With everything else going on both here in the U.S. and around the world you can be forgiven for losing track of the fact that next Tuesday is an important off-year Election Day in a number of states, including Kentucky, Mississippi, New Jersey, Ohio, Virginia and elsewhere. On today's BradCast, we try to get you caught up on a number of key contests and the stakes for what will be seen next week --- correctly or not --- as bellwether elections in advance of next year's critical 2024 Presidential contest. [Audio link to full show follows this summary.]

There are some interesting Gubernatorial races next week. In "deep red" Kentucky, the state's popular Democratic Governor Andy Beshear will be running for a second term. And in even "deeper red" Mississippi, dysfunctional infighting among state Republicans could translate into what would be a surprise, long-shot victory for Democratic candidate Brandon Presley. But, as our guest suggests today, elections tend to be won by the voters who show up.

In Ohio, as you may recall, back in August, Republicans attempted to use a last minute, single-issue Special Election to adopt a ballot initiative that would mandate all future amendments to the state Constitution require a 60% majority for passage, instead of a simple majority, as has been the case for over a hundred years in the Buckeye State. That measure, Issue 1, failed. It wasn't even close. Voters understood that it was clearly a scheme meant to derail a popular state Constitutional initiative to protect abortion rights scheduled for the November 7 ballot in response to the overturning of Roe v. Wade by the U.S. Supreme court last year and state GOP lawmakers adoption of a 6-week abortion ban with no exceptions for rape or incest.

Ohio's popular Republican Governor, Mike DeWine, has been lying to voters about next week's ballot initiative to protect reproductive freedoms by calling Issue 1 (yes, confusingly, it has the same name as the GOP's failed measure in August!) "too extreme" for Ohio. Of course, there is nothing extreme about it. Which is why state Republicans are lying to voters and even succeeded in convincing the state's GOP-leaning Supreme Court to allow them to use a "summary" of the measure on the ballot, rather than the actual text of the initiative (which was shorter!), to replace the word "fetus" with "unborn child". Hopefully Buckeye Staters don't fall for that scam either.

In Virginia, every seat in the General Assembly is up for grabs this year, as Democrats need to flip just a handful of seats to retake the majority in the state's House of Delegates and Republicans need to flip just two seats to take back the state Senate. At the same time, all new legislative maps this year have completely shaken up the Commonwealth, with the political future of Republican Gov. Glenn Youngkin apparently hanging in the balance. Whatever happens next week could well decide whether the termed-out Governor jumps into the 2024 GOP Presidential contest and/or adopts a 15-week abortion ban, which has been prevented to date by Democrats in the Assembly.

Those stakes may also help explain why Youngkin has worked so hard during his two years in office to prevent new voters from registering and to suppress the votes of certain types of voters.

We're joined today by VA's longtime progressive radio host and three-term Democratic former state Delegate MARK LEVINE to discuss what next week's elections mean for VA, for the nation, and for Youngkin's political future.

"I've long argued that Virginia is an 'indigo' state, which means it's mostly purple with a tinge of blue. I think, on average, we're going to very very closely vote Democratic," he tells me today regarding next week's contests. "Unfortunately --- or fortunately, depending on the year --- Virginia really is a very good bellwether for the United States. The same year we lost our House [of Delegates] in 2021, barely, the Republicans gained the [U.S.] House of Representatives, barely. Virginia really is an excellent bellwether. I would argue the nation is an indigo nation --- purple but ever-so-slightly blue --- and that's where we are. It really could go either way."

Levine explains that VA voter turnout in Presidential years is usually about 75% in the Commonwealth. In mid-term elections and off-year elections with a Governor's race, it's about 45%. Next week's race, he says, "is called the 'off-off elections'" when usually "only about 23% of Virginians show up. So what that means is whoever is angrier, that's who shows up. Are the MAGA Republicans angrier? Or are progressive Democrats angrier? I don't know. I would think abortion is very motivating. It will be a real test, because that's mostly what Democrats are running on."

"We had an election in 2017 that was a tie vote. They flipped a coin, and that's why we didn't control the legislature in 2017," he says. "The point is, one vote really can make a difference, particularly in these local races that decide the legislature. So I just want to urge anyone in Virginia, or anyone who knows someone who you think may still live in Virginia, please call them, remind them to vote. We've made it really easy. We have early voting now. You can go vote today, tomorrow, next day. The polls are open. They're close to your house. Get out and vote!"

Will the Democrats' focus on protecting reproductive freedoms in an ostensibly "blue" state, currently headed up by a Republican, work as well as it has over the past year in so many "red" states? Will the re-shuffling of legislative maps hurt or help Democrats? And will the results next week really help determine whether Youngkin decides to jump into the 2024 GOP Presidential contest? Levine has a lot of thoughts on all of those topics and many others, in our VERY lively discussion today!

Finally, Desi Doyen joins us for our latest Green News Report with a suspiciously larger-than-usual amount of not-terrible-news, including even some good environmental news out of the, yes, so-called "deep red" state of Kentucky...

Among our stories, first grim, and then much less so, today...

• We begin with the horrible news out of Lewiston, Maine, following Wednesday night's mass shootings that have, so far, resulted in 18 dead and another 13 wounded, with several still in critical condition. The state was largely shut down as of airtime, with a broad, statewide manhunt underway for the suspect who is alleged to have had serious mental health issues...but was still able to obtain a deadly, high-powered, military-style assault rifle for his rampage somehow, because...freedom!

• Similarly grim news out of Acapulco, where a climate change-fueled Hurricane Otis experienced explosive intensification off the Pacific Coast this week, as it spun up from Tropical Storm to a catastrophic Category 5 in just twelve hours time. As of airtime, 27 were confirmed dead in Mexico, with searches underway for more missing as authorities struggle to clear major roads of knee-deep mud and restore power to the battered resort city and nearby villages.

• All of that, amid what is likely to be the hottest year ever recorded, as Republicans in the U.S. House just elected a long-time climate science denier from the oil and gas state of Louisiana to be House Speaker. Rep. Mike Johnson received more money last year from the fossil fuel industry than any other. Since 2018, the far-right religious zealot has received some $240,000 from the industry. Some of it, as it turns out, came --- unlawfully --- from Russian oligarchs, according to FEC investigators last year.

• IN BRIGHTER NEWS...A federal judge in Georgia has ordered the state's legislature to reconvene to redraw its Congressional and state legislative maps before 2024, after being found in violation of the Voting Rights Act. The state must now add new Black-majority voting districts to all three of its maps. The judge's 516-page(!) ruling [PDF] issued today, finds the Republican-controlled legislature drew new maps following the 2020 Census which completely ignored the fact that ALL of the state's population growth since 2010 has been among the non-white population. U.S. District Judge Steven Jones has ordered one new Black-majority Congressional district, two new districts in the state Senate, and five for the state House by December 8, or he would have the maps drawn himself.

• More good news for U.S. Constitution lovers, this time in Colorado, where a state judge ruled on Wednesday that Section 3 of the 14th Amendment, the "Insurrectionist Disqualification Clause", is self-executing. In other words, public officials who have "engaged in insurrection" are simply disqualified from running for public office, even without a federal law detailing precise enforcement of the provision. Donald Trump, whose qualifications for the 2024 Presidential ballot have been challenged in a state lawsuit, argued to the contrary. But he lost. Next week, a hearing will be held to determine if the former President "engaged in insurrection", as per the Constitutional Amendment. Similar challenges to Trump's eligibility for office are also pending in Michigan and Minnesota.

• And good news for striking autoworkers, as the United Auto Workers union announced on Wednesday night that they reached a tentative agreement with Ford. The new four-year contract, if approved by workers, will boost base pay by at least 25%, increase starting hourly wages to $28/hour and includes a myriad of other benefits sought by the labor union. It is hoped that the agreement will also pressure management for a similar contract at the other two "Big Three" automakers, G.M. and Stellantis, where the UAW also began its walk-outs about six weeks ago. Chalk up yet another in a series of very big wins for organized labor over the past year!

• Finally, both good news and bad, as usual, with Desi Doyen in our latest Green News Report. A bad day in court for the former President is a good day for America and democracy. Happily, as reported on today's BradCast, it was a very bad day for the former President. [Audio link to full show follows this summary.]

Rudy Giuliani's attempted election theft sidekick, rightwing media darling, accomplished liar and opportunistically Christian Trump attorney Jenna Ellis offered a teary apology-ish in an Atlanta courtroom today, as she threw Rudy under the bus and pretended to be contrite for helping him and Donald Trump try to steal the 2020 election in Georgia.

Ellis was allowed to plead guilty to a single felony charge (she was originally charged with two) in Fulton County District Attorney Fani Willis' sprawling racketeering conspiracy indictment [PDF] against Trump and 18 co-defendants. She will receive no jailtime if she follows the terms of her plea deal and cooperates with prosecutors against her fellow co-defendants, which include Trump, Giuliani, Mark Meadows, John Eastman and others.

The manipulative Ms. Ellis (pictured above either crying or smiling following her remarks to the judge on Tuesday) boasted just last month about raising more than $200,000 for her legal defense in the case, which she characterized as "the criminalization of the practice of law" by a "weaponized government."

On Tuesday, however, she suddenly decided to claim "deep remorse" and that she should have made sure "that the facts the other lawyers alleged to be true were in fact true." She told the judge through her tears: "I believe in and I value election integrity. If I knew then what I know now, I would have declined to represent Donald Trump in these post-election challenges."

And you shouldn't believe her for a second, as discussed today. Ellis is the fourth co-defendant to plead guilty in Willis' case, and the third attorney to do so after Sidney Powell and Ken Chesebro last week. To date, all have avoided any jail time...as we discuss as well.

Elsewhere, on a very Trumpy news day (sorry, not sorry)...

• Moments before midnight last night, at the deadline for pre-trial motions, Trump filed a flurry of desperate pleadings in the felony indictment case against him by Special Counsel Jack Smith in federal court in D.C. for efforts related to his attempt to steal the 2020 election, including the January 6 insurrection. TPM's David Kurtz has an excellent quick round-up of the filings; former U.S. Attorney Barb McQuade characterizes them as "all losers"; and our friend Marcy Wheeler of Emptywheel offers the shortest, sharpest round-up of the pleadings which appear destined to fail miserably.

• In a New York state courtroom on Tuesday, where Trump, his company and his two eldest sons face the loss of their fraudulent business empire in Attorney General Letitia James' civil case against him, Trump's former attorney and fixer Michael Cohen testified --- as Trump glowered from the defense table --- that, when he worked for the Trump Organization he was "tasked by Mr. Trump" to inflate the value of company assets to "whatever number Trump told us." The judge in the case has already found Trump et al guilty on the key fraud claims brought by James. Several other issues and the final size of the judgement against the defendants remain at stake. Also, the question of whether Trump and his attorneys will be sickened by COVID again.

• In Congress, Republicans in the U.S. House spent the last two days selecting their newest Speaker Designate after moving to fire Kevin McCarthy three weeks ago. On Tuesday, after five rounds of voting in a close-door conference meeting, House Republicans selected Majority Whip Tom Emmer (MN). A few hours later, after being attacked by Trump, Emmer --- following in the footsteps of Steve Scalise and Jim Jordan before him over the past two weeks --- dropped out of the running. And we're back to square one with no Speaker and a House that is unable to do any business until the GOP can grow up and govern before next month's deadline for a full government shutdown.

• And, in one more Trump-related story from Friday. A state judge in Colorado rejected three different attempts by the disgraced former President to dismiss a lawsuit charging that he is ineligible to appear on the state's ballot next year under Section 3 of the 14th Amendment, the "Insurrection Disqualification Clause". The filings from both Trump and the Colorado GOP were all but laughed out of court by the judge. The trial in the matter begins in state court next week!

More voices over "the information superhighway" was supposed to make it easier for the public to discern fact from fiction. As discuss on today's BradCast, it seems to have done the exact opposite. [Audio link to full show follows this summary.]

Two hot wars in both Israel and Ukraine, a still-simmering pandemic, a worsening climate crisis, the takeover of Twitter by a disgruntled rightwing billionaire, and a "master propagandist" running again for President of the United States, have all combined into a "perfect storm" of disinformation, my guest today explains.

We're joined by Boston University research fellow and best-selling author LEE MCINTYRE, author of 2018's Post-Truth, 2021's How to Talk to a Science Denier, and the just-published On Disinformation: How to Fight for Truth and Protect Democracy.

He's here today to help us understand the difference between misinformation and disinformation; to discuss which is worse; and what, if anything, can be done about any of it. In short, as he explains, "Misinformation is an accident. Disinformation is a lie." For example, the New York Times' (and others') coverage of the deadly explosion at a hospital in Gaza City last week, which now appears to have been caused by an errant rocket fired by a Palestinian militant group, was misinformation when the Times reported it as having been caused by an Israeli airstrike in the immediate aftermath. The misleading reportage might have originated, however, as disinformation from Hamas sources, whose allegations the Times --- as they finally conceded today --- was not properly vetted before being used to drive traffic to its website.

McIntyre also focuses on the danger that social media sites like Twitter/X now pose to democracy and the world, particularly since its takeover by Elon Musk, his blowing up of the previously helpful blue-check "verified" system which helped users distinguish legitimate sources from fakes, and his removal of most of the company's trust, safety, and information moderation team.

He details how disinformation also serves the dual purpose of not just forwarding false information on any particular issue --- like the war in the Middle East or denial of the efficacy of COVID vaccines, our climate crisis, or democratic elections --- but also collapses trust in all verified information and news sources. "Through polarization and the raising of mistrust and distrust, one message that comes through with disinformation is, 'Maybe we can't even know the truth. How do we know? Is everybody biased?' Because in that situation, you might give up on the idea of truth. That paves the way for authoritarianism."

"I wrote my book because I want people to understand there's a way to fight back against this," McIntyre tells me. "You don't just have to believe the first media accounts. There's a way to be critical, a way to be skeptical, but also a way to push back against social media, push back against cable news, and even the government, to try to make them better and more responsible in how they fight disinformation."

  On January 7, 2021, the day after a right-wing mob stormed the Capitol building, several people paid a visit to the Coffee County elections office. A year and a half later, the Georgia Bureau of Investigation began formally looking into allegations that "computer trespass" had taken place that day. The delay seems to have been due to resistance from the Georgia secretary of state's office, which, for months, denied that a breach had occurred.

That's two. And this is a big one, as discussed on today's BradCast with someone who helped make it happen. [Audio link to full show follows this summary.]

Former Trump attorney Sidney Powell pleaded guilty in Fulton County, Georgia today. She was the second of 19 co-defendants to do so in District Attorney Fani Willis' sprawling racketeering indictment [PDF] against Donald Trump and his alleged co-conspirators who tried, but failed, to steal the 2020 Presidential election in the Peach State.

Powell is, perhaps, most notorious for her so-called "Kraken" lawsuits filed after 2020, which she promised would expose evidence of massive Democratic fraud in several states. Her suits includes no such evidence and were all quickly dismissed. Her claims, for example, that dead Venezuelan President Hugo Chavez was somehow involved in stealing the election with voting machines --- in which Powell bastardized and misused some of my own accurate exclusive reporting on Dominion Voting Systems circa 2010 --- all turned out to be false.

But, as our guest today helped reveal earlier this year, Powell also organized and paid for a scheme to breach proprietary statewide voting system software in Coffee County, unlawfully make copies of it and distribute it across the Internet to sources still unknown. She was indicted by Willis on 7 felony counts related to that plot and, today, pleaded guilty to 6 misdemeanor charges that would keep her out of jail and on probation for 6 years, with the requirement that she cooperate fully with prosecutors and testify truthfully against her 17 remaining co-defendants still facing felony charges. Scott Hall, an Atlanta bail bondsman who initially confessed to the plot in Coffee County during a recorded phone call to frequent BradCast guest Marilyn Marks, as first aired on this program, pleaded guilty earlier this month and is also cooperating with prosecutors as part of his plea deal.

We're joined today for both a bit of a victory lap and a very serious warning by SUSAN GREENHALGH, longtime election integrity expert and Senior Advisor on Election Security at the non-partisan Free Speech for People. With Marks, whose Coalition for Good Governance has a long-running lawsuit against GA Sec. of State Brad Raffensperger, seeking to replace the state's touchscreen voting machines with hand-marked paper ballots, Greenhalgh helped reveal that the plot to breach the voting systems in GA was actually part of a broader, multi-state conspiracy hatched during an infamous December 18, 2020 meeting with Trump in the Oval Office. In addition to Powell, co-defendant Rudy Giuliani, disgraced former National Security Advisor Michael Flynn and others on Team MAGA were there that night, hoping that Trump would issue an Executive Order for the military to seize the nation's voting machines. Instead, they settled on the Coffee County scheme and others like it in several other states.

"We know that [Powell's] been involved in voting system software breaches in other states, like in Michigan," Greenhalgh explains today. "But Sidney hasn't been charged there. It's important to keep in mind that this was a networked, coordinated, multi-pronged plan to get access to voting systems in multiple states that she was a part of, and she really shouldn't escape responsibility for her role in those alleged criminal activities in other states."

Greenhalgh recently co-wrote a piece at Slate, calling on the U.S. Justice Department to launch a probe into the multi-state scheme which, she explains today, still poses a very serious threat to the 2024 elections. "Suppose there was a plutonium laboratory that had a robbery, and your local police prosecuted the thieves and the people that let them in. You wouldn't expect them to stop there. You'd expect the feds to go out and find out who got the plutonium and what was the plan to do with it. That's the kind of investigation that we need right now."

For today, at least, the guilty plea by Powell was good news. Marks called it "eminently important...for raising public awareness of the seriousness of the offense that puts Georgia's 2024 elections at risk because Powell's team released Georgia's software into the wild."

As we've discussed with Marks on the program many times, however, Raffensperger has taken no action and has arguably helped cover up the Coffee County breach from the jump. "While Georgia's Secretary of State has turned a blind eye and declined to either investigate or mitigate this massive security failure," Marks said in a statement today, "at least DA Willis is holding some of the ring leaders accountable in ways that will certainly expose other actors' wrongdoing in this unlawful attempt to subvert the 2020 election."

For her part, Greenhalgh says today that, though she "was surprised at how lenient the deal is", she is hoping that Powell's guilty plea is "really going to bring the goods" on the multi-state plot and, of course, the involvement of higher-ups in the food chain like Trump and Giuliani.

Greenhalgh encourages listeners to contact their members of Congress to insist they take action on the ongoing threats posed to our voting systems by the breaches in Coffee County and elsewhere before 2024.

Given the mind-blowing and ongoing dysfunction in the GOP-run U.S. House right now, however, amid the Republican Party's continuing inability to choose a Speaker --- as we also discuss on today's show --- it's unlikely that there will be any kind of hearings or anything else there for quite some time.

We begin again on today's BradCast with the latest developments in what AP is now calling the latest Israel-Palestinian war, before catching up with a number of political and climate related issues here at home. [Audio link to full show follows below this summary.]

ISRAEL v. HAMAS:

• On Monday, the leaders of France, Germany, Italy, the U.K., and the U.S. issued an unusual joint statement condemning the "terrorist actions of Hamas" over the weekend, declaring "steadfast and united support to the State of Israel" and recognizing "the legitimate aspirations of the Palestinian people".

• Today, an at-times visibly angry President Biden expressed similar sentiments, decried the weekend's "atrocity on a appalling scale"; warned against adversaries both at home and abroad who might be tempted to take advantage of the situation for political violence; vowed to help secure the release of American hostages around the world; declared this "a moment for the United States to come together, to grieve with those who are mourning"; promised to uphold the "laws of war", and reiterated that the U.S. "stands with Israel" while condemning the "indiscriminate evil" of the weekend's attack. He also confirmed that 14 Americans are now confirmed to have been killed as a result of Saturday's surprise assault by Hamas.

• Beyond that, we cover the latest, including escalating death tolls, with at least 1,000 dead in Israel, and at least 800 dead in Gaza, as Israel continues its fourth day of pounding neighborhood after neighborhood in the Gaza Strip with air strikes. More than 200,000 Palestinians have reportedly fled their homes for U.N. shelters, as deliveries of food, fuel, water, electricity, medicine and other supplies to Gaza have been cut off by Israel, as hospitals are said to be running out of supplies, surgical equipment and antibiotics.

• Back home in Congress, the U.S. House remains crippled thanks to Republicans having removed their own House Speaker last week. Given our recent history and the current situation in the Middle East, that might not actually be a terrible thing.

2004 MISCELLANY:

• On Friday, the Wisconsin Supreme Court, after a 4 to 3 vote, scheduled a hearing next week on a voter petition to draw fair legislative maps for the state Senate and Assembly, for the first time in more than a decade. Justice Janet Protasiewicz, whose recent election gave liberals a majority on the High Court for the first time in 15 years, has decided to not recuse herself from the case, even as GOP Assembly Speaker Robin Vos' threat to impeach her if she did so has shown no sign of materializing yet.

• Out here in California, 74-year old former L.A. Dodgers All-Star Steve Garvey announced today that he will be running as a Republican next year to fill the seat held by Dianne Feinstein, who recently passed away. He will be vying for one of the two spots up for grabs in next year's March Primary, in hopes of going on to compete in the November general election. He will have to face off with at least three Democratic all-stars hoping to become the state's new Senator, including Congressmembers Barbara Lee, Katie Porter and Adam Schiff --- and potentially against Laphonza Butler should she decide to run, after having been tapped by Gov. Gavin Newsom to fill the rest of Feinstein's term.

• Robert F. Kennedy, Jr., with much support from Republicans, announced on Monday that he plans to drop out of his Democratic primary bid and run for President as an independent next year. In theory, he will join Cornel West who plans to do the same after leaving the Green Party, and a potential candidate put up for 2024 by the right-leaning "centrist" group calling itself No Labels.

LATE-BREAKING AND FINALLY:

• Republican Rep. George Santos (NY), already facing 13 federal campaign finance-related charges, now faces an additional 10 related to identify theft for stealing donor credit cards to make unauthorized charges.

• Hurricane Lidia spun up quickly before airtime to become a major Category 3 storm as it headed toward landfall on Mexico's Pacific coast near Puerto Vallarta. (Since we've gotten off air, Lidia has spun up even more, making landfall as a Cat 4 with 140 mph winds!) It is the second tropical storm to slam the Pacific coast in two days, following landfall by Max on Monday.

• Desi Doyen joins us for our latest Green News Report, with good news for both striking auto workers and Electric Vehicles, and bad news for India, the children of the world, and your olive oil...

It's game on, Wisconsin!

Last Friday, eight days after it declined to hear an emergency request to block the Wisconsin Assembly from initiating impeachment proceedings against recently seated Justice Janet Protasiewicz, the state's Supreme Court partially granted a request to determine whether The Badger State's existing legislative maps violate the state Constitution.

The Court's 4-3 Decision [PDF] to review the constitutionality of arguably the most politically gerrymandered maps in the nation comes on the heels of liberals recently assuming a majority on the bench for the first time in more than 15 years.

In their initial filing [PDF] seeking new, fairer maps, the petitioners in Clarke vs. Wisconsin Elections Commission argued (1) the Wisconsin Supreme Court should grant the petition because it is the only entity that can resolve the issue; (2) that extreme partisan gerrymanders violate the Wisconsin Constitution; (3) that the current legislative districts, both in the state Senate and Assembly, are unconstitutionally noncontiguous, and (4) that the current maps violate separation of powers.

The High Court's narrow majority determined that it will only hear issues (3) and (4). It directed the parties to file briefs by Oct. 16 that will address four specified questions, including the standards the Court should apply in adopting a remedy if it finds the existing maps to be unconstitutional and "the legislature and governor fail to adopt maps that comply with the Wisconsin constitution."

That wasn't the only critical decision issued on Friday regarding what is likely to be a landmark ruling by the High Court...

Good news, bad news, news about shamefully misreported news, and something that's as close to "normal" news as we are able to find these days. All on today's BradCast! [Audio link to full show follows this summary.]

THE GOOD NEWS: After two years and countless shameful losses in federal courts --- including twice at the U.S. Supreme Court --- Republican Alabama lawmakers are finally forced to follow the Constitution and Rule of Law by adding a second U.S. House District where Black voters may be able to elect a representative of their own choosing for the first time in state history. (Similar fights continue, however, in other states, such as South Carolina, Texas, Florida...)

THE BAD NEWS: September heat records around the globe were literally off-the-charts. Or, as climate scientist Zeke Hausfather recently described it, "absolutely gobsmackingly bananas". Is last month's alarming spike, completely blowing away some 80 years of temperature anomalies, temporary or here to stay? We discuss.

THE SHAMEFULLY MISREPORTED NEWS: Yes, the Biden Administration will be building some 17 miles of new border wall in the Texas Rio Grande Valley. No, it's not because Biden has "hypocritically reversed" his position on physical barriers or now agrees with Donald Trump (as Fox "News", Trump and too many actual news outlets have also been misleading reporting today). Rather, it is because the Administration is required to do so under the 2019 appropriations bill passed by Congress during the Trump Administration. Yes, the Biden Administration believes they must follow the Rule of Law, whether they agree with it or not. Crazy. The number of media outlets rewriting their originally misleading stories today would be hilarious, had the initial versions of those stories not been so woefully irresponsible.

SOMETHING CLOSE TO 'NORMAL' NEWS: We'll call it "The Old Normal". A U.S. President who is running for re-election next year sits down for a one-on-one interview with an actual journalists and answers many questions. No threats are issued. Nobody is attacked. In fact, no huge news is broken. But the electorate becomes better informed so they can hopefully cast an educated vote next year. We share the bulk of that interview because few others will bother to do so. And, yes, the perfectly reasonable conversation touches on our ongoing threats to democracy in America and around the world, and what can be done about the menace of looming political violence by rightwing MAGA extremists and their authoritarian cult leader. Seems important.

Longtime listeners of The BradCast likely knew about the big news last Friday better than almost anyone in the nation. Certainly better than those in the corporate media. We'd been reporting on it for years now, so our listeners likely knew the name "Scott Hall" before pretty much everyone else in the country. [Audio link to full show follows this summary.

On Friday, Atlanta bail bondsman Scott Hall was the first among Donald Trump's 18 co-defendants to plead guilty in the Fulton County, Georgia racketeering indictment, detailing Trump's broad conspiracy to steal the state's 2020 Presidential election in the state. Hall was indicted in the RICO scheme [PDF] on five felony charges related to his participation in the January 7, 2021 breach of Georgia's voting system software in rural, Republican-leaning Coffee County. The plot included Trump supporters unlawfully gaining access to the state's proprietary voting system software at the County's elections office, making copies of it and illegally distributing it via the Internet.

The crime first came to light after Hall called longtime Election Integrity champion and frequent BradCast guest MARILYN MARKS, founder of the nonpartisan Coalition for Good Governance, and essentially confessed to the entire scheme. Marks recorded the phone call "confession" and we were the first in the nation to broadcast audio from that phone call last year in May. Marks' group has been leading a long-running lawsuit against GA Sec. of State Brad Raffensperger, seeking to replace the Peach State's wildly vulnerable and unverifiable touchscreen voting systems with verifiable hand-marked paper ballots before next year's Presidential election. Her quick thinking to record Hall's phone call resulted in at least five of the indictments in District Attorney Fani Willis' case against Trump and friends.

"It was one of the more intelligent things I've done, which are not many!," quips Marks today. "But I'm glad I recorded that." She joins us today for the first time since Hall was the first to cop a plea in the case last week to avoid jail time in exchange for testifying against his fellow defendants. He received 12 months of probation and a $5,000 fine.

Marks explains that Hall will have a lot to share with Willis' team. "On mainstream media over the weekend, I heard many commentators saying, 'Well, he's kind of a small player.' Oh no no no --- he is not a 'small player'," she insists. "He knows the ladder, up and down. He was smart to get that deal he did. He got in early. And now Fani Willis has his truthful testimony about a whole range of characters and facts."

Among the many points we discuss with Marks today...

• What Hall knows about the Coffee County breach, its organization by co-defendant and Trump attorney Sidney Powell, and the genesis of the multi-state plot beginning in Trump's Oval Office in December of 2020.
• Why MyPillow CEO Mike Lindell flew into tiny Coffee County in his private plane for a few hours in the middle of the night as the County was preparing to fire its Election Director, co-defendant Misty Hampton, in the wake of the breach.
• Why did all of Hampton's emails from her years as the County's Elections Supervisor supposedly disappear after she was fired? (Though, on today's show, we found one of them! Read on!)
• Who else was involved in the breach but wasn't indicted by Willis (for example, Lindell and head of the now-defunct "Cyber Ninjas" outfit, Doug Logan) and why?
• Why has GA SoS Raffensperger been covering up the breach since it happened in early 2021, and why is he still refusing to take any action in response to it? For example, why is his office refusing to install new security patches created by Dominion Voting Systems for the touchscreen voting systems until after the 2024 Presidential election?
• Why is the state's voting system software breach in Coffee County important to the Coalition's lawsuit against Raffensperger, which seeks to move to hand-counted paper ballots? (The trial in that years-long case, by the way, is finally set to begin in federal court in January.)

"There is nothing to suggest that [Raffensperger] is remotely interested in learning what happened," Marks argues today. "He has still not started an investigation of the implications of this breach --- who was involved, how the administrative rules fell apart --- and has not done any kind of work on the security implications of it. It is absolutely shameful."

That's just the tip of the iceberg today which also includes another 'BradCast' first: We share the long sought after invitation letter allegedly sent by Hampton to the MAGA breachers on December 31, 2020, giving them the greenlight to come to the Coffee County Board of Elections office. "Y'all are welcome in our office any time," writes Hampton in the brief letter that Powell had claimed would somehow exonerate her, and in which Hampton goes out of her way to mention being in accordance with "Georgia Law" at least three different times, for some reason, in a single paragraph letter.

The subject material --- Wednesday night's ridiculous GOP 2024 "Presidential Primary Debate" (if it's even worth calling it that) at the Ronald Reagan Presidential Library out here in Simi Valley, California --- is what makes it dumb.

It featured seven "candidates" --- former Vice President Mike Pence, Florida Gov. Ron DeSantis, former South Carolina Gov. and UN Ambassador Nikki Haley, South Carolina Sen. Tim Scott, former New Jersey Gov. Chris Christie, supposed businessman Vivek Ramaswamy and North Dakota Gov. Doug Burgum --- but not the much-indicted guy who Republicans apparently intend, for now, to actually nominate for the job next year.

Some breaking news just before airtime helped, once again, threw off our best laid plans for today's BradCast. But, given this particularly huge breaking news, we're just fine with that. [Audio link to full show follows below this summary.]

The New York Judge in state Attorney General Letitia James' $250 million civil fraud lawsuit against Donald Trump, the Trump Organization, his eldest sons, Don Jr. and Eric, and two top company executives, ruled [PDF] that they all committed years of "persistent and repeated fraud" to the tune of billions of dollars by inflating the value of company assets when applying for bank loans. They also decreased the value of the same properties to receive favorable terms on both insurance and taxes, according to the ruling.

Judge Arthur Engoron found in favor of the state's key contention during the summary judgment phase of the landmark case on Tuesday, before the non-jury trial is slated to begin next Monday. Trump's attorneys had also sought summary judgement, hoping to see the case thrown out entirely. Instead, the key issue has already been decided against them and Engoron, in a brutal ruling, has stripped the former President, his company, his sons and execs, of control over several of his main New York properties. The Trump Organization and its various LLCs were placed into receivership to be controlled by court-appointed officers!

In the massive fraud suit, James seeks to permanently revoke the Trump family's license to do business at all in New York state. The trial, set to begin next week, will now determine the other issues at stake and the full breadth of penalties. Of course, Trump will appeal everything. But, make no mistake, this is a huge verdict against the failed former President and current 2024 GOP frontrunner who, as validated by Judge Engoron today, has built his business empire on decades of fraud and lies.

Among the many other important stories also covered on today's program...

• Cassidy Hutchinson, star witness at last year's House January 6 Committee hearings and the former top aide to Trump's final Chief of Staff, Mark Meadows, warns that Trump "almost destroyed democracy in one day and he wants to run for President do it again."

• This week's second GOP Presidential Primary debate, at the Reagan Library here in Southern California, will feature the same candidates as last month's debate in Milwaukee, other than former Arkansas Gov. Asa Hutchinson, who apparently did not meet the RNC's criteria. Trump was also not invited for refusing to sign the party's loyalty pledge, but he had already announced he wouldn't participate in any of their debates.

• Labor economist Kathryn Anne Edwards offered a must-listen response to Louisiana's loopy U.S. Senator John Kennedy during a Senate subcommittee hearing last week on post-pandemic child care concerns. While Kennedy suggested he really really wanted to help, he had no idea where, oh, where the federal government could possibly find the money to do so. Edwards' straightforward, well-supported answer: Raise taxes on the wealthy that you've been lowering for the past two decades if you really care about children in need.

• In a related matter on Tuesday, Joe Biden became the first sitting U.S. President, incredibly enough, to join a picket line with striking workers. In this case, he called on striking United Auto Workers members in Detroit to "stick with it," as he rallied workers with UAW President Shawn Fain. On Wednesday, the former President is set to speak at a non-union facility in a "red" county outside of Detroit.

• California Governor Gavin Newsom signed a bill into law today that doubles the tax on sales of guns and ammunition in the state to help pay for increased school safety measures. While the federal government already charges a 10% tax on guns and ammo, California doubled it with one of their own, becoming the first in the nation to do so.

• Bona fide good news today from our corrupted, packed and stolen U.S. Supreme Court. They rejected Alabama's attempt --- once again --- to violate the Voting Rights Act with a racially gerrymandered U.S. House map. Last June, in a surprising 5 to 4 ruling, with Chief Justice John Roberts and Justice Brett Kavanaugh joining the Court's three liberals, SCOTUS ordered the state to create a second majority black U.S. House District. Just 1 of 7 districts is currently a majority minority district despite African Americans comprising more than a quarter of the state's population. But Alabama Republicans, blatantly defying the U.S. Supreme Court, redrew their districts without including a second black majority district as mandated. A federal court panel then ordered a Special Master to draw up a new map instead. Alabama tried to stay that decision at SCOTUS, which unanimously rejected the state today in a one sentence ruling. That is good news for voters and bad news for several other GOP-controlled states trying the same gambit to cheat their way to a Republican majority in the House again next year.

• Speaking of the Republicans' narrow majority in the U.S. House, it appears next to impossible at this hour to believe they will be able to agree amongst themselves on a spending bill to keep the federal government open as of Saturday. At least not without either Democrats saving them and/or House Speaker Kevin McCarthy losing his job as Speaker.

• New Jersey's Democratic Sen. Bob Menendez, federally indicted for a second time late last week on charges of bribery and corruption, maintains his innocence. But the flood of fellow Democratic U.S. Senators calling for his resignation seems all but unstoppable now, with at least six of them --- including fellow NJ Senator Corey Booker --- calling for Menendez to step down. The charges, by the way, would seem to dramatically undercut Trump/GOP claims that the DoJ has been "weaponized" by Democrats against them.

• Finally, Desi Doyen joins us for our latest Green News Report, as New Orleans declares a drinking water emergency; Fracking is "devouring American's groundwater" amid persistent drought in a number of states; and FEMA girds to suspend critical recovery operations in several states if Republicans shut down the federal government as of this Saturday...

It's a very exciting time for organized labor in these United States, as discussed on today's BradCast, after decades of corporate measures that have succeeded in vastly shrinking union membership and power across the country, along with the power of the American middle class itself. [Audio link to full show follows this summary.]

Late on Sunday, out here in Hollywood, striking film and television scribes from the Writer's Guild of America (WGA), finally came to terms on a new contract with major studio executives to share some of the bounty of record profits the writers have helped those giant corporations make. The tentative deal is described by the writer's union negotiators as "exceptional," including "meaningful gains and protections for writers in every sector of the membership."

Pending likely final approval by members this week, only some film and TV production will be able to begin rolling again --- for example, late-night and daytime shows without actors --- as the more than 100,000 actors of SAG-AFTRA still remain on strike, hoping to see similar financial benefits and protections for their members as achieved by the WGA after nearly 150 days on the picket lines.

In related news, President Biden will be meeting with striking union members from the United Autoworkers on the picket line this week in Detroit, in what is apparently (shamefully?) an historic first for an American President. That will happen on Tuesday, the day before Donald Trump is set to meet with non-union workers at a plant outside of Detroit, in a ruby red suburb this week. (Good luck noticing that part of the story as corporate media outlets seem to be working overtime to "both sides" the two very different appearances.)

At the same time, the Biden-Harris campaign has released a video featuring GOP Presidential candidates Nikki Haley and Tim Scott and a Fox "News" anchor singing Biden's support for union workers.

We've had a very busy news weekend beyond the good news for organized labor and collective bargaining. But I wanted to move that good labor news up to the top today, and take some calls from listeners on it. Some of those callers seemed to have some misconceptions about unions which other callers, happily, were able to rebut in what I believe was an obscenely reasonable conversation for talk radio. My apologies in advance.

We'll try to get to some of the other ongoing stories --- the indictment of Democratic U.S. Senator Bob Menendez (NJ); the House GOP's pathetic plan to shut the federal government down as of this weekend, and more --- in the days ahead. Today, however, seemed a good day to focus momentarily on some good news about organized labor, the struggling middle class, and a newly revitalized stand against major corporations, making records profits, fighting like hell to prevent their workers from sharing in the gains those very workers helped them achieve.

• Popularity of solar and other renewable energy sources is reportedly soaring across the globe, according to a huge new survey, as support for fossil fuels plummets amid our quickly worsening climate crisis.

• The persistence of progressive protesters and environmental advocates demanding a "Green New Deal" continues to pay off as President Biden unveils an Executive Order for creation of the American Climate Corps, echoing FDR's legendary Civilian Conservation Corps (CCC).

• Despite public displays of confidence and false bravado, privately Donald Trump is reportedly terrified of the possibility of going to prison. He should be. For one, there would be nobody to dye his hair, blow-dry his comb-over or apply his orange bronzer make-up which, according to a new book by former White House staffer Cassidy Hutchinson, is likely the reason that rightwing supporters of Trump had to also be against wearing life-saving masks during the worst of the COVID crisis, leaving hundreds of thousands of them dead in support of Trump's malignantly narcissistic vanity.

• The Minnesota Supreme Court has set a briefing and argument schedule [PDF] this week on a lawsuit brought by its former Sec. of State and the Constitutional law experts at Free Speech for People, seeking Trump's disqualification from the state's primary and general election ballots under Section 3 of the 14th Amendment, the "Insurrectionist Disqualification Clause." This matter is likely to move quickly, since names on the ballot must be settled by January 2 to be printed and mailed out in time for the state's March 5, Super Tuesday primary. The High Court has set oral argument for November 2.

• As we've been reporting quite a bit on the possibility of Trump's 14.3 disqualification under the "Insurrection Disqualification Clause" in recent weeks (and years!), we take some time today to respond to a number of listener emails on the topic, and respond to several "myths" about the Constitutional clause --- (yes, it applies to Presidents; no, it doesn't require a conviction on insurrection before it can be applied) --- with some help from a helpful Myths and Realities about 14.3 [PDF] document, courtesy of the Constitutional law scholars and experts at the non-profit, non-partisan Free Speech for People.
