On today's BradCast: The Election Administrator's (and Election Integrity journalist's) Prayer was decidedly not answered on Tuesday, based on reported results in at least two key races, and problems in the four states (Kansas, Missouri, Michigan and Washington) which held midterm primaries and the one (Ohio) which held the final major U.S. House Special Election of the year. But, first up today, Republican Congressman Chris Collins of New York, the first sitting member of Congress to endorse Donald Trump's candidacy, was indicted Wednesday morning, along with his son and the father of his son's fiancee, for an insider trading scheme, after he had tipped off his son to failed testing for a multiple sclerosis treatment by an Australian company in which Collins was the top shareholder and a member of its board. According to the indictment by the Trump-appointed U.S. Attorney in Manhattan, it sure looks like they've caught Collins red-handed. Though he vows to fight the charges and remain on the ballot this November, his once-safe seat is now believed to be in danger.

Then, onto yesterday's Election Day and the very long night that followed.

In the OH-12 special election, Democrat Danny O'Connor trails Republican Troy Balderson by about 1,700 votes out of some 200,000 cast, mostly on 100% unverifiable touch-screen systems across seven Ohio counties. About 3,500 uncounted provisional and late vote-by-mail ballots could change the outcome in the days ahead, or at least lead to a state-mandated "recount" in the district that, for decades --- until Tuesday --- had been solidly "red". In 2016, Trump carried the district by 11 points and the now-resigned House GOP incumbent had carried it by 36 points. That has clearly changed with a virtual dead heat contest on Tuesday, leading to growing confidence in a "blue wave" this November by many Democrats and, yes, a "RED WAVE" in the same crucial midterms, as predicted today by Donald Trump.

In Detroit, where voters cast hand-marked paper ballots, they were able to continue voting even during power outages at more than a dozen polling places on Tuesday, following storms the night before. We have results from MICHIGAN's closely-watched Gubernatorial primaries and the somewhat bizarre, two separate Democratic primary races (one normal, one special) to fill the U.S. House seat left vacant last year by Rep. John Conyers resignation. State Dems will now host an historic, all-female slate at the top of the ticket for Governor, U.S. Senator, Attorney General and Sec. of State, and Rashida Tlaib will become the first Muslim woman in Congress.

In KANSAS, $10 million wasted on new, unverifiable touch-screen voting systems didn't help voters as some of the brand new ES&S ExpressVote ballot marking devices failed to work at all on Tuesday morning, and electronic tabulation grounded to a halt all together in Johnson County, the state's most populous, due to a problem that remains unclear at this hour. All of it resulted in another "too close to call" race today, in the GOP's gubernatorial primary between current Gov. Jeff Colyer and the controversial Trump-endorsed Sec. of State Kris Kobach. He leads, according to unverifiable touch-screen results finally reported on Wednesday morning, by just 191 votes(!) out of some 300,000 cast. A "recount" (overseen by Kobach himself) almost certainly awaits, as do future failures on the ExpressVote systems which produce unverifiable barcoded "paper trails" instead of hand-marked paper ballots. Sadly, the same systems are also being adopted by many other jurisdictions around the country as well.

In MISSOURI, a few Republicans came up with a novel new way to stop voters from voting. But that didn't deter the state which voted for Trump by double digits in 2016 from soundly rejecting a GOP anti-union (so-called "Right-to-Work") measure by a 2 to 1 margin. And, in St. Louis County, in a triumph of democracy, Bill McCulloch, the 7-term Democratic prosecutor who failed to bring charges in the 2014 police killing of Ferguson's Michael Brown, was defeated by Wesley Bell, one of the African-American leaders of the 2014 protests there. Bell had become a City Council member in Ferguson in 2015 and he will now be St. Louis County's Prosecuting Attorney.

And finally today, in WASHINGTON state, results of several U.S. House primaries suggest incumbent Republicans previously thought to be in safe "red" districts --- including Cathy McMorris Rodgers, the highest ranking female in Congress --- may not be quite as safe in this November's midterms as they had thought...

On today's BradCast: Tax cuts by executive fiat? It may depend on what the definition of "cost" is. Republicans used to pretend to oppose "Imperial Presidencies" --- at least when the President in question was Barack Obama --- but, hey, things change. [Audio link to show is posted below.]

First up today, however, we begin with some good news for a change! The Michigan Supreme Court late on Tuesday, approved a wildly popular, non-partisan, grassroots anti-gerrymandering measure for this November's statewide ballot, after GOP opposition to the initiative. Michigan's Proposal 2 is just one of several encouraging election reforms that Michiganders will be able to vote for (or against) during this year's midterms. And, MI is just one of several states (along with Missouri, Utah, and Colorado) that will see citizen-driven initiatives to end the scourge of partisan redistricting on this year's ballot!

More good news: A U.S. court of appeals in California on Wednesday upheld a lower court ruling finding Donald Trump's executive order barring federal funds to so-called "sanctuary cities" as unconstitutional.

Then, several new studies find record corporate profits --- both before and after the Trump/GOP tax cuts to corporations and the wealthy late last year --- are being spent mostly on stock buybacks, rather than increased worker wages, as Republicans had pretended would be the case when they rammed last year's massive tax cuts through Congress. Those cuts have already raised the federal deficit above $1 trillion, rather than paying for themselves as promised.

At the same time, Trump's Dept. of Treasury is now said to be considering a controversial scheme to bypass Congress entirely in order to offer at least another $100 billion in tax cuts to the wealthiest Americans. We're joined today by ALEXANDRA THORNTON, former tax policy adviser to the U.S. Senate Finance Committee, now Senior Director of Tax Policy for Economic Policy at the Center for American Progress. She tells me: "We already have very low taxes on capital income, capital gains, and now they want to make it lower."

Thornton explains Treasury Secretary Steven Mnuchin's planned scheme that would reinterpret the word "cost" in the federal Revenue Act of 1918 in order to index the already very low tax rate on income earned via investment in stocks and real estate to inflation, and how doing so by executive branch fiat would most likely be unlawful. (At least the George W. Bush Administration found that to be the case when they considered a similar plan.)

"Here is this administration that's been talking about 'regulatory overreach' and wanting to get rid of all these regulations, and now they want to go beyond their authority to pass a regulation that gives this gigantic tax cut almost exclusively to the wealthy. It's incredibly hypocritical."

Thornton also debunks the long-held GOP "fairy tale" that tax cuts pay for themselves by growing the economy, rather than blowing holes in the national debt and deficit, and further helps explain why last year's tax cuts, as passed without any Democratic votes, may not be working quite as well as a campaign issue for Republicans before the midterms as they had hoped.

"This is all part of the conservative mantra that if we tax investment that'll slow down economic growth. There's really no evidence for that at all. Basically, what they say is that we need to cut taxes on any kind of income, and eventually that will mean that we'll be able to invest in more things in the economy which will make workers more productive, and when they become more productive their wages can go up and there will be more jobs. And it's a fairy tale. It's basically never happened. It doesn't work like that."

Finally today, Senate Majority Leader Mitch McConnell cancelled this year's August Senate recess in hopes of ramming through a bunch of Trump's federal judicial nominees and his pick for the U.S. Supreme Court, Brett Kavanaugh. His hope was to do so before Republicans potentially lose their slim majority in the U.S. Senate in the fall elections. But that plan may be facing an unexpected hurdle from Arizona's outgoing U.S. Senator Jeff Flake, who is currently in Africa observing the hand-counting of hand-marked paper ballots in Zimbabwe's historic election. He may not be returning to D.C. anytime soon, according to some Senate staffers, which could stymie the possibility of any nominees being voted out of the Senate Judiciary Committee (which is deadlocked at 10 to 10 without Flake's presence), and perhaps even prevent floor votes in a 49-49 Senate with both Flake and ailing fellow Arizona Senator John McCain both missing. Is Flake, who claims to be a Trump opponent (even while voting for most of his agenda anyway) finally taking some form of real action in response?...

It's remarkable that Democrats --- and the mainstream corporate media --- have allowed Republicans to get away with claiming to be "conservatives" who support states rights, small government and local control for so many years. As it turns out, the exact opposite is usually true. That becomes abundantly clear whenever and wherever the GOP takes the reins of government power. We've got several examples of that, once again, on today's BradCast. [Audio link to show is posted below.]

As global climate change continues to shatter heat records across the country and planet, the death toll continues to rise along with temperatures and more intense, unexpected (if long-predicted) extreme weather. On Tuesday, at least 74 were killed in sudden wildfires in Greece. That toll, which is expected to rise, comes on the heels of hundreds killed by recent record rain, flooding and accompanying landslides in Japan, and at least 77 dead amid all-time record heat there over the past week alone.

Heat records are being shattered every day of late here in the U.S. as well, including in Phoenix where it topped out at a record 115 degrees on Monday, and where airplanes were grounded for several days last summer thanks to record warmth. This year, however, with the help of Trump's FAA, American Airlines has come up with a way to avoid being grounded despite new record temps. They've just raised the maximum temps under which their planes are allowed to take off! What could go wrong?

At the same time, the Trump Administration is now challenging the state of California's right to set their own fuel efficiency standards for cars, despite an agreement with the Obama Administration that had, with the approval of automakers, established a uniform nationwide standard. The state's right to set its own environmental standards at all --- as established over nearly 50 years under the federal Clean Air Act --- will now, reportedly, be revoked by Trump's EPA who, apparently, have no use for states rights (at least when that's inconvenient to GOP corporate funders.) Let the law suits begin continue.

Similarly, so-called "conservatives" in Texas are attempting to use Big Government state law to preempt efforts by local governments and voters in Austin, San Antonio and Dallas, who hope to establish their own rules for paid sick-leave. Some 40% of Texas workers, according to a recent study, are currently prevented from taking a paid day off when either they or their children get sick. The state's Big Government-loving Governor Greg Abbott and Attorney General Ken Paxton (facing his own securities fraud indictments) oppose the city measures, just as they have in the past when voters in local jurisdictions have attempted to ban fracking, raise minimum wage requirements or even ban plastic bags.

There is, however, a solution. We can all try --- try, at least --- to vote the liars and hypocrites out of office this November. In Nevada, for example, voters are now said to be on the verge of potentially electing the first female majority state legislature in our nation's history. To pull it off, however, and to flip local, state and Congressional seats from "red" to "blue" this year, voters will have to turn out and actually be allowed to cast a vote.

A new study from the Brennan Center for Justice suggests that may be more difficult than many currently appreciate. Their analysis finds that voters are being purged from the rolls at a record pace, particularly in jurisdictions with a history of racial discrimination, where such procedures previously required federal preclearance under the Voting Rights Act (until the GOP majority on the U.S. Supreme Court gutted the landmark 1965 law in 2013.)

So, with just over 100 days remaining until this year's crucial midterm elections, please CHECK YOUR VOTER REGISTRATION to make sure you are still properly registered! Don't wait until its too late!

But, we close today with at least a bit of encouraging news. Despite the stolen GOP majority on the U.S. Supreme Court recently blocking lower federal court rulings finding U.S. House and state legislative seats had been unlawfully gerrymandered by partisans in several states, a number of statewide measures to end partisan gerrymandering will most likely be on the ballot this November. Unless, that is, so-called "conservative" Republicans block the so-far wildly successful, bi-partisan grassroots initiatives in states like Michigan, Missouri, Colorado and Utah...

A whole lotta stuff happened over the long holiday weekend, much of which the Trump Administration hopes you don't notice at all. We try help you notice them on today's BradCast. [Audio link to full show is posted below.]

But we start with some of the very few bits of good news we could find, as November's elections --- and our only hope --- loom large. First up: A petition drive in Michigan to place a host of election reforms on the ballot appears to have been successful. With 430,000 signatures submitted (far more than the 316,000 required), it looks like Michiganders will be able to vote for automatic voter registration, same-day registration, no-fault absentee voting and much more this Fall.

In Kansas, following a trial and federal court order, Kris Kobach, the state's embarrassing Sec. of State, has finally added some 25,000 voters to the rolls who had been denied access for lack of "Proof of Citizenship" documents. The court struck down the state law requiring the documentation as unconstitutional after Kobach monumentally failed in his defense of the law during the recent trial on behalf of voters who had challenged it. That hasn't stopped the GOP's top "voter fraud" fraudster, however, from claiming --- you guessed it --- fraud during a recent GOP straw poll in advance of the August primary in the state, where Kobach hopes to win the Republican nomination for Governor. (He lost the straw poll to Republican Gov. Jeff Colyer...by a lot.)

In other (largely) good news, Starbucks says they plan to do away with plastic straws to help save the planet (and comply with local governments who are banning them.)

Then, to the much less good news, as all-time heat records were shattered, by double-digits, here in Southern California over the holiday. Though the wildly corrupt fossil-fueled tool Scott Pruitt was finally forced to resign over the holiday weekend as chief of the Environmental Protection Agency (his resignation letter is amazingly creepy!), his second-in-command, Andrew Wheeler, an actual coal industry lobbyist, will now take over the EPA.

Also in recent days, two issues that Trump claims to have fixed (which he broke in the first place), have proven not to have been fixed at all. Despite Sec. of State Mike Pompeo describing recent "denuclearization" talks with North Korea as "productive", the North's Foreign Ministry characterized the U.S. attitude at negotiations as "gangster-like" and "cancerous" just after he left. That, after Donald Trump recently declared: "There is no longer a Nuclear Threat from North Korea".

And, the chaos continues as the Administration is reportedly nowhere near being able to reunite some 3,000 children with their parents, as required by a federal court order and deadlines, after they were separated at the southern border by Trump's immigration goons. That, after identification documents for many of the children were reportedly lost or destroyed, and despite Trump signing an Executive Order two weeks ago which he said would solve the tragic separations that he caused in the first place.

Finally today --- along with a ton of phone calls from listeners on all of the above and much more throughout today's show --- a few words, and some personal remembrances, on the sad passing last week of progressive radio and television broadcaster, and workers' champion, Ed Schultz...

• As we predicted last week, Republican Senator Rand Paul (KY), who had been pretending to oppose the nomination of CIA Director Mike Pompeo as the next Secretary of State, has flipped his position (as usual), and is now voting in favor of Pompeo, virtually guaranteeing the pro-war, anti-gay, climate science denier as the nation's next top diplomat.

• The alleged shooter who killed 4 and injured several others at a Waffle House in Nashville on Sunday morning is finally apprehended and taken in peacefully by local officials. But why was the suspect, a 29-year old white guy with a long record of mental issues and run-ins with police, even in possession of four semi-automatic weapons that were taken from him, for a short time, following his arrest by Secret Service outside the White House, where he is said to have identified himself as a "sovereign citizen" (a rightwing domestic extremist movement, according to the Southern Poverty Law Center and law enforcement officials.) The mass shooting was ended on Sunday morning, not by "a good guy with a gun" but, in fact, by a potential African-American victim without a gun. James Shaw Jr. burned his hand as he grabbed the muzzle of the shooters AR-15 and wrestled it away from him.

• Despite going to court to successfully stop Green Party Presidential candidate Jill Stein's attempted post-election "recount" in the state of Michigan after the 2016 election, state Republicans have now passed a number of bills in the state legislature to make it even more difficult for candidates and the public to oversee their own elections to ensure that computer-tallied results have been accurately reported. The measures heading to Republican Gov. Rick Snyder's desk follow Stein's attempted 2016 count, in a state which hadn't gone to a Republican Presidential candidate in nearly 30 years, where Trump is said to have won by just over 10,000 votes (out of more than 5,000,000 cast), and where terrible state "recount" laws prevented some 60,000 hand-marked paper ballots from even being considered for "recounting" in Detroit alone.

• Meanwhile, down in Fort Worth, Texas, a Tarrant County Justice of the Peace, after submitting fraudulent signatures to appear on the Republican primary ballot last March, resigned from office after pleading guilty and receiving, essentially, five years probation. It appears disgraced Judge Russ Casey won't won't spend a day in a jail, despite his guilty plea and a previous record of an "improper sexual relationship" with a former clerk. We also contrast the gentle treatment of Casey, a white elected Republican judge, with that of Crystal Mason and Rosa Maria Ortega, both of them in Tarrant County. Mason is a 43-year old African-American mother sentenced to five years in prison just last month for voting in 2016 while on supervised release from her three-year sentence on a 2011 fraud conviction for helping tax clients receive larger refunds than they deserved. She was not told by her probation officer, or anyone else, that she was not allowed to vote while on probation in Texas. Ortega, a mother of four, voted unlawfully in both 2012 and 2014, thinking she was allowed to do so as a Green Card holder from Mexico. She received an eight-year prison sentence for her crime (and likely deportation after it), despite testifying that she believed she was allowed to vote as a permanent U.S. resident. Too bad for the black woman and the immigrant. But fantastic news for the white elected Republican Judge, who had received a $125,000/year salary since his initial election in 2007, before he knowingly committed his election fraud crimes!

• Also today, speaking of accountability --- or, perhaps, lack thereof --- for powerful white Republicans, Missouri's embattled GOP Governor Eric Greitens was charged with a second felony late Friday, though he refuses to step down, despite the two charges. One is related to tying up a woman with whom he was having an affair, photographing her naked, and threatening to blackmail her, and the second for unlawfully using a veterans charity mailing list during his 2016 run for Governor. Top GOP lawmakers and the state's Attorney General have called for Greitens' resignation. But he, just like President Donald Trump, describes the investigation of his alleged felony crimes as nothing more than a "witch hunt...by the liberal media and their allies".

On today's BradCast: Bill Maher quipped Friday night that the U.S. attack, with France and Britain, on Syria was code-named "Operation Desert Stormy", an attempt by Donald Trump to force his legal and ethical nightmares off the front pages. It didn't work. [Audio link to show follows below.]

On Sunday night, fired FBI Director James Comey described Trump as "morally unfit" for the Presidency in a prime-time ABC News interview, and on Monday, just before air today, Sean Hannity of Fox "News" was revealed in federal court to be a secret client of Trump's hush money payoff "fixer" Michael Cohen, and Cohen and Trump's motion to review documents seized in the raid on Cohen's office and residences last week was denied (for now) by the federal judge.

Nonetheless, before it's forgotten entirely in the fog of Trump Scandal, we focus mostly today on the fact that the pre-dawn bombing of Damascus by US and its allies, said to be in response to an alleged chemical attack by Syrian President Bashar al-Assad against his own people a week earlier in Douma, was done without any actual hard evidence of a chemical attack or who was actually responsible for it. Trump's Secretary of Defense James Mattis admitted as much during Congressional hearings just one day before more than 100 cruise missiles were unleashed on supposedly chemical weapons-related facilities in Damascus. (No proof was offered to buttress the claim about those facilities either.)

Moreover, there is absolutely no legal authority whatsoever for Trump's attack --- either domestically or internationally --- despite various claims to the contrary. Shamefully, most of Congress, both Republicans and Democrats alike, have so far failed to demand accountability for the unconstitutional use of military force (even after threatening President Obama with impeachment when he wanted to launch a similar attack in response to an alleged Syrian chemical attack in 2013).

For his part, the hapless Trump, who mercilessly derided Obama for calling for Syrian airstrikes in 2013, took to Twitter on Saturday to echo George W. Bush's infamous appearance on a U.S. Aircraft Carrier in 2003 after the ill-fated invasion of Iraq, to declare "Mission Accomplished" in Syria.

Friday's unlawful US attack, as we also discuss today, is believed to have cost some $200 million. That could have paid for the replacement of all of Flint, MI's lead water pipes some four times over, as new studies reveal that reading proficiency levels for third-graders in Flint has plummeted in the wake of the lead drinking water contamination crisis. That continuing crisis came about after MI's Gov. Rick Snyder (R), following his election in 2010, ordered an Emergency Manager takeover of the city and a subsequent change to its water supply.

As one caller observed today, some poisoned children, like those in Syria apparently, seem to be a larger concern for the Trump Administration than others...no matter the evidence or lack thereof...

On today's BradCast: It is "a very dangerous time", as longtime White House reporter and historian Paul Brandus may have understated last night. "Objectively speaking," he observed in a "difficult to write" tweet, he has "never seen, or known of, a President as unhinged and unstable as" Donald Trump appeared during remarks at the White House before his Monday meeting with his military team.

On Monday evening, following FBI raids on the office and residences of his personal attorney Michael Cohen, President Trump lashed out at law enforcement, calling the court-approved searches "disgraceful", "an attack on our country", and falsely claimed that the search warrant approved by a federal judge and the U.S. Attorney's office in Manhattan, amounted to a "break in". Trump's remarks also included musings about the possibility of firing Special Counsel Robert Mueller, whose office is said to have shared information with the U.S. Attorney in the Southern District of New York, leading to yesterday's raids.

Trump's friend, attorney and business partner Cohen is currently embroiled in the scandal involving a $130,000 hush money payoff to porn star Stormy Daniels, made just days before the 2016 election. The lawful raid, however, which may involve far more serious crimes, comes at a particularly precarious moment.

On Tuesday --- one day after Trump's new and extraordinarily hawkish National Security Advisor John Bolton's first day on the job --- longtime White House Homeland Security Advisor, Tom Bossert, was abruptly fired. His dismissal came after Bossert, while making clear that all options were on the table, had argued in favor of Trump's recent position on Syria over the weekend, in opposition to increased U.S. military action in the war-torn nation. But, after a recent chemical attack in the Syrian town of Douma, Trump has now cancelled a scheduled trip to Latin America and appears to be readying military action against the sovereign nation --- a close ally of both Russia and Iran --- even without authorization from Congress. Such action would likely, at a minimum, mirror the missile attack Trump unleashed on a Syrian airbase last year, which both Congressional Republicans and Democrats lauded at the time, even though Republicans had threatened President Obama with the possibility of impeachment when he considered doing the very same thing during his term in office. This time, however, the action could be much larger, more deadly, and far more dangerous for the region and the U.S.

At the same time, nobody seems to be certain as to exactly why Cohen was raided in the first place. Speculation ranges from the Stormy Daniels affair, to bank and wire fraud, to alleged schemes and payouts from Ukrainian and Russian oligarchs, to Cohen's taxi business in New York.

We're joined today by the great HEATHER DIGBY PARTON of Salon and Digby's Hullabaloo blog, to try and make sense of all of the above. Wish us luck. "It's like there's this unharmonic convergence happening with all this news," she tells me. "I don't know what it is, but it's not good."

"In this situation, when you've got Syria there and Trump under the gun, feeling Robert Mueller breathing down his neck, this is something that a guy like Bolton --- if he is smart enough to suss that out about Trump, and I have a suspicion that he might be --- he could be feeding that into Trump and we're going to see some kind of --- what do they call it these days? --- 'kinetic violence'. That's another word for war," she says.

We've got a lot to discuss about all of this on today's show with 'Digby', including what is likely to happen if (when) Trump moves to fire Mueller, as well as how this entire long national nightmare may finally end.

Well, huge tariffs on imported steel and aluminum, anyway, (those are taxes on the American people, Mr. President), which will almost certainly lead to international trade wars with friend and foes alike, raise the cost of many consumer goods and, yes, kill American jobs.

The proposed tariff scheme has already led to an internal White House war with Trump's lead economic advisor threatening to resign if they are implemented, Congressional Republicans furious about the plan, close allies such as Canada and the EU threatening to retaliate against the U.S., the entirety of the fossil fuel industry (from oil to natural gas to coal) declaring that jobs will be lost and prices will rise, and even Trump's own Defense Secretary advising that the measure, which President Chaos is hoping to pull off on "national security" grounds, will have a "negative impact on our key allies". Other than that, the idea is going over very well.

At the same time, there was another school shooting by a 19-year old on Friday, this time at Central Michigan University; Texas sees huge early voting turnout in advance of Tuesday's 2018 mid-term primary elections (even beating turnout for the 2016 Presidential primaries!); New polling finds the Affordable Care Act (Obamacare) and Medicaid with record high approval ratings; and the state of Georgia is finally moving away from their 14-year old 100% unverifiable Diebold touch-screen voting systems...to new, similarly unverifiable computer-printed "paper ballot" systems.

(The GA legislature is moving a measure forward to fund new "Ballot Marking Devices" or "BMDs", which are, essentially, very expensive computerized "electronic pencils" that allow voters to use a touch-screen to print out a non-human readable barcode on a piece of paper, which is then tallied by a computer scanner. Or, the computer may print human-readable vote selections on paper which may or may not actually be verified by the voter to reflect their intent before being tallied by a computer. After an election, it'll be impossible to know if any of those so-called ballot cards actually reflect voter intent. That's why election integrity advocates oppose the new "bad to worse" scheme quickly moving forward in GA!)

Then, Desi Doyen joins us for the latest Green News Report as Trump's EPA chief Scott Pruitt cites the bible as his excuse for polluting the planet and killing children with fossil fuel exploitation and dangerous chemicals. (Hope Pope Francis doesn't find out!)

On today's BradCast: Never mind Russia. Is it even possible for Democrats to overcome the systemic structural disadvantages Republicans have put in place in virtually every aspect of U.S. elections? We've got both encouraging and not-so-encouraging news in that regard on today's show. [Audio link to show posted below.]

Now that both the U.S. intelligence community and Democrats --- and even a few Republicans --- have finally begun to figure out that Election Integrity requires, at a bare minimum, a paper ballot for every vote cast, how long will it take them to figure out that those ballots need to be hand-marked (not computer-marked) and, preferably hand-counted, so that the American public can truly begin to restore confidence in election results and know that their votes actually matter? There is some --- precious little, but some --- encouraging news out of Pennsylvania today on that front, and even from the U.S. Senate Intelligence Committee.

The Governor in PA, a state which still hates its voters so much that it forces the vast majority of them to vote on 100% unverifiable touch-screen voting systems, has decreed that any new voting systems purchased to replace the old ones, must have some form of "paper trail" or "paper record" or "paper backup". That's a very low bar, but better --- for the most part --- than the current 100% unverifiable touch-screen systems used across the state. Yet, the Democratic Governor, Tom Wolf, has yet to propose any new funding to purchase those new systems. So, like PA votes, they remain vapor ware for the moment.

At the same time, Sen. Mark Warner of Virginia, Ranking Democrat on the U.S. Senate Intelligence Committee, seems to have noticed the cost of trying to secure elections (like "the Dutch elections, where they hand-counted all the ballots") versus the price of one single F-35. Hand-counts, like those carried out by the Dutch, is, in truth, a pretty inexpensive deterrent against foreign manipulation of our computer tabulation systems, if our elected officials were truly concerned about it. (It would also help to deter the much greater threat of domestic manipulation, by the way!)

But, even if we had a hand-marked paper ballot for every vote cast and even if we counted them all by hand, publicly at the precincts, before ballots were moved anywhere (as per Democracy's Gold Standard), Democrats would still have a mountain to overcome this year in the shape of the GOP's systemic partisan gerrymandering of state legislative districts and U.S. House seats.

To that end, we've got some similarly-qualified encouraging news out of Pennsylvania as well today, where the state Supreme Court recently ordered new U.S. House maps to be drawn in time for the upcoming May primary elections in the commonwealth, after finding the ones drawn by Republicans following the 2010 census were in violation of the state constitution's right to a fair vote. The battle over those new maps --- which have given the GOP a 13 to 5 advantage in U.S. House seats in the largely 50/50 state over the last three elections, where Dems outnumber Republicans --- is now moving forward on a very tight court-ordered deadline.

Meanwhile, similarly partisan gerrymandering by the GOP in Wisconsin, North Carolina, and many other swing-states continues, thanks in no small part to the U.S. Supreme Court delaying lower federal rulings that determined Republicans had unconstitutionally given themselves a steep enough advantage on district maps that they were able to retain huge majorities in state legislatures and the U.S. House, despite being consistently out-voted by Democrats.

We're joined today by FairVote gerrymandering expert DAVID DALEY, former Editor-in-Chief at Salon and author of RATF**KED: The True Story Behind the Secret Plan to Steal America's Democracy. We discuss the gerrymandered state of play as the 2018 primaries are now just weeks away in many states, and as the dam seems to be bursting in both state and federal courts --- finally! --- against partisan gerrymandering.

"The courts have been consistently outraged by what the Republicans pulled off in 2010, 2011," Daley says. "The problem is, here we are in 2018, we've been using these unconstitutional maps now this entire decade. There is no sense we're going to have new maps in most of these states, with the possible exception of Pennsylvania, in time for the 2018 election. We may well have the fourth of five elections in all of these states held on unconstitutional maps."

By way of one example, Daley notes: "In 2012, 52% of Pennsylvanian voters vote for Barack Obama, 51% of them vote for Democratic members of the U.S House. Republicans however, take 13 of the18 seats that year --- 71% of them! Democrats get 28% of the seats, even with more votes."

We also discuss the new documents he recently uncovered, published in a new Salon exclusive, detailing the fascinating story of how the Republicans' so-called REDMAP scheme to take over state legislatures and redistrict the nation with a wildly partisan advantage, first came about prior to the 2010 election and U.S. Census.

Among the questions we discuss: Is it even possible for Democrats to overcome that structural disadvantage in the 2018 mid-terms without the U.S. Supreme Court finding partisan gerrymandering to be unlawful? Are state court cases, like the one in PA, the answer instead? And can any of this be done in time for the 2020 elections, after which district maps will be redrawn once again by partisan majorities in state houses for another 10 years?

"There may be a blue wave [in 2018], but there is also a red firewall that stands ready to knock it down," Daley warns. "Democrats are probably going to need two seismic, historic waves in order to have a shot at fair maps in 2021. And it they can't pull that off, and if the courts don't come in and do something in the meantime, the maps that are drawn in 2021 are the ones we are going to live with until 2031."

Also today, in other related news: A second federal court, this time in New York, blocks Trump's attempt to reverse DACA, and one Republican candidate for the U.S. Senate must be a very bad choice...at least according to his own parents!...

After yet another exhausting and harrowing week in Donald Trump's America, as the Doomsday Clock inches closer to midnight, we try to lighten things up a bit, at least comparatively, on today's BradCast --- even if it's not always easy. [Audio link to show follows below.]

• A few words about Donald Trump's reported attempt to fire Special Counsel Robert Mueller last June before chickening out, which the President describes today as "fake news";

• Kansas' failed Governor Sam Brownback has, apparently, failed up, with an appointment by the Trump Administration, confirmed this past week by the U.S. Senate, after Vice President Mike Pence was brought in to break the tie vote in Brownback's favor;

• The Guggenheim Museum declines to loan a valuable Vincent van Gogh painting to Donald and Melania Trump for use in their White House residence, but offers a solid gold alternative that seems perfect for the first family;
• And, speaking of the first family, Trump's recently reported hatred of sharks --- revealed by adult film actress Stormy Daniels in the wake of revelations of her alleged affair with Donald Trump and $130,000 hush-money payoff just before the 2016 election --- has resulted in an outpouring of donations to shark charities across the nation and the world! See? Donald Trump can do some good in this world after all!

On today's BradCast, we're still fighting for the right to vote and to have that vote counted, 60 years after MLK's "Give Us the Ballot" speech, 50 years after the passage of the hard-won Voting Rights Act, 4 years after the U.S. Supreme Court gutted it, and one day after what my guest today describes as a "really wicked decision" by the Court on Thursday to set aside a landmark ruling on gerrymandering that was meant to finally correct a grave injustice to voters in 2018. [Audio link to full show follows below.]

With Republicans in the U.S. House, on Thursday, having passed a short-term stopgap spending bill to keep the U.S. Government from shutting down beginning on Friday night at midnight, Republicans in the U.S. Senate are still racing to figure out how to overcome a filibuster of the same bill. The measure includes support for kids that rely on the currently-expired Children's Healthcare Insurance Program (CHIP), but leaves some 800,000 kids of immigrants who came here with their parents still facing deportation as early as March, after Trump ended Obama's Deferred Action for Childhood Arrivals (DACA) program. So, once again, rather than simply including a fix to DACA, Republicans are using children as human shields to try and force Democrats to vote with them for a short-term bill to avoid a shutdown of the federal government. It would be the first such shutdown in U.S. history while the House, Senate and White House are all controlled by the same party.

Sick of this sort of BS? If so, you can theoretically do something about it this year at the ballot box. But the GOP's stolen U.S. Supreme Court isn't making it easy. On Thursday, SCOTUS stayed a landmark ruling by a lower federal court panel that had ordered North Carolina to immediately redraw the state's U.S. House district maps, since the Republican majority legislature admitted that they, unconstitutionally, drew them to ensure a Republican advantage. Though it's largely a 50/50 state, NC Republicans hold 10 seats in the U.S. House to the Democrats' 3.

That's just one of the ways that Republicans hope to keep cheating voters this year in order to hang on to power as the mid-terms approach. Another way was through Trump's discredited and now disbanded "Presidential Advisory Commission on Election Integrity", run by the GOP "voter fraud" fraudster and Kansas Sec. of State Kris Kobach. He had hoped to use the Commission to make it harder (for certain people) to vote, but he faced yet another embarrassment in court this week. When Kobach's Commission was originally shut down a week or two ago, there was a cry from voting rights advocates for a national committee to study and call out the real scourge of American democracy: voter suppression.

That call may have been answered this week with the formation of the non-partisan National Commission for Voter Justice, co-chaired by my guest today, BARBARA ARNWINE, former longtime Executive Director of the Lawyer's Committee for Civil Rights Under Law and now President and Founder of the Transformative Justice Coalition. Arnwine explains the new Commission's mission, responds to the "wicked" SCOTUS ruling on NC maps and other recent voting rights issues, and details many of the threats to democracy that must be overcome in 2018, more than sixty years after, as she and John Nichols note at The Nation this week, Martin Luther King, Jr. delivered his landmark "Give Us the Ballot" address on the steps of the Lincoln Memorial in 1957.

"We gotta remember, we are looking at the Roberts Court. This is a man who made his life ambition the evisceration and the weakening of the Voting Rights Act. In fact, if he had had his way, there wouldn't be a Voting Rights Act, as he wrote many, many years ago," Arnwine says in response to the SCOTUS stay on the NC redistricting ruling and a similar one in Texas. "They are fine with these kinds of schemes --- gerrymandering and other devices and tactics that deny people the right to vote --- because they believe in their hearts that the result is fair, it's a result that they want, and it's a result that puts people into power that they favor. And that's wrong."

"We believe that democracy should be for every single voter. That's why we created the National Commission for Voter Justice, because every voter should have the right to be able to vote and to have their vote counted," the animated Arnwine explains. "Democracy should always be about a competition of ideas, a competition of the best candidates, and then the people make their choices. Politicians should never pick who their constituents are. The constituents should pick the politicians. We are in a reverse democracy right now."

It has, sadly, been that way for a while. I recalled today, while prepping for the show, that Arnwine and I were on a National Public Radio show back in 2008, facing off against the notorious GOP "voter fraud" fraudster Hans von Spakovsky, who, I suspect, was very used to getting away with his lies before that show. I also recall Arnwine's testimony to the Baker/Carter Commission on Voting Rights which was a panel created by Republican Party vote suppressors in 2005 to push for Photo ID voting restrictions. In comparison to the Trump/Kobach Commission, however, that panel was blue ribbon! The fight for democracy is never ending, it seems.

"Democracy is never permanent. It requires vigilance. It requires engagement. It requires organizations to monitor, to advocate for it," Arnwine tells me. "But it shouldn't be as bad as it is in the United States. That's the problem. The problem is that even with the fact that you've got to constantly seek it, it shouldn't be this bad. We should not have millions upon millions of voters finding themselves blocked from the polling booth. We shouldn't have three-hour lines. We shouldn't have machinery that everybody knows is worthless."

"But that's why the National Commission for Voter Justice is going to be coming to every area where we can," she says. "We're going to have over 20 hearings around the country, so that we can hear directly from voters what they are encountering, what their experiences are and, more importantly, what some of the solutions are, helping people to advocate for those changes."

According to my guest on today's BradCast, last minute GOP maneuvering on the U.S. Senate versions of the tax bill, in hopes of buying off holdouts within their own caucus, definitively proves that so-called 'trickle-down' economic theory doesn't actually work --- and that Republicans know it. [Audio link to show follows below.]

But first up on today's show, U.S. House Minority Leader Nancy Pelosi (D-CA) calls for long-serving Democratic Rep. John Conyers of Michigan to resign in the wake of sexual misconduct allegations by a series of women, and long-serving Republican Rep. Joe Barton of Texas announces he will not run for re-election, after admitting to sexual misconduct with a series of women.

Those are just two of a flood of powerful men in politics, entertainment and journalism to be called out of late. However, how many women are still facing sexual assault and harassment from men who aren't as high-profile and, therefore, not being exposed by the mainstream media? And, how many others, even powerful ones like President Donald Trump and, perhaps, Alabama's Republican U.S. Senate nominee Roy Moore --- whose poll numbers are back up over Democrat Doug Jones in advance of the Dec. 12th U.S. Senate special election, even after multiple allegations of sexual assault with under-aged girls --- still get away without any accountability at all? We discuss.

Then, while Republicans claim their massive $1.5 trillion tax cut scheme for corporations and the wealthy (and tax increases for most everyone else) will magically pay for itself, history and all independent analysis suggest otherwise. So does evidence from large corporations, most of which indicates that companies have no plans to use their expected windfall profits from tax cuts to increase employment or raise worker wages.

With that in mind, in order to get the massive tax measure passed at all, some Republicans in the U.S. Senate are demanding a 'trigger' in the legislation that would automatically kick in to reverse some of the tax cuts if the GOP and Trump Administration's rosy scenarios that tax cuts pay for themselves do not actually come to pass.

We're joined today by financial journalist DAVID DAYEN who explains why such a trigger is the GOP's worst idea yet for their already terrible scheme. "You could let monkeys bang on typewriters for several millennia and not come up with an idea as profoundly stupid," he reports at The Nation this week.

The result, he tells me, would be that taxes would potentially be automatically increased and/or spending reduced, at the worse possible moment for doing so. "Austerity in the midst of an economic slowdown is economic suicide. It would intentionally destabilize the economy if it slowed down. It would turn recessions into depression," he warns. "I cannot stress enough how stupid this idea is."

He also notes how opposition to such a trigger from so-called "conservatives"-- other members of the Senate, as well as right-wing advocacy groups like the Koch Brothers' Americans for Prosperity, Grover Norquist’s Americans for Tax Reform and the US Chamber of Commerce --- "gives the game away" that 'trickle-down', and this bill as a whole, are all "all a scam"...and Republicans know it.

Please tune in for another very insightful conversation with Dayen, revealing just how hypocritical, dangerous and misleading the entire scam is, how much it will cost the American people in real terms, whether the GOP and Trump will be able to get it passed at all, and how the American electorate are likely to react if so, in 2018 and beyond.

Finally, a quick reminder that Open Enrollment for the Affordable Care Act ('ObamaCare') at Healthcare.gov is still under way until December 15th in most states and, while sign-up numbers have been very high so far this year, they are very low as a percentage compared to last year, since Trump has cut the period for enrollment in half from previous years.

Setting aside Donald Trump's own self-assessment that his government's response was a "10" out of 10 --- that it couldn't have been better --- actual facts reveal otherwise.

The phrase "high crimes" that appears in the Impeachment Clause of the U.S. Constitution, according to the Constitution Society, "refers to those punishable offenses that only apply to high persons, that is, to public officials, those who, because of their official status, are under special obligations that ordinary persons are not under, and which could not be meaningfully applied or justly punished if committed by ordinary persons."
