Thanks to recent travel, holidays, studio construction, Presidential indictments and arraignments, hurricanes, wildfires and more, we've been unable to open our phones to listeners on The BradCast for several weeks. Today, we try to begin making up for failing! [Audio link to full show follows this summary.]

First up, Planet Earth is angry. The frantic search for survivors continues today in Morocco, where a 6.8 magnitude quake on Friday was already confirmed to have killed more than 2,700 as of airtime. In eastern Libya, 2,000 are feared dead today in massive, climate change-enhanced flooding over the weekend. In what suffices for slightly less grim news over the same weekend, Hawaii's Governor reported that the number of missing following last month's climate change-enhanced wildfires on Maui has now dropped to 66, as the horrific confirmed death toll holds steady, for now, at 115. And, Desi Doyen joins us as we continue to keep our eyes on the massive, climate change-enhanced Hurricane Lee in the Atlantic, as it continues to gain strength as it moves northward through exceedingly warm waters toward Bermuda and threatens the northern East Coast of the U.S. and Canada.

Next, we've been talking for some time (about two years now, if memory serves, but who's counting?) about the fact that the U.S. Constitution's "Insurrection Disqualification Clause" bars Donald Trump from office and, therefore, next year's 2024 ballot. Over the last several weeks, the corporate media has finally decided to take notice, largely after two Constitutional law scholars from the right-wing Federalist Society issued a 126-page law review paper [PDF] concluding that Section 3 of the 14th Amendment disqualifies the former President from running again, due to his having "engaged in insurrection" on January 6, 2021.

Secretaries of State and other chief election officials across the country are now grappling with whether Trump can Constitutionally qualify for the 2024 GOP Primary ballot and some Democratic U.S. Senators are finally speaking up about the matter --- even if several of them believe the matter should be left up to voters next year, as opposed to the Constitution and the Courts.

It is our position that an originalist, textualist reading of the Constitution's Civil War-era 14th Amendment is clear. Trump is, in fact, now barred from running for or serving in office. That may be a good or a bad thing for Democrats. But the decision will ultimately be made by the Courts. In this case, almost certainly, by the stolen, packed and corrupted U.S. Supreme Court whose rightwing majority is, no doubt, already twisting itself into a pretzel trying to figure out how to declare the Constitution to be unconstitutional.

But the political question is a very different one. Sure, Trump is disqualified based on a fair, simple or even scholarly reading of the Constitution. But is that a trigger that should be pulled? For that matter, will it lead to actual triggers being pulled in response?

We open up the phones today to listeners on those very questions and, I'm happy to say, they did not disappoint...

It's been a few months since she's been on BradCast, but she returns today, for the first time since the sprawling RICO indictment against Donald Trump and 18 co-conspirators for attempting to steal Georgia's 2020 Presidential election. The indictment includes charges based on a phone call she received --- and was smart enough to have recorded --- from a Team Trumper who essentially confessed to the now-notorious breach of the state's voting system software in Coffee County. She deserves, and receives, a bit of a victory lap today, while breaking still more news about the breach which, she warns, has yet to be investigated by the state's Secretary of State or its Board of Elections in advance of 2024. But first up today, a few somewhat related items...

A federal judge ruled Wednesday that E. Jean Carroll's upcoming civil trial against Trump will only be on damages --- how much he will have to pay the former magazine columnist who accused him of raping her in the 1990's and then lying about her years later. A civil trial that ended in May found Trump liable for sexual assault and defamatory remarks made about Carroll in 2022. Today, the judge found that the previous finding of assault and defamation already establish Trump's liability regarding defamatory comments he made about her in 2019, while serving as President and, therefore, the only question to be resolved in this separate suit is how much he will have to pay her. She is seeking not less than $10 million in this case and the judge has allowed her to add defamatory comments Trump made about Carroll on a CNN Townhall the day after he was found liable in the earlier case.

Picking up on our detailed coverage on yesterday's show of the various chief election officials around the country now grappling with whether Trump is even eligible for the 2024 ballot next year, based on his violation of the U.S. Constitution's "Insurrection Disqualification Clause" (14th Amendment, Section 3), the nonprofit Citizens for Responsibility and Ethics in Washington (CREW) filed a lawsuit challenging Trump's eligibility for the ballot in Colorado on Wednesday on behalf of six Republican and unaffiliated voters there. The matter is likely to move quickly all the way to the U.S. Supreme Court, given that the state must settle its 2024 Primary ballot by January 5th!

A hearing was held on Wednesday in Fulton County, Georgia in Fanni Willis' RICO case [PDF] against Trump with co-defendant attorneys Ken Chesebro (alleged architect of the fake electors plot) and Sidney Powell (alleged organizer of the Coffee County voting system software breach) each seeking to be tried quickly and alone. The judge appears to have agreed on "quickly", setting a trial date for both beginning on October 23. But he he denied their motion to have their cases severed from each other. Still to be determined, however: the question of whether all 19 co-defendants must be tried at the same time, as Willis' team argues, given that guilt for any one defendant in the covert actions listed in the RICO charge (Count 1 of 41) means that all co-conspirators are guilty under state law. Prosecutors told the judge today that they expect the trial to take at least four months and will include more than 150 witnesses. (One of whom might be our guest on today's show!)

At the same time, a filing last week in the case by Powell claims she had nothing at all to do with the scheme to unlawfully breach, copy and distribute Georgia's state voting system software in the rural, Republican-leaning Coffee County. A report last week at the Atlanta Journal Constitution, however, which (literally) has the receipts, suggests otherwise.

But all of that --- including the receipts --- is only known publicly thanks to our guest today, MARILYN MARKS of the small, critical non-profit, Coalition for Good Governance. As first aired on this program in May of last year, Marks received a phone call from an Atlanta bail bondsman named Scott Hall, who, essentially, confessed to the entire Coffee County scheme. That is how we even know that the breach happened at all, and why four people involved with it --- one of whom is Powell, another of whom is Hall --- were charged last month in the scheme that still endangers elections both across the entire state of Georgia, where the same systems will be used again next year, and in more than a dozen other states.

Marks explains today how Hall originally "confessed" to the breach after calling out of the blue to bully her into turning over documents from her long-running civil lawsuit which is challenging the use of GA Sec. of State Brad Raffensperger's unverifiable, wildly insecure touchscreen voting systems. Hall claimed he had actually "hacked" into her group's legal documents.

"Instead of slamming the phone down, which was my first inclination, I instead decided to go into playing the sweet little old lady mode," Marks explains today, noting that she "kept him on the phone for about an hour" before he "just blurted out" the fact that he and other MAGA folks were allowed in to the Coffee County elections building to scan, image and copy everything. Two local officials, Coffee's then Election Supervisor Misty Hampton and the County's GOP chair Cathy Latham, have also been indicted in the same RICO conspiracy. (In addition to helping facilitate the software breach, Latham is also charged for her role as a fake elector in Georgia.)

Marks quipped that Hall has likely by now "realized that he, unlike Trump, had not made a 'perfect phone call."

In the meantime, Marks warns that, despite the indictments, the threat posed by the breach has still not been fully investigated by either federal or state officials. Two and a half years since the breach, which she believes Raffensperger learned of almost immediately afterward and has been covering up, "the Secretary and State Election Board have not even begun an investigation of Coffee County," Marks emphasized, telling me that "there are so many people that were involved in the Coffee County Breach that have not been held to any kind of accountability."

"What they did was just turn the criminal aspects of this over to Georgia Bureau of Investigation," she asserts. "But they are doing nothing at all. They have not even conducted one interview. They have not picked up the first piece of paper. They have not done anything to consider what are the impacts on the voting system? What are the impacts for future elections? How did this go wrong? What kind of better rules should have been in place? What kind of reporting structure should we have had? They have still not put in a single rule or requirement for reporting a security incident. If Coffee happened today, they would not have to report it."

That, Marks warns, remains a serious threat moving forward, especially since the software still remains in the wild and Raffensperger has refused to install Dominion touchscreen voting system security patches certified by the U.S. Election Assistance Commission (EAC) and strongly recommended by the U.S. Cybersecurity and Infrastructure Security Agency (CISA) in the wake of the January 7th, 2021 breach in Coffee County until after the 2024 elections.

Marks' long-running lawsuit seeking to replace Raffensperger's Dominion touchscreens with verifiable hand-marked paper ballots is finally set to go on trial in January. "We are really looking forward to putting on all of this evidence," she tells me, after explaining why the Coffee County breach is so key to her case. "And, certainly we are hoping for a decision that will at least protect the November elections for 2024. After all, these breaches that happened in Coffee County --- they are still ongoing."

"Remember, all that software was posted on the Internet. Lots of people took it. Nothing has been done to mitigate it. So, if you think about it, every day that people have their hands on that software, sharing it with others, the breach continues."

Election officials grapple with Trump's Constitutional ballot disqualification; Also: Proud Boy boss gets 22 years for 1/6; Courts order lawless AL, FL to restore Black-majority U.S. House Districts...

We're back! Both on today's BradCast and even in L.A., after fleeing the state last month to avoid weeks of construction on the roof of the apartment housing our home studio. To no one's surprise, the work is taking longer than we were told, so please pardon our efforts this week to work around it as best as possible after taking last week off to both avoid it and to enjoy the last days of Summer 2023 before the 2024 fight for Democracy (represented this year by Democrats) and Autocracy (represented by a lawless Republican party) begins in earnest.

Among our stories today...

  • Enrique Tarrio, former head of the far-right Proud Boys gang was sentenced to 22 year in federal prison on Tuesday following his conviction for Seditious Conspiracy for his role in the January 6th, 2021 U.S. Capitol insurrection. It's the longest sentence for any of the MAGA insurrectionists to date. Also, of note, Tarrio wasn't even in Washington D.C. that day. Point taken: One didn't need to be personally smashing windows and storming the Capitol to be held to serious account for what happened that day. Got it. Hopefully other jurors in other upcoming related cases will get it as well.
  • The federal Courts are still holding. Mostly. For now. On Tuesday, a three-judge panel found that Alabama Republicans blatantly defied an order from the U.S. Supreme Court to add another Black-majority district to their U.S. House map. The SCOTUS order to do so --- after finding the state violated both the U.S. Constitution and Voting Rights Act with their racially gerrymandered districts --- came in Allen v. Milligan [PDF] in early June. Alabama didn't care. In an unprecedented move, they gave the finger to the Court and drew up a new map with the very same deficiencies featuring just one Black-majority district out of seven, in a state where some 27% of residents are Black. The federal court panel has now assigned a Special Master to draw U.S. House districts for the state, after a lawless Gov. Kay Ivey joined with lawless legislators in the gerrymandered statehouse to defy SCOTUS, the Rule of Law and the U.S. Constitution. Alabama is now appealing the ruling to the same U.S. Supreme Court Justices who rejected their arguments barely three months ago.
  • The story is similar in authoritarian Governor and Presidential candidate Ron DeSantis' lawless state of Florida this weekend. In this case, a state court judge on Saturday ordered the state legislature to draw a new U.S. House map restoring a Black-majority district in Northern Florida that DeSantis had personally ordered state lawmakers to break into pieces and divvy up its Black voters into White Republican districts. The weekend's court order would seem to be good news. However, the State will now appeal the ruling directly to its Supreme Court where DeSantis has hand-picked a majority of the Justices. As we have long been warning, the fight between Democracy and Autocracy (or Fascism, as one of our longtime listeners insists), continues into 2024.
  • Next, I finally catch up with a bunch of news on a growing story --- some of which we've been discussing over the past two years --- that I've otherwise been trying to get to for weeks, but for all of the various indictments, hurricanes, wildfires, debates, etc. continually sidetracking me. The news has to do with the continuing feeling I have that Donald Trump will ultimately not be on the ballot come next November. As noted, that's not a prediction or an inside scoop. It's simply a feeling for now, but one that I can't shake as an increasingly swelling body of evidence seems to support its possibility.

    Today, that evidence includes polling last month finding nearly two-thirds of Americans say they will either "definitely" (53%) or "probably" (11%) not support Trump in 2024. Might such numbers begin to grab the notice of Republican Primary voters? (So far, the answer is largely no. But we've got a long way to go --- and a lot of criminal trials --- before the GOP's nominating convention next July.) There are already a number of high profile Republicans calling on Trump to drop out of the race or noting that he very well may be Constitutionally disqualified entirely from the ballot.

    It is that part of this story today --- disqualification from the ballot via Section 3 of the 14th Amendment of the U.S. Constitution for his role in the January 6 Insurrection --- that we focus on today. Namely, the far-right, Federalist Society legal scholars who recently issued a 126-page law review paper [PDF] finding Trump to be Constitutionally ineligible for the ballot --- "cannot be president --- cannot run for president, cannot become president, cannot hold office" --- due to his roll in the January 6 insurrection.

    And now, there is a host of state Secretaries of State --- both Republican and Democratic --- around the country who are currently or soon to be grappling with the decision as to whether Trump is even eligible to be on their state ballots in 2024.

    Among those Secretary of State's discussed today, after they recently offered various opinions on the matter: New Hampshire's David Scanlan (R); Ohio's Frank LaRose (R); Arizona's Adrian Fontes (D), New Mexico's Maggie Toulouse Oliver (D); Maine's Shenna Bellows (D) and Michigan's Jocelyn Benson (D). (Benson gets credit for the first part of today's headline. REO Speedwagon gets credit for the alternate hed.)

On today's BradCast, it's special coverage of the first GOP Presidential Primary debate of the 2024 campaign. It featured eight candidates, none of which were named Trump, But he was there anyway. [Audio link to full show follows below this summary.]

The raucus two-hour debate in Milwaukee, Wisconsin was sponsored by Fox "News" and held before a rowdy audience of booing and cheering Republicans who, at times, resembled a pro wrestling crowd --- or a lynch mob --- more than supporters of an American political party.

The actual participants on the stage were (in order of polling popularity before the debate): Florida Gov. Ron DeSantis; 38-year old entrepreneur Vivek Ramaswamy (who, if you hadn't heard of him before last night, you probably have now); Former Vice President Mike Pence; Former South Carolina Gov. and U.N. Ambassador Nikki Haley; Former New Jersey Gov. Chris Christie; South Carolina U.S. Senator Tim Scott; Former Arkansas Gov. Asa Hutchinson; North Dakota Gov. Doug Burgum (who, if you hadn't heard of him before last night, you may still have no idea who he is today.)

We're joined today by some favorite BradCast special coverage guests to try and make sense of it all. (Which was no easy feat, frankly!) HEATHER DIGBY PARTON is a longtime, award-winning columnist at Salon and founder of Digby's Hullabaloo blog; "DRIFTGLASS" is otherwise known as both @Mr_Electrico on the site formerly known as Twitter and occasional as just "Bill" back at home in "Flyover Country, Illinois" where he produces the weekly Professional Left Podcast.

POST-SHOW UPDATE: The judge quickly approved Willis' request for an October 23 trial, but only for Trump attorney Ken Chesebro (alleged architect of the fake electors scheme), who invoked Georgia's speedy trial law. The other defendants do not yet have a trial date. So The Cheese stands alone...

There is no small amount of irony throughout today's BradCast, as Republican lawmakers threaten to impeach a newly elected state Supreme Court Justice just days after she was sworn in. Do they think we don't remember how they pretended to be outraged(!) in 2020 and 2021, charging Democrats were offending voters with attempted "election nullification" by twice impeaching the former President at the end of his four-year term?

Before we get to that mess in Wisconsin today, speaking of The Former Guy, two of his co-defendants in his fourth criminal indictment of the year (the RICO case in Georgia for his attempted to steal the 2020 election there) surrendered at a Fulton County jail on Tuesday. John Eastman and Scott Hall both turned themselves in after arranging to be released on bond after booking.

Eastman is the far-right Trump attorney and architect of the unlawful/unconstitutional failed scheme to have then Vice President Mike Pence toss out legitimate Electoral College votes on January 6th, 2021. Hall, little known to most of the nation but well known by now to longtime BradCast listeners, is the Atlanta bail bondsman (well, that'll come in handy!) who confessed to frequent guest on this program, Marilyn Marks of the Coalition for Good Governance, that he helped run the unlawful MAGA breach of Georgia's sensitive voting system hardware and software in Coffee County, GA on January 7th, 2021.

Marks had the wherewithal to record Hall's phone call to her. We aired it for the first time on this program last year and have been closely covering the Coffee County breach ever since (even as GA Sec. of State Brad Raffensperger appears to still be covering it up.) That scheme, part of a multi-state conspiracy, was allegedly hatched in Trump's Oval Office in December of 2020, and paid for by another co-defendant, Trump attorney Sidney Powell, and plays a key role in the 41-count grand jury RICO indictment [PDF] secured last week by Fulton County D.A. Fani Willis. More surrenders, including Trump's own, are to come this week before the Friday deadline, after which Willis has vowed to seek arrest warrants.

As that plays out in the Peach State, desperate Republican lawmakers in the Badger State may be seeing the writing on the wall. Their 15 years of autocratic, partisan gerrymandered majority rule of both chambers of the Wisconsin state Legislature may finally be coming to an end following the statewide landslide election victory last April of Janet Protasiewicz to the state Supreme Court.

On August 1, Justice Protasiewicz was finally sworn in (as pictured above), giving liberals on the High Court a 4 to 3 majority for the first time in some 15 years. The next day, August 2, the first of two petitions was filed with the Court seeking a ruling that the GOP's extreme partisan gerrymandered Legislative maps for both the state Assembly and Senate are unlawful violations of the state's Constitution. Plaintiffs seek not only new, fair maps in advance of the 2024 elections, but they are also asking the Court to order an emergency special election for all seats in the Senate next year. According to plaintiffs, current office holders "lack legal entitlement" to hold those seats due to the unlawful maps in place since 2011, as first approved by the state's hard-right radical then-Governor Scott Walker.

Republicans are both furious and terrified about the two new lawsuits filed by voters, leading current, far-right Assembly Speaker and autocracy fan, Robin Vos (arguably one of the biggest benefactors of the states "rigged" maps), to float the idea of impeaching Protasiewicz if she fails to recuse herself from both cases. Vos argues that, during her campaign earlier this year, Protasiewicz "prejudged" the cases by describing the obviously unfair maps as both unfair and rigged.

There are a whole bunch of problems with Vos' argument, one that was laughably shared in a recent "intemperate dissent" penned in response to these cases by Walker-appointed Justice Rebecca Bradley.

Longtime BRAD BLOG legal analyst ERNEST A. CANNING has been closely following and writing about the matter. He joins us today to detail the allegations against Protasiewicz, the hypocrisy of Bradley, and the constitutional crisis that could occur in the Badger State if Vos moves ahead with impeachment and removal by the state's Republican gerrymandered Assembly and Senate.

"For the Republicans to hold on to a 2/3rds majority in the Senate, even when they received as little as 45% of the vote, tells you what they've done. This is a deeply anti-democratic project," Canning explains. "If they're willing to impeach simply to hold on to power, that in itself is a direct assault on democracy. Particularly when you consider the argument that they really don't have a legal basis for the seats they are holding right now."

GOPers in gerrymandered state legislative seats float possibility of removing newly elected Justice over state gerrymandering case...

If acted upon, a recent threat by Wisconsin's Republican Assembly Speaker Robin Vos to impeach newly seated state Supreme Court Justice Janet Protasiewicz could give rise to a Badger State constitutional crisis --- albeit, a crisis that can be somewhat ameliorated by the ability of Wisconsin's Democratic Governor Tony Evers to appoint her replacement.

The political gamesmanship that could play out in the weeks ahead, thanks to sore loser Republicans in the state's gerrymandered Legislature, may rival or even surpass some of the worst partisan excesses of the fading Scott Walker era.

As detailed last week, Wisconsin voters, mathematicians and computer scientists filed a pair of petitions (Clarke v. Wisconsin Election Commission and Wright v. Wisconsin Election Commission) directly with the Wisconsin Supreme Court earlier this month.

Petitioners seek to break the chains of the GOP's 12-year entrenched and politically-engineered control of both chambers of the Badger State legislature --- control that was and is the product of what petitioners allege to be unlawful extreme partisan gerrymandering.

The petitions, consistent with a dissent issued by three of the Court's liberal justices last year in Johnson v. Wisconsin Elections Commission, allege that the Badger State's existing Legislative maps violate voter rights as guaranteed by multiple provisions of the Wisconsin Constitution.

The voters' petition in Clarke not only seeks the creation of fair state Senate and Assembly maps in time for next year's election, but also seeks the issuance of an emergency writ that would schedule a Special Election for those WI Senators whose terms would not otherwise expire until 2027. The voter petitioners argue that all currently serving state Senators "lack legal entitlement" to their respective offices because they were procured via unconstitutionally configured districts.

Vos, who owes his position as Speaker to those partisan gerrymandered maps, claims Protasiewicz "prejudged" the outcome of the new cases during her campaign for the seat earlier this year. He threatened to impeach her if she dared take part in the pending challenges. That "prejudgment" accusation, however, would be far more apt when applied to right-wing WI Supreme Court Justice Rebecca Bradley when, last year, she joined with the right wing majority, in Johnson --- a decision, which, per the dissent, violated Wisconsin's constitutionally-mandated separation of powers by overriding a governor's veto in order to saddle the electorate with the Republican-drawn, partisan gerrymandered Legislative map.

Bradley authored an intemperate dissent in the new cases...

Also: Hurricane Hillary eyes Southern CA and/or AZ...

Among the stories covered today that (largely) have nothing to do with felony indictments...

  • Hurricane Hilary spins up suddenly off the coast of Mexico and is now gaining strength amid an El Nino. The storm is said to be heading north to make what could be an "exceedingly rare" landfall over the next few days somewhere here in Southern California or along the Baja Peninsula before moving up and into Arizona --- if you believe scientists who are experts in this sort of thing.
  • The gerrymandered Republican state legislature in North Carolina on Wednesday overrode vetoes by Democratic Gov. Roy Cooper to enact new laws that are unspeakable cruel to, among others, transgender children. If you are unaware, we explain exactly why these types of laws --- now adopted by 22 GOP-controlled states (though being challenged in court in most of them) --- are so awful and cruel. That is, unless you are a Republican, like those who stole control of the NC legislature, who believe Big Government should intercede between doctors and patients and that so-called "parental rights" should also be overruled by Big Government autocratic fiat.
  • Speaking of autocracy, gerrymanders and Big Government Republicans now dictating to small, local government and voters...the morally and ethically broken GOP-controlled state legislature in Texas has recently passed a law to oust the chief election official in Harris County (Houston) --- and only in Harris County --- just months before upcoming municipal elections in the state's largest and most Democratic-leaning County. A state judge this week found the new law in violation of the Lone Star State's constitution. But, just hours later, the state put that ruling on hold by appealing it to the TX Supreme Court (all Republican). The November elections are now just weeks away and, unless something changes quickly, will apparently be run by the Harris County Tax Assessor-Collector who has zero experience running elections and had nothing to do with the months-long planning for the one where early voting is set to begin next month.
  • In far more encouraging news about autocracy, gerrymandering and, in this case, democracy, we head to the great state of Wisconsin. On August 1, Justice Janet Protasiewicz became the state Supreme Court's newest member after being elected earlier this year. Her landslide (for Wisconsin) 11-point victory in April means that liberals now hold a majority on the state's High Court for the first time in about 15 years. On August 2, a group of petitioners filed with the state Supremes to not only force new, fair legislative maps for the state's House and Senate for the first time in more than a decade, but also for emergency elections next year for all members of the state Senate, many of whom will not otherwise face reelection until 2026 despite occupying seats that petitioners argue are held only thanks to the GOP's unconstitutional partisan gerrymanders. BRAD BLOG legal analyst Ernie Canning wrote about this challenge to the state's illicit, entrenched legislative majorities this week and the potentially very good news it represents for Badger State voters. Just after airtime today, however, he updated his article with...well, some more good news but also...some troubling news about the gerrymandered GOP's new scheme to undermine democracy, the rule of law, the state constitution and state voters with impeachment proceedings against Protasiewicz in hopes of stealing back the Court to hold onto their entrenched, corrupt state legislative majorities. (See Ernie's UPDATE today on that story for more details.)
  • Then, a bit of listener mail in response to my apparently controversial suggestions of late that Donald Trump may very well not be on the general election ballot by November of next year.

We've got more Special Coverage on today's BradCast of the fourth --- and, theoretically, last, but who knows? --- criminal indictment of our disgraced former President for the Summer season. [Audio link to full show follows below this summary.]

On Monday's show this week, just hours in advance of the massive new criminal charges out of Georgia, we detailed the dangers to next year's elections of the illicit Coffee County, Georgia voting system software breach carried out by Trump supporters beginning on January 7, 2021 (and covered up in the many months that followed by Sec. of State Brad Raffensperger). The scheme --- which we helped break last year and have been covering ever since --- is now known to have been just one part of a multi-state conspiracy organized by Trump attorney Sidney Powell and hatched inside Trump's Oval Office in December of 2020. It remains a huge threat to the security of next year's Presidential elections across the entire state of Georgia and in more than a dozen states with jurisdictions using the same breached, proprietry hardware and software that was stolen from Coffee County.

On Tuesday's show, we detailed the sprawling 97-page RICO indictment [PDF] of Donald John Trump and 18 co-conspirators charged with 41 felony counts by a grand jury in Fulton County, Georgia late on Monday. The charges are related to Trump's alleged (and failed) criminal enterprise to steal the 2020 Presidential election in the Peach State (and elsewhere) and comes out of the two-year probe by Fulton County, D.A. Fani Willis. We broke down all of the charges, detailed those who were indicted, along with a focus on the specific charges brought against Powell and the three others facing several counts related specifically to conspiracies to commit Computer Theft, Computer Trespass, Computer Invasion of Privacy ("with the intention of examining personal voter data") and Conspiracy to Commit Election Fraud as part of the Coffee County scheme.

The new indictment brings the number of criminal felony charges that our disgraced former President is now personally facing in four different jurisdictions at both the state and federal level to a gob-smacking 91!

And then on today's program, our hot indictment summer continues, with both legal and political analysis of the new indictment with two old friends. New indictments did not yet come in Georgia as of airtime on today's BradCast. But, as the nation awaits the former President's almost certain fourth criminal indictment in about as many months --- and this could be the broadest and most sweeping yet --- a somewhat related "exclusive" by CNN on Sunday seems to have made a lot of folks suddenly pay attention to a story we've been covering in great detail on this show and at The BRAD BLOG for the better part of the past year.

The Coffee County, Georgia voting system breach by Trump supporters is likely to play a role in the expected new indictments from Fulton County District Attorney Fani Willis, even though there was largely nothing "exclusive" at all about CNN's weekend report. At least to those of us who have been paying attention and reporting on it ourselves for the past year. But, that's okay. If CNN's coverage makes people sit up and pay attention to this critical issue, we'll take it.

If it helps people --- including other media outlets --- notice that the multi-state conspiracy is still either being ignored or actively covered-up by the folks who SHOULD be investigating it --- from GA Sec. of State Brad Raffensperger, to the Georgia Bureau of Investigations (GBI) and even the Dept. of Justice --- then, okay, bring on more such "exclusives".

CNN's Sunday report, deceptively headlined "Exclusive: Georgia prosecutors have messages showing Trump’s team is behind voting system breach," repackages material already reported long ago by outlets like Washington Post, Atlanta Journal Constitution, Atlanta's NBC affiliate 11-Alive and, yes, The BradCast and BRAD BLOG. Almost all of CNN's material comes thanks to information discovered in a long-running federal lawsuit challenging the use of Raffensperger's new, unverifiable and insecure touchscreen voting systems, as filed years ago by the Coalition for Good Governance (CGG). CNN didn't even have the decency to name the nonprofit group in their "exclusive", referring simply to material "originally unearthed as part of a long-running civil suit focused on election security in Georgia."

As to the content of the story well, see our program from April headlined: "The Multi-State MAGA Conspiracy to Breach Voting Systems Was Hatched in Trump's Oval Office: 'BradCast' 4/24/2023". That show, from four months ago, features most of what CNN describes in their weekend "exclusive".

On that program, we were joined by guest SUSAN GREENHALGH, a election integrity and transparency expert who now serves as Senior Advisor on Election Security at FreeSpeechForPeople.org. Greenhalgh had discovered admissions in sworn testimony given to the U.S. House January 6 Committee revealing that the plot to have MAGA activists unlawfully obtain and copy sensitive, proprietary voting and tabulation system hard drives in multiple states (Georgia, Michigan, Nevada, Pennsylvania) was a scheme dreamt up during Trump's crazy December 18, 2020 meeting in the Oval Office with attorneys Sidney Powell and Rudy Giuliani, disgraced National Security Advisor Michael Flynn, former Overstock.com CEO and billionaire Patrick Byrne and others. Yes, the breaches in several states were not over-zealous local MAGA activists. It was a scheme hatched with the President of the Unites States himself.

Greenhalgh joins us again on today's program to continue connecting dots in the multi-state criminal scheme which remain uninvestigated or prosecuted to this day. (Pay attention, or wait to read them at CNN in about 6 months as "exclusive".)

Were it not for folks like Greenhalgh and CGG founder Marilyn Marks --- who had the wherewithal to hit the record button when one of the apparent MAGA breachers (Atlanta businessman Scott Hall) called her to essentially confess to the crimes in Coffee County --- we might not even know about it today. Lord knows Raffensperger and his friends in the Peach State have largely been covering it all up ever since the breach first occurred on January 7, 2021, the day after Trump's insurrection at the U.S. Capitol.

"Who knows if there were other counties that they went into in Georgia?," Greenhalgh observes. "There might have been similar breaches in other counties. Because we've lacked a real, robust investigation from the people that are paid to protect our citizens and our government from these types of illegal activities, they haven't uncovered it!"

Charges were recently brought against some of the participants in Michigan's several breaches --- at least five of whom are also known to have been involved in the Georgia breach --- and charges may soon be brought against some of them by Willis in Georgia in the coming hours. But, as Greenhalgh argues, the threat posed by theses breaches to next year's 2024 election --- and accountability for all of the people who allowed it to happen --- is crying out for a federal conspiracy probe of this organized crime that took place in multiple states following the 2020 election.

"There's no deterrence," Greenhalgh asserts. "What we saw happen in Coffee County --- if these people do not face any consequences, the message that is being presented is, 'It's okay. Go ahead and do this. If you can get a complicit election official, go in and do whatever you want to the voting machines and nothing is going to happen to you.' This crime happened on videotape. There's no question about it. If this was a corner store robbed by some kids, they'd be in prison by now."

Finally today, some very good news out of Montana, where a landmark legal challenge by young plaintiffs, aged 5 to 22, challenging Republican state lawmakers for failing to follow the state constitution's mandate guaranteeing a "clean and healthful environment," was victorious! The court found that the Montana Environmental Policy Act, which weakened environment protections on behalf of the state's fossil fuel industry, is unconstitutional. The first-of-its-kind ruling by a judge in the U.S. may very well affect similar suits by youth plaintiffs as now filed in all 50 states and nations around the world...

Elections have consequences.

Recently, in "The Darkest Hour is Just Before Dawn", we described how the decision by the U.S. Supreme Court's corrupt, right-wing "radicals in robes" last year to overturn the Constitutional right to an abortion led directly to the election of pro-choice Wisconsin Supreme Court Justice Janet Protasiewicz "by 11 percentage points, a huge margin in a narrowly divided state," as The New York Times described it.

On Aug. 1, the new Justice was seated, thereby flipping the WI's Supreme Court from a 4-3 right-wing majority to a 4-3 liberal majority for the first time in more than 15 years.

The very next day, on Aug. 2, state voters filed a Petition [PDF] directly with the WI Supreme Court. In Clarke v. Wisconsin Elections Commission, petitioners seek to break the chains of the GOP's 12-year entrenched control in both Houses of the Badger State legislature --- control that was and is the product of what petitioners allege to be unlawful, extreme partisan gerrymandering.

Two days after that, a second Petition [PDF] (Wright v. Wisconsin Elections Commission) was also filed in the WI Supreme Court by a group of mathematicians and computer scientists. In addition to presenting essentially the same legal challenge, the Wright petitioners bolstered both cases with objective scientific evidence establishing that the 2011 and 2021 Wisconsin legislative maps are the product of unlawful gerrymandering.

Both petitions are based upon a scathing judicial dissent issued last year in Johnson v. Wisconsin Elections Commission. In their dissenting opinion, the Court's three liberal Justices --- then in the minority --- opined that the WI Supreme Court's right-wing majority usurped the constitutional functions of the Badger State's other branches. In Johnson, the Court's then-majority overrode Democratic Governor Tony Evers' veto of the 2021 gerrymander after Badger State Republicans in the Legislature failed to muster sufficient votes to override the Governor's veto on their own. Both petitions and the dissent identify multiple provisions within the WI Constitution that were violated by extreme partisan gerrymandering.

The Clarke Petition not only seeks to replace the partisan gerrymandered map with a fair map in time for next year's legislative elections but also seeks an emergency writ that would schedule a 2024 special election for all Badger State senators, including those whose terms would not otherwise expire until 2027. This is based upon the argument that all state Senators "lack legal entitlement to their office" because their respective offices are the product of unconstitutionally configured districts.

The Petitions, however, do not seek to redress Wisconsin's partisan gerrymandered Congressional map which helped hand Republicans six of the Badger State's eight seats in the U.S. House of Representatives, in a state where almost all statewide seats are now held by Democrats and where Joe Biden won in 2020...

Guest: Maui radio veteran Shaggy Jenkins; Also: Record U.S. storm damage; Tim Scott's climate change lies; Listener mail and more...

The death toll stood at 36 as we went to air on today's BradCast, with nearly 300 structures confirmed as destroyed. But officials have since bumped up the confirmed death toll to 53, with more than 1,000 homes and buildings destroyed in the town of Lahaina and surrounding areas on Hawaii's island of Maui. According to our guest today, who has been on the ground there since the blazes were first sparked on Tuesday, those numbers could still get far worse as he describes what has happened in his community as if "Hell opened its mouth."

You have likely heard, by now, that devastating wildfires were whipped up this week in Hawaii, amid near hurricane force wind gusts from the northern edge of Hurricane Dora, passing about 500 miles to the south. The high winds made it impossible for firefighting helicopters to snuff out the blazes in their early hours on Tuesday. Those fires then grew out of control amid dry and windy conditions over the next two days.

Officials are still battling to contain the fires as search and rescue efforts are ramping up, even as they attempt to find shelter for displaced residents and tourists in the once tropical paradise.

We're joined today by radio veteran SHAGGY JENKINS from Maui, where he formerly served as the longtime Program Director at our affiliate station there, KAKU 88.5FM. Jenkins now serves as Operations Manager for a group of Hawaii stations and has been putting in a ton of overnight on-air hours along with his regularly scheduled morning show, to try and help keep the community informed over our public airwaves during the ongoing emergency.

In addition to the firestorms that seemingly sprang up from nowhere and have leveled much of the historic, 1700s-era town of Lahaina --- once the Hawaiian kingdom's capitol city --- on the western side of Maui, Jenkins explains that fires are also raging somewhat to the east and on the Big Island as well.

"Although Lahaina made a lot of national headlines, parts of the neighborhoods upcountry, far away from Lahaina, have also had devastation. We've had complete neighborhoods and subdivisions wiped out for local families," he tells me, describing scenes that look more like bombed out cities of post-WWII Europe or in Ukraine today. "It's on a scale that we've never seen. It's just exhausting to look at, because it's still happening. I don't know how to describe Lahaina other than it's like Hell opened its mouth."

I hope you'll tune in for this must-listen conversation, particularly if you both want to know what appears to have happened and how you can help.

"It's all gone," laments Jenkins, as he becomes swept up in emotion describing the fate of Lahaina, "one of the most historic cities in the entire state."

"It's kind of hard to put into scale how much history, and how much of our old families that were born here and raised for generations, have lost everything. Some of the places that have been devastated --- they're the postcard images that you send everybody when you come to a vacation here. And they're all gone."

"The families that lived in those areas ... they're gone ... I'm sorry ... It's hard," he tells me as he chokes up, "...because we on the island, we're very close, as far as the local population. We know everybody."

Jenkins details how environmental conditions have changed in recent years as our climate crisis has taken a toll in drying out the once idyllic tropical paradise, and as "Big Ag" sugar operations up and left behind unrestored swaths of land.

"It is appreciably different" in recent years, he explains. "Part of the reason for that, not too long ago, we shut down the sugar industry here. The center body of the island is mostly ag land. And when the sugar industry left, a lot of that land went barren waiting for different owners. As all of these changes have happened, it's dried out the island. For the past five years, we have seen more and more brown than we usually do. Those conditions --- those dry, big, open-area fields --- were some of the reasons that the fires here spread so much. And since the sugar industry ended, we have had a step up in our wildfires."

One of the biggest ways we can help, Jenkins says, is to not come to Maui right now. While the island thrives on the tourism industry, now is not the time, as empty hotel rooms are being used to help house those who have lost everything. "We do not have the water, we do not have the power, we do not have the space," he asserts, noting that he is not "anti-tourist", but "every single resort that we have that has an empty room, we are trying to put in a local displaced family."

"The way that you can help us, the best way, is to stay away, and let us have the time to find and bury our dead, to fix our broken infrastructure. And, sadly, to start the very dangerous and long, arduous process of rebuilding one of the most historic cities in the state."

  • Reinsurance giant Swiss Re Group released a report asserting that severe thunderstorms during the first half of this year in the U.S. have resulted in unprecedented levels of damage, including some $34 billion in insured losses. That number accounted for 70% of the $50 billion in global catastrophic damage from similar storms over the same period.
  • All of this, even as 2024 Republican (Vice-)Presidential hopeful and U.S. Senator Tim Scott of climate change-threatened South Carolina took to Fox "News" on Wednesday with faux outrage claiming that the idea that we are facing a "climate emergency is ridiculous"(!) Of far greater import, he asserted, is that "we have a border emergency that is an existential threat right now." Desi Doyen has a few choice words for the embarrassing Senator, who apparently hasn't noticed the actual existential threat of climate change, right now, which has, over the same 24-hour period during which Scott was blathering his dangerous, wingnut, fossil-fueled disinformation on Fox, taken the lives of at least 53 of Scott's fellow American citizens in Hawaii. That, just days after hundreds have died from prolonged extreme heat in places like Arizona.

It was a great day for democracy in Ohio on Tuesday. And how often do we get to say that on The BradCast? [Audio link to full show follows below this summary.]

But first, it's not a great day for our friends in Maui, Hawaii, where windswept wildfires have leveled homes and businesses and a historic town; killed at least six and injured dozens so far; and sent some residents fleeing into the ocean to avoid the flames. That, as wind gusts above 60 mph --- part of Hurricane Dora passing about 500 miles safely to the south --- kept firefighting helicopters out of the sky, while climate change-fueled dry conditions and non-native, non-drought tolerant plant species (brought there by humans) went up like torches. Sending our best wishes to our listeners at our affiliate station, KAKU 88.5FM, "The Voice of Maui"! Please drop us a line when you can to let us know how you're doing!

Moving on from that terrible news, to much better news out of Ohio last night, where democracy was literally on the ballot. The Buckeye State GOP's anti-democracy constitutional amendment, known as Issue 1 on Tuesday's special election ballot, went down to huge defeat by some 13 points --- 57% to 43% --- according to the latest unconfirmed tallies. The measure, which could have passed with a simple majority, would have changed the state constitution to require 60% voter approval for all future constitutional amendments. As it turns out, voters don't like voting their own democracy away.

As Ohio's Sec. of State Frank LaRose was eventually caught on tape admitting to supporters --- after claiming for months it had nothing to do with abortion --- the measure was "100% about abortion". It was meant to preempt a citizen-led ballot initiative set for this November that will codify reproductive freedoms into the constitution of the otherwise right-leaning and wildly gerrymandered state.

We spend some time today explaining what happened, why it happened, and just how extraordinarily corrupt and hypocritical the measure's lead proponent, LaRose, actually is, as he hopes to become the state's GOP nominee to square off with Ohio's Democratic U.S. Senator Sherrod Brown next year. Good luck after Tuesday's $20 million, anti-democracy boondoggle, Frank!

But what happened in Ohio on Tuesday is reverberating throughout the nation today and will, almost certainly, continue to reverberate into next year's 2024 general election. It is also giving hope to a lot of otherwise "deep red" states, proving again that their citizenry can also successfully push back against GOP forces of hypocrisy, anti-democracy and pro-autocracy. Even in states like "deep red" Alabama.

We're joined today by ROBIN MARTY, Operations Director at the West Alabama Women's Center, and the prescient author of 2019's The New Handbook for a Post-Roe America and The End of Roe v. Wade: Inside the Right's Plan to Destroy Legal Abortion.

Marty, as you might guess, is elated about the great news out of Ohio. "Of course, I am very excited about it," she says, before adding: "I'm not surprised, though. This is yet another in a series of wins for abortion rights when it is put up to a statewide vote." Indeed, every time a measure even tangentially related to reproductive rights has appeared on a statewide ballot since the corrupt U.S. Supreme Court overturned Roe v. Wade last year, reproductive freedoms have ultimately won. That is true in both "red" and "blue" states alike.

But Marty also shares just some of the authoritarian horror still playing out in her own home state where abortion has now been banned entirely by state Republicans, and where her West Alabama Women's Center still offers much-needed healthcare for woman...but may no longer provide them with abortion services.

Most incredibly, as Marty tells details today, the medical professionals at her clinic are not even allowed, by law, to tell patients where they might go --- which states or clinics --- to receive lawful abortion care elsewhere. That, she says, could result in felony charges and up to 99 years in prison. In fact, she wasn't even certain she could tell me about that on air!

"The moment it became illegal in our state, not only did we have to stop every bit of abortion care that we were doing in the clinic," she explains, "our Attorney General made statements saying that, in his opinion, he believed that providing a person with information about how they could access abortion care somewhere else would, in fact, constitute a criminal conspiracy. And people could be arrested over that."

The center has just filed suit against the state A.G., hoping to win back their free speech rights. As the ACLU describes the case, the lawsuit was last month "in federal court to prevent Alabama Attorney General Steve Marshall and district attorneys throughout the state from prosecuting those who assist Alabamians seeking to travel across state lines to access abortion care where abortion is legal. Attorney General Marshall has explicitly threatened that health care providers could face felony charges for assisting Alabamians seeking to travel out of state to obtain abortion where it is legal."

The health care providers are fighting the law adopted by the very same hypocritical GOP lawmakers who pretended to be "outraged" about "Big Government coming between a patient and their doctor" during the passage of ObamaCare in 2010. And the very same ones who, today, are pretending to be "outraged" about Trump being prosecuted for "nothing more than exercising his Free Speech rights!" (that's not why he is being prosecuted) and pretending to be concerned that social media sites are "censoring" rightwing opinions.

Democracy can reverse the damage wrought by corrupt, right-wing Supreme Court ideologues...

When our corrupted U.S. Supreme Court, in June, handed down their closing opinions for last year's term, it became clear that we are facing a dark judicial hour in this nation.

Dark for women whose reproductive liberty and very lives have been placed at risk; dark for those who are drowning in seemingly insurmountable student debt; dark for those in the LGBTQ+ community who are seeing their very existence and right to medical care being challenged; dark for young African-American students hoping to acquire a higher education so as to overcome our nation's legacy of systemic racism; dark for the families of the ever-growing number of victims of mass shootings.

Our judicial institutions, for the moment, are still holding when it comes to accountability for the scoundrel who served as our 45th President. But, for too many others, the High Court has wrought a darkness brought on by the corrosive influence of the billionaire class and the "dark money" that billionaires and corporations use to corrupt our political and legal institutions.

That darkness comes courtesy of the Supreme Court's infamous 2010 Citizens United decision. It is a darkness also facilitated by political chicanery resulting in a Republican Party, which lost the popular vote in seven of the last eight Presidential Elections, packing a "corrupt" supermajority of six right-wing ideologues onto the nine-member High Court.

Their dark, radical interpretations of the Rule of Law have done more than simply endanger democracy's survival. By inventing a Second Amendment right of an individual to bear arms unrelated to military service in a State's "well-regulated" militia, the Roberts Court has become "destructive" of the first of the "unalienable Rights" listed in our nation's Declaration of Independence --- the right to "Life"!

Early last month, for example, CBS published a jaw-dropping U.S. statistic, citing "26 mass shootings in the first five days of July."

Yet, it is the dark and oppressive nature of the immensely unpopular decisions handed down by six unelected "radicals in robes", that, ironically, may help to facilitate a new dawn. The bright side of their decisions can be found in an incensed electorate, whose approval of the Court, as presently constituted, has plunged to a dismal 29%.

Democracy, as the late British MP Tony Benn described it, is "more revolutionary than socialist ideas." It is the light that can drive out the darkness.

The very existence of public revulsion towards the dark turn by the Court in recent years, such as overturning abortion rights and much more, make a 2024 Blue Tsunami possible. If the source of the darkness lies in the decisions of a corrupt and radicalized Supreme Court, then Democrats must convey a clear and coherent message that a vote for their candidates will serve to restore the light...including with reform of the Court itself...

Former Prez pleads 'not guilty' in election theft conspiracy; Also: U.S. credit rating cut thanks to 'fiscal conservatives'; WI GOP threaten 2024 election administration; MI GOP A.G. nominee charged with vote machine tampering; Willis threatened, but 'ready to go' in GA...

Ten years ago, a BradCast like today's would have been unimaginable. Today, it's just our latest BradCast. [Audio link to full show follows below this summary.]

Among our many stories covered (some of which we've been trying to get to all week but for all the breaking news that kept bumping them!)...

  • The former President of the United States pleaded "not guilty" to felony crimes in his third arraignment in four months. This one at the federal courthouse in D.C., on four alleged charges [PDF] brought by Special Counsel Jack Smith related to Donald J. Trump's failed conspiracies to steal the 2020 Presidential election before, during and after his January 6, 2021 insurrection. Defendant Trump was reportedly warned by the magistrate judge overseeing his arraignment about committing more crimes, tampering with jurors or communicating with co-conspirators while he was freed pending trial.
  • Congressional Republicans still pretend they are "fiscal conservatives". Shamefully, the media still allows them to do so. But their brand of "fiscal conservatism" is, once again, costing the Government and American people untold billions. This week, the Fitch Rating service downgraded the U.S. credit rating from top tier AAA to AA+, citing principally the GOP's recent brinkmanship threatening to allow the U.S. government to default on its debts for the first time in history, and even due to the January 6, 2021 attack on the U.S. Capitol. The newly lowered credit rating led the stock market to dive in response, is already increasing the cost of government borrowing and mortgage rates for homeowners.
  • On Tuesday, the state Supreme Court in Wisconsin officially flipped to a liberal majority for the first time in about 15 years after the election of Milwaukee Judge Janet Protasiewicz to the high court back in early April. The new era in the critical Presidential battleground state comes not a moment too soon, as Republicans in the gerrymandered state Senate are attempting to oust Elections Administrator Meagan Wolfe from the state's Election Commission after unanimously appointing her four years ago. When Trump lost the state in 2020, state Republicans decided the experienced administrator who has successfully overseen thousands of state election jurisdictions and is well-respected by clerks and experts of all parties, had cheated --- or didn't cheat enough --- or something. And now, amusingly, Democrats on the Election Commission are citing a ridiculous, 4 to 3 opinion by the state Supremes from last year, when the court had a rightwing majority, which allowed agency heads to remain in place after their term had ended. (The ruling was meant to support a sleazy GOP scheme to prevent Democratic Gov. Tony Evers from being able to appoint his own nominees to state agencies.) The 2024 election in the critical battleground state now hangs in the balance and may --- or may not --- as Bolt's Cameron Joseph reports, lead the Court's liberals to change their position on the issue when this matter, almost certainly, makes it's way to the newly liberal high court.
  • Michigan's failed 2022 Republican candidate for Attorney General, Matt DePerno, was indicted this week along with a former GOP State Rep. on state charges related to accessing and tampering with voting systems. The Trump-endorsed Matt DePerno was a 2020 election denier already under investigation for the alleged crimes when he was nominated by his party to become the state's top law enforcement official last year. State Attorney General Dana Nessell then referred the probe to a Special Prosecutor who brought charges this week against DePerno, former State Rep. Daire Rendon and, as we've learned since getting off air, GOP attorney and Trump ally Stefanie Lambert. The Special Prosecutor, D.J. Hilson, suggests more charges are likely coming as part of a scheme by the MAGA Republicans to take voting system tabulators from several counties in order to "test" them for...something or other. Lambert and four others targeted by the probe, also participated in the breach of sensitive voting system hardware and software in Coffee County, Georgia, a story which we broke on this show last year and have been covering in detail ever since.
  • Speaking of Georgia, election deniers, voting system breaches and GOP attempts to steal the 2020 election, Fulton County District Attorney Fani Willis, over the weekend, said she is "ready to go". She made the remarks to a local news outlet, suggesting she will be bringing indictments in her broad conspiracy probe of Team Trump's failed attempt to steal the Peach State's 2020 election "before September the first of 2023". Willis recently warned County officials to "stay alert" and keep staffers "safe" as barricades have now been erected around the County Courthouse in anticipation of new indictments. In her warning to County Commissioners, she shared a sample of the appalling, racist threats her office has received recently. All signs suggest that Trump --- and perhaps many others --- are about to be indicted in her probe. It would be Trump's fourth such criminal indictment in the past four months. We told you long ago accountability would be coming. Now, it finally is. Bigly!
  • Finally, Desi Doyen joins us for our latest Green News Report, with a climate in crisis that couldn't care less about politics. A new study finds that man-made climate change is getting very costly for small businesses; record high temps are, ironically, forcing the shut down of oil refineries and raising gas prices in the bargain (neat trick, eh?); and, speaking of Georgia, the state has finally opened the nation's first new nuclear plant in decades. It is already costing state ratepayers a lot more money...
