Guest: Annie Platoff of the North American Vexillological Association; Plus: Callers, Trump surge & more!...
By Brad Friedman on 6/24/2015 5:22pm PT

As the Confederate flag falls, once again, across the South, in the wake of the Charleston AME church terrorist attack, flag expert Annie Platoff of the North American Vexillological Association (yes, there is such a thing!) joins us to a question I've had all week on The BradCast: Why so much passion about a piece of colored cloth?!

I understand why people want the Confederate Battle Flag taken down. But I have much less understanding of why people are so passionate and emotional about wanting it, or any other flag, to be raised in the first place --- at least outside of a military context.

Platoff, who, in addition to being a flag expert is also a librarian at UCSB, explains the history of flags, their symbolic importance, and why they inspire such passion --- both for and against. She also tells us about the Apollo mission flags, which are still on the Moon, and about which wrote a paper when she worked as a lunar/Mars librarian at NASA. (She's also an expert on Russian flags and discussed their history and use in more recent context, both after the fall of the Soviet Union and during the ongoing conflict in Ukraine.)

Also on today's BradCast: A whole lot of breaking news on a whole lot of stuff, including Donald Trump's surge into 2nd place in the GOP 2016 race in New Hampshire (told ya so!); Listener/callers weigh in on the controversial Confederate flag and more; Plus: Desi Doyen with the latest Green News Report!...

GUEST: VICE News investigative journalist Jason Leopold...
By Brad Friedman on 5/13/2015 4:01pm PT

I'm joined today on The BradCast by VICE News' investigative journalist Jason Leopold to discuss the exclusive documents he obtained concerning the drugging of detainees during interrogations after 9/11. Also, Leopold, who has spent quite a bit of time lately as a reporter at Guantanamo Bay, discusses why President Obama may suddenly be in a hurry to keep his promise to shut down the controversial facility.

Also, after defending Jeb Bush on his Iraq comments on yesterday's show, I'm forced to offer a retraction today in light of Jeb's second attempt to answer the same question. It is clear that he's at least as dumb as his brother, and certainly too dumb to be President of these United States.

Finally, millions of dollars in campaign contributions are flowing to elected officials from fossil fuel interests in exchange for billions in tax-payer funded subsides, reports The Guardian --- Plus, the story of the Iowa farmer who claims an oil executive offered him a 'teenage prostitute' in exchange for giving up his land to a new Bakken Shale oil pipeline...

Rightwing grifter and convicted federal criminal James O'Keefe --- the guy who we exposed as having faked the infamous ACORN "pimp" hoax --- lost again in court this week.

O'Keefe, of course, is no stranger to being a loser. You'll recall the Republican scam-artist was also forced to pay $100,000 to a San Diego ACORN worker after illegally videotaping him as part of the phony "sting" scheme back in 2009.

This week's latest loss for the pretend "journalist" was in regard to his attempted 2010 wiretap conspiracy in the New Orleans office of then Democratic U.S. Sen. Mary Landrieu...

Mind-boggling response to BRAD BLOG: 'No correction warranted'...
By Brad Friedman on 12/15/2014 2:19pm PT

A few weeks ago, Francis Barry, whose bio identifies him as having "previously served as Director of Public Affairs and Chief Speechwriter for New York City Mayor Michael R. Bloomberg," had a piece published by Bloomberg View (the op-ed arm of the Bloomberg News outlet), portending to examine whether Photo ID voting laws had an adverse effect on turnout this year.

Specifically, as the very first paragraph of his piece explained, Barry claims to have been looking at whether "voter identification laws suppress turnout" since, as he opined in the same graf, "Liberals" argue "not all citizens have the type of ID that many states now require at the polls."

The piece, headlined "Quit Blaming Low Turnout on Voter ID", went out of its way to make the case that such laws had nothing to do with turnout this year, as some states with such laws even saw higher turnout than others without them. While one could attempt to make such an argument, in this case, unfortunately, Barry used extraordinarily deceptive data and moving goal posts in order to do so, as detailed in the emails (posted below) between me, him and one of his editors.

The main trick he employed was an apples to oranges comparison of turnout rates in "21 states that had a competitive gubernatorial or Senate race", where, he misleadingly claimed, "Fourteen of the 21 states had a voter ID requirement in place, while seven didn't".

But here's the thing. Barry deceptively swapped the type of very specific Photo ID laws cited in his first paragraph, with very non-restrictive ID laws that are in use without objection in many states.

When I explained all of this in detail to him and his editors via email (all posted below), the response I received back was, as I noted, "mind-boggling, to be frank"...

By Brad Friedman on 11/7/2014 6:02am PT

It's been happening for years now. On the day after elections like last Tuesday's, media figures begin navel gazing to figure out how pre-election polls, created by dozens of independent pollsters using dozens of different methodologies, could all find the same thing but turn out to be so wrong once the election results are in.

The presumption is that the results are always right, and if they don't match the pre-election polling, its the polling that must be wrong, as opposed to the election results.

On Wednesday morning, after Tuesday's mid-term election surprise in which Republicans reportedly won handily in race after race despite pre-election polls almost unanimously predicting much closer races or outright Democratic victories, FiveThirtyEight statistics guru Nate Silver declared "The Polls Were Skewed Toward Democrats".

His analysis of aggregated averages from dozens of different pollsters and polls this year found that the performance of Democrats was overestimated by approximately 4 percentage points in Senate races and 3.4 points in gubernatorial contests. Silver's assessment relies on a "simple average of all polls released in the final three weeks of the campaign," as compared to the (unofficial and almost entirely unverified) election results reported on Tuesday night. He doesn't suggest there was anything nefarious in the polling bias towards Dems this year, simply that the pollsters got it wrong for a number of speculative reasons.

Citing the fact that nearly all of the polls suggested Democrats would do much better than they ultimately did, when compared to the reported election results, Silver asserts it wasn't that the polls were more wrong that usual, per se, but that almost all of them were wrong in a way that appears to have overestimated Democratic performance on Election Day.

"This year's polls were not especially inaccurate," he explains. "Between gubernatorial and Senate races, the average poll missed the final result by an average of about 5 percentage points --- well in line with the recent average. The problem is that almost all of the misses were in the same direction."

Silver is much smarter than I when it comes to numbers; I'm happy to presume he has the basic math right. But he seems to have a blind spot in his presumption that the pre-election polls were wrong and the election results were right. That, despite the lack of verification of virtually any of the results from Tuesday night, despite myriad and widespread if almost completely ignored problems and failures at polls across the country that day, and despite systematic voter suppression and dirty tricks that almost certainly resulted in election results (verified or otherwise) that were skewed toward Republicans...

By Brad Friedman on 9/17/2014 6:30am PT

It's hard to compete with Maine's Paul LePage for the title of Nation's Dumbest Governor, but Louisiana's Gov. Bobby Jindal, who pretends to think he might be a viable Republican Presidential candidate in 2016, seems to want to give him a run for his money.

Jindal's new plan to deflect criticism about his denial of global warming and anthropogenic climate change in his state --- which is rapidly disappearing into the ocean --- seems to be to employ the old "I know you are, but what am I?" strategy that works so well for 7-year olds.

In remarks announcing his plans for an energy policy this week, Jindal, while receiving a spiritual pat on the back from George Orwell, called the Barack Obama administration "science deniers," according to Politico:

"The reality is, right now, we've got an administration --- the Obama administration --- that are science deniers when it comes to harnessing America's energy resources and the potential to create good-paying jobs," the Republican and potential 2016 candidate said at a breakfast sponsored by the Christian Science Monitor.
...
"Absolutely, let's listen to scientists, absolutely..." Jindal said. "But let's not do so in a way that hurts our economy."

Asked about his personal views on climate change, he said he believed that the climate is "always changing."

"It's not controversial to say human activity is contributing" to changes in climate, he said, but he said he would "leave it to scientists to decide how much, what that means..."
...
Pressed on what he meant by calling the administration "science deniers," Jindal pointed to "their approach to energy policy," saying the White House should push for building the Keystone pipeline and blasting Environmental Protection Agency regulations.

Got that? It's science denial for the EPA to regulate emissions that the vast consensus of world scientists say are threatening the health of our planet. And it's science denial to not push for dirty Canadian oil sands to be pumped through the Keystone XL pipeline to the Gulf of Mexico for export over seas --- oil sands that, if fully exploited would be "game over for the climate" according to climate scientists.

If I wasn't on jury duty this week, I suspect I'd have a few more responses and/or fact-checks for Jindal's idiocy above. He can't really believe that stuff he says, right? Well, either way, now that I think of it, the dumber he is, or at least appears to be, the more viable he might become as a Republican Presidential candidate in 2016.

GUEST: Attorney and BRAD BLOG legal analyst Ernest A. Canning...
By Brad Friedman on 9/3/2014 9:24pm PT

On Wednesday, U.S. District Court Judge Martin Feldman became the first federal judge since the U.S. Supreme Court's 2013 Windsor decision to uphold a state marriage-equality ban. But it's hardly the first questionable ruling by Feldman.

On this week's KPFK/Pacifica Radio BradCast I was joined by BradBlog.com's legal analyst Ernest A. Canning to discuss his 2010 call for Feldman's impeachment after his ruling that lifted the temporary federal moratorium on off-shore drilling following the BP oil disaster in the Gulf. Feldman, it turns out, failed to disclose his many conflicts of interest in the case or recuse himself at the time.

(And speaking of corrupt federal judges with lifetime appointments who need to be impeached immediately, please do not forget this one!)

I also talked with Ernie about his belief that Photo ID voting restrictions will be struck down by the federal court in Texas, and then at the U.S. Supreme Court.

Other issues also covered on this week's show: rape and murder convictions tossed out after 30 years for two NC men on death row, thanks to DNA evidence; the CA 'recount' reform bill blocked by state Republicans after the close election in state history; the new report finding Citizens United has directly resulted in more Republicans elected to office; and much more, including, as usual, Desi Doyen and the latest Green News Report...

Described by political reporter as 'most frightening I've ever met'...
By Brad Friedman on 8/1/2014 2:30pm PT

Michele Bachmann may be on her way out. And Sarah Palin cut and run long ago. But make way for Republican state Rep. Lenar Whitney, who is now running for an open Congressional seat from Louisiana.

She cites Bachmann "as a political role model" and proudly accepts the monicker of "Palin of the South", according to Dave Wasserman of the Cook Political Report, who wrote about her at Washington Post this week.

"I've personally interviewed over 300 congressional candidates over the course of seven years, both to get to know them and evaluate their chances of winning" he writes. "But never have I met any candidate quite as frightening or fact-averse as Louisiana state Rep. Lenar Whitney, 55, who visited my office last Wednesday."

Wasserman describes how she eventually "fled the room", after he'd asked her "repeatedly for the source of her claim that the earth is getting colder", as seen --- along with much more --- in the remarkable video below. He says "she froze and was unable to cite a single scientist, journal or news source to back up her beliefs."

Not surprising, given that her claims are all bullshit, until you see the confidence with which she presents that bullshit in the campaign video below. Get a load --- and I do mean load --- of this...

We're getting ready to hit the road, so no time at the moment to debunk each of her ridiculous --- and long ago debunked everywhere else --- assertions. Even the frequently absurd PolitiFact judged the claims in her otherwise hilarious video to be "Pants on Fire".

But the video seems worth highlighting here, nonetheless, if only so that folks can know who may become the next Congressmember from Louisiana's 6th district, and so we all might further appreciate just how far off the rails of reality the Republican Party has now gone, that a) this woman is even a viable candidate for U.S. Congress from any party and b) she's actually already been elected to something beyond Dog Catcher by voters in the state of Louisiana!

How dumb, gullible, confused, played, brainwashed and miseducated are Republicans in Louisiana?

This dumb, gullible, confused, played, brainwashed and miseducated, apparently...

A significant chunk of Louisiana Republicans evidently believe that President Barack Obama is to blame for the poor response to the hurricane that ravaged their state more than three years before he took office.
...
Twenty-eight percent said they think former President George W. Bush, who was in office at the time, was more responsible for the poor federal response while 29 percent said Obama, who was still a freshman U.S. Senator when the storm battered the Gulf Coast in 2005, was more responsible. Nearly half of Louisiana Republicans — 44 percent — said they aren't sure who to blame.

Heckuva job, GOP and Fox "News"!

By Ernest A. Canning on 6/17/2013 2:15pm PT

In a ruling hailed by voting rights advocates today, Arizona's requirement that newly registered voters submit proof of citizenship with their registration has been struck down by the U.S. Supreme Court in a 7-2 decision. Justice Antonin Scalia authored the opinion for the majority, while Justices Clarence Thomas and Samuel Alito dissented.

The court rejected provisions of Proposition 200, a ballot measure approved by AZ voters in 2004, which mandated that state election officials reject all applications to register to vote that did not include documentary proof of citizenship. Those documents, however, are not currently required by the Federal Form for voter registration, as approved by the Elections Assistance Commission (EAC) pursuant to provisions of the National Voter Registration Act of 1993 (NVRA).

Today's ruling in Arizona v. Inter Tribal Council of Arizona [PDF], is grounded upon the plenary power given to Congress by the Elections Clause (Art. I §4 of the U.S. Constitution) empowering Congress to preempt state regulations governing the "Times, Places and Manner" of holding federal elections. The court found that the NVRA mandate that states "accept and use" the Federal Form for voter registration takes precedence, and that Prop 200 is invalid because it conflicts with the Congressional intent that the NVRA help ease the ability of citizens to register to vote.

Writing for the majority, Justice Scalia observed that if a state could "demand of Federal Form applicants every additional piece of information the State requires…the Federal Form ceases to perform any meaningful function, and would be a feeble means of 'increas[ing] the number of eligible citizens who register to vote in elections for Federal office.'"

This does not close the door on the issue altogether, however. Justice Scalia noted that, pursuant to the NVRA, any state can ask that "the EAC alter the Federal Form to include information the State deems necessary to determine eligibility." If the EAC then rejects such a request, the state "may challenge the EAC's rejection of that request [in court]"...

What happens if we start with known public corruption cases and work backwards to the intersection with elections?

What you will find is kickbacks and bid-rigging schemes; at least two of these, in New Orleans and in Pennsylvania, connect back to Ciber, the Independent Testing Authority (ITA) that supposedly tested and then signed off on most of the U.S. voting machines currently in use in all fifty states, on behalf of the federal government.

You will learn of a now-admittedly corrupt government technology official who benefited from rigged bids, (courtesy of Ciber) who had placed, as one of his first priorities, setting up his very own Internet Voting system.

And when you look into money-laundering, the mechanism providing the juice for corruption, you'll find out about a strikingly odious situation: a New York City Democrat who bribed New York City Republicans to help him run for Mayor (as a Republican). The case has recently made news as at least 5 high-ranking elected and party officials were rounded up this week as part of a sweeping FBI sting in the Empire State.

"Trust" will never suffice when it comes to conducting elections. There can never be a place where counting votes in secret, or governmental snooping on how we voted, or hidden money behind campaigns, or hiding records on elections, can be accepted by the public, yet that is happening right now. In all fifty states.

Vendors who do business with the government do participate in bid-rigging and kickback schemes, and both politicians and government employees sometimes deprive the public of honest services, as we find in the New Orleans case involving Ciber, the company which signed off on almost every electronic voting system in use across the country today.

Political corruption spreads like cancer. It creates a neural system of one politician beholden to another. The public always needs to retain its right to know, to examine documents, and to see what's going on. Otherwise, who's gonna notice? Who's gonna tell?

I write about it all in great, and sordid, detail today at BlackBoxVoting.org, where, as I note, the moral of the story is this...

Before we go skipping down the road trusting any politician to know what's best for us regarding our own right to see and authenticate elections...

Before we agree to some pie-in-the-sky idea that secret vote counting processes are safe because some company tested them...

Before we accept the idea that some legislators can pass a law telling us we have to cede over our right to know...

We need to understand that when it comes to elections, trust is childlike. It's wishful thinking. It's immature.

It's not how the world works, and we owe it to our children to remember that.
