender not only faces up to one year in prison, but could be ordered to pay twice the economic loss an owner suffered as a result of publication of the video even if its content was true.

The Animal Legal Defense Fund (ADLF) and several other organizations, including the ACLU, filed the federal lawsuit and moved for summary judgment, alleging that the Idaho "Ag-Gag" statute violated both the First Amendment right to free speech and the Equal Protection Clause of the 14th Amendment. The court agreed, expressly noting that "agricultural...operations that affect food and worker safety are not exclusively a private matter" and that the right to free speech includes the ability to rely upon audio and visual recording...

Last year, the California State Supreme Court improperly nixed a ballot initiative meant to encourage state Legislators to support an amendment to overturn the U.S. Supreme Court's infamous Citizens United decision, according to a court brief recently filed by several state advocacy groups.

In the summer of 2014, the California state Legislature enacted SB 1272, a ballot initiative (Prop 49), asking California voters to advise whether the state's elected representatives should pursue passage of an Amendment to the U.S. Constitution that would overturn Citizens United. The advisory measure, had it been allowed on the general election ballot last year, had sought to establish that corporations are not people and that the rights enshrined in our nation's founding documents apply only to living, breathing human beings.

The effort to permit voters to weigh-in on the subject was cut short when the CA Supreme Court promptly ordered then Secretary of State Debra Bowen to remove Prop 49 from the November ballot pending full briefing and argument with respect to a legal challenge filed by the Howard Jarvis Taxpayers Association ("HJTA") --- an anti-tax organization founded by Republican Howard Jarvis.

As described on the Court's docket sheet, the state Supremes removed Prop 49 from last year's ballot based on a 1984 CA Supreme Court decision, American Federation of Labor v. Eu ("Eu"), which established "that substantial harm can occur if an invalid measure is permitted to remain on the ballot."

In Eu, the CA Supremes struck down a ballot initiative that sought "to compel California's elected representatives, on penalty of loss of salary, to apply to Congress to convene a constitutional convention for the…purpose of proposing an amendment to the United States Constitution requiring a balanced federal budget." (Emphasis added).

But, according to the amicus curiae ("friend of the court") brief, recently filed by Free Speech for People (FSP) and other advocacy groups, the Court's earlier decision in Eu does not support last year's decision to remove the Overturn Citizens United initiative from the 2014 ballot. The brief explains that the state Legislature does, indeed, have the constitutional authority to seek advisory instructions from the Golden State's electorate via the ballot.

FSP not only defends the legality of the Prop 49 initiative, as measured against both the U.S. and California Constitutions, but presents both historical and legal arguments that, if successful, could define the very essence of our (small "r") republican form of government (aka, representative democracy) --- a form of government that is guaranteed in every state by Article 4, Section 4 of the U.S. Constitution...

On a more substantive note, while The BRAD BLOG had been considering an endorsement in this race for the guy who had been living in Fat Jack's cellar, we're trying to find Fat Jack himself to see if he can be drafted as a write-in instead.

Also, too, we're a little disappointed that the last guy didn't tell us anything about "the Negro". Seems a missed opportunity.
