Po', po' Diebold. Being unAmerican pays well only up to a point, we guess, as the company's stock once again begins to tumble today after a key analyst cuts his rating for the once-great "security" company, citing "possible legislative concerns in the company's voting machines business."

And even as the company continues to misrepresent its products, on its own website, via knowing lies (otherwise known as fraud).

After the voting machine company's spectacular failure over the weekend at the GOP Straw Poll in Iowa --- where anywhere from 10.5% to 32% of the ballots had to be counted by hand after Diebold's machines failed --- it's little surprise that things are coming apart for the company again. The question, however, is how much farther it still has to go and what the hell the company can possibly do about it at this point.

"Investors could increasingly sour on the stock if Diebold does not try to sell the unit," reports Forbes this afternoon as the stock fell some 4.5% to $47.60 today on heavy trading, after falling at least that much since a high near $54 last Thursday.

Good luck selling that clunker of a division, boys. Liabilities much?

The company, which is already under investigation by the SEC, as we reported exactly one year ago today, reportedly for misstatements of revenue concerning its voting machine business, might face even more difficulties once its investors come to fully understand the depth of the fraud which the company seems to still be perpetuating.

Here's just one fresh example of the company's continuing lies, as found on the Diebold Election Systems, Inc., FAQ page on its own website today.

The company claims, incorrectly, that its touch-screen voting systems "insure ballot anonymity" by scrambling "the order of cast ballots"...

That is, of course, a complete and utter lie. At least according to the computer scientists at University of California who studied the matter in CA SoS Debra Bowen's recent "Top-to-Bottom Review" and found precisely the opposite to be true...

Buried in a newly published profile in the Wall St. Journal comes word that Karl Rove is resigning as head of the White House political office effective August 31.

As to the timing of his departure, Rove offers a bit of his signature plausible implausibility. He says his decision now was prompted by a demand from White House chief of staff Josh Bolten that staffers who stay on past the summer break must commit to serving Bush through the end of his term. That may sound reasonable on the surface but in fact the idea that Bolten could tell Rove when to come and go is not credible.

Whatever his excuse, Rove's departure will increase speculation that investigators are closing in him over his role in the illegal firing of U.S. attorneys for political purposes, vote caging schemes by the Bush-Cheney 2004 campaign, which he directed, or other as-yet unrevealed activities.

HD Net has announced the content of this Tuesday's "Dan Rather Reports": An hour-long investigative special report dedicated to the failures of touch-screen voting and the companies that make them. Horribly. Here's a piece of their recent media release, and a video preview is posted below...

This is on HD Net so not everyone is going to be able to see it live but there will surely be copies on-line a day or two after the episode airs, if not sooner.

In the startling preview clip (posted below) notice that the only test performed on the ES&S iVotronic Direct Recording Electronic (DRE) touch-screen voting machines by the people who manufacture the machines in the Philippines is a "shake test" to ensure there were no loose pieces left in the machines. These people who make $2.10 to $2.50 a day and work in what amounts to a sweat shop where cats, rats, and snakes were removed from the basement by the truckload.

And the American who was dispatched to deal with problems at the factory back in 2001 admits that the touch-screens failed and "bubbled" as far back as then. But what has been done about it since?

The machines made by ES&S may not have any screws loose, but the folks who think this is any way to run a democracy certainly do!

That was then, this is now, we suppose.

Dick Cheney, in 1994 (see short video at right), said "we got it right" by deciding not to invade Iraq after the liberation of Kuwait in '91, since "for the 146 Americans killed in action, and for their families --- it wasn't a cheap war."

"[I]n an effort to get Saddam Hussein, [the question for the President] was how many additional dead Americans is Saddam worth?" Cheney is seen answering the question at the time: "Our judgment was, not very many, and I think we got it right."

Apparently, the worth of Saddam has increased since '94, to at least 4,000 dead Americans and still counting.

But, as we said, that was then, and this is now. So flip-floppery doesn't matter, even though he predicted back then that "if we'd gone to Baghdad we would have been all alone. There wouldn't have been anybody else with us...It's a quagmire if you go that far and try to take over Iraq."

Smart guy. He should have listened to him.

As we reported on July 15, Ron Paul's supporters were concerned that Diebold touch-screen voting machines were going to be used in the Iowa Republican Straw Poll. Well, it turns out the concerns about touch-screens were misplaced, as the GOP chose paper-based Diebold optical-scan machines instead. But their fears of Diebold may well have been justified as two of their op-scan systems failed and delayed the reported results.

While GOP candidate Mitt Romney may have walked away with a winning edge in the Iowa Straw Poll, Diebold was true to form as their voting system failed to count ballots correctly. As the Des Moines Register is reporting two of Diebold's optical scanners failed and 1500 paper ballots had to be manually recounted by hand...

At least there were paper ballots that could be hand counted when the machines failed. Had the Republican's used Direct Recording Electronic (DRE) voting machines --- as millions of Americans are forced to do each Election Day --- there would have been nothing to go back to when the machines failed.

UPDATE: The Atlantic is reporting the number of ballots which had to be "re-run" as "about 4,500".

Either way, there were reportedly 14,203 total ballots cast. So going by the Des Moines Register's reported numbers, more than 10.5% of the ballots had to be recounted. If we go by The Atlantic's reported numbers, nearly 32% of the ballots in the Iowa Republican Straw Poll had to be recounted by hand.

On July 27, the Florida State University Security and Assurance in Information Technology Laboratory (SAIT) issued a report on the results of a review of the source code for the Diebold voting system that was in the state of Florida certification process. This report was commissioned by the Secretary of State, Kurt Browning.

On July 31, Browning sent a letter to Diebold to tell them that the system would not be certified as it was presented to the state and that the company had until August 17 to fix the problems or the certification process would be stopped. Included in that letter were three pages of required software repairs.

On August 10, Browning sent a congratulatory letter to Diebold to let them know all of the code fixes were successfully inspected by the SAIT Lab. and the state and that the Diebold optical-scan system and AutoMark were to be certified for use by the state.

That's less than two weeks from report of numerous problems to repairs to the source code to reinspection to issuance of certification.

How did this happen so fast?

UPDATE August 12 It appears that the changes that were made to the code had already been made in a newer version of the code that is in the federal testing process. The Independent Test Authority sent that code to Florida State and that is what was inspected and passed. I am being told that the report by the SAIT will be published early in the week.

Looks like the Republican National Committee is getting a particularly early start in their attempts to steal next year's election. And from the looks of Paul Kiel's report on the deceptive RNC letter sent to a life-long Democratic voter in the Show Me State, once again Missouri may be ground zero in 2008.

All of which is swell, because we happen to be in Missouri this week, and plan to speak to folks in St. Louis next Thursday at an event sponsored by Missourians for Honest Elections (yes, there still are a few, including MO SoS Robin Carnahan, whose office contacted us to chat a bit yesterday upon seeing we'd be in town). We'll be causing trouble in Thor Hearne Country, firing up the troops, and taking questions, after a showing of Dorothy Fadiman's superb documentary Stealing America: Vote by Vote (which we're told is being submitted for Academy Award nomination).

See Kiel's story for the details on the GOP's latest efforts to game democracy and fool voters, instead of impressing them with actual ideas and policy, as that's what this quick item was meant to be about. In a late comment posted just this morning, in reply to the article and photos about my recent visit to Diebold in Texas, a person claiming to be an employee of one of Diebold's New England distributors believes I am "totally full of shit"...

I don't know Mr. Hajjar, nor his company, LHS Associates, and don't have much time again today, as I'm still on the road, to look into them, but I'll presume both are legitimate entities and he is the one who posted the above comment. Hajjar, according to LHS's website, appears to be their "Director of Sales and Marketing," so it's little wonder he's a bit deluded about the products his company represents and upon which his livelihood depends. It makes sense that he might be a tad paranoid about what may come in the wake of recent devastating findings out of California concerning Diebold and their shitty, hackable voting systems, as far as his continuing ability to make a living off them courtesy of the tax-payer teat.

Nonetheless, I am happy to reply to a point or two of his silly, ill-conceived screed, along with gladly accepting his invitation to debate these particular issues publicly...

Once again, in a world of horrible reporting and irresponsible journalists (Media Matters rounds up a bunch of them here) willing to pass on discredited, unevidenced sour grapes from Election Officials and Voting Machine Company spokesliars, it's syndicated columnist Tom Elias who cuts through the crap and tells the truth about those "loser" Officials.

Elias also validates the fine choice we made in the only official candidate endorsement at The BRAD BLOG.

Last night Congressman Dennis Kucinich was one of two guests on the Election Integrity radio program, "Voice of the Voters," which airs weekly at 8PM Eastern on WNJC Radio 1360AM and streams live.

The subject was voting machines, the vendors, and the voters, and Kucinich raised the possibility that the recent studies done on such systems in California might be the basis of a lawsuit to throw out "that technology." He said felt that legal action, in this instance, may be a faster route than waiting on Congress to act.

He also discussed his concerns about the use of Direct Recording Electronic (DRE, usually touch-screen) voting machines in general, and expressed his feeling that they do not allow for confidence by the electorate. "There is a question of validity of an election. People have to know their vote counts and is counted," he told host Mary Ann Gould, "People cannot be guaranteed that with the present DRE system."

Marcy Winograd, former Democratic candidate for the U.S. House and President of the Progressive Democrats of Los Angeles (PDLA), sent the following e-mail missive to PDLA members earlier today describing a meeting on Tuesday with Rep. Henry Waxman (D-CA), the chairman of the House Oversight Committee.

The conversation regarding Impeachment, the Congressman's views on same, and the arguments made by the activists in favor of it are interesting and offer some insight into both Waxman's thinking at this moment and, undoubtedly, that of many other House Democrats who clearly are seeing things differently from inside the Beltway than those of us outside of it.

We can only hope that all U.S. House and Senate members are getting such an earful now that they're on recess and back in their home districts. Here's Winograd's instructive report in full...

Waxman Says He Will Keep an Open Mind on Impeachment

Congressman Waxman, Chair of the House Oversight Committee, told an impeachment
delegation meeting with him in his Los Angeles office, Tues., Aug. 7, 2007, that he would mull over his constituents' articulate arguments, watch the Bill Moyers' interview on impeachment, and weigh whether there was sufficient evidence to, not just impeach, but convict Bush and Cheney. Waxman told the delegation it was not enough to believe Bush and Cheney were responsible for high crimes; his decision to support or co-sponsor an impeachment resolution must be predicated on the knowledge that there is overwhelming evidence for a conviction.

Progressive Democrats of Los Angeles, California's 41st Assembly District Delegates, the Los Angeles National Impeachment Center, and the LA Green Party participated in the office delegation, while a group of impeachment supporters rallied outside, holding Impeachment is Patriotic signs and a huge banner that read Impeachment is on Our Table.

The impact of California SoS Debra Bowen's "Top-to-Bottom Review" is beginning to be felt, tangibly, in other states across the country.

One such state is Kentucky, where this morning a press release was issued by the state's Attorney General Gregory D. Stumbo demanding that electronic voting machine manufacturers immediately correct security flaws identified in the independent reviews by experts in California.

In terse letters sent to voting machine companies Diebold and Hart Intercivic (letters posted in full below), Stumbo demanded that the companies "immediately implement in Kentucky all modifications and security upgrades necessary to correct the vulnerabilities identified by California."

Meanwhile Kentucky's "do-nothing" Secretary of State, Trey Grayson publicly criticized Attorney General Stumbo's statements to which Stumbo retorted:

"By November 2008, every voter would be given a verifiable paper ballot," Congressman Rush Holt (D-NJ) lies to Steven Rosenfeld at AlterNet today concerning his flawed Election Reform Bill (HR811) which is still pending in Congress.

Despite the comments to Rosenfeld, Holt's legislation does not require a "paper ballot" --- no matter how many times he tries to put lipstick on that pig.

The state of California recently found the very voting systems Holt is pushing to see used across the entire nation to be easily hackable and not in compliance with federal requirements for disabilities voters. The state also found the "paper trail" that Holt's bill is to require for such systems, and which California already uses, cannot stop the tampering with votes found to be so easy on such systems.

Despite CA SoS Debra Bowen having decertified and severely restricted the use of Direct Recording Electronic (DRE, usually touch-screen) voting machines with so-called "Voter Verified Paper Audit Trails" (VVPATs) last Friday --- as the Holt bill would allow for use --- and despite her having found that such paper trails do not protect voters and do not even meet minimal disabled accessibility standards, Holt continues apace to push his paper trail bill.

California's unprecedented independent study and actions "just adds more weight, more urgency to the need to pass federal standards," Holt told Rosenfeld concerning Bowen's appropriate decision to restrict the use of the systems. "We can't go into another federal election with machines that do no allow voters to verify their votes," he said --- despite the fact that his legislation does exactly that.

While Holt continues his disappointing campaign to deceive voters, media, and Congress Members into believing that "paper trails" are actually paper ballots, America seems to be moving on without him for the time being. In addition to the new restrictions in California, the use of DREs was recently banned entirely in Florida and New Mexico, and other states are re-evaluating their use of such systems.

HR 811's most powerful proponent/advocacy-group inside the beltway, People for the American Way (PFAW), is on record as preferring non-verifiable DRE voting systems over real paper ballots. They'd both do well to reconsider their positions, and adopt the voters' desire for paper ballots --- ones which are actually counted --- and a full ban on DREs.

Mr. Holt: Your deceptive misuse of the words "paper ballots" is a dog which no longer hunts. Please stop it.

[DISCLOSURE: I was asked to work with Holt's office on the language in HR 811 prior to its introduction in the U.S. House. Though I strongly urged they ban the use of DRE systems, that particular recommendation was not taken. I was, however, told that if I could convince PFAW to accept such a ban, they'd adjust their legislation immediately. So far, that has yet to happen. PFAW can be reached at PFAW@PFAW.org.]
