The conservative victories in favor of the Constitution and equal rights for all continue, as the Reagan/Bush I-appointed U.S. District Court Judge Vaughn Walker has just ruled that same-sex marriages in California may resume once again as of 5pm PDT, August 18th.

Opponents of equality have until then to appeal the decision at the 9th Circuit Court of Appeals.

Walker's ruling today follows his recent ruling which found that the state's Prop 8 constitutional amendment banning such marriages is in violation of the U.S. Constitution's equal protection and due process clauses.

Seriously, what part of "conservative values" and the "U.S. Constitution" do Fox "News" "conservatives" not get?

As we've been pointing out for years, and as we re-iterated yet again on Wednesday when CA's Proposition 8 banning same-sex marriage was found to be unconstitutional by a Reagan/Bush I-appointed federal judge, the ruling was "Great news for real conservatives who believe in the U.S. Constitution and its guarantee of equal protection under the law!"

Poor Fox "News" viewers, however, have been so obscenely and opportunistically disinformed for so many years about what "conservatism" actually means (basically, they've been told by the Fox/GOP opportunists that Republicanism is the same thing as conservatism, when it's usually anything but, and foolish folks on the non-Right have continued that fiction by describing them as "conservatives"), that they've had a next-to-impossible time wrapping their grotesquely disinformed brains around what last Wednesday's extremely conservative ruling actually means.

The scam that has been played on wingnuts --- inaccurately and opportunistically conflating Republicanism with Conservatism --- has rarely been more clear than it was on Fox News Sunday today, when anchor Chris Wallace's "conservative" disinformation train ran smack-dab into the brick wall of conservative facts and reality offered by Theodore Olson, George W. Bush's former Solicitor General (he of the infamous Bush v. Gore), who happens to be the plaintiff's victorious lead attorney in the Prop 8 case.

So, we'll ask again: What part of "conservative values" and the "U.S. Constitution" do Fox "News" "conservatives" not get? As we've got many such disinformed phony "conservatives" trolling us here at The BRAD BLOG, we'll look eagerly forward, as always, to their amusing, self-defeating, non-conservative, anti-Constitutional comments in reply to this video [courtesy of RAW STORY]...

'Targeted Assassinations' Threaten Very Foundation of Our Republic...

In a March 25, 2009 article, "Prosecute or Perish," in which I urged that "the survival of our Constitutional Democracy may hinge on factually justified criminal prosecutions of the Bush/Cheney cabal," and again in "Fixing the Facts and Legal Opinions Around the Torture Policy," I took dead aim at the sophistry employed by President Barack Obama to evade his constitutionally mandated obligation to see that the laws are faithfully executed. The same Harvard Law School-educated President who said that, in torture, America had lost its "moral bearings," suggested we must only look forward --- an "illogical formulation [that] was incompatible with the very essence of the rule of law."

I was naive. I thought the President was merely evading his constitutional obligation out of political expediency; that he actually intended to restore the rule of law and salvage what was left of our nation's honor.

A growing body of evidence, including confirmation contained in the recently exposed Afghan "Pentagon Papers," suggests the President did not look back at his predecessor's war crimes because he saw, in the failure to prosecute, the ground work for his own round of "Unitary Executive" lawlessness --- an expanded, illegal and increasingly covert "war on terror" in which hundreds, perhaps thousands of paramilitary assassins, operating in secret and beyond the rule of law, carry out targeted killings of "suspected" terrorists on a global scale --- a program that has already produced massive collateral casualties amongst innocent civilians who are in the wrong place at the wrong time.

Worse, as revealed by a newly filed lawsuit, the Obama administration has moved beyond the Bush/Cheney cabal's assertion of unchecked Executive lawlessness in the form of extraordinary rendition, indefinite detention and torture. The Obama administration has now not only asserted a right to assassinate anyone that the Executive branch labels a terrorist, including U.S. citizens, but has gone so far as to place lawyers in legal jeopardy should they seek a court order to block an extrajudicial execution unless the executive branch grants the lawyer permission to do so...

CA's same-sex marriage ban struck down by federal judge...

Great news for real conservatives who believe in the U.S. Constitution and its guarantee of equal protection under the law!

A U.S. District Court Judge, first nominated by Ronald Reagan and then appointed under George H.W. Bush, has struck down CA's Prop 8 which added an amendment to the state constitution banning same-sex marriage equality. The state's majority Republican-appointed Supreme Court had previously found no basis for banning same-sex marriage in the CA constitution. That finding was, in effect, overturned at the ballot box in November 2008 by Prop 8 which ended same-sex marriage in the state and left thousands of marriages in limbo until today's finding.

As New York Magazine was first to report...

This afternoon U.S District Judge Vaugh[n] Walker ruled in the case brought before him by lawyers Ted Olson and David Boies, which argued that the Proposition 8 ballot initiative denying marriage rights to same sex couples in California was unconstitutional. In a decision just handed down to lawyers for both sides, Walker ruled in that Proposition 8 is "unconstitutional under both the due process and equal protection clauses." The court, therefore, "orders entry of judgment permanently enjoining its enforcement." We're staying tuned for more updates and details on the 136-page decision, but these two sentences from the conclusion are critical:

Proposition 8 fails to advance any rational basis in singling out gay men and lesbians for denial of a marriage license. Indeed the evidence shows Proposition 8 does nothing more than enshrine in the California constitution the notion that opposite sex couples are superior to same sex couples.

That's what history sounds like. Of course, before the ruling was released, lawyers for the opposing side filed a motion to stay his ruling pending an appeal to the 9th Circuit Court of Appeals.

TPMMuckraker's Rachel Slajda reports that "Supporters of Prop 8 (that is, opponents of gay marriage) have already promised to file an appeal," and she now offers more quotes from Judge Vaughn Walker's landmark decision.

And just a reminder to those of you foes of equality and the Constitution: Remember, where same-sex marriage is found to be legal and Constitutional, it will still be voluntary. You will not be forced to marry someone of the same sex. Just in case that's been unclear up until now.

UPDATE: CNN reports that, in a separate ruling [PDF], Walker grants a stay to his finding, pending appeal by the opponents of equality. If appealed, as is almost certain, the case will go to the 9th Circuit Court of Appeals and then likely to the U.S. Supreme Court.

The madness in AZ provides ample warning, but is anyone paying attention?...

The radical-right agenda, hidden from so many of the uninformed, working class useful idiots (aka post-2008 "Tea Party" followers) was aptly described by Chalmers Johnson on the cover of Naomi Klein's The Shock Doctrine as "a conspiracy to privatize war and disaster and grab public property for the rich few...[as part of] our headlong flight back to feudalism..."

In Meg Whitman, Wall Street, 'Billionaire Sociopaths' and the Media 'Substance Deficit', we cited a Pew Research Center study on how the campaign by America's political elites to ravage the middle class has, for "wide layers of the population," destroyed "faith in the US government to secure their most basic social needs." As we observed at the time:

What has become painfully obvious is that many within these "wide layers of the population" simply do not realize that the source of the middle class demise lies not in government per se but in the carefully thought out, decades-long effort of the hard-right to "starve the beast" by massive tax cuts for those who already have too much in order to, in the words of Grover Norquist, reduce government to the point it could be "drown in a bathtub" and in order to privatize the commons so that the privileged few can be enriched beyond the wildest imagination of ordinary citizens.

An American Political Science Association study, cited by Bill Moyers in Moyers on America (2004) referred to a "radical political elite who have...inequality as its mission and has organized 'a fanatical drive to dismantle the political institutions, the legal and statutory cannons, and the intellectual and cultural framework that have shaped public responsibility from social harms arising from the excesses of private powers.'"

Into this mix comes "Tea Party in Sonora": Ken Silverstein of Harper’s Says Arizona is Laboratory for Radical GOP Policies, a powerful, must-see segment of Democracy Now (video below) which exposes the bleak future, indeed the madness, in store for all of us if we permit the radical right to assert the same control at the national level that they have already secured in Arizona.

An eerily prescient 1944 New York Times op-ed written by Franklin D. Roosevelt's then-Vice President may have best described the ultimate goal of the hard-right agenda of those who now drive the so-called "Tea Party" in 2010...

Wow. Seriously. Just...really...Wow.

Fox "News" analyst and former NJ Superior Court Judge Andrew Napolitano was featured on a segment of C-Span's BookTV over the weekend, to discuss his book, Lies the Government Told You: Myth, Power, and Deception in American History.

While being interviewed by Ralph Nader, Napolitano says what Bush and Cheney did while in office was "blatantly unconstitutional, and in some cases criminal."

When asked by Nader what the consequences should be, the judge says, in no uncertain terms: "They should have been indicted! They absolutely should have been indicted! For torturing, for spying, for arresting without warrant."

Wow. Guess his contract on Fox must be up. If it wasn't, we suspect it is now. While I'm preparing for tonight's Mike Malloy Show --- the last night of my latest week-long guest hosting stint for him --- and working on a story concerning the exclusive news we brought you on a disturbing new break in a years-long election fraud mystery in Pima County, AZ during Hour 2 last night (audio archive here, listen to "Hour 2"), I thought you might enjoy a very short, but fun clip from the first hour of last night's show.

The caller was "Billy" from Austin, and he was calling to dispute my take on yesterday's encouraging news of the U.S. District Court judge in MA who found the federal ban on same-sex marriage to be unconstitutional.

"Billy" was very confused about marriage and about being a "conservative" --- which he isn't, as I explained, while I am. Give it a listen.

"Fact, the world has divided into rich and poor as at no time in our history," warns Maude Barlowe, head of the Council of Canadians and a founder of the Blue Planet Project.

"Called the silent crisis, climate change is melting glaciers, eroding soil, causing freak and increasingly wild storms, displacing untold millions from rural communities to live in desperate poverty in peri-urban centers. Almost every victim lives in the Global South in communities not responsible for greenhouse gas emissions and not represented here at the summit."

Speaking out as a counterpoint to last week's billion dollar, G-20 Summit, whose leaders she referred to as a "global royalty, who have more in common with one another than they do with their own citizens," and as leaders who came to Toronto with an agenda which offers "more of the bad medicine that made the world sick in the first place—environmental deregulation, unbridled financial speculation, unlimited growth, unregulated free trade, relentless resource exploitation, tax cuts for the wealthy, cuts to Social Security and a war on working people," Barlowe delivered a must-see, fact-filled condemnation of a bleak economic and ecological future that is at the heart of what she described as "savage capitalism."

It is vital that the American people come to appreciate the danger to liberty as well as community posed by doctrinaire libertarianism.

Despite widespread coverage of Rand Paul's absurd criticism of the provisions of the 1964 Civil Rights Act as applied to private businesses, there has been a dearth of analysis as to how this absurdity was brought about by the serious intellectual deficiencies in doctrinaire libertarian philosophy; a philosophy which led to a second astounding Rand Paul remark.

In the face of horrendous safety records on the part of both Massey Energy, which had been found to have violated federal safety regulations thousands of times over the past several years, and BP, which had steadfastly fought off safety measures for deep water oil rigs, Rand summarily dismissed the significance of both the deadly West Virginia mine disaster and the deadly explosion at BP's deep water facility that has produced the worst oil spill in U.S. history with the cavalier, "accidents happen."

What Rand Paul has done is open a window into "libertarianism," which, contrary to the current Wikipedia definition, does not merge into "anarchism." The principle distinction arises because, as explained by Noam Chomsky, anarchism challenges not only authoritarian government but all authoritarian societal structures, including the work place.

Libertarians like Ron and Rand Paul focus exclusively on individual liberty vis-a-vis the government. They fail to appreciate that, especially in the 21st Century, the removal of government as a check against unfettered corporate wealth and power leads to "the tyranny of a corporate controlled economy"...

In "Meg Whitman, Wall Street, 'Billionaire Sociopaths' and the Media 'Substance Deficit,'" we noted:

Californians have been drawn within the cross-hairs of a propaganda blitz bought and paid for by Meg Whitman, the billionaire former CEO of eBay, who, since declaring her intent to run for governor in February, 2009, has already contributed $59 million of her own money to her "campaign" --- a one-sided political phenomenon which has seen a stealth candidate, with disturbing connections to Goldman Sachs, soar to the top of the polls because the electoral process has been emasculated by the absence of mandatory debates and meaningful investigative journalism.

Now comes a SurveyUSA poll, conducted May 6-9, revealing that Whitman's once commanding lead over CA Insurance Commissioner Steve Poizner has all but evaporated. Where she led Poizner by 22% on April 22, Whitman is now said to hold a meager 2% lead. One suspects that, in the wake of a hard-hitting, front page May 12 Los Angeles Times article, "Whitman's words put spotlight on deeds," Whitman's once-commanding lead may soon become a deficit.

The Los Angeles Times followed up on May 13 with a separate piece, "Companies challenged Poizner business claims," which revealed that a major portion of Poizner's wealth was acquired when SnapTrack Inc., the company Poizner founded, was sold to Qualcomm. Poizner claims SnapTrack invented mobile-phone GPS technology. In pending lawsuits, other companies accused SnapTrack of infringing intellectual property rights, and, the Times reports, "as SnapTrack developed its GPS technology, Poizner faced another test of his entrepreneurial skills, as a special interest trying to bend the Washington regulatory process his way."

The drastic change in the recent public opinion polls is tied not only to the fact that her fellow billionaire Poizner unleashed his own paid-for propaganda (ad) blitz, deconstructing Whitman's one-sided narrative. Nor is the change tied only to hard-hitting, if overdue, front page newspaper exposés on the facts behind how these two rapacious "business people" amassed their fortunes.

Disturbingly, Poizner's late gain in the polls may be attributed to his open embrace of Arizona's version of apartheid South Africa's infamous "pass laws." Poizner's is a cynically calculated effort to scapegoat immigrants while deflecting attention from the true source of California's fiscal woes: the very same billionaire sociopath economics in which both he and Whitman amassed their fortunes...

In Florida, state Senate Democrats are just barely blocking (for now) an abortion restriction advocated by Republicans that would force women to have, pay for, and view, an ultrasound image before having an abortion.

In Oklahoma, it is already law that women are forced to undergo and view such an ultrasound, along with listening to a detailed description of the embryo or fetus. In a completely inconsistent addendum, a doctor is permitted to withhold information about any defects that are revealed in such an ultrasound.

In Virginia, new budgetary measures cut Medicaid funding for abortions, even if the woman's life is in danger.

In Nebraska, a medically unsupported "pain provision" bars all abortions after 20 weeks and requires women seeking abortions before then to undergo a mental health evaluation.

In Kansas, only a gubernatorial veto stands between women's right to self-determination and being reported to the state for having abortions.

Why now? Foes of women's sovereignty over their own bodies have been working on abortion restrictions for decades. But after standing pat during the Bush years, perhaps thinking that sooner or later George W. Bush would give them the magic prize they've coveted for so long, all of a sudden state after state is passing abortion restrictions that make very clear the misogynistic leanings of these states' legislatures. Forcing women to have invasive vaginal ultrasounds? Forcing them to view images? Mental health evaluations?

But is it just about misogyny? Or does it have something to do with the pee-in-the-pants terror of the teabag movement at the inevitable end of white majority that's coming in this country?

There are no mistakes. As fate, or someone's idea of a joke would have it, I find myself, by complete coincidence, at the Creekside Inn in Northern California today, on totally unrelated work, on the first anniversary of the sudden and tragic death of my friend and colleague John Gideon.

John, for those who may not know, particularly for those of you who have only found The BRAD BLOG over the past year, was for many years an integral part of this place. He was the co-founder of VotersUnite.org, the author of their indispensable Daily Voting News, which we ran virtually every single day here since Election Day of 2005, an irreplaceable friend, partner and frequent contributor here at The BRAD BLOG and an indefatigable and unwavering champion of Election Integrity, reform and voters' rights --- particularly of the right not only to cast a ballot, but to have that ballot counted accurately and transparently as per the voter's intent.

It was here at the Creekside Inn, a serene, modest hotel in Northern California set around a quiet ivy-lined creek, towering old tress and a lush green courtyard, that I, John's long-time Voters Unite co-founder Ellen Theisen and a small number of other dedicated folks from the Election Integrity movement in this country (shown here), crafted a deceptively simple mission statement of sorts, which we vowed to use as a yardstick for any and all future election reform initiatives. We came to call it The Creekside Declaration:

"Mission: To encourage citizen ownership
of transparent, participatory democracy."

While John was not there in person, he certainly was in spirit. After hearing of the declaration, he began using the short statement of principle as his email signature line right up until his sudden passing one year ago today. He is here again, in both spirit and my heart, at the Creekside Inn today. That mission now continues in his honor.

His loss to us at the blog, in the EI movement, and to voters across the country cannot be adequately or fully described --- at least not by this writer.

And so, for whatever reason, one that I certainly couldn't even guess at right now, fate has returned me here today --- just the second time I have ever been here.

Well, may be I can take a guess. Perhaps it's John's handiwork somehow, trying to mess with my head, force me to remember how much I miss him on this day --- not that I need any such reminders on any day --- so that he can laugh and laugh and laugh about it all at my expense from the after life. If so, glad I could bring my old friend, confidante, partner and hero one last hearty chuckle.

So...

Has anybody here seen my old friend John?
Can you tell me where he's gone?
He freed a lot of people, but it seems the good they die young.
I just looked around and he was gone...

Russian Television's English language satellite broadcast channel, RT, tracked me down on the road to comment on George W. Bush's speech yesterday at a conference on "Internet Freedom" at his George W. Bush Freedom Institute in Dallas.

A speech by Bush on "Internet Freedom"?! Irony much? Um, yes.

As it turns out, the Internet connection in the little town I was in was not stable enough to handle a Skype video interview, so my contribution had to be via telephone. Here's their story...

Amidst exploding bombs, smoke billowing from sinking battleships and dead bodies floating atop the oil slicked waters of Pearl Harbor, it was not all that difficult to appreciate the damage wrought by a surprise attack launched by the Empire of Japan. The same was true when we watched in horror as the smoldering twin towers of the World Trade Center precipitously collapsed on September 11, 2001.

Like these two earlier pivotal events, January 21, 2010 is, "a date which will live in infamy." Yet, unlike Pearl Harbor and 9/11, most Americans do not recognize it as such. This attack came not by way of planes or bombs delivered by some foreign menace. It came from within courtesy of what Professor Cass Sunstein aptly described as "radicals in robes" --- four directly connected to the Robert-Bork founded, billionaire-funded Federalist Society; all five as appointees of the Reagan and two Bush administrations. Men bent on unraveling the very constitution they had all solemnly sworn to uphold.

Their assault, though subtle, wrought far greater devastation than either Pearl Harbor or 9/11. They did not merely attack planes, ships and buildings. They assaulted the very foundations of our constitutional democracy...
