The non-partisan Election Protection coalition offers a mid-day press release detailing some of the problems being reported to their 1-866-OUR-VOTE hotline today from both Indiana and North Carolina.

The Supreme Court's recent, outrageous approval of Indiana's restrictive and disenfranchising Photo ID law --- better described as their Voter Suppression Act, despite Scalia's claim that "the burden at issue is minimal," to him, anyway --- is already "working" to disenfranchise legal voters, denying them their right to cast ballots like everyone else.

According to EP, it's not just veterans, elderly, and minorities who are being affected by the ruling, so are young voters and, yes, nuns, who have reportedly already been disenfranchised today under the Republican law...

This morning, in South Bend, Indiana, a freshman student at St. Mary's College, excited to vote for the first time, left the polling place in tears because she only possessed a private college ID and was unable to vote. The poll workers, nuns at a local convent, were trying to help the young student through her problem. While they were helping her, they realized that some of their fellow nuns, who had just arrived at the polling place, also could not vote because of the photo ID law. Not only was this group of nuns disenfranchised, but so would be four floors of retired nuns in their convent.

Remember, the law was upheld by the Supremes just last week, despite Indiana's inability to point to a single instance of in-person, polling place, voter impersonation fraud (the type of "voter fraud" the law was purportedly meant to deter) in the entire history of the state.

UPDATE: Brad Jacobson has more on the dangerous "roaming pack of octogenarian and nonagenarian hooligans [nuns, who] attempted to exercise their right to vote," including one of them, a clearly-up-to-no-good, 98 year-old, trouble maker who Catholic Antonin Scalia and friends don't believe deserves the right to cast a ballot.

Additional updates at the end of this article, including details on the evil nuns, a newly married woman, and more disenfranchised students.

Milwaukee Magazine's Bruce Murphy notes today that if a study recently done in Wisconsin correlates to numbers in Indiana, as many as 620,000 citizens in the Hoosier State might lack the Photo ID needed to cast votes there. That, even as the state downplayed the numbers in the SCOTUS case, arguing that there were only 43,000 such voters there. The authors of the WI study were unable to check the same numbers in Indiana, because "the Indiana Bureau of Motor Vehicles would not provide the data needed to do the study," reports Murphy.

EP's news release goes on to list a number of other incidents being reported (if not yet by the corporate media) so far during voting today in IN and NC both, including multiple reports of voting machines problems; paper ballots not being offered to voters when machines go down; registered Independent voters being disallowed from voting in either party's primary; or voters being given Republican ballots when they believed they were registered as Democrats.

The Republican War on Voting continues apace.

In addition to the recent, outrageously bad decision by the Supreme Court to approve Indiana's draconian polling place Photo ID restrictions, sure to keep thousands of legal voters from even being able to cast votes in tomorrow's important Primary Election --- despite the state's inability to offer up a single instance of in-person polling place voter impersonation that's ever occurred during the state's entire history (as we've covered here, here and here, for example) --- another 1.1 million voters have now been purged from the voting rolls altogether, reports Bev Harris of Black Box Voting, as based on the Hoosier State's own data.

Moreover, the state will use unverifiable touch-screen style voting systems across the state. One widely used system, made by MicroVote, will be used despite having been decertified, and two other systems, made by ES&S and Diebold, have been found vulnerable to undetectable vote-flipping viruses by several reputable universities.

On the other hand, there are dozens of toons this week about that guy who said some stuff and who also happens to know someone that's running for President (to paraphrase Jon Stewart on the Rev. Wright nonsense).

Why Do Republicans Hate our Troops? And the U.S. Constitution?

As I've been trying to help people understand, this Indiana polling place Photo ID restriction law, as upheld last week by the Supreme Court, is so much worse than most folks realize right now.

It is, as previously predicted, already beginning to spread like wildfire to other states, such as Missouri, where the Republicans control both legislature and state house, and where even a few thousand legal Democratic votes, shaved cynically off of the results in places like the city of St. Louis next November, can be the difference between the state going "red" instead of "blue."

The following remarkable tale of a U.S. Army vet who has fought in three conflicts for our country, and who has won multiple medals for his service, including two bronze stars, purple heart, etc., who has been registered to vote since 1968, but who is now having a helluva time being able to cast a ballot in Indiana, will likely become all too typical now. The report comes from from the Nuvo weekly in the Hoosier state, and was sent in by BRAD BLOG reader "RC."

It is absolutely maddening, at least to those of us who give a damn about American values, such as democracy, the U.S. Constitution, patriotism, love of country, etc., so it may mean little to the vast majority of Republicans out there today. Please, at least, read the lede to the story below and --- if you're a Republican who supports this anti-American bullshit --- please let us know, in comments, why why this sort of treatment of our troops is okay with you. All of this, despite Indiana's own admission during the SCOTUS hearing, that there has never been, in the state's entire history, a single known instance of polling place voter impersonation fraud of the type this law is supposedly meant to keep from happening...

I just finished a very lively late-night hour (actually 26 minutes with all the commercials removed, you're welcome) on San Francisco's KGO with Christine Craft. The discussion concerned the Supreme Court's outrageous ruling in the Indiana Photo ID restriction case, and my article yesterday detailing how difficult it now is to vote in Indiana if you don't happen to have one. Rights shmights.

The audio features plenty of wingnut callers who just don't get it, demonstrating why it's so damned difficult to fight off this out-and-out GOP voter suppression scam/assault on your democracy and Constitution. If it's this difficult in "liberal" SF (albeit, on "conservative" KGO), this nation is in big trouble. And, if the articles from the last few days here haven't made that clear, we are. Big time. This November is gonna be a nightmare. Big time.

Media Bloodhound nails the latest corporate mainstream media disgrace. This time, courtesy of NBC's Brian Williams, and Dick Cheney's longtime former protégé turned NBC News "reporter" Pete Williams...

Last night, NBC Nightly News with Brian Williams allotted eighty seconds to yesterday's momentous Supreme Court ruling that there's nothing unconstitutional with Indiana's law requiring a photo ID to vote. Meanwhile, during the same broadcast, it spent over two minutes on the concern caused by photos of teen star Miley Cyrus in Vanity Fair.

That would be embarrassing enough for a news organization purporting to be credible.

But earlier in the day on the Nightly News blog The Daily Nightly, anchor and managing editor Brian Williams (in a post titled "What Times Is It?") actually took The New York Times to task for publishing puff pieces.

Well, at least Williams covered the outrageously anti-Constitutional Supreme Court decision, sure to disenfranchise thousands, if not millions, of voters, right? Even if only for 80 seconds. But, as it turns out, no coverage would have been preferable to Williams' unfair, unbalanced (and inaccurate) coverage...

For those wondering what a legally registered voter needs to do to successfully cast a ballot in Indiana --- now that their draconian polling place Photo ID restrictions have been upheld by the Supreme Court --- so that it might be counted, in the event the voter doesn't currently own a state-issued photo ID (no, military ID is not acceptable) we thought we'd offer a handy quick guide.

Note: It doesn't matter if you've voted in every single election for the last 40 or 50 years at the same polling place. Nor does it matter, as Justice Souter pointed out his dissent yesterday, "that the State has not come across a single instance of in-person voter impersonation fraud in all of Indiana’s history." You'll still need to do the following if you don't happen to have an IN drivers license!

Also note: Given the SCOTUS decision, and the nation-wide GOP effort (anywhere they can get away with it) to deny legal, Democratic-leaning voters from being able to even cast a ballot, folks in other states may wish to read the following to get an idea what's likely to be coming your way, as the Republican War on Voting successfully rages on. Please try not to be a causality.

How to cast a ballot in Indiana, if you don't currently have a state-issued ID:

  • Find your birth certificate or passport. If you don't have either, you might be able to apply to the state to get a copy of your birth certificate, if you happened to have been born there, for just $12. A passport may cost you $100 (I can't help you get to the place where you'll need to get your photo taken for that.) UPDATE: BRAD BLOG commenter Mary Mancini points out Indiana's requirements for a copy of your birth certificate, require you to have......you guessed it...a Photo ID!
  • Get yourself to a Bureau of Motor Vehicles. Don't let the fact that you don't drive, or have a car, or have access to public transportation, as in many counties in Indiana, stop you from getting to the BMV before Election Day.
  • Do the above every four years, without fail, or risk not being able to vote like everyone else at the polls in Indiana on Election Day.

If you fail in any step above, don't have the money to afford the necessary documents, or have a religious objection to having your photo taken, do not to worry. Indiana has you covered...

  • Figure out how to get to the nearby polling place to vote. (Unlike the BMV, polling places in IN, for the moment, are many. If you're lucky, one will be close enough that you can walk there, presuming the weather in Indiana, say, in November, allows it. Though many will help you get to the polls on Election Day, even if they're not always available to drive you to the BMV at other times of the year.)
  • When you get to the polls, and are told you can't vote like everyone else, because you have no state-issued ID, you'll get to vote on a provisional ballot (hopefully, at least that's the law).
  • Don't forget to sign the affidavit on the ballot, stating that you are who you say you are, before dropping it into the box, so officials can match your polling place Election Day signature with your voter registration form signature.

But it's not over yet, if you want to get that vote counted somehow! (Having it counted accurately and/or transparently, due to the voting systems used in IN, is largely out of any citizen's hands, at this point.)

  • Before 10 days have elapsed after you've voted, you must now go back and figure out how to get your Photo ID still! (see original three steps.) And then...
  • Get a ride to the county seat, however far that may be from where you live. Get to the Courthouse there within those 10 days, and then show them your ID as mentioned above, sign yet another affidavit, similar to the one you signed on Election Day at the polling place on your provisional ballot, attesting again to the fact that you are you. And then maybe, just maybe, if that signature is also judged to match your registration, then your vote might be counted.

No, it's not onerous at all. As Scalia and friends noted in their decision [PDF] yesterday, "the burden at issue is minimal," as he sees it. (Though we're guessing he probably owns a state-issued ID already.) So what could those losers on the Supreme Court have been thinking, just 42 years ago, when they struck down a simple $1.50 poll-tax on the grounds that it might keep some voters from being able to cast their legal vote? Silly them.

Welcome to America's brave new modern world. 9/11 changed everything.

Polling Place Photo ID Restrictions in Indiana Upheld by SCOTUS in Courageous and Historic Dredd Scott-like Decision
But Why Stop at Keeping Black and Elderly Fraudsters from Stealing Elections?...

As the great voting rights advocate, Rush Limbaugh, trumpeted at the beginning of his radio show this morning, today's 6 to 3 Supreme Court ruling allowing new, modern restrictions regarding which citizens may or may not cast votes at American polling places on Election Day, is "a huge, huge, huge move forward to undercut Democrat efforts to commit voter fraud this fall."

Fortunately, instead of coming in June as expected, this decision on an Indiana Photo ID restriction case comes just in time to prevent massive voter fraud at the polls in Indiana's Democratic Primary two weeks from now, when millions of fraudulent Democratic voters were almost certainly plotting to try and show up to vote on electronic voting systems on which it's impossible to prove one way or another whether they did or didn't vote the way the machines will tell us they did. With voting systems like those in use across the Hoosier State, and elsewhere around the country, it's all the more reason to ensure those Democrats can't show up and commit the fraud they were probably planning to engage in on May 6th!

The news is certainly the most important SCOTUS decision pertaining to elections since the triumphant, well-considered, and much-beloved Bush v. Gore decision of 2000. Today's verdict will undoubtedly be heralded and taught at American institutions of learning for decades to come, with the same reverence as that dedicated to landmark Supreme Court decisions like 1857's Dredd Scott v. Sandford ruling, which thankfully found that "people of African descent imported into the United States and held as slaves, or their descendants --- whether or not they were slaves --- could never be citizens of the United States, and that the United States Congress had no authority to prohibit slavery in federal territories."

The Supremes have done it again! But no such important American political battle like that which was won today is ever fought alone. Due thanks must go to the long-fought efforts of countable simple citizens around our nation, concerned about the integrity of voting. We'd be remiss without noting some of the selfless freedom fighters who helped make today's great news a reality: Courageous, unheralded voices, such as those of "longtime advocate of voter rights" and Bush/Cheney '04 Inc. General Counsel Mark F. "Thor" Hearne, tireless Republican "voter fraud" information-wareness man John Fund, and Bush-appointed DoJ Civil Rights Division guardians of the ballot box, like Hans von Spakovsky, Bradley Schlozman and its former Voting Section chief, John "Minorities Die First" Tanner.

Thanks to brave men like them, and Mr. Limbaugh, of course, it'll be a new day at the polling place this fall! One in which, if Republicans legislators around the country hurry up and get on the anti-voter fraud ball, they can assure that millions of Democratic-leaning citizens won't be fraudulently mistaken for actual voters when they show up at their polling places this November.

But are restrictions that may keep just blacks and the elderly from casting a ballot enough to ensure the true integrity of our vote? Shouldn't we keep fighting to ensure that legitimate voters like you and me don't have our voices diluted by even more fraudulent groups out there, like gays, communists, and dead people, who every year change the results of election after election through their insidious anti-American efforts, because I say they do?

Read on for a couple of new ideas. Clearly, today's SCOTUS decision is a good start, but it hardly goes far enough to ensure that the right American voices are heard, as our founders intended! 14th Amendment, equal protection, blah, blah, blah, my ass!...

Paging Dan Abrams! Working on several detailed stories for the moment, so not much time for background on this, but we'll try to quickly connect a few dots for you.

Much of it the first part here is so amusing and/or ironical on its own, that I suspect it speaks for itself. At least for anybody who is cursorily familiar with the John "Minorities Die First" Tanner story, as originally broken by The BRAD BLOG's Alan Breslauer, who video-taped the remarks which led, fairly directly, to Tanner's embarassing downfall, sad Congressional testimony and eventual resignation as the head of the DoJ's Civil Rights voting unit. The former chief of the Justice Department's Voting Rights Section, who stepped aside in December after apologizing for remarks about minority voters, is now working on election-related issues for the Alabama Law Institute.

John Tanner, who is being paid by the Justice Department under a federal program, also will teach at two Alabama law schools.

The law institutes's president, Alabama House Speaker Pro Tem Demetrius Newton, said he personally contacted Tanner when he heard the long-time voting rights specialist wanted some time away from Washington. At the institute, a part of the University of Alabama, Tanner's work includes developing handbooks for public officials on getting Justice Department approval of election-law changes.

"He's the expert on that," Newton, D-Birmingham, said Monday.

Expert on that, indeed.

The article goes on to note that the DoJ is "paying Tanner's salary and benefits to work in Alabama through next spring." About which Bob McCurley, director of the Alabama Law Institute, said, "It's not costing me anything."

And well worth the price at that!

But that's not all that should be taken note of here. There are at least two very important dots that need connecting here between Tanner, Alabama, the Siegelman case and an unprecedented order by the DoJ in 2006 taking away control of elections from the AL Secretary of State and handing it to the Republican Governor who ousted him under, um, less than crystal-clean circumstances...

Art Levine at The American Prospect has a new must read piece titled, “The Republican War on Voting: Using the Department of Justice, friendly governors, and its usual propaganda outlets, the GOP has propagated the myth of voter fraud to purge the rolls of non-Republicans.” Here's a small taste of it...

"Sharrard's cautionary tone was a response to the Republican Party's ongoing nationwide campaign to suppress the low-income minority vote by propagating the myth of voter fraud. Using various tactics --- including media smears, bogus lawsuits, restrictive new voting laws and policies, and flimsy prosecutions --- Republican operatives, election officials, and the GOP-controlled Justice Department have limited voting access and gone after voter-registration groups such as ACORN..."

"Unfortunately, progressives have tended to pay more attention to Election Day dirty tricks and to electronic voting machines than to a more systemic threat: the Republican campaign to suppress the votes of low-income, young, and minority voters through restrictive legislation and rulings, all based on the mythic specter of voter fraud..."

"Unfortunately, the public hasn't heard just how nonexistent the voter fraud epidemic actually is. While progressives have successfully challenged some of the most restrictive laws in court, they're still playing catch-up when it comes to combating the glib sound bites of voter-fraud alarmists. Republicans and the Bush Justice Department have cloaked their schemes under such noble-sounding concepts as "ballot integrity." The GOP's vote-suppression playbook features everything from phony lawsuits to questionable investigations to authoritative-seeming reports, all with the aim of promoting restrictive laws."

Levine also draws quite a bit (and links to some) of The BRAD BLOG's years-long exposé coverage of high-ranking Republican vote-suppression cappo Mark F. "Thor" Hearne and his GOP front-group "American Center for Voting Rights" elsewhere in his detailed report.

In related news, John Tanner, the man in charge of the Justice Department's efforts to disenfranchise millions of voters until he was forced to resign after The BRAD BLOG captured and exposed him making crazy offensive comments on video (see below), has a new job, apparently. Tanner is reportedly now a fellow with the Alabama Law Institute - which provides the Legislature with legal expertise in drafting and revising laws.

'Huh?' Says The BRAD BLOG...And So Does the Campaign Legal Center...

We admit to being perplexed enough by Matthew Mosk's Sunday article in WaPo, claiming that GOP "voter fraud" zealot Hans von Spakovsky, formerly of the DoJ Civil Rights voting unit, was "cleared" by a U.S. Election Assistance Commission (EAC) inspector general's report, to poke around for a few minutes trying to figure out who this Mosk was, and how the hell he figured the report "cleared" von Spakovsy of anything.

vS was one of the notorious villians at the DoJ who politicized the hell out of the Civil Rights division by turning it into a blunt instrument to keep minority voters from being able to cast their lawful vote in any way he could figure out how to do.

He is also the failed nominee for the FEC who still has yet to show enough grace to remove his name from consideration, as he has singlehandedly succeeded in ensuring that the commission is entirely crippled, unable to vote on anything without a quorum, during an election year.

As the IG's report on whether the EAC was inappropriately influenced, by von Spakovsky and others, to withhold and the re-write a bi-partisan study on voter fraud, the then-chair of the EAC, Paul DiGregorio --- a Republican himself --- said that “too many of [von Spakovsky’s] decisions are clouded by his partisan thinking”...vS “certainly tried to influence...There’s no question about that," and that, the EAC chair felt that "von Spakovsky thought he should use his position (on the EAC commission) to advance the Republican Party position.”

Mosk used his WaPo article then, to quote vS alleging that the "conclusions (of the EAC IG report) represented a personal vindication" for him. Huh?

We got distracted by other business, and were unable to finish our poking around to figure out what Mosk might have been after, and why this article, on a report published three weeks ago suddenly became "news" to the Washington Post, with "clearance" of von Spakovsky as the central meme.

J. Gerald Hebert, over at the Campaign Legal Center Blog seems to have come away with the same perplexed reaction, opening his article yesterday with...

Thor Hearne and his phony White House/GOP "American Center for Voting Rights" (ACVR) front group may be officially disbanded, but that simply means their still mysteriously-funded, tax-exempt scam to push for disenfranchising Photo ID restrictions at polling places around the country continues beneath the radar and by occasionally different names. Same anti-democracy thugs. Same money. A few less discredited (so far) names.

One of those names was front and center yesterday during a hearing on Capitol Hill yesterday, as the huckster Hearne could be heard faintly in the distance, still pulling the strings.

When the U.S. Senate's Committee on Rules and Administration held a hearing yesterday to discuss whether Photo ID Voting Laws lead to disenfranchisement, University of Missouri academic Jeffrey Milyo was among those who were present to give testimony.

The primary reason for Milyo's inclusion in the panel was his recent publication of a study purporting to show that restrictive photo ID voting laws had no adverse effect on voter turnout in 2006 elections in Indiana. Never mind that voter turnout is not necessarily indicative of whether or not voters were disenfranchised by such laws or not. More to the point, for the moment, while Milyo's testimony poured forth easily for the committee when he was talking about his contention that Photo ID laws do not disenfranchise voters, he became less erudite when the simple question arose of how his research had been funded.

There was good reason for his sudden hemming and hawing...

Feinstein Notes Bush Administration Refusal to Allow Testimony Despite Republican, White House Claims of Rampant In-Person Polling Place Fraud

For all the Bush Administration and Republican Party's phony sturm and drang about a supposed epidemic of "voter fraud" at the polling place, the DoJ refused to offer a representative to testify at a Senate hearing today on the topic.

According to a statement from Sen. Dianne Feinstein (D-CA), who chaired the hearing this morning in the Senate Rules and Administration Committee, the DoJ refused to allow testimony from the William Welch, Chief of the Public Integrity Section, which has "responsibility for civil and criminal enforcement of such voter fraud to discuss what the Department has found and to help quantify the problem of voter fraud at the polls."

"Only after extensive back and forth between my staff and the Department," Feinstein says, "did they finally send a letter stating that at some future date they would provide an unspecified witness." The full press release, including her opening statement today, is posted at the end of this article.

"In the void left by the Justice Department," Feinstein said, former US Attorney David Iglesias was called as a witness today. As The BRAD BLOG reported in some detail when the hearing was announced several days ago, Iglesias was fired during the U.S. Attorney Purge after he'd refused to bring phony "voter fraud" charges despite pressure from both Republican operatives and elected officials alike.

It's little wonder the DoJ was not allowed to participate in the hearings, despite the well-funded White House and Republican efforts to use discredited "evidence" of "voter fraud" in order to require Photo ID restrictions at the polling place which would succeed in disenfranchising millions of legal, largely Democratic voters, who do not have such ID...

Senator Says 'It Wouldn't Make Much Sense' For Illegals To Vote 'To Be Perfectly Honest'

Neil Cavuto of Fox "News" had on Maryland state senator, Alex Mooney (R), to discuss Maryland Governor Martin O'Malley's plan to allow "illegals" to keep driver's licenses. For the most part, Mooney plays the Fox guest role perfectly --- bashing the plan that could help "illegals", calling the Governor a "strong supporter of Hillary Clinton" and repeatedly referring to his political opposition as the "Democrat" party. However, the Senator fails to follow Cavuto's lead when he tries to link the licensing of "illegals" to voter fraud (beginning at the 2:55 mark):

Cavuto: But that second license, the illegal license, whatever you want to call it, that can't get you on planes or in federal offices, but I bet you it could let you vote.

Senator Mooney: Well, actually to vote you have to be a citizen according to the voter, when you register to vote you have to check off, at least pledge, under penalties of perjury, that you are a citizen.

Unconvinced, Cavuto pushes his case by stating that some municipalities might accept the licenses granted to illegals to which Mooney gives in a little. With Mooney back on board, Cavuto proceeds to bottom line the issue:

Cavuto: Bottom line Senator, you could have illegals voting in your state.

Senator Mooney: We could, but it wouldn't make much sense for them to do so, to be perfectly honest, because they would be subject to perjury and other problems. There's other things they'd rather do like be able to drive and have these jobs and, you know, go to schools.

Ouch! Only time will tell if the Senator is ever invited back to Fox "News".

Reports of 'Voter Fraud' in Dixville Notch, Dem Ballots Unavailable to Voters, Both Debunked by The BRAD BLOG
Though Reasons Remain for Concern About Tabulation on Diebold Machines...

Our Spidey-sense started tingling before going to bed last night and hearing reports, on MSNBC, that there were 17 paper ballots cast in Dixville Notch, NH, in its midnight, first-in-the-country voting. The report said that there were only 16 registered voters in the tiny voting precinct, yet 17 votes had been cast --- suggesting that somehow, paper ballot "voter fraud" skullduggery was afoot.

Following on that, reports throughout the day appeared that NH precincts were out of paper ballots, and voters were unable to vote.

Trouble is, both reports are either completely untrue, or wholly misleading, or both, as The BRAD BLOG was able to confirm with two simple phone calls.

Each of those reports, however, would seem to go a long way towards giving the impression that paper ballots are a bad idea, and that "voter fraud" is easy to commit when using them. Given that one of those reports seems to have begun on The DRUDGE REPORT earlier today, we're not particularly surprised that the MSM kept repeating the easily-debunked stories running all day.

That, even while there are reasons to be concerned about how the paper ballots used in the New Hampshire Primary will actually be counted by the hackable Diebold optical-scan systems used in the state, as controlled and programmed by an outrageously bad private contractor there...
