Rightwing activists and propagandists James O'Keefe and Hannah Giles, employees of con-artist and propagandist Andrew Breitbart, may not use the First Amendment as an excuse for breaking the law in California, according to a federal judge's ruling this week.

Judge M. James Lorenz rejected the defendants' argument and motion for summary judgment in federal court, as part of the civil lawsuit filed against them by former San Diego ACORN worker Juan Carlos Vera.

Giles had previously thrown O'Keefe under a bus by arguing that she should not be held accountable at all for violating California's Invasion of Privacy Act [CA Penal Code § 632], since he, not she, was actually wearing the hidden video camera used to secretly tape their conversations with Vera, even after they had asked if their meeting would be kept confidential.

For his part, O'Keefe, a convicted federal criminal, argued that he was allowed to violate the law because the U.S. Constitution's First Amendment protected him as a "journalist". The judge ruled against the defendants on all points...

The nation has seen more than 1,000 tornadoes so far this year. In Alabama and elsewhere on April 27, there were some 290 deaths when twisters ripped through Tuscaloosa. Nearly 125 are now dead in Joplin, MO, with some 1,500 still missing, and at least 5 are dead in Oklahoma tonight as the result of still more deadly tornadoes in the past few hours. There have been other deaths from this outbreak as well, as far north as Minneapolis this week, making 2011's death toll from tornadoes, to date, the worst since 1953, (long before the advanced weather forecasting and warning systems we now have in place.)

[Update 11:44pm PT: And this just in, the National Weather Service reports tonight that Denning, Arkansas, a town with 100 homes in Franklin County, has been destroyed. "Spotters reported that this large tornado was up to a mile wide at one point just before it struck Denning."]

A link between climate change and Joplin tornadoes? Never!

Caution: It is vitally important not to make connections. When you see pictures of rubble like this week's shots from Joplin, Mo., you should not wonder: Is this somehow related to the tornado outbreak three weeks ago in Tuscaloosa, Ala., or the enormous outbreak a couple of weeks before that (which, together, comprised the most active April for tornadoes in U.S. history). No, that doesn't mean a thing.

It is far better to think of these as isolated, unpredictable, discrete events. It is not advisable to try to connect them in your mind with, say, the fires burning across Texas "” fires that have burned more of America at this point this year than any wildfires have in previous years. Texas, and adjoining parts of Oklahoma and New Mexico, are drier than they've ever been "” the drought is worse than that of the Dust Bowl. But do not wonder if they're somehow connected.

If you did wonder, you see, you would also have to wonder about whether this year's record snowfalls and rainfalls across the Midwest "” resulting in record flooding along the Mississippi "” could somehow be related. And then you might find your thoughts wandering to, oh, global warming, and to the fact that climatologists have been predicting for years that as we flood the atmosphere with carbon we will also start both drying and flooding the planet, since warm air holds more water vapor than cold air...

For weeks, we've been reporting on the mess seen in the statewide "recount" of Wisconsin's very close and very contentious April 5th Supreme Court election between Republican incumbent Justice David Prosser and his challenger, Asst. Attorney General JoAnne Kloppenburg.

As The BRAD BLOG obtained evidence of new irregularities this week --- to add to previously reported revelations of, among other irregularities, ballot bags discovered "wide open" with mismatched or missing serial numbers as well as ballots discovered completely unsecured, all in violation of the secure chain of custody, and other similar messes and mistallies across the state --- we wanted to find out if the state's chief election agency, the Government Accountability Board (G.A.B.), was able to confirm that the ballots counted during the "recount" were actually the ones cast on Election Day. And, if so, how they could confirm that.

To date, with about 25,000 "recounted" votes still to be canvassed from the now infamous Waukesha County, some 2,690 votes have been discovered during the "recount" to have been originally mistallied. That's according to the G.A.B.'s own figures, and includes hundreds of thousands of ballots which were simply re-tallied rather than counted by hand during the "recount," on the same computers which tallied them --- either correctly or incorrectly --- on Election Night.

31 out of the state's 72 counties counted some or most of their ballots by hand for the first time during the "recount" (including several of the largest counties). But, given the fact that supposedly "secured" ballot bags were discovered during the "recount" to have been "wide open" and not secured at all, with little or no explanation from officials, after being accessible for weeks by the same untrustworthy and partisan election officials, such as Waukesha's County's activist GOP County Clerk Kathy Nickolaus, who screwed up the tabulation in the first place, how is it that anybody knows if the ballots finally counted by human beings are actually genuine?

We've been trying, with no small amount of frustration, to get a definitive answer from the G.A.B. on that question for the past week, as well as from the campaigns of both candidates in the race.

The G.A.B. generally agrees with the campaign of the election's current leader, incumbent Justice David Prosser, that broken security seals, opened ballot bags --- even some that are torn open and taped back shut with duct tape, as seen in Waukesha County this week (photos below) --- and other violations of chain of custody are of little concern. So long as the newly tabulated results largely match the results printed on the poll tapes by the computer tabulators at the end of Election Night on April 5th, that is, essentially, close enough for government work.

The G.A.B. and the Prosser campaign, as we confirmed with each directly, and as the G.A.B. indicated on a recent post to their website published in the wake of the specific questions we've been asking them --- are placing their faith largely in the accuracy of the state's oft-failed, easily-manipulated, privately-manufactured electronic voting systems made by companies like Diebold, ES&S, and Sequoia. They are also placing faith in their election official colleagues around the state.

All of which begs the question: What's the point of having a "recount," or of using security procedures and physical seals for the ballots after the election, if violations of those procedures and seals are of little concern to the state's top election agency?

Worse, if the results printed on the poll tapes are the ultimate proof of the accuracy of results, what happens when --- as discovered among poll tapes from the City of Pewaukee in Waukesha County late last week --- the "recount" uncovers "Official Results Report" poll tapes dated a full seven days before the actual election was held?

Or, worse still, what happens when poll tapes failed to print at all on Election Day, as has been seen in a number of towns across the state?...

Narrow margin, 10,000 still-to-be-tallied absentee ballots to test L.A. County's Bowen-approved op-scan system, again

Yesterday, California's Republican-supported Prop 14 --- which voters approved last June, changing the state's separate party primary system to a single primary for all candidates, with the top two vote-getters going on to a run-off election if none receives more than 50% of the vote --- had its first official try-out in the Special Election to replace the resigning Blue Dog Democrat and unrepentant war supporter Rep. Jane Harman in the state's 36th Congressional District.

While similarly "Blue Dog" Democratic candidate and L.A. City Councilwoman Janice Hahn was in the lead last night as results were reported throughout the evening, it was the battle for second place, and therefore the right to participate in the run-off, that presented a real late-night nail-biter twist as unofficial precinct results were completed in the wee hours.

With Democratic CA Sec. of State Debra Bowen running second and seemingly headed for the run-off with Hahn for most of the night, according to L.A. County's running totals, the final unverified results inched self-financed Republican Craig Huey into the second place spot by just 206 votes at evening's end, after all 261 precincts in the very Democratic-leaning CA-36 were tallied.

With nearly 10,000 mail-in, provisional and other votes still to be tallied on the county's optical-scan system, however --- a system which was decertified and then conditionally re-certified, in part, by Bowen herself in 2008 --- the result of the cliff-hanger is likely to ensure "busy days ahead" at the L.A. County Registrar Recorder/County Clerk's office as Dean Logan, L.A. County's Registrar Recorder/County Clerk, noted last night on his personal Twitter account...

Paper ignores wide-spread irregularities, mistallies, massive chain of custody violations discovered in state's Supreme Court race...

We have been working, over the past week --- digging into details, speaking with election officials --- on a new article we hope to publish soon on the "recount" of the April 5th Wisconsin Supreme Court election between the Republican incumbent Justice David Prosser and his independent challenger Asst. Attorney General JoAnne Kloppenburg.

If all continues apace, the article will follow up with details on still more disturbing new "irregularities" discovered recently during the continuing count in Waukesha County and elsewhere across the state, following on our earlier reports of wide-spread irregularities such as"wide open" ballots bags in Waukesha and elsewhere, ballots discovered unsecured on the desk of a city clerk, and inaccurate counting in Milwaukee. In all, the unavoidable fact we continue to see is that, thanks to Wisconsin's woeful election procedures, pathetic chain of custody requirements, and horrible secret vote-tabulation computers, nobody can know for certain whether thousands of ballots being counted today are the ones actually cast by voters on Election Day.

Taking all that we've learned into account, one might even conclude: This is no way to run an election. But more on that soon.

In the meantime, in her first official public statement since her April 20 press conference announcing her intention to ask for a "recount" and a special investigation of Waukesha County Clerk Kathy Nickolaus, Kloppenburg speaks out today in an op/ed response to an embarrassingly obnoxious unbylined editorial by the Milwaukee Journal Sentinel's editorial board published last week.

The Journal Sentinel's three paragraph, anti-democratic (small "d") pot-shot last week --- which may as well have been written by the campaign of Justice Prosser, criminally-inclined candidate whom the paper endorsed (even as they failed to disclose that point in their editorial) --- was riddled with evidence-free assertions, and mocked the very idea of a "recount" as a "waste of time," on the grounds that they believe "nothing will change in the election for state Supreme Court."

The paper failed, sadly, to note that more than 2,600 votes have, so far, been discovered as originally mistallied by the state's woeful computerized tabulation systems (and that's with hand counts performed in only 31 of the state's 72 counties) and the inability to confirm, thanks to the blatant violations of chain of custody, that thousands of votes being counted are actually the same as those originally cast.

Kloppenburg's op/ed details some of the "irregularities" being found, but ignored by the Journal Sentinel's editorial board, this way...

And a word about Ensign's scofflaw replacement Sen. Dean Heller...

We don't usually offer much space here to sex scandals, unless, in some cases, they demonstrate, for example, blatantly offensive hypocrisy in regard to everyone else's civil rights (talking to you, disgraced former Sen. Larry Craig (R-ID)) --- or, as in the case of disgraced now-former Sen. John Ensign (R-NV), charges of blatant criminality.

The details out of the bi-partisan, unanimously approved 68-page report released late yesterday by the U.S. Senate Ethics Committee --- which usually does absolutely nothing --- referring the Ensign case to the Dept. of Justice and the FEC for criminal prosecution are stunning, and much worse than previously understood.

In their letter to the DoJ [PDF] the Committee's Chair and Vice-Chair, Senators Barbara Boxer (D-CA) and Sen. Johnny Isakson (R-GA) respectively, refer the matter...

[S]howing that Senator Ensign and others:

  • aided and abetted violations of the one-year post-employment contact restriction,
  • conspired to violate that restriction,
  • made false statements to the Federal Election Commission,
  • violated campaign finance laws, and
  • obstructed the Committee's preliminary inquiry.

But even that damning summary of wrong-doing fails to adequately describe the offensive squalor at the heart of this mess, as you'll see below.

Moreover, another reason worth mentioning the whole scandal here: there may be at least one scofflaw still on the loose in regards this matter, still serving in the U.S. Senate --- namely, Sen. Tom Coburn (R-OK), one of the very few involved in this extraordinarily ugly, sad and shameful scandal to have, so far, gotten off largely scot-free despite his apparent role in attempting to cover it all up for his friend Ensign.

Finally, there is still one more reason to mention all of this: to highlight the fact that Ensign has now been replaced in the U.S. Senate by the scofflaw, and lying, former NV Secretary of State Dean Heller. Be sure to read on below for details on him and how he too has been allowed to avoid accountability for years despite having, in 2004, illegally certified the 100% unverifiable e-voting systems now used across the state of Nevada (and also used to elect him to the U.S. House of Representatives in 2006.)

Rachel Maddow did a fine job of summarizing the remarkable Senate Ethics Committee report on Ensign on Thursday night, so we'll happily allow her to do so again below, as we're buried in several other stories ourselves at the moment...

In light of the new admission by the Tokyo Electric Power Co. (TEPCO) that at least one reactor at its Fukushima Daiichi nuclear plant in Japan appears to have experienced a meltdown of its radioactive fuel core, comes this report from the New York Times yesterday...

Despite repeated assurances that American nuclear plants are better equipped to deal with natural disasters than their counterparts in Japan, regulators said Thursday that recent inspections had found serious problems with some emergency equipment that would have made it unusable in an accident.

The briefing was part of a review requested by the commissioners to evaluate the vulnerability of American reactors to severe natural disasters like the ones that hit the Japanese plant in March.

Marty Virgilio, the deputy executive director of the agency, told the five commissioners that inspectors checked a sample of equipment at all 104 reactors and found problems at less than a third of them. The problems included pumps that would not start or, if they did, did not put out the required amount of water; equipment that was supposed to be set aside for emergencies but was being used in other parts of the plants; emergency equipment that would be needed in case of flood stored in places that could be flooded; and insufficient diesel on hand to run backup systems.

The two-hour briefing given to the five-member commission was an early assessment, 30 days into a 90-day review being conducted by an N.R.C. task force.

[Massachusetts' Democratic Congressman Ed] Markey pointed out that in the last eight years, the commission had received 69 reports of inoperable diesel generators at 33 plants, with six of those generators out for more than a month. The diesels provide power for water pumps that allow removal of "decay heat," the heat that fuel generates even after a reactor shuts down. The Fukushima plants shut down successfully but decay heat wrecked their cores.

Radiation said leaking from holes in bottom of container vessel...

From BNO News tonight:

The Tokyo Electric Power Co. (Tepco), which operates the troubled Fukushima nuclear plant, on Thursday admitted that a nuclear meltdown occurred at the plant.

With the nuclear meltdown, Tepco said the nuclear fuel rods in the reactor are completely exposed, as large amounts of radiation are being released. The water level at the plant's No. 1 reactor was much lower than thought - as much as 5 meters (16.4 feet) below the nuclear rods - and clearly not high enough to cover the nuclear fuel.

According to reports, several holes were found at the bottom of the nuclear reactor's pressure vessel, where the melted nuclear fuel now threatens to leak out.

On a daily basis, Tepco injects almost 200 tons of water into the pressure vessel, but it is highly likely that the water has been constantly leaking from the vessel and containment chamber, eventually flowing under the reactor building.

Reuters' report on the admission by TEPCO notes that the disclosure "is the latest indication that the disaster was worse than previously disclosed, making it more difficult to stabilize the plant."

They go on to report that "U.S. nuclear experts said that the company may have to build a concrete wall around the unit because of the breach, and that this could now take years."

NHK World adds:

The company believes the melted fuel has cooled down, judging from the reactor's surface temperature.

But it suspects the meltdown created a hole or holes in the bottom of the reactor causing water to leak into the containment vessel.

It also suspects the water is leaking into the reactor building.

UPDATE 5/13/11: We should make clear that the "meltdown" in question did not just happen yesterday. Rather, it appears to have occured in March after the quake and tsunami, but is only now being admitted to by TEPCO --- just in case that point was not clear from the initial reports above, as some have suggested in comments. Here are a few additional details now from the Wall Street Journal's coverage...

On last Sunday's news shows, former Bush administration officials outnumbered Dems 3 to 1 to comment on bin Laden story...

In early 2006, Media Matters released an special report called "If It's Sunday, It's Conservative: an Analysis of the Sunday talk show guests on ABC, CBS, and NBC, 1997 - 2005," which thoroughly debunked the ridiculous "Liberal Media" charge by empirically demonstrating the imbalance of Rightwing guests (politicians, pundits and journalists) dominating the Sunday morning network news shows in almost all of those years. They found, for example, that "In every year examined by the study --- 1997 - 2005 --- more panels tilted right (a greater number of Republicans/conservatives than Democrats/progressives) than tilted left. In some years, there were two, three, or even four times as many right-titled panels as left-tilted panels."

The excuse the networks offered in response was, essentially, that there was a Republican administration in the White House and Republican majorities in Congress for most of those years, so, naturally, there would be more Republican guests. And also, we were "at war." Or something.

One year later, Media Matters followed up with "If It's Sunday, It's Still Conservative: How the Right Continues to Dominate the Sunday Talk Shows," a follow-up "analysis of more than 2,000 guest appearances on the Sunday Talk shows in 2005 and 2006." Unsurprisingly, they found that while there was marginal improvement since their previous report, little had changed the Rightwing tilt of the Sunday news shows, even after the Democratic takeover of both houses of Congress in November of 2006. The media excuses, again, were pathetic.

And now, in response to the news that the Democratic President Obama's Democratic administration killed Osama bin Laden the week before, there was this on this week's Sunday news shows...


If it's Sunday, it's still Republicans --- over both our public airwaves, as well as cable news --- and the myth of a "Liberal Media" remains as mythical as ever.

It is now officially impossible to know whether thousands of paper ballots being counted in the state of Wisconsin's Supreme Court election "recount" are the same ones actually cast on Election Day. It didn't have to be that way, unlike in Kentucky, where the voters never had a chance, and where high-ranking election officials have now been sentenced to more than 150 years in federal jail following "decades" of manipulated elections.

Thanks to serious chain of custody violations in Wisconsin --- such as ballot bags discovered to have been left "wide open" and unsealed in Waukesha County, and ballots left completely unsecured for weeks in the office of the Verona City Clerk in Dane County --- that now make it quite likely the real winner of the April 5th election for a 10-year term on the bench of that state's highest court will never be known for certain. That, even though thousands of votes have now been verified as having been miscounted during the state's partial hand-count, and even as the hotly-contested seat in question will determine the ideological balance of the court during one of the most contentious moments in Badger State history.

The majority of voters in Wisconsin cast their votes on hand-marked paper ballots. However, due to a failure to count those ballots publicly on Election Night, at the precinct, in front of the public (as per "Democracy's Gold Standard"), citizens are left guessing and forced to place misguided trust in partisan election officials like GOP activist and Waukesha County Clerk Kathy Nickolaus and her unsecure chain of custody and election reporting procedures.

With results that will never be known for certain, the razor-thin contest has now become a fully "faith-based election," in contradiction to the checks and balances necessary for true self-governance.

But where Wisconsin could have had an overseeable and fully verifiable election in which voters might have had confidence, voters in Kentucky, for years, never even had a chance as they were forced to vote on 100% unverifiable touch-screen voting machines.

The good-ish news? That is changing, as much of the Bluegrass State is finally turning to the use of hand-marked paper ballots, though they plan on tallying them similarly to Wisconsin, via oft-failed, easily-manipulated optical-scan systems manufactured by private vendors, rather than counting them transparently in front of the public.

Given Kentucky's recent history, that's a particularly troubling prospect, as underscored by several developments in two different counties in the state of late.

In 2009, a spate of high-ranking election officials in Clay County, KY --- including the County Clerk, a Circuit Court Judge, the School Superintendent, a former Magistrate, and several polling place officials --- were arrested in a massive vote buying/selling and electronic vote-machine rigging conspiracy which netted the criminals millions of dollars over the past decade. The federal charges included the County Clerk and other members of the Board of Elections having intentionally falsified election reports to include inaccurate voting results when submitted to the state.

One Republican election official pleaded guilty after the arrest two years ago, and the other eight were found guilty and convicted last year in federal court. They were sentenced this past March to a total of more than 1,871 months in federal prison.

And last week, in a separate, newly developing case, state officials impounded electronic voting machines in Perry County, KY, after Republican candidates in last November's election complained of "vote rigging" on the county's 100% unverifiable electronic voting machines...

At the end of the "New Rules" segment on HBO's Real Time With Bill Maher last night, Maher called out Republicans for being "neither fiscally conservative nor strong on defense," adding "they have to tell us what exactly it is they're good at."

"How many Muslims does a black guy have to kill in one weekend before crackers climb down off his ass?" Maher asked, before offering a flashing "FACTS" light at the bottom of the screen so Fox "News" viewers would know to keep the sound turned down until it disappeared. He then went on to call out the GOP for, among other things, implementing policies over the past decade that revealed them to be anything but fiscally responsible.

"When Bill Clinton left office in 2001," Maher said, "the Congressional Budget Office predicted that by the end of the decade, we would have paid off the deficit and have a 2 trillion dollar surplus. Instead, we have a 10 trillion dollar public debt, and the difference in those two numbers is mostly because the Republicans put tax cuts for the rich, free drugs for the elderly, and two wars on the layaway plan and then bailed on the check."

Maher then criticized George W. Bush's failure to capture or kill Osama bin Laden, after his admission that he "didn't spend that much time on Osama, [and] that he was no longer concerned about him, just as he wasn't before 9/11 when he blew off that mysterious, inscrutable memo entitled 'Bin Laden Determined to Attack Inside the U.S.'"

"Why focus on the terrorists who reduced Wall Street to rubble, when you can help Wall Street reduce the whole country to rubble?" the satirist asked rhetorically.

Near the end of his "New Rule," after eviscerating Republicans such as Bush for his "War on Terror" strategy, and Sen. John McCain for being "naive" in his criticism of Obama's promise to focus on bin Laden during the 2008 Presidential election, Maher went on to declare President Obama "one efficient, steely-nerved, multitasking, black ninja gangsta President." It's been a very busy start to the 8th year here at The BRAD BLOG. So busy, in fact, that we've been able to do almost no fundraising at all, despite our desperate need to do so.

If you've gotten anything from our coverage this year --- from our month-long, round-the-clock detailed coverage of the Fukushima nuclear disaster, to our coverage of Wisconsin and other electoral disasters, outrages and political scoundrels, to our twice weekly Green News Reports --- I hope you'll consider tossing a little (or big) something in our very empty tip jar.

Over the past year alone, we've learned The BRAD BLOG has been long-buried by a cowardly Rightwing cabal at Digg and Reddit, censored by AOL, and, most disturbingly, targeted as part of a $12 million smear, disinfo, fraud, forgery, spy plot by the insidious U.S. Chamber of Commerce which has made its way all the way to the U.S. Congress. So, um, I guess we're doing something right.

Chain of custody violations continue to emerge, particularly in Waukesha, during state Supreme Court election 'recount'
ALSO: $25,000 reward offered for evidence of WI election tampering...

Five out of six bags of ballots from first batch to be counted out of the City of Brookfield in Waukesha County, WI, today were discovered "almost wide open" during Day 9 of the statewide Supreme Court election "recount." The bags were open and unsealed, according to both photographic evidence and an eye-witnesses account from the counting room. (Many more exclusive photos posted below.)

"When the ballot bags were taken out and placed upon the counting table, we were literally stunned," one of the citizen observers, Mary Magnuson, a Kloppenburg volunteer, told The BRAD BLOG this morning. "5 out of the 6 ballot bags were almost literally wide open, and ballots could be clearly seen."

The ballots in those bags were among the 14,000 said to have been cast in the April 5th election, but left off of Waukesha County's tally as reported to the media on Election Night.

Earlier this week we offered a detailed report on the status of the statewide "recount," highlighting a host of disturbing and outright violations of the chain of custody of ballots, including unnumbered and renumbered ballots bags (many of them from Waukesha County); ballots discovered unsecured and/or left out of the original count all together; and exceedingly sloppy record-keeping and reporting of "recount" results by the state's chief election agency, the Wisconsin Government Accountability Board (G.A.B.). In sum, we described the state of the "recount" of the contested election between Republican incumbent Justice David Prosser and his independent challenger Asst. AG JoAnne Kloppenburg, as "a mess."

Today, after the newest revelations from the Waukesha County counting room, it got a lot messier.

"We are finding significant anomalies, including chain of custody and missing ballots, that we need to shine light on," Kloppenburg campaign manager Melissa Mulliken told The BRAD BLOG earlier this week, while we were working on our previous story. The anomalies she was referring to, given where today's unsecured ballots are said to come from, have gotten much more "significant" in the past few hours...
