Republicans and corporate media appeared to be shocked on Tuesday night. But it looks like we had it right all along on BradCast regarding this year's midterm elections. And, once again, the corporate media didn't. But, good news for them! As usual, they'll pay no price for being wrong, no matter how many times they ill-serve the nation with their failures. There was no "red" wave. Conventional wisdom, as we've been advising since early Spring, was to be ignored before this year's midterms in these decidedly UNconventional times. If we could see that data --- sometimes via polling from some of the very same media outlets --- why couldn't the corporate media? Maybe its group think. Maybe its because whatever Republicans tell them they believe to be the truth, or simply report it as such.

In any event, while there was no "red" wave, it is still quite possible that Republicans win majorities in both the U.S. House and the Senate --- if just barely in each case. And while Dems, as we go to air today, have an apparent edge to hold on to their Senate majority, it'll almost certainly require another win in another U.S. Senate runoff in Georgia next month to nail it down. There even remains a long-shot chance that Dems can keep a majority in the House as well, and that, as we explained yesterday, it all may come down to the effect of unusually large downpours on Tuesday's Election Day in both Northern and Southern California.

Either way, for the moment, American democracy, while still on life support, has lived to see another day. For now. In similarly encouraging news, our previous President may even finally face some accountability from his own infuriated party. They were deprived of what should have been a huge and easy win on Tuesday, but for the rightwing loons that Donald Trump helped push into the Party and onto ballots across the nation. Many of them, if not all, lost bigly.

On today's program, we discuss all of the above and, based on what we know as of airtime, run through a ton of critical victories and losses --- including both inspiring surprise wins and several disappointments --- in dozens of states, at both the state and federal level.

As of yesterday's election, anyway, American voters (including many young ones, thankfully!) appear to have held the line for democracy. It is not dead yet. For that, I hope you'll take a minute or two to breathe a small sigh of relief. But not too many minutes. The good fight ain't over yet. Not by a long shot...

On today's Midterm Elections Day 2022 BradCast: Unspooling the media's midterm mess and the high price of failed computerized voting and tabulation systems in several states.

Among the many stories covered today as voters across the nation headed to the polls...

• What is the possible connection between today's otherwise much-needed downpours in both Northern and Southern California and potential partisan control of the U.S. House? We 'splain!

• Major corporate media outlets have done another irresponsible job in their coverage of this year's midterms, particularly in their bizarre Doomsday-for-Dems coverage in recent weeks. While Tuesday's elections certainly could prove to be a "red" wave for Republicans --- after all, conventional wisdom (which we've been advising you to ignore all year) would certainly predict as much --- a fair reading of both pre-election polling and other available early voting data, suggests Dem strength could be greater than most outlets have been reporting. Some are even ignoring their own polling numbers to report a coming apocalypse for Dems. (Also: Compare and contrast NYT's front pages from day before the midterms in 2018, when Dems picked up 41 seats in the House, with the day before this week's midterms.) Of course, the polls are tight enough that a minor polling error in either direction could lead to either a "red" or "blue" wave, or simply a maddeningly close contest all around. But the problem is, the doom and gloom reporting can either become a self-fulfilling prophecy by depressing Dem turnout or, more dangerously, yet another misleading basis for Republicans to falsely declare "FRAUD!" in the event that Dems do better than expected on Tuesday night. Either scenario suggests another mainstream corporate media failure in 2022. We 'splain that too.

• Donald Trump big footed Ohio's Republican U.S. Senate candidate J.D. Vance at his rally on Monday night by announcing that he's got a big announcement coming next week. Reportedly, Republican officials had to beg Trump to not declare his candidacy to run again for President before today's midterms. He wanted to do it last night. Of course, facing as many legal perils all at once as he now is, I'd want to try and change the subject as quickly as possible too. It won't work.

• A tale of two voting system failures. In Mercer County, New Jersey today, hand-marked paper ballot optical scanners used across the county and made by Dominion failed to work. Luckily, they are one of only two counties in the state that offer voters hand-marked paper ballots. So, voters were instructed instead to place their ballots into the scanning system's locked box to be tabulated later at County headquarters. Voters did so. Voting continued. Life went on. Everything was fine. Meanwhile, at a bunch of polling sites in Maricopa County (Phoenix), Arizona, the scanners, also made by Dominion, were failing as well. Instead of following the same procedure to vote and place their ballot in the box to be scanned later, the wingnuts went crazy. Howls of "FRAUD!" followed, with demands to recall the County's Republican election officials and for paper ballots to be used from now on! (Someone please let GA's lunkhead Rep. Marjorie Taylor Greene know that Maricopa already uses paper ballots.) Sigh. This in a county where Reuters reported over the weekend that elections officials faced more than 100 threats in the lead up to today's elections, including calls to "kill them all" and worse. (The reason eventually discovered for the scanner failures in Maricopa was pretty mundane).

• Meanwhile, actual voter disenfranchisement took place for hours in Harris County (Houston), Texas, on Tuesday morning, thanks to the fact that, like much of the Lone Star state, they don't allow voters to use verifiable hand-mark paper ballots at the polls. Instead, after a poll worker quit before today's Election Day, touchscreen voting systems made by Hart Intercivic were not properly set up until four hours after polls opened in a heavily-Hispanic part of the heavily-Democratic County. An unknown number of voters were turned away, unable to vote. Marjorie Taylor Greene has yet to say a word about it.

• Finally, Desi Doyen joins us for our latest Green News Report, as the U.N.'s big COP27 climate conference kicks of in Egypt; a new report finds major glaciers will soon disappear entirely; and a late-season hurricane spins up and takes aims at Florida's east coast...

Some good news, some bad news, and the most difficult news of all for talk radio: nuanced news on today's BradCast. [Audio link to full show is posted below this summary.]

Among the many stories covered on today's program...

• Texas has finally figured out that home solar panels and battery storage can help save the state's brittle, failing electric grid this winter. That's good news for Texas, Tesla and homeowners who can make money selling excess energy back to the grid.

• There is actually quite a bit of good news for renewable energy according to a new report this week from the International Renewable Energy Agency, as per the New York Times' Ivan Penn today. Top line: As solar and wind production are now cheaper sources for electricity than fossil fuels, renewables now dominate all new electric energy capacity (81% last year) and, if the current trajectory continues, are likely to very soon generate more electricity globally than fossil fuels.

• Even the Brothers of Italy --- the actually fascist right-wing party which recently won a Parliamentary majority in Italy --- and its far-right leader Giorgia Meloni (soon to become Prime Minister) appear to be more progressive on climate change concerns than the Republican Party in the U.S. It's kind of remarkable really and, yes, a bit nuanced.

• Speaking of fascists, with early voting now under way in many states for the critical 2022 midterms, so is the voter intimidation and suppression by disinformed rightwingers. MAGA Republicans in Arizona appear to be taking the early lead nationwide when it comes to reported intimidation, as armed and masked vigilantes in tactical gear are now camping out in parking lots near absentee ballot drop boxes because they've been duped into believing they are used for massive voter fraud. While some of the few remaining GOP officials in the state who haven't become brain poisoned are trying to lower the temperature, others, including MAGA Republican Gubernatorial nominee Kari Lake and MAGA State Sen. Kelly Townsend continue to fan the flames with lies about the 2020 election.

• Meanwhile, however, in defending against Donald Trump's lies about election and voter fraud, Democrats may have backed themselves into a corner when it comes to their own ability to challenge election results themselves. In their ill-considered efforts to force Republicans into answering gotcha questions about whether or not they will accept election results for elections that haven't even happened yet --- which could include outcome determinative problems like voter suppression or problems with voting and tabulation computers --- Dems may have short-circuited their own ability to challenge results that legitimately need challenging. We discuss.

• At the same time, MAGA rightwingers in several rural (heavily GOP-leaning) Nevada counties are certain that Dominion Voting Systems done them wrong in 2020. So now they're demanding hand-counted paper ballots. While hand-counting is, in fact, the only way to know for certain if computers actually tallied ballots as per voter intent, the NV GOPers who bought into Trump's evidence-free fraud conspiracies are doing it all wrong. One county has even been given permission by the state Supreme Court to begin hand-counting early ballots beginning this week. That is a recipe for all sorts of disaster, including unlawful leaks about early results.

  And here comes more nuance: While we have spent nearly two decades decrying computer-tabulated ballots, we have called not for hand-counting, but for hand-count pilot projects to determine its feasibility in each jurisdiction and to develop simple, efficient and publicly-overseeable protocols to do it safely and transparently at the precinct on Election Night, in front of everyone, before ballots are moved anywhere. (Similar to how it has been successfully been done for many years now by about 40% of the towns in New Hampshire.)

  Ad hoc hand-counting (for example, like the kind that took NV's Esmerelda County more than seven hours to tally 317 ballots after their June primary!) is a disaster in the making and one that is likely to end up discrediting real hand-counting for years to come. I hope I'm wrong.

  In the meantime, there are critical contests in the state this year, including a very tight race between incumbent Democratic U.S. Senator Catherine Cortez Masto and Republican Adam Laxalt. If she is reported to have lost and there are any questions about the results, good luck to the Dems after shortsightedly decrying any and all concerns about elections when they may need to challenge an election themselves.

As noted on today's BradCast, we generally cover the track conditions of our elections more than the actual horse races. We do so again today. But, as it turns out, Dems have put up some pretty good horses this year. We cover a couple of them today as well. [Audio link to full show is posted below this summary.]

First, track conditions...

The corrupt, stolen and packed rightwing U.S. Supreme Court majority on Tuesday overturned an appeals court ruling which had found that both the landmark Civil Rights Act of 1964 and Pennsylvania law mandates that legitimately voted ballots may not be invalidated due to minor errors that are "immaterial" to determining voter qualification. In this case, the question was about absentee ballots where voters had forgotten to fill in the date on the ballot's outer envelope. The activists on SCOTUS, however, held today that such ballots may not be counted this November, despite the Civil Rights Act provision that previously ended the Jim Crow era's use of immaterial errors to invalidate perfectly legitimate votes.

Also, FBI officials say they have identified no credible threats to U.S. election systems this year, despite efforts by some foreign adversaries, including Russia, to sow doubt about fraud. But do these officials understand the actual threats now posed to our non-transparent, easily manipulated and error-prone computerized voting and tabulation systems? Do they appreciate the increased threat level thanks to recent breaches of election management systems by MAGA conspiracy theorists in several states following the former President's false claims of fraud?

While the Trump-appointed FBI Director Christopher Wray seems to falsely suggest there are similar domestic threats of violence from "both sides" following the 2020 election and the SCOTUS ruling on Roe v. Wade, the federal Elections Threat Task Force, launched last year by the Dept. of Justice, seems to finally be taking at least some action in response to the thousands of violent threats made by rightwingers against election officials and poll workers following the last Presidential election.

Next, horse races...

During a U.S. Senate debate in Ohio on Monday night, Democratic candidate Rep. Tim Ryan called out his Republican opponent, author J.D. Vance, for running a fake non-profit charity to support opioid addicts; defending January 6 insurrectionists; and for giving up his "dignity" to Trump who said about Vance at a recent rally in Youngstown: "All you do is kiss my ass to get my support," before Vance went on to pose for pictures with the disgraced former President. "Ohio needs an ass-kicker, not an ass-kisser," said Ryan in response.

In Wisconsin's U.S.. Senate race, Democratic Lt. Gov. Mandela Barnes was similarly ass-kicking in his debate against incumbent Republican Sen. Ron Johnson. Barnes called out the Badger State GOPer for supporting the January 6 insurrection while claiming to support police, despite the serious injuries to more than 140 law enforcement officials that day. Barnes also made clear he would vote to codify the rights of Roe v. Wade into federal law, and made a very impressive showing against Johnson.

Both races are currently neck and neck, and are among at least five Senate races this year (along with Pennsylvania, North Carolina and even Florida) where Dems have real shots at flipping currently GOP-held seats from "red" to "blue". That, by way of contrast with Republicans who are looking at just two states (Nevada and Georgia), where they stand any real chance, generally speaking, of flipping a Senate seat from "blue" to "red" this year --- at least if you have any confidence in this year's pre-election polling.

Among the stories covered on today's program...

• Despite a bizarre, very much Nazi-like rally in Ohio held by our former President over the weekend, mainstream corporate media are still pulling their punches in calling out the Republican Party for having gone full bore authoritarian at this point under their far-right MAGA cult leader Donald Trump. Democracy itself is now very much at stake in this nation, and we really need a professional media corps which isn't afraid to start acting like it, calling it out, and reporting it to the American people.

• While the death and funeral of Queen Elizabeth in Great Britain has received virtual wall-to-wall coverage from outlets such as CNN since her death 11 days ago, three major climate change-fueled hurricanes made landfall over the weekend. Puerto Rico had its power knocked out island-wide by Hurricane Fiona (almost 5 years to the day since Hurricane Maria did the same), with as much as 30 inches of rain falling catastrophically in some areas. In Alaska, remnants of Typhoon Merbok resulted in the state's most intense storm in 50 years, leading to widespread flooding across a thousand miles of coastline. And, in Japan, over the same weekend, Supertyphoon Nanmadol resulted in widespread flooding and power outages, while clocking in as the fourth most intense typhoon to make landfall in the nation's history. As Desi Doyen reports today, all of those storms were super-charged by our warming climate and all seemingly quite newsworthy. Then again, Queen Elizabeth died 11 days ago, so...ya know.

• As you have heard by now, Ron DeSantis, Florida's ambitious Republican Governor, has taken credit for coercing 48 migrants from Venezuela, who were lawfully seeking asylum in San Antonio, Texas, onto to two chartered private jets to Martha's Vineyard, Massachusetts. Neither the people of Martha's Vineyard, nor even the state's Republican Governor, were notified in advance before the migrants were left stranded. While DeSantis claims the migrants boarded the planes "voluntarily", a brochure, obtained by Popular Information today, citing "Massachusetts Refugee Benefits," appears to have falsely informed the migrants that they would be eligible for "8 months cash assistance," "assistance with housing," "food," "clothing," "transportation to job interviews," "job training," "job placement," "registering children for school," "assistance applying for Social Security cards," and more in MA. That brochure, according to attorneys for 30 of the 48 migrants, is now evidence of a crime --- specifically, as former life-long Republican attorney Keith Barber describes, the federal crime of kidnapping (18 U.S.C. § 1201).

• So, what will or should be done about DeSantis' apparent political stunt that actually appears to have been a pretty straightforward federal crime? Will he be held accountable by MA's Democratic Attorney General or by the U.S. Dept. of Justice? Callers ring in with their thoughts (several of whom, by the way, support DeSantis' crime!), on today's very lively program!...

Look at the faces in that photo. Those are the faces of people grappling to understand a profound truth that they simply had no idea about prior to Tuesday night. Those faces should serve as inspiration for every Democrat and/or progressive on the ballot in every race in all 50 states between today and November 8. And as a warning for every Republican.

On today's BradCast, selective, noteworthy, curated results --- or what is known about them, unofficial, incomplete or otherwise --- from Tuesday's primary elections in six states, Arizona, Kansas, Michigan, Missouri, Washington and Ohio. (And several problems for voters in Pinal County, AZ.) [Audio link to full show is posted below this summary.]

Of course, the biggest news from Tuesday, hands down, was the stunning landslide rejection of a state constitutional amendment in Kansas that would have allowed the state's Republicans to restrict and/or ban abortion rights. (That's what the folks in that photo were just learning about.) It was the first statewide vote on the matter anywhere in the nation since the newly extremist, far-right, radical, activist, corrupt, Republican U.S. Supreme Court majority overturned 50-years of Constitutionally protected rights and freedoms by striking down 1973's Roe v. Wade decision.

Even in the theoretically "conservative" state of KS, voters soundly rejected that proposed Amendment with their "NO" votes by a stunning 18 points over "YES" as of airtime. The "NO" vote did well in large and small, rural and urban, Democratic and Republican counties alike. Turnout, thanks to this measure --- in a midterm primary where Republicans assumed few would notice --- was enormous and at levels normally seen in Presidential primaries or even mid-term general elections in the recent past.

The question now is whether Democrats will finally have the confidence and courage to run on this issue, following the overturning of Roe in June, in every state in the country and for virtually every office on the ballot from Governor to Attorney General to District Attorney to County Sheriff to state Judge to state Supreme Court Justice. And, whether Democrats will be able to capitalize on Josh Marshall's "Roe and Reform" campaign that he's been pushing hard at Talking Points Memo, calling for a very specific promise to voters from Democrats on the federal level: Let us hold our House majority and give us two more seats in the Senate and we vow, come January 2023, to reform the Senate filibuster to codify the protections of Roe into federal law, guaranteeing privacy rights and reproductive freedom in all 50 states.

Nothing short of that very specific "You give us that, we'll give you this" promise will do, as Josh has smartly been explaining for weeks now. We have long argued ourselves that candidates must give voters something very clear and specific to vote for. When they do, as proven on Tuesday in Kansas --- where the stakes were crystal clear, and voters knew exactly what they would get from their one single vote --- they will respond in large numbers.

Of course, all of this also further underscores the argument I've been making for months that Democrats and progressives must ignore the "conventional wisdom" from so-called political professionals about the historical odds of impending doom this November. These are decidedly UNconventional times, proven once again in KS yesterday.

Beyond that very encouraging news on Tuesday, there was still more good news in both the Secretary of State and Attorney General races in KS; Somewhat disappointing news in the MO race to fill the U.S. Senate seat being vacated by retiring Republican Sen. Roy Blunt; Potentially concerning news out of MI's Republican gubernatorial contest, where a well funded, Trump-backed loon will run against the state's popular Democratic Governor; And wildly troubling news out of AZ on the Republican side in the contests for the Gubernatorial and Sec. of State nominations, in what could turn out to be two of the most critical races in the nation this November.

Finally, we close with some tragic news on the death this afternoon of Indiana's 58-year old Republican Congresswoman Jackie Walorski and two of her young staffers in an automobile accident. And, some pleasant thoughts following the passing on Tuesday night of Hall of Fame broadcasting legend Vin Scully at age 94. He served as the inimitable and nationally recognized voice of Dodger baseball --- in both Brooklyn and Los Angeles --- for 67 incomparable years...

In our opinion, on today's BradCast, the scaled back, surprise "Build Back Better" spending bill compromise (now renamed the "Inflation Reduction Act" to help win over West Virginia's rightwing Democratic Senator) comes not a moment too soon. And, even "scaled back", it's still chocked full of so much stuff that if each of its provisions were passed in separate bills over the past 18 months, we'd likely be discussing Joe Biden as having one of the most successful first two years of any President in history. That said, the bill has not yet been passed, and it could still be a very bumpy ride in the coming days to see it through to the President's signature. Before we get to that today --- and some callers on same --- a few other headlines covered on today's show...

• Minutes before airtime, news broke that the U.S. killed Al-Qaeda leader Ayman Al-Zawahiri in Afghanistan over the weekend in a successful drone strike, in which no civilians are said to have been killed. President Biden was to give remarks about what happened on Monday evening.

• Speaking of Biden, he tested positive for COVID again over the weekend, in what White House officials are describing as a "rare rebound" case after finishing his 5-day course of the anti-viral drug called Paxlovid. Well, it can't be ALL that rare, because last week, when the White House announced Biden had tested negative and was cleared to leave isolation, we warned about the possibility of such a rebound, as many Paxlovid users have experienced same. The Pfizer drug has very good results at preventing serious cases and hospitalization, but many patients have experienced a second --- non-fatal --- COVID infection shortly after using it. That is, apparently, the case with Biden. His White House doctor says he has few if any symptoms and will likely be fine, despite needing to isolate again.

• Deadly flash flooding continues in parts of Kentucky today, and warnings for more of the same have been issued for the next several days from Tennessee to Kentucky to West Virginia to Virginia and North Carolina. 37 have so far been confirmed to have died from the horrific flooding in Eastern Kentucky. Governor Andy Beshear believes that toll will continue to rise, as hundreds are still unaccounted for in a number of Appalachian mountain towns after recent, and ongoing, deluges. That, as our climate emergency continues with record heat predicted again this week from the Dakotas to the East Coast.

• On Tuesday, voters will head to the polls in six states: Ohio, Arizona, Kansas, Michigan, Missouri and Washington state for primary elections. And there are a lot of 2020 election deniers (and worse) on the GOP ballots. We quickly preview just a few of those insane races today and will have noteworthy reported results, of course, on Wednesday's program.

Then, it's on to the so-called Inflation Reduction Act --- a scaled down version of the Build Back Better Act that Democratic Senators Joe Manchin and Kyrsten Sinema killed last year. If successfully adopted this time, it would increase federal revenue by some $750 billion over the next ten years, allowing for some $450 billion in spending on a bunch of several long-overdue programs. Most of them have been progressive priorities for years.

Only Democrats in the U.S. Senate will be needed to pass it under Senate reconciliation rules, but all 50 will have to be there (not out with COVID) and vote yes. Sinema has yet to comment on the measure, even as Manchin has been taking to media over the weekend to try and sell her on it.

If passed, the 725-page measure [PDF] will: Allow Medicare to negotiate with pharmaceutical companies for lower drug prices; Cap out-of-pocket spending on prescription drugs for seniors at $2,000 per year; Expand federal subsidies for premiums for individuals who purchase health insurance on the federal Affordable Care Act (Obamacare) exchanges; Set a minimum 15% tax for corporations who make more than $1 billion in profits per year; Increase policing of tax cheats; and, perhaps most critically, invest some $369 billion in climate and energy projects to cut deadly greenhouse gas emissions by 40% by 2030 through investments that hasten the nation's move from dirty fossil fuels to clean, renewable energy.

What the bill won't do is raise taxes on anyone making less than $400,000 a year, as Biden has long promised. That, despite blatant lies from Republicans such as Senate Majority Whip John Cornyn (R-TX) who, when announcing he tested positive for COVID today, lied about the bill, declaring on Twitter that he will "continue to fight Chuck Schumer and Joe Manchin's massive tax increase on working families." That is a lie. There is no "massive tax increase on working families" in the bill. Republicans hope you are dumb enough to be duped to the contrary.

In order to win over Manchin, whose family and campaign have long been propped up by fossil fuel interests, the bill does mandate oil and gas lease sales on federal lands be auctioned off in exchange for the approval of on- and off-shore wind and solar projects. Even there, however, oil and gas companies will be required to pay higher royalties on whatever they extract, and will be fined for failing to prevent methane leaks that exacerbate global warming. So, yeah. Art of the compromise. But, according to most climate experts we've read, heard from or spoken with, it's a compromise well worth taking..and comes not a moment too soon, as our climate emergency worsens by the day.

The moment the U.S. Supreme Court handed down its opinion in Dobbs --- the case in which five of the Court's six right-wing Radicals in Robes voted to completely overturn Roe v. Wade (1973) --- it resurrected a cruel and grotesque division between States that had not existed since the end of the American Civil War.

In 1860, prior to passage of the 13th, 14th and 15th Amendments, the very existence of a "United States" was under a grave threat due to an unsustainable, race-based divide between Slave States and Free States.

Today, courtesy of Dobbs, our nation finds itself mired in an unsustainable, gender-based divide between Free States, where a woman's reproductive liberties are preserved, and Slave States, where reproductive liberties no longer exist. (Andrew Koppelman's 2010 paper argued that "forced pregnancy" doesn't just deprive women of their "individual liberty". It also denies Equal Protection under law guaranteed by the 14th Amendment because that "deprivation is selectively imposed on women.")

The immediate impact of Dobbs was felt in Ohio, where the only option available to the parents of a 10-year old rape victim was to flee to neighboring Indiana so that their child would not be forced to carry the rapist's baby to term. But even the liberty that 10-year old's parents took advantage of is now threatened by a gender-based, Fugitive Slave Act mentality...

"We must face the truth," Andrew Hairston, Director of the Education Justice Project told the Advancement Project. "More militarized school environments do not address the root causes of mass violence." In fact, noted Jonathan Stith of the National Campaign for Police Free Schools, "Proposals that increase the presence of police, guns, and other militarized approaches to school safety only put gasoline on the fire."

The "truth" or "root cause" of mass shootings is precisely what Wayne LaPierre, the disgraced National Rifle Association (NRA) CEO/VP, sought to evade when, during his 2012 presser following the Sandy Hook Massacre, he ridiculously proclaimed that the "only thing that stops a bad guy with a gun is a good guy with a gun."

Anyone who suggests that safety is to be found in the mythical "good guy with a gun" has never served in combat.

In Vietnam, where I served (1968), we were far better equipped and armed than either the North Vietnamese Army or the Vietcong. We not only had ready access to our deadly M-16 Assault Rifles and other, even more powerful weapons, but also had the ability to call in artillery and airstrikes. Yet, that didn't prevent the deaths of 58,220 of my brothers-in-arms.

Proposals for armed school safety officers and arming teachers are but an extension of LaPierre's infamous and dangerous "more guns make us safer" canard.

Despite an increase in the number of school districts that deploy armed officers on campus, an academic study of mass shootings in the U.S. between 1980 and 2019, published last year by the Journal of the American Medical Association, failed to establish an "association between having an armed officer and deterrence of [school] violence."

Nevertheless, last month, over the opposition of educators, Ohio's Republican Gov. Mike DeWine signed into law a bill that will allow teachers, with some training, to keep a handgun inside their classrooms --- a decision that amounts to a fool's errand....

On today's BradCast: With midterm primaries in Ohio and Indiana yesterday kicking off a month of about a dozen such primaries across the country, and more to come in subsequent months, America is voting again. So, naturally, America's voting systems are failing voters again. [Audio link to full show is posted below this summary.]

In Ohio, in at least three different counties (Lucas, Cuyahoga and Williams) reports of misprogrammed systems prevented voters from casting their votes or forced them to return later in the day to do so. Electronic pollbooks used as part of computer touchscreen Ballot Marking Devices (BMDs) appear to be the culprit this time. Again. In this case, at least in Lucas (Toledo) and Cuyahoga (Cleveland) it appears the e-pollbook vendor misprogrammed them to print out barcodes on ballot cards that subsequently brought up the ballot for the wrong party when voters put those ballot cards into the BMDs to try and cast their votes. Republicans received Democratic ballots and vice versa.

The widespread failure was reportedly corrected eventually, by about 2pm. In some cases, poll workers were able to manually punch in codes to bring up the correct party ballots and precincts onto the BMD systems for voters. In other cases, voters were given printed ballots that they could fill in by hand (begging the question as to why all voters weren't simply given reliable, verifiable hand-marked paper ballots to use in the first place to avoid these ongoing electoral nightmares!) Either way, problems like these do little to foster confidence in our electoral system, particularly on BMD systems which are already 100% unverifiable after elections, making it impossible to know if votes cast via such systems actually reflect the intent of any voter.

Luckily, confidence in our voting systems hasn't been a big concern in the U.S. of late, right?

As to actual reported results of voting on Tuesday, we cover, among other things, the Democratic U.S. House race watched closed by some on the progressive left between Rep. Shontel Brown and Bernie Sanders-ally Nina Turner in the state's 11th Congressional District (which happens to touch both Lucas and Cuyahoga Counties, where voting systems failed). The contest was a re-run of last Summer's special election to fill the House seat vacated by Rep. Marcia Fudge after she was tapped to serve as Joe Biden's HUD Secretary. Turner lost once again on Tuesday, reportedly by a much wider margin this time, before suggesting in her fiery concession speech that she may be planning an independent run for President in 2024.

All of the U.S. House races in Ohio were run on a new map found by the state Supreme Court to violate the state's constitution, requiring districts that reflect the state's partisan balance after a 2018 ballot iniative for fairer maps won 70% of the vote. Ohio's Presidential contest in 2020 was about 53 to 45% in Trump's favor. Nonetheless, the new maps created by the GOP-majority Redistricting Commission in the Buckeye State will likely result in a 13 to 2 --- or maybe 12 to 3 --- advantage in favor of Republicans in Ohio's U.S. House delegation, as redistricting expert Dave Daley told me via email today. The unconstitutional map is being used in 2022 as the court challenge continues. Perhaps they'll get fair U.S. House maps by 2024. Or not.

On the Republican side of Tuesday's primaries, all of Trump's endorsed candidates --- no matter how crazy, no matter how many times they've been accused of domestic violence or sexual harassment --- won yesterday in both Ohio and Indiana. In Ohio, that even included author and former never-Trumper J.D. Vance in his bid for the GOP U.S. Senate nomination. Vance, back in 2016, said he couldn't "stomach Trump" and found him "noxious". But he changed his tune when he decided to run for the open Senate seat being vacated by retiring Republican Sen. Rob Portman. Now, Vance says, Trump's "a great President, certainly the best President of my lifetime." That was enough, apparently, to win Trump's endorsement, which appears to have catapulted Vance from third place, just a few weeks ago, to a reported win on Tuesday night. He'll be running in November against Democratic nominee Rep. Tim Ryan.

While all of this is great for Trump's considerable ego, it remains to be seen whether having a bunch of far-right, radical loons and alleged abusers who insist the election was stolen from Trump in 2020 (despite any evidence to support the claim) will be good or bad for the GOP this November. It should be a big year for them, but there are still a whole lot of X Factors that could affect so-called Conventional Wisdom on this.

Next, the voters challenging the eligibility of North Carolina insurrectionist Rep. Madison Cawthorn to run for reelection had their day in federal appeals court on Tuesday, after a Trump-appointed lower court judge tossed their Constitutional challenge to Cawthorn's eligibility under the "Insurrectionist Disqualification Clause" of the 14th Amendment. The Q&A between Cawthorn's defense attorney and one of the judge's on the appeals panel was...um...kinda mind-blowing.

As Constitutional law expert John Bonifaz of Free Speech for People, the group representing the voter challengers, summarized on Twitter yesterday: "'Let's say you want to run for office at 12 years old, or something like that,' Judge James Wynn said. 'The state can't do anything? You've got to wait until Congress says they can't run?' Cawthorn's counsel: Yes, the state has no role + must allow that 12 year old on the ballot." Even that snippet doesn't do this hearing justice. We break the whole thing down for ya today.

Then, as we try to get caught up on a bunch of stuff that's been buried by larger stories (in Ukraine, at the Supreme Court) this week, a new memoir by Trump's last Defense Secretary, Mark Esper, claims that Trump wondered why the military couldn't just shoot Black Lives Matter protesters in the street.

Finally, Desi Doyen joins us for our latest Green News Report, as unprecedented heat in South Asia is now "testing the limits of human survivability" and much more, including even some good news on Denmark going all-electric...

We had a very lively call-in show today on The BradCast, as we stacked the deck with folks who disagree with me, in response to my calling out those, particularly on the (supposed) Left, for forwarding Kremlin propaganda (including at on our own flagship station, KPFK, here in Los Angeles), over our public airwaves, amid Russia's deadly and grotesque war and war crimes against Ukraine. [Audio link to full show is posted below this summary.]

Before we get to that and to a bunch of callers on that topic...The midterm primary season gets under way in earnest this week --- with Ohio and Indiana voters holding Election Day tomorrow. So, we've got a few quick words on that, and on the gerrymandered U.S. House District map that Republicans have managed to keep in play this year, even though it was found --- four times to date! --- to be in violation of the Ohio state Constitution by its state Supreme Court. But, as we discussed in detail last week, the GOP's packed federal courts allowed the even more gerrymandered map drawn after 2010 to be used once again in this year's election, as Ohio's GOP-majority Redistricting Commission purposely ran out the clock on drawing new legal maps following the 2020 Census.

Then, it's on to our main topic: Namely, Russia's ongoing military invasion of its sovereign neighbor and the propaganda help Vladimir Putin is getting from some on the far-Left in this country who are lying and/or misinformed about it all. Hopefully, via at least some of the calls from listeners today, we straighten out at least some of what happens to be Kremlin propaganda and what is not.

It remains unclear some on the Left --- who claim to be anti-war (like us), who were critical of the U.S. when we were the empire invading a sovereign nation (as we were) --- are now having such a difficult time condemning Russia for doing the very same thing. Our anti-war position has been both accurate and consistent. As you'll hear on today's program, at least a few of our listeners seem to have a problem with that sort of consistency, choosing to blame the U.S. for Russia's war.

Today's lively conversation also comes as new polling from WaPo/ABC finds huge, bipartisan majorities of Americans support Joe Biden's actions in Ukraine, including his vow to keep American troops out of the conflict, sanctions against Russia; and sending defensive weaponry, humanitarian and economic aid to Ukraine. Despite that, in the very same poll, only a minority of Americans say they support Joe Biden's actions in Ukraine! Ya know, the same ones they previously said in the very same poll that they supported. Seriously. So, what's going on here? We open the phones to callers to try and help us understand that puzzle as well today.

Among the lively calls, several who try to forward more Russia propaganda on Ukraine (it didn't go well), and one who seemed disappointed, oddly enough, that the U.S. was trying to stay out of the direct conflict in hopes of avoiding a nuclear World War III.

As midterm primary elections begin in earnest next month, today on The BradCast, we catch up with the latest successful attempts by GOP states to undermine their constituents' wishes through new, partisan gerrymanders following the 2020 Census and the Courts which are helping them do so. In the meantime, a Democratic-leaning court in New York today did the opposite, blocking a Dems from gerrymandering in the Empire State. [Audio link to full show follows this summary.]

Before we're joined by our guest to discuss all of that and more today, just a quick kudos to Rebecca Beitsch at The Hill for coming up with a new euphemism --- or, at least, one we haven't seen used yet by the rest of the corporate media --- to report on new evidence documenting the failed Trump/GOP attempt to steal the 2020 Presidential election. It's getting more difficult by the day to do so without using the correct word, "steal", when doing so. Sure, anyone can describe the GOP's attempt to "undermine" or "overturn" or "question the results". But that gets stale after a while. So, congrats to Beitsch for reporting on their attempt to "UNWIND the 2020 election", just to freshen things up! <insert eyeroll emoji here>

Then, we're joined today by redistricting expert and author DAVID DALEY, Senior Fellow at FairVote, to get caught up on a whole bunch of recent court rulings (and outrages) from over the past week or three when it comes to the last minute efforts --- largely by Republican-controlled states --- to game the 2022 midterms (and elections for the next ten years), with outrageously partisan gerrymandering of U.S. House maps.

Daley walks us through a number of such cases, including in several states where, over the past decade, large majorities of voters have adopted ballot initiatives to prevent the very gerrymandering that Republicans appear to be getting away with, nonetheless, in their newly redistricted maps.

In Ohio, the GOP-majority Redistricting Commission has had its new maps rejected four different times in recent weeks by the state's Supreme Court, with the help of its Republican Chief Justice. Despite being ordered by the court to follow the state's Constitution --- which now requires districts that generally reflect the partisan balance of the closely divided, if GOP-leaning state --- Republican Commissioners (which include state Gov. Mike DeWine, whose son sits on the state Supreme Court but refuses to recuse) aren't even trying anymore. With primaries scheduled for next month in the Buckeye State, the Commission is "just not meeting" anymore at all, says Daley. "They're trying to run out the clock so the federal court imposes one of the unconstitutional maps that has already been rejected by Ohio's state Supreme Court."

The state's previous gerrymandered map gave the GOP a 12 to 4 advantage in U.S. House districts. The new ones, repeatedly rejected by the state court, would give them a 13 to 2 advantage, despite the roughly 53-45% partisan split in the 2020 Presidential election and a 2015 mandate from more than 70% of voters rewriting the state Constitution to ensure new maps reflect the statewide partisan makeup.

In Florida, where voters also voted for redistricting reform, things are even more obnoxious and anti-democratic. The GOP-controlled legislature produced a map giving Republicans a 16 to 12 advantage, but it was rejected by Governor and Presidential hopeful Ron DeSantis for his own hand-drawn map that is likely to result in 20 Republican House seats and just 8 Democratic ones. State Republicans "already produced a pretty good Republican gerrymander," Daley explains, "and DeSantis said, 'Wait a second, I can do even better than that.'" With the state's high court packed with his own appointees, Daley warns, "that is not a Supreme Court that we should look to for any sort of help when it comes to fair maps."

Back in 2019, the U.S. Supreme Court determined that federal courts may play no role in preventing partisan redistricting, leaving the matter the chaos of each individual state court to decide. But on the matter of racial gerrymandering, SCOTUS is still happy to tell states what they can and can't do, even when the High Court's own rulings disagree with each other.

Daley explains how SCOTUS jumped in, back in February, months before the primaries, to block a new black-majority district ordered in Alabama by a lower federal court under the Voting Rights Act because. The Supremes, on the stolen and packed Court, determined it was just too soon before the primary election to draw up a new map. But late last month, after the Wisconsin Supreme Court approved a new state legislative map drawn by the state's Democratic Governor, SCOTUS ordered the state to rewrite the map, just weeks before the primaries, to remove a new black legislative district created in Milwaukee.

"The US Supreme Court has been eager this cycle to help Republicans and to put their foot on the scale against Democrats," Daley charges, describing their rulings as "Heads I win, tails you lose. They're not even pretending anymore."

And then we get to New York, where it was Democrats' turn to face the music for gerrymandering the state's U.S. House map to add three new likely Democratic U.S. House seats. Today, mid-show, NY's high court blocked the map (appropriately, as Daley sees it), ordering a court-appointed Special Master to draw up new maps in time for this year's primary (which the court also postponed until August to allow time to create the new maps.)

Last week, Daley, a longtime proponent of fair maps in all fifty states, wrote at CNN about what he saw as the "indefensible" map drawn up by NY Dems, describing it as "among the most obscene partisan gerrymanders nationwide." NY courts clearly agreed, but even Daley's own opinion article seemed to make the case for what Democrats tried --- but failed --- to do.

"If blue state courts roll back Democratic gerrymanders, but red state judges rule as partisan ideologues, a pro-GOP bias will be baked into the national map for another decade," he wrote. "A maximally gerrymandered national congressional map is...bad in nearly every way except, perhaps, compared with the previous decade's map, rigged so Republicans held control in 2012 even when they won 1.4 million fewer votes."

As regular listeners and readers know, over the past year I've (regrettably) changed my position on partisan gerrymandering, given the gaming of the system by Republicans which has succeeded in endangering America's small-'d' democratic project entirely. Short of federal legislation to ban partisan redistricting everywhere (an effort by Dems that was blocked by all Senate Republicans last year), I've been calling on states controlled by Democrats to gerrymander wherever possible. I hate that position. It's bad for many voters in the states but, ultimately, important for something resembling democracy on the national level at a time when democracy is facing a serious challenge from the forces of authoritarianism.

But Daley disagrees with. At least in as much as he has argued that such an effort could never be successful. "A national map that has been rigged for one side to win is extraordinarily dangerous, especially when one party has completely broken faith with democracy," he tells me as we debate this point again today. "Gerrymandering the hell out of Illinois and New York doesn't save democracy. It doesn't give Democrats that much of a leg up on fixing this. It is a band-aid, when what you need is a tourniquet. It's not sufficient. By all means, go ahead and put a band-aid on, but don't think it's going to stop the bleeding."

"I'm calling for a national standard that fixes the problem in New York as well as in Texas," he argues (as do I). "Because there are not enough New Yorks to balance out the Texases and Floridas. Democrats can gerrymander the hell out of these states if they want, but it's not going to help them. What they need to do is fix the overall structural problem, or it's only going to get worse."

Prepare for it to get worse...

The bad news for democracy continues overseas on today's BradCast, but there is at least a bit of better news on that front back here at home. [Audio link to full show is posted at end of this summary.]

FIRST UP, the latest on the crisis in Eastern Europe: Ukraine declares a nationwide state of emergency; Russian troops are said to be "as ready as they can be" and "literally ready to go now, if they get the order to go," according to U.S. officials; Nancy Pelosi describes the Russia's aggression as "an attack on democracy'; China's U.N. ambassador seeks a diplomatic and peaceful solution for "safeguarding the sovereignty and territorial integrity of all states"; And a new AP polls finds little support among Americans for a "major role in the conflict" (though a "minor" one is much more popular.)

THEN, with that grim news for democracy overseas, some slightly better news back home. The GOP majority on the Ohio Redistricting Committee has, apparently, given up in their attempt to draw state legislative and U.S. House maps that they can live with and which meet the new requirements of both the state constitution and state Supreme Court. What that means for the future of those maps, with primary election deadlines drawing near in a close-divided if GOP-leaning state, is currently unknown. But it's likely not good new for Republicans who had hoped to continue their extreme gerrymanders of the past 10 years.

In the critical swing-state of Pennsylvania some (almost) unambiguously good news along these lines. After a standoff between the commonwealth's GOP state legislature and Democratic Governor, today PA's Supreme Court has selected a map to be used that is supported by Democrats, voting rights advocates and is seen as fair by political analysts, according to the Pennsylvania Capital-Star. The new map will combine two currently Republican U.S. House districts into one, to make up for PA's loss of a House seat following the 2020 census. That said, there is still an existing federal lawsuit against the new maps filed by a number of Republicans. And with the GOP's packed federal courts, anything could happen these days.

NEXT, it's back to Ukraine. Or, at least, U.S. foreign policy in Russia and Ukraine which our guest today, JOHN JUDIS, argues has helped lead to this moment of crisis and potential war for many years, not unlike other failures of U.S. foreign policy where America has failed to play the long game.

Judis is a journalist, author and Editor-at-Large for Talking Points Memo after spending two and a half decades at The New Republic. His latest book (his eighth), is The Politics of Our Time: Populism, Nationalism, and Socialism and his latest piece for TPM, which we discuss in detail today, is "A Dissenting View of US Policy toward Russia".

He details how the latest mess in Ukraine begins way back in the late 80s and early 90s and, like a number of similar U.S. foreign policy failures in recent decades, was based on the misguided theory "that as you become more capitalist, you become more democratic. This was an entirely abstract notion, not borne out by any particular experience, but more by a kind of millennial dream that Americans have had of a world transformation, of making the world like us. And it backfired."

Judis, who notes in his TPM piece that he both opposes Putin's "decision to dismember Ukraine" and supports "placing sanctions on Russia," nonetheless cites China, Iraq and now Russia/Ukraine in our conversation today as case studies where "we sort of get into these things willy-nilly. Where we start off, we're going to make things better and we end up with a big war."

FINALLY, bad news in New York? It sure seems like it today. The New York Times broke the news this afternoon that the two lead prosecutor in the Manhattan D.A.'s criminal investigation of Donald Trump and his company have abruptly resigned. That, after a monthlong pause in what had previously been an accelerating investigation last month, and after the new D.A., Alvin Bragg, finally got fully up to speed after succeeding Cyrus Vance, Jr. at the end of last year. The Times reports that Bragg reportedly has "doubts about moving forward with a case against Mr. Trump." The new D.A.'s office, however, says that the investigation remains ongoing. There is still much unknown here, but the civil probe by NY's state Attorney General Letitia James, looking into many of the same alleged bank, tax and insurance fraud schemes by Trump and his company, continues to power forward, as does another lesser discussed criminal probe by the D.A. in New York's Westchester County...

On today's BradCast: The greatest threat to autocracy is, of course, democracy. Which is why, I believe, Vladimir Putin is now threatening Ukraine and why Republicans in this country are (successfully) attacking the right to vote itself. [Audio link to full show is posted below this summary.]

On Ukraine today, we share the latest in the increasingly dangerous standoff that threatens to spark all out war in Eastern Europe, unlike anything seen since WWII. That, on the heels of Putin's increasingly militaristic and bellicose pronouncements and his unilateral declaration on Monday that two Russia-backed, separatist-controlled regions in the eastern part of Ukraine are now independent "republics" that Russian troops may enter (invade) at will, in defiance of international law.

In response to the increased aggression, and in hopes of staving off a full-scale invasion, the U.S. and some 27 European Union members have begun to institute a series of sanctions, including Germany's announcement that they are halting certification of the Nord Stream 2 gas pipeline, a lucrative project for Russia which they had spent years working to open.

In Washington today, President Biden offered brief remarks which we share, decrying the Russian President for "carving out a big chunk of Ukraine" in defiance of international law, even as Biden remains hopeful that diplomacy is still possible. At the same time, however, he announced what he described as the "first tranche" of economic sanctions against Russian financial institutions, as well as several elites and their family members, with much more to come if a full scale invasion is launched.

There is, of course, much discussion and debate about all of this, with experts and pundits choosing up sides and offering explanations for Putin's behavior. The U.S. and EU and NATO certainly play a part in this potentially lethal failure of post-WWII, post-Cold War European diplomacy. But the point for now that rings most true, at least to me, was cited today by the WaPo Editorial Board arguing that Putin's "true reason for targeting Ukraine is not Russian national security but to preserve his own power in Moscow, which would be threatened by a successful democratic experiment in a former Soviet republic of Ukraine’s size and cultural importance."

Yes, authoritarians hate democracy. It's as simple as that. Which is why we've seen, in this country of late, so many voter suppression laws adopted by GOP-controlled states in the wake of Donald Trump's loss in 2020 and his false, evidence-free claims that the election was stolen from him through some sort of "fraud".

We've covered --- and warned about --- the many new voting restrictions adopted by Republican-controlled states and legislatures since 2020 for months. Now we are finally seeing how those new suppression laws are having a direct and disastrous effect on actual elections, beginning with Texas, which is the first state to hold its primaries for the 2022 mid-terms, next Tuesday.

With new restrictions on absentee voting --- in one of the most difficult states to vote by mail already! --- an extraordinarily high percentage of absentee ballot applications have been rejected in recent weeks in the state's most populous counties. Many of the rejected applications --- more than 30% in Houston's Harris County --- were due to the new, and at times impossible, requirements to include identifying information that exactly matches that on the voter's record, even if they registered to vote decades ago and have no clue whether they included a drivers license number or a social security number or no number at all at the time.

But of those who are able to finally get an absentee ballot, the rejection rates, so far, of actual ballots in advance of next week's Election Day are stunning. 35% of ballots are being rejected in Harris County, the state's most populous (and most African-American); 26% of mail-in ballots in Dallas County; and 25% of ballots are being nixed in Collins County, just north of Dallas.

We're joined today by GRACE CHIMENE, President of the League of Women Voters of Texas, to explain what is going on in the Lone Star State; why it's going on; whether Republicans (whose voters are also being suppressed, if not in as large numbers) have any concerns about what is going on; and what, if anything, can be done about any of it in time for next Tuesday or, at the very least, before this November, when the number of voters --- and rejected applications and ballots --- will be much much higher unless the state's SB1 law is amended or blocked by the courts.

Chimene cites Texas officials who declared the 2020 election as "a very safe and secure election." Nonetheless, she notes, "the officials and the politicians who are writing these bills were the ones who won during the election. And it was safe and secure. So, really, I don't think they thought of this SB1 voter suppression bill, I don't think they thought of these ideas themselves. I think they came from someplace else and they were pushed out trying to meet somebody else's agenda of suppressing the vote even further here in Texas."

Election officials are now barred from informing eligible voters that they may vote by mail and, even when their applications or ballots are rejected, they are forced to be circumspect about why. Chimene explained that eventually officials were allowed to send a postcard to notify voters about rejected applications, but "what they don't tell them is where the mistake was in their application. They're not being told why the application was rejected, they're just notified that it was a rejected application." Notifying voters of rejected BALLOTS has been similarly fraught. "It's just a mess," the longtime non-partisan voting advocate tells us.

Chimene says that she "was hoping for some federal help, through federal legislation, such as updating the Voting Rights Act or the John Lewis Voting Rights Act, and it was so disappointing that that didn't happen." She calls out Texas Republicans for targeting voters and federal law enforcement for an inadequate response to it: "The issue is, who do they want to vote in the election, and how can they stop it? And it's just very disheartening to see this happening and that there's no help coming from the federal government."

What is now happening, in alarming numbers in Texas, Chimene explains, is "a way to stop people who have been voting for a very long time, very successfully, very securely and safely, and now they're unable to participate in the democracy. It's just bad news for democracy."

We seem to have quite a bit of that today...And not just in Texas...
