There was a little something for everyone, it seems, in Tuesday's primary elections in Vermont, Connecticut, Minnesota and Wisconsin. We cover as much of it as we can on today's BradCast, as voters in all but 10 states have now selected their candidates for the crucial 2018 midterms. [Audio link to show follows below.]

There were a lot of "firsts" and reasons for Democrats to be optimistic about November, based on the reported results today, and some of that optimism comes from races that Donald Trump believes he is happy about today, as his party moves farther and farther to the right to become the Party of Trump. It should also be noted that many of the Democratic winners on Tuesday were both progressive and political newcomers.

Among the many noteworthy contests on Tuesday covered on today's show, we now have the first transgender person to become a major party nominee for Governor (Christine Hallquist in VT); the first African-American woman to likely represent New England in the U.S. House (former teen mother turned "Teacher of the Year", Jahana Hayes in CT); the first Somali-American refugee who will likely become one of two of the first Muslim women to be elected to Congress (Ilhan Omar in MN); a stunning upset in Minnesota's Republican gubernatorial primary (front-runner and former two-term Gov. Tim Pawlenty was crushed by Trump-endorsed Jeff Johnson); and there were some encouraging Democratic wins in Wisconsin and victories over moderate GOPers by fully Trumped-up Republicans in several races.

We're joined today by native Wisconsinite and longtime progressive journalist JOHN NICHOLS of The Nation and of Madison, WI's Capitol Times for analysis and insight on all of the above, as WI's controversial, union-busting, two-term Republican Gov. Scott Walker faces his greatest political challenge this November against Tuesday's Democratic nominee, state school superintendent Tony Evers, and as the Democrats' face a tough fight to flip retiring House Speaker Paul Ryan's seat from "red" to "blue" with the Bernie Sanders-endorsed iron-worker and union organizer turned first time politician, Randy Bryce.

We cover a LOT of ground on today's show (including the late domestic abuse allegations against MN Rep. Keith Ellison, who easily won his Democratic primary in the state's Attorney General's race), so it's best I just let you listen rather than try to summarize Nichols' keen insights on Tuesday's races and more.

After a quick report on Saturday's primary elections in Hawaii (moderate Democrats did well, more progressive candidates less so), we head straight out to Las Vegas for today's BradCast, where the 26th annual hackers convention, DEF CON, held its 2nd annual Vote Hacking Village. [Audio link to show follows below.]

After every voting system on display at last year's event was hacked within minutes by conference attendees, organizers tried to make it a bit more difficult this year. They made unverifiable electronic voting systems, optical-scan paper ballot tabulators and electronic pollbooks from a number of companies --- almost all of which will be in wide use across the country once again for this November's crucial midterms --- available for investigation and penetration. Once again, the hackers in attendance made short order of pretty much all of them.

Stunning vulnerabilities [PDF] were discovered, including some that officials have known about (and ignored or tried to keep secret for years) while others were revealed for the first time. Things like Chinese pop song files were found on one system used in actual elections recently, along with a host of other disturbing findings, which we summarize today.

Other disturbing findings regard the ES&S m650, an optical scanner used to tabulate paper absentee ballots in more than half of the country. Hackers discovered several severe vulnerabilities (some of which have been known for more than a decade, and others which election officials hoped to withhold from the public), including the ease with which the machine's entire operating system can be overwritten by inserting a zipdrive with a file named "update" before powering it on. Also, electronic pollbooks were found to be corruptible in seconds and found to store unencrypted administrative passwords --- in plain text format! --- on their removable memory cards (one of which was simply "password".)

There was also a mock election run on the systems still used in states like Georgia. In that election, a candidate not even on the ballot ending up winning. In another case which officials should take note of, a ballot cast via email was intercepted and changed. "The selection of the candidate was changed so that when it was received it was different from what was sent," the organizers note. "This is a big deal for the real world because we already allow for email balloting, in special cases for Americans living overseas [such as active military]. This is allowed in 30 states plus DC."

Moreover, the Voting Village organizers also offered replicas of swing-state Sec. of State website available to some 50 children from ages 6 to 17. You'll be shocked to learn that most were able to hack the mock SoS websites in some fashion, including changing candidates names and parties, and tampering with reported elections results to show, for example, 12 billion votes cast. The fastest exploit of a Sec. of State replica site (Florida's) was by an 11-year old who did it in 10 minutes!

We're joined today to discuss all of this by Emmy-award winning journalist and documentarian LULU FRIESDAT whose video from last year's DEF CON Voting Village went viral (several times) since then, and who was on hand to document this past weekend's conference once again. She details the extraordinary "sea change" since last year's event, as many elections officials and U.S. Intelligence Community representatives were on hand for this year's festivities.

"What's really great about this year's Def Con is that we are starting to see a collaboration and communication between three groups that really have been working more as silos previously, and that is election officials, security experts, and hackers," Friesdat reports. "It was very deliberate on the part of the organizers, Jake Braun, Harri Hursti and Matt Blaze, to really try to bring those three groups together... Because we're not going to make progress on this issue unless these three groups start communicating with each other."

"We don't have a one-size-fits-all solution for this. Every county is going to have to have some different solutions. What we have are principles. And I think the principles remain the same. The principles are yes, every voter who can mark a ballot by hand, needs to mark a ballot by hand. And security experts across the board are really starting to say that, openly publicly."

"There is a sea change happening. You really could feel it. This year, there was an entire panel of election officials, whereas last year almost none of them actually came," Friesdat tells me, adding cautiously: "There are thousands of election officials all over the country who are still dragging their feet. You look at states like Georgia, and they are doing everything they can to stay in basically an unauthenticated election protocol. So it is a wide spectrum."

Among the noteworthy accounts from Friesdat, we discuss California Sec. of State Alex Padilla's call for more federal funding for election systems (meaning, more money for more computers) and Colorado Elections Manager Dwight Shellman who, though a fan of electronic tabulation, calls for routine post-election audits everywhere (which almost no states do at all.)

We also discuss the remarks at the conference by DHS Asst. Secretary for Cybersecurity and Communications Jeanette Manfra, who admitted last summer during U.S. Senate Hearings that the agency never found evidence that votes were changed in the 2016 Presidential election, in no small part, because nobody ever bothered to look! DHS never carried out any forensic investigations of voting systems, nor even bothered to count ballots to make sure they were accurately tabulated by counting computers in the election, despite the ongoing warnings by the Intelligence Community of Russian cyberattacks and interference. "Could it be done?," Friesdat asks rhetorically, "The answer, over and over and over again, is yes, it could be done. Election results could be manipulated. And is it difficult? No. It is a piece of cake."

While this year's DEF CON Voting Village was another huge leap forward in bringing concerns about all of these systems to the public, it appears we have a long way to go until American figures out the solution. I'd suggest that solution is public oversight of tabulation of hand-marked paper ballots (Not computers, but people! I call it "Democracy's Gold Standard".) But, hey, computers --- all of which are obviously wildly hackable --- could work too, right?

Or, The 'Conservative' Con Continues as the World Burns...

It's remarkable that Democrats --- and the mainstream corporate media --- have allowed Republicans to get away with claiming to be "conservatives" who support states rights, small government and local control for so many years. As it turns out, the exact opposite is usually true. That becomes abundantly clear whenever and wherever the GOP takes the reins of government power. We've got several examples of that, once again, on today's BradCast. [Audio link to show is posted below.]

As global climate change continues to shatter heat records across the country and planet, the death toll continues to rise along with temperatures and more intense, unexpected (if long-predicted) extreme weather. On Tuesday, at least 74 were killed in sudden wildfires in Greece. That toll, which is expected to rise, comes on the heels of hundreds killed by recent record rain, flooding and accompanying landslides in Japan, and at least 77 dead amid all-time record heat there over the past week alone.

Heat records are being shattered every day of late here in the U.S. as well, including in Phoenix where it topped out at a record 115 degrees on Monday, and where airplanes were grounded for several days last summer thanks to record warmth. This year, however, with the help of Trump's FAA, American Airlines has come up with a way to avoid being grounded despite new record temps. They've just raised the maximum temps under which their planes are allowed to take off! What could go wrong?

At the same time, the Trump Administration is now challenging the state of California's right to set their own fuel efficiency standards for cars, despite an agreement with the Obama Administration that had, with the approval of automakers, established a uniform nationwide standard. The state's right to set its own environmental standards at all --- as established over nearly 50 years under the federal Clean Air Act --- will now, reportedly, be revoked by Trump's EPA who, apparently, have no use for states rights (at least when that's inconvenient to GOP corporate funders.) Let the law suits begin continue.

Similarly, so-called "conservatives" in Texas are attempting to use Big Government state law to preempt efforts by local governments and voters in Austin, San Antonio and Dallas, who hope to establish their own rules for paid sick-leave. Some 40% of Texas workers, according to a recent study, are currently prevented from taking a paid day off when either they or their children get sick. The state's Big Government-loving Governor Greg Abbott and Attorney General Ken Paxton (facing his own securities fraud indictments) oppose the city measures, just as they have in the past when voters in local jurisdictions have attempted to ban fracking, raise minimum wage requirements or even ban plastic bags.

There is, however, a solution. We can all try --- try, at least --- to vote the liars and hypocrites out of office this November. In Nevada, for example, voters are now said to be on the verge of potentially electing the first female majority state legislature in our nation's history. To pull it off, however, and to flip local, state and Congressional seats from "red" to "blue" this year, voters will have to turn out and actually be allowed to cast a vote.

A new study from the Brennan Center for Justice suggests that may be more difficult than many currently appreciate. Their analysis finds that voters are being purged from the rolls at a record pace, particularly in jurisdictions with a history of racial discrimination, where such procedures previously required federal preclearance under the Voting Rights Act (until the GOP majority on the U.S. Supreme Court gutted the landmark 1965 law in 2013.)

So, with just over 100 days remaining until this year's crucial midterm elections, please CHECK YOUR VOTER REGISTRATION to make sure you are still properly registered! Don't wait until its too late!

But, we close today with at least a bit of encouraging news. Despite the stolen GOP majority on the U.S. Supreme Court recently blocking lower federal court rulings finding U.S. House and state legislative seats had been unlawfully gerrymandered by partisans in several states, a number of statewide measures to end partisan gerrymandering will most likely be on the ballot this November. Unless, that is, so-called "conservative" Republicans block the so-far wildly successful, bi-partisan grassroots initiatives in states like Michigan, Missouri, Colorado and Utah...

On today's BradCast we take a precious few minutes to duck out of the horrific breaking news cycle this week --- sort of --- for some words of wisdom and perspective from a number of very smart folks in response to the news that Justice Anthony Kennedy is resigning, and all of the fear, panic and depression that is going with it for many progressives. [Audio link to show follows below.]

Among the smart folks we turn to for sage thoughts today: longtime newsman Dan Rather, civil rights icon Rep. John Lewis & Daily Kos' "Meteor Blades", blogger and activist Zawn Villines and journalist David Dayen. Each offer helpful, non-pollyannaish advice on keeping our current moment in the appropriate perspective. That, while the struggle for justice and to somehow save the U.S. Supreme Court from an onslaught of GOP/Trump hypocrisy, extremism, lies, cynicism, and far-right schemes to roll back decades of hard-fought civil, voting, human and reproductive rights, will demand persistence and steady, determined courage in the days ahead.

Nonetheless, both pessimism and despair are counterproductive to progress. So I hope today's program helps us all (including me!) to stay a bit more hopeful, optimistic and healthy, during these seemingly ever-darkening hours.

Also providing a bit of hope and inspiration today, some more news from Tuesday's primary elections, in which an extraordinary progressive 28-year old Latina from The Bronx unseated a 10-term Democratic member of the U.S. House Leadership establishment in New York's Democratic primary, despite being outspent 15 to 1; A record third LGBT person this year has now won a Democratic nomination for Governor, this time in Colorado; And Oklahoma voters unseated a host of Republicans in the state House and Senate who voted against recent tax increases to fund education following a two-week long teacher walk-out and years of slashed funding to pay for massive corporate tax cuts; And, as if that's not enough good news from supposedly "conservative" Oklahoma, voters also approved a citizen-sponsored statewide ballot initiative for medical marijuana, in defiance of GOP elected officials and a well-funded campaign against it. We join Steven Colbert's celebration on that today.

Finally, Desi Doyen joins us for the latest Green News Report, with more on Kennedy's climate legacy at SCOTUS, environmental concerns in the wake of his retirement, and a few other encouraging results from this past Tuesday's primaries in seven states...

On today's BradCast: As voters head to the polls in eight states (CA, AL, IA, MS, MT, NJ, NM and SD) on Tuesday, we cover a few "sorta victories" elsewhere for now, including at the U.S. Supreme Court. [Audio link to show is posted below.]

Reports of problems at the polls have already cropped up, however, in South Dakota, where electronic pollbooks failed in eight counties, and here in Los Angeles, where a "random issue with the print job" on paper rosters at polling places, according to the County Clerk, has led to some voters needing to cast provisional ballots.

As we await election results and likely reports of more problems elsewhere, a "sorta victory" for Twitter users who had sued the President after he blocked them on Twitter. Those seven plaintiffs were finally unblocked by Trump after a federal court found last month that he was violating their Constitutional First Amendment free speech rights. But, on the same day those seven were unblocked, the Dept. of Justice appealed the court's ruling anyway.

In Alabama, another "sorta victory" as the story of Sec. of State John Merrill blocking folks on Twitter for pointing out his errors as the state's top election official, has finally been picked up by the corporate media in the state. That, just hours before voters headed to the polls, with Merrill himself on the ballot. The coverage comes after we first reported on Merrill's behavior months ago (when he blocked me for being right about the state's computerized election tabulators), and again last week after he sent me a flurry of insane emails [PDF] in response to a simple query as to whether he planned to unblock followers now that a federal court has found his behavior to be in violation of the U.S. Constitution. The Montgomery Advertiser's weak coverage, however, largely serves to offer the Sec. of State a platform to call election experts and journalists "trolls" (for being correct and polite), while still refusing to unblock them.

In Arizona, a lawsuit against the state for keeping tens of thousands of registered voters off the rolls for failing to provide "proof of citizenship" before being allowed to vote has now been settled with a consent decree that will enfranchise many voters, even if it will still result in thousands being disallowed from voting in state and local contests. So, a "sorta victory" there as well.

And, at the U.S. Supreme Court this week, a "sorta victory" for both anti-gay bigots and civil rights advocates as the long-awaited ruling in Masterpiece Cakeshop v. CO Civil Rights Commission, a case involving a Colorado baker who refused to make a cake for a same-sex couple's wedding reception is finally decided by a narrow 7 to 2 ruling in favor of the baker...sorta.

Slate legal reporter MARK JOSEPH STERN joins us to explain how Justice Anthony Kennedy, with his majority opinion. tries to "have his cake and eat it too," by largely kicking the can down the road for another day, while ostensibly siding with the baker against the state Commission on rather dubious religious freedom grounds.

The decision, however, also appears to strengthen the existing right of states to bar discrimination by similar businesses on the basis of sexual orientation. So much so, that, under the ruling, the two plaintiffs, according to their ACLU attorney, should be able to walk into Jack Phillip's Masterpiece Cakeshop in Lakewood, CO today and purchase a cake for their wedding anniversary, if they wished. If they are blocked, that would be in violation of the Constitution. Nonetheless, a definitive opinion from SCOTUS on the issue of discrimination on the basis of sexual orientation will have to wait for another day.

"If the Supreme Court applied the same standard to the [Trump] travel ban case as they have applied to Masterpiece, the Court would have no trouble striking down the travel ban as a violation of First Amendment religious freedoms," Stern tells me, when I ask whether Kennedy's weak religious liberty argument here may apply more to some religions than others. "Unfortunately, I do not think the court is going to be consistent. I think, instead, the Court's going to wind up applying a much stricter standard when it's Christians' rights on the line, than when it's Muslims' rights on the line. And we're all going to be very disappointed in this kind of inconsistent religious liberty --- 'for me, but not for thee.'"

Stern offers smart insight on the Court's opinion(s) --- which were widely misreported elsewhere on Monday --- as well as another decision this week from the Court on the Trump Administration's failed attempt to punish the ACLU for supporting a teen immigrant who sought a lawful abortion after being detained at the border. That ruling, at least, was a complete victory, he explains, not just a "sorta" one.

At long last, we're beginning to see shades, shadows, clouds of accountability rolling in across D.C. and even elsewhere in the country. Many of those clouds seemed to roll in all at once today for some reason, but we cover as many as we can on today's BradCast. [Audio link to full show is posted below.]

Among the stories on today's busy program...

  • Huge explosions, a raging fire, and 10-mile evacuations at another oil refinery today, this time in Wisconsin;
  • Bill Cosby is found guilty on three felony counts of drugging and sexually assaulting a woman and now faces the rest of his life in prison;
  • Tens of thousands of teachers walked out in Arizona and Colorado on Thursday, demanding increased funding for education after years of slashed state budgets to help pay for tax cuts to the rich and corporations;
  • A spate of new polling suggest Senate Republicans may face a storm of accountability this November, with encouraging numbers for Democratic candidates in at least three different states --- Arizona, Tennessee and Nevada --- where they hope to flip "red" seats to "blue" to regain majority control of the upper chamber of Congress this fall. (And also in a fourth state, if you include Texas, where Sen. Ted Cruz' challenger Rep. Beto O'Rourke is now within "too close to call" striking distance, according to new polling, even as the Democrat is refusing corporate and super PAC funding, even from billionaire Tom Steyer);
  • No accountability to date, however, for the anti-gay, anti-Muslim, anti-environment, pro-war CIA Director Mike Pompeo, who was narrowly confirmed in the U.S. Senate today as Donald Trump's new Secretary of State;
  • The Senate Judiciary Committee voted to approve a bi-partisan bill to protect Special Counsel Robert Mueller from being fired by Trump, though obstructionism from GOP leadership in the full Senate and U.S. House will likely prevent the legislation from going any further;
  • Admiral Ronny Jackson, Trump's personal White House physician and his nominee to head the Dept. of Veterans Affairs finally withdrew his name from consideration following a host of damning allegations from current and former White House and military co-workers unearthed by Sen. Jon Tester (MT), the ranking Democratic member of the Senate Veterans Affairs Committee;
  • Trump's wildly corrupt and scandal-plagued EPA chief Scott Pruitt finally faced a bit of accountability, at least from Dems, as he testified before two separate House Committees on Thursday and refused to answer many direct questions, threw much of his staff under the bus, and denied responsibility for the mountain of personal corruption scandals he continues to face --- even as bi-partisan calls for his resignation continue;

On today's BradCast: Trump's unending White House chaos appears to have morphed into Trump's White House purge of not-insane top officials, beginning with his Tuesday firing of Secretary of State Rex Tillerson, via Tweet. [Audio link follow below.]

At the same time, Trump named rightwing former Congressman and Fox "News" Tea Party flunky turned CIA Director Mike Pompeo as his nominee to take over the role of the nation's top diplomat and Deputy CIA Director Gina Haspel, who oversaw torture at so-called "black site" prisons during the George W. Bush presidency, to take over Pompeo's role as CIA chief.

We're joined today by national security and civil rights journalist MARCY WHEELER of emptywheel.net to discuss all of today's alarming developments. At the center of our conversation, after discussion of why Trump off-loaded Tillerson, is whether Pompeo and Haspel will even be able to make it through the confirmation process in the U.S. Senate at all at this point, and how the entire mess, once again, highlights the shameful failure by Congressional Democrats and former President Barack Obama to demand real accountability for the war criminals at the center of Bush's torture regime.

"When people talk about how we ended up with Donald Trump, this is the problem," Wheeler argues. "We have excused things like torture for so long that it's just created the opportunity for Donald Trump. Yes, those precedents really created the way for him."

Remarkably, as discussed today, even Democratic Sen. Diane Feinstein --- who spent years heroically fighting the U.S. Intelligence agencies to expose their horrific torture practices --- seems prepared to approve Haspel, for some reason, as do the former heads of those agencies --- the very same folks who claim to oppose Trump and object to his response to allegations of Russian meddling in the 2016 election.

On Haspel, Wheeler warns: "She's terrible for two reasons. One is that she's a torturer, and not just a torturer but a particularly sadistic one. But the second one is that she orchestrated both a personal and agency cover-up. And so we should expect, with her as CIA Director, to have the CIA even less in control than it is now." Yes, Haspel also oversaw the CIA's destruction of their videotapes of torture sessions.

Hard to figure out who's more furious about it all, me or Wheeler, after years of warning about precisely this day.

On Pompeo, Wheeler says: "He is much closer to Trump's views on [Russia, North Korea and Iran]. Very importantly, especially on Iran. So I think if Pompeo is confirmed, I think the chances of us going to war with Iran are significantly higher."

And, just to make my day, she warns that, should National Security Advisor H.R. McMaster be replaced, as rumored, his replacement won't even have to struggle with Senate confirmation (a road, which she predicts, may be difficult for both Haspel and Pompeo, though more so for the latter.) If McMaster is replaced by John Bolton, as some have suggested, "he gets appointed, because it's not Senate confirmed. So If Trump wants him, he's in charge of nuking North Korea."

Finally, Desi Doyen joins us for some more thoughts on the removal of Tillerson (ironically enough, even though he previously served as CEO of ExxonMobil, he was decidedly not a climate change denier and actually supported the U.S. staying in the Paris Agreement) and for the latest Green News Report, in which the nation and planet continue to suffer from the perfidy of dishonest Republican climate change denialism...

Trump proves (again) he knows nothing about climate change; Former CO GOP Chair sentenced for voter fraud; and other news you need to know...

Today's BradCast took several unexpected turns as news broke, callers called, and the Trump-era debunkery continued. [Audio link to show follows below.]

Among the many stories covered and/or debunked on today's program, before we opened up the line to callers...

  • In a surprise reversal, some good news to start off, as Donald Trump's EPA Administrator Scott Pruitt puts the brakes on a huge, dangerous, proposed Canadian mining project in Alaska's pristine Bristol Bay watershed;
  • In a weekend interview, Trump once again made clear he knows nothing at all about climate science (beyond what they told him about it on Fox "News) and doesn't care to learn. Desi Doyen joins us to correct at least some of the misinformation offered by the President of the United States' embarrassing comments to Piers Morgan;
  • Former Colorado Republican Party Chair and rightwing radio host Steve Curtis (pictured above) was found guilty of forgery and voter fraud in the 2016 Presidential election last year, after claiming on air, just before the election, that only Democrats commit voter fraud and they should be prevented from voting at all. On Friday, he was sentenced to four years of probation and community service, even as he claims he didn't know that voting his ex-wife's absentee ballot was unlawful. ("He knew exactly what he was doing," the prosecutor argued during the trial's closing arguments. "He received it in the mail, opened it, voted, signed it, sealed it back up and sent it in." All in his wife's name. She had moved out 11 months earlier.)
  • We then contrast the white Republican Curtis' lenient sentence for voter fraud to that of a Mexican national who came here as an infant, has long been a permanent US resident with four U.S. citizen children, but was sentenced last year to 8 years in federal prison and likely deportation thereafter for unlawfully voting. She thought she was allowed to do so as a permanent US resident;
  • On the encouraging side of election and voting rights news today, however, the North Carolina Supreme Court on Friday sided with the state's new Democratic governor, and effectively reversed a years-long effort by the state's Republican legislature to roll back many voting rights in the key swing-state.

And, with all of that, we then open our phone lines to all sorts of interesting listener calls, including one caller (one of our favorites) who argues that progressives should mount write-in campaigns to take on corporatist Dems, (we debate whether doing that or primarying such Dems is the smarter route to take), and another right-wing caller who pretends to have no idea how Photo ID voting restrictions suppress the legal votes of minorities --- or he simply doesn't care. (He also revealed himself to be a climate change denier, what a surprise, as the call turned quickly South)...
