On today's BradCast: If lying to Americans about crime failed to result in a "red wave" for Republicans in 2022, perhaps lying to them about "woke" banks will do the trick in 2024! I'm sure it'll work. [Audio link to full show is posted below this summary.]

Among the many stories and important context offered on today's program...

  • Moody's considers downgrading the U.S. banking sector in the wake of several bank failures in recent days, even while declaring that the industry's outlook remains strong.
  • Inflation has eased slightly over the past month, according to the U.S. Bureau of Labor Statistics. Wall Street rejoices.
  • Elizabeth Warren, as usual, was right when she warned in 2018 that rolling back the Dodd-Frank Act (enacted to prevent bank failures after the 2008 banking crisis) to loosen regulations and oversight of banks like Silicon Valley Bank and Signature Bank would end in disaster. As she noted at the time, before Donald Trump signed the bill to loosen restrictions on financial institutions: "Washington is about to make it easier for the banks to run up risk, make it easier to put our constituents at risk, make it easier to put American families in danger, just so the C.E.O.s of these banks can get a new corporate jet and add another floor to their new corporate headquarters." As usual, we should have heeded her warning.
  • Today we explain exactly happened that resulted in the failure and subsequent federal takeover of SVB and Signature by the FDIC, in case it hasn't yet been made clear. And, while the unnecessary failures stem directly from loosening government oversight and restrictions on banks to gamble with depositer funds, as allowed by Congress and Trump in 2018, what didn't cause it, is "wokeness." That's the explanation from Fox "News" over the past few days for what happened.
  • The cause of the bank failures was also not ESG (Environmental Social Governance) or DEI (Diversity, Equity and Inclusion, as Fox itself boasts about on its own company's website) or CRT or LGBTQ or anything else that Fox and Ron DeSantis are lying about to Americans about.
  • But what does appear to be true, when it comes to the latest Fox/DeSantis boogeyman of "woke", is that Americans have no problem with being "informed, educated on, and aware of social injustice," the definition of "woke" according to most Americans in a new USA Today/Ipsos poll. The same survey also finds Americans overwhelmingly (75% to 21%) in opposition of book banning by state's such as DeSantis' Florida.
  • 81-year old Republican minority Senate Leader Mitch McConnell has now been released from the hospital after suffering a concussion from a fall last week. But he has checked into inpatient rehab for some reason. We truly hope he will be okay, if only because he may now be the only thing still holding together Congressional GOP support for Ukraine in its war against imperialistic invading Russia.
  • As we learned on Monday night via Tucker Carlson on Fox, DeSantis is now against supporting Ukraine in what he now describes as a "territorial dispute" with Russia, the authoritarian-led nation that has invaded it. As it turns out, DeSantis, while a member of Congress, was strongly in favor of the U.S. supporting Ukraine with lethal aide against Putin. That was before he became a contender for the 2024 GOP Presidential nomination and decided to be against it. The survival of democracy in Europe is, apparently, no longer important for either of the GOP's two 2024 front-runners. Donald Trump has said his "peace plan" is to allow Russia to "take over" parts of Ukraine.
  • But some good news for democracy out of New Mexico, where the state legislature finally passed a voting rights bill on Monday that will expand the franchise to all residents who are now out of prison; strengthen access to the ballot for Native Americans; make Election Day a state holiday; and significantly strengthen the state's automatic voter registration program.
  • Finally, Desi Doyen joins us for our latest Green News Report. Why isn't the FBI or DoJ investigating the broad, multi-state conspiracy, carried out by Trump supporters after the 2020 election, to breach sensitive voting and tabulation systems? Especially with the 2024 elections now coming into view? Disturbing new evidence of the DoJ and FBI's LACK of action on today's BradCast!

But, first up, a few quick words on the federal takeover of several failed banks late last week and into the weekend (after the Trump Administration rolled back regulations enacted after the 2008 banking crisis to help prevent such failures), and then on Biden's decision to allow a controversial new oil project on federal lands in Alaska, while otherwise ordering the federal protection millions of acres in Alaska and the Arctic from similar future drilling projects.

Next, a few quick words on former Vice President Mike Pence's weekend comments at the Gridiron Dinner in D.C., characterized by many in the corporate media as his "toughest words yet" against Trump's incitement of insurrection on January 6, 2021.

While Pence was, in fact, heroic that day in refusing to leave the Capitol while it was under siege by Trump supporters, until the Electoral College vote was officially certified, the former Veep's recent legal challenge to a Subpoena to testify before the Grand Jury in Special Counsel Jack Smith's probe of the deadly 1/6 probe is unconscionable.

Among Pence's reported comments at the no-cameras-allowed Gridiron Dinner on Saturday: "History will hold Donald Trump accountable." (No, sir. It's not history's job, it's law enforcement's! And, as a witness to a crime, it's your responsibility to help them!) Also, he repeatedly praised media and said, "I expect members of the fourth estate to continue to do their job" in covering the tragic, shameful events of that day. But, guess what? While it's the media's job to report on what happened, if witnesses don't tell law enforcement what they know, then those who should be held accountable will not be.

Then, speaking of people not being held accountable, why hasn't the FBI begun a probe of the multi-state effort, headed up by Trump's then-attorney Sidney Powell, to unlawfully and surreptitiously make copies of voting and tabulation system software in at least four states after the 2020 election? We now know that this happened in Coffee County, Georgia, Mesa County, Colorado, several townships in Michigan, and at least one county in Pennsylvania. We also have evidence that the conspirators planned to breach the election system in Nevada as well.

America's computerized election systems were officially designated as "critical federal infrastructure" during the Obama Administration. Shouldn't evidence of a multi-state conspiracy to unlawfully make copies and release that proprietary software publicly be a crime worth probing by the FBI? Especially before 2024?

SUSAN GREENHALGH, a longtime election integrity and transparency expert and Senior Advisor on Election Security at Free Speech For People thinks so. She and 14 other cybersecurity and voting system experts wrote a letter [PDF] last December to Attorney General Merrick Garland, Special Counsel Jack Smith, FBI Director Chris Wray and Cybersecurity & Infrastructure Security Agency (CISA) Director Jen Easterly, seeking a federal probe, given the overwhelming evidence of this MAGA conspiracy and the recent evidence that they are using the stolen software and knowledge gained from it for potentially nefarious means.

"The people that got the software seem to be interested in further disrupting elections," Greenhalgh tells me today. "They already tried once to disrupt an election and impact the results in 2020 and we see that this is continuing. The software that was taken unlawfully in Coffee County, Georgia, showed up at CPAC [the Conservative Political Action Conference] CPAC last week, in a presentation by a bunch of conspiracy theorists making a lot of unfounded and really disturbing false claims about elections in it."

"We can see the software already being used for disinformation campaigns," she continues, "but it could actually be used for much worse, like to reverse engineer it and create malware to impact and potentially corrupt an election."

As the Los Angeles Times reported last week, Greenhalgh has now heard back from the head of the FBI's Public Corruption and Civil Rights Section, in a polite, if terse, four-paragraph letter [PDF] that seems to not only suggest that the FBI is not investigating the matter, but to do so they would have to receive a request from local or state officials.

That doesn't make much sense. This is a federal issue, if only because it appears to be conspiracy stretching across multiple states. Moreover, as Greenhalgh explains, such requests have been made, for example, by the State Board of Elections in Georgia.

So, what is going on here? Is the matter being probed by the feds, but the FBI is suggesting otherwise (since they may not wish to comment on ongoing investigations)? Is it not being probed at all, for some reason? If so, why not? And, why does all of this matter? Greenhalgh answers those questions and many others on today's BradCast!

Today on The BradCast: The so-called investigations of the Biden Administration by GOP-led Congressional committees are virtually guaranteed to crash and burn for Republicans in the months ahead. But whether they crash and burn the national and global economies in the meantime remains a very real question. It's one about which our guest today has a few very interesting suggestions for Democrats. [Audio link to full show is posted below this summary.]

First up, however, we pick up a bit on yesterday's coverage helping to gird you for the circus of insanity now barreling toward all of us with the GOP's takeover of the U.S. House. Yesterday, we detailed NBC's Chuck Todd (of all people!) calling out the lies of Ohio Rep. Jim Jordan --- the new Chair of both the House Judiciary Committee and the GOP's newly formed Select Subcommittee on "The Weaponization of the Federal Government" --- regarding Jordan's false equivalency between the handful of classified documents discovered and promptly returned by President Biden's aides, and Donald Trump's more than a year-and-a-half long effort to retain hundreds of classified documents he stole from the White House and refused to return.

In a similar vein today, the new Chair of the House Oversight Committee, Kentucky Rep. James Comer, made a yutz of himself on CNN over the weekend, trying to explain why President Joe Biden and his family must be investigated for "influence peddling," despite the lack of evidence to support the charge. That while, he insisted, there is absolutely nothing to look into regarding the mountain of actual known evidence suggesting influence peddling by Donald Trump and his family.

For good measure, we also help Marjorie Taylor Greene embarrass herself today by simply playing some of her very serious questions to the U.S. Comptroller --- about Drag Queen Story Hour and an elementary school she claimed received $5.1 billion in "COVID Cash" to teach Critical Race Theory --- at a House hearing today.

As to real damage that Republicans are capable of causing, the Treasury Department is currently taking "extraordinary measures" to avoid defaulting on our national debt for the first time in U.S. history as House Republicans figure out how to best hold the nation's (and world's) economy hostage to demands of cuts to federal spending before they are willing to raise the statutory debt limit. Unless they do so very soon, giving authority to the U.S. Treasury to borrow the money needed to pay for stuff that Congress and Presidents of both parties long ago authorized and/or purchased, the global economy could come crashing down on everyone. The White House refuses to negotiate on whether our bills must be paid. But House Speaker Kevin McCarthy, on behalf of his far-right caucus, is holding out for...something...though he has yet to make clear precisely what they want.

We're joined today by KEVIN DRUM, longtime blogger formerly of Washington Monthly and Mother Jones, now back on the indie blogging beat at his site, Jabberwocking, for insight on this dangerous mess.

In addition to thoughts on how he sees all of this ultimately shaking out; whether Republicans will really pull the trigger on the hostage this time; how it played out the last time they tried the same gambit when they had control of Congress while a Democrat occupied the White House in 2011; and the history of why the U.S. stands nearly alone among developed democracies in even having such a dumb statutory limit on paying our bills, Drum recently wrote about a couple of ways that Dems may consider moving forward without a vote from Republicans at all.

One idea long discussed by many on the Internet is that the President has the authority to simply order the minting of a $1 trillion platinum coin. Drum explains that well-worn --- if never invoked --- theory, what makes it lawful, and if it would actually work to allow our bills to continue to be paid without Congress voting to raise the debt ceiling.

Another idea he prefers, however, involves calling the GOP's bluff by citing Section 4 of the 14th Amendment of the U.S. Constitution which plainly states "The validity of the public debt of the United States, authorized by law ... shall not be questioned" and telling Republicans to "pound sand." Just continue writing checks as usual and let Republicans go to court to get a ruling that the U.S. Government must immediately stop sending Social Security checks to grandma, stop issuing food stamps to hungry families, stop paying for medical care for the poor and elderly, stop all military spending, and stop all interest payments on U.S. treasury bonds, etc.

"If this goes to court for one reason or another, that's actually pretty useful," Drum argues. "It makes Republicans really take a stand. It makes it clear that Republicans are the ones who are trying to cut off food stamps or Social Security or whatever it is."

But, while Drum explains why he believes it's a "low-risk" option, it could still be a dangerous one nonetheless. A favorable decision by the U.S. Supreme Court in days of yore might have been a no-brainer. But, with an entirely corrupted, far-right extremist super-majority now at SCOTUS, it's anyone's guess as to whether they would vote to uphold the clear text of the Constitution or not.

There's a lot to discuss with Drum today! I hope you'll tune in!...

Is there any amount of blatant corruption that would result in Ohio voters finally turning against Republicans? As we discuss in detail on today's BradCast, state GOP lawmakers seem to really be testing that question at this point. [Audio link to full show is posted below this summary.]

But, first up, speaking of testing voters, the Treasury Department made it official today. The U.S. Government has now hit its current, statutory borrowing limit. We are now officially using "extraordinary measures" to continue paying our bills to avoid defaulting on our debts. But that can only go on for so long. At this point, according to Treasury's best guess, the U.S. will see its first-ever default "before early June" unless House Speaker Kevin McCarthy and his Republicans in Congress cast a simple vote to raise the amount we are allowed to borrow so that we can pay for all the stuff that Congress and Presidents of both parties long ago agreed to pay for.

It's not hard. It's been done about 80 times since the 1960s, mostly without a problem. But now, with a Democrat in the White House and radicalized Republicans in control of the U.S. House, GOP hard-liners seem determined to play a dangerous game that could result in a national or even world-wide recession or depression. They are pretending to care about the national debt, after years of voting to increase spending while reducing revenue with huge tax cuts for corporations and the wealthy. Their performative actions now --- as they hold the nation hostage, demanding cuts to Social Security and Medicare --- will only make the national debt worse. Will voters remember, the next time they go to the voting booth, the damage the GOP seems hell-bent on causing?

We can only hope there will be some not totally insane, "moderate" Republicans left in Congress to join with Democrats to end this madness before its too late, because nobody knows how bad the damage will soon be if they don't. They are likely to run this up to the wire. Again. So, buckle up.

Meanwhile, there's Republican-controlled Ohio, with its totally not insane, supposedly "moderate" Republican Governor, Mike DeWine. He just signed legislation, passed by the GOP state legislature, redefining natural gas --- one of the worst causes of global warming --- as "green energy" under state law. Not insane or corrupt at all, right?

As it turns out, DeWine and state Republicans, once again, seem to be participants in another dark money corruption scandal courtesy of the fossil fuel industry. That, as the state's Republican former House Speaker, Larry Householder, begins his $60 million federal bribery trial next week. That, after Householder, former Ohio Republican Party chair Matt Borges, three others and a dark money political group controlled by Householder participated in "an elaborate scheme, secretly funded by FirstEnergy, to secure Householder's power, elect his allies, pass legislation containing a $1 billion bailout for two aging nuclear power plants, and then vex a ballot effort to overturn the bill with a dirty tricks campaign," according to prosecutors.

Householder shepherded the 2019 passage of the bill to bailout the nuke plants (and a coal-fired power plant) owned by FirstEnergy, a huge energy and fossil fuel conglomerate based in Akron. The bailout was to have been paid for with an additional fee on the utility bills of Buckeye State rate payers, according to the legislation that was signed be DeWine just hours after passage.

And now, it seems, DeWine has done it again. This time on behalf of the natural gas industry. But, why not? Last November, Ohio voters said they didn't mind all the corruption. DeWine easily won a second term in office and state GOP lawmakers increased their super-majorities in both chambers of the legislature.

But, just in case the voters get wise, DeWine recently signed a major overhaul of state election laws, implementing a series of new restrictions on voters. One of those restrictions, however, will make it more difficult for active-duty military members overseas to cast their votes without being disenfranchised. Oops. Military families are said to be furious. But do Republicans actually care about that either? Why would they?

Controversial partisan hand-count in Maricopa County also found 2020 margin increased for Dem over Repub in U.S. Senate race; Plus: GOP Senate now threatening to force unprecedented default on U.S. debt...

Now, even the Cyber Ninjas agree that Donald Trump lost, and by more than originally thought. The full, final, long-awaited report is set to be released on Friday in three different "volumes" in which they hope to bury the lede. But we've got the breaking skinny, exclusively reported for you on today's BradCast. [Audio link to full show is posted below this summary.]

According to a months-long, so-called "forensic audit" and hand-count of more than 2.1 million ballots in Maricopa County (Phoenix), Arizona from the 2020 election, not only did Joe Biden defeat Trump, as previously reported by the County and the state, the private partisan company hired by the GOP state Senate to carry out the exercise, found that Biden actually received more votes over Trump than originally reported.

Information obtained just minutes before airtime today, reveals that the months-long "audit" by the far-right, partisan, conspiracy-promoting Florida company named Cyber Ninjas, headed up by CEO Doug Logan, determined that Biden's vote total in the state's most populous county was actually larger, by about 100 votes, than the certified numbers, while Trump's total decreased by more than 200.

The certified results in Arizona determined that Biden defeated Trump by about 10,000 votes statewide, and by some 45,000 votes in Maricopa.

The Ninjas' "clown show" hand-count was paid for partially with Arizona taxpayer dollars, along with millions in private donations raised from duped Trump supporters who believed his claims that the election was somehow rigged in the state with the help of Dominion's voting and tabulation computers. The post-election review was carried out largely without public or media oversight, but it found numbers remarkably similar to those initially tallied by the County's Dominion tabulators, as previously reported by Maricopa County and certified by the state.

Similarly, the Ninjas' hand-count of the U.S. Senate race between Democrat Mark Kelly and then Republican Senator Martha McSally --- the only other statewide race won by Democrats last year --- found an increase in the margin of the Democrat over the Republican. In the Senate contest, both candidates lost a small number of votes compared to the County's certified computer tally, according to the numbers the Ninjas are set to report publicly on Friday. While Kelly lost fewer than 100 votes in the private hand-count, McSally lost more than 500.

The final report, scheduled for its long-awaited release tomorrow, will include three different volumes. Volume I is said to include the Ninjas' "Executive Summary & Recommendations". Their recommendations, as we have learned, are fairly standard recommendations for ways to improve local procedures, similar to recommendation often made by actual longtime Election Integrity advocates in previous elections in both Arizona and other states. The second volume of the report details "Operations and Methodology" claimed to have been used by the Ninjas. And the third, by far the largest and most detailed, is titled "Results Details".

It is not until the third volume of the report that the Ninjas finally get around to detailing the actual results of their hand-counts as compared to the County's tally. They almost precisely confirm the originally reported official results of both the 2020 Presidential and Senatorial races in Maricopa County. There still may be some changes made to the report before the final version is released on Friday.

I suspect we'll have more details on all of this in the coming days, since today's program began just minutes after we obtained a large amount of the data, which we work through on air.

What is clear, however, is that Republicans who were told that the election in Arizona was somehow manipulated, were lied to. From our review of the Ninja's information, there remains zero evidence of fraud that might have altered the ultimate results in either the county or the state. Nonetheless, based on the theatrical performance put on by the Ninjas beginning in April and continuing over the past five months, Republicans in states across the country are now planning similar, taxpayer funded exercises to review the results of the 2020 election. They may be as disappointed as the Ninjas and those who gave them their money.

If the Arizona findings are echoed elsewhere, the Republican Party is on the verge of wasting a whole lot more taxpayer money, along with millions in private donations that their "forensic audit" proponents are currently raising to fund those similar investigations.

Beyond that on today's program, we cover, in some detail, the Congressional GOP's dangerous threat to force a default on the good faith and credit of the U.S. Government. Senate Republicans are currently vowing to block an increase in the nation's allowable statutory debt limit before the U.S. runs out of borrowing power to cover bills for stuff approved by Congress (both Republicans and Democrats) long ago. That, as Republicans in the Senate also threaten to force a full government shutdown as the new fiscal year begins on October 1.

We've got a lot of detail on that shameful, reckless and under-reported mess today, as Republicans, once again, hold a nation hostage to their demands...even if, this time, they don't seem to actually be making any. They appear to simply be causing havoc and potentially costing the U.S. economy trillions, simply because they can.

CORRECTION 9/23/2021: In the article above, I initially misidentified Cyber Ninjas' CEO Doug Logan as Doug Jones, who, unlike Logan, is an actual voting system and cybersecurity expert. Another Doug Jones is the former Senator from Alabama. Also, while going through the just obtained information live on air, I misspoke at one point to say there were some 4 million ballots cast in Maricopa. In fact, as I noted elsewhere during the show, there were 2.1 million ballots cast in the County last November. I had misread, on the fly, some of the data showing 2.x million votes tabulated by the County originally and 2.x million tabulated by the Ninjas. I read that on the fly on air as 4 million votes total (incorrectly seeing those numbers as one row for Trump and the other for Biden, when they actually were for each of the two different tallies.) My apologies for both errors!

On today's BradCast: It's nice to see hundreds of companies and corporate executives coming out in favor of democracy and voting rights. If only they actually meant it. [Audio link to full show is posted below this summary.]

First up today, however, the Biden Administration announced a spate of new sanctions against Russian organizations and individuals in response to both the massive Solar Winds hack of top U.S. agencies, including including the Treasury, Justice, Energy and Homeland Security departments, as well as for what is described as interference in the 2020 election on behalf of Donald Trump.  At the same time, the Administration seems to be going out of their way to downplay the sweeping sanctions by suggesting that they are open to top level discussions to avoid further exacerbating growing tensions between the two nations.

But one of the 32 individuals sanctioned is of note today because the announcement from the U.S. Treasury Department refers to the 2016 election, charging that the individual, Konstanin Kilimnik shared proprietary polling information given to him by Trump's first campaign manager, Paul Manafort, directly with Russian Intelligence Services.  If true, that would be significant new information. Previous reports on Russia's involvement in the 2016 election from both Special Counsel Robert Mueller and the bipartisan Senate Intelligence Committee cite the information Manafort is said to have given to his former business associate Kilimnik, a Russian and Ukrainian political operative linked to Russian intelligence. But neither of those voluminous report goes so far as to say that the data was subsequently given directly to Russian intelligence services.  Those reports acknowledge they were not able to learn what came of it after it was handed over to Kilimnik. Today's announcement of the sanctions by the Treasury, however, notes: "During the 2016 U.S. presidential election campaign, Kilimnik provided the Russian Intelligence Services with sensitive information on polling and campaign strategy."

As national security website Just Security observes: "The Treasury Department’s new statement raises questions about why this information is coming out now and why the Special Counsel’s office did not have access to it during its investigation. Was it not available then or did it exist but was not provided to the Mueller team?"   So, does this mean the Biden Administration has uncovered details on manipulation of the 2016 election that was previously hidden or withheld by the Trump Administration?  It looks like the "Clean up on Aisle 45" will be continuing for quite some time. There is a LOT to clean up.

In not entirely unrelated news, hundreds of companies and corporate CEOs issued a full-size, two-page ad in the New York Times, Washington Post and other papers this week, with a short statement purporting to declare "WE STAND FOR DEMOCRACY," and noting: "We all should feel a responsibility to defend the right to vote and to oppose any discriminatory legislation or measures that restrict or prevent any eligible voter from having an equal and fair opportunity to cast a ballot."

Though the statement doesn't mention any specific states, it was issued in response to Republicans' recently enacted voters suppression law in Georgia and dozens of other states where similar restrictions on the franchise, in bills sponsored by GOP state lawmakers, are moving forward.  All of which is said to be in response to false claims by Trump and Republicans of massive fraud in 2020.  Georgia's new law, for example, makes it more difficult to vote by mail, limits the use of drop boxes, bans the distribution of food or water on long voting lines (which are all too typical in certain parts of the Peach State) and allows the partisan GOP state legislature to replace bipartisan County Election Boards with a single partisan person who will be able to unilaterally undermine elections or even overturn results.

While statements like the one issued this week in the two-page ad --- and, before it, by Atlanta-based companies such as Coca-Cola, Delta Airlines --- have resulted in good publicity for those signed onto them, they have also brought blowback from the right, leading Republicans (who pretend to abhor so-called "cancel culture") to demand boycotts of any company which stands up for voting rights.

I have railed in recent weeks about the absurdity of Republicans finally paying attention to concerns about new voter suppression laws only now that a number of corporations have come out in apparent opposition to such laws. Corporate entities, it seems, have far more sway with the GOP lawmakers who ignored weeks of complaints and protests about the new laws from actual voters before the GA law was passed.

But our guest today is seemingly even more cynical about these recent corporate declarations of fealty to democracy. We're joined today by MICHAEL HILTZIK, Pulitzer Prize-winning journalist and business columnist at the Los Angeles Times. He argued in his column this week that many of the "vague" declarations recently by large corporations are no substitute for actual action. He cites a host of companies, for example, which, following the January 6th U.S. Capitol insurrection, vowed to suspend donations to lawmakers who had voted to overturn the Electoral College results that same day. Despite those public pronouncements, he details one company after another --- from Jet Blue to AT&T to Toyota --- which, despite their previous public claims, have since given plenty of money to dozens of Republicans who voted against the certification of Biden's Electoral College victory.

In his column, he notes that while many companies and executives have come out in opposition of suppressive voting laws, almost none have gone on record to demand the passage of measures which would counteract them, such as the John Lewis Voting Rights Act or H.R. 1, the For the People Act.

"It's not that unusual for businesses to affiliate themselves on the side of the angels when they feel a lot of popular pressure to do so.  But once again the question is, what are they going to do about it?," Hiltzik tells me today. "Let's face facts. Many of the companies --- if not all of them --- that signed on to these statements, these honeyed words, had been assiduous supporters of the politicians who are now out there introducing and passing laws that restrict the voting franchise."

Criticizing their failure to speak out before Georgia's law was adopted, for example, he says, "They didn't really put their reputations on the line when they didn't think they had to.  And, as a result, we have a law in Georgia that's going to be very hard to repeal because the more these companies come out and say this is wrong, the more the rightwing legislators who passed it are doubling down, saying 'We're not going to kowtow to these liberal leftwing corporations'.  So they lost their chance. They're trying to recover. But I don't think they really deserve a lot of credence just by signing a statement."

Moreover, he explains, many of these very same companies have been opponents of democracy within their own corporate organizations. "What's really hypocritical is that these same companies that have said 'We believe in democracy, we believe in everybody having a vote' --- they've actually gone to the Securities and Exchange Commission and asked for, and received, a tightening of the rules that makes it even harder for small shareholders to get resolutions on the annual meeting agenda, and to actually get votes on the resolutions that they submit."

There is plenty of cynicism on today's show to go around. And it extends to our discussion of the need for campaign finance reform, and several neat GOP tricks that have long been used to prevent such long-overdue efforts to keep corporations out of our elections altogether.

Finally, Desi Doyen joins us once again for our latest Green News Report, which, as always, is chocked full of important news, including Japan's announcement that they intend to dump more than a million tons of radioactive water from the crippled Fukushima nuclear plant into the sea. On today's BradCast: The effort by Donald Trump and Republicans to steal the Presidential election with false allegations of "voter fraud" didn't work. But that tsunami of disinformation is now being used to advance new restrictions on voting in the states as the GOP obstruction gets underway in the new Democratically-controlled U.S. Senate.

First today, there is quite a bit of news out of both the White House and the Senate. Among those stories covered today...

  • President Biden's flurry of executive orders continue, including one today that calls for an end to privately-run federal prison facilities.
  • Biden's nominee for Sec. of State, Anthony Blinken, was confirmed in the Senate. His nominee for Treasury Secretary, Janet Yellen, the first woman in that role, was sworn in today by the nation's first female Vice President.
  • Mitch McConnell caved in his demand that Chuck Schumer and the Democrats promise to not do away with the wildly undemocratic legislative filibuster before he would agree to a new power-sharing agreement in the nation's wildly undemocratic upper chamber of Congress
  • The historic second impeachment of Donald Trump, on charges of "Incitement of Insurrection" for the deadly, January 6th U.S. Capitol riot, formally began with Senators sworn in on Tuesday as "impartial" jurors and a vote by 45 Senate Republicans to toss out the whole matter entirely.
  • And, before this one slips completely down the memory hole...Charges filed by the Justice Department against several military veterans who took part in the attempted insurrection at the Capitol that killed five people, include allegations that dozens of the former military insurrectionists pre-planned their coordinated attack, had hoped to arrest lawmakers, and appear to have had disturbing help from at least one, still-unidentified Congressional insider who gave the seditionists real-time help during the attack to locate lawmakers who had been shuttled into secured locations below the Capitol.

Then, we're joined by DAVID DALEY Senior Fellow at FairVote and author of the books UNRIGGED: How Americans Are Battling Back to Save Democracy and RATF**KED: The True Story Behind the Secret Plan to Steal America's Democracy. The latter documents the GOP's ingeniously insidious --- and successful --- plan to capture electoral control of statehouses in the 2010 elections in order to gerrymander the hell out of them for the next 10 years (or more).

Daley writes this week at Boston Globe about the latest effort by GOP state legislators to exploit Trump's absurdly false claims about "voter fraud" in the 2020 election in order to implement new restrictions on voting at the state level and new ways to game the electoral college vote. Among the states we discuss where Republicans are right now citing false fraud claims in order to game the systems: Wisconsin, Michigan, New Hampshire, Georgia, Minnesota and Texas. These efforts are very real, and may well work, even in states which currently have Democratic Governors.

We also discuss the ridiculously undemocratic Senate, where Democratic Senators represent tens of millions of more voters than Republicans but, due to "the original gerrymander" as Daley describes it, are barely able to win 50 percent of the seats. "The US Senate is weighted so viciously towards small states in a way that the founders, if they saw it now, they would be truly horrified," he tells me.

"You've got a 50/50 body and yet, those 50 Democratic Senators are representing about 41.5 MILLION MORE PEOPLE.  When you add into that the small-state bias of the Electoral College, when you add into that the advantage that that bias has given Republicans in selecting Supreme Court Justices --- five of these nine Justices  on the Supreme Court selected by a President that lost the popular vote --- when you factor in the advantages that Republicans have with gerrymandering and geography --- all the way down from the US House to the state legislative level --- we are looking at an epidemic of Republican minority rule in this country."

And then there's the need to get rid of the undemocratic filibuster in the already wildly undemocratic Senate if Democrats hope, as they are now promising, to quickly accomplish "big, bold things" done. One of those "big, bold things," as we discuss, is HR-1, the "For the People Act." It's an enormously ambitious and much-needed bill that includes a ton of long-overdue reforms for voting and fair elections; ending dominance of big money and dark money in politics; and re-enforcing disclosure and ethics rules for members of Congress. But, as long as the filibuster remains in place, it will be next to impossible to see that, or any of the other much-needed reforms get through Congress. Constituents of Democratic Senators Kyrsten Sinema in Arizona and Joe Manchin in West Virginia may wish to mention that to them. Repeatedly.

On today's BradCast, it's concierge service from the Fed for Wall Street during the crisis, as American workers are left fighting for table scraps to stay alive. Again. [Audio link to full show is posted at end of summary.]

New weekly unemployment numbers out on Thursday from the U.S. Dept. of Labor suggest that while new jobless claims are beginning to slow, they are still coming in each week at all-time record numbers. Another 2.1 million Americans filed new claims last week, bringing the number of unemployed to Great Depression era levels of nearly 41 million Americans out of work. Another way to look at it is that a staggering one in four working Americans has filed for unemployment over the past 10 weeks since the COVID-19 crisis began in earnest in the U.S. Those official government numbers [PDF], however, are still lower than the real unemployment numbers, as millions are believed still stuck in line or having trouble getting through to still-overburdened state unemployment offices.

"A closer depiction of reality in the crisis," our guest DAVID DAYEN of The American Prospect, reports today, is a recent Census Bureau survey finding "that nearly half of all households have lost income" since the crisis struck in mid-March. At the very same time, however, as jobs are still disappearing and S&P 500 companies report an average 13% loss in profits during the first quarter of the year, the stock market has been soaring of late. Even with today's record jobless numbers, the market continued to rise (though it dropped a bit just before today's close) with the Dow up over 1,000 points in the past three days and the S&P 500 reporting record gains over the past month.

Another study cited by Dayen today comes from the Institute for Policy Studies, finding that "since March 18, as 100,000 died from COVID-19 and 40 million lost their jobs, billionaires in America have added $485 billion in wealth." Must be nice. So why is this happening? Why does the economy appear to be tanking everywhere except for on Wall Street?

Dayen, who, in his daily "Unsanitized" columns at The Prospect has been reporting for weeks on the "$4.5 trillion money cannon" unleashed by the Federal Reserve, with the approval of Congress in the CARES Act. He explains how that relief bill gave the go-ahead for the Fed to signal in late March, for the first time in history, that they will backstop corporate debt for huge companies. Without spending a dime, the signal the Fed gave on March 23rd is that investors didn't have to worry about about any risk associated with buying bonds from those companies. The Fed would back them up in the event the companies failed. So, as Dayen detailed this week, troubled firms like Carnival Cruise Lines, which is unable to make a penny now in the cruise line business, and Boeing, which was already in trouble before the coronavirus crisis began, are still raking in tens of millions (even billions) of dollars in the bargain. And, since the funding is coming from private equity firms and hedge funds (as guaranteed by the federal government), that "mothers milk", as Dayen describes it, is coming with no strings attached, unlike direct loans from the Government's CARES Act might have. That means, he says, that at least 49 major companies have brought in enormous sums of money during the crisis this way, even as they've laid off tens of thousands of workers at the very same time while using their windfall of cheap money to pay executive bonuses and purchase stock buybacks as working class American suffer in a way they haven't since the Great Depression.

"What idiot would send money to Carnival Cruise lines right now?," Dayen quips, before explaining how the Fed's announcement gave the go ahead to private equity firms to invest in the company anyway. "What they're saying is 'We're going to support the entire market'. ... They're essentially saying to investors, we will take care of you, we will do whatever it takes. The markets take that as a signal that they're going to be coddled, they're going to be protected, and that's all it takes."

This was all done with the approval of both parties in Congress, even as some Dems are now beginning to regret giving no-string attached approval to Donald Trump's Treasury Dept./Federal Reserve money cannon. "When you defer to the Fed as your main policy-making engine in the country, you're going to get disproportionate responses, because the Fed deals with banks and they deal with large corporations. And that's who is going to get the relief. Not the average person on the street."

"When ordinary people, 40 million strong, have to go on to the unemployment lines, they get limited, temporary relief that will probably go away very soon, and they struggle to obtain food and figure out how to maintain their shelter," Dayen explains. "The problem is not that large companies got a bailout from something that wasn't of their own making --- the coronavirus crisis --- the problem is that there's one system for elite investors and large corporations and one system for everybody else."

How long can this last? Dayen discusses that as well, as states and municipalities around the country are themselves facing massive revenue shortages and fiscal year budget deadlines by July 1 in many cases. Without Congress enacting another relief bill for those states and municipalities, critical local services will soon be slashed. Cops, firefighters, teachers, and even medical workers will be laid off amid the continuing global pandemic, gutting revenue to those states even further. Democrats in the House have already passed a $3 trillion bill to help out state and local governments. Republicans in the Senate, however, have said they are in no rush to take any further action for now.

We also discuss the unimaginable politicization of this pandemic, where even the idea that measures to keep Americans alive has now become a political hot potato just five months before the crucial November elections.

That unimaginable politicization is now on full display in Pennsylvania, where a Republican state lawmaker disclosed on Wednesday that he had tested positive for the coronavirus. While he had known for at least ten days, he told only his Republican colleagues in the House. Democrats were left in the dark, even as GOPers in the gerrymandered House demanded in-person committee hearings where Dems were unknowingly put in contact with colleagues who had been in contact with the infected Rep and didn't even bother to wear masks during hearings demanding the reopening of businesses in the state. One Democratic Representative from Philadelphia unleashed a tirade during a Facebook Live video Wednesday night (which we share on today's show), calling on the GOP Speaker of the House to resign and for the state Attorney General to consider prosecution of those members who endangered the others along with their families. All of which underscores, yet again, the importance of the upcoming election and the reckoning that should come with it.

To that end, we've got some good news out of the state of Wisconsin (for a change), where the bi-partisan state Election Commission voted unanimously on Wednesday to send absentee ballot applications to all of the Badger State's 2.7 million registered voters before the November election. That, in hopes of avoiding the nightmarish consequences of the state's April 7th primary when GOP state lawmakers refused to agree to the Democratic Governor's attempt to postpone the election or extend absentee balloting to keep residents safe during the crisis. So, will Donald Trump threaten to cut off funding to WI as he did last week when Michigan announced their intention to also sent absentee ballot applications to all registered voters? Stay tuned.

On today's BradCast: We start and finish today with some good news. Everything else inside that sandwich may be a different matter. [Audio link to full show is posted below.]

First up, a federal judge has ordered the New York State Board of Elections to reinstate all candidates to the ballot who have not asked to be removed for the state's June 23 Democratic Presidential primary. The order is in response to a lawsuit filed by former candidate Andrew Yang following the state Board's effective cancellation of the primary --- ostensibly to lower polling place turnout to make it safer voters. The move last week angered the Bernie Sanders campaign, his supporters and, yes, Yang. That seemingly good news for voters is tempered by the fact that the NY Board says they plan to appeal the decision.

In less good news today, the coronavirus infection and death rate in Texas has --- completely predictably --- spiked with thousands of new cases after Republican Gov. Greg Abbott lifted restrictions in the Lone Star State last week for businesses. Even more disturbingly, Abbott knew that it would happen, but did it anyway. An audio recording of a private phone conversation of Abbott speaking to other lawmakers released on Tuesday appears to contradict the Governor's public statements about what would happen after the state reopened all businesses.

Our guest today, The American Prospect's Executive Editor and investigative financial journalist DAVID DAYEN is not happy with public officials who are standing by while the nation is prematurely reopened for business, even as the COVID-19 infection and death rate continues to increase --- not decrease --- across the country. "Anyone working in the federal government on pandemic response right now who doesn't want to be known historically as a mass murderer should probably resign," he recently wrote in one of his must-read daily "Unsanitized" columns.

Dayen speaks to that ("The administration has pretty clearly signaled they are done with pandemic response. They're over it. ... This is a prescription for tens of thousands of people unnecessarily dying. And we should be really clear about that."); the disastrous roll-out of the federal government's Paycheck Protection Program (PPP), meant to provide short-term relief to small businesses; the far smoother roll-outs of big bailouts for huge corporations; how the federal coronavirus financial relief response compares to the programs implemented in response to the 2008 mortgage crisis and Great Recession (about which Dayen wrote an award-winning book); and his scoop today regarding the U.S. Postal Service.

As we've discussed on the show previously, the USPS is in trouble, thanks to the crash in postal deliveries with so many businesses shut down. The Post Office does not receive any tax-payer dollars. It runs solely on the postage it sells as it delivers to every address in the nation, six days a week. It is also responsible for delivering absentee ballots in all 50 states amid the ongoing global pandemic and will be crucial to our ability to hold something that resembles a legitimate Presidential election this November. But now the Service has said they may have to stop operating entirely as early as June without an infusion of cash.

Republicans in Congress and Donald Trump in the White House have refused, so far, to provide a bailout to the Postal Service as they have for thousands of other private companies. But Congress did approve a $10 billion extension of credit for the USPS, to allow them to borrow more money to weather the crisis. However, the Treasury Department is holding up the increase in the USPS credit limit in hopes of forcing a bunch of conditions on them first.

"The Treasury Department, which offers that line of credit, has signaled that they will use that to make major policy changes," Dayen explains. "In other words, you want that $10 billion? You're going to have to pay the Piper. You're going to have to bust your unions, you're going to have to get some give backs on pay and benefits. You're going to have to do what we want in terms of package delivery. Specifically, making sure Amazon pays through the nose --- this is the thing Donald Trump is obsessed with, because he hates Jeff Bezos --- and you're going to have to institute a bunch of policy changes and give us some decision-making authority on personnel, including the Postmaster General. And that's just to get the loan. ... It's really an imposition into the authority of the Postal Service, which is an independent entity that is self-sufficient."

With that explained, Dayen's scoop today is that the Administration's strong-arming appears to be working. That insight is based on the recently revealed resignation from the USPS Board of Governors by David C. Williams, the former longtime Inspector General and the Democratic appointee to the Board. A longtime champion of the Postal Service (and its return to postal banking --- which could, on its own, save the Service, as we also discuss), Williams' departure, Dayen reports, is a very bad sign that the Republican appointees who control the Board are on the precipice of winning this battle.

What it may mean for the near future of the USPS and its union workers is ominous. All of this is made even worse because Democrats have now given away much, if not all, of their negotiating leverage in Congress to include a bailout for the USPS by kicking the can down the road in earlier emergency relief bills, even as Republicans got just about everything they wanted already in those measures. All and all, this will not be good for the American people in a multitude of ways.

Finally, we close with some slightly better news as promised. According to a new poll in Montana, the state's very popular Democratic Governor Steve Bullock is up by 6 points (46% to 39%) at the moment in his U.S. Senate race against the Montana's GOP incumbent Sen. Steve Daines. A once-longshot win for Democrats in the U.S. Senate, flipping a seat in Montana this year would go a long way towards flipping control of the upper chamber of Congress from red to blue this November. The state which went for Trump by more than 20 points in 2016 (on the same statewide ballot where Bullock won reelection the same year) is also now trending toward Biden, as the same poll from Montana State University finds Trump with only a 5 point lead (45% to 40%) over the former Vice President right now. Of course, it's only May. But we'll take our encouraging news where ever we can find it these days...

On today's BradCast: We start with good news for Democrats and Joe Biden before moving to the bad for Nancy Pelosi and her puzzling pick for a key oversight panel and seemingly terrible negotiation skills on emergency relief bills. [Link to full audio of today's show is posted below.]

On Wednesday, moments after we got off air yesterday, Donald Trump tossed his sorry pal Brian Kemp, Georgia's dumb-as-dirt and illegitimate Governor, under the bus, by pretending that he "disagreed strongly" with and felt it was "too soon" for Kemp's scheme to re-open nail salons, barber shops, tattoo and massage parlors and more in the Peach State as of Friday. That, even though Trump had reportedly called Kemp the day before to congratulate him on the move. At the same time, he was condescendingly tweeting about how much he cares about the old people who will be killed when Republican Governors across the country begun re-opening their states against the advice of health experts.

Trump's latest reversal is likely for good reason. One, the top health officials on his coronavirus task force pretty much insisted that he condemn Kemp's deadly decision and two, older voters --- a key part of his base --- appear to be abandoning Trump in droves thanks to his terrible response to the virus. New polling from Trump's favorite source, Fox "News", now shows Joe Biden beating Trump by 8 points in both Michigan and Pennsylvania, two states that are crucial to Trump's hopes of being re-elected. The Democratic Governors of both states, according to Fox, are very popular while Trump is decidedly not. In both states, large majorities of voters strongly support current stay-at-home restrictions, even if it continues to damage the economy.

The information in those polls amounts to the good news today for Dems. Then we turn to the mess that House Speaker Nancy Pelosi seems to be creating in D.C., while members are back in their districts and she is left to negotiate new relief bills, largely by herself with Mitch McConnell in the Senate.

DAVID DAYEN, Executive Editor of The American Prospect and author of the upcoming book, Monopolized: Life in the Age of Corporate Power, joins us again today to catch us up on just some of the very important scoops he has been churning out each day in his daily, must-read "Unsanitized" report at The Prospect.

He has been causing a lot of problems for Pelosi of late, after exposing her embarrassingly poor pick for the four-person Congressional oversight board created by the CARES Act to oversee trillions of dollars of corporate bailouts and giveaways in the bill. Each of the Democratic and Republican leaders in the House and Senate get to pick one member each for the panel. Freshman oversight bulldog Rep. Katie Porter (CA) --- who would be perfect for the job --- had made clear she was hoping to get it. Nonetheless, Pelosi selected her friend, freshman Rep. Donna Shalala (FL), who has absolutely no experience in financial oversight. Worse, much worse, as Dayen first revealed last weekend, Shalala, who previously served as Bill Clinton's Health and Human Services Secretary and CEO of The Clinton Foundation, had mountains of conflicts due to stock investments in dozens of companies whose bailout funds she was being asked to oversee.

The story gets even worse, however, as Shalala first claimed she had sold most (if not all) of those stocks, before Dayen found that, if she had, she failed to publicly report those transactions as mandated by the federal STOCK Act, as her office had previously tried to claim she had. After another day or so of this fact-pummeling by Dayen at The Prospect --- eventually picked up by the corporate media --- Shalala was forced to admit that she, in fact, failed to file those mandatory disclosures. She apologized, claiming she had failed to understand the requirements of the Act, despite it being incredibly simple --- unlike the task of overseeing trillions of dollars in loans and grants by the Treasury Department and Federal Reserve, as required by the oversight panel on which she is now seated.

"How is Donna Shalala going to be in a hearing with the Federal Reserve, asking them about the rules and procedures of the corporate bailout, when she couldn't follow the most simple, basic step required of her as a member of Congress?," Dayen wonders.

Not a promising sign, even as Dayen reports that Shalala continues to have large holdings in a health care company that would also be subject to oversight by her panel. "The one stock she did not sell was in United Health, the health insurance company that she was on the board of for several years. She still holds that now. So she is a walking conflict of interest even in her normal duties in Congress," he tells me.

Nonetheless, nearly a week into Dayen's coverage, after a belated apology from Shalala for her violations of federal law, Pelosi continues to stand by her poor selection. Why? Well, Dayen discusses that and much more on today's show (including the much better selection of former Elizabeth Warren protege, Bharat Ramamurti, by Senate Minority Leader Chuck Schumer for the same panel.)

We also discuss what is --- and, more disturbingly, is NOT! --- in the nearly $500 billion bailout bill passed by the House on Thursday, after largely being crafted by Mitch McConnell in the Senate as Dems continue to give away pretty much all of the leverage they may have had for a list of things Dayen argues they should have fought for, including: "State and local government funding...Payroll support along the lines of just having the government operate these payrolls rather than having people laid off...Money for the Postal Service, which is about to go under...Health insurance expansion for the duration of the crisis...Rent relief...foreclosure relief...Nor did they guarantee Vote-By-Mail for every American during the November election."

It's a very lively and troubling conversation, with lots of stuff --- maddening, amusing and informative --- including why Congress has failed to adopt some way of remote voting so that they can somehow continue to carry on the people's business, even during the need for physical distancing.
